RECOGNITION OF DISABILITY PENSION. PRE-EXISTING DISABILITY DOES NOT BAR THE RIGHT TO A PENSION IF IT WORSENS OVER TIME. EFFECTIVE AS OF THE DATE OF THE FORENSIC MEDICAL REPORT. The plaintiff requested that the Caja Costarricense de Seguro Social grant him a disability pension (pensión por invalidez), since due to his health condition (polio sequela, tendon rupture in the left shoulder, and other medical conditions) he could no longer work. The Labor Court (Juzgado de Trabajo) ruled in favor of the plaintiff, ordering that the Caja must grant the disability pension. The latter appealed, arguing that the plaintiff's polio sequelae should not be considered for the pension, since the Reglamento de Invalidez, Vejez y Muerte establishes that a disability pension can only be granted if the condition manifests after enrollment in the pension system. It also criticized that the lower court did not adequately consider the report of the Comisión Calificadora del Estado de Invalidez, which had determined that the plaintiff was not in a condition of disability to receive the pension. El actor solicitó que la Caja Costarricense de Seguro Social le reconociera una pensión por invalidez, ya que debido a su estado de salud (secuela de poliomielitis, ruptura de tendones en el hombro izquierdo y otras condiciones médicas) no podía seguir trabajando. El Juzgado de Trabajo resolvió a favor del demandante, estableciendo que la Caja debía reconocer la pensión por invalidez.
