throughout the entire text - Full Text of Regulation 012 Prohibits fishing within the Hule, Bosque Alegre, and Congo lagoons, as well as in the other bodies of water that form part of the Bosque Alegre Mixed National Wildlife Refuge NATIONAL SYSTEM OF CONSERVATION AREAS Resolution No. SINAC-ACAHN-DR-R-012-2022.—National System of Conservation Areas.—Arenal Huetar Norte Conservation Area, Regional Directorate.

1. 1That, in accordance with Article 22 of the Biodiversity Law No. 7788 of May 27, 1998, the National System of Conservation Areas, hereinafter SINAC, was created, with its own legal personality, as a decentralized and participatory institutional management and coordination system, which integrates competencies in forestry, wildlife, and protected areas, in order to issue policies, plan, and execute processes aimed at achieving sustainability in the management of the natural resources of Costa Rica.
2. 2That, it is a priority policy of SINAC to facilitate and promote actions that lead to the protection, conservation, and sustainable management of the natural resources and biodiversity present in the Protected Wilderness Areas, hereinafter the ASP, of the Conservation Areas.
3. 3That, in accordance with Article 8 of Executive Decree No. 40054-MINAE of December 21, 2016, the Arenal Huetar Norte Conservation Area (subsection X), hereinafter ACAHN, is part of the organization and has the competencies of SINAC in their respective territories.
4. 4That, the administration and protection of the ASP throughout the entire national territory is the competence of SINAC through each Conservation Area.
5. 1That, the Bosque Alegre National Wildlife Refuge, of mixed ownership, hereinafter Bosque Alegre Refuge, was created through Executive Decree No. 22847-MIRENEM of January 19, 1994, for the purpose of protecting the Hule and Congo lagoons, which constitute a lacustrine wetland that harbors a great diversity of native wild flora and fauna, plus the protection of the aquifer recharge area that harbors said protected wilderness area.
6. 2That, the National Council of Conservation Areas (CONAC) firmly approved the General Management Plan for the RNMVSBA, by means of resolution R-SINAC-CONAC-112-2017; which was prepared by the Central Conservation Area at the time, given that the Refuge belonged to the boundaries of said AC during that period.
7. 3That, Executive Decree No. 36515-MINAET established in its Article 25 the prohibition of fishing within the Hule Lagoon, located in the Bosque Alegre Refuge, which is currently
8. 4That, Executive Decree No. 32633, Regulation to the Wildlife Conservation Law for Fishing and National Wildlife Refuges, which maintains some of its articles in force, establishes in its section 151 that MINAE, through SINAC, may authorize, within the boundaries of Mixed Ownership Refuges and Private Property Refuges, in accordance with the principles of sustainable development set forth in management plans, activities of public or social interest and any other activity that SINAC considers pertinent, compatible with the policies of Conservation and sustainable development.
9. 5That, the Fishing and Aquaculture Law No. 8436, in its section 9, establishes that the exercise of fishing activity in the continental and insular parts, in forest reserves, protective zones, national wildlife refuges, and wetlands, shall be restricted in accordance with the management plans determined for each zone by the Ministry of Environment and Energy.
10. 6That, the General Management Plan for the Bosque Alegre Refuge does not establish the possibility, nor the prohibition, of carrying out the fishing activity within the lagoons and other bodies of water that form part of this ASP.
11. 7That, no technical-scientific studies are known with information demonstrating the feasibility or infeasibility of allowing the fishing activity within the lagoons and other bodies of water that form part of the Bosque Alegre Refuge.
12. 8That, even though there is no positive criterion to authorize fishing within the Bosque Alegre Refuge, it is known that people from the neighboring community and visitors carry out fishing activity indiscriminately in the lagoons of the ASP, for which the impact or effect that this activity may be causing to the fish populations that inhabit these ecosystems is unknown.
13. 9That, given the lack of sufficient scientific knowledge regarding a potential impact and effect on biodiversity, it is advisable to apply principles 1 and 2 of the Biodiversity Law No. 7788:

text-align:justify'>"1.-Preventive criterion: it is recognized that it is of vital importance to anticipate, prevent, and attack the causes of biodiversity loss or its threats.

2.-Precautionary criterion or in dubio pro natura: when there is danger or threat of serious or imminent damage to the elements of biodiversity and the knowledge associated with them, the absence of scientific certainty shall not be used as a reason to postpone the adoption of effective protection measures." 10.—That, based on the legal opinion of the Legal Advisory Office of the Arenal Huetar Norte Conservation Area, SINAC-ACAHN-AJ-14-2022, which recommends prohibiting fishing within the Lagoons found within the Bosque Alegre Refuge, until such time as the technical and scientific studies that validate the possibility of carrying out the fishing activity are available, with the necessary restrictions for the protection of the existing ecosystems. 1. 1Que, de conformidad con el artículo 22 de la Ley de Biodiversidad número 7788 del 27 de mayo de 1998, se crea el Sistema Nacional de Áreas de Conservación, en adelante SINAC, con personería jurídica propia, como un sistema de gestión y coordinación institucional, desconcentrado y participativo, que integra las competencias en materia forestal, vida silvestre y áreas protegidas, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica.
2. 2Que, es política prioritaria del SINAC facilitar y promover acciones que conlleven a la protección, conservación y manejo sostenible de los recursos naturales y la biodiversidad presentes en las Áreas Silvestres Protegidas, en adelante las ASP, de las Áreas de Conservación.
3. 3Que, de conformidad con el artículo 8 del Decreto Ejecutivo N° 40054-MINAE del 21 de diciembre del 2016, el Área de Conservación Arenal Huetar Norte (inciso X) en adelante ACAHN, es parte de la organización y con las competencias del SINAC en sus territorios respectivamente.
4. 4Que, es competencia del SINAC a través de cada Área de Conservación, la administración y protección de las ASP a lo largo de todo el territorio nacional.
5. 1Que, el Refugio Nacional de Vida Silvestre Bosque Alegre, de propiedad mixta, en adelante Refugio Bosque Alegre, fue creado mediante Decreto Ejecutivo N° 22847-MIRENEM del 19 de enero de 1994, con el fin de proteger las lagunas Hule y Congo, las cuales constituyen un humedal lacustrino que alberga gran diversidad de flora y fauna silvestre autóctonas, más la protección del área de recarga acuífera que alberga dicha área silvestre protegida.
6. 2Que, el Consejo Nacional de Áreas de Conservación (CONAC) aprobó en firme el Plan General de Manejo del RNMVSBA, mediante resolución R-SINAC-CONAC-112-2017; el cual fue elaborado por el Área de Conservación Central en su momento, siendo que el Refugio pertenecía a los límites de dicha AC para ese entonces.
7. 3Que, el decreto ejecutivo N° 36515-MINAET, establecía en su artículo 25 la prohibición de pescar dentro de la Laguna del Hule, ubicada en el Refugio Bosque Alegre, el cual actualmente se encuentra vencido.
8. 4Que, el decreto ejecutivo N° 32633 Reglamento a Ley de Conservación de la Vida Silvestre para Pesca y Refugios Nacionales de Vida Silvestre, el cual mantiene algunos de sus artículos vigentes, establece en su numeral 151 que El MINAE a través del SINAC, podrá autorizar dentro de los límites de los Refugios de Propiedad Mixta y Refugios de Propiedad Privada, de conformidad con los principios de desarrollo sostenible planteados en los planes de manejo, actividades de interés público o social y cualquier otra actividad que el SINAC considere pertinente compatibles con las políticas de Conservación y desarrollo sustentable.
9. 5Que, Ley de Pesca y Acuicultura N° 8436 en su numeral 9, establece que el ejercicio de la actividad pesquera en la parte continental e insular, en las reservas forestales, zonas protectoras, refugios nacionales de vida silvestre y humedales, estará restringido de conformidad con los planes de manejo, que determine para cada zona el Ministerio de Ambiente y Energía.
10. 6Que, el Plan General de Manejo para el Refugio Bosque Alegre, no establece la posibilidad, ni la prohibición de que se realice la actividad de pesca dentro de las lagunas y demás cuerpos de agua que forman parte de esta ASP.
11. 7Que, no se conocen estudios técnicos-científicos con información que demuestren viabilidad o inviabilidad de permitir la actividad pesquera dentro de las lagunas y demás cuerpos de agua que forman parte del Refugio Bosque Alegre.
12. 8Que, a pesar de que no existe criterio positivo para autorizar la pesca dentro del Refugio Bosque Alegre, se conoce que personas aledañas a la comunidad y visitantes, realizan la actividad pesquera indiscriminadamente en las lagunas del ASP, para lo cual se desconoce el impacto o afectación que esta actividad pueda estar ocasionando a las poblaciones de peces que habitan en estos ecosistemas.
13. 9Que, al no haber suficiente conocimiento científico ante un potencial impacto y afectación a la biodiversidad, conviene aplicarse los principios 1 y 2 de la Ley de Biodiversidad N° 7788:

text-align:justify'>"1.-Criterio preventivo: se reconoce que es de vital importancia anticipar, prevenir y atacar las causas de la pérdida de la biodiversidad o sus amenazas.

2.-Criterio precautorio o indubio pro natura: cuando exista peligro o amenaza de daños graves o inminentes a los elementos de la biodiversidad y al conocimiento asociado con estos, la ausencia de certeza científica no deberá utilizarse como razón para postergar la adopción de medidas eficaces de protección".

10.-Que, con base en el criterio jurídico de la Asesoría Legal del Área de Conservación Arenal Huetar norte, SINAC-ACAHN-AJ-14-2022, el cual recomienda prohibir la pesca dentro de las Lagunas que se encuentran dentro del Refugio Bosque Alegre, hasta tanto se tengan los estudios técnicos y científicos que validen la posibilidad de que se realice la actividad pesquera, con las restricciones necesarias para el resguardo de los ecosistemas existentes. Por tanto, LA DIRECCIÓN DEL ÁREA DE CONSERVACIÓN ARENAL HUETAR NORTE,
