Use permits (permisos de uso) will be granted directly to applicants, who must process personally or through a proxy and of Maritime Terrestrial Zone, for which they must submit the application with clear handwriting on the use permit application form (formulario de solicitud de permiso de uso) that will be available on the Municipality's website or on the Platform of Services, where they will indicate the purposes they have for the parcel they request.
The form and the respective documentation must be submitted at the Platform of Services of the Municipality of Nicoya. The administered party, upon presenting their application, will identify themselves by presenting their identity card in case of doing so personally. In the event that they cannot appear personally or in the case of a legal entity, the signature of the applicant or the legal representative appearing on the application must be authenticated by a lawyer.
For the processing of the application for the use permit (permiso de uso), as well as during its validity, in case of being approved, the administered party will be obliged to keep an updated place for receiving notifications.
The applicant for a Use Permit (Permiso de Uso) in the Maritime Terrestrial Zone must submit the following documents:
- a)General qualifications of the applicant with their exact address, location of the requested property, and current means of notification.
- b)Original and photocopy of the physical identity card or legal entity certification with no more than one month since issuance.
- c)In the case of foreign persons, present a suitable document proving their legal residence in the country.
- d)Original and photocopy of a cadastral plan of the requested area or sketch prepared by a professional in the field, of the area over which the use permit (permiso de uso) is requested and a detailed description of the existing construction in the place.
- e)Certification of legal entity status, share capital, and its distribution in the case of legal entities.
- f)Sworn declaration stating that they do not have any prohibition based on article 4 of these regulations.
- g)(Deleted by ordinary session No. 166 of July 4, 2023) h) Being up to date with the payment of Municipal services and taxes.
Once the documentation is complete, the Department of ZMT will form the respective file (expediente), duly foliated and numbered, and will attach the respective legal technical report on the use permit application (solicitud de permiso de uso). Said department will send it to the ZMT Commission of the Municipal Council for its analysis and recommendation, which will have a period of two calendar months to render a discretionary criterion on the opportunity and convenience of the granting or rejection of the permit, a period that may be extended for an equal period by a prior considered resolution. This commission will send the file (expediente) with its commission opinion to the full council so that it definitively decides whether to approve or disapprove the granting of the use permit (permiso de uso).
Once approved by the Municipal Council and the Mayor's Office notified thereof, it must proceed with the preparation of the corresponding administrative resolution, subsequently communicate what was agreed to the administered party, at the indicated fax, electronic mail, or place indicated. The notification receipt will be attached to the formed file (expediente), which will be kept in the department of ZMT.
