in the entirety of the text - Complete Text of Norm 075 Amendment to the Regulation for the granting of use permits in the maritime terrestrial zone of the canton of Nicoya MUNICIPALITY OF NICOYA AMENDMENT TO ARTICLE 11 OF THE REGULATION FOR THE GRANTING OF USE PERMITS IN THE MARITIME TERRESTRIAL ZONE OF THE CANTON OF NICOYA.
In accordance with the provisions of articles 11, 169 and 170 of the Political Constitution, 11 and 13 of the General Law of Public Administration, 13 subsections c) and ñ), and 43 second paragraph of the Municipal Code, the Municipal Council of Nicoya, through Municipal Agreement N° 020-054-2025, of Ordinary Session N° 054 held on Tuesday, May 13, 2025, agreed to issue the "DRAFT AMENDMENT TO ARTICLE 11 OF THE REGULATION FOR THE GRANTING OF USE PERMITS IN THE MARITIME TERRESTRIAL ZONE OF THE CANTON OF NICOYA", for its non-binding public consultation for a period of 10 business days counted from the business day following its publication, and having received comments which were duly addressed by the Municipal Council after its publication, the Collegiate Body, in Municipal Agreement N° 014-075-2025 of Ordinary Session N° 075 held on Tuesday, October 7, 2025, approves its publication for the second time for formalization before the Municipal Corporation as: "AMENDMENT TO ARTICLE 11 OF THE REGULATION FOR THE GRANTING OF USE PERMITS IN THE MARITIME TERRESTRIAL ZONE OF THE CANTON OF NICOYA".
In accordance with the provisions of Article 43 of the Municipal Code, it is submitted for publication in La Gaceta for its entry into force, which states the following:
AMENDMENT TO ARTICLE 11 OF THE REGULATION FOR THE GRANTING OF USE PERMITS IN THE MARITIME TERRESTRIAL ZONE OF THE CANTON OF NICOYA.
"Article 11.-Term of the use permit. The use permits shall be granted for a term of five years, which shall be renewable for equal terms, and the renewals granted must not exceed 15 years in total. At the request of the interested party, it may remain in force until the coastal regulatory plan (plan regulador costero) of the respective area is approved." De conformidad con lo establecido en los artículos 11, 169 y 170 de la Constitución Política, 11 y 13 de la Ley General de la Administración Pública, 13 incisos c) y ñ), y 43 párrafo segundo del Código Municipal, el Concejo Municipal de Nicoya mediante Acuerdo Municipal N° 020-054-2025, de la Sesión Ordinaria N° 054 celebrada el martes 13 de mayo del 2025, acordó emitir el "PROYECTO DE REFORMA AL ARTÍCULO 11 DEL REGLAMENTO PARA EL OTORGAMIENTO DE PERMISOS DE USO EN ZONA MARÍTIMO TERRESTRE DEL CANTÓN DE NICOYA", para su consulta pública no vinculante por el plazo de 10 días hábiles contados a partir del día hábil siguiente posterior a su publicación, y habiéndose presentado observaciones las cuales fueron debidamente atendidas por el Concejo Municipal posterior a su publicación, el Órgano Colegiado en Acuerdo Municipal N° 014-075-2025 de la Sesión Ordinaria N° 075 celebrada el martes 07 de octubre del 2025, aprueba realizar su publicación por segunda vez para la oficialización ante la Corporación Municipal como: "REFORMA AL ARTÍCULO 11 DEL REGLAMENTO PARA EL OTORGAMIENTO DE PERMISOS DE USO EN ZONA MARÍTIMO TERRESTRE DEL CANTÓN DE NICOYA".
De conformidad con lo dispuesto en el Artículo 43 del Código Municipal, se somete a publicar en La Gaceta para su entrada en vigencia, que indica lo siguiente:
REFORMA AL ARTÍCULO 11 DEL REGLAMENTO PARA EL OTORGAMIENTO DE PERMISOS DE USO EN ZONA MARÍTIMO TERRESTRE DEL CANTÓN DE NICOYA.
"Artículo 11.-Vigencia del permiso de uso. Los permisos de uso se otorgarán por un plazo de cinco años, el cual será prorrogable por plazos iguales y las prórrogas que se otorguen no deben superar los 15 años en total.
