in the entirety of the text - Complete Text Norm 166 Reform Regulation for the granting of use permits in the maritime terrestrial zone of the canton of Nicoya MUNICIPALITY OF NICOYA REFORM TO THE REGULATION FOR THE GRANTING OF USE PERMITS IN THE MARITIME TERRESTRIAL ZONE OF THE CANTON OF NICOYA In accordance with the provisions of articles 169 of the Political Constitution, 11 of the General Law of Public Administration, 13 subsection c), and 43 second paragraph of the Municipal Code, the Municipal Council of Nicoya, through Municipal Agreement No. 040-135-2022 of Ordinary Session No. 135 held on Tuesday, November 29, 2022, agreed to issue a "DRAFT REFORM TO THE REGULATION FOR THE GRANTING OF USE PERMITS IN THE MARITIME TERRESTRIAL ZONE OF THE CANTON OF NICOYA" for non-binding public consultation for a period of 10 business days counted from the business day following its publication, and no observations having been submitted to the Municipal Council regarding this matter after its publication, the Collegiate Body, in Municipal Agreement No. 006-166-2023 of Ordinary Session No. 166 held on Tuesday, July 4, 2023, approves its publication a second time for formalization before the Municipal Corporation as the "REFORM TO THE REGULATION FOR THE GRANTING OF USE PERMITS IN THE MARITIME TERRESTRIAL ZONE OF THE CANTON OF NICOYA." Municipal Agreement No. 040-135-2022: The Municipal Council of Nicoya unanimously accepts the recommendation provided on matter 3 of opinion dcaj-05-11-2022 of the commission on legal affairs, regarding official communication ZMT- 0089-2022 sent by the department of the maritime terrestrial zone concerning the reform proposal to the regulation for the granting of use permits in the maritime terrestrial zone of the canton of Nicoya. Therefore, The Municipal Council of Nicoya unanimously approves the reform proposal for article 22 of the Regulation for the Granting of Use Permits in the Maritime Terrestrial Zone of the Canton of Nicoya, deleting its subsection "g) request for verification of the state's natural heritage," considering that it constitutes a municipal verification requirement. likewise, in accordance with the provisions of article 43 of the Municipal Code, this Draft Reform is submitted for Non-binding Public Consultation in the Official Gazette La Gaceta, for a period of ten business days, counted from the business day following its publication, with observations to be submitted to the office of the Municipal Council Secretariat located in La Casa de la Cultura or to the email address concemunicipal@ municoya.go.cr.

en la totalidad del texto - Texto Completo Norma 166 Reforma Reglamento para el otorgamiento de permisos de uso en la zona marítimo terrestre del cantón de Nicoya MUNICIPALIDAD DE NICOYA REFORMA AL REGLAMENTO PARA EL OTORGAMIENTO DE PERMISOS DE USO EN ZONA MARÍTIMO TERRESTRE DEL CANTÓN DE NICOYA De conformidad con lo establecido en los artículos 169 la Constitución Política, 11 de la Ley General de la Administración Pública, 13 inciso c), y 43 párrafo segundo del Código Municipal, el Concejo Municipal de Nicoya mediante Acuerdo Municipal N° 040-135-2022 de la Sesión Ordinaria No. 135 celebrada el martes 29 de noviembre del 2022, acordó emitir "PROYECTO DE REFORMA AL REGLAMENTO PARA EL OTORGAMIENTO DE PERMISOS DE USO EN ZONA MARÍTIMO TERRESTRE DEL CANTÓN DE NICOYA" para su consulta pública no vinculante por el plazo de 10 días hábiles contados a partir del día hábil siguiente posterior a su publicación, y no habiéndose presentado al Concejo Municipal observaciones al respecto posterior a su publicación, el Órgano Colegiado en Acuerdo Municipal N° 006-166-2023 de la Sesión Ordinaria N° 166 celebrada el martes 04 de julio del 2023, aprueba realizar su publicación por segunda vez para la oficialización ante la Corporación Municipal como "REFORMA AL REGLAMENTO PARA EL OTORGAMIENTO DE PERMISOS DE USO EN ZONA MARÍTIMO TERRESTRE DEL CANTÓN DE NICOYA".
De conformidad con lo dispuesto en el Artículo 43 del Código Municipal, se somete a publicar en La Gaceta para su entrada en vigencia, que indica lo siguiente:
Acuerdo Municipal N° 040-135-2022: El Concejo Municipal de Nicoya en forma unánime acoge la recomendación brindada sobre el asunto 3 del dictamen dcaj-05-11-2022 de la comisión de asuntos jurídicos, referente al oficio ZMT- 0089-2022 remitido por el departamento de la zona marítimo terrestre sobre propuesta de reforma al reglamento para el otorgamiento de permisos de uso en la zona marítimo terrestre del cantón de Nicoya. Por tanto, El Concejo Municipal de Nicoya en forma unánime aprueba la propuesta de reforma del artículo 22 del Reglamento para el Otorgamiento de Permisos de Uso en la Zona Marítimo Terrestre del Cantón de Nicoya, suprimiendo su inciso "g) solicitud de verificación de patrimonio natural del estado", al considerar que constituye un requerimiento de constatación municipal. asimismo, de conformidad con lo dispuesto en el artículo 43 del Código Municipal, se somete el presente Proyecto de Reforma a Consulta Pública no Vinculante en el Diario Oficial La Gaceta, por el plazo de diez días hábiles, contados a partir del día hábil siguiente posterior a su publicación, debiéndose presentar las observaciones ante la oficina de Secretaría Del Concejo Municipal ubicada en La Casa de la Cultura o al correo electrónico concemunicipal@ municoya.go.cr.
