Regulation for the Integrated Management of Solid Waste of the Canton of Garabito
General Provisions
Chapter 1
The purpose of this regulation is to comprehensively regulate the management of waste generated in the canton of Garabito, responsibilities established through Law 8839 for Integrated Waste Management and its regulation. This regulation applies to every waste generator (ente generador) in the canton of Garabito, except those regulated by special legislation.
The objectives of this regulation are:
For purposes of interpretation of this regulation, the following definitions and abbreviations are established:
It is the result of a planning process that is preferably elaborated in a participatory manner by the municipality incorporating the various actors of the canton.
aa) Separation: procedure through which waste is prevented from the generating source (fuente generadora) from being mixed, to facilitate the use of valorizable materials and avoid their final disposal.
bb) Treatment: Transformation of waste or specific parts into new products or the change of characteristics, such as recycling, composting, mechanical-biological treatment, thermal treatment, among others.
dd) Valorization: set of associated actions whose objective is to recover the value of waste for production processes, the protection of health and the environment.
ee) Recycling: transformation of waste through different valorization processes that allow restoring its economic and energy value, thus avoiding its final disposal, provided that this restitution implies savings in energy and raw materials without harm for health and the environment.

In the case of commerce, industry and public and private institutions, these must be reported together with their Integrated Waste Management Program, approved by the competent institutions, to the Department of Patents. Waste treatment involves changes to the physical or chemical composition of the waste. This treatment is carried out in order to recover and valorize the waste, or to reduce its hazardousness and decrease its environmental impact.
The Municipality of Garabito shall be responsible, through its powers and in compliance with current legislation, for treating recyclable materials in such a way that they are separated and conditioned according to buyer requirements, making them suitable for valorization.
This shall be achieved through the location, sizing, and work organization at the site for each type of waste. Furthermore, it must verify the required technical and legal specifications, and ensure the participation of the community in this work.
The Municipality of Garabito shall be responsible, through its powers and in compliance with current legislation, for treating disposable waste. During the period of the first Plan de Gestión Integral de Residuos, this shall be carried out using the sanitary landfill technique.

The Municipal Finance Directorate must conduct the studies and analyses for updating the rates for municipal services associated with the Gestión Integral de Residuos, based on the requirements and inputs from the Department of Environmental Engineering.
Payment for the services associated with the Gestión Integral de Residuos shall be made through a waste generation fee (tasa de generación de residuos) for each generating entity. This is in accordance with Chapter 14, Weighting Factors.
For the implementation of this waste generation fee, the Municipality of Garabito shall annually conduct, update, or review the corresponding technical studies. These studies shall define generating entities, categories, generation rates, costs, investments, and the rate for each category, among others.
The Department of Urban Development shall incorporate into the construction permit process the tariff for the category that the property will occupy, from the moment of the permit application.
The inspection of the service category shall be incorporated into the municipal inspections and municipal police process, according to the procedure defined in the chapter on Weighting Factors,
The Cadastre Department shall biannually generate and update in the Municipal Geographic Information System the categories and payment status of the Gestión Integral de Residuos services for each registered property. This shall be done in order to identify delinquent lots and those for which no charge is being made, and to improve collection management, based on the information generated and transferred by the Departments of Urban Development, Real Estate, Licenses (Patentes), and Appraisals.

The residential rate applies to every housing unit where no license (patente) exists or is held, and where the estimated average waste generation is less than 73.4 kilograms per month. The residential rate is taken as weighting factor 1.

The Commercial 2 category includes activities that generate twice the amount of waste compared to Commercial 1. An indication of the representative economic activities for this category is provided.
The eleven aforementioned economic activities are covered under this category, since categorization depends on waste generation.
The Commercial 3 category includes activities that generate a greater amount of waste compared to Commercial 2. A list of five representative economic activities for this category is provided.

The Municipality of Garabito shall strengthen the rate model so that the charge is differentiated once the citizen has carried out preventive actions, and optimal handling, classification, segregation, storage, and collection of waste for each type of material.
Any generating entity that considers that the weighting factor being applied does not match the amount of waste it is generating must submit a formal request, meeting the following requirements, to the Department of Environmental Engineering:
³ High season: December 15 - January 15 and Holy Week.
⁴ Low season: Months of May, June, August, September, October, November.
a. The Department of Environmental Engineering reviews the documentation.
b. The Department of Environmental Engineering coordinates the inspection and data verification with the Department of Inspections and/or Municipal Police.
c. The Department of Environmental Engineering issues a criterion for approval or rejection of the request and proposes the corresponding category, based on the information provided by the Departments of Inspections and/or Municipal Police.
d. The Department of Urban Development, with the criterion of the Department of Environmental Engineering, may modify the waste category.
Chapter 15 Sanctions
The Municipality may suspend commercial licenses when it is repeatedly proven (more than 3 times) that they are violating the provisions of Chapters 3 through 11 of this regulation and Law 8839 for the Gestión Integral de Residuos, in accordance with Article 81 bis of the Municipal Code (Código Municipal).
The Municipality of Garabito, in accordance with Article 74 of the Municipal Code, shall impose surcharges on the amounts established in the collection and final disposal rates on generating entities that fail to comply with the duties defined in the previous chapters, as set forth below:
Sanctions shall be executed by the Municipality of Garabito upon identifying non-compliance with the duties established in the chapters of this regulation, and shall follow the procedure below:
a. Upon evidencing non-compliance with duties by generating entities, the municipal official proceeds to document the non-compliance through photographs, witnesses, videos, among others, and transfers it to the municipal official responsible for taking action.
b. The competent official shall proceed to issue an infraction ticket, which shall notify the alleged transgressor, granting a period of 5 days to exercise the right to defense and submit exculpatory evidence.
c. Once the aforementioned period has expired, the competent municipal official transfers the infraction tickets, with their corresponding administrative file (expediente administrativo), to the Department of Environmental Engineering, verifying whether the situation persists or whether the measure stated in the notification was taken.
d. The Department of Environmental Engineering continues processing the file, analyzing the reported facts and issuing the final resolution, either acquitting the alleged offender or imposing the sanction; if the transgression of the legal framework is confirmed, it must transfer the resolution to the Collections Department.
e. The Collections Department must add the surcharge to the system so that it is collected together with the municipal taxes on the property.
f. The property owner pays the surcharge with the quarterly or annual taxes, as applicable.
Repeals

The actions described in this regulation shall enter into force as of the date of its publication in the gazette, except for the application of Article 52, Article 55 items a, b, c, d, e, and Article 58, which shall have a transitional period of 2 years.

1. Que el artículo 50 de la Constitución Política reconoce el derecho de toda persona a gozar de un ambiente sano y ecológicamente equilibrado, así como el deber del Estado de garantizar, defender y preservar dicho derecho.
2. Que la protección ambiental es un elemento básico para el desarrollo sostenible y garantizar la calidad de vida a las futuras generaciones.
3. Que, en el cumplimiento de la prestación de servicios y competencias dadas a los Gobiernos Locales, las cuales están expresadas en la Constitución Política artículos 169 y 170 y el Código Municipal (Ley No.7794) la Municipalidad se encuentra en el deber de realizar la prestación de servicios municipales.
4. Que la Ley No.8839 sobre la gestión integral de los residuos confiere a las Municipalidades responsabilidades expresas sobre la implementación de la Gestión de Residuos a nivel local.
5. Que el cantón cuenta con el Plan Municipal de Gestión Integral de Residuos sólidos como instrumento para la planificación y ejecución de la reglamentación vigente en materia de residuos a nivel local.
6. Que la misión de este plan es velar por la protección del ambiente y salud humana por medio de la optimización de las actividades de generación, manejo, almacenamiento, recolección, transporte, tratamiento y disposición final de residuos en los sectores de la población, privado, público y gubernamental del cantón de Garabito. Por tanto, Dicta el siguiente:

Considerando
Capítulo 1
Disposiciones Generales
El presente reglamento tiene por objeto regular en forma integral la gestión de residuos que se generan en el cantón de Garabito, responsabilidades establecidas mediante la Ley 8839 para la Gestión Integral de Residuos y su reglamento. Este reglamento aplica para todo ente generador de residuos del cantón de Garabito, salvo aquellos regulados por legislación especial.
Son objetivos del presente reglamento:
Para efectos de interpretación del presente reglamento se establecen las siguientes definiciones y abreviaturas:
Es resultado de un proceso de planificación que se elabora de preferencia de forma participativa por la municipalidad incorporando los diversos actores del cantón.
aa) Separación: procedimiento mediante el cual se evita desde la fuente generadora que se mezclen los residuos, para facilitar el aprovechamiento de materiales valorizables y se evite su disposición final.
bb)Tratamiento: Transformación de los residuos o partes específicas a nuevos productos o al cambio de las características, como son el reciclaje, compostaje, tratamiento mecánico-biológico, tratamiento térmico, entre otros.
dd) Valorización: conjunto de acciones asociadas cuyo objetivo es recuperar el valor de los residuos para los procesos productivos, la protección de la salud y el ambiente.
ee) Reciclaje: transformación de los residuos por medio de distintos procesos de valorización que permiten restituir su valor económico y energético, evitando así su disposición final, siempre y cuando esta restitución implique un ahorro de energía y materias primas sin perjuicio para la salud y el ambiente.

Sin embargo, la Municipalidad puede otorgar derechos a terceros según sus requerimientos y formas legales.

En el caso de comercio, industria e instituciones público y privado deberán ser reportados en conjunto con su Programa de Manejo Integral de Residuos, aprobado por las instituciones competentes, al Departamento de Patentes. Esto deberá reportarse al solicitar, renovar, trasladar, modificar su patente o realizar solicitudes relacionadas a la Gestión Integral de Residuos. Finalmente, el Departamento de Patentes realizará su traslado al Departamento de Ingeniería Ambiental.
Adicionalmente contará con los tipos, cantidades y composiciones de los residuos generados.
Los colores para la identificación de estos serán azul para reciclable, anaranjado para ordinarios y verde para orgánicos. Si fuese requerida una clasificación adicional se utilizarán los colores y clasificación de la estrategia Nacional de Reciclaje Decreto Nº 36499-MINAET -S o vigente.

La corta y poda deberá ser de no más de 80cm de largo, reduciendo su volumen al máximo.
Idealmente los tamaños de los residuos no serán mayores a 8cm2 .
Eliminar restos de comida o líquidos, lavar y enjuagar, limpiar y secar previo a la segregación y acondicionarlos en pacas atadas con cuerda o mecate.

Adicionalmente deben de permitir el cierre adecuado de manera que si está cerrado no permita la entrada de agua, insectos o roedores ni el escape de líquidos. De acuerdo a legislación vigente.
Y eliminar otros recipientes de disposición final con el fin de fomentar la segregación de residuos.
Almacenamiento de residuos

Para los entes generadores donde el sitio de almacenamiento es igual al punto de recolección, en estos casos, el sitio de almacenamiento deberá estar ubicado de manera que sea factible realizar la recolección desde la calle pública sin ingresar a propiedad privada.
Para el caso del Cantón de Garabito este tiempo deberá ser mínimo 3 días para residuos desechables, 2 días para biodegradables y 6 días para reciclables. Los especiales dependerán de cada ente generador ya que es el responsable de su gestión integral.
Recolección de residuos

Este estará a cargo del Departamento de Ingeniería Ambiental, sub área de recolección de residuos.
De manera general residuos voluminosos que generen acumulación de agua y criaderos de vectores. En caso de ser requerido por el Ministerio de Salud y de acuerdo a la situación epidemiológica del cantón se podrán programar recolecciones extraordinarias en conjunto con instituciones y grupos organizados para recolecciones de este tipo.
Además, deberá planificar las rutas y horarios de recolección de manera que garantice el cumplimiento del servicio.
Esto será realizado por medio del área, responsables de comunicación o bien mediante la persona designada por el alcalde.
Adicionalmente debe de informar a su superior cualquier inconveniente o retraso que haya impedido brindar el servicio de acuerdo a lo establecido en el presente reglamento.

Tratamiento de residuos

El tratamiento de residuos responde a los cambios en la composición física o química de los residuos. Este tratamiento se realiza con el fin de recuperar los residuos y valorizarlos o bien con el fin de disminuir su peligrosidad, y reducir su impacto ambiental.
La Municipalidad de Garabito será la responsable, mediante las facultades y cumplimiento de la legislación vigente, de tratar los materiales reciclables de manera que sean separados y acondicionados de acuerdo a los requisitos de los compradores que los hagan aptos para su valorización.
Esto mediante la ubicación, el dimensionamiento y organización del trabajo en el sitio de cada uno de los tipos los residuos. Además, debe verificar las especificaciones técnicas y legales requeridas, y la participación de la sociedad en esta labor.
La Municipalidad de Garabito será la responsable, mediante las facultades y cumplimiento de la legislación vigente, de tratar los residuos desechables. Durante el período del primer Plan de Gestión Integral de Residuos esto será realizado mediante la técnica del relleno sanitario.

En estos se definirán entes generadores, categorías, tasas de generación, costos, inversiones, y tarifa para cada categoría entre otros.

El Departamento de Catastro, semestralmente, generará y actualizará en el Sistema de Información Geográfica Municipal las categorías y estado de pago de los servicios de Gestión Integral de Residuos de cada finca registrada. Esto se realizará con el fin de identificar los lotes morosos y los que no presentan cobro y mejorar la gestión de cobro. A partir de la información generada y trasladada por medio de los Departamentos de Desarrollo Urbano, Bienes Inmuebles, Patentes y Valoraciones

La tarifa residencial se toma como factor de ponderación1.
Estos se constituyen en lo que se pueden denominar kioscos o mini ventas de productos como celulares, artesanías y venta al detalle. Se asigna una ponderación equivalente a la mitad de lo que genera una vivienda (0,5).
Son cabinas sin equipar, se ofrece al huésped la cama, abanico con baño y en algunos lugares un televisor, por lo tanto no hay posibilidad de preparar alimentos.
Son cabinas equipadas, se ofrece al huésped una habitación que incluye un refrigerador y/o cocina.
Se presenta una indicación de las actividades económicas representativas de esta categoría.
Dentro de la categoría Comercial 2 se encuentran actividades que generan una cantidad dos veces mayor en comparación con la Comercial 1. Se presenta una indicación de las actividades económicas representativas de esta categoría.
Se contempla en esta categoría las once actividades económicas anteriores, ya que la categorización depende de la generación de los residuos.
Dentro de la categoría Comercial 3 se encuentran actividades que generan una mayor cantidad de residuos en comparación con la Comercial 2. Se presenta una lista de cinco actividades económicas representativas de esta categoría.
La Municipalidad de Garabito fortalecerá el módelo tarifario de manera que se diferencie el cobro una vez que el ciudadano haya realizado las acciones preventivas, manipulación, clasificación, segregación, almaceneamiento y recolección de los residuos de manera óptima para cada tipo de material.
Todo ente generador que considere que el factor de ponderación que se le está aplicando no está de acuerdo a la cantidad de residuos que está generando deberá presentar la solicitud formal cumpliendo con los siguientes requisitos al Departamento de Ingeniería Ambiental:
4 Temporada baja: Meses de Mayo, Junio, Agosto, Septiembre, Octubre, Noviembre b) El estudio debe estar firmado por un profesional de la rama de gestión ambiental (Ing. Ambiental, Gestión Ambiental, Salud Pública, etc.) incorporado al Colegio respectivo c) Para comercios: presentar el Plan de Gestión Integral de Residuos (avalado por el Ministerio de Salud) d) Se debe presentar el registro fotográfico correspondiente.
a. El Departamento de Ingeniería Ambiental realiza la revisión de la documentación b. El Departamento de Ingeniería Ambiental coordina la inspección y verificación de datos con el Departametno de Inspecciones y/o Policía Municipal c. El Departamento de Ingeniería Ambiental emite criterio de aprobación o desaprobación de la solicitud y propone la categoría correspondiente, con base en la información provista por los Departamentos de Inspecciones y/o Policía Municipal.
d. El Departamento de Desarrollo Urbano con el criterio del Departamento de Ingeniería Ambiental, podrá modificar la categoría de residuos.
Capítulo 15 Sanciones
La Municipalidad podrá suspender las licencias comerciales, cuando se compruebe reiteradamente (más de 3 veces), que infrinjan lo estipulado en los capítulos 3 al 11 del presente reglamento y la ley 8839 para la Gestión Integral de Residuos de conformidad con el artículo 81 bis del Código Municipal.
La Municipalidad de Garabito de conformidad con el Artículo 74 del Código Municipal impondrá recargos sobre el monto establecido en las tarifas de recolección y disposición final a los entes generadores que incumplan con los deberes definidos en los capítulos anteriores según los establecido a continuación:
Las sanciones serán ejecutadas por la Municipalidad de Garabito al identificar el incumplimiento de los deberes de los capítulos del presente reglamento, y tendrán el siguiente procedimiento:
a. El funcionario municipal al evidenciar el incumplimiento de los deberes de los entes generadores procede a documentar el incumplimiento mediante fotografías, testigos, videos, entre otros y traslado al funcionario municipal responsable de toma de acción.
b. El funcionario competente procederá a emitir una boleta de infracción, que notificará al supuesto trasgresor; otorgando el plazo de 5 días para ejercer el derecho de defensa y aportar la prueba de descargo.
c. Cumplido el plazo anterior, el funcionario municipal competente traslada las boletas de infracción, con su correspondiente expediente administrativo, al Departamento de Ingeniería Ambiental. Esto verificando si persiste el hecho o bien si se tomó la medida dictada en la notificación.
d. El Departamento de Ingeniería Ambiental continua con la tramitación del expediente, debiendo analizar los hechos denunciados y dictar la resolución final, absolviendo al supuesto infractor o imponiendo la sanción; en el caso de ser confirmada la trasgresión al ordenamiento jurídico, deberá trasladar la resolución al Departamento de Cobros.
e. El Departamento de Cobros deberá agregar el recargo al sistema para que sea cobrado junto con los impuestos municipales del inmueble.
f. El propietario realiza el pago de su recargo con los impuestos trimestrales o anuales según corresponda.
