1. 1That in accordance with the presentation made by Mr. Edwin Salazar Serrano, Head of the Protection and Registration Department, regarding the actions carried out for addressing control and surveillance in the Gulf of Nicoya, he presents a proposal for an Agreement to allow the seizure of fishing gear that, in accordance with current regulations, is considered illegal, which would allow for an effective control tool over said illegal fishing gear, in safeguard of the fishery resource of the Gulf of Nicoya.
2. 2That in accordance with what is regulated in Law 7384 and Law 8436, the Costa Rican Institute of Fisheries and Aquaculture has the pertinent competencies and powers to establish regulations for the protection, control, and regulation of maritime fishing activities.
3. 3That the fishing activity was considered and declared of public utility and social interest, it being the responsibility and attribution of INCOPESCA to exercise effective control as the executing authority of what is established in Law 8436.
4. 4That in accordance with the provisions of the Fisheries and Aquaculture Law, the use or possession of illegal or prohibited fishing gear in carrying out extractive operations for sea products is deemed an offense of a criminal nature and its use significantly affects the conservation of marine resources.
5. 5That according to what is established in Law 8436 in its Article 133 and Law 8000, it corresponds to the National Coast Guard Service and the Public Force to seize goods, equipment, fishing gear, and sea products, as well as to ensure the legitimate exploitation and protection of the natural resources existing in the jurisdictional maritime waters and the internal waters of the State, in accordance with current national and international legislation; to this end, it may enter into agreements or establish coordination and cooperation mechanisms with INCOPESCA.
6. 6That under this premise, the Directors consider it advisable to accept the proposed recommendation regarding illegal fishing gear, so as to have a legal tool that allows the Authorities of the National Coast Guard Service and the Public Force to seize fishing gear considered illegal, wherefore, the Board of Directors, therefore;

AGREES:

1º-The officers of the National Coast Guard Service or the Public Force who, in application of the fisheries legislation and the existing regulatory and normative provisions on the matter, identify in the performance of their duties the discovery, existence, possession, carrying, sale, importation, manufacture, storage, or use of prohibited or illegal fishing gear by any person, are fully authorized and empowered to proceed immediately with the seizure thereof.

2º-The police authority proceeding with the seizure of illegal fishing gear shall be under the obligation to draw up a record, in the presence of two witnesses. This document must contain the date, the place, the first name and last names of the persons involved, indicating the proceedings carried out, and the signature of all the participants or the mention that some cannot or do not want to sign.

A copy of the record must be delivered to the person from whom the gear is seized or to whomever is at the location of the seizure.

Fishing gear found or seized shall be placed at the disposal of the competent judicial authority, together with the respective complaint, or of INCOPESCA and the pertinent report, as applicable.

3º-Only those fishing gears that are duly established and recorded in the fishing license or authorization for each permit holder are permitted. Pursuant to article one, no fishing gear not expressly authorized by INCOPESCA is permitted.

4º-Apart from what is mentioned in the preceding article, the following fishing gears are totally and absolutely prohibited:

The gillnet that, when stretched, has an internal distance measurement between the two opposite knots of the mesh opening of less than 3 inches.

The gillnet with a height greater than 50 meshes high or with a length greater than 600 linear meters, when found in zone A of the Gulf of Nicoya, understood as that area which lies between an imaginary straight line running from the Puntarenas Cruise Ship Pier (9º58´26" North Latitude, 84º49´51" West Longitude), to the Lighthouse located on the easternmost part of the Islas Negritos (09º49´14" North Latitude, 84º49´35" West Longitude), and from this line skirting the coast towards the interior of the Gulf until reaching an imaginary straight line between Puerto Níspero (10º12´7" North Latitude, 85º13´9" West Longitude) and Puerto Moreno (10º12´4" North Latitude, 85º14´75" West Longitude) at the mouth of the Tempisque River.

The gillnet with a height greater than 70 meshes high or with a length greater than 600 linear meters when found in the area comprised between an imaginary straight line running from the tip of the Puntarenas point (9°57´59",43 north latitude and 84°51´01",31 west longitude) to Playa Blanca in the Gulf of Nicoya (9°54´52",91 north latitude and 84°55´11",64 west longitude) and from there, external waters to the imaginary line that runs from the lighthouse located on the easternmost part of the Islas Negritos (9°49´21",76 north latitude and 84°49´30",43 west longitude) to the Cruise Ship Pier in Puntarenas (9°58´18",51 north latitude and 84°49´53",58 west longitude).

The trawl net 5º-For fishing gear placed at the disposal of INCOPESCA where no claim whatsoever has been filed by private parties, the institute is permitted to carry out any of the following actions:

• A)Donate the fishing gear to public institutions or non-governmental organizations; in such case, the request must clearly indicate the purposes for which they will be used.
• B)Donate the fishing gear to non-governmental organizations dedicated to cooperation in environmental matters. This method of disposal may be applied only when the fishing gear is to be used for recycling or for environmental education.

7º-Final Agreement

Whereas:

(Este Acuerdo fue así modificado mediante Acuerdo AJDIP/329-2016).

1. 1Que de conformidad con la presentación realizada por el Sr. Edwin Salazar Serrano, Jefe del Departamento de Protección y Registro, sobre las acciones realizadas para la atención del control y vigilancia en el Golfo de Nicoya, presenta propuesta de Acuerdo a efecto que permita el decomiso de artes de pesca, que de conformidad con la normativa vigente, se consideren ilegales, lo cual permitiría contar con una herramienta efectiva de control sobre esas artes de pesca ilegales, en resguardo del recurso pesquero del Golfo de Nicoya.
2. 2Que de conformidad con lo regulado en la ley 7384 y en la ley 8436, el Instituto Costarricense de la Pesca y Acuacultura tiene las competencias y facultades pertinentes para establecer las regulaciones de protección, control y regulación de las actividades de pesca marítima.
3. 3Que la actividad pesquera fue considerada y declarada de utilidad pública e interés social, siendo responsabilidad y atribución del INCOPESCA ejercer el efectivo control como autoridad ejecutora de lo establecido en la Ley 8436.
4. 4Que de conformidad con las disposiciones de la Ley de Pesca y Acuicultura, la utilización, el uso o la tenencia de artes de pesca ilegales o prohibidas en la realización de las faenas extractivas de los productos del mar, son reputadas como infracciones de naturaleza penal y su uso afecta notablemente la conservación del recurso marino.
5. 5Que según lo establecido en la Ley 8436 en su artículo 133 y la Ley 8000, corresponde al Servicio Nacional de Guardacostas y de la Fuerza Pública decomisar bienes, equipos, artes de pesca y productos del mar, así como velar por el legítimo aprovechamiento y la protección de los recursos naturales existentes en las aguas marítimas jurisdiccionales y en las aguas interiores del Estado, según la legislación vigente, nacional e internacional, para ello podrá suscribir convenios o establecer mecanismos de coordinación y cooperación con el INCOPESCA.
6. 6Que bajo esa premisa, consideran los Sres. Directivos, que resulta conveniente acoger la recomendación propuesta sobre artes de pesca ilegales, a fin de que se cuente con una herramienta jurídica que permita a las Autoridades del Servicio Nacional de Guardacostas y de la Fuerza Pública, el decomiso de artes de pesca considerados ilegales, razón por la cual, la Junta Directiva, por tanto;

ACUERDA:

1º-Los oficiales del Servicio Nacional de Guardacostas o de la Fuerza Pública que en aplicación de la legislación pesquera y disposiciones normativas y reglamentarias existentes en la materia, determinen en el cumplimiento de sus funciones, el hallazgo, la existencia, la posesión, la portación, venta, importación, fabricación, almacenaje o utilización de artes de pesca prohibidas o ilegales, por parte de cualquier persona, quedan plenamente autorizados y facultados para proceder en forma inmediata al decomiso de las mismas.

2º-La autoridad policial que proceda al decomiso de un arte de pesca ilegal estará en la obligación de levantar un acta, en presencia de dos testigos. Ese documento deberá contener la fecha, el lugar, el nombre y los apellidos de las personas que actúan, con indicación de las diligencias realizadas y la firma de todos los intervinientes o la mención de que alguno no puede o no quiere firmar.

Deberá entregarse copia del acta a la persona, a quien se le decomise el arte o a quien se encuentre en el lugar del decomiso.

Las artes de pesca por hallazgo o decomisadas serán puestas a la orden de la autoridad judicial competente, junto con la denuncia respectiva o del INCOPESCA y el informe pertinente, según corresponda.

3º-Son artes de pesca permitidas únicamente aquellas que se encuentren debidamente establecidas y consignadas en la licencia de pesca o autorización para cada permisionario. No se permite de conformidad con el artículo primero ningún arte de pesca no autorizado expresamente por el INCOPESCA.

4º-Aparte de lo mencionado en el artículo anterior son artes de pesca total y absolutamente prohibidas las siguientes:

La red agallera que estirada la medida de distancia interna entre los dos nudos opuestos de la abertura de una medida menor de 3 pulgadas.

La red agallera con una altura mayor de 50 mallas de alto o con un largo mayor de 600 metros lineales, que se encuentre en la zona A del Golfo de Nicoya, entendida ésta como aquella que se encuentra comprendida entre una línea recta imaginaria que va desde el Muelle de Cruceros de Puntarenas (9º58´26" Latitud Norte, 84º49´51" Longitud Oeste), hasta el Faro ubicado en la parte más oriental de las Islas Negritos (09º49´14" Latitud Norte, 84º49´35" Longitud Oeste) y de esta línea bordeando la costa hacia el interior del Golfo hasta llegar a una línea recta imaginaria entre Puerto Níspero (10º12´7" Latitud Norte, 85º13´9" Longitud Oeste) y Puerto Moreno (10º12´4" Latitud Norte, 85º14´75" Longitud Oeste) en la desembocadura del Río Tempisque.

La red agallera con una altura mayor de 70 mallas de alto o con un largo mayor de 600 metros lineales que se encuentre en el área comprendida entre una línea recta imaginaria que va desde el extremo de la punta de Puntarenas (9°57´59",43 latitud norte y 84°51´01",31 longitud oeste) hasta Playa Blanca en el Golfo de Nicoya (9°54´52",91 latitud norte y 84°55´11",64 longitud oeste) y de ahí aguas externas hasta la línea imaginaria que parte del faro ubicado en la parte más oriental de las Islas Negritos (9°49´21",76 latitud norte y 84°49´30",43 longitud oeste) hasta el Muelle de Cruceros en Puntarenas (9°58´18",51 latitud norte y 84°49´53",58 longitud oeste).

La rastra 5º-Las artes de pesca que se pongan a disposición del INCOPESCA y no habiéndose presentado reclamo alguno por parte de particulares, le quedará permitido al instituto realizar cualquiera de las siguientes gestiones:

• A)Donar las artes de pesca a instituciones públicas u organizaciones no gubernamentales, en tal caso la solicitud debe indicar con claridad los fines para los que serán utilizados.
• B)Donar las artes de pesca a organizaciones no gubernamentales dedicadas a la cooperación en materia ambiental. Pudiendo ser aplicada esta modalidad de disposición únicamente cuando las artes de pesca vayan a ser utilizadas para reciclaje o para educación ambiental.

7º-Acuerdo Firme

Considerando:
