throughout the entire text - Full Text of Standard 37393 Partial Amendment to the Regulation of Tourism Enterprises, Executive Decree No. 25226-MEIC-TUR of March 15, 1996, and its amendments for the adaptation of requirements applicable to Indigenous Reserves Full Text of act record: EA140 No. 37393-MEIC-TUR THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF ECONOMY, INDUSTRY AND TRADE, AND THE MINISTER OF TOURISM Pursuant to the powers and authorities conferred in Articles 140, subsections 3) and 18), and 146 of the Political Constitution of November 7, 1949; Article 28 of Law No. 6227 of May 2, 1978, and its amendments; the General Law of Public Administration; Articles 2 and 4 of Law No. 1917 of July 30, 1955, the Organic Law of the Costa Rican Tourism Institute; and Executive Decree No. 25226-MEIC-TUR of March 15, 1996, the Regulation of Tourism Enterprises and Activities and its amendments.

Whereas:

1917 of July 30, 1955, the Organic Law of the Costa Rican Tourism Institute, the governing body in tourism matters is the Costa Rican Tourism Institute (hereinafter the Institute), which is responsible for promoting and supervising the private activity of tourism services, within which are found lodging establishments (Hospedaje), Airlines, Gastronomy, Night Entertainment Centers, Vehicle Rental Agencies, Water Transportation, Themed Activities, Travel Agencies, and the Congresses and Conventions Section, defined and categorized in accordance with the Regulation of Tourism Enterprises and Activities, Executive Decree No. 25226-MEIC-TUR, of March 15, 1996, published in La Gaceta No. 121 of June 26, 1996, and its amendments (hereinafter: the Regulation of Tourism Enterprises and Activities).

1917 of July 30, 1955, is the promotion of tourism activity and the supervision of private services to tourists through the administrative regime of the tourism declaration (declaratoria turística), which is of a voluntary nature and which entails the technical classification of establishments and the regulation of their activities under parameters of quality, safety, and tourist service.

1917 of July 30, 1955, the Institute shall promote and encourage any of the commercial, industrial, transportation, sports, artistic, or cultural activities that seek to attract tourism, providing facilities and entertainment or that make known the country in its diverse aspects, especially folklore.

"(...)

By virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development.

(...)"

6172 of November 29, 1977, the Indigenous Law (Ley Indígena), in its fourth article states: "The reserves shall be governed by the indigenous peoples in their traditional community structures or by the laws of the Republic that govern them, under the coordination and advisory of CONAI. The population of each of the reserves constitutes a single community, administered by a board of directors (Concejo directivo) representative of the entire population; auxiliary committees shall depend on the main board if the geographic extension warrants it."

Article 4 of Decree No. 8487 of April 26, 1978, the Regulation to the Indigenous Law (Reglamento a la Ley Indígena): "(...) The Presidents of the respective Indigenous Development Associations (Asociaciones de Desarrollo Indígenas), legally registered, and with the powers of general agents of the same, shall appear before the Office of the Attorney General of the Republic, for the granting of the deed and registration in the Public Registry, of the Reserves in the name of the respective Indigenous Communities."

Article 5 of Decree No. 8487 of April 26, 1978, the Regulation to the Indigenous Law stipulates: "(...) The traditional community structures referred to in Article 4 of the Law, shall operate within the respective Communities; and the Development Associations (Asociaciones de Desarrollo), once legally registered, shall represent judicially and extra- judicially said Communities."

13568 of April 30, 1982, Legal Representation of Indigenous Communities by the Development Associations and as Local Government, decrees in its first article: "(...) The Integral Development Associations (Asociaciones de Desarrollo Integral) have the legal representation of the Indigenous Communities and act as their local government."

10.—That the aforementioned amendment to the Regulation of Tourism Enterprises and Activities has as territories may apply for the Tourism Declaration (Declaratoria Turística), thus promoting the sustainable development of our country's indigenous communities and the cultural authenticity of our tourism product. Therefore, They Decree:

PARTIAL AMENDMENT TO THE REGULATION OF TOURISM ENTERPRISES AND ACTIVITIES, EXECUTIVE DECREE NO. 25226-MEIC-TUR OF MARCH 15, 1996 AND ITS AMENDMENTS FOR THE ADAPTATION OF APPLICABLE REQUIREMENTS TO INDIGENOUS RESERVES

Legal-type requirements, of Article 8 of the Regulation of Tourism Enterprises and Activities, Executive Decree No. 25226-MEIC-TUR of March 15, 1996, and its amendments, keeping the rest of the standard unchanged, so that it reads as follows:

"(...)

f)In the case of lodging (hospedaje) enterprises and themed activities (actividades temáticas) located within an Indigenous Reserve, the interested party must submit:

f.1— A written reference of the number and dates of validity and publication of the Law or the Executive Decree, by means of which the Indigenous Reserve where the project is located was created.

f.2— Certification of the legal capacity (personería jurídica) of the Integral Development Association or the body that operates as the competent authority within said Reserve.

f.3— An authorization document issued by the Integral Development Association or competent Authority within the reserve, to develop the activity intended to be covered by the tourism declaration (declaratoria turística), within the territory of the reserve.

f.4— A topographic survey (levantamiento topográfico) of the site (sketch/croquis) indicating the physical delimitation of the tourism activity, showing its area and boundaries (linderos)."

Legal-type requirements of Anexo 2, the Requirements Guide for obtaining the Tourism Declaration Activity: Lodging (Hospedaje), of the Regulation of Tourism Enterprises and Activities, Executive Decree No. 25226-MEIC-TUR, of March 15, 1996, and its amendments, keeping the rest of the standard unchanged, so that it reads as follows:

" (...)

f)In the case of lands located in indigenous reserves, the following must be provided:

f.1— A written reference of the number and dates of validity and publication of the Law or the Executive Decree, by means of which the Indigenous Reserve where the project is located was created.

Considerando:

En virtud de ese derecho determinan libremente su condición política y persiguen libremente su desarrollo económico, social y cultural.

(.)"

La población de cada una de las reservas constituye una sola comunidad, administrada por un Concejo directivo representante de toda la población; del concejo principal dependerán comités auxiliares si la extensión geográfica lo amerita."

10.-Que la mencionada reforma al Reglamento de Empresas y Actividades Turísticas, tiene como resultados esperados facilitar que iniciativas turísticas en territorios indígenas puedan aplicar por la Declaratoria Turística, fomentando así el desarrollo sostenible de las comunidades indígenas de nuestro país y la autenticidad cultural de nuestro producto turístico. Por tanto,

REFORMA PARCIAL AL REGLAMENTO DE LAS EMPRESAS Y ACTIVIDADES TURÍSTICAS, DECRETO EJECUTIVO Nº 25226-MEIC-TUR DEL 15 DE MARZO DE 1996 Y SUS REFORMAS PARA LA ADAPTACIÓN DE REQUISITOS APLICABLES A LAS RESERVAS INDÍGENAS

Decretan:

Requisitos de tipo legal, del artículo 8º del Reglamento de Empresas y Actividades Turísticas, Decreto Ejecutivo Nº 25226-MEIC-TUR del 15 de marzo de 1996 y sus reformas, manteniéndose el resto de la norma invariable, para que se lea como sigue:

"(.)

f)En el caso de las empresas de hospedaje y actividades temáticas localizadas dentro de una Reserva Indígena, el interesado deberá presentar:

f.1- Referencia por escrito del número y fecha de vigencia y publicación de la Ley o el Decreto Ejecutivo, mediante el cual se dio origen a la Reserva Indígena donde se localiza el proyecto.

f.2- Certificación de personería jurídica de la Asociación de Desarrollo Integral u órgano que opere como autoridad competente dentro de dicha Reserva.

f.3- Documento de autorización emitido por la Asociación de Desarrollo Integral o Autoridad competente dentro de la reserva, para desarrollar la actividad que se pretende amparar a la declaratoria turística, dentro del territorio de la reserva.

f.4- Un levantamiento topográfico del sitio (croquis) con indicación de la delimitación física de la actividad turística, en el cual se señale su medida y linderos."

Requisitos de tipo legal del Anexo 2, Guía de Requisitos para obtener la Declaratoria Turística Actividad: Hospedaje, del Reglamento de Empresas y Actividades Turísticas, Decreto Ejecutivo Nº 25226-MEIC-TUR, del 15 de marzo de 1996 y sus reformas, manteniéndose el resto de la norma invariable, para que se lea como sigue:

" (.)

f)En el caso de terrenos ubicados en reservas indígenas, debe aportarse:

f.1- Referencia por escrito del número y fechas de vigencia y publicación de la Ley o el Decreto Ejecutivo, mediante el cual se dio origen a la Reserva Indígena donde se localiza el proyecto.

f.2- Certificación de personería jurídica de la Asociación de Desarrollo Integral u órgano que opere como autoridad competente dentro de dicha Reserva.

f.3- Documento de autorización emitido por la Asociación de Desarrollo Integral o Autoridad competente dentro de la reserva para desarrollar la actividad que se pretende amparar a la declaratoria turística dentro del territorio de la reserva.

f.4- Un levantamiento topográfico del sitio (croquis) con indicación de la delimitación física del área de la actividad turística, en el cual se señale su medida y linderos.

Amendment to Tourism Companies Regulation for Indigenous ReservesReforma Parcial al Reglamento de las Empresas Turísticas, Decreto Ejecutivo

Artículo 1 — That in accordance with Law No.

Artículo 2 — That among the purposes assigned to the Institute in Article 4 of its Organic Law, No.

Artículo 3 — That likewise, according to Article 5, subsection c), of its Organic Law, No.

Artículo 4 — That the United Nations Declaration on the Rights of Indigenous Peoples of September 13, 2007, states:

Artículo 3 — —Indigenous peoples have the right to self-determination.

Artículo 4 — —Indigenous peoples, in exercising their right to self-determination, have the right to autonomy or self-government in matters relating to their internal and local affairs, as well as ways and means for financing their autonomous functions.

Artículo 5 — That Law No.

Artículo 1 — —Add a subsection f) to point 1.

Artículo 4 — Que la Declaración de las Naciones Unidas sobre los Derechos de los Pueblos Indígenas del 13 de setiembre del 2007, indica:

Artículo 3 — Los pueblos indígenas tienen derecho a la libre determinación.

Artículo 4 — Los pueblos indígenas, en ejercicio de su derecho de libre determinación, tienen derecho a la autonomía o el autogobierno en las cuestiones relacionadas con sus asuntos internos y locales, así como a disponer de los medios para financiar sus funciones autónomas.

Artículo 5 — Que la Ley Nº 6172 del 29 de noviembre de 1977, Ley Indígena, en su cuarto artículo indica: "Las reservas serán regidas por los indígenas en sus estructuras comunitarias tradicionales o de las leyes de la República que los rijan, bajo la coordinación y asesoría de CONAI.

Artículo 1 — Adiciónese un inciso f) al punto 1.

Artículo 2 — Adiciónese un inciso f) al punto I.

Artículo 3 — Rige a partir de su publicación en el Diario Oficial La Gaceta.
