throughout the entire text - Full Text of Standard 37393 Partial Amendment to the Regulation of Tourism Enterprises, Executive Decree No. 25226-MEIC-TUR of March 15, 1996, and its amendments for the adaptation of requirements applicable to Indigenous Reserves Full Text of act record: EA140 No. 37393-MEIC-TUR THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF ECONOMY, INDUSTRY AND TRADE, AND THE MINISTER OF TOURISM Pursuant to the powers and authorities conferred in Articles 140, subsections 3) and 18), and 146 of the Political Constitution of November 7, 1949; Article 28 of Law No. 6227 of May 2, 1978, and its amendments; the General Law of Public Administration; Articles 2 and 4 of Law No. 1917 of July 30, 1955, the Organic Law of the Costa Rican Tourism Institute; and Executive Decree No. 25226-MEIC-TUR of March 15, 1996, the Regulation of Tourism Enterprises and Activities and its amendments.
1.—That in accordance with Law No. 1917 of July 30, 1955, the Organic Law of the Costa Rican Tourism Institute, the governing body in tourism matters is the Costa Rican Tourism Institute (hereinafter the Institute), which is responsible for promoting and supervising the private activity of tourism services, within which are found lodging establishments (Hospedaje), Airlines, Gastronomy, Night Entertainment Centers, Vehicle Rental Agencies, Water Transportation, Themed Activities, Travel Agencies, and the Congresses and Conventions Section, defined and categorized in accordance with the Regulation of Tourism Enterprises and Activities, Executive Decree No. 25226-MEIC-TUR, of March 15, 1996, published in La Gaceta No. 121 of June 26, 1996, and its amendments (hereinafter: the Regulation of Tourism Enterprises and Activities).
2.—That among the purposes assigned to the Institute in Article 4 of its Organic Law, No. 1917 of July 30, 1955, is the promotion of tourism activity and the supervision of private services to tourists through the administrative regime of the tourism declaration (declaratoria turística), which is of a voluntary nature and which entails the technical classification of establishments and the regulation of their activities under parameters of quality, safety, and tourist service.
3.—That likewise, according to Article 5, subsection c), of its Organic Law, No. 1917 of July 30, 1955, the Institute shall promote and encourage any of the commercial, industrial, transportation, sports, artistic, or cultural activities that seek to attract tourism, providing facilities and entertainment or that make known the country in its diverse aspects, especially folklore.
4.—That the United Nations Declaration on the Rights of Indigenous Peoples of September 13, 2007, states:
"(...)
Whereas:
By virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development.
(...)" 5.—That Law No. 6172 of November 29, 1977, the Indigenous Law (Ley Indígena), in its fourth article states: "The reserves shall be governed by the indigenous peoples in their traditional community structures or by the laws of the Republic that govern them, under the coordination and advisory of CONAI. The population of each of the reserves constitutes a single community, administered by a board of directors (Concejo directivo) representative of the entire population; auxiliary committees shall depend on the main board if the geographic extension warrants it." 6.—That according to Article 4 of Decree No. 8487 of April 26, 1978, the Regulation to the Indigenous Law (Reglamento a la Ley Indígena): "(...) The Presidents of the respective Indigenous Development Associations (Asociaciones de Desarrollo Indígenas), legally registered, and with the powers of general agents of the same, shall appear before the Office of the Attorney General of the Republic, for the granting of the deed and registration in the Public Registry, of the Reserves in the name of the respective Indigenous Communities." 7.—That for its part, Article 5 of Decree No. 8487 of April 26, 1978, the Regulation to the Indigenous Law stipulates: "(...) The traditional community structures referred to in Article 4 of the Law, shall operate within the respective Communities; and the Development Associations (Asociaciones de Desarrollo), once legally registered, shall represent judicially and extra- judicially said Communities." 8.—That Decree No. 13568 of April 30, 1982, Legal Representation of Indigenous Communities by the Development Associations and as Local Government, decrees in its first article: "(...) The Integral Development Associations (Asociaciones de Desarrollo Integral) have the legal representation of the Indigenous Communities and act as their local government." 9.—That this situation requires promoting an amendment to the Regulation of Tourism Enterprises and Activities, so that it is the Governing Authorities in each of the Indigenous Territories that generate certifications for these activities, facilitating the pertinent information and permission, corresponding to each of the requirements established for the tourism declaration (declaratoria turística) granted by the Institute.
10.—That the aforementioned amendment to the Regulation of Tourism Enterprises and Activities has as territories may apply for the Tourism Declaration (Declaratoria Turística), thus promoting the sustainable development of our country's indigenous communities and the cultural authenticity of our tourism product. Therefore, They Decree:
PARTIAL AMENDMENT TO THE REGULATION OF TOURISM ENTERPRISES AND ACTIVITIES, EXECUTIVE DECREE NO. 25226-MEIC-TUR OF MARCH 15, 1996 AND ITS AMENDMENTS FOR THE ADAPTATION OF APPLICABLE REQUIREMENTS TO INDIGENOUS RESERVES
