in the entirety of the text - Complete Text of Regulation 37187 Creates the Implementation and Development Commission of the Arenal Tempisque Basin (CIDECAT) Complete Text record: E7393 No. 37187 - MINAET THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT, ENERGY AND TELECOMMUNICATIONS In use of the powers conferred upon them by Articles 46, 50, 140 subsections 3) and 18) and 146 of the Political Constitution, Articles 25, 27 subsection 1, 28 subsection 2b of the General Public Administration Law No. 6227 of May 2, 1978, Articles 46 and 47 of the Organic Environmental Law No. 7554 of October 4, 1995 and Article 117 of the Biodiversity Law No. 7788 of April 30, 1998.
1-. That through Executive Decree No. 26395-MINAE of September 18, 1997, the Implementation Commission for the Management and Development Plan of the Arenal Reservoir Basin was created, which was assigned the primary function of undertaking the relevant efforts to effectively support the execution of said plan, also being able to participate in the follow-up on the various specific problems that arise in the basin.
2-. That the Management and Development Plan of the Arenal Reservoir Basin is the result of the inter-institutional cooperation efforts regarding said basin, conceived as part of the policies developed by the Government of Costa Rica through the Ministry of Environment, Energy and Telecommunications.
3-. That the Ministry of Environment, Energy and Telecommunications, aware of the need to involve the different populations in the process of conservation and management of natural resources, and to integrate actions under a participatory basin management framework, has promoted a change process in the conceptual and organizational framework of the National System of Conservation Areas of the country, as a result of which the boundaries of the Arenal Conservation Area have been modified to include the middle and lower parts of the basin up to the mouth of the Tempisque River, consequently being renamed the Arenal - Tempisque Conservation Area.
4-. That as a result of the expansion of the scope of action of the Arenal - Tempisque Conservation Area, the institutions participating in the commission created by Executive Decree No. 26395-MINAE have deemed it essential to expand institutional participation in it, to include various technical and administrative entities interested in the sound management of the Arenal-Tempisque Basin, as it contains the basic operational resources of said institutions 5-. That by expanding institutional participation, the aim is also to integrate the efforts and tasks carried out by the different entities, so that the Management and Development Plan of the Arenal Reservoir Basin is projected and implemented with technical and administrative grounding for the Arenal-Tempisque Basin, given its importance for the social and economic development of the country, and for its associated functions of conservation, use, and sustainable management of resources.
6-. That in accordance with Article 12 subsection t) of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE of March 11, 2008, the National Council of Conservation Areas (CONAC), in Ordinary Session No. 01-2010 held on February 12, 2010, through Agreement No. 27 approved this decree.

Considering:
Therefore,
-Promote coordination that determines the development of plans, programs, and projects responding to the integrated management of the resources of the Arenal- Tempisque Basin, achieving a balance between the needs of the population and nature.
-Undertake the pertinent efforts to channel infrastructure, technical, and financial resources, at the domestic or international level, to effectively support the execution of actions promoting the integrated management of the Basin.
-Participate in the analysis, proposed solutions, and follow-up on the various specific problems that arise in the Arenal - Tempisque Basin.
-A representative of the Ministry of Environment, Energy and Telecommunications, through the Directorate of the Arenal -Tempisque Conservation Area.
-A representative of the Ministry of Agriculture and Livestock.
-A representative of the Ministry of Health.
-A representative of the Costa Rican Institute of Aqueducts and Sewers.
-A representative of the Costa Rican Electricity Institute.
-A representative of the Institute of Agrarian Development.
-A representative of the National Groundwater, Irrigation and Drainage Service.
-A representative of the Municipality of Cañas.
-A representative of the Municipality of Tilarán.
-A representative of the Foundation for the Development of the Arenal-Tempisque Conservation Area.
-A representative of the Diocese of Tilarán.
-A representative of civil society appointed by the Regional Council of the Arenal Tempisque Conservation Area.
The representatives of the indicated sectors, duly accredited by their respective institution or organization before the coordinating entity of the Commission, shall meet at a minimum every two years and from among themselves shall elect the members of the board of directors.

The institutions added to the Commission by virtue of this decree must communicate the appointments of their representatives to the coordinating entity of the Commission in writing, within a maximum period of 15 business days following the day of publication of this decree in the Official Gazette La Gaceta.
The Commission may also be convened by at least five of its members, jointly.
Sessions shall be held with at least eight members present, decisions shall be made by simple majority of votes present and in the event of a tie, the coordinator shall have the authority to exercise a double vote.
-Seek resources, through the members of the Commission, volunteers and persons knowledgeable about the area, for the achievement of financing, implementation, and sustainability of the Plan for the Arenal Reservoir Basin-Arenal Tempisque Irrigation District.
-Develop plans, programs, and projects responding to the integrated management of the resources of the Arenal-Tempisque Basin.
-Create financial mechanisms and efforts before institutions to promote participation and the financial sustainability of projects.
-Develop proposed solutions and follow up on them, in order to address the problems that arise in the Arenal-Tempisque Basin.
-Representative of the Directorate of the Arenal Tempisque Conservation Area, who shall act as coordinator of the Board.
-Representative of the Institute of Aqueducts and Sewers.
-Representative of the National Groundwater, Irrigation and Drainage Service.
-Representative of the Costa Rican Electricity Institute.
-They shall be designated from among the other members of the assembly, by simple majority vote, and may not be reelected for consecutive periods, in order to give opportunity to members from other entities.
This person's functions shall include:
-The administrative management of the various projects promoted by the Board of Directors of the Commission.
-Knowing the budgetary content and work plans of public institutions in the management of the basin, through the collection and systematization of information.
-Knowing specific uses established in decrees for discharges, water use rights (aprovechamiento), and water concessions, carrying out legal consultations for the use of these fees. This shall be verified through indicators with legal analyses.
The sessions of the Board attended by said guests may be attended with the right to speak but not to vote.

1-. Que mediante Decreto Ejecutivo Nº 26395-MINAE del 18 de setiembre de 1997, se creó la Comisión de Implementación del Plan de Manejo y Desarrollo de la Cuenca del Embalse Arenal, a la cual se le asignó como función primordial, efectuar las gestiones pertinentes para apoyar de manera efectiva la ejecución de dicho plan, pudiendo participar además, en el seguimiento a los diferentes problemas puntuales que se presentan en la cuenca.
2-. Que el Plan de Manejo y Desarrollo de la Cuenca del Embalse Arenal, es el resultado de los esfuerzos de cooperación interinstitucional en torno a dicha cuenca, concebido como parte de las políticas que desarrolló el Gobierno de Costa Rica a través del Ministerio de Ambiente, Energía y Telecomunicaciones.
3-. Que el Ministerio de Ambiente, Energía y Telecomunicaciones, consciente de la necesidad de involucrar a las diferentes poblaciones en el proceso de conservación y manejo de los recursos naturales, e integrar las acciones bajo un esquema participativo de manejo de cuencas, ha impulsado un proceso de cambio en el esquema conceptual y organizativo del Sistema Nacional de Áreas de Conservación del país, producto del cual se han modificado los límites del Área de Conservación Arenal para incluir la parte media y baja de la cuenca hasta la desembocadura del Río Tempisque, pasando en consecuencia a denominarse Área de Conservación Arenal - Tempisque.
4-. Que como resultado de la ampliación del campo de acción del Área de Conservación Arenal - Tempisque, las instituciones participantes en la comisión creada por el Decreto Ejecutivo Nº 26395-MINAE han considerado indispensable ampliar la participación institucional en la misma, para incluir a diversas entidades técnicas y administrativas interesadas en el buen manejo de la Cuenca Arenal-Tempisque, por contener ésta los recursos básicos de funcionamiento de dichas instituciones 5-. Que al ampliarse la participación institucional se busca, además, integrar los esfuerzos y labores realizados por los diferentes entes, de manera que el Plan de Manejo y Desarrollo de la Cuenca del Embalse Arenal, se proyecte e implemente con fundamento técnico y administrativo a la Cuenca Arenal-Tempisque, dada la importancia que ésta tiene para el desarrollo social y económico del país, y por sus funciones asociadas de conservación, uso y manejo sostenible de los recursos.
6-. Que de conformidad con el artículo 12 inciso t) del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo de 2008, el Consejo Nacional de Áreas de Conservación (CONAC), en Sesión Ordinaria Nº 01-2010 celebrada el día 12 de febrero del 2010, mediante Acuerdo Nº 27 aprobó el presente decreto.

Considerando:
Por tanto,
Decretan:
-Promover la coordinación que determine el desarrollo de planes, programas y proyectos que respondan al manejo integral de los recursos de la Cuenca Arenal- Tempisque, logrando un equilibrio entre las necesidades de la población y la naturaleza.
-Efectuar las gestiones pertinentes para canalizar recursos de infraestructura, técnicos y financieros, a nivel interno o externo del país, para apoyar de manera efectiva la ejecución de acciones que promuevan el manejo integral de la Cuenca.
-Participar en el análisis, propuesta de soluciones y seguimiento a los diferentes problemas puntuales que se presentan en la Cuenca Arenal - Tempisque.
-Un representante del Ministerio de Ambiente, Energía y Telecomunicaciones, a través de la Dirección del Área de Conservación Arenal -Tempisque.
-Un representante del Ministerio de Agricultura y Ganadería.
-Un representante del Ministerio de Salud.
-Un representante del Instituto Costarricense de Acueductos y Alcantarillados.
-Un representante del Instituto Costarricense de Electricidad.
-Un representante del Instituto de Desarrollo Agrario.
-Un representante del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento.
-Un representante de la Municipalidad de Cañas.
-Un representante de la Municipalidad de Tilarán.
-Un representante de la Fundación para el Desarrollo del Área de Conservación Arenal-Tempisque.
-Un representante de la Diócesis de Tilarán.
-Un representante de la sociedad civil nombrado por el Consejo Regional del Área de Conservación Arenal Tempisque.
Los representantes de los sectores indicados, debidamente acreditados por su institución u organización respectiva ante el ente coordinador de la Comisión, se reunirán como mínimo cada dos años y de su seno se elijarán los puestos de la junta directiva.
Las instituciones que se adicionan a la Comisión en virtud del presente decreto, deberán comunicar los nombramientos de sus representantes al ente coordinador de la Comisión de forma escrita, en un plazo no mayor de 15 días hábiles siguientes, a partir del día de publicación de este decreto en el Diario Oficial La Gaceta.
La Comisión también podrá ser convocada por al menos cinco de sus miembros, en forma conjunta.
Las sesiones se llevarán a cabo con al menos ocho miembros presentes, las decisiones se tomarán por mayoría simple de votos presentes y en caso de empate el coordinador tendrá la facultad de ejercer doble voto.
-Buscar recursos, mediante los miembros de la Comisión, personas voluntarias y conocedoras de la zona, para el logro del financiamiento, implementación y la sostenibilidad del Plan de la Cuenca Embalse Arenal-Distrito de Riego Arenal Tempisque.
-Desarrollar planes, programas y proyectos que respondan al manejo integral de los recursos de la Cuenca Arenal-Tempisque.
-Crear mecanismos financieros y gestiones ante las instituciones para promover la participación y la sostenibilidad financiera de los proyectos.
-Desarrollar propuestas de soluciones y dar seguimiento a las mismas, a efectos de atender la problemática que se presente en la Cuenca Arenal-Tempisque.
-Representante de la Dirección del Área de Conservación Arenal Tempisque, quien fungirá como coordinador de la Junta.
-Representante del Instituto de Acueductos y Alcantarillados.
-Representante del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento.
-Representante del Instituto Costarricense de Electricidad.
-Se designarán entre los demás integrantes de la asamblea, por votación de mayoría simple, no pudiendo reelegirse por períodos consecutivos, a fin de dar oportunidad a miembros de otras entidades.
Este tendrá entre sus funciones:
-El manejo administrativo de los diversos proyectos que promueva la Junta Directiva de la Comisión.
-Conocer el contenido presupuestario y los planes de trabajo de las instituciones públicas en el manejo de la cuenca, mediante recolección y sistematización de información.
-Conocer destinos específicos establecidos en decretos de vertidos, aprovechamiento y concesiones de agua, llevando a cabo consultas legales para el uso de estos cánones. Esto se comprobará mediante indicadores con análisis jurídicos.
A las sesiones de la Junta a que concurran dichos invitados, podrán asistir con derecho a voz pero no a voto.
