In the case of aqueducts for the rural and dispersed population built with specific State contributions, special tariffs may be established, taking into account the community’s contributions to the construction, operation, and maintenance of the works.
The Costa Rican Institute of Aqueducts and Sewers shall have a period of three months to modify or accept the tariffs submitted for its consideration. If, after this period has elapsed, it has not issued a ruling, the interested party may consider this procedure completed and forward the proposed tariffs to the National Electricity Service (Servicio Nacional de Electricidad).
The Costa Rican Institute of Aqueducts and Sewers or the interested parties shall publish the proposed rates and tariffs that they submit to the National Electricity Service for approval, which shall grant citizens thirty business days, starting from their publication, to substantiate their opposition to them or to make pertinent observations.
Once this period has concluded and after a complete examination of the tariff filing and the oppositions and observations received, it shall decide what is most convenient for the interests of the users, within the principles established in this article. If another thirty business days elapse without the National Electricity Service issuing a ruling, the tariffs shall be considered approved.
The new tariffs must be made publicly known and will come into effect starting the month immediately following the dates on which they were authorized.
Tariff increases may not be made more than once per year; but increases may be made in a staggered manner with consecutive monthly increments.
