Fidagro: this is understood as the Trust for Agricultural Protection and Promotion for Small and Medium-Sized Producers (Fideicomiso para la protección y el fomento agropecuario para pequeños y medianos productores), created for the purchase and restructuring of debts, as well as for its own financial resources to reactivate the productive units of those already beneficiaries of the trust who qualified for it.
agricultural producers (Pequeños productores agropecuarios): for the purposes of this Law, small agricultural producers are understood to be all producers who operate economic units in which family participation represents seventy-five percent (75%) of their farm or productive activity, the majority of production is destined for subsistence and only the surpluses are placed on the domestic market, and gross annual income is less than twenty-five thousand United States dollars (US$25,000) per year, or its equivalent in national currency.
Medium-sized agricultural producer (Mediano productor agropecuario): all producers who operate economic units of an entrepreneurial nature, in which family participation or dedication to this activity is sixty percent (60%) or less of their time, a part of the production is destined for subsistence and another significant part for the domestic and international market, they regularly employ hired labor, and gross annual income is less than seventy-five thousand United States dollars (US$75,000) per year, or its equivalent in national currency.
Productive Restructuring Program (Programa de reconversión productiva): program of the agricultural sector, created by Law No. 7742, with the purpose of increasing its competitiveness, under the execution coordination of the National Production Council (Consejo Nacional de Producción).
Natural disaster or force majeure (Desastre natural o fuerza mayor): any event of nature of a biological or climatic nature, which cannot be avoided nor foreseen by the agricultural producer, that has the capacity to partially or totally destroy the plantations, the harvests, or the investments made by those who maintain debts with Fidagro, as well as with Productive Restructuring.
Adverse market conditions (Condiciones adversas de mercado): all unfavorable and unforeseen market conditions, which place the project in a situation of difficult or impossible success.
Development Banking System (Sistema de Banca para el Desarrollo): mechanism to finance and promote productive projects, viable and feasible technically and economically, in accordance with the country's development model regarding the social mobility of the groups subject to this Law.
For the purposes of this Law, the execution of the provisions and responsibilities that fall within the Development Banking System (Sistema de Banca para el Desarrollo) (SBD) shall be the responsibility of its Governing Council (Consejo Rector) as the deciding, governing, and highest authority.
