article that will be Article 6 BIS to Executive Decree No. 23943 of January 5, 1995, and its amendments, which shall read as follows:
"Article 6 bis: In addition to the fees defined above, the shipowners or representatives of tuna vessels with purse seines, at the time of requesting the granting of the respective fishing license, must pay the sum of $10.00 (dollars) per net registered ton of the vessel, which will be allocated to the creation of a special fund with a specific objective, for the handling of the commitments assumed by the country in the condition of Contracting Party, Non-Cooperating Party, or duly accredited participant, as corresponds, whether by determination of Law or by definition of the Minister of Agriculture and Livestock, before the Regional Tuna Fisheries Management Organizations (OROPs), as well as for the handling of any other objective related to the fulfillment of said commitments and the country's interests in the development of the Costa Rican fishing sector. The Costa Rican Institute of Fisheries and Aquaculture shall carry out the collection simultaneously with the collection of the fees defined in Article 6 of this Decree, an entity that must maintain the resources corresponding to this fund managed in a separate account with a specific purpose, at the order of the Ministry of Agriculture and Livestock so that the latter may dispose of the amounts collected under the terms of the present Decree.
The collected resources will be used primarily for the payment of the financial commitments assumed by the country in the condition of contracting party, non- cooperating party, or participant, in the Regional Tuna Fisheries Management Organizations.
The Costa Rican Institute of Fisheries and Aquaculture, in the months of March and September of each year, will proceed to pay the country's pending and demandable financial obligations in the Tuna RFMOs as a country contribution, according to the detail to be elaborated in accordance with the parameters defined in the resolutions in force in each organization, and will keep the Ministry of Agriculture and Livestock duly informed of each disbursement.
From the resources registered by the fund, once the corresponding provisions are made to address the payment of the defined priority commitments, the Minister of Agriculture and Livestock, attending to the technical criterion endorsed by the Council of Experts on Fisheries and Aquaculture Competitiveness established by Executive Decree 35188-MAG, may allocate items or amounts to cover, in whole or in part, the payment of expenses generated by the logistical, technical, or scientific management of national interest developed by the country in application of the resolutions issued within the respective Tuna RFMOs of interest to the country, aimed at facilitating and overseeing the follow-up of regional policies and regulations for the sustainable use of the tuna resource, as well as the costs corresponding to all expenses that must be incurred for participation in working sessions or plenary meetings convened within the framework of the activity developed by the aforementioned Tuna RFMOs, through the Commissioners whom, in accordance with current regulations, the Executive Branch designates, as well as to attend to the fulfillment of the complementary objectives and purposes set forth herein."
