7788, is the body of the National System of Conservation Areas responsible for the administration of the Cocos Island Marine Conservation Area (Área de Conservación Marina Isla del Coco).

Of the Purposes

a. Integrate the different sectors of society, public and private, in order to promote activities for the conservation of natural resources and socio-cultural development in the environment of the ACMIC.

b. Coordinate with the different sectors of society, municipalities, public institutions, non-governmental organizations, in order to promote activities that contribute to the protection of marine and terrestrial resources in the protected area of the ACMIC.

c. Guarantee the efficiency and effectiveness of the conservationist and administrative management of the ACMIC in accordance with environmental and public administration legislation.

d. Promote, publicize, and defend the interests of the ACMIC in all instances, both nationally and internationally.

Of the Administrative Structure

Of the Assembly

They will be chaired by the President of the Council and in their absence by the Vice President. The quorum on first call shall be 51% of those accredited at the set time and on second call with the members present thirty minutes later.

The institutional or organizational alternate shall represent the principal with full voice and vote rights, in their absence, both in the assemblies and in the Board of Directors, in the event of being elected.

It shall be the responsibility of the Executive Secretary (Secretario Ejecutivo) to make the respective call.

Each entity shall report in a signed and sealed document the names, qualifications, and positions of the representatives; this accreditation shall be valid for two years and must be renewed for each Annual Assembly. The accreditation of Assembly Members shall be done before the Executive Secretariat of the Council, represented by the Directorate of the ACMIC.

a. Appoint the members of the Board of Directors (Junta Directiva) and the Oversight Officer (Fiscal).

b. Hear and approve the annual report of the Board of Directors (Junta Directiva) and of the Oversight Office (Fiscalía).

c. Hear and approve specific matters submitted to the Board of Directors (Junta Directiva).

d. Stay informed about the activities carried out by the Board of Directors (Junta Directiva) and the ACMIC.

e. Propose policies, plans, and projects of interest to the ACMIC and the Region.

Of the Board of Directors

1. The Board of Directors shall be composed of seven members, with voice and voting rights, and an oversight officer (fiscal). Five of its members and the oversight officer are elected by simple majority in the General Assembly (Asamblea General) every four years and shall serve for the period of time according to Article 12 of this Regulation, and may be reelected only once. The Director of the ACMIC shall permanently exercise the Executive Secretariat (Secretaría Ejecutiva).

2. The representative of the Municipality of Puntarenas shall be designated by agreement of the Municipal Council and not by the Assembly.

3. In the first session of the Regional Council (Consejo Regional), a Board of Directors (Junta Directiva) shall be formed consisting of a President, a Vice President, a Treasurer, a Secretary, two Vocal Members, and an Oversight Officer (Fiscal), whose functions are:

President: Preside over the Assemblies and sessions of the Board; represent the Council in the internal activities of the ACMIC and in those projecting the Conservation Area in the Region, as well as before public and private entities; ensure that the Regional Council complies with the policies, laws, and regulations related to its function, as established by the legal and technical framework binding on SINAC; render reports to the Regional Council when required and sign the minutes of the Regional Council. In their absence, they shall be represented by the vice president; in the event that the latter is also absent, they shall be represented by the I Vocal Member and ultimately by the II Vocal Member.

Vice President: Shall exercise, in the absence of the president, the same functions as the latter.

Secretary: Collaborate with the Executive Secretariat (Secretaría Ejecutiva); contribute to the calls for meetings that are required; maintain permanent communication with the local councils and other members of the CORAC and contribute to the drafting of the minutes.

Treasurer: Review the annual budget of the Regional Council (Consejo Regional) based on the Work Plan and submit it to the Directorate upon prior approval of the Board of Directors (Junta Directiva). Maintain a record of expenses and provide a quarterly report to the Board of Directors and an annual report to the assembly of the CORACMIC. As well as matters related to Article 30, subsection 5 of the Biodiversity Law.

Vocal Members: In descending order, they shall substitute for the other directors in their absence, join the committees, and represent the Regional Council (Consejo Regional) and the ACMIC in any function assigned to them.

4. The Board of Directors (Junta Directiva) of CORACMIC shall meet ordinarily at least once a month and extraordinarily when the Presidency or 51% (fifty-one percent) of the members so request of the Executive Secretary (Secretario Ejecutivo). The call shall be made by the Executive Secretary of the CORACMIC as provided in Article 40 of the Regulation to the Biodiversity Law. The calendar and time of the sessions shall be defined in the first session. The agenda shall be prepared jointly by the Presidency and the Secretariat and shall be delivered in advance to the Directors. Agreements shall be approved by simple majority and in case of a tie, the President exercises a double vote. Minutes shall be drawn up for each session and shall be reviewed at the next session.

5. Attendance at sessions by all members shall be mandatory.

a. Ensure the application of policies on the matter.

b. Ensure the integration of community needs into the plans and activities of the Conservation Area.

c. Foster the participation of the different sectors of the Area in the analysis, discussion, and search for solutions to regional problems related to natural resources and the environment.

d. Submit to the National Council of Conservation Areas the proposal for the appointment of the Director of the Area, through a shortlist (terna).

e. Approve the strategies, policies, guidelines, directives, plans, and specific budgets of the ACMIC, upon proposal of the Director.

f. Define specific matters for the management of the area and submit them to the National Council for approval.

g. Decide, jointly with the Director of the ACMIC, on the administration of trust funds (fondos patrimoniales), specific donations, and income from the sale of services.

h. Approve the annual budget and the operating regulations for the self-regulating bodies of the Regional Council (Consejo Regional).

i. Coordinate with the different instances of the ACMIC the organization of activities for the conservation of the socio-cultural and natural heritage within the ACMIC and in the region of influence.

j. Motivate the organization of communities and promote the participation of organized groups in the work carried out by the ACMIC.

k. Channel information and promote its dissemination in all spheres of action of the ACMIC.

l. Supervise the work of the Director and the established financial administration body.

m. Approve, in the first instance, matters related to the concessions and service contracts stipulated in Article 39 of the Biodiversity Law.

n. Designate from within its membership a representative to the National Council of Conservation Areas.

o. Foster the participation of representatives of the ACMIC in the Environmental Commissions of the Municipalities of Puntarenas, Quepos, among others.

p. Any other function assigned by national legislation or the National Council.

Of the Council's Oversight Office

In their absence, they shall be represented by the alternate.

a. Present to the Board of Directors (Junta Directiva) of the Regional Council (Consejo Regional) all matters that come to their knowledge that affect the administration of the ACMIC.

b. Submit an annual report to the General Assembly (Asamblea General).

Of the Executive Secretariat

a- Convene ordinary and extraordinary sessions of the Board of Directors (Junta Directiva).

b- Convene the General Assembly (Asamblea General).

c- Draw up the minutes of the sessions of the Regional Council (Consejo Regional) and keep the corresponding minute book updated.

d- Sign the minutes.

e- Keep a file of all documentation issued or sent to the Regional Council (Consejo Regional).

f- Execute, together with the President, the execution of agreements made by the Board of Directors (Junta Directiva).

g- Facilitate the transfer of information throughout the entire structure of the ACMIC.

h- Coordinate the dissemination of activities and information to all bodies of the Council and the member organizations of the Assembly.

i- Keep the Council's file updated, review the minutes prepared by the secretary, and process the respective correspondence.

j- Execute the agreements and resolutions of the CORACMIC.

Final Provisions

De los fines

a. Integrar los diferentes sectores de la sociedad, públicos y privados, con el fin de promover actividades para la conservación de los recursos naturales y el desarrollo socio-cultural en el entorno del ACMIC.

b. Coordinar con los diferentes sectores de la sociedad, municipalidades, instituciones públicas, organizaciones no gubernamentales, con el fin de promover actividades que contribuyan a la protección del recurso marino y terrestre en el área protegida del ACMIC.

c. Garantizar la eficiencia y la eficacia de la gestión conservacionista y administrativa del ACMIC acorde con la legislación ambiental y de la administración pública.

d. Proyectar, promocionar y defender los intereses del ACMIC en todas las instancias, tanto a nivel nacional como internacional.

De la asamblea

Serán presididas por el Presidente del Consejo y en su ausencia por el Vicepresidente. El quórum en primera convocatoria será del 51% de los acreditados a la hora fijada y en segunda convocatoria con los miembros presentes treinta minutos después.

El suplente institucional u organizacional representará al titular con derecho a voz y voto, en su ausencia, tanto en las asambleas, como en la Junta Directiva, en caso de ser electo.

Corresponderá al Secretario Ejecutivo realizar la respectiva convocatoria.

Cada entidad reportará en documento firmado y sellado, los nombres, calidades y posiciones de los representantes, ésta tendrá vigencia de dos años, debiendo ser renovada para cada Asamblea Anual. La acreditación de los Asambleístas se hará ante la Secretaría Ejecutiva del Consejo, representada por la Dirección del ACMIC.

a. Nombrar a los miembros de la Junta Directiva y al Fiscal.

b. Conocer y aprobar el informe anual de la Junta Directiva y de la Fiscalía.

c. Conocer y aprobar asuntos específicos que someta a la Junta Directiva.

d. Mantenerse informada sobre las actividades que realiza la Junta Directiva y el ACMIC.

e. Proponer políticas, planes y proyectos de interés para el ACMIC y para la Región.

De la junta directiva

1. La Junta Directiva estará integrada por siete miembros, con derecho a voz y voto y un fiscal. Cinco de sus miembros y el fiscal, electos por mayoría simple en la Asamblea General cada cuatro años y durarán en su función el periodo de tiempo según el artículo 12 del presente Reglamento, podrán ser reelectos una sola vez. El Director (a) del ACMIC ejercerá la Secretaría Ejecutiva permanentemente.

2. El representante de la Municipalidad de Puntarenas será designado por acuerdo del Consejo Municipal y no por la Asamblea.

3. En la primera sesión del Consejo Regional se integrará una Junta Directiva formada por un Presidente (a), un Vicepresidente (a), un Tesorero(a), un Secretario (a), dos Vocales y un (a) Fiscal, cuyas funciones son:

Presidente(a): Presidir las Asambleas y las sesiones de la Junta; representar al Consejo en las actividades internas del ACMIC y en las de proyección del Área de Conservación en la Región, así como ante los entes públicos y privados; velar porque el Consejo Regional cumpla las políticas, leyes y reglamentos relativos a su función, según lo establece el ordenamiento jurídico y técnico vinculante al SINAC; rendir informes al Consejo Regional, cuando sean requeridos y firmar las actas del Consejo Regional. En su ausencia será representado por el vicepresidente, en caso de que éste también se encuentre ausente será representado por el I vocal y en último caso por el II vocal.

Vicepresidente(a): Ejercerá, en ausencia del presidente las mismas funciones que éste.

Secretario(a): Colaborar con la Secretaría Ejecutiva; contribuir en las convocatorias que se requieran; mantener una permanente comunicación con los consejos locales y demás integrantes del CORAC y contribuir en la elaboración del acta.

Tesorero(a): Revisar el presupuesto anual del Consejo Regional en función del Plan de Trabajo y presentarlo a la Dirección previa aprobación de la Junta Directiva. Mantener un registro de gastos y brindar un informe trimestral a la Junta Directiva y anual a la asamblea del CORACMIC. Así como lo referente al artículo 30, inciso 5 de la Ley de Biodiversidad.

Vocales: En su orden descendente suplirán a los demás directivos en su ausencia, integrarán las comisiones y representarán al Consejo Regional y al ACMIC en cualquier función que se les asigne.

4. La Junta Directiva de CORACMIC se reunirá ordinariamente al menos una vez al mes y extraordinariamente cuando la Presidencia o el 51% (cincuenta y uno por ciento) de los miembros así lo soliciten al Secretario Ejecutivo. La convocatoria será realizada por el Secretario Ejecutivo del CORACMIC según lo dispone el artículo 40 del Reglamento a la Ley de Biodiversidad. El calendario y hora de las sesiones se definirán en la primera sesión. La agenda la elaborarán en forma conjunta la Presidencia y la Secretaría y se entregará con anticipación a los Directivos. Los acuerdos se aprobarán por mayoría simple y en caso de empate el Presidente ejerce el doble voto. Para cada sesión se levantará un acta que se revisará en la sesión siguiente.

5. La asistencia a las sesiones por parte de todos los miembros será obligatoria.

a. Velar por la aplicación de las políticas en la materia.

b. Velar por la integración de las necesidades comunales en los planes y actividades del Área de Conservación.

c. Fomentar la participación de los diferentes sectores del Área, en el análisis, la discusión y la búsqueda de soluciones para los problemas regionales relacionados con los recursos naturales y el ambiente.

d. Presentar al Consejo Nacional de Áreas de Conservación la propuesta para el nombramiento del Director(a) del Área, mediante una terna.

e. Aprobar las estrategias, las políticas, los lineamientos, las directrices, los planes y los presupuestos específicos del ACMIC, a propuesta del Director.

f. Definir los asuntos específicos para el manejo del área y someterlos al Consejo Nacional para su aprobación.

g. Decidir, conjuntamente con el Director del ACMIC, sobre la administración de los fondos patrimoniales, donaciones específicas y los ingresos provenientes de la venta de servicios.

h. Aprobar el presupuesto anual y los reglamentos de funcionamiento para los organismos propios del Consejo Regional.

i. Coordinar con las diferentes instancias del ACMIC la organización de actividades para la conservación del patrimonio socio-cultural y natural dentro del ACMIC y en la región de influencia.

j. Motivar la organización de las comunidades y promover la participación de grupos organizados en las labores que desarrolla el ACMIC.

k. Canalizar información y promover su divulgación en todas las esferas de acción del ACMIC.

l. Supervisar la labor del Director y del órgano de administración financiera establecidos.

m. Aprobar, en primera instancia, lo referente a las concesiones y contratos de servicios que estipula el artículo 39 de la Ley de Biodiversidad.

n. Designar de su seno a un representante ante el Consejo Nacional de Áreas de Conservación.

o. Propiciar la participación de representantes del ACMIC en las Comisiones Ambientales de las Municipalidades de Puntarenas, Quepos, entre otras.

p. Cualquier otra función que le asigne la legislación nacional o el Consejo Nacional.

De la Fiscalía del Consejo

En su ausencia será representado por el suplente.

a. Presentar a la Junta Directiva del Consejo Regional todos los asuntos que sean de su conocimiento, que afecten la administración del ACMIC.

b. Entregar un informe anual a la Asamblea General.

De la secretaría ejecutiva

a- Convocar las sesiones ordinarias y extraordinarias de la Junta Directiva.

b- Convocar a la Asamblea General.

c- Levantar las actas de las sesiones del Consejo Regional y llevar actualizado el correspondiente libro de actas.

d- Firmar las actas.

e- Llevar un archivo de toda la documentación que emita o se envíe al Consejo Regional.

f- Ejecutar en conjunto con el Presidente la ejecución de los acuerdos tomados por la Junta Directiva.

g- Facilitar la transferencia de información entre toda la estructura del ACMIC.

h- Coordinar la divulgación de actividades e información a todos los órganos del Consejo y a las organizaciones integrantes de la Asamblea.

i- Mantener actualizado el archivo del Consejo, revisar las actas elaboradas por el secretario y tramitar la correspondencia respectiva.

j- Ejecutar los acuerdos y resoluciones del CORACMIC.
