in the entirety of the text - Full Text of Standard 35067 Declaration of Regional Health Emergency (animal and phytosanitary health emergency) Full Text of record: F3C9C No. 35067-MAG-H No. 35067-MAG-H (This executive decree was repealed by Article 1 of Executive Decree No. 37947 of July 18, 2013) THE PRESIDENT OF THE REPUBLIC AND THE MINISTERS OF AGRICULTURE AND LIVESTOCK AND OF FINANCE Exercising the powers granted in Articles 140, subsections 3), 8), 18), and 20) and 146 of the Political Constitution; Articles 25, 27.1, 28.2.b) of Law No. 6227 of May 2, 1978, General Law of Public Administration; Law No. 8495 of April 6, 2006, Law of the National Animal Health Service; Law No. 7664 of April 8, 1997, Phytosanitary Protection Law.
1st—That on the occasion of the earthquake that occurred at thirteen hours twenty-two minutes on the eighth of January of this year, with its epicenter in the Central Volcanic Mountain Range Zone, a state of emergency was declared in the cantons of Alajuela, Grecia, Poás, Alfaro Ruiz, and Valverde Vega in the province of Alajuela and the cantons of Heredia, Barva, Santa Bárbara, and Sarapiquí in the province of Heredia.
2nd—That said emergency declaration encompasses all actions necessary for the attention, response, rehabilitation, reconstruction, and replacement of infrastructure, housing, agriculture, and in general all damaged public services.
3rd—That as a result of the earthquake, the damage in the Agricultural Sector has been substantial, and it is necessary to take urgent measures to assist the affected production units, their animals, and their production systems.
4th—That likewise, on the occasion of the earthquake, domestic and wild animals have been left vulnerable, requiring attention in order to prevent Public Health from being exposed to disease risks due to their neglect.
5th—That both the National Animal Health Service and the State Phytosanitary Service, both deconcentrated bodies of the Ministry of Agriculture and Livestock, in their corresponding constitutive laws contain instruments to be applied in times of emergency and are therefore called upon to carry out actions of immediate response, rehabilitation, and reconstruction of activities related to the Agricultural Sector, its processes, its productive animals and plants, and regarding the management of domestic and wild animals that have been left at risk and could potentially affect Public Health.
6th—That the magnitude of the catastrophe requires, for its proper attention, especially during the rehabilitation and reconstruction stages, reinforcing the necessary existing infrastructure and services in the cantons declared in a state of emergency in order to adequately meet the demands that different stakeholders place upon it and for the State to be capable of providing effective responses to said demands for support and services.
