Considering:
7554, in its Article 35 on the creation, conservation, administration, development, and surveillance of protected areas, indicates as one of its objectives, to "Protect and improve aquifer zones and watersheds, to reduce and avoid the negative impact that their poor management can cause."
Likewise, to establish guidelines for territorial planning (ordenamiento territorial) and urban development, so that the development and reorganization of cities is promoted, through the intensive use of urban space, in order to free up and conserve resources for other uses or for future residential expansion.

103-2007, held on July 9, 2007, the Municipal Council of San Rafael de Heredia agreed not to grant permits for any type of urban development within the territorial jurisdiction of the canton of San Rafael de Heredia, that are included within the area covered by Decree Law LXV of 1888 of July 28, 1888 and proceeds to issue instructions to the Administration for the Municipal Engineering Department to apply all existing regulations in environmental matters and apply the law as appropriate.
It includes the four main provinces: Alajuela, Heredia, San José, and Cartago. Surrounding this area is the Special Protection Zone; a ring of 152,000 hectares, containing national parks, aquifer protection zones, valuable agricultural lands, and an excellent dairy cattle herd.
10.-That municipalities are the institutions that are closest to the citizen and that by constitutional mandate are responsible for the administration of cantonal interests and services, therefore, they need to strengthen their planning and resource management schemes. This is extremely important in the current situation, given the interest that the Government is showing in allocating more resources for cantonal infrastructure works.
11.-That urban growth turns out to be an inevitable phenomenon inherent to the human being, typical of the natural desire for progress of a people and its solidary objective of achieving a better quality of life for the greatest number of its members. However, as it is also inevitable that this phenomenon produces an impact on nature, it is a legal, moral, and common-interest obligation that this development be planned, foreseen, and organized in such a way that it can occur in an orderly, safe, sustainable manner and therefore with the least possible consequence to the environment, so as to achieve the intended objective of progress and development, but at the same time ensuring a healthy and ecologically balanced environment for future generations. Therefore:
The Municipal Council of San Rafael de Heredia, aware that the basis supporting the responsibility of local governments in matters of planning is contained, among others, in the Political Constitution of the Republic, the Municipal Code, the Organic Laws of the Environment, of Urban Planning, and of Constructions, and Decree No. 25902 MIVAH-MP-MINAE, agrees:

Aware of the responsibility that the Municipality has to make decisions and to guide its inhabitants towards a true local development, which meets the necessary conditions of safety, health, comfort, and beauty in its public roads, buildings, and constructions.
This Municipal Policy comes into effect upon its publication in the Official Gazette La Gaceta.

Considerando:
Por su parte, el artículo 46 de la Carta Magna establece que "los consumidores y usuarios tiene derecho a la protección de su salud, ambiente, seguridad e intereses económicos y a recibir información adecuada y veraz: a la libertad de elección y a un trato equitativo."
Asimismo, para establecer directrices para el ordenamiento territorial y el desarrollo urbanístico, de manera que se promueva el desarrollo y el reordenamiento de las ciudades, mediante el uso intensivo del espacio urbano, con el fin de liberar y conservar recursos para otros usos o para expansión residencial futura.
Incluye las cuatro principales provincias: Alajuela, Heredia, San José y Cartago. Circundante a esta área se encuentra la Zona Especial de Protección; un anillo de 152.000 hectáreas, que contiene parques nacionales, zonas de protección de acuíferos, valiosas tierras agrícolas y un excelente hato de producción lechera.
10.-Que las municipalidades son las instituciones que están más cerca del ciudadano y que por mandato constitucional les corresponde la administración de los intereses y servicios cantonales, por tanto, requieren fortalecer sus esquenas de planificación y gestión de los recursos. Esto es sumamente importante en la coyuntura actual, dado el interés que está mostrando el Gobierno en asignar mayores recursos para obras de infraestructura cantonal.
11.-Que el crecimiento urbano resulta ser un fenómeno inevitable e inherente al ser humano, propio del natural afán de progreso de un pueblo y de su objetivo solidario de lograr una mayor calidad de vida para el mayor número de sus integrantes. No obstante, al ser también inevitable que este fenómeno produzca un impacto en la naturaleza, es una obligación legal, moral y de interés común, que ese desarrollo sea planeado, previsto y planificado de forma tal que pueda darse de una manera ordenada, segura, sostenible y por ende con la menor consecuencia posible al medio ambiente, de manera que permita lograr el pretendido objetivo de progreso y desarrollo, pero al mismo tiempo asegurando un ambiente sano y ecológicamente equilibrado para las futuras generaciones. Por tanto:
El Concejo Municipal de San Rafael de Heredia, conciente que la base que sustenta la responsabilidad de los gobiernos locales en materia de la planificación, está contenida, entre otros, en la Constitución Política de la República, el Código Municipal, las Leyes Orgánicas del Ambiente, de Planificación Urbana y de Construcciones y el Decreto Nº 25902 MIVAH-MP-MINAE, acuerda:

Concientes de la responsabilidad que tiene la Municipalidad de tomar decisiones y de orientar a sus habitantes hacia un verdadero desarrollo local, que reúna las condiciones necesarias de seguridad, salubridad, comodidad y belleza en sus vías públicas, en los edificios y construcciones.
Esta Política Municipal rige a partir de su publicación en el Diario Oficial La Gaceta.
