4760 of May 4, 1971, establishes in its article 2 the purpose of solving the problem of extreme poverty in the country and in its article 4, within its founding purposes, it states "to meet the needs of social groups or of persons who must be provided with means of subsistence when they lack them."
article 4 of the Regulation for the Provision of Services and the Granting of Benefits of the Joint Institute for Social Aid, published in La Gaceta No. 102 of May 29, 2000, defines the concept of poverty as: "A complex phenomenon or situation of a temporary or structural nature (índole coyuntural o estructural), multifaceted and heterogeneous, that affects persons and is characterized by their precarious housing and sanitary conditions, low educational levels, unstable insertion in the productive system, conditions of social risk, with little or no incorporation into mechanisms of social participation, insufficient resources to satisfy basic nutritional, health, education and housing needs and in some cases absence or insufficiency of skills, aptitudes, tools and opportunities to generate and accumulate income."

10.-That the closed season period (período de veda) causes a situation of temporary poverty (pobreza coyuntural) among fishermen due to the lack of income from this source. Therefore,
Decree:
A.J.D.I.P./137-2008 of INCOPESCA shall be beneficiaries of IMAS resources.
Said list shall contain the following minimum requirements:
Said subsidy shall be issued in two events or installments (tractos), as follows:
IMAS professionals shall be empowered to request from potential beneficiaries the requirements established in article 4 of this decree and shall not require that they be registered in the Target Population Information System (Sistema de Información de la Población Objetivo) (SIPO). However, if from the information contained in said system or from other means it is evident that the potential beneficiaries or their families have other income, from salaries, remunerated activities, rent or others, IMAS may deny the granting of the benefit.
Said information shall be sent to IMAS, within the first five business days of the month of June and October respectively of 2008.
INCOPESCA shall communicate to the respective Regional Management (Gerencia Regional) of IMAS, within a period not exceeding three business days, the name of those persons who fail to comply with this condition, as well as those who carry out actions that contravene the closed season declaration (declaratoria de veda) or who have supplementary income. In these cases, the authorized benefit shall be revoked, after compliance with due process (debido proceso).

Los profesionales del IMAS estarán facultados para solicitar a los potenciales beneficiarios los requisitos establecidos en el artículo 4º del presente decreto y no requerirán que los mismos se encuentren registrados en el Sistema de Información de la Población Objetivo (SIPO). No obstante, si de la información contenida en dicho sistema o de otros medios se desprende que los potenciales beneficiarios o sus familias cuentan con otros ingresos, proveniente de salarios, actividades remuneradas, renta u otros el IMAS podrá denegar el otorgamiento del beneficio.
Dicha información será remitida al IMAS, dentro de los primeros cinco días hábiles del mes de junio y octubre respectivamente del 2008.
INCOPESCA comunicará a la Gerencia Regional respectiva del IMAS, en un plazo no mayor de tres días hábiles, el nombre de aquellas personas que incumplan esta condición, así como aquellos que ejecuten acciones que contravengan la declaratoria de veda o que posea ingresos complementarios. En estos casos se procederá a la revocatoria del beneficio autorizado, previo cumplimiento del debido proceso.
