1. In the case of works for cantonal development and public interest, the Executive Branch shall grant exploitation authorizations for non-metallic materials to the municipalities.
2. The application for an exploitation authorization for non-metallic materials by the municipalities must be submitted to the National Mining Registry of the Directorate of Geology and Mines of the Ministry of Environment and Energy, which, once received, shall record the date and time of receipt and assign an expediente number. Once the requirements are completed and the application is accepted as provided in this decree, the Directorate of Geology and Mines shall issue a recommendation to grant the authorization to the Minister of Environment and Energy, who in turn shall forward it to the Presidency of the Republic. The authorization shall be issued by the Executive Branch.
3. The application must be signed by the Mayor and must contain:
- a)Sketch of the area on a faithful and legible copy of the National Geographic Institute (IGN) sheet, scale 1:50,000, Lambert projection, size 22 X 27 cm (8 ½ X 11) with the cartographic coordinates on the margins and the names of the sheets clearly stated. If the area is located on two or more cartographic sheets, they must be joined respecting the aforementioned size.
- b)In the case of quarries, permission from the property owner must be provided, accompanied by a property registry or notarial certification. Cadastral plan of the parent property locating the site of interest and topographic plan of the area to be exploited. In the case of extraction of materials in public-domain watercourses, indication of the access route to the river and, if said route is private, present the owner's permission and certification of ownership, whether notarial or issued by the Public Registry. If the route is public, the Topographic Engineer must state this situation on the corresponding plan.
- c)Work plan prepared by a geologist or mining engineer, containing:
1. Extraction methods and system to be used.
2. Description of the equipment to be used and characteristics of the machinery.
3. Exploitation period.
4. Lithologies to be utilized, calculation of available reserves at the source, and volume of material required.
5. Destination of the material.
- d)Resolution of environmental viability (viabilidad ambiental) issued by the National Environmental Technical Secretariat (SETENA).
- e)Fax number for receiving notifications.
4. Upon receipt of the application, the National Mining Registry of the Directorate of Geology and Mines shall verify that the requirements are submitted completely and correctly. If it is necessary for the municipality to correct an error or complete the requirements, the National Mining Registry of the Directorate of Geology and Mines shall, by resolution, give a single warning identifying the error or missing requirement, granting the applicant municipality a period of twenty business days. If the required documentation is not submitted within the granted period, or if it is submitted again incomplete or incorrect, the Directorate of Geology and Mines shall archive the application.
5. Once the application is received completely and correctly, the Directorate of Geology and Mines must, within one month, forward its recommendation to the Minister of Environment and Energy.
