1. 1That in accordance with Law No. 7384, Law for the Creation of INCOPESCA and Law No. 8436, Fisheries and Aquaculture Law, it is the responsibility and competence of INCOPESCA to control fishing and the hunting of marine species in jurisdictional waters, as provided in Article 6 of the Political Constitution, and to regulate the rational use of fishery resources with the aim of protecting and maintaining their sustainability.
2. 2That according to studies conducted by researchers from the Universidad Nacional de Costa Rica (UNA), the sardine fishery reached its maximum yield in 1976, when 7590 metric tons (Tm) were caught while 9 vessels were operating at that time, a period after which catches decreased abruptly, reaching approximately 1,000 metric tons (Tm) in 1983.
3. 3That despite the fact that only two purse-seine (red de cerco) sardine vessels have been operating in the last 8 years, it has also been observed that catches of this resource continue to decrease significantly along the entire Costa Rican Pacific coastline and very especially within the Gulf of Nicoya, making it necessary to take the pertinent measures to allow its recovery.
4. 4That as a result of the decrease in catches of this resource, the companies owning the vessels with a current commercial fishing license for the extraction of sardine with purse seine (red de cerco), in turn have experienced an increase in their operating costs, and in view of this situation, they have been implementing the practice of product transshipment, thereby allowing the fishing vessel a longer stay on the fishing grounds (caladeros de pesca).
5. 5That due to the aspects indicated above regarding this fishery, it is not advisable to allow this type of practice; otherwise, by not restricting it, an increase in fishing effort would be encouraged on a resource that is in a rather delicate state and that could result in greater harm to the biology and population dynamics of said fishery. Therefore,

IT IS AGREED:

To prohibit the transshipment of sardine along the entire Costa Rican Pacific coastline from one vessel to another, except in those exceptional cases duly justified before the Board of Directors and for which a prior technical recommendation authorizing it must be obtained.

Considering:

1. 1Que de conformidad con la Ley Nº 7384, Ley de Creación del INCOPESCA y la Ley Nº 8436, Ley de Pesca y Acuicultura, es atribución y competencia del INCOPESCA controlar la pesca y la caza de especies marinas, en las aguas jurisdiccionales, conforme a lo dispuesto en el artículo 6º de la Constitución Política y normar el aprovechamiento racional de los recursos pesqueros con el afán de proteger y mantener su sostenibilidad.
2. 2Que de acuerdo con estudios realizados por investigadores de la Universidad Nacional de Costa Rica (UNA) la pesquería de la sardina alcanzó su máximo rendimiento en el año 1976 en el que se capturaron 7590 Tm cuando en aquel entonces operaban 9 embarcaciones, período después del cual las capturas disminuyeron abruptamente hasta alcanzar cerca de las 1.000 Tm en el año 1983.
3. 3Que a pesar de que en los últimos 8 años han venido operando únicamente dos embarcaciones sardineras con red de cerco, igualmente se ha venido observando que las capturas de dicho recurso continúan disminuyendo significativamente en todo el litoral pacífico costarricense y muy especialmente dentro del Golfo de Nicoya, por lo que se hace necesario tomar las medidas pertinentes que permitan su recuperación.
4. 4Que como resultado de la disminución de las capturas de ese recurso, las empresas propietarias de las embarcaciones con licencia de pesca comercial vigente para la extracción de sardina con red de cerco, a su vez han experimentado un aumento en sus costos de operación y ante tal situación, han venido implementando la práctica del trasbordo de producto permitiéndole de esta manera a la embarcación pesquera una mayor permanencia en los caladeros de pesca.
5. 5Que por los aspectos indicados anteriormente en cuanto a esta pesquería, no es conveniente permitir ese tipo de práctica, caso contrario de no restringirse se estaría propiciando un aumento del esfuerzo pesquero sobre un recurso que se encuentra en un estado bastante delicado y que podría resultar en un perjuicio mayor sobre la biología y la dinámica poblacional de dicha pesquera. Por tanto,

SE ACUERDA:

Prohibir el trasbordo de sardina en todo el litoral pacífico costarricense de una embarcación a otra, salvo en aquellos casos excepcionales debidamente justificados ante la Junta Directiva y para lo cual deberá contarse de previo con una recomendación técnica que lo autorice.
