Complete Text of Act: 79742 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP-386.-Puntarenas, on the twenty-seventh day of August, two thousand four.

1. 1That through Board of Directors agreements AJDIP/318-2004 and 319-2004, modifications to the Fuel Regulation adopted by means of Agreement AJDIP/258-2002 were approved. 2º-That in parallel, the Fuel Commission has undertaken the task of carrying out the corresponding training on the respective Fuel Instruction Manual for the officials of the various institutional offices.
2. 3That while it is true that the internal training has been carried out successfully, this is not yet the case with respect to the fishing sector regarding the new guidelines to be followed in terms of fuel processing.
3. 4That while it is true that agreements AJDIP/318-2004 and AJDIP/319-2004 established a deadline for their entry into force, this Board of Directors considers it convenient, for the purpose of the coordination that must exist between the Institute and the sector, so that the latter has sufficient information on the procedure to be followed. 5º-That due to a clerical error (error material), it was established in agreement AJDIP/318-2004 that the first paragraph is modified, the correct wording being, "modification of the second paragraph," for which reason it is necessary to make the respective clarification. Therefore:

It is agreed:

1. 1That in accordance with the considerations noted and with the aim that the fishing sector clearly knows the guidelines to follow established in the Fuel Instruction Manual, to establish the effective date of agreements AJDIP/318-2004 and AJDIP/319-2004, as of October 1, 2004.

2º-To correct Article 1 of agreement AJDIP/318-2004, so that it is read henceforth as follows:

"Article 1.-To modify the second paragraph of Article 11 of the Fuel Regulation, issued through agreement AJDIP/258-2002 of September 12, 2002, so that it reads as follows:

"For vessels of the small-scale artisanal fleet (flota artesanal en pequeña escala), the application shall be received during the first ten days following the last previous voyage(s), for which a maximum of 25 days of absence shall be recognized." 3º-Let it be published. Final Agreement (Acuerdo Firme) Puntarenas, October 19, 2004.

Considering:

Texto Completo acta: 79742 INSTITITO COSTARRICENSE DE PESCA Y ACUACULTURA INSTITITO COSTARRICENSE DE PESCA Y ACUACULTURA AJDIP-386.-Puntarenas, a los veintisiete días del mes de agosto del dos mil cuatro.

1. 1Que mediante acuerdos de Junta Directiva AJDIP/318-2004 y 319-2004, se aprobaron modificaciones al Reglamento de Combustible adoptado por medio del Acuerdo AJDIP/258-2002. 2º-Que de manera paralela la Comisión de combustible se ha dado a la tarea de efectuar la correspondiente capacitación del respectivo Instructivo de Combustible a los funcionarios de las distintas oficinas institucionales.
2. 3Que si bien es cierto se ha llevado a cabo con buen suceso la capacitación interna, no aún en lo que respecta al sector pesquero sobre las nuevas pautas a seguir en cuanto a la tramitación de combustible se refiere.
3. 4Que si bien es cierto los acuerdos AJDIP/318-2004 y AJDIP/319-2004 estableció plazo para su entrada en vigencia, considera conveniente esta Junta Directiva, que al efecto de la coordinación que debe existir entre el Instituto y el sector, de manera que éste cuente con la suficiente información sobre el procedimiento a seguir. 5º-Que debido a un error material, se estableció en el acuerdo AJDIP/318-2004, que se modifica el párrafo primero, siendo lo correcta, "modificación del párrafo segundo", por lo cual se hace necesario realizar la aclaración respectiva. Por tanto:

Se acuerda:

1. 1Que de conformidad con las consideraciones anotadas y con el afán de que el sector pesquero conozca claramente las pautas a seguir establecidas en el Instructivo de Combustible, establecer la vigencia de los acuerdos AJDIP/318-2004 y AJDIP/319-2004, a partir del 01 de octubre del 2004.

2º-Corregir el Artículo 1, del acuerdo AJDIP/318-2004, para que en lo sucesivo se lea de la siguiente manera:

"Artículo 1º-Modificar el párrafo segundo del artículo 11, del Reglamento de Combustible, emitido mediante acuerdo AJDIP/258-2002, del 12 de setiembre del 2002, para que se lea de la siguiente manera:

"Para las embarcaciones de la flota artesanal en pequeña escala la solicitud se recibirá durante los primeros diez días posteriores al último viaje (es) anteriores, para lo que se reconocerá un máximo de 25 días de ausencia".

3º-Publíquese. Acuerdo Firme Puntarenas, 19 de octubre del 2004.
