in the entirety of the text - Complete Text of Regulation 31632 Grants a deadline to the State Forestry Administration to conduct an audit of forest inventory permits granted from January 1 to October 29, 2003, and maintains a 90-day restriction on tree felling Complete Text Record: 718E5 No. 31632-MINAE-MP No. 31632-MINAE-MP THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF ENVIRONMENT AND ENERGY, AND THE MINISTER OF THE PRESIDENCY Based on the principles and objectives established in Article 50 of the Political Constitution and in exercise of the powers conferred by subsections 3) and 18) of Article 140 and Article 146 of the Political Constitution, the provisions of Articles 2, 3, and 9 of the Emergency Law No. 7914, published in Supplement No. 78 to La Gaceta No. 199 of Wednesday, October 13, 1999, the provisions of the Forestry Law (Ley Forestal) No. 7575, published in Supplement No. 21 to La Gaceta No. 72 of Tuesday, April 16, 1996, and the Biodiversity Law (Ley de Biodiversidad) No. 7788, published in La Gaceta No. 101, of Wednesday, May 27, 1998.
1.-That the Forestry Law (Ley Forestal) No. 7575, in its Article One, establishes as an essential and priority function of the State, to ensure the conservation, protection, and administration of natural forests and the production, utilization, industrialization, and promotion of the country's forest resources destined for this purpose, in accordance with the principle of adequate and sustainable use of renewable natural resources.
2.-That the Emergency Law No. 7914 is the agile and effective legal framework to confront emergency situations or prevent them in order to safeguard the life, physical integrity, and property of the country's inhabitants, in whose application the principles of rationality, proportionality, urgent need, and solidarity shall be taken into account, and the Executive Branch may decree temporary restrictions on land use, in order to avoid greater disasters, among other things.
3.-That the Executive Branch, by means of Executive Decree (Decreto Ejecutivo) No. 30866-MP, declared a state of emergency in all the cantons of the province of Limón, the following cantons of the province of Cartago:
Cartago, Paraíso, Turrialba, Oreamuno, Alvarado, and Jiménez, the cantons of Sarapiquí and San Isidro of the province of Heredia, and the canton of San Carlos of the province of Alajuela, due to the effects caused by the heavy rainfall occurring in certain sectors of these locations.
4.-That the Executive Branch, by means of Executive Decree (Decreto Ejecutivo) No. 31332-MINAE-MP, published in La Gaceta No. 166 of August 29, 2003, established a series of measures to restrict for a period of five months the administrative processing and approval of cutting authorizations in the area declared an emergency in Executive Decree No. 30866-MP.
5.-That it was technically and administratively impossible for the State Forestry Administration (Administración Forestal del Estado), to determine, within a period of five months, the degree of incidence of forestry activity in the area declared an emergency, regarding the atmospheric phenomena that affected said territories.
6.-That despite the fact that through official communication SINAC-DS 987, of October 29, 2003, the Senior Director of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación), issued the necessary instructions, in order to unify internal procedures for the adequate fulfillment of what is stipulated in Executive Decree No. 31332-MINAE-MP, published last August 29 in La Gaceta No. 166, reasons of force majeure, among which logistical aspects, regulatory, budgetary, and even climatic conditions can be cited, prevented the State Forestry Administration from conducting the audit of valid permits in the areas declared an emergency, as indicated by Executive Decree No. 31332-MINAE-MP.
7.-That the use of the forest cover (cobertura boscosa) map for the year 2000, as well as the application of global positioning systems, when processing cutting authorizations in areas that are not forest today, have proven to be efficient instruments for detecting processes of land-use change (cambio de uso de la tierra), in contravention of the provisions of Article 19 of the Forestry Law No. 7575, which expressly establishes the prohibition of land-use change on lands covered by forests, making it essential to make use of modern technologies and instruments to control the process of land-use change.
8.-That the resolution of the Court of Criminal Appeals (Sala de Casación Penal) at 12:00 hours on May eighth, 2003, established the principle of lifetime tenure (irreductibilidad) of forests, which indicates the necessary repair of damages caused to the environment, pointing out the State's responsibility to do everything within its power to recover the forest that has been eliminated through the crime of land-use change, as a measure to guarantee a healthy and balanced environment, in compliance with Article 50 of the Political Constitution. Therefore:
