Complete Text of act: 6BD65 No. 31332-MINAE-MP No. 31332-MINAE-MP THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF ENVIRONMENT AND ENERGY AND THE MINISTER OF THE PRESIDENCY In exercise of the powers conferred in Articles 140, subsections 3) and 18), 146 of the Political Constitution, Articles 2, 3 and 9 of the Emergency Law No. 7914 published in Alcance No. 78 of La Gaceta 199 of Wednesday, October 13, 1999, the Forest Law (Ley Forestal) No. 7575 of April 16, 1996 and the Biodiversity Law No. 7788 of April 30, 1998.
Whereas:
7575 provides that the essential and priority function of the State is to ensure the conservation, protection and administration of natural forests, the utilization, industrialization and promotion of the country's forest resources destined for that purpose, in accordance with the Principle of adequate and sustainable use of renewable natural resources.
7914 is the agile and effective legal framework for facing emergency situations or preventing them with the purpose of safeguarding the life, physical integrity and patrimony of the country's inhabitants, in whose application the Principles of rationality, proportionality, and the Principle of urgent need and that of solidarity shall be taken into account, and the Executive Branch may decree temporary restrictions on land use, in order to avoid greater disasters, among others.
30866-MP, declared a state of emergency in all the cantons of the province of Limón, the following cantons of the Province of Cartago: Cartago, Paraíso, Turrialba, Oreamuno, Alvarado and Jiménez, the cantons of Sarapiquí and San Isidro of the province of Heredia and the canton of San Carlos of the province of Alajuela, due to the climatic phenomena that occurred, which have caused significant precipitation on the Caribbean Slope and Northern Zone of the country, whose direct and indirect effects caused by abundant rains that in turn caused a growth in the river flow and high saturation, causing landslides and floods that resulted in damage to property and persons, in addition to damage to infrastructure, communications and agriculture, putting vital public services at risk.
DECREE:
Likewise in the upper parts of aquifer recharge areas, in the hydrographic watersheds where there are steep slopes greater than 40% and high precipitation, in the area comprising the emergency declaration contained in Executive Decree (Decreto Ejecutivo) No. 30866-MP so that the technical analyses and the diagnosis of the situation are carried out, which will allow determining with better precision the degree of incidence of the forest activity in the area declared in emergency, as well as the corrective measures to prevent and mitigate the adverse effects.
30866-MP, where a natural forest existed in the year 2000, shall cease their felling for a period of five months as a precautionary and preventive measure. However, timber that is legally cut upon the publication of this Decree may be extracted and transported, and the State Forest Administration must corroborate the balance of trees pending felling, for which it must, through the forestry manager (regente forestal), prepare a technical report within a period not exceeding fifteen days from the publication of this Decree, stating the total number of approved trees, the total of felled trees and the number of trees pending felling, which the State Forest Administration must verify by sampling. Once the precautionary measure is lifted, if appropriate, only the felling of the trees indicated in the technical report of the State Forest Administration shall be authorized. Permits that expire during the five-month period, and if it is verified that they comply with the technical and administrative requirements, may be renewed under the conditions and procedures established once the restriction is concluded.
In addition, an exhaustive review of the requirements and procedures, principles and criteria required to grant forest utilization (aprovechamiento forestal) permits must be carried out, as well as adopting the use of technology to georeference the trees to be felled and to establish a control and monitoring system over the use of the forest resource.

Así mismo en las partes altas de recarga acuífera, en las cuencas hidrográficas donde existan fuertes pendientes mayores de 40% y alta precipitación, en el área que comprende la declaratoria de emergencia contenida en el Decreto Ejecutivo Nº 30866-MP a efecto de que se realicen los análisis técnicos y el diagnóstico de la situación, que permitan determinar con mejor precisión el grado de incidencia de la actividad forestal en la zona declarada de emergencia, así como las medidas correctivas para prevenir y mitigar los efectos adversos.
No obstante, la madera que esté legalmente cortada a la publicación del presente Decreto, podrá ser extraída y transportada, debiendo corroborar la Administración Forestal del Estado, el saldo de árboles pendientes de corta, para lo cual deberá por medio del regente forestal, realizar un informe técnico en un plazo no mayor de quince días a la publicación del presente Decreto, donde conste el número total de árboles aprobados, el total de árboles cortados y el número de árboles pendientes de corta, lo que deberá comprobar por muestreo la Administración Forestal del Estado. Además se deberá realizar una revisión exhaustiva de los requisitos y procedimientos, principios y criterios que se exigen para otorgar permisos de aprovechamiento forestal, así como adoptar el uso de tecnología para georeferenciar los árboles a cortar y para establecer un sistema de control y monitoreo sobre el uso del recurso forestal.
