in the entirety of the text - Full Text of Norm 31513 Declares Montaña El Tigre Private National Wildlife Refuge Full Text record: 6FB7E Nº 31513-MINAE Nº 31513-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred by articles 140, subsections 3), 8) and 18) and 146 of the Political Constitution, based on the provisions of articles 82 and 87 of Law Nº 7317, Wildlife Conservation Law, published in La Gaceta Nº 235 of December 7, 1992; articles 15, 80, 81, 88, 102, 103, 104, 105 and 106 of the Regulation to said law, Executive Decree Nº 26435-MINAE, published in La Gaceta Nº 233 of Wednesday, December 3, 1997; Organic Environmental Law, articles 32, 34, 35, 36 and 37; Biodiversity Law, articles 58 and 60; in application of the provisions of articles 6, 9, 11 and 27 of the General Law of Public Administration.

2That within the area subject to the request there exists a large number of faunal resources (insects, mammals, amphibians, birds and reptiles) as well as floristic resources that deserve to be conserved rationally and sustainably, to guarantee their permanence within the ecosystems in which they are currently found.
3That in accordance with article 87 of the Wildlife Conservation Law, the main environmental effect generated by the declaration of a property under this legal regime is that, for the purposes of natural resource conservation, the general administration of the refuge corresponds to the property owners, supervised by the National System of Conservation Areas of the Ministry of Environment and Energy, through the Área de Conservación La Amistad Pacífico, Oficina Subregional de Buenos Aires, the office that will grant prior approval to carry out all those activities that may be desired to be undertaken henceforth within the declared area submitted to the Wildlife Refuge.
4That by means of resolution Nº ACLA-P-D-454 of ten hours, thirty minutes of the seventh of October of two thousand two, the Director of the Área de Conservación La Amistad Pacífico, licensed Gladys De Marco González, accepted the request for voluntary submission made by the President of the company Corporación de Desarrollo Agrícola Del Monte Sociedad Anónima to voluntarily submit to the Private Wildlife Refuge.
5That with the official protection of these ecosystems, the protection and conservation of wildlife species characteristic of these habitats will be achieved, which have great biological and socioeconomic importance, since some are in danger of extinction and due to the current state of natural resources in the area and the national opening towards biodiversity conservation through Protected Wild Areas, their preservation is necessary. 6º-That the rational integrated management of natural resources contributes to satisfying regional needs for research, recreation, environmental education, as well as the utilization of rationally exploited renewable natural resources.
7That the administration of wildlife and the recommendation of measures that ensure the perpetuity of species is a function of the Dirección General de Vida Silvestre of the Ministry of Environment and Energy. Therefore:

1Que la sociedad denominada Corporación de Desarrollo Agrícola Del Monte Sociedad Anónima, cédula jurídica número tres-ciento uno-cero diez mil ochocientos ochenta y dos, representada por el señor Rodrigo Jiménez Rímolo, portador de la cédula de identidad Nº 1-504-185, Vicepresidente con facultades de apoderado generalísimo sin límite de suma de la citada sociedad, cuya personería está vigente e inscrita en la Sección Mercantil del Registro Público al tomo mil trescientos sesenta y uno, folio noventa y nueve, asiento ciento veintiuno, solicitó al Área de Conservación La Amistad Pacífico, Oficina Subregional de Buenos Aires, el sometimiento voluntario al Régimen de Refugios Privados de Vida Silvestre, un inmueble de su propiedad el cual se encuentra inscrito en el Registro Nacional, Folio Real matrícula número ciento quince mil setecientos cincuenta y siete-cero cero cero, sito en el distrito segundo Volcán, cantón tercero Buenos Aires, provincia de Puntarenas, con una superficie de doscientas setenta y tres hectáreas, dos mil ochocientos cincuenta y ocho metros cuadrados con cuarenta y tres decímetros cuadrados, plano catastrado número P-seiscientos siete mil setecientos treinta y uno-dos mil, el cual se somete en su totalidad. La sociedad Corporación de Desarrollo Agrícola Del Monte Sociedad Anónima, aceptó someter voluntariamente al régimen de Refugio de Vida Silvestre Privado, el inmueble dicho por un periodo de diez años, según lo establece el artículo 102, inciso f), del Reglamento a la Ley de Conservación de Vida Silvestre, prorrogables en forma automática salvo su previa manifestación o de la administración que exprese lo contrario.
2Que dentro del área objeto de la solicitud existe un gran número de recursos faunísticos (insectos, mamíferos, anfibios, aves y reptiles) así como recursos florísticos que merecen ser conservados racional y sosteniblemente, para garantizar su permanencia dentro de los ecosistemas en que actualmente se encuentran.
3Que de conformidad con el artículo 87 de la Ley de Conservación de la Vida Silvestre, el principal efecto ambiental que genera la declaratoria de un inmueble bajo este régimen jurídico lo es, que para los efectos de la conservación de los recursos naturales la administración general del refugio corresponde a los propietarios del inmueble, supervisada por el Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía, a través del Área de Conservación La Amistad Pacífico, Oficina Subregional de Buenos Aires, dependencia que dará la aprobación previa para ejecutar todas aquellas actividades que deseen realizar en lo sucesivo dentro del área declarada y sometida al Refugio de Vida Silvestre.
4Que por medio de la resolución Nº ACLA-P-D-454 de las diez horas, treinta minutos del siete de octubre del dos mil dos, la Directora del Área de Conservación La Amistad Pacífico, licenciada Gladys De Marco González, aceptó la solicitud de sometimiento voluntario que realizó el Presidente de la sociedad Corporación de Desarrollo Agrícola Del Monte Sociedad Anónima para someterse voluntariamente al Refugio de Vida Silvestre Privado.
5Que con la protección oficial de estos ecosistemas, se logrará la protección y conservación de especies de vida silvestre propias de estos hábitats, los cuales tienen gran importancia biológica y socioeconómica, ya que algunas se encuentran en peligro de extinción y que debido al estado actual de los recursos naturales en la zona y la apertura nacional hacia la conservación de la biodiversidad por medio de las Áreas Silvestres Protegidas, lo que es necesaria su preservación. 6º-Que el manejo racional integrado de los recursos naturales, contribuye a satisfacer las necesidades regionales para la investigación, recreación, educación ambiental, así como el aprovechamiento de los recursos naturales renovables explotados racionalmente.
7Que la administración de la vida silvestre y la recomendación de medidas que aseguren la perpetuidad de las especies es función de la Dirección General de Vida Silvestre del Ministerio del Ambiente y Energía. Por tanto:

Dicho informe deberá ser aprobado por El Estado, siempre y cuando las actividades se ajusten al plan de manejo propuesto y a la legislación vigente.

Artículo 4 — The activities developed by the owner within this Refuge must comply with the legal, regulatory and technical standards established by the Ministry of Environment and Energy and those approved in the corresponding management plan (plan de manejo).

Artículo 6 — The owner must send to the Área de Conservación La Amistad Pacífico, an annual report on the following aspects: development and infrastructure within the property, achievements obtained, activities for the next period and the state of the natural resources on the property.

Artículo 7 — The owner of the indicated farm shall enjoy the benefits and incentives established in the Wildlife Conservation Law, for which the distinct involved ministerial offices shall issue the necessary documents.

Artículo 8 — It becomes effective upon its publication.

Artículo 4 — Las actividades que desarrolle la propietaria dentro de este Refugio deberán cumplir con las normas legales, reglamentarias y técnicas que establezca el Ministerio del Ambiente y Energía y las aprobadas en el correspondiente plan de manejo.

Artículo 6 — La propietaria deberá enviar al Área de Conservación La Amistad Pacífico, un informe anual sobre los siguientes aspectos: desarrollo e infraestructura dentro del inmueble, logros obtenidos, actividades del próximo periodo y el estado de los recursos naturales en el inmueble.

Artículo 7 — La propietaria de la finca señalada, gozará de los beneficios e incentivos establecidos en la Ley de Conservación de la Vida Silvestre, para lo cual las distintas dependencias ministeriales involucradas, emitirán los documentos necesarios.

Artículo 8 — Rige a partir de su publicación.
