General Objectives

CHAPTER I

7794 of April 30, 1998, and in conformity with the provisions of the Ley General de Agua Potable, No. 1634-55.

For the purposes of this Regulation, the following terms shall be used:

Subscriber (Abonado): Individual or legal entity that owns the property or building to which the service is provided.

Service Connection (Acometida): Flow of water passing through a pipe.

Connection Line (Prevista): Pipe and accessories between the main pipe and the property boundary with the public road (water connection stub).

Service Cut-off (Corte de servicio): Definitive or temporary deprivation of service.

New Connection Cost (Costo por nueva conexión): Amount that the subscriber must pay for the service of connecting the water connection stub to the property.

Reconnection Cost (Costo por reconexión): Amount that the subscriber must pay when the service is suspended for lack of payment and the person requests its reconnection.

Stub Relocation Cost (Costo por traslado de paja): Amount that the subscriber must pay when requesting the relocation of the water connection stub to another property.

System (Sistema): The set of pipes, storage tanks, treatment plant, and other assets necessary to provide water supply service to the population.

Domiciliary Installations (Instalaciones domiciliarias): Internal drinking water system of dwellings.

User (Usuario): Any individual or legal entity that uses the drinking water services, whether or not the owner of the property receiving the service.

Municipality (Municipalidad): Institution responsible for supplying the water supply service.

Otherwise, the Municipality assumes no responsibility for the malfunction of said system.

Obtaining Service

CHAPTER III

The Municipality shall carry out the liquid conduction works at the request of the interested party up to 6 (six) meters from the main pipe.

If approved, it must be communicated in writing to the applicant so that they may proceed to pay the new connection fee, as well as the cost for connection or connection line (prevista). Said requests shall be registered and granted chronologically when appropriate.

The Municipality is the only one authorized to make the connections; if any connection of this type is discovered, the owner shall be notified in writing to appear to make the stub request (solicitud de paja), granting 8 business days for this; otherwise, the service shall be suspended.

The Municipality is not obligated to grant temporary water service connections.

Payment and Suspension of Service

CHAPTER IV

The categories are the following:

Domestic (Domiciliaria): For houses and apartment buildings destined exclusively for habitation, whether occupied by their owners or tenants.

Ordinary (Ordinaria): For offices, commercial, and industrial businesses in which water use is similar to that of dwellings.

Reproductive (Reproductiva): For industries and businesses that use water as raw material or as an element for the production of their goods or the provision of their services.

Preferential (Preferencial): For use by charitable, educational, and religious institutions.

Government (Gobierno): For offices and institutions of the Central Government, Public Powers, and Decentralized Government Institutions. The preferential and Government categories only include the indicated institutions; any other institution belonging to the same institutions that is dedicated to other activities must be classified according to the use of the services.

If they do so, it shall be disconnected again and shall not be reconnected—if applicable—until the reconnection cost has been paid, which shall be 50% more than the established connection rate.

The service reconnection shall occur only after the corresponding amount for it has been paid.

a)Does not pay the service in a timely manner, once the grace period consisting of five (5) business days after the last day of the month or quarter under collection has expired, and has been previously notified.
b)Interconnects a system pipe with others from other water sources.
c)When the user does not permit inspection of the internal installations.
d)When the subscriber's installations are defective and the deficiencies are not corrected (if previously warned).
e)When the installations do not meet the necessary conditions to prevent damage to themselves or third parties.

General Provisions

CHAPTER V

1)The areas bordering springs (manantiales) within a radius of two hundred (200) meters, or one hundred (100) meters if the springs originate on flat terrain.
2)A minimum zone of ten (10) meters on both sides of all rivers, streams (quebradas), or creeks (arroyos), permanent or not, if the terrain is flat, and of fifty (50) meters if the terrain is uneven (quebrado).
3)The aquifer recharge areas of the springs whose waters are used for human consumption.

The washing of sidewalks, irrigation of green areas, and nursery beds (almacigales) is strictly prohibited during said months.

This Regulation was approved by means of article IX of ordinary session No. 51, on the 12th day of the month of May, 2003.

Objetivos generales

CAPÍTULO I

Para los efectos del presente Reglamento, se utilizarán los siguientes términos:

Abonado: Persona física o jurídica propietaria de la finca o edificación, a la que se le presta el servicio.

Acometida: Caudal de agua que pasa por una tubería.

Prevista: Tubería y accesorios entre la tubería principal y el límite de la propiedad con la vía pública (paja de agua).

Corte de servido: Privación definitiva o temporal del servicio.

Costo por nueva conexión: Valor que debe pagar el abonado por el servicio de conexión de la paja de agua a la propiedad.

Costo por reconexión: Valor que debe de pagar el abonado cuando el servicio es suspendido por falta de pago y la persona solicita su reconexión.

Costo por traslado de paja: Valor que debe de pagar el abonado cuando solicita el traslado de la paja de agua a otra propiedad.

Sistema: Es el conjunto de tubería, tanques de almacenamiento, planta de tratamiento y demás activos necesarios para prestar el servicio de acueducto a la población.

Instalaciones domiciliarias: Sistema interno de agua potable de los domicilios.

Usuario: Toda persona física o jurídica que utiliza los servicios de agua potable, sea o no propietaria del bien que recibe el servicio.

Municipalidad: Institución encargada de suministrar el servicio de acueducto.

De lo contrario la Municipalidad no asume ninguna responsabilidad por el mal funcionamiento del sistema mencionado.

Obtención del servicio

CAPÍTULO III

La Municipalidad llevará a cabo los trabajos de conducción del líquido a solicitud del interesado hasta 6 (seis) metros del tubo madre.

De ser acogida la misma, se debe comunicar por escrito al solicitante para que proceda a cancelar el derecho por nueva conexión, así como el costo por conexión o prevista. Dichas solicitudes serán registradas y conferidas en forma cronológica cuando ello proceda.

La Municipalidad es la única autorizada a hacer las conexiones, en caso que se descubra alguna conexión de esta forma, se le notificará al propietario por escrito para que se presente a hacer la solicitud de paja, otorgándole 8 días hábiles de tiempo, caso contrario se procederá a suspender el servicio.

La Municipalidad no se encuentra obligada a conceder conexiones temporales de servicio de agua.

Pago y suspensión del servicio

CAPÍTULO IV

Las categorías son las siguientes:

Domiciliaria: Para casas y edificios de apartamentos destinados exclusivamente a habitación, sean ocupados por sus dueños o inquilinos.

Ordinaria: Para oficinas, negocios comerciales e industriales en los cuales se haga uso del agua similar al de los domicilios.

Reproductiva: Para industrias y comercios que utilicen el agua como materia prima o como elemento para la elaboración de sus productos o de la prestación de sus servicios.

Preferencial: Para uso de instituciones de beneficencia, educación y culto.

Gobierno: Para oficinas e instituciones del Gobierno Central, Poderes Públicos e Instituciones Descentralizadas del Gobierno. Las categorías preferencial y Gobierno comprenden solamente a las instituciones indicadas, cualquier otra institución perteneciente a las mismas instituciones que se dedicara a otras actividades, debe ser clasificada según corresponda al uso de los servicios.

De hacerlo se procederá a desconectarlo de nuevo y no se reconectará -si fuere del caso- hasta tanto no se haya pagado el valor de la reconexión el cual será de un 50% más de la tarifa que se tenga establecida de conexión.

La reconexión del servicio se hará hasta que se pague el monto correspondiente a la misma.

a)No pague oportunamente el servicio, una vez vencido el periodo de gracia que consiste en cinco (5) días hábiles posteriores al último día del mes o trimestre, en cobro, plazo de cancelación y se le haya notificado previamente.
b)Interconecte tubería del sistema con otras provenientes de otras fuentes de agua.
c)Cuando el usuario no permita inspeccionar las instalaciones internas.
d)Cuando las instalaciones del abonado estén defectuosas y no se corrijan las deficiencias (si se ha prevenido anteriormente).
e)Cuando las instalaciones no reúnan las condiciones necesarias para evitar daños a sí mismos o a terceros.

CAPÍTULO V

Disposiciones generales

1)Las áreas que bordeen manantiales en un radio de doscientos (200) metros, de cien (100) metros si los manantiales nacen en terrenos planos.
2)Una zona mínima de diez (10) metros a ambos lados de todos los ríos, quebradas o arroyos, permanentes o no, si el terreno es plano y de cincuenta (50) metros si el terreno es quebrado.
3)Las áreas de recarga acuífera de los manantiales en que sus aguas sean utilizadas para consumo humano.

Queda terminantemente prohibido el lavado de aceras, riego de zonas verdes y almacigales durante dichos meses.

El presente Reglamento fue aprobado mediante artículo IX, de la sesión ordinaria Nº 51, del día 12 del mes de mayo del 2003

Artículo 1 — —Enact this Regulation in accordance with the provisions of Articles 4, subsection a) and 13, subsections c) and d) and 43 of the Código Municipal, Law No.

Artículo 2 — —This Regulation shall govern the municipal organization and operation, regarding the provision of drinking water service, as well as establish the rights and duties of both the subscribers of the system and the Municipality.

Artículo 3 — —Glossary of terms.

Artículo 4 — —The Municipality is obligated to provide water service to all property owners of the canton of Dota.

Artículo 5 — —The Municipality shall provide its services in the most efficient manner that its resources and circumstances permit and shall take the necessary measures to ensure the maintenance, development, and expansion of the service.

Artículo 6 — —The Municipality undertakes to provide users with adequate service in terms of quantity, continuity, and quality.

Artículo 7 — —The water service must be provided continuously, except in the case of repairs, maintenance, force majeure (caso fortuito), or other justifiable cause, in which case the Municipality must notify users in advance of the alterations or interruptions of the service.

Artículo 8 — —It is the authority (potestad) of the Municipality to carry out extensions, branches, modifications, and repairs to the networks and installations of the systems that belong to it, as well as to the connection lines (previstas) of the subscribers' connections.

Artículo 9 — —It is the responsibility and obligation of the subscriber to maintain the internal systems and installations in good working condition.

Artículo 10 — —The Municipality may inspect, by means of duly identified personnel, the internal installations and systems, when the respective permission exists from the subscriber.

Artículo 11 — —The user must use the service according to the category with which it was classified (see Article 26).

Artículo 12 — —The Municipality shall grant water service to a property only upon request of the interested party.

Artículo 15 — —The applicant must always indicate the use to be given to the service requested, and the Municipality may reject that request when it is technically or regulatorily impossible due to problems of liquid scarcity or others.

Artículo 17 — —Under no circumstances may users utilize a single service (one connection stub) for two or more occupancy units.

Artículo 18 — —If for any reason Article 17 could not be complied with, and that several occupancy units on a property are supplied from one connection, the bill is calculated based on the interconnected occupancy units.

Artículo 19 — —Users enjoying the water service may request from the Municipality a change in the account name due to transfer of the property and a change in the use of the service (different category), for which the Local Government shall determine whether the user's request is justified.

Artículo 22 — —The temporary connection shall be made if approved by the Mayor (Alcalde), prior to payment of the corresponding fees.

Artículo 23 — —For the maintenance of the water supply (acueducto), the Municipality shall propose a basic fee for the service, following a study of administration, operation, and maintenance costs.

Artículo 24 — —The rates approved by the Municipality shall be charged to users thirty days after their publication in the Diario Oficial La Gaceta, as ordered by Article 74 of the current Código Municipal.

Artículo 25 — —The water service provided by the Municipality to subscribers cannot be free; even if it concerns any national public entity; unless some special law determines otherwise.

Artículo 26 — —The water service shall be classified into categories, and for each one a specific rate shall correspond.

Artículo 27 — —The income received from the provision of the water service shall be destined solely for the operation, maintenance, and improvement of the drinking water supply system, the Municipality thereby being obligated to keep separate accounts for said funds.

Artículo 28 — —The Municipality may suspend the service when the subscriber fails to meet their payment obligations for the service, following a written notification, granting them 5 business days; otherwise, it shall proceed.

Artículo 29 — —For late payment of the drinking water service, interest shall be charged, in accordance with Article 32 of the Código Municipal.

Artículo 30 — —The service charge shall be made on a monthly or quarterly basis.

Artículo 31 — —Under no circumstances may subscribers reconnect a service that has been suspended.

Artículo 32 — —A user who wastes water in gardens, crops, defective pipes, vehicle washing, and other situations deemed as such, shall be notified twice in writing, and if ignored, the service shall be suspended without further procedure than its communication by the administration.

Artículo 33 — —The Municipality, in the figure of the Mayor (Alcalde o Alcaldesa), may order the suspension of the service when the subscriber:

Artículo 34 — —Debts for drinking water service payment shall constitute a preferential legal mortgage on the respective properties, in accordance with Article 70 of the current Código Municipal.

Artículo 36 — —As the Municipality does not have personnel trained to carry out water quality studies, it shall request specialized private or public institutions to carry them out at least once a year, thus guaranteeing water potability to the user.

Artículo 37 — —The Municipality is obligated to review the rate it charges for drinking water service once a year.

Artículo 39 — —The potable waters of the rivers and watershed (vertiente), in any part of the cantonal territory where they are found, shall be affected to the service of a drinking water system for the populations, as determined by the Poder Ejecutivo (Article 30 of the Ley de Aguas No.

Artículo 40 — —The Municipality must be in legal compliance regarding the concession of the springs (nacientes) of water in its canton with the Ministerio de Ambiente Energía, in order to guarantee the service to subscribers.

Artículo 41 — —The protective zones are those established in the Ley de Aguas No.

Artículo 42 — —During the months of December, January, February, March, April, and May, the use of drinking water for vehicle washing shall not be permitted.

Artículo 43 — —Takes effect 10 (ten) days after its publication in La Gaceta.

Artículo 1 — Díctese el presente Reglamento según lo dispuesto en los artículos 4 inciso a) y 13 inciso c) y d) y 43 del Código Municipal, Ley Nº 7794 del 30 de abril de 1998 y de conformidad con lo dispuesto de la Ley General de Agua Potable, Nº 1634-55.

Artículo 2 — Este Reglamento regulará la organización y funcionamiento municipal, en cuanto a la prestación del servicio de agua potable, así como establecer los derechos y deberes tanto de los abonados del sistema como de la Municipalidad.

Artículo 3 — Glosario de términos.

Artículo 4 — La Municipalidad está obligada a prestar el servicio de agua a todos los propietarios de inmuebles del cantón de Dota.

Artículo 5 — La Municipalidad prestará sus servicios en la forma más eficiente que sus recursos y circunstancias lo permitan y tomará las medidas necesarias para asegurar el sostenimiento, desarrollo y ampliación del servicio.

Artículo 6 — La Municipalidad se compromete a dotar a los usuarios de un servicio adecuado en cuanto a cantidad, continuidad y calidad.

Artículo 7 — El servicio de agua deberá ser prestado en forma continua, salvo el caso de reparaciones, mantenimiento, caso fortuito u otra causa justificante, en cuyo caso la Municipalidad deberá comunicar por anticipado de las alteraciones o interrupciones del servicio a los usuarios.

Artículo 8 — Es potestad de la Municipalidad realizar extensiones, derivaciones, modificaciones y reparaciones a las redes e instalaciones de los sistemas que le pertenezcan, así como en las previstas de las conexiones de los abonados.

Artículo 9 — Es responsabilidad y obligación del abonado mantener en buenas condiciones de funcionamiento los sistemas e instalaciones internas.

Artículo 10 — La Municipalidad podrá inspeccionar, por medio de personal debidamente identificado, las instalaciones y sistemas internos, cuando exista el permiso respectivo por parte del abonado.

Artículo 11 — El usuario deberá hacer uso del servicio, de acuerdo con la categoría con que fue calificado (ver artículo 26).

Artículo 12 — La Municipalidad concederá el servicio de agua a una propiedad, solamente a gestión de la parte interesada.

Artículo 15 — El solicitante deberá indicar siempre el uso que va a dar al servicio que solicita y la Municipalidad podrá rechazar esa solicitud cuando técnica o reglamentariamente no sea posible por problemas de escasez de líquido u otros.

Artículo 17 — —En ningún caso los usuarios podrán utilizar un único servicio (una paja) para dos o más unidades de ocupación.

Artículo 18 — —Si por algún motivo el artículo 17 no pudiese cumplirse, y que en una propiedad se abastezcan de una conexión varias unidades de ocupación, el recibo se calcula por las unidades de ocupación interconectadas.

Artículo 22 — La conexión temporal se realizará si fuera acogida por el Alcalde, previo pago de las tasas que correspondan.

Artículo 23 — Para el sostenimiento del acueducto, la Municipalidad propondrá una cuota básica por el servicio, previo estudio de costos de administración, operación y mantenimiento.

Artículo 24 — Las tarifas aprobadas por la Municipalidad se pondrán al cobro a los usuarios treinta días después de su publicación en el Diario Oficial La Gaceta conforme lo ordena el artículo 74 del Código Municipal vigente.

Artículo 25 — El servicio de agua que presta la Municipalidad a los abonados no puede ser gratuito; así se trate de cualquier entidad pública nacional; salvo que alguna ley especial determine lo contrario.

Artículo 26 — El servicio de agua se clasificará en categorías y para cada una de ellas corresponderá una tarifa determinada.

Artículo 27 — El ingreso que se perciba por la prestación del servicio de agua, se destinará únicamente para la operación, mantenimiento y mejoramiento del sistema de abastecimiento de agua potable quedando por ello obligada la Municipalidad a llevar cuentas separadas para dichos fondos.

Artículo 28 — La Municipalidad podrá suspender el servicio, cuando el abonado no atienda sus obligaciones de pago por el servicio, previa notificación escrita, otorgándoles 5 días hábiles, de lo contrario se procederá.

Artículo 29 — Por atraso en el pago del servicio de agua potable, se cobrará intereses, de conformidad con el artículo 32 del Código Municipal.

Artículo 30 — El cobro del servicio se hará en forma mensual o trimestral.

Artículo 31 — En ningún caso podrán los abonados reconectar un servicio que ha sido suspendido.

Artículo 33 — La Municipalidad en la figura del Alcalde o Alcaldesa podrá ordenar la suspensión del servicio cuando el abonado:

Artículo 34 — Las deudas por concepto de pago del servicio de agua potable, constituirán hipoteca legal preferente sobre los respectivos inmuebles, de conformidad con el artículo 70 del Código Municipal vigente.

Artículo 36 — Al no contar la Municipalidad con personal capacitado para realizar estudios de calidad del agua, gestionará ante las instituciones especializadas, privadas o públicas, para que los realicen por lo menos una vez al año, garantizando así la potabilidad del agua al usuario.

Artículo 37 — La Municipalidad está obligada a revisar la tarifa que cobra por el servicio de agua potable, una vez al año.

Artículo 40 — La Municipalidad deberá estar a derecho, con respecto a la concesión de las nacientes de agua de su cantón, ante el Ministerio de Ambiente Energía, con el fin de garantizar el servicio a los abonados.

Artículo 41 — —Son zonas protectoras las establecidas en la Ley de Aguas Nº 276 del 27 de agosto de 1942 y sus reformas.

Artículo 42 — Durante los meses de diciembre, enero, febrero, marzo, abril y mayo, no se permitirá el uso del agua potable para lavado de vehículos.

Artículo 43 — Rige 10 (diez) días a partir de su publicación en La Gaceta.
