Full Text of Record: 50D1A No. 30478-MINAE No. 30478-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Exercising the constitutional and regulatory powers conferred by Article 140, subsections 3) and 18) and Article 146 of the Political Constitution in relation to the provisions of Article 3, subsection k) of the Forest Law (Ley Forestal) No. 7575; Articles 3, 46, 47, subsection d) and Article 4 of Law No. 8114, Tax Simplification and Efficiency, of July 4, 2001; Article 3, subsections c) and d), of the Regional Convention for the Management and Conservation of Natural Forest Ecosystems and the Development of Forest Plantations, Law No. 7572 of February 1, 1996; Article 4, paragraph 1, subsection d), of the United Nations Framework Convention on Climate Change, Law No. 7414 of June 6, 1994; and applying the provisions of Article 27, subsection 1) of the General Law on Public Administration

Considering:

30090-MINAE allocated for environmental service payments for services provided by forested areas, which technically allow forest management (manejo forestal), through management plans executed by individuals or legal entities, individually, which allow for more efficient control and monitoring of operations carried out in the forest, and which comply with the principles, criteria, and indicators of sustainable management, in accordance with the provisions of Executive Decrees No. 27388-MINAE and No. 27998-MINAE, the sum of two hundred forty-four million fifty-three thousand two hundred seventy colones (¢244,053,270.00) for the recognition of environmental services on three thousand nine hundred fifty-one hectares (3,951 ha.).

Therefore, They decree:

30090-MINAE, of the fourth day of the month of December of the year 2001, published in La Gaceta No. 32 of February 14, 2002.

Given at the Presidency of the Republic.—San José, on the fifth day of the month of June of the year two thousand two.

Dado en la Presidencia de la República.-San José, a los cinco días del mes de junio del año dos mil dos.

Decree 30478 — No Increase in Area for Forest Management Environmental Services Payments for 2002Determina no aumentar el área ya establecida para pago de servicios

Artículo 2 — That Costa Rican society recognizes and contributes to the environmental service payments provided by forests and forest plantations, through the tax on fuels and other hydrocarbons.

Artículo 4 — That for the year 2002, Executive Decree No.

Artículo 5 — That the said decree established in Article 11 a maximum deadline for submitting applications for environmental service payments for the year two thousand two, of thirty calendar days after the publication of the respective decree.

Artículo 6 — That the deadline for submitting applications for service payments expired on March 14, 2002; and

Artículo 7 — That it is the interest of the current administration to increase the area of environmental service payments in the modalities of protection and reforestation.

Artículo 1 — —Not to increase the area already established for environmental service payments under the forest management modality for the 2002 period.

Artículo 2 — —Repeal Article 1, subsection 6-c) of Executive Decree No.

Artículo 3 — —The funds allocated in the repealed Article 1, subsection 6-c) shall be distributed in the proportion of sixty percent for reforestation and agroforestry systems, and the remaining forty percent for protection.

Artículo 4 — —Effective from its publication.

Artículo 2 — Que la sociedad costarricense reconoce y contribuye al pago de servicios ambientales que brindan los bosques y las plantaciones forestales, por medio del impuesto a los combustibles y otros hidrocarburos.

Artículo 5 — Que el dicho decreto determinó en el artículo 11 un plazo máximo para la presentación de solicitudes para el pago de servicios ambientales para el año dos mil dos, de treinta días naturales después de la publicación del respectivo decreto.

Artículo 6 — Que el plazo para la presentación de solicitudes para el pago de servicios venció el 14 de marzo del 2002; y

Artículo 7 — Que es interés de la presente administración aumentar el área del pago de servicios ambientales en las modalidades de protección y reforestación.

Artículo 1 — No aumentar el área ya establecida para pago de servicios ambientales en la modalidad de manejo de bosque para el período 2002.

Artículo 2 — Deróguese el artículo 1, inciso 6-c) del Decreto Ejecutivo N° 30090-MINAE, de los cuatro días del mes de diciembre del año 2001, publicado en La Gaceta N° 32 del 14 de febrero del año 2002.

Artículo 3 — Los fondos destinados en el artículo 1 inciso 6-c) derogado, serán distribuidos con la proporción de un sesenta por ciento para reforestación y sistemas agroforestales, y el restante cuarenta por ciento para protección.

Artículo 4 — Rige a partir de su publicación.
