Full Text of Record: 50D1A No. 30478-MINAE No. 30478-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Exercising the constitutional and regulatory powers conferred by Article 140, subsections 3) and 18) and Article 146 of the Political Constitution in relation to the provisions of Article 3, subsection k) of the Forest Law (Ley Forestal) No. 7575; Articles 3, 46, 47, subsection d) and Article 4 of Law No. 8114, Tax Simplification and Efficiency, of July 4, 2001; Article 3, subsections c) and d), of the Regional Convention for the Management and Conservation of Natural Forest Ecosystems and the Development of Forest Plantations, Law No. 7572 of February 1, 1996; Article 4, paragraph 1, subsection d), of the United Nations Framework Convention on Climate Change, Law No. 7414 of June 6, 1994; and applying the provisions of Article 27, subsection 1) of the General Law on Public Administration
1.—That it is Government policy to recognize the owners of forests and forest plantations through environmental service payments (Pago de Servicios Ambientales) for the environmental services provided by forested areas, such as mitigation of greenhouse gas emissions, protection of water resources for human consumption and hydroelectric power generation, protection of biodiversity, and scenic beauty.
2.—That Costa Rican society recognizes and contributes to the environmental service payments provided by forests and forest plantations, through the tax on fuels and other hydrocarbons.
3.—That the National Forest Financing Fund is authorized to raise financing both nationally and internationally for the environmental service payments provided by forests and forest plantations and for other activities necessary to strengthen the development of the country's natural resource sector.
4.—That for the year 2002, Executive Decree No. 30090-MINAE allocated for environmental service payments for services provided by forested areas, which technically allow forest management (manejo forestal), through management plans executed by individuals or legal entities, individually, which allow for more efficient control and monitoring of operations carried out in the forest, and which comply with the principles, criteria, and indicators of sustainable management, in accordance with the provisions of Executive Decrees No. 27388-MINAE and No. 27998-MINAE, the sum of two hundred forty-four million fifty-three thousand two hundred seventy colones (¢244,053,270.00) for the recognition of environmental services on three thousand nine hundred fifty-one hectares (3,951 ha.).
5.—That the said decree established in Article 11 a maximum deadline for submitting applications for environmental service payments for the year two thousand two, of thirty calendar days after the publication of the respective decree.
6.—That the deadline for submitting applications for service payments expired on March 14, 2002; and 7.—That it is the interest of the current administration to increase the area of environmental service payments in the modalities of protection and reforestation. Therefore, They decree:
