General Agreement for economic, technical, and related assistance between the Governments of Costa Rica and the United States of America, signed in San José on the twenty-second day of December of nineteen hundred sixty-one, the text of which is as follows:

GENERAL AGREEMENT FOR ECONOMIC, TECHNICAL AND RELATED ASSISTANCE BETWEEN THE GOVERNMENT OF COSTA RICA AND THE GOVERNMENT OF THE UNITED STATES OF AMERICA Whereas the Government of Costa Rica and the Government of the United States of America wish to forge an Alliance for Progress based on self-help, mutual effort, and common sacrifice, intended to help meet the needs for better housing, jobs, land, health, and schools of the peoples of Latin America, and Whereas the Act of Bogotá recommends the implementation of an inter-American social development program aimed at the execution of measures to improve rural welfare, land use (uso de la tierra), housing, community services, educational systems, training services, and public health, and for the mobilization of local resources, and Whereas the Government of Costa Rica and the Government of the United States of America agree on the need for specific action plans aimed at promoting economic progress and improvement of the welfare and standard of living of all the peoples of Latin America, and Whereas the Government of the United States of America has the intention of providing to the Latin American countries that participate in the Alliance for Progress, the economic, technical, and related assistance that they request and that the Government of the United States of America approves, in light of the resources available for the purpose and the self-help programs and measures contemplated in the Act of Bogotá; Therefore, the Government of Costa Rica and the Government of the United States of America hereby agree as follows:

In order to assist the Government of Costa Rica regarding its national development and its efforts to achieve social and economic progress through the effective utilization of its own resources and other self-help measures, the Government of the United States of America will provide the economic, technical, and related assistance that is in the future requested by representatives of competent agencies of the Government of Costa Rica and approved by the representatives of the agency or agencies designated by the Government of the United States of America for the administration of its commitments under this Agreement. Said assistance will be provided according to written agreements signed between the representatives indicated above.

To promote the social and economic progress of the country, the Government of Costa Rica will contribute to the maximum extent permitted by its resources and general economic conditions to the development program and to the programs and activities related thereto, including those that are carried out in accordance with this Agreement, and will provide the broadest information to the people of Costa Rica concerning the programs and activities contemplated herein. The Government of Costa Rica will take the appropriate measures to ensure the effective utilization of the assistance provided in accordance with this Agreement and will give all opportunities and facilities to the representatives of the Government of the United States of America to observe and review the programs and activities that are conducted in accordance with this Agreement and will provide any information that they may need to determine the nature and the scope of the activities planned or carried out, and to make an evaluation of the results.

The Government of Costa Rica will receive a special mission and the corresponding personnel for the performance of the duties of the Government of the United States of America in accordance with this Agreement and will consider said special mission and its personnel as part of the Diplomatic Mission of the Government of the United States of America in Costa Rica, for the purpose of granting them the privileges and immunities granted to the latter and to its personnel of equal rank.

In order to ensure for the people of Costa Rica the maximum benefits derived from the assistance to be provided under this Agreement, it is provided:

• a)The goods or funds used or that will be used in connection with this Agreement by the Government of the United States of America or by any contractor financed by that Government, shall be exempt from the payment of all property or use taxes and any other tax, from requirements related to investments or deposits, and from exchange controls of Costa Rica; and the importation, exportation, acquisition, use, or disposition of such goods or funds related to this Agreement shall be exempt from the payment of any tariff, customs duties, import and export taxes, purchase or transfer taxes, and any other similar taxes or fees that exist in Costa Rica.
• b)All persons, except permanent residents of Costa Rica, who are present here for the purpose of performing work related to this Agreement, shall be exempt from the payment of income and Social Security taxes paid in accordance with the laws of Costa Rica, and from taxes on the purchase, ownership, use, or disposition of personal movable property (including automobiles) for their own use.

Such persons and their family members shall receive the same treatment with respect to the payment of customs, import, and export duties on their personal movable property (including automobiles) that they import into Costa Rica for their personal use, as that granted by the Government of Costa Rica to diplomatic personnel of the American Embassy in Costa Rica.

Funds used for the purpose of providing assistance under this Agreement shall be converted into the currency of Costa Rica at the exchange rate that yields the greatest number of units of said currency per dollar of the United States of America and that, at the time the conversion is made, is not illegal in Costa Rica.

1.- This Agreement shall enter into force on the date of the communication by which the Government of Costa Rica notifies the Government of the United States of America that it has been ratified and shall remain in force until 90 days after the date of the communication by which either of the two Governments gives written notice to the other of its intention to terminate the Agreement. In such case, the provisions of this Agreement shall remain in full force and effect as to the assistance provided under this Agreement prior to its termination.

2.- All or any part of the assistance program provided under this Agreement, except when stipulated otherwise in arrangements agreed upon pursuant to Article I hereof, may be terminated at will by either of the two Governments if that Government determines that due to a change in conditions, the continuation of such assistance is unnecessary or undesirable. The termination of such assistance in accordance with this provision may include the cancellation of deliveries of any materials or items covered by this Agreement that have not been made.

3.- The provision of assistance under this Agreement shall be subject to the applicable laws and regulations of the Government of the United States of America and the receipt of such assistance by the Government of Costa Rica shall be subject to the applicable laws and regulations of the latter.

4.- The two Governments or their duly appointed representatives shall, at the request of either, hold consultations regarding any matter related to the application, operation, or amendment of this Agreement.

5.- Once in force, this Agreement shall replace the General Agreement for Technical Cooperation of Point 4, between the Government of Costa Rica and the United States of America, which was signed in San José, Costa Rica, on January 11, 1951, extended and amended by exchange of notes in San José, on December 19 and 20, 1951. The arrangements or agreements for carrying out the aforementioned General Agreement, as extended and amended, which have been concluded prior to the entry into force of this Agreement, shall be subject to it from the date on which it enters into force.

Convenio General para la ayuda económica, técnica y para propósitos afines entre los Gobiernos de Costa Rica y los Estados Unidos de América, suscrito en San José a los veintidós días del mes de diciembre de mil novecientos sesenta y uno, cuyo texto es el siguiente:

CONVENIO GENERAL PARA LA AYUDA ECONOMICA, TECNICA Y PARA PROPOSITOS AFINES ENTRE EL GOBIERNO DE COSTA RICA Y EL GOBIERNO DE LOS ESTADOS UNIDOS DE AMERICA Por cuanto el Gobierno de Costa Rica y el Gobierno de los Estados Unidos de América desean concertar una Alianza para el Progreso basada en la ayuda propia, el esfuerzo mutuo y el sacrificio común, destinada a ayudar a satisfacer las necesidades de mejores viviendas, trabajo, tierras, salud y escuelas de los pueblos de la América Latina, y Por cuanto en el Acta de Bogotá se recomienda la implantación de un programa interamericano de desarrollo social que tienda a la ejecución de medidas para mejorar el bienestar rural, el uso de la tierra, la vivienda, los servicios colectivos, los sistemas educativos, los servicios de adiestramiento, y la salubridad pública, y para la movilización de los recursos locales, y Por cuanto el Gobierno de Costa Rica y el Gobierno de los Estados Unidos de América están de acuerdo en la necesidad de planes de acción específicos destinados a fomentar el progreso económico y el mejoramiento del bienestar y nivel de vida de todos los pueblos de la América Latina, y Por cuanto el Gobierno de los Estados Unidos de América tiene la intención de suministrar a los países de la América Latina que participan en la Alinza para el Progreso, la ayuda económica, técnica y para propósitos afines que soliciten ellos y que apruebe el Gobierno de los Estados Unidos de América, a la luz de los reucursos disponibles para el objeto y de los programas y medidas de ayuda propia contemplados en el Acta de Bogotá; Por lo tanto el Gobierno de Costa Rica y el Gobierno de los Estados Unidos de América por este medio acuerdan lo siguiente:

A fin de ayudar al Gobierno de Costa Rica en lo que respecta al desarrollo nacional y a sus esfuerzos por alcanzar el progreso social y económico por medio de la utilización efectiva de sus propios recursos y otras medidas de ayuda propia, el Gobierno del los Estados Unidos de América proporcionará la ayuda económica, técnica y para asuntos afines que en el futuro soliciten los representantes de organismos competentes del Gobierno de Costa Rica y que aprueben los representantes del organismo y organismos designados por el Gobierno de los Estados Unidos de América para la administración de sus compromisos según el presente Convenio. Dicha ayuda se proporcionará conforme a acuerdos escritos y firmados entre los representantes anteriormente indicados.

Para fomentar el progreso social y económico del país, el Gobierno de Costa Rica contribuirá en la forma máxima que le permitan sus recursos y condiciones económicas generales al programa de desarrollo y a los programas y actividades relacionados con el mismo, incluyendo aquellos que se efectúen de acuerdo con este Convenio, y suministrará la más amplia información al pueblo de Costa Rica en lo que concierne a los programas y actividades contemplados aquí. El Gobierno de Costa Rica tomará las medidas del caso para asegurar el aprovechamiento efectivo de la ayuda proporcionada de acuerdo con este Convenio y dará todas las oportunidades y facilidades a los representantes del Gobiernbo de los Estados Unidos de América para que observen y revisen los programas y actividades que se conduzcan de acuerdo con este Convenio y suministrará cualquier información que ellos puedan necesitar para determinar la naturaleza y el alcance de las actividades planificadas o llevadas a cabo, y para hacer una evaluación de los reslutados.

El Gobierno de Costa Rica recibirá una misión especial y el personal correspondiente para el desempeño de los deberes del Gobierno de los Estados Unidos de América de acuerdo con este Convenio y considerará a dicha misión especial y a su personal como parte de la misión Diplomática del Gobierno de los Estados Unidos de América en Costa Rica, con el fin de concederles los privilegios e inmunidades que se conceden a esta última y a su personal de igual rango.

A fin de asegurar para el pueblo de Costa Rica los beneficios máximos provenientes de la ayuda que se proporcionará en virtud de este Convenio, se dispone:

• a)Los bienes o fondos utilizados o que se utilizaren con relación a este Convenio por parte del Gobierno de los Estados Unidos de América o de cualquier contratista financiado por ese Gobierno, estarán exentos del pago de todo impuesto sobre la propiedad o el uso y de cualquier otro impuesto, de requisitos relacionados con inversiones o depósitos, y de controles cambiarios de Costa Rica; y la importación, exportación, adquisición, uso o disposición de dichos bienes o fondos relacionados con este Convenio estarán exentos del pago de cualquier arancel, derechos de aduana, impuestos de importación y exportación, impuestos sobre compras o traspasos y cualesquier otros impuestos o tasas similares que existan en Costa Rica.
• b)Todas las personas, excepto los residentes permanentes de Costa Rica, que estén aquí presentes con el objeto de ejecutar trabajos relacionados con este Convenio, estarán exentas del pago de impuestos sobre la renta y de Seguro Social que se pagan de acuerdo con las leyes de Costa Rica, y de los impuestos sobre la compra, propiedad, uso o disposición de bienes muebles personales (incluyendo automóviles) para su propio uso.

Dichas personas y los miembros de sus familias recibirán el mismo trato con respecto al pago de derechos de aduana y de importación y exportación sobre sus bienes muebles personales (incluyendo automóviles) que importen a Costa Rica para su uso personal, que el que otorga el Gobierno de Costa Rica al personal diplomático de la Embajada Americana en Costa Rica.

Los fondos que se utilicen con el fin de proporcionar ayuda en virtud de este Convenio serán convertidos en moneda de Costa Rica al tipo de cambio que produzca el mayor número de unidades de dicha moneda por cada dólar de los Estados Unidos de América y que en el momento en que se haga la conversión, no sea ilegal en Costa Rica.

1.- Este Convenio entrará en vigencia en la fecha de la comunicación por la cual el Gobierno de Costa Rica le notifique al Gobierno de los Estados Unidos de América que ha sido ratificado y permanecerá en vigencia hasta 90 días después de la fecha de la comunicación por la cual cualquiera de los dos Gobiernos le dé avioso por escrito al otro de su intención de dar por terminado el Convenio. En tal caso, las disposiciones de este Convenio permanecerán en plena vigencia y efectividad en cuanto a la ayuda proporcionada conforme a este Convenio antes de su terminación.

2.- Todo o cualquier parte del programa de ayuda que se proporcione en virtud de este Convenio, excepto cuando se estipulare de otra manera en arreglos que se acuerden conforme al Artículo I del msimo, podrá terminarse a voluntad de cualquiera de los dos Gobiernos si ese Gobierno determinare que por motivos de un cambio en las condiciones, la continuación de dicha ayuda es innecesaria o indeseable. La terminación de dicha ayuda de acuerdo con esta disposición puede incluir la cancelación de las entregas de cualesquier materiales o artículos que estén cubiertos por este Convenio, y que no se hayan efectuado.

3.- El suministro de ayuda bajo este Convenio estará sujeto a las leyes y reglamentos del Gobierno de los Estados Unidos de América que sean aplicables y el recibo de dicha ayuda por parte del Gobierno de Costa Rica estará sujeto a los reglamentos y leyes de este último que sean aplicables.

4.- Los dos Gobiernos o sus representantes debidamente nombrados deberán, a solicitud de cualquiera de los dos, llevar a cabo consultas respecto a cualquier asunto relacionado con la aplicación, operación o enmmienda de este Convenio.

5.- Una vez vigente, este Convenio reemplazará al Convenio General para Cooperación Técnica del Punto 4, entre el Gobierno de Costa Rica y los Estados Unidos de América que se firmó en San José, Costa Rica, el 11 de enero de 1951, prorrogado y enmendado por canje de notas en San José, el 19 y 20 de diciembre de 1951. Los arreglos o acuerdos para llevar a cabo el susodicho Convenio General, tal como se ha prorrogado y enmendado, que se hayan concertado con anterioridad a la vigencia del presente Convenio, estarán sujetos a éste a partir de la fecha en que entre en vigencia.
