No. 28742-MOPT THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF PUBLIC WORKS AND TRANSPORT Based on Article 140, subsections 3 and 18 of the Political Constitution and Law No. 4786 of July 5, 1971, the Law Creating the Ministry of Public Works and Transport, and Article 28 of the General Law on Public Administration,
DECREES
Considering:
4786 of July 5, 1971, confers upon the Ministry of Public Works and Transport competence regarding the regulation and control of international maritime transport, cabotage, and transport via inland navigation waterways, and makes it the sole official authority in all matters relating to national objectives, extending that authority to activities of any nature related to or falling under its competence.
11147-T of February 1980, the Organic Regulation of the Dirección General de Transporte Marítimo, it is established that the aforementioned Directorate shall ensure the safety of human life at sea, as well as on inland navigation waterways.
7291 of March 12, 1992, in its Article 146, establishes that with respect to activities in the Area, necessary measures shall be taken to ensure the effective protection of human life. To that end, the Authority shall establish appropriate rules, regulations, and procedures to supplement existing international law.
2220 of June 20, 1958, in its Article 14, subsection f, establishes that each time a vessel puts to sea, it must request departure permission or clearance (zarpe).
27917-MOPT of June 10, 1999, establishes that the Dirección General de Seguridad Marítima y Portuaria shall supervise that ships and vessels operate in safe conditions and respecting current regulations, by means of the action of the Port Captaincies (Capitanías de Puerto).
Therefore, They Decree:
The following, Regulation on the Issuance of Departure Clearance (Zarpe) to Vessels Flying the National Flag
Name and registration number of the vessel.
Name and identification number of the captain, crew members, or passengers. The maximum number of persons on board may not exceed the maximum number authorized by the certificate of seaworthiness (certificado de navegabilidad).
Estimated date and time of departure.
Estimated date and time of return.
Estimated destination location.
Authorization of the departure clearance (zarpe) may also be requested at the Central Offices of the Dirección General de Seguridad Marítima y Portuaria 48 hours in advance of the voyage, during the following hours: Monday through Friday from 7:30 a.m. to 4:00 p.m.
The official of the Port Captaincy who carries out the inspection must draw up a record (acta) of what occurred and also make the respective entry in the logbook (libro de bitácora).
Vessel not registered with the National Ship Registry (Registro Nacional de Buques).
Seizure order (Decreto de embargo).
Destination location beyond the vessel's autonomy (autonomía).
The denial of the departure clearance (zarpe) must be notified to the shipowner (armador) in writing, indicating the reasons that motivated it.

Considerando:
establece que con respecto a las actividades de la zona, se adoptarán las medidas necesarias para asegurar la eficaz protección de la vida humana. Con ese objeto, la Autoridad establecerá las normas, reglamentos y procedimientos apropiados que complementen el derecho internacional existente.
Por tanto,
El siguiente, Reglamento a la Emisión de Zarpe a las Embarcaciones de Bandera Nacional
Decretan:
Nombre y número de matricula de la embarcación.
Nombre y número de cédula del capitán, tripulantes o pasajeros. El número máximo de personas a bordo no podrá exceder el número máximo que autoriza el certificado de navegabilidad.
Fecha y hora estimada de salida.
Fecha y hora estimada de regreso.
Lugar estimado de destino.
La autorización del zarpe también podrá solicitarse en las Oficinas Centrales de la Dirección General de Seguridad Marítima y Portuaria con 48 horas de antelación a la realización del viaje, bajo el siguiente horario: de lunes a viernes de 7,30 a . m a 4,00 p. m.
El funcionario de la Capitanía de Puerto que realice la inspección deberá levantar un acta de lo acontecido y además realizar la anotación respectiva en el libro de bitácora.
Embarcación no inscrita ante el Registro Nacional de Buques.
Certificado de navegabilidad vencido.
Decreto de embargo.
Lugar de destino fuera de la autonomía de la embarcación.
La negación del zarpe deberá ser notificada alarmador por escrito indicando las razones que motivaron la misma.
