in that city. It shall be exclusively responsible for the administration of the electrical company of the Municipality of the Central canton of that province, the transfer of which is ordered by this law, and, to that end, shall have the powers, authorities, and duties indicated herein.

It is also authorized to provide cable television services. The Administrative Board of the Electrical Service of Cartago shall be subject to the payment of royalties, taxes, fees, special assessments, and all other levies to which telecommunications operators and providers are subject, without prejudice to the exemptions established in other laws. .

Municipalities, by means of an agreement duly approved by the Comptroller General of the Republic, may cede to JASEC the provision of those municipal services that they currently provide themselves.

JASEC is authorized to sell, in the national and international market, advisory, consulting, training services, and any other service related to its competencies. The prices of these products and services shall be freely determined by JASEC. Likewise, it is authorized to implement the commercial and marketing practices customary in industry and commerce, in general.

The Board of Directors shall be composed of seven members; four shall be appointed directly by the Municipal Council of the Central canton of the province of Cartago and the other three representatives shall be designated by the Executive Branch.

The members of the Board of Directors shall be appointed for terms of four years, starting from May 9 of each year in which the Executive Branch is renewed. The representatives of the Municipality shall rotate according to their expiration.

• a)To approve the ordinary and extraordinary budgets, as well as their modifications.
• b)To approve both the plans for the development of the public services it provides and the respective reports and studies.
• c)To request studies and research on the services and apply them.
• d)To appoint and remove the Manager (Gerente) and the Sub-Manager (Subgerente), if any, in accordance with Article 14 of this law.
• e)To appoint and remove the internal auditor, in accordance with Article 15 of this law.
• f)To approve both the economic and financial reports and the budget execution and liquidation reports, whether quarterly or annual.
• g)To approve the bidding processes that correspond to it by regulation.
• h)To issue the internal organization and service regulations that the Institution provides.
• i)To approve the internal organization.
• j)To approve the tariff proposals or projects for the public services, which the Manager shall propose, to be submitted to the Regulatory Authority of Public Services or to the corresponding authorities.
• k)To render, to the municipalities receiving its services, a detailed annual report of the Institution, no later than the last day of March of the following year. It must include the short- and long-term plans.
• l)To dictate measures that regulate the execution of the mission and the fulfillment of the Institution's objectives.
• m)Those other functions necessary for the good direction and management of the Institution.

during their term, unless civil, criminal, or administrative liability is declared against them in the exercise of their office, or if they fail to fulfill their duties, or fail to attend, without valid justification, six consecutive ordinary sessions or four alternate sessions in a period of two months. Removal shall be the responsibility of the Municipality of the Central canton of Cartago or the Executive Branch, as applicable, after the prior establishment of a disciplinary record (expediente).

The Board of Directors may grant permission to not attend sessions consecutively, but may not grant leaves of absence for more than six months.

Directors before their term concludes, the substitute shall assume office for the remaining time.

is linked by consanguinity or affinity up to the third degree inclusive, in a direct or collateral line, with another member of the same.

If persons covered by this prohibition are elected, the older one shall exclude the younger one.

municipalities that receive services from the Municipal Electrical Service Administrative Board of Cartago may not form part of the Board of Directors; nor may their first-degree relatives by consanguinity or affinity, nor employees, contractors, or members of a company or institution antagonistic to the interests, purposes, and objectives of this Administrative Board.

The members of the Municipal Council during their term may not be appointed officials of the Municipal Electrical Service Administrative Board of Cartago; nor may they be advisors or selected as contractors.

the members of the Board have been appointed, it must notify the corresponding body for the purpose of the respective appointment.

ordinary sessions per month; additionally, it shall meet extraordinarily when necessary and convened by its President or four of its members, with a minimum of twenty-four hours' notice.

The members of the Board of Directors shall earn a per diem equal to that of the directors of autonomous institutions. No more than eight sessions per month may be remunerated.

Directors may order, by unanimous agreement of its members present, that the general public or certain persons have access to them; it shall grant or deny the right to participate in the deliberations, with voice but without vote.

A quorum shall be constituted by four members and agreements shall be adopted by a simple majority of those present. When it is necessary to break a tied vote, the President shall have the deciding vote (voto de calidad).

a President, a Vice President, and a Secretary, who shall perform their duties in accordance with the General Law of Public Administration and may be reelected.

In case of absence, illness, or just cause, the President shall be substituted by the Vice President. An ad hoc secretary may also be appointed when required.

The functions of the Manager shall be those of a general administrator, in accordance with the purposes of this law and the policies of the Board of Directors. They shall be the superior chief of all instances of the company and its personnel, except for the internal audit; furthermore, they shall be responsible, before the Board of Directors, for the efficient and correct administrative performance of the Institution.

The Manager legally and extrajudicially represents the Institution; they may substitute their authority, in whole or in part, revoke substitutions, and grant new ones, always retaining their powers.

• a)To formulate and direct the work programs and the internal and functional organization plans of the Municipal Electrical Service Administrative Board of Cartago, to submit them to the consideration of the Board of Directors.
• b)To appoint personnel and remove them in accordance with the laws, regulations, and other relevant legal provisions. They shall submit to the decision of the Board of Directors the appointments or removals of departmental chiefs.
• c)To formulate the ordinary annual budgets and the extraordinary ones, subject to the laws, regulations, and other legal provisions on the matter, and submit them to the Board of Directors.
• d)To present to the Board of Directors the economic and financial reports, as well as the quarterly and annual budget execution and liquidation reports.
• e)To approve purchases that the Board of Directors authorizes them to make by regulation.
• f)To process, through judicial means, all debts arising from the services provided and any other damages and losses caused to the Institution. The certifications of debt issued in this regard by the company's accounting constitute an enforceable instrument (título ejecutivo).
• g)To include the monitoring, control, evaluation, and presentation before the Board of Directors of proposals to approve, modify, or adjust the tariffs for the different public services that the Institution shall administer.
• h)To enter into contracts and execute acts within their competence.
• i)To prepare an annual report on the Institution's labors.
• j)To inform the Board of Directors about the Institution's matters.
• k)To request ex officio, from the Municipality of the Central canton of Cartago or the Executive Branch, the initiation of the removal or substitution proceeding for a member of the Board of Directors, in accordance with Article 5 of this law.
• l)Other functions assigned by the Board of Directors.

To remove or dismiss them, the provisions of the Organic Law of the Comptroller General of the Republic shall be observed.

In matters of service regulation, the Institution shall be governed by the Law of the Regulatory Authority of Public Services, No. 7593, of August 9, 1996.

The same Administrative Procurement Regime that applies to the Costa Rican Institute of Electricity, established in current regulations, shall apply to the Municipal Electrical Service Administrative Board of Cartago.

services between the energy-producing companies and the Board and between it and consumers shall be definitively resolved by the Regulatory Authority of Public Services, in its capacity as regulatory body.

provisions are established:

• a)The Costa Rican Institute of Electricity shall transfer to the Municipality of Cartago, no later than three months after the enactment of this law, for the price indicated below, the following property it owns: the electrical networks of the City of Cartago, eastern and western part of El Carmen, San Nicolás, San Francisco, Guadalupe, Tierra Blanca, El Sanatorio, Dulce Nombre, 1st District of Paraíso, San Rafael de Oreamuno, Cot, Potrero Cerrado, Santa Rosa, El Tejar de El Guarco, San Isidro, Barro Morado, and El Radio.
• b)The Institute and the Board shall agree on the transfer of transport equipment, tools, and other materials and equipment currently forming part of the Institute's Agency in Cartago and intended for the electrical services in the aforementioned places; this shall be done within the period indicated in the preceding subsection.
• c)Any voltage line equal to or greater than 33,000 volts, forms part of the transmission system of the Central Interconnected System, owned by the Costa Rican Institute of Electricity, shall remain under its domain and operational control.
• d)Those existing lines shall remain the property of said Institute, as well as those future lines necessary for the transmission of energy in said Central Interconnected System and to supply the energy that the Electrical Board needs to acquire to meet the demand of the zones under its area of operation.
• e)Energy consumers at a voltage of 33,000 volts shall be served by the Costa Rican Institute of Electricity. However, the Institute may grant the Board the administration of these services.
• f)Insurance on the networks and on the stations, and the depreciation of the same, as well as other legally allowable expenses, shall be cost factors for the Board's system services.
• g)The Board may resort to the National Banking System so that, within its own regulations, it may provide means to finance the adequate fulfillment of its purposes.
• h)Once the Administrative Board is organized and its members are sworn in, as soon as it receives the installations, it shall begin to provide services.

The appraisal of the assets received by the Board shall indicate the original value less accumulated depreciation, according to the books of the Costa Rican Institute of Electricity.

• i)The Costa Rican Institute of Electricity is authorized to transfer to the Board the electric energy purchase-sale contract entered into with Compañía Agrícola de Santiago S. A., existing between both entities; and the National Electricity Service is authorized to regulate the conditions for the deliveries of electric energy from the Company to the Board and to approve the agreements that these last two entities may enter into for this purpose.

Energy purchases from both the Institute and the Company must be carried out in such a way as to guarantee the lowest use of both sources in order to achieve the lowest possible cost.

• j)All assets that the Institute transfers to the Municipality of Cartago in accordance with this law shall be received by the Board through a rigorous inventory and, when the case arises, it must make, in the same form, their return to the Municipality. As the administrator of a public electric service company, the Board shall be subject to all the legal and regulatory provisions governing that matter in the country, shall be exempt from national and municipal taxes, and shall enjoy postal and telegraph franking privilege.

roads, streets, squares, and other public places; it shall be obligated to repair, with equal or superior quality, the damages caused, in coordination with the competent authorities.

One month after this law enters into force, four members shall be appointed to complete the Board of Directors; of these, two shall correspond to those appointed directly by the Municipality of the Central canton of Cartago and two to the Executive Branch.

To maintain the adequate rotation of the members of the Board of Directors, upon the expiration of the current directors' terms, the Executive Branch shall appoint one director and the Municipality shall designate two; in this latter case, the appointments must indicate the term adjustments.

They shall be recognized, as severance assistance (auxilio de cesantía), one month's salary or fraction thereof for each year or fraction of seniority in the service of the respective municipality. The latter shall pay for the years it is legally authorized to do so, and the remainder shall be assumed by the Board. Said salary shall be the average of the last six gross salaries earned.

The employees who it is necessary to dispense with or those who request the termination of the employment relationship shall receive as severance assistance (auxilio de cesantía) the payment of one month's salary or fraction thereof for each year of seniority recognized by the Municipal Electrical Service Administrative Board of Cartago, for vacation and annuity purposes. Said salary shall be the average of the last six gross salaries earned. These employees may not be appointed again as employees of said Board until after five years have elapsed.

Administrativa del Servicio Eléctrico Municipal de Cartago, con domicilio en esa ciudad. Tendrá a su cargo, en forma exclusiva, la administración de la empresa eléctrica de la Municipalidad del cantón Central de esa provincia, cuyo traspaso ordena esta ley y, al efecto, tendrá las atribuciones, facultades y deberes en ella indicados.

También queda facultada para prestar los servicios de televisión por cable. La Junta Administrativa del Servicio Eléctrico de Cartago estará sujeta al pago de los cánones, los impuestos, las tasas, las contribuciones especiales y los demás tributos a los que estén sometidos los operadores y proveedores de telecomunicaciones, sin detrimento de las exenciones establecidas en otras leyes. .

Las municipalidades, mediante convenio, debidamente refrendado por la Contraloría General de la República, podrán ceder a JASEC la prestación de aquellos servicios municipales que hasta este momento prestan por sí mismas.

Se autoriza a Jasec para que venda, en el mercado nacional e internacional, servicios de asesoramiento, consultoría, capacitación y cualquier otro servicio afín a sus competencias. Los precios de esos productos y servicios serán determinados libremente por Jasec. Asimismo, se le autoriza a implementar las prácticas comerciales y de mercadeo usuales en la industria y el comercio, en general.

La Junta Directiva estará integrada por siete miembros; cuatro serán nombrados directamente por el Concejo Municipal del cantón Central de la provincia de Cartago y los otros tres representantes serán designados por el Poder Ejecutivo.

Los miembros de la Junta Directiva serán nombrados por períodos de cuatro años, a partir del 9 de mayo de cada año en que se renueve el Poder Ejecutivo. Los representantes de la Municipalidad rotarán de acuerdo con su vencimiento.

• a)Aprobar los presupuestos ordinarios y extraordinarios, así como sus modificaciones.
• b)Aprobar tanto los planes para el desarrollo de los servicios públicos que preste como los respectivos informes y estudios.
• c)Solicitar estudios e investigaciones sobre los servicios y aplicarlos.
• d)Nombrar y remover al Gerente y al Subgerente, si los hubiere, de conformidad con el artículo 14 de esta ley.
• e)Nombrar y remover al auditor interno, conforme al artículo 15 de esta ley.
• f)Aprobar tanto los informes económicos y financieros como los de ejecución y liquidación presupuestaria, ya sean trimestrales o anuales.
• g)Aprobar las licitaciones que reglamentariamente le correspondan.
• h)Dictar los reglamentos de organización interna y de servicios que presta la Institución.
• i)Aprobar la organización interna.
• j)Aprobar las propuestas o los proyectos tarifarios para los servicios públicos, que le propondrá el Gerente, para que sean sometidos a la Autoridad Reguladora de los Servicios Públicos o a las autoridades correspondientes.
• k)Rendir, a las municipalidades que reciben sus servicios, un informe anual detallado de la Institución, a más tardar el último día de marzo del año siguiente. En él deberá incluir los planes a corto y largo plazo.
• l)Dictar medidas que regulen la realización de la misión y el cumplimiento de los objetivos de la Institución.
• m)Aquellas otras funciones necesarias para la buena conducción y manejo de la Institución.

durante su período, salvo que se declarare contra ellos responsabilidad civil, penal o administrativa, en el ejercicio del cargo o si faltaren al cumplimiento de sus deberes o dejaren de asistir sin justificación válida a seis sesiones ordinarias consecutivas o a cuatro alternas en un período de dos meses. La remoción le corresponderá a la Municipalidad del cantón Central de Cartago o al Poder Ejecutivo, según corresponda, previo levantamiento del expediente.

La Junta Directiva podrá conceder permiso para no asistir consecutivamente a sesiones, pero no podrá conceder licencias por más de seis meses.

Directiva antes de concluir su período, el sustituto tomará el cargo por el tiempo restante.

esté ligado por parentesco consanguíneo o afín hasta el tercer grado inclusive, en línea recta o colateral, con otro miembro de la misma.

Si se eligieran personas comprendidas en esa prohibición, la de mayor edad excluirá a la más joven.

municipalidades que reciben servicios de la Junta Administrativa del Servicio Eléctrico Municipal de Cartago no podrán formar parte de la Junta Directiva; tampoco sus familiares en primer grado por consanguinidad o afinidad, ni los empleados, contratistas o integrantes de una empresa o institución antagónica a los intereses, propósitos y finalidades de esta Junta Administrativa.

Los miembros del Concejo Municipal durante su período no podrán ser nombrados funcionarios de la Junta Administrativa del Servicio Eléctrico Municipal de Cartago; tampoco podrán ser asesores ni seleccionados como contratistas.

han sido nombrados los miembros de la Junta, esta deberá comunicarlo al organismo correspondiente para el efecto del respectivo nombramiento.

sesiones ordinarias al mes; además, sesionará extraordinariamente cuando sea necesario y la convoquen su Presidente o cuatro de sus miembros, con una antelación mínima de veinticuatro horas.

Los miembros de la Junta Directiva devengarán una dieta igual a la de los directores de las instituciones autónomas. No podrán remunerarse más de ocho sesiones al mes.

Directiva podrá disponer, por acuerdo unánime de sus miembros presentes, que tengan acceso a ellas el público en general o ciertas personas; concederá o no el derecho de participar en las deliberaciones, con voz pero sin voto.

El quórum estará constituido por cuatro miembros y los acuerdos se adoptarán por mayoría simple de los presentes. Cuando se necesite desempatar una votación, el Presidente tendrá voto de calidad.

a un Presidente, un Vicepresidente y un Secretario, quienes se desempeñarán según la Ley General de la Administración Pública y podrán ser reelegidos.

En caso de ausencia, enfermedad o causa justa, el Presidente será sustituido por el Vicepresidente. También podrá nombrarse a un secretario ad hoc cuando se requiera.

años a un Gerente, quien podrá ser reelegido en forma sucesiva. Será una persona de reconocida capacidad técnica y plena confianza de la Junta Directiva. Para su nombramiento y remoción se requerirá mayoría calificada.

Las funciones del Gerente serán las de un administrador general, de acuerdo con los propósitos de esta ley y las políticas de la Junta Directiva. Será el jefe superior de todas las instancias de la empresa y su personal, excepto de la auditoría interna; además, será responsable, ante la Junta Directiva, por el desempeño administrativo eficiente y correcto de la Institución.

El Gerente representará legal y extrajudicialmente a la Institución; podrá sustituir su mandato, en todo o en parte, revocar sustituciones y otorgar otras de nuevo, conservando siempre sus facultades.

• a)Formular y dirigir los programas de trabajo y los planes de organización interna y funcional de la Junta Administrativa del Servicio Eléctrico Municipal de Cartago, para presentarlos a consideración de la Junta Directiva.
• b)Nombrar al personal y removerlo conforme a las leyes, los reglamentos y demás disposiciones legales pertinentes. Someterá a la decisión de la Junta Directiva los nombramientos o remociones de los jefes departamentales.
• c)Formular los presupuestos anuales ordinarios y los extraordinarios, con sujeción a las leyes, los reglamentos y las demás
• d)Presentar a la Junta Directiva los informes económicos y financieros, así como los informes de ejecución y liquidación presupuestaria trimestral y anual.
• e)Aprobar las compras que reglamentariamente le autorice la Junta Directiva.
• f)Tramitar, por vía judicial, todas las deudas originadas en los servicios prestados y cualesquiera otros daños y perjuicios causados a la Institución. Las certificaciones por deudas, que al respecto emita la contabilidad de la empresa, constituyen título ejecutivo.
• g)Incluir el seguimiento, control, evaluación y presentación ante la Junta Directiva de propuestas para aprobar, modificar o ajustar las tarifas de los diferentes servicios públicos que administrará la Institución.
• h)Celebrar los contratos y ejecutar actos de su competencia.
• i)Preparar un informe anual de labores de la Institución.
• j)Informar a la Junta Directiva sobre los asuntos de la Institución.
• k)Solicitar de oficio, a la Municipalidad del cantón Central de Cartago o al Poder Ejecutivo, el inicio del trámite de remoción o sustitución de un miembro de la Junta Directiva, de acuerdo con el artículo 5 de la presente ley.
• l)Otras funciones que le asigne la Junta Directiva.

año, a un auditor interno, quien podrá ser reelegido en forma indefinida; deberá ser Contador Público Autorizado y asistirá a las sesiones de la Junta Directiva con voz pero sin voto. Para removerlo o destituirlo se observará lo dispuesto en la Ley Orgánica de la Contraloría General de la República.

que en virtud de esta ley pasan a poder de la Municipalidad y administrará la Junta conforme lo indica esta ley, así como todas las mejoras y aumentos que lleguen a producirse bajo la administración de la Junta, pertenecen a la Municipalidad de Cartago.

Municipal de Cartago podrá contratar con cualquier entidad, pública o privada, la recaudación del pago de los servicios públicos que preste, o establecer sus propias oficinas de recaudación. Sin embargo, siempre mantendrá sus fondos en dinero efectivo depositados en cuentas corrientes de los bancos comerciales del Estado, y en títulos valores, siempre que esto no le limite la actividad financiera normal a la Institución.

Municipal de Cartago estará obligada a velar para que las tarifas, los precios y las condiciones de los servicios públicos que preste sean las más favorables para el consumidor, de conformidad con los principios de servicio al costo y equilibrio financiero. Dentro de los propósitos de su ley de creación, tratará de mantener una política de precios concordante con las de las demás empresas distribuidoras.

En materia de regulación del servicio, la Institución se regirá por la Ley de la Autoridad Reguladora de los Servicios Públicos, No. 7593, de 9 de agosto de 1996.

Municipal de Cartago podrá realizar las gestiones comerciales, legales y financieras necesarias para el desempeño de su cometido, dentro de las normas corrientes de contratación que le permita su situación financiera, sin incurrir en riesgos indebidos para la estabilidad de la empresa, conforme a las disposiciones legales vigentes.

Administrativa del Servicio Eléctrico Municipal de Cartago, podrá celebrar contratos de asociación empresarial con empresas nacionales o extranjeras, públicas o privadas, con el objeto de emprender en conjunto con ellas el desarrollo y la explotación tanto de las obras como de los servicios que presta.

Eléctrico de Cartago estará constituido por los bienes muebles e inmuebles adquiridos y los que llegue a adquirir, así como por los que reciba gratuitamente de la Administración Pública, centralizada y descentralizada, las empresas públicas y cualquier otra institución o persona pública o privada, nacional o extranjera.

recursos financieros por medio de emisiones de títulos valores, que, junto con la contratación de préstamos que efectúe la Junta, se regirán por la legislación vigente sobre la materia.

A la Junta Administrativa del Servicio Eléctrico Municipal de Cartago se le aplicará el mismo Régimen de contratación administrativa que al Instituto Costarricense de Electricidad, establecido en la normativa vigente.

• a)El Instituto Costarricense de Electricidad traspasará a la Municipalidad de Cartago a más tardar tres meses después de promulgada la presente ley, por el precio que adelante se indica, los siguientes bienes de su propiedad; las redes eléctricas de la Ciudad de Cartago, parte oriental y occidental de El Carmen, San Nicolás, San Francisco, Guadalupe, Tierra Blanca, El Sanatorio, Dulce Nombre, Distrito 1º de Paraíso, San Rafael de Oreamuno, Cot, Potrero Cerrado, Santa Rosa, El Tejar de El Guarco, San Isidro, Barro Morado y El Radio.
• b)El Instituto y la Junta convendrán el traspaso del equipo de transportes, útiles y demás materiales y enseres que formen parte actualmente de la Agencia del Instituto en Cartago y destinado a los servicios eléctricos en los lugares anteriormente mencionados, ello se hará dentro del plazo indicado en el aparte anterior.
• c)Toda línea de voltaje igual o superior a 33.000 voltios, forma parte del sistema de transmisión del Sistema Central Interconectado, de propiedad del Instituto Costarricense de Electricidad, seguirá bajo su dominio y control de operación.
• d)Seguirán de propiedad de dicho Instituto aquellas líneas existentes así como las futuras necesarias para la transmisión de energía en dicho Sistema Central Interconectado y para suministrar la energía que la Junta Eléctrica necesita adquirir para completar la demanda de las zonas bajo su radio de acción.
• e)Los consumidores de energía a tensión de 33.000 voltios, serán servidos por el Instituto Costarricense de Electricidad. Sin embargo, el Instituto podrá otorgar a la Junta la administración de estos servicios.
• f)Los seguros sobre las redes y sobre las estaciones y la depreciación de las mismas, así como los demás gastos legalmente procedentes, serán factores de costo de los servicios del sistema de la Junta.
• g)La Junta podrá recurrir al Sistema Bancario Nacional a fin de que dentro de sus propias regulaciones, le pueda brindar medios para financiar el adecuado cumplimiento de sus fines.
• h)Organizada la Junta Administrativa y juramentados sus miembros, tan pronto reciba las instalaciones, daría comienzo a prestar servicios.

El avalúo de los bienes que reciba la Junta indicará el valor original menos la depreciación acumulada, según los libros del Instituto Costarricense de Electricidad.

• i)El Instituto Costarricense de Electricidad queda autorizado para traspasar a la Junta el contrato de compraventa de energía eléctrica suscrito con la Compañía Agrícola de Santiago S. A. existente entre ambas entidades; y el Servicio Nacional de Electricidad queda autorizado para regular las condiciones de las entregas de energía eléctrica de la Compañía a la Junta y para aprobar los convenios que al respecto celebraren estas dos últimas entidades.

Las compras de energía tanto del Instituto como de la Compañía deberán realizarse en forma tal que se garantice la menor utilización de ambas fuentes a fin de lograr el costo más bajo posible.

• j)Todos los bienes que el Instituto traspase a la Municipalidad de Cartago de acuerdo con la presente ley serán recibidos por la Junta mediante riguroso inventario y llegado el caso, deberá hacer, en igual forma, su devolución a la Municipalidad. Como administradora de una empresa de servicio público de electricidad, la Junta estará sujeta a todas las disposiciones legales y reglamentarias que rigen esa materia en el país, estará exenta de impuestos nacionales y municipales y gozará de franquicia postal y telegráfica.

Administrativa del Servicio Eléctrico Municipal de Cartago podrá utilizar vías, calles, plazas y demás lugares públicos; quedará obligada a reparar, con calidad igual o superior, los daños ocasionados, en coordinación con las autoridades competentes.

Un mes después de la entrada en vigencia la presente ley, se nombrará a cuatro miembros para completar la Junta Directiva; de ellos dos corresponderán a los nombrados directamente por la Municipalidad del cantón Central de Cartago y dos al Poder Ejecutivo.

Para mantener la rotación adecuada de los integrantes de la Junta Directiva, al vencer el plazo de los actuales directores, el Poder Ejecutivo nombrará un director y la Municipalidad designará a dos; en este último caso, los nombramientos deberán indicar los ajustes de período.

público a la Junta Administrativa del Servicio Eléctrico Municipal de Cartago y al personal correspondiente, de conformidad con el párrafo in fine del artículo 2 de esta ley, la Junta quedará facultada para colaborar con el pago del auxilio de cesantía de los funcionarios.

Se les reconocerá, como auxilio de cesantía, un mes de salario o fracción por cada año o fracción de antigüedad al servicio de la municipalidad respectiva. Esta última cancelará los años que jurídicamente esté autorizada y el resto lo asumirá la Junta. Dicho salario será el promedio de los últimos seis salarios brutos devengados.

de la vigencia de esta ley, la Junta Directiva podrá realizar una reorganización interna, procurando conservar a los empleados actuales hasta donde sea posible y convenga al interés público. Los empleados de los cuales sea necesario prescindir o los que soliciten el cese de la relación laboral, obtendrán como auxilio de cesantía el pago de un mes de salario o fracción por cada año de antigüedad reconocido por la Junta Administrativa del Servicio Eléctrico Municipal de Cartago, para efectos de vacaciones y anualidades. Dicho salario será el promedio de los últimos seis salarios brutos devengados. Estos empleados no podrán ser nuevamente nombrados empleados de la citada Junta hasta después de transcurrir cinco años.
