Throughout the full text - Complete Text of Norm 24282 Establishes the Category of Multiple Use Marine Area (AMUM) Complete Text acta: 12EF30 1 No. 24282-MP-MAG-MIRENEM (This executive decree was repealed by Article 16 of executive decree No. 41775 of June 8, 2019, "Creation of the governance mechanism for marine spaces subject to the Jurisdiction of the Costa Rican State") THE PRESIDENT OF THE REPUBLIC AND THE MINISTERS OF THE PRESIDENCY, OF NATURAL RESOURCES, ENERGY AND MINES, AND OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred upon them by Article 140, subsections 3 and 18 of the Political Constitution, and in accordance with the provisions of the Forest Law (Ley Forestal), No. 7174, the Law for the Conversion of MIRENEM, No. 7152, the Law Creating the National Parks Service, No. 6084, the Wildlife Conservation Law, No. 7317, the Law Creating INCOPESCA, No. 7384, and the Fisheries Law, No. 190.
Considering:
7227, of April 12, 1991, the Convention for the Protection and Development of the Marine Environment was approved, providing that States must establish protected zones to conserve rare or vulnerable ecosystems, as well as the habitat of depleted, threatened, or endangered species.
Considering its importance for future generations, in prior years, the country proceeded to protect the zones of greatest importance under the management category of National Park or Biological Reserve.
Likewise, the first article of the Law Creating INCOPESCA establishes that the Institution must attend to the guidelines set in said Plan.
Through it, the management, use, and conservation, as applicable, of the marine resource, as well as the coastal area, will be planned, in such a way as to protect marine habitats and their areas of influence, seeking a rational exploitation of the resources. Therefore, THEY DECREE:
The Marine Areas that are established must be based on technical criteria that demonstrate the need for their establishment, considering the integral protection of resources, from the ecosystem management point of view.
The AMUM may extend up to a maximum of 12 nautical miles, and their limits and recommended uses will be those defined in a Management Plan, for which the National Marine-Coastal Program must be a priority. Said Plan will be prepared necessarily by the Executive Branch, the decentralized public institutions with jurisdiction in the matter, and the Commission on the Coastal-Maritime Zone.

However, the approval, review, or updating of the Regulatory Plans for the maritime terrestrial zones adjacent to the Multiple Use Marine Areas must be consulted, before holding the Open Town Hall, with the National Parks Service, which must issue a decision within a period of one month, and whose opinion will be sought to be incorporated into the respective Regulatory Plans. Once the indicated period has elapsed without the administrative act being issued, the normal procedure will continue, without the opinion subsequently given being able to be claimed as binding.

EL PRESIDENTE DE LA REPUBLICA Y LOS MINISTROS DE LA PRESIDENCIA, DE RECURSOS NATURALES, ENERGIA Y MINAS Y DE AGRICULTURA Y GANADERIA En ejecución de las facultades que les confiere el artículo 140 incisos 3 y 18 de la Constitución Política, y de conformidad con lo dispuesto en la Ley Forestal, Nº 7174, Ley de Conversión de MIRENEM, Nº 7152, Ley de Creación del Servicio de Parques Nacionales, Nº 6084, Ley de Conservación de Vida Silvestre, Nº 7317, Ley de Creación del INCOPESCA, Nº 7384 y la Ley de Pesca, Nº 190.
Considerando:
Considerando su importancia para las generaciones futuras, en años anteriores, el país procedió a proteger las zonas de mayor importancia, bajo la categoría de manejo de Parque Nacional o Reserva Biológica.
Asimismo, el artículo primero de la Ley de Creación del INCOPESCA establece que la Institución deberá atender los lineamientos fijados en dicho Plan.
Por su medio, se planificará el manejo, uso y la conservación, según corresponda, del recurso marino, así como del área costera, de manera que se protejan los hábitats marinos y sus áreas de influencia, procurando una explotación racional de los recursos. Por tanto,
DECRETAN:
Las Areas Marinas que se establezcan, deberán fundamentarse en criterios técnicos, que demuestren la necesidad de su establecimiento, considerando la protección integral de los recursos, desde el punto de vista del manejo de los ecosistemas.
Las AMUM podrá extenderse hasta un máximo de 12 millas marítimas, y sus límites y usos recomendados, serán aquellos que se definan en un Plan de Manejo, para lo cual el Programa Nacional Marino Costero deberá ser prioritario. Dicho Plan será elaborado necesariamente por el Poder Ejecutivo, las instituciones públicas descentralizadas con competencias en la materia y la Comisión sobre la Zona Marítimo Costera.

Transcurrido el plazo indicado, sin que se emitiera el acto administrativo, se seguirá el trámite normal, sin que posteriormente pueda pretenderse la vinculancia de la opinión que se dé.
