1§ Que es competencia del Ministerio de Obras P£blicas y Transportes, de conformidad con lo prescrito mediante Ley N§ 4786 del 5 de julio de 1971 y sus reformas, ejercer la regulaci¢n, control y vigilancia, entre otras cosas, en lo concerniente a la construcci¢n de instalaciones portuarias, as¡ como el uso de las mismas y la navegaci¢n fluvial y mar¡tima.
2§ Que el art¡culo 5§ de la Ley sobre la Zona Mar¡timo Terrestre, N§ 6043 del 2 de marzo de 1977 posibilita la construcci¢n de instalaciones de protecci¢n y salvamento en las zonas cubiertas permanentemente por el mar, adyacentes a los litorales, seg£n autorizaci¢n que al efecto extiendan las respectivas municipalidades.
3§ Que, asimismo, el art¡culo 18 de la referida Ley sobre la Zona Mar¡timo Terrestre, N§ 6043, autoriza el uso de reas de la zona mar¡timo terrestre, cuando fuere indispensable su utilizaci¢n para el debido funcionamiento de plantas industriales, instalaciones de pesca deportiva, instalaciones artesanales, de obras portuarias, programas de maricultura, u otros establecimientos similares, siempre y cuando se cuente con la aprobaci¢n expresa, entre otros, por parte de la respectiva municipalidad, del Instituto Costarricense de Turismo, del Instituto Nacional de Vivienda y Urbanismo y del Ministerio de Obras P£blicas y Transportes.
4§ Que el Decreto N§ 7841-P del 16 de diciembre de 1977, Reglamento a la Ley sobre la Zona Mar¡timo Terrestre, si bien contiene en su art¡culo 2§ una serie de definiciones sobre algunos t,rminos de especial importancia, cuya comprensi¢n permite la debida interpretaci¢n de las normas jur¡dicas, en aplicaci¢n de casos concretos, requiere ser complementada con todo lo referente a la construcci¢n y operaci¢n de "marinas" con fines tur¡sticos.
