1°_ That it is State policy to prevent the sale and speculation of lands in Indigenous reserves.
2°_ That despite the are still cases of Indigenous persons who sell their lands, and then seek to settle in other reserves, causing multiple problems therein, and even re-offending in illegal land sales.
3°_ That it is necessary to regulate this situation, so that there is true compliance with the law.
4°_ That, on the other hand, Indigenous Law No. 6172 and related decrees have given Indigenous communities the power to manage their internal affairs, through their legal representatives, and each Indigenous reserve was recognized as a distinct entity, governed by its own customs and local government.
5°_ That in accordance with Article 38 of the regulation to Law No. 3859 on Community Development, persons who in some way harm the activities of the community may be disaffiliated from the development associations.

1°_ Que es política del Estado el impedir la venta y especulación de tierras en las reservas indígenas.
2°_ Que a pesar de la prohibición expresa establecida por la Ley indígena y decretos conexos todavía hay casos de indígenas que venden sus tierras, y luego buscan radicarse en otras reservas, causando en éstas múltiples problemas, e incluso vuelven a incurrir en ventas ilegales de terrenos.
3°_ Que es necesario regular esta situación, para que haya un cumplimiento verdadero de la ley.
4°_ que. por otra parte, la Ley Indígena N° 6172 y decretos conexos han dado à las o munidades indígenas la facultad de manejar sus asuntos internos, a través de sus representantes legales, y se reconoció cada reserva indígena como una entidad distinta, regida por sus costumbres propias y su gobierno local.
