ZONING REGULATION The Zoning Regulation is modified to adjust to the current version of the Manual of Regulatory Plans of the Costa Rican Tourism Institute, so that it reads as indicated below:
The Public Zone may not be subject to any occupation. It shall be dedicated to public use and especially to the free transit of persons. The passage of motor vehicles or pack animals is not permitted, except in cases of exception according to article 9 of the Regulation of Law 6043. The progressive eviction of those illegal buildings or installations and their removal form part of the management program for the ZMT.
Those roads in the Public Zone where vehicular traffic is suppressed shall be used as pedestrian trails. In the public zone, any activity tending to modify its natural state is prohibited, including slashing (chapia) and forest thinning practices.
The concessionaire bordering the Public Zone must collaborate with the maintenance, protection, and improvement of the natural resources existing therein, contributing resources to the Municipality to be used in the sector. These actions must be supported, advised, and supervised by the Costa Rican Tourism Institute and the Municipality of Carrillo.
Permitted Uses The permitted uses of Basic Services are: Locker room, restrooms, showers, lifeguard, medical, information, communications, parking.
f.2) Non-permitted uses: Tourist lodging, swimming pool, dwelling, and any other not indicated in the permitted uses.
Tourist Commercial (TAN 3): 2 floors at 10 meters maximum, to the highest point of the building.
Setbacks (Retiros) The side, rear, and front setbacks shall be governed according to the provisions established in Article 65 of the Regulation of the Maritime-Terrestrial Zone Law.

The assignment of large lots of land and the provision of infrastructure to attract private investment is favored in these areas. The businesses that establish themselves in these areas must necessarily have the tourist declaration issued by the ICT and for this purpose must observe the provisions of the Regulation of tourist businesses and activities, and the Regulation of tourist lodging businesses, both issued by the ICT.
Setbacks. The side, rear, and front setbacks shall be governed according to the provisions established in Article 65 of the Regulation of the Maritime-Terrestrial Zone Law.
Planned Area for High-Density Tourist Development h) Definition. These are areas intended for the development of tourist lodging and restaurant businesses, at medium and low densities. The assignment of large lots of land and the provision of infrastructure to attract private investment is favored in these areas. The businesses that establish themselves in these areas must necessarily have the tourist declaration issued by the ICT and for this purpose must observe the provisions of the Regulation of tourist businesses and activities, and the Regulation of tourist lodging businesses, both issued by the ICT.
Location. The TAP AD zones may only be located, within the planning, no less than 75 meters from the marker line of the coastal front. Of the total area of the sector to be planned, no more than 10% maximum may be exceeded for TAP AD.
Setbacks. The side, rear, and front setbacks shall be governed according to the provisions established in Article 65 of the Regulation of the Maritime-Terrestrial Zone Law.
Tourist use: Tourist businesses with a tourist declaration issued by the ICT. The type, characteristics, and complementary services of the businesses shall correspond to those included in the Regulation of tourist lodging businesses and the Regulation of tourist lodging businesses, both issued by the ICT.
Lodging with campsites: Reception, showers, restroom services, locker room, parking for users, space for setting up tents, internal circulation paths.
Residential Use:
Recreational dwelling without commercial purposes for the use of the concessionaire and their family.
Rental dwellings with an administrative and maintenance area.
Commerce: Stores, grocery stores, sodas, cafeterias, souvenirs, and small businesses.
And any other not indicated in the permitted uses.

The Municipality of Carrillo shall suspend any work that is executed contrary to the zoning and roadways and their requirements, being able to request the assistance of the Public Force for this purpose.
a. Furthermore, all civil and criminal sanctions contemplated in the corresponding laws shall be applied.
Both the offenders and the officials responsible for the non-compliance with this Regulation, who consent to its violation, shall be subject to said sanctions.
TRANSITORY PROVISIONS
Once the contract ends, all the provisions set forth in this Regulation must be fully observed.
MODIFICATION OF THE REGULATION AND EFFECTIVE DATE. Modifications and variants that are desired to be introduced to this Regulation shall be submitted to the technical criteria of the Costa Rican Tourism Institute and the procedure provided for in article 17 of the Urban Planning Law No. 4240 of November 15, 1968, at the express request of the local government, in accordance with the provisions of opinion C-011-99 of the Comptroller General of the Republic. It takes effect upon its publication in the Official Gazette and any prior municipal provision that opposes its rules is hereby repealed.

1. REGLAMENTOS DEL PLAN REGULADOR INTEGRAL PLAYA HERMOSA - EL COCO - BAHÍA AZUL 1.1. REGLAMENTO PARA EL COBRO DEL CANON POR CONCESIÓN El Reglamento del cobro del canon no se modifica, por lo que no se incluye en lo correspondiente del trámite de rectificación, y se mantiene tal y como está publicado en el Alcance N°290 del Diario Oficial La Gaceta del miércoles 7 de diciembre de 2016.
1.2. REGLAMENTO DE DESARROLLO SOSTENIBLE El Reglamento de Desarrollo Sostenible no se modifica, por lo que no se incluye en lo correspondiente del trámite de rectificación, y se mantiene tal y como está publicado en el Alcance N°290 del Diario Oficial La Gaceta del miércoles 7 de diciembre de 2016.
1.3. REGLAMENTO DE ZONIFICACIÓN El Reglamento de Zonificación, se modifica para ajustarse a la versión vigente del Manual de Planes Reguladores del Instituto Costarricense de Turismo, para que se lea como se indica a continuación:
La Zona Pública no podrá ser objeto de ocupación alguna. Estará dedicada al uso público y en especial al libre tránsito de personas. No se permitirá el paso de vehículos automotores ni de animales de carga salvo casos de excepción de acuerdo al artículo 9 del Reglamento de la Ley 6043. El desalojo progresivo de aquellas edificaciones o instalaciones ilegales y su remoción, forman parte del programa de ordenamiento de la ZMT.
Se utilizarán como senderos peatonales aquellas vías en Zona Pública donde sea suprimido el tránsito vehicular. En la zona pública está prohibida toda actividad tendiente a modificar el estado natural de la misma, entre ellas la chapia y la práctica de raleo de bosque.
El concesionario colindante con la Zona Pública deberá colaborar con el mantenimiento, protección y mejoramiento de los recursos naturales existentes en ella, aportando recursos a la Municipalidad para que sean utilizados en el sector. Estas acciones deberán ser apoyadas, asesoradas y fiscalizadas por el Instituto Costarricense de Turismo y la Municipalidad de Carrillo.
Usos permitidos Los usos permitidos de Servicios Básicos son: Guardarropa, sanitarios, duchas, salvamento, médico, información, comunicaciones, parqueos d) Localización (TAN 2). El Área Núcleo para Atracciones Turísticas en la categoría de Esparcimiento Público no se encuentra en la zonificación de este sector costero.
f.2) Usos no permitidos: Alojamiento turístico, piscina, vivienda y cualquier otro que no esté indicado en los permitidos.

Las empresas que se instalen en estas áreas deberán contar necesariamente con la declaratoria turística emitida por el ICT y para esto deberán observar lo dispuesto en el Reglamento de las empresas y actividades turísticas, y el Reglamento de empresas de hospedaje turístico, ambos dictados por el ICT.

Las empresas que se instalen en estas áreas deberán contar necesariamente con la declaratoria turística emitida por el ICT y para esto deberán observar lo dispuesto en el Reglamento de las empresas y actividades turísticas, y el Reglamento de empresas de hospedaje turístico, ambos dictados por el ICT.
Ubicación. Las zonas TAP AD solo podrán ser ubicadas, dentro de la planificación, a no menos de 75 metros de la línea de mojones del frente costero. Del área total del sector a planificar no se podrá sobrepasar el 10% como máximo para TAP AD.
Retiros. Los retiros laterales, posteriores y anteriores, se regirán de acuerdo a lo establecido en el Artículo 65 del Reglamento de la Ley de la Zona Marítimo Terrestre.
Uso turístico: Empresas turísticas con declaratoria turística emitida por el ICT. El tipo, características y servicios complementarios de las empresas corresponderán a los incluidos en el Reglamento de empresas de hospedaje turístico y el Reglamento de empresas de hospedaje turístico, ambos dictados por el ICT.
Hospedaje con tiendas para acampar: Recepción, duchas, servicios sanitarios, guarda ropa, parqueo para usuarios, espacio para instalación de tiendas de campaña, circulaciones internas.
Uso Residencial:
Vivienda de recreo sin fines comerciales para uso del concesionario y su familia.
Viviendas de alquiler con área administrativa y de mantenimiento.
Comercio: Tiendas, abarrotes, sodas, cafeterías, suvenir, y pequeños comercios.
Y cualquier otro que no esté indicado en los permitidos f) Concesiones. Deberá cumplirse con lo que establece la Ley 6043 y su Reglamento. Las empresas que se instalen en estas áreas deberán contar necesariamente con la declaratoria turística emitida por el ICT y para esto deberán observar lo dispuesto en el Reglamento de las empresas y actividades turísticas, y el Reglamento de empresas de hospedaje turístico, ambos dictados por el ICT.

f. Concesiones. No se darán en concesión por ser vías públicas.
g. Requisitos De 14 metros de derecho de vía con 9 metros de calzada.

De 8.5 metros de derecho de vía con 6 metros de calzada.

Cada área para estacionamiento: mínimo 300 m²; máximo 10,000 m² Cobertura N/P Densidad N/P Altura N/P Retiros N/P SANCIONES. Las contravenciones de las normas del presente Reglamento se sancionarán de la siguiente manera:
La Municipalidad de Carrillo suspenderá toda obra que se ejecute en contra de la zonificación y vialidad y sus requisitos, pudiendo disponer para ello del auxilio de la Fuerza Pública.
a. Se aplicarán, además, todas las sanciones civiles y penales contempladas en las leyes correspondientes.
Serán acreedores a dichas sanciones, tanto los infractores como los funcionarios responsables del incumplimiento de este Reglamento, que consienten en la violación del mismo.
TRANSITORIOS
Una vez finalizado el contrato, deberán observarse, en forma completa, todas las disposiciones dictadas en el presente Reglamento.
MODIFICACIÓN DEL REGLAMENTO Y VIGENCIA. Las modificaciones y variantes que se deseen introducir al presente Reglamento, serán sometidas al criterio técnico del Instituto Costarricense de Turismo y la tramitación prevista en el artículo 17 de la Ley de Planificación Urbana N° 4240 del 15 de noviembre de 1968, a solicitud expresa del gobierno local, de conformidad con las disposiciones del dictamen C-011-99 de la Controlaría General de la República. Rige a partir de su publicación en el Diario Oficial y queda derogada toda disposición municipal anterior que se oponga a sus normas.
