For the purposes of these regulations, the following is understood by:
1. Sidewalk (Acera): Section of the right-of-way, located at the ends of the roadway for the transit of pedestrians.
2. Stormwater (Aguas pluviales): Water from rainfall that flows superficially through gutters or sewers.
3. Wastewater (Aguas servidas): Domestic wastewater that is the result of the daily activities of people. It requires channeling and treatment systems in order to comply with current regulations. It is also called black water or sewage water.
4. Municipal Mayor's Office (Alcaldía Municipal): The highest-ranking administrative body, which holds the status of head of the departments, supervises, organizes, and coordinates the functioning of the Municipality.
5. Storm sewer system (Alcantarillado pluvial): System that collects and disposes only of stormwater.
Comprised of catch basins (tragantes), manholes, headwalls, pipes, and others.
6. Storage (Almacenamiento): Action of temporarily retaining waste while it is delivered to the collection service, processed for its use or change of its characteristics, or disposed of.
7. Real estate (Bien inmueble): Any land with or without constructions or infrastructure works.
8. Manhole (Caja de registro): Box within the sewerage system for the purpose of allowing the inspection and cleaning of the drain and channeling water to the underground pipes.
9. Roadway (Calzada): Surface intended for vehicular traffic located between the curb-and-gutter (cordones de caño), gutters, or drainage ditches and is part of the public thoroughfare.
10. Category (Categoría): Classification of a taxpayer according to the estimation of waste they generate.
11. Recovery center for recoverable waste (Centro de recuperación de residuos valorizables): A permanent site for the reception and temporary storage of waste for its valorization, where recoverable materials can be weighed, classified, and separated according to their nature for their subsequent commercialization. Also known as a collection center (centro de acopio).
12. Collector (Colector): The infrastructure into which several underground pipes converge, equipped with a manhole cover for the purpose of inspecting the pipes.
13. Compost (Compost): Result of the decomposition and stabilization by the action of microorganisms of organic waste through composting processes or anaerobic fermentation.
14. Composting (Compostaje): Technique that allows the aerobic decomposition of biodegradable organic matter in a controlled manner to achieve a usable product as a soil improver.
15. Municipal Council (Concejo Municipal): Highest body of the Municipality, which is composed of a deliberative body made up of council members (regidores) and district representatives (síndicos).
16. Container (Contenedor): Receptacle intended for the temporary storage of non-hazardous waste of domestic, commercial, or industrial origin.
17. Collective container (Contenedor colectivo): Larger volume receptacle intended for the temporary storage of waste from a group of users, located at a common point for them.
18. Taxpayer (Contribuyente): Owner or possessor of a property where the Municipality provides public services.
19. Curb and gutter (Cordón y caño): Drain for the evacuation of stormwater from the roadway, which is located parallel between the edge of the roadway and the sidewalk or green strip of the thoroughfare.
20. Effective cost (Costo efectivo): For the purposes of these regulations, the effective cost of the work is the sum of the cost of materials, labor, equipment use, as well as its depreciation, contingencies, administrative and financial expenses, cost of collection, disposal, and treatment of solid waste if required, as well as other direct and indirect costs related to the work, plus ten percent (10%) profit for development.
21. Body of water (Cuerpo de agua): Any spring (manantial), river, stream (quebrada), permanent or non-permanent brook (arroyo), lake, lagoon, natural or artificial reservoir, peat bog (turbera), or freshwater swamp (pantano).
22. Final disposal (Disposición final): Orderly and definitive placement, distribution, and confinement of ordinary waste in a site designed for this purpose.
23. Communal facilities (Facilidades comunales): Public area planned for the installation of buildings for communal use, whether cultural, educational, sanitary, security, or other with that purpose. 24. Weighting factor (Factor de ponderación): Value established using as reference the domestic or housing unit.
25. Source of generation (Fuente de generación): Place where the waste is generated.
26. Official (Funcionario): The natural person who, in exchange for remuneration, provides the Municipality with their material, intellectual, or both types of services, personally, subordinately, and on behalf of another, by virtue of a valid and effective act of appointment, through an express or implied, verbal or written, individual or collective employment contract.
27. Generator (Generador): Natural or legal person, public or private, who generates waste, through the development of productive, service, commercialization, or consumption processes that are within municipal jurisdiction.
28. Integrated Waste Management (Gestión Integral de Residuos, GIR): Articulated and interrelated set of regulatory, operational, financial, administrative, educational, planning, monitoring, and evaluation actions for the management of waste, from its generation to final disposal.
29. Authorized manager (Gestor autorizado): Natural or legal person, public or private, responsible for the total or partial management of solid waste and duly authorized for that purpose by the Ministry of Health and this municipality.
30. Large generator (Gran generador): Natural or legal person who produces large quantities of waste. Includes apartment buildings, condominiums, supermarkets, shopping centers, educational centers, medical centers, public and private institutions.
31. Incentives (Incentivos): Refers to the benefit granted to generators who contribute to correct management, demonstrating minimization and the application of the hierarchy in integrated waste management.
32. Infrastructure (Infraestructura): Any work for the development and proper functioning of a community, such as: public thoroughfares (paths, roads, streets, boulevards (alamedas)), storm or sanitary sewerage, aqueducts, electricity, signage, etc.
33. Inspector (Inspector): The competent official, for surveillance, preventive measures, the survey, the inspection both on-site and technological of possible infractions of the laws and these regulations.
34. Leachate (Lixiviados): Liquid that forms from the reaction, drag, or filtering of materials contained in waste and that contains in dissolved form or in suspension substances that can infiltrate soils or run off from the sites where solid waste is deposited and that can lead to contamination of the soil and of bodies of water.
35. Waste handling (Manejo de residuos): Set of technical and operational activities of waste management that includes storage, collection, transportation, valorization, treatment, and final disposal of ordinary, recoverable, and non-traditional solid waste generated in the Canton.
36. Municipality (Municipalidad): State legal entity with territorial jurisdiction over the canton of Desamparados. It is responsible for the administration of local services and interests, with the purpose of promoting the integral development of the Canton in harmony with the national development plan.
37. License holder (Patentado): Natural or legal person with a commercial license to exercise lucrative activities.
38. Municipal Plan for Integrated Waste Management (Plan Municipal de Gestión Integral de Residuos, PMGIR): Instrument that defines the cantonal policy on the matter and will guide municipal and/or cantonal actions on the issue within its area of jurisdiction. It is the result of a planning process that is preferably prepared in a participatory manner by the municipality incorporating the various actors of the Canton.
39. Possessor (Poseedor): Natural or legal person who exercises dominion over a property without having a title registered in the Public Registry.
40. Cleaner production (Producción más limpia): Integrated preventive strategy applied to productive processes, products, and services, in order to increase efficiency and reduce risks for human beings and the environment.
41. Owner (Propietario): Natural or legal person who exercises dominion over real estate through a public document registered in the Public Registry.
42. Recycling (Reciclaje): Transformation of waste through different valorization processes that allow its economic and energy value to be restored, thus avoiding its final disposal, as long as this restitution implies a saving of energy and raw materials without prejudice to health and the environment.
43. Collection (Recolección): Action of collecting waste under municipal jurisdiction at the sources of generation or containers, according to what is established in these regulations, to be transported to transfer stations, treatment facilities, or final disposal.
44. Private collection (Recolección privada): Any collection process carried out directly between a generator and a waste manager within the territory of the Canton, without the direct participation of the Municipality in the process.
45. Selective collection (Recolección selectiva): Separate collection service for waste previously separated at source that allows certain waste to be valorized.
46. Sanitary landfill (Relleno sanitario): Engineering method for the final disposal of waste generated in the Canton in accordance with the Regulation on Sanitary Landfills (Reglamento de Rellenos Sanitarios).
47. Waste (Residuo): Solid, semi-solid, liquid, or gas material, whose generator or possessor must or needs to dispose of it, and which can or must be responsibly valorized or treated or, failing that, be managed by adequate final disposal systems.
48. Construction and/or demolition waste (Residuo de construcción y/o demolición): Those solid wastes generated in tasks such as: the construction, reconstruction, repair, alteration, expansion, and demolition of buildings, and urbanization works of any nature, whether urban or rural.
49. Yard waste (Residuo de jardín): Those wastes obtained from pruning and maintenance tasks of gardens, such as: grass, leaves, branches, flowers, fruits, among others. They can be considered biodegradable waste.
50. Special handling waste (Residuo de manejo especial): Those that, due to their composition, transportation needs, storage conditions, forms of use or recovery value, or a combination of these, pose significant risks to health and systematic degradation of the quality of the ecosystem, and therefore require removal from the normal stream of ordinary waste.
51. Electronic waste (Residuo electrónico): Those wastes derived from electronic devices for both domestic and commercial use as described in Annex I (Anexo I) of the Regulation for the Integrated Management of Electronic Waste in Costa Rica (Reglamento para la Gestión Integral de los Residuos Electrónicos de Costa Rica). Considered part of this waste are the components, subassemblies, and consumables that are part of the product.
52. Non-recoverable waste (Residuo no valorizable): Waste that has no use or recovery value and that must be properly disposed of in a sanitary landfill.
53. Ordinary waste (Residuo ordinario): Waste of mainly household origin or that comes from any other commercial, service, industrial activity, cleaning of roads and public areas, that has characteristics similar to household waste.
54. Hazardous waste (Residuo peligroso): That which, due to its corrosive, radioactive, toxic, infectious, biological characteristics, or a combination of them, can cause toxic, explosive, corrosive, radioactive, biological, bioinfectious, flammable, combustible, or other reactions that can cause damage to the health of people and the environment.
55. Sharp waste (Residuo punzo-cortante): Any object capable of penetrating and/or cutting tissues, including surgical medical instruments; laboratory articles, dental instruments, as well as general use articles: such as light bulbs (all types), fluorescent tubes, and all types of staples and metal and plastic bands.
56. Solid waste (Residuo sólido): Post-consumer solid or semi-solid material whose generator or possessor must or needs to dispose of it.
57. Valorizable waste (Residuo valorizable): Waste that has reuse value or has potential to be valorized through recycling or composting processes.
58. Bulky or non-traditional waste (Residuo voluminoso o no tradicional): Those objects disposed of by their owners sporadically, upon having ended their useful life, which due to their size, weight, or characteristics are not suitable for ordinary collection and require a special collection service; such as refrigerators, water heaters, stoves, mattresses, washing machines, or any furniture of similar characteristics.
59. Waste separation (Separación de residuos): Procedure by which it is prevented at the generating source that waste be mixed, which allows it to be disposed of separately, for collection purposes.
60. Separation at source (Separación en la fuente): Procedure by which it is prevented at the generating source that waste be mixed, to facilitate the use of recoverable materials.
61. Waste management service (Servicio de gestión de residuos): The management of waste under municipal jurisdiction includes mainly the storage, collection, sweeping and cleaning of roads and public spaces, as well as the transportation, transfer, treatment, and final disposal of waste.
62. Municipal services (Servicios municipales): Set of solid waste handling services, road cleaning, maintenance of green areas, and storm sewer cleaning provided by the Municipality.
63. Collective storage system (Sistema de almacenamiento colectivo): A defined and enclosed area, intended for the temporary collective storage of solid waste, awaiting the collection service.
64. Taxable person (Sujeto pasivo): Any natural or legal person obliged to comply with tax obligations, as a taxpayer, whether as owner or possessor of a land to which the service is provided.
65. Rate (Tarifa): Denomination given to the mathematical expression representing the cost that the taxpayer must pay for the effective or potential provision of the public service.
66. Public service fee (Tasa del servicio público): Tax whose obligation has its taxable event (hecho generador) as the effective or potential provision of a public service, individualized for the taxpayer, and whose revenue must not have a destination unrelated to the service, which is the reason for the obligation.
67. Treatment (Tratamiento): Transformation of waste or specific parts into new products or the change of characteristics, such as recycling, composting, mechanical-biological treatment, thermal treatment, among others.
68. Domestic or housing unit (Unidad doméstica o habitacional): Structure built on a property where a waste generator lives.
69. Served unit (Unidad servida): Commerce, institution, or residence to which the service is provided.
70. User (Usuario): Has the category of user for the purposes of providing the services regulated herein, any natural and legal person who is affected or benefited by the Integrated Waste Management (Gestión Integral de Residuos, GIR) services.
71. Valorization (Valorización): Set of associated actions whose objective is to give added value to waste for productive processes through the recovery of materials and/or energy use and the rational use of resources.
72. Open dump (Vertedero): Site without prior preparation, where waste is deposited, without technique or using very rudimentary techniques, and where adequate control is not exercised.
73. Public thoroughfare (Vía pública): Any land of public domain and common use, which by provision of the administrative authority is designated for free transit, in accordance with the laws and urban planning regulations, also includes that land that has in fact been designated for public use.
74. Green area (Zona verde): Public undeveloped land partially or totally covered with vegetation (grass, trees, or shrubs).
