Heard before the Agrarian Court of the Second Judicial Circuit of the Southern Zone, seated in Corredores.- BACKGROUND:

  1. 1The plaintiff, [Nombre1], brought this ordinary proceeding, valued at one million five hundred thousand colones, seeking a judgment declaring the following: “...1) That the complaint be granted in all respects.2) That the undersigned’s property be declared landlocked, without sufficient means of ingress and egress as stipulated by the national legal system.3) That a compulsory right-of-way easement (servidumbre forzosa de paso) be established, with the undersigned’s property registered in the province of Puntarenas under registration number [Placa1] as the dominant estate (fundo dominante), and the properties registered in the province of Puntarenas under registration [Placa2] as the servient estates (fundos sirvientes).4) That said easement be six meters wide and approximately four hundred fifty meters long, without prejudice to reliable evidence establishing that it should be longer or shorter, crossing the defendants’ property in the direction of [Dirección1].5) That the defendant be ordered to refrain from obstructing passage by the undersigned, any other co-owner, or any person authorized to enter by that road, under penalty, upon failure to comply, of forwarding certified copies to the Public Prosecutor’s Office for the offense of disobedience of authority.6) That a certified enforceable copy of the judgment be issued to the Public Registry of Property so that said easement may be recorded against the undersigned’s property as the dominant estate and against the defendants’ property as the servient estates.7) That the defendant be ordered to pay the procedural costs and attorney’s fees arising from the complaint...,” (7 to 9 and reverse).-
  2. 2The defendant Association denied the action brought against it and raised the defense of mandatory joinder of plaintiffs (litis consorcio activo necesario), which was rejected by judgment 189-2016 of fourteen hours and thirty-six minutes on ten August two thousand sixteen. In turn, co-defendant [Nombre3], having been duly served, denied the complaint against her and raised the defenses of lack of legal right, lack of standing to sue and be sued, lack of a present interest, and sine actione agit (folios 77 to 83; and 86 to 90).-
  3. 3Judge Marisel Zamora Arias of the Agrarian Court of the Second Judicial Circuit of the Southern Zone, by judgment Nº 02-2020 of fifteen hours and twenty-four minutes on nine January two thousand twenty, ruled: “THEREFORE: In accordance with the foregoing, and it having first been demonstrated that the plaintiff’s property, namely property number 32168 006 in the province of Puntarenas, is landlocked property and, as such, has no access to the public road, and it not having been demonstrated that any better means of access to the property existed, the ordinary agrarian claim for a compulsory right-of-way easement brought by Mr. [Nombre1] () against ASOCIACIÓN (sic) ADMINISTRADORA DE SERVICIO DE AGUA POTABLE DE BARRIO SAN RAFAEL is GRANTED as follows:1) A compulsory right-of-way easement is established in favor of property number CED7 one, CED8 two, CED8 three, CED8 four, CED9 and CED8 six, and burdening property thirty thousand three hundred twenty-six (sic) zero zero zero, owned by ASOCIACIÓN ADMINISTRADORA DE SERVICIO DE AGUA POTABLE DE BARRIO SAN RAFAEL DE CORREDORES.2) The established easement shall (sic) be four meters wide and shall run from the landlocked estate to the road [Dirección2], with a length of 178 linear meters and three centimeters.3) The owners (sic) of the dominant estate shall exercise due care to protect and respect the pipelines (sic) running along the same route as the easement, which belong to the defendant Asada, and shall also (sic) protect the valves on the pipeline located on the property.4) This easement is for travel on foot, on horseback, and by vehicle (sic).5) As compensation (sic) for the easement right, the plaintiff shall pay the defendant the value of the easement strip, which in this case is four hundred thirty-seven thousand eighty-three colones.6) The easement established by this judgment confers no right whatsoever to use the bridge belonging to the defendant Asada for access to its property.7) The owner of the servient estate is hereby advised that, once this judgment becomes final, it shall thereafter refrain from obstructing passage over the declared easement. 6) This matter is decided without a special award of costs,” (See Virtual Desktop of the Agrarian Court of Corredores, under Associated Documents, file dated 9/1/20 at 15:24:56 p.m.).-
  4. 4Counsel for the co-defendant Association filed an appeal, expressly stating the grounds on which he relied to challenge the trial court’s position (See Virtual Desktop of the Agrarian Court of Corredores, [Dirección3], file dated 17/1/20 at 4:04:28 p.m.).-
  5. 5The statutory requirements have been observed in the conduct of the proceedings, and no errors or omissions capable of rendering the judgment null and void are apparent.-

CONSIDERATIONS

I- Proven Facts. The proven facts of the appealed judgment are affirmed because they are supported by evidence contained in the record.

II- The defendant Association appeals first-instance judgment number 02-2020 of 15:24 hours on 9 January 2020 (digital case file/documents/date: 17/01/2020 04:04:28), which grants the claim to establish a right-of-way easement. In its appeal, it raises substantive grounds of error and also alleges that the decision is null and void due to incongruity. In this regard, it claims that the defect of ruling beyond the relief requested (extrapetita) is present because relief not included in the complaint was granted. This is because the action did not request authorization for the right-of-way easement to be used by vehicles. Yet the appealed decision expressly decrees that it is established for travel by vehicle. It points out that the judicial inspection shows that the area recommended as a right-of-way easement in the expert appraisal ordered by the court is not suitable for vehicular travel, which means that it would have to be modified or altered in some manner in order to comply with that order.

It states that this places at risk not only the existing pipelines and works for the collection and conveyance of drinking water, but also the property’s forest cover (cobertura boscosa), which is located along the banks of the river [Dirección4]. It recounts that the ruling places its private property at risk, as well as the environmental balance currently existing on the property, given its nature and designated use for forest cover and rural aqueduct civil works. As its second claim on appeal, it states that there is incongruity due to a failure to rule on all relief requested (infrapetita), because not all the Association’s requests were decided. It asserts that, when answering the action, it requested in its filing: “A. That the plaintiff, the other current co-owners, or any subsequent owner of the dominant property must refrain from using heavy machinery to widen the granted easement in any manner.

(listed as request ‘B’).” The appeal states that the judgment did not address that request, either to grant or deny it. It indicates that, to safeguard its interests, the owners of the dominant estate must be prohibited from altering the easement with heavy machinery because of the environmental and civil damage that such conduct could cause. For that reason, it requested that the court rule on this issue when issuing judgment. This was omitted. It adds that, in its answer, it requested: “B. That the plaintiff, or one or more of the other current co-owners, or any subsequent owner of the dominant property, must safeguard and avoid damaging the pipelines, springs (nacientes), tanks, and any other instrument or installation existing on my client’s property that has been used or designated to provide drinking-water service to the community of [Dirección5]. (listed as request ‘C’).” In this regard, the appellant asserts that the court referred only to the obligation to safeguard and avoid damaging the pipelines and valves, while failing to address the springs, tanks, instruments, and installations.

It considers this incongruous because the relief requested in its answer was not decided, in view of what was decreed in the operative portion. In its brief, it objects that it requested: “C. That the plaintiff, the other current co-owners, or any subsequent owner of the dominant property must refrain from felling trees or damaging the forest cover currently existing on the property owned by my client. (listed as request ‘D’),” regarding which no ruling or analysis was provided either. It argues that such rulings are necessary in order to determine whether there is authority to remove, cut, prune, dry out, or otherwise affect the trees or forest cover existing within the easement or in adjoining areas—for example, when maintaining the established easement—and to exercise the right. It asserts that a ruling must be issued on each request made by the parties, a requirement it considers unfulfilled.

It argues that the Association is concerned because the easement was granted to the plaintiff as a kind of “blank check” to damage the property’s forest cover or the drinking-water supply aqueduct facilities serving the population, which are natural resources at issue in this case. It states that this could result in liability for the judge who permits conduct contrary to law, given the ambiguity of the ruling. As its third ground, it alleges ambiguity in the establishment of the easement because the course of the easement was omitted, even though this is an indispensable requirement for its registration with the Registro Nacional. The location of said easement is not clearly stated. It requests that the appealed decision be annulled so that a ruling may be issued as required by law.

III- Having analyzed the complaint and the grounds for appeal, the arguments for nullity based on inconsistency between the relief sought and the ruling and on failure to adjudicate all claims (infrapetita), raised in the appeal, must be rejected. This Court finds that the allegations set forth in the brief under review by this Court relate more closely to the exercise of the granted easement (servidumbre), and that the ruling neither induces, contributes to, nor orders the plaintiff to act to the detriment of the forest resources and infrastructure used by the ASADA to capture, transport, and collect the water resources supplying the respective community. The foregoing is pursuant to Articles 395 and 398 of the Civil Code and Articles 199 and 195 of the repealed Code of Civil Procedure, applied supplementarily by virtue of Transitory Provision I.3 of Ley 9343 and II of Ley 9342. The ground for appeal concerning the alleged failure to adjudicate claims that the defendant Association states it included in its answer must be rejected.

First, this Chamber notes that Article 54 of the Agrarian Jurisdiction Law establishes the duty to adjudicate in the judgment the matters submitted in the proceedings. A review of the case file shows that the defendant did not file a counterclaim and that, in its answer to the complaint, it included a series of matters that it called claims but that technically are not claims; nevertheless, its allegations were analyzed and weighed in the appealed judgment. Accordingly, no claim was left unresolved, nor was any matter submitted in the proceedings left unanalyzed. This follows from the following portions of the appealed decision. The second recital (considerando) of the judgment under appeal described the subject matter of the complaint and the answer of the appellant defendant Association, stating the following regarding the Association’s response to the action: “SECOND: ON THE MERITS OF THE MATTER AND DEFENSES (.......): it states that the plaintiff has indeed used a track crossing the property of the Asociación Administradora del Servicio de Agua Potable de [Dirección6] de [Dirección7] Neily to enter his property, but that the width of that track is not six meters as stated in the complaint.

That there has never been any opposition to the plaintiff’s use of the right of way benefiting his property; it states that the problem has been that the plaintiff is demanding from the Asada Board of Directors access that would jeopardize the public drinking-water service provided to the community of San Rafael, as well as the integrity of several trees located along the road the plaintiff plans to use, because he has expressed his intention to widen the existing track using heavy machinery. That the defendant’s property is subject to Pago de Servicios Ambientales and contains the springs (nacientes) from which that vital liquid is drawn to supply the entire community of [Dirección8]. And that these two conditions of the property could be placed at risk if work is performed with heavy machinery. The defendant therefore requests that the judgment state that the easement shall have a maximum width of three meters and that its length be determined by expert evidence; that the plaintiff and the other co-owners must refrain from using heavy machinery to widen the granted easement in any manner.

That the plaintiff must safeguard and avoid damaging the pipelines, springs, tanks, and any other equipment or facility existing on the defendant’s property that has been used or designated to provide drinking-water service to the community of [Dirección8]. That the plaintiff and the other current co-owners of the dominant estate are required to compensate the defendant for the value of the area required to establish the claimed easement, which value must be determined by an expert qualified in the matter, and that the plaintiff may not use the easement until the corresponding payment has been made; it further requests that this matter be resolved without a special award of costs.” In that same recital, the following reasoning was given regarding the allegations in the Association’s answer: “Now then, it is important to highlight the defendant’s statement in its answer to the complaint that the defendant’s property is subject to Pago de Servicios Ambientales and contains the springs from which water is drawn to supply the community of San Rafael de Corredores, because this requires greater care when exercising the right of way ..., since not only the forest resources must be protected, but also all the piping running parallel to the proposed course of the easement.

The fact is that the plaintiff’s property has been shown to be landlocked property (fundo enclavado) and, as such, it is entitled to adequate access to the public road, as provided in Article 395 of the Civil Code. Its status as landlocked property has been duly demonstrated both by the submitted expert report and by the judicial inspection, and the witnesses were also clear in stating that, for a very long time, access from the plaintiff’s property to the public road has been by way of the existing track or road crossing the defendant Association’s property. These facts are also undisputed, since the defendant acknowledges them in its answer. The submitted expert report establishes not only that the plaintiff’s property (property number CED10) is landlocked property, but also that the exit the plaintiff has used for some time, which crosses the defendant Association’s property, is the best route for access to the public road because it is the shortest and most feasible access and causes the least damage to the property, since that road or access physically exists on the land and is used by the Asada.

This road is one hundred seventy-eight meters and three centimeters long, extending from the landlocked property to the bank of the Corredores River; the passage then continues along the riverbed for approximately 40.98 meters until it reaches a section of the protection zone on the opposite bank of the river, which in turn connects with [Dirección2] road. A maximum width of four meters is established due to the condition and topography of the land.” The operative portion of the judgment, in turn, ordered: “In accordance with the foregoing and in view of the initial showing that the plaintiff’s property, namely property number CED11 006 in the Province of Puntarenas, is landlocked property and, as such, has no access to the public road, and because the existence of any better access to the property was not demonstrated, the ordinary agrarian action for a compulsory right-of-way easement (servidumbre forzosa de paso), brought by [Nombre1] against ASOCIACIÓN ADMINISTRADORA DE SERVICIO DE AGUA POTABLE DE BARRIO SAN RAFAEL, is GRANTED as follows:

  • 1)A compulsory right-of-way easement is established in favor of property number thirty-two thousand one hundred sixty-eight zero zero one, zero zero two, zero zero three, zero zero four, zero zero five, and zero zero six, and burdening property thirty thousand three hundred twenty-six zero zero zero, owned by ASOCIACIÓN ADMINISTRADORA DE SERVICIO DE AGUA POTABLE DE BARRIO SAN RAFAEL DE CORREDORES.
  • 2)The established easement shall be four meters wide and shall run from the landlocked property to the public road, for a length of 178 linear meters and three centimeters.
  • 3)The owners of the dominant estate (fundo dominante) shall exercise due care to protect and respect the water pipes located along the same course as the easement, which are owned by the defendant Asada, and shall also protect the valves in the piping located on the land.
  • 4)This easement permits passage on foot, on horseback, and by vehicle.
  • 5)As compensation for the easement right, the plaintiff shall pay the defendant the value of the easement strip, which in this case is four hundred thirty-seven thousand eighty-three colones.
  • 6)The easement established by this judgment grants no right whatsoever to use the bridge that the defendant Asada has for access to its property.
  • 7)The owner of the servient estate (fundo sirviente) is advised that, once this judgment becomes final, it must henceforth refrain from obstructing passage over the declared easement. 6) This matter is resolved without a special award of costs.” Accordingly, this Court does not find that any matter submitted in the proceedings was left unresolved, that Article 54 of the Agrarian Jurisdiction Law was breached, that the defect of failure to adjudicate all claims occurred, or that due process was violated. As stated above, the appellant defendant did not file a counterclaim; its arguments were analyzed, and a ruling was issued on the defenses it raised in its answer to the complaint, in compliance with Article 54 of the Agrarian Jurisdiction Law. For the sake of completeness, this Court notes that the appealed judgment does not grant [Nombre1] any authorization to bring machinery onto the route of the granted easement or to fell forest species, nor does it authorize damage to the Association’s infrastructure used to provide drinking-water service to the population. By operation of law, it must be understood that the exercise of property rights (derechos reales), such as the one granted here, must be carried out in a manner that respects the natural resources and services provided by the servient estate. Environmental legislation governing land, forest, and water use applies with all its legal effects and restrictions, under penalty of civil and criminal liability for environmental damage (daño ambiental) that may be caused by improper or abusive exercise of the granted right. Such liability shall rest with whoever engages in the improper or unlawful conduct, which will not have been caused by the appealed judgment. Upon analysis of this ground for appeal and the ruling issued, this Court does not agree with the argument that the manner in which the matter was resolved gives the plaintiff “free rein” to cause damage. It bears noting that, within our legal system, beginning with Article 50 of the Constitution and its closest statutory implementation, namely Article two of the Organic Environmental Law, environmental damage is defined as: “an offense of a social nature, because it affects the foundations of society’s existence; economic, because it threatens the materials and resources essential to productive activities; cultural, insofar as it endangers communities’ way of life; and ethical, because it threatens the very existence of present and future generations.” For the protection of the environment, a body of protective environmental law (bloque normativo tutelar del medio ambiente), comprising domestic and international rules, has been established to govern human actions that may cause the ecosystem imbalances sought to be prevented, reduced, or mitigated—that is, actions that alter the environmental baseline (línea base del ambiente). Based on the doctrinal and case-law definitions that have been given to the term environmental damage, it may be understood as human acts or omissions that cause deterioration or pollution of the surrounding environment. Such damage affects human beings both individually and collectively as a society. Article 59 of the Organic Environmental Law provides that environmental pollution (contaminación del ambiente) means: “any alteration or modification of the environment that may harm human health, threaten natural resources, or affect the Nation’s environment in general. The discharge and emission of pollutants shall mandatorily comply with the technical regulations issued. The State shall adopt the measures necessary to prevent or correct environmental pollution.” For its part, given that the issue on appeal concerns the existence of forest and forest resources (recurso forestal), Ley Forestal number 7575 establishes in its first article the following State function: “to ensure the conservation, protection, and management of natural forests and the production, harvesting, industrialization, and promotion of the country’s forest resources intended for that purpose, in accordance with the principle of the proper and sustainable use of renewable natural resources. It shall also ensure the creation of employment and improvement of the rural population’s standard of living through its effective incorporation into forestry activities (actividades silviculturales) …”. Furthermore, as one of the core principles of Environmental Law for the protection of the natural environment and its elements, the precautionary principle (principio precautorio) applies to all human activity. In Judgment N°1923-2004, the Constitutional Chamber of the Supreme Court of Justice explained in this regard: “XV.- PRECAUTIONARY PRINCIPLE OF ENVIRONMENTAL LAW AND PROTECTION OF GROUNDWATER. One of the guiding principles of Environmental Law is the precautionary principle, also known as prudent avoidance. This principle is embodied in the United Nations Conference on Environment and Development, or Rio Declaration, which states verbatim: ‘Principle 15.- In order to protect the environment, States shall widely apply the precautionary approach according to their capabilities. Where there is a threat of serious and irreversible damage, lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.’ Within the domestic legal system, the Ley de Biodiversidad (No. 7788 of April 30, 1998), in Article 11, establishes the following principles as interpretive parameters: ‘1.- Preventive approach: It is recognized that anticipating, preventing, and addressing the causes of biodiversity loss or threats thereto is vitally important. 2.- Precautionary approach, or in dubio pro natura: Where there is a danger or threat of serious or imminent damage to elements of biodiversity and the knowledge associated with them, the absence of scientific certainty shall not be used as a reason for postponing the adoption of effective protective measures.’ In this Chamber’s Voto No. 1250-99, issued at 11:24 a.m. on February 19, 1999 (reiterated in Votos Nos. 9773-00, issued at 9:44 a.m. on November 3, 2000; 1711-01, issued at 4:32 p.m. on February 27, 2001; and 6322-03, issued at 2:14 p.m. on July 3, 2003), this Court held as follows: ‘(...) Prevention seeks to anticipate adverse effects and ensure the protection, conservation, and proper management of resources. Accordingly, the guiding principle of prevention is based on the need to adopt and implement all precautionary measures necessary to prevent or contain potential harm to the environment or human health. Thus, where there is a risk of serious or irreversible damage—or uncertainty in that regard—a precautionary measure must be adopted, and the activity in question may even be postponed. This is because, in environmental matters, ex post coercion is ineffective: once socially harmful biological consequences have occurred, punishment may carry moral significance, but it will hardly compensate for the damage caused to the environment.’ Subsequently, in Voto No. 3480-03, issued at 2:02 p.m. on May 2, 2003, this Court stated: ‘Properly understood, the precautionary principle refers to the adoption of measures not when the facts giving rise to the risk are unknown, but when there is no certainty as to whether such facts will actually have harmful effects on the environment.’” The foregoing concepts are relevant in light of the appellant’s appeal, in which it argues that granting the route without acceding to what it considered to be its claims will result in harm to the forest resources and associated ecosystem on its property, where there is forest under conservation, as well as to the water-resource supply infrastructure intended for human consumption. As explained above, this Court does not agree with that argument because it granted an existing route that was deemed the most appropriate for the legal and technical reasons set forth in the judgment. The Association acknowledges that road as an access route leading to a public road and that it has been used in the past, as stated in the judgment under appeal. The plaintiff may not destroy, fell, or remove any forest or forest species, given the nature of the property serving as the dominant estate (fundo dominante), to which the exercise of the granted easement right (derecho de servidumbre) must conform. If the plaintiff violates the statutory prohibitions concerning land use (uso de suelo), the felling of forest resources, or the alteration of protective areas (áreas de protección) around rivers, springs (nacientes), or bodies of water, it will incur the corresponding criminal, environmental, and financial liability. The claim of nullity is denied.

IV—Likewise, the claim that the judgment granted relief beyond that requested (extrapetita) by awarding a right-of-way easement (servidumbre de paso) for travel on foot, horseback, and also by vehicle must be rejected. The appellant contends that, by stating that the easement could also be exercised by vehicle, relief not sought in the complaint was granted. It should be noted that the conditions of the route granted are those physically existing on the land, according to the route analyzed in the expert report used as the basis for the decision and the observations made during the judicial inspection (expert report in images 106 to 121 of the digital case file in PDF format and judicial inspection in image 86). In the operative portion of the judgment, it was determined that: “The easement established shall be four meters wide and shall run from the landlocked property to the public road, with a length of 178 linear meters and three centimeters.” As stated in the reasoning portion of the ruling (which was not appealed), based on that technical study, it was concluded that the plaintiff’s property, number CED11 of Puntarenas, in which he holds right 006, is a landlocked property (fundo enclavado); that the access to the public road historically used by the plaintiff crosses the property of the defendant Asociación; and that this route was deemed the best alignment for access to the public road.

This is because it is shorter, passable, and causes less harm to the servient estate (fundo sirviente). It physically exists and is being used by the Asada. Those conclusions are contained in the aforementioned second expert report. It was further stated that the route has a length of one hundred seventy-eight meters and three centimeters, beginning at the landlocked dominant estate (finca dominante) and extending to the bank of the Río Corredores; the riverbed is crossed for approximately 40.98 meters, after which the route reaches a sector of the protection area (área de protección) on the opposite bank of the river that connects with [Dirección9]. Of relevance to the appeal, it was added that the route was established at a width of four meters due to the condition and topography of the land. This Court concludes that the action filed seeks the establishment of a right-of-way easement because the property is landlocked, and that the easement was granted in accordance with the route’s current condition and Article 398 of the Código Civil.

The means of traveling along that road, whether on foot, by vehicle, or on an animal, depends on the same existing path. It is not appropriate to restrict the plaintiff’s access by vehicle if the vehicle used can enter and causes no harm to the surrounding area. Any modification to the route granted must be made in accordance with the rules governing the exercise of the real property right (derecho real) granted; the plaintiff must not construe the judgment as giving him authority to modify the route or its surroundings unilaterally and to the detriment of the servient estate. This is pursuant to Articles 395 and 398 of the Código Civil. Accordingly, entry in a vehicle capable of being used on the current route is not contrary to the nature of the real property right granted, provided that it causes no harm of any kind. It is obvious that the path cannot be forced to have a width greater than or different from that granted merely to permit the entry of vehicles unsuitable for the capacity of the current route.

Furthermore, this is a matter concerning the manner in which the easement right is exercised and falls outside the subject matter of this particular proceeding. This Court finds no inconsistency arising from relief beyond that requested in mentioning the possibility of vehicle use in addition to travel on foot or on an animal, because any vehicle used by the plaintiff to enter must be one that, given the climatic, topographical, and physical conditions, can travel on the existing road without causing harm to the surrounding area or the environment, or greater harm to the servient estate and its structures, as stated above. For the foregoing reasons, the request for nullity based on relief beyond that requested is denied, because the foregoing was decided in accordance with the rules governing the system for weighing evidence (sistema de valoración probatoria) under Article 54 of the Ley de Jurisdicción Agraria and the relief sought in the complaint.

V—Furthermore, the substantive argument that, in the appellant’s view, gives rise to nullity because the direction of the right-of-way easement granted was omitted and the route is indeterminate must be rejected. This is because the route is fully identified in the judgment itself through a detailed description and location, based on the judicial inspection and expert evidence (prueba pericial) upon which the judgment was founded. Therefore, if there is any defect in the land-registry registration process (proceso de inscripción registral) for the easement recognized in the judgment, it must be remedied by the trial court for purposes of registration, pursuant to the powers granted to it for such purposes by the Legal System (Ordenamiento Jurídico).

VI—For the reasons stated, pursuant to Article 50 of the Constitución Política, Articles 1 and 2 of the Ley de Jurisdicción Agraria, Articles 395 and 398 of the Código Civil, and Articles 199 and 195 of the Código Procesal Civil, applied supplementarily, the grounds of appeal and the request for nullity shall be rejected. As to the matters appealed, the judgment under review must be affirmed.

POR TANTO

The request for nullity is denied. As to the matters appealed, judgment number Nº 02-2020 of fifteen hours and twenty-four minutes on nine January two thousand twenty is affirmed.

VOTO N° 835-F-2020 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las diecisiete horas ocho minutos del once de setiembre de dos mil veinte.- PROCESO ORDINARIO establecido por [Nombre1] , mayor, soltero, abogado, vecino de Ciudad Neily, cédula de identidad número CED1 - - ; contra ASOCIACIÓN ADMINISTRADORA DE SERVICIO DE AGUA POTABLE DE BARRIO SAN RAFAEL DE CORREDORES, cédula jurídica CED2 - - , representada por el señor [Nombre2] , cédula de identidad número CED3 - - , en su condición de presidente con facultades de apoderado generalísimo sin límite de suma; y [Nombre3] , mayor, soltera, ama de casa, cédula de identidad número CED4 - - , representada por su apoderada generalísima sin límite de suma [Nombre4] , mayor, casada, abogada, vecina de San José, cédula de identidad CED5 - - . Interviene en este proceso como defensora pública agraria del actor la licenciada Laura Beita Benavente; como apoderado especial judicial de la asociación demandada el letrado Luis Vargas Parras, mayor, casado, abogado, vecino de Ciudad Neily, cédula de identidad número CED6 - - ; y como abogado director de la señora [Nombre3] el licenciado Roberto Quirós Brenes, colegiado diez mil ciento sesenta y dos. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, con sede en Corredores.-

RESULTANDO:

  1. 1La parte actora [Nombre1] formuló el presente proceso ordinario estimado en un millón quinientos mil colones para que en sentencia se declare lo siguiente: "...1) Se declare con lugar la demanda en todos sus extremos.2) Se declare que la finca del suscrito se encuentra enclavada, sin entrada y salida suficiente conforme lo estipula el ordenamiento jurídico nacional.3) Se constituya una servidumbre forzosa de paso, teniendo como fundo dominante la finca del suscrito del partido de Puntarenas bajo matrícula número [Placa1] y como fundos sirvientes las fincas del partido de Puntarenas bajo matricula [Placa2] .4) Que el ancho de dicha servidumbre lo es por seis metros y su longitud de aproximadamente de cuatrocientos cincuenta metros, sin perjuicio que pueda determinarse con prueba fehaciente que deba de ser más o menos, atravesando la propiedad de las accionadas con rumbo de [Dirección1] .5) Que se le ordene a la accionada abstenerse de impedir el paso del suscrito, de cualquier otro copropietario o persona autorizada para el ingreso por ese camino, bajo pena en caso de no hacerlo de testimoniar piezas ante el Ministerio Público por el delito de desobediencia a la autoridad.6) Se expida al Registro Público de la propiedad,mediante ejecutoria inscribir dicha servidumbre en la finca del suscrito como fundo dominante y en la finca de las accionadas como fundos sirvientes.7) Se condene a la accionada al pago de las costas procesales y personales con ocasión de la demanda...," (7 a 9 y vuelto).-
  2. 2La Asociación demandada contestó la acción incoada en su contra en forma negativa e interpuso las excepción de litis consorcio activo necesario rechazada mediante sentencia 189-2016 de las catorce horas y treinta y seis minutos del diez de agosto de dos mil dieciséis. A su vez la codemandada [Nombre3] debidamente notificada contesto de forma negativa la demanda en su contra interponiendo las excepciones de falta de derecho, falta de legitimación activa y pasiva, falta de interés actual y la sine actione agit, (folios 77 a 83; y 86 a 90).-
  3. 3La jueza Marisel Zamora Arias, del Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, mediante la sentencia Nº 02-2020 de las quince horas y veinticuatro minutos del nueve de enero de dos mil veinte, resolvió: “POR TANTO: De conformidad con lo expuesto y en vista de haberse demostrado primeramente que la finca de la parte actora, sea la finca numero 32168 006 de la provincia de Puntarenas es un terreno enclavado, y como tal no tiene salida a la calle pública y no se demostró que existiera otra mejor salida al terreno, se DECLARA CON LUGAR la demanda ordinaria agraria de servidumbre forzosa de paso establecida por el señor [Nombre1] () en contra de ASOCIACIÓN (sic) ADMINISTRADORA DE SERVICIO DE AGUA POTABLE DE BARRIO SAN RAFAEL, de la siguiente forma:1) Se constituye servidumbre forzosa de paso a favor de la finca numero CED7 uno, CED8 dos, CED8 tres, CED8 cuatro, CED9 y CED8 seis, y en contra de la finca treinta mil trescientos veintiséis (sic) cero cero cero propiedad de ASOCIACIÓN ADMINISTRADORA DE SERVICIO DE AGUA POTABLE DE BARRIO SAN RAFAEL DE CORREDORES,.2) La servidumbre constituida tendrá (sic) un ancho de cuatro metros y la misma tiene una dirección tomando como partido el fundo enclavado hasta la calle [Dirección2], con una longitud de 178 metros con tres centímetros lineales.3) Deberán (sic) los propietarios del fundo dominante tener el debido cuidado para la protección y respeto de las cañerías (sic) existentes en el mismo rumbo de la servidumbre, las cuales son propiedad de la Asada demandada y también (sic) proteger las válvulas existentes en la cañería existente en el terreno.4) Es una servidumbre para transitar a pie, a caballo y en vehículo (sic).5) Como indemnización (sic) por el derecho de servidumbre deberá la parte actora pagar el valor de la franja de servidumbre a la parte demandada, la cual para este caso es de cuatrocientos treinta y siete mil ochenta y tres colones.6) La servidumbre que se constituye con esta sentencia no otorga derecho alguno al uso del puente que tiene la Asada demandada para el ingreso a su finca.7) Se le indica a la parte propietaria del fundo sirviente que una vez firme esta sentencia en lo sucesivo deberá abstenerse de obstaculizar el paso de la servidumbre declarada. 6) Se resuelve este asunto sin especial condenatoria en costas," (Ver Escritorio Virtual del Juzgado Agrario de Corredores, en Documentos Asociados, archivo del 9/1/20 de las 15:24:56 p.m.).-
  4. 4El letrado de la Asociación codemandada, interpuso recurso de apelación con indicación expresa de las razones en que se apoyó para refutar la tesis del juzgado de instancia, (Ver Escritorio Virtual del Juzgado Agrario de Corredores, [Dirección3] , archivo del 17/1/20 de las 4:04:28 p.m.).-
  5. 5En la substanciación del proceso se han observado las prescripciones legales, y no se observa la existencia de errores u omisiones capaces de producir la nulidad del fallo.-

Redacta la jueza Castro García; y,

CONSIDERANDOS

I- Hechos Probados. Se avalan los hechos probados de la sentencia apelada, por estas sustentados en elementos probatorios que constan en autos.

II- La Asociación demandada recurre la sentencia de primera instancia número 02-2020 de las 15:24 horas del 9 de enero de 2020 (expediente digital/documentos/fecha: 17/01/2020 04:04:28) que acoge la demanda de constitución de servidumbre de paso. Invoca en su recurso agravios de fondo, en donde alega también la nulidad de la resolución por incongruencia. Al respecto reclama se presenta el vicio de extrapetita, en virtud de reconocer pretensiones no incluidas en la demanda. Lo anterior, por no haberse pedido en la acción se le autorizara la servidumbre de paso para ser utilizada con vehículos. Y en la pieza recurrida de forma expresa se decreta que se constituye para ser transitada en vehículo. Hace ver, del reconocimiento judicial se logra apreciar que el área recomendada como servidumbre de paso en el peritaje ordenado por el despacho, no se encuentra en condiciones de ser transitada en vehículo, lo cual implica que deberá ser modificada o intervenida de alguna forma, para dar cumplimiento con dicha orden.

Esto pone en riesgo, cita, no solamente las tuberías y obras existentes para la captación y transporte del agua potable, sino también la cobertura boscosa de la finca; que se ubica a orillas del río [Dirección4]. Reseña, con lo fallado se pone en riesgo su propiedad privada, así como el equilibrio ambiental que existe actualmente en la finca, dada la naturaleza y destino de cobertura boscosa y obras civiles de acueducto rural. Como segundo reclamo del recurso, cita media la incongruencia por infrapetita, al dejarse de resolver todas la pretensiones que realizara la Asociación. Aduce, cuando contesta la acción solicitó en su escrito: " A. Que el actor, los demás copropietarios actuales, o cualquier otro propietario posterior de la finca dominante, deben abstenerse de utilizar maquinaria pesada para ampliar de cualquier forma la servidumbre otorgada. (enumerada como pretensión “B”)." Menciona el recurso, no se refirió la sentencia a esa pretensión ni para acogerla o denegarla.

Indica, en resguardo de sus intereses, se debe señalar sobre la imposibilidad para las personas propietarias del terreno dominante, sobre la intervención de la servidumbre con maquinaria pesada, por los daños (ambientales y civiles) que esa conducta pudiera provocar. Motivo por el cual, se solicitó mediara pronunciamiento al despacho al momento de dictarse la sentencia. Lo cual fue omitido. Agrega, pidió en ese escrito de contestación: " B. Que el actor, o uno o los demás copropietarios actuales, o cualquier otro propietario posterior de la finca dominante debe resguardar, y evitar dañar las tuberías, nacientes, tanques, y cualquier otro instrumento o instalación existente la finca de mi representada, que se ha utilizado o destinado a brindar el servicio de abastecimiento de agua potable a la comunidad de [Dirección5] . (enumerada como pretensión “C”)". Aduce al respecto la recurrente, el despacho solamente indicó sobre su obligación de resguardar y evitar dañar las tuberías y válvulas; obviándose referirse a las nacientes, tanques, instrumentos e instalaciones.

Que considera incongruente, por no resolverse lo solicitado en su contestación, visto lo decretado en la parte dispositiva. Reprocha en su memorial, peticionó: " C. Que el actor, lo demás copropietarios actuales, o cualquier otro propietario posterior de la finca dominante, deben abstenerse de talar árboles, o de dañar la cobertura boscosa existente actualmente en la finca propiedad de mi representada. (enumerada como pretensión “D”)", sobre lo cual tampoco medió resolución ni análisis. Argumenta, esos pronunciamientos son necesarios a fin de conocer si se tiene la potestad de eliminar, cortar, derramar, secar o de cualquier otra forma afectar los árboles o la cobertura boscosa existente en la servidumbre o en sus áreas aledañas (por ejemplo, al momento de dar mantenimiento a la servidumbre establecida) y ser ejercido el derecho. Aduce, debe emitirse sobre cada pretensión de las partes; lo que estima incumplido.

Arguye, preocupa a la Asociación que se le otorgó la servidumbre a la parte actora, en una especie de “carta en blanco” para dañar la cobertura boscosa de la finca, o las instalaciones del acueducto de abastecimiento de agua potable a la población; recursos naturales en juego en este caso. Que puede llevar a responsabilidad en contra de la persona juzgadora que permite conductas contrarias a Derecho; en virtud de la ambigüedad del fallo. Acusa como tercer motivo la ambigüedad en la constitución de la servidumbre, al omitirse citar el rumbo de la misma, que es requisito indispensable para su inscripción ante el Registro Nacional. Sin que se mencione claramente cuál es la ubicación de dicha servidumbre. Pide, se anule la pieza recurrida a fin de que se dicte conforme a Derecho corresponde.

III- Analizada la demanda y los agravios han de rechazarse los motivos de nulidad por incongruencia de cita e infrapetita apuntados en el recurso. Estima esta Sede, los alegatos expuestos en el escrito que conoce esta Instancia, tienen mayor relación con el ejercicio de la servidumbre otorgada, sin que lo fallado induzca, contribuya u ordene a la parte actora, se actúe en perjuicio de los recursos forestales e infraestructura de la ASADA para captar, transportar y recolectar el recurso hídrico que abastece a la comunidad respectiva. Lo anterior, al tenor del ordinal 395 y 398 del Código Civil, 199 y 195 del Código Procesal Civil derogado, aplicado supletoriamente en virtud del Transitorio I.3 de Ley 9343 y II de Ley 9342. Respecto al agravio referido a la omisión de resolverse pretensiones que indica la Asociación demandada incorporó en su escrito de contestación, ha de rechazarse. En mi primer orden, se señala por esta Cámara que el artículo 54 de la Ley de Jurisdicción determina el deber de resolverse en sentencia los temas sometidos al proceso.

De la lectura del expediente, se constata que la demandada no procedió a reconvenir y que en su contestación de demanda incorporó una seria de elementos que denominó pretensiones, que técnicamente no lo son, sin embargo sus alegatos si fueron analizados y ponderados en la sentencia recurrida. Por lo que no existe pretensión dejada de resolver o temas sometidos al proceso no analizados. Lo anterior se deduce de los siguientes contenidos de la pieza recurrida. En el considerando segundo del fallo venido en alzada se describió el objeto de la demanda y la contestación de la Asociación accionada recurrente, citándose respecto a la respuesta a la acción por parte de la Asociación: "SEGUNDO: SOBRE EL FONDO DEL ASUNTO Y EXCEPCIONES (.......) :señala que efectivamente el actor ha utilizado para ingresar a su finca una trocha que atraviesa la finca de la Asociación Administradora del Servicio de Agua Potable de [Dirección6] de [Dirección7] Neily, pero que el ancho de esa trocha no es de seis metro como se indica en la demanda.

Que nunca ha existido oposición para que el actor utilice el paso a favor de su propiedad, indica que el problema ha sido que el actor exige a la Junta directiva de la Asada, un acceso que atentaría contra el servicio público de agua potable que se brinda a la comunidad de San Rafael, así como la integridad de varios árboles que existen en el camino que el actor planea utilizar, esto por cuanto ha manifestado su intención de ampliar la trocha existente con maquinaria pesada. Que la finca de la demandada esta sometida al pago de servicios ambientales y posee las nacientes de agua de las cuales se toma dicho líquido vital para abastecer a toda la comunidad de [Dirección8] . Y que estas dos condiciones de la finca se podrían riesgo si se hacen trabajos con maquinaria pesada. Por lo que pide la demandado que en sentencia se indique que la servidumbre tendrá un acceso máximo de tres metros de ancho y que la longitud se determine pericialmente, que el actor o los demás copropietarios deben abstenerse de utilizar maquinaria pesada para ampliar de cualquier forma la servidumbre otorgada.

Que el actor debe resguardar y evitar dañar las tuberías, nacientes, tanques y cualquier otro instrumento o instalación existente en la finca de la demandada, que se ha utilizado o destinado a brindar servicio de abastecimiento de agua potable a la comunidad de [Dirección8] . Que el actor y los demás copropietarios actuales de la finca dominante se encuentran obligados a indemnizar a la demandada el valor del espacio requerido para la constitución de la servidumbre reclamada, valor que deberá ser determinado por un perito idóneo en la materia y que el actor no podrá hacer uso de la servidumbre hasta que se haya realizado el pago correspondiente, y pide además que se resuelva este asunto sin especial condenatoria en costas." En ese mismo considerando respecto a los alegatos de la contestación de la Asociación se razonó: "Ahora bien, es importante rescatar lo que señala la demandada cuando contesta la demanda, en el sentido de que la finca de la demandada esta sometida al pago de servicios ambientales y de que la misma posee las nacientes de agua de las cuales se toma el líquido para abastecer la comunidad de San Rafael de Corredores, ya que esto hace que haya que tener más cuidado a la hora de ejercer el derecho de paso ... , ya que debe de protegerse no solamente el recurso forestal sino también toda la tubería que corre paralelo al mismo rumbo de la servidumbre que se plantea.

Lo cierto es que se ha demostrado que la finca del actor es un fundo enclavado y como tal tiene derecho a tener salida suficiente a la vía pública, así lo regula el artículo 395 del Código Civil, la condición de fundo enclavado ha quedado debidamente demostrada tanto con la pericia aportada como con el reconocimiento judicial y además los testigos fueron claros en señalar que desde mucho tiempo atrás la salida a la vía pública del fundo del actor ha sido por la trocha o camino existente que pasa por la finca de la asociación demandada, estos son hechos además no controvertidos, pues así los acepta la demandada en su escrito de contestación. Con la pericia aportada se logra determinar no solamente que la finca del actor (finca número CED10 ) es un fundo enclavado, sino que la salida que ha estado usando el actor desde tiempo atrás, y que pasa por la finca de la asociación demandada, es el mejor trazado para el acceso a la vía pública, por ser el acceso más corto, viable y menos dañino para la finca, ya que ese camino o acceso consta en la materialidad del campo y esta en uso por parte de la Asada.

Este camino tiene un largo de ciento setenta y ocho metros con tres centímetros, que van desde el fundo enclavado hasta la orilla del río Corredores, posteriormente el paso continúa por el cause del río unos 40.98 metros y llega a topar con un sector de la zona de protección a la otra orilla del río y esta a su vez conecta con la calle [Dirección2]. Como ancho máximo se establecen cuatro metros por la condición del terreno y la topografía del mismo. ". Por su parte en la parte dispositiva del fallo se decretó: " De conformidad con lo expuesto y en vista de haberse demostrado primeramente que la finca de la parte actora, sea la finca número CED11 006 de la provincia de Puntarenas es un terreno enclavado, y como tal no tiene salida a la calle pública y no se demostró que existiera otra mejor salida al terreno, se DECLARA CON LUGAR la demanda ordinaria agraria de servidumbre forzosa de paso establecida por el señor [Nombre1] en contra de ASOCIACIÓN ADMINISTRADORA DE SERVICIO DE AGUA POTABLE DE BARRIO SAN RAFAEL, de la siguiente forma:

  • 1)Se constituye servidumbre forzosa de paso a favor de la finca numero treinta y dos mil ciento sesenta y ocho cero cero uno, cero cero dos, cero cero tres, cero cero cuatro, cero cero cinco y cero cero seis, y en contra de la finca treinta mil trescientos veintiséis cero cero cero propiedad de ASOCIACIÓN ADMINISTRADORA DE SERVICIO DE AGUA POTABLE DE BARRIO SAN RAFAEL DE CORREDORES,.
  • 2)La servidumbre constituida tendrá un ancho de cuatro metros y la misma tiene una dirección tomando como partido el fundo enclavado hasta la calle pública, con una longitud de 178 metros con tres centímetros lineales.
  • 3)Deberán los propietarios del fundo dominante tener el debido cuidado para la protección y respeto de las cañerías existentes en el mismo rumbo de la servidumbre, las cuales son propiedad de la Asada demandada y también proteger las válvulas existentes en la cañería existente en el terreno.
  • 4)Es una servidumbre para transitar a pie, a caballo y en vehículo.5) Como indemnización por el derecho de servidumbre deberá la parte actora pagar el valor de la franja de servidumbre a la parte demandada, la cual para este caso es de cuatrocientos treinta y siete mil ochenta y tres colones. 6) La servidumbre que se constituye con esta sentencia no otorga derecho alguno al uso del puente que tiene la Asada demandada para el ingreso a su finca. 7) Se le indica a la parte propietaria del fundo sirviente que una vez firme esta sentencia en lo sucesivo deberá abstenerse de obstaculizar el paso de la servidumbre declarada. 6) Se resuelve este asunto sin especial condenatoria en costas.". Así las cosas, no se concluye por esta Instancia se hubiere dejado de resolver aspecto alguno sometido al proceso, ni se incumpliera el ordinal 54 de la Ley de Jurisdicción Agraria, se incurriera en el vicio de infrapetita, ni se violentara el debido proceso. Como se citó supra, la apelante demandada no reconvino, sus argumentaciones fueron analizadas y medió pronunciamiento respecto a las excepciones que interpuso en su contestación de demanda; cumpliendo con el artículo 54 de la Ley de Jurisdicción Agraria. Cabe citarse por esta Sede a mayor abundamiento, la sentencia apelada no le otorga a [Nombre1] autorización alguna para introducir maquinaria a la ruta de la servidumbre concedida ni derribar especies forestales, así como tampoco causar daños a la infraestructura de la Asociación destinada al servicio de abastecimiento de agua potable a la población. Debe entenderse por imperativo legal que el ejercicio de los derechos reales como el que se concede, ha de desarrollarse de forma tal, que se respeten los recursos naturales y servicios que brinda el fundo sirviente. Pues la legislación ambiental respecto al uso del suelo, bosque y agua rige con todos sus efectos legales y todas sus restricciones, so pena de incurrir en responsabilidades civiles y penales por el daño ambiental que pueda llegar a ocasionar un uso indebido o abusivo del derecho otorgado. Lo cual será responsabilidad de quien cometa las conductas inapropiadas o ilegítimas. Que no serán por causa de la sentencia que se recurre. Del análisis de ese agravio y lo resuelto, no se comparte el argumento referido a que la forma de resolver da "carta abierta" al actor para causar daños. Cabe acotarse en nuestro ordenamiento jurídico respecto al daño ambiental, a partir del artículo 50 constitucional y su más cercano desarrollo legal, sea la Ley Orgánica del Ambiente en su artículo dos, se establece que el daño ambiental constituye: "un delito de carácter social, al afectarse las bases de la existencia de la sociedad; económico, porque atenta contra las materias y los recursos indispensables para las actividades productivas; cultural, en tanto pone en peligro la forma de vida de las comunidades, y ético, porque atenta contra la existencia misma de las generaciones presentes y futuras". En protección del ambiente se ha decretado el bloque normativo tutelar del medio ambiente, alimentado por normas nacionales e internacionales, las cuales rigen las actuaciones humanas que pueden provocar los desequilibrios ecosistémicos que pretenden ser evitados, disminuidos o mitigados. Es decir, que alteren la línea base del ambiente. De los conceptos que se han expuesto del término daño ambiental a nivel doctrinal o jurisprudencial, podría entenderse como los actos u omisiones del ser humano que causan deterioro o contaminación del medio ambiente que le rodea. Mismo que le afecta en forma individual y colectiva como sociedad. La Ley Orgánica del Ambiente prescribe en el artículo 59 que contaminación del ambiente se entiende como: " toda alteración o modificación del ambiente que pueda perjudicar la salud humana, atentar contra los recursos naturales o afectar el ambiente en general de la Nación. La descarga y la emisión de contaminantes, se ajustará, obligatoriamente, a las regulaciones técnicas que se emitan. El Estado adoptará las medidas que sean necesarias para prevenir o corregir la contaminación ambiental”. Por su parte, dado que lo que se apela es tema de existencia de bosque y recurso forestal, la Ley Forestal número 7575 determina en su artículo primero como función estatal: “velar por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables. Además, velará por la generación de empleo y el incremento del nivel de vida de la población rural, mediante su efectiva incorporación a las actividades silviculturales …”. Por su parte, como uno de los principios medulares del Derecho Ambiental para la tutela del entorno natural y sus elementos, el principio precautorio resulta aplicable a toda actividad humana. La Sala Constitucional de la Corte Suprema de Justicia en la sentencia N°1923-2004, explicó al respecto: "XV.- PRINCIPIO PRECAUTORIO DEL DERECHO AMBIENTAL Y PROTECCIÓN DE LAS AGUAS SUBTERRÁNEAS. Uno de los principios rectores del Derecho Ambiental lo constituye el precautorio o de evitación prudente. Este principio se encuentra recogido en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo o Declaración de Río, la cual literalmente indica “Principio 15.- Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades. Cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente”. En el ordenamiento jurídico interno la Ley de Biodiversidad (No. 7788 del 30 de abril de 1998), en su artículo 11 recoge como parámetros hermenéuticos los siguientes principios: “1.- Criterio preventivo: Se reconoce que es de vital importancia anticipar, prevenir y atacar las causas de la pérdida de biodiversidad o sus amenazas. 2.- Criterios precautorio o indubio pro natura: Cuando exista peligro o amenaza de daños graves o inminentes a los elementos de la biodiversidad y al conocimiento asociado con estos, la ausencia de certeza científica no deberá utilizarse como razón para postergar la adopción de medidas eficaces de protección”. En el Voto de esta Sala No. 1250-99 de las 11:24 horas del 19 de febrero de 1999 (reiterado en los Votos Nos. 9773-00 de las 9:44 horas del 3 de noviembre del 2000, 1711-01 de las 16:32 horas del 27 de febrero del 2001 y 6322-03 de las 14:14 horas del 3 de julio del 2003) este Tribunal estimó lo siguiente: “(...) La prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos. Consecuentemente, el principio rector de prevención se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar contener la posible afectación del ambiente o la salud de las personas. De esta forma, en caso de que exista un riesgo de daño grave o irreversible –o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido ya las consecuencias biológicas socialmente nocivas, la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados en el ambiente”. Posteriormente, en el Voto No. 3480-03 de las 14:02 horas del 2 de mayo del 2003, este Tribunal indicó que “Bien entendido el principio precautorio, el mismo se refiere a la adopción de medidas no ante el desconocimiento de hechos generadores de riesgo, sino ante la carencia de certeza respecto de que tales hechos efectivamente producirán efectos nocivos en el ambiente”. Los conceptos anteriormente citados cobran relevancia dada la apelación del recurrente, cuando invoca que el haber concedido la ruta sin acceder a lo que estimó son sus pretensiones, conduce a la producción de un daño al recurso forestal y ecosistema asociado existente en su finca al existir bosque en conservación y de la infraestructura de abastecimiento de recurso hídrico para consumo humano. Como se expuso, ese argumento no se comparte por este Tribunal, en virtud de que se concedió una ruta existente, que se estimó era la más adecuada por los motivos de derecho y técnicos expuestos en la sentencia. Camino que la Asociación reconoce como ruta de acceso de salida a calle pública y que ha sido utilizado en el pasado; tal y como se afirmó en la sentencia recurrida. Sin que pueda el actor destruir, derribar o eliminar bosque alguno o especies forestales, dada la naturaleza de la propiedad que sirve como fundo dominante, al que debe ajustar el ejercicio del derecho de servidumbre concedido. Pues de irrespetar las prohibiciones legales de uso de suelo, derribo de recurso forestal o modificar áreas de protección de ríos, nacientes o cuerpos de agua, incurrirá en las responsabilidades penales, ambientales y patrimoniales correspondientes. Se rechaza la nulidad.

IV-En igual sentido, ha de rechazarse el reclamo de haberse resuelto en forma extrapetita, por haberse otorgado la servidumbre de paso, al citar que lo era para transitar a pie, a caballo y además en vehículo. Considerando la recurrente que al indicar que también podría ejercerse en vehículo, se otorgaba una pretensión no contenida en la demanda. Cabe señalar, que las condiciones de la ruta concedida son las que existen en la materialidad del terreno; según la ruta analizada en la pericia que se tomó de base y lo observado en el reconocimiento judicial (pericial en imágenes 106 a 121 de expediente digital modo pdf y reconocimiento judicial en imagen 86). En sentencia, se determinó sobre la misma en la parte dispositiva que: "La servidumbre constituida tendrá un ancho de cuatro metros y la misma tiene una dirección tomando como partido el fundo enclavado hasta la calle pública, con una longitud de 178 metros con tres centímetros lineales." Como se citó en el fallo, en la parte considerativa (no fue objeto de apelación), con fundamento en ese estudio técnico se concluye que la finca del actor número CED11 de Puntarenas, del cual es titular del derecho 006, es fundo enclavado, la salida a calle pública que se ha estado utilizando por el actor desde el pasado transcurre por la propiedad de la Asociación accionada y se calificó la misma como el mejor trazado para el acceso a la vía pública.

Lo anterior, por presentar las condiciones de ser más corto, transitable y que causa menor perjuicio para la el fundo sirviente. Lo anterior por existir materialmente y estar en uso por parte de la Asada. Tales conclusiones están contenidas en la pericial segunda ya referida. Se indicó además, que la ruta tiene una distancia de ciento setenta y ocho metros con tres centímetros, que inicia en la finca dominante enclavada hasta la orilla del Río Corredores, se cruza el cauce en aproximadamente 40.98 metros y se llega a un sector del área de protección a la otra orilla del río, que entronca con la [Dirección9] . De importancia a lo recurrido, se agregó que se establecían cuatro metros de anchura de la ruta, en virtud de la condición del terreno y la topografía del mismo. Concluye esta Sede, en la acción entablada se pide la constitución de servidumbre de paso por estar el fundo en estado de enclave, y se otorga acorde con el estado actual de la ruta y el artículo 398 del Código Civil.

La forma de accesar ese camino, sea a pie, vehículo o en bestia, depende del mismo sendero existente. No corresponde limitar el ejercicio del acceso al actor en vehículo, si el que utiliza permite el ingreso y no causa daños al entorno. Cualquier modificación a la ruta concedida, deberá ser ejercida a la luz de las normas que regulan el uso del derecho real concedido, sin que se deba entender por el actor que tiene la potestad de modificar de forma unilateral y en perjuicio de la finca sirviente, la ruta o su entorno. Lo anterior al tenor del artículo 395 y 398 del Código Civil. Por lo que el ingreso en un vehículo que tenga la posibilidad de ser utilizado en la ruta actual, no es contrario a la naturaleza del derecho real concedido, siempre que no cause daños de ninguna índole. Pues resulta obvio que sería imposible forzar la senda a tener un ancho mayor o diverso al concedido, solo para ingresar vehículos no aptos para la capacidad de la ruta actual.

Además, ello es un tema propio de la forma de ejercicio del derecho de servidumbre concedida que escapa del objeto de este proceso en particular. No encuentra incongruencia alguna por extrapetita esta Sede al citar la posibilidad de uso de vehículo aparte del modo a pie o en bestia, pues el tipo de vehículo con el que se puede ingresar por la parte actora, es aquel que por condiciones climatológicas, topográficas y materiales, permitan en el camino existente, sin que genere daños al entorno o el ambiente. O mayores perjuicios al fundo sirviente y a sus estructuras; como se ha indicado. Por lo anteriormente expuesto, se rechaza la nulidad por extrapetita, pues se ha emitido lo anterior en apego a las reglas de sistema de valoración probatoria del artículo 54 de la Ley de Jurisdicción Agraria y las pretensiones de la demanda.

V- Por otra parte, ha de rechazarse el alegato de fondo que en su criterio produce la nulidad, por omitirse la indicación del rumbo de la servidumbre de paso concedida y ser indeterminada la ruta. Lo anterior por cuanto se encuentra plenamente identificada en la sentencia misma, con descripción y ubicación detallada, que se sustentó en el reconocimiento judicial y la prueba pericial en que se fundó . Por lo que si existe algún defecto en el proceso de inscripción registral de la servidumbre reconocida en sentencia, deberá ser subsanado por el juzgado de instancia a efectos de su registración y con las facultades que lo otorga para esos efectos el Ordenamiento Jurídico.

VI - Por los motivos expuestos, con fundamento en los artículos 50 de la Constitución Política, 1 y 2 de la Ley de Jurisdicción Agraria, numerales 395 y 398 del Código Civil, 199 y 195 del Código Procesal Civil aplicado supletoriamente, se rechazarán los agravios y la nulidad invocada. En lo apelado, deberá confirmarse la sentencia recurrida.

POR TANTO

Se rechaza la nulidad. En lo apelado, se confirma la sentencia número Nº 02-2020 de las quince horas y veinticuatro minutos del nueve de enero de dos mil veinte.
