Injuriousness proceeding (proceso de lesividad) brought by the Instituto de Desarrollo Rural, hereinafter INDER, legal entity identification number CED3194, represented by attorneys Rodrigo Cervantes Barrantes, bar identification number CED12889, and Erick Jiménez Trejos, bar identification number CED9416, as special judicial attorneys-in-fact, against Nombre112494, an adult, married, a Licensed Nurse, holder of identity card number CED89040, resident of Puntarenas, represented by attorney Filadelfo Silva Silva, bar identification number CED23087. The Sistema de Áreas de Conservación (SINAC) participates as an interested third party, represented by attorney Maureen Solís Retana, bar identification number CED23087, and the State participates as an active supporting party (coadyuvante activo), represented by attorney Susana Fallas Cubero, bar identification number CED7620.
BACKGROUND:
I.On 20 de agosto de 2013, INDER’s representatives filed the complaint, seeking a judgment granting the claims, which were ratified at the preliminary hearing as follows: “1. That this complaint be deemed duly filed. 2. Because it is injurious to the public interest, that the resolution adopted by the Board of Directors of the Instituto de Desarrollo Agrario in Article 56 of session 022-05, dated 3 de mayo del 2005, be annulled solely insofar as it concerns the issuance of title (titulación) to the property in the Puntarenas Registry District, real property folio No. 146022-000, in favor of Nombre112494, whose personal particulars are stated above, corresponding to cadastral plan (plano catastrado) P-0869458-2003. 3. By reason of its connection thereto, that the public deed issued by the Instituto de Desarrollo Agrario be annulled solely insofar as it concerns the issuance of title to the property in the PUNTARENAS Registry District, real property folio No. 146022-000, in favor of Nombre112494, whose personal particulars are stated above, corresponding to cadastral plan P-0869458-2003. 4.
By reason of its connection thereto, that the registration entry (asiento registral) for the property registered under the Real Property Folio System in the Puntarenas Registry District, real property folio No. 146022-000, issued by the Registro Nacional, be annulled. 5. By reason of its connection thereto, that any registration arising from the registration of the property recorded in the Registro Nacional, Province of Puntarenas, Real Property Folio registration number Placa20342, be annulled. 6. That the defendant be ordered to pay both categories of costs (ambas costas) in this proceeding.” (See the digital version of the court file).

CONSIDERING:
Counsel for INDER brought this action seeking a judgment declaring null and void the resolution adopted by its Board of Directors in Article 56 of Session 022-05, dated May 3, 2005, insofar as it concerns the issuance of title (titulación) to parcel 145-000-14 in favor of Mr. Nombre112494, which resulted in the creation of the property registered in the Puntarenas District, real-property folio No. 146022-000, on the grounds that, contrary to law, land forming part of the State Natural Heritage (Patrimonio Natural del Estado) was awarded and titled, and that, as a result, related acts should be annulled, such as the deed through which title to the property was formally conveyed to Mr. Nombre112494 and its registration in the property registry. In this regard, counsel stated: A) Regarding titling programs: The existence of large areas of the national territory in which farmers lacked title to their land, preventing them from obtaining loans, led the Instituto de Desarrollo Agrario -IDA-, formerly the Instituto de Tierras y Colonización -ITCO-, now the Instituto de Desarrollo Rural -INDER-, to promote a series of Titling Programs in National Reserves, pursuant to the provisions of the "Ley de Titulación de Tierras ubicadas en Reservas Nacionales" No. 7599 del 9 de agosto de 1996; the "Ley de Tierras y Colonización" No. 2825 del 14 de octubre de 1961, artículos 11 y 12; and the "Ley de Creación del Instituto de Desarrollo Agrario" No 6735 artículo 32 inciso a).
IDA’s work under those programs was aimed at declaring titling zones in areas where persons possessed land but lacked title thereto, after which surveys and cadastral mapping (catastro) were conducted for properties not registered in the Registro Público and the corresponding title was registered; beneficiaries were required to pay the titling and land-surveying (agrimensura) costs, which were substantially lower than the average market cost of obtaining title to land and had to be paid to IDA within no more than one year. Among those Titling Programs was the "Programa de Titulación Coto Brus," created by Decreto Ejecutivo No. 3216-G del 2 de octubre de 1973, published in the Diario Oficial La Gaceta del 9 de noviembre de 1973, and an area of 157.308 has was registered with the Registro Nacional in IDA’s name under Real Property Folio Registration number Placa20344, for the purpose of carrying out the corresponding titling projects (artículo 7 del Reglamento para la Titulación de Tierras en Reservas Nacionales).
Counsel for INDER reiterated that the transfers of the areas to be titled were justified by possessors’ holding of unregistered properties (artículos 2 y 4 del Reglamento para la titulación), but that this involved a legal fiction through which a large geographic area was transferred to IDA that indiscriminately encompassed registered and unregistered land, land owned by the State and by private parties, and land with or without possessors; hence, the transfers were made without prejudice to rights already registered over specific portions within the general perimeter of the respective zone, to acquisitive-possession proceedings (información posesoria) pending when the Decree referred to in artículo 7 del "Reglamento para la Titulación de Tierras en Reservas Nacionales" was published in La Gaceta, to rights that might be registered in the future, or to portions designated for public use.
The purpose of those transfers was to provide IDA with a mechanism by which it could subdivide and convey the land, likewise under a legal fiction, and thereby register parcels in favor of possessors who had possessed such land under the conditions established by the legal system, for the purpose of facilitating access to credit (artículo 10 del Reglamento para la Titulación de Tierras en Reservas Nacionales). It was understood that the basis for acquiring such land was the possession exercised by the possessors, rather than the transfers or sales made by IDA, because the only consideration received by the Instituto was the cost of preparing the corresponding plans, rather than the actual price of the parcels; accordingly, there was no agreement as to property and price, and the Instituto could not convey the land to the highest bidder but was required to convey it to the possessor who demonstrated compliance with the legal requirements, with the Instituto’s role limited to verifying those requirements (artículo 10 del Reglamento para la Titulación de Tierras en Reservas Nacionales).
In resolution 04587-97 de las 15:45 horas del 05 de agosto de 1997, the Sala Constitucional, referring to acquisitive-possession proceedings insofar as relevant, stated: “the moment at which ownership is acquired through adverse possession (usucapión) is distinguished from the moment at which that circumstance is asserted in acquisitive-possession proceedings in order to obtain a title eligible for registration in the Registro Público. Thus, adverse possession is regarded as a means of acquiring ownership and other possible rights in rem, while titling is the procedure through which, once compliance with the requirements for adverse possession has been established, a registrable title of ownership is granted.” By analogy, this distinction drawn by the Sala also applies to the titling proceedings carried out by IDA; therefore, the legal nature of the acts undertaken in IDA’s titling projects was merely declaratory: they were limited to recognizing the ownership right acquired by a person through adverse possession so that it could be registered in the Registro Público, and were not acts creating an ownership right.
In the case of the parcel registered in the name of Mr. Nombre112494, the case file submitted as evidence shows that possession of the land was established, demonstrating that possessory tenure (tenencia posesoria) of the parcel predated the Board of Directors’ resolution authorizing its transfer (adopted in artículo 56 de la Sesión Ordinaria No. 022-05 celebrada el 3 de mayo del 2005). B) Substantive arguments supporting the proceedings for a declaration of injury to the public interest (proceso de lesividad): In the titling of parcel 145-000-14 in favor of Nombre112494, within the "Proyecto Coto Brus," authorized by the Board of Directors of the Instituto de Desarrollo Agrario in Article 56 of Session 022-05, dated May 3, 2005, and resulting in the registration in the Registro Público of the property in the Puntarenas District under real-property folio No. Placa20342, corresponding to cadastral plan (plano catastrado) Placa20345, the regulatory requirements set forth in the "Ley de Titulación de Tierras en Reservas Nacionales" No. 7599 del 29 de abril de 1996; the "Reglamento para la Titulación de Tierras en Reservas Nacionales" publicado en la Gaceta 173 del 10 de septiembre del 2002, in conjunction with the "Ley Forestal" No. 7575 del 5 de febrero de 1996 and the "Reglamento a la Ley de Uso de Suelos" No. 29375-MAG-MINAE-S-HACIENDA-MOPT, were not met.
This gave rise to defects rendering the administrative act absolutely null and void (nulidad absoluta), because the public interest was adversely affected, since the property forms part of the State Natural Heritage; this situation must be reversed by annulling that act on the following grounds: 1) A first defect arose from failure to comply with artículo 10 del "Reglamento para la Titulación de Tierras en Reservas Nacionales," which provides that title would be issued to land not under the administration of MINAET, in accordance with artículo 32 de la "Ley Orgánica del Ambiente" and 13 de la "Ley Forestal," which state that protected wildlife areas (áreas silvestres protegidas) and the State Natural Heritage are administered by MINAE. Consequently, inciso b) del artículo 10 del "Reglamento para la Titulación de Tierras en Reservas Nacionales" required the applicant to submit an “original certification issued by MINAE attesting that, according to the cadastral plan, the land for which title is sought is not affected by or located within conservation areas or the State Natural Heritage”; this was an essential and insurmountable requirement for the validity of the proceeding before IDA and the subsequent issuance of title.
Nevertheless, page 46 of the titling file contains certification No. SINAC-DS-OFAU-C-5103 del 01 de diciembre del 2003, issued by the Ministerio del Ambiente y Energía, Sistema Nacional de Áreas de Conservación, Oficina de Atención al Usuario, stating that the property in question partially constitutes State Natural Heritage pursuant to artículos 13, 14 y 15 de la Ley Forestal 7575 del 16 de abril de 1996. Despite that statement, issuance of title was recommended in clear violation of the cited provisions; therefore, an evident and manifest defect of absolute nullity arose in this case. 2) A second defect arose because on March 21, 2001, the "Reglamento a la Ley de Uso de Suelos" No. 29375-MAG-MINAE-S- HACIENDA-MOPT was approved, Article 58 of which requires: “In every acquisitive-possession proceeding filed with IDA or the Courts of Justice for the purpose of registration in the Registro Público de la Propiedad, the interested party, in addition to satisfying the requirements imposed by the generally applicable rules, must demonstrate, through an appropriate soil study, that possession has been exercised in compliance with the conforming land use (uso conforme de suelo) applicable to the activity performed, in accordance with the approved methodology and using best management practices and the best available technology, pursuant to artículos 3,6, 12, 13,19,26,2741,43 y 64 de la ley 7779 y su reglamento.” That article requires that, in every acquisitive-possession proceeding filed with IDA, the applicant for title must submit a study demonstrating appropriate use of the soils over which possession has been exercised.
Those regulations entered into force before title to parcel 145-000-14 was issued in favor of Mr. Nombre112494; the study was therefore mandatory. It was not submitted, however, and this noncompliance gave rise to a defect of absolute nullity. Accordingly, although IDA’s Board of Directors was advised to authorize the transfer of the parcel to Mr. Nombre112494 on the assumption that compliance with the requirements established by the "Reglamento para la Titulación de Tierras en Reservas Nacionales" had been verified, which constituted the grounds for the administrative acts, the documentation submitted as evidence established that IDA committed a series of violations during the titling proceeding for that parcel, rendering the administrative act of transfer null and void. Accordingly, the ground for nullifying the issuance of title to the parcel lies, on the one hand, in the failure to satisfy requirements established by law and regulation for the issuance of the administrative act and, on the other, in the failure to observe prohibitory provisions.
Whereas, for its part, Article 133 of the General Law of Public Administration, in referring to the grounds (motivo) as an element of validity of an administrative act (acto administrativo), provides that such grounds must be lawful and must exist as they were taken into account when the act was issued. Whereas, in the case of land titling (titulaciones de tierras) in national reserves, the grounds were regulated, and therefore failure to comply with the requirements established by law or the applicable regulations, as occurred in the case at hand, constitutes in itself a defect rendering the act null and void because the grounds did not exist as they had been taken into account when the act was issued. b. Noncompliance with prohibitory rules as grounds for absolute nullity (nulidad absoluta): Article 129 of the Political Constitution establishes that acts and agreements contrary to prohibitory laws shall be null and void unless those laws provide otherwise.
Whereas Articles 13,14, 15, 33 and 34 of the "Ley Forestal" constitute prohibitory rules, and therefore the administrative act that authorized the transfer of the parcel to the defendant is contrary to those rules, since that act authorized the titling of land forming part of the "State Natural Heritage (Patrimonio Natural del Estado)," which unquestionably contravenes Article 13 of the Ley Forestal, which declares forestlands and forests in national reserves to be part of the State Natural Heritage and places them under the administration of MINAE. Whereas, for its part, Article 14 of that same law establishes that such real property is immune from attachment and inalienable from that natural heritage. Whereas private possession of such property creates no rights whatsoever for private parties, it may not be registered through possessory information proceedings (información posesoria), and the State’s action for recovery of possession (acción reivindicatoria) is not subject to limitations.
Whereas Article 15 of that law also addresses the prohibitions preventing the Public Administration from transferring, conveying, or leasing rural real property owned by it or under its administration unless it has first been classified by MINAE; and, finally, Articles 33 and 34 of the Ley Forestal designate protection areas (áreas de protección), with the consequence that contravention of the referenced articles results in absolute nullity. D) IMPAIRMENT OF THE PUBLIC INTEREST: Whereas, having clearly established the arguments supporting the grounds for nullity of the administrative acts that authorized the transfer to the defendant of the parcel mentioned repeatedly above, it is important to analyze how those grounds for nullity affect the public interest. Whereas the nullity of the administrative act—due to noncompliance with essential requirements and because it was contrary to prohibitory rules—through which the real property at issue here was titled harms the public interest because that absolutely null and void act titled land forming part of the State Natural Heritage.
Whereas, pursuant to Article 28 of the Political Constitution, private actions that do not harm morality or public order, or injure third parties, are beyond the reach of the law. Whereas the titling of the State Natural Heritage harms public order by preventing enjoyment of every person’s right to a healthy and ecologically balanced environment, under the terms of Article 50 of the Political Constitution, which is itself a public-order rule. Whereas it must also be added that the right to a healthy and ecologically balanced environment is a third-generation fundamental right that arose with the Universal Declaration of Human Rights in 1948; and, for its part, the Lisbon Declaration of 1988, issued within the framework of the "International Conference on Guarantees of the Human Right to the Environment," urged recognition of every person’s right to live in a healthy and ecologically balanced environment and, at the same time, recommended that states establish legal mechanisms enabling each individual to exercise and demand, without impediment, the right to inhabit a healthy environment in which to develop their life.
HOWEVER, IT PARTIALLY CONSTITUTES STATE NATURAL HERITAGE PURSUANT TO ARTICLES 13, 14 AND 15 OF THE LEY FORESTAL Placa12929 16 DE ABRIL DE 1996."; without specifying the percentage of the property occupied by State Natural Heritage. Whereas the case file also contains no evidence that the defendant submitted the INTA land-use conformity study (estudio de uso conforme de suelo), or one prepared by a duly accredited private professional qualified to conduct such a study, or that any report from the Instituto Geográfico Nacional was submitted. Whereas, despite the failure during the property-titling process to comply with the requirements supporting its registration, the IDA Board of Directors, by resolution adopted under Article 56 of Ordinary Session No 022-05 held on 3 de mayo del 2005, authorized the segregation (segregación) and transfer of the parcel, which was formalized in a public deed (escritura pública).
Whereas, in Report No DFOE-PGAA-20-2008 dated 27 de agosto del 2008, entitled "Results of Studies on Land Titling in National Reserves on Land Belonging to the State Natural Heritage," the Contraloría General de la República informed INDER that the study had established that, within the substantive framework of the various titling projects and in contravention of Articles 13, 14,15 and 33 of Ley Forestal No. 7575 del 5 de febrero de 1996, IDA had titled properties with partial or complete forest cover (cobertura boscosa), or possessing land-use and topographical characteristics that placed them in the category of land suitable for forestry (terrenos de aptitud forestal) and protection areas, and that such properties therefore could not be removed from State administration or be eligible for titling in favor of the applicants because they formed part of the Natural Heritage and because all of the requirements necessary to proceed in accordance with the body of law (bloque de legalidad) in force at that time had neither been met nor submitted so that the titling in question could lawfully proceed, ordering IDA as follows: "a.
Carry out the administrative procedures and legal actions that may be appropriate before the corresponding authorities so that proceedings may be initiated to recover the lands titled by IDA that belong to the State Natural Heritage and correspond to the 15 cases detailed in this document. b. Order a complete analysis of the titles issued by IDA that were not part of the sample analyzed by this Contraloría General in this study, in order to identify cases involving the titling of land belonging to the State Natural Heritage and, where appropriate, carry out the procedures to recover such land." Whereas, in view of the order issued by the oversight body, by resolution adopted by the INDER Board of Directors under Article 5 of Ordinary Session 011-2013 dated 18 de marzo del 2013, the administrative act issued through resolution number 56 of Ordinary Session number 022-05, held on 3 de mayo de 2004 by the Board of Directors of that Institution, which gave rise to the title registered in the Property Registry, Partido de Puntarenas, real-property folio registration number Placa20342 in favor of Nombre112494, was declared detrimental to the public interest (lesivo a los intereses públicos), because it had been granted to the detriment of the State Natural Heritage.
For its part, the representative of Mr. Nombre112494 stated: Whereas, after submitting the required documentation and meeting all requirements requested by the Institution, and since he was never notified of any alleged defects, he became a beneficiary of one of the programs promoted at that time by INDER, and the land was legally and transparently registered in his name under the factual and legal framework then in effect, which remains in force to date, with the consent and full knowledge of INDER’s representatives. Whereas, if irregularities occurred in registering the property, they were not his fault; and if inconsistencies existed, they are the exclusive responsibility of the claimant’s officials, and therefore no fault should be attributed to him and the registration must be respected. Whereas IDA was at the time obligated to notify him of this alleged error, if indeed it was an error, since those requirements were not imposed when the disputed property was registered; therefore, a current rule cannot be applied retroactively to his detriment, and, if the claimant’s assertions are true, its officials were negligent in allowing that alleged error to pass at the proper procedural stage, when he should have been notified of any irregular situation; consequently, it was not his responsibility but an error by the Administration, and he cannot be blamed for that situation.
Whereas the entire matter resulted from a failure by the claimant’s officials. Whereas registration was the exclusive responsibility of the claimant Administration, since that lack of care was possibly due to the incompetence of its officials at the time, who failed to exercise such care and inform him at that time; and only many years after the property was registered in his name are they seeking to dispossess him of it, which is completely unlawful, while he bears no responsibility for the Administration’s negligence and incompetence. Whereas the proceedings conducted before the Contraloría General de la República concerning this matter were not brought to a conclusion, even though he defended himself therein, and the oversight body ordered those administrative proceedings closed and archived. Whereas, believing that the problem had already been resolved, he unexpectedly received this complaint against him, which is unjust and unlawful and is barred by the statute of limitations (prescrita) and by expiration of the applicable filing period (caduca).
Whereas the claimant’s argument is spurious insofar as it alleges that he supposedly failed to comply with requirements, which is not true; and if an error occurred, it was exclusively the claimant’s. Whereas possession (posesión) for more than 50 years was proven beyond all doubt, having been exercised by his predecessor openly, peacefully, uninterruptedly, as owner and in good faith; he acquired it from the prior possessor through a public instrument and, to date, has exercised it for more than 32 years under the conditions described above, and at no time was such possession exercised over public-domain (demaniales) or State-owned land, as demonstrated and established by the documentation he submitted. Whereas the Sala Constitucional, in the decision cited by the claimant, had already ruled in his favor by finding that the basis of acquisition was adverse possession (usucapión), which is not unrelated to this case, and the years of possession by his predecessors, combined with his own, total more than 50 years.
Whereas the act of registration is not null and void because the rules currently in force invoked by the claimant do not apply to the case at hand. Whereas he never failed to comply with the requirements for registering the land because IDA did not request them at the time, and situations of that kind were never his fault.
That the registration act is not null because rules currently in force cannot be applied retroactively to his detriment with respect to acquisitive prescription (usucapión) and acquisition dating back more than 50 years. That he has respected the conservation of the flora and fauna on the land. The State’s representative, as an active intervenor (coadyuvante activo), stated: A) NULLITY OF THE REGULATIONS FOR LAND TITLING IN NATIONAL RESERVES: That the Board of Directors of INDER adopted resolution No. 56 at ordinary session No. 022-05 concerning expediente No. 18, relating to parcel 14, block 145, the transfer of which gave rise to property No. 6-146022-000, associated with cadastral plan No. P-869458-2003 (56 ha 3197.90 m2), and which derives from property No. 6-18777-000 registered in the name of Mr. Nombre112494. That said titling proceeding (trámite de titulación) was conducted on the basis of the “Reglamento para la Titulación de Tierras en Reservas Nacionales,” approved by resolution of the Board of Directors of the Instituto de Desarrollo Agrario and published in La Gaceta No. 173 of 10 de setiembre del 2002; however, those Regulations were annulled by judgment No. 2063-2007 of the Sala Constitucional with effects “retroactive to the effective date of the provisions being annulled, namely, doce de agosto del dos mil dos.” Accordingly, the administrative act issued through resolution No. 56 of ordinary session No. 022-05 became absolutely null, and therefore, at ordinary session No. 011-2013 of 18 de marzo de 2013, article 5, INDER declared it detrimental to the public interest (lesivo a los intereses públicos).
That the Sala Primera de la Corte Suprema de Justicia, in decisions 1070-F-S1-2010 and 1088-F-S1-2011, confirmed the view that the nullity—and annulment—of the Reglamento para la Titulación de Tierras en Reservas Nacionales invalidated the titles issued under that provision. On that point, the Court stated: “...In this regard, the illegitimate titling by the Board of Directors of the IDA of the disputed property in favor of the co-defendant was based on the Reglamento para la Titulación de Tierras en Reservas Nacionales, approved by the Board of Directors of the Instituto de Desarrollo Agrario and published in La Gaceta number 173 of diez de setiembre del dos mil dos. Subsequently, through Voto No. 02063-07, the Sala Constitucional annulled those regulations as unconstitutional. Given the declaratory and retroactive effects of that ruling, it is evident that the administrative conduct based on the provision declared unconstitutional became null by connection (nulidad por conexidad).
This Chamber considers the scope that the Court gave to the various constitutional rulings to be correct...” (Voto No. 1070-F-51-2010 considerando VII. Emphasis not in the original). “...The decision of the Sala Constitucional was correctly assessed by the lower-court judges, since the judgment found that the resolution of the Board of Directors of the IDA, article 32, adopted at session 016-04 of 13 de mayo de 2003, was issued on the basis of the rules that the aforementioned Chamber declared unconstitutional; this was one of the grounds weighed in the judgment for granting the claim insofar as it sought a declaration of nullity of that resolution, with the consequent nullity of the remaining subsequent acts and contracts that enabled title to the property at issue in these proceedings to be transferred to a private individual...” (Voto No. 1088-F-S1-2011). Those “regulations,” used as the basis for the “titling” in favor of the defendant, were annulled precisely because the Instituto de Desarrollo Agrario lacked authority to issue them and because there were no legal grounds supporting them: “...because the Law that purportedly supports these regulations in no way authorizes the State to issue title to national reserves within the titling project of the Instituto de Desarrollo Agrario...but only to promote land tenure for exclusively agricultural purposes (article 1 of the Ley de Tierras y Colonización), through land-allocation contracts (contratos de adjudicación de tierras)” (constitutional judgment No. 2063-2007).
That article 1 of the annulled Regulations stated: “The purpose of this legal instrument is to regulate the provisions of the Ley de Tierras y Colonización concerning land titling in National Reserves...”; however, the Ley de Tierras y Colonización, No. 2825 de 14 de octubre de 1961, does not regulate land titling, but addresses only subdivision (parcelación) in articles 49 through 81 and colonization (colonización) in sections 82 through 91. Consequently, the Instituto de Desarrollo Agrario lacked authority to issue title in favor of the defendant to the land described in cadastral plan No. P-869458-2003, and that defect is sufficient to annul the administrative act. That titling, or the procedure for obtaining a registrable title of ownership based on the exercise of possession for purposes of acquisitive prescription (posesión ad usucapionem), subject to the requirements listed in the Código Civil, differs from subdivision and colonization: “Requirements as to time and condition characterize the possession necessary to acquire title by prescription.
(...) Titling of real property requires acquisition of ownership. In other words, the time at which ownership is acquired by prescription is distinguished from the time at which that situation is asserted (...) to obtain a title registrable in the Registro Público. Accordingly, acquisitive prescription is regarded as a means of acquiring ownership and other possessory real rights, while titling is the procedure through which, once the requirements for acquisitive prescription have been established, a registrable ownership title is conferred.” (Voto No. 4587-1997 of the Sala Constitucional, boldface not in the original). That subdivision and colonization, by contrast, are contractual, derivative means of acquiring ownership from the public agrarian entity and are based on other prerequisites. Colonization may even involve land-tenure arrangements other than ownership, such as a lease, with or without an option to purchase, sharecropping, or usufruct (article 83 and sections 49 through 91 of Ley No. 2825).
Allocation (adjudicación) is inherent in subdivision or land-assignment contracts and colonization contracts (Ley No. 2825, articles 49 subsection e), 55, 60, 64, 65, 68 subsection 4) and 69; Sala Primera de la Corte Suprema de Justicia, decisions 229-F-90 de 15 horas del 20 de julio de 1990, reiterated on numerous occasions, and 649-C-2001, considerando V; Tribunal Agrario, decisions 555-1993, 119-1995, 105-2001, 395-2002 and 542-2002). No article of the Ley de Tierras y Colonización authorized the Instituto de Desarrollo Agrario to issue titles, much less to issue a Reglamento para la Titulación de Tierras en Reservas Nacionales. That the Reglamento para la Titulación de Tierras en Reservas Nacionales encroached upon the authority of the Poder Legislativo by creating a special summary administrative titling procedure that excluded the judicial procedure provided for in the Ley de Informaciones Posesorias, No. 139 de 14 de julio de 1941, which only the legislature could establish.
That it amended the titling rules by authorizing titling of land registered in the name of the IDA (article 7° of the Regulations and article 1 of the Ley de Informaciones Posesorias). All legislation that formerly authorized administrative titling before the ITCO or IDA, and which is no longer in force, had the rank of statute: Ley de Informaciones Posesorias Administrativas No. 3971 de 11 de octubre de 1967, Ley de Informaciones Posesorias No. 4545 de 20 de marzo de 1970 and Ley de Titulación Múltiple de Tierras No. 5064 de 22 de agosto de 1972. B) TITLING OF THE STATE’S NATURAL HERITAGE: That, moreover, certification No. SINAC-DS-OFAUC-5103-2003 states that the land described in cadastral plan No. P-869458-2003 “PARTIALLY CONSTITUTES PART OF THE STATE’S NATURAL HERITAGE.” That the plan describes the property as partly mountain land, and that the forests and forest land, or land suitable for forestry (aptitud forestal), within property No. 6-18777-000, registered in the name of the Instituto de Desarrollo Agrario, constitute the State’s Natural Heritage (Patrimonio Natural del Estado) pursuant to article 13 of the Ley Forestal, which states: “The State’s natural heritage shall consist of the forests and forest land on properties registered in its name and those belonging to autonomous institutions and other Public Administration bodies.” And that, in that capacity, they could not be exchanged, assigned, alienated in any manner, transferred, or leased, because articles 13, 14, and 15 of that law prohibit such acts.
That this was confirmed by the Sala Primera de la Corte Suprema de Justicia in decisions No. 1070-F-S1-2010 and 1088-F-S1-2011, concerning the annulment of titles issued by the IDA over land forming part of the Patrimonio Natural del Estado. In that regard, the Chamber stated: “...VIII—The IDA asserts that the Court failed to consider that it was MINAET that transferred the land to it in the year 2000, and that this situation led it to understand that the land did not fall within the categories established by the Ley Forestal as forming part of the State’s natural heritage. Because it was established before this court that most of the property at issue in these proceedings is covered by forest, it follows that the very regulations annulled as unconstitutional barred the transfer of the land in favor of the IDA. Similarly, article 14 of the Ley Forestal provides that the forest land and forests constituting the State’s natural heritage ‘...shall be immune from attachment and inalienable; possession thereof by private individuals shall create no right in their favor, and the State’s action to recover such land shall not be subject to any limitation period.
Consequently, they may not be registered in the Registro Público through possessory-information proceedings (información posesoria), and both their invasion and occupation shall be punished as provided in this law.’ Notwithstanding the IDA’s contention that MINAET transferred the land to it, which it claims led it into error, that circumstance does not relieve it of its duty to conform its conduct to the legal framework in force; accordingly, this ground of appeal cannot be accepted. Similarly, the assertion that the Court failed to consider that the land had been in the possession of private individuals does not constitute a claim that this Chamber can uphold, because the Ley Forestal is clear that such property is inalienable, that possession by private individuals creates no right in their favor, and that the State’s action to recover it is not subject to any limitation period...” (Sala Primera de la Corte Suprema de Justicia, decision No. 1070-F-S1-2010).
That article 10 of the “Reglamento para la Titulación de Tierras en Reservas Nacionales” permitted only the transfer of land “that is not subject to administration by MINAE” and required an “original certification issued by MINAE stating that the land to be titled, as shown on the cadastral plan, is not affected by or located within the ‘Patrimonio Natural del Estado’”; however, in view of certification No. SINAC-DS-OFAU-C-5103-2003, it is clear that those requirements were not met, because it states that the land “PARTIALLY CONSTITUTES PART OF THE STATE’S NATURAL HERITAGE,” administered by MINAE pursuant to article 13 of the Ley Forestal. That the aforementioned certification constitutes conclusive evidence (plena prueba) pursuant to article 370 of the Código Procesal Civil, which applies supplementarily to this case by operation of article 220 of the Código Procesal Contencioso Administrativo.
That public ownership of forested land, forest land, or land suitable for forestry, dedicated to the pursuit of objectives of general interest, is a powerful conservation tool: “forest ownership is conceived fundamentally for conservation, not for production or to form part of commerce among persons.” (Sala Constitucional, decision No. 4587-1997).
That the duty to protect and preserve the integrity of the environment (the principle of environmental protection entrusted to the State) encompasses forest resources (Constitutional Chamber, decisions numbers 2233-1993 and 6836-1993). That the protective regime established in the Ley Forestal for the State Natural Heritage (Patrimonio Natural del Estado) means that tree cutting (corta), forest harvesting (aprovechamiento forestal), and land-use change (cambio de uso del suelo) are not permitted; and only research, training, and ecotourism activities may be authorized (articles 1; paragraph 2°, 3 subsection a), 14, 15, 18, 58 subsections a) and b), and 61 subsection e). That the report submitted by Costa Rica to the IV Conference of the Parties to the Convention on Biological Diversity stated (in 1998) that the principal causes of biodiversity loss included the expansion of the agricultural frontier into areas unsuitable for this type of use and agricultural incentive policies that have led to deforestation.
That the improper conveyance of lands belonging to the State Natural Heritage alters the purpose prescribed by the Ley Forestal for those public assets, in conflict with Article 50 of the Constitution and Article 11 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights, the “Protocol of San Salvador,” approved by Law No. 7907 of 3 de setiembre de 1999, which guarantee the right to an adequate environment; with the principle that protection of environmental rights is entrusted to the State (among others, Constitutional Chamber decisions numbers 3341-1996 and 9193-2000); and with Article 8 of the Convention on Biological Diversity (Law No. 7416 of 30 de junio de 1994), which establishes the State’s duty to manage resources “important for the conservation of biological diversity, whether within or outside protected areas, with a view to ensuring their conservation” (subsection e).
Finally, the representative of SINAC, as an interested third party, stated: TITLING OF THE STATE NATURAL HERITAGE: That certification No. SINAC-DS-OFAU-C-5103-2003 indicates that the land depicted in plan P-869458-2003, registered in the name of IDA and possessed by the respondent, describes a property that partially constitutes State Natural Heritage, pursuant to articles 13, 14, and 15 of Ley Forestal No. 7575 of 16 de abril de 1996. That Article 13 of that Law expressly provides that the State Natural Heritage consists of the forests and forestlands of national reserves, areas declared inalienable, properties registered in the State’s name, and properties belonging to municipalities, autonomous institutions, and other Public Administration bodies, and that, as such, they may not be exchanged, assigned, conveyed, transferred in any manner, or leased, pursuant to that law. Finally, the representative of SINAC cited the First Chamber’s holding in decision 1070-2010, which stated that the forestlands and forests constituting the State Natural Heritage are not subject to attachment and are inalienable, that their possession by private parties creates no rights in their favor, and that the State’s action for recovery of those lands (acción reivindicatoria) is not subject to any limitation period. Consequently, those properties cannot be privately registered in the Public Registry. These arguments were reiterated by all parties at the preliminary hearing.
The following proven facts are relevant for purposes of these proceedings:
The representative of Mr. Nombre112494 raised the defense of limitation and expiration without elaboration. Because these defenses may bring the proceedings to an end, they must be examined first. In this regard, the plaintiff must bear in mind that the purpose of these proceedings is for this Court to declare absolutely null and void the decision adopted by the Board of Directors of the Instituto de Desarrollo Agrario in Article 56 of Session 022-05, dated May 03, 2005, insofar as it concerns the issuance of title to the property Partido de Puntarenas, real-property record No. 146022-000, in favor of Mr. Nombre112494, as well as all other related acts. The proceedings before the Court are therefore an action challenging an administrative act as harmful to the public interest (proceso de lesividad), based on the allegation that part of the registered land forms part of the State Natural Heritage (Patrimonio Natural del Estado), which constitutes public-domain property (dominio público), and, as such, the State’s action to recover it is not subject to any statute of limitations (imprescriptible).
In this regard, Sala I stated: “...Likewise, the assertion that the Court failed to consider that the land has been in the possession of private parties does not constitute a claim that may be entertained by this Chamber, because the Ley Forestal is clear that these are inalienable assets, whose possession by private parties shall create no rights in their favor, and the State’s recovery action (acción reinvindicatoria) is not subject to any statute of limitations...” (Sala Primera de la Corte Suprema de Justicia, voto No. 1070-F-S1-2010). Accordingly, this defense is technically unavailable against the claim and is therefore denied. Regarding expiration, it should be noted that, pursuant to Article 34 of the Código Procesal Contencioso Administrativo, an action challenging an administrative act as harmful to the public interest concerning the protection of public-domain property shall not be subject to any time limit.
Consequently, since these proceedings concern such an action for the recovery of the State Natural Heritage as public-domain property, the action is not subject to an expiration period; therefore, this defense is likewise unavailable and is also denied.
The harmfulness proceeding (proceso de lesividad) seeks a judgment annulling the resolution adopted by the INDER Board of Directors in Article 56 of session 022-05, held on 03 de mayo del 2005, insofar as it concerns the titling (titulación) of the property registered in the Puntarenas District, real-property folio No. Placa20342, on the grounds that the titling was carried out without the beneficiary having satisfied the requirements imposed by the applicable regulations, and consequently seeks the annulment of related acts, such as the deed through which title to the property was formally conveyed to Mr. Nombre112494 and the registry entry. Regarding the nullity of the administrative act, this Section of the Court has reiterated in its judgments, including Judgment No. 64-2016 of nueve horas del doce de julio de dos mil dieciséis: “...Pursuant to Article 158 of the Ley General de la Administración Pública (hereinafter, LGAP), the absence or defect of any requirement of an administrative act, whether expressly or implicitly required by the legal system, shall constitute a defect (vicio) in that act.
It then states that an administrative act that is substantially inconsistent with the legal system shall be invalid, while clarifying that immaterial violations shall not invalidate the act. This means that an administrative act may involve two types of violations: material and immaterial. The former render the act invalid, which, depending on the seriousness of the violation committed, takes the form of relative or absolute nullity; the latter do not render the act invalid, but do give rise to the disciplinary liability of the responsible public servant. Accordingly, the validity of an administrative act is established by the complete and proper fulfillment and presence of its constituent elements, both formal and substantive. Both national legal scholarship and the LGAP distinguish these elements to which we refer as formal and substantive. The formal elements include the actor, procedure, and form, while the substantive or material elements are the grounds, content, and purpose.
The first formal element of an administrative act is the actor (sujeto). This is the author of the act. It is the public official, administrative body, or administrative entity that issues an administrative act and that must, in turn, satisfy a series of requirements, such as investiture (investidura), jurisdiction (competencia), and incumbency (titularidad). Investiture is the appointment or election of a person to a public office or position (in this regard, Articles 111 et seq. of the LGAP). It is the authority to act in the name and on behalf of the State and to attribute the effects of that person’s conduct to it. Investiture may arise through election or appointment. It becomes effective upon taking office. Nombre28 defines jurisdiction ‘as the exact measure of the legally authorized means available to the State, within a specific case, to pursue a particular purpose.’ Jurisdiction means the set of powers and duties vested in a particular administrative entity.
Jurisdiction is the body of authorities and powers attributed to a particular administrative body in relation to the others, because its foundation lies in the plurality of bodies comprising the Public Administration and the distribution of the various functions among them (Articles 59 and 129 LGAP). Finally, incumbency means that the public official must not only have jurisdiction but must also be the holder of that jurisdiction. An incumbent has been understood to be a person who holds an office, profession, or position by right or by permanent appointment, with all applicable qualifications and security of tenure, as distinguished from a person called upon to occupy it provisionally.
The second formal element of an administrative act is the procedure. The Public Administration has the authority to issue administrative acts unilaterally, which may even annul or revoke the subjective rights (derechos subjetivos) of private parties. This power of self-enforcement (auto tutela) has been limited by the legal system. That limitation consists of the Public Administration’s obligation to follow a procedure when issuing an administrative act. An administrative procedure (procedimiento administrativo) is a connected series of procedural acts directed toward a particular end. The fundamental purpose of an administrative procedure is to ascertain the substantive truth (verdad real) concerning the grounds that will serve as the basis for the final administrative act. The procedure is the method by which an act is produced (Articles 214, 216, 224, 225, 308, and 320 LGAP). However, when such a procedure is intended to impose a sanction or otherwise issue an adverse act (acto de gravamen), whether by imposing an obligation or causing the loss of a status or right, the act initiating that procedure must be duly communicated to the affected party.
This communication is accomplished in two ways: service of notice (notificación) or publication. General acts are communicated by publication and specific acts by service of notice—Article 240 Ley General de la Administración Pública—; however, when the address for serving notice on the interested party is unknown or incorrect through that party’s own fault, the act must be communicated by publication, in which case communication shall be deemed completed five days after such publication (Article 242 LGAP).
Service of notice is the method of directly and personally communicating the initiation of the procedure to the person affected by, or addressed by, the final act; it constitutes a fundamental requirement of legal certainty (seguridad jurídica) and substantive due process (debido proceso sustancial). Service of notice is a legal duty of the Administration, the purpose of which is to ensure that the affected parties obtain true, actual, and complete knowledge that an administrative procedure has been instituted against them and of its consequences. Undoubtedly, proper service of notice is another manifestation of the elements comprising due process (debido proceso), which the Constitutional Chamber has defined as follows: (a) serving the affected party with notice of the charges, which entails communicating the alleged facts individually, specifically, and promptly; (b) allowing unrestricted access to the administrative record (expediente administrativo); (c) granting a reasonable period to prepare a defense; (d) granting a hearing and allowing the submission of any evidence deemed appropriate in support of the defense; (e) stating the grounds for the decisions that conclude the procedure; and (f) recognizing the right to appeal the sanctioning decision (resolución sancionatoria)” (Voto número 5469-95 de las dieciocho horas tres minutos del cuatro de octubre de mil novecientos noventa y cinco).
It should be noted that, pursuant to Article 223 LGAP, only the omission of essential procedural formalities shall result in the nullity of the proceedings, an essential formality being understood as one whose proper observance would have prevented or altered the final decision in significant respects, or whose omission caused a denial of the right to a defense (indefensión). Accordingly, procedural defects are those caused by failure to observe the required procedural formalities, insofar as the omission or absence of such a formality prevents or alters the final decision or causes a denial of the right to a defense.
The third formal element of an administrative act is its form, meaning the manner in which the administrative act is expressed or manifested. Pursuant to Article 134 of the LGAP, an administrative act must be expressed in writing unless its nature or the circumstances require a different form (see 136 LGAP and 146 Constitución Política). This formal element gives rise to the Administration’s obligation to adequately justify its decisions by providing reasons (motivación) for its acts, since providing reasons means the explanation, legal basis, or justification furnished by the Administration when issuing an administrative act. It has been stated that: ‘To state the reasons for an administrative act is to trace the decision contained therein back to a rule of law that authorizes that decision or from whose application it arises. Therefore, stating the reasons for an act requires, first, establishing the facts taken into consideration and bringing those facts within the scope of a legal rule; and, second, explaining how that legal rule requires the determination adopted in the operative portion of the act.’ (Eduardo García de Enterría and Tomás Ramón Fernández; “Curso de Derecho Administrativo,” Volume I, Editorial Civitas, Madrid, 1997, p. 556).
The Constitutional Chamber has stated: ‘The requirement to provide reasons for administrative acts must be understood as the justification that public authorities must give for the content of the act they issue, taking into account the factual and legal grounds and the purpose sought by the decision. In settled case law, this Court has held that providing reasons for administrative acts is a requirement arising from the constitutional principle of due process as well as from the right of defense, and entails reference to facts and legal grounds so that the person subject to the Administration’s authority may know the reasons for being sanctioned or for the denial of an application affecting that person’s interests or even subjective rights.’ (Voto 7924-99).
With respect to the material or substantive elements of an administrative act, the grounds (motivo) (Article 133 LGAP) are the legal predicate, the triggering fact that gives rise to the administrative act. Thus, the grounds for the administrative act constitute the predicate or triggering fact for issuing an administrative act; in other words, they constitute the administrative act’s rationale—what requires or permits its issuance. They may consist of a legal act or legal fact contemplated by the legal rule. The content of the act, meanwhile, constitutes its legal effect or operative portion—what it commands, orders, or provides. It is the change that the act introduces into the legal sphere. It is the part of the act that provides for a sanction, authorization, permit, or concession (Article 132 LGAP).
The last of the substantive or material elements is the purpose (fin). The Public Administration has a single mission: satisfying the public interest. The public interest is satisfied in various ways, one of which is through the issuance of administrative acts that exercise the specific jurisdiction assigned to the administrative body or entity precisely so that it may act upon and satisfy the public interest inherent in the jurisdiction conferred. In principle, every administrative act, as the specific result of general jurisdiction, is understood to seek the satisfaction of the common interest. It is therefore stated that the purpose of an administrative act is the satisfaction of the public interest, which constitutes the general purpose of every administrative act, while its specific purpose is the satisfaction of the public interest entrusted to that jurisdiction (Article 131 LGAP).
Article 166 LGAP provides: ‘An act shall be absolutely null (nulidad absoluta) when one or more of its constituent elements are entirely absent, either factually or legally.’ It should be borne in mind, as Nombre111027 reminds us, that ‘the concept of an administrative act is unquestionably a consequence of the Public Administration’s subjection to a legal regime’ and that the ‘frequently referenced general principle of legality of administrative action becomes, when each specific administrative act is examined, a matter of purely legal analysis, the use of which is then indispensable for rigorously determining which administrative acts are legally valid and which are not....’ Thus, pursuant to the Ley General de la Administración Pública, an administrative act (acto administrativo) shall be absolutely void (nulidad absoluta) when one or more of its elements—namely, grounds (motivo), content (contenido), or purpose (fin)—are lacking, a circumstance that must be determined in each specific case.
Although the statement of reasons (motivación) does not technically constitute one of the constituent elements of the act, it provides the technical and logical explanations and justifications for why the Administration acts in a particular manner; therefore, failure to provide an adequate statement of reasons for an administrative act constitutes a violation of the affected party’s right of defense (derecho de defensa). In the present matter, it is alleged that the resolution whose annulment is sought is absolutely void due to a lack of grounds, an issue that will be analyzed below.
Without prejudice to the literal wording of its arguments, which this Court has reviewed in their entirety, we now proceed to analyze this matter. INDER’s counsel instituted an action seeking a declaration that an administrative act is injurious to the public interest (proceso de lesividad), requesting that, because it is injurious to the public interest, the resolution adopted by the Board of Directors of the Instituto de Desarrollo Agrario in Article 56 of session 022-05, dated 3 de mayo del 2005, be annulled solely insofar as it concerns the issuance of title (titulación) to parcel No. 000-14 of Block 145 of the Proyecto de Titulación Coto Brus. It further requested that, by reason of their connection, public deed No. 2 of Volume No. 8, executed before Notary Jimmy Meza Lázarus on 29 de junio de 2005, by which the title issued by IDA was formalized and recorded in a notarial protocol, and the resulting registry entry—namely, the property in the Puntarenas Registry District, real-property folio No. 146022-000, in the name of Nombre112494, corresponding to cadastral plan P-0869458-2003—be annulled.
That request was based on the following: The Board had been advised to authorize the transfer and issuance of title to parcel 000-14 of Block 145 of the “Proyecto Coto Brus” in favor of Nombre112494, purportedly because he had satisfied the requirements established by the “Reglamento para la Titulación de Tierras es Reservas Nacionales”; consequently, at ordinary session No. 022-05, held on 3 de mayo de 2005, Article 56 authorized the issuance of title, thereby creating the property in the Puntarenas Registry District, real-property folio No. Placa20342, corresponding to cadastral plan P-0869458-2003. It alleged, however, that those requirements had not been satisfied due to two defects: 1) Because Article 32 of the Organic Environmental Law and Article 13 of the Ley Forestal respectively establish that Protected Wildlife Areas (Áreas Silvestres Protegidas) and the State Natural Heritage (Patrimonio Natural del Estado) are administered by MINAE, applicants were required to submit a certificate issued by MINAE stating that the land for which title was sought was not located within a protected wildlife area and did not form part of the State Natural Heritage.
This requirement was essential and insurmountable for the validity of the proceeding because Article 10.b) of the Reglamento para la Titulación de Tierras en Reservas Nacionales required the interested party to submit a MINAE certificate stating that, according to the cadastral plan, the land for which title was sought was not within a conservation area (área de conservación) and did not form part of the State Natural Heritage. In this case, certificate SINAC-DS-OFAU-C-5103 of 01 de diciembre de 2003 was submitted, stating that the parcel partially constitutes State Natural Heritage; notwithstanding that fact, issuance of title was recommended, thereby contravening Article 13 of the Ley Forestal and Article 10.b) of the Reglamento para la Titulación de Tierras en Reservas Nacionales, which resulted in an evident and manifest defect of absolute nullity (nulidad absoluta evidente y manifiesta). 2) Article 58 of the Regulations to the Land Use Law (Reglamento a la Ley de Uso de Suelos), No. 29375-MAG-MINAE-S-HACIENDA-MOPT, of 21 de marzo de 2001, required applicants in possessory-information proceedings (información posesoria) before IDA to submit an appropriate soil study stating that possession had been exercised in compliance with proper land use.
Nombre112494 did not submit such a study, resulting in another defect of absolute nullity. Because of those defects, pursuant to Articles 133, 158, 166, and 167, and because the grounds (motivo) for issuing title were duly regulated, failure to satisfy those requirements resulted in defects rendering the act null, since the grounds as considered when the act was issued did not exist. Second, prohibitory provisions were violated because title was issued to State Natural Heritage, which is impermissible under Articles 13, 14, 15, 33, and 34 of the Ley Forestal; therefore, pursuant to Article 129 of the Constitution, acts and agreements contrary to prohibitory laws are null and void. SINAC’s counsel, acting as an interested third party (tercero interesado), argued that certificate SINAC-DS-OFAU-C-5103-2003 stated that the land described in plan P-869458-000, in IDA’s name, partially constitutes State Natural Heritage and that, under Article 13 of the Ley Forestal, forests and lands constituting State Natural Heritage may not be exchanged, assigned, or conveyed in any manner.
For its part, counsel for the State, acting as an active supporting party (coadyuvante activo), likewise stated that, according to certificate SINAC-DS-OFAU-C-5103-2003, the titled parcel constitutes State Natural Heritage, thereby violating Articles 13, 14, and 15 of the Ley Forestal and rendering the award resolution absolutely null, a position reiterated by the First Chamber in decisions No. 1070-F-S1-2010 and 1088-F-S1-2011. That counsel also added an argument not advanced by either INDER’s or SINAC’s counsel, stating that the issuance of title to Nombre112494 under the resolution whose annulment is sought was based on the Reglamento para la Titulación de Tierras en Reservas Nacionales, approved by IDA’s Board of Directors on 12 de agosto de 2002 and published in La Gaceta No. 173 of 10 de setiembre de 2002. That regulation was annulled by Constitutional Chamber judgment No. 2063-2007, with retroactive effect as of the date on which the annulled provision took effect, namely, 12 de agosto de 2002; consequently, resolution No. 56 of ordinary session No. 022-05 is affected by supervening nullity (nulidad sobrevenida).
In decisions 1070-F-S1-2010 and 1088-F-S1-2011, the First Chamber confirmed that the nullity and annulment of the Reglamento para la Titulación de Tierras en Reservas Nacionales rendered null the titles issued pursuant to it. This was because the Constitutional Chamber annulled it on the grounds that IDA, now INDER, lacked authority (competencia) to issue it and that the statute purportedly underlying the regulation did not in any manner authorize the State to issue title to national reserve lands and State Natural Heritage. Accordingly, IDA, through that Regulation, encroached upon the authority of the Legislative Branch and therefore lacked authority to issue title to parcel No. 000-14 of Block 145 of the Proyecto de Titulación Coto Brus in the name of Nombre112494, a defect sufficient to annul the award act (acto de adjudicación). Counsel for Nombre112494 argued that he acquired the right of possession (derecho de posesión) over the property from his predecessor, who had exercised it openly, peacefully, and as owner for more than 50 years, and that, to date, he had exercised it for more than 32 years under the same conditions.
At no time had that possession been exercised over public-domain or State land; thus, the basis for acquiring bare ownership (nuda propiedad) was acquisitive prescription (usucapión), as stated by the Constitutional Chamber in the decision cited by counsel for the State. He asserted that he submitted all legally required documentation and requirements with his application for title and that IDA did not notify him of any defect or omission. Having submitted all legal and factual requirements without receiving notice of any defect, INDER issued title to the parcel in his name, and it was then registered. IDA was responsible for verifying compliance with the requirements, and any inconsistencies, omissions, or irregularities were exclusively the responsibility of INDER officials; therefore, no fault or blame should be attributed to him, and the registration should be upheld. He contended that only many years after registration of the property was an attempt being made to dispossess him of it, which was entirely unlawful because he was not responsible for the negligence and lack of expertise with which the granting authority had acted.
At the time the property was registered, the allegedly omitted requirements were not mandatory; therefore, the requirements of a later provision could not be applied retroactively to his detriment. Based on the alleged facts and the admitted evidence, this Chamber finds that the action seeking a declaration that the administrative act is injurious to the public interest must be granted for the reasons set forth below. By resolution adopted in Article 56 of session 022-05 of 3 de mayo del 2005, INDER’s Board of Directors awarded parcel No. 145-000-14 to Nombre112494, leading to the registration of the property in the Puntarenas Registry District under real-property folio No. 146022-000. INDER’s counsel then instituted this action seeking annulment of that resolution, alleging two instances of noncompliance that resulted in defects of absolute nullity: namely, INDER failed to take into account that, in Certificate No. SINAC-DS-OFAU-C-5103-2003 of 01 de diciembre de 2003, the Sistema Nacional de Áreas de Conservación warned that the parcel for which title was sought, as shown on cadastral plan No. P-0869458-2003, partially constituted State Natural Heritage; moreover, the interested party failed to submit the required land-use study (estudio de uso de suelos), as mandated by Article 58 of the Reglamento a la Ley de Uso de Suelos, No. 29375-MAG-MINAE-S-HACIENDA-MOPT.
This position was supported by SINAC’s counsel as an interested third party and by the State as an active supporting party. In addition, counsel for the State argued that the decree underlying the resolution by which title to the parcel was issued had been declared unconstitutional, affecting the validity and legal effect of the actions taken. This Chamber does indeed find that those actions were carried out in violation of the legal system, rendering them affected by an evident and manifest defect of absolute nullity for the following reasons: 1) Title was issued to State Natural Heritage, a public-domain asset (bien de dominio público): This matter seeks the annulment of the acts and contracts that allowed the property consisting of State Natural Heritage to leave State ownership and pass into private hands. Accordingly, this Chamber analyzed the evidence concerning the background of those actions in order to determine precisely whether the property had been owned by the State or any of its institutions or was covered by forest (bosque), questions that must be answered in the affirmative for the following reasons: On 11 de diciembre de 2003, Nombre112494 submitted an application to the Instituto de Desarrollo Agrario requesting title to parcel 000-14 of Block 145 of the Proyecto de Titulación Coto Brus, located in Río Bonito, Distrito Corredores, Cantón Corredores, Provincia de Puntarenas, with an area of 56ha 3197.90 Mts2.
As evidence, he submitted a deed executed before Notary Roy Faustino Jiménez Rodríguez, who certified that Nombre112494 appeared before him on 01 de julio de 2001 and acquired from Nombre112495 the right of possession, held for 17 years, over an unregistered property measuring 40 hectares and located in Río Bonito, Distrito de Corredores, Cantón Corredores, which he described as agricultural land consisting of brushland and mountain forest (tacocal y montaña). He also submitted a private document signed by Nombre112494 and José Ángel Castro Baguardia, dated 07 de octubre de 1983, under which the former acquired from the latter, for 20 thousand colones, a right of possession over an unregistered property located in Río Bonito, Distrito Corredores, Cantón Corredores, measuring 30 hectares and described as land planted with pasture, with the remainder consisting of secondary brush and mountain forest, used for grazing, with part of the mountain forest devoted to agriculture and to the conservation of flora and fauna.
In other words, both documents establish that mountain forest had always existed on the property or parcel for which title was sought. Its status as State Natural Heritage was expressly stated in the certificate issued by the Sistema Nacional de Áreas de Conservación No.
SINAC-DS-OFAU-C-5103-2003 dated 01 de diciembre de 2003, in which it warned that the parcel to be titled pursuant to cadastral plan No. P-0869458-2003 partially constituted the State’s natural heritage (patrimonio natural del Estado); however, that circumstance was not considered in the challenged resolution. That status was conclusively established in Report SINAC-ACOSA-PNE-AD-044-2016, dated 24 de abril del 2015, which concluded: “...The PNE-ACOSA Program concludes and recommends that it be stated that, within the area of 56ha 3197.9 m2 of the property shown on cadastral plan 60869458-2003, located in Distrito Corredores, cantón de Corredores, Provincia de Puntarenas, IGN Cañas Gordas Map Sheet, Scale 1:50000, between the coordinates under the CRTM05 projection system, Placa20340 Placa20341, there are approximately 50 ha 5797 M2 of features that could qualify as the State’s natural heritage; that is, 89.8% of the area is affected...”.
Therefore, because the property was covered by forest and was within the State’s domain, it formed part of the State’s natural heritage, which precluded its titling in favor of private parties pursuant to Articles 14, 15, 16, 33, and 34 of the Ley Forestal. Indeed, Article 14 of the Ley Forestal provides that forestlands and forests constituting the State’s natural heritage “...shall be immune from attachment and inalienable; their possession by private parties shall create no right in their favor, and the State’s action to recover such lands shall not be subject to limitation. Consequently, they may not be registered in the Public Registry through possessory proceedings (información posesoria), and both their encroachment and occupation shall be punished in accordance with this law.” Thus, possession by private parties creates no right in their favor, and the State’s recovery action is not subject to limitation.
Accordingly, when the Board of Directors of the Instituto de Desarrollo Agrario resolved in Article 56 of Session 022-05 of 03 de mayo del 2005 to title parcel 000-14 of Block No. 145 of the Proyecto de Titulación de Coto Brus, described in cadastral plan P-0869458-2003, in favor of Mr. Nombre112494, even though it constituted the State’s natural heritage and therefore public-domain property (bien de dominio público) that, by its nature, is immune from attachment, not subject to limitation, inalienable, and outside private commerce, it acted contrary to the legal system by failing to consider the aforementioned warning. This constituted an absolute, evident, and manifest defect in Resolution No. 56 adopted at Session 022-05 held on 03 de mayo de 2005, and the resolution must therefore be annulled. The second instance of noncompliance alleged to have caused a defect of absolute nullity in the proceedings was that Mr.
Nombre112494 did not submit the Land-Use Certificate (Certificado de Uso de Suelo), as required by Article 58 of the “Reglamento a la Ley de Uso de Suelos,” Decreto No. 29375-MAG-MINAE-S- HACIENDA-MOPT of 21 de marzo de 2001, which provides: “In every possessory proceeding or filing submitted to the IDA or the Courts of Justice for the purpose of registration in the Public Property Registry, the interested party, in addition to the requirements imposed by the generally applicable regulations, must demonstrate through an adequate soil study that possession has been exercised in compliance with the proper land use for the activity conducted, in accordance with the approved methodology, and that such activity has been carried out using best management practices and the best available technology, in compliance with Articles 3, 6, 12, 13, 19, 26, 27, 41, 43, and 64 of ley 7779 and its regulations.” In this Court’s view, had the interested party submitted that certificate, the application would necessarily have been denied, because the use would not have been compliant given the property’s status as natural heritage.
Consistent with this reasoning, Article 158 of the LGAP states that the absence or deficiency of any requirement for an administrative act (acto administrativo) expressly or implicitly imposed by the legal system constitutes a defect in that act. Therefore, because the cited article required that certificate and the interested party failed to provide it, it was improper to title parcel No. 000-14 of Block 145 of the Proyecto de Titulación Coto Brus in the name of Mr. Nombre112494, an omission that also gives rise to a defect of absolute nullity in the proceedings. A third issue that, in this Chamber’s view, rendered the proceedings absolutely, evidently, and manifestly null was that the Sala Constitucional, through Resolution No. 2063-2007, issued at 14 horas 40 minutos on 14 de febrero de 2007, ruled: “The action is declared PARTIALLY GRANTED. Consequently, the Reglamento para la Titulación en Reservas Nacionales, approved by resolution of the Board of Directors of the Instituto de Desarrollo Agrario at Session 055-02 of doce de agosto del dos mil dos and published in La Gaceta 173 of diez de setiembre del dos mil dos, is annulled.
This judgment shall have declaratory and retroactive effect as of the effective dates of the provisions hereby annulled, namely doce de agosto del dos mil dos and dieciséis de abril de mil novecientos noventa y seis, respectively. The foregoing is without prejudice to any financial liability of the State arising from this unconstitutionality (...)”. Now, it has been established that Article 56 of the resolution of the IDA Board of Directors, adopted at Session 022-05 of 03 de mayo de 2005, under which parcel 000-14 of Block 145 of the Proyecto de Titulación Coto Brus was titled to Mr. Nombre112494, was based on the Reglamento para la Titulación de Tierras en Reservas Nacionales approved by the Board of Directors of the Instituto de Desarrollo Agrario, Decreto Ejecutivo No. 28746-MINAE-MAG, published in La Gaceta número 173 del diez de setiembre del dos mil dos. Because that regulation was declared unconstitutional with declaratory and retroactive effect as of the effective date of the annulled provisions, namely 12 de agosto de 2002, Article 56 of the resolution of the IDA Board of Directors adopted at Session 022-05 of 03 de mayo de 2005 became legally ineffective under Article 88 of the Ley de la Jurisdicción Constitucional.
This provides an additional basis for declaring its absolute nullity and, by connection, the nullity of all subsequent acts and contracts. Regarding Mr. Nombre112494’s arguments, he essentially asserted that he acted in good faith and that, if errors or omissions occurred during the administrative processing, responsibility for them lay with INDER, and that submission of a soil study was not a requirement when his titling application was processed. In response, although the INDER Board of Directors failed to consider the warning issued by the Oficina de Atención al Usuario del Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía in Certificate No. SINAC-DS-OFAU-C-5103 dated 01 de diciembre del 2003—that the property to be titled partially constituted the State’s natural heritage and, pursuant to Articles 13, 14, and 15 of Ley Forestal 7575 del 16 de abril de 1996, could not be awarded—that omission does not justify the claimant’s assertion of a vested right (derecho adquirido) in the awarded property.
A right cannot be acquired contrary to the legal system, particularly where the disregarded provision states that property classified as the State’s natural heritage is not subject to limitation, is immune from attachment, and is inalienable; in other words, as public-domain property, it is outside private commerce. Accordingly, any administrative act providing for its private titling is absolutely null and void by operation of law. Indeed, classifying land as the State’s natural heritage has, as a logical legal consequence, its dedication to the public domain (afectación como bien de dominio público), such that, from the time it was so classified, the land became subject to a special legal regime different from the one applicable before that event. It is precisely this circumstance—namely, that the land currently forms part of the State’s natural heritage—that prevents the Instituto de Desarrollo Rural, ---now INDER---, from granting title to private parties, given the inalienability characteristic of public-domain property.
(In this regard, see judgments issued by the Sala Primera de la Corte Suprema de Justicia, Nos. 1070-F-S1-2010, 1088-F-S1-2011, and 1675-F-51-2012, as well as judgments of the Sala Constitucional Nos. 17659-2008, 21258-2010, and 16938-2011, among others.) Consequently, private parties cannot exercise any form of possession or ownership over such property. It further follows that acquiring ownership through adverse possession or acquisitive prescription (usucapión o prescripción positiva) is likewise not legally possible, even if they had occupied such lands for more than ten years. As a corollary to the foregoing, the action seeking a declaration of injury to the public interest (demanda de lesividad) is granted, and it is therefore ordered:
Counsel for Mr. Nombre112494 raised the objections of expiration (caducidad), statute of limitations (prescripción), and what counsel termed sine actione agit. The Chamber has already addressed the first two, and therefore, as it is unnecessary, we will not discuss them in this section. With respect to the improperly named “sine actione agit,” the claimant’s representative shall abide by what the First Chamber states in its voto 317-2008: “Regarding the generic expression ‘sine actione agit,’ in light of the principles established by procedural-law scholarship, it does not currently constitute any defense whatsoever. It originated and was grounded in Roman law, chiefly during the second period of the formulary system, when a claimant could bring a defendant to trial only if the Praetor granted the formula-action. It referred to the absence of that ‘formula’ for appearing before the Praetor.
This archaic system of access to justice has been superseded. Therefore, for both historical and constitutional reasons, it may not be raised and is unacceptable. Moreover, that expression does not encompass the defenses of lack of a legal right, interest, and standing, as has been asserted. The defense of ‘sine actione agit’ had its own specific purpose; it was never used to challenge substantive law, whereas the three aforementioned objections do so. What it challenged, it bears repeating, was the valid establishment of the procedural relationship.” As may be inferred from the foregoing, this “doctrine,” improperly incorporated into our procedural system as a generic objection encompassing the objections of lack of a legal right, interest, and standing, has no effect capable of defeating the substantive right; rather—as the Chamber explains—it concerned the procedural form that had to be used in ancient times to establish and declare the relief sought, and is not even necessary today. Accordingly, it is deemed denied.
Article 193 of the Código Procesal Contencioso Administrativo provides that litigation costs and attorneys’ fees (costas procesales y personales) shall be imposed on the losing party solely by virtue of having lost. Exemption from such an award is permissible only when, in the Tribunal’s judgment, there was sufficient cause to litigate or when judgment is rendered on the basis of evidence unknown to the opposing party. In this case, the respondent was the losing party; however, in view of the factual circumstances, it is clear that there was more than sufficient cause to litigate, and therefore judgment is rendered without a specific award of costs.
POR TANTO:
The objections of expiration, statute of limitations, and sine actione agit are denied. The action seeking annulment of an injurious administrative act (demanda de lesividad) brought by the Instituto de Desarrollo Rural against Mr. Nombre112494 is granted, and consequently:

Proceso de lesividad establecido por el Instituto de Desarrollo Rural, en adelante el INDER cédula jurídica CED3194, representado por los licenciados Rodrigo Cervantes Barrantes carne CED12889 y Erick Jiménez Trejos carné CED9416, como apoderados especiales judiciales contra el señor Nombre112494 , quien es mayor, casado, Licenciado en Enfermería, cédula de identidad número CED89040, vecino de Puntarenas, representado por el Licenciado Filadelfo Silva Silva, carné CED23087. Interviene el Sistema de Áreas de Conservación (SINAC) como tercer interesado, representado por la Licenciada Maureen Solís Retana carné CED23087 y el Estado como coadyuvante activo representado por la Licenciada Susana Fallas Cubero carne CED7620.
RESULTANDO:
I.En fecha 20 de agosto de 2013, la representación del INDER formuló la demanda para que en sentencia se acojan las pretensiones que fueron ratificadas en la audiencia preliminar de la siguiente manera: "1. Que se tenga por interpuesta la presente demanda. 2. Que en razón de ser lesivos a los intereses públicos se anule el acuerdo tomado por la Junta Directiva del Instituto de Desarrollo Agrario, en el artículo 56, de la sesión 022-05, de fecha 3 de mayo del 2005, únicamente en lo que se refiere a la titulación de la finca Partido de Puntarenas, folio real No. 146022-000 a favor de Nombre112494 , de calidades indicadas, correspondiente al plano catastrado P-0869458-2003 3. Por conexidad, que se anule la escritura pública emitida por el Instituto de Desarrollo Agrario, únicamente en lo que se refiere a la titulación de la finca Partido de PUNTARENAS, folio real No. 146022-000, a favor de Nombre112494 de calidades indicadas, correspondiente al plano catastrado P-0869458-2003. 4.
Por conexidad, que se anule el asiento registral de inscripción de la finca inscrita bajo sistema de Folio Real Partido de Puntarenas, folio real No. 146022-000 emitido por el Registro Nacional. 5. Por conexidad, se anule cualquier inscripción que depare de la inscripción del inmueble inscritos en el Registro Nacional, Provincia de Puntarenas Folio Real matrícula número Placa20342. 6. Que se condene al demandado al pago de ambas costas de este juicio." (Ver expediente judicial en versión digital).
Redacta el Juez Salas Leitón;
CONSIDERANDO:
La representación del INDER accionó solicitando que en sentencia se declare la nulidad del acuerdo tomado por su Junta Directiva en el artículo 56, de la sesión 022-05, de fecha 3 de mayo del 2005, en lo que se refiere a la titulación de la parcela 145-000-14 a favor del señor Nombre112494 , y que dio paso de la finca Partido de Puntarenas, folio real No. 146022-000, por considerar que de manera contraria la ley se adjudicó y tituló terreno que forma parte del Patrimonio Natural del Estado, y que a raíz de ello se anulen los actos conexos tales como la escritura mediante la que se materializó la titulación del bien a favor del señor Nombre112494 y la inscripción registral. Al respecto indicó: A) Sobre los programas de titulación: Que la existencia de grandes extensiones del territorio nacional donde los campesinos carecían de título de propiedad lo que les impedía accesar a préstamos, hizo que el Instituto de Desarrollo Agrario -IDA-, antes Instituto de Tierras y Colonización -ITCO-, hoy Instituto de Desarrollo Rural -INDER-, impulsara una serie de Programas de Titulación en Reservas Nacionales, con fundamento en lo dispuesto en la "Ley de Titulación de Tierras ubicadas en Reservas Nacionales" No. 7599 del 9 de agosto de 1996; la "Ley de Tierras y Colonización" No. 2825 del 14 de octubre de 1961, artículos 11 y 12 y la "Ley de Creación del Instituto de Desarrollo Agrario" No 6735 artículo 32 inciso a).
Que la labor del IDA dentro de esos programas se orientó a declarar zonas de titulación en áreas donde las personas se encontraban en posesión de la tierra, pero carecían de título de propiedad, procediéndose a realizar el levantamiento y catastro de las fincas que no se encontraban inscritas en el Registro Público y a inscribir el título respectivo, debiendo pagar los beneficiarios los costos por la titulación y agrimensura, dichos costos fueron muy inferiores al promedio del mercado para titular tierras, y debían ser cancelados al IDA como máximo a un año plazo. Que dentro de esos Programas de Titulación, se encontró el denominado: "Programa de Titulación Coto Brus" creado mediante el Decreto Ejecutivo No. 3216-G del 2 de octubre de 1973, publicado en el Diario Oficial La Gaceta del 9 de noviembre de 1973, y se inscribió en el Registro Nacional a nombre del IDA un área de 157.308 has, con el Folio Real Matrícula número Placa20344, con el objeto de cumplir con los respectivos proyectos de titulación (artículo 7 del Reglamento para la Titulación de Tierras en Reservas Nacionales).
Reiteró la representación del INDER, que los traspasos de las áreas a titular se justificaron en la tenencia de las fincas sin inscribir por parte de poseedores (artículos 2 y 4 del Reglamento para la titulación) pero que se trató de una ficción legal, mediante la cual se le traspasó al IDA una extensa área geográfica que abarcaba en forma indistinta terrenos inscritos, sin inscribir, propiedad del Estado y de particulares, con poseedores o sin estos, de ahí que los traspasos se hacían sin perjuicio de los derechos ya inscritos sobre porciones determinadas dentro del perímetro general de la zona respectiva, ni de los derechos de información posesoria en trámite en el momento de publicarse en la Gaceta el Decreto al que se refiere el artículo 7 del "Reglamento para la Titulación de Tierras en Reservas Nacionales", o los que se inscribirían en el futuro, ni de las porciones destinadas al uso público.
Que esos traspasos tenían por objetivo darle al IDA, un instrumento para que pudiera segregarlos y traspasarlos, también bajo una ficción legal, y así inscribir predios a favor de los poseedores que hubiesen poseído esos terrenos bajo las condiciones que establecía el ordenamiento jurídico con la finalidad de facilitar la obtención de crédito (artículo 10 del Reglamento para la Titulación de Tierras en Reservas Nacionales). Que se consideró que la causa de adquisición de esos terrenos era la posesión ejercida por los poseedores y no los traspasos o ventas hechas por el IDA, ya que el Instituto lo único que recibía a cambio era el costo de la confección de los planos correspondientes y no el precio en sí de los predios, en tal sentido, no se daba un acuerdo entre cosa y precio, y el Instituto no podía traspasar los terrenos al mejor oferente, sino que tenía que traspasarlos al poseedor que le demostrara haber cumplido con los requisitos legales, limitándose a constatar esos requisitos (artículo 10 del Reglamento para la Titulación de Tierras en Reservas Nacionales).
Que la Sala Constitucional mediante la resolución 04587-97 de las 15:45 horas del 05 de agosto de 1997 al referirse a la información posesoria en lo que interesa indicó: "se distingue el momento de adquisición de la propiedad por usucapión del momento que esa situación se hace valer en el procedimiento de información posesoria para obtener un título inscribible en el Registro Público. De ahí que se considere la usucapión como un modo de adquisición de la propiedad y de otros derechos reales posibles, y a la titulación como el procedimiento por medio del cual, comprobados los requisitos de la usucapión se confiere el título de propiedad inscribible". Que analógicamente, esta distinción que hace la Sala es válida también en los procesos de titulación realizados por el IDA, por lo que la naturaleza jurídica de los actos en los proyectos de titulación realizados por el IDA eran meramente declarativos, se limitaban a reconocer el derecho de propiedad adquirido por una persona por medio de la figura de la usucapión, para su inscripción en el Registro Público y no actos constitutivos del derecho de propiedad.
Que en el caso de la parcela inscrita a nombre del señor Nombre112494 , consta en el expediente que se aportó como prueba, haber poseído los terrenos, lo cual evidenció la preexistencia de la tenencia posesoria de las parcela con anterioridad al acuerdo de Junta Directiva de su traspaso (tomado en artículo 56 de la Sesión Ordinaria No. 022-05 celebrada el 3 de mayo del 2005). B) Argumentos de fondo que fundamentan el proceso de lesividad: Que en el proceso de titulación de la parcela 145-000-14 a favor de Nombre112494 , del "Proyecto Coto Brus", autorizado por la Junta Junta Directiva del Instituto de Desarrollo Agrario, en el artículo 56, de la sesión 022-05, de fecha 3 de mayo del 2005, y que dio origen a la inscripción en el Registro Público de la finca Partido de Puntarenas, folio real No. Placa20342 correspondiente al plano catastrado Placa20345; se incumplió con los requisitos normativos previstos en la "Ley de Titulación de Tierras en Reservas Nacionales" No. 7599 del 29 de abril de 1996; el "Reglamento para la Titulación de Tierras en Reservas Nacionales" publicado en la Gaceta 173 del 10 de septiembre del 2002, en concordancia con la "Ley Forestal" No. 7575 del 5 de febrero de 1996 y el "Reglamento a la Ley de Uso de Suelos" No. 29375-MAG-MINAE-S-HACIENDA-MOPT, lo cual generó vicios de nulidad absoluta en el acto administrativo, por afectación al interés público, por constituir el inmueble parte del Patrimonio Natural del Estado, situación que se debe revertir anulando dicho acto, con fundamento en lo siguiente: 1) Que un primer vicio se da por incumplimiento de lo dispuesto en el artículo 10 del "Reglamento para la Titulación de Tierras en Reservas Nacionales", el cual establece que se titularían las tierras que no estuviesen bajo la administración del MINAET, ello en cumplimiento de lo dispuesto en el artículo 32 de la "Ley Orgánica del Ambiente" y 13 de la "Ley Forestal" que señalan que las áreas silvestres protegidas y el Patrimonio Natural del Estado, son administradas por el MINAE.
Que por ello el inciso b) del artículo 10 del "Reglamento para la Titulación de Tierras en Reservas Nacionales", exigía del solicitante presentar una "certificación original extendida por el MINAE en donde conste que el terreno a titular según plano catastrado no está afectado o inmerso dentro de áreas de conservación, Patrimonio Natural del Estado", lo cual era un requisito esencial e infranqueable para la validez del trámite ante el IDA, y su posterior titulación; sin embargo a folio 46 del expediente de titulación consta la certificación emitida por el Ministerio del Ambiente y Energía, Sistema Nacional de Áreas de Conservación, Oficina de Atención al Usuario, No. SINAC-DS-OFAU-C-5103 del 01 de diciembre del 2003, según la cual el inmueble mencionado constituye parcialmente patrimonio natural del Estado según artículos 13, 14 y 15 de la Ley Forestal 7575 del 16 de abril de 1996, y pese a dicha indicación, se recomendó su titulación en evidente violación a lo dispuesto en la indicada normativa, por lo que en este caso se generó un vicio de nulidad absoluta evidente y manifiesta. 2) Que un segundo vicio se dio porque el 21 de marzo de 2001, se aprobó el "Reglamento a la Ley de Uso de Suelos" No. 29375-MAG-MINAE-S- HACIENDA-MOPT, el cual exige en su artículo 58: "En toda información posesoria o que se presente ante el IDA o ante los Tribunales de Justicia, con el fin de inscribir en el Registro Público de la Propiedad, el interesado, además de los requisitos que exige la normativa común, deberá de demostrar, con un estudio adecuado de suelos, que ha ejercido la posesión cumpliendo con el uso conforme de suelo para la actividad que realiza de acuerdo con la metodología aprobada y ejecutándolas con las mejores prácticas de manejo, según la mejor tecnología disponible en cumplimiento de lo dispuesto en los artículos 3,6, 12, 13,19,26,2741,43 y 64 de la ley 7779 y su reglamento" Que en dicho artículo se exige que en toda información posesoria que se presente ante el IDA, el titulante deberá aportar obligatoriamente un estudio en el que se demuestre un uso adecuado de suelos en los que ha ejercido la posesión; normativa que entró en vigencia con anterioridad a la titulación de la parcela 145-000-14 a favor del señor Nombre112494 , de ahí que el estudio era obligatorio; sin embargo no se aportó, por lo que su incumplimiento generó un vicio de nulidad absoluta.
Que así las cosas, si bien a la Junta Directiva del IDA se le recomendó autorizar el traspaso de la parcela a nombre del señor Nombre112494 , bajo el supuesto de que se verificó el cumplimiento de los requisitos establecidos por el "Reglamento para la Titulación de Tierras en Reservas Nacionales", siendo éste el motivo de los actos administrativos; lo cierto es que de la documentación que se aportó como prueba, se constató que el IDA incurrió en una serie de incumplimientos dentro del procedimiento de titulación de ese predio, que produjo la nulidad del acto administrativo de traspaso. Que así las cosas, la causal de nulidad de la titulación de la parcela reside en el incumplimiento de requisitos establecidos en la Ley y en el Reglamento para el dictado del acto administrativo, y por otro lado en la inobservancia de normas prohibitivas. C) Fundamento de derecho: a. Incumplimiento de requisitos para el dictado del acto como causal de nulidad absoluta: Que el artículo 158 de la Ley General de la Administración Pública, dispone que la falta o defecto de algún requisito del acto administrativo expresa o implícitamente exigido por el ordenamiento jurídico constituirá un vicio de éste, artículo que en relación con el 166 de la misma ley que establece que habrá nulidad absoluta del acto cuando falte totalmente uno o varios elementos constitutivos real o jurídicamente, y el artículo 167 que dispone que habrá nulidad relativa del acto cuando sea imperfecto uno de sus elementos constitutivos, salvo que la imperfección impida la realización del fin en cuyo caso la nulidad será absoluta.
Que todos estos artículos relacionados permiten concluir que la falta de requisitos esenciales para la titulación de la parcela de referencia, produce la nulidad absoluta de dicho acto administrativo. Que por su parte, el artículo 133 de la Ley General de la Administración Pública, al referirse al motivo como elemento de validez del acto administrativo dispone que éste tiene que ser legítimo y existir tal y como ha sido tomado en cuenta para dictar el acto. Que en el caso de las titulaciones de tierras en reservas nacionales, el motivo se encontraba regulado, por lo que el incumplimiento de los requisitos establecidos en la ley o el reglamento respectivo como sucedió en el caso que nos ocupa, constituyen en sí vicios de nulidad del acto por no existir tal y como había sido tomado en cuenta para su dictado. b. Incumplimiento de normas prohibitivas como causal de nulidad absoluta: El artículo 129 de la Constitución Política, establece que los actos y convenios contra las leyes prohibitivas serán nulos, si las mismas leyes no disponen otra cosa.
Que los artículos 13,14, 15, 33 y 34 de la "Ley Forestal", corresponden a normas prohibitivas, y que por tanto el acto administrativo que autorizó el traspaso de la parcela a favor del demandado es contrario a tales normas, toda vez que mediante dicho acto se autorizó la titulación de terrenos que forman parte del "Patrimonio Natural del Estado", lo cual contraviene sin lugar a dudas, el artículo 13 de la Ley Forestal, que declara que el Patrimonio Natural del Estado a los terrenos forestales y bosques en reservas nacionales y los somete a la administración del MINAE. Que por su parte, el artículo 14 de esta misma ley establece que tales bienes inmuebles son inembargables e inalienables de ese patrimonio natural. Que la posesión de éstos por los particulares no les genera derecho alguno y no se pueden inscribir por información posesoria, siendo imprescriptible la acción reivindicatoria del Estado.
Que el artículo 15 también de esa ley, se refiere a los impedimentos de la Administración Pública de traspasar, entregar o dar en arrendamiento inmuebles rurales de su propiedad o bajo su administración, sin que antes hayan sido clasificados por el MINAE, y que finalmente los artículos 33 y 34 de la Ley Forestal que declaran áreas de protección, siendo la consecuencia de la contravención de los artículos relacionados, la nulidad absoluta. D) AFECTACIÓN AL INTERÉS PÚBLICO: Que teniendo claridad en los argumentos que fundamentan la causal de nulidad de los actos administrativos que autorizaron el traspaso de la parcela tantas veces mencionada a favor del demandado, es importante analizar el cómo dicha causal de nulidad afecta el interés público. Que la nulidad del acto administrativo (debido al incumplimiento de requisitos esenciales y por ser contrario a normas prohibitivas), por el que se produjo la titulación del inmueble que se discute aquí, lesiona el interés público toda vez que a través de dicho acto nulo de forma absoluta, se titulan terrenos que forman parte del Patrimonio Natural del Estado.
Que según el artículo 28 de la Constitución Política, las acciones privadas que no dañen la moral o el orden público, o que no perjudiquen a tercero, están fuera de la acción de la ley. Que la titulación del Patrimonio Natural del Estado, daña el orden público, al impedir el disfrute del derecho que tiene toda persona a un ambiente sano y ecológicamente equilibrado, en los términos del artículo 50 de la Constitución Política, la cual es a su vez una norma de orden público. Que a lo anterior debe adicionarse, que el derecho a un ambiente sano y ecológicamente equilibrado es un derecho fundamental de tercera generación, que surge con la Declaración Universal de los Derechos Humanos en 1948 y por su parte, la Declaración de Lisboa de 1988 emitida dentro del marco de la "Conferencia Internacional sobre garantías del Derecho Humano al Ambiente", exhortó a reconocer el derecho que tiene una persona a vivir en un ambiente sano y ecológicamente equilibrado, y a la vez sugirió a los estados crear mecanismos jurídicos que hagan posible que cada individuo pueda ejercer y exigir sin impedimentos, el derecho a habitar en un medio ambiente saludable para el desarrollo de su vida.
SIN EMBARGO CONSTITUYE PARCIALMENTE PATRIMONIO NATURAL DEL ESTADO SEGÚN ARTÍCULOS 13, 14 Y 15 DE LA LEY FORESTAL Placa12929 16 DE ABRIL DE 1996."; sin indicar el porcentaje de Patrimonio Natural del Estado que ocupa la finca. Que tampoco consta en el expediente, que el demandado presentara el estudio de uso conforme de suelo del INTA, o bien de algún profesional privado debidamente acreditado para realizar dicho estudio, ni que se haya presentado informe alguno del Instituto Geográfico Nacional. Que a pesar de que en el proceso de titulación de la finca no se cumplió con los requisitos que fundamentara su inscripción; la Junta Directiva del IDA por acuerdo tomado en artículo 56 de la Sesión Ordinaria No 022-05 celebrada el 3 de mayo del 2005, autorizó la segregación y traspaso de la parcela lo que se materializó en escritura pública. Que en el Informe No DFOE-PGAA-20-2008 del 27 de agosto del 2008, denominado "Resultado de estudios de titulación de tierras en reservas nacionales en terrenos pertenecientes al Patrimonio Natural del Estado" la Contraloría General de la República le indicó que dicho al INDER que el estudio permitió determinar que en el marco de contenido de los diferentes proyectos de titulación y en contravención a lo señalado en los artículos 13, 14,15 y 33 de la Ley Forestal No. 7575 del 5 de febrero de 1996 el IDA tituló propiedades con cobertura parcial o totalmente boscosa o que poseían características de uso suelo y topográficas que les otorgaban la categoría de terrenos de aptitud forestal y de áreas de protección, y por lo tanto, no podían salir de la Administración del Estado, ni ser susceptibles de titular a favor de los solicitantes por ser parte del Patrimonio Natural, y por no concurrir, ni haberse aportado todos y cada uno los requisitos necesarios para proceder de conformidad con el bloque de legalidad vigente en aquel momento para que fuera procedente la titulación de tratamiento, ordenándole al IDA lo siguiente: "a.
Realizar los procedimientos administrativos y las acciones que en derecho procedan ante las instancias correspondientes, a efecto de que se inicie un proceso de recuperación de las tierras tituladas por el IDA que pertenecen al Patrimonio Natural del Estado y que corresponden a los 15 casos que se detallan en este documento. b. Ordenar que se realice un análisis completo a las titulaciones efectuadas por el IDA, que no formaron parte de la muestra analizada por esta Contraloría General en este estudio, con el fin de determinar aquellos casos de titulaciones en terrenos propiedad del Patrimonio Natural del Estado y, de proceder, se realicen los procedimientos para recuperar las tierras." Que en razón de lo ordenado por el órgano contralor, por acuerdo tomado por la Junta Directiva del INDER en artículo 5 Sesión Ordinaria 011-2013 del 18 de marzo del 2013, se declaró lesivo a los intereses públicos el acto administrativo dictado mediante el acuerdo número 56 de la Sesión Ordinaria número 022-05 celebrada el 3 de mayo de 2004 de la Junta Directiva de esta Institución, que dio origen al título de propiedad inscrito en el Registro de la Propiedad, Partido de Puntarenas, matrícula de folio real número Placa20342 a favor de Nombre112494 , por haber sido otorgado en detrimento del patrimonio natural del Estado.
Por su parte la representación del señor Nombre112494 indicó: Que habiendo presentado la documentación requerida, con todos los requisitos que le solicitó la Institución y siendo que nunca se le previno de supuestos defectos; fue beneficiado en uno de los programas impulsados en aquel momento por el INDER y de manera legal y transparente y amparado al marco fáctico legal del momento y que a la fecha se encuentra vigente, se inscribió la tierra a su nombre con anuencia y con pleno conocimiento de los representantes del INDER. Que si se dieron anomalías en la inscripción del inmueble no fue de su culpa y que de haberse dado inconsistencias, ello es resorte exclusivo de los personeros de la actora, por lo que no se le debe endilgar falta alguna y se le debe respetar dicha inscripción. Que el IDA en su momento tenía la obligación haberle prevenido de este supuesto error si es que fue un error, toda vez que en el tiempo de inscripción del inmueble en litigio esos requisitos no eran exigidos por lo que no se le puede aplicar una norma actual retroactivamente en su perjuicio y que de ser cierto lo señalado por la actora, fue negligencia de sus funcionarios de haber dejado pasar ese supuesto error y en el momento procesal oportuno, en el que se le debió haber prevenido de alguna situación anómala por lo cual no es su responsabilidad y fue un error de la administración por lo que no se le puede culpar de esa situación.
Que todo fue una falla de los personeros de la parte actora. Que la inscripción es resorte exclusivo de la Administración actora ya que esa falta de cuidado obedece posiblemente a la impericia de sus funcionarios del momento de no haber tenido ese cuidado y haberle hecho conocer en el momento, y no es sino muchos años después de haberle inscrito el inmueble se le quiere despojar del mismo lo que es completamente ilegal y no es su responsabilidad la negligencia e impericia de la administración. Que el proceso llevado ante la Contraloría General de la República referente a este tema, no concluyó a pesar de que le hizo frente al mismo y el ente contralor dispuso archivar dicho procedimiento administrativo. Que creyendo que ya había finalizado ese problema, sorpresivamente recibió esta demanda en su contra lo cual es injusto y antijurídico, la cual se encuentra prescrita y caduca. Que la argumentación que alega la actora es espuria en cuanto alega que supuestamente incumplió con requisitos lo que nos es cierto, y si hubo un error, este es exclusivamente de la actora.
Que se demostró hasta la saciedad la posesión por más de 50 años que la ejerció su antecesor en forma pública, pacífica sin interrupción a título de dueño y de buena fe y la adquirió del poseedor anterior por medio de documento público y a la fecha la ha ejercido durante más de 32 años en las condiciones anteriormente apuntadas y en ningún momento dicha posesión se ha ejercido en terrenos demaniales o del Estado lo cual se evidencia y acredita con la documentación que aportó. Que la Sala Constitucional en la resolución que citó la parte actora ya le dio la razón, en que la causa de a adquisición fue por usucapión, lo cual no es ajeno al este caso, sumado los años de posesión de sus antecesores, más la ejercida por él, suman un tiempo de más de 50 años. Que el acto de inscripción no es nulo, porque las normas vigentes alegadas por la parte actora no encuadran dentro del caso que nos ocupa.
Que nunca incumplió requisitos para la inscripción del terreno, ya que el IDA en su momento no se las solicitó y nunca fue su culpa, de ese tipo de situaciones. Que el acto de inscripción no es nulo porque no se puede retrotraer en su perjuicio normas vigentes a la usucapión y adquisición por más de 50 años. Que ha sido respetuoso en cuanto a la conservación de la flora y fauna del terreno. La representación estatal como coadyuvante activo indicó: A) NULIDAD DEL REGLAMENTO PARA LA TITULACIÓN DE TIERRAS EN RESERVAS NACIONALES: Que la Junta Directiva del INDER tomó el acuerdo No. 56 de la sesión ordinaria No. 022-05 respecto al expediente No. 18 relativo a la parcela 14 bloque 145, cuyo traspaso originó la finca No. 6-146022-000, asociada al plano catastrado No. P-869458-2003 (56 ha 3197.90 m2), y que proviene de la finca No. 6-18777-000 a nombre del señor Nombre112494 . Que dicho trámite de titulación se realizó con fundamento en el "Reglamento para la Titulación de Tierras en Reservas Nacionales", aprobado mediante acuerdo de la Junta Directiva del Instituto de Desarrollo Agrario y publicado en La Gaceta No. 173 del 10 de setiembre del 2002; sin embargo dicho Reglamento fue anulado por la sentencia No. 2063-2007 de la Sala Constitucional con efectos "retroactivos a la fecha de vigencia de las normas que se anulan, sea el doce de agosto del dos mil dos.
Por lo anterior el acto administrativo dictado mediante el acuerdo número No. 56 de la sesión ordinaria No. 022-05 devino en nulo de manera absoluto, por lo que esa Junta Directiva en su sesión ordinaria de No. 011-2013 del 18 de marzo de 2013, artículo 5, el INDER lo declaró lesivo a los intereses públicos. Que la Sala Primera de la Corte Suprema de Justicia, en los votos números 1070-F-S1-2010 y 1088-F-S1-2011 confirmó el criterio de que la nulidad (y anulación) del Reglamento para la Titulación de Tierras en Reservas Nacionales vició las titulaciones que fueron hechas con sustento en esa norma. Sobre ese punto el Tribunal indicó: "...En este sentido, se tiene que la titulación que en forma ilegítima efectuó la Junta Directiva del IDA, del inmueble en discordia, a favor de la codemandada se sustentó en el Reglamento para la Titulación de Tierras en Reservas Nacionales aprobado por la Junta Directiva del Instituto de Desarrollo Agrario y publicado en La Gaceta número 173 del diez de setiembre del dos mil dos.
Posteriormente mediante Voto No. 02063-07 la Sala Constitucional anuló por inconstitucional dicho reglamento. Por los efectos declarativos y retroactivos que esa declaratoria produce, es evidente que la conducta administrativa que se fundamentó en la norma declarada inconstitucional, deviene nula por conexidad. "Esta Sala es del criterio, que el alcance dado por el Tribunal, a los distintos pronunciamientos constitucionales, es el correcto..." (Voto No. 1070-F-51-2010 considerando VII. El destacado no pertenece al original). "...El voto de la Sala Constitucional fue apreciado de manera correcta por los juzgadores de instancia, ya que en el fallo se consideró, que el acuerdo de la Junta Directiva del IDA, artículo 32, tomado en la sesión 016-04 del 13 de mayo de 2003, fue dictado con fundamento en la normativa que la Sala aludida declaró inconstitucional, siendo este uno de los motivos ponderados en la sentencia, para acoger la demanda en lo relativo a declarar la nulidad del citado acuerdo, y con la consecuente nulidad de los restantes actos y contratos posteriores, que permitieron trasladar el dominio de la finca objeto de este proceso, a nombre de un particular..."(Voto No. 1088-F-S1-2011).
Ese "reglamento", utilizado como fundamento de la "titulación" en favor del demandado, fue anulado precisamente por falta de competencia del Instituto de Desarrollo Agrario para emitirlo y por la inexistencia de presupuestos legales que lo sustentaran: "...por cuanto la Ley que supuestamente sustenta esta reglamentación en modo alguno faculta al Estado a titular las reservas nacionales dentro del proyecto de titulación del Instituto de Desarrollo Agrario...sino únicamente a la promoción de la tenencia de la tierra para fines exclusivamente agrícolas (artículo 1 de la Ley de Tierras y Colonización), mediante los contratos de adjudicación de tierras" (sentencia constitucional No. 2063-2007). Que el artículo 1 del Reglamento anulado indicaba: "El presente instrumento jurídico tiene como finalidad reglamentar lo establecido en la Ley de Tierras y Colonización relativo a la titulación de tierras en las Reservas Nacionales...", sin embargo, la Ley de Tierras y Colonización, No. 2825 de 14 de octubre de 1961, no regula la titulación de tierras, sólo se ocupa de la parcelación en los artículos 49 a 81, y de la colonización en los numerales 82 a 91, razón por la cual, el Instituto de Desarrollo Agrario carecía de competencia para titular en favor del demandado el terreno descrito en el plano catastrado No. P-869458-2003 y ese vicio es suficiente para anular el acto administrativo.
Que la titulación o procedimiento para obtener un título de dominio inscribible, cimentado en el ejercicio de la posesión ad usucapionem, con los requisitos que enumera el Código Civil, es diversa de la parcelación y colonización: ''requisitos de tiempo y condición, caracterizan la posesión necesaria para usucapir. (...) la titulación del bien inmueble tiene como requisito la adquisición de la propiedad. O sea, que se distingue el momento de adquisición de la propiedad por usucapión del momento en que esa situación se hace valer (...) para obtener un título inscribible en el Registro Público. De ahí que se considere la usucapión como un modo de adquisición de la propiedad y de otros derechos reales poseibles, y a la titulación como el procedimiento por medio del cual, comprobados los requisitos de la usucapión, se confiere el título de propiedad inscribible." (Voto No. 4587-1997 de la Sala Constitucional, la negrita no es del original).
Que la parcelación y la colonización son, en cambio, modos contractuales, derivativos, de adquirir la propiedad del ente público agrario, que se asientan en otros presupuestos. E inclusive la colonización puede tener regímenes de tenencia de la tierra distintos de la propiedad, como el arrendamiento, con opción de compra o sin ella, aparcería o usufructo (artículo 83 y numerales 49 a 91 de la Ley No. 2825). La adjudicación es consustancial a los contratos de parcelación o asignación de tierras, y de colonización (Ley No. 2825, artículos 49 inciso e), 55, 60, 64, 65, 68 inciso 4) y 69; Sala Primera de la Corte Suprema de Justicia, votos números 229-F-90 de 15 horas del 20 de julio de 1990, reiterado en muchas ocasiones y 649-C-2001, considerando V; Tribunal Agrario, votos 555-1993, 119-1995, 105-2001, 395-2002 y 542-2002). Ningún artículo de la Ley de Tierras y Colonización autorizaba al Instituto de Desarrollo Agrario a titular, ni mucho menos a emitir un Reglamento para la Titulación de Tierras en Reservas Nacionales.
Que el Reglamento para la Titulación de Tierras en Reservas Nacionales invadió la competencia del Poder Legislativo al crear un procedimiento administrativo especial y sumario para la titulación, excluyente del judicial previsto en la Ley de· Informaciones Posesorias, No. 139 de 14 de julio de 1941, que sólo el legislador podría instituir. Que al reformar las reglas de titulación, autorizándola en terrenos inscritos, a nombre del IDA (artículo 7° del Reglamento y 1 de la Ley de Informaciones Posesorias). Toda la normativa que en el pasado autorizó la titulación administrativa, ante el ITCO o IDA, hoy insubsistente, tuvo rango de ley: Ley de Informaciones Posesorias Administrativas No. 3971 de 11 de octubre de 1967, Ley de Informaciones Posesorias No. 4545 de 20 de marzo de 1970 y Ley de Titulación Múltiple de Tierras No. 5064 de 22 de agosto de 1972. B) TITULACIÓN DEL PATRIMONIO NATURAL DEL ESTADO: Que por otra parte, la certificación No. SINAC-DS-OFAUC-5103-2003 indica que el terreno descrito por el plano catastrado No. P-869458-2003 "CONSTITUYE PARCIALMENTE PATRIMONIO NATURAL DEL ESTADO.
Que en ese plano se describe el inmueble como de montaña en parte y los bosques y terrenos forestales o de aptitud forestal de la finca No. 6-18777-000, inscrita a nombre del Instituto de Desarrollo Agrario, constituyen Patrimonio Natural del Estado según el artículo 13 de la Ley Forestal que indica: "El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las fincas inscritas a su nombre y de las pertenecientes a instituciones autónomas y demás organismos de la Administración Pública." Y que en esa condición no podían ser permutados, cedidos, enajenados de ninguna manera, entregados ni dados en arrendamiento, pues ello lo prohíben los artículos 13, 14 y 15 de esta ley. Que ello fue confirmado por la Sala Primera de la Corte Suprema de Justicia en sus votos No. 1070-F-S1-2010 y 1088-F-S1-2011, referidos a la anulación de titulaciones del IDA sobre terrenos del Patrimonio Natural del Estado.
Indicó al respecto esa Sala: "...VIII- Refiere el IDA, que el Tribunal no valoró que fue el MINAET quien le traspasó los terrenos, en el año 2000; y esta situación los hace entender, que dichos terrenos, no estaban dentro de las categorías que establece la Ley Forestal, como conformación del patrimonio natural del Estado. Al haberse demostrado en esta sede, que el inmueble objeto de este proceso está cubierto de bosque en su mayoría, se concluye que la propia normativa anulada por inconstitucionalidad, impedía el traspaso del terreno a favor del IDA. En igual sentido, la Ley Forestal en el ordinal 14, determina que los terrenos forestales y bosques que constituyen el patrimonio natural de Estado, "...serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley.
"Pese al fundamento apuntado por el IDA, en el sentido de que el MINAET le traspasó los terrenos, lo cual aduce, los indujo a error, esta situación no los exime de su obligación de apeqar su conducta al marco de legalidad vigente, por lo que agravio no es de recibo. En igual sentido, lo indicado respecto a que el Tribunal no consideró que el terreno ha estado en posesión de particulares, no resulta un reclamo atendible ante esta Sala, por ser la Ley Forestal clara, en el sentido de que se trata de bienes inalienables, cuya posesión por particulares no causará derecho alguno a su favor, siendo imprescriptible la acción reinvindicatoria del Estado..."(Sala Primera de la Corte Suprema de Justicia, voto No. 1070-F-S1-2010). Que el artículo 10 del "Reglamento para la Titulación de Tierras en Reservas Nacionales" permitía únicamente el traspaso de tierras "que no estén sujetas a la administración por parte del MINAE y requería "certificación original extendida por el MINAE en donde conste que el terreno a titular según el plano catastrado no está afectado o inmerso dentro del "patrimonio natural del Estado", mientras que, con vista de la certificación No. SINAC-DS-OFAU-C-5103-2003 es claro que no se cumplieron esos requisitos, al indicar que "CONSTITUYE PARCIALMENTE PATRIMONIO NATURAL DEL ESTADO", administrado por el MINAE, según el artículo 13 de la Ley Forestal.
Que la citada certificación constituye plena prueba de conformidad con el artículo 370 del Código Procesal Civil de aplicación supletoria al presente caso por mandato del artículo 220 del Código Procesal Contencioso Administrativo. Que la propiedad pública de los terrenos de bosque, forestales o con esa aptitud, vinculados a la persecución de fines de interés general, es una poderosa arma de conservación: "la propiedad forestal se concibe fundamentalmente para conservar, no para producir, ni ser parte del comercio de los hombres". (Sala Constitucional, voto No. 4587-1997). Que el deber de proteger y preservar la integridad del ambiente (principio de tutela ambiental a cargo del Estado) comprende la riqueza forestal (Sala Constitucional, votos números 2233-1993 y 6836-1993). Que el régimen tutelar contemplado en la Ley Forestal para el Patrimonio Natural del Estado implica que no cabe la corta, el aprovechamiento forestal ni el cambio de uso del suelo; y solo pueden autorizarse labores de investigación, capacitación y ecoturismo (artículos 1; párrafo 2°, 3 inciso a), 14, 15, 18, 58 incisos a) y b) y 61 inciso e).
Que en el informe presentado por Costa Rica a la IV Conferencia de las Partes que suscribieron el Convenio sobre la Diversidad Biológica, se señaló (en 1998) que entre las principales causas de la pérdida de biodiversidad; el avance de la frontera agrícola en sitios no aptos para este tipo de uso y las políticas de incentivos agropecuarios que han conducido a la deforestación. Que la enajenación indebida de terrenos del Patrimonio Natural del Estado modifica el destino que la Ley Forestal ha previsto para esos bienes públicos, en pugna con el artículo 50 constitucional y el artículo 11 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en materia de Derechos Económicos, Sociales y Culturales, "Protocolo de San Salvador", aprobado por Ley No. 7907 de 3 de setiembre de 1999, que garantizan el derecho a un ambiente adecuado; con el principio de la tutela del derecho ambiental a cargo del Estado (entre otros, votos de la Sala Constitucional números 3341-1996 y 9193-2000) y con el artículo 8 del Convenio sobre la Diversidad Biológica (Ley No. 7416 de 30 de junio de 1994), que contempla el deber del Estado de administrar los recursos "importantes para la conservación de la diversidad biológica, ya sea dentro o fuera de las áreas protegidas, para garantizar su conservación" (inciso e).
Finalmente la representación del SINAC como tercero interesado señaló: TITULACIÓN DEL PATRIMONIO NATURAL DEL ESTADO: Que la certificación No. SINAC-DS-OFAU-C-5103-2003 indica que el terreno del plano P-869458-2003 a nombre del IDA en posesión del accionado, describe un inmueble que constituye parcialmente patrimonio natural del Estado, conforme a los artículos 13, 14 y 15 de la Ley Forestal No. 7575 del 16 de abril de 1996. Que el artículo 13 de esa Ley expresamente señala que el Patrimonio Natural del Estado está constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y las pertenecientes a las municipalidades, instituciones autónomas y demás organismos de la Administración Pública y que en tal condición no podrían ser permutados, cedidos, enajenados, de ninguna manera entregados ni dados en arrendamiento, según dicha ley.
Finalmente la representación del SINAC, citó lo señalado por la Sala Primera en su voto 1070-2010, en el que indicó que los terrenos forestales y bosques que constituyen el Patrimonio Natural del Estado, serán inembargables e inalienables y su posesión por parte de particulares no le causa derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. Y que en consecuencia dichos inmuebles no pueden ser inscribibles en el Registro Público de manera privativa. Alegatos que fueron reiterados por todas las partes en la audiencia preliminar.
De relevancia para efectos del presente proceso se tienen los siguientes hechos demostrados:
La representación del señor Nombre112494 opuso la excepción de prescripción y caducidad sin profundizar. Por tratarse de excepciones que tienen la virtud de poner fin al proceso, se deben analizar dichas excepciones de previo. Al respecto debe tener presente el actor, que el objeto del presente proceso es que se declare por parte de este Tribunal la nulidad absoluta del acuerdo tomado por la Junta Directiva del Instituto de Desarrollo Agrario, en el artículo 56, de la sesión 022-05, de fecha 03 de mayo del 2005, en lo que se refiere a la titulación de la finca Partido de Puntarenas, folio real No. 146022-000 a favor del señor Nombre112494 y demás actos conexos. El proceso entonces que conoce el Tribunal lo es de lesividad, bajo el alegato de que parte del terreno que se inscribió constituye parte del Patrimonio Natural del Estado, el cual constituye dominio público y como tal la gestión del Estado para su recuperación resulta imprescriptible.
En este sentido la Sala I indicó: "...En igual sentido, lo indicado respecto a que el Tribunal no consideró que el terreno ha estado en posesión de particulares, no resulta un reclamo atendible ante esta Sala, por ser la Ley Forestal clara, en el sentido de que se trata de bienes inalienables, cuya posesión por particulares no causará derecho alguno a su favor, siendo imprescriptible la acción reinvindicatoria del Estado..."(Sala Primera de la Corte Suprema de Justicia, voto No. 1070-F-S1-2010). Por lo anterior técnicamente resulta inoponible tal excepción, razón por la cual se rechaza. Sobre la caducidad, indicar que conforme al artículo 34 del Código Procesal Contencioso Administrativo, la lesividad referente a la tutela de bienes de dominio público no estará sujeta a plazo. Así las cosas y entratándose de un proceso de lesividad referido a la recuperación del Patrimonio Natural del Estado como bien de dominio público, la lesividad no está entonces sujeta a plazo de caducidad y por ende también dicha excepción no resulta oponible, razón por la cual se rechaza también.
El proceso de lesividad tiene como objeto, que en sentencia se anule el acuerdo tomado por la Junta Directiva del INDER en el artículo 56, de la sesión 022-05, celebrada el 03 de mayo del 2005, en lo que se refiere a la titulación de la finca Partido de Puntarenas, folio real No. Placa20342, por considerar que se hizo sin que el beneficiado cumpliera con los requisitos que le exigía la normativa aplicable, y que a raíz de ello se anulen los actos conexos tales como la escritura mediante la que se materializó la titulación del bien a favor del señor Nombre112494 y la inscripción registral. En cuanto a la nulidad del acto administrativo, esta Sección del Tribunal ha reiterado en sus sentencias, entre otras, la No. 64-2016 de las nueve horas del doce de julio de dos mil dieciséis: "...Conforme con el artículo 158 de la Ley General de la Administración Pública (en adelante LGAP) la falta o defecto de algún requisito del acto administrativo, expresa o implícitamente exigido por el ordenamiento jurídico constituirá un vicio de éste.
Manifestando a continuación, que será inválido el acto administrativo sustancialmente disconforme con el ordenamiento jurídico, precisando que las infracciones insustanciales no invalidarán el acto. Lo que significa que en un acto administrativo se pueden presentar dos tipos de infracciones: sustanciales e insustanciales, siendo las primeras de ellas las que determinan la invalidez del acto, que se manifiesta, dependiendo de la gravedad de la violación cometida, en nulidad relativa o absoluta y, las insustanciales que no producen la invalidez del acto, pero si responsabilidad disciplinaria del servidor agente. En tal sentido, la validez del acto administrativo se verifica con el cumplimiento y presencia en forma perfecta de los elementos que lo constituyen, tanto formales como sustanciales. Estos elementos a que hacemos referencia, la doctrina nacional, como la LGAP, los distingue entre formales y sustanciales.
Entre los elementos formales se encuentran el sujeto, procedimiento y la forma, y en los sustanciales o materiales se tiene el motivo, el contenido y el fin. El primer elemento formal del acto administrativo es el sujeto. Corresponde al autor del acto. Es el funcionario público, órgano o ente administrativo que dicta un acto administrativo, el cual debe a su vez contar con una serie de requisitos, tales como: investidura, competencia y titularidad. La investidura es el nombramiento o la elección de una persona en un cargo o empleo público (en tal sentido artículos 111 y siguientes de la LGAP). Es la potestad para actuar a nombre y por cuenta del Estado y dirigir a éste el efecto de su conducta. Esta puede darse por elección o nombramiento. Se hace efectiva con la toma de posesión del cargo. Nombre28 define a la competencia "como la medida exacta de la cantidad de medios legalmente autorizados en favor del Estado, dentro de un caso concreto para perseguir un fin determinado".
La competencia significa la cantidad de poderes y deberes dispuestos en favor de un determinado ente administrativo. La competencia es el complejo de facultades y poderes atribuido a un determinado órgano administrativo con relación a los demás, pues el fundamento de la competencia radica en la pluralidad de órganos que integran la Administración Pública y la distribución de las distintas funciones entre ellas (artículos 59 y 129 LGAP). Finalmente la titularidad, implica que el funcionario público no sólo debe ser competente, sino además debe ser el titular de la competencia. Por titular se ha entendido aquel que ejerce un cargo, profesión u oficio, por derecho propio o nombramiento definitivo, con la plenitud de requisitos y estabilidad, a diferencia del llamado a ocuparlo provisionalmente. El segundo elemento formal del acto administrativo es el procedimiento. La Administración Pública cuenta con la facultad de emitir actos administrativos en forma unilateral, que incluso pueden llegar a anular o revocar derechos subjetivos de los particulares.
Este poder de auto tutela ha sido limitado por el ordenamiento jurídico. Ese límite lo constituye la obligación de la Administración Pública de seguir un procedimiento para emitir el acto administrativo. El procedimiento administrativo es una serie concatenada de actos procedimentales tendentes a un fin. El procedimiento administrativo tiene por objeto fundamental la averiguación de la verdad real del motivo que va a servir de base al acto administrativo final. El procedimiento se trata del modo de producción de un acto (artículos 214, 216, 224, 225, 308 y 320 LGAP). Ahora bien, en el caso que tal procedimiento tenga por objeto la imposición de una sanción, o de alguna manera un acto de gravamen, sea que imponga una obligación o la pérdida de una condición o derecho, se requiere que el acto de inicio de tal procedimiento sea debidamente comunicado al afectado. Esta comunicación se logra de dos maneras: notificación o publicación.
Se comunican por publicación los actos generales y por notificación los concretos –artículo 240 Ley General de la Administración Pública-, sin embargo, cuando se ignore o esté equivocado el lugar para notificaciones al interesado por culpa de éste, deberá comunicársele el acto por publicación, en cuyo caso la comunicación se tendrá por hecha cinco días después de ésta última (artículo 242 LGAP). La notificación es el modo de comunicar al afectado o destinatario del acto final, de manera directa y personal, el inicio del procedimiento, lo que constituye un requisito fundamental para la seguridad jurídica y el debido proceso sustancial. La notificación es un deber jurídico de la Administración, cuya finalidad es asegurar el verdadero, real e íntegro conocimiento por parte de los afectados del establecimiento de un procedimiento administrativo en su contra y de sus consecuencias. Indudablemente, la debida notificación constituye una manifestación más de los elementos que integran el debido proceso, los que ha definido la Sala Constitucional de la siguiente manera: a) hacer traslado de cargos al afectado, lo cual implica comunicar en forma individualizada, concreta y oportuna los hechos que se imputan; b) permitirle el acceso irrestricto al expediente administrativo, c) concederle un plazo razonable para la preparación de su defensa, d) concederle la audiencia y permitirle aportar toda prueba que considere oportuna para respaldar su defensa; e) fundamentar las resoluciones que pongan fin al procedimiento; f) reconocer su derecho a recurrir contra la resolución sancionatoria” (Voto número 5469-95 de las dieciocho horas tres minutos del cuatro de octubre de mil novecientos noventa y cinco).
Valga señalar que al tenor del artículo 223 LGAP, solo causará la nulidad de lo actuado, la omisión de formalidades sustanciales del procedimiento, entendiendo como tal, la formalidad cuya realización correcta hubiera impedido o cambiado la decisión final en aspectos importantes, o cuya omisión causare indefensión. Se tiene entonces, que los vicios del procedimiento son los causados al inobservarse la debida ritualidad de éste, en tanto con la omisión o ausencia de esa formalidad se impida o cambie la decisión final o que se cause indefensión. El tercer elemento formal del acto administrativo es la forma, que es la manera como se exterioriza o manifiesta el acto administrativo. De conformidad con el artículo 134 de la LGAP, el acto administrativo deberá expresarse por escrito, salvo que su naturaleza o las circunstancias exijan forma diversa (ver 136 LGAP y 146 Constitución Política). Deriva de este elemento formal, la obligación de la Administración de justificar adecuadamente sus decisiones, por medio de la motivación de sus actos, en tanto la motivación significa la explicación, fundamentación o justificación que la Administración brinda en el dictado de un acto administrativo.
Se ha dicho que “Motivar un acto administrativo es reconducir la decisión que en el mismo se contiene a una regla de derecho que autoriza tal decisión o de cuya aplicación surge. Por ello motivar un acto obliga a fijar, en primer término, los hechos de cuya consideración se parte y a incluir tales hechos en el supuesto de una norma jurídica; y, en segundo lugar, a razonar como tal norma jurídica impone la resolución que se adopta en la parte dispositiva del acto.” (Eduardo García de Enterría y Tomás Ramón Fernández; “Curso de Derecho Administrativo”, Tomo I, Editorial Civitas, Madrid, 1997, p. 556). La Sala Constitucional ha manifestado: "En cuanto a la motivación de los actos administrativos se debe entender como la fundamentación que deben dar las autoridades públicas del contenido del acto que emiten, tomando en cuenta los motivos de hecho y de derecho, y el fin que se pretende con la decisión.
En reiterada jurisprudencia, este tribunal ha manifestado que la motivación de los actos administrativos es una exigencia del principio constitucional del debido proceso así como del derecho de defensa e implica una referencia a hechos y fundamentos de derecho, de manera que el administrado conozca los motivos por los cuales ha de ser sancionado o por los cuales se le deniega una gestión que afecta sus intereses o incluso sus derechos subjetivos." (Voto 7924-99). Respecto de los elementos materiales o sustanciales del acto administrativo, tenemos que el motivo (artículo 133 LGAP) es el presupuesto jurídico, el hecho condicionante que da génesis al acto administrativo. De tal manera que el motivo del acto administrativo constituye el supuesto o el hecho condicionante de la emisión de un acto administrativo, en otros términos, constituye la razón de ser del acto administrativo, lo que obliga o permite su emisión.
Puede consistir en un acto o un hecho jurídico previsto por la norma jurídica. En tanto que el contenido del acto, constituye el efecto jurídico o la parte dispositiva del acto, lo que manda, ordena o dispone. Es el cambio que introduce en el mundo jurídico. Es la parte del acto que dispone una sanción, una autorización, permiso, concesión (artículo 132 LGAP). El último de los elementos sustanciales o materiales es el Fin. La Administración Pública tiene un cometido único, la satisfacción del interés público. Esa satisfacción del interés público se logra de diversas maneras, siendo una de ellas a través de la emisión de actos administrativos que actúan las competencias específicas asignadas al órgano u ente administrativo y que le han sido asignadas, precisamente para actuar y satisfacer el interés público incito en la competencia conferida. En principio se entiende que, todo acto administrativo, como resultado concreto de una competencia genérica, tiende a la satisfacción del interés común.
Por ello se afirma, que el fin del acto administrativo en consecuencia será la satisfacción del interés público, que constituye el fin general de todo acto administrativo y a su vez, el fin específico será la satisfacción del interés público que está a cargo de esa competencia (artículo 131 LGAP). Dispone el artículo 166 LGAP: “Habrá nulidad absoluta del acto cuando falten totalmente uno o varios de sus elementos constitutivos, real o jurídicamente.” Advirtiendo, como nos los recuerda Nombre111027 que "la noción de acto administrativo es indudablemente una consecuencia de la sumisión de la Administración Pública a un régimen de derecho" y que el "principio general, tantas veces aludido, de la legalidad de la actuación administrativa se resuelve, a la vista de cada concreto acto administrativo, en una cuestión de pura técnica jurídica, cuyo empleo se hace entonces indispensable para determinar con rigor qué actos administrativos son legalmente válidos y cuáles no...".
De esta forma de acuerdo a la Ley General de la Administración Pública, habrá nulidad absoluta del acto administrativo cuando falte uno o varios de los elementos del acto administrativo, sea, motivo, contenido o fin, circunstancia que habrá de determinarse en cada caso concreto. Ahora, la motivación, técnicamente no constituye uno de los elementos conformadores del acto, sin embargo por tratarse la motivación del acto, de las explicaciones y justificaciones técnico-lógicas del porque la Administración actúa en un determinado sentido, el no motivar de manera debida un acto administrativo, dicha omisión constituye una violación al derecho de defensa del Administrado. En el presente asunto se acusa que el acuerdo que se pide anular padece de un vicio de nulidad absoluta por falta de motivo, situación que se analizará de seguido.
Sin perjuicio de la literalidad de sus argumentaciones, las cuales han sido estudiadas en su totalidad por este Tribunal, se procede al análisis del presente asunto. La representación del INDER planteó el proceso de lesividad solicitando que por ser lesivo al interés público, se anule el acuerdo tomado por la Junta Directiva del Instituto de Desarrollo Agrario, en el artículo 56, de la sesión 022-05, de fecha 3 de mayo del 2005, únicamente en lo que se refiere a la titulación de la parcela No. 000-14 del Bloque 145 del Proyecto de Titulación Coto Brus. Y por conexidad, se anule la escritura pública No. 2 del Tomo No. 8 otorgada ante el Notario Jimmy Meza Lázarus, del 29 de junio de 2005, en la que se formalizó y protocolizó la titulación emitida por el IDA, así como el asiento registral que generó, a saber, la finca del Partido de Puntarenas, folio real No. 146022-000 a nombre del señor Nombre112494 , correspondiente al plano catastrado P-0869458-2003.
Solicitud que presentó con base en lo siguiente: Que a esa Junta se le recomendó autorizar el traspaso y titulación de la parcela 000-14 del bloque 145 del "Proyecto Coto Brus", a favor de Nombre112494 , supuestamente porque éste cumplió con los requisitos que establecía el "Reglamento para la Titulación de Tierras es Reservas Nacionales", y por ello en la sesión ordinaria No. 022-05 celebrada el día 3 de mayo de 2005, en el artículo 56 se autorizó su titulación, dando origen a la finca del Partido de Puntarenas, folio real No. Placa20342 correspondiente al plano catastrado P-0869458-2003; sin embargo acusó que tal cumplimiento no se dio en razón de dos vicios: 1) Que en razón de que el artículo 32 de la Ley Orgánica del Ambiente y el 13 de la Ley Forestal, establecen respectivamente que las Áreas Silvestres Protegidas y el Patrimonio Natural del Estado; los administra el Minae, los solicitantes debían aportar una certificación emitida por el MINAE en la que se indicara que el terreno a titular no se ubicaba dentro de una área silvestre protegida o conformara parte del patrimonio natural del Estado, requisito que era esencial e infranqueable para la validez del trámite, pues el artículo 10.b) del Reglamento para la Titulación de Tierras en Reservas Nacionales, exigía del interesado, presentar una certificación del MINAE en la que se indicara que el terreno a titular según el plano catastrado, no estaba dentro de un área de conservación o formara parte del patrimonio natural del Estado.
Que en el caso presente, se aportó la certificación SINAC-DS-OFAU-C-5103 del 01 de diciembre de 2003, en la que se indicó que la parcela constituye parcialmente patrimonio natural del Estado y no obstante ello, se recomendó su titulación, contraviniendo con ello el artículo 13 de la Ley Forestal y 10.b) del Reglamento para la Titulación de Tierras en Reservas Nacionales, lo que generó un vicio de nulidad absoluta evidente y manifiesta. 2) Que el artículo 58 del Reglamento a la Ley de Uso de Suelos No. 29375-MAG-MINAE-S-HACIENDA-MOPT, del 21 de marzo de 2001; exigía de los gestionantes de una información posesoria ante el IDA; la presentación de un estudio adecuado de suelos, en la que se indicara que el ejercicio de la posesión se había hecho cumpliendo con el uso adecuado de suelos, sin embargo el señor Nombre112494 no lo aportó, lo que generó otro vicio de nulidad absoluta. Que en razón de los vicios indicados, conforme a lo que disponen los artículo 133, 158, 166 y 167, al estar el motivo para la titulación debidamente regulado, al incumplirse con esos requisitos, se generaron vicios de nulidad del acto por no existir entonces el motivo tal y como había sido tomado en cuenta para su dictado y en segundo lugar se violentaron normas prohibitivas pues se tituló patrimonio natural del Estado lo cual es imposible conforme a lo que dispone 13, 14, 15, 33 y 34 de la Ley Forestal, y por ende conforme a lo que señala el artículo 129 constitucional, los actos y convenios contra las leyes prohibitivas; son nulos.
El alegato de la representación del SINAC como tercero interesado indicó que la certificación SINAC-DS-OFAU-C-5103-2003 que el terreno que describe el plano P-869458-000 a nombre del IDA constituye parcialmente patrimonio natural del Estado y conforme al artículo 13 de la Ley Forestal los bosques y terrenos que cnstituyen Patrimonio Natural del Estado, dichos terrenos no pueden ser permutados, cedidos o enajenados de ninguna manera. Por su parte la representación del Estado, como coadyuvante activo también señaló que, según la certificación SINAC-DS-OFAU-C-5103-2003, la parcela titulada constituye Patrimonio Natural del Estado, con lo que se violó el artículo 13, 14, y 15 de la Ley Forestal, lo cual vició de nulidad absoluta el acuerdo de adjudicación, situación que fue reiterada por la Sala Primera en sus votos No. 1070-F-S1-2010 y el 1088-F-S1-2011. Pero además esa representación agregó un argumento, no expuesto, ni por la representación del INDER, ni por la del SINAC, señalando que la titulación que se hizo al señor Nombre112494 , mediante el acuerdo que se pide anular, se hizo con fundamento en el Reglamento para la Titulación de Tierras en Reservas Nacionales aprobado por la Junta Directiva del IDA el día 12 de agosto de 2002 y publicado en la Gaceta No. 173 del 10 de setiembre de 2002, el cual fue anulado por la sentencia de la Sala Constitucional No. 2063-2007, con efectos retroactivos a la fecha de vigencia de la norma que se anulan, sea el 12 de agosto de 2002, por lo que el acuerdo No. 56 de la sesión ordinaria No. 022-05 está viciado de una nulidad sobrevenida.
Que la Sala Primera en sus votos 1070-F-S1-2010 y el 1088-F-S1-2011 confirmó que la nulidad (y anulación) del Reglamento para la Titulación de Tierras en Reservas Nacionales, vició de nulidad las titulaciones que se hicieron con sustento en él. Ello por cuanto la Sala Constitucional lo anuló, porque el IDA hoy INDER, carecía de competencia para emitirlo y porque la Ley que supuestamente sustentó esa reglamentación en modo alguno facultó al Estado a titular reservas nacionales y patrimonio natural del Estado y por ende el IDA en dicho Reglamento invadió competencias del Poder Legislativo, y por ende carecía de competencia para titular la parcela del bloque 145, No. 000-14 del Proyecto de Titulación Coto Brus a nombre del señor Nombre112494 , vicio que es suficiente para anular el acto de adjudicación. El alegato de la representación del señor Nombre112494 fue que adquirió el derecho de posesión sobre el inmueble de su antecesora, quien lo hizo de manera pública, pacífica y en calidad de dueño, por más de 50 años y a la fecha la ha ejercido durante más de 32 años en las mismas condiciones y que en ningún momento dicha posesión se ha ejercido en terrenos demaniales o del Estado, de manera que la causa de la adquisición de la nuda propiedad lo fue por usucapión según lo indicó la Sala Constitucional en el voto que citó la representación estatal.
Que con su solicitud de titulación presentó toda la documentación y requisitos legales exigidos y el IDA no le previno defecto u omisión alguna. Que habiendo presentado todos los requisitos legales y fácticos sin que le previnieran defecto alguno; el INDER le tituló la parcela a su nombre y se procedió con su inscripción. Que era el IDA quien debía verificar con el cumplimiento de los requisitos, y que de haberse dado inconsistencias, omisiones o anomalías, ello fue resorte exclusivo de los personeros del INDER, por lo que no se le debe endilgar falta o culpa alguna y se le debe respetar dicha inscripción. Que no es sino muchos años después de haberse inscrito el inmueble, que se le quiere despojar del mismo, lo que es completamente ilegal ya que no fue su responsabilidad de la negligencia e impericia con que actuó la administración otorgante. Que al momento de la inscripción del inmueble, los requisitos supuestamente omitidos no eran exigidos, por lo que no se le puede aplicar retroactivamente en las exigencias de una norma posterior, en su perjuicio.
Con base en los hechos alegados y la prueba acreditada, esta Cámara es del criterio que el proceso de lesividad se debe acoger en razón de lo que se indica de seguido. La Junta Directiva del INDER, por acuerdo tomado en el artículo 56, de la sesión 022-05, del 3 de mayo del 2005, adjudicó al señor Nombre112494 , la parcela No. 145-000-14 y que dio paso a la inscripción registral de la finca del Partido de Puntarenas, folio real No. 146022-000. Ahora, la representación del INDER acudió en proceso de lesividad solicitando se anule dicho acuerdo bajo el alegato de que se dieron 2 incumplimientos que generaron en él, vicios de nulidad absoluta, a saber, no se consideró por parte del INDER que el Sistema Nacional de Áreas de Conservación en su Certificación No. SINAC-DS-OFAU-C-5103-2003 del 01 de diciembre de 2003, advirtió que en la parcela a titular conforme al plano catastrado No. P-0869458-2003, constituía parcialmente patrimonio natural del Estado, y además que el interesado omitió presentar el estudio de uso de suelos conforme, según lo exigía el artículo 58 del Reglamento a la Ley de Uso de Suelos, No. 29375-MAG-MINAE-S-HACIENDA-MOPT.
Tesis que fue apoyada por la representación del SINAC como tercero interesado y del Estado como coadyuvante activo. Aunado a que la representación estatal alegó también que el decreto que sustentó el acuerdo mediante el que se tituló la parcela fue declarado inconstitucional lo que afectó la validez y eficacia de lo actuado. Efectivamente la Cámara considera que lo actuado se realizó en violación al ordenamiento jurídico, que lo afectó de un vicio de nulidad absoluta evidente y manifiesta en razón de lo siguiente:
La representación del señor Nombre112494 opuso las excepciones de caducidad, prescripción y la que denominó sine actione agit. En cuanto a las dos primera ya la Cámara se refirió por lo que por innecesario nos manifestaremos al respecto en este apartado. Respecto de la mal llamada "sine actione agit", aténgase el representante del actor a lo que dice la Sala Primera en su voto 317-2008: "En torno a la expresión genérica “sine actione agit", a la luz de lo señalado por la doctrina procesalista, en la actualidad, no configura defensa alguna. Tuvo su origen y fundamento en el derecho romano, principalmente en el segundo período del Derecho Formulario, cuando el actor sólo podía llevar a juicio al demandado si el Pretor le otorgaba la fórmula-acción. Hacía referencia a la inexistencia de esa “fórmula” para acudir ante el Pretor. Este sistema arcaico de acceso a la justicia fue superado. Por lo tanto, no sólo por razones históricas, sino también constitucionales, resulta inoponible e inaceptable.
Además, tal expresión no comprende las defensas de falta de derecho, de interés, y de legitimación, como se ha querido establecer. La defensa de “sine actione agit” tuvo una finalidad propia, con ella nunca se atacó el derecho material, lo cual sí hacen las tres indicadas excepciones. Lo que se combatía con ella, se reitera, era la válida constitución de la relación procesal." Como se colige de lo anterior, tal "instituto", mal incorporado en nuestro sistema procesal como una excepción genérica comprensiva de las excepciones de falta de derecho, de interés y de legitimación, no tiene ninguna virtud denegatoria del Derecho de Fondo, sino ---como lo rescata la Sala---, sobre la forma procesal que se debía emplear para constituir y declarar lo reclamado en épocas antiguas y ni siquiera necesario en la actualidad; dado lo cual entiéndase rechazada la misma.
El artículo 193 del Código Procesal Contencioso Administrativo establece que las costas procesales y personales se imponen al vencido por el solo hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o cuando la sentencia se dicte en virtud de pruebas que desconociera la parte contraria. En este caso, la parte accionada resultó vencida, sin embargo en razón del cuadro fáctico es claro que hubo motivo mas que suficiente para litigar, razón por la que se falla sin especial condenatoria en costas.
POR TANTO:
Se rechazan las excepciones de caducidad, prescripción y sine actione agit. Se declara con lugar la demanda de lesividad incoada por el Instituto de Desarrollo Rural contra el señor Nombre112494 , y en consecuencia:
