EL ESTADO, subsidiarily INDER and SINAC, is ordered to PAY Nombre115261, by adding the possession of her predecessors in title (transmitentes), during enforcement of judgment (ejecución de sentencia), the value of the property that, through its fault and UNDER ITS OWN RESPONSIBILITY, it has failed to expropriate since 1978, using every possible means to disregard Executive Decrees N° 8494-A of April 28, 1978, Articles 9, 10, 11, which ordered the EXPROPRIATION of private properties or properties acquired by adverse possession (usucapidas) within Reserva Forestal Golfo Dulce (La Gaceta N° 104 of June 1, 1978); Decree N° 9388-A of November 30, 1978, which amended 8494-A, Article 2, again stipulating the EXPROPRIATION of the aforementioned properties (La Gaceta N° 239 of December 15, 1978); Decree N° 10.088-G-H, which ordered the expropriation of the lands of Osa (Alcance N° 6 to La Gaceta N° 102 of June 1, 1979); and Constitutional Chamber judgment N° 97-256, issued at 11:03 a.m. on May 2, 1977, whereby “the Ministry of Environment and Energy, through the Dirección General Forestal or the Dirección Nacional de Áreas de Conservación, was ordered to comply with Executive Decrees 84-94-A, 9388-A and 10.142 and to initiate expropriation proceedings (diligencias de expropiación) concerning the lands with respect to which IDA recognized him as having been in possession for more than 40 years as of 2005, and which are described as follows: Dirección14232 °, located in Sierpe, canton of Osa, Provincia Puntarenas, bounded as follows: North: Nombre115264 and Jorge Rojas Sanabria; South: Nombre115263 and Horacio Montero Barrantes; East: Manuel Caravaca Guadamuz; and West: Dirección336 and Mateo Montes Cárdenas; measuring 29 hectares and 9,918.31 square meters, according to a cadastral survey plan (plano catastrado) of the Registro Nacional under N° P-1027420-2005, in the name of Nombre115261.

EL ESTADO, INDER and SINAC are ordered to pay Nombre115261, after IDA declared them beneficiaries through adverse possession (beneficiarios usucapientes), recognizing her status as a beneficiary as of 2006 pursuant to Memorial OS0-009-06 of January 9, 2006, by adding the possession of her predecessors in title, for the right to have her deed issued pursuant to the IDA Board of Directors Resolution, Article XXXIX of session N° 44-05, of November 14, 2005, WHICH, at the Oficina Regional de OSA, she was informed would never again be applied, and the documents contained in the case file were returned to her, without even photocopies remaining therein, such conduct being deemed yet another affront by the State Public Administration and IDA. 3. EL ESTADO, INDER and SINAC are to be ordered to pay Nombre115261, after IDA declared him a beneficiary through adverse possession, according to the Institute’s books and records at the Oficina Regional de OSA, with only the issuance of the deed remaining to be completed pursuant to Memorial OS0-009-06 of January 9, 2006, by adding the possession of his predecessors in title, for the right to have his deed issued pursuant to the IDA Board of Directors Resolution, Article XXXIX of session No 44-05, of November 14, 2005, which was learned some time later to have been REPEALED secretly and illegally, without notice to the plaintiff and without IDA treating it as the basis of the administrative proceeding (procedimiento administrativo), through IDA Board of Directors Resolution N° 35 of session 040-2007, of November 10, 2007; in the alternative, I request: That EL ESTADO, INDER and SINAC be ordered to pay Nombre115261, during enforcement of judgment, based on the corresponding appraisal (avalúo), for the property valued at no less than 10 MILLION per hectare (TEN MILLION COLONES PER HECTARE), which was the market price determined when the proceedings in this case began in 2008.

The following facts relevant to these proceedings are deemed duly established:
According to cadastral plan (plano catastrado) P/1027420-2005; Located in Los Planes de Drake, Distrito Sierpe, Cantón Osa, Provincia Puntarenas. Measures 29 Ha…” (folio 173 of the judicial case file [expediente judicial]);
The following facts relevant to these proceedings are deemed unproven: a) That the plaintiff was notified of resolution 35 adopted by the Board of Directors of the IDA at ordinary session number 040-07 of 19 de noviembre del 2007 (there is no evidence in the record); b) That the plaintiff possessed the land, either directly or by adding the alleged possession of the prior occupants to her own, for ten years before 01 de junio de 1978, the date on which the Reserva Forestal Osa was created (this cannot be inferred from the witness testimony given by Nombre115268, Nombre115269, Nombre34677, and Nombre115270, or from the affidavit (declaración jurada) appearing at folios 176 to 177 of the judicial record and images 72 to 73 of the brief filed by INDER on 05 de enero del 2016, available in the pleadings folder of the virtual case file); c) That the Board of Directors of the IDA—now INDER—set aside, through the procedures established for that purpose in the legal system, the resolution contained in Article VI of session number 002-99 held on 06 de enero de 1999, by which it awarded the plaintiff and Nombre115266 the Dirección14234, located within the Reserva Forestal Golfo Dulce (there is no evidence in the record demonstrating this); d) That the plaintiff was in any way prevented from collecting payment for environmental services under the forest-protection category, as authorized by the Board of Directors of INDER in the resolution partially transcribed above (there is no evidence in the record).
In general terms, the plaintiff seeks a declaration that resolution 35 adopted by the Board of Directors of INDER at session 0040-2007 of 10 de noviembre del 2007 is null and void. That resolution set aside resolution 39 of session number 44-05 of 14 de noviembre del 2005, which, allegedly in compliance with the order issued by the Sala Constitucional in judgment number 1997-256 of 02 de mayo de 1997, created a special procedure for granting title to land within the Reserva Golfo Dulce to persons holding title to or possessing such land. In her view, resolution 35: i) Was not served on the plaintiff; and ii) Disregards the adverse-possession rights (derechos de usucapión) recognized in favor of the plaintiff by OSO-009-06 of 09 de enero del 2005 over parcel 23 of INDER’s Asentamiento Osa, located within the Reserva Forestal Golfo Dulce. On that basis, she requests that the plaintiff be issued the corresponding deed to parcel 23, sector 4, of INDER’s Asentamiento Osa.
She also seeks damages from the State and, subsidiarily, from SINAC and INDER, for preventing her from exercising her rights over parcel 23 of the Asentamiento Osa from 1978 until effective payment is made—which she estimates at 2 million colones per year—and for her inability to receive FONAFIFO forestry incentives, in an amount to be determined during enforcement of the judgment. She further seeks to have the three co-defendants held jointly and severally or proportionally liable for subjective emotional distress (daño moral subjetivo), which she claims to have endured for more than 50 years under indescribable conditions at the disputed property while awaiting fair payment for the property she possessed for more than ten years, and which she estimates at 50 million colones. As alternative relief (Pretensión Subsidiaria), she requests that the State and, subsidiarily, SINAC and INDER be ordered to pay the value of the property, estimated at no less than 10 million colones per hectare, which was the market price determined when these proceedings were originally instituted.
In the opening arguments at the trial hearing held on 2 y 5 de abril del 2019 (see the digital recording of that proceeding in the associated-documents folder of the virtual case file), counsel for the State raised the defense of res judicata on the merits, and counsel for INDER renewed that defense, since, in INDER’s case, it had already been denied by oral ruling number 1452-2016-T issued at 14:22 hours on 30 de junio del 2016 by the Case Management Judge at the preliminary hearing held on that same date (see image 2 of the preliminary-hearing minutes file and the digital recording of that proceeding, available in the associated-documents folder of the virtual case file). First, it should be emphasized that, although it is true that the Sala Constitucional de la Corte Suprema de Justicia, in judgment number 2008-14134 issued at 09:04 hours on 24 de setiembre del 2008, denied the amparo proceeding (recurso de amparo) processed under case number 08-008420-0007-CO and filed on 06 de junio del 2008 by the plaintiff, Nombre115261, and others against the then Instituto de Desarrollo Agrario (IDA), in which they challenged the resolution contained in Article 35 adopted by that entity’s Board of Directors at ordinary session number 040-2007 held on 19 de noviembre del 2007, which revoked resolution number 39 adopted by the Board of Directors of the IDA at session 44-05 of 14 de noviembre del 2005 concerning the special titling procedure for the Reserva Forestal Golfo Dulce (folios 1279 to 1297 and 1306 of the judicial record), it is also true that, at the end of that judgment, the Constitutional Court clearly states that “…if the Sala were to undertake to determine whether the protected parties in this matter are or are not beneficiaries of any right over the parcels of that Settlement, and from what date, it is evident that the matter described exceeds the scope of constitutional adjudication and concerns ordinary legality.
Accordingly, because it was not possible to establish that any violation of the protected parties’ fundamental rights had occurred, this action must be denied, although it is noted that this ruling does not prejudge the validity of the challenged administrative acts. Consequently, the protected parties must, if they deem it appropriate, resort to contentious-administrative proceedings (vía contencioso administrativa) to assert their rights…” (folios 1729 to 1735 of the judicial record; emphasis not in the original). In other words, the Sala Constitucional itself states that the contentious-administrative jurisdiction is the proper forum for the petitioners to assert their rights, since its judgment does not prejudge the validity of the resolution contained in Article 35 adopted by that entity’s Board of Directors at ordinary session number 040-2007 held on 19 de noviembre del 2007. This is because it must first be determined whether the petitioners—including the plaintiff in these plenary proceedings (proceso de conocimiento)—are or are not “…beneficiaries of the IDA or whether they have any occupancy or ownership right with respect to any parcel in the Asentamiento Campesino Osa arising from an act issued directly by the Board of Directors or by the Subregional Office of the respondent Institute…,” and therefore whether the challenged resolution—namely, Article 35 of ordinary session number 040-2007 held on 19 de noviembre del 2007—did or did not have the effect of extinguishing or denying individual rights (derechos subjetivos) that the Board of Directors of the IDA or the IDA Subregional Office in Osa may have declared by an administrative act in favor of those who filed that amparo proceeding.
This is precisely what the Case Management Judge found when denying the defense of res judicata on the merits raised by the representative of INDER at the preliminary hearing of 30 de junio del 2016. Furthermore, judgment number 2008-14134, upon which the co-defendants base their res judicata defense, substantially predates ruling number 2014-12825, issued by the Sala Constitucional itself at 15:05 hours on 06 de agosto del 2014, in which it introduced the concept known as “constitutional res judicata on the merits” (cosa juzgada material constitucional) (see image 2 of the preliminary-hearing minutes file and the digital recording of that proceeding, available in the associated-documents folder of the virtual case file). Accordingly, the defense of res judicata on the merits raised by the representatives of the State and INDER is denied.
This Court considers that, in this case, the provisions of Transitory Provision III of the Administrative Judicial Procedure Code (Código Procesal Contencioso Administrativo) and Article 175 of the General Public Administration Law (Ley General de la Administración Pública)—prior to the amendment introduced by Law number 8508—are not applicable; rather, section 39.1.a of the Administrative Judicial Procedure Code applies, for the reasons set forth below: a) Although it is true that the resolution contained in Article 35, unanimously approved by the IDA Board of Directors at ordinary session number 040-2007 held on 19 de noviembre del 2007, became final before the Administrative Judicial Procedure Code entered into force (01 de enero del 2008), it is also true that the plaintiff did not become aware of it until 06 de junio del 2008—because that resolution was not served upon her (recital (considerando) II, subsection a, of this judgment), even though on 02 de febrero del 2006 she had submitted an application for title (solicitud de titulación) concerning Dirección13781, pursuant to the special titling procedure (procedimiento especial de titulación) in the Asentamiento Campesino Osa, located within the Reserva Forestal Golfo Dulce, which, in any event, had already been awarded to her by the INDER Board of Directors on 06 de enero de 1999 (pages 165 to 170 of the court record and images 46 to 59 of INDER’s statement of defense, located in the pleadings folder of the electronic case file)—the date on which she filed the constitutional amparo proceeding (recurso de amparo), processed under expediente 08-008420-0007-CO against IDA, seeking a declaration of absolute nullity (nulidad absoluta) of the resolution adopted by that entity’s Board of Directors, which revoked the resolution that had created the Special Procedure for Titling Lands Located in the Asentamiento Campesino Osa, within the Reserva Forestal Golfo Dulce (pages 1278 to 1307 of the court record); b) Because the plaintiff did not become aware of the challenged resolution (Article 35, unanimously approved by the IDA Board of Directors at ordinary session number 040-2007 on 19 de noviembre del 2007) until 06 de junio del 2008, by which time the Administrative Judicial Procedure Code was already in force, the applicable limitation period (plazo de caducidad) is the one-year period established in section 39 of that Code, rather than the four-year period established in Article 175 of the General Public Administration Law—prior to the amendment introduced by Law number 8508—because, although the challenged act became final before the Administrative Judicial Procedure Code entered into force, IDA did not serve it upon the plaintiff before 01 de enero del 2008; c) Furthermore, it is deemed established that, on 17 de marzo del 2009, the plaintiff filed an incidental motion based on new facts and an expansion of the relief sought (incidente de hechos nuevos y ampliación de pretensiones) in the plenary proceeding (proceso de conocimiento) in which her case was originally processed—that is, expediente 08-000110-0161-CA—requesting that “…Board of Directors Resolution Nº 35 from session 040-2007, held on 10 de noviembre del 2007, be declared null and void, and that Board of Directors Resolution Nº 39 from session 44-05, held on 14 de noviembre del 2005, be declared fully effective…” (pages 1009 to 1013 of the court record).
Consequently, the claim for nullity (pretensión de nulidad) against the resolution contained in Article 35 of ordinary session number 040-2007, held by the IDA Board of Directors on 19 de noviembre del 2007, was brought within the one-year period established in section 39 of the Administrative Judicial Procedure Code, calculated from 06 de junio del 2008, the date on which the plaintiff became aware of that resolution, as analyzed in subsection a) of this recital; d) At this point, it should be emphasized that, although this case file was assigned number 15-006080-1027-CA, this is due to the following: the original complaint was filed on 14 de febrero del 2008 and processed under expediente 08-000110-0161-CA, and its allegations and requested relief were expanded in relation to resolution 35 from ordinary session number 040-2007, held on 19 de noviembre del 2007, through a filing dated 17 de marzo del 2009 (pages 177 to 237 and 1009 to 1013 of the court record).
Subsequently, through an oral ruling issued on 25 de mayo del 2009, the judges who were then hearing the various plenary proceedings involving cases similar to the one now before this Court ordered, among others, the consolidation (acumulación) of expediente 08-000110-0161-CA with expediente 08-000111-161-CA (pages 1034 to 1037 of the court record). However, through a ruling issued at 13:42 on 10 de noviembre del 2014, the Case-Management Judge (Jueza Tramitadora) ordered as follows: “…Thus, the Court concludes that the only possible solution that will allow the matter to proceed and guarantee the full exercise of adversarial proceedings (contradictorio) is to separate it, not according to geography or legal status, but by parcel, in accordance with the attached table. Once this decision becomes final, the case files will be physically separated and the parties will be notified of the assigned folder number, the designated judge, and the date on which the preliminary hearing will resume…” (pages 2040 to 2046 of the court record).
For the foregoing reasons, the proceeding brought by the plaintiff was assigned folder number 15-006080-1027-CA. Nevertheless, it bears repeating that the original complaint was filed on 14 de febrero del 2008 and that the expansion of the allegations and requested relief relating to resolution 35 from ordinary session number 040-2007, held on 19 de noviembre del 2007, was received by this Court on 17 de marzo del 2009. Therefore, as analyzed in the preceding subsections, it was filed within the one-year period established in section 39 of the Administrative Judicial Procedure Code, calculated from 06 de junio del 2008, the date on which the plaintiff became aware of the challenged resolution. e) In light of all the foregoing, the defense of expiration raised by INDER’s representative is denied.- SIXTH.- REGARDING THE LEGALITY OF RESOLUTION 35 OF ORDINARY SESSION 040-2007 AND THE SCOPE OF RESOLUTION 39 OF ORDINARY SESSION 39-2005, BOTH OF THE IDA BOARD OF DIRECTORS, IN THE SPECIFIC CASE.
This Court finds as follows: i) First, it must be noted that Resolution 39, approved by the IDA Board of Directors at ordinary session number 044-05 of 14 November 2005, did not per se entail the granting of a vested right (derecho subjetivo) to those who availed themselves of the special procedure for titling plots in Asentamiento Campesino Osa, registered in the name of IDA under real-property folio registration Placa20756 and located within Reserva Forestal Golfo Dulce (folios 4 to 6, 11 to 13, 18 to 29, 42 to 58, and 353 to 424 of the court record). This is because it was limited to regulating a procedural mechanism for the purpose of “…issuing property titles to those occupants who demonstrate possession for at least ten years prior to 1 June 1978, the date on which Reserva Forestal Golfo Dulce was created by decree…”. For that purpose, the interested party was required to meet a series of requirements, most notably submitting to the IDA Subregional Office in Osa “…legal documents demonstrating ten-year possession exercised prior to 1 June 1978 (…) A sworn statement executed before a Notary Public stating the duration of the applicant’s possession, the first name, surnames, and other particulars of the person from whom the applicant acquired the right, as well as the chain of title (cadena de transmisión) thereto beginning on 1 July 1968…”.
Once the application had been received with all the requirements established in sections two and three of that same resolution, the IDA Subregional Office in Osa, acting jointly with the Directorate of Área de Conservación Osa of MINAE (Ministerio de Ambiente y Energía), was required to conduct an on-site inspection (inspección ocular) of the property for which title was sought, in order, among other things, to: “…a) Verify at the site the occupant’s presence as owner of the land. b) Verify boundaries and establish that there are no overlaps or third-party occupants. c) Describe the nature of the property. d) Prepare the corresponding record, which shall be signed by the aforementioned officials. e) Verify the information investigated against the database, censuses, and documents held by the IDA Subregional Office in Osa…”. Thereafter, the regional representative of MINAE and IDA, through the Osa Subregional Office, would issue the respective recommendation either to grant or deny the requested title; these actions were required to be included in the case file opened for that purpose, which would be forwarded to the Director of the Brunca Region of INDER, whose legal counsel would verify the contents of the file and issue a recommendation on the case.
“…If the examination yields a positive result, the subdivision and conveyance of the property to be titled shall be recommended to the titling division, which shall submit it to the IDA Board of Directors so that the corresponding resolution may be issued…” (folios 117 to 122 of the court record; digital recording of the witness testimony of Nombre115267 during the trial hearing held on 05-04-2019, available in the associated-documents folder of the electronic case file). Consequently, Resolution 39 of ordinary session number 044-05 of 14 November 2005, adopted by the INDER Board of Directors, was limited to regulating a procedure intended to determine, in each specific case, whether the applicant met one of the requirements set forth in Article 8 of Decreto Ejecutivo number 8494-A, which created Reserva Forestal Golfo Dulce as of 1º June 1978—namely, properties subject to ten-year possession predating the establishment of the reserve—and, if so, to subdivide the respective plot or lot from parent property 39334-000, registered in the name of IDA, and grant a property title to the subdivided property.
Therefore, because Resolution 30 of ordinary session number 44-05 of 14 November 2005 did not constitute an act declaring vested rights (acto declarativo de derechos subjetivos), a proceeding for a declaration of harmfulness to the public interest (procedimiento de lesividad) was not required to render it ineffective; ii) At this point, it must be emphasized that the purpose of the special procedure established by the IDA Board of Directors in Resolution 30 of ordinary session number 44-05 of 14 November 2005—the titling of plots in Asentamiento Campesino Osa located within Reserva Forestal Golfo Dulce—was contrary not only to the provisions of Articles 9 and 10 of Decreto Ejecutivo number 8494-A, because in cases involving registered properties, properties subject to ten-year possession predating the creation of the forest reserve, or properties under precarious possession (posesión precaria) for fewer than ten years, steps would be taken to directly purchase or expropriate privately owned land located within the reserve, or to relocate and resettle occupants who had possessed land within it for more or fewer than ten years; but also to Articles 13, 14, and 15 of Ley Forestal (number 7575, in force since 16 April 1996) and Article 3 of Decreto Ejecutivo 8494-A.
Under those provisions, land located within the boundaries of the reserve—such as that of Asentamiento Campesino Osa—not only became automatically incorporated into the State Natural Heritage (Patrimonio Natural del Estado), but this also means that such land is “…not subject to attachment and is inalienable; possession thereof by private parties shall create no rights in their favor, and the State’s action for recovery of such land is not subject to any statute of limitations. Consequently, it may not be registered in the Public Registry through possessory information proceedings (información posesoria), and both its invasion and its occupation shall be punished in accordance with this law…”; iii) In view of the matters set forth in the preceding sections, the IDA Board of Directors did not act unlawfully, through the formal conduct challenged by the plaintiff, when it resolved to “…Revoke Resolution 39 of session 44-05 of 14 November 2005 concerning titling in Reserva Forestal Golfo Dulce…”, because “…the designation as a Forest Reserve of land registered in the name of Instituto de Desarrollo Agrario results in its automatic incorporation into the Natural Heritage, and the Institute is prohibited from granting property titles to private parties…” (folios 641 and 1307 of the court record; images 59 and 114 to 120 of the pleading filed by INDER on 05 January 2016, available in the pleadings folder of the electronic case file).
In this regard, it must be reiterated that granting title to land that has formed part of the State’s National Heritage (Patrimonio Nacional del Estado) since 01 June 1978 is unlawful under Articles 13, 14, and 15 of Ley Forestal (number 7575, in force since 16 April 1996) and Article 3 of Decreto Ejecutivo 8494-A, even though property 39334-000 has been registered in the name of IDA since 21 January 1982 (folios 4 and 5 of the court record) and although Article 5 of Decreto Ejecutivo number 10088-G-H provides that “…The Procuraduría General de la República is authorized to appear before the notary public designated by Instituto de Tierras y Colonización to execute the corresponding deed conveying the expropriated property and, in the same instrument, to convey it to that Institute, which shall use it for the purposes of law number 2825 of 14 October 1961 and its amendments…” (folios 18 and 29 of the court record), as stated in deed number 40 executed before notaries public Eduardo Ching Murillo and Jorge Manuel Solano Chinchilla at 16:00 hours on 12 July 1979 (folios 353 to 424 of the court record), because that land has not been subject to attachment or adverse possession (imprescriptibilidad) and has been inalienable since 01 June 1978; iv) Although, in principle, the plaintiff should have been notified of that resolution because, on 02 February 2006, based on the special land-titling procedure governed by Resolution 39 of ordinary session number 044-05 of 14 November 2005, she filed an application seeking to have title issued in her name—initially, and subsequently both in her favor and in favor of Nombre115266, identity card number CED91109, who was her partner at the time—to plot number 23, sector 4, of IDA’s Asentamiento Campesino Osa, property registered under real-property folio Placa4406 and located within Reserva Forestal Golfo Dulce—which, in any event, had already been awarded to them by the IDA Board of Directors through the resolution contained in Article VI of session number 002-99 of 06 January 1999—(images 48 to 59 and 72 to 73 of the pleading filed by INDER on 05 January 2016, available in the pleadings folder of the electronic case file; folios 165, 166, and 168 to 170 of the court record), it is also true that IDA’s failure to provide notice did not have the effect of denying or extinguishing a vested right belonging to her within the meaning of Article 223 of Ley General de la Administración Pública.
This is because, in the specific case, processing of the special titling procedure was limited solely to receiving the documents specified in sections two and three of Resolution 39 of ordinary session number 044-05 of 14 November 2005, to the extent that the field inspection provided for in section four of that same resolution was not even conducted in this case (see the digital recording of the testimony of Nombre115267 given at the trial hearing held on 05-04-2019, available in the associated-documents folder of the electronic case file; folios 165, 166, 168 to 170, and 641 to 652 of the court record; images 46 to 59 of the pleading filed by INDER on 05 January 2016, available in the pleadings folder of the electronic case file). Likewise, the revocation of the resolution approving the special procedure for titling plots in IDA’s Asentamiento Campesino Osa did not render ineffective the act declaring rights adopted by the IDA Board of Directors in the resolution contained in Article VI of session number 002-99 of 06 January 1999, through which the plaintiff, Nombre115261, and her partner at that time, Nombre115266, were declared “…beneficiaries and awardees of lots and plots in Asentamiento Osa, Los Planes de Drake sector, located in Sierpe de Osa, Provincia de Puntarenas, Región Brunca…”, specifically plot 23, sector 4, of that settlement, because, in any event, a declaration of harmfulness to the public interest (declaratoria de lesividad) was required for that purpose under Articles 173 of Ley General de la Administración Pública—the version predating its amendment by Código Procesal Contencioso Administrativo—and Articles 10 and 35 of Ley Reguladora de la Jurisdicción Contencioso Administrativa, which were in force at that time (images 72 to 73 of the pleading filed by INDER on 05 January 2016, available in the pleadings folder of the electronic case file).
At this point, it must be emphasized that, in this case, official letter OSO-009-06 of 09 January 2006, signed by the Head of the IDA Subregional Office in Osa, reflects the provisions adopted by the Board of Directors of that same entity through Resolution number VI of session 002-99 of 06 January 1999, by stating that “…according to our Database, censuses, and records, Ms. Nombre115261, identity card CED91108, is registered as an IDA Beneficiary in the capacity of Awardee (Adjudicataria) of plot No. 23, Sector 4, Asentamiento Campesino Osa.
According to registered cadastral plan (plano catastrado) P/1027420-2005; Located in Los Planes de Drake, Distrito Sierpe, Cantón Osa, Provincia Puntarenas, measuring 29 Ha…” (folio 173 of the judicial record); v) Lastly, and contrary to the plaintiff’s assertion, judgment number 1997-2456, issued by the Constitutional Chamber of the Supreme Court of Justice at 11:03 on 02 de mayo de 1997, in the amparo proceeding (recurso de amparo) processed under expediente number 1992-003605-0007-CO—in which the plaintiff did not appear as a petitioner, as evidenced by the document appearing at folios 892 to 899 of the judicial record—does not entail an abstract recognition of a right in favor of every possessor or owner of land located within Reserva Forestal Golfo Dulce, under the terms of Article 8 of Decreto Ejecutivo 8494-A, to have such land expropriated pursuant to Article 9 of that same body of regulations.
This is so not only because the order directs MINAE, through the Dirección General Forestal or Dirección del Sistema Nacional de Áreas de Conservación, to “…from the date notice of this decision is given, proceed to comply with the provisions of Decretos Ejecutivos 8494-A, 9388-A y 10142-A and initiate the expropriation proceedings (diligencias de expropiación)…”; but also because the judgment clearly establishes that the same Ministry must “…proceed to prepare, jointly with those petitioners who, according to the census, are found to be owners or lawful possessors (poseedores legítimos), a land-use plan (plan de explotación de la tierra) consistent with the legal regime governing the land and allowing the owners or lawful possessors to maintain and support themselves while the expropriation proceedings remain pending…” (folios 69 to 73 of the judicial record). Accordingly, Decreto Ejecutivo 8494-A itself imposes upon MINAE the duty to identify those persons whose circumstances fall within the factual circumstances contemplated in Article 8 of that Decreto Ejecutivo (namely: a registered property (finca inscrita); ten-year possession (posesión decenal) predating 01 de junio de 1978; or properties held under precarious possession (posesión precaria)), as a sine qua non requirement for it to pursue the direct purchase or expropriation of those lands “…located within the boundaries of this Reserve and indispensable to its integration…” (Article 9 of Decreto Ejecutivo 8494-A).
This in no way means that, through judgment number 1997-2456, the Constitutional Chamber declared that every occupant of land located within Reserva Forestal Osa has that status per se and must therefore be expropriated, regardless of whether or not they appeared as petitioners in the amparo proceeding in which that ruling was issued. Moreover, Agreement 30 from ordinary session number 44-05 of 14 de noviembre del 2005, approved by the Board of Directors of IDA, unlawfully exceeded not only what the Constitutional Chamber ordered in judgment 1997-2456, but also the provisions of Articles 13, 14, and 15 of Ley Forestal (number 7575, in force since 16 de abril de 1996), and Articles 3, 8, 9, and 10 of Decreto Ejecutivo 8494-A, because through that act the Board of Directors of IDA created a special procedure for granting title (titulación) to plots in Asentamiento Campesino Osa located within Reserva Forestal Golfo Dulce, even though, as of 01 de junio de 1978, those lands became part of the State Natural Heritage (Patrimonio Natural del Estado) and are therefore inalienable (inalienables), not subject to acquisitive prescription (imprescriptibles), and not subject to attachment (inembargables); vi) For all the foregoing reasons, this Court finds that Agreement number 35 from ordinary session 040-2007, held by the Board of Directors of IDA on 19 de noviembre del 2007, is not affected by the alleged defects of absolute nullity (nulidad absoluta) asserted by the plaintiff’s representative; consequently, principal claims 1 through 7 are unfounded and must be so declared.
VII.REGARDING THE TEN-YEAR POSSESSION (POSESIÓN DECENAL) CLAIMED BY THE PLAINTIFF AND THE SCOPE OF RESOLUTION VI OF SESSION 002-99 OF 06 DE ENERO Placa21560, BY WHICH SHE WAS DECLARED THE ALLOTTEE (ADJUDICATARIA) OF PARCEL 23-4 OF THE ASENTAMIENTO CAMPESINO OSA. At first instance, the dispute as to whether the plaintiff satisfied the requirement of having possessed parcel 28 in sector 4 of the Asentamiento Campesino Osa for 10 years before 01 de junio de 1978—the date on which the Reserva Forestal Golfo Dulce was created—ceases to be relevant in this particular case, given that the IDA Board of Directors itself declared that she held a vested right (derecho subjetivo) over said land, described in cadastral plan (plano catastrado) number P-1027420-2005, insofar as it declared her its allottee as of 06 de enero de 1999, a status recorded in official letter OSO-009-06 of 09 de enero del 2006, signed by the Head of the IDA Subregional Office in Osa (images 72 to 73 of the brief filed by INDER on 05 de enero del 2016, available in the pleadings folder of the virtual case file; pages 173 and 179 of the court record).
Notwithstanding the foregoing, it must be noted that the evidence submitted in the proceeding does not show that the plaintiff possessed the land (parcel 23, sector 4 of the Asentamiento Campesino OSA) forming part of property 39334-000, registered in the name of IDA since 21 de enero de 1982 and resulting from the consolidation of properties bearing registration numbers Placa20660, Placa20661 and Placa21562, which were expropriated by the State and transferred to ITCO so that it could use them in a land-titling program in the so-called Asentamiento Campesino Osa (pages 18, 29, 42 to 56, and 353 to 424 of the court record). In this regard, the witness Nombre115268 specified only one circumstance of time, manner, and place: that before the year 1966, the plaintiff had not arrived in Rincón de San Josecito de Drake—the place where, according to his testimony, the property at issue in this proceeding is located.
In that regard, although he states that said property belonged to other people who occupied it before the park was created and sold it to the plaintiff, he also states that he does not remember when that sale occurred, in addition to not identifying those persons by name, since he indicates that he had no direct relationship with them. Likewise, the witness first maintained that in 1966, the year in which he arrived in Rincón de San Josecito de Drake, the land belonged to the State; subsequently, however, in response to a question posed by the plaintiff’s representative, he stated that the company Osa Forestal harassed them and did not allow them to enter, although he did not specify the particular place they were prohibited from entering. Lastly, he maintains that the plaintiff had been on the land for quite some time and planted cacao and laurel, but that he does not know why those crops were unsuccessful (see the digital recording of the testimony of Nombre115268, given at the trial hearing held on 02-04-2019, in the associated-documents folder of the virtual case file).
For her part, the witness Nombre115269 maintained that she entered the area where the property at issue in the proceeding is located in 1976 or 1977, and that she does not know how many years Nombre115271—who allegedly sold the property to the plaintiff—or Nombre115261 had been on that land. She also states that the plaintiff lived on said property and attempted to work it, but was unsuccessful; consequently, she worked with some Americans on the beach and also in parque Corcovado, although she is now retired and lives in Agujitas de Drake (see the digital recording of the testimony of Nombre115269, given at the trial hearing held on 02-04-2019, in the associated-documents folder of the virtual case file). As to the witness Nombre115270, he clarified that although he began working in 1979 for the then Instituto de Tierras y Colonización, it was not until 1986 that he began conducting compliance inspections at the Asentamiento Campesino Osa.
He stated that in that year, when he visited Dirección14235 in said settlement, the plaintiff was on the land performing work, as she also was in 1999, when the plaintiff was on the property accompanied by Nombre115266. By 2005 and 2006, the plaintiff was no longer living on the land and has not occupied it to date (see the digital recording of the testimony of Nombre115270, given at the trial hearing held on 05-04-2019, in the associated-documents folder of the virtual case file). The witness Nombre34677 testified—insofar as relevant—that he has no relationship with the plaintiff and has known her since 1985, when a meeting of farmers was held in Drake (see the digital recording of the testimony of Nombre34677, given at the trial hearing held on 05-04-2019, in the associated-documents folder of the virtual case file). Lastly, although it is true that the sworn statement (declaración jurada) submitted by the plaintiff with her titling application, based on the special procedure created for that purpose by the IDA Board of Directors through resolution number 39 of session number 044-05 of 14 de noviembre del 2005, states that “…she acquired said property through the purchase of improvements (compra de mejoras), with authorization from the Instituto de Desarrollo Agrario, from Ms.
Nombre115271 in the year one thousand nine hundred seventy-three; who, in turn, publicly took possession of the property in the year one thousand nine hundred sixty-five, when it was vacant land (terreno baldío)…” (pages 176 to 177 of the court record; images 72 to 73 of the brief filed by INDER on 05 de enero del 2016, available in the pleadings folder of the virtual case file), it is also true that said statement contains a series of inconsistencies. In this regard, it should be emphasized that the Instituto de Desarrollo Agrario did not exist in 1973; rather, the Instituto de Tierras y Colonización existed at that time, without prejudice to the fact that properties 8947-000, 22046-000 and 22048 were expropriated by the State from the company Osa Productos Forestales S.A. (Agroindustrial Rincón S.A.) through Decreto Ejecutivo number 10088-G-H of 2 de mayo de 1979, and the company, in turn, transferred them to ITCO so that it could use them in a land-titling program in the so-called Asentamiento Campesino Osa, thereby creating property 39334-000, which encompasses parcel 23, sector 4, described in cadastral plan number P-1027420-2005.
In view of the foregoing, ITCO could not have authorized the alleged transfer claimed by the plaintiff, since it lacked authority to dispose of that land because it was not vacant land but rather was owned by Osa Productos Forestales, S.A., with which ITCO even signed a preliminary settlement agreement on 20 de noviembre de 1974, aimed at transferring to ITCO those areas of the company’s properties that were necessary, following the conduct of censuses and studies by that entity, in order to provide economically workable land to those occupants who qualified as precarious possessors (poseedores en precario) (pages 4 to 5, 18, 29, 35 to 40, 42 to 56, and 353 to 424 of the court record). Consequently, the evidence entered into the record does not show that the plaintiff, either directly or by tacking (sumando) the alleged possession of the previous occupants, possessed the land for ten years before 01 de junio de 1978, the date on which the Reserva Forestal Osa was created (recital II, subsection b, of this judgment).
However, as indicated supra, that circumstance ceases to be relevant in this particular case, given that the IDA Board of Directors itself issued an act favorable to the plaintiff and a third party with respect to parcel 23, sector 4, of the Asentamiento Campesino Osa, described in cadastral plan number Placa21563, insofar as it declared her and Nombre115266—her domestic partner at that time—to be allottees of that land as of 06 de enero de 1999, a status recorded in official letter OSO-009-06 of 09 de enero del 2006, signed by the Head of the IDA Subregional Office in Osa (images 72 to 73 of the brief filed by INDER on 05 de enero del 2016, available in the pleadings folder of the virtual case file; page 173 of the court record). Although it is true that the IDA Board of Directors could not dispose of land that, upon the creation of the Reserva Forestal Golfo Dulce, became part of the State Natural Heritage (Patrimonio Natural del Estado) on 01 de junio de 1978, because it constitutes public-domain property (bien demanial) characterized as inalienable, immune from attachment, and not subject to acquisitive prescription (inalienable, inembargable e imprescriptible), it is also true that it has not been established that said resolution was revoked by the Board of Directors of the then IDA or the current INDER (recital II, subsection c, of this judgment).
However, the fact that said resolution cannot be enforced and, consequently, that the property described in cadastral plan Placa21564 cannot be titled in the plaintiff’s name in the Public Registry—which means that claim 7 of the complaint must be denied, as determined in the preceding recital—because, pursuant to Articles 13, 14 and 15 of the Ley Forestal (number 7575, in force since 16 de abril de 1996); Article 170 of the Ley General de la Administración Pública; Article 3 of Decreto Ejecutivo 8494-A; and judgment number 2007-008098, issued by the Sala Constitucional de la Corte Suprema de Justicia at 16:24 hours on 12 de junio del 2007, in an amparo proceeding (recurso de amparo) filed by the plaintiff herein, Nombre115261, and others against the Instituto de Desarrollo Agrario and others, processed under case file 07-007540-0007-CO, “…there is a material impossibility for the respondents to title land located within forest reserves because such action is unconstitutional, as established by this Court (…) without prejudice to the appellants’ right to bring against the respondents any actions they deem appropriate in ordinary administrative judicial proceedings, aimed at protecting their interests and rights…” (pages 155 to 164 of the court record), does not justify the failure of the Board of Directors of the current INDER, formerly IDA, to fulfill the obligation imposed by Article 174(1) of the Ley General de la Administración Pública, to the effect that “...The Administration shall be required to annul on its own motion (anular de oficio) an absolutely void act (acto absolutamente nulo), subject to the limitations of this Law…,” which required a declaration that the act was adverse to the public interest (declaratoria de lesividad) under Articles 173 of the Ley General de la Administración Pública and 10, 35, and 37(3) of the Ley Reguladora de la Jurisdicción Contencioso Administrativa, which were in force at that time (images 72 to 73 of the brief filed by INDER on 05 de enero del 2016, available in the pleadings folder of the virtual case file).
This Court considers that the failure of the former IDA and the current INDER to declare resolution number VI of session 002-99 of 06 de enero de 1999 adverse to the public interest, which declared the plaintiff Nombre115272 and Nombre115266 allottees of Dirección14234, is contrary to Article 174(1) of the Ley General de la Administración Pública, because it has allowed an act declaring rights in favor of the plaintiff and a third party to remain in force over time, even though it cannot be enforced because it is manifestly contrary to Articles 13, 14 and 15 of the Ley Forestal (number 7575, in force since 16 de abril de 1996) and Article 3 of Decreto Ejecutivo 8494-A.
That unlawful omission has adversely affected the claimant’s legal sphere, because INDER placed her in a state of uncertainty that she has no duty to endure, given that she continues to await the titling in her name and delivery of the property deed for Dirección14235, which is impossible to carry out because the land forms part of the State Natural Heritage (Patrimonio Natural del Estado). Thus, even though it is included within property 39334-000, registered in the name of the former IDA, now INDER, that institution lacks authority to convey or encumber it because it is public-domain property (bien demanial), pursuant to Articles 14 and 15 of Ley Forestal number 7575. In view of the foregoing, this Court finds that the State and SINAC are not the authors of the omission declared unlawful in these plenary proceedings (proceso de conocimiento), because, in fulfillment both of the obligation imposed upon it by Decreto Ejecutivo 8494-A—to identify those persons whose circumstances fell within the factual situation contemplated in Article 8 of that Decreto Ejecutivo—and of the operative portion of judgment number 1997-2456 issued by the Constitutional Chamber of the Supreme Court of Justice, MINAE conducted a census of the claimant pursuant to Decretos Ejecutivos numbers 8494-, 938-A and 10142-A, even though she was not listed as a petitioner in expediente number 92-0003605-0007-CO, in which that judgment was issued, as evidenced by official communication number DM-816-203 dated 23 de abril del 2003, appearing at pages 75 and 93 of the judicial record.
At this point, it must be emphasized that, by the date on which the Minister of Environment and Energy informed the Constitutional Chamber of the partial results of the census of persons occupying land within Reserva Forestal Golfo Dulce, the Board of Directors of IDA had already issued the decision awarding parcel 28 Dirección14236—which is located within that forest reserve and described in cadastral plan number P-1027420-2005—because that formal act (conducta formal) had been issued on 06 de enero de 1999. Accordingly, this Court considers that, because a declaratory act granting subjective rights (acto declarativo de derechos subjetivos) in favor of the claimant over that property existed, Articles 8 and 9 of Decreto Ejecutivo 8494-A were no longer applicable in principle. Those provisions concerned determining whether persons occupying land within Reserva Forestal Golfo Dulce did so on property registered in their names, on property possessed for ten years prior to 01 de junio de 1978, or on properties held under precarious possession (posesión precaria), as a sine qua non requirement for the State, through MINAE and SINAC, to arrange the direct purchase or expropriation of such lands “…located within the boundaries of this Reserve and essential to its integration…”.
Indeed, neither the claimant nor the property awarded to her by INDER appears on the list, as of 09 de noviembre del 2015, of properties acquired by the State through purchase or donation within Reserva Forestal Golfo Dulce, which appears in images 55 through 57 of the submission filed by the State on 12 de enero del 2016 and contained in the pleadings folder of the electronic case file. Accordingly, the objection based on lack of standing (falta de legitimación) raised by the representative of SINAC is upheld, the State is declared to lack passive standing on the merits (legitimación ad causam pasiva), and the action is declared inadmissible with respect to both.
VIII.REGARDING THE STATUTE OF LIMITATIONS (PRESCRIPCIÓN) ASSERTED BY THE THREE CO-DEFENDANTS WITH RESPECT TO THE CLAIMS FOR DAMAGES (PRETENSIONES INDEMNIZATORIAS) ASSERTED ANCILLARILY BY THE PLAINTIFF. At first instance, given that the defense of lack of standing (excepción de falta de legitimación) raised by the representative of SINAC was sustained and the State was found to lack passive standing on the merits (legitimación ad causam pasiva), there is no need to address the statute-of-limitations defenses raised by both of them; therefore, this collegiate body will refer only to the defense asserted by counsel for INDER. At first instance, the 10-year period provided for in Article 868 of the Código Civil is not applicable, because the purpose of these proceedings is to review the legality of conduct by the Public Administration, specifically INDER (formerly IDA), and to determine whether the claims for damages asserted as ancillary claims are warranted; consequently, the applicable rules of public law must be applied.
This collegiate body likewise finds that Article 873 of the Código Civil, in relation to Article 868 of that same body of law, is also inapplicable to this specific case, because this is not a proceeding to enforce judgment number 1997-2456, issued by the Sala Constitucional de la Corte Suprema de Justicia at 10:15 hours on 02 de noviembre del 2007 to adjudicate the amparo proceeding (recurso de amparo) processed under expediente número 92-003605-0007-CO, since the plaintiff in these plenary proceedings (proceso de conocimiento) was not a petitioner in that amparo proceeding (see folios 892 to 899 of the court record). As is apparent from the list of claims appearing at folios 2230 to 2236 of the court record, this is not a civil proceeding against the Treasury (proceso civil de hacienda) in which the claim for damages is its central subject matter; rather, these are plenary proceedings challenging formal conduct and omissions by INDER.
In that regard, it should be recalled that, although the expiration defense (caducidad) raised by the representative of that institute concerning the claims for annulment (pretensiones anulatorias) of resolution number 35 from ordinary session number 040-2007 of 19 de noviembre del 2007 was rejected in recital V (considerando V) of this judgment, it is also true that, pursuant to Article 40 of the Código Procesal Contencioso Administrativo, omissions (conductas omisivas) may be challenged for as long as their continuing effects persist. This is relevant here because, as analyzed in the preceding recital, IDA’s own Junta Directiva issued an act favorable to the plaintiff and a third party concerning Dirección14234, described in registered survey plan (plano catastrado) number P-1027420-2005, insofar as it declared her and Nombre115266—her domestic partner (pareja de hecho) at that time—to be awardees (adjudicatarios) of that land as of 06 de enero de 1999, a status recorded in official letter OSO-009-06 of 09 de enero del 2006, signed by the Head of the IDA Subregional Office in Osa (images 72 to 73 of the brief filed by INDER on 05 de enero del 2016, appearing in the pleadings folder of the electronic case file; folio 173 of the court record).
Nevertheless, INDER has maintained in force an act declaring rights (acto declarativo de derechos) in favor of the plaintiff and a third party that cannot be enforced because it is manifestly contrary to Articles 13, 14, and 15 of the Ley Forestal (número 7575, in force since 16 de abril de 1996) and Article 3 of Decreto Ejecutivo 8494-A, even though Article 174(1) of the Ley General de la Administración Pública imposes upon it the obligation to “…annul ex officio an absolutely void act (acto absolutamente nulo), within the limitations of this Law….” This means that INDER’s omission has continuing effects that persist to this date, because it has not been established that the institute set aside, through the procedures provided for that purpose in Articles 173 of the Ley General de la Administración Pública and 10 and 35 of the Ley Reguladora de la Jurisdicción Contencioso Administrativa—which were in force at that time—that act declaring rights in favor of the plaintiff (recital II, subsection c, of this judgment).
It must be emphasized that it was not until judgment number 2007-008098 was issued at 16:24 hours on 12 de junio del 2007 in the amparo proceeding brought by the plaintiff herein, Nombre115261, and others against Instituto de Desarrollo Agrario and others, processed under expediente 07-007540-0007-CO, that the plaintiff obtained actual knowledge of the event that could give rise to potential liability on the part of the Administration, specifically INDER, because Considerando III of that judgment states that “…the respondents are materially unable to grant title to land within forest reserves because such action is unconstitutional, as held by this Court (…) without prejudice to the petitioners’ ability to bring against the respondents such actions as they deem appropriate in ordinary contentious-administrative proceedings (vía ordinaria contencioso administrativa) for the protection of their interests and rights…” (folios 155 to 164 of the court record).
Accordingly, this Court finds that the statute-of-limitations defense raised by the representative of INDER under Article 198 of the Ley General de la Administración Pública, with respect to the claims for damages asserted by the plaintiff as ancillary to the principal claims—claims seeking the annulment of formal acts and declaratory relief (pretensiones declarativas) concerning omissions related to the failure to grant title and deliver a deed of ownership (escritura de propiedad) for Dirección14234—is unfounded, not only because, as the Sala Primera de la Corte Suprema de Justicia has held: “…Article 198 of the LGAP provides: ‘The right to claim compensation from the Administration shall be subject to a four-year limitation period, calculated from the event giving rise to liability.’ Although the provision under discussion states that the period is calculated from the event giving rise to liability, this Chamber has held that, in order ‘(…) to determine when the limitation period begins to run, two requirements are necessary: an objective requirement, namely the event or conduct causing the harm, and a subjective requirement, consisting of certainty on the part of the person suffering the harm that the former is the cause of the injury.
These requirements do not always arise simultaneously, and it is for the interpreter to determine the relevant time, which, under the constitutional principle of effective judicial protection (tutela efectiva), can be none other than the time when the harmful event becomes known’ (Judgment no. 456-F-2007 of 14 hours 30 minutos on 2 de julio de 2007. In this regard, see resolutions no. 844-F-S1-2016 of 10 hours 10 minutos on 11 de agosto de 2016, 279-F-S1-2014 of 8 hours 55 minutos on 26 de febrero de 2014, and 490-F-S1-2012 of 8 hours 50 minutos on 19 de abril de 2012)…”; but also because this is not a civil proceeding against the Treasury, given that the claims for damages were asserted as ancillary to the claims seeking annulment of formal acts and declaratory relief concerning omissions related to the failure to grant title and deliver a deed of ownership for Dirección14234, which, as stated both in this recital and in recital V of this judgment, were asserted pursuant to Articles 39 and 40 of the Código Procesal Contencioso Administrativo.
In that regard, it is reiterated that the plaintiff obtained actual knowledge of the event that could give rise to liability on the part of the Administration, specifically INDER, as of 12 de junio del 2007, the date on which the Sala Constitucional de la Corte Suprema de Justicia held that, although title could not be granted in favor of the petitioners—including the plaintiff—to land located within Reserva Forestal Golfo Dulce because it had formed part of Patrimonio Natural del Estado since 01 de junio de 1978, this did not preclude “…the petitioners from bringing against the respondents such actions as they deem appropriate in ordinary contentious-administrative proceedings for the protection of their interests and rights…” (folios 155 to 164 of the court record). For all the foregoing reasons, the statute-of-limitations defense raised by the representative of INDER is rejected.
This is without prejudice to the fact that, through a resolution adopted by the INDER Board of Directors under Article 77 of ordinary session number 023-2013, held on 30 de setiembre del 2013, it was finally decided to “…Authorize the Pago de Servicios Ambientales under the forest-protection category for the lands described in the registered survey plans: 4- P-1027420-2005…,” which describes parcel number 23, sector 4, of Asentamiento Campesino Osa, located within Reserva Forestal Golfo Dulce. That resolution was served upon her at 11:55 on 20 de diciembre del 2013 through the person who claimed to be her forestry manager (regente forestal) (images 76 and 77 of the brief filed by INDER on 05 de enero del 2016, appearing in the pleadings folder of the electronic case file). At this point, it should be emphasized that the plaintiff did not prove that she had in any way been prevented from collecting the Pago de Servicios Ambientales under the forest-protection category authorized by the INDER Board of Directors in the resolution partially transcribed above (recital (considerando) II, subsection d, of this judgment).
In light of all the foregoing, this panel finds that claims numbers 8 and 9, for alleged damages and losses caused by an alleged absolute prohibition on exploiting the natural resources of parcel 23, sector 4, of Asentamiento Campesino Osa because it is located within a Forest Reserve, lack any factual or legal basis. ii) Regarding subjective non-pecuniary damage (daño moral subjetivo). The plaintiff seeks an award of fifty million colones (¢50.000.000,00) as compensation for subjective non-pecuniary damage arising from the suffering and distress she has endured as a consequence of having experienced, for more than fifty years, indescribable conditions at the site in dispute while awaiting fair payment for the property she has possessed. This situation forced her to seek sources of employment in order to survive because she was not permitted to exploit the natural resources existing on the land.
In this regard, it must be recalled that although, where subjective non-pecuniary damage is alleged, it is not necessary to prove its amount, it is nevertheless necessary to establish both the existence of the damage and the causal link (nexo de causalidad) with the conduct that allegedly caused it, except in those cases in which human experience makes the suffering, anguish, or pain caused by particular conduct evident, as occurs in this case. This is because the subjective non-pecuniary damage arose from the uncertainty and hardship caused to the plaintiff while she waited for INDER to register Dirección14234, located within Reserva Forestal Golfo Dulce, in her name. That property had been awarded to her by the IDA Board of Directors on 06 de enero de 1999. Although that resolution cannot be implemented because it is contrary to Articles 13, 14, and 15 of the Ley Forestal (number 7575) and Article 3 of Decreto Ejecutivo number 8494-A, INDER has nevertheless failed to fulfill its obligation to annul it ex officio (anularlo de oficio), in accordance with the procedural channels established in Article 173 of the Ley General de la Administración Pública.
Notwithstanding the foregoing, it should be noted that such suffering and uncertainty are mitigated not only because it has been proven that the plaintiff had an actual opportunity to exploit the natural resources of Dirección14235 after the forest reserve was established, but also because she worked at Parque Nacional Corcovado until her retirement and currently lives in the Agujitas de Osa area, as witness Nombre115269 testified during the first part of the trial hearing held on 02 de abril del 2019 (see the digital recording of that proceeding in the associated-documents folder of the electronic case file). In light of all the foregoing, Instituto de Desarrollo Rural is ordered to pay one million five hundred thousand colones for subjective non-pecuniary damage (¢1.500.000,00), the effective calculation and appropriate adjustment of which shall be carried out during the judgment-enforcement proceedings (ejecución de sentencias) once this ruling becomes final.
With respect to alternative claims 1 and 2, which seek payment to the plaintiff, by way of expropriation, of the value of parcel 23, sector 4, of Asentamiento Campesino Osa, with an area of 299.918.31 square meters, described in registered survey plan number P-1027420-2005, on the grounds that she allegedly possessed it for more than ten years before Reserva Forestal Golfo Dulce was created through Decreto Ejecutivo 8494-A, and that her status as a beneficiary through adverse possession (beneficiaria usucapiente) was allegedly recognized by official letter OSO-09-06 of 09 de enero del 2006, this Court declares those claims inadmissible. This is because, as analyzed in recitals VI and VII of this judgment, the evidence entered into the record does not show that the plaintiff possessed the land, either directly or by adding the alleged possession of the prior occupants, for ten years before the creation of Reserva Forestal Osa (1 de junio de 1978).
Nor does it show that, through official letter OSO-09-06 of 09 de enero del 2006, the Head of the Subregional Office in Osa of the then Instituto de Desarrollo Agrario recognized her status as a beneficiary through adverse possession under Article 8 of Decreto Ejecutivo 8494-A and, consequently, her entitlement to have the expropriation or direct purchase of those lands pursued, provided that they were indispensable for incorporating the lands into the reserve. With respect to alternative claim number 3, however, this panel finds that it must be granted for the following reasons: i) The failure of the former IDA and the current INDER to declare Resolution number VI of session 002-99 of 06 de enero de 1999, which declared the plaintiff Nombre115272 and Nombre115266 to be the awardees of Dirección14234, injurious to the public interest (lesivo) is contrary to Article 174(1) of the Ley General de la Administración Pública, because they have kept in force an act conferring rights upon the plaintiff and a third party that cannot be implemented because it is manifestly contrary to Articles 13, 14, and 15 of the Ley Forestal (number 7575, in force since 16 de abril de 1996) and Article 3 of Decreto Ejecutivo 8494-A; ii) This unlawful omission adversely affected the plaintiff’s legal sphere because INDER placed her in a state of uncertainty that she has no duty to endure, given that she continues to wait for parcel 23, sector 4, to be registered in her name and for its deed of ownership to be delivered to her.
This is impossible to accomplish because the land forms part of the State Natural Heritage (Patrimonio Natural del Estado). Therefore, even though it is located within property 39334-000, registered in the name of the former IDA, now INDER, that institution lacked authority to transfer or encumber it because it is public-domain property (bien demanial), pursuant to Articles 14 and 15 of Ley Forestal number 7575; iii) In light of the foregoing, the defenses excluding liability (eximentes de responsabilidad) asserted by INDER’s counsel, relating to fault of the victim (culpa de la víctima) and the act of a third party (hecho de un tercero), are manifestly without merit, since that entity awarded parcel 23, sector 4, of Asentamiento Campesino Osa (property 39334-000) to the plaintiff even though that property forms part of the State Natural Heritage because it is located within Reserva Forestal Golfo Dulce.
Accordingly, the creation of the reserve through Decreto Ejecutivo number 8494-A is not the cause or event giving rise to liability; rather, liability arises from INDER’s conduct in awarding her the specified parcel even though the act was contrary to the legal system, aggravated by its failure to fulfill the obligation imposed upon it by Article 174 of the Ley General de la Administración Pública to annul that act ex officio because it was affected by defects rendering it absolutely null (nulidad absoluta), subject to the limitations established by that Law; iv) In light of all the foregoing, INDER is ordered to pay the plaintiff, as compensation for the impossibility of implementing Resolution VI of session 002-99, held by that entity’s Board of Directors on 06 de enero de 1999, which awarded her parcel 23, sector 4, of Asentamiento Campesino Osa, located within Reserva Forestal Golfo Dulce, with an area of 299.918.31 square meters and described in registered survey plan number P-1027420-2005, one-half of the market value that the property had (because it was also awarded to Nombre115266) on 14 de febrero del 2008 (the date on which the plaintiff filed the complaint), as requested in the final part of alternative claim number 3. That amount shall be effectively determined and calculated during the judgment-enforcement phase before this Court.
XI.ON THE PRELIMINARY DEFENSES AND DEFENSES ON THE MERITS (presupuestos y excepciones de fondo). In accordance with the analysis in recitals (considerandos) IV, V, and VII of this judgment, the defenses of substantive res judicata (cosa juzgada material), expiration (caducidad), and statute of limitations (prescripción) are rejected. Likewise, and based on the provisions of recital VII of this judgment, the defense of lack of standing (falta de legitimación) raised by the representative of SINAC is sustained, and the State is declared to lack passive standing as a proper defendant (legitimación ad causam pasiva); therefore, the action is inadmissible as to both. Furthermore, this Court finds that the proceeding was brought by the party directly affected by the conduct of INDER when, beginning in 1999, it awarded her Dirección14234 and failed to comply with the obligation imposed on it by Section 174 of the General Public Administration Law to annul sua sponte, through the procedural means provided for in that same law, an act conferring rights (acto declarativo de derechos) that is affected by defects rendering it absolutely null and void (nulidad absoluta); and the claim is brought against the Rural Development Institute, formerly the Agrarian Development Institute, which is responsible for the acts and omissions at issue in this plenary proceeding (proceso de conocimiento).
Accordingly, active standing (legitimación activa) is supported by Section 10.1.a of the Contentious-Administrative Procedure Code, and the defense of lack of passive standing (falta de legitimación pasiva) is rejected. The interest, in turn, remains current because the acts and omissions relating both to the act conferring rights in favor of the plaintiff, which INDER adopted in Article VI of session 002-99 of 6 de enero de 1999, and to that entity’s failure to comply with the obligation contained in Article 174 of the General Public Administration Law, continue to have effects within the plaintiff’s legal sphere and require a judicial ruling resolving them; therefore, the defense of lack of interest (falta de interés) is rejected. Finally, this panel finds that, for all the reasons set forth in recitals VI, VII (in part), IX (in part), and X (in part), the defense of lack of legal entitlement (falta de derecho) is sustained solely with respect to principal claims 1 through 9 and alternative claims 1 and 2.
Consequently, and for all the reasons set forth in recitals VII (in part), IX (in part), and X (in part) of this judgment, the defense of lack of legal entitlement is rejected as to the remaining matters, and the action filed by Nombre115261 Nombre115261 against the Rural Development Institute is partially granted on the following terms, with any relief not expressly indicated being deemed denied:
XII.ON COSTS (costas). Pursuant to Section 193 of the Contentious-Administrative Procedure Code, procedural costs and attorneys’ fees (costas procesales y personales) are imposed on the losing party by virtue of its having lost. Relief from this award is available only when, in the Court’s judgment, there was sufficient reason to litigate or when the judgment is issued on the basis of evidence whose existence was unknown to the opposing party. In this case, this panel finds no basis for applying the exceptions established by law and departing from the principle that costs are imposed on the losing party. Accordingly, the Rural Development Institute is ordered to pay the attorneys’ fees and procedural costs incurred by the plaintiff, which shall be calculated during the judgment-enforcement phase before this Court. Furthermore, this panel considers that, given the complexity of the issues in dispute, the plaintiff had sufficient reason to litigate against the State and Sistema Nacional de Áreas de Conservación; she is therefore relieved from paying both categories of costs with respect to those co-defendants.—
POR TANTO.
The defenses of substantive res judicata, expiration, and statute of limitations are rejected. The defense of lack of standing raised by the representative of SINAC is sustained, and the State is declared to lack passive standing as a proper defendant; consequently, the action is inadmissible as to both co-defendants. The defenses of lack of passive standing and lack of current interest raised by the Rural Development Institute are rejected. The defense of lack of legal entitlement is sustained solely with respect to principal claims 1 through 9 and alternative claims 1 and 2. Consequently, the defense of lack of legal entitlement is rejected as to the remaining matters, and the action filed by Nombre115273 against the Rural Development Institute is partially granted on the following terms, with any relief not expressly indicated being deemed denied:

Considera este Tribunal que en la especie no resulta aplicable lo dispuesto en el Transitorio III del Código Procesal Contencioso Administrativo y el artículo 175 de la Ley General de la Administración Pública -antes de la reforma introducida por la Ley número 8508-, sino el numeral 39.1.a del Código Procesal Contencioso Administrativo, por las razones que de seguido se exponen: a) Si bien es cierto, el acuerdo contenido en el artículo 35 que la Junta Directiva del IDA, aprobó por unanimidad en sesión ordinaria número 040-2007 celebrada el 19 de noviembre del 2007, quedó en firme antes de la entrada en vigencia del Código Procesal Contencioso Administrativo (01 de enero del 2008); también lo es, que la actora tuvo conocimiento del mismo hasta el 06 de junio del 2008 –pues dicho acuerdo no le fue notificado (considerando II aparte a de esta sentencia), a pesar de que el 02 de febrero del 2006 presentó una solicitud de titulación de la Dirección13781 , al amparo del procedimiento especial de titulación en el Asentamiento Campesino Osa comprendido en la Reserva Forestal Golfo Dulce, que en todo caso, ya le había sido adjudicada por la Junta Directiva del INDER desde el 06 de enero de 1999 (folios 165 a 170 del expediente judicial e imágenes 46 a 59 del memorial de contestación de la demanda del INDER, visible en la carpeta de escritos del expediente virtual)-, fecha en que interpuso el recurso de amparo tramitado bajo expediente 08-008420-0007-CO contra el IDA, con el objeto de que se declarara la nulidad absoluta del acuerdo adoptado por la Junta Directiva de esa entidad, en que se dispuso revocar el que había creado el Procedimiento Especial de Titulación de tierras ubicadas en el Asentamiento Campesino Osa, comprendido en la Reserva Forestal Golfo Dulce (folio 1278 a 1307 del expediente judicial); b) En razón de que la actora tuvo conocimiento del acuerdo cuestionado (artículo 35 aprobado por unanimidad en sesión ordinaria número 040-2007 por la Junta Directiva del IDA el 19 de noviembre del 2007) hasta el 06 de junio del 2008, momento para el cual ya estaba en vigencia el Código Procesal Contencioso Administrativo, el plazo de caducidad aplicable es el de un año previsto en el numeral 39 de ese cuerpo normativo y no el de cuatro años establecido en el artículo 175 de la Ley General de la Administración Pública -antes de la reforma introducida por la Ley número 8508-, pues aunque el acto impugnado quedó firme antes de la vigencia del Código Procesal Contencioso Administrativo, la actora no fue notificada del mismo por parte del IDA antes del 01 de enero del 2008; c) Por otra parte, se tiene por acreditado que el 17 de marzo del 2009, la actora presentó un incidente de hechos nuevos y ampliación de pretensiones en el proceso de conocimiento en que originalmente se tramitó su caso –o sea en el expediente 08-000110-0161-CA-, en el sentido de que “…Se declare nulo el Acuerdo de Junta Directiva Nº 35 de la sesión 040-2007, celebrada el 10 de noviembre del 2007, y con plena vigencia el Acuerdo de Junta Directiva Nº 39 de la sesión 44-05 de la sesión celebrada el 14 de noviembre del 2005…” (folios 1009 a 1013 del expediente judicial).
En consecuencia, la pretensión de nulidad contra el acuerdo contenido en el artículo 35 de la sesión ordinaria número 040-2007 celebrada por la Junta Directiva del IDA, el 19 de noviembre del 2007, fue incoada dentro del plazo de un año establecido en el numeral 39 del Código Procesal Contencioso Administrativo, que se computa a partir del 06 de junio del 2008, fecha en que la actora tuvo conocimiento de dicho acuerdo, tal y como se analizó en el aparte a) de este considerando; d) En este punto cabe resaltar, que si bien es cierto, este expediente tiene asignado el número 15-006080-1027-CA, ello se debe a lo siguiente: la demanda original se interpuso desde el 14 de febrero del 2008 y fue tramitada bajo expediente 08-000110-0161-CA, ampliándose sus hechos y pretensiones con relación al acuerdo 35 de la sesión ordinaria número 040-2007 celebrada el 19 de noviembre del 2007, mediante escrito del 17 de marzo del 2009 (folios 177 a 237, 1009 a 1013 del expediente judicial).
Con posterioridad y mediante resolución oral dictada el 25 de mayo del 2009, los Jueces que aquel momento tramitaban los diferentes procesos de conocimiento en que se discuten casos similares al que aquí nos ocupa, ordenaron la acumulación –entre otros- del expediente 08-000110-0161-CA, al expediente 08-000111-161-CA (folios 1034 a 1037 del expediente judicial). Sin embargo por resolución dictada a las 13:42 horas del 10 de noviembre del 2014, la Jueza Tramitadora dispuso: “…Así, la conclusión a la que llega el Tribunal es que la única solución posible para permitir el avance del asunto y garantizar el ejercicio pleno del contradictorio es su separación, no por geografía o situación jurídica sino por predio, conforme a la tabla adjunta. Firme esta decisión, se procederá a la separación física de los expedientes y a comunicar a las partes el número de carpeta asignado, el juez turnado y la fecha de continuación de la audiencia preliminar…” (folios 2040 a 2046 del expediente judicial).
En razón de lo antes expuesto, es que al proceso incoado por la accionante se le asignó el número de carpeta 15-006080-1027-CA, sin embargo, se insiste en que la demanda original fue planteada desde el 14 de febrero del 2008 y la ampliación de hechos y pretensiones relacionadas con el acuerdo 35 de la sesión ordinaria número 040-2007 celebrada el 19 de noviembre del 2007, fue recibida en este Despacho desde el 17 de marzo del 2009, por lo que, tal y como se analizó en los apartados precedentes, se planteó en el plazo de un año previsto en el numeral 39 del Código Procesal Contencioso Administrativo, que se computa a partir del 06 de junio del 2008, fecha en que la actora tuvo conocimiento del acuerdo cuestionado. e) Por todo lo expuesto, se rechaza la excepción de caducidad interpuesta por el representante del INDER.- VIo.- CON RELACIÓN A LA LEGALIDAD DEL ACUERDO 35 DE LA SESIÓN ORDINARIA 040-2007 Y LOS ALCANCES DEL ACUERDO 39 DE LA SESIÓN ORDINARIA 39-2005 AMBOS DE LA JUNTA DIRECTIVA DEL IDA, EN EL CASO CONCRETO.
Este Tribunal estima lo que de seguido se expone: i) En primera instancia es menester indicar, que el acuerdo 39 aprobado por la Junta Directiva del IDA, en sesión ordinaria número 044-05 del 14 de noviembre del 2005, no implicaba per se el otorgamiento de un derecho subjetivo a favor de quienes se acogieran al procedimiento especial de titulación de parcelas en el Asentamiento Campesino Osa, inscrito a nombre del IDA bajo matrícula de folio real Placa20756 y comprendido en la Reserva Forestal Golfo Dulce (folios 4 a 6, 11 a 13, 18 a 29, 42 a 58, 353 a 424 del expediente judicial). Ello por cuanto, se limitaba a regular un cauce procedimental a efecto de “…entregar títulos de propiedad a favor de aquellos ocupantes que demuestren una posesión de por lo menos diez años con anterioridad al 1 de junio de 1978 fecha en la que se creó por decreto la Reserva Forestal Golfo Dulce…”. Con ese objeto, el interesado debía cumplir una serie de requisitos, entre los que destacaban presentar ante la Oficina Subregional del IDA en Osa, “…documentos legales que demuestren la posesión decenal ejercida con anterioridad al 1 de junio de 1978 (…) Declaración jurada rendida ante Notario Público donde conste el tiempo de posesión del solicitante, el nombre, apellidos y demás calidades d la persona de quién adquirió su derecho, así como la cadena de transmisión del mismo a partir del 1 de julio de 1968…”.
Una vez recibida la solicitud con todos los requisitos previstos en los apartes segundo y tercero de ese mismo acuerdo, la Oficina Subregional del IDA en Osa, en acción conjunta con la Dirección del Área de Conservación Osa del MINAE (Ministerio de Ambiente y Energía), debían realizar una inspección ocular en el predio que se pretendía titular, a fin de –entre otros-: “… a) Comprobar en el propio sitio la presencia del ocupante como dueño del terreno. b) Comprobar linderos, comprobar que no existen traslapes ni presencia de terceros ocupantes. c) Reseñar la naturaleza del inmueble. d) Levantar el acta correspondiente, que será suscrita por los funcionarios señalados. e) Verificar la información investigada con la base de datos, censos y documentos que posea la oficina subregional del IDA en Osa…”. Con posterioridad, el representante regional del MINAE y el IDA por medio de la Oficina Subregional de Osa emitirían la recomendación respectiva, ya fuera para otorgar o denegar el título solicitado; actuaciones que debían constar en el expediente levantado al efecto, el que sería remitido al Director de la Región Brunca del INDER, que mediante su asesoría legal verificarían el contenido del expediente y emitiría la recomendación sobre el caso.
“…En el supuesto de que el examen resultare positivo se recomendará la segregación y traspaso del predio a titular ante el área de titulación y éste lo elevará a la Junta Directiva del IDA para que se dicte el acuerdo correspondiente…” (folios 117 a 122 del expediente judicial; respaldo digital de la declaración testimonial de Nombre115267 , durante la audiencia de juicio celebrada el 05-04-2019, visible en la carpeta de documentos asociados del expediente virtual). En consecuencia, el acuerdo 39 de la sesión ordinaria número 044-05 del 14 de noviembre del 2005, adoptado por la Junta Directiva del INDER, se limitaba a regular un procedimiento tendente a establecer en cada caso concreto, si el solicitante cumplía o no uno de los requisitos previstos en el artículo 8 del Decreto Ejecutivo número 8494-A, que creó la Reserva Forestal Golfo Dulce a partir del 1º de junio de 1978 –a saber: fincas con posesión decenal anterior a la constitución de la reserva- y en caso positivo, segregar la parcela o el lote respectivo de la finca madre 39334-000 inscrita a nombre del IDA y otorgarle un título de propiedad sobre el inmueble segregado.
Por ende y al no constituir el acuerdo 30 de la sesión ordinaria número 44-05 del 14 de noviembre del 2005, un acto declarativo de derecho subjetivos, no se requería de un procedimiento de lesividad para dejarlo sin efecto; ii) En este punto es menester resaltar, que la finalidad del procedimiento especial dispuesto en el acuerdo 30 de la sesión ordinaria número 44-05 del 14 de noviembre del 2005 por la Junta Directiva del IDA -la titulación de parcelas en el Asentamiento Campesino Osa comprendido en la Reserva Forestal Golfo Dulce-, resultaba contrario no sólo a lo dispuesto en los numerales 9 y 10 Decreto Ejecutivo número 8494-A, pues en los casos de fincas inscritas, o con posesión decenal anterior a la creación de la reserva forestal, o en posesión precaria (con menos de diez años), se gestionaría la compra directa o expropiación de los terrenos reducidos a dominio particular que se encontraran dentro de la reserva o bien, el traslado y reasentamiento de ocupantes de más o menos de diez años de poseer terrenos dentro de la misma; sino también a lo previsto en los artículos 13, 14 y 15 de la Ley Forestal (número 7575 vigente desde el 16 de abril de 1996) y 3 del Decreto Ejecutivo 8494-A, conforme a los cuales, los terrenos que se encuentran dentro de la delimitación de la reserva –como los del Asentamiento Campesino Osa- no sólo quedaron incorporados automáticamente al Patrimonio Natural del Estado, sino que además, ello implica que son “…inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible.
En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley…”; iii) En razón de lo expuesto en los apartados anteriores, no resulta contrario a derecho lo acordado por la Junta Directiva del IDA en conducta formal impugnada por la actora al “…Revocar el acuerdo 39 de la sesión 44-05 del 14 de noviembre del 2005, referente a la titulación en la Reserva Forestal Golfo Dulce…”, dado que “…la afectación a Reserva Forestal de los terrenos que se encuentran inscritos a nombre del Instituto de Desarrollo Agrario, hace que su afectación al Patrimonio Natural sea automático, estándole vedado otorgar títulos de propiedad a particulares…” (folio 641, 1307 del expediente judicial; imágenes 59, 114 a 120 del memorial presentado por el INDER el 05 de enero del 2016, visible en la carpeta de escritos del expediente virtual).
En ese sentido, es menester reiterar que resulta contrario a derecho titular terrenos que forman parte del Patrimonio Nacional del Estado desde el 01 de junio del 1978, conforme a lo dispuesto en artículos 13, 14 y 15 de la Ley Forestal (número 7575 vigente desde el 16 de abril de 1996) y, 3 del Decreto Ejecutivo 8494-A, aún y cuando la finca 39334-000 se encuentre inscrita a nombre del IDA desde el 21 de enero de 1982 (folios 4 y 5 del expediente judicial) y que por Decreto Ejecutivo número 10088-G-H, se establezca en el artículo 5 que “…Se autoriza a la Procuraduría General de la República para que comparezca ante el notario público que indique el Instituto de Tierras y Colonización, a otorgar la correspondiente escritura de traspaso de los bienes que se expropian y para que, en el mismo acto lo traspase a dicho Instituto, el que los destinará para los fines de la ley número 2825 de 14 de octubre de 1961 y sus reformas…” (folios 18 y 29 del expediente judicial), tal y como se consignó en la escritura número 40 otorgada ante los notarios públicos Eduardo Ching Murillo y Jorge Manuel Solano Chinchilla, a las 16:00 horas del 12 de julio de 1979 (folios 353 a 424 del expediente judicial), dado que dichos terrenos son inembargables, imprescriptibles e inalienables desde el 01 de junio de 1978; iv) Ahora bien, aunque en principio la actora debió ser notificada de ese acuerdo, ya que el 02 de febrero del 2006, presentó con base en el procedimiento especial de titulación de tierras regulado en el acuerdo 39 de la sesión ordinaria número 044-05 del 14 de noviembre del 2005, una solicitud tendente a que se titulara a su nombre –en primera instancia y después tanto a su favor como de Nombre115266 , cédula de identidad número CED91109, quién para ese momento era su pareja-, la parcela número 23 sector 4 del Asentamiento Campesino Osa del IDA, finca con matrícula de folio real Placa4406, comprendida en la Reserva Forestal Golfo Dulce –que en todo caso, ya les había sido adjudicada por la Junta Directiva del IDA mediante acuerdo comprendido en el artículo VI de la sesión número 002-99 del 06 de enero de 1999- (imágenes 48 a 59, 72 a 73 del memorial presentado por el INDER el 05 de enero del 2016, visible en la carpeta de escritos del expediente virtual; folios 165, 166, 168 a 170 del expediente judicial); también lo es, que la falta de notificación en que incurrió el IDA, no tuvo la virtud de denegarle o suprimirle un derecho subjetivo, en los términos del artículo 223 de la Ley General de la Administración Pública.
Lo anterior, porque en el caso concreto, el trámite del procedimiento especial de titulación, únicamente se limitó a la recepción de los documentos previstos en los apartes segundo y tercero del acuerdo 39 de la sesión ordinaria número 044-05 del 14 de noviembre del 2005, al punto de que ni siquiera se realizó en la especie la inspección de campo prevista en el apartado cuatro de ese mismo acuerdo (ver respaldo digital de la declaración testimonial de Nombre115267 , rendida en la audiencia de juicio celebrada el 05-04-2019, visible en la carpeta de documentos asociados del expediente virtual; folios 165, 166, 168 a 170, 641 a 652 del expediente judicial; imágenes 46 a 59 del memorial presentado por el INDER el 05 de enero del 2016, visible en la carpeta de escritos del expediente virtual). Asimismo, la revocatoria del acuerdo en que se aprobó el procedimiento especial de titulación de parcelas en el Asentamiento Campesino Osa del IDA, tampoco dejó sin efecto el acto declarativo de derechos adoptado por la Junta Directiva del IDA en acuerdo contenido en el artículo VI de la sesión número 002-99 del 06 de enero de 1999, mediante el cual, se declaró “…beneficiarios y adjudicatarios de lotes y parcelas en el Asentamiento Osa, sector los Planes de Drake, sito en Sierpe de Osa, de la Provincia de Puntarenas, Región Brunca…” a la actora Nombre115261 y a su pareja en ese momento Nombre115266 , de la parcela 23 sector 4 de ese asentamiento, ya que en todo caso, para tal efecto se requería una declaratoria de lesividad en los términos de los artículos 173 de la Ley General de la Administración Pública -la versión anterior a su reforma por el Código Procesal Contencioso Administrativo; 10 y 35 de la Ley Reguladora de la Jurisdicción Contencioso Administrativa, vigentes en ese momento (imágenes 72 a 73 del memorial presentado por el INDER el 05 de enero del 2016, visible en la carpeta de escritos del expediente virtual).
En este punto, es menester resaltar que en la especie, el oficio OSO-009-06 del 09 de enero del 2006, suscrito por el Jefe de la Oficina Subregional del IDA en Osa, es reflejo de lo dispuesto por la Junta Directiva de esa misma entidad, mediante acuerdo número VI de la sesión 002-99 del 06 de enero de 1999, a consignar que “…según nuestra Base de Datos, censos y archivos la señora Nombre115261 , cédula CED91108, aparece registrada como Beneficiaria del IDA en calidad de Adjudicataria de la parcela No. 23, Sector 4, Asentamiento Campesino Osa. Según plano catastrado P/1027420-2005; Sito en Los Planes de Drake, Distrito Sierpe, Cantón Osa, Provincia Puntarenas Mide 29 Ha…” (folio 173 del expediente judicial); v) Por último y contrario a lo indicado por la actora, la sentencia número 1997-2456 dictada por la Sala Constitucional de la Corte Suprema de Justicia, a las 11:03 horas del 02 de mayo de 1997, en el recurso de amparo tramitado en expediente número 1992-003605-0007-CO –en el cual, la actora no figuró como recurrente, según se desprende del documento visible de folio 892 a 899 del expediente judicial-, no implica un reconocimiento en abstracto de un derecho a favor de todo poseedor o propietario de terrenos comprendidos en la Reserva Forestal Golfo Dulce en los términos del artículo 8 del Decreto Ejecutivo 8494-A, a ser expropiado conforme a lo dispuesto en el numeral 9 de ese mismo cuerpo normativo, no sólo porque la orden va en el sentido de que el MINAE, por medio de la Dirección General Forestal o Dirección del Sistema Nacional de Áreas de Conservación, debe “…a partir de la notificación de esta resolución, proceder a cumplir con lo establecido en los Decretos Ejecutivos 8494-A, 9388-A y 10142-A e iniciar las diligencias de expropiación…”; sino porque además, la sentencia es clara al establecer que ese mismo Ministerio debe “…proceder a elaborar conjuntamente con aquellos recurrentes que resulten del censo ser propietarios o poseedores legítimos, un plan de explotación de la tierra acorde con el Régimen a que están sometidos los terrenos y que le permita a los propietarios o poseedores legítimos su sustento y subsistencia mientras dure el trámite expropiatorio…” (folios 69 a 73 del expediente judicial).
En consecuencia, es el propio Decreto Ejecutivo 8494-A, que impone al MINAE el deber de determinar a aquellas personas cuya situación encuadra en el supuesto de hecho previsto en el numeral 8 de ese Decreto Ejecutivo (a saber: finca inscrita; con posesión decenal anterior al 01 de junio de 1978, o fincas en posesión precaria), como requisito sine qua non para que gestionara la compra directa o la expropiación de esos terrenos “…que se encuentren dentro de la demarcación de esta Reserva y que sean indispensables para su integración…” (artículo 9 del Decreto Ejecutivo 8494-A); lo que no implica en modo alguno que la Sala Constitucional por sentencia número 1997-2456, haya declarado que todo ocupante de terrenos comprendidos en la Reserva Forestal Osa, tienen esa condición per se y que por ende, deban ser expropiados, aún y cuando figuraran o no como recurrentes en el amparo en que dicho pronunciamiento se dictó.
Sin perjuicio de que además, el acuerdo 30 de la sesión ordinaria número 44-05 del 14 de noviembre del 2005 aprobado por la Junta Directiva del IDA, excedió de manera ilegítima no sólo lo ordenado por Sala Constitucional en la sentencia 1997-2456, sino también, lo dispuesto en los artículos 13, 14 y 15 de la Ley Forestal (número 7575 vigente desde el 16 de abril de 1996); 3, 8, 9 y 10 del Decreto Ejecutivo 8494-A, puesto que mediante ese acto, la Junta Directiva del IDA creó un procedimiento especial para la titulación de parcelas en el Asentamiento Campesino Osa comprendido en la Reserva Forestal Golfo Dulce, a pesar de que desde el 01 de junio de 1978 dichos terrenos pasaron a formar parte del Patrimonio Natural del Estado y por ende, son inalienables, imprescriptibles e inembargables; vi) Por todo lo expuesto, este Tribunal considera que el acuerdo número 35 de la sesión ordinaria 040-2007 celebrada por la Junta Directiva del IDA, el 19 de noviembre del 2007, no adolece de los vicios de nulidad absoluta alegados por el representante de la parte actora, razón por la cual, las pretensiones principales 1 a 7 resultan improcedentes y así deben declararse.
VIIo.- RESPECTO A LA POSESIÓN DECENAL ALEGADA POR LA DEMANDANTE Y A LOS ALCANCES DEL ACUERDO VI DE LA SESIÓN 002-99 DEL 06 DE ENERO Placa21560 QUE SE LE DECLARÓ COMO ADJUDICATARIA DE LA PARCELA 23-4 DEL ASENTAMIENTO CAMPESINO OSA. En primera instancia, la discusión en torno a que si la actora cumplía el requisito de poseer la parcela 28 del sector 4 del Asentamiento Campesino Osa, 10 años antes del 01 de junio de 1978 –fecha de creación de la Reserva Forestal Golfo Dulce-, pierde interés en el caso concreto, dado que la propia Junta Directiva del IDA le declaró un derecho subjetivo sobre dicho terreno descrito en el plano catastrado número P-1027420-2005, en el tanto la declaró adjudicataria del mismo desde el 06 de enero de 1999, condición que se hace constar en el oficio OSO-009-06 del 09 de enero del 2006, suscrito por el Jefe de la Oficina Subregional del IDA en Osa (imágenes 72 a 73 del memorial presentado por el INDER el 05 de enero del 2016, visible en la carpeta de escritos del expediente virtual; folios 173 y 179 del expediente judicial).
No obstante lo anterior, es menester señalar que de los elementos probatorios allegados a la causa, no se desprende que la actora haya poseído el terreno (parcela 23 sector 4 del Asentamiento Campesino OSA) que forma parte de la finca 39334-000, inscrita a nombre del IDA desde el 21 de enero de 1982 y que fue el resultado de la reunión de los inmuebles con matrícula número Placa20660, Placa20661 y Placa21562, que fueron expropiados por el Estado y que se traspasaron al ITCO, a fin de que los utilizara en un programa de titulación de tierras en el denominado Asentamiento Campesino Osa (folios 18, 29, 42 a 56, 353 a 424 del expediente judicial). En ese sentido, el testigo Nombre115268 , sólo precisó un aspecto de tiempo, modo y lugar, relativo a que con anterioridad al año de 1966, la actora no había llegado a Rincón de San Josecito de Drake –lugar donde según su dicho se encuentra ubicado el inmueble objeto de este proceso-.
En ese sentido, si bien afirma que dicho inmueble era de otra gente que lo ocupó antes de la creación del parque y que se lo vendieron a la actora, también manifiesta que no recuerda cuándo sucedió esa venta, aparte de que no indicó cuál era el nombre de esas personas, pues señala que no tenía relación directa con ellas. Asimismo, el testigo primero sostuvo que para 1966, año en que él llego a Rincón de San Josecito de Drake, los terrenos eran del Estado; sin embargo, con posterioridad y ante una pregunta formulada por el representante de la actora, manifestó que la empresa Osa Forestal los molestaba y no los dejaba ingresar, aunque no precisó a qué lugar en concreto se les prohibía entrar. Por último, sostiene que hacía rato que la actora estaba en el terreno y que sembró cacao y laurel, pero que no sabe porqué no le sirvieron esos cultivos (ver respaldo digital de la declaración testimonial de Nombre115268 , rendida en la audiencia de juicio celebrada el 02-04-2019, en la carpeta de documentos asociados del expediente virtual).
Por su parte, la testigo Nombre115269 sostuvo que ingresó a la zona en que se localiza la finca objeto del proceso entre 1976 o 1977, y que no conoce cuántos años tenía Nombre115271 –quién presuntamente le vendió el inmueble a la actora- o Nombre115261 , de estar en ese terreno. Asimismo, señala que la actora vivió en dicho inmueble y trató de trabajarlo, pero no le funcionó, por lo que, trabajó con unos gringos en la playa y también en el parque Corcovado, aunque actualmente está pensionada y vive en Agujitas de Drake (ver respaldo digital de la declaración testimonial de Nombre115269 , rendida en la audiencia de juicio celebrada el 02-04-2019, en la carpeta de documentos asociados del expediente virtual). En el caso del testigo Nombre115270 , aclaró que si bien empezó a laborar desde el año 1979 para el entonces Instituto de Tierras y Colonización, fue hasta 1986 que empezó a realizar inspecciones de fiscalización en el Asentamiento Campesino Osa.
Que para ese año, cuando visitó la Dirección14235 , de dicho asentamiento, la actora se encontraba en el terreno haciendo trabajos, al igual que en el año de 1999, oportunidad en que la demandante estaba en la finca acompañada de Nombre115266 . Que ya para el año 2005 y 2006, la accionante no vivía en el terreno, ni lo ha ocupado hasta la fecha (ver respaldo digital de la declaración testimonial de Nombre115270 , rendida en la audiencia de juicio celebrada el 05-04-2019, en la carpeta de documentos asociados del expediente virtual). En el supuesto del testigo Nombre34677 , declaró -en lo que interesa- que no tiene relación con la actora, y que la conoce desde el año 1985, cuando se celebró una reunión de campesinos en Drake (ver respaldo digital de la declaración testimonial de Nombre34677 , rendida en la audiencia de juicio celebrada el 05-04-2019, en la carpeta de documentos asociados del expediente virtual).
Por último, si bien es cierto en la declaración jurada que la demandante presentó junto con la solicitud de titulación, basada en el procedimiento especial creado al efecto por la Junta Directiva del IDA, mediante acuerdo número 39 de la sesión número 044-05 del 14 de noviembre del 2005, se indica que “…dicha finca la adquirió por compra de mejoras con autorización del Instituto de Desarrollo Agrario, que le hiciera a la señora Nombre115271 en el año mil novecientos setenta y tres; quien a su vez tomó públicamente la posesión del inmueble en el año mil novecientos sesenta y cinco, al ser éste un terreno baldío en ese entonces…” (folios 176 a 177 del expediente judicial; imágenes 72 a 73 del memorial presentado por el INDER el 05 de enero del 2016, visible en la carpeta de escritos del expediente virtual); también lo es, que en dicha declaración se incurre en una serie de inconsistencias.
En ese sentido, cabe destacar que para el año 1973 no existía el Instituto de Desarrollo Agrario, sino el Instituto de Tierras y Colonización, sin perjuicio de que las fincas 8947-000, 22046-000 y 22048, que mediante Decreto Ejecutivo número 10088-G-H del 2 de mayo de 1979 fueron expropiadas por el Estado a la empresa Osa Productos Forestales S.A. (Agroindustrial Rincón S.A.), que a su vez las traspasó al ITCO, a fin de que los utilizara en un programa de titulación de tierras en el denominado Asentamiento Campesino Osa, originando la finca 39334-000 en que se encuentra comprendida la parcela 23 sector 4, descrita en el plano catastrado número P-1027420-2005. En razón de lo anterior, el ITCO no podía haber autorizado el supuesto traspaso alegado por la actora, dado que estaba imposibilitado para disponer de esos terrenos, puesto que no eran baldíos, sino que eran propiedad de la empresa Osa Productos Forestales, S.A., con la que incluso firmó un convenio preliminar de arreglo el 20 de noviembre de 1974, tendiente a traspasar al ITCO las áreas de las fincas de su propiedad que fueran necesarias, previa realización de censos y estudios por esa entidad, a fin de dotar de tierras económicamente explotables, a aquellos ocupantes que calificaran como poseedores en precario (folios 4 a 5, 18, 29,35 a 40, 42 a 56, 353 a 424 del expediente judicial).
En consecuencia, de la prueba allegada a los autos no se desprende que la actora haya poseído el terreno de manera directa o sumando la supuesta posesión de los anteriores ocupantes, diez años antes del 01 de junio de 1978 fecha de creación de la Reserva Forestal Osa (considerando II aparte b de esta sentencia). Ahora bien, tal y como se indicó supra dicha circunstancia pierde interés en el caso concreto, dado que la propia Junta Directiva del IDA dictó un acto favorable a la actora y a un tercero sobre la parcela 23 sector 4 del Asentamiento Campesino Osa, descrita en el plano catastrado número Placa21563, en el tanto la declaró junto con Nombre115266 –en ese entonces su pareja de hecho- adjudicatarios de ese terreno desde el 06 de enero de 1999, condición que se hace constar en el oficio OSO-009-06 del 09 de enero del 2006, suscrito por el Jefe de la Oficina Subregional del IDA en Osa (imágenes 72 a 73 del memorial presentado por el INDER el 05 de enero del 2016, visible en la carpeta de escritos del expediente virtual; folio 173 del expediente judicial).
Si bien es cierto, la Junta Directiva del IDA no podía disponer de un terreno que desde el 01 de junio de 1978 pasó a formar parte del Patrimonio Natural del Estado, al crearse la Reserva Forestal Golfo Dulce, dado que constituye un bien demanial que se caracteriza por ser inalienable, inembargable e imprescriptible; también lo es, que se tiene por no acreditado que dicho acuerdo haya sido dejado sin efecto por la Junta Directiva del entonces IDA o del actual INDER (considerando II aparte c de esta sentencia). Ahora bien, el hecho de dicho acuerdo no pueda ser ejecutado y por ende, no pueda titularse a nombre de la actora en el Registro Público el inmueble descrito en el plano catastrado Placa21564 –lo que implica, que la pretensión 7 de la demanda debe ser denegada, tal y como se dispuso en el considerando precedente-, ya que de conformidad con lo dispuesto en los artículos 13, 14 y 15 de la Ley Forestal (número 7575 vigente desde el 16 de abril de 1996); 170 de la Ley General de la Administración Pública; 3 del Decreto Ejecutivo 8494-A, y la sentencia número 2007-008098 dictada por la Sala Constitucional de la Corte Suprema de Justicia, a las 16:24 horas del 12 de junio del 2007, en recurso de amparo interpuesto por la aquí actora Nombre115261 y otros contra el Instituto de Desarrollo Agrario y otros, que se tramitó bajo expediente 07-007540-0007-CO, “…existe una imposibilidad material para los recurridos de titular terrenos dentro de las reservas de carácter forestal por resultar tal proceder inconstitucional, según lo dispuesto por este Tribunal (…) sin perjuicio de que los recurrentes puedan iniciar en contra de los recurrido las acciones que estimen pertinentes en la vía ordinaria contencioso administrativa, tendente a la protección de sus intereses y derechos…” (folios 155 a 164 del expediente judicial); no justifica la omisión de la Junta Directiva del actual INDER, antes IDA, en torno a cumplir la obligación impuesta en el numeral 174 inciso 1) de la Ley General de la Administración Pública, en el sentido de que “..La Administración estará obligada a anular de oficio el acto absolutamente nulo, dentro de las limitaciones de esta Ley…”, lo que implicaba una declaratoria de lesividad en los términos de los artículos 173 de la Ley General de la Administración Pública; 10, 35, 37 inciso 3) de la Ley Reguladora de la Jurisdicción Contencioso Administrativa, vigentes en ese momento (imágenes 72 a 73 del memorial presentado por el INDER el 05 de enero del 2016, visible en la carpeta de escritos del expediente virtual).
Considera este Tribunal que la omisión en que ha incurrido el antiguo IDA y el actual INDER en declarar lesivo el acuerdo número VI de la sesión 002-99 del 06 de enero de 1999, en que declara como adjudicatarios a la actora Nombre115272 y a Nombre115266 de la Dirección14234 , resulta contrario a lo dispuesto en el artículo 174 inciso 1) de la Ley General de la Administración Pública, pues ha mantenido vigente en tiempo un acto declarativo de derechos a favor de la actora y un tercero, que no puede ser ejecutado por ser resultar manifiestamente contrario a lo dispuesto en los numerales 13, 14 y 15 de la Ley Forestal (número 7575 vigente desde el 16 de abril de 1996); 3 del Decreto Ejecutivo 8494-A. Dicha omisión ilegítima ha incidido negativamente en la esfera jurídica de la demandante, pues el INDER la colocó en un estado de incertidumbre que no tiene el deber de soportar, dado que sigue a la espera de que se titule a su nombre y se le entregue la escritura de propiedad sobre la Dirección14235 , lo cual, resulta imposible ejecutar por constituir un terreno que forma parte del Patrimonio Natural del Estado, por lo que, aún y cuando se encuentre comprendido en la finca 39334-000 inscrita a nombre del antiguo IDA hoy INDER, dicha institución no está facultada para enajenarlo o gravarlo al ser un bien demanial, conforme a lo dispuesto en los numerales 14 y 15 de la Ley Forestal número 7575.
En razón de lo anteriormente expuesto, estima este Tribunal que el Estado y el SINAC, no constituyen los autores de la conducta omisiva que se declara ilegítima en este proceso de conocimiento, toda vez que en cumplimiento tanto de la obligación que le impone el propio Decreto Ejecutivo 8494-A, en el sentido de determinar a aquellas personas cuya situación encuadraba en el supuesto de hecho previsto en el numeral 8 de ese Decreto Ejecutivo; como de la parte dispositiva de la sentencia número 1997-2456 dictada por la Sala Constitucional de la Corte Suprema de Justicia, el MINAE procedió a censar a la actora conforme a lo dispuesto en los Decretos Ejecutivos número 8494-, 938-A y 10142-A, aún y cuando la misma no figuraba como recurrente en el expediente número 92-0003605-0007-CO en que dicha sentencia se dictó, tal y como se desprende del oficio número DM-816-203 del 23 de abril del 2003, visible a folios 75 y 93 del expediente judicial.
En este punto es menester resaltar que para la fecha en que el Ministro de Ambiente y Energía informó a la Sala Constitucional, acerca de los resultados parciales del censo de personas ocupantes en terrenos comprendidos en la Reserva Forestal Golfo Dulce, la Junta Directiva del IDA ya había emitido el acuerdo de adjudicación de la parcela 28 Dirección14236 -comprendido en dicha reserva forestal y descrito en el plano catastrado número P-1027420-2005-, dado que esa conducta formal fue dictada desde el 06 de enero de 1999. Por ende, considera este Tribunal que al existir un acto declarativo de derechos subjetivos a favor de la actora sobre dicho inmueble, ya no resultaba aplicable -en principio- lo dispuesto en los artículos 8 y 9 del Decreto Ejecutivo 8494-A, relativo a determinar si las personas ocupantes de terrenos comprendidos en la Reserva Forestal Golfo Dulce, lo hacían en una finca inscrita a su nombre; en una finca con posesión decenal anterior al 01 de junio de 1978 o en fincas bajo posesión precaria, como requisito sine qua non para que el Estado a través del MINAE y el SINAC, gestionaran la compra directa o la expropiación de esos terrenos “…que se encuentren dentro de la demarcación de esta Reserva y que sean indispensables para su integración…”.
Tan es así, que la actora y el inmueble que le fue adjudicado por el INDER, no aparecen en la lista de las fincas adquiridas por el Estado mediante compra o donación dentro de la Reserva Forestal Golfo Dulce, al 09 de noviembre del 2015, visible de imagen 55 a 57 del memorial presentado por el Estado el 12 de enero del 2016, que consta en la carpeta de escritos del expediente virtual. Por ende, se acoge la excepción de falta de legitimación planteada por el representante del SINAC y se declara la falta de legitimación ad causam pasiva del Estado y se declara la demanda inadmisible respecto de ambos.
VIII.SOBRE LA PRESCRIPCIÓN ALEGADA POR LOS TRES CODEMANDADOS, RESPECTO A LAS PRETENSIONES INDEMNIZATORIAS PLANTEADAS ACCESORIAMENTE POR LA PARTE ACTORA. En primera instancia y dado que se acogió la excepción de falta de legitimación planteada por el representante del SINAC y se declaró la falta de legitimación ad causam pasiva respecto del Estado, carece de interés referirse a las defensas de prescripción que ambos plantearon, por lo que, este órgano colegiado únicamente hará referencia a la interpuesta por el apoderado del INDER. En primera instancia, no resulta aplicable el plazo de 10 años previsto en el 868 del Código Civil, toda vez que el objeto del proceso es revisar la legalidad de conductas de la Administración Pública, específicamente del INDER (antiguo IDA) y determinar la procedencia o no de las pretensiones indemnizatorias planteadas de manera accesoria, por lo que, deben aplicarse las normas de derecho público que resulten procedentes.
Asimismo, estima este órgano colegiado, que lo dispuesto en el artículo 873 del Código Civil con relación al 868 de ese mismo cuerpo normativo, tampoco resulta aplicable al caso concreto, pues no estamos ante el supuesto de una ejecución de la sentencia número 1997-2456 dictada por la Sala Constitucional de la Corte Suprema de Justicia, a las 10:15 horas del 02 de noviembre del 2007, a efecto de resolver el recurso de amparo tramitado bajo expediente número 92-003605-0007-CO, toda vez que la demandante en este proceso de conocimiento, no figura como recurrente en dicho amparo (ver folios 892 a 899 del expediente judicial). Ahora bien, tal y como se desprende del elenco de pretensiones visibles de folios 2230 a 2236 del expediente judicial, no estamos frente a un proceso civil de hacienda en que la pretensión indemnizatoria sea el objeto central del mismo, sino que por el contrario nos encontramos ante un proceso de conocimiento en que se impugnan conductas formales y omisivas del INDER.
En ese sentido, cabe recordar que si bien en el considerando V de esta sentencia se rechazó la caducidad planteada por el representante de dicho instituto respecto de las pretensiones anulatorias del acuerdo número 35 de la sesión ordinaria número 040-2007 del 19 de noviembre del 2007; también lo es, que conforme a lo dispuesto en el artículo 40 del Código Procesal Contencioso Administrativo, serán impugnables las conductas omisivas mientras subsistan sus efectos continuados. Lo anterior adquiere relevancia en la especie, pues tal y como se analizó en el considerando precedente, la propia Junta Directiva del IDA dictó un acto favorable a la actora y a un tercero sobre la Dirección14234 , descrita en el plano catastrado número P-1027420-2005, en el tanto la declaró junto con Nombre115266 –en ese entonces su pareja de hecho- adjudicatarios de ese terreno desde el 06 de enero de 1999, condición que se hace constar en el oficio OSO-009-06 del 09 de enero del 2006, suscrito por el Jefe de la Oficina Subregional del IDA en Osa (imágenes 72 a 73 del memorial presentado por el INDER el 05 de enero del 2016, visible en la carpeta de escritos del expediente virtual; folio 173 del expediente judicial).
No obstante, el INDER ha mantenido vigente un acto declarativo de derechos a favor de la actora y de un tercero, que no puede ser ejecutado por ser resultar manifiestamente contrario a lo dispuesto en los numerales 13, 14 y 15 de la Ley Forestal (número 7575 vigente desde el 16 de abril de 1996); 3 del Decreto Ejecutivo 8494-A, a pesar de que el numeral 174 inciso 1) de la Ley General de la Administración Pública, le impone la obligación de “…anular de oficio el acto absolutamente nulo, dentro de las limitaciones de esta Ley…”. Lo anterior implica que la conducta omisiva en que incurre el INDER, tiene efectos continuados que se mantienen hasta la fecha, puesto que se tiene por no acreditado que dicho instituto dejara sin efecto, mediante las vías previstas al efecto en los artículos 173 de la Ley General de la Administración Pública, 10 y 35 de la Ley Reguladora de la Jurisdicción Contencioso Administrativa -vigentes en ese momento-, dicho acto declarativo de derechos a favor de la actora (considerando II aparte c de esta sentencia).
Ahora bien, es menester resaltar, que no es hasta el dictado de la sentencia número 2007-008098 de las 16:24 horas de 12 de junio del 2007, en el recurso de amparo interpuesto por la aquí actora Nombre115261 y otros contra el Instituto de Desarrollo Agrario y otros, tramitado bajo expediente 07-007540-0007-CO, que la demandante tuvo conocimiento efectivo del hecho que podría motivar la posible responsabilidad de la Administración, específicamente del INDER, puesto que en el considerando III de esa sentencia se indica que “…existe una imposibilidad material para los recurridos de titular terrenos dentro de las reservas de carácter forestal por resultar tal proceder inconstitucional, según lo dispuesto por este Tribunal (…) sin perjuicio de que los recurrentes puedan iniciar en contra de los recurrido las acciones que estimen pertinentes en la vía ordinaria contencioso administrativa, tendente a la protección de sus intereses y derechos…” (folios 155 a 164 del expediente judicial).
En razón de lo anterior, estima este Tribunal que la pretendida prescripción planteada por el representante del INDER con fundamento en el artículo 198 de la Ley General de la Administración Pública, respecto de las pretensiones indemnizatorias que la actora formula de manera accesoria a la principal –anulatorias de actos formales y a las declarativas por conductas omisivas relacionadas con la falta de titulación y entrega de escritura de propiedad sobre la Dirección14234 -, no resulta procedente, no sólo porque tal y como ha considerado la Sala Primera de la Corte Suprema de Justicia: "...El cardinal 198 de la LGAP establece: “El derecho de reclamar la indemnización a la Administración prescribirá en cuatro años, contados a partir del hecho que motiva la responsabilidad”. Si bien la norma de comentario dispone que el plazo se contabiliza a partir del hecho que motiva la responsabilidad, esta Sala ha considerado que para “(…) determinar el inicio del plazo de la prescripción se necesitan dos requisitos, uno objetivo tal como lo es el hecho o la conducta que motiva el daño, y otro subjetivo constituido por la certeza en el sujeto que lo sufre, de que aquélla es la causa de su lesión.
Estos requisitos no siempre ocurren en forma simultánea, correspondiendo al intérprete su determinación, que bajo el principio constitucional de tutela efectiva, no puede ser otro que aquel cuando se tiene conocimiento del hecho dañino” (Sentencia no. 456-F-2007 de las 14 horas 30 minutos del 2 de julio de 2007. En ese sentido consúltense las resoluciones no. 844-F-S1-2016 de las 10 horas 10 minutos del 11 de agosto de 2016, 279-F-S1-2014 de las 8 horas 55 minutos del 26 de febrero de 2014 y 490-F-S1-2012 de las 8 horas 50 minutos del 19 de abril de 2012)..."; sino porque no nos encontramos ante un proceso civil de hacienda, dado que las pretensiones indemnizatorias fueron planteadas accesoriamente a las anulatorias de actos formales y a las declarativas por conductas omisivas relacionadas con la falta de titulación y entrega de escritura de propiedad sobre la Dirección14234 , las que tal y como se indicó tanto en este considerando como en el número V de esta sentencia, fueron planteadas conforme a lo dispuesto en los artículos 39 y 40 del Código Procesal Contencioso Administrativo.
En ese sentido, se reitera que la demandante tuvo conocimiento efectivo del hecho que podría motivar la responsabilidad de la Administración, específicamente del INDER, a partir del 12 de junio del 2007, fecha en que la Sala Constitucional de la Corte Suprema de Justicia, indicó que si bien no era posible titular a favor de los recurrentes –entre los que se encuentra la actora- en terrenos comprendidos en la Reserva Forestal Golfo Dulce, dado que forman parte del Patrimonio Natural del Estado desde el 01 de junio de 1978, ello no obstaba para que “…los recurrentes puedan puedan iniciar en contra de los recurrido las acciones que estimen pertinentes en la vía ordinaria contencioso administrativa, tendente a la protección de sus intereses y derechos…” (folios 155 a 164 del expediente judicial). Por todo lo expuesto, se rechaza la excepción de prescripción planteada por el representante del INDER.
IXo.- EN CUANTO A LAS PRETENSIONES INDEMNIZATORIAS NÚMERO 8, 9 Y 10 DE LA DEMANDA. Este Tribunal estima lo que de seguido se expone: i) Daños y perjuicios relativos a la supuesta prohibición para utilizar la parcela 23 sector 4 del Asentamiento Campesino Osa, comprendida en la Reserva Forestal Golfo Dulce: En primera instancia, es menester indicar que contrario a lo que afirma el representante de la actora, de los artículos 6 y 7 del Decreto Ejecutivo numero 8494-A –que crea la Reserva Forestal Golfo Dulce- se desprende que es posible el aprovechamiento de los recursos naturales en dicha reserva, siempre y cuando se cuente con el permiso respectivo, el cual, se otorgará bajo normas técnicas que se aprobaran por la autoridad forestal y/o ambiental competente, conforme a la zonificación que para tal efecto se establezca, lo que se corrobora mediante oficio número ACOSA D-0183 del 22 de abril del 2008, suscrito por la Directora del Área de Conservación Osa del SINAC, visible a folios 540 y 541 del expediente judicial, conforme al cual, “…los ocupantes de la reserva han podido hacer uso libremente de sus tierras siempre y cuando cumplan con los requisitos establecidos en la legislación vigente aplicable por igual a todos los ciudadanos del país…”.
Tan es así, que de la declaración jurada otorgada por la demandante ante el Notario Público Ramón Zumbado Retana, a las 14:00 horas del 11 de enero del 2006; así como, de las declaraciones testimoniales de Nombre115268 , Nombre115269 y Nombre115270 , se desprende que la demandante ha aprovechado el terreno con posterioridad a que fuera declarado como parte de la Reserva Forestal, pues ha sembrado laurel, cacao y pastos, aunque con resultados negativos (ver respaldo digital de las declaraciones testimoniales de Nombre115268 , Nombre115269 y Nombre115270 , rendidas en las audiencias de juicio celebradas el 02 y 05 de abril del 2019 -respectivamente-, en la carpeta de documentos asociados del expediente virtual; folios 168 a 169 del expediente judicial; imágenes 47 y 48 del escrito presentado el 05 de enero del 2016 por el INDER, en la carpeta de documentos asociados del expediente virtual).
Sin perjuicio de que mediante acuerdo adoptado por la Junta Directiva del INDER en artículo 77 de la sesión ordinaria número 023-2013, celebrada el 30 de setiembre del 2013, se dispuso en firme “…Autorizar el pago de servicios ambientales en la modalidad de protección al bosque, para los terrenos descritos en los planos catastrados: 4- P-1027420-2005…” que describe la parcela número 23 sector 4 del Asentamiento Campesino Osa, comprendido en la Reserva Forestal Golfo Dulce. Dicho acuerdo le fue notificado a la 11:55 horas del 20 de diciembre del 2013, por medio de quién dijo ser su regente forestal (imágenes 76 y 77 del memorial presentado por el INDER el 05 de enero del 2016, visible en la carpeta de escritos del expediente virtual). En este punto cabe destacar, que la actora no acreditó que de alguna manera se hubiera visto imposibilitada para hacer efectivo el cobro de los servicios ambientales en la modalidad de protección del bosque, que le fue autorizado por la Junta Directiva del INDER en el acuerdo parcialmente transcrito con anterioridad (considerando II aparte d de esta sentencia).
Que por todo lo expuesto, estima este órgano colegiado que las pretensiones número 8 y 9 por supuestos daños y perjuicios causados a consecuencia de una supuesta prohibición absoluta para el aprovechamiento de los recursos naturales de la parcela 23 sector 4 del Asentamiento Campesino Osa, por encontrarse en una Reserva Forestal, resultan carentes de todo sustento fáctico y jurídico. ii) Sobre el daño moral subjetivo. La actora pretende que se le reconozca la suma de cincuenta millones de colones (¢50.000.000,00) por concepto de indemnización por daño moral subjetivo, por los sufrimientos y aflicciones que ha padecido, a consecuencia de haber sufrido por más de cincuenta años condiciones indescriptibles en el lugar objeto de conflicto, mientras esperaba a que se hiciera un pago justo de la finca que ha poseído, situación que la obligó a buscar fuentes de trabajo para tratar de subsistir dado que no le era permitido realizar un aprovechamiento de los recursos naturales existentes en el terreno.
En ese sentido, es menester recordar, que no obstante en los supuestos en que se alegue un daño moral subjetivo, no es necesario demostrar su cuantía; también lo es, que sí debe acreditarse no sólo la existencia del daño, sino el nexo de causalidad con la conducta que presuntamente los provocó, con excepción de aquellos casos en que por la experiencia humana, sea evidente el sufrimiento, la angustia o el dolor ocasionado a consecuencia de una determinada conducta, lo cual ocurre en este caso. Ello por cuanto, el daño moral subjetivo surge por la incertidumbre y el desgaste que le provocó a la demandante, esperar a que el INDER procediera a titular a su nombre la Dirección14234 , comprendido en la Reserva Forestal Golfo Dulce, que le fue adjudicada desde por la Junta Directiva del IDA desde el 06 de enero de 1999, acuerdo que si bien es cierto no puede ser ejecutado por ser contrario a lo dispuesto en los artículos 13, 14 y 15 de la Ley Forestal (número 7575) y 3 del Decreto Ejecutivo número 8494-A, también lo es, que el INDER ha omitido su obligación de anularlo de oficio, conforme a los cauces procesales previstos en el artículo 173 de la Ley General de la Administración Pública.
No obstante lo anterior, cabe indicar que dicho sufrimiento e incertidumbre se atenúa, no sólo porque se tiene por demostrado que la demandante tuvo la posibilidad efectiva de aprovechar los recursos naturales de la Dirección14235 una vez constituida la reserva forestal; sino también porque trabajó en el Parque Nacional Corcovado hasta acogerse a la jubilación, sin perjuicio de que en la actualidad vive en el sector de Agujitas de Osa, tal y como declaró la testigo Nombre115269 en la primera parte de la audiencia de juicio, realizada el 02 de abril del 2019 (ver respaldo digital de esa diligencia, en la carpeta de documentos asociados del expediente virtual). En razón de todo lo expuesto, se condena al Instituto de Desarrollo Rural al pago de un millón quinientos mil de colones por concepto de daño moral subjetivo (¢1.500.000,00) cuya liquidación efectiva y su debido reajuste, se realizará en la vía de ejecución de sentencias, una vez que este pronunciamiento adquiera firmeza.
Xo.- CON RELACIÓN A LAS PRETENSIONES SUBSIDIARIAS 1, 2 Y 3 RELATIVAS AL PAGO DEL VALOR DE LA PARCELA 28 SECTOR 4. En cuanto a las pretensiones subsidiarias 1 y 2 tendentes a que se pague a la actora a título de expropiación, el valor de la parcela 23 sector 4 del Asentamiento Campesino Osa, con un área de 299.918.31 metros cuadrados, descrita en el plano catastrado número P-1027420-2005, en virtud de supuestamente haberla poseído por más de diez años antes de la creación de la Reserva Forestal Golfo Dulce mediante Decreto Ejecutivo 8494-A, condición de beneficiaria usucapiente que según su dicho le fue reconocida mediante oficio OSO-09-06 del 09 de enero del 2006, este Tribunal las declara improcedentes. Ello por cuanto, tal y como se analizó en los considerandos VI y VII de esta sentencia, de la prueba allegada a los autos no se desprende que la actora haya poseído el terreno de manera directa o sumando la supuesta posesión de los anteriores ocupantes, diez años antes a la creación de la Reserva Forestal Osa (1 de junio de 1978), como tampoco que mediante oficio OSO-09-06 del 09 de enero del 2006, el Jefe de la Oficina Subregional del entonces Instituto de Desarrollo Agrario en Osa, le haya reconocido la condición de beneficiaria en calidad de usucapiente prevista en el numeral 8 del Decreto Ejecutivo 8494-A, y por ende, que tenga derecho a que se gestione la expropiación o compra directa de esos terrenos, siempre que fueran indispensables para la integración de la reserva.
Ahora bien, en cuanto a la pretensión subsidiaria número 3, este órgano colegiado estima que debe acogerse por las siguientes razones: i) La omisión en que ha incurrido el antiguo IDA y el actual INDER en declarar lesivo el acuerdo número VI de la sesión 002-99 del 06 de enero de 1999, en que declara como adjudicatarios a la actora Nombre115272 y a Nombre115266 de la Dirección14234 , resulta contraria a lo dispuesto en el artículo 174 inciso 1) de la Ley General de la Administración Pública, pues ha mantenido vigente un acto declarativo de derechos a favor de la actora y un tercero, que no puede ser ejecutado por ser resultar manifiestamente contrario a lo dispuesto en los numerales 13, 14 y 15 de la Ley Forestal (número 7575 vigente desde el 16 de abril de 1996); 3 del Decreto Ejecutivo 8494-A; ii) Dicha omisión ilegítima ha incidido negativamente en la esfera jurídica de la demandante, pues el INDER la colocó en un estado de incertidumbre que no tiene el deber de soportar, dado que sigue a la espera de que se titule a su nombre y se le entregue la escritura de propiedad sobre la parcela 23 sector 4, lo cual, resulta imposible de ejecutar por constituir un terreno que forma parte del Patrimonio Natural del Estado, por lo que, aún y cuando se encuentre comprendido en la finca 39334-000 inscrita a nombre del antiguo IDA hoy INDER, dicho institución no estaba facultado para enajenarlo o gravarlo al ser un bien demanial, conforme a lo dispuesto en los numerales 14 y 15 de la Ley Forestal número 7575; iii) Que en razón de lo expuesto, resultan manifiestamente improcedentes las eximentes de responsabilidad alegadas por el apoderado del INDER, relativas a culpa de la víctima y hecho de un tercero, toda vez que fue dicha entidad la que adjudicó a favor de la actora la parcela 23 del sector 4 del Asentamiento Campesino Osa (finca 39334-000), a pesar de dicho inmueble forma parte del Patrimonio Natural del Estado, al estar comprendido en la Reserva Forestal Golfo Dulce.
Por ende, la creación de la misma mediante Decreto Ejecutivo número 8494-A, no es la causa o el hecho que genera la responsabilidad, sino las conductas en que incurrió el INDER al adjudicarle la parcela indicada, a pesar de que el acto resulta contrario al ordenamiento jurídico, con el agravante de que omitió cumplir la obligación que le impone el artículo 174 de la Ley General de la Administración Pública, en orden a anular de oficio ese acto por adolecer de vicios de nulidad absoluta, dentro de las limitaciones que le establece esa Ley; iv) Por todo lo expuesto, se condena al INDER a pagar a la actora a título de indemnización por la imposibilidad de ejecutar el acuerdo VI de la sesión 002-99 celebrada por la Junta Directora de esa entidad el 06 de enero de 1999, en que se le adjudica la parcela 23 del sector 4 del Asentamiento Campesino Osa, comprendida en la Reserva Forestal Golfo Dulce, con un área de 299.918.31 metros cuadrados, descrita en el plano catastrado número P-1027420-2005, la mitad del valor de mercado que tenía dicho inmueble (dado que también fue adjudicado a favor de Nombre115266 ), al 14 de febrero del 2008 (fecha en que la actora planteó la demanda), tal y como se solicita en la parte final de la pretensión subsidiaria número 3, monto que será determinado y liquidado de manera efectiva, en la fase de ejecución de sentencia de este Tribunal.
XIo.- SOBRE LOS PRESUPUESTOS Y EXCEPCIONES DE FONDO. Conforme a lo analizado en los considerandos IV, V y VII de esta sentencia, se rechazan las excepciones de cosa juzgada material, caducidad y prescripción. Asimismo y con base en lo dispuesto en el considerando VII de esta sentencia, se acoge la excepción de falta de legitimación planteada por el representante del SINAC y se declara la falta de legitimación ad causam pasiva del Estado, por lo que, la demanda resulta inadmisible respecto de ambos. Por otra parte, este Tribunal estima que el proceso fue incoado por la destinataria de las conductas en que incurrió el INDER al adjudicarle desde el año 1999 la Dirección14234 y al no cumplir la obligación que le impone el numeral 174 de la Ley General de la Administración Pública en orden a anular de oficio un acto declarativo de derechos que adolezca de vicios de nulidad absoluta por los medios procesales previstos en esa misma ley; y el reclamo se plantea contra el Instituto de Desarrollo Rural antes Instituto de Desarrollo Agrario, que es el autor de las conductas activas y omisivas objeto de este proceso de conocimiento, por lo que, la legitimación activa se ampara en lo dispuesto en los ordinal 10.1.a del Código Procesal Contencioso Administrativo, y se rechaza la excepción de falta de legitimación pasiva.
Por su parte, el interés se mantiene actual, en el tanto las conductas activas y omisivas relacionadas tanto con el acto declarativo de derechos en favor de la actora, que el INDER adoptó en artículo VI de la sesión 002-99 del 6 de enero de 1999, como con el incumplimiento de la obligación contenida en el artículo 174 de la Ley General de la Administración Pública por esa misma entidad, siguen surtiendo efectos en la esfera jurídica de la demandante y requieren de una resolución jurisdiccional que las resuelva, por lo que, se rechaza la excepción de falta de interés. Finalmente, encuentra este órgano colegiado que por todo lo expuesto en los considerandos VI, VII (en parte) IX (en parte) y X (en parte), se acoge la excepción de falta de derecho, únicamente en cuanto a las pretensiones principales 1 a 9, y las pretensiones subsidiarias 1 y 2. En consecuencia, y por todo lo expuesto en los considerados VII (en parte) IX (en parte) y X (en parte) de esta sentencia, se rechaza la excepción de falta de derecho en los extremos restantes y se declara parcialmente con lugar la demanda interpuesta por Nombre115261 Nombre115261 contra el Instituto de Desarrollo Rural, en los siguientes términos, entendiéndose por denegada en lo que no se indique de manera expresa:
XIIo.- SOBRE LAS COSTAS. De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, este órgano colegiado no encuentra motivo para aplicar las excepciones que fija la normativa y quebrar el postulado de condena al vencido. Por ende, se imponen al Instituto de Desarrollo Rural, el pago de las costas personales y procesales en que incurrió la actora, extremos que se liquidarán en la fase de ejecución de sentencia de este Tribunal. Por otra parte, considera este órgano colegiado, que por la complejidad de las cuestiones debatidas, existió motivo bastante para que la actora litigara en contra del Estado y del Sistema Nacional de Áreas de Conservación, razón por la cual, se le exonera del pago de ambas costas con relación a dichos codemandados.-
POR TANTO.
Se rechazan las excepciones de cosa juzgada material, caducidad y prescripción. Se acoge la excepción de falta de legitimación planteada por el representante del SINAC y se declara la falta de legitimación ad causam pasiva del Estado, razón por la cual, la demanda resulta inadmisible respecto de ambos codemandados. Se rechazan las excepciones de falta de legitimación pasiva y falta de interés actual planteadas por el Instituto de Desarrollo Rural. Se acoge la excepción de falta de derecho, únicamente en cuanto a las pretensiones principales 1 a 9, y las pretensiones subsidiarias 1 y 2. En consecuencia, se rechaza la excepción de falta de derecho en los extremos restantes y se declara parcialmente con lugar la demanda interpuesta por Nombre115273 contra el Instituto de Desarrollo Rural, en los siguientes términos, entendiéndose por denegada en lo que no se indique de manera expresa:
