The property* remains subject to reservations concerning the right-of-way (derecho de vía) of public roads,* as provided by Article four of the Ley General de Caminos Públicos and* Article nineteen, subsection a), of the Ley de Informaciones Posesorias.- Furthermore, because this is an area* located within a protected zone (zona protectora), it remains subject to the restrictions of* Ley Forestal Nº 7575, and the cutting or removal of trees in* that sector is therefore prohibited (Articles 33 and 34); moreover, the channel, waters, and spring (naciente) of the* unnamed stream, as well as the Burio stream, those watercourses, and all other surface and/or* groundwater existing on the property are in the public domain and do not form part of the* property (Ley de Aguas, Article 1, subsection IV, and Article 3, subsection III).- Once this decision becomes final and* upon request by the interested party, the corresponding certified enforceable copy shall be issued.’”* (See the virtual case file of the Juzgado Agrario de Puntarenas, document associated on* 21/03/2018 at 17:36:24).-* * * * * * * * * * 4.- Attorney Susana Fallas Cubero, in her capacity as government attorney, filed an appeal,* expressly stating the grounds on which it was based in order to challenge the trial court’s position (See the virtual case file of the Juzgado Agrario de Puntarenas, filing entered on 03/04/2018 at 9:32:17).-* * * * * * * * * * 5.- The legal requirements were observed in the conduct of the proceeding, and no errors or omissions capable of rendering the judgment null and void are apparent.- * * * * * * * * * * * Drafted by Judge Castro García; and,* CONSIDERATIONS:* * * * * * * * * * I-Proven facts.* * The proven facts set forth in the appealed judgment are affirmed because they are supported by evidence. * * * * * * * * * * II- The Office of the Attorney General files an appeal (virtual desk/filings/date 03/04/2018 09:31:50)* against judgment N. 2018000030 issued at 17:36 hours on March 21, 2018 (digital case file/documents/date 21/03/2018 17:36:24).
It raises the following objections: 1) The petitioner seeks to obtain title to a parcel located within the Península de Nicoya Protected Zone (Zona Protectora), created by Decreto Ejecutivo No. 22968-MIRENEM (in force* since March 10, 1994). * In the initial filing and the copy of deed No. 409, the* petitioner acquired it in the year 1987* from [Nombre6]. It objects that * this does not coincide with the witness testimony, according to which the* transfer occurred in 1983. The declarant [Nombre7] stated that the* applicant for title acquired it from [Nombre8][Nombre8]. It argues that the judgment under appeal overlooks these shortcomings in the witness evidence when it states that the purchase date given by the witnesses is merely “for reference,” notwithstanding the foregoing. However, no date similar to that in the transfer document can be inferred from their statements. It considers that the reason why the chain of* transfers is deemed proven has not been justified.
It notes that, under the Tribunal Agrario’s standard, the* witness statements and the submitted documents must be consistent in order to validate the transferred possession and merit the* adjudicator’s confidence. It cites various decisions in this regard. 2) There is a lack of correspondence between the area and * the natural boundaries of the property involved in these proceedings: 33 hectares 8666 square meters. [Nombre9] to the * north, partly along an unnamed* stream; to the west, along the [Dirección6] and [Dirección7] streams, both in part. Deed CED6 describes an area of 45 hectares. It borders to the north solely on [Nombre10]; to the west, * [Nombre11][Nombre12][Nombre13] and [Nombre14]. This * prevents the parcels from being identified as the same property and that deed from being relied upon as a transfer document. It partially transcribes several judgments issued by this Court.
It asserts that this issue was not properly analyzed, that * the lack of correspondence between the natural boundaries was not mentioned, and that the presumption that the difference in area is explained by a lack of knowledge of the exact measurement is unfounded.* 3)* It alleges that it was proven that, throughout the occupation* of the property, no action aimed at protecting the* natural resources in properties located * within protected wildlife areas (áreas silvestres protegidas), as in this case, had been undertaken, and that the petitioner did so only after being required by the* Court. It cites part of a decision of the Tribunal. It states that environmental protection must be maintained throughout the entire period* of possession up to the present. It should not be permitted to be limited to the period during which* the proceedings are pending. It contends that the record contains * three land-use study certifications (certificaciones de estudio de uso del suelo).
The first, approved on March 13, 2008, certified a nonconforming use (uso no conforme) on 57% of the land because sector B,* * which accounts for that* percentage of the land within management unit (unidad de manejo) VI, has severe erosion “demonstrating the substantial degradation of this management unit when it is subjected to extensive cattle-ranching activity....” It adds that the document stated that the forest cover (cobertura forestal) around the springs (nacientes) does not comply with Ley Forestal, Article 33, and refers to the document’s observations. It objects that Decreto NO. 23214-MAG-MIRENEM of April 13, 1994,* provides as follows regarding* management unit VI: “* lands located within this class are used for forest production, as well as permanent crops such as fruit trees and coffee, although the latter* require intensive soil and water management and conservation practices.... *” It indicates that the same study recommended “eliminating cattle-ranching activity in sector B and* leaving that land to undergo natural forest regeneration.” It states that the second certification, dated May 15, 2008, 2* months after the first, indicates that nonconforming use had increased to 91.1% of the property, with pasture use identified throughout that percentage, demonstrating “severe symptoms of erosion, including livestock trails 30 to 40 centimeters deep and some small gullies”* (observations section at folio 107).
It was recommended that “grazing activity be eliminated” throughout* that sector (folio 108). It argues that, of that 91.1%, 57.18% corresponds to management unit VI, whose* limitations were cited above, while the remaining 33.91% corresponds to* management unit VII, which is subject to limitations so severe that they permit only the management of primary or secondary natural forest (Decreto No.* 23214-MAG-MIRENEM). It adds that, notwithstanding the foregoing, the third certification, dated October 22,* 2013, stated that cattle-ranching activity was still being conducted, since at least* 60% was then under silvopastoral use (uso silvopastoril), with a significant stocking density,* in breach of the recommendation issued by the Departamento de Servicios Técnicos of* INTA. Yet, strangely, conforming use (uso conforme) was certified for the entire area, based also* on actions that had not been carried out (the planting of trees during the* following year in accordance with the recommendations).
It outlines that, in the study dated May 15, 2008 (the second certificate), 33.91% of the area was deemed to have a steep slope and the remainder* a strongly undulating slope, whereas, curiously, the third study states that only* 15% of the surface has steep conditions (that is, less than half), while other sectors consist of* moderately and strongly undulating land. It notes that plan No. P-1823065-2015 of May 19,* 2015, describes almost the entire property as pastureland, including, according to the land-use certificate, * sectors that* the third land-use study classified as reforestation, secondary forest,* and sector E, where the purported future reforestation with teak was to be carried out* (as shown on the map attached to the study). It states that Decreto No. 23214-MAG-MIRENEM* does not recommend planting teak on strongly* undulating terrain, as in the case of sector E. It contends that * the practices carried out on the land contravene Article 102 of the Regulations to the Soil Use, Management, and Conservation Act (Reglamento a la Ley de Uso, Manejo y Conservación de Suelos), Decreto* Ejecutivo No. 29375 MAG-MINAE-S-HACIENDA-MOPT, * * * * * * * * which reads: “Owners, lessees, or possessors of land under any title are required * to manage their farms using the best available technology to prevent the degradation, erosion, and contamination of soils and waters.” It objects that this Tribunal Agrario has held that maintaining conforming land use* before and after the creation of the protected wildlife area is a requirement for ensuring the* proper protection of natural resources, which is itself a prerequisite for obtaining title, * and* that cattle ranching is incompatible with conservation.
It notes that the witnesses confirmed that the land is used for cattle ranching and* pastureland. It alleges that the appealed decision does not analyze all the matters raised regarding* this issue and that the court below limited itself to relying solely on the most recent study, without considering the lack of protection of the resources* on the land for which title is sought. It requests that the judgment be reversed and the petition denied. * * * * * * * * * * III- Article seven of the Ley de Informaciones Posesorias expressly established, as of its entry into force on 13 de febrero de 1996 through the amendment introduced by Ley Forestal N. 7575., the possibility of obtaining title to land located within protected wildlife areas (áreas silvestres protegidas), provided that possession (posesión) for ten years before the creation of that area, under any management category, is demonstrated.
That article has been challenged twice before the Constitutional Chamber, and a declaration of unconstitutionality has been denied, thus leaving that provision in force, without any judicial body being permitted to disregard its validity. Regarding possession, the representative of the Office of the Attorney General of the Republic appeals, arguing that the statements of the witnesses are not useful for demonstrating the possession exercised by the applicant and his transferors. He objects on the basis of contradictions between the initial application, the deed of sale submitted, and the witnesses’ testimony, as there is no agreement regarding the date on which the applicant for title acquired the property. The record shows that, at the evidentiary hearing of 11 de noviembre del 2008 (folio 91), minutes were prepared of the testimony * of [Nombre15] (folio 91), [Nombre7] (folio 92), and [Nombre16] (folio 93).
The witness [Nombre17] stated that he was 63 years old and had known the property (fundo) for 40 years. He explained that it belonged to [Nombre6], who transferred it to the applicant approximately 25 years earlier. [Nombre5] formerly engaged in cattle ranching more intensively and now does so on a smaller scale. The property has remained fenced and contains a dry-season spring (naciente veranera), where a “small wooded area” is located that has always been maintained to preserve it. There is a house where the applicant lived with his family. He stated that he had never known of any dispute concerning possession of the property, that possession had been peaceful, and that the applicant for title was recognized as the owner. This testimony describes a continuous chain of possession (cadena posesoria) dating from 1968, based on what was stated regarding knowledge of the parcel, first in favor of [Nombre6] and subsequently [Nombre1] (the applicant).
In addition, it was stated that those two persons had carried out cattle-ranching activities and conserved the spring and forest cover (cobertura boscosa), and that cattle-ranching activity was less intensive than in the past. The witness [Nombre16] stated that he had known the property for 40 years (1968), when the farm belonged to [Nombre6], who transferred it to [Nombre1], who has possessed it for approximately 25 years. He indicated that in the past the land was used partly for pasture and for growing rice, beans, and corn. He stated that it is currently used only for pasture and for conserving the existing wooded area. The parcel has an old dwelling and is properly demarcated. He stated that there are no springs (nacientes), but there are two small streams. The pastures are maintained by clearing weeds, and the wooded portion has been conserved. He stated that he was unaware of any problem arising from the possession, which had always been peaceful, and that the applicant for title was recognized in the community as the owner.
In this Court’s view, this witness agrees with the preceding witness that the owner 40 years ago was [Nombre6], who transferred the property to [Nombre18] 25 years earlier. He likewise stated that possession had been peaceful and public, since the current applicant for title is recognized as the owner. Regarding the acts performed, he stated that the property had been devoted to pasture and to conserving the water bodies, which he described as small streams. The witness [Nombre7], however, stated that he had known the land for 35 years because he visited [Nombre1] and his family, as he was a Jehovah’s Witness and saw him frequently. He stated that when he first became acquainted with the farm, it belonged to [Nombre6], and that it later passed into the hands of [Nombre8]. He subsequently stated that the applicant for title acquired it approximately 25 years ago. He described the land as having been used for pastureland (repastos), rice, and beans, and as currently being used for pastureland.
The farm is fenced, has a dwelling, and has been occupied. He has not seen any springs, but has seen some “small streams” within it. The farm is maintained through brush clearing (chapias), and the wooded portion is conserved. He has never become aware of any problems concerning possession, which has been peaceful, and the applicant is known among the local population as the owner. This witness agrees in all respects with the statements of the preceding witnesses, except that he adds to the chain of possession a person whom he identified as [Nombre19], who was not mentioned by the other two witnesses. It bears repeating that, because the farm lies within the Zona Protectora Península de Nicoya-Sector Buena Vista pursuant to decreto N. 22968-MIRENEM of 10 de marzo de 1994 and in accordance with article 7 of the Ley de Informaciones Posesorias, possession respectful of natural resources must be established for at least 10 years before the creation of that protected wildlife area.
In other words, qualifying possession (posesión idónea) before 1984 must be established. * Having analyzed these statements, this Court observes that the three witnesses consistently and coherently describe possession sufficient to obtain title dating from a period more than ten years before 1984. This satisfies the requirement of article 7 ibídem regarding the period of possession that must be demonstrated when the property for which title is sought is located within a protected wildlife area or contains forested land. This issue will be addressed below in light of the appeal. * * * * * * * * * * IV- Regarding the appellant’s second ground of appeal, which alleges contradictions among the witnesses’ testimony, the contents of the public deed submitted, and the statements concerning the applicant for title’s period of possession: having analyzed the witness testimony given in these proceedings and cited in the preceding recital (considerando), the Court will compare it with the statements in the initial application and the public deed of acquisition to verify the contradictions alleged by the appellant entity.
In the initial application (folio 21), [Nombre1] stated that he was the possessor of unregistered land bounded to the north by [Nombre9], [Nombre20], and [Nombre21], to the south by [Nombre22] and the applicant for title, to the east by [Nombre23] and [Nombre24], and to the west by [Nombre1] and [Dirección8]. It has an area of 33 hectares 3.338, 01 square meters and survey plan (plano) P-845422-1989 dated 309 de agosto de 1989 in the applicant’s name. He stated that he had possessed the property in good faith (buena fe) since purchasing it by public deed n. 409 executed at 09:00 hours on 13 de octubre de 1987, which he submitted. He is the sole owner. He subsequently clarified that he acquired it from [Nombre6] (submission at folio 29). The cited deed (folios 27 and 28) contains a contract for the sale of possession and improvements (venta de posesión y mejoras) dated 13 de noviembre de 1987, under which [Nombre6] transferred to [Nombre1] the unregistered farm, consisting of pastureland, scrubland (charral), and wooded land.
It is located in Dulce Nombre de Paquera, [Dirección9], in the province of Puntarenas. It is bounded to the north by [Nombre9] and [Nombre10], to the south by [Nombre1], to the east by [Nombre21], and to the west by [Nombre13] and, in part, [Nombre25]. It measures approximately 45 hectares. The deed states that both parties waive future claims arising from any excess or deficiency in area. The seller stated that, through that act, he sold the possession he had exercised for more than ten years publicly, peacefully, uninterruptedly, and as owner (a título de dueño). In this Court’s view, the appeal must be denied with respect to the alleged discrepancies between the chain of possession described by the witnesses, the initial application, and the deed. The contract of sale for valuable consideration (contrato de venta a título oneroso) is consistent with the chain of possession described by the witnesses, insofar as [Nombre6] possessed the property beginning in 1968 according to [Nombre15] and [Nombre16], based on their having known the property for 40 years before giving their testimony, and beginning in 1973 according to the witness [Nombre7].
The first two witnesses identify [Nombre6] as the first possessor and state that he transferred it to [Nombre1] approximately 25 years ago (that is, around 1983). For his part, [Nombre7] also mentions [Nombre6] as the first possessor and then a person whom he identifies as [Nombre19], who was not mentioned by the other two witnesses, but he likewise states that [Nombre1] acquired it 25 years ago. This circumstance does not disprove that the chain of possession has been continuous from 1968 to the present or that [Nombre6] was the first identified possessor. The fact that the third witness names another person does not support the conclusion, in light of a comprehensive assessment of the evidence, that the land was not under possession. All the witnesses agree on the approximate dates and the persons who exercised dominion over the site in question. (See voto voto 874-F-08). In addition, the deed of sale from [Nombre6] to the applicant for title was executed in 1987, while the witnesses testified that the applicant purchased the property 25 years before their testimony, which indicates an approximate date of 1983.
Accordingly, under the system of free assessment of evidence (libre valoración probatoria) established by section 54 of the Ley de Jurisdicción Agraria and the rules of reasoned judgment (sana crítica racional), the witnesses provided an approximate period that, although not exact, differs by only four years and does not diminish the credibility or validity of their testimony; together with [Nombre8], this is understood to establish the chain of possession and the closely corresponding dates on which this longstanding possession was exercised. The ground of appeal concerning the discrepancies identified in the documents in the case file regarding the periods in which the farm was acquired is therefore denied. Thus, based on a comprehensive analysis and in accordance with the rules of article 54 of the Ley de Jurisdicción Agraria, this Court finds that the witnesses’ descriptions show that the applicant’s period of actual physical possession (posesión material) indeed dates from more than ten years before the creation of the protected wildlife area that partially affects the farm for which title is sought.
This follows from the statements made in each deposition. This Chamber does not understand there to be any genuine contradiction concerning the chain of possession described by the witnesses, since they were clear in their statements and did not contradict one another. The deed of sale described above was submitted, and it records the applicant’s instrument of acquisition (título de adquisición). Its contents are consistent with the statements of the witnesses already assessed, who referred to the applicant’s actual physical possession of the land through acts of cultivation, maintenance, and conservation of the existing forest resource. Because the sale document was submitted for the purpose of tacking the transferors’ possession (aprovecharse la posesión de los transmitentes), pursuant to section 1 of the Ley de Informaciones Posesorias, that possession is deemed proven and may be relied upon.
The ground of appeal raised by the Attorney General’s Office is denied. * * * * * * * * * * * * * * * * * V - Regarding the grievance concerning the nature of the land affected by the protected-zone designation and the findings certified in the soil studies issued. Protected wildlands (áreas silvestres protegidas), regardless of their management category (categoría de manejo), must be understood as areas subject to a particular and specific administrative and regulatory regime, governed by management plans that ensure the protection, conservation, and rational use of natural resources. Their administration, management, and protection * fall to MINAET, unless a special law provides otherwise. * Article 58 of the Ley de Biodiversidad defines them as delimited geographical areas consisting of land, wetlands, and portions of the sea, declared as such because they have special significance and warrant protection and conservation of the environment and its ecosystems, as well as of historical and cultural resources.
That provision expressly refers to the Ley Orgánica del Ambiente* for regulation of the requirements and mechanisms for establishing or reducing these areas. By law, their administration falls exclusively to the Ministerio de Ambiente, * Energía y Telecomunicaciones, except for Natural Monuments.* The Ley Forestal, in turn, provides that when state-owned land is declared a protected wildland, it must immediately become part of the Natural Heritage of the State (Patrimonio Natural del Estado), governed by Article 13 of that law, which expressly states that its administration falls to MINAET. This body of law must be interpreted in conjunction with Article 58 in fine of the Ley de Biodiversidad, which recognizes the vested rights (derechos adquiridos) of Indigenous and rural populations and natural or legal persons* over land declared to be protected wildlands and their management categories.
This is supplemented by Article 7 of the Ley de Informaciones Posesorias, which states: “When the property to which the possessory-information proceeding (información posesoria) relates is located within a protected wildland, regardless of its management category, the title applicant (titulante) must prove that he or she holds legal rights based on ten-year possession (posesión decenal), exercised for at least ten years before the effective date of the law or decree by which that protected wildland was created.” * In this specific case, the land for which title is sought is located within the Zona Protectora Península de Nicoya -Sector Buena Vista, created by Decreto Ejecutivo N.22968-MIRENEM of March 10, 1994. This means that, for it to be registered, possession dating back at least to March 1984 had to be established; this was proven in accordance with the preceding whereas clause (considerando).
Article 5 of the decree establishing the area states: “Privately owned land existing within the area shall be considered part of the Protected Zone when acquired by the State; until then, the owners shall enjoy all incidents of ownership.”* (emphasis not in the original). The Protected Zone management category was incorporated as [Nombre8] in subsection (b) of Article 32 of the Ley Orgánica del Ambiente. That legislation failed to define each of the classified categories * governed by that article, and the current Ley Forestal numero 7575 likewise contains no legal definition. The Ministerio de Ambiente y Energía, in turn, has defined them as: “land, mostly suitable for forestry, appropriate for timber production, on which management activities are carried out in accordance with sustainability criteria.” (Table of Management Categories, as defined by MINAE-SINAC, 2000). As a statutory antecedent, the repealed Ley Forestal número 4465 of November 25, 1969, defined a protected zone (zona protectora) in Article 83 as: “….those forest areas or forest lands which, established by provisions of law or by decree of the Executive Branch, are intended to protect soils, maintain and regulate the hydrological regime, or act as regulators of the climate or environment.” Subsequently, Ley Forestal 7174 defined it in the same terms, whereas, as noted, the current Ley Forestal número 7575 of February 13, 1996, refers neither to this management category nor to any other.
The Procuraduría General de la República, for its part, stated the following regarding the objective or purpose assigned to this management category: “Now then, Ley Forestal número 4465, both before and after its comprehensive amendment, assigned protected zones a clear environmental purpose, since they were established to protect vital natural resources such as soil and water through the conservation and protection of forest resources. The environmental legislation currently in force assigns this same objective to protected zones as a management category of protected wildlands, although it does not define the term.” (Opinion C-323-2004).* Similarly, Opinion C-16-2002 defined it as follows:* “The term ‘Protected Zone’ has been used in our legal system as a management category of protected wildlands whose primary purpose has been associated with protecting soil resources and the hydrological regime (springs (nacientes), protection areas (zonas de protección), watersheds (cuencas hidrográficas), etc.).”* This Court finds, based on its review of the witness testimony and the legal and technical references in the soil studies, that, because compliance with them has been established, it cannot * be concluded that the proceeding should be dismissed.
The title applicant’s conduct demonstrates that ownership was exercised in accordance with the recommendations of the soil specialist, so as to make rational use of soil resources, by eliminating practices that, although traditional in the area, such as livestock farming, are not an activity consistent with the classification assigned to that resource in that sector. As stated, fifty percent of the property lies within the aforementioned protected zone, in accordance with the certification appearing at folio 4. In the case under review, the land-use certification (certificación de uso de suelo) dated March 8, 2008 (folios 41 to 44), recorded the presence of pastureland in 5.65 hectares (16.97%), pastureland and forest in Sector B covering 17.15 hectares (51.51), and forest covering 2 hectares (6%), as well as 8.50 hectares (25.52%) of scrubland (tacotal). It stated that 43% of the land was in compliant use (uso conforme de suelo), while 57%, located in Sector B, was not.
Regarding the latter area, it explained that the land exhibited degradation-induced erosion because it had been subjected to extensive livestock farming. Cattle tracks and gullies leading to soil removal were observed. It was likewise noted that the spring protection areas had good forest cover (cobertura forestal), which had to be expanded to encompass the area specified in Article 33 of Ley Forestal 7575. It added that a two-hectare forest area protecting the spring was evident. It recommended eliminating livestock farming in Sector B and allowing natural forest regeneration in order to promote water capture by Quebrada Burío, a tributary of Río Ario. This was the activity most consistent with the characteristics of Sector B, classified as Class VI because of its steep slopes, together with maintaining the protection areas around bodies of water. Following that report, the judicial inspection (reconocimiento judicial) was conducted on November 12, 2008 (folio 94).
It recorded that the property had irregular topography, with steep slopes in certain sectors where no agricultural activities had been undertaken because of the rugged terrain. It noted that the area through which Quebrada Burío flows was protected. The property was described as consisting mainly of pastures divided into paddocks, except for the central portion, where a wooded area and a spring with abundant vegetation were located, as was also the case along the streams crossing and bordering the property. This inspection shows that the streams and springs had been protected with forest vegetation. In an order issued at 14:30 on November 12, 2008, the trial court stated that, in light of the observations made by the representative of the Procuraduría, the applicant was willing to comply with the technical recommendations of the Soil Certifier (folio 97). The applicant responded affirmatively in the filing at folio 100.
Another Land-Use Certification dated May 5, 2008 (folios 107 to 109), two months after the preceding one, was submitted, and it still did not certify compliant land use. Thereafter, a new soil study dated September 2013 was attached, showing that the property’s conditions differed from those described in the first and second reports. In [Nombre8], compliant land use was certified for one hundred percent of the property. It also showed a change in land uses to silvopastoral use, reforestation, secondary forest, brushland (charral), and scrubland. The document’s Observations stated that the property had low- to medium-intensity silvopastoral stocking, from 0.5 to 1.5 animals per unit of area, on pastures mixed with numerous forest species native to the area (Roble Sabana, Laurel, Pochote), representing a large amount of usable biomass. In addition, the owner had begun a teak reforestation project to restore areas unsuitable for livestock farming.
Of particular relevance, it states that because Sector D could not be used for livestock and could be devoted only to conservation, that activity had been discontinued several years earlier and the sector had been set aside for conservation through natural regeneration, with tall brushland and scrubland already present, leading to early successional stages of secondary forest for the purpose of protecting water, soil, flora, and fauna. Regarding Sector E, it states that, although the activity there had been livestock farming for years, this was the area where teak reforestation would be undertaken to expand the reforested area, because it was the steepest portion and still contained pasture. It adds that the areas containing forest resources within the property demonstrate conservation undertaken using the title applicant’s own resources. As a recommendation, it notes that Sector D should be reforested, as Sector B already had been, or allowed to recover naturally, as was being done at that time.
That area had been demarcated with a wire fence, while Sector E was being reforested with teak. It states that the forested areas that had been conserved should remain so and should be enclosed with physical boundaries to prevent cattle from entering. For this Court, the contents of the cited document establish compliant land use throughout the entire area of the title applicant’s parcel, including the portion outside the boundaries of the Protected Zone, since this was duly certified. The appellant asserts that possession in a manner safeguarding natural resources cannot be deemed proven in view of the findings in the land-use certifications cited above, and that the condition of ownership should have been established throughout the entire period required to obtain title.* This Chamber finds that the aforementioned witness testimony proved that livestock farming on the property began before fifty percent of the land became part of its current management category, and that title was acquired by adverse possession (usucapión) under those conditions in 1994, before the land was affected by the creation of the Protected Zone at issue and before the enactment of the Ley de Manejo Uso y Conservación de Suelos and its regulations.
It was established that, since the 1960s and 1970s, its original possessor, [Nombre6], had engaged in livestock farming. The restriction arose in 1994, and the witnesses instead stated that the intensity of livestock keeping was reduced. As noted above, the regulations governing soil use, management, and conservation date from the 1990s. Ley 7779 is dated April 30, 1998, as are its regulations.
It is therefore not possible to seek its retroactive technical application in order to demonstrate ecological possession (posesión ecológica). Moreover, the title claimant (titulante) has complied with the technical recommendations of the experts in soil-resource management, and what was found in sector B of the property in the first soil report does not mean that these proceedings should be denied, because it is an activity that has been carried out for decades on the property, which has always been used for livestock farming and grazing, as stated by the witnesses cited. The regulations governing soil use and management have only recently come into force; property owners should not be penalized for the use customarily or culturally made of the properties by their former possessors, although this does not mean that landowners are exempt from complying with the recommendations issued by the competent entities and from respecting the soil resource, which requires careful management because of its fragility.
In this case, the title claimant has complied with the technical recommendations issued by the person who conducted the soil study, which certified one-hundred-percent compliant use. It should be noted that compliance with the regulations and technical recommendations governing the use and management of the resource is mandatory. The title claimant shall be liable for any environmental damage that may be caused by the irrational use of this resource, a matter of which the claimant in these proceedings must be fully aware, and must follow the recommendations in the aforementioned soil study. This is in addition to the necessary oversight and monitoring that the competent environmental authorities are legally required to exercise. It bears repeating that, by 1994, the possessor had already acquired the right to obtain title by adverse possession (usucapir), and on that date the Ley de Manejo Uso y Conservación de Suelos had not yet been enacted.
In this regard, this Court has ruled: “IV. In decision Nº459-F-06 at 16 hours 15 minutes on 11 de mayo de 2006, the Court analyzed the issue of exercising possession in compliance with applicable requirements in relation to the certification issued by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria, as follows: ‘An analysis of the Ley de Uso, Manejo y Conservación de Suelos N° 7779 del 30 de abril de 1998 shows that this legislation does not require, as a condition for obtaining title through possessory-title proceedings (Información Posesoria), that a soil study be conducted to verify whether compliant soil use (uso conforme del suelo) has been observed, much less that recognition of the right of ownership be denied if possession is not currently exercised in accordance with the use to which the soil should be put. Accordingly, the state entity is incorrect in asserting that this requirement is contained in that statute.
What did occur is that Decreto N° 29375-MAG-MINAE-H-HACIENDA-MOPT del 8 de agosto del 2000, which promulgated the Regulations to that law, provides in Article 58: “In every possessory-title proceeding filed with the IDA or the Courts of Justice for the purpose of registration in the Public Property Registry, the interested party, in addition to the requirements imposed by the general regulations, must demonstrate through an appropriate soil study that possession has been exercised in compliance with the soil use appropriate for the activity being conducted, in accordance with the approved methodology, and that such activity has been carried out using best management practices and the best available technology, in compliance with Articles 3, 6, 12, 13, 19, 26, 27, 41, 43, and 64 of Ley N° 7779 and these Regulations”; Article 173 of those Regulations provided that they would enter into force upon publication. * IX.
It must be noted that, before the Regulations imposing that requirement entered into force (published in La Gaceta No 57 del 21 de marzo del 2001), the petitioner had already acquired the land at issue by adverse possession (usucapion), since [Nombre8] and, as previously stated, the possession personally exercised by the transferor [Nombre26] dates back to mil novecientos setenta y seis. * * X. From the cited Constitutional Chamber precedent, the following principle may clearly be inferred: OWNERSHIP IS ACQUIRED WHEN ADVERSE POSSESSION IS PERFECTED, REGARDLESS OF WHETHER OR NOT THE PROPERTY IS REGISTERED, SINCE OBTAINING TITLE IS MERELY THE FORMALIZATION OF THE RIGHT OF OWNERSHIP. XI. Under this interpretation, the Regulations cannot be applied retroactively to the detriment of rights already acquired because, since the right of ownership had been perfected by the date on which the compliant-soil-use requirement was introduced by regulation, the petitioner cannot be required to demonstrate that the possessory acts on which the requested title is based complied with those new regulations.
It should be noted that, when the adverse possession giving rise to the right of ownership was perfected, the petitioner’s transferor had exercised possessory acts in accordance with the requirements then in force for acquiring ownership. XII. The Ley de Uso, Manejo y Conservación de Suelos N° 7779 del 30 de abril de 1998 establishes in Article 6(a), as one of the specific functions of the Ministerio de Agricultura y Ganadería, the duty to “inspect, evaluate, and conduct, whenever it deems necessary, basic land-use studies to define agricultural uses, in accordance with the guidelines of the legislation in force concerning land-use planning”; and Article 41 provides: “Every natural or legal person, whether public or private, shall be required to promote, contribute to, and carry out all practices and activities necessary for soil management, conservation, and restoration. Therefore, cooperation and compliance with the measures issued by the Ministerio de Agricultura y Ganadería, in coordination with the Ministerio de Ambiente y Energía, for the purpose of managing, conserving, and restoring soil resources shall be mandatory.” Article 45 likewise provides that “natural and legal persons owning or possessing land suitable for agriculture are required to allow technicians authorized by the Comité del Area or the Ministerio de Agricultura y Ganadería to enter in order to verify the continued implementation of soil-management, conservation, and restoration practices.” Article 51 likewise provides that “any person who, by act or omission, violates the provisions of these regulations, including the purposes and objectives set forth in Chapters I and II of this law, shall be subject to the causes of action established under the criminal and punitive legislation in force.
The corresponding administrative legislation shall likewise apply to violations of administrative rules protecting public or private property against such acts and penalizing offenders.” * * XIII. Accordingly, it is evident that approval of the possessory-title proceeding does not prevent the relevant public entities (Ministerio del Ambiente y Energía or Ministerio de Agricultura y Ganadería) from monitoring this particular case in order to ensure fulfillment of the objectives and scope of the Ley de Uso, Manejo y Conservación de Suelos by applying the appropriate procedures. XIV. This is so because title to the property cannot properly be denied merely because compliant soil use is not currently observed in its entirety, since [Nombre8] and, as explained, the purpose of this possessory-title proceeding is to recognize a right of ownership that has already been perfected. Interpreting it otherwise would effectively entail denying a preexisting right of ownership due to failure to comply with a regulatory provision that may be enforced through the administrative mechanisms established by law.’ From the foregoing extensive opinion issued by this Court, it is clear that a requirement concerning soil management cannot be imposed when adverse possession had already been perfected by the time the law under review entered into force.
In this matter, the period of the petitioner’s possession, added to that of its prior transferors, far exceeds the required period; see in this regard the testimony of [Nombre27], [Nombre28], and [Nombre29] (folios 35 to 38). The witnesses consistently stated that they knew the property and explained the chain of transferors in detail, demonstrating that, by the time the cited law and its regulations entered into force, the right of ownership asserted in these proceedings had already been perfected. It should be noted that, in the matter before the Court (subjúdice), the certification expressly states that possession was exercised in compliance with applicable requirements; the requirement has therefore been satisfied. It is also evident that the professional responsible for conducting the fieldwork and issuing the document recommended: “Exclude [Dirección10] of the property from livestock activity, [Nombre8] and as described in the attached sworn statement (declaración jurada).” It is therefore clear that monitoring and inspection are the responsibility of the Ministerio del Ambiente, Energía y Telecomunicaciones or the Ministerio de Agricultura y Ganadería, which is legally obligated to perform them.
Imposing a new certification, as requested by the state representative, is contrary to the requirements established by law and could infringe the governed parties’ fundamental right of access to justice. As explained above, the petitioner proved compliant use; therefore, as to the matters appealed, the ruling must be affirmed.’ (voto 078-F-09). In another respect, the appellate argument that approval was granted on the basis of a future reforestation project is likewise unpersuasive, because it was certified that the respective boundaries of the areas to be reforested already exist on the land. It is important to emphasize that the technical prohibition on livestock farming does not apply to the entire property, but rather to the areas already identified and demarcated in the field, which must be devoted to natural regeneration or reforestation through planting by the title claimant. This follows from the content of the latest Soil Study, which states that the process has already begun, and the appellant submitted no evidence refuting it (Article 317 of the Código Procesal Civil, applied supplementarily). * * * * * * * * * * VI- Furthermore, the appellant’s argument concerning the inadvisability of reforesting with Teca is not accepted, given that decree N. 23214-MAG-MIRENEM states that the forest species Teca and Melina, in pure plantations, are unsuitable for slopes because they accelerate erosion processes and would be suitable only for soils with moderately rolling to rolling terrain.
This decree is entitled Metodología Determinación Capacidad Uso Tierras Costa Rica, published in La Gaceta N. 107 on: 06/06/1994. Regarding the soil of the sector identified as VI in the Soil Study, it states: " 3.6 Class VI.* Lands within this class are used for forest production, as well as for permanent crops such as fruit trees and coffee, although the latter require intensive soil- and water-management and conservation practices. However, certain forest species, such as Teca (Tectona grandis) and Melina (Gmelina arborea), in pure plantations, are unsuitable for the slopes in this class because they accelerate soil-erosion processes; therefore, this type of use is recommended only on moderately rolling to rolling terrain.* The limitations that may occur, individually or in combination, are: strongly rolling terrain, severe prior erosion, moderately deep soils, soil textures ranging from very fine to coarse, subsoil textures ranging from very fine to moderately coarse, very stony soils, very low fertility, severe toxicity, moderate salinity, moderately excessive or moderately slow drainage, moderate flood risk, dry and pluvial life zones except páramo, a severe or absent dry season, and moderate fog and wind conditions." In this case, its assertion runs counter to the technical opinion of the soil certifier, who found the practice consistent with the land use (uso de suelo).
This may be understood in light of the combination of limitations in that area that allow such a practice. This Court finds no reason why a recommendation contained in a decree, rather than a prohibition, should diminish the scientific value of a field study conducted by a professional accredited before the authority competent in soil use, management, and conservation, in which the property’s actual limitations were considered. It should be noted that this Metodología is a technical standard adapted to the reality applied by professionals in the field of Environmental Law, unlike the legal rules of Law itself, which are interpreted differently. In Environmental Law, the principle of technical and scientific judgment prevails, and legal practitioners must interpret it accordingly. The record contains no notice from any competent environmental oversight authority instructing the applicant for title not to introduce that forest species, nor any other element suggesting that it is unsuitable so as to cast doubt on its scientific basis.
The ground of appeal (agravio) is rejected.* The argument that the new survey plan submitted under number P-1823065-2015 (folio 242) depicted the property as pastureland likewise fails, because, as observed by the soil-use certifier and the adjudicating judge, it has already been established that the existing forest cover (cobertura forestal) actually exists, the spring (naciente) and stream were depicted, and they are duly protected by sufficient forest cover. Neither the appellant entity nor any interested party has submitted any evidence that the applicant or the prior possessors were notified, sanctioned, or found responsible for violating national environmental protection regulations, from which it could be inferred that they breached their obligation to exercise possession (posesión) in a manner respectful of natural resources when possessing real property subject to environmental restrictions, given the nature of that property; moreover, the activity found in one sector of the property that was not recommended has been corrected.
It is relevant to note that no land-use change (cambio de uso de suelo) detrimental to the environment ever occurred on the property for which title is sought, from before the creation of the Zona Protectora management category (categoría de manejo) at issue through the present, or at least no evidence to that effect appears in the record. Its claims are therefore without merit. It should be noted that each management category has its own technical and scientific purposes, and the existence of any such category cannot be understood as absolutely excluding human production or recreational activities. Those activities are defined in the respective land-use plans (planes de ordenamiento territorial) for each category. In this case, the ground of appeal under consideration lacks proper substantiation as to why the appellant believes that the existing activities, through the current actions, impair the purposes of that zone, and which directives, orders, or provisions of that area’s management plan have been violated.
It must not be forgotten that, pursuant to Article 82 of the Ley de Conservación de Vida Silvestre and regarding its use and exploitation, in decision N. 144-96 at 16:51 hours on January 9, 1996, the Sala Constitucional de la Corte Suprema de Justicia held: " When forest reserves, protective zones, and national wildlife refuges are established, the owner is given the option of retaining the land because, by following the management plan, the owner may continue to exploit it economically; that is, the restrictions imposed are not of such [Nombre8] magnitude as to prevent the owner from exploiting the property and therefore do not render that right ineffective." SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciséis horas y quince minutos del treinta y uno de mayo del año dos mil dieciocho.-* * * * * * * * * * * * * * * * * * * PROCESO DE INFORMACIÓN POSESORIA promovida por [Nombre1] , mayor, casado una vez, agricultor, vecino de Paquera, Puntarenas, cédula de identidad CED1 - - . Intervienen como partes la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por la licenciada* Susana Fallas Cubero, mayor, casada, abogada, vecina de San José, cédula de identidad CED2 - - , en su condición de procuradora,* y el* INSTITUTO DE DESARROLLO RURAL, cédula* jurídica* CED3 - - - , representada por su apoderada general judicial* Marjorie Mayela Madrigal* Muñoz, mayor, casada, Abogada, vecina de San Ramón, Alajuela, cédula CED4 - - . Actúa como apoderada especial judicial de la parte promovente, el licenciado Juan Carlos Fonseca Herrera, carné uno dos cero uno cinco.
Tramitado ante el* Juzgado Agrario de Puntarenas.-* RESULTANDO* * * * * * * * * * 1.- La parte promovente interpuso el presente* proceso de información posesoria para que por medio de esta vía se proceda a inscribir en el Registro Público de la Propiedad una finca* que se describe así:* "NATURALEZA: repasto* y tacotal,* SITUADO: provincia de Puntarenas, cantón primero,* Puntarenas, Distrito [Dirección1],* LINDEROS: NORTE: Tronco Negro Vista Hermosa* S.A., [Nombre2] y [Dirección2] , ;* SUR: [Nombre3] , [Nombre4] y* Cabo Norte de Santa Teresa S.A.;* ESTE: [Nombre3] y [Nombre5] ;* y OESTE: Cabo Norte de Santa Teresa* S.A, MIDE: trescientos treinta y ocho mil* seiscientos ochenta y seis metros cuadrados,* PLANO CATASTRADO: P - uno ocho dos tres cero seis cinco - dos cero uno cinco (1823065-2015).", (folios 21 a 23 y 243 a 244).-* * * * * * * * * * 2.-* * La Procuraduría General de la República se apersonó al proceso en los términos visibles a folios 52 a 54; a su vez el Instituto de Desarrollo Rural, se apersonó al proceso en los términos visibles a folio 63 y 274.-* * * * * * * * * * 3.-* La jueza Edith Brenes Quesada, del Juzgado Agrario de Puntarenas, mediante la sentencia* N° 2018000030 de las* diecisiete horas y treinta y seis minutos del veintiuno de marzo de dos mil* dieciocho, resolvió: “POR TANTO: "De acuerdo a lo expuesto y citas de ley, SE APRUEBAN las presentes* diligencias de información posesoria, trámite que cumplió apegado a la Ley de* Informaciones Posesorias número ciento treinta y nueve del catorce de julio de mil* novecientos cuarenta y uno, sus reformas y adiciones, y la Ley de Jurisdicción Agraria* número seis mil setecientos treinta y cuatro del veinticinco de marzo de mil novecientos* ochenta y dos y sus reforma.- En consecuencia: Libre de gravámenes y cargas reales* y sin perjuicio de terceros de mejor derecho, proceda el Registro Público Sección* Registro Inmobiliario, inscribir por partes iguales y a nombre d [Nombre1] ,* cédula de identidad CED5, el siguiente fundo sin inscribir, descrito en el plano* catastrado número P-UNO OCHO DOS TRES CERO SEIS CINCO DOS MIL QUINCE* (1823065-2015), con fecha del veintitrés de octubre de dos mil quince, el cual* corresponde al terreno situado en la provincia de Puntarenas, [Dirección3] ,* Puntarenas, [Dirección4] , cuya medida es de trescientos treinta y ocho mil* seiscientos ochenta y seis metros cuadrados; su Naturaleza es terreno de repasto* y tacotal y tiene los siguientes linderos: al al NORTE: Tronco Negro Vista Hermosa* S.A., [Nombre2] y [Dirección5] , al SUR: [Nombre3] , [Nombre4] y* Cabo Norte de Santa Teresa S.A. al ESTE: [Nombre3] y [Nombre5] y al OESTE: Cabo Norte de Santa Teresa* S.A.- El proceso se estimó en la suma de DIEZ MILLÓN DE COLONES.
El inmueble* queda afecto a las reservas en cuanto al derecho de vía de las calles públicas,* conforme lo dispone el artículo cuatro de la Ley General de Caminos Públicos y* diecinueve inciso a) de la Ley de Informaciones Posesorias.- Asimismo al ser una área* que se encuentra dentro de una zona protectora queda afectada a las limitaciones de la* Ley Forestal Nº 7575, por lo que queda prohibida la corta o eliminación de árboles en* ese sector (artículos 33 y 34), además el cauce, las aguas y la naciente de la quebrada* sin nombre así como quebrada Burio esas corrientes y demás aguas superficiales y/o* subterráneas existentes en el inmueble son de dominio público y no forman parte de la* finca (Ley de Aguas, artículo 1 inciso IV y 3 inciso III).- Una vez firme esta resolución y* a solicitud de la parte interesada, expídase la ejecutoria correspondiente.",* (Ver escritorio virtual del Juzgado Agrario de Puntarenas, documento asociado en fecha* 21/03/2018 a las 17:36:24).-* * * * * * * * * * 4.- La licenciada Susana Fallas Cubero, en su condición de procuradora, interpuso recurso de apelación* con indicación expresa de las razones en que se fundamenta para refutar la tesis del juzgado de instancia, (Ver escritorio virtual del Juzgado Agrario de Puntarenas, escrito incorporado en fecha 03/04/2018 a las 9:32:17).-* * * * * * * * * * 5.- En la substanciación del proceso se han observado las prescripciones legales, y no se nota la existencia de errores u omisiones capaces de producir la nulidad del fallo.- * * * * * * * * * * * Redacta la jueza Castro García;y,* CONSIDERANDOS:* * * * * * * * * * I-Hechos probados.* * Se avalan los hechos probados de la sentencia recurrida por contener prueba que les da sustento. * * * * * * * * * * II- El ente procurador interpone recurso de apelación (escritorio virtual/ escritos/fecha 03/04/2018 09:31:50)* contra la sentencia N. 2018000030 de las 17:36 horas del 21 de marzo del 2018 (expediente digital/ documentos/fecha 21/03/2018 17:36:24).
Como reproches invoca: 1) Se pretende titular un fundo ubicado dentro de la Zona Protectora* Península de Nicoya, creada mediante Decreto Ejecutivo No. 22968-MIRENEM (vigente* desde el 10 de marzo de 1994). * En el escrito inicial y copia de la escritura No. 409, el* promoverte adquirió en el año 1987* de [Nombre6] . Reprocha, * esto no coincide con las declaraciones testimoniales, según las cuales la* transmisión fue en 1983. El declarante [Nombre7] manifestó que el* titulante adquirió de [Nombre8][Nombre8] . Reclama, en la sentencia recurrida se soslayan esas falencia de la prueba testimonial, cuando se señala por ellos que la fecha de compra es de "referencia", no obstante. Pero de las declaraciones no se extrae una fecha similar a la del documento de traspaso. Estima que no se justifica * el motivo por el cual se tiene acreditada * * la cadena de* transmisión. Menciona, es criterio del Tribunal Agrario debe existir congruencia entre las* declaraciones testimoniales y los documentos aportados, como para dar validez a la posesión transmitida y para que merezcan la* credibilidad del juzgador.
Cita diversos al respecto. 2) Existe una falta de correspondencia entre la cabida y * los linderos naturales del inmueble de este proceso: 33 hectáreas 8666 metros cuadrados. [Nombre9] al * norte en parte con quebrada sin* nombre; al oeste con quebrada [Dirección6] y [Dirección7] , ambos en parte. En la escritura CED6. se describe una cabida de 45 hectáreas. Colinda al norte solo con [Nombre10] ; al oeste * [Nombre11][Nombre12][Nombre13] y [Nombre14] . Lo que * Impide establecer una* identidad entre los terrenos y aprovechar esa escritura como documento de traspaso. Transcribe parcialmente diversas sentencia de esta Sede. Afirma, no se analiza adecuadamente este punto y se omite * mención sobre la falta de coincidencia entre los linderos naturales, y carece de* fundamento la presunción de que la diferencia de cabida se explica por el desconocimiento de la medida exacta.* 3)* Acusa se probó que a lo largo de la ocupación* sobre el inmueble, no se había procurado un ejercicio tendiente a la protección de los* recursos naturales a desarrollarse * en los bienes situados * dentro de las áreas* silvestres protegidas como en este caso, y lo hizo hasta hasta que le fue requerido por el* Despacho.
Cita parte de voto del Tribunal. Expone, la protección ambiental se debe desplegar durante todo el tiempo* de posesión hasta el presente. No alentarse se limite al periodo durante el cual* se tramita el proceso. Aduce, en autos constan * tres certificaciones de estudio de uso del* suelo. La primera visada el 13 de marzo del 2008, que certificó un uso no* conforme en un 57% del terreno, debido a que en el sector B* * que corresponde a ese* porcentaje de terreno en una unidad de manejo W, tiene erosión severa 'que evidencia la fuerte degradación de esta unidad de manejo, cuando la misma es sometida a la actividad ganadera extensiva.." . Agrega, se consignó que la cobertura forestal de las* nacientes no cumple con lo establecido en la Ley Forestal, artículo 33 y refiere a las observaciones del documento. Reprocha, el Decreto NO. 23214-MAG-MIRENEM del 13 de abril de 1994,* establece sobre la* unidad de manejo VI: "* las tierras ubicadas dentro de esta clase son utilizadas para la producción forestal, así como cultivos permanentes tales como frutales y café, aunque estos últimos* requieren prácticas intensivas de manejo y conservación de suelos yaguas ... * ".
Indica, el mismo estudio recomendó "eliminar la actividad ganadera en el sector B y* dejar esos terrenos en regeneración natural forestal. Señala, en la segunda certificación del 15 de mayo del 2008, 2* meses después de la primera, indica que el uso no conforme pasó a ser en el 91.1% de la propiedad, determinándose el uso de pasturas en todo ese porcentaje, que evidencia " síntomas severos de erosión con la presencia de trillos de 30 a 40 centímetros de profundidad y algunas pequeñas cárcavas"* (apartado de observaciones en folio 107). Se recomendó en* todo ese sector 'eliminar la actividad de pastoreo" (follo 108. Argumenta, de ese 91.1%, el 57.18% corresponde a la unidad de manejo va cuyas* limitaciones citó líneas arriba, y el restante 33.91% corresponde a la unidad de* manejo VII, que tiene limitaciones tan severas que sólo permiten el manejo del bosque natural primero o secundario (Decreto No.* 23214-MAG-MIRENEM).
Agrega, a pesar de lo anterior, en la tercera certificación del 22 de octubre* del 2013, se consignó que aún se realiza actividad ganadera, pues al menos en el* 60% tiene un uso actual silvopastoril con una carga Importante de animales,* incumpliéndose la recomendación dada por el Departamento de Servicios Técnicos del* INTA. Pero de forma extraña se certificó un uso conforme en todo el área, basándose además* en actos que no se han realizado (siembra de árboles para el* próximo año según las recomendaciones. Esboza, en el estudio con fecha 15 de mayo del 2008 (el segundo certificado), se consideró que un 33.91% del área tiene pendiente escarpada y el resto* una pendiente fuertemente ondulada, pero curiosamente en el tercer estudio se habla de apenas un* 15% de superficie es de condición escarpada (sea menos de la mitad), y otros sectores son* tierras onduladas moderadamente y fuertemente onduladas.
Hace qué, el plano No. P-1823065-2015 del 19 de mayo del* 2015, describe casi la totalidad del terreno como repasto y según certidicado de uso de suelo * en sectores donde* el tercer estudio de uso del suelo calificaba como reforestación, bosque* secundario y en el sector E, donde se Iba a efectuar la supuesta futura reforestación con teca* (que consta en mapa adjunto al estudio). Menciona, el Decreto No. 23214-MAG-MIRENEM* no recomienda la plantación de la especie teca en relieves fuertemente* ondulados, como en el caso de esa zona E. Aduce, * las prácticas ejercidas sobre de terreno se contraviene lo establecido en el* artículo 102 del Reglamento a la Ley de Uso, Manejo y Conservación de Suelos, Decreto* Ejecutivo No. 29375 MAG-MINAE-S-HACIENDA-MOPT * * * * * * * * que reza: "Los propietarios, arrendatarios o poseedores de tierras por cualquier título tienen la obligación * de realizar el manejo de sus fincas, según la mejor tecnología disponible para prevenir la degradación, erosión y contaminación de suelos y aguas ".
Reprocha, este Tribunal Agrario ha analizado que el ejercicio de un uso conforme del suelo* antes y después de la creación del área silvestre protegìda es requisito pan garantizar la* adecuada protección de los recursos naturales, que a su vez es presupuesto para titular * y* que la actividad ganadera no es compatible con la conservación. Hace notar, los testigos confirmaron que el terreno es dedicado a la ganadería y* repastos. Acusa, en la pieza apelada no se analizan todos los aspectos expuestos en* este tema que se habían reclamado y se limitó el a quo a tomar como referencia solamente el último de los estudios. Sin ver el tema de la desprotección de los recursos que se ha* dado en el terreno que se quiere titular. Solicita se revoque la sentencia y se deniegue el proceso. * * * * * * * * * * III- El artículo sétimo de la Ley de Informaciones Posesorias estableció a partir de su entrada en vigencia el 13 de febrero de 1996 por reforma de la Ley Forestal N. 7575., la posibilidad expresa de titular terrenos ubicados dentro de áreas silvestres protegidas siempre que se demuestre la posesión diez años antes de la creación de esa zona en cualquiera de las categorías de manejo.
Dicho artículo ha sido, en dos ocasiones, cuestionado ante la Sala Constitucional y se ha rechazado la declaratoria de su inconstitucionalidad dejando vigente así esa norma, sin que ningún órgano judicial pueda desconocer su vigencia. (ver última consulta constitucional en Sentencia N.01667 del * 27/01/2010 de las 15:11: de la Sala Constitucional). Sobre la posesión, el representante de la Procuraduría General de la República apela, las declaraciones de las personas testigas no resultan útiles a fin de demostrar la posesión ejercida por el promovente y sus transmitentes. Reprocha, debido a contradicciones con el escrito inicial. la escritura de venta aportada y lo declarado por los testigos, donde no existe coincidencia de la fecha de adquisición del inmueble por el titulante. Consta que en audiencia de recepción de prueba del 11 de noviembre del 2008 (folio 91), se levantaron actas de las declaraciones testimoniales * de [Nombre15] (folio 91), [Nombre7] (folio 92) y [Nombre16] (folio 93).
El testigo [Nombre17] declaró tener 63 años y conocer el fundo desde hacía 40 años. Explica, le pertenecíó a [Nombre6] que lo traspasó al promovente 25 años antes aproximadamente. [Nombre5], se dedicaba a ganadería en mayor intensidad en el pasado, y ahora en menor escala. Se ha mantenido cercada y contiene una naciente veranera en donde se ubica una "montañita" que se ha mantenido siempre para preservarla. Existe una casa donde habitó el promovente con su familia. Afirmó nunca supo de conflicto por la posesión del fundo, que ha sido pacífica y se le reconoce al titulante como el dueño. Este testimonio describe una cadena posesoria de forma contínua desde el año 1968 dado lo indicado en cuanto el conocimiento de la parcela, primero a favor de [Nombre6] y en forma posterior [Nombre1] (promovente). Aunado a lo anterior, se indicó que ha sido desarrollada por esas dos personas actos de ganadería y conservación de naciente y cobertura boscosa e indicando que la actividad ganadera era en menor intensidad que en el pasado.
El testigo [Nombre16] , declaró conocer el fundo desde hacía 40 años (1968), época en que la finca le pertenecía a [Nombre6] quién se la transmitió a [Nombre1] que la ha poseído por 25 años en forma aproximada. Señalo el uso dado en el pasado era en parte pastos y cultivo de arroz, frijoles y maíz. Indicando que actualmente solo pastos y la conservación de la montaña existente. Con casa de habitación de antigüedad y debidamente delimitada la parcela. Citó, no existen nacientes pero hay dos quebradas pequeñas. Se da mantenimiento de chapia malezas en los pastos y se ha conservado la parte de montaña. Cita, desconoce de problema alguno en virtud de la posesión que ha sido pacífica siempre y en la comunidad se le reconoce como dueño al titulante. Para este Tribunal este testigo coincide con lo indicado con el anterior en cuanto el dueño hace 40 años lo fue [Nombre6] que lo transmitió a [Nombre18] 25 años antes.
Igualmente que se ha ejercido una posesión pacífica y pública, dado que se reconoce como le dueño al actual titulante. Sobre los actos desplegados señala se ha dedicado a pastos y la conservación de los cuerpos de agua que califica como quebradas pequeñas. Ahora bien, el testigo [Nombre7] afirmó conocer el terreno 35 años, por visitar a [Nombre1] y su familia en virtud de ser Testigo de Jehová y frecuentarlo. Citó, cuando conoció al finca le pertenecía a [Nombre6] , y luego paso a manos de [Nombre8] . Posteriormente señala que se adquiere por el titulante hace unos 25 años. Describió que se dedicó ese terreno a repastos, arroz, frijoles y actualmente a repastos. Finca cercada, con casa de habitación, que ha estado ocupada. NO ha visto nacientes pero si unas "quebradillas" dentro. Se da asistencia a la finca con chapias y se conserva la parte montañosa. Nunca se ha percatado de problemas por la posesión, que ha sido pacífica y se le conoce en la población al promovente como el dueño.
Este testigo coincide en todos los aspectos declarados con los anteriores, salvo que incorpora en la cadena posesoria a una persona que identificó como [Nombre19] que no fue citado por los otros dos declarantes. Cabe reiterar que al estar inmersa la finca dentro de la Zona Protectora Península de Nicoya-Sector Buena Vista por decreto N. 22968-MIRENEM del 10 de marzo de 1994 y acorde con el artículo 7 de la Ley de Informaciones Posesorias, se debe acreditar una posesión en respecto de los recursos naturales al menos 10 años antes de la creación de esa área silvestre protegida. Es decir, se debe acreditar una posesión idónea anterior al año 1984. * Analizadas estas declaraciones, observa este Tribunal que los tres testigos son coincidentes y congruentes en describir una posesión idónea para titular que data de un periodo mayor al decenal antes de 1984. Cumpliendo con la exigencia del artículo 7 ibídem respecto del tiempo a demostrarse en posesión en caso de ubicarse el fundo a titular dentro de un área silvestre protegida o con terrenos boscosos.
Tema a desarrollarse adelante dado lo apelado. * * * * * * * * * * IV- Sobre el agravio segundo del apelante que ataca contradicciones de lo declarado por los testigos, el contenido de las escritura pública aportada y manifestaciones del período de posesión del titulante. Analizadas las declaraciones testimoniales vertidas en este proceso ya citadas en el considerando anterior, se procede a contrastarlas con las manifestaciones del escrito inicial y la escritura pública de adquisición a fin de verificas las contradicciones acusadas por el ente apelante. En el escrito inicial (folio 21), se indicó por [Nombre1] e poseedor de terreno sin inscribir que [Nombre9] al norte con [Nombre20] y [Nombre21] , al sur con [Nombre22] y el titulante, al este con [Nombre23] y [Nombre24] y al oeste con [Nombre1] y [Dirección8] . Canbida de 33 hectáreas 3.338, 01 metros cuadrados y con plano P-845422-1989 del 309 de agosto de 1989 a nombre del promovente.
Describe ha poseído de buena fe el fundo a partir de la compra suscrita en escritura publica n. 409 de las 09:00 horas del 13 de octubre de 1987 que aportó. Es el único propietario. Aclara luego que adquiere de [Nombre6] (memorial a folio 29). La escritura citada (folio 27 y 28) contiene un contrato de venta de posesión y mejoras del 13 de noviembre de 1987, en donde [Nombre6] le transmite a [Nombre1] la finca sin inscribir que es terreno de pastos, charral y montaña. Sito en Dulce Nombre de Paquera, [Dirección9] de la provincia de Puntarenas. [Nombre9] al norte con [Nombre10] , al sur [Nombre1] , al este con [Nombre21] y al oeste con [Nombre13] y [Nombre25] en parte. Con medida aproximada de 45 hectáreas. Indicándose que ambas partes renuncian a reclamos futuros por exceso o disminución de área. Manifestó el vendedor que por este acto vende la posesión ejercida por un espacio mayor a los diez años en forma pública, pacífica, ininterrumpida y a título de dueño.
Para este Tribunal sobre las disconformidades respecto de la cadena posesoria entre lo citado por los testigos, el escrito inicial y la escritura ha de denegarse lo apelado. El contrato de venta a título oneroso se muestra coincidente con la cadena posesoria descrita por los testigos, en cuando se poseyó la heredad por [Nombre6] desde el año 1968 para [Nombre15] y [Nombre16] dado su conocimiento del fundo 40 años antes de su declaración y desde 1973 por el testigo [Nombre7] . Los dos primeros testigos citan como el primer poseedor a [Nombre6] y que éste le transmite hacia 25 años a [Nombre1] (sea aproximadamente en 1983). Por su parte, [Nombre7] menciona también como el primer poseedor a [Nombre6] y luego a una persona que identifica como [Nombre19] no mencionado por los otros dos, pero indica también que hace 25 años adquiere [Nombre1] . Esta situación no conlleva a desvirtuar que la cadena de posesión ha sido continua desde 1968 hasta la actualidad, y que [Nombre6] fue el primer poseedor identificado.
El hecho de que ese tercer testigo nombre a otra persona no afecta, en vista de la valoración integral de la prueba que se entienda el terreno no ha estado sometido a posesión. Pues todos son contestes en las fechas aproximadas y las personas que ha ejercido el dominio sobre el sitio en cuestión. (ver voto voto 874-F-08). En abono a lo anterior, se tiene que la escritura de venta de [Nombre6] al titulante se otorga en el años 1987 y acorde con lo depuesto por los declarantes, refieren a que el promovente compra 25 años antes de su declaración, lo cual refleja una fecha aproximada correspondiente a 1983. Por lo que en aplicación del sistema de libre valoración probatoria del ordinal 54 de la Ley de Jurisdicción Agraria, y las reglas de la sana crítica racional se da un periodo aproximado por los testigos, que si bien no es exacto la diferencia de cuatro años no resta credibilidad y validez a su testimonio y con [Nombre8] se entiende que se comprueba la cadena posesoria y las fechas cercanas del ejercicio de la posesión que es de vieja data.
Por lo que se rechaza el agravio de las disconformidades apuntadas en las piezas del expediente, respecto a los periodos de adquisición de la finca. Por lo que, al amparo del análisis integral y acorde con las reglas del artículo 54 de la Ley de Jurisdicción Agraria, estima este Tribunal que de lo descrito por las personas testigas se nota que efectivamente el plazo de posesión material del promovente data de más de diez años anteriores a la creación del área silvestre protegida que afecta parcialmente la finca que se solicita titular. Ello se deduce de lo citado en cada deposición. No entiende esta Cámara medie una contradicción real en cuanto a la cadena posesoria que describen los testigos pues fueron claros en sus afirmaciones, sin que se contradijeran entre ellos. La escritura de venta descrita se aportó y se hace constar por el promovente el título de adquisición. Cuyo contenido coincide con lo indicado por los testigos ya valorados, cuando refieren a una posesión real y material del promovente en el terreno ejerciendo actos de cultivo, mantenimiento y conservación del recurso forestal existente.
Por lo que al haberse aportado el documento de venta a efectos de aprovecharse la posesión de los transmitentes, al tenor del ordinal 1 de la Ley de Informaciones Posesorias, se tiene por probada y puede ser aprovechada. Se rechaza el agravio del ente procurador. * * * * * * * * * * * * * * * * * V - Sobre el agravio respecto a la naturaleza del terreno afectado a zona protectora y lo certificado en el estudio de suelos emitidos. Sobre las áreas silvestres protegidas, independientemente de su categoría de manejo, deben ser entendidas como zonas con un régimen de administración y normativa particular y específica, supeditadas a planes de manejo que aseguran su protección, conservación y uso racional de los recursos naturales. Recae * en el MINAET su administración, manejo y tutela, salvo Ley especial que indique otra situación. * El artículo 58 de la Ley de Biodiversidad, las define como zonas geográficas delimitadas, que se forman de terrenos, humedales y porciones de mar, declaradas como tales por representar una significancia especial, un interés de tutela y conservación del ambiente y sus ecosistemas, así como históricos y culturales.
Esta norma hace una remisión expresa a la Ley Orgánica del Ambiente* sobre la regulación de los requisitos y mecanismos para el establecimiento o reducción de estas áreas. La administración por Ley recae en forma exclusiva sobre el Ministerio de Ambiente, * Energía y Telecomunicaciones, salvo los Monumentos Naturales.* Por su parte, la Ley Forestal prevé que cuando se declare un área silvestre protegida de propiedad estatal, ésta debe pasar en forma inmediata a formar parte del Patrimonio Natural del Estado, regulado por el artículo 13 de la citada norma que expresamente señala que su administración corresponde al MINAET. Ese conjunto normativo debe interpretarse con lo prescrito en el artículo 58 in fine de la Ley de Biodiversidad, que reconoce los derechos adquiridos por poblaciones indígenas, campesinas, personas físicas o jurídicas,* sobre los terrenos que sean declarados áreas silvestres protegidas y sus categorías de manejo.
Ello se complementa con el artículo 7 de la Ley de Informaciones Posesorias cuando indica: "Cuando el inmueble al que se refiera la información posesoria esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser el titular de los derechos legales sobre posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre." * En el caso concreto estamos ante un terreno que se piden titular, ubicado dentro de la Zona Protectora Península de Nicoya -Sector Buena Vista creada por decreto ejecutivo N.22968-MIRENEM del 10 marzo de 1994. Lo que conlleva a entender que para poder ser inscrito debió acreditarse una posesión al menos desde el mes de marzo de 1984; lo que se probó acorde con lo expuesto en el considerando anterior. El decreto de creación indica en el artículo 5: "Los terrenos privados existentes en el área se considerarán parte de la Zona Protectora cuando el Estado las adquiera, mientras tanto los propietarios gozarán de todos los atributos del dominio".* (negrita no corresponde al original).
La categoría de manejo de Zona Protectora, se incorporó como [Nombre8] en el inciso b) del artículo 32 de la Ley Orgánica del Ambiente. Dicha normativa omitió definir el concepto de cada una de las categorías clasificas * que reguló dicho numeral y la actual Ley Forestal numero 7575 tampoco cuenta con una definición legal. Por su parte, el Ministerio de Ambiente y Energía las ha definido como: " como terrenos, en su mayoría, de aptitud forestal, apropiados para la producción de madera, en los cuales se ejecutan acciones de manejo con criterios de sostenibilidad.” (Cuadro sobre categoría de Manejo, definidas por MINAE-SINAC, 2000). Como antecedente normativo, la Ley Forestal número 4465 del 25 de noviembre de 1969 derogada, definió a la zona protectora en el artículo 83 como: “….aquellas áreas de bosques o terrenos forestales que, establecidas por disposiciones de la ley o por decreto del Poder Ejecutivo, sean destinadas a proteger los suelos, mantener y regular el régimen hidrológico, o actúen como agentes reguladores del clima o medio ambiente.”.
Posteriormente, la Ley Forestal 7174 la definió en los mismos términos indicados, mientras que, como fue señalado, la Ley Forestal vigente número 7575 del 13 de febrero de 1996, no hace referencia ni a ésta categoría de manejo, ni a ninguna otra. Por su parte, la Procuraduría General de la República, indicó sobre el objetivo o propósito asignado a esta categoría de manejo: "Ahora bien, la Ley Forestal número 4465, antes y después de su reforma integral, asignaban a las zonas protectoras un claro propósito ambiental, pues la mismas se constituían con el objetivo de proteger recursos naturales vitales como el suelo y el agua mediante la conservación y protección de los recursos forestales. La legislación ambiental actualmente vigente asigna este mismo objetivo a las zonas protectoras, como categoría de manejo de las áreas silvestres protegidas, aunque no defina el término.”(Dictamen C-323-2004).* En igual sentido, por dictamen C-16-2002 se definió:* “El término de “Zona Protectora” ha sido usado en nuestro ordenamiento jurídico como una categoría de manejo de áreas silvestres protegidas cuyo fin primordial ha estado asociado con la protección del recurso suelo y del régimen hidrológico (nacientes, zonas de protección, cuencas hidrográficas, etc)”.* Estima esta sede, del estudio de las declaraciones testimoniales y las referencias normativas y técnicas de los estudios de suelo, al demostrarse que han sido acatadas no se * concluye deba rechazarse el proceso.
Pues con la conducta desplegada por el titulante se muestra el desarrollo del dominio apegado a lo que el técnico de suelos le ha recomendado a fin de dar un uso racional del recurso suelo, al eliminar las prácticas que si bien son tradicionales de la zona como lo es la ganadería no responden a una actividad acorde con la clasificación encontrada en ese sector de ese recurso. Como se citó, el fundo esta en un cincuenta por ciento dentro de la zona protectora aludida acorde con lo consignado en la certificación de folio 4. En el caso en estudio, en la certificación de uso de suelo del 8 de marzo del 2008 (folio 41 a 44) se anotó la presencia de Repasto en 5.65 hectáreas (16.97%), repasto y bosque en el sector B de 17.15 hectáreas (51.51) y Bosque en 2 hectáreas (6%, y en el sector Tacotal en 8.50 hectáreas ( 25.52 %). Se indicó que se ha ejercido el uso conforme de suelo en un 43% del terrenos y no en un 57%, ubicado en el sector B. Sobre esta última área se detalló que presenta erosión por degradación, al ser sometida a actividad ganadera extensiva.
Fueron observadas huellas de ganado y cárcavas que conducen a la remoción del suelo. De igual forma se anotó que las áreas de protección de las nacientes tienen buena cobertura forestal, que debe ser ampliada al área del artículo 33 de la Ley Forestal 7575. Agregó, se evidenció una zona de dos hectáreas de bosque que protege la naciente. Se recomendó la eliminación de la actividad ganadera del sector B y dejarlo en regeneración natural forestal a fin de favoreces la captación de aguas de la quebrada Burío que esa afluente del Río Ario. Que es la actividad más acorde con las características de esa zona B clasificada como VI dadas las fuertes pendientes y mantener las áreas de protección de los cuerpos de agua. Posterior a ese informe se realiza el reconocimiento judicial (folio 94) del 12 de noviembre del 2008. Donde se anotó que es un fundo de topografía irregular con pendientes pronunciadas en algunos sectores donde no han sido desarrolladas actividades agrícolas dada su condición escarpada.
Se apuntó que donde discurre la Quebrada Burío que esta protegida. Se describe como finca mayormente de potreros dividida por apartos salvo la parte central donde se ubica una zona montañosa y una naciente con abundante vegetación, al igual que sobre las quebradas que le atraviesan y con las que colinda la finca. De este reconocimiento de observa que las quebradas y nacientes han sido protegidas con vegetación forestal. Por auto de las 14:30 horas del 12 de noviembre del 2008, se indica por el despacho de instancia que dadas las observaciones de la representante de la Procuraduría se esta en anuente a someterse a las recomendaciones técnicas del Certificador de Suelos (folio 97). Lo que contesta afirmativamente por memorial de folio 100. Nuevamente se aporta Certificación de Uso de Suelos del 5 de mayo del 2008 (folio 107 a 109), dos meses después del anterior, donde aún no se certifica el uso conforme de suelos.
Luego de ello se adjunta un nuevo estudio de suelos fechado en setiembre del 2013, donde se denota una diferencia respecto a las condiciones del inmueble del primer y segundo informe. En [Nombre8] se certifica un uso conforme de suelo sobre el cien por ciento del fundo. Y se muestra un cambio en los usos del terreno a silvopastoril, reforestación, bosque secundario, charral y tacotal. Se mencionó en las Observaciones del documento es finca con carga silvopastoril de media a baja intensidad de 0.5 a 1.5 de animales por unidad de área, que corresponden a pastos mezclados con gran cantidad de especies forestales de la zona (Roble Sabana, Laurel, Pochote), que es una gran cantidad de biomasa aprovechable. Aunado a que el propietario inició un proyecto de reforestación con teca a fin de restablecer las áreas no aptas para la ganadería. Se indica en lo de interés, en el sector D al no poder destinarse a ganado y solo a la conservación desde hace varios años se dejó esa actividad y se destinó a conservación para la regeneración natural, con la presencia ya de charrales altos altos y tacotales que conducen a estadios sucesionales iniciales de bosque secundario con el objeto de proteger el agua, suelo, flora y fauna.
En el sector E, se afirma que aun y cuando por años la actividad fue de ganadería se presenta el área donde se desarrollará la reforestación con Teca a fin de aumentar el área de reforestación y ser la parte de mayor pendiente y aún contiene pastos. Agrega, en las zonas donde se sitúa recurso forestal dentro de la propiedad, es una muestra de la conservación con recursos propios del titulante. Como recomendación se anota que el Sector D debe ser sometido a reforestación como ya se hizo en el B, o dejado naturalmente a recuperación como se hace a la fecha. Zona que se ha delimitado con cerca de alambre y en el sector E con reforestación con Teca. Se indica que las áreas boscosas que han sido conservadas, así deben permanecer y cerrarlas con delimitaciones físicas a fin de que no ingrese el ganado. Para este Tribunal, con el contenido del documento citado, se tiene por acreditado el uso conforme de suelo en toda el área de la parcela del titulante, aún la que se encuentra fuera de los límites de la Zona Protectora, pues así se certificó.
Señala la apelante, que no es posible tener por demostrada la posesión en resguardo de los recursos naturales en virtud de lo encontrado en el uso conforme de suelos ya citados y que la condición del dominio debió haber sido acreditada durante todo el periodo necesario para obtener el título.* Es criterio de esta Cámara se probó con las declaraciones testimoniales ya referidas, que el uso de ganadería de la finca proviene desde que ese terreno no formaba parte de la categoría de manejo a la cual pertenece en un cincuenta por ciento y que se usucapió en esas condiciones en 1994, antes de la afectación con la creación de la Zona Protectora en cuestión y de la emisión de la Ley de Manejo Uso y Conservación de Suelos y su reglamento. Se demostró que desde las décadas de los años 60 y 70 su original poseedor [Nombre6] tenía actividad ganadera. La afectación ocurre en 1994, y más bien indican los testigos se bajó la intensidad de mantenimiento de semovientes.
Como se menciona supra, las regulaciones de uso manejo y conservación de suelos corresponden a la década de los 90. La Ley 7779 es del 30 de abril de 1998, al igual que su reglamento. Por ello no es posible pretender su aplicación técnica retroactiva a fin de demostrar una posesión ecológica . Por otra parte, el titulante se ha sometido a las recomendaciones técnicas de los expertos en la gestión del recurso suelo y lo encontrado en el sector B de la finca, en el primer informe de suelos, no implica deban ser rechazadas estas diligencias por ser una actividad desarrollada desde hace décadas en la heredad, que siempre se ha destinado a la ganadería y pastoreo, según lo manifiestan los testigos citados. Las regulaciones del uso y manejo de suelos, son de reciente vigencia; no debiendo castigarse a los dueños de inmuebles, por el uso dado por sus antiguos poseedores por costumbre o cultura a los fundos, sin que esto implique los dueños y dueñas de terrenos, estén exentos del cumplimiento de las recomendaciones giradas por los entes competentes y el respeto al recurso suelo, que es de frágil gestión.
En este caso, el titulante se ha sometido a las recomendaciones técnicas dadas por la persona que hizo el estudio de suelos que le certificó el uso conforme al cien por ciento. Cabe citar, el cumplimiento de la normativa y recomendaciones técnicas en el uso y gestión del recurso, son de acatamiento obligatorio. Haciéndose responsables del daño ambiental que pudiera causarse por el uso irracional de este recurso, lo que debe tener claro el titulante de estas diligencias y seguir lo recomendado en el estudio de suelos mencionado. Aunado al necesario acompañamiento y fiscalización que las autoridades ambientales competentes deben ejercer por obligación legal. Se reitera, para el año 1994, ya la persona poseedora había obtenido el derecho de usucapir y en esa fecha aún no había sido emitida la Ley de Manejo Uso y Conservación de Suelos. Al respecto este Tribunal ha resuelto: " IV. El Tribunal en resolución Nº459-F-06 de las 16 horas 15 minutos del 11 de mayo de 2006 analizó el tema de ejercicio conforme de la posesión con relación a la certificación que expide el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria de la siguiente forma: "Analizada la Ley de Uso, Manejo y Conservación de Suelos N° 7779 del 30 de abril de 1998, se tiene en dicha normativa no se exige como requisito para titular por medio de Información Posesoria, el que se efectúe el estudio de suelos a fin de verificar si se cumple o no con el uso conforme del suelo, mucho menos que se deniegue el reconocimiento del derecho de propiedad si no se ejerce actualmente la posesión conforme al uso que debe tener el suelo.
De acuerdo a lo anterior, no lleva razón el ente estatal de que dicho requisito está contemplado en ese cuerpo legal. Lo que sí ocurre es que en el Decreto N° 29375-MAG-MINAE-H-HACIENDA-MOPT del 8 de agosto del 2000 mediante el cual se promulga el Reglamento a dicha ley, en su artículo 58 se dispone: "En toda información posesoria o que se presente ante el IDA o ante los Tribunales de Justicia, con el fin de inscribir en el Registro Público de la Propiedad, el interesado, además de los requisitos que exige la normativa común, deberá demostrar con un estudio adecuado de suelos, que ha ejercido la posesión cumpliendo con el uso conforme del suelo para la actividad que realiza de acuerdo con la metodología aprobada, y ejecutándolas con las mejores prácticas de su manejo, según la mejor tecnología disponible en cumplimiento con lo dispuesto en los artículos 3, 6, 12, 13, 19, 26, 27, 41, 43 y 64 de la Ley N° 7779 y este Reglamento", siendo que el artículo 173 de ese Reglamento dispuso que el mismo regiría a partir de su publicación. * IX.
Es menester indicar, antes de entrar en vigencia el Reglamento que exige ese requisito (publicado en La Gaceta No 57 del 21 de marzo del 2001), ya el promovente había obtenido la usucapion sobre el terreno de marras, toda vez [Nombre8] y como se indicó anteriormente, la posesión ejercida personalmente por la trasmitente [Nombre26] data desde mil novecientos setenta y seis. * * X. En el antecedente jurisprudencial de la Sala Constitucional citado, se infiere claramente como principio que LA PROPIEDAD SE ADQUIERE CUANDO SE CONSOLIDA LA USUCAPION, INDEPENDIENTEMENTE DE SI SE INSCRIBE O NO EL INMUEBLE, TODA VEZ LA TITULACION ES SIMPLEMENTE UNA FORMALIZACION DEL DERECHO DE PROPIEDAD. XI. Bajo esta inteligencia, no es posible aplicar retroactivamente el Reglamento en perjuicio de derechos ya adquiridos, toda vez al haber estado consolidado el derecho de propiedad a la fecha en que se incorpora vía reglamentaria el requisito del uso conforme del suelo, no es procedente exigirle al promovente demostrar que los actos posesorios en que pretende basar su titulación han sido conformes a esa nueva normativa.
Nótese cuando se consolidó la usucapion que dió origen al derecho de propiedad, la trasmitente de la promovente había ejercido los actos posesorios conforme a los requisitos para adquirir el dominio vigentes en ese momento. XII. Ahora bien, la Ley de Uso, Manejo y Conservación de Suelos N° 7779 del 30 de abril de 1998, establece en el artículo 6 inciso a) como una de las funciones específicas del Ministerio de Agricultura y Ganadería el "fiscalizar, evaluar y realizar, cuando lo considere necesario, los estudios básicos de uso de la tierra para definir los de uso agrícola, acatando los lineamientos de la legislación vigente en materia de ordenamiento territorial", y el artículo 41 establece: "Toda persona física o jurídica, pública o privada, estará obligada a fomentar, contribuir y ejecutar todas las prácticas y actividades necesarias para el manejo, la conservación y recuperación de suelos.
Por tanto, es obligatorio cooperar y acatar la medidas que el Ministerio de Agricultura y Ganadería, en coordinación con el Ministerio de Ambiente y Energía, dicte con el fin de manejar, conservar y recuperar el recurso suelo". Asimismo el artículo 45 dispone que "es obligación de las personas físicas y jurídicas, propietarias o poseedoras de terrenos de aptitud agrícola, permitir el ingreso de los técnicos autorizados por el Comité del Area o el Ministerio de Agricultura y Ganadería, para que verifiquen el mantenimiento de las prácticas de manejo, conservación y recuperación de suelos". Asimismo el artículo 51 dispone que "quien por acción u omisión, atente contra lo dispuesto en la presente normativa, incluso contra las finalidades y los objetivos señalados en los capítulos I y II de esta ley, incurrirán en las acciones que tipifique la legislación penal y sancionatoria vigente. Igualmente, se aplicará la legislación administrativa correspondiente en las faltas que impliquen violación de las normas administrativas que protegen de estos hechos a los bienes públicos o privados y que sancionen a los infractores". * * XIII.
Bajo este orden de ideas, es evidente que al aprobarse la información posesoria, no implica que las entidades públicas del caso (Ministerio del Ambiente y Energía o Ministerio de Agricultura y Ganadería) no puedan dar seguimiento a este caso concreto a fin de lograr que se cumplan los objetivos y alcances de la Ley de Uso, Manejo y Conservación de Suelos, aplicando los procedimientos que correspondan. XIV. Lo anterior resulta de esa manera porque no es dable denegar la titulación del inmueble por el hecho de que no se cumpla en su totalidad actualmente con el uso conforme del suelo, ya que [Nombre8] y como se explicó, mediante este procedimiento de información posesoria lo que se hace es reconocer un derecho de propiedad ya consolidado. Interpretar lo contrario implicaría prácticamente la denegación de un derecho de propiedad preexistente por no cumplirse con una disposición reglamentaria que puede ser cumplida a través de los mecanismos administrativos previstos por la ley".
De la lectura del amplio criterio vertido por esta Sede, es claro, que no se puede exigir un requisito con respecto al manejo del suelo, cuando al momento de entrada en vigencia de la ley objeto de análisis ya había usucapido. En este asunto la parte promovente más la sumada por sus anteriores transmitentes suman sobradamente ese plazo, véase al respecto las declaraciones de [Nombre27] , [Nombre28] y [Nombre29] (folios 35 a 38). Los deponentes fueron contestes en afirmar conocer el inmueble y explican de manera detallada la cadena de transmitentes, con lo cual se denota, para la entrada en vigencia de la ley de cita y su reglamento ya se había consolidado el derecho de propiedad que se opone en estas diligencias. Nótese, en el subjúdice, la certificación expresamente indica que se ha ejercido conforme la posesión, por lo que el requisito se cumple. También se nota, el profesional encargado de hacer el trabajo de campo y extender el documento recomendó: "Liberar de la actividad ganadera el [Dirección10] de la finca, [Nombre8] y como se describe en la declaración jurada adjunta".
De ello es claro, el seguimiento y fiscalización le corresponde al Ministerio del Ambiente, Energía y Telecomunicaciones o Ministerio de Agricultura y Ganadería, quien tiene la obligación de acuerdo a la legislación. Imponer un nuevo certificado como lo pide la representación estatal, es contrario a los requisitos que establecidos por la legislación y podría lesionar derechos fundamentales de acceso a la justicia de los administrados. Como se explicó en líneas anteriores, el uso conforme se probó por parte de la entidad promovente y por ello, en lo apelado, deberá confirmarse lo resuelto." (voto 078-F-09). En otro orden, tampoco resulta de recibo el argumento de apelación de que se aprobó con un proyecto de reforestación futuro, pues se certificó que en el terreno ya existen las delimitaciones respectivas de las zonas a reforestar. De necesaria atención es resaltar que la prohibición técnica de ganadería no lo es sobre todo el terreno, sino en las zonas ya identificadas en el campo y delimitadas que deben dedicarse a la regeneración natural o bien a la reforestación con plantación por el titulante.
Ello se deduce del contenido de último Estudio de Suelos, donde se menciona el proceso ya arrancó, sin que la recurrente aportara prueba alguna que lo desvirtuara (artículo 317 del Código Procesal Civil, aplicado supletoriamente). * * * * * * * * * * VI- Por otra parte, no se comparte el argumento de la impugnante sobre la inconveniencia de reforestar con Teca, dado que el decreto N. 23214-MAG-MIRENEM señala que la especie forestal Teca y Melina en plantaciones puras no son adecuadas para pendientes por acelerar procesos de erosión y solo lo serían para suelos en relieves moderadamente ondulados a ondulados. Este decreto es el denominado Metodología Determinación Capacidad Uso Tierras Costa Rica publicado en La Gaceta N. 107 del: 06/06/1994. Señala, sobre el suelo del sector identificado en el Estudio de Suelos como VI: " 3.6 Clase VI.* Las tierras ubicadas dentro de esta clase son utilizadas para la producción forestal, así como cultivos permanentes tales como frutales y café, aunque estos últimos requieren prácticas intensivas de manejo y conservación de suelos yaguas.
Sin embargo, algunas especies forestales como la Teca (Tectona grandis) y Melina (Gmelina arborea) en plantaciones puras no son adecuadas para las pendientes de esta clase, debido a que aceleran los procesos de erosión de suelos, por lo que se recomienda este tipo de uso sólo en relieves moderadamente ondulados a ondulados.* Las limitaciones que se pueden presentar, solas o combinadas son: relieve fuertemente ondulado, erosión sufrida severa, suelos moderadamente profundos, texturas en el suelo de muy finas a gruesas, en el subsuelo de muy finas a moderadamente gruesas, fuertemente pedregosos, muy baja fertilidad, toxicidad fuerte, salinidad moderada, drenaje moderadamente excesivo o moderadamente lento, riesgo de inundación moderado, zonas de vida seca y pluviales excepto páramo, periodo seco fuerte o ausente, condición de neblina y viento moderada." En este caso, su señalamiento va contra el criterio técnico del certificador de suelos que encontró la práctica acorde con el uso de suelo.
Lo que podría comprenderse en cuanto el conjunto de limitaciones de esa zona que permiten esa práctica. No encuentra esta Sede motivo alguno para que una recomendación de un decreto, y no una prohibición reste el valor científico del un estudio que se hizo en campo por un profesional acreditado ante la autoridad competente en el uso, manejo y conservación de suelos emitió y donde se consideraron las limitaciones reales del fundo. Cabe señalar, esa Metodología es una norma técnica que se adecua a la realidad aplicada por los profesionales del área propia del Derecho Ambiental, diversa a las normas legales propias del Derecho que tienen una interpretación diversa. En el Derecho Ambiental priva el principio del criterio técnico científico y así debe ser interpretado por los operadores del derecho. No consta en autos prevención alguna de ninguna autoridad fiscalizadora ambiental competente, que le haya indicado al titulante no introducir esa especie forestal o elemento alguno de otra naturaleza que conlleve a entender que no es adecuada; como para dudar de su fundamento científico.
Se rechaza el agravio.* Igual suerte corre el argumento de que el plano nuevo aportado bajo número P-1823065-2015 (folio 242) dibujó como de repastos la finca, pues ya se demostró según lo observó el certificador de uso de suelos y la persona juzgadora las coberturas forestales existentes existen en la realidad, se representó la naciente y quebrada y están debidamente cubiertas con cobertura forestal suficiente. No ha aportado el ente apelante o cualquier interesado, prueba alguna de que el promovente o los anteriores poseedores hubieran sido prevenidos, sancionados o culpados de haber transgredido la normativa nacional tutelar del ambiente, de donde se pudiera inferir han transgredido su obligación de ejercer una posesión en respeto de los recursos naturales la ejercer posesión de un inmueble con limitaciones de orden ambiental dada la naturaleza de esa finca y lo encontrado como actividad no recomendado en un sector del fundo ha sido corregid.
Es relevante citar que nunca medió un cambio de uso de suelo en la finca a titular en perjuicio del ambiente, desde antes de la creación de la categoría de manejo de Zona Protectora en cuestión hasta la actualidad, o al menos no consta ninguna prueba al respecto. Por lo que sus reclamos no son atendibles. Nótese, que cada categoría de manejo tiene sus propios fines técnico científicos, sin que pueda entenderse que la existencia de alguna de ella excluye en forma absoluta actividades humanas de producción o recreo. Lo que se define en los respectivos planes de ordenamiento territorial de cada una. En este caso el agravio en estudio esta ayuno de fundamentación debida, en cuanto al motivo por el cual estima el apelante las actividades existentes lesionan los fines de esa zona con los actos actuales y cuales directrices, órdenes o normas del plan de manejo de esa área se han incumplido. No debe olvidarse que según el artículo 82 de la Ley de Conservación de Vida Silvestre y sobre su uso y aprovechamiento en voto N. 144-96 de las 16:51 horas del 9 de enero de 1996. resolvió la Sala Constitucional de la Corte Suprema de Justicia: " En el caso de establecerse reservas forestales, zonas protectoras y refugios nacionales de vida silvestre, se da la opción de que el propietario conserve su tierra, ya que, siguiendo el plan de manejo puede continuar aprovechándola en términos económicos, es decir, las limitaciones impuestas no son de [Nombre8] magnitud que le impidan explotar su propiedad, por lo que no hacen nugatorio su derecho."
