RULING NO. 725-F-12 AGRARIAN COURT. SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.—At eleven hours and thirteen minutes on quince de junio de dos mil doce.
POSSESSORY INFORMATION PROCEEDINGS (DILIGENCIAS DE INFORMACIÓN POSESORIA), brought by [Nombre1]., of legal age, […]. The PROCURADURÍA GENERAL DE LA REPÚBLICA appears herein, represented by Lydiana Rodríguez Paniagua in her capacity as Deputy Attorney General, whose identifying particulars are not stated in the record; and the INSTITUTO DE DESARROLLO AGRARIO, represented by Carmelina Vargas Hidalgo, of legal age, attorney, […]. WHEREAS:
1. The applicant requests that registered title be granted to an unregistered parcel (fundo sin inscribir) that he claims to have possessed for more than ten years, consisting of pastureland located at [Dirección1][…], […], […], in the province of Guanacaste; depicted on cadastral plan (plano catastrado) […]; with an area of one hectare, nine thousand seven hundred twenty-six square meters. [Nombre3] to the north with […], (pleading at folios 12 and 61).
2. The Instituto de Desarrollo Agrario entered an appearance in the proceedings under the terms of the pleading on page 37; the Procuraduría General de la República also appears in accordance with the statements in the document on page 33.
3. Judge José Walter Ávila Quirós of the Agrarian Court of Santa Cruz ruled on these proceedings as follows: “The possessory information is approved. Subject to the encumbrances (afectaciones) referred to in Article 17 of the Ley de Informaciones Posesorias and without prejudice to third parties having a superior right, the Registrar of the Property Registry is ordered to register, for the first time, in the name of [Nombre1]., of legal age, […], the property described in the plan registered with the Catastro Nacional. Nature: Pastureland, LOCATION […], District […], Canton […], Province of Guanacaste, which, according to attached cadastral plan […], MEASURES: One hectare, nine thousand seven hundred twenty-six square meters, and whose boundaries are: [Dirección2]: […], currently possessed by Mr. [Nombre4]., who is the true adjoining landowner, and […]. The property at issue in these proceedings is valued at THREE MILLION COLONES. a) The right-of-way (derecho de vía) of the public road adjoining the property to be titled along its western boundary is 14.00 (Article 4 of the Ley General de Caminos Públicos and Article 19(a) of the Ley de Informaciones Posesorias). b) The public road adjoining the property to be titled to the northeast is [Dirección3] and has a right-of-way of 20 meters. c) The area adjoining the watercourses, pursuant to Article 33(a) and (b) of Ley Forestal N° 7575, where the cutting or removal of trees is prohibited, must be stated in the judgment for registration purposes (Article 34 ibid.).
Likewise, the channel and waters of that watercourse are in the public domain (Ley de Aguas, Articles 1(IV) and 3(III)). d) The surface water and groundwater existing on the property (wells, etc.) are in the public domain of the State and do not form part of the property. A certified copy of this judgment shall serve to register the aforementioned property with the Property Registry” (emphasis in the original at folios 155 through 157).
1. The Procuraduría General de la República challenged the above decision, as reflected in the pleading on pages 158 through 159.
2. The statutory requirements were not observed in the conduct of the proceedings.
Judge Díaz Bolaños drafts the opinion; and, CONSIDERING:
I.In view of the manner in which this matter will be resolved, no ruling is made concerning the list of proven facts contained in the challenged judgment.
II.The appeal with a concurrent claim of nullity was filed by Lic. Lydiana Rodríguez Paniagua, in her capacity as Deputy Attorney General, against the judgment issued at 08 horas 11 minutos del 23 de abril de 2012, which approved these possessory information proceedings. Her principal objection is that the proceedings should have been dismissed because the testimony received shows that the property to be titled contains a “stream (quebrada) protected by trees” and “a drainage channel (yurro) with Guácimo and hormiguillo trees,” a watercourse that, in her view, is not depicted on the plan underlying these proceedings. She contends that a new plan depicting the watercourses should have been submitted in accordance with Section 11 of the Ley de Informaciones Posesorias and in compliance with the Reglamento a la Ley de Catastro Nacional. She cites Agrarian Court ruling No. 824-10 and requests that the decision be vacated (folios 158 through 160).
III.In this matter, the plan appearing at folio 60 does not depict any spring (naciente), drainage channel, or stream. Nevertheless, witness [Nombre5]. testified as follows: “…There is a stream protected by trees…” (folio 79). Witness [Nombre6]. stated: “There is a drainage channel with Guácimo and hormiguillo trees” (page 80). The third witness, [Nombre7]., stated: “There is a ditch through which water flows during the rainy season, and it is protected by trees around it” (folio 96). In light of this evidence, the court of origin, in the decision on page 134, found with respect to the waters flowing through the property to be titled: “These are intermittent waters that flow during the rainy season, and the plans were prepared during the dry season, which logically explains why that ditch or brook was not depicted.” In this Court’s view, that assertion is unfounded because every geographical feature must be depicted in the topographic survey (levantamiento topográfico), whether permanent or intermittent.
This Court understands that a topographic survey must reflect reality and that it, together with the party’s statements—which are made under oath pursuant to Article 3 of the Ley de Informaciones Posesorias—establishes the actual condition of the property to be titled. Section 2 of that law provides that plans must show accurate data and measurements and imposes responsibility for compliance with those provisions upon the professional who conducted the survey. It also refers to Law 3454 of 14 de noviembre de 1964 and the Ley para el ejercicio de la Topografía y Agrimensura, N° 4294 of 16 de diciembre de 1968. Section 1 of the Reglamento a la Ley del Catastro Nacional lists a series of definitions. For purposes of this case, the following concepts are relevant: “Surveying Plan (Plano de Agrimensura): The document that graphically, mathematically, textually, and legally depicts only one property, parcel, or tract and complies with the standards established by these regulations.
Registered Cadastral Plan (Plano Catastrado): A surveying plan that has been registered with the Catastro Nacional.” In light of all the foregoing, and as stated above, the plan depicts the property to be titled and must accurately represent it graphically, mathematically, textually, and legally.
IV.The sole ground asserted by the appellant is that the judgment was premature because the base survey plan (plano base) for the proceeding does not depict the watercourse described by the three witnesses. It is also striking that, despite having the information provided by the deponents regarding the possible existence of water, the court a quo did not conduct a judicial inspection (reconocimiento judicial), pursuant to Article 11 of the Ley de Jurisdicción Agraria. Instead, it vacated that inspection, as recorded in the decision at page 111, asserting that the property does not have the minimum area required by the law governing possessory information proceedings (información posesoria). Moreover, before the party’s statements (folio 147), it indicated that the plan did not have to depict the waters crossing the property because it was prepared during the dry season and the feature was a “ditch or brook [‘zanjo o rachuelo’] (sic)” (page 134).
Based on the cited legislation, this Chamber finds that such a physical feature (accidente físico) must be described on the registered cadastral plan (plano catastrado), as required by Article 34(e) of the Reglamento de la Ley de Catastro Nacional. In addition, the adjudicating judge must consider what was agreed at the XVI Cumbre Judicial Iberoamericana, held in Buenos Aires, Argentina, on 25, 26 y 27 de abril de 2012, where the Declaración de Buenos Aires 2012 was signed. In the section concerning information and transparency, and public participation in environmental matters, the following was declared: “INFORMATION AND TRANSPARENCY IN ENVIRONMENTAL MATTERS. It is important for judges and the parties to have access to truthful, effective, accurate, and appropriate environmental information so that effective judgments may be rendered in environmental matters. It is important for judges to ensure that citizens and society have access to the environmental information they need or request, including information held by judicial bodies.
It is important for judges to bear in mind how significant their contribution, as public officials, can be to environmental education and to raising public awareness regarding environmental protection. It is important for judicial bodies to use appropriate and efficient means to convey relevant environmental information to everyone, inform society about their actions in environmental matters, and clarify for the public environmental issues decided within the judicial sphere. It is important for judges to have broad access to all environmental information held by the parties, third parties, and public agencies, in accordance with each legal system and Principle 10 of the Rio Declaration. PUBLIC PARTICIPATION IN ENVIRONMENTAL MATTERS. It is important that, whenever possible, judicial bodies adopt environmental-management policies and encourage measures for the rational and sustainable use of their resources.
It is important that judicial bodies consider their social and environmental responsibilities in their strategic planning, including: (a) adopting any environmental-protection measures that are possible or necessary; (b) requiring judges and officials to exercise environmental responsibility in performing their duties; and (c) favoring practices that combat the waste of natural resources, promote sustainability, and prevent environmental harm. It is important that each country’s procedural mechanisms ensure broad participation by citizens and society in judicial actions relating to the environment. It is important that the judge hearing the case or the competent court, whenever deemed necessary or advisable, hold public hearings to clarify issues relevant to adjudicating environmental actions, at which the views of society may be heard and technical statements from specialists may be obtained concerning matters relevant to rendering judgment.
It is important that, while respecting impartiality and independence, judges share the experience accumulated through their daily handling of environmental proceedings and problems by maintaining institutional contacts and cooperating with public agencies, social stakeholders, economic or professional associations, nongovernmental organizations, and the scientific and academic community, in order to improve the administration of justice, ensure the effective application of environmental legislation, and disseminate environmental-education and environmental-protection initiatives....” From the foregoing, this Court finds that the persons responsible for resolving matters in judicial proceedings, as well as the parties, must have access to truthful, effective, accurate, and appropriate environmental information so that effective judgments may be rendered in environmental matters. In possessory information proceedings, it is evident from Articles 45 and 50 of the Constitución Política that judges are required to ensure that the registrable title (título inscribible) in the Registro Público provides information intended to promote the greatest well-being of all inhabitants of the country by stimulating agricultural and agro-environmental production; encouraging the conservation and preservation of a healthy and ecologically balanced environment; and preventing harm that may affect future generations.
Furthermore, the cited declaration establishes the importance of judges ensuring that citizens and society have access to the environmental information they need or request, including information held by judicial bodies. When possessory information proceedings are conducted, the decision to be recorded in the corresponding registry must provide the general public with accurate and transparent information. Accordingly, everything concerning water resources (recurso hídrico), and potentially drinking-water supply sources for communities, must be clear and precise. Access to drinking water is a right that all men and women must enjoy. The Sala Constitucional de la Corte Suprema de Justicia has addressed this issue as follows: “‘III. — Fundamental right to drinking water. This Court has recognized in its case law that the rights to health and life are fundamental human rights that depend—to a large extent—on access to drinking water, and that the competent agencies have an unavoidable responsibility to ensure that society as a whole is not deprived of those rights....’ (Voto Nº18633 at 10 horas 50 minutos on 21 de diciembre de 2007).” It is therefore imperative that information concerning physical features be included in land surveys (levantamientos topográficos), and in this matter, as stated, the judgment was premature because it did not fully comply with the requirements imposed by law.
V.In view of the foregoing, pursuant to Articles 45 and 50 of the Constitución Política, Article 11 of the Ley de Informaciones Posesorias, Articles 6, 26, 54 and 79 of the Ley de Jurisdicción Agraria, Article 34(e) of the Reglamento de la Ley de Catastro Nacional, and Article 7 of the Ley de Tierras y Colonización, the petitioner shall be granted a reasonable period of two months to submit a new plan that consistently indicates the applicable minimum width of the roads and identifies the physical feature on the property through which the water referred to by the witnesses in their statements flows, with a corresponding reduction in the area for which title is sought after those exclusions. In addition, before judgment is rendered, a report shall be requested from the Departamento de Cuencas Hidrográficas de Acueductos y Alcantarillados stating whether it is necessary to reserve those waters for human consumption. Consequently, the judgment must be declared void because it was rendered prematurely.
THEREFORE:
The application to set aside the judgment (solicitud de nulidad de la sentencia), filed by the representative of the State together with the appeal, is granted, and the judgment is therefore vacated. Before rendering a new judgment, the Court must request a report from the Departamento de Cuencas Hidrográficas de Acueductos y Alcantarillados indicating whether the waters flowing through the property in dispute (fundo en litis) are intended, or must be reserved, to supply water to any population, based on the new plan that the petitioner shall submit within a reasonable period of two months, which shall consistently indicate the applicable minimum width of the roads and identify the physical feature on the property through which the water referred to by the witnesses in their statements flows, with a corresponding reduction in the area for which title is sought. The petitioner is hereby warned that, in the event of noncompliance, judgment shall be rendered on the basis of the land survey already contained in the record.

VOTO N° 725-F-12 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.-A las once horas y trece minutos del quince de junio de dos mil doce. DILIGENCIAS DE INFORMACIÓN POSESORIA, tramitadas por [Nombre1]., mayor, […]. Interviene la PROCURADURÍA GENERAL DE LA REPÚBLICA representada por Lydiana Rodríguez Paniagua en su condición de Procuradora Adjunta de calidades ignoradas en autos; y el INSTITUTO DE DESARROLLO AGRARIO, representado por Carmelina Vargas Hidalgo, mayor, abogada, […]. Interviene como abogado director del promovente [Nombre2]., de calidades ignoradas en autos.Tramitado en el Juzgado Agrario de Santa Cruz.
RESULTANDO:
1. El promovente solicita se conceda título registral de un fundo sin inscribir que dice haber poseído por más de diez años, que es terreno para potrero, situado en [Dirección1][…], […], […], de la provincia de Guanacaste; graficado en el plano catastrado […]; con una extensión de una hectárea nueve mil setecientos veintiséis metros cuadrados. [Nombre3] al norte con […], (memorial de folio 12 y 61).
2. El Instituto de Desarrollo Agrario se apersonó a los autos en los términos del memorial de página 37; también la Procuraduría General de la República, interviene según las manifestaciones del libero en página 33.
3. El juez José Walter Ávila Quirós, del Juzgado Agrario de Santa Cruz, resolvió las presentes diligencia así: "Se aprueba la información posesoria. Con las afectaciones a que se refiere el artículo 17 de la Ley de informaciones Posesorias y sin perjuicio de terceros de mejor derecho, se ordena al Señor Registrador del Registro de la Propiedad inscribir, por primera vez, a nombre de [Nombre1]., mayor, […], la finca descrita en el plano inscrito en el Catastro Nacional Naturaleza: Terreno para potrero, SITUACIÓN […], Distrito […], Cantón […], de la Provincia de Guanacaste, que según el plano catastrado adjunto […], MIDE: Una hectárea nueve mil setecientos veintiséis metros cuadrados, cuyos linderos son: [Dirección2]: […], actualmente en posesión del señor [Nombre4]., quien es el colindante verdadero, y […]. El inmueble objeto de este proceso se estima en la suma de TRES MILLONES DE COLONES. a) Que el derecho de vía de la calle pública que colinda por el rumbo oeste con el predio a titular es de 14.00 (artículos 4 de la Ley General de Caminos Públicos y 19, incisos a), de la Ley de Informaciones Posesorias). b) Que la calle pública que colinda por el noreste con el predio a titular es la [Dirección3] . y tiene un derecho de vía de 20 metros. c) Que el área contigua a las corrientes, según el artículo 33, incisos a) y b) de la Ley Forestal N° 7575, y queda prohibida la corta o eliminación de árboles, debiéndose consignar en sentencia para efectos de inscripción en el Registro (artículo 34 ibídem).
Asimismo, que el cauce y las aguas de esa corriente son de dominio público (Ley de Aguas, artículos 1 inciso IV, y 3 inciso III). d) Las aguas superficiales y subterráneas existentes en el inmueble (pozos, etc.), son de dominio público estatal y no forman parte de la finca. Sirva la certificación de esta sentencia para inscribir en el Registro de la Propiedad la finca relacionada" (lo destacado es del original a folios 155 a 157).
1. La Procuraduría General de la República impugnó la decisión arriba citada según consta en memorial de páginas 158 a 159.
2. En la substanciación de las diligencias no se han observado las prescripciones legales.
Redacta la jueza Díaz Bolaños; y, CONSIDERANDO:
I.Dada la manera en que se resolverá se omite pronunciamiento sobre el elenco de hechos demostrados contenidos en el fallo recurrido.
II.La apelación con nulidad concomitante es interpuesta por la licenciada Lydiana Rodríguez Paniagua en su condición de Procuradora Adjunta contra la sentencia de las 08 horas 11 minutos del 23 de abril de 2012 que aprueba las presentes diligencias de información posesoria. En lo medular se muestra disconforme por cuanto tales debieron de rechazarse, porque de la prueba testimonial recibida, se desprende que en el inmueble a titular hay una "quebrada que esta protegida por árboles" y ´hay un yurro con árboles de Guácimo (sic) y hormiguilloµ, corriente que según su entender no están descritas en el plano base de estas diligencias. A su criterio debió de presentarse un nuevo plano en el que se describen las corrientes de agua de conformidad con el ordinal 11 de la Ley de Informaciones Posesorias y en cumplimiento por lo ordenado en el Reglamento a la Ley de Catastro Nacional. Cita el voto del Tribunal Agrario Nº824-10, y pide se anule la decisión (folio 158 a 160).
III.En este asunto el plano visible a folio 60 no tiene dibujada naciente, yurro o quebrada alguna. Sin embargo, de la testimonial de [Nombre5]. declaró lo siguiente: "...Hay una quebrada que esta protegida por arboles (sic)..." (foja 79). El deponente [Nombre6]. afirmó: «Hay un yurro con arboles (sic) de Guácimo y hormiguillo«µ(página 80). Por otra parte el tercer declarante [Nombre7]. . reseñó lo siguiente: ´«Hay un zanjo por donde corre agua en invierno el cual se encuentra protegido con arboles (sic) a su alrededor«µ(folio 96). ante tal panorama probatorio el Juzgado de origen en la resolución de página 134 consideró sobre las aguas que discurren por el fundo a titular: ´se trata de aguas intermitentes que corren en época de invierno y los planos fueron confeccionados en época de verano razón lógica por la cual no se ilustró dicho zanjo o riachueloµ. A criterio de esta Cámara, tal afirmación es infundada, porque todo accidente geográfico debe estar graficado en el levantamiento topográfico, sea permanente o intermitente.
Este Tribunal comprende que un levantamiento topográfico se debe ajustar a la realidad, y de ahí junto con las manifestaciones de la parte, las cuales se hacen bajo la fe de juramento, al tenor de lo indicado en el artículo 3 de la Ley de Informaciones Posesorias, son la realidad del inmueble a titular. El ordinal 2 de la ley en mención, establece que los planos deberán representar datos y medidas exactas, e impone al profesional encargado del levantamiento la responsabilidad por el cumplimiento de lo estatuido. Además remite a las leyes 3454 del 14 de noviembre de 1964 y la Ley para el ejercicio de la Topografía y Agrimensura, N° 4294 del 16 de diciembre de 1968. En el Reglamento a la Ley del Catastro Nacional, en el ordinal 1° se enlistan una serie de definiciones. Para los fines de este caso, interesa analizar los siguientes conceptos: ´Plano de Agrimensura: Es el documento mediante el cual se representa en forma gráfica, matemática, literal y jurídicamente sólo una finca, parcela o predio, que cumple con las normas que establece el presente reglamento.
Plano Catastrado: Es el plano de agrimensura que ha sido inscrito en el Catastro Nacionalµ. Con todo lo anterior, y como se ha expresado, el plano representa la finca a titular, y debe ser de forma real, tanto en forma gráfica, matemática, literal y jurídicamente.
IV.El único motivo de la representación recurrente, radica en acusar lo anticipado de la sentencia, porque el plano base de la diligencia no tiene dibujada la corriente de agua descrita por los tres testigos. También llama la atención que teniendo los datos suministrados por los deponentes sobre la posibilidad de existencia de aguas, el ad quo no realizara el reconocimiento judicial, con fundamento en el ordinal 11 de la Ley de Jurisdicción Agraria . Sino que dejó sin efecto tal inspección según consta en la decisión de foja 111, aduciendo que no posee la extensión necesaria que señala la ley del procedimiento de la información posesoria. Además previo a las manifestaciones de la parte (folio 147), señala que el plano no tiene que tener reflejado las aguas que le cruzan, porque se confeccionó en verano y se trata de una ´zanjo o rachuelo (sic)µ(página 134). Esta Cámara considera, con sustento en la legislación citada, la necesidad de describir en el plano catastrado tal accidente físico, tal y como lo exige el artículo 34 inciso e) del Reglamento de la Ley de Catastro Nacional.
Abonado a lo anterior, debe considerar la persona juzgadora, lo acordado en la XVI Cumbre Judicial Iberoamericana, realizada en Buenos Aires, Argentina, los días 25, 26 y 27 de abril de 2012, donde se suscribió la Declaración de Buenos Aires 2012. En el segmento relativo a la información y transparencia, y la participación pública en materia de medio ambiente, se declaró lo siguiente: "INFORMACIÓN Y TRANSPARENCIA EN MATERIA DE MEDIO AMBIENTE . Es importante que el juez y las partes tengan acceso a una información ambiental verdadera, eficaz, real e idónea para que se dicten sentencias y efectivas en materia ambiental. Es importante que los jueces velen para que la ciudadanía y la sociedad tengan acceso a la información ambiental que precisen o soliciten, incluyendo la información en poder de los órganos jurisdiccionales. Es importante que los jueces tengan en cuenta cuán significativa puede ser su contribución, como agentes públicos, a la educación ambiental y a la sensibilización de la opinión pública en materia de protección del medio ambiente.
Es importante que los órganos jurisdiccionales utilicen medios idóneos y eficientes para transmitir a todos la información ambiental relevante, para informar a la sociedad sobre su actuación en materia de medio ambiente y para esclarecer al público cuestiones ambientales decididas en el ámbito judicial. Es importante que los jueces tengan un amplio acceso a toda la información ambiental que obre en poder de las partes, de terceros y de órganos públicos, de acuerdo con lo establecido en cada ordenamiento jurídico y el Principio 10 de la Declaración de Río. PARTICIPACIÓN PÚBLICA EN MATERIA DE MEDIO AMBIENTE.Es importante que, siempre que sea posible, los órganos jurisdiccionales adopten políticas de gestión ambiental e incentiven medidas para un uso racional y sostenible de sus recursos. Es importante que los órganos jurisdiccionales consideren sus responsabilidades socioambientales en sus planificaciones estratégicas, incluyendo: (a) la adopción de las medidas de protección del medio ambiente que sean posibles o necesarias; (b) la exigencia de una responsabilidad ambiental a los jueces y funcionarios en el desempeño de sus obligaciones; y (c) la preferencia de prácticas que combatan el desperdicio de recursos naturales, incentiven la sostenibilidad y eviten daños al medio ambiente.
Es importante que los mecanismos procesales de cada país aseguren una amplia participación de la ciudadanía y de la sociedad en acciones judiciales que guarden relación con el medio ambiente. Es importante que el juez de la causa o tribunal competente, siempre que lo estime necesario o conveniente, realice audiencias públicas para esclarecer cuestiones relevantes para el juicio de acciones ambientales, en las que conozca la opinión de la sociedad y recabe declaraciones técnicas de especialistas sobre aspectos relevantes a la hora de dictar sentencia. Es importante que, respetando su imparcialidad e independencia, el juez comparta la experiencia acumulada en el trato cotidiano con procesos y problemas ambientales, manteniendo contactos institucionales y cooperando con órganos públicos, agentes sociales, asociaciones económicas o profesionales, organizaciones no gubernamentales y la comunidad científica y académica, en beneficio de la mejora de la prestación jurisdiccional, de la aplicación eficiente de la legislación ambiental y de la divulgación de iniciativas de educación ambiental y de protección del medio ambiente...".
De lo anterior estima este Tribunal, la persona encargada de resolver los asuntos en sede judicial y las partes, deben tener acceso a una información ambiental verdadera, eficaz, real e idónea para que se dicten sentencias efectivas en materia ambiental. En el caso de las informaciones posesorias, es evidente, a partir de los numerales 45 y 50 de la Constitución Política, se impone a quien juzga velar porque el título inscribible en el Registro Público, suministre información tendiente a generar el mayor bienestar a todos los habitantes del país, estimulando la producción agraria y agroambiental; incentivando que se conserve y preserve un ambiente sano y ecológicamente equilibrado; evitando daños que puedan afectar a las futuras generaciones. Además, la declaración en cita, establece la importancia que los jueces y las juezas velen para que la ciudadanía y la sociedad tengan acceso a la información ambiental que precisen o soliciten, incluyendo la información en poder de los órganos jurisdiccionales.
Cuando se tramitan las diligencias de información posesoria, la decisión que se inscribirá en el registro correspondiente, deberá suministrar a la ciudadanía en general información precisa y transparente. Por lo anterior, es relevante que todo lo que concierne al recurso hídrico, y eventualmente a fuentes de abastecimiento de agua potable para las comunidades, sea diáfana y precisa. El suministro de agua potable es un derecho al que todos los hombres y mujeres deben tener acceso. Este tema ha sido abordado por la Sala Constitucional de la Corte Suprema de Justicia de la siguiente manera: ´« III . - Derecho fundamental al agua potable. Este Tribunal ha reconocido en su jurisprudencia que el derecho a la salud y a la vida son derechos fundamentales del ser humano que dependen -en gran parte-del acceso al agua potable, y que los órganos competentes tienen la responsabilidad, ineludible, de velar para que la sociedad como un todo no los vea mermados..." (Voto Nº18633 de las 10 horas 50 minutos del 21 de diciembre de 2007).
Resulta entonces imperante que la información sobre los accidentes físicos consten en los levantamientos topográficos, y en este asunto como se afirmó, la sentencia resulta anticipada al no cumplir a cabalidad con los requisitos exigidos por la legislación.
V.Por lo expuesto, con fundamento en los artículos 45 y 50 de la Constitución Política, numeral 11 de la Ley de Informaciones Posesorias, 6, 26, 54 y 79 de la Ley de Jurisdicción Agraria, 34 inciso e) del Reglamento de la Ley de Catastro Nacional, 7 de la Ley de Tierras y Colonización, deberá concederse al promovente dentro del plazo prudencial de dos meses, un nuevo plano que describa siempre el ancho mínimo de las calles según corresponda y cite el accidente físico existente en el bien por donde discurre agua al que se hace alusión los testigos en sus declaraci ones, con la reducción del área a titular correspondiente, luego de tales exclusiones. Además, deberá solicitarse, en forma previa a dictar sentencia, un informe emitido por el Departamento de Cuencas Hidrográficas de Acueductos y Alcantarillados, donde de cuenta de la necesidad o no de reservar tales aguas para consumo humano. Por ende, deberá declararse la nulidad de la sentencia al haber sido emitida en forma anticipada.
POR TANTO:
Se acoge la solicitud de nulidad de la sentencia, planteada por la representante del Estado en forma concomitante a la apelación, por lo que se anula la sentencia. Antes de su emisión, debe el Juzgado pedir un informe emitido por el Departamento de Cuencas Hidrográficas de Acueductos y Alcantarillados donde indique si las aguas que discurren en el fundo en litis están destinadas o deben ser reservadas para surtir de agua a alguna población, con base al nuevo plano que presentará el promovente dentro del plazo prudencial de dos meses, donde se describa siempre el ancho mínimo de las calles según corresponda y cite el accidente físico existente en el bien por donde discurre agua al que se hace alusión las personas testigas en sus declaraciones, con la reducción del área a titular correspondiente. Lo anterior con el apercibimiento en caso de incumplimiento de dictar sentencia con el levantamiento topográfico existente en autos.
