JUDGMENT NO. 0 987-F-10 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, at eight hours zero minutes on veintiséis de octubre de dos mil diez.- POSSESSORY TITLE PROCEEDING (INFORMACIÓN POSESORIA), brought by [Nombre1], of legal age, married once, farmer, resident of Buena Vista, identity card CED1 - - . Participating in the proceeding are the PROCURADURÍA GENERAL DE LA REPÚBLICA, represented by Lydiana Rodríguez Paniagua, whose personal details do not appear in the record, in her capacity as Deputy Attorney General, and the INSTITUTO DE DESARROLLO AGRARIO, legal entity identification number CED2 - - - , represented by Carmelina Vargas Hidalgo, of legal age, divorced, attorney, resident of Guachipelín, Escazú, identity card CED3 - - , in her capacity as general attorney-in-fact for judicial proceedings.   1. 1The petitioner brings a possessory title proceeding so that the property described as follows may be registered in her name in the Registro Público de la Propiedad: “pastureland with a house, located at [Dirección1], in the Province of Cartago. Area: TWENTY-SEVEN THOUSAND TWO HUNDRED ELEVEN METERS. BOUNDARIES: NORTH: [Nombre2]; SOUTH: [Nombre3]; EAST: [Dirección2], with frontage thereon measuring ninety-four meters and twenty-nine centimeters; and West: QUEBRADA CENTRAL,” (folio 7).-
  2. 2The Procuraduría General de la República and the Instituto de Desarrollo Agrario entered appearances in the proceeding under the terms appearing at folios 94, 95, 133 to 135, 86 and 121, respectively, neither expressing opposition to these proceedings.-
  3. 3Attorney Andrea Ruiz Ramírez, the trial judge, by judgment issued at quince horas once minutos del once de agosto de dos mil diez, ruled: “POR TANTO: The possessory title proceeding is approved. Subject to the encumbrances referred to in article seventeen of the Ley de Informaciones Posesorias and without prejudice to third parties having superior rights, free of real-property encumbrances, the registrar of the Registro Público de la Propiedad is ordered to register for the first time, in the name of [Nombre1], who is of legal age, married once, identity card CED5 - - , and a resident of Buena Vista, Pacayas, the property depicted on the survey plan registered with the Catastro Nacional under number C - one million three hundred sixty-nine thousand seven hundred ninety-four; it is Pastureland Land (sic) with a house, located in Buena Vista, First District Pacayas, Sixth Canton Alvarado, Province of Cartago, bounded on the North by: [Nombre2], South: [Nombre3], East: [Dirección3], West: [Dirección4].Area: Two hectares seven thousand twenty-one square meters, in accordance with the aforementioned registered survey plan. These proceedings were valued at four hundred thousand colones. A certified copy of this judgment shall serve to register the aforementioned property in the Registro de la Propiedad. The area adjoining Quebrada central is a protected area (área de protección), as provided by articles thirty-three, subsection b), and thirty-four of Ley Forestal No. seven thousand five hundred seventy-five, and the cutting or removal of trees is prohibited; the channel and waters of that stream are in the public domain (Ley de Aguas, article one, subsection IV, and article three, subsection III); the surface water and groundwater existing on the property (wells, etc.) are in the State public domain and do not form part of the property. The right-of-way (derecho de vía) of the public road bordering the property on the east is fourteen meters. (article four of the Ley General de cambios Públicos and article nineteen, subsection a), of the Ley de informaciones Posesorias),” (folio 206).-
  4. 4Attorney Lydiana Rodríguez Paniagua, in her capacity as Deputy Attorney General, filed an appeal expressly stating the reasons for challenging the trial court’s position (folios 207 to 212).-

5. In the conduct of the proceeding, the statutory requirements have been observed, and the judgment contains no apparent errors or omissions capable of rendering it null and void.

Judge HURTADO GARCÍA drafts the opinion; and,

CONSIDERING:

I.The list of proven facts is adopted because it reflects the evidence, subject to the following qualifications. In proven fact number one, the eastern boundary is modified to state that the frontage on the adjoining public road measures ninety-four meters and thirty-two linear centimeters (plan at folio 164). The following shall be added to proven fact number two: The deed is number forty-one, executed before Notary Yolanda Leiva Urcuyo (document at folio 83; witnesses at folios 151 to 154). The following is added as proven fact 7): The land that is the subject of the title proceeding also contains a pure stand forest (bosque rodal puro) of Jaúl, with Guayabillo, Turruz, and cala shrubs, and the area adjoining the stream on the western side is protected (certificate at folio 58; judicial inspection at folio 88).-

II. No ruling is made regarding unproven facts, because none of that nature can be inferred from the record.-

III.The Procuraduría General de la República appeals judgment number 71-2010, issued at quince horas once minutos del once de agosto de dos mil diez, asserting the following grounds of error: 1) It states that, according to the land-use certificate (certificado de uso de suelos), the property for which title is sought is forested in nature and is therefore subject to the public domain as part of the State’s natural heritage (patrimonio natural del Estado). It states that this designation has existed since Ley Forestal 4465, article 33, as amended by Ley Forestal 7174 de 1990 (Art. 32 y 33), and that its public-domain status (carácter demanial) is maintained by Ley 7575, arts 13 y 14. It states that, even though forestry legislation permits title to property outside protected wildlands (áreas silvestres protegidas) when ten-year possessory rights are established, the resource has been protected, and the property is duly demarcated, the aforementioned designation as part of the forest public domain must be taken into account. It also bases its appeal on Voto No. 4587-97 of the Sala Constitucional. 2) It asserts that the witnesses’ testimony does not establish ten-year possession sufficient for acquisitive prescription (usucapión) by the petitioner.

IV.This Tribunal finds that the appellant is not correct. Through a possessory information proceeding (Información Posesoria), the possessor of an unregistered agricultural holding (fundo agrario) who lacks a registrable title may, after complying with a series of formal requirements (including the publication of a notice, notification of adjoining landowners, and notification of the state entities Instituto de Desarrollo Agrario and Procuraduría General de la República), obtain registration of the land in the Registro Público. Likewise, substantive requirements must be established, namely, the exercise of agricultural or agro-environmental possession (posesión agraria o agro-ambiental), exercised as owner, publicly, peacefully, continuously, and for a minimum period of ten years. If those requirements are not met, the proceeding may not be approved. The State’s representative argues that approval of this proceeding is improper because the land includes a forested area, which forms part of the State’s natural heritage (patrimonio natural del Estado) and is inalienable.

Article 32 of the repealed Ley forestal No. 4465 provided that “The State’s forest heritage (patrimonio forestal del Estado) consists of all forests and forest lands within national reserves, areas declared inalienable, and properties registered in its name…” Thus, Article 33 of that statute stated that assets included within the State’s forest heritage could not be registered in the Registro through a possessory information proceeding. Subsequently, however, Ley forestal No. 4465 was amended by Ley No. 7174, which, insofar as relevant, regulated in Article 2 the amendment of section 7 of Ley de Informaciones Posesorias No. 139. Accordingly, the amendment to Article 7 of the Ley de Informaciones Posesorias provided that areas located outside zones declared to be national parks, biological reserves, forest reserves, or protected zones, but containing forests, “…may be titled only if the applicant proves that he or she has possessed them for ten years or more and has protected that natural resource, provided that the property must be duly demarcated by fences or cleared boundary paths…” Article 7 of the Ley de Informaciones Posesorias thus clearly reflects the legislature’s intent that land with forest cover (cobertura boscosa) may be registered, provided that the requirements concerning enclosure and protection of the natural resource are established.

An analysis of the current ley forestal No. 7575, in Article 13 thereof, does not indicate that Article 7 of the Ley de Informaciones Posesorias was expressly or tacitly repealed. Rather, it was modified in a manner that strengthens titling. Article 13 of ley forestal No. 7575 defines the concept of the State’s natural heritage as: “consisting of the forests and forest lands within national reserves, areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other bodies of the Public Administration, except for properties securing credit transactions with the Sistema Bancario Nacional that become part of its assets…” Note that the State’s natural heritage refers to forest lands within national reserves; pursuant to Article 11 of the Ley de Tierras y Colonización, in the case of unregistered land, the ten-year possession (posesión decenal) of private parties may be protected, and evidence to the contrary regarding its status as a national reserve may properly be submitted.

Consequently, the arguments of the State’s representative are rejected. This Tribunal’s view is that, with respect to property such as that at issue here, which contains forested areas and is not located within the zones identified in the first paragraph of Article 7 of the Ley de Informaciones Posesorias, land containing forests may indeed be registered through a possessory information proceeding. This is subject to proof of all formal and substantive requirements concerning the required special possession (posesión especial). In this matter, the statements of the witnesses [Nombre4], [Nombre5], and [Nombre6], at folios 151 to 154, show that the land subject to titling has been possessed by both the previous owners and the applicant for livestock raising and agriculture, and that they have also preserved the forest. That circumstance was verified in the judicial inspection record (acta de reconocimiento judicial) appearing at folio 88.

Accordingly, it may be inferred that the possession exercised by the applicant complies with the statutory environmental requirements, since the forest resource has been protected, as observed during the judicial inspection and confirmed by the statements of the cited witnesses. Indeed, Ingeniero Shiriam Yassir Farah G., the land-use certifier (certificador de uso del suelo), states at folios 58 and 75 that the land in question has been used in conformity with its appropriate land use for the activity carried out there, in accordance with the approved methodology. According to the land-use certifier, the property contains annual crops and a forest consisting of a pure stand of jaúl, with Guayabillo, Turruz, and Calas shrubs, and he recommends encouraging natural forest regeneration and refraining from cutting trees within the stream’s protection zone. In the judicial inspection record appearing at folio 88, the judge states that the property is fenced, noting that the fences appear old; that there is a house and broccoli crops that appeared to have been harvested; and that at the rear of the property there is a stream with an almost vertical slope that is duly protected and covered with trees.

The requirement established in Article 7 of the Ley de Informaciones Posesorias has therefore been proven, in that the property is duly fenced and the forest and water resources have been protected. Likewise, according to the inspection record appearing at folio 88, 70 % of the land is devoted to agriculture, and forest exists on only one-third of it, specifically in an area with a steep slope that constitutes a protection area. The definition of “forest” in Ley Forestal 7575 therefore does not apply. Consequently, the arguments of the State’s representative are not accepted.

V.The ground of appeal alleging that ten-year possession was not proven is likewise without merit. The document at folio 83 shows that the applicant acquired the land by a donation made to her by her husband, [Nombre7], also known as [Nombre8], in the year 1987. This is consistent with the witness testimony referring to the chain of transferors, who agree that the property belonged to Mr. [Nombre9], then to [Nombre3], who in turn transferred it to his daughters [Nombre10], [Nombre11], [Nombre12], and [Nombre13]; the latter then sold it to the applicant’s husband, who donated it to her. The previous owners’ possession exceeded ten years, since the witnesses attest to it because they have known the property for more than twenty years, as they stated at folios 151 to 154. The witnesses state that possession was continuous and free of disputes with third parties, and that the applicant is known as the owner. Ten-year possession has therefore been established, and the applicant may add the period of possession exercised by her transferor to her own, pursuant to Article 1 of the Ley de Informaciones Posesorias. Consequently, the asserted grounds of appeal must be rejected, and the judgment must be affirmed insofar as it was appealed.

POR TANTO:

The appealed decision is affirmed insofar as it was appealed. It is modified with respect to the eastern boundary of the property to be titled, to specify that its frontage along the public road adjoining it is ninety-four meters and thirty-two linear centimeters.- [Nombre14] [Nombre15] [Nombre16] CASE FILE: EXPN1 POSSESSORY INFORMATION PROCEEDING [Nombre1] D+G+V

RESULTANDO:

  1. 1El promovente plantea proceso de información posesoria con el fin de que se inscriba a su nombre en el Registro Público de la Propiedad la finca que describe así: “ terreno de pastos con una casa, situado en el [Dirección1] , de la Provincia de Cartago, Mide: VEINTISIETE MIL DOSCIENTOS ONCE METROS. LINDEROS: NORTE: [Nombre2] ; SUR: [Nombre3] ; ESTE: [Dirección2] con un frente a esta de noventa y cuatro metros con veintinueve centímetros ; y Oeste: QUEBRADA CENTRAL, ” (folio 7 ).-
  2. 2La Procuraduría General de la República y e l Instituto de Desarrollo Agrario, se apersonaron al proceso en los términos visibles de folios 94, 95, 133 a 135, 86 y 121 ; respectivamente, sin manifestar ambos su oposición a las presentes diligencias.-
  3. 3La licenciad a Andrea Ruiz Ramírez , juez a de primera instancia , mediante sentencia de las quince horas once minutos del once de agosto de dos mil diez , resolvió: “ POR TANTO: Se aprueba Información Posesoria. Con la afectaciones a que se refiere el artículo diecisiete de la Ley de Informaciones Posesorias y sin perjuicio a terceros de mejor derecho, libre de cargas reales, se ordena al señor o señora registrador (a) del Registro Público de la Propiedad, inscribir por primera vez a nombre de [Nombre1] , quien es mayor, casad a una vez , cédula de identidad CED5 - - , vecin a de Buena Vista, Pacayas, la finca descrita en el plano inscrito en el Catastro Nacional bajo el número C - un millón trescientos sesenta y nueve mil setecientos noventa y cuatro, es terreno Terreno (sic) de Pastos con una casa, situado en Buena Vista el Distrito Primero Pacayas, Cantón sexto Alvarado, de la Provincia de Cartago, colinda al Norte: [Nombre2] , Sur: [Nombre3] , Este: [Dirección3] , Oeste: [Dirección4] .Mide: Dos hectáreas siete mil veintiún metros cuadrados; de conformidad con el plano catastrado supra indicado. El monto por el cual fueron estimadas las presentes diligencias fue de cuatrocientos mil colones. Sirva la certificación de esta sentencia para inscribir en el Registro de la Propiedad la finca relacionada. El área contigua a la Quebrada central es área de protección según señala el artículo treinta y tres, inciso b) y treinta y cuatro de la Ley Forestal Nº siete mil quinientos setenta y cinco constituye área de protección y queda prohibida la corta o eliminación de arboles, siendo el cauce y las aguas de esa corriente de dominio público ( Ley de Aguas, artículos primero inciso IV, y tres inciso III); las aguas superficiales y subterráneas existentes en el inmueble ( pozos, etc), de dominio publico estatal y no forman parte de la finca. El derecho de vía de la calle pública que colinda por el rumbo este con el inmueble es de catorce metros. (artículo cuatro de la Ley General de cambios Públicos y diecinueve, inciso a, de la Ley de informaciones Posesorias)", (folio 206).-
  4. 4La licenciada Lydiana Rodríguez Paniagua, en su condición de Procuradora Adjunta, formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia, (folios 207 a 212 ).-

5. En la substanciación del proceso se han observado las prescripciones legales, y no se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad.

Redacta la Jueza HURTADO GARCÍA, y;

CONSIDERANDO:

I.Se prohija el elenco de hechos probados por ser reflejo de las probanzas, con las siguientes salvedades. En el hecho probado número uno, se modifica el lindero este en el sentido que el frente a calle pública con la cual colinda es de noventa y cuatro metros con treinta y dos centímetros lineales (plano a folio 164). En el hecho probado número dos, debe agregarse: La escritura corresponde a la número cuarenta y uno, otorgada ante la Notaria Yolanda Leiva Urcuyo (documento a folio 83, testigos a folio 151 a 154). Se agrega como hecho probado 7): En el terreno objeto de titulación también existe bosque rodal puro de Jaúl, con arbustos de Guayabillo, Turruz y calas, y está protegida el área aledaña a la quebrada en el costado oeste (certificado a folio 58, reconocimiento judicial a folio 88).-

II. No se emite pronunciamiento sobre hechos indemostrados, dado que de los autos no se infieren de esa índole.-

III.La Procuraduría General de la República formula recurso de apelación contra la sentencia número 71-2010 dictada a las quince horas once minutos del once de agosto de dos mil diez, y como fundamento expone los siguientes agravios: 1) Señala, que según el certificado de uso de suelos, el inmueble a titular es de naturaleza boscosa, y por ello está afecto a dominio público, patrimonio natural del Estado. Dice, esa afectación se da desde la Ley Forestal 4465, artículo 33, reformada por Ley Forestal 7174 de 1990 (Art. 32 y 33) y el carácter demanial que mantiene la Ley 7575, arts 13 y 14. Dice, aún cuando la legislación forestal permite titular inmuebles fuera de las áreas silvestres protegidas si se demuestran los derechos de posesión decenal, haber protegido el recurso y tener el inmueble debidamente deslindado, ha de tenerse en cuenta la declaratoria de dominio público forestal antes dicha. Sustenta su apelación, también en el Voto No. 4587-97 de la Sala Constitucional. 2) Afirma, las declaraciones de los testigos no demuestran la posesión decenal apta para usucapir en cabeza de la parte promovente.

IV.Estima este Tribunal que no lleva razón la apelante. Mediante el trámite de Información Posesoria, el poseedor o poseedora de un fundo agrario sin inscribir y que carezca de título inscribible, previo al cumplimiento de una serie de requisitos formales (entre los cuales cabe mencionar: la publicación de un edicto, notificación de colindantes, notificación de los entes estatales Instituto de Desarrollo Agrario y la Procuraduría General de la República) puede lograr la inscripción del terreno en el Registro Público. Asimismo, debe acreditarse requisitos sustanciales o de fondo, a saber el ejercicio de una posesión agraria o agro-ambiental, ejercida como dueño o dueña, en forma pública, pacífica, continua y por un plazo mínimo de diez años. Si no se cumple con esos requisitos la diligencia no podrá ser aprobada. La representación del Estado aduce que no es procedente aprobar este trámite, en virtud que el terreno comprende área boscosa, la cual está comprendida dentro del patrimonio natural del Estado, es inalienable.

En la derogada Ley forestal No. 4465, artículo 32 se estableció que “El patrimonio forestal del Estado está constituido por todos los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre…” Así, el artículo 33 de ese cuerpo legal indicaba que los bienes comprendidos en el patrimonio forestal del Estado no eran susceptibles de inscripción en Registro mediante información posesoria. Sin embargo, con posterioridad la ley forestal No. 4465 fue reformada por la Ley No. 7174 que en lo que interesa reguló en el artículo 2 la modificación al numeral 7 de la Ley de Informaciones Posesorias No. 139. Es así como la modificación al artículo 7 de la Ley de Informaciones Posesorias operó en el sentido que las áreas que estén fuera de zonas declaradas parques nacionales, reservas biológicas, reservas forestales o zonas protectoras, pero que contengan bosques, “…sólo podrán ser tituladas si el promoverte demuestra haberlas poseído por diez años o más y haber protegido dicho recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado con cercas o carriles limpios…” De dicho artículo 7 de la Ley de Informaciones posesorias, se deriva con claridad la voluntad del legislador, en el sentido que es procedente la inscripción de terrenos con cobertura boscosa, en el tanto se acrediten los presupuestos de cerramientos y protección del recurso natural.

Analizada la actual ley forestal No. 7575, en su artículo 13, no se deduce que haya operado derogatoria expresa, ni tácita del numeral 7 de la Ley de Informaciones posesorias. Más bien, se modifica reforzando la titulación. En el artículo 13 de la Ley forestal No. 7575, se define el concepto de patrimonio natural del Estado, entendido como: “constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio…” Nótese que el patrimonio natural del Estado refiere a terrenos forestales de reservas nacionales; de conformidad con el artículo 11 de la Ley de Tierras y Colonización, tratándose de terrenos sin inscribir es dable el amparo de la posesión decenal de particulares, siendo pertinente la prueba en contrario en cuanto a la naturaleza de reserva nacional.

Consecuentemente, los alegatos de la representación estatal no se acogen. Es criterio de esta sede que en bienes como el que nos ocupa, en el cual existen áreas boscosas, y el inmueble no se ubica en las zonas indicadas en el párrafo primero del artículo 7 de la Ley de informaciones posesorias, sí es procedente la inscripción de terrenos con bosques mediante el trámite de información posesoria. Lo anterior, en el entendido que deben acreditarse todos los requisitos de forma y de fondo en cuanto a la posesión especial exigida. En el presente asunto, se deduce de las declaraciones de los deponentes [Nombre4] , [Nombre5] , [Nombre6] , a folios 151 a 154, que el terreno objeto de titulación ha sido poseído tanto por los anteriores dueños, como por la promovente en ganadería, agricultura, y además han mantenido el bosque. Esa situación fue verificada en el acta de reconocimiento judicial, visible a folio 88.

En ese orden, se infiere que la posesión ejercida por la parte promovente es conteste con las exigencias legales de carácter ambiental, pues se ha protegido el recurso bosque, según se observó en el reconocimiento judicial, y las declaraciones de los testigos citados. Incluso, el Ingeniero Shiriam Yassir Farah G., certificador de uso del suelo, a folios 58 y 75 indica que en el fundo relacionado se ha ejercido el uso conforme del suelo para la actividad que realiza de acuerdo a la metodología aprobada. Según el certificador de uso del suelo, en el fundo hay cultivos anuales, y bosque-Rodal puro de jaúl, con arbustos de Guayabillo, Turruz y Calas, siendo que recomienda propiciar la regeneración forestal natural y no cortar árboles en la zona de protección de la quebrada. En el reconocimiento judicial visible a folio 88, el juzgador consigna que el inmueble se encuentra cercado, observando que las cercas se notan antiguas, hay una casa, cultivos de brócoli que se notó cosechado; asimismo que al fondo del terreno hay una quebrada con una pendiente casi vertical y está debidamente protegida y cubierta de árboles.

De tal manera, se ha acreditado el requisito establecido en el artículo 7 de la Ley de Informaciones Posesorias, en el sentido que el fundo está debidamente cercado y se ha cuidado el recurso forestal e hídrico. Asimismo, de acuerdo al acta de reconocimiento visible a folio 88, el terreno esta dedicado en un 70 % a agricultura, y solamente en un tercio existe bosque, precisamente en área donde existe una pendiente pronunciada y corresponde a área de protección. De ese modo no aplica el concepto de "bosque" de la Ley Forestal 7575. Por consiguiente no se comparten los alegatos de la representación estatal.

V.Respecto al agravio relativo a que no se demostró la posesión decenal, tampoco es de recibo. Del documento a folio 83, se infiere que la promovente adquirió el terreno por donación que le hizo su esposo [Nombre7] conocido como [Nombre8] , en el año 1987. Ello es consteste con las declaraciones testimoniales, quienes refieren a la cadena de transmitentes, siendo que coinciden en que perteneció al señor [Nombre9] , luego a [Nombre3] , quien a su vez traspasó a sus hijas [Nombre10], [Nombre11] , [Nombre12] y [Nombre13]; y estas últimas le vendieron al esposo de la promovente, quien le donó. La posesión de los anteriores dueños es superior a los diez años, toda vez que los deponentes dan fe de la misma, porque conocen la finca desde hace más de veinte años, según lo declararon a folios 151 a 154. Los testigos enuncian que la posesión ha sido sin problemas con terceros, continua, y la promovente es conocida como la dueña. Por consiguiente, sí se ha acreditado la posesión decenal, de forma que la promovente aprovecha el tiempo de posesión ejercido por su transmitente, de conformidad con el artículo 1 de la Ley de Informaciones Posesorias. En consecuencia, procede el rechazo de los agravios invocados, y deberá confirmarse la sentencia en lo que objeto de apelación.

POR TANTO:

Se confirma la resolución recurrida, en lo que fue objeto de apelación. Se modifica en cuanto al lindero este del inmueble a titular, en el sentido que el frente a calle pública con la cual colinda es de noventa y cuatro metros con treinta y dos centímetros lineales.- [Nombre14] [Nombre15] [Nombre16] INFORMACIÓN POSESORIA [Nombre1] D+G+V
