JUDGMENT NO. 0 952-F-10 AGRARIAN COURT OF THE SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. Goicoechea, at catorce horas veinte minutos on doce de octubre de dos mil diez.- POSSESSORY INFORMATION PROCEEDING (INFORMACIÓN POSESORIA), brought by [Nombre1], of legal age, married once, secretary, resident of Turrialba, identity card CED1 - -. Participating in the proceeding are the PROCURADURÍA GENERAL DE LA REPÚBLICA, represented by Lydiana Rodríguez Paniagua, whose personal details are not recorded in the case file, in her capacity as Deputy Attorney General, and the INSTITUTO DE DESARROLLO AGRARIO, legal entity identification number CED2 - - -, represented by Carmelina Vargas Hidalgo, of legal age, divorced, attorney, resident of Guachipelín, Escazú, identity card CED3 - -, in her capacity as general judicial attorney-in-fact. The proceeding was heard before the Juzgado Agrario de Turrialba. WHEREAS:

  1. 1The petitioner brings a possessory information proceeding for the purpose of having the following property registered in her name in the Registro Público de la Propiedad: “land cultivated with coffee and timber trees, located in San Gerardo, [Dirección1],, in the Province of Cartago, bounded to the North by [Nombre2], to the South by [Nombre3], to the East by [Nombre4], and to the West by [Dirección2], fourteen meters wide, with frontage thereon of one hundred twenty-nine linear meters and fifteen centimeters, having an area of ten thousand three hundred eighty-three square meters and sixteen square decimeters, and depicted on cadastral survey plan number C-1246514-2007,” (folio 98).-
  2. 2The Procuraduría General de la República and the Instituto de Desarrollo Agrario appeared in the proceeding under the terms shown at folios 34 to 40 and 46, respectively, neither expressing opposition to these proceedings.-
  3. 3Attorney Wilberth Herrera Delgado, the trial judge, by judgment issued at diez horas cinco minutos on diecisiete de agosto de dos mil diez, ruled: “THEREFORE: Attorney Lydiana Rodríguez Paniagua’s request concerning proof of possession prior to the enactment of the Ley Forestal is denied. Because all requirements for obtaining title to real property through this proceeding have been fulfilled, and pursuant to Articles 1, 4, 7, 15, 16, and 19 of the Ley de Informaciones Posesorias and Articles 853, 856, and 860 of the Código Civil, these possessory information proceedings are approved. The Registro Público de la Propiedad is ordered to register the property in the name of [Nombre1], who is of legal age, married once, a secretary, resident of Turrialba, [Dirección3], [Dirección4] Santa Rosa, and holder of identity card number CED5, without prejudice to third parties having an equal or superior right of possession, and with notice that the area adjacent to Quebrada Danta constitutes a protection area (área de protección), where the cutting or removal of trees is prohibited, and that the watercourse of that stream is in the public domain (dominio público) (Ley de Aguas, Article 1, subsection IV, and Article 3, subsection III); the land described as follows: land cultivated with coffee and timber trees, located in San Gerardo, [Dirección5], [Dirección6] quinto Turrialba, in the Province of Cartago, bounded to the North by [Nombre2], to the South by [Nombre3], to the East by [Nombre4], and to the West by [Dirección7] pública, fourteen meters wide, with frontage thereon of one hundred twenty-nine linear meters and fifteen centimeters, having an area of ten thousand three hundred eighty-three square meters and sixteen square decimeters, and depicted on cadastral survey plan number C-1246514-2007.The adjoining landowners were notified, and the notice was published in Judicial Bulletin number ciento noventa y ocho of catorce de octubre del dos mil ocho. The land is duly demarcated, and the title applicant has possessed it for veintisiete años quietly, peacefully, publicly, continuously, and as owner, including the possession previously exercised over it by her transferor. This land was valued at cuatro millones de colones, and these proceedings were assessed at that same monetary amount. During the proceeding, the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria determined that possession of this land had been exercised in compliance with the permitted land use (uso conforme del suelo) for the activity carried out, in accordance with the approved methodology. (See certification appearing at folios 5 and 6).-”, (folio 100).-
  4. 4Attorney Lydiana Rodríguez Paniagua, in her capacity as Deputy Attorney General, filed an appeal expressly stating the reasons for which she disputes the trial court’s position, (folios 104 to 107).-

5. In the conduct of the proceeding, the statutory requirements have been observed, and no errors or omissions capable of rendering the judgment null and void are apparent.

CONSIDERING

I. The proven facts are adopted because they are consistent with the merits of the case file

II.Attorney Lydiana Rodríguez Paniagua, in her capacity as Deputy Attorney General of the Republic, appeals resolution number 54-10, issued at diez horas cinco minutos on 17 de agosto, by the Juzgado Agrario de Turrialba. She bases her disagreement on the following: 1. The land-use certificate (certificado de uso de suelos) states that the nature of the property is forested (mountain land). She states that, although forestry legislation permits title to be obtained for properties outside protected wilderness areas (áreas silvestres protegidas) where legitimate rights arising from ten years of possession are demonstrated, consideration must be given to the declaration of forest-domain status (dominio forestal), under which forestlands and forests within national reserves are subject to the public domain and constitute the State’s natural heritage (Patrimonio Natural del Estado), at least since Ley Forestal 4465 de 1969, Article 33, as amended by Ley Forestal 7174 de 1990 (Articles 32 and 33), a public-domain status (carácter demanial) maintained by Ley 7575, Articles 13 and 14.

In the appellant’s view, title may be obtained to forestland only if acquisitive prescription (usucapión) had been completed before the land became part of the State’s Natural Heritage by operation of law. In this case, she contends that the witness testimony does not establish the ten years of possession required for the petitioner to acquire title by prescription. Accordingly, she concludes that, because the requested title concerns property belonging to the public domain, namely the State’s natural heritage, she requests that the judgment be reversed and that these proceedings instead be denied approval (folios 104, 105).

III.The grievances raised by the Procuraduría must be analyzed with respect to the two grounds for appeal. The first ground concerns the assessment of the evidence (apreciación de la prueba), which in this case relates to whether or not a forest exists on the petitioner’s property, and the second concerns its legal interpretation of the application of forestry regulations. We shall first analyze the assessment of the evidence. It must first be made clear that, in agrarian matters, there is no formal system of evidence (prueba tasada). Evidence in proceedings submitted to the Agrarian Courts (Tribunales Agrarios) is evaluated in accordance with the principles derived from Article 54 of the Ley de Jurisdicción Agraria. This provision establishes that, when ruling on the merits of the case, the judge shall evaluate the evidence according to conscience (en conciencia); however, the judge must state the grounds in equity or law on which the decision is based.

This method of evaluating evidence is known as free assessment of evidence (libre apreciación valoratoria) and has been subject to constitutional review, with the Chamber stating as follows: “…. The authority granted to the agrarian judge to evaluate evidence according to conscience and to weigh it without strict adherence to the rules of ordinary law, as provided in the second paragraph of the challenged Article 54, is not unconstitutional, provided that the judge issues a reasoned judgment—that is, analyzes the evidence collected in the proceedings and states the principles of equity or law on which the judge’s opinion is based—thereby respecting the minimum requirements of the right of defense...” (Sala Constitucional, Voto [Telf1]). When this method of assessment is applied to the specific case, the conclusion is that the Procuradora’s assertion is incorrect, because she does not properly evaluate the certificate in question or assess the evidence presented as a whole.

It should be noted that the land-use conformity certificate (certificación de uso conforme del suelo) issued by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria, while indicating that the current use of 21% of the land is forest (equivalent to 2136.64 square meters), clarifies in the observations section that “trees such as laurel and cedar are planted,” and its recommendations include continuing to plant those trees. (folios 4 and 5). That assessment is supported by the judicial inspection (reconocimiento judicial) recorded at folio 31, which states: “The property is used for planting timber trees of the laurel species and some fruit trees, such as sweet orange, mandarin lime, and sweet lime; an abandoned coffee crop was also observed on the property.” If this were not sufficient, all of the testimonial evidence is consistent on the same points (folios 28, 29,30).

From all of the foregoing, we conclude that the purported forest noted in the certificate is a timber-tree plantation, which is in fact improving the forest cover (cobertura forestal) of the land, and is neither a primary nor even a secondary forest. It is therefore necessary to determine the legal regime applicable to this type of forestry planting, which brings us to the second ground for appeal: the legal interpretation given to the applicable legal provisions under Forestry Law (Derecho Forestal).

In forestry matters, the applicable regulations are not limited to Ley Forestal 7575; in analyzing each case, account must be taken of the conceptual evolution that has occurred in this field. In another decision, 149- F- 05, this Court analyzed the legal framework to be considered when interpreting agrarian-environmental disputes and forestry regulations, stating as follows: “It was at the United Nations Conference on Environment and Development (UNCED), known as the Rio Summit and held in 1992, that new principles for the international community were consistently developed in several legal instruments, such as the Rio Declaration on Environment and Development; the so-called Agenda XXI, which was an action plan to promote sustainable development; and a nonbinding Declaration of Principles on Forests. Two legally binding instruments were also opened for signature: the Framework Convention on Climate Change and the Convention on Biological Diversity.

Negotiations also began on the Convention to Combat Desertification, which was opened for signature in 1994 and entered into force in December 1996; all of these were signed by our country. Finally, the 2002 Johannesburg Summit followed up on the Rio Agreements. As a result of these new principles incorporated into our legal system, the concept of sustainable development (desarrollo sostenible) is now recognized and is already included in Article 1 of the current Ley Forestal, which provides, insofar as relevant: ‘This law establishes as an essential and priority function of the State the duty to ensure the conservation, protection, and administration of natural forests, and the production, harvesting, industrialization, and promotion of the country’s forest resources intended for that purpose, in accordance with the principle of the proper and sustainable use of renewable natural resources.

It shall also ensure job creation and improvement of the standard of living of the rural population through its effective integration into silvicultural activities.’ (emphasis added). The concept was similarly regulated in Article 2(c) of the Ley Orgánica del Ambiente and in Article 9 of the Ley de Biodiversidad, the relevant portion of which we reproduce: Article 9: General principles: The following, among others, constitute general principles for purposes of applying this law: …4. Intragenerational and intergenerational equity. The State and private parties shall ensure that the elements of biodiversity are used sustainably, so that the possibilities and opportunities for their use and the benefits thereof are fairly guaranteed for all sectors of society and to meet the needs of future generations.” In the case of both the Ley de Biodiversidad and the Ley de Suelos, the Agrarian Jurisdiction (Jurisdicción Agraria) has an actual duty to apply these principles, because both laws granted the Agrarian Courts jurisdiction over actions arising from them (Article 108 of the Ley de Biodiversidad and Article 54 of the Ley de Suelos).

The principle of sustainable development incorporated into our legislation encompasses at least three dimensions: economic, social, and environmental or ecological. This means that when analyzing a case involving biodiversity, forest resources, or the environment in general, we must take into account that sustainable development is achieved not only through ecological preservation, but also by attaining a balance with the social dimension, which seeks equitable development for rural inhabitants, and with the so-called economic dimension, which recognizes the need to assign value to our natural resources...” The foregoing shows that, in the case of forestry regulation of forest resources, the applicable rules must be interpreted in light of both national provisions and the principles and rules derived from international conventions signed by the country, with the understanding that there is both private forest property (propiedad forestal privada) and forest subject to public regulations, and that forest property serves a complex function, as established in Article 1 of Ley Forestal 7575: on the one hand, it is suitable for production and the rural development of local communities through silviculture, and, on the other, for conservation and the generation of environmental services (servicios ambientales).

In the present case, the Procuradora asserts that, because a forest exists, the calculation of the period of possession must date back to Ley 4465 of 1969, since, in her view, forestlands and forests within national reserves have been subject to the public domain and constituted the State’s natural heritage (patrimonio natural del Estado) since Ley forestal 4465 of 1969. In this regard, it must be noted, as has already been clarified, that what occurred in the present case was the planting of timber trees in an area of slightly more than two thousand meters. From a technical standpoint, the definition of forest in our country is as follows: “A native or indigenous ecosystem, whether disturbed or undisturbed, regenerated through natural succession or other forestry techniques, occupying an area of two or more hectares and characterized by the presence of mature trees of different ages, species, and sizes, with one or more canopies covering more than seventy percent (70%) of that area, and containing more than sixty trees per hectare with a diameter of fifteen or more centimeters measured at breast height.” (Article 3, subsection d), of Ley Forestal 7575).

Applying this definition, the area within the petitioner’s property could not in itself be considered forest because it does not exceed two hectares. Beyond that, however, it is instead a planting of timber trees, which is subject to a legal regime different from that governing forests. Ley Forestal distinguishes between the two concepts; in the case of a forest plantation (plantación forestal), the emphasis is on the fact that its principal, although not exclusive, purpose is timber production (Article 3, subsection f)), and what is required in such cases for harvesting is a certificate of origin (certificado de origen).

Having clarified the issue concerning the forest, another aspect of the appeal must also be addressed: the period for calculating forest possession (posesión forestal) on privately owned land. Article 7 of the Ley de Informaciones Posesorias, amended specifically by Ley Forestal 7575 of 1996, establishes that properties located outside protected areas and containing forest may be titled, provided there have been at least ten years of possession and the natural resource has been protected. It is therefore unclear why a private owner of unregistered forest property would be required to prove forest possession extending beyond those ten years when the case does not involve protected wildlife areas (áreas silvestres protegidas) or land subject to the State’s natural heritage, as established in Article 13 of Ley Forestal 7575. The amendment to Article 7 of the Ley de Informaciones Posesorias is part of the same law that enacted Ley 7575; consequently, when the definition of the State’s natural heritage was approved, the provision establishing the possession sufficient to obtain title (posesión apta para titular) was also approved.

In the present case, according to the certificate issued by the Instituto de Desarrollo Agrario appearing at folio 46, the land for which title is sought does not correspond to land owned or administered by that Institution, nor are we dealing with protected wildlife areas; therefore, the definition in Article 13 of Ley Forestal 7575 is inapplicable.

Finally, it is important to remind the Procuradora of the purposes of sustainable development, a principle of constitutional rank derived from Article 50 and incorporated into forestry legislation, one of which is precisely to promote rural development, as expressly provided by the Ley Forestal itself, compliance with which is an obligation of the Procuraduría. That provision states that one of the objectives of the law is to generate employment and income by “improving the standard of living of the rural population through its effective integration into silvicultural activities...” (Article 1, Ley Forestal 7575). In the present matter, the petitioner is planting timber species on part of her property, thereby improving the quality of the soil and the environment. This objective will also enable her to generate income that will improve her quality of life; the titling of such areas should instead be encouraged as a means of securing land-tenure rights (derechos de tenencia de la tierra) and promoting rural development.

For all the reasons stated, this ground must be rejected, and the challenged decision must be affirmed insofar as it was appealed.

THEREFORE

The challenged decision is affirmed.

RESULTANDO:

  1. 1El promovente plantea proceso de información posesoria con el fin de que se inscriba a su nombre en el Registro Público de la Propiedad la finca que describe así: “ terreno cultivado por café y árboles maderables, sito en San Gerardo, [Dirección1] , , de la Provincia de Cartago, linda al Norte con [Nombre2] , al Sur con [Nombre3] , al Este con [Nombre4] y al Oeste con [Dirección2] de catorce metros de ancho y con un frente a ella de ciento veintinueve metros con quince centímetros lineales, posee una cabida de diez mil trescientos ochenta y tres metros con dieciséis decímetros cuadrados y descrito en el plano catastrado número C-1246514-2007, ” (folio 98 ).-
  2. 2La Procuraduría General de la República y e l Instituto de Desarrollo Agrario, se apersonaron al proceso en los términos visibles de folios 34 a 40 y 46 ; respectivamente, sin manifestar ambos su oposición a las presentes diligencias.-
  3. 3El licenciado Wilberth Herrera Delgado , juez de primera instancia , mediante sentencia de las diez horas cinco minutos del diecisiete de agosto de dos mil diez , resolvió: “ POR TANTO: Se rechaza la solicitud de la licenciado Lydiana Rodríguez Paniagua, en cuanto demostrar posesión antes de la creación de la Ley Forestal. Por haberse cumplido todos los requisitos exigidos para titular un inmueble mediante este proceso y de conformidad con los artículos 1, 4, 7, 15, 16 y 19 de la Ley de Informaciones Posesorias y 853, 856 y 860 del Código Civil, se aprueban las presentes diligencias de información posesoria. Se ordena al Registro Público de la Propiedad, inscribir a nombre de [Nombre1] , quien es mayor de edad, casada una vez, secretaria, vecina de Turrialba, [Dirección3] , [Dirección4] Santa Rosa y con cédula de identidad número CED5 , sin perjuicios de terceros con igual o mejor derecho de posesión y con la advertencia de que el área contiguo a la Quebrada Danta, constituye área de protección y queda prohibida la corta o eliminación de árboles, además que el cauce de las aguas de esa corriente son de dominio público (Ley de Aguas, artículos 1 inciso IV y 3 inciso III); el terreno que se describe a continuación: terreno cultivado por café y árboles maderables, sito en San Gerardo, [Dirección5] , [Dirección6] quinto Turrialba, de la Provincia de Cartago, linda al Norte con [Nombre2] , al Sur con [Nombre3] , al Este con [Nombre4] y al Oeste con [Dirección7] pública de catorce metros de ancho y con un frente a ella de ciento veintinueve metros con quince centímetros lineales, posee una cabida de diez mil trescientos ochenta y tres metros con dieciséis decímetros cuadrados y descrito en el plano catastrado número C-1246514-2007.Los colindantes fueron notificados y el edicto fue publicado en el boletín judicial número ciento noventa y ocho del catorce de octubre del dos mil ocho. El terreno se encuentra debidamente deslindado y la titulante lo ha poseído durante veintisiete años en forma quieta, pacifica, pública, ininterrumpida y a título de dueña, lo anterior sumada la posesión ejercida sobre el mismo por su trasmitente. Este terreno fue estimado en la suma de cuatro millones de colones, siendo estimadas estas diligencias en esa misma suma de dinero. Durante el proceso se determinó por parte del Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria, que sobre este terreno, se ha ejercido la posesión cumpliendo con el uso conforme del suelo para la actividad que realizan de acuerdo con la metodología aprobada. (ver certificación que corre a folios 5 y 6).- ”, (folio 100 ).-
  4. 4La licenciada Lydiana Rodríguez Paniagua, en su condición de Procuradora Adjunta, formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia, (folios 104 a 107 ).-

5. En la substanciación del proceso se han observado las prescripciones legales, y no se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad.

Redacta el Juez Bolaños Céspedes, y;

CONSIDERANDO

I. Se prohíjan los hechos probados por estar ajustados al mérito de los autos

II.La Licenciada Lydiana Rodríguez Paniagua, en su carácter de Procuradora Adjunta de la República apela de la resolución número 54-10 de las diez horas cinco minutos del 17 de agosto , del Juzgado Agrario de Turrialba . Fundamenta su inconformidad en lo siguiente: 1. En el certificado de uso de suelos consta que la naturaleza del inmueble es boscosa ( montaña). Indica que aún cuando la legislación forestal permite titular inmuebles fuera de las áreas silvestres protegidas, si se demuestran los legítimos derechos de posesión decenal, ha de tenerse en cuenta la declaratoria de dominio forestal, de que los terrenos forestales y bosques de las reservas nacionales están afectos al dominio público, patrimonio natural del Estado, al menos desde la ley Forestal 4465 de 1969, artículo 33, reformada por la ley Forestal 7174 de 1990 ( artículos 32 y 33 ) y carácter demanial que mantiene la Ley 7575, artículos 13 y 14.

A juicio de la apelante los terrenos de bosque solo podrán titularse si la usucapión se había consolidado antes de ingresar por ley al Patrimonio Natural del Estado. En este caso, a su criterio las declaraciones de los testigos no demuestran la posesión decenal para usucapir en cabeza de la promovente. Así las cosas, concluye, por pretenderse la titulación de un bien perteneciente al dominio público como lo es el patrimonio natural del Estado, solicita la revocatoria de la sentencia y en su lugar se proceda a improbar las presentes diligencias ( folios 104, 105)

II I .- El análisis de los agravios planteados por la Procuraduría se debe hacer en cuanto a los dos motivos de apelación. El motivo relacionado con la apreciación de la prueba, que en este caso se refiere a la existencia o no de bosque en la finca de la promovente y el que se refiere a la interpretación legal que hace de la aplicación de la normativa forestal. Pasamos a analizar en primer término lo que se refiere a la apreciación de la prueba. Hay que tener claro en primer lugar que en materia agraria, no existe la prueba tasada. La valoración probatoria de los procesos sometidos al conocimiento de los Tribunal Agrarios se realiza conforme los principios derivados del artículo 54 de la Ley de Jurisdicción Agraria. Esta norma dispone que al resolver sobre el fondo del negocio, el juez apreciará la prueba en conciencia, sin embargo deberá fundamentar las razones de equidad o derecho en que basa su resolución.

Este sistema de valoración de la prueba se conoce como libre apreciación valoratoria, y ha sido sometido al control constitucional, señalando la Sala lo siguiente: “…. No resulta inconstitucional el poder otorgado al juez agrario para apreciar en conciencia la prueba y valorarla sin sujeción estricta a las normas del derecho común según lo dispuesto en el párrafo segundo del artículo 54 impugnado, siempre y cuando dicte un fallo fundamentado, es decir analice el resultado de la prueba recogida en el proceso y exprese los principios de equidad o de derecho en que basa su criterio, respetando de tal modo los contenidos mínimos del derecho de defensa..." ( Sala Constitucional, Voto [Telf1] ). Aplicado al caso concreto, este método de valoración, se llega a la conclusión de que lo afirmado por la Procuradora es incorrecto , pues no valora correctamente el certificado que da cuenta, ni valora en su conjunto la prueba ofrecida .

Obsérvese que la certificación de uso conforme del suelo expedida por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria, si bien indica que el uso actual del terreno en un 21% es bosque ( equivalente a 2136.64 metros cuadrados) , aclara en el ítem de observaciones, que : “ se siembran árboles como laurel y cedro” y dentro de las recomendaciones se contempla continuar con esa siembra de árboles. ( folios 4 y 5). Esa apreciación es respaldada por el reconocimiento judicial visible a folio 31, donde se consigna que: “ El inmueble está destinado a la siembra de árboles maderables de la especie laurel y algunos árboles frutales tales como naranja dulce, limón mandarino y limón dulce, también se observó dentro del mismo un cultivo de café en abandono “. Si esto no fuere suficiente, toda la prueba testimonial es conteste en los mismo s extremos ( folios 28, 29,30). De todo lo anterior concluimos que el llamado bosque consignado en la certificación, es una plantación de árboles maderables, que justamente están mejorando la cobertura forestal del terreno y no un bosque primario, ni siquiera secundario.

De manera entonces que debe analizarse cuál es el régimen aplicable a este tipo de siembras forestales , lo que nos lleva al segundo motivo de apelación y es la interpretación jurídica que se le da a las normas jurídicas de aplicación por parte del Derecho Forestal. En materia forestal la normativa aplicable no es solamente la ley forestal 7575, para realizar un análisis de cada caso debe tenerse en cuenta la evolución conceptual que se ha dado en el tema. En otro Voto, el 149- F- 05, este Tribunal analizaba el tema del marco legal a tener en cuenta para la interpretación de conflictos agro ambiental y normas forestales, manifestándose lo siguiente : " Fue en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y Desarrollo (CNUMAD) conocida como Cumbre de Río, celebrada en el año 1992 que se elaboran consistentemente nuevos principios para la comunidad internacional, desarrollados en varios instrumentos legales como la Declaración de Río sobre Medio Ambiente y Desarrollo, la llamada Agenda XXI que era un Plan de acción para promover el desarrollo sostenible, además se emite una Declaración de Principios relativos a los bosques, sin carácter vinculante y se abren a firma dos instrumentos con fuerza jurídica, la Convención Marco sobre Cambio Climático y el Convenio sobre Diversidad Biológica, también se iniciaron negociaciones sobre la Convención de Lucha contra la Desertificación la cual quedó abierta a la firma en 1994 y entró en vigor en diciembre de 1996, todos ellos suscritos por nuestro país.

Finalmente en la Cumbre de Johannesburgo del 2002, se le dio seguimiento a los Acuerdos de Río. Como consecuencia de esos nuevos principios incorporados a nuestro ordenamiento jurídico, se habla hoy del concepto de desarrollo sostenible, el cual ya está incluido en la ley Forestal vigente en su artículo primero: que establece en lo de interés: “ La presente ley establece como función esencial y prioritaria del Estado, velar por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables. Además velará por la generación de empleo y el incremento del nivel de vida de la población rural, mediante su efectiva incorporación a las actividades silviculturales.”.

( el subrayado es nuestro ) En el mismo sentido se reguló el concepto en el artículo 2 inciso c) de la Ley Orgánica del Ambiente y en la Ley de Biodiversidad en su artículo 9, el cual transcribimos en lo que interesa: Artículo 9: Principios generales: Constituyen principios generales para los efectos de la aplicación de esta ley, entre otros, los siguientes: …4. Equidad intra e intergeneracional. El Estado y los particulares velarán porque la utilización de los elementos de la biodiversidad se utilicen en forma sostenible, de modo que las posibilidades y oportunidades de su uso y sus beneficios se garanticen de manera justa para todos los sectores de la sociedad y para satisfacer las necesidades de las generaciones futuras. “ Tanto en el caso de la Ley de Biodiversidad, como la de Suelos, existe verdadera obligación de la Jurisdicción Agraria para aplicar esos principios por cuanto, tanto una ley como la otra le dieron competencia a los Tribunales Agrarios para conocer de las acciones derivadas de ellas ( artículos 108 de la Ley de Biodiversidad y 54 de la Ley de Suelos).

El principio del desarrollo sostenible incorporado en nuestra legislación contempla al menos tres dimensiones, la económica, la social y la ambiental o ecológica. Quiere decir que al analizarse un caso de biodiversidad, recursos forestales, o en general del ambiente debemos tomar en cuenta, que el desarrollo sostenible no solo se logra a través de la preservación ecológica, sino también logrando el equilibrio, con la dimensión social que busca un desarrollo con equidad para los habitantes rurales y la llamada dimensión económica que entiende es necesario darle valor a nuestros recursos naturales..." De lo expresado anteriormente, se observa que en el caso de la regulación forestal de los recursos forestales, la normativa debe ser interpretada, atendiendo tanto a normas nacionales, como a los principios y normas derivados de convenciones internacionales, firmada por el país y entendiendo existe entonces tanto propiedad forestal privada, como bosques sujetos a regulaciones de carácter público, y que la propiedad forestal tiene una función compleja, conforme lo establece el artículo 1 de la Ley forestal 7575, pues por un lado es apta para la producción y el desarrollo rural de las comunidades locales, en el área de silvicultura, como para la conservación y generación de servicios ambientales.

En el presente caso la Procuradora afirma que al existir bosque, debe remitirse para el cómputo de la posesión hasta la ley 4465 de 1969, pues a su entender los terrenos forestales y bosques de las reservas nacionales están afectos al dominio público, patrimonio natural del Estado desde la Ley forestal 4465 de 1969. Debe indicarse al respecto, y ya se ha aclarado, que en el presente caso lo que se ha dado es la siembra de árboles maderales en una área de poco más de dos mil metros. Desde el punto de vista técnico, en nuestro país, la definición de bosque es la siguiente: " Ecosistema nativo o autóctono, intervenido o no, regenerado por sucesión natural u otras técnicas forestales, que ocupa una superficie de dos o más hectáreas, caracterizada por la presencia de árboles maduros de diferentes edades, especies y porte variado, con uno o más doseles que cubran más del setenta por ciento (70%) de esa superficie y donde existan más de sesenta árboles por hectárea de quince o más centímetros de diámetro medido a la altura de pecho.." (artículo 3, inciso d), de la Ley Forestal 7575).

Aplicando esta definición, el área dentro de la finca de la promovente ya de por sí no podría considerarse bosque por cuanto no supera las dos hectáreas. Pero más allá de ello, se trata más bien de una siembra de árboles maderales, con un régimen jurídico distinto al del bosque. La Ley Forestal hace la diferenciación entre uno y otro concepto, así el en el caso de la plantación forestal, el énfasis está puesto en que el objetivo principal, aunque no único, es la producción de madera ( artículo 3, inciso f), y lo que se exige en estos casos, para su extracción, es un certificado de origen. Aclarado el punto relacionado con el tema del bosque debe también precisarse otro aspecto de la apelación, y es el referido al plazo de cómputo de la posesión forestal en terrenos privados. El artículo 7 de la Ley de Informaciones Posesorias, reformado precisamente por la Ley Forestal 7575 de 1996, establece que son titulables las fincas ubicadas fuera de las áreas protegidas, que tengan bosque siempre y cuando se cuente con diez años de posesión al menos y se haya protegido el recurso natural.

No se entiende entonces por qué tendría que obligarse a un propietario particular con propiedad forestal no inscrita a demostrar una posesión forestal más allá de esos diez años, si en el caso no se está en presencia de áreas silvestres protegidas o terrenos sujetos al patrimonio natural del estado, como establece el artículo 13 de la ley Forestal 7575. La reforma al artículo 7 de la Ley de Informaciones Posesorias es parte de la misma Ley que promulgó la Ley 7575, y por ende cuando se aprobó la definición de patrimonio natural del Estado, también se aprobó la norma que establece la posesión apta para titular. En el presente caso conforme a la certificación emanada por el Instituto de Desarrollo Agrario visible a folio 46, el terreno a titular no corresponde a tierras en propiedad o bajo administración de esa Institución, ni estamos en presencia de áreas silvestres, por lo que no es aplicable la definición del artículo 13 de la Ley Forestal 7575.

Finalmente es importante recordar a la Procuradora, los fines del desarrollo sostenible, principio que tiene rango constitucional, derivado del artículo 50, incorporado en la legislación forestal, uno de los cuales es justamente buscar el desarrollo rural, como lo concreta la propia ley forestal, cuyo cumplimiento es obligación de la Procuraduría. Dice esa norma que parte de los objetivos de esa ley es la generación de empleo e ingreso " incrementando el nivel de vida de la población rural, mediante su efectiva incorporación a las actividades silviculturales ..." (artículo 1, Ley Forestal 7575). En el presente asunto la promovente está sembrando parte de su finca de especies maderables, con lo cual está mejorando la calidad del suelo, y el ambiente. Este objetivo también le va a permitir generar un ingreso, que mejorará su calidad de vida; la titulación de esas áreas debe ser más bien estimulado, como una forma de asegurar los derechos de tenencia de la tierra, y favorecer el desarrollo rural. Por todas las razones indicadas debe rechazarse este motivo, y lo procedente será confirmar en lo que ha sido objeto de apelación la resolución recurrida.

POR TANTO

Se confirma la resolución recurrida.
