Full cognizance proceeding (proceso de conocimiento) declared subject to expedited procedure, filed by the Contraloría General de la República, represented by Nombre602, of legal age, married, attorney-at-law, holder of national identity document (cédula de identidad) number CED413, residing in Santa Bárbara de Heredia, and Nombre603, of legal age, married, attorney-at-law, holder of national identity document number CED414, residing in San Francisco de Heredia, against the Instituto de Desarrollo Agrario, represented by its Executive President, Nombre127833, of legal age, married, holder of national identity document number CED102868, residing in San Isidro de Heredia, and Nombre125801, of legal age, married once, farmer, holder of national identity document number CED110553, residing in Dirección16929.
BACKGROUND 1- The Contraloría General de la República files the complaint that gave rise to these proceedings against the Instituto de Desarrollo Agrario and Mr. Nombre125801, seeking the following relief as set out in the statement of claim: "1) That the resolution of the Board of Directors (Junta Directiva) of the Instituto de Desarrollo Agrario, contained in Article 32 of session number 016-04 — dated May 3, 2004 — be annulled, solely as it concerns the issuance of title (titulación) to a property (finca) in favor of Mr. Nombre125801, described in cadastral survey plan (plano catastrado) number Placa26957.
3- By means of ruling number 700-2008, at sixteen hours and twenty minutes on the eighteenth of September, two thousand and eight, this Tribunal granted the request for a precautionary measure (medida cautelar) inaudita altera parte, filed by the oversight body.
4- The Instituto de Desarrollo Agrario responded to the complaint in timely and proper form, requesting that it be dismissed, that it be exempted from liability for damages and losses, and that it be relieved from court costs and attorneys' fees. It also filed a jurisdictional objection (excepción de incompetencia) based on subject-matter jurisdiction.
5- The defendant Nombre125801 responded to the complaint in timely and proper form, requesting that it be rejected and the file closed.
6- At the precautionary measure hearing held at eight-thirty in the morning on the third of October, two thousand and eight, oral judgment number 766-2008 was issued, whereby the jurisdictional objection based on subject-matter jurisdiction filed by the representative of the Instituto de Desarrollo Agrario was rejected.
7- During the continuation of the precautionary measure hearing, held at eight thirty-five in the morning on the eighth of October, two thousand and eight, this judicial body, by means of an oral judgment under the same ruling number 700-2008, upheld the content of the precautionary measures provisionally accepted and partially granted the measures requested in the expansion thereof filed by the oversight body, with the required precautionary measures set forth in the following terms: "1) The defendant Nombre125801 is ordered to refrain from carrying out burning or felling of forest (bosque) anywhere on the property that is the subject of these proceedings.
8- In ruling number 000028-C-S1-2009, issued by the Sala Primera de la Corte Suprema de Justicia at ten thirty in the morning on the fifteenth of January, two thousand and nine, the objection (inconformidad) filed by the Instituto de Desarrollo Agrario against ruling number 766-2008, issued by this Tribunal, was declared without merit, and it was declared that jurisdiction over these proceedings belongs to the Tribunal Contencioso Administrativo.
9- By ruling number 000136-A-TC-2009, issued by the Tribunal de Casación de lo Contencioso Administrativo at ten o'clock in the morning on the twenty-first of July, two thousand and nine, the appeal (recurso de apelación) filed against ruling 700-2008 was deemed abandoned, and said ruling granting the precautionary measures was declared final.
10- In accordance with articles 60, paragraph 3), and 70, paragraph 2), of the Código Procesal Contencioso Administrativo, this Tribunal convened a single hearing held beginning at eight twenty-two in the morning on the third of August, two thousand and nine, at which the matters referred to in article 90 of said Code were heard and resolved. At that hearing, the claims numbered 4), 5), and 6) in the statement of claim were adjusted and reformulated as follows: "4) That the property registered under Folio Real matriculation number Placa26958 was registered in a technically and legally improper manner in favor of Mr. Nombre125801. 5) That the property described in cadastral survey plan number Placa26959 is State Natural Heritage and therefore subject to administration by MINAET, and that the Instituto de Desarrollo Agrario shall take the appropriate actions to prepare the deed of transfer in favor of the State and to process its inscription in the Public Registry with the corresponding change in its legal nature. 6) That MINAET be placed in possession of said property and that Mr.
Nombre125801 be evicted." 11- At the hearing held at the hour and date noted above, these proceedings were declared to involve a pure question of law (puro derecho), as there was no testimonial or expert evidence to be heard, pursuant to article 98, paragraph 2), read in conjunction with article 60, paragraph 3), both of the Código Procesal Contencioso Administrativo. The parties therefore proceeded to present their closing arguments orally before the members of this Section of the Tribunal.
12- Upon conclusion of the closing arguments presented by both parties at the hearing referred to above, this Tribunal declared these proceedings to be a complex matter for the purposes of article 111, paragraph 1), of the Código Procesal Contencioso Administrativo, read in conjunction with article 82, paragraph 1), of the Reglamento Autónomo de Organización y Servicio de la Jurisdicción Contencioso Administrativa y Civil de Hacienda.
13- The case file was referred to the reporting judge (juez ponente) beginning on the day following the single hearing, on the fourth of August, two thousand and nine. Furthermore, the time limit for issuing this judgment was suspended by a ruling of this Tribunal at sixteen hours and twenty-five minutes on the seventh of August, two thousand and nine, due to the existence of a force majeure circumstance (causal de fuerza mayor) affecting the Reporting Judge, pursuant to article 81, paragraph 1), of the Reglamento Autónomo de Organización y Servicio de la Jurisdicción Contencioso Administrativa y Civil de Hacienda; accordingly, the suspension of the fifteen-business-day time limit ran from August 10 through August 14, 2009, with the remaining eleven business days resuming from the seventeenth through the thirty-first of August, two thousand and nine.
14- In the proceedings before this Tribunal, no nullities (nulidades) have been observed that must be remedied or that give rise to a violation of the right of defense (indefensión); accordingly, pursuant to article 111 of the cited Code, read in conjunction with articles 79 and 82 of its Regulations, after deliberation, this Tribunal proceeds with the drafting, writing, and communication of this judgment within the legally established time limit. This judgment is issued with the drafting by Reporting Judge González Vílchez and the affirmative votes of Judges Álvarez Molina and Garita Navarro; and
WHEREAS
I- PROVEN FACTS: The following facts are found to be established as relevant for the purposes of these proceedings:
It was established that the defendant Nombre125801 does not reside on the property that is the subject of these proceedings (see the judicial site inspection (reconocimiento judicial) recorded in digital format and located in the case file);
II- UNPROVEN FACT: Determinative for the resolution of the present case, the following fact is considered unproven: 1) That co-defendant (codemandado) Nombre125801 acted in bad faith at the time of requesting the title issuance (titulación) of the property that is the subject of these proceedings and in its subsequent title issuance (the case record).
III- ON THE SUBJECT MATTER OF THESE PREFERENTIAL ADMINISTRATIVE CONTENTIOUS PROCEEDINGS: The Contraloría General de la República brings this matter before this judicial forum, seeking the annulment of the resolution of the Board of Directors of the Instituto de Desarrollo Agrario, contained in Article 32 of session number 016-04, dated May 3, 2004, exclusively as it relates to the title issuance of a registered parcel (finca) in favor of co-defendant Nombre125801, described in cadastral plan (plano catastrado) number Placa26957, as well as the annulment of notarial deed (escritura pública) number 47, executed before Public Notaries Giovanni Varela Dijeres and Alba Iris Ortiz Recio, at 8:00 a.m. on May 24, 2004, which formalized and registered in notarial protocol the title issuance made by the Instituto de Desarrollo Agrario, exclusively as it relates to the title issuance of a parcel in favor of Señor Nombre125801.
Likewise, the oversight body requests the annulment of the registry entry (asiento registral) of registration of the parcel recorded under the Folio Real system, registration number Placa26958 (titled parcel), issued by the Registro Nacional. Furthermore, the plaintiff body requests a declaration that the parcel registered under Folio Real registration number Placa26958 was registered in an improper manner, from both a technical and legal standpoint, in favor of Señor Nombre125801, as well as a declaration that the property described in cadastral plan number Placa26959 constitutes Natural Heritage of the State (Patrimonio Natural del Estado) and that, consequently, the competent authority to exercise its administration is the Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET), and that the Instituto de Desarrollo Agrario must take the appropriate actions to prepare the deed of transfer in favor of the State, as well as to process its registration in the Registro Público with the corresponding change in its legal classification.
Finally, the Contraloría General de la República requests that MINAET be placed in possession of that parcel, that Señor Nombre125801 be evicted therefrom, that the defendants be ordered to pay, in the abstract, the damages and losses caused, and that they be ordered to pay the costs of these proceedings. The oversight body bases its claims on the following grounds: 1. The Sala Constitucional annulled, as unconstitutional, the Regulations for Title Issuance in National Reserves (Reglamento para la Titulación en Reservas Nacionales), and therefore, by extension, all administrative acts issued on the basis of those regulations are null and void, including the resolution of the Board of Directors of the Instituto de Desarrollo Agrario (hereinafter IDA), by which co-defendant Nombre125801 was granted title to a parcel located in La Sabana, in the district of La Legua, canton of Aserrí, province of San José, with an area of 35 hectares, 82.59 square meters, corresponding to cadastral plan SJ-600333-99, as well as the acts deriving therefrom, such as the notarial deed of transfer of the property and the corresponding registry entry; 2.
The parcel to which the IDA granted title to defendant Nombre125801 consists of forests that constitute the Natural Heritage of the State, and therefore that parcel is public-domain (dominio público) or demanial property, which is consequently non-attachable (inembargable), imprescriptible, and inalienable, meaning that the IDA could not grant title deeds over property of this nature. For this reason, it requests that the parcel be declared Natural Heritage of the State and that its possession, as well as its ownership, be transferred to the State, specifically to MINAET; 3. The Law on Land Use, Management, and Conservation of Soils (Ley de Uso, Manejo y Conservación de Suelos) obligates the IDA to carry out a land-use capacity study (estudio de capacidad de uso de suelo) prior to granting any title issuance, a requirement that the IDA unlawfully failed to meet at the time of issuing title to the property that is the subject of these proceedings in favor of co-defendant Nombre125801.
Furthermore, the Regulations to the Law on Land Use, Management, and Conservation of Soils precluded the IDA from issuing titles over land not classified for agricultural purposes. For its part, the IDA, a co-defendant in this matter, set forth its defensive arguments, stating, in substance, the following: 1. Co-defendant Nombre125801 met all of the requirements then in force for the granting of title, and the IDA acted within the block of legality (bloque de legalidad) and within the regulatory framework governing its activities; 2. The certificate prepared by the Área de Conservación Pacífico Central of the Sistema de Áreas de Conservación of the Ministerio de Ambiente y Energía, number ACOPAC-OTC-065, submitted during the title issuance process, indicated that the property at issue in these proceedings was located outside the Protected Wildlife Areas (Áreas Silvestres Protegidas) and was not an area protected under Article 33 of the Ley Forestal, Ley 7575, and therefore the IDA acted in conformity with the law; 3.
Although Article 27 of the Law on Land Use, Management, and Conservation of Soils does establish the requirement that the IDA carry out land-use capacity studies, that provision applies to parcels purchased by the IDA with its own resources for the purpose of establishing rural settlements (asentamientos campesinos), which is not the case here, since what occurred was that an Executive Decree transferred thousands of hectares throughout the national territory, and therefore that provision cannot be applied to this matter; 4. Although the Regulations to the Law on Land Use, Management, and Conservation of Soils require an adequate land-use conformity study (estudio de uso conforme de suelos) for title issuance proceedings carried out by the IDA, it was considered that such studies were to be carried out by the Ministerio de Agricultura y Ganadería, a responsibility subsequently assigned to the Instituto de Innovación y Transferencia de Tecnología Agropecuaria (hereinafter INTA), and that, due to a shortage of human and technical resources, those studies only began to be conducted as of the year two thousand and one; 5.
At the time title was granted to the defendant, INTA did not have the mechanism or organizational structure in place to handle land-use conformity certifications (certificaciones de uso conforme de suelos) on behalf of the IDA, as it was INTA that was responsible for carrying out those certifications; moreover, INTA suspended that type of certification. For his part, co-defendant Nombre125801 argues in his defense that he had always been in possession of the parcel over which the IDA granted him title, having even received the possessory rights (derechos de posesión) to that parcel from his own mother. He further argues that he submitted the documents required by the IDA, and that the IDA thereupon granted him title. He states that he has always worked that parcel with a number of head of cattle and has always respected and preserved the forest located within the property. Having set out the arguments of the parties in dispute, this Tribunal proceeds to analyze the substantive arguments in order to determine which party is in the right in this matter.
IV- THE NATURAL HERITAGE OF THE STATE AS AN EXPRESSION OF THE FUNDAMENTAL RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT, RECOGNIZED AND PROTECTED BY CONSTITUTIONAL LAW: This judicial body considers that, before resolving the specific case, it is necessary to refer to what this very Section of this Tribunal has already explained, as a general framework, regarding what is understood as the Natural Heritage of the State in forest areas. In this regard, resolution number 0063-2009, issued at 4:00 p.m. on January 19, 2009, stated, insofar as it is relevant to the rendering of this judgment, as follows:
Constitutional recognition of the fundamental right to a healthy and ecologically balanced environment (derecho fundamental a un ambiente sano y ecológicamente equilibrado). In Costa Rica, the recognition and protection of the aforementioned fundamental right within Constitutional Law (Derecho de la Constitución) does not originate with the amendment to Article 50 of the Constitución Política, enacted by Ley número 7412 of June 3, 1994. This is so because, from the time the constitutional text was promulgated in 1949, the intent of the Constituent Assembly (Constituyente) was clear in establishing in Article 89 that: "Among the cultural aims of the Republic are: to protect natural beauty, to conserve and develop the historical and artistic heritage of the Nation, and to support private initiative for scientific and artistic progress"; which is complemented by the unequivocal declaration contained in Article 21, to the effect that in our country, "Human life is inviolable." The integration of the provisions of both articles implies that the need to preserve the environment—even though at that time the Constituent Assembly used the term "natural beauty"—transcends a purpose of a merely cultural nature, becoming instead a vital necessity for every human being, since it constitutes an essential prerequisite for giving effect to other fundamental rights such as: life, health, and development.
(See, in this regard, rulings number 1993-03705 of fifteen hours on July 30, 1993; 1993-06240 of fourteen hours on November 26, 1993; 1993-04423 of twelve hours on December 7, 1993; and 1994-02485 of nine hours and eighteen minutes on May 27, 1994, all issued by the Sala Constitucional de la Corte Suprema de Justicia.) In this regard, it should be recalled that Constitutional Law is composed not only of the constitutional text itself, but also of the values and principles that inform and permeate its content, as well as Public Treaties, International Conventions, and Concordats duly approved by the Asamblea Legislativa, and the International Human Rights Instruments applicable in the Republic (see Articles 1, 7, 21, 50 of the Constitución Política; and Articles 1 and 3 of the Ley de la Jurisdicción Constitucional). Furthermore, both written and unwritten norms that make up Constitutional Law are characterized by being directly and immediately applicable; accordingly, those to whom they are addressed not only have the right to enforce them through administrative and judicial channels if they consider that such norms have been impaired by act or omission, but it also follows that legal practitioners have a duty to apply them directly and immediately in their decision-making process, in order to fulfill constitutional requirements (see the ruling by the Sala Constitucional de la Corte Suprema de Justicia in ruling number 1999-00644 of eleven hours and twenty-four minutes on January 29, 1999).
Taking as a basis the provisions of Articles 7 and 48 of the Constitución Política, and Articles 1 and 3 of the Ley de la Jurisdicción Constitucional, we may affirm that even if the constitutional text had not contained provisions recognizing and protecting the fundamental right to a healthy and ecologically balanced environment, that right and its correlative duty would not only have already existed within Costa Rican domestic law, but their effective protection would have been enforceable at both the domestic and international level. This is by virtue of the fact that the Costa Rican State had subscribed to a series of Conventions, Treaties, and International Instruments related to this subject matter prior to the amendment of Article 50 of the Constitución Política by Ley número 7412 of June 3, 1994, among which the following stand out: the "Pacto Internacional de Derechos Económicos, Sociales y Culturales" (Articles 2.1, 12.1, and 12.2.c); the "Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos Económicos, Sociales y Culturales" (Article 11); the "Convención para la Protección del Patrimonio Cultural y Natural," subscribed in Paris on November 23, 1972, and approved by Ley número 5980 of October 23, 1976; the "Convención para la Protección de la Flora, de la Fauna y de las Bellezas Escénicas Naturales de los Países de América," adopted in Washington on March 3, 1973, and approved by Ley número 3763 of October 19, 1976; the "Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas," subscribed at Ramsar on February 2, 1971, and approved by Ley número 7224 of 1991; the "Convenio de Viena para la Protección de la Capa de Ozono," adopted in Vienna on March 22, 1985, and approved by Ley número 7228 of April 22, 1991, and its "Protocolo de Montreal Relativo a Sustancias Agotadoras de la Capa de Ozono," subscribed in Montreal on September 16, 1987, and approved by Ley número 7223 of April 2, 1991; the "Convención de la ONU sobre el Derecho del Mar," subscribed in Montego Bay on December 10, 1982, and approved by Ley número 7291 published on July 15, 1992, among others.
All of these international norms were incorporated into Costa Rican domestic law in accordance with the provisions of Articles 7 and 48 of the Constitución Política, and Articles 1 and 3 of the Ley de la Jurisdicción Constitucional, so that "...all of these international instruments are of mandatory compliance and enjoy full enforceability insofar as their provisions do not require further legislative development and must therefore be respected (...) given that the normative rank of the former is superior..." (Ruling number 1993-06240 issued by the Sala Constitucional de la Corte Suprema de Justicia at fourteen hours on November 26, 1993).
Sub-constitutional (infraconstitucional) development of the fundamental right to a healthy and ecologically balanced environment. Undoubtedly, the recognition and protection of the aforementioned fundamental right gave rise to its sub-constitutional development through the enactment of statutory or regulatory norms governing its various manifestations, many of which were issued well before the amendment to Article 50 of the Constitución Política. Examples of these include: the Ley de Aguas (No. 276 of August 27, 1942); the Ley de Planificación Urbana (No. 4240 of November 15, 1978); the Ley Forestal (No. 4465 of November 25, 1979, now repealed); the Ley de la Zona Marítimo Terrestre (No. 6043 of March 2, 1977); the Ley General de Salud (No. 5395 of October 30, 1973); the Ley de Creación del Servicio de Parques Nacionales (No. 6084 of August 24, 1977); the Ley de Salud Animal (No. 6243 of May 2, 1978); the Ley de Conservación de la Vida Silvestre (No. 7317 of October 21, 1992), among others.
This implies that, prior to the amendment of Article 50 of the Constitución Política, the fundamental right to which we have been referring was not only recognized and protected within Constitutional Law, but had also been developed—though in a sectoral manner and without an integrated vision—at the statutory and regulatory level. In light of all that has been set forth thus far, this Tribunal considers that the amendment to Article 50 of the Constitución Política did nothing more than expressly and individually recognize a fundamental right that was already enshrined and guaranteed by Constitutional Law; declare expressly the scope of the pre-existing obligation of the State to guarantee, defend, and preserve the right to a healthy and ecologically balanced environment; and grant individuals full standing to defend it through a popular action (acción popular) (see rulings number 1994-01394 of fifteen hours and twenty-one minutes on March 16, 1994, and 1994-05527 of ten hours and forty-five minutes on September 23, 1994, both issued by the Sala Constitucional de la Corte Suprema de Justicia).
Consequences of recognizing the guarantee of Article 50 of the Constitución Política in the terms explained. Such recognition entails two aspects that are relevant to the resolution of the present proceeding. First. The imposition of a duty—on the State, understood as both the Central and Decentralized Administration, as well as on private legal persons—to guarantee, defend, and preserve that right. Second. The establishment of a series of technical-legal mechanisms to achieve effective protection of that right, at both the administrative and jurisdictional levels. With regard to the first of these aspects, it should be noted that "The impact that the right to a healthy and ecologically balanced environment has upon the activities of the State, and correspondingly of municipalities (bearing in mind Article 169 of the Constitución Política), finds its primary justification in the fact that, by definition, rights are not limited to the private sphere of individuals but also bear upon the very structure of the State in its role as guarantor of those rights and, secondly, because the activities of the State are directed toward the satisfaction of collective interests.
The Constitución Política establishes that the State must guarantee, defend, and preserve that right. Prima facie, to guarantee means to secure and protect the right against some risk or need; to defend means to prohibit, forbid, and prevent any activity that threatens the right; and to preserve is an action directed at proactively shielding the right from possible dangers in order to ensure its endurance for future generations. The State must assume a dual role of action and inaction; on the one hand, it must refrain from itself infringing upon the right to enjoy a healthy and ecologically balanced environment, and on the other hand, it must undertake the task of issuing measures that fulfill the constitutional requirements..." (Ruling No. 1999-00644 issued by the Sala Constitucional de la Corte Suprema de Justicia at 11:24 hours on January 29, 1999). In this regard, "...The action that the Constitución Política imposes upon the State in the face of sources of environmental contamination is multidirectional and definitively active, absolutely intolerant of situations that threaten or affect the optimal environmental conditions guaranteed by the Constitución Política itself to the inhabitants.
From this perspective, public authorities are not permitted to make concessions or grant extensions that allow environmental damage to continue, even when such concessions are made with a view to bringing economic benefits to a particular geographic area..." (Ruling No. 1999-05906 issued by the Sala Constitucional de la Corte Suprema de Justicia at 16:15 hours on July 28, 1999). This constitutional duty of the State to oversee the protection, defense, and preservation of the environment is developed and expressed, among others, in the following provisions: Articles 1, 2.a.
2.c, 2 last paragraph, 3, 12, 28, 32, 34, 37, 56, 59, 78, 83, 103 through 112 of the Organic Law of the Environment; Articles 1, 2, 9.4, 12, 22 through 30, 45, 49, 54, 86, 88 of the Law on Biodiversity; 3, 4, 6, 7, 15, 34, 122 of the Law on Conservation of Wildlife; 1, 2, 5, 6, 13, 37, 54 of the Ley Forestal; 5, 6, 7, 11, 21, 29 through 33, 37 of the Law on the Use, Management, and Conservation of Soils; 13.a, 13.o of the Municipal Code; 11, 12, 13, 17, 18, 19, 21, 22, 25 of the Law on the Maritime-Terrestrial Zone; 1, 2 of the General Health Law; 1, 2, 17, 175, 176 of the Water Law; 15, 18, 19, 51, 56, 58.5, Transitional Provision II of the Urban Planning Law. That duty, moreover, is not confined to the State as a whole but extends also to private-law subjects, who hold the right to enjoy a healthy and ecologically balanced environment and who likewise bear the obligation to guarantee, preserve, and defend it, as follows, among others, from Articles 1 first paragraph, 2.a, 6, 22, 23, 99 of the Organic Law of the Environment; 10.2, 10.13, 11.4, 88, 95, 101, 105 of the Law on Biodiversity; 15, 28 through 30, 36 through 38, 51 through 53, 62 through 64, 83, 88 through 121 of the Law on Conservation of Wildlife; 57 through 66 of the Ley Forestal; 37, 40, 41 through 45, 51 through 53 of the Law on the Use, Management, and Conservation of Soils; 14 of the Law on the Maritime-Terrestrial Zone; as well as from judgments number 1999-02219 handed down at fifteen hours eighteen minutes on the twenty-fourth of March of nineteen ninety-nine; 1999-05906 issued by the Constitutional Chamber of the Supreme Court of Justice at sixteen hours fifteen minutes on the twenty-eighth of July of nineteen ninety-nine, among others.
With respect to the second aspect—relating to the establishment of a series of technical and legal mechanisms designed to achieve effective protection of that right, both at the administrative and judicial levels—this Tribunal considers that those protective mechanisms may be classified into two broad groups: procedural and substantive. It should be clarified that, although concrete examples related to each of the classification criteria mentioned above will be referenced, this Tribunal's intention is not to establish a numerus clausus list but merely to highlight, through those examples, aspects that bear on the subject matter of the present proceedings.
In that regard, within the group of procedural protective mechanisms (mecanismos de tutela de índole procesal), three examples deserve particular mention:
In that regard, the legal practitioner (operador del derecho) must always bear in mind that "…when there is a threat of serious or irreversible damage, lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation…".
On the other hand, within the group of substantive protective mechanisms (mecanismos de tutela de índole material), the following two manifestations are particularly representative: 1) The environmental impact assessment (evaluación de impacto ambiental, EIA) conducted by SETENA as a sine qua non requirement before commencing activities, works, or projects that may alter or destroy elements of the environment or biodiversity, or generate waste or toxic or hazardous materials. This requirement has been in effect since November 13, 1995, the date on which the Organic Law of the Environment was published. It is also regulated by Articles 92 through 97 of the Law on Biodiversity; Article 14 of the Convention on Biological Diversity and its Annexes I and II; Principle 17 of the United Nations Conference on Environment and Development, Rio Declaration; Article 18 of the Ley Forestal; the General Regulation on Environmental Assessment Procedures (Decreto Ejecutivo número 31849-MINAE-S-MOPT-MAG-MEIC), among others.
In this regard, constitutional case law has established that "…the fact that both the right to health and the right to enjoy an ecologically balanced environment are recognized as fundamental rights obliges the Constitutional Chamber to clarify that the solution to any problem cannot be grounded in quick fixes; that, in order to reach a decision in this field, technical studies must be available demonstrating that the proposed solution, in each specific case, will not be the source of a public health problem or of undue interference with the environment…" (Among others, judgment No. 1995-02671 issued by the Constitutional Chamber of the Supreme Court of Justice at 16:45 on May 24, 1995). In that regard, "…it is not possible for the State to execute or authorize the execution of projects about which there is doubt as to the negative impact they may generate on the environment. Consequently, the failure to conduct a prior environmental impact study amounts to a violation of Article 50 of the Constitution…" (judgment No. 1999-02219 issued by the Constitutional Chamber of the Supreme Court of Justice at 15:18 hours on the twenty-fourth of March of nineteen ninety-nine).
On the State Natural Heritage.
In keeping with the subject matter of the present proceedings, this Tribunal will focus its analysis on the State Natural Heritage (PNE). In view of the terms in which the fundamental right to a healthy and ecologically balanced environment has been recognized, as already explained, it is important to note that Forest Law No. 4465, already cited (subsequently repealed by Ley Forestal number 7575 of February 5, 1996), not only established "…as an essential function and state priority, to safeguard the protection, conservation, exploitation, industrialization, administration, and promotion of the country's forest resources, in accordance with the principle of rational use of renewable natural resources…" (Article 1), but also defined the concepts of Forest (bosque) (Article 6) and the State Forest Heritage (Patrimonio Forestal del Estado) (Article 32, first paragraph).
With respect to the State Forest Heritage, Law No. 4465 established its characteristics (Article 33); the competent bodies to administer and oversee the State Forest Heritage, which under that legislation were the General Forestry Directorate (Dirección General Forestal) and the Ministry of Environment and Energy (Article 32, second paragraph), as well as the powers conferred upon those bodies for the purpose of protecting and conserving the State Forest Heritage. Among those powers, the following are worth highlighting: 1) Revindicatory actions (acciones reinvindicatorias) with respect to those immovable properties (Article 33); 2) The establishment, within the State Natural Heritage, of forest reserves (reservas forestales), protection zones (zonas protectoras), national parks (parques nacionales), national wildlife refuges (refugios nacionales de vida silvestre), and biological reserves (reservas biológicas) (Articles 35 through 37); 3) Boundary demarcation (deslinde) of the areas comprising the State Forest Heritage (Article 38).
In the currently applicable Ley Forestal No. 7575, that concept is retained but with a change of name: it is now called the State Natural Heritage (Patrimonio Natural del Estado). This term is broader in scope, as it encompasses the protection and preservation of the forest ecosystem (Article 3, subparagraph c of the Ley Forestal). The State Natural Heritage forms part of the public domain; accordingly, the lands and forests included within it are exempt from attachment, not subject to adverse possession, and inalienable. Likewise, its conservation and administration are entrusted by law to the Ministry of Environment, Energy and Telecommunications (MINAET), through SINAC, as provided in Articles 6.a, 13 second paragraph, and 14 of the aforementioned Ley Forestal and in Article 32, second paragraph of the Organic Law of the Environment.
The PNE is composed of two important components: 1) Protected Wild Areas (Áreas Silvestres Protegidas), regardless of their management category and whether they have been declared by Law or by Executive Decree, namely: forest reserves, protection zones, national parks, biological reserves, national wildlife refuges, wetlands (humedales), and natural monuments (monumentos naturales) (Ley No. 7575, Article 1°, paragraphs 2° and 3°, subparagraph i; Organic Law of the Environment, Article 32; Law on Biodiversity, Articles 22 et seq. and 58; Law on the National Parks Service, Article 3°, subparagraphs d and f, in relation to the Organic Law of MINAE and its Regulations; Law on Conservation of Wildlife, Article 82, subparagraph a); 2) All other forests and forest lands forming part of the inalienable areas, of the registered properties (fincas) held in its name, and of those belonging to the Municipalities, autonomous institutions, and other public administrative bodies, which carry an immediate legal encumbrance by operation of law, except for those immovable properties that serve as collateral for credit transactions with the National Banking System and thereby enter into its assets (Article 13, first paragraph of the Ley Forestal).
It should be noted that both Protected Wildlife Areas (Áreas Silvestres Protegidas) and the remaining forested areas and forestry-suitable lands (terrenos de aptitud forestal) within the maritime-terrestrial zone (zona marítimo terrestre) are excluded from the regulatory scope of Ley No. 6043 and, therefore, from the jurisdiction of the Municipalities, as will be elaborated further below. These zones are subject to their own legislation (Ley Forestal), which means that their administration falls under the Ministry of Environment, Energy, and Telecommunications, through the Sistema Nacional de Áreas de Conservación (see, in this regard, judgment number 2008-16975 issued by the Sala Constitucional of the Supreme Court of Justice at fourteen hours and fifty-three minutes on the twelfth of November of two thousand eight). Now, among the duties that MINAET and SINAC are responsible for in the conservation and protection of the State National Heritage (Patrimonio Nacional del Estado, PNE) are:
First. Since the environment constitutes the Common Heritage (Patrimonio Común) of all inhabitants of the Nation, the State Natural Heritage constitutes a species of that genus (articles 50, second paragraph; 89; 121, subsection 14, first paragraph of the Constitution; article 2, subsection a) of the Ley Orgánica del Ambiente; article 1 of the Ley de Biodiversidad; and article 13 of the Ley Forestal).
Second. There is an immediate legal dedication (afectación legal inmediata) to the State Natural Heritage of all lands comprising protected wildlife areas, areas declared inalienable — such as the maritime-terrestrial zone (article 73 of Ley 6043) —, forestry-suitable lands, and properties registered in the name of the State, the Municipalities, Autonomous Institutions, and other entities of the Decentralized Public Administration (Administración Pública Descentralizada).
Third. The State Natural Heritage does not require an express declaration, given that, pursuant to articles 13 and 14 of the Ley Forestal, as well as the rulings of the Sala Constitucional in judgments 1992-03789 and 1997-04587, forested areas, forestry-suitable lands, mangroves (manglares), and wetlands (humedales) within inalienable areas — such as the maritime-terrestrial zone — are immediately dedicated to this Heritage without any action by the Administration being required.
Fourth. Consequently, the demarcation of the boundaries of the areas making up the State Natural Heritage, as provided in article 16 of the Ley Forestal, constitutes a power that MINAET, through SINAC, must exercise on its own motion (de oficio) and not only upon a party's request. This follows not only from the duty imposed by articles 21, 50 second and third paragraphs, and 89 of the Constitution to guarantee, preserve, and conserve the fundamental right to a healthy and ecologically balanced environment, but also because the law does not indicate that demarcation must be carried out only upon a party's request. In the view of this body, the State cannot validly invoke a lack of resources to that end, as constitutional case law (jurisprudencia constitucional) has repeatedly held (see, among others, judgments 1995-00915 of sixteen hours and six minutes of the fifteenth of February of nineteen ninety-five; and 1996-000695 of fifteen hours and forty-two minutes of the seventh of February of nineteen ninety-six).
Fifth. Consequently, the classification carried out by the Sistema Nacional de Áreas de Conservación with respect to the type of ecosystem existing on properties within the State Natural Heritage constitutes merely a categorization of those properties, in accordance with the classification criteria set forth in article 13, first paragraph of the Ley Forestal and Executive Decree number 34295-MINAE, namely: forests, forestry-suitable lands, wetlands, mangroves, among others.
Sixth. It is evident that the State has a duty — both at the constitutional and statutory level — to guarantee, defend, and protect forested areas, forestry-suitable lands, mangroves, wetlands, and similar areas within inalienable zones — such as, in this case, the Zona Marítimo Terrestre — which, by the mere fact of possessing that character, became directly and automatically dedicated to the State Natural Heritage. Therefore, the result of classifying the type of ecosystem present in those areas — which must be carried out on its own motion and not only upon a party's request, in order to take the measures necessary to achieve their effective protection and conservation — is not what determines whether or not they are incorporated into the State Natural Heritage, since by law they had already been dedicated to it by virtue of being inalienable zones.
From the cited ruling, the following aspects relevant to the resolution of this case may be highlighted:
V- ON THE NULLITY OF THE TITLING (TITULACIÓN) CARRIED OUT BY THE IDA IN FAVOR OF CO-DEFENDANT Nombre125801, UPON TRANSFER OF A PROPERTY THAT IS STATE NATURAL HERITAGE: In this case, it has been established as proven that the property at issue in these proceedings, located in La Sabana, in the district of La Legua, canton of Aserrí, province of San José, with an area of 35 hectares and 82.59 square meters, corresponding to cadastral map (plano catastrado) SJ-600333-99, was transferred to co-defendant Nombre125801 by the Board of Directors (Junta Directiva) of the Instituto de Desarrollo Agrario, under Artículo 32 of Session 016-04 of May 13, 2004, and that said land constitutes State natural heritage, for the following reasons: 1) During the proceedings prior to the IDA's Board of Directors titling the property in question to co-defendant Nombre125801, the latter was required to submit a series of documents, one of which was the certificate issued by M.s.c. Julio Bustamante B., Territorial Planning Coordinator of the Área de Conservación Pacífico Central, SINAC, Ministerio del Ambiente y Energía, number ACOPAC-OTC-065, dated November 25, 2002. That document stated, insofar as relevant to the issuance of this judgment, the following:
"I hereby certify that, upon inspection of the farm corresponding to cadastral map SJ-600333-99, with an area of 35 ha 0082.59 m2, located at Dirección15384, belonging to FR 1219039-000, registered in the name of Mr. Nombre125801, ID Placa23073, the land presents forest cover (cobertura boscosa) of natural forest (Bosque natural) and early-succession forest (bosque en sucesión temprana)." (...) "Furthermore, no indication is observed that the land is affected by artículo Nº 33 de la Ley Forestal Nº 7575 of February 5, 1996, and its amendments." It is important to note that this certificate clearly states that the land under dispute presents forest cover of natural forest and early-succession forest, and this court therefore finds that, even prior to the titling, technical evidence existed that the property was forested in nature. However, that same certificate states that the land is not observed to be affected by artículo 33 de la Ley Forestal; in the view of this court, all that the certificate was indicating was that the land was not located within a protected area.
This is entirely irrelevant in this case, because when artículo 33 is read in conjunction with artículo 13, both of the Ley Forestal, the conclusion is that State natural heritage consists of properties covered by forests regardless of whether they are located within or outside national reserves or protected areas. Accordingly, the defensive arguments advanced by the IDA — to the effect that the technical requirement of having a certificate or attestation from MINAET confirming the nature of the land had been fulfilled — were not in fact satisfied;
"The review of 1997 and 2003 aerial photographs in relation to the approximate location of the property on cadastral map SJ-6000333-99 has yielded the following conclusions: The land use of the property on cadastral map SJ-600333-99 is consistent with what is observed in the 1997 and 2003 aerial photographs; specifically: in both years, two forest patches existed coinciding with what the cadastral map describes as 'montaña'; likewise, the remainder of the farm area has a cover of intermixed grasses and shrubs, which is found primarily in the eastern sector of the property, referred to in the cadastral map as 'tacotales.'" This technical finding confirms what was stated both in the sworn declarations and in the cadastral map itself — namely, that the term "montaña" in reality denotes the existence of forest cover on the farm. This evidence likewise corroborates what was observed during the judicial inspection conducted by this Court: that forest exists and has existed on the property titled by the IDA in favor of defendant Nombre125801; 6) Another piece of technical evidence of fundamental importance consists of the findings set out in official communication DST-217-09 of July 23, 2009, issued by the Head of the Department of Technical Services of INTA, in which a Certificate of Conforming Land Use (Certificado de Uso Conforme del Suelo) was transmitted to the Contraloría General de la República — a certificate that, as will be explained in the following considerando, was never prepared during the titling process carried out by the IDA, even though this type of study is mandatory for the defendant institution.
The certificate was prepared by Agricultural Engineer (Ing. Agr.) German José Aguilar Vega, an INTA official, based on an inspection of the property at issue in these proceedings, in which land use on the property titled in the name of co-defendant Nombre125801 was divided and analyzed as follows: Sector A: Pasture (Potrero) 3.36 hectares (9.58%), Brushland (Charral) 5.23 hectares (14.91%), Forest (Bosque) 6.30 hectares (17.95%); Sector B: Forest 7.13 hectares (20.33%); Sector C: Pasture 2.90 hectares (8.27%); Sector D: Scrubland (Matorral) 10.16 hectares (28.96%). This breakdown is consistent with what the members of this Court observed on the ground, albeit from a technical and scientific perspective. Likewise, this certificate stated verbatim, insofar as relevant to the issuance of this ruling, the following:
"In accordance with Article 58 of the Regulations to the Law on Soil Use, Management, and Conservation, No. 7779 of April 30, 1998, and based on a field visit, this office certifies that on 9.58 percent of the property, conforming land use (uso conforme del suelo) for the activity carried out HAS NOT BEEN EXERCISED in accordance with the approved methodology, and on 90.42 percent, conforming land use for the activity carried out HAS BEEN EXERCISED in accordance with the approved methodology" (...) The current land use is pastureland (potrero), scrubland (charral), shrubland (matorral), and forest. (...) The pastureland, of the sparse herbaceous type (herbazal ralo) (...) acidic, degraded soils with low fertility (...) This type of pastureland likely allows only a low stocking rate (carga animal), of less than 1 animal unit per hectare per year. In Sector A, covered by pastureland, non-conforming land use is present; according to the current methodology for determining land-use capability (capacidad de uso de las tierras) in Costa Rica, the strongly undulating slope is the principal limiting factor of this area, which exceeds 40 percent—simple, convex, long, and west-facing—making the area unsuitable for its current use as pasture; its management is confined (sic) to forest production or permanent high-altitude crops, through intensive soil and water conservation practices.
(...) The scrubland is undergoing natural regeneration (regeneración natural) by native, pioneer species, which are abundant, with medium to high cover and heights approaching 1 meter. The forest is covered with trees and shrubs with a dense understory (sotobosque); the height of the upper stratum is approximately 15 meters, with evergreen, broadleaf, perennial species—particularly those of the family Fabaceae and oak trees (Quercus spp)—with numerous Bromeliaceae and Sphagnum epiphytes (epifitias), and lianas (bejucos) on their branches. The shrubland zone to the east of the property, with strongly rugged terrain toward (sic) the depression of the quebrada Pilas in the río Pirris watershed, corresponds to an ecosystem of sparse shrub vegetation dominated by Asteraceae ((Vernomia spp)), exposed to strong and constant winds and fog; consequently, the plants are small, branched, with twisted stems and leathery leaves; there are areas of exposed soil, which is extremely rocky with a very shallow effective soil depth.
Chasms, ravines (yurros), and the quebrada Lajas—which is protected by woodland—run through the area. The property is (sic) affected by Ley Forestal 7575, Article 33. Areas of natural regeneration, shrubland, and forest must be maintained under present conditions, which are consistent with the current land-use capability of the land. Classes VII and VIII, under current legislation, are designated for forest management or preservation of flora and fauna, protection of aquifer recharge (recarga acuífera) areas, genetic reserves, and scenic beauty." From what is expressed in this Conforming Land Use Certificate, prepared by INTA, this judicial body reaches the following conclusions: a) That a considerably high percentage of the hectares consists of forest, and furthermore, that the scrubland and shrubland zones are areas of natural regeneration that must be protected; consequently, the property that is the subject of these proceedings constitutes State natural heritage (patrimonio natural del Estado) in its entirety; b) This certification affirms that the titled property is affected by Article 33 of Ley Forestal 7575, meaning that it falls within a forest protection area; c) From the aforementioned certification, this judicial body may infer that the pastureland zone has low fertility, which means it is not well suited for the development of agricultural activities.
Indeed, this document states that in the pastureland zone only a very low cattle stocking rate is permitted; therefore, the property is likewise unsuitable for livestock activities. In other words, the property titled by the defendant institution in favor of co-defendant Nombre125801 does not qualify for agrarian purposes according to the conforming land use certification issued by INTA. Consequently, the property that the Board of Directors of the Instituto de Desarrollo Agrario, in its Article 32 of Session 016-04 of May 13, 2004, titled in favor of co-defendant Nombre125801 constitutes State natural heritage, in accordance with Articles 13, 14, 15, 16, 17, 18, and 33 of Ley Forestal número 7575; therefore it is unseizable, imprescriptible, and inalienable, being a public-domain asset (bien de dominio público), and accordingly the allegations of co-defendant Nombre125801—that his right to title derives from possessory rights exercised by himself and his family—are without merit, since on these lands, possession by private individuals shall give rise to no rights whatsoever in their favor.
Likewise, as the said property is State natural heritage, and as this public-domain character existed before, during, and after the titling procedure carried out by IDA, it renders absolutely null (nulidad absoluta) all formal administrative actions (conductas administrativas) that allowed the transfer of that property to defendant Nombre125801. Likewise, the administrative conduct carried out by IDA in this matter is considered abnormal functioning (funcionamiento anormal) which, as will be explained in the following considerandos, gives rise to administrative liability (responsabilidad administrativa) that must be compensated by that defendant institution.
VI- ON THE NULLITY OF THE TITLING CARRIED OUT BY IDA IN FAVOR OF CO-DEFENDANT Nombre125801, DUE TO THE ABSENCE OF SUPPORTING LEGAL AUTHORITY AND THE OMISSION OF REQUIRED STEPS DURING THE TITLING PROCEDURE: For this judicial body, what has been explained in the foregoing considerando alone is sufficient grounds to annul IDA's administrative actions and to uphold this claim; however, in the course of these proceedings, the parties have raised other grounds that vitiate the titling procedure carried out in favor of co-defendant Nombre125801, which this Tribunal must analyze. In this regard, the administrative actions carried out by IDA that are the subject of these proceedings are also rendered null for the following reasons: 1) It is established as proven that the titling carried out by IDA's Board of Directors of the disputed property in favor of co-defendant Nombre125801 was based on the Reglamento para la Titulación de Tierras en Reservas Naturales, approved by the Board of Directors of the Instituto de Desarrollo Agrario in its Article 2 of session zero fifty-five-zero two, held on August 12, 2002, and published in La Gaceta número 173 of September 10, 2002.
By means of a ruling issued by the Sala Constitucional of the Corte Suprema de Justicia, voto número 02063-07, of fourteen hours and forty minutes on February 14, 2007, said regulation was annulled as unconstitutional. Likewise, that judgment expressly stated the following:
"XV. On the Effects of the Declared Unconstitutionality: Pursuant to the provisions of Articles 90, first paragraph, and 91 of the Ley de la Jurisdicción Constitucional, the finding of unconstitutionality made in this judgment with respect to the Reglamento para la Titulación de Tierras en Reservas Nacionales, approved by the Board of Directors of the Instituto de Desarrollo Agrario by Article 11 of session número 055-02, of August 12, 2002, and published in the Diario Oficial La Gaceta número 173, of August 10, 2002, has declaratory and retroactive effects as of the date of entry into force of this regulatory instrument, namely August 12, 2002, such that recovery of assets that, being public-domain property, were the subject of titling under the regulations now annulled is warranted, without prejudice to the patrimonial liability of the State (responsabilidad patrimonial del Estado) arising from this unconstitutionality." Precisely, the titling carried out by IDA of the land that constitutes State natural heritage—for the reasons already explained—in favor of co-defendant Nombre125801 is not grounded in any authority existing within the legality framework (bloque de legalidad); therefore it constitutes a null administrative action by virtue of the declaration of unconstitutionality alone issued by our Constitutional Tribunal.
Furthermore, this Tribunal is concerned that, notwithstanding the order of the Sala Constitucional to the effect that public-domain assets that were the subject of titling under the Reglamento para la Titulación de Tierras en Reservas Naturales must be recovered, in this particular case IDA has taken no steps whatsoever aimed at complying with the order of the Sala Constitucional, which denotes a failure to act (conducta omisiva) and a clear violation of the duties incumbent upon all public administrations to protect State natural heritage—which constitutes abnormal functioning and, therefore, conduct contrary to law; 2) It is established as proven that by Executive Decree número 3667-G, issued on March 18, 1974, and published in La Gaceta número 72, Alcance 64, of April 17, 1974, an area of 267.239 hectares was transferred free of charge to the Instituto de Tierras y Colonización (the current IDA) in order to create the Programa de Titulación "Parrita-Puriscal," in which occupants of plots who had not regularized their possession of those lands were situated.
That land transferred to the Instituto de Tierras y Colonización (the current IDA) was registered in the Registro Nacional in the name of the Instituto de Desarrollo Agrario, under the folio real system, registry number Placa26960, which was the parent tract (finca madre). In turn, parcel número 92691, located within the Proyecto Puriscal Parrita—that is, a parcel split off (segregación) from the aforementioned parent tract, located in La Sabana, in the district of La Legua, canton of Aserrí, province of San José, with an area of 35 hectares, 82.59 square meters, corresponding to cadastral plan (plano catastrado) SJ-600333-99—was precisely the property that IDA's Board of Directors titled in favor of co-defendant Nombre125801, and which was registered in the Registro Nacional under folio real registry number Placa26958, in the name of defendant Nombre125801. Now, Executive Decree número 3667-G, issued on March 18, 1974, and published in La Gaceta número 72, Alcance 64, of April 17, 1974, was repealed by Executive Decree número 346554-MGP, published in the Diario Oficial La Gaceta número 147 of July 31, 2008, which provided, in its Article 2, verbatim as follows:
"The Instituto de Desarrollo Agrario is hereby authorized to proceed, through the corresponding procedure, to cancel the registrations in the Registro Público that were generated as a result of the aforementioned decrees." As is evident from the foregoing, the Executive Decree that created the parent parcel (finca madre)—from which the property titled by the IDA in favor of defendant Nombre125801 was in turn segregated—was repealed by a subsequent Executive Decree. As a result, the titling (titulación) performed in favor of defendant Nombre125801 lacks any foundational basis, since neither the original property nor the legal provision enabling the titling of those lands currently exists. Once again, this Tribunal notes that, notwithstanding the express order issued in Executive Decree No. 346554-MGP to the IDA to initiate procedures to cancel the registrations in the Public Registry that were generated by Executive Decree No. Placa20346, issued on the eighteenth of March of nineteen seventy-four, there has in this particular case been conduct by omission, as the IDA did not pursue the nullity of the title granted to co-defendant Nombre125801 through administrative proceedings (sede administrativa); 3) In addition to the grounds set forth above, there is one final argument raised by the Contraloría General de la República, to the effect that the Ley de Uso, Manejo y Conservación de Suelos requires the IDA to obtain a land-use capacity study (estudio de capacidad de uso de suelo) before granting any titling, a requirement that the IDA unlawfully failed to meet at the time it titled the property at issue in these proceedings in favor of co-defendant Nombre125801.
Furthermore, the Reglamento a la Ley de Uso, Manejo y Conservación de Suelos prohibited the IDA from titling lands that do not qualify for agrarian purposes. This Tribunal fully endorses this argument, given that it has been established as proven that at the time the Instituto de Desarrollo Agrario titled the property at issue in these proceedings in favor of co-defendant Nombre125801, the land-use capacity study required by Article 27 of the Ley de Uso, Manejo y Conservación de Suelos and by Articles 58, 59, 60, 61, 62, and 63 of the Reglamento to that Law had not been obtained. This is so because the IDA itself acknowledged as much in its statement of claim, and because at the preliminary hearing in this case all the facts alleged in the complaint were declared uncontested, including this fact. Likewise, this Tribunal finds that in this case there was a clear violation of the provisions set forth in Article 27 of the Ley de Uso, Manejo y Conservación de Suelos, which reads:
ARTICLE 27.— It shall be mandatory for the Instituto de Desarrollo Agrario to have land-use capacity studies before acquiring land for titling purposes.
Every adjudication of land shall be subject to the condition that the use of the adjudicated land may not conflict with its use capacity. Failure to comply with this provision shall result in revocation of the adjudication, in addition to any other penalties that may be imposed for criminal offenses attributable thereto.
It should be noted that the provision is very clear regarding the IDA's obligation to have land-use capacity studies prior to titling, and that failure to comply with that mandate shall result in revocation of the adjudication. This is precisely what occurred in this case, since in the titling performed in favor of co-defendant Nombre125801, the IDA neither requested nor obtained such a study, thereby flagrantly violating the cited provision. Accordingly, from this perspective as well, the titling performed in favor of co-defendant Nombre125801 is absolutely null and void. In this regard, the IDA's defensive argument—to the effect that, while Article 27 of the Ley de Uso, Manejo y Conservación de Suelos does indeed require the IDA to conduct land-use capacity studies, that provision applies to farms that the IDA purchases with its own funds for the establishment of Peasant Settlements (Asentamientos Campesinos), and that this is not such a case, since what occurred here was that thousands of hectares throughout the national territory were transferred by Executive Decree, and therefore that provision cannot apply in this matter—is entirely without merit.
This is because the cited article states "before acquiring land for titling purposes," and the provision draws no distinction as to whether the land acquired by the IDA is acquired by purchase with its own funds or by simple transfer, as in the present case established by Executive Decree. That is to say, Article 27 of the Ley de Uso, Manejo y Conservación de Suelos is mandatorily applicable to every titling of properties that the IDA carries out with respect to land that this institution acquires by any title transferring ownership (título traslativo de dominio). Furthermore, the IDA openly violated the provisions of Articles 58, 59, 60, 61, 62, and 63 of the Reglamento a la Ley de Uso, Manejo y Conservación de Suelos, Executive Decree No. 29375 MAG-MINAE-S-HACIENDA-MOPT, which state:
Article 58.— In every possessory information proceeding (información posesoria) or proceeding filed before the IDA or before the Courts of Justice for the purpose of registering property in the Public Property Registry, the interested party, in addition to the requirements imposed by common regulations, must demonstrate through an adequate soil study that possession has been exercised in compliance with the conforming land use (uso conforme del suelo) for the activity performed in accordance with the approved methodology, and that such activities have been carried out using best management practices according to the best available technology, in compliance with the provisions of Articles 3, 6, 12, 13, 19, 26, 27, 41, 43, and 64 of Ley Nº 7779 and this Reglamento.
Article 59.— The study shall be conducted by the Conforming Land-Use Certifier (Certificador de Uso Conforme del Suelo), who must analyze and certify, based on a field visit, whether possession in the activities carried out on the property has been exercised in accordance with the conforming land use for its classification, and that best soil and water management and conservation practices have been applied to the property in accordance with the approved methodology.
Article 60.— It is mandatory for the IDA to have soil studies, at least at a semi-detailed level, in coordination with the MAG, prior to every purchase of farms, parceling, adjudication, titling, or leasing, with particular emphasis on the titling of lands located in national reserves (reservas nacionales) pursuant to ley 7599 of April 29, 1996.
Article 61.— Under no circumstances may the IDA acquire, adjudicate, or title lands that do not qualify for agrarian purposes according to the soil study.
Article 62.— If the soil study and land classification determine that titling for agrarian or urban purposes is not appropriate, the IDA shall designate such lands as national reserves, transferring them as appropriate to MINAE.
Article 63.— Every lease or adjudication contract or title issued by the IDA shall necessarily include, under penalty of lapse (caducidad) or revocation, the condition that the adjudicatee may not carry out any activity on the land contrary to the use, management, and conservation of soils and waters, as provided in Articles 27 and 64 of Ley Nº 7779. Upon demonstrated non-compliance, the IDA shall initiate the revocation procedure for the TITLE, for which purpose a cautionary notation (anotación preventiva) shall be entered in the Folio Real of the respective property.
It must be noted that the cited regulations are clear in establishing that, prior to titling and registering lands, the IDA is obligated to conduct land-use capacity studies before titling. Likewise, the aforementioned Article 61 prohibits the IDA from acquiring, adjudicating, or titling lands that do not qualify for agrarian purposes according to the soil study. Precisely in this case, as shown by the Conforming Land-Use Certificate (Certificado de Uso Conforme del Suelo) prepared by Ing. Agr. German José Aguilar Vega, an official of the INTA, analyzed in the preceding recital (considerando) of this ruling, the conclusion is reached that the property at issue in these proceedings—which was titled in favor of defendant Nombre125801—is not suitable for agrarian or cattle-raising activities. Thus, the nullity of the titling carried out by the IDA arises not only from the existence of forest cover (cobertura boscosa) on the property, which constitutes State natural heritage (patrimonio natural del Estado), but also from the fact that titling was performed over land that is not suitable for agricultural exploitation.
Now, in this court's view, the defensive arguments raised by the IDA—to the effect that, while the Reglamento a la Ley de Uso, Manejo y Conservación de Suelos does require an adequate conforming land-use study for titling procedures carried out by the IDA, it was considered that these studies should be conducted by the Ministerio de Agricultura y Ganadería, responsibility that was subsequently assigned to the Instituto de Innovación y Transferencia de Tecnología Agropecuaria INTA, and that due to a shortage of human and technical resources those studies did not begin to be carried out until two thousand and one, and that at the time the title was granted to the defendant the INTA did not have the mechanism or structure in place to handle conforming land-use certifications, that it is the INTA that was responsible for carrying out such certifications for the IDA, and that the INTA had suspended this type of certification—are incorrect.
This is because the IDA cannot transfer its responsibility to other agencies such as the Ministerio de Agricultura y Ganadería or the INTA for its inability to conduct land-use capacity studies, as the IDA had the legal obligation to fulfill that requirement. Furthermore, if the IDA did not have those studies because other institutions were responsible for conducting them and lacked the necessary human and technical resources to do so, what the IDA should have done was refrain entirely from titling those lands until such time as it had the capacity to fully comply with the provisions of Article 27 of the Ley de Uso, Manejo y Conservación de Suelos. It is precisely in this case that the defendant institution issued a title of ownership without complying with the requirements set forth in the cited article of the Ley de Uso, Manejo y Conservación de Suelos and the specified provisions of the Reglamento to that Law, making the nullity of the IDA's actions in this case evident and manifest.
Consequently, for all the reasons explained, the nullity of the administrative act must be declared—solely with respect to the titling of the land corresponding to cadastral survey plan (plano catastrado) SJ-600333-1999 in favor of defendant Nombre125801, issued by the Board of Directors (Junta Directiva) of the Instituto de Desarrollo Agrario in its Article 32 of Session 016-04 of May 13, 2004—as well as all related acts, which shall be specified in the subsequent recitals of this judgment.
VII- ON THE CLAIM FOR AN ABSTRACT AWARD OF DAMAGES (DAÑOS Y PERJUICIOS) AGAINST THE DEFENDANTS: The Contraloría General de la República requests that the defendants be ordered to pay damages (daños y perjuicios) caused. Regarding this claim, this Tribunal considers that the IDA must be ordered to make an abstract payment of damages because the acts and omissions described throughout this ruling constitute sufficient cause to determine that the defendant institution engaged in abnormal functioning (funcionamiento anormal), for which it must pay compensation to the State or Central Public Administration, represented in this case by the Contraloría General de la República, pursuant to Articles 190 et seq. of the Ley General de la Administración Pública, in conjunction with Article 122, subsection m), sub-subsection iii) of the Código Procesal Contencioso Administrativo. Accordingly, the IDA is ordered to pay, in the abstract, the damages resulting from its abnormal functioning; the existence and amount thereof shall be determined during the judgment enforcement phase (fase de ejecución de sentencia).
This Tribunal further considers that co-defendant Nombre125801 must be exonerated from payment of the damages requested by the oversight body, because throughout these proceedings, and on the basis of the evidence contained in the record, no liability can be attributed to him, given that it was not established that his actions were carried out in bad faith, with willful misconduct, or with negligence at the time he became a beneficiary of a land titling (titulación), in which his participation was passive rather than active, as was the case with the IDA. Accordingly, Nombre125801 is exonerated from payment of damages.
VIII- ON THE RELEVANT STEPS TO PREPARE THE DEED OF TRANSFER TO THE STATE OF THE PROPERTY THAT IS THE SUBJECT OF THESE PROCEEDINGS AND THE REGISTRATION PROCEDURES BEFORE THE NATIONAL REGISTRY: The Contraloría General de la República requests that the property subject to these proceedings be declared State Natural Heritage (Patrimonio Natural del Estado) — an aspect accepted in this ruling — and that a deed of transfer (escritura de traspaso) in favor of the State be prepared and that its registration in the Public Registry (Registro Público), along with the corresponding change in its legal nature, be processed. This claim is accepted by this jurisdictional body; however, it must be carried out in accordance with the second paragraph of Article 13 of the Ley Forestal, which provides that the Procuraduría General de la República, through the State Notary's Office (Notaría del Estado), is the body responsible for preparing the new deed of transfer with its corresponding change in legal nature and for taking the necessary steps to register that deed in the Public Registry of Real Property (Registro Público de la Propiedad Inmueble).
IX- ON THE RULING UPHOLDING THE CLAIMS ESTABLISHED IN THESE PROCEEDINGS: For all the reasons set forth in this ruling, the complaint is granted in the following terms:
X- ON THE MAINTENANCE OF PRECAUTIONARY MEASURES (MEDIDAS CAUTELARES) IMPOSED IN THESE PROCEEDINGS UNTIL THIS JUDGMENT BECOMES FINAL: In order to protect the subject matter of these proceedings, the precautionary measures issued by this Tribunal at the precautionary-measure hearing held at eight thirty-five in the morning on October 8, 2008, by means of oral ruling number 700-2008, are ordered maintained in the following terms: "1) Defendant Nombre125801 is ordered to refrain from conducting burns and forest felling on the entire property subject to these proceedings.
XI- ON THE PAYMENT OF COURT COSTS AND ATTORNEY'S FEES (COSTAS PROCESALES Y PERSONALES) IN THIS MATTER: In accordance with Article 193 of the Código Procesal Contencioso Administrativo, and finding no valid grounds for exemption from costs, the IDA is ordered to pay the court costs and attorney's fees of these proceedings. Nombre125801 is exonerated from payment of court costs and attorney's fees because, in this Tribunal's judgment, he has acted in good faith, in accordance with Article 193, subsection b), of the Código Procesal Contencioso Administrativo.
THEREFORE
The present complaint is granted in the following terms:

Proceso de conocimiento declarado de trámite preferente interpuesto por la Contraloría General de la República, representada por Nombre602 , mayor, casado, abogado, portador de la cédula de identidad número CED413 y vecino de Santa Bárbara de Heredia y Nombre603 , mayor, casada, abogada, portadora de la cédula de identidad número CED414 y vecina de San Francisco de Heredia contra el Instituto de Desarrollo Agrario, representado por su Presidente Ejecutivo, Nombre127833 , mayor, casado, portador de la cédula de identidad número CED102868 y vecino de San Isidro de Heredia y Nombre125801 , mayor, casado una vez, agricultor, portador de la cédula de identidad número CED110553 y vecino de Dirección16929 .
RESULTANDO
1- La Contraloría General de la República interpone la demanda que ha dado origen al presente proceso, contra el Instituto de Desarrollo Agrario y el señor Nombre125801 , con la finalidad que se declare en sentencia, las siguientes pretensiones indicadas en el escrito de demanda: “1) Que se anule el acuerdo de la Junta Directiva del Instituto de Desarrollo Agrario, contenido en el Artículo 32 de la sesión número 016-04 – de fecha 3 de mayo del 2004, únicamente, en lo que se refiere a la titulación de una finca a favor del señor Nombre125801 , descrita en el plano catastrado número Placa26957.
3- Mediante resolución número 700-2008 de las dieciséis horas con veinte minutos del dieciocho de setiembre del dos mil ocho, este Tribunal acogió la solicitud de medida cautelar inaudita altera parte, presentada por el órgano contralor.
4- El Instituto de Desarrollo Agrario contestó en tiempo y forma la demanda, solicitando que ésta se declare sin lugar, se le exima de responsabilidad en cuanto a los daños y perjuicios, costas personales y procesales. Asimismo, interpuso la excepción de incompetencia en razón de la materia.
5- El demandado Nombre125801 , contestó en tiempo y forma la demanda, solicitando que se desestime y se archive.
6- En la audiencia de medida cautelar efectuada a las ocho horas y treinta minutos del tres de octubre del dos mil ocho, se dictó la sentencia oral número 766-2008, mediante la cual se rechazó la excepción de incompetencia en razón de la materia interpuesta por la representación del Instituto de Desarrollo Agrario.
7- Dentro de la continuación de la audiencia de medida cautelar, efectuada a las ocho horas y treinta y cinco minutos del ocho de octubre del dos mil ocho, este órgano jurisdiccional, mediante sentencia oral, con el mismo número de resolución 700-2008, mantuvo el contenido de las medidas cautelares aceptadas de manera provisional y admitió parcialmente las medidas solicitadas en la ampliación de éstas formulada por el órgano contralor, quedando las medidas cautelares requeridas en los siguientes términos: "1) Se le ordena al demandado Nombre125801 , que se abstenga de realizar quemas y tala de bosque en la totalidad del inmueble objeto de este proceso.
8- En resolución número 000028-C-S1-2009, dictada por la Sala Primera de la Corte Suprema de Justicia, a las diez horas treinta minutos del quince de enero del dos mil nueve, se declaró sin lugar la inconformidad presentada por Instituto de Desarrollo Agrario planteada contra la resolución número 766-2008, emitida por este tribunal, y declaró que el conocimiento del presente proceso le corresponde al Tribunal Contencioso Administrativo.
9- Por resolución número 000136-A-TC-2009, dictada por el Tribunal de Casación de lo Contencioso Administrativo, a las diez horas del veintiuno de julio de dos mil nueve, se tuvo por desistido el recurso de apelación presentado contra la resolución 700-2008, por lo que se declaró firme dicha resolución que admitió las medidas cautelares.
10- De conformidad con los artículos 60 inciso 3) y 70 inciso 2) del Código Procesal Contencioso Administrativo, este Tribunal convocó a una única audiencia que se celebró a partir de las ocho horas con veintidós minutos del tres de agosto del dos mil nueve, en la cual se conocieron y resolvieron los extremos a los que alude el numeral 90 del citado Código Procesal. En dicha audiencia se ajustaron las pretensiones, numeradas en el escrito de demanda, como 4),
12- Al finalizar las conclusiones brindadas por ambas partes en la audiencia señalada, este Tribunal declaró este proceso como un asunto complejo, para los efectos de lo dispuesto en el artículo 111 inciso 1) del Código Procesal Contencioso Administrativo, en relación al numeral 82, inciso 1), del Reglamento Autónomo de Organización y Servicio de la Jurisdicción Contencioso Administrativa y Civil de Hacienda.
13- El expediente del presente asunto fue remitido al juez ponente, a partir del día siguiente a la celebración de la audiencia única el cuatro de agosto del dos mil nueve. Asimismo, el plazo para el dictado de la presente sentencia fue suspendido mediante resolución dictada por este Tribunal a las dieciséis horas con veinticinco minutos del siete de agosto del dos mil nueve, debido a la existencia de una causal de fuerza mayor que cubría al Juez Ponente, de conformidad a lo estipulado en el artículo 81, inciso 1) del Reglamento Autónomo de Organización y Servicio de la Jurisdicción Contencioso Administrativa y Civil de Hacienda, por lo que la suspensión del plazo de quince días hábiles, transcurrió del día 10 al 14 de agosto del 2009, computándose nuevamente el plazo restante de once días hábiles a partir del diecisiete hasta el treinta y uno de agosto del dos mil nueve.
14- En los procedimientos ante este Tribunal no se han observado nulidades que deban ser subsanadas o que generen indefensión, por lo de conformidad con los artículos 111 del citado Código Procesal en relación con los numerales 79 y 82 de su Reglamento, previa deliberación, se procede con el dictado, redacción y comunicación de la presente sentencia dentro del término de ley. Se dicta esta sentencia con redacción del Juez ponente González Vílchez y el voto afirmativo de los Juzgadores Álvarez Molina y Garita Navarro, y;
CONSIDERANDO
I- HECHOS PROBADOS: De relevancia para efectos del presente proceso, se tienen por acreditados los siguientes:
II- HECHO NO PROBADO: Determinante para la resolución del presente proceso, se tiene por indemostrado el siguiente: 1) Que el codemandado Nombre125801 , haya actuado de mala fe al momento de solicitar la titulación del inmueble objeto de este proceso y en su posterior titulación (los autos).
III- SOBRE EL OBJETO DE ESTE PROCESO DE CONOCIMIENTO DE TRAMITE PREFERENTE CONTENCIOSO ADMINISTRATIVO: La Contraloría General de la República, acude a esta instancia jurisdiccional, con la pretensión de que se anule el acuerdo de la Junta Directiva del Instituto de Desarrollo Agrario, contenido en el Artículo 32 de la sesión número 016-04, de fecha 3 de mayo del 2004, únicamente, en lo que se refiere a la titulación de una finca a favor del codemandado Nombre125801 , descrita en el plano catastrado número Placa26957, así como se anule la escritura pública número 47, otorgada ante los Notarios Públicos Giovanni Varela Dijeres y Alba Iris Ortiz Recio, a las 8 horas del día 24 de mayo del 2004, que formalizó y protocolizó la titulación emitida por el Instituto de Desarrollo Agrario, únicamente, en lo que se refiere a la titulación de una finca a favor del señor Nombre125801 . Asimismo, solicita el órgano contralor que se anule el asiento registral de inscripción de la finca inscrita bajo el sistema de Folio Real matrícula número Placa26958 (finca titulada), emitido por el Registro Nacional.
Además, solicita el órgano demandante, que se declare que la finca inscrita a folio real matrícula número Placa26958 fue inscrita técnica y jurídicamente de forma indebida a favor del señor Nombre125801 , así como se declare el inmueble descrito en el plano catastrado número Placa26959 como Patrimonio Natural del Estado y por ende, el competente para ejercer su administración es el Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET), debiendo el Instituto de Desarrollo Agrario adoptar las acciones pertinentes para confeccionar la escritura de traspaso a favor del Estado, así como, tramitar su inscripción en el Registro Público con el respectivo cambio en su naturaleza. Por útimo, solicita la Contraloría General de la República, que se ponga en posesión de esa finca al Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET) y se desaloje al Señor Nombre125801 , así como se condene a los demandados al pago en abstracto de los daños y perjuicios ocasionados, así como a las costas de este proceso.
El órgano contralor, fundamenta sus pretensiones en los siguientes puntos: 1. La Sala Constitucional anuló por inconstitucional, el Reglamento para la Titulación en Reservas Nacionales, por lo que de forma conexa todos los actos administrativos que se emitieron con base en esa normativa reglamentaria devienen en nulos, como el acuerdo de la Junta Directiva del Instituto de Desarrollo Agrario (en adelante IDA), en el cual se le tituló al codemandado Nombre125801 un inmueble ubicado en La Sabana, del distrito La Legua del cantón Aserrí de la provincia de San José, con un área de 35 hectáreas, 82, 59 metros cuadrados, que corresponde con el plano catastrado SJ-600333-99, así como los actos que son consecuencia de éste, como la escritura pública de traspaso de la propiedad y el respectivo asiento registral; 2. La propiedad que le fue titulada por el IDA al demandado Nombre125801 , está constituida por bosques que son patrimonio natural del Estado, por lo que ese inmueble es de dominio público o demanial, que en consecuencia, es inembargable, imprescriptible, inalienable, por lo que el IDA no podía otorgar títulos de propiedad en un bien de esta naturaleza.
Por ello pide que se declare Patrimonio Natural del Estado y se traslade su posesión, así como su propiedad, al Estado, específicamente al Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET); 3. La Ley de Uso, Manejo y Conservación de Suelos, obliga al IDA a realizar de forma previa a otorgar una titulación, contar con el estudio de capacidad de uso de suelo, requisito que de forma ilegal no cumplió el IDA, al momento de titular la propiedad objeto de este proceso a favor del codemandado Nombre125801 . Además, de que el Reglamento a la Ley de Uso, Manejo y Conservación de Suelos, le imposibilitaba al IDA titular tierras que no clasifiquen para fines agrarios. Por su parte el IDA, codemandado en este asunto, externó sus argumentos defensivos, indicando en lo medular, los siguientes: 1. El codemandado Nombre125801 , cumplió con todos los requisitos exigidos en ese momento para el otorgamiento del título de propiedad, y que el IDA actuó dentro del bloque de legalidad y bajo el marco de la normativa que regula su actividad; 2.
La constancia elaborada por el Área de Conservación Pacífico Central, Sistema de Áreas de Conservación del Ministerio de Ambiente y Energía, número ACOPAC-OTC-065, aportada durante el trámite de titulación, indicaba que la propiedad objeto de este proceso, se encontraba fuera de la Áreas Silvestres Protegidas y que no áreas que se resguardan mediante el artículo 33 de la Ley Forestal número 7575, por lo que se actuó ajustado a derecho; 3. El artículo 27 de la Ley de Uso, Manejo y Conservación de Suelos, si bien es cierto establece la necesidad de que el IDA realice estudios de capacidad de uso de suelos, esa norma se aplica para fincas que compre el IDA con recursos propios para destinarlas a la formación de Asentamientos Campesinos, y este no es el caso, ya que lo que sucedió fue que por Decreto Ejecutivo se traspasó miles de hectáreas en todo el territorio nacional, por lo que esa norma no se puede aplicar en este asunto; 4.
Si bien es cierto que el Reglamento a la Ley de Uso, Manejo y Conservación de Suelos, solicita un estudio adecuado de uso conforme de suelos para los procedimientos de titulación realizados por el IDA, se consideró que estos debían ser realizados por el Ministerio de Agricultura y Ganadería, que se le encargó posteriormente, al Instituto de Innovación y Transferencia de Tecnología Agropecuaria (en adelante INTA), y por motivos de escazes de recursos humanos y técnicos comenzaron a realizarse esos estudios hasta el dos mil uno; 5. Para cuando se le otorgó el título al demandado el INTA, no contaba con el mecanismo o estructura para la atención de las certificaciones de uso conforme de suelos y es a esta institución la que le correspondía llevar a cabo las certificaciones de uso conforme de suelo del IDA, y el INTA, suspendió este tipo de certificaciones. Por su parte, el codemandado Nombre125801 , argumenta en su defensa, que la propiedad, en la cual el IDA le otorgó el título de propiedad, siempre la había poseído, incluso, él recibió los derechos de posesión de ese inmueble de su propia mamá.
Asimismo, aduce que él presentó los requisitos que le solicitó el IDA, y dicha institución la otorgó el título de propiedad. Indica, que él siempre a explotado ese inmueble con algunas cabezas de ganado y que siempre ha respetado y conservado el bosque que se ubica dentro de esa propiedad. Establecidos los argumentos de las partes en conflicto, este Tribunal procede al análisis de los argumentos de fondos, a efectos de determinar quién lleva la razón en este asunto.
IV-EL PATRIMONIO NATURAL DEL ESTADO COMO EXPRESIÓN DEL DERECHO FUNDAMENTAL A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO, RECONOCIDO Y TUTELADO POR EL DERECHO DE LA CONSTITUCIÓN: Considera este órgano jurisdiccional, que antes de entrar a resolver el caso en concreto, resulta necesario referirse a lo que ya esta misma Sección de este Tribunal, ha explicado, como marco general, de lo que se entiende como patrimonio natural del Estado, en zonas forestales. En ese sentido, la resolución número 0063-2009, dictada a las dieciséis horas del diecinueve de enero del dos mil nueve, indicó en lo que interesa para el dictado de esta sentencia, lo siguiente:
"Reconocimiento constitucional del derecho fundamental a un ambiente sano y ecológicamente equilibrado. En Costa Rica, el reconocimiento y tutela en el Derecho de la Constitución del citado derecho fundamental no tiene como punto de partida la reforma al artículo 50 de la Constitución Política, dispuesta por Ley número 7412 del tres de junio de mil novecientos noventa y cuatro. Lo anterior toda vez que ya que desde la promulgación del texto constitucional en el año 1949, la voluntad del Constituyente fue clara al establecer en el artículo 89, que: “Entre los fines culturales de la República están: proteger las bellezas naturales, conservar y desarrollar el patrimonio histórico y artístico de la Nación, y apoyar la iniciativa privada para el progreso científico y artístico”; lo cual, se complementa con la tajante declaración contenida en el artículo 21, en el sentido de que en nuestro país, “La vida humana es inviolable”.
La integración de lo dispuesto en ambos artículos implica, que la necesidad de preservar el medio ambiente –aunque en esa época el Constituyente utilizara el término de bellezas naturales-, trasciende una finalidad de carácter meramente cultural, para convertirse en una necesidad vital de todo ser humano, pues constituye un presupuesto esencial para hacer efectivos otros derechos fundamentales como lo son: la vida, la salud y el desarrollo. (véanse en ese sentido, las sentencias número 1993-03705 de las quince horas del treinta de julio de mil novecientos noventa y tres; 1993-06240 de las catorce horas del veintiséis de noviembre de mil novecientos noventa y tres; 1993-04423 de las doce horas del siete de diciembre de mil novecientos noventa y tres, 1994-02485 de las nueve horas dieciocho minutos del veintisiete de mayo de mil novecientos noventa y cuatro, todas de la Sala Constitucional de la Corte Suprema de Justicia).
En ese sentido, cabe recordar que el Derecho de la Constitución está compuesto no sólo por el texto constitucional, sino también por los valores y principios que informan y permean su contenido, como también por los Tratados Públicos, los Convenios Internacionales y los Concordatos debidamente aprobados por la Asamblea Legislativa, así como también, por los Instrumentos Internacionales sobre Derechos Humanos aplicables en la República (ver artículos 1, 7, 21, 50 de la Constitución Política; 1 y 3 de la Ley de la Jurisdicción Constitución Política). Aunado a ello, las normas escritas y no escritas que conforman el Derecho a la Constitución, se caracterizan por ser de aplicación directa e inmediata, por lo que, sus destinatarios no sólo tienen el derecho de hacerlas efectivas en vía administrativa y jurisdiccional, si estiman que por acción u omisión han sido menoscabadas, sino que además, ello implica que los operadores del derecho tienen el deber de aplicarlas de forma directa e inmediata en su proceso de toma de decisiones, a efecto de cumplir los requerimientos constitucionales (véase lo considerado por la Sala Constitucional de la Corte Suprema de Justicia en sentencia número 1999-00644 de las once horas veinticuatro minutos del veintinueve de enero de mil novecientos noventa y nueve).
Si se toma como base lo dispuesto en los artículos 7, 48 de la Constitución Política y, 1 y 3 de la Ley de la Jurisdicción Constitucional, podemos afirmar que aún y cuando el texto constitucional no hubiese contenido normas relativas al reconocimiento y tutela del derecho fundamental a un ambiente sano y ecológicamente equilibrado, ese derecho y deber correlativo no sólo ya existían en el derecho interno costarricense, sino que además su tutela efectiva era exigible tanto a nivel doméstico como internacional. Ello en virtud de que el Estado Costarricense había suscrito una serie de Convenios, Tratados e Instrumentos Internacionales relacionados con esta materia, antes de que por Ley número 7412 del tres de junio de mil novecientos noventa y cuatro, se reformara el artículo 50 de la Constitución Política, instrumentos entre los que destacan: el “Pacto Internacional de Derechos Económicos, Sociales y Culturales” (artículos 2.1, 12.1 y 12.2.c); el “Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos Económicos, Sociales y Culturales” (artículo 11); la “Convención para la Protección del Patrimonio Cultural y Natural”, suscrita en París el 23 de noviembre de mil novecientos setenta y dos y, aprobada por Ley número 5980 del veintitrés de octubre de mil novecientos setenta y seis; la “Convención para la Protección de la Flora, de la Fauna y de las Bellezas Escénicas Naturales de los Países de América”, adoptada en Washington el tres de marzo de mil novecientos setenta y tres y aprobada por Ley número 3763 del diecinueve de octubre de mil novecientos setenta y seis; la “Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas”, suscrito en Ramsar el dos de febrero de mil novecientos setenta y uno, y aprobado por Ley número 7224 de mil novecientos noventa y uno; el “Convenio de Viena para la Protección de la Capa de Ozono”, adoptado en Viena el veintidós de marzo de mil novecientos ochenta y cinco, y aprobado por Ley número 7228 de veintidós de abril de mil novecientos noventa y uno, y su “Protocolo de Montreal Relativo a Sustancias Agotadoras de la Capa de Ozono”, suscrito en Montreal el dieciséis de setiembre de mil novecientos ochenta y siete, y aprobado por Ley número 7223 del dos de abril de mil novecientos noventa y uno; la “Convención de la ONU sobre el Derecho del Mar”, suscrita en Montego Bay el diez de diciembre de mil novecientos ochenta y dos, y aprobada por Ley número 7291 publicada el quince de julio de mil novecientos noventa y dos, entre otras.
Todas esas normas internacionales se integraron al derecho interno costarricense de conformidad con lo dispuesto en los artículos 7 y 48 de la Constitución Política y, 1 y 3 de la Ley de la Jurisdicción Constitucional, por lo que, “...todos estos instrumentos internaciones son de obligado acatamiento y gozan de plena ejecutoriedad en tanto sus normas no precisen de mayor desarrollo legislativo y por ende deben ser respetadas (...) en tanto el rango normativo de aquéllas es superior...” (Sentencia número 1993-06240 dictada por la Sala Constitucional de la Corte Suprema de Justicia a las catorce horas del veintiséis de noviembre de mil novecientos noventa y tres). Desarrollo Infraconstitucional del derecho fundamental a un ambiente sano y ecológicamente equilibrado. Sin duda, el reconocimiento y tutela del citado derecho fundamental, provocó el desarrollo infraconstitucional de aquel, por medio del dictado de normas legales o reglamentarias en las que se regulan diversas manifestaciones del mismo, las cuales fueron emitidas mucho antes de la reforma al artículo 50 de la Constitución Política.
Como ejemplo de ello tenemos: la Ley de Aguas (No. 276 del 27 de agosto de 1942; Ley de Planificación Urbana (No. 4240 del 15 de noviembre de 1978, la Ley Forestal (No. 4465 del 25 de noviembre de 1979, ya derogada); la Ley de la Zona Marítimo Terrestre (No. 6043 del 2 de marzo de 1977); la Ley General de Salud (No. 5395 del 30 de octubre de 1973); la Ley de Creación del Servicio de Parques Nacionales (No. 6084 del 24 de agosto de 1977); la Ley de Salud Animal (No. 6243 del 2 de mayo de 1978); la Ley de Conservación de la Vida Silvestre (No. 7317 del 21 de octubre de 1992), entre otras. Lo anterior implica, que antes de la reforma al artículo 50 de la Constitución Política, el derecho fundamental a que hemos hecho referencia no sólo estaba reconocido y tutelado en el Derecho a la Constitución, sino también, se había desarrollado –aunque de manera sectorial y no con visión de conjunto- a nivel legal y reglamentario.
En virtud de lo hasta ahora expuesto, este Tribunal estima que la reforma al artículo 50 de la Constitución Política, no hizo sino reconocer de manera expresa y claramente individualizada, un derecho fundamental que ya estaba consagrado y garantizado por el Derecho de la Constitución; declarar en forma expresa, los alcances de la ya preexistente obligación del Estado, respecto a garantizar, defender y preservar el derecho a un ambiente sano y ecológicamente equilibrado y otorgar a las personas plena acción para defenderlo, a través de una acción popular (ver sentencias número 1994-01394 de a las quince horas veintiún minutos del dieciséis de marzo de mil novecientos noventa y cuatro, y 1994-05527 de las diez horas cuarenta y cinco minutos del veintitrés de setiembre de mil novecientos noventa y cuatro, ambas de la Sala Constitucional de la Corte Suprema de Justicia). Consecuencias del reconocimiento de la garantía del artículo 50 constitucional en los términos explicados.
Dicho reconocimiento lleva aparejado dos aspectos relevantes para la resolución del presente proceso. Primero. La imposición de un deber, tanto para el Estado –entendido como Administración Central y Descentralizada- como para los mismos sujetos de derecho privado, de garantizar, defender y preservar ese derecho. Segundo. El establecimiento de una serie de mecanismos de carácter técnico jurídico para lograr una tutela efectiva de ese derecho, tanto a nivel administrativo como jurisdiccional. En cuanto al primero de estos aspectos, cabe indicar que “La incidencia que tiene el derecho a un ambiente sano y ecológicamente equilibrado dentro de la actividad del Estado, y congruentemente de las municipalidades (téngase presente el artículo 169 constitucional), encuentra su primera razón de ser en que por definición los derechos no se limitan a la esfera privada de los individuos sino que tienen asimismo trascendencia en la propia estructura del Estado en su papel de garante de los mismos y, en segundo término, porque la actividad del Estado se dirige hacia la satisfacción de los intereses de la colectividad.
La Constitución Política establece que el Estado debe garantizar, defender y preservar ese derecho. Prima facie garantizar es asegurar y proteger el derecho contra algún riesgo o necesidad, defender es vedar, prohibir e impedir toda actividad que atente contra el derecho, y preservar es una acción dirigida a poner a cubierto anticipadamente el derecho de posibles peligros a efectos de hacerlo perdurar para futuras generaciones. El Estado debe asumir un doble comportamiento de hacer y de no hacer; por un lado debe abstenerse de atentar él mismo contra el derecho a contar con un ambiente sano y ecológicamente equilibrado, y por otro lado, debe asumir la tarea de dictar las medidas que permitan cumplir con los requerimientos constitucionales...” (sentencia No. 1999-00644 dictada por la Sala Constitucional de la Corte Suprema de Justicia, a las 11:24 horas once horas del 29 de enero de 1999).
En ese sentido, “...La acción que la Constitución Política impone al Estado frente a los focos de contaminación ambiental es multidireccional y definitivamente activa, absolutamente intolerante frente a situaciones que amenazan o afectan las condiciones ambientales óptimas que están garantizadas por ella misma a los habitantes. Desde esta perspectiva no es permitido a la autoridades públicas hacer concesiones o conceder prórrogas para que se continúe afectando el medio ambiente, aún y cuando ello se haga con miras a traer beneficios económicos a una zona geográfica determinada...” (sentencia No. 1999-05906 dictada por la Sala Constitucional de la Corte Suprema de Justicia a las 16:15 horas del 28 de julio de 1999). Ese deber constitucional del Estado de velar por la protección, defensa y preservación del medio ambiente, se desarrolla y manifiesta, entre otras, en las siguientes normas: artículos 1, 2.a. 2.c, 2 párrafo último, 3, 12, 28, 32, 34, 37, 56, 59, 78, 83, 103 a 112 de la Ley Orgánica del Ambiente; artículos 1, 2, 9.4, 12, 22 a 30, 45, 49, 54, 86, 88 de la Ley de Biodiversidad; 3, 4, 6, 7, 15, 34, 122 de la Ley de Conservación de la Vida Silvestre; 1, 2, 5, 6, 13, 37, 54 de la Ley Forestal; 5, 6, 7, 11, 21, 29 a 33, 37 de la Ley de Uso, Manejo y Conservación de Suelos; 13.a ,13.o del Código Municipal; 11, 12, 13, 17, 18, 19, 21, 22, 25 de la Ley de la Zona Marítimo Terrestre; 1, 2 de la Ley General de Salud; 1, 2, 17, 175, 176 de la Ley de Aguas; 15,18, 19, 51, 56, 58.5, Transitorio II de la Ley de Planificación Urbana.
Ahora bien, ese deber no sólo se circunscribe al Estado en su conjunto, sino también a los sujetos de derecho privado, quienes tienen el derecho a gozar de un ambiente sano y ecológicamente equilibrado, pero también, a garantizarlo, preservarlo y defenderlo, tal y como se desprende, entre otros, de los artículos 1 párrafo primero, 2.a, 6, 22, 23, 99, de la Ley Orgánica del Ambiente; 10.2, 10.13, 11.4, 88 95, 101, 105 de la Ley de Biodiversidad; 15, 28 a 30, 36 a 38, 51 53, 62 a 64, 83, 88 a 121 de la Ley de Conservación de la Vida Silvestre; 57 a 66 de la ley Forestal; 37, 40, 41 a 45, 51 a 53 de la Ley de Uso, Manejo y Conservación de Suelos; 14 de la Ley de la Zona Marítimo Terrestre; como también, de las sentencias número 1999-02219 de las quince horas dieciocho minutos del veinticuatro de marzo de mil novecientos noventa y nueve; 1999-05906 dictada por la Sala Constitucional de la Corte Suprema de Justicia a las dieciséis horas quince minutos del veintiocho de julio de mil novecientos noventa y nueve, entre otras.
En cuanto al segundo aspecto, relacionado con el establecimiento de una serie de mecanismos de carácter técnico jurídico para lograr una tutela efectiva de ese derecho, tanto a nivel administrativo como jurisdiccional, este Tribunal considera que dichos medios de tutela pueden clasificarse en dos grandes grupos: procesales y materiales. Es preciso aclarar, que si bien es cierto, se hará referencia a ejemplos concretos relacionados con cada uno de los criterios de clasificación antes indicados, la intención de este Tribunal no es la de establecer una lista de números clausus, sino únicamente resaltar por medio de dichos ejemplos, aspectos que tienen incidencia en el objeto de este proceso. En ese sentido, dentro del grupo de los mecanismos de tutela de índole procesal, cabe resaltar tres ejemplos:
V- SOBRE LA NULIDAD DE LA TITULACIÓN EFECTUADA POR EL IDA, A FAVOR DEL CODEMANDADO Nombre125801 , AL TRASLADAR UN INMUEBLE QUE ES PATRIMONIO NATURAL DEL ESTADO: En este caso se tiene por probado que el inmueble objeto de este proceso, que se encuentra ubicado en La Sabana, del distrito La Legua del cantón Aserrí de la provincia de San José, con un área de 35 hectáreas, 82,59 metros cuadrados, que corresponde con el plano catastrado SJ-600333-99, le fue trasladado al codemandado Nombre125801 , por la Junta Directiva del Instituto de Desarrollo Agrario, en su Artículo 32 de la Sesión 016-04 del 13 de mayo del 2004, es un terreno que es patrimonio natural del Estado, por los siguientes motivos: 1) Durante el procedimiento previo a que la Junta Directiva del IDA, le titulara el inmueble en cuestión al codemandado Nombre125801 , éste tuvo que presentar una serie de documentos, uno de los cuales era la constancia emitida por el M.s.c. Julio Bustamante B., Coordinador Ordenamiento Territorial, del Área de Conservación Pacífico Central, Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía, número ACOPAC-OTC-065, del 25 de noviembre del 2002, en este documento se indicó, en lo que interesa para el dictado de esta sentencia. lo siguiente:
"Hago constar que inspeccionada la finca correspondiente a plano catastrado SJ-600333-99, con área de 35 ha 0082.59 m2, ubicada en la Dirección15384 , , perteneciente a FR 1219039-000, a nombre del señor Nombre125801 , céd. Placa23073, que es terreno que se encuentra con cobertura de Bosque natural y bosque en sucesión temprana." (...) "No se observa además, que se afecte el artículo Nº 33 de la Ley Forestal Nº 7575 del 05 de febrero de 1996 y sus reformas" Es importante destacar que esta constancia es clara al indicar que el terreno objeto de debate, se encuentra con cobertura de bosque natural y bosque en sucesión temprana, por lo que este tribunal considera que desde antes de la titulación, existían pruebas técnicas de que el inmueble es de naturaleza boscosa. Ahora, esta misma certificación indica que no se observa que el terreno se encuentre afectado por el artículo 33 de la Ley Forestal, esto significa para este órgano jurisdiccional, que lo que esa constancia indicó era que ese terreno no se encontraba ubicado en un área de protección, esto es totalmente irrelevante en este caso, debido a que si se relaciona el artículo 33 con el numeral 13, ambos de la Ley Forestal, se puede llegar a la conclusión, que el patrimonio natural del Estado, se constituye en los inmuebles que se encuentren cubiertos de bosques, indepedientemente que se ubiquen dentro o fuera de las reservas nacionales o áreas de protección, por lo que los alegatos defensivos del IDA, en el sentido de que se cumplía con el requisito técnico de contar con una certificación o constancia, del MINAET, que acreditara la naturaleza del terreno, no se cumplió;
"La revisión de fotografías de 1997 y 2003 en relación con la ubicación aproximada del inmueble del plano catastrado SJ-6000333-99, ha generado las siguientes conclusiones: El uso del suelo del inmueble en el plano catastrado SJ-600333-99 es conforme a lo observado en fotografias aéreas de 1997 y 2003; a saber: que en esos dos años existieron dos manchas de bosque coincidentes con lo que el plano describe como "montaña"; asimismo, el resto del área de la finca posee una cobertura de pastos y arbustos entremezclados, que se desarrolla principalmente en el sector este de la propiedad, denominada en el plano como "tacotales." Este criterio técnico, confirma lo indicado tanto en las declaraciones juradas, como en el mismo plano catastrado, de que el término "montaña", en la realidad significa que existe en la finca cobertura boscosa. También esta prueba, constata lo apreciado en el reconocimiento judicial efectuado por este Tribunal, que en la propiedad titulada por el IDA a favor del demandado Nombre125801 , existe y ha existido, bosque; 6) Otra prueba técnica de fundamental importancia, consiste en lo indicado en el oficio DST-217-09, del 23 de julio de 2009, emitido por el Jefe del Departamento de Servicios Técnicos del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA), en el cual le remitió a la Contraloría General de la República, un Certificado de Uso Conforme del Suelo, que como se explicará en el siguiente considerando, nunca fue elaborado durante el trámite de titulación realizado por el IDA, siendo este tipo de estudios obligatorios para la institución demandada, y que fue elaborado por el Ing. Agr.
German José Aguilar Vega, funcionario del INTA, realizado en el inmueble objeto de este proceso, en el cual se dividió y analizó el uso del suelo en la propiedad titulada a nombre del codemandado Nombre125801 , de la siguiente manera: Sector A: Potrero 3, 36 hectáreas (9,58%), Charral 5,23 hectáreas (14,91%), Bosque 6,30 hectáreas (17,95%); Sector B: Bosque 7,13 hectáreas (20,33%); Sector C: Potrero 2,90 hectáreas (8,27%); Sector D: Matorral 10,16 hectáreas (28,96%). Esta división, concuerda con lo que los miembros de este Tribunal apreciaron en la zona, pero desde una perspectiva técnica y científica. Asimismo, en esta certificación, se indicó textualmente, en lo que interesa para el dictado de esta resolución, lo siguiente:
"De conformidad con el artículo 58 del Reglamento a la Ley de Uso, Manejo y Consevación de Suelos, Nº 7779 del 30 de abril de 1998 y con base en una visita de campo, esta instancia certifica que en el 9,58 por ciento de la finca NO SE HA EJERCIDO el uso conforme del suelo para la actividad que realiza de acuerdo con la metodología aprobada y en el 90,42 por ciento SE HA EJERCIDO el uso conforme del suelo para la actividad que se realiza con la metodología aprobada" (...) El uso actual de la tierra está en potrero, charral, matorral y bosque. (...) El potrero de tipo herbazal ralo (...) suelos ácidos, degradados y de baja fertilidad (...) Posiblemente esta modalidad de potrero solo permita una carga animal baja, menor a 1 unidad animal/hectária/año. En el sector A, cubierto por potrero se presenta el uso no conforme de la tierra, de acuerdo a la metodología actual para la determinación de la capacidad de uso de las tierras en Costa Rica, la pendiente fuertemente ondulada es la principal limitante de esta área, la cual es superior al 40 por ciento, simple, convexa, larga con orientación al poniente, por lo que no son aptas para su uso actual de pasturas, su manejo se cirscuncribe a la producción forestal o cultivos permanentes de altura, mediante a prácticas intensivas de conservación de suelos y aguas.
(...) El charral esta sometido a regeneración natural por especies nativas, colonizadoras, las cuales son abundantes, con media a alta cobertura y cercanas al 1 metro de altura. El bosque esta cubierto de árboles y arbustos con sotobosque denso, la altura del estrato superior es alrededor de 15 metros, con especies siempreverdes, latifolias, perennes, en especial de la familia Fabaceae, robles encinos (Quercus spp), con numerosas epifitias Bromeleaceas, Sphagnum, y bejucos en sus ramas. La zona de matorral al oriente de la propiedad con relieve fuertemente escarpado cia (sic) la depresión de la quebradaPilas de la Cuenca del río Pirris, corresponde a un ecosistema de vegetación arbustiva rala, dominado por Asteraceas ((Vernomia spp), expuestas a fuertes y constantes vientos y neblina, por lo que son pequeños, ramificados, con tallos retorcidos y hojas coriáceas, existen espacios de exposición del suelo, el cual es extremadamente pedregoso y con profundidad efectiva superficial.
Transcurren en las simas yurros y la quebrada Lajas la cual se encuentra protegida por boscaje. La propiedad esá (sic) afectada por la ley forestal 7575 artículo 33. Las áreas de regeneración natural, matorral y bosque deben mantenerse bajo las condiciones presentes, que son acordes con la capacidad de uso actual de la tierra. Las clases VII y VIII, según la legislación vigente son de manejo forestal o preservación de la flora y fauna, protección de áreas de recarga acuífera, reserva genética y belleza escénica." De lo expresado en este Certificado de Uso Conforme del Suelo, elaborado por el INTA, este órgano jurisdiccional llega a las siguientes conclusiones: a) Que existe un porcentaje bastante elevado de hectáreas que son bosques, y además, que las zonas de charral y matorral son áreas de regeneración natural, que deben ser protegidas, por lo que la propiedad objeto de este proceso, es patrimonio natural del Estado en su totalidad; b) Esta certificación afirma que el inmueble titulado se encuentra afectado por el artículo 33 de la Ley Forestal 7575, esto significa que está comprendido dentro de un área de protección forestal; c) De la certificación indicada, este órgano jurisdiccional puede inferir, que la zona de potrero tiene una fertilidad baja, lo que significa que no es muy apta para el desarrollo de actividades agrícolas.
Incluso, este documento afirma que en la zona de potrero, se permite una carga de ganado bastante baja, por lo que la propiedad tampoco es adecuada para realizar actividades ganaderas. Es decir, el inmueble titulado por la institución demandada a favor del codemandado Nombre125801 , no clasifica para fines agrarios según la certificación de uso conforme del suelo emitida por el INTA. En consecuencia, el inmueble que la Junta Directiva del Instituto de Desarrollo Agrario, en su Artículo 32 de la Sesión 016-04 del 13 de mayo del 2004, tituló a favor del codemandado Nombre125801 , constituye patrimonio natural del Estado, de conformidad con los artículos 13, 14, 15, 16, 17, 18 y 33 de la Ley Forestal número 7575, por lo que es inembargable, imprescriptible e inalienable al ser un bien de dominio público, por lo que no son de recibo las alegaciones del codemandado Nombre125801 , de que su derecho de titulación se deriva de los derechos de posesión ejercidos por él y su familia, ya que en estos terrenos la posesión por parte de particulares no causara derecho alguno a su favor.
Asimismo, al ser dicha propiedad patrimonio natural del Estado, y constar esta naturaleza demanial, antes, durante y después del procedimiento de titulación efectuado por el IDA, vicia de nulidad absoluta todas las conductas administrativas formales que permitieron el traslado de esa propiedad al demandado Nombre125801 . Asimismo, la conducta administrativa realizada por el IDA en este asunto se considera un funcionamiento anormal, que como se explicará en los siguientes considerandos, produce responsabilidad administrativa, que debe ser indemnizada por parte de dicha institución demandada.
VI- SOBRE LA NULIDAD DE LA TITULACIÓN EFECTUADA POR EL IDA, A FAVOR DEL CODEMANDADO Nombre125801 , AL NO EXISTIR NORMATIVA QUE LA SUSTENTE Y OMITIRSE REQUISITOS NECESARIOS DURANTE EL PROCEDIMIENTO DE TITULACIÓN: Para este órgano jurisdiccional, con solo lo explicado en el considerando anterior, es motivo suficiente para anular las conductas administrativas del IDA y declarar con lugar esta demanda, sin embargo, en el curso de este proceso, las partes han discutido sobre otras razones que vician el procedimiento de titulación efectuado a favor del codemandado Nombre125801 , que este Tribunal debe analizar. En este sentido, las conductas administrativa efectuadas por el IDA, objeto de este proceso, también devienen en nulas, por las siguientes razoneS: 1) Se tiene por probado, que la titulación efectuada por la Junta Directiva del IDA, del inmueble en discordia, a favor del codemandado Nombre125801 , se sustentó en el Reglamento para la Titulación de Tierras en Reservas Naturales, aprobado por la Junta Directiva del Instituto de Desarrollo Agrario, en su artículo segundo, de la sesión cero cincuenta y cinco -cero dos, celebrada el doce de agosto del dos mil dos, el cual fue publicado en La Gaceta número 173 del diez de setiembre del dos mil dos.
Precisamente, por resolución dictada por la Sala Constitucional de la Corte Suprema de Justicia, voto número 02063-07, de las catorce horas con cuarenta minutos del catorce de febrero del dos mil siete, se anuló por inconstitucional dicho reglamento. Asimismo, dicha sentencia indicó claramente lo siguiente:
"XV. De los efectos de la inconstitucionalidad que se declara: Al tenor de lo dispuesto en los artículos 90 párrafo primero y 91 de la Ley de la Jurisdicción Constitucional, la estimación de inconstitucionalidad que se hace en esta sentencia en relación con el Reglamento para la Titulación de Tierras en Reservas Nacionales, aprobado por la Junta Directiva del Instituto de Desarrollo Agrario, aprobado por la Junta Directiva del Instituto de Desarrollo Agrario por el artículo 11 de la sesión número 055-02, del doce de agosto del dos mil dos, y publicado en el Diario Oficial La Gaceta número 173, del diez de agosto del dos mil dos, tiene efectos declarativos y retroactivos a la fecha de vigencia de este cuerpo reglamentario, sea el doce de agosto del dos mil dos, lo anterio, de manera que procede la recuperación de los bienes que, siendo de dominio público, hayan sido objeto de titulación al tenor de la normativa que ahora se anula, lo anterior, sin perjuicio de la responsabilidad patrimonial del Estado que derive de esta inconstitucionalidad" Precisamente, la titulación realizada por el IDA, del terreno que constituye patrimonio natural del Estado, por lo ya explicado, a favor del codemandado Nombre125801 , no se sustenta en una normativa que exista dentro del bloque de legalidad, por lo que deviene en una conducta administrativa nula, con la sola la declaración de inconstitucionalidad realizada por nuestro Tribunal Constitucional.
Además, le preocupa a este Tribunal, que pese a lo ordenado por la Sala Constitucional, en el sentido de que se deben recuperar los bienes de dominio público, que fueron objeto de titulación con base en el Reglamento para la Titulación de Tierras en Reservas Naturales, en este caso en particular, el IDA no haya hecho ningún tipo de gestión tendiente a cumplir con lo ordenado por la Sala Constitucional, lo que denota una conducta omisiva y una clara violación a los deberes que tienen todas las Administraciones Públicas de proteger el patrimonio natural del Estado, lo que constituye un funcionamiento anormal, por tanto, contrario a Derecho; 2) Es un hecho probado que por Decreto Ejecutivo número 3667-G, dictado el dieciocho de marzo de mil novecientos setenta y cuatro, y públicado en La Gaceta número 72, Alcance 64, del diecisiete de abril de mil novecientos setenta y cuatro, se traspasó de forma gratuita al Instituto de Tierras y Colonización (actual IDA), un área de 267.239 hectáreas para crear el Programa de Titulación "Parrita-Puriscal", en donde se ubicaban ocupantes de predios que no tenían regularizada la posesión de esos terrenos.
Justamente, ese terreno traspasado al Instituto de Tierras y Colonización (actual IDA), se inscribió en el Registro Nacional a nombre del Instituto de Desarrollo Agrario, bajo el sistema de folio real, matrícula Placa26960, que fue la finca madre. A su vez, la parcela número 92691, que se encontraba ubicada dentro del Proyecto Puriscal Parrita, es decir, era una segregación de la finca madre indicada anteriormente, ubicada en La Sabana, del distrito La Legua del cantón Aserrí de la provincia de San José, con un área de 35 hectáreas, 82, 59 metros cuadrados, que correspondía con el plano catastrado SJ-600333-99, fue precisamente, el inmueble que la Junta Directiva del IDA, tituló a favor del codemandado Nombre125801 , y que se inscribió en el Registro Nacional bajo la matrícula de folio real número Placa26958, a nombre del demandado Nombre125801 . Ahora, el Decreto Ejecutivo número 3667-G, dictado el dieciocho de marzo de mil novecientos setenta y cuatro, y publicado en La Gaceta número 72, Alcance 64, del diecisiete de abril de mil novecientos setenta y cuatro, fue derogado mediante Decreto Ejecutivo número 346554-MGP, publicado en el Diario Oficial La Gaceta número 147 del 31 de julio de 2008, el cual dispuso en su artículo 2º, textualmente lo siguiente:
"Se autoriza al Instituto de Desarrollo Agrario para que mediante el procedimiento correspondiente proceda a cancelar las inscripciones en el Registro Público que se generaron a raíz de los decretos mencionados" Como se desprende de lo dicho, el Decreto Ejecutivo que creo la finca madre, que a su vez, se segrega de ésta el inmueble titulado por el IDA a favor del demandado Nombre125801 , fue derogado por otro Decreto Ejecutivo, por lo que la titulación realizada al demandado Nombre125801 , carece de sustento en su base, debido a que no existe actualmente la propiedad originaria y la norma que habilito la titulación de esos terrenos. Ahora, nuevamente, este Tribunal, nota que pese a la orden, expresa, dada en el Decreto Ejecutivo número 346554-MGP, al IDA en el sentido de que debía iniciar los procedimientos para cancelar las inscripciones en el Registro Público, que se generaron con el Decreto Ejecutivo número Placa20346, dictado el dieciocho de marzo de mil novecientos setenta y cuatro, en el caso particular, ha existido una conducta omisiva, ya que el IDA, no gestionó en sede administrativa la nulidad del título dado al codemandado Nombre125801 ; 3) Además, de los motivos expuestos, existe un último argumento expuesto por la Contraloría General de la República, en el sentido de que la Ley de Uso, Manejo y Conservación de Suelos, obliga al IDA a realizar de forma previa, a otorgar una titulación, contar con el estudio de capacidad de uso de suelo, requisito que de forma ilegal no cumplió el IDA, al momento de titular la propiedad objeto de este proceso a favor del codemandado Nombre125801 .
Además, de que el Reglamento a la Ley de Uso, Manejo y Conservación de Suelos, le imposibilitaba al IDA titular tierras que no clasifiquen para fines agrarios. Este alegato lo comparte plenamente este Tribunal, debido a que se tiene por probado que al momento de que el Instituto de Desarrollo Agrario, título el inmueble objeto de este proceso, a favor del codemandado Nombre125801 , no se contó con el estudio de capacidad de uso del suelo, requerido por el artículo 27 de la Ley de Uso, Manejo y Conservación de Suelos y los numerales 58, 59, 60, 61, 62 y 63 del Reglamento a dicha Ley. Esto debido a que el mismo IDA lo acepta en su escrito de demanda, y porque en este caso, dentro de la audiencia preliminar, se declararon como no controvertidos todos los hechos de la demanda, entre ellos este hecho. Asimismo, para este Tribunal, existió en este caso una clara violación a los establecido en el artículo 27 de la Ley de Uso, Manejo y Conservación de Suelos, que dispone:
ARTÍCULO 27.- Será obligatorio para el Instituto de Desarrollo Agrario disponer de estudios de capacidad de uso de la tierra, antes de adquirir terrenos para fines de titulación.
Toda adjudicación de terrenos deberá tener como limitación que el uso del terreno adjudicado no pueda ir en contra de su capacidad de uso. El incumplimiento de esta disposición acarreará la revocatoria de la adjudicación, aparte de otras penas con que se pueda castigar por los delitos que le sean imputables.
Nótese, que la norma es muy clara en la obligación del IDA, de contar con los estudios de capacidad de uso de suelos, de previo a titular, y que el incumplimiento de ese mandato acarreará la revocatoria de la adjudicación, que fue lo que sucedió en este caso, debido a que en la titulación realizada a favor del codemandado Nombre125801 , el IDA no solicitó, ni contó con este estudio, violando de manera grosera la citada norma, por lo que también desde esta perspectiva, la titulación realizada a favor del codemandado Nombre125801 deviene en absolutamente nula. En este sentido, el argumento defensivo del IDA, de que el artículo 27 de la Ley de Uso, Manejo y Conservación de Suelos, si bien es cierto establece la necesidad de que el IDA realice estudios de capacidad de uso de suelos, esa norma se aplica para fincas que compre el IDA con recursos propios para destinarlas a la formación de Asentamientos Campesinos, y este no es el caso, ya que lo que sucedió fue que por Decreto Ejecutivo se traspasó miles de hectáreas en todo el territorio nacional, por lo que esa norma no se puede aplicar en este asunto, es totalmente improcedente ese alegato, debido a que el citado artículo, indica, "antes de adquirir terrenos para fines de titulación", por lo que la norma no realiza distinción, de si los terrenos que adquiera el IDA, sea por compra con recursos propios o por simple traspaso, como en este caso, establecido por Decreto Ejecutivo.
Es decir, el artículo 27 de la Ley de Uso, Manejo y Conservación de Suelos, es de aplicación obligatoria para toda titulación de inmuebles que el IDA realice de terrenos que esta institución adquiera por cualquier título traslativo de dominio. Además, el IDA, violó abiertamente lo establecido en los artículos 58, 59, 60, 61, 62 y 63 del Reglamento a la Ley de Uso, Manejo y Conservación de Suelos, Decreto Ejecutivo número 29375 MAG-MINAE-S-HACIENDA-MOPT, que disponen:
Artículo 58.—En toda información posesoria o que se presente ante el IDA o ante los Tribunales de Justicia, con el fin de inscribir en el Registro Público de la Propiedad, el interesado, además de los requisitos que exige la normativa común, deberá de demostrar, con un estudio adecuado de suelos, que ha ejercido la posesión cumpliendo con el uso conforme del suelo para la actividad que realiza de acuerdo con la metodología aprobada, y ejecutándolas con las mejores prácticas de su manejo, según la mejor tecnología disponible en cumplimiento con lo dispuesto en los artículos 3, 6, 12, 13, 19, 26, 27, 41, 43 y 64 de la Ley Nº 7779 y este Reglamento.
Artículo 59.—El estudio será realizado por el Certificador de Uso Conforme del Suelo, quien deberá analizar y certificar con base en visita de campo, si la posesión en las actividades del inmueble, se han ejercido de acuerdo con el uso conforme de suelo según su clasificación y que en el inmueble se realizan prácticas de manejo y conservación de suelos y aguas de acuerdo con la metodología aprobada.
Artículo 60.—Es obligatorio para el IDA contar con estudios de suelos, al menos a nivel de semidetalle en coordinación con el MAG, de previo a toda compra de fincas, parcelación, adjudicación, titulación, arrendamiento, y con mayor énfasis en la titulación de tierras ubicadas en reservas nacionales según ley 7599 del 29 de abril de 1996.
Artículo 61.—Por ningún concepto el IDA podrá adquirir, adjudicar o titular tierras que no clasifiquen para fines agrarios según el estudio de suelos.
Artículo 62.—Si del estudio de suelos y la clasificación de las tierras, no sea procedente la titulación para fines agrarios o urbanos, el IDA las destinará en su caso a reserva nacional traspasándolas en su caso al MINAE.
Artículo 63.—En el contrato o título de arrendamiento o adjudicación de tierras por parte del IDA, se incluirá necesariamente bajo pena de caducidad o revocación, la condición de que en el terreno el adjudicatario, no podrá realizar ninguna actividad contraria al uso, manejo y conservación de suelos y aguas. Conforme lo dispone el artículo 27 y 64 de la Ley Nº 7779. Demostrado su incumplimiento el IDA iniciará el procedimiento de revocación del TÍTULO, para lo que se anotará preventivamente en el Folio Real de la respectiva finca.
Debe hacerse notar, que la normativa citada es clara, respecto a que antes de titular e inscribir terrenos, el IDA tiene la obligación de realizar los estudios de capacidad de uso de suelos, de previo a titular. Asimismo, el citado artículo 61, le prohíbe al IDA adquirir, adjudicar o titular tierras que no clasifiquen para fines agrarios según el estudio de suelos, y precisamente, en este caso del Certificado de Uso Conforme del Suelo, elaborado por el Ing. Agr. German José Aguilar Vega, funcionario del INTA, analizado en el considerando anterior de esta resolución, se llega a la conclusión, que el inmueble objeto de este proceso, y que le fuera titulado a favor del demandado Nombre125801 , no es apto para realizar actividades agrarias o ganaderas, por lo que la nulidad de la titulación efectuada por el IDA, no solo se presenta por la existencia de bosques en el inmueble, que lo constituye en patrimonio natural del Estado, sino también, en que se tituló sobre un terreno que no es apto para actividades de explotación agrícola.
Ahora, en criterio de este órgano jurisdiccional, los alegatos defensivos dados por el IDA, en el sentido de que si bien es cierto que el Reglamento a la Ley de Uso, Manejo y Conservación de Suelos, solicita un estudio adecuado de uso conforme de suelos para los procedimientos de titulación realizados por el IDA, se consideró que estos debían ser realizados por el Ministerio de Agricultura y Ganadería, que se le encargó posteriormente, al Instituto de Innovación y Transferencia de Tecnología Agropecuaria INTA, y por motivos de escases de recursos humanos y técnicos comenzaron a realizarse esos estudios hasta el dos mil uno, y que para cuando se le otorgó el título al demandado, el INTA, no contaba con el mecanismo o estructura para la atención de las certificaciones de uso conforme de suelos y es a esta institución la que le correspondía llevar a cabo las certificaciones de uso conforme de suelo del IDA, y el INTA, suspendió este tipo de certificaciones, son incorrectos, debido a que el IDA no puede trasladar su responsabilidad a otras dependencias como el Ministerio de Agricultura y Ganadería o al INTA, por no poder realizar los estudios de capacidad de uso de suelos, ya que tenía la obligación legal de cumplir con ese requisito.
Además, si el IDA no contaba con esos estudios, porque otras instituciones eran las encargadas y no tenían los recursos humanos y técnicos necesarios para realizarlos, lo que debió haber hecho el IDA era no titular del todo los terrenos, hasta tanto no tuviera la capacidad de dar cabal cumplimiento a lo dispuesto en el artículo 27 de la Ley de Uso, Manejo y Conservación de Suelos. Precisamente, en este caso la institución demandada, otorgó un título de propiedad sin cumplir con lo establecido en el citado artículo de la Ley de Uso, Manejo y Conservación de Suelos y las normas indicadas de el Reglamento a dicha Ley, por lo que la nulidad de las actuaciones del IDA en este caso, son evidentes y manifiestas. En consecuencia, por todas las razones explicadas, debe declararse la nulidad del acto administrativo, únicamente en la titulación del terreno correspondiente con el plano catastrado SJ-600333-1999 a favor del demandado Nombre125801 , emitido por la Junta Directiva del Instituto de Desarrollo Agrario, en su Artículo 32 de la Sesión 016-04 del 13 de mayo del 2004, así como todos los actos conexos, que en los siguientes considerandos de esta sentencia se precisaran.
VII- SOBRE LA PRETENSIÓN DE CONDENA EN DAÑOS Y PERJUICIOS EN ABSTRACTO A LOS DEMANDADOS: La Contraloría General de la República, solicita que se condene a los demandados al pago de los daños y perjuicios causados. Respecto a esta pretensión, considera este Tribunal, que el IDA debe ser condenado al pago en abstracto de los daños y perjuicios debido a que las conductas activas, así como omisivas, descritas a lo largo de esta resolución, son causa suficiente para determinar que esa institución accionada incurrió en un funcionamiento anormal que debe ser indemnizado a favor del Estado o Administración Pública Central, representada en este caso por la Contraloría General de la República, con base en lo dispuesto en los artículos 190 y siguientes de la Ley General de la Administración Pública, relacionado con el numeral 122, inciso m), subinciso iii) del Código Procesal Contencioso Administrativo.
En consecuencia, se condena al pago en abstracto de los daños y perjuicios ocasionados con su funcionamiento anormal, al IDA, que se determinará su existencia y cuantía en la fase de ejecución de sentencia. Ahora, este Tribunal considera, que el codemandado Nombre125801 debe ser exonerado del pago de los daños y perjuicios solicitados por el órgano contralor, debido que a lo largo de este proceso, y de las pruebas que constan en autos, no se le puede atribuir responsabilidad, debido a que no se logró comprobar que sus actuaciones hayan sido realizadas con mala fe, dolo o culpa, al momento de ser beneficiario de una titulación, en la cual su participación fue pasiva y no activa como si lo fue la del IDA. Por lo que se exonera del pago de los daños y perjuicios al señor Nombre125801 .
VIII- RESPECTO A LAS ACCIONES PERTINENTES PARA CONFECCIONAR LA ESCRITURA DE TRASPASO A FAVOR DEL ESTADO DEL INMUEBLE OBJETO DE ESTE PROCESO Y LOS TRÁMITES DE INSCRIPCIÓN EN EL REGISTRO NACIONAL: La Contraloría General de la República, solicita que el inmueble objeto de este proceso, se declare patrimonio natural del Estado, aspecto aceptado en esta resolución, y que se proceda a confeccionar la escritura de traspaso a favor del Estado, así como, tramitar su inscripción en el Registro Público con su respectivo cambio de su naturaleza. Esta pretensión es aceptada por este órgano jurisdiccional, sin embargo debe hacerse según lo dispone el párrafo segundo del artículo 13 de la Ley Forestal, que dispone que será la Procuraduría General de la República, por medio de la Notaría del Estado, el órgano encargado de confeccionar la nueva escritura de traspaso, con su respectivo cambio de naturaleza, y hacer las gestiones pertinentes para inscribir esa escritura en el Registro Público de la Propiedad Inmueble.
IX- SOBRE LA DECLARATORIA CON LUGAR DE LAS PRETENSIONES ESTABLECIDAS EN ESTE PROCESO: Por todas las razones expuestas en esta resolución se declara con lugar la demanda, en los siguientes términos:
X- RESPECTO AL MANTENIMIENTO DE LAS MEDIDAS CAUTELARES IMPUESTAS EN ESTE PROCESO, HASTA QUE SE DICTE LA FIRMEZA DE ESTA SENTENCIA: Con la finalidad de proteger el objeto de este proceso, se ordena mantener las medidas cautelares dictadas por este Tribunal, en la audiencia de medida cautelar, efectuada a las ocho horas y treinta y cinco minutos del ocho de octubre del dos mil ocho, mediante resolución oral, número 700-2008, en los siguientes términos: "1) Se le ordena al demandado Nombre125801 , que se abstenga de realizar quemas y tala de bosque en la totalidad del inmueble objeto de este proceso.
XI- SOBRE EL PAGO DE LAS COSTAS PERSONALES Y PROCESALES DE ESTE ASUNTO: De conformidad con lo establecido en el artículo 193 del Código Procesal Contencioso Administrativo, y al no apreciar este órgano jurisdiccional razones válidas para la exoneración en costas, se condena al IDA, al pago de las costas procesales y personales de este proceso. Se exonera del pago de las costas procesales y personales de este proceso, al señor Nombre125801 , debido que a juicio de este Tribunal, su actuación ha sido de buena fe, de conformidad con lo dispuesto en el artículo 193, inciso b), del Código Procesal Contencioso Administrativo.
POR TANTO
Se declara con lugar la presente demanda, en los siguientes términos:
