RULING NO. 0419-F-06 RULING NO. 0419-F-06 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ, SECCIÓN PRIMERA. Goicoechea, at sixteen hours, seventeen minutes, and twenty seconds on the twenty-sixth of April, two thousand and six.
Possessory title proceeding (información posesoria) brought by GANADERÍA HERMANOS ARAYA GAMBOA SOCIEDAD ANÓNIMA, legal entity identification number (cédula jurídica) CED1- -, represented by [Nombre1], of legal age, married once, farmer, national ID number CED2- -, resident of Ticabán de la Rita, Pococí de Limón, acting in his capacity as attorney-in-fact with unlimited general power of attorney (apoderado generalísimo sin límite de suma). Processed before the Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica. The State participated as a party in the proceedings, represented by attorney Víctor Bulgarelli Céspedes, of legal age, married, attorney-at-law, national ID number CED3- -, resident of Heredia, acting as Agrarian State Attorney (Procurador Agrario); and the Instituto de Desarrollo Agrario, whose representative did not appear. The petitioner's supervising attorney is attorney Rafael Elías Madrigal Brenes, whose personal details do not appear of record.
BACKGROUND:
1. The title applicant (titulante) files a possessory title proceeding valued at nine million five hundred thirty-eight thousand colones, for the purpose of registering in the Registro Público de la Propiedad del Inmueble a parcel described as follows: pastureland (repasto) and scrubland (tacotal), with a surface area (cabida) of ninety-five hectares, five thousand three hundred eighty-five square meters and six square decimeters, per cadastral survey map (plano catastrado) number L-855001-03. The scrubland area is approximately thirty hectares, and the remainder is pastureland. There are two wooden houses currently not in use and a cattle pen. Current boundaries (linderos): to the north, Ganadería Hermanos Araya, S.A. (formerly [Nombre2] and [Nombre3]); to the south, [Nombre4] and the Sota River in between; to the east, Ganadería Hermanos Araya Gamboa S.A., [Nombre5], [Nombre6], [Nombre4], and the Zota River in between; and to the west, [Nombre4] and Aguaitacamino, S.A. (formerly [Nombre7]) and Caño Negro in between (folios 16 and 62, front).
2. For its part, the Procuraduría General de la República appeared in the proceedings in the terms set out at folios 111 to 115, stating its opposition thereto. The Instituto de Desarrollo Agrario was notified as shown at folio 109 and did not appear in the proceedings.
3. Attorney Sergio Ramos Alvarez, trial court judge, in the judgment issued at eleven hours thirty minutes on the thirtieth of November, two thousand and five, ruled: "THEREFORE: By virtue of the foregoing, the reasons cited, and the statutory provisions referenced, the present possessory title proceedings are hereby APPROVED. Accordingly, the Registro Nacional, Registro de la Propiedad Inmueble, is ordered to register, for the first time and without prejudice to third parties with superior rights, in the name of Ganadería Hermanos Araya Gamboa Sociedad Anónima, legal entity ID number CED4-, represented by its president acting as attorney-in-fact with unlimited general power of attorney, Mr. [Nombre1], of legal age, married once, farmer, resident of Ticabán, La Rita, Pococí, national ID number CED5--, the following property: Pastureland and scrubland, located at [Dirección1], [Dirección2], Pococí, Province of Limón, measuring ninety-five hectares, five thousand three hundred eighty-five square meters and six square decimeters, as shown on cadastral survey map L-855001-2003.
Bounded to the North: Ganadería Hermanos Araya Sociedad Anónima; South: [Nombre4], Zota River in between; East: [Nombre4], [Nombre5], Ganadería Hermanos Araya Sociedad Anónima, [Nombre6], and the Zota River; and West: [Nombre4], Aguaitacaminos Sociedad Anónima, [Dirección3], and [Dirección4]. Property valued at nine million five hundred thirty-eight thousand colones. The Registro Nacional, Registro Público de la Propiedad, Sección Propiedad Inmueble, is ordered to proceed with the first-time registration of the property by means of a certified copy of this judgment, without prejudice to third parties with superior rights. The property is registered subject to the limitations established by the Ley de Aguas, Caminos Públicos, and Ley Forestal. Forest areas may not be cleared without the corresponding permit, and no vegetation whatsoever may be removed from the riverbanks within a strip of ten to fifteen meters, depending on the topography. Criminal penalties may be imposed for non-compliance with the foregoing. Once this judgment becomes final, issue the aforementioned certification. SERVE NOTICE." (folio 145, front).
5. Attorney Víctor Bulgarelli Céspedes, Agrarian State Attorney, filed a cassation appeal (recurso de casación) expressly stating the grounds for his challenge to the position of the trial court (folios 147 to 153).
6. In the course of the proceedings, the applicable legal requirements have been observed; no errors or omissions in the judgment capable of causing its nullity are noted.
Opinion drafted by Judge Bolaños Céspedes; and:
LEGAL ANALYSIS:
II.The Agrarian State Attorney of the Republic files an appeal (apelación) against the judgment rendered at eleven hours thirty minutes on the thirtieth of November, two thousand and five, based on the following grounds: The trial court judge stated during the first site inspection of the parcel to be titled that what he found was "a forest that is being cleared (socolando)"; accordingly, compliance with Article 7, second paragraph, of the Ley de Informaciones Posesorias could not be considered established, since it was not proven that the forest resource (recurso boscoso) had been protected. In the Procuraduría's view, the fact that the petitioner, after the Judge's warning, changed his conduct and allowed the forest to regenerate does not reflect good faith on his part—as the trial court asserts—but rather his desire to have the present possessory title proceeding approved (folio 151).
III.In order to properly resolve this matter, the following must be taken into account: 1. The possessory title proceedings conducted under case file (expediente) number EXPN1 were partially denied with respect to the parcel shown on plan No. L-855001-2003, on the grounds that, in the Court's judgment, it was not proven, as to that parcel, that the natural resource (recurso natural) had been protected (folio 21). 2. At that time, the corresponding ruling stated that part of the parcel was being cleared and that clearing was occurring near the bank of the [Dirección5] (folio 21). 3. As a result, an inspection was conducted by MINAE, which found no alteration to the forest and no land-use change (cambio de uso del suelo) at the time of the visit (folio 10). 4. In the present possessory title proceeding, there is a certificate of conforming land use (certificación de uso conforme del suelo) stating the following: "Possession has been exercised in compliance with the conforming use for the activity carried out, in accordance with the approved methodology" (folio 60). 5.
The judicial site inspection (reconocimiento judicial) conducted in the present proceedings recorded the following: "The area is walked where, on a previous occasion during a proceeding of this type, the undersigned had observed persons clearing the riverbank; today the only thing found along its edge is a cleared track of approximately three meters, which is made in order to be able to walk along the riverbank, and the vegetation has already grown back to heights exceeding three meters; furthermore, the shrubs typical of scrubland already reach heights exceeding ten meters; in general, a great number of capulín trees are observed. The area of the river and the Caño Negro stream (quebrada) is protected..." (folio 125).
IV.Having clarified the foregoing, it is important to return to the central point of the grievance, namely that the Judge could not consider the requirement established in Article 7 of the Law on Possessory Information Proceedings to have been met—with respect to the protection of natural resources on forested land—given that the first inspection carried out indicated that the forest was being cleared of undergrowth (socolando). In this regard, it must be said that the appellant is not correct. First, it must be stated that the Possessory Information Proceeding (Información Posesoria) is a non-contentious procedure in which the Judge's role is to verify compliance with the requirements established by law and, accordingly, to disapprove or approve the registration of a new property parcel (finca) with the Public Property Registry (Registro Público de la Propiedad). Among the requirements that must be met is, in the case of forested land, demonstrating that the natural resource has been protected.
To establish this fact, various means are available, such as a judicial site inspection (reconocimiento judicial), a land-use certification (certificación de uso del suelo), and, where applicable, testimonial evidence. In the present case, the observations regarding brush clearing (socola) arose within a prior titling proceeding, not in the present case file; in the current proceeding, the Judge's judicial site inspection states that the natural resource is indeed protected with respect to [Dirección6] and the riverside area. As for brush clearing, no such thing is indicated; rather, the inspection refers to secondary scrubland in regrowth (tacotal en regeneración) (judicial site inspection, folio 125). Additionally, the report submitted at folio 10 by officials of the Ministry of the Environment has been reviewed; those officials, upon conducting an inspection, found that no land-use change (cambio de uso) had occurred.
The final outcome of the criminal complaint filed against the title applicant (titulante) for violation of the Ley Forestal does not appear in the case file; nevertheless, the copy of the MINAE report, together with the judicial site inspection, allows for the appreciation of a change in circumstances relative to the prior proceeding. On the basis of those elements, the judgment would already have to be confirmed, since the requirements of Article 7 are met. Furthermore, it must be borne in mind that the obligation contained in that provision is of recent origin, having been enacted through an amendment to the Law on Possessory Information Proceedings, pursuant to ley 7575 of January 13, 1996. Our country has been correcting a public titling policy that previously placed emphasis on the felling of forest resources as a means of demonstrating possession, and that provision is part of that effort.
Therefore, this matter must always be analyzed in light of the context and social reality of the time in which the rules are to be applied (Article 10 of the Civil Code). Today it is understood that there exist human rights of the first, second, and third generation, which must be integrated. The right to development is, for example, a human right, which implies the obligation of States to provide all necessary measures for access to basic resources, including access to property; this must also be balanced with another human right: the right to enjoy a healthy and ecologically balanced environment. These have been encapsulated in the concept of sustainable development, which carries constitutional status in our country, as contemplated in Article 50, and is subsequently elaborated by ordinary legislation. It is appropriate at this point to cite, insofar as relevant, the analysis on the subject of sustainable development and forest resources conducted by this Tribunal in Voto 149-F-05 of fifteen hundred hours on the tenth of March, two thousand and five: "More recently, the Tribunal has conducted further analyses in order to incorporate new principles that enrich the subject of ecological possession (posesión ecológica) with additional perspectives (see in that regard Voto 311-F-03).
The conceptual evolution is essential to bear in mind, since the judge, in accordance with Article 10 of the Civil Code, is obligated to interpret legal rules in accordance with the context and social reality of the time in which they are to be applied, paying primary attention to their spirit and purpose. For this reason, we summarize in condensed form the evolution of that legal and social reality. It was at the United Nations Conference on Environment and Development (CNUMAD), known as the Rio Summit, held in 1992, that new principles for the international community were consistently elaborated and developed in several legal instruments, such as the Rio Declaration on Environment and Development, the so-called Agenda XXI—an Action Plan to promote sustainable development—and a non-binding Declaration of Principles on Forests; two legally binding instruments were also opened for signature: the Framework Convention on Climate Change and the Convention on Biological Diversity.
Negotiations were likewise begun on the Convention to Combat Desertification, which was opened for signature in 1994 and entered into force in December 1996, all of them signed by our country. Finally, at the 2002 Johannesburg Summit, the Rio Agreements were followed up. As a consequence of those new principles incorporated into our legal system, the concept of sustainable development is now spoken of, and it is already included in the current Ley Forestal in its first article, which establishes, insofar as relevant: 'This law establishes as an essential and priority function of the State the safeguarding of the conservation, protection, and management of natural forests and the production, utilization, industrialization, and promotion of the country's forest resources designated for that purpose, in accordance with the principle of adequate and sustainable use of renewable natural resources.
It shall also safeguard the generation of employment and the improvement of the standard of living of the rural population, through their effective incorporation into silvicultural activities.' (underlining is ours) In the same vein, the concept was regulated in Article 2, subsection c) of the Organic Law of the Environment and in the Biodiversity Law in its Article 9, which we transcribe insofar as relevant: Article 9: General Principles: The following, among others, constitute general principles for the purposes of the application of this law: …4. Intra- and intergenerational equity. The State and private parties shall ensure that the elements of biodiversity are used in a sustainable manner, so that the possibilities and opportunities for their use and their benefits are guaranteed fairly for all sectors of society and to meet the needs of future generations.' Both in the case of the Biodiversity Law and the Soils Law, there is a genuine obligation on the Agrarian Jurisdiction (Jurisdicción Agraria) to apply those principles, since both laws conferred jurisdiction on the Agrarian Courts to hear actions arising from them (Articles 108 of the Biodiversity Law and 54 of the Soils Law).
The principle of sustainable development incorporated in our legislation encompasses at least three dimensions: the economic, the social, and the environmental or ecological. This means that when analyzing a case involving biodiversity, forest resources, or the environment generally, we must take into account that sustainable development is achieved not only through ecological preservation, but also by achieving balance with the social dimension—which seeks development with equity for rural inhabitants—and the so-called economic dimension, which holds that it is necessary to assign value to our natural resources. In the case of agrarian possession, then, which has always served an economic and social function, the environmental dimension is now incorporated; and in the case of ecological possession, it is enriched by the dimensions of sustainable development." In the present matter, there is evidently a right of the title applicant to register his property, as part of his right to enjoy a registered title, which may enable him access to a series of services provided to those who hold documents of that rank.
On the other hand, the purpose is to verify the care given to the natural resource, as a fundamental legally protected interest for present and future generations. Therefore, if in the present matter the title applicant has demonstrated the performance of acts aimed at protecting the natural resource, he cannot be sanctioned with the rejection of his proceedings on account of a prior proceeding, since doing so would violate essential human rights. Consequently, the appropriate course will be to confirm the appealed judgment to the extent it has been the subject of the appeal.
THEREFORE:
The judgment is confirmed insofar as it has been the subject of the appeal.
CARLOS BOLAÑOS CÉSPEDES DAMARIS VARGAS VÁSQUEZ ENRIQUE ULATE CHACÓN DISSENTING VOTE OF JUDGE VARGAS VÁSQUEZ The undersigned judge respectfully disagrees with the majority vote of this Tribunal for the reasons that will be set forth below:
I.First, it is on record in these proceedings that this Tribunal, in Voto Nº 127, issued at 7:48 a.m. on March 18, 2004—less than one year after the present possessory information proceeding (Información Posesoria) was filed—upheld the judgment rendered by the court of origin rejecting a similar proceeding that sought the titling (titulación) of the same property. On that occasion, the fundamental reason set forth by the Tribunal was that the forest resources (recurso forestal) had not been protected. This was so because the a quo placed on record, among other things, the following: "... what exists to the west is forest, except that the low-growth vegetation has been gradually felled or cleared ..." (folio 37). The aforementioned ruling of the Tribunal also referred to the existence of forest "... which is being encroached upon through brush clearing (socolas) and felling (talas) along the banks of the river." The former constitutes a land-use change (cambio de uso del suelo) prohibited by our forestry legislation, and the latter constitutes a disregard for areas forming protected zones (zonas protegidas), given that they are riverbanks.
It is true that the judgment issued in a possessory information proceeding does not have the nature of res judicata (cosa juzgada); and therefore, the titling of an estate (fundo) by means of filing a new proceeding could perfectly well be ordered. Nevertheless, it would be imprudent to grant such a judicial request when neither the petitioner (promovente), nor the court, nor the Tribunal placed on record the outcome of the criminal proceeding whose initiation was ordered precisely by this Chamber in the ruling referenced above. A criterion expressed by the Ministerio de Ambiente or by the a quo, reporting that no evidence of brush clearing is observed, is not sufficient, given that such a report is issued after enough time has passed for nature to have regenerated the affected vegetation to levels that could render imperceptible the situation that the court recorded in the prior proceeding.
Moreover, if one carefully reviews the judicial site-inspection record (Acta de Reconocimiento Judicial) produced in this proceeding, the judge clearly states that a lane (carril) was constructed along the bank of the river that serves as the boundary of the property sought to be titled—which constitutes additional evidence obtained in this new proceeding that forest resources are not being protected. Riverbanks are protected zones that cannot be subject to modification through brush clearing or felling by private parties, and in this case the construction of a lane through that area necessarily implies that both modalities occurred, pursuant to the express provisions of, among others, Article 7 of the Ley de Tierras y Colonización. Most seriously, the majority ruling resolves the matter in disregard of the provisions of the second paragraph of Article 7 of the Ley de Informaciones Posesorias, insofar as, given the existence of forest on the estate, there should have been clear and unambiguous demonstration that forest resources were being protected—a showing that, in the undersigned's view, was not made.
II.For the reasons set forth in the foregoing considerando, the undersigned concurs with the position of the State's representative in that the record contains sufficient elements to deny the possessory information proceeding, it having been established that forest resources are not being protected. It must be clarified, however, that it would not be possible to adopt the position advanced by the appellant—namely, that by allowing the brush clearing to regenerate, the petitioner's intent was to secure approval of the possessory information proceeding rather than to genuinely protect forest resources. This is so because it is impossible in this type of proceeding to determine with certainty the ultimate purpose of the petitioner's representative, who could well have an interest in obtaining titling approval while simultaneously and genuinely seeking to protect forest resources. Nevertheless, in this case the failure to demonstrate the latter again leads to denial of the registration (inscripción), insofar as, although it appears that the brush clearing was allowed to regenerate, no attention was given to the area adjacent to the river, whose banks constitute a protected zone.
III.For the foregoing reasons, in the undersigned's view, the first-instance judgment should in this case have been reversed and, in its place, the possessory information proceeding should have been rejected.

VOTO N° 0419-F-06 VOTO N° 0419-F-06 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIALD DE SAN JOSE, SECCION PRIMERA. Goicoechea, a las dieciséis horas diecisiete minutos veinte del veintiseís abril de dos mil seis.
Información Posesoria planteada por GANADERIA HERMANOS ARAYA GAMBOA SOCIEDAD ANONIMA, cédula jurídica CED1 - - , representada por [Nombre1] , mayor, casado una vez, agricultor, cédula CED2 - - , vecino de Ticabán de la Rita, Pococí de Limón, en su condición de apoderado generalísimo sin límite de suma. Tramitada en el Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica. En el proceso se tuvo como parte al Estado representado por el licenciado Víctor Bulgarelli Céspedes, mayor, casado, abogado, cédula CED3 - - , vecino de Heredia, en el carácter de Procurador Agrario; y al Instituto de Desarrollo Agrario, cuyo representante no se apersonó. Actúa como abogado director del promovente el licenciado Rafael Elías Madrigal Brenes, de calidades en autos ignorados.
RESULTANDO:
1. El titulante plantea diligencias de información posesoria, estimadas en la suma de nueve millones quinientos treinta y ocho mil colones, con el fin de inscribir en el Registro Público de la Propiedad del Inmueble una finca que se describe: terreno de repasto, y tacotal, con una cabida de noventa y cinco hectáreas cinco mil trescientos ochenta y cinco metros y seis decímetros cuadrados, según plano catastrado número L-855001-03. El área de tacotales es de aproximadamente treinta hectáreas, y el resto es de repastos. Existen construídas dos casas de madera, actualmente sin uso, y un corral para ganado. Linderos actuales: al norte Gandera Hermanos Araya, S.A. (antes [Nombre2] y [Nombre3] ), al sur [Nombre4] y río Sota en medio, al este Ganadería Hermanos Araya Gamboa S.A., [Nombre5] , [Nombre6] , [Nombre4] y Río Zota en medio, y al oeste [Nombre4] , y Aguaitacamino, S.A. (antes [Nombre7] ) y Caño Negro en medio, (folios 16 y 62 frente).
2. Por su parte la Procuraduría General de la República, se apersonó al proceso en los términos que corren a folios 111 a 115, manifestando su oposición al mismo. El Instituto de Desarrollo Agrario fue notificado según folio 109, y no se apersonó al proceso.
3. El licenciado Sergio Ramos Alvarez, juez de primera instancia, en sentencia de las once horas treinta minutos del treinta de noviembre del año dos mil cinco, resolvió: "POR TANTO: Virtud de lo expuesto, razones y artículos citados se APRUEBAN las presentes diligencias de INFORMACIÓN POSESORIA. Por ello, se ordena al Registro Nacional, Registro de la Propiedad Inmueble, para que por primera vez y sin perjuicio de tercero de mejor derecho, se inscriba a nombre de Ganadería Hermanos Araya Gamboa Sociedad Anónima, cédula jurídica número CED4- , representado por su presidente en condición de apoderado generalísimo sin límite de suma, señor [Nombre1] , mayor, casado una vez, agricultor, vecino de Ticabán, La Rita, Pococí, cédula de identidad número CED5- - el siguiente bien: Terreno de repasto y tacotal, sito en [Dirección1], , [Dirección2] , , Pococí de la provincia de Limón, que mide noventa y cinco hectáreas, cinco mil trescientos ochenta y cinco metros con seis decímetros cuadrados, graficado según plano L-855001-2003.
Colinda al Norte: Ganadería Hermanos Araya Sociedad Anónima, Sur: [Nombre4] río Zota en medio, Este, [Nombre4] , [Nombre5] , Ganadería Hermanos Araya Sociedad Anónima, [Nombre6] y río Zota y Oeste: [Nombre4] , Aguaitacaminos Sociedad Anónima, [Dirección3] , y [Dirección4] . Inmueble estimado en la suma de nueve millones quinientos treinta y ocho mil colones. Se ordena al Registro Nacional, Registro Público de la Propiedad, Sección Propiedad Inmueble, para que mediante copia certificada de ésta sentencia proceda a la inscripción del inmueble por primera vez y sin perjuicio de tercros de mejor derecho. Se inscribe con las limitaciones que al efecto establecen las leyes de Aguas, Caminos Públicos y Forestal. El área de bosque no podrá ser talada si contar con el permiso respectivo y no se podrá eliminar absolutamente ninguna vegetación en los borden dele río, entre diez quince metros según sea la topografía. Pudiéndose sancionar penalmente la inobservancia de lo aquí indicado. Firme esta sentencia, expídase la certificación citada. NOTIFÍQUESE. (folios 145 frente).
5. El licenciado Vícto rBulgarelli Céspedes procurador agrario, interpuso recurso de casación con indicación expresa de las razones que apoyaron para refutar la tesis del juzgado de instancia, (folios147 a 153).
6. En la substanciación del proceso se han observado las prescripciones legales, no se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad.
Redacta el juez Bolaños Céspedes: y;
CONSIDERANDO:
II.El Procurador Agrario de la República presenta apelación de la sentencia de las once horas treinta minutos del treinta de noviembre del dos mil cinco, con base en las siguientes consideraciones: El juez de primera instancia indicó en la primera inspección del terreno a titular que lo que encontró fue " un bosque que están socolando", entonces no podría haberse tenido por demostrado el cumplimiento del artículo 7 párrafo segundo de la Ley de Informaciones Posesorias, al no probarse que se ha protegido el recurso boscoso. En criterio de la Procuraduría el hecho de que el promovente, después de la advertencia del Juez, cambió su conducta y dejó regenerar el bosque, no obedece a su buena fe, como afirma el Juzgador, si no a su deseo de que se apruebe la presente Información Posesoria (folio 151).
III.Para resolver adecuadamente el presente asunto debe tenerse en cuenta lo siguiente: 1. Las diligencias de Información Posesoria tramitadas bajo expexdiente número EXPN1, fueron improbadas parcialmente respecto del inmueble plano N° L-855001-2003, por cuanto a juicio del Despacho no se probó, respecto de ese inmueble haber protegido el recurso natural (folio 21) 2. En esa oportunidad se indicó en la resolución respectiva, se estaba socolando una parte del inmueble y cerca de la orilla de la [Dirección5] ( folio 21). 3. A raiz de ello se realizó una inspección por parte del Ministerio de Ambiente y Energía no encontrándose alteración del bosque y que no hay cambio de uso del suelo en el momento de la visita ( folio 10) 4. En la presente información posesoria existe certificación de uso conforme del suelo que indica lo siguiente: " Se ha ejercido la posesión cumpliendo con el uso conforme para la actividad que se realiza de acuerdo con la metodología aprobada" (folio 60) 5.
En el reconocimiento judicial realizado en las presentes diligencias se consignó lo siguiente: " Se recorre lazona (sic)en donde con ocasi;on (sic) anterior a una diligencia de este tipo, el suscrito habíaobservado (sic) personas limpiando la orilla del río, hoy lo únicoqe (sic) hay en su borde (sic) es un carril de unos tres metros de limpio, qe (sic) se hace para poder recorrer el borde del río y la vegetación ya ha crecido a alturas superiores a los tres metros, sumado además de que los arbustos, propios de un tacotal ya tiene alturas superiores a los diez metros, en general se observamucho (sic) árbol del tipo capulín. el área del río y de la quebrada caño negro se encuentra protegida..." ( folio 125).
IV.Aclarado lo anterior es importante retomar el punto central del agravio a saber, que el Juez no podía tener por demostrado el cumplimiento del requisito establecido en el artículo 7 de la Ley de Informaciones, en cuanto a la protección del recurso natural en terrenos con bosque, si en la primera inspección realizada se dijo que el bosque se estaba socolando. Al respecto debe decirse el recurrente no lleva razón. En primer término debe decirrse, el procedimiento de la Información Posesoria es un trámite de naturaleza no contenciosa, donde el Juez lo que hace es verificar el cumplimiento de los requisitos exigidos por la ley, y en tal caso improbar o aprobar i la inscripción por parte del Registro Público de la Propiedad de una nueva finca. Dentro de los requisitos que se deben cumplir se encuentra, en el caso de los terrenos con bosque, la demostración de haber protegido el recurso natural.
Para la acreditación de tal extremo, existen diferentes medios, como el reconocimiento judicial, la certificación de uso del suelo, y eventualmente prueba testimonial. En el presente caso, las observaciones sobre socola se dieron dentro de un proceso de titulación anterior, no en el presente expediente, pues en el presente trámite, el juez en el reconocimiento judicial indica que si se encuentra protegido dicho recurso en cuanto a la [Dirección6] y el área del río. En cuanto a que hubiere socola, no se indica tal cosa, más bien habla de un tacotal en regeneración (reconocimiento judicial folio 125). Por otra parte se ha tenido a la vista el informe dado por funcionarios del Ministerio del Ambiente a folio 10, quienes al realizar una inspección no encontraron se haya hecho cambio de uso. No aparece en el expediente el resultado final de la denuncia penal que se tramitó contra el titulante por infracción a la Ley Forestal no obstante, la copia del informe del MINAE junto con el reconocimiento judicial permiten apreciar un cambio de circunstancias en relación con el proceso anterior.
Con esos elementos ya habría que confirmar la sentencia, pues se cumplen con los requisitos del artículo 7. Pero además debe tenerse en cuenta la obligación contenida en esa norma es de reciente data pues se aprueba mediante reforma realizada a la Ley de Informaciones posesorias, según ley 7575 de 13 de enero de 1996). Nuestro país ha venido rectificando una política pública de titulación, que anteriormente ponía el énfasis en la tala de los recursos del bosque como medio de demostración de la posesión, y esa norma es parte de ese esfuerzo. Por tanto debe analizarse siempre este tema a la luz del contexto y la realidad social del tiempo en que han de ser aplicada (artículo 10 del Código Civil). Hoy día se comprende existen derechos humanos de primera, segunda y tercera generación, los cuales deben ser integrados. Es por ejemplo un derecho humano, el derecho al desarrollo, que implica la obligación de los Estados de proveer todas las medidas necesarias para el acceso a los recursos básicos, entre ello el acceso a la propiedad, lo cual también debe combinarse con otro derecho humano que es el de disfrutar de un ambiente sano y ecológicamente equilibrado, lo cual se ha resumido en el concepto de desarrollo sostenible, que tiene rango constitucional en nuestro país, al contemplarse en el artículo 50 y luego es desarrollado por la legislación ordinaria.
Conviene citar en este momento, en lo que interesa, el análisis que sobre el tema del desarrollo sostenible y los recursos forestales ha realizado este Tribunal en el Voto 149-F-05 de las quince horas del diez de marzo del dos mil cinco: "Más recientemente, el Tribunal ha realizado otros análisis a fin de incorporar nuevos principios, que enriquecen con otros aspectos el tema de la posesión ecológica.( en ese sentido se puede consultar el Voto 311-F-03 ). La evolución conceptual es fundamental tenerla en cuenta, por cuanto el juez de conformidad con el artículo 10 del Código Civil, tiene la obligación de interpretar las normas de acuerdo con el contexto y la realidad social del tiempo en que han de ser aplicadas, atendiendo fundamentalmente al espíritu y finalidad de ellas. Por ello en forma condensada resumimos cual ha sido la evolución de esa realidad jurídica y social. Fue en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y Desarrollo (CNUMAD) conocida como Cumbre de Río, celebrada en el año 1992 que se elaboran consistentemente nuevos principios para la comunidad internacional, desarrollados en varios instrumentos legales como la Declaración de Río sobre Medio Ambiente y Desarrollo, la llamada Agenda XXI que era un Plan de acción para promover el desarrollo sostenible, además se emite una Declaración de Principios relativos a los bosques, sin carácter vinculante y se abren a firma dos instrumentos con fuerza jurídica, la Convención Marco sobre Cambio Climático y el Convenio sobre Diversidad Biológica, también se iniciaron negociaciones sobre la Convención de Lucha contra la Desertificación la cual quedó abierta a la firma en 1994 y entró en vigor en diciembre de 1996, todos ellos suscritos por nuestro país.
Finalmente en la Cumbre de Johannesburgo del 2002, se le dio seguimiento a los Acuerdos de Río. Como consecuencia de esos nuevos principios incorporados a nuestro ordenamiento jurídico, se habla hoy del concepto de desarrollo sostenible, el cual ya está incluido en la ley Forestal vigente en su artículo primero: que establece en lo de interés: “ La presente ley establece como función esencial y prioritaria del Estado, velar por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables. Además velará por la generación de empleo y el incremento del nivel de vida de la población rural, mediante su efectiva incorporación a las actividades silviculturales.” (el subrayado es nuestro) En el mismo sentido se reguló el concepto en el artículo 2 inciso c) de la Ley Orgánica del Ambiente y en la Ley de Biodiversidad en su artículo 9, el cual transcribimos en lo que interesa: Artículo 9: Principios generales: Constituyen principios generales para los efectos de la aplicación de esta ley, entre otros, los siguientes: …4.
Equidad intra e intergeneracional. El Estado y los particulares velarán porque la utilización de los elementos de la biodiversidad se utilicen en forma sostenible, de modo que las posibilidades y oportunidades de su uso y sus beneficios se garanticen de manera justa para todos los sectores de la sociedad y para satisfacer las necesidades de las generaciones futuras. “ Tanto en el caso de la Ley de Biodiversidad, como la de Suelos, existe verdadera obligación de la Jurisdicción Agraria para aplicar esos principios por cuanto, tanto una ley como la otra le dieron competencia a los Tribunales Agrarios para conocer de las acciones derivadas de ellas ( artículos 108 de la Ley de Biodiversidad y 54 de la Ley de Suelos). El principio del desarrollo sostenible incorporado en nuestra legislación contempla al menos tres dimensiones, la económica, la social y la ambiental o ecológica. Quiere decir que al analizarse un caso de biodiversidad, recursos forestales, o en general del ambiente debemos tomar en cuenta, que el desarrollo sostenible no solo se logra a través de la preservación ecológica, sino también logrando el equilibrio, con la dimensión social que busca un desarrollo con equidad para los habitantes rurales y la llamada dimensión económica que entiende es necesario darle valor a nuestros recursos naturales.
En el caso de la posesión agraria entonces, la cual siempre reportó una función económica y social ahora incorpora la dimensión ambiental y en el caso de la posesión ecológica, ésta se enriquece con las dimensiones del desarrollo sostenible". En el presente asunto, existe evidentemente un derecho del titulante a inscribir su propiedad, como parte de su derecho a gozar de un título inscrito, lo cual le puede permitir el acceso a una serie de servicios que se brindan a quien tiene documentos de ese rango. Por otro lado se busca la verificación del cuido al recurso natural, como un bien jurídico fundamental para las presentes y futuras generaciones. Por tanto si en el presente asunto el titulante ha demostrado el desarrollo de actos tendientes a proteger el recurso natural, no podría sancionársele con el rechazo a sus diligencias, por un proceso anterior, pues con ello estaríamos vulnerando derechos humanos esenciales. En consecuencia lo procedente será confirmar en lo que ha sido objeto de apelación la sentencia recurrida.
POR TANTO:
Se confirma la sentencia en lo que ha sido objeto de apelación.
CARLOS BOLAÑOS CÉSPEDES DAMARIS VARGAS VÁSQUEZ ENRIQUE ULATE CHACÓN VOTO SALVADO DE LA JUEZA VARGAS VÁSQUEZ La suscrita jueza, respeta pero no comparte el voto de mayoría de este Tribunal por las razones que de seguido se expondrán:
I.En primer término, consta en autos este Tribunal en Voto Nº 127 de las 7 horas 48 minutos del 18 de marzo del 2004, dictado a menos de un año de que se presentaran estas diligencias de Información Posesoria, confirmó la sentencia dictada por el Juzgado de origen rechazando un trámite similar que pretendía la titulación del mismo inmueble. En esa oportunidad la razón fundamental esbozada por el Tribunal fue que no se había protegido el recurso forestal. Esto último porque el a quo hizo constar en el acta entre otras cosas lo siguiente: "... lo que existe hacia el oeste es bosque, solo que se ha venido talando o limpiando la vegetación de porte pequeño ..." (folio 37). También se hizo alusión en el citado fallo del Tribunal de la existencia de bosque "... mismo que está siendo intervenido mediante la práctica de socolas y talas a orillas del río". Lo primero implica un cambio de uso del suelo prohibido por nuestra legislación forestal y lo segundo, un irrespeto a áreas que conforman zonas protegidas, pues se trata de las orillas de un río.
Ciertamente, la sentencia que se dicte en un trámite de Información Posesoria no tiene la naturaleza de cosa juzgada; y por ende, podría perfectamente disponerse la titulación de un fundo mediante la presentación de un nuevo proceso; no obstante, es imprudente acceder a tal petición judicial si no se hizo constar en autos por parte del promovente, y tampoco por el Juzgado o el Tribunal, los resultados del proceso penal cuya apertura fue ordenada precisamente por esta Sede en el voto en referencia. No es suficiente con un criterio exteriorizado por el Ministerio de Ambiente o por el a quo, informando no se observa la existencia de socolas, pues ello se informa luego de que ha transcurrido tiempo suficiente para que la naturaleza haya logrado regenerar la vegetación afectada a niveles tales que podrían hacer imperceptible la situación que el Juzgado consignó en el proceso anterior. Inclusive, si se observa con detenimiento el Acta de Reconocimiento Judicial practicado en este proceso, el juzgador es claro en afirmar se construyó un carril a orillas del río que sirve de colindancia al inmueble que se pretende titular, lo cual es una evidencia más obtenida en este nuevo proceso, de que no se está protegiendo el recurso forestal, pues las orillas de los ríos constituyen zonas protegidas que no pueden ser objeto de modificaciones mediante socolas o talas por parte de los particulares y en este caso, la hechura de un carril por ese sector necesariamente implica que en este caso se dieron ambas modalidades, según disposición expresa, entre otros, del artículo 7º de la Ley de Tierras y Colonización.
Lo grave de todo esto, es que se está resolviendo en el voto de mayoría con menosprecio de lo dispuesto por el párrafo segundo del artículo 7º de la Ley de Informaciones Posesorias, en la medida de, al existir bosque en el fundo, debió ser diáfana la demostración de que se estaba protegiendo el recurso fotestal, situación que en criterio de la suscrita no se dio.-
II.Por lo expuesto en el considerando anterior, la suscrita comparte el criterio del representante del Estado en el sentido de que existen en el proceso elementos suficientes para denegar el trámite de Información Posesoria al haberse constatado que no se está protegiendo el recurso forestal. Aunque debe aclararse, no podría asumirse la posición expuesta por el recurrente en el sentido de que al dejar que se regenerara la socola lo que pretendió el promovente fue se aprobara la Información Posesoria, lejos de tener la convicción de proteger el recurso forestal. Esto último en la medida de que es imposible en este tipo de trámites poder tener certeza del fin último del representante de la promovente, pues bien podría tener interés en que se apruebe la titulación y a la vez proteger el recurso forestal; no obstante, en este caso la no demostración de lo segundo conlleva de nuevo a la denegatoria de la inscripción en la medida de que, aunque parece se dejó se regenerara la socola, no se ocupó del área aledaña al río, cuyas orillas constituyen zona protegida.-
III.En razón de lo anterior, en criterio de la suscrita, debió en este caso revocarse la sentencia de primera instancia y en su lugar, haberse dispuesto el rechazo de la Información Posesoria.-
