Res: [Telf1] CRIMINAL COURT OF CASSATION. SECOND JUDICIAL CIRCUIT OF SAN JOSE, GOICOECHEA. At ten hours and eleven minutes on the twentieth of May of two thousand and four.
APPEAL ON POINTS OF LAW (Recurso de Casación) filed in the present case brought against [Nombre1], of legal age, married, Costa Rican, Agricultural Engineer, resident of Palmar Sur de Osa, 75 meters southwest of the roundabout at [Dirección1], born in Cartago on the ninth of September of nineteen fifty-seven, son of [Nombre2] and [Nombre3], bearing national identity card number CED1, for the offense of WATER CONTAMINATION, to the detriment of NATURAL RESOURCES. Participating in the decision on the appeal are judges Omar Vargas Rojas, Fernando Cruz Castro, and Ulises Zúñiga Morales. The following parties appeared before the Court of Cassation: Lic. [Nombre7] as defense counsel (defensor) for the defendant (imputado) and as representative of the civil defendant (demandada civil) Inversiones Sábalo S.A.; and, representing the State, Lic. [Nombre8].
WHEREAS:
1) That the Trial Court of the Southern Zone, Golfito Branch, by resolution of nine hours on the fifth of January of two thousand and three, ruled: "THEREFORE: For the reasons stated above and pursuant to articles 39 and 41 of the Constitución Política, 1, 31 and 45 of the Código Penal, 122 and 124 of the Código Penal of 1941, 1, 1045 of the Código Civil, 1, 4, 5, 6, 141, 142, 266, 269, 270, 360, 366, 368, of the Código Procesal Penal, [Nombre1] is ACQUITTED of all punishment and liability for the offense of WATER CONTAMINATION to the detriment of NATURAL RESOURCES. With no special award of costs in the criminal proceedings. The civil damages action (ACCION CIVIL RESARCITORIA) filed by the State against Inversiones Sábalo S.A., represented by [Nombre9], is hereby declared GRANTED, with the amount of damages and losses sustained fixed at THREE MILLION COLONES, a sum which the losing defendant shall pay in favor of the State. The procedural costs and attorney's fees (costas procesales y personales) of the civil action brought against said company shall be borne by it. With respect to the civil claim filed by the same plaintiff against [Nombre1], it is declared WITHOUT MERIT, and as regards that party, with no special award of procedural costs and attorney's fees. Written by Cassation Judge VARGAS ROJAS; and,
CONSIDERING:
I.The appeal on points of law meets the admissibility requirements of articles 422, 423, 424, 443, 444, 445, and 447 of the Código Procesal Penal, and the grounds presented are therefore taken up for consideration.
II.The first ground of the procedural cassation appeal (casación por la forma) alleges violation of the chain-of-custody (cadena de custodia) rules governing evidence. The appellant invokes as violated Articles 19 and 41 of the Constitución Política, and Articles 18, 175, 178(a), 182, and 183 of the Code of Criminal Procedure. The appellant argues that in the challenged judgment the trial judge granted full validity and evidentiary weight to the collected water samples and their corresponding analyses, even though the chain-of-custody rules were violated during their collection. In the present case, the collection, preservation, packaging, transport, delivery, and analysis of the evidence did not involve members of the judicial police; instead, these steps were carried out by officials from INCOPESCA, the Ministerio de Salud, MINAE, and a private chemical analysis laboratory, none of whom left documentary records of the procedures used.
The second ground alleges violation of the rules of rational evaluation (sana crítica), specifically the rule of logic and the principle of logical inference (principio de derivación). The appellant identifies as violated Articles 39 and 41 of the Constitución Política, and Articles 142 and 369 of the Code of Criminal Procedure. In the challenged judgment, the trial judge found the civil defendant's liability established on the basis of an erroneous evaluation of the evidence. From the evidence admitted at trial, it is not possible to conclude that the pesticides (plaguicidas) sprayed on the plantation were the same ones detected in the water samples. The experts were clear in stating that pesticides dissolve within a few hours, making it impossible to detect them after a day or a day and a half from their application, particularly given the dilution factor caused by rainwater that fell on the day of the spraying (fumigación).
Furthermore, the water analyses detected Clorpirifos, a pesticide not used by the civil defendant. On the other hand, the results of the sample analyses present significant technical inconsistencies. Specifically, the contamination found in Canal Camote was far greater than that recorded in Laguna Arrozal. Now, if a substance is sprayed at a given location, the highest concentration will occur at the upper point and not at the end of the flow path, since the substance dilutes and tends to disappear along the way. Therefore, the concentration should have been higher in Laguna Arrozal than in the canals. The judge found the presence of pesticides established based on the testimony of witness [Nombre12]; however, witness Santamaría stated the contrary, namely that "…I did not perceive any smell of agrochemicals (agroquímico)." The appellant again challenges the improper collection of the samples. Neither the specific points at which the samples were taken, the depth at which they were collected, the type of instrument used, nor other relevant details were documented.
The third ground alleges lack of reasoning (falta de fundamentación) due to the failure to evaluate essential evidence. The appellant identifies as violated Articles 39 and 41 of the Constitución Política, and Articles 142, 363, and 369 of the Code of Criminal Procedure. At trial, the report of Dr. [Nombre14], Professor of Pharmacology and Toxicology at the School of Veterinary Medicine of the Universidad Nacional, was admitted into evidence, as was official memorandum PR 14-2002 from Engineer [Nombre15]; however, the judgment omits any analysis of these documents. Dr. Villalobos's report demonstrates the irregularities committed by the authorities at the time of collecting the water samples, as well as in the procedure followed through to the issuance of the corresponding expert opinion (dictamen). As for memorandum PR-2002, it demonstrates that Hinosan was authorized for aerial application and that its degradation half-life is a matter of a few hours.
The fourth ground alleges lack of reasoning due to insufficient reasoning (fundamentación insuficiente). The appellant claims violation of Articles 39 and 41 of the Constitución Política, and Articles 142 and 369 of the Code of Criminal Procedure. The defect occurs when the challenged judgment discredits the testimony of Dr. [Nombre14] without providing any reasoning whatsoever. The sole basis given for discounting his testimony is that he was retained by the defense.
The fifth ground alleges lack of reasoning due to insufficient reasoning. The defect consists in the trial judge finding the civil liability of the defendant company established without addressing the procedural necessity of admitting fundamental evidence, namely the necropsy (necropsia) of the dead fish. This necessity was acknowledged by witnesses [Nombre12] and Villalobos themselves. Such evidence would have established beyond doubt the cause of death of the fish.
The sixth ground alleges lack of reasoning due to insufficient reasoning with respect to the civil action (acción civil). The appellant contends that neither strict liability (responsabilidad objetiva) nor the causal link (nexo causal) between the company's activity and the environmental damage (daño ambiental) in question has been established. The judge finds that the civil defendant acted negligently, yet fails to set out which specific negligent acts were committed by the appellant's client that caused the environmental damage. The appellant alleges lack of reasoning in the civil damages action (acción civil resarcitoria) due to non-observance of the rules of rational evaluation. The appellant argues that neither the breach of the objective duty of care (deber objetivo de cuidado) by the appellant's client, nor the environmental damage, was proven. The court finds proven the breach of the objective duty of care in the application of the fumigation substances and establishes a causal link between this fumigation and the alleged environmental damage.
This inference is drawn from testimonial evidence. However, biologist [Nombre12] draws his conclusions from what neighbors told him — that is, from third parties who did not testify at trial. In any event, the testimony of the witnesses does not support the conclusion that "following the fumigation of the rice paddies, rain subsequently fell on the area and carried the chemical components through the canals, thereby causing the alleged environmental damage described." The eighth ground continues to allege lack of reasoning in the civil damages action. The judge imposes civil liability on the grounds that there was a breach of the duty of care in applying the chemical substances to the rice paddy, which allegedly caused environmental damage. This conclusion is never explained with supporting reasoning. A clear violation of the chain of custody occurred, as was revealed by the expert report of Dr. Villalobos.
Furthermore, memorandum Pr-2002 demonstrated that Hinosan dissolves in water within a few hours, yet the samples were taken seven days after the application; moreover, no necropsy was performed on the dead fish or other fauna found, making it impossible to determine the cause of death.
THE APPEAL IS DENIED. Although the appeal is presented through nine grounds, all of them concern issues of reasoning, and they are therefore resolved jointly.
According to the first recital (considerando primero) of the challenged judgment, it was found established that the accused (encartado) [Nombre1], in his capacity as an agronomist, worked for the company Inversiones Sábalo S.A. and was responsible for technical advisory services regarding the application of chemicals on the rice plantation located in La Virgen de Golfito. On November 13, 14, and 16, 2000, the accused prepared the application prescriptions (recetas) for agrochemical products, selecting, among other products, Endosulfán, which is toxic to fish and may only be applied by ground means, and Hinosofán, which is also toxic to fish. After November 14, and within the same month, aerial spraying was carried out using Hinosofán and Endosulfán; those chemicals reached the waters of the rivers Coto and Sábalo, contaminating them and causing the death of large numbers of native fauna. The trial court acquitted the accused by application of the principle of in dubio pro reo, but found the civil defendant liable by applying strict liability and grounding the judgment in Article 1045 of the Civil Code. Accordingly, the only matters at issue in this appeal are the civil aspects, not the criminal ones.
This makes it questionable to apply the requirements of the "chain of custody," which is a purely criminal-law doctrine for determining the admissibility of evidence, to a strictly civil matter governed by different principles and legal foundations. Indeed, as is well known, civil liability arises from two main branches. On one hand, there is contractual liability (responsabilidad contractual), which need not be analyzed here, and on the other, extra-contractual liability (responsabilidad extracontractual). The latter comprises fault-based liability (responsabilidad subjetiva) and strict liability. Fault-based liability is that which arises as a consequence of intentional wrongdoing (dolo) or negligent conduct (culpa) through which harm is caused. This form of liability is expressly set forth in Article 1045 of the Civil Code, which provides: "Anyone who by willful misconduct, fault, negligence, or recklessness causes harm to another is obligated to repair it together with the resulting losses." From this it follows that it is essential to prove both the existence of the harm and the causal relationship between that harm and the intentional or negligent conduct.
The foregoing allows us to establish that the trial judge committed a material error by grounding strict liability in the aforementioned Article 1045 of the Civil Code, when that provision actually addresses fault-based liability — an error that, pursuant to Articles 146 and 433 of the Code of Criminal Procedure, must be corrected in the manner set out below. In the present case, strict liability arises, the starting point of which is not the actor's conduct but rather the carrying out of industrial, commercial, or agricultural activities that, although lawful, generate risk and are a potential source of harm. Its basis is not subjective but rather objective, in that the central concern is not to sanction or punish but to provide reparation. Progressively, the new law of damages (derecho de daños), guided by solidarity-based principles, moves toward the objectification of liability and takes into account other criteria grounded in economic, social, and other assessments, imposing the requirement that the harm suffered not be borne exclusively by the victim but be capable of being economically shifted to a third party. The idea centers no longer on sanctioning or punishing the author of the unlawful conduct, but on the need for the harm to be repaired. (Cf.: [Nombre17]. Teoría General de la Reparación de daños. As provided by Article 41 of the Constitución Política of Costa Rica: "Having recourse to the laws, all persons shall find reparation for injuries or damages suffered in their person, property, or moral interests…" Under this provision, the basis for reparation does not rest on negligence or willful misconduct but rather on the occurrence of harm. This provision is complemented by Articles 46 and 50 of the same Constitution. In this regard, the final paragraph of Article 46 provides that "…consumers and users have the right to the protection of their health, environment, safety, and economic interests; to receive adequate and truthful information; to freedom of choice and to equitable treatment…," while Article 50 establishes: "The State shall seek the greatest well-being for all inhabitants of the country by organizing and stimulating production and the most equitable distribution of wealth. Every person has the right to a healthy and ecologically balanced environment. Every person therefore has standing to report acts that infringe upon that right and to claim reparation for the harm caused. The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and sanctions" (emphasis added).
For its part, the Ley Orgánica del Ambiente, giving effect to the constitutional mandate, sets forth in Article 2, subsection d) a general principle to the effect that: "Whoever pollutes the environment or causes damage to it shall be liable, as established by the laws of the Republic and the international conventions in force." Meanwhile, Article 59 of the same statute defines environmental pollution (contaminación del ambiente) as "any alteration or modification of the environment that may be harmful to human health, threaten natural resources, or affect the Nation's environment in general. The discharge and emission of pollutants shall mandatorily comply with the technical regulations issued for that purpose. The State shall adopt such measures as are necessary to prevent or remedy environmental pollution." Regarding the discharge of polluting material—which is precisely what is under discussion—Article 66 of the same statute provides that "…responsibility for treating discharges shall rest with whoever produces the pollution…".
Finally, Article 101 of the Ley Orgánica del Ambiente provides that "Without prejudice to any other liability that may arise for parties acting in any capacity whatsoever, those who commit violations of this law or of laws regulating the protection of the environment and biological diversity, whether natural or legal persons, shall be jointly and severally liable in civil law for all damages and losses caused…" From the foregoing legal framework it is clear that our legislature has received and given concrete expression to the traditional principle of environmental law, under which "the polluter pays," regardless of whether a subjective link exists. We are witnessing a paradigm shift, since liability is not always grounded solely in the theory of fault; rather, the growing number of harmful causes produced by industrial, commercial, and agricultural development exposes human beings to greater risks.
In connection with this topic, and analyzing paragraph five of the Código Civil, [Nombre18] notes that "in our case law… it has been clarified that paragraphs 4 and 5 of Article 1048 of the Código Civil are not based on liability for direct or indirect fault, but on strict liability (responsabilidad objetiva)—that is, liability without fault—which falls upon the operators of hazardous establishments and those engaged in the operation of means of transport; these two rules are a reflection of the theory of risk. In reality, the legislature has thereby taken two things into account: on the one hand, to encourage the care of owners and operators of hazardous activities in order to prevent accidents, and, on the other, to better guarantee payment of the corresponding indemnification by placing it directly upon solvent individuals. As may be observed, unlike cases of 'fault-based liability,' strict liability rests on the fact that a person, for their own benefit, creates a source of probable harm and exposes other persons and property to dangers, and thus becomes obligated if the damage materializes…" (Pérez Vargas Víctor. Derecho Privado. San José, Publitex, 1998, p. 416).
From a practical standpoint, strict liability may be summarized as an advantage in favor of the injured party, in that it represents a reversal of the burden of proof (inversión de la carga de la prueba): the injured party is relieved of the burden of proving the fault or intent of the party who caused the harm, and need not prove their own absence of fault either, unlike in cases of subjective liability. The basis for this type of liability is the social recognition that certain activities, even when lawful (meaning it is not a requirement that they be unlawful) and necessary within current social and technological development—which cannot and must not be obstructed—nonetheless concurrently generate a risk—as entities capable of producing eventual harm—which of course must not be borne by the victim or their relatives, but rather by whoever benefits from the hazardous activity or from the possession of a source of danger.
Those enterprises, which generate danger for the community and benefit for their owner, constitute the means through which harm is caused to the victim. Consequently, as the party causing the injury, they are obligated to repair it. (On civil strict liability, cf.: Voto 085-F-99 of 10 March 1999, Tribunal Superior de Casación Penal. That being so, the central argument of the appellant that the chain of custody (cadena de custodia) was violated in the collection of samples is without merit. Such principles are valid for establishing criminal liability, but not for civil liability, where different criteria apply. It must be recalled that the water samples were not taken by members of the Organismo de Investigación Judicial, nor by officers of that agency. Rather, it was members of the Golfito Coast Guard station and officials of the Ministerio de Salud who were responsible for those proceedings. In any event, with respect to the objections concerning the collection of water samples and their results, the judgment addresses the matter with proper reasoning. On this point, the judgment states that "…the analysis of the samples collected by the marine biologist (biólogo marino), coast guard officer in that area and witness in this case, [Nombre20].
That witness is clear when describing the manner in which the samples were taken, and in response to each of the defense's challenges regarding the chain of custody of those samples from the time of collection through delivery to the Ministerio de Salud for analysis, as well as the care taken with them, he was able to answer all questions clearly and decisively, without hesitation and without leaving any gap whatsoever as to how the samples were transported, how they were collected, how they were stored, where they were kept, and finally to whom they were delivered for analysis" (folio 277). The same is true of the report submitted by the defense expert, Mr. [Nombre14]. The judgment reasonably dismisses his thesis. In this regard, the judgment states: "That witness declares that he cannot render a judgment on the veracity of those results—understandably so, since he did not himself conduct the tests, we would add here.
But immediately thereafter he contradicts those statements and indicates that there are two methodologies for conducting such tests and describes them, noting that one is the methodology used to perform the analyses and another is the one he would prefer. However, he never moves beyond mere speculation regarding the standards that should or could have been applied in the analysis of the samples. He insists on the need to perform an autopsy on the fish found, in order to have certainty, from his point of view, as to the cause of death of the fish. Nevertheless, this court considers that the circumstantial evidence referred to is more than clear and makes it possible to determine what caused the death of those animals. Even witness [Nombre12] was clear when he stated that the canals smelled of fungicide…" (folio 278).
In light of the foregoing, although no autopsy was performed on the fish, it was possible to establish the existence of the pollution through a joint and harmonious analysis of the various items of circumstantial evidence examined at trial. Therefore, contrary to what is argued in the appeal, the judgment does address the chain of custody and the report of the expert offered by the defense.
Now, with respect to civil liability, the trial judge bases his decision on strict liability. Although the judgment, due to a clerical error, cites Article 1045 of the Código Civil, which does not apply to the case, the fact remains that, pursuant to the Constitución Política and the Ley Orgánica del Ambiente, civil strict liability does indeed apply. Beyond that, the judgment is duly grounded in the creation of risk by the defendant and the production of harm to the environment. It is an undisputed fact that the civil defendant owns a farm located in la Virgen de Golfito, of approximately one thousand hectares, dedicated to rice production. It is likewise undisputed that in November of the year two thousand, approximately five hundred hectares were aerially fumigated with the chemicals Hinosán and Endosulfan. Following the fumigation, heavy rain fell, and subsequently a mass die-off of fish and other animals was discovered at the mouth of the Río Coto.
To the foregoing must be added—as the judge sets out in the judgment—that as a result of the incident, a marine biologist, accompanied by other officials of the Ministerio de Salud, conducted a survey of the area, beginning at the river mouth and proceeding upstream, following the trail of dead animals, until they reached the farm of the defendant Inversiones Sábalo S.A., which is precisely where the incident originated. If, in addition, local residents informed those officials that an aerial fumigation had recently taken place on that farm, it is valid to establish a link between the fumigation and the pollution—a link that may be established even excluding the water sample and its results. As the judge rightly notes: "the local residents indicate that, from a temporal standpoint, the event that explains the water pollution is the fumigation activity on that farm; that the aforementioned farm practically surrounds the referenced canals; that, as [Nombre21] himself admitted, they fumigated during the rainy season and it also rained heavily on the day of the applications, which the witness [Nombre14] repeated through the defense counsel; there being a temporal and geographic proximity, with the use of products toxic to fish…with water samples containing toxic residues found both in those canals and in the rice paddies themselves, it is possible to conclude beyond doubt that the cause of this harm is the agricultural exploitation activity…" (folio 276).
That being so, the judgment is sufficiently and duly grounded with respect to the civil liability of the defendant.
Finally, the appellant's claim that the judge found that the civil defendant's defense had submitted to the plaintiff's claims is without merit. The judge does indeed commit an error by stating that "In fact, with respect to the State's damages claim, the representative of the defendant company made no statement whatsoever, from which it is even possible to conclude that they submit to those claims" (cf. folio 283). Regardless of whether the defendant made or did not make any reference to the civil claim—an assertion contested by the appellant—this cannot be interpreted as a submission to the opposing party's claims, since for that to occur an express manifestation of intent is required. Nonetheless, what is true and relevant is that the judge does proceed to examine the substantive grounds and determines the existence of strict liability—a conclusion that, as has been shown, is shared by this Chamber. In light of the foregoing, the cassation appeal filed by the civil defendant is denied.
POR TANTO:
The appeal filed is dismissed. The clerical errors referred to in this ruling are hereby deemed corrected.

TRIBUNAL DE CASACION PENAL. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSE, GOICOECHEA. A las diez horas once minutos del veinte de mayo del dos mil cuatro.- RECURSO DE CASACION interpuesto en la presente causa seguida contra [Nombre1], mayor, casado, costarricense, Ingeniero Agrónomo, vecino de Palmar Sur de Osa, 75 metros suroeste de la rotonda [Dirección1], nativo de Cartago el nueve de setiembre de mil novecientos cincuenta y siete, hijo de [Nombre2] y [Nombre3], con cédula de identidad número CED1, por el delito de CONTAMINACION DE AGUA, en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, los jueces Omar Vargas Rojas, Fernando Cruz Castro y Ulises Zúñiga Morales. Se apersonaron en Casación, el Lic. [Nombre7] como defensor del imputado y representante de la demandada civil Inversiones Sábalo S.A.; en representación del Estado el Lic. [Nombre8].
RESULTANDO:
1) Que el Tribunal de Juicio de la Zona Sur, Sede Golfito, mediante resolución de las nueve horas del cinco de enero de dos mil tres, resolvió: “POR TANTO: Razones expuestas y artículos 39 y 41 de la Constitución Política, 1, 31 y 45 del Código Penal, 122 y 124 del Código Penal de 1941, 1, 1045 del Código Civil, 1, 4, 5, 6, 141, 142, 266, 269, 270,360,366,368, del Código Procesal Penal se ABSUELVE de toda pena y responsabilidad a [Nombre1] del delito de CONTAMINACION DE AGUA en perjuicio de LOS RECURSOS NATURALES. Sin especial condenatoria en costas en lo penal. A su vez se declara CON LUGAR la ACCION CIVIL RESARCITORIA planteada por el Estado contra Inversiones Sábalo S.A. representada por [Nombre9], fijándose el monto de los daños y perjuicios sufridos en TRES MILLONES DE COLONES, suma que deberá cancelar el demandado vencido a favor del Estado. Son las costas procesales y personales de la acción civil incoada en contra de dicha sociedad, a su cargo. Respecto de la demanda civil incoada por igual accionante contra [Nombre1], se declara SIN LUGAR, en lo que a este toca sin especial condenatoria en cuanto a las costas procesales y personales. [Nombre10] Juez” (sic)
Redacta el Juez de Casación VARGAS ROJAS; y,
CONSIDERANDO:
I.El recurso de casación reúne los requisitos de admisibilidad de los artículos 422, 423, 424, 443, 444, 445 y 447 del Código Procesal Penal, por lo que se entran a conocer los motivos presentados.
II.En el primer motivo de casación por la forma se alega la violación a las reglas de la cadena de custodia de la prueba. Invoca como violados los artículos 19 y 41 de la Constitución Política, 18, 175, 178 inciso a), 182 y 183 del Código Procesal Penal. Aduce que en la sentencia recurrida el juzgador le otorga plena validez y eficacia a las muestras de agua recolectadas y sus correspondientes análisis, a pesar de que en su recolección se violaron las reglas de la Cadena de Custodia. En el presente caso la recolección, preservación, empaque, transporte, entrega y análisis de la prueba no participaron miembros de la policía judicial, sino que fueron funcionarios de INCOPESCA, Ministerio de Salud, MINAE y un laboratorio privado de análisis químicos, quienes no dejaron registros documentales de los procedimientos empleados. En el segundo motivo se reclama la violación a las reglas de la sana crítica, específicamente la lógica, principio de derivación.
Señala como quebrantados los numerales 39 y 41 de la Constitución Política, 142 y 369 del Código Procesal Penal. En la sentencia recurrida, el juzgador tiene por acreditada la responsabilidad de la demandada civil con fundamento en una errónea valoración de la prueba. Con los elementos de prueba recibidos no es posible colegir que los plaguicidas rociados en la plantación fueran los detectados en las muestras de agua. Los expertos fueron claros en señalar que los plaguicidas se disuelven en pocas horas por lo que resulta imposible detectarlo después de un día o día y medio desde su aplicación, máxime cuando existe un factor de dilución como fue el agua producto de las lluvias que ocurrieron el día de la fumigación. Además, en los análisis de agua se detectó el Clorpirifos que es un plaguicida no utilizado por la demandada. Por otro lado, los resultados de los análisis de las muestras presentan incongruencias técnicas importantes.
De donde la contaminación encontrada en el Canal Camote resulta muy superior al verificado en la Laguna Arrozal. Ahora bien, si la sustancia se rocía en un determinado lugar, la mayor concentración se va a dar en el punto superior y no al final, ello debido a que en el trayecto se diluye y tiende a desaparecer. De allí que la concentración debió ser mayor en la laguna del arrozal que en los canales. El juez constató la presencia de los plaguicidas con base en el dicho del testigo [Nombre12], sin embargo, el testigo Santamaría dijo lo contrario, a saber, que “…no percibí olor a agroquímico”. Se reprocha nuevamente la indebida recolección de las muestras. No se documentaron ni los puntos concretos donde se tomaron las muestras, la profundidad a que se hizo, el tipo de instrumento empleado, etc. En el tercer motivo se reprocha falta de fundamentación por omisión de valorar prueba esencial. Acusa como violados los ordinales 39 y 41 de la Constitución Política, 142, 363 y 369 del Código Procesal Penal.
En el debate se incorporó el informe del Dr. [Nombre14], catedrático de Farmacología y Toxicología de la Escuela de Medicina Veterinaria de la Universidad Nacional, así como el oficio PR 14-2002 de la Ingeniera [Nombre15], sin embargo, en la sentencia se omite sus análisis. Con el informe del Dr. Villalobos se demuestra las irregularidades cometidas por las autoridades al momento de recolectar las muestras de agua, así como del procedimiento seguido hasta la emisión del dictamen respectivo. En cuanto al oficio PR-2002, con ello se demuestra que el hinosan estaba autorizado para aplicarse por vía aérea y además que la vida media de degradación es de pocas horas. En el cuarto motivo se aduce falta de fundamentación por fundamentación insuficiente. Se reclama la violación de los artículos 39 y 41 de la Constitución Política, 1º42 y 369 del Código Procesal Penal. El vicio se presenta cuando en la sentencia recurrida el juzgador desacredita el testimonio del Dr. [Nombre14], sin fundamentación alguna.
La única referencia por la cual se resta valor es por haber sido contratado por la defensa. El quinto motivo reprocha falta de fundamentación por fundamentación insuficiente. El vicio consiste en que el juzgador tuvo por acreditada la responsabilidad civil de la empresa demandada, sin atender la necesidad procesal de evacuar prueba fundamental como era la necropsia de los peces muertos. Necesidad que fue admitida por los propios testigos [Nombre12] y Villalobos. Prueba con la cual se hubiera determinado sin duda alguna, la causa de la muerte de los peces. El sexto motivo reclama falta de fundamentación por fundamentación insuficientes respecto a la acción civil. Señala que no se acredita la responsabilidad objetiva ni el nexo causal entre la actividad de la empresa y el daño ambiental discutido. El juez establece la existencia de un actuar culposo por parte de la condenada civil, sin embargo no fundamenta cuál o cuales fueron las acciones culposas que realizara su representada y que generara el daño ambiental.
Se alega falta de fundamentación de la acción civil resarcitoria por inobservancia de las reglas de la sana crítica. Señala que no se acreditó la falta del deber objetivo de cuidado por parte de su representada, así como tampoco se demostró el daño ambiental. El tribunal tiene por demostrado la falta del deber objetivo de cuidado en la aplicación de las sustancias de fumigación y establece un nexo causal entre esta fumigación y el supuesto daño ambiental. Tal derivación la realiza a partir de la prueba testimonial. Sin embargo en cuanto al biólogo [Nombre12], este saca sus conclusiones a partir de lo dicho por los vecinos, es decir, de terceras personas que no acudieron al debate. En todo caso de la declaración de los testigos no se deriva que “luego de la fumigación sobre los arrozales, posteriormente cayera lluvia al lugar y transportara los componentes químicos que fueron llevados por los canales hasta producir el supuesto daño ambiental señalado”.
El octavo motivo continúa reprochando falta de fundamentación de la acción civil resarcitoria. El juez condena civilmente aduciendo la existencia de una falta al deber de cuidado en la aplicación de las sustancias químicas sobre el arrozal que generó un supuesto daño ambiental. Nunca se fundamenta esa conclusión. Se produjo una clara violación a la cadena de custodia, las que quedaron al descubierto con el informe pericial del Dr. Villalobos. Además, el oficio Pr-2002 demostró que el Hinosan se diluye en agua a las pocas horas, siendo que las muestran se tomaron siete días después de la aplicación y además no se realizó la necropsia a los peces o fauna encontrada con lo cual no se pudo determinar la causa de la muerte. SIN LUGAR EL RECURSO. Aunque el recurso se plantea a través de nueve motivos, todos ellos versan sobre aspectos de fundamentación, razón por la cual se resuelven de manera conjunta.
De acuerdo con el considerando primero de la sentencia impugnada, se tuvo por acreditado que el encartado [Nombre1], en su condición de agrónomo trabajaba para la empresa Inversiones Sábalo S.A. y era el encargado de la asesoría técnica para la aplicación de químicos en la plantación de arroz ubicada en La Virgen de Golfito. Los días 13, 14 y 16 de noviembre de dos mil, el encartado confeccionó las recetas para la aplicación de productos agroquímicos escogiendo, entre otros productos el Endosulfán que es tóxico para los peces y únicamente se puede aplicar por vía terrestre y el Hinosofán que también es tóxico para los peces. Posterior al 14 de noviembre y siempre dentro del mismo mes, se realizó la fumigación aérea aplicando Hinosofán y Endosulfán, siendo que dichos químicos llegaron hasta las aguas de los ríos Coto y Sábalo, las que contaminaron y ocasionaron la muerte de gran cantidad de fauna nativa.
El tribunal de juicio absuelve al encartado en aplicación del principio in dubio pro reo, pero condena a la demandada civil en aplicación de la responsabilidad objetiva y con fundamento en el artículo 1045 del Código Civil. De manera que lo único que se discute en el presente recurso son los aspectos civiles y no los penales. Lo anterior hace que resulte cuestionable la discusión y aplicación de los requisitos de la “Cadena de Custodia”, que es un instituto netamente penal para determinar la legitimidad de la prueba a un tema estrictamente civil, donde operan otros principios y fundamentos. En efecto, como todos sabemos, la responsabilidad civil surge de dos grandes vertientes. Por un lado la responsabilidad contractual, que no es del caso analizar, y por otro la responsabilidad extracontractual. Esta última se compone de la responsabilidad subjetiva y la objetiva. La responsabilidad subjetiva es aquella que surge como consecuencia de un comportamiento doloso o culposo en virtud del cual se produce un daño.
Precisamente esta responsabilidad se encuentra expresamente contemplada en el artículo 1045 del Código Civil, el cual señala “Todo aquel que por dolo, falta, negligencias o imprudencia causa a otro un daño, está obligado a repararlo junto con los perjuicios”. De donde se colige que resulta indispensable demostrar tanto la existencia del daño como la relación de causalidad entre ese daño y la conducta dolosa o culposa. Lo anteriormente expuesto, nos permite establecer que el juzgador un error material al sustentar la responsabilidad objetiva en el citado artículo 1045 del Código Civil, cuando precisamente esa norma se refiere a la subjetiva, yerro que, conforme a lo dispuesto por los artículos 146 y 433 del Código Procesal Penal debe ser corregido en la forma que se dirá seguidamente. En el presente caso surge la responsabilidad objetiva, cuyo punto de partida no es la acción del sujeto sino más bien el desarrollo de actividades industriales, comerciales, agrícolas que aunque lícitas, son causas generadoras de riesgo y fuente potencial de daños.
Su fundamento no es subjetivo, sino más bien objetivo en la medida que el interés central no es sancionar o castigar, sino reparar. Progresivamente, el nuevo derecho de daños, con criterios solidaristas, se orienta hacia la objetivación de la responsabilidad y toma en cuenta otros criterios basados en valoraciones económicas, sociales, etc, que impone que el daño sufrido no sea asumido exclusivamente por la víctima y pueda ser trasladado económicamente a un tercero. La idea se centra no ya en sancionar o castigar al autor de la conducta antijurídica, sino en la necesidad de que el daño sea reparado. (Cfr: [Nombre17]. Teoría General de la Reparación de daños. Editorial Astrea, Buenos Aires, 1997, p 143 y 144.) Según dispone el artículo 41 de la Constitución Política de Costa Rica, “Ocurriendo a las leyes, todos han de encontrar reparación para las injurias o daños que hayan recibido en su persona, propiedad o intereses morales…” De acuerdo con dicha normativa, el fundamento de la reparación no estriba en la culpa o el dolo, sino más bien en la producción de un daño.
Norma que se complementa con los artículos 46 y 50 de la misma Constitución. Al respecto el ordinal 46, párrafo final dispone que “…los consumidores y usuarios tienen derecho a la protección de su salud, ambiente, seguridad e intereses económicos; a recibir información adecuada y veraz; a la libertad de elección y a un trato equitativo…”, mientras que el 50 establece: “El Estado procurará el mayor bienestar a todos los habitantes del país organizando y estimulando la producción y el más adecuado reparto de la riqueza. Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes” (El subrayado es nuestro). Por su parte, la Ley Orgánica del Ambiente, desarrollando el postulado constitucional, en su artículo 2 inciso d) dispone un principio general a cuyo tenor: “Quien contamine el ambiente o le ocasiones un daño será responsable, conforme lo establezcan las leyes de la República y las Convenciones internacionales vigentes.” Mientras tanto el numeral 59 del mismo cuerpo normativo define la contaminación del ambiente como “toda alteración o modificación del ambiente que pueda perjudicar a la salud humana, atentar contra los recursos naturales o afectar el ambiente en general de la Nación.
La descarga y la emisión de contaminantes, se ajustará, obligatoriamente a las regulaciones técnicas que se emitan. El Estado adoptará las medidas que sean necesarias para prevenir o corregir la contaminación ambiental.” Respecto al vertido de material contaminante, que es precisamente lo que estamos discutiendo, artículo 66 de la ley en comentario establece que “ …la responsabilidad de tratamiento de vertidos corresponderá a quien produzca la contaminación…”. Finalmente, el 101 de la Ley Orgánica del Ambiente dispone que “Sin perjuicio de las responsabilidades de otra naturaleza que les puedan resultar como partícipes en cualquiera de sus formas, los causantes de las infracciones a la presente ley o las que regulan la protección del ambiente y la diversidad biológica, sean personas físicas o jurídicas, serán civil y solidariamente responsables por los daños y perjuicios causados…” De la normativa citada se desprende claramente que nuestro legislador ha receptado y materializado el principio tradicional en materia ambiental, conforme al cual “el que contamina paga” con independencia de la existencia de un vínculo subjetivo.
Estamos frente aun cambio de paradigma, ya que no siempre la responsabilidad se encuentra fundada únicamente en la teoría de la culpa, sino que el aumento de causas de dañosidad producidas por el desarrollo industrial, comercial y agrícola exponen al ser humano a mayores riesgos. En relación con esta temática y analizando el párrafo quinto del Código Civil, [Nombre18] señala que " en nuestra jurisprudencia… se ha aclarado que los párrafos 4 y 5 del artículo 1048 del Código Civil no se basan en la responsabilidad por culpa directa o indirecta, sino en la responsabilidad objetiva- es decir sin culpa-, que recae sobre los empresarios de establecimientos peligrosos y los que se dedican a la explotación de los medios de transporte; estos dos reglas son reflejo de la teoría del riesgo. En realidad, con esto, la ley ha tomado en cuenta dos cosas: de un lado, excitar el cuidado de los dueños y empresarios de actividades peligrosas, en el sentido de impedir accidentes y, de otro lado, garantizar mejor el pago de la respectiva indemnización, poniéndolo directamente a cargo de los individuos solventes.
Como puede observarse, a diferencia de los casos de "responsabilidad por culpa", la responsabilidad objetiva reside en el hecho de que aquél para su propio provecho crea una fuente de probables daños y expone a las personas y los bienes ajenos a peligros y queda obligado si el daño se verifica…" (Pérez Vargas Víctor. Derecho Privado. San José, Publitex, 1998, p. 416). Desde la óptica práctica, la responsabilidad objetiva se resume en una ventaja a favor del lesionado que significa una inversión de la carga de la prueba, en el sentido de que éste queda exonerado de la carga de probar la culpa o dolo del causante del daño y tampoco requiere probar su falta de culpa, a diferencia de los casos de responsabilidad subjetiva. El fundamento de este tipo de responsabilidad es el reconocimiento social de que ciertas actividades, aún siendo lícitas (por lo que no es requisito el ser antijurídicas) y necesarias dentro del desarrollo social y tecnológico actual, que no puede ni debe ser obstruido, pero que, concomitantemente generan un riesgo -como entidades productoras de eventuales daños- el cual desde luego no debe ser asumido por la víctima o sus allegados, sino más bien por aquel que se beneficia de la actividad riesgosa o de la tenencia de una fuente productora de peligro.
Esas empresas, generadoras de peligro para la comunidad y de beneficio para su dueño, constituyen un medio a través del cual se produce el daño a la víctima. De manera que como causante del perjuicio, se encuentran obligados a repararlo. (Sobre la responsabilidad civil objetiva, crf: Voto 085-F-99 del 10 de marzo de 1999, Tribunal Superior de Casación Penal. Voto No: 1262-97 de las 11:30 horas del 14 de noviembre de 1997. Sala Tercera de la Corte Suprema de Justicia. Voto No: 525-F- 2001 del 31 de mayo del 2001, Sala Tercera de la Corte Suprema de Justicia. Igualmente Sala Segunda Civil de la Corte Suprema de Justicia, No: 304 de las 15:10 horas del 4 de octubre de 1973 y 481 de las 10:05 horas de 20 de julio de 1992, del Tribunal Superior Segundo Civil, Sección Segunda). Así las cosas, el argumento central del recurrente en cuanto a que se violó la cadena de custodia en relación con la recolección de muestras no resulta atendible.
Tales principios son válidos para establecer la responsabilidad penal, no así para la responsabilidad civil donde aplican otros criterios. Debemos recordar que las muestras de agua no fueron tomadas por miembros del Organismo de Investigación Judicial, ni por oficiales de dicha dependencia. Fueron más bien los miembros de la estación de Guarda costas de Golfito y personeros del Ministerio de Salud quienes se encargaron de dichas diligencias. En todo caso, en relación a los reparos sobre la recolección de agua y sus resultados, la sentencia se pronuncia de manera motivada. Sobre el particular expresa que “…el análisis de las muestras recolectadas por el biólogo marino, policía de guardacostas de la zona y testigo en esta causa, [Nombre20]. Tal deponente es claro cuando refiere la forma como se tomaron las muestras y ante cada uno de los cuestionamientos de la defensa acerca de la cadena de custodia de dichas muestras hasta llevarlas al Ministerio de salud para su análisis y el cuidado que se tuvo con ellas, pudo sin cavilación dar respuesta a todas las inquietudes, de forma clara y contundente, sin dejar laguna de tipo alguno acerca de cómo se llevaron las muestras, cómo se recolectaron, cómo se guardaron, dónde se mantuvieron y finalmente a quien se le hizo llegar hasta su análisis” (folio 277).
Igual ocurre con el informe rendido por el experto de la defensa, señor [Nombre14]. La sentencia de manera razonable descarta su tesis. Al respecto se indica “Declara dicho deponente que él no puede emitir un juicio acerca de la veracidad de tales resultados, eso es así porque él no aplicó las pruebas, agregaríamos acá. Pero acto seguido entra en contradicción con tales afirmaciones e indica que existen dos metodologías para hacerlo y las describe, refiere que una es con la que se realizaron los análisis y otra es la que él preferiría. Sin embargo nunca pasa de meras especulaciones respecto a los estándares que debieron o pudieron aplicarse en el análisis de las muestras. Se insiste en la necesidad de realizar una necropsia de los peces hallados, para tener certeza desde su punto de vista acerca de la causa de muerte de los peces. No obstante, considera este tribunal que los indicios referidos son más que claros y permite determinar cuál ha sido la causa de la muerte de dichos animales.
Incluso el testigo [Nombre12] fue claro cuando indicó que olía a fungicida en los canales…”(folio 278). De acuerdo con lo anterior, a pesar de que no se contó con una necropsia de los peces, fue posible establecer la existencia de la contaminación a través del análisis conjunto y armoniosos de los distintos indicios que se evacuaron en el debate. De allí que contrario a lo sostenido en el recurso, el fallo si se refiere a la cadena de custodia y al informe del experto ofrecido por la defensa. Ahora bien, en cuanto a la responsabilidad civil, el juzgador sustenta su decisión en la responsabilidad objetiva. Aunque la sentencia por un error material cita el artículo 1045 del Código Civil, el que no resulta aplicable al caso, lo cierto es que conforme a la Constitución Política y la Ley Orgánica del Ambiente, efectivamente opera una responsabilidad civil objetiva. Aparte de lo anterior, la sentencia se encuentra debidamente fundamentada en cuanto a la creación del riesgo por parte de la demandada y la producción de un daño en el ambiente.
Es un hecho no controvertido, que la demandada civil es propietaria de una finca ubicada en la Virgen de Golfito, de aproximadamente mil hectáreas y dedicada a la producción de arroz. Tampoco está en discusión que en el mes de noviembre de dos mil, se procedió a fumigar, vía aérea, aproximadamente quinientas hectáreas con los químicos Hinosán y Endosulfan. Luego de la fumigación cae una fuerte lluvia y posteriormente aparece una mortandad de peces y otros animales que se encontraban en la desembocadura del Río Coto. A lo anterior hay que agregar, conforme lo sustenta el juez en la sentencia, que a raíz del suceso, un biólogo marino en compañía de otras autoridades del Ministerio de Salud realizan un recorrido por la zona, empezando por la desembocadura del río y avanzando río arriba, siguiendo el rastro de animales muertos, llegan hasta la finca de la demandada Inversiones Sábalo S.A. donde precisamente se origina el siniestro.
Si además los vecinos informan a esos personeros que recientemente había ocurrido una fumigación área en dicha finca, es válido establecer la vinculación entre la fumigación y la contaminación. Vinculación que puede efectuarse aún suprimiendo la muestra de agua y sus resultados. Como bien lo señala el juzgador “los vecinos refieren que desde el punto de vista temporal el suceso que explica la contaminación del agua es la actividad de la fumigación en dicha finca; que la mencionada finca prácticamente rodea a los canales citados; que como admitió el propio [Nombre21] fumigaron en época de lluvia y el día que hicieron las aplicaciones también llovió bastante, lo que por boca del defensor repite el testigo [Nombre14]; existiendo una cercanía temporal, geográfica, utilizando productos tóxicos para los peces…encontrándose muestras de agua con residuos tóxicos, tanto en dichos canales, como en el propio arrozal, es posible concluir sin lugar a duda que la causa de es daño es la actividad de explotación agrícola…”(folio 276).
Así las cosas, la sentencia se encuentra debidamente suficientemente motivada en cuanto a la responsabilidad civil de la demandada. Finalmente, el reclamo del recurrente en cuanto a que el juez consideró que la defensa de la demandada civil se allanó a las pretensiones de la actora, carece de interés. Ciertamente el juzgador comete un error al indicar que “De hecho en cuanto a la pretensión resarcitoria estatal el representante de la sociedad demandada no hizo manifestación alguna por lo que incluso es dable concluir que se allana a las mismas” (cfr. Folio 283). Independientemente de que el demandado hiciera o no referencia a la acción civil (afirmación que combate el impugnante), ello no puede interpretarse como un allanamiento a las pretensiones de la parte contraria, pues para que ello suceda debe ocurrir una expresa manifestación de voluntad. Sin embargo, lo cierto y relevante es que el juez entra a conocer las razones de fondo y determina la existencia de una responsabilidad objetiva. Conclusión que como se ha visto, es compartida por esta Cámara. En atención a lo expuesto, se declara sin lugar el recurso de casación formulado por la demandada civil.
POR TANTO:
Se declara sin lugar el recurso interpuesto. Ténganse por corregidos los errores materiales a que se refiere el presente fallo.
