THE STATE No. 2025005724 ADMINISTRATIVE AND CIVIL COURT OF THE TREASURY, SECOND JUDICIAL CIRCUIT, SAN JOSÉ, GOICOECHEA, at eleven hours and eighteen minutes on June eleventh, two thousand twenty-five.- The Court considers the application for preliminary relief filed by the MUNICIPALITY OF CARTAGO against the STATE, with the company WPP CONTINENTAL LOS PINOS SOCIEDAD ANÓNIMA, corporate identification number 3-101-526134, participating as an interested third party.
WHEREAS
a-) In its filing submitted on April 28, 2025, the petitioner requests preliminary relief in the following terms: “(...) Based on the factual and legal grounds set forth above, I respectfully request that Your Honor order, as a pre-action preliminary measure, the suspension of the effects of Health Order No. CARTA-MS-DRRSCE-DARSC-OS-0020-2025, issued by the Ministry of Health, Central East Regional Directorate – Cartago Health Governing Area, until the plenary proceeding to be filed for the purpose of seeking its annulment is finally resolved” (see image 15 of the preliminary-relief case file). b-) By orders issued at seventeen hours and twenty-seven minutes on May ninth, two thousand twenty-five, the defendant, THE STATE, and the company WPP CONTINENTAL LOS PINOS S.A., as an interested third party, were granted THREE BUSINESS DAYS to respond in writing and submit any evidence they deemed relevant (see images 25 to 26 of the preliminary-relief case file). c-) The representative of THE STATE, as defendant, responded to the hearing granted regarding the preliminary relief in the brief appearing at images 257 to 287, stating, in summary, that the request for preliminary protection should be denied because, in its view, it fails to satisfy all the requirements for granting the requested preliminary measure.
As evidence, it offered the 11 items detailed in the corresponding section of its filing, which are described in the relevant whereas clause of this decision (see images 257 to 286 of the preliminary-relief case file). d-) After being notified to respond to the application for preliminary relief as an interested third party in this matter, WPP CONTINENTAL LOS PINOS S.A. entered an appearance through briefs dated June 3 and 4, 2025, opposing the application, requesting that the municipality’s application for preliminary relief be denied, and offering evidence in support of its position (see images 289 to 347 of the preliminary-relief case file).
In this matter, the petitioner requests a preliminary measure for the following purpose: (...) Based on the factual and legal grounds set forth above, I respectfully request that Your Honor order, as a pre-action preliminary measure, the suspension of the effects of Health Order No. CARTA-MS-DRRSCE-DARSC-OS-0020-2025, issued by the Ministry of Health, Central East Regional Directorate – Cartago Health Governing Area, until the plenary proceeding to be filed for the purpose of seeking its annulment is finally resolved” (see image 15 of the preliminary-relief case file). In summary, this is an application for preliminary relief of a suspensive and affirmative nature seeking, on the one hand, the suspension of the effects of Health Order CARTA-MS-DRRSCE-DARSC-OS-0020-2025, issued by the Ministry of Health, Central East Regional Directorate – Cartago Health Governing Area (hereinafter, the challenged “Health Order”), until the proceeding seeking its annulment is resolved; and, on the other hand, the application maintains and proceeds from the premise that technical and legal responsibility for the sanitary landfill rests with the developer, WPP Continental de Costa Rica S.A., which, it states, holds the project’s environmental approval. Everything stated in the application for preliminary relief at issue is based upon that premise, and the Court is requested to so declare and proceed accordingly for purposes of the present case.
In general terms, the claimant states the following regarding the requirements for interim relief (tutela cautelar): With respect to the so-called “prima facie case (apariencia de buen derecho)” or “Fumus boni iuris,” it states, in summary, that the challenged health order (orden sanitaria) CARTA-MS-DRRSCE-DARSC-OS-0020-2025, the effects of which the application seeks to suspend, was served on 13 de febrero de 2025, and an interim measure (medida cautelar), as well as a motion for reconsideration with a subsidiary appeal (revocatoria con apelación en subsidio), was filed against it through official letters N° AM-OF-139-2025 and AM-OF-141-2025. The claimant also states that the motion for reconsideration and the appeal were denied through resolutions N° MS-DRRSCE-0170-2024 and N° MS-DM-CP-1732-2025, the latter communicated on 01 de abril de 2025. It further states that the actions required by the aforementioned health order relate to the solid-waste disposal maintenance process at the Los Pinos sanitary landfill, located in Dulce Nombre de Cartago, 2,3 kilometers from Campo Ayala, operated by WPP Continental de Costa Rica S.A.; specifically, the project called “Technical closure of the Navarro dump and construction of the Los Pinos Sanitary Landfill” is being carried out on the land covered by plans C-409236-1980 and C-572610-1985, according to resolution N° 0618-2025-SETENA.
The claimant further states that the health order is affected by grounds for absolute nullity (nulidad absoluta) as regards its statement of reasons, because an analysis of Technical Report n.° CARTA -MS-DRRSCE-URS-IT-0016-2025 does not reveal any failure by the Municipalidad de Cartago to comply with the obligations relating to the management and operation of the Relleno Sanitario Los Pinos, given that the report shows that responsibility for managing that landfill rests exclusively with WPP Continental Los Pinos S.A., which is responsible for its operation and maintenance (see image 06 of the interim-measure case file). The claimant states that, even though the aforementioned private company is responsible for operating and maintaining the landfill, the health order arbitrarily imposes on the claimant the obligations identified in image 06 of the interim-measure case file. In addition, it states that the order is unlawful not only because it lacks technical justification, but also because the Secretaría Técnica Nacional Ambiental (SETENA), through official letter N° SETENA-AJ-0265-2020, made clear that responsibility for complying with the environmental commitments arising from the project rests with the developer, which is the party legally entitled to request modification of the project and acquired the rights and duties concerning the area, not with a third party, even if that party is the registered owner.
In support of its position, the claimant likewise cites resolution N° 0618-2025-SETENA. Accordingly, the claimant maintains that the challenged health order contains substantial defects affecting its validity and enforceability (absence of a statement of reasons), and concludes as follows regarding the first requirement for interim relief: “(...) In this specific case, the prima facie case supporting the requested suspension, as an interim measure, of the effects of health order n.° CARTA-MS-DRRSCE-DARSC-OS-0020-2025 is based on the Municipalidad’s lack of substantive authority to act, because the project’s environmental approval (viabilidad ambiental) was not granted to it but, on the contrary, belongs to the developer, WPP Continental Los Pinos S.A.; it is also based on the absence of a statement of reasons, because the health order was issued on the basis of a technical report that assigns no responsibility whatsoever to this Municipalidad.” (see image 08 of the interim-measure case file, emphasis added).
With regard to the risk arising from delay (peligro en la demora), after providing a general discussion of that requirement for interim relief, the claimant Municipalidad states the following: “(...) In this case, the health order at issue requires the Municipalidad de Cartago to assume responsibilities and make significant investments of public funds in work that, in addition to lacking technical support, clearly does not fall within its responsibilities, because those obligations belong to WPP Continental Los Pinos S.A.” (see image 09 of the interim-measure case file). The claimant Municipalidad then proceeds with what it calls an individualized assessment of the impact of the order whose suspension it requests, from the operational, financial, budgetary, rate-setting, and human-resources management perspectives. In summary, regarding the operational impact (section 2.1 of its application), the Municipalidad alleges that, according to official letter AOM-OF-105-2025 signed by the head of the municipal Operations Area, it lacks the technical, human, and financial resources necessary to comply with the health order because the matters specified therein have never been the Municipalidad’s responsibility and concern functions assigned to the operator under the environmental approval.
Compliance would therefore entail a significant investment that has not yet been quantified; moreover, with respect to the leachate-treatment plant, it receives leachate deposited on private property (belonging to the aforementioned WPP company), and thus compliance would entail allocating public resources to address a privately caused problem. In that section, the Municipalidad identifies some of the details of the work required under the health order whose suspension is sought, as well as the potential contracts that such work would entail, because it maintains that it lacks the personnel and equipment needed to perform it. Finally, it states that an initial investment of no less than one hundred and fifty million colones is estimated solely for studies and designs, without including implementation or long-term maintenance. Regarding the budgetary impact (section 2.2.), it states, in summary, that according to official letter PL-OF-040-2025, allowing the health order to remain in effect would be particularly serious because it would require committing resources allocated for a specific purpose in the municipal budget for the 2025 period (budget item 1.04.06), which are intended to cover payment for solid-waste treatment and final-disposal services.
Thus, the health order requires the Municipalidad to assume new tasks not included in the Annual Work Plan, which it characterizes as an improper reallocation of public funds that would be diverted from their original purpose and would be insufficient to cover the costs associated with carrying out those actions. In summary, it states the following in this regard: “(...) the risk arising from delay materializes in the possibility that, while the full adjudicatory proceedings seeking annulment of the health order are pending, the Municipalidad may be required to make significant investments without any budgetary allocation, thereby affecting the institution’s financial balance and devoting public funds to functions that are the responsibility of a private party” (see image 12 of the interim-measure case file). Regarding the impact on the management of institutional human resources (section 2.3), the Municipalidad alleges, in summary, that according to official letter RH-OF-356-2025 from the Human Resources Department, the current Position Manual contains no job profile encompassing the functions detailed in the health order.
It would therefore be necessary to create new positions, following the required steps for that purpose, including a financial analysis to assess the impact of potentially creating the positions. If that analysis establishes financial feasibility, budgetary authorization would then have to be obtained and the institutional Position Manual amended, and only then could a personnel recruitment and selection process begin. It therefore states that this demonstrates a “serious” institutional risk, because the Municipalidad is required to perform immediately functions for which it lacks the necessary structure and human resources. Lastly, regarding the rate impact, the Municipalidad states that, according to official letter AAF-OF-102-2025 from the municipal Administrative and Financial Area, if the order remained in effect, the Municipalidad would be required to incur expenses exceeding one billion two hundred ninety-four million colones over a period of 15 years, with an initial cost of four hundred fourteen million colones in the first year alone.
It states that this cost would have to be passed on to users through a rate increase of 78,12%, in addition to a previous increase already approved in December 2024. In addition, on this point, it also maintains that a sustained increase of 17.43% is projected over the following fourteen years, which it states would disproportionately affect a vulnerable population because, according to IMAS data, more than 67% of the inhabitants of the canton are socially vulnerable. It characterizes this as irreversible harm to the rate structure and social balance of the public service, affecting the ability of Cartago families to pay. With respect to the third requirement for interim relief, the balancing of the interests at stake (ponderación de intereses en juego) is addressed by the claimant Municipalidad in section 3 of its application. It states, in summary, that according to the aforementioned official letter AAF-OF-102-2025, a technical report is presented concerning the economic impact of those actions, based on the technical memorandum submitted by WPP Continental de Costa Rica S.A., in which the annual costs of the work are estimated.
The Municipalidad states that, if it were to assume the actions detailed in the health order, those costs would have to be passed on to taxpayers through rate adjustments, according to the municipal financial analysis, which would entail the aforementioned rate increase. It considers this disproportionate for the population and states that it would affect their ability to pay for and access essential public services. This must also be viewed in the context of the socioeconomic conditions of the cantón de Cartago, where, according to IMAS data, up to 67% of the population lives in poverty or is socially vulnerable. Accordingly, the claimant essentially states that the projected rate increase would directly raise the cost of living, aggravating the socioeconomic circumstances of the population of Cartago. Finally, with respect to the balancing of interests, the claimant emphasizes that the interim suspension of the health order would not harm the public interest, because no noncompliance by the Municipalidad has been established.
On the contrary, it maintains that technical and legal responsibility for the sanitary landfill rests with the developer, WPP Continental de Costa Rica S.A., which holds the project’s environmental approval. Accordingly, the Municipalidad argues the following regarding the balancing of interests in this case: “(...) In this regard, allowing the health order to remain in effect while the merits of the adjudicatory proceedings are resolved would seriously and concretely affect the Municipalidad’s budgetary balance, as well as the economic well-being of tens of thousands of residents. // In addition, the balancing of interests must take into account the provisional and ancillary nature of the interim measure; this measure does not have final effect but seeks to prevent irreparable harm from materializing while the adjudicatory proceedings to be brought to seek annulment of the health order are resolved.
// In sum, upon weighing the interests at stake, staying the effects of the health order (orden sanitaria) proves to be a reasonable and proportionate measure that not only protects the public resources of the Municipalidad de Cartago, but also ensures that the public interests are respected, without causing irreparable harm to any of the parties involved” (see image 16 of the interim-relief file (legajo de medida cautelar)). The Municipalidad offers the following items as evidence, which are available in the corresponding section in images 16 through 18 of the interim-relief file and were submitted on CD:
In summary, both the STATE, as the respondent, and the interested third party WPP CONTINENTAL LOS PINOS S.A. have requested that the application for interim relief (gestión cautelar) be denied, each providing its own reasons. IV. A) POSITION OF THE RESPONDENT STATE: In summary, the STATE (Ministry of Health), as the respondent, addresses the requested interim measure (medida cautelar) and seeks its denial because the essential requirements for granting a measure of this nature are not met in this case. In its arguments, counsel for the respondent State first recounts the subject matter of the request, as well as the provisions of the health order (orden sanitaria) whose suspension is sought, stating that “(...) the Local Government files this application for interim relief on the grounds that what was ordered in the interim proceedings is improper, since everything related to the management, maintenance, and disposal of solid waste at the Los Pinos sanitary landfill is the responsibility of WPP CONTINENTAL LOS PINOS S.A., as that company holds the respective environmental clearance (viabilidad ambiental) granted by SETENA for the project ‘Technical Closure of the Navarro Dump and Construction of the Los Pinos Sanitary Landfill’ and has a contract with the Local Government” (see page 3 of the State’s response, image 259 of the interim-relief case file).
In addition, counsel for the State sets forth its position regarding the municipality’s arguments concerning the operational, financial, budgetary, rate-related, and human-resource-management impacts whose repercussions are alleged by the claimant, and informs the Court that the issue of determining who is responsible for the management, oversight, and development of the Los Pinos landfill is already under dispute in judicial proceeding 23-006078-1027-CA, in which WPP CONTINENTAL LOS PINOS S.A. appears as the plaintiff and the defendants include, among others, THE STATE and the MUNICIPALIDAD DE CARTAGO. It also indicates that the matter was the subject of an amparo proceeding (recurso de amparo) filed in 2019 and decided in 2020 (voto N° 2020002374 de las 09:30 horas del 07 de febrero de 2020), which involved the Local Government.
Accordingly, counsel for the State proceeds to recount what it calls the relevant background to this matter and the legal framework governing the final disposal of waste or residues on pages 4 to 12 of its response, before addressing the requirements for the requested interim measure. Regarding that background, counsel for the State ultimately states as follows: “(...) it is necessary to point out to the Court that the technical report (MSDRRSCE- URS-IT-0016-2025 de fecha 21 de enero de 2025) on which the health order sought to be annulled is based was issued as a result of the directive given by the Constitutional Chamber through resolution N.°2020002374 (which is attached), requesting coordination of the administrative procedures required in response to problems and violations affecting public health and the environment arising from the Los Pinos Sanitary Landfill, which operates on real property owned by WPP and the Municipalidad de Cartago, land located in the province of Cartago and therefore within the territorial jurisdiction of that Local Government.
It is evident that a series of activities were carried out on municipal land that lacks environmental clearance and that part of the municipal land does have such clearance; however, that clearance concerns the treatment plant and the works required for its proper operation. // These observations are of paramount importance to the determination of the merits of this response to the application for interim relief, particularly with regard to the obligations incumbent upon the Municipalidad de Cartago under the Political Constitution, the Comprehensive Waste Management Act and its Regulations, among others, especially considering that the actions sought and ordered through the health order are to be performed within property owned by the municipality” (see image 265 of the interim-relief case file, emphasis added).
Following the foregoing, in the section entitled “Regarding the application for an interim measure,” counsel for the State addresses the specific requirements for interim protection (tutela cautelar) and argues, in summary, that the application lacks instrumentality (instrumentalidad) and provisionality (provisionalidad), which are structural requirements for interim protection, and seeks to anticipate a potential ruling on the merits granting its claims concerning the nullity of the act before the matter has been litigated, thereby constituting an autonomous claim intended to stand on its own and which must therefore be summarily denied.
Notwithstanding the foregoing, with respect to the so-called likelihood of success on the merits (apariencia de buen derecho), counsel for the State argues, in summary, that it is weakened because, without addressing the merits—which is not appropriate in these interim proceedings—Article 7 of the “Comprehensive Waste Management Act” (“Ley para la Gestión Integral de Residuos”) (Ley N.°8838) defines the authority held by the Ministry of Health in this area, describing it as the authority responsible for establishing policies, regulations, and mechanisms to ensure the proper and environmentally sustainable management of solid waste, consistent with its institutional mission. It also states that the Ministry of Health is the governing authority for monitoring, assessment, and oversight in the field of comprehensive waste management, and that Article 8 of the Regulations on Ordinary Solid Waste Management (N° 36093-S) defines the functions of municipalities and makes them responsible for the comprehensive management of waste generated within their canton.
It further argues as follows in this regard: “(...) Specifically, Articles 36 and 37 of that Act, in conjunction with the ‘General Regulations for sanitary operating permits, licensing permits, and authorization for temporary mass-gathering events’ (‘Reglamento general para permisos sanitarios de funcionamiento, permisos de habilitación y autorización para eventos temporales de concentración masiva de personas’) (Decreto Ejecutivo N.°43432) and the ‘Regulations on environmental parks for the separation, treatment, recovery, and final disposal of solid waste’ (‘Reglamento de parques ambientales para la separación, tratamiento, aprovechamiento y disposición final de residuos sólidos’) (Decreto Ejecutivo N.° 44421, artículos 6, 7 y 8), require every natural or legal person engaged in this type of activity to hold a sanitary operating permit (Permiso Sanitario de Funcionamiento) issued by that Ministry. // Once the permit has been issued, officials of the Health Governing Areas must inspect the activities conducted and the operating condition of the environmental park so that any irregularity or situation requiring correction is remedied as promptly as possible to protect human health and life, as well as the environment.
(Decreto Ejecutivo N.°43432, artículos 20-21 y Decreto Ejecutivo N.° 44421, artículo 31 y 33) // The Ministry of Health’s Directorate of Radiological Protection and Environmental Health (Dirección de Protección Radiológica y Salud Ambiental, DPRSA), for its part, is responsible for conducting studies in solid-waste disposal areas, including: a) topographical verification of the area, b) slope-stability studies, including displacement monitoring, c) analysis of the calculation report, d) piezometric analysis studies of groundwater, e) technical verification of remaining useful life, f) the level of progress on closure works, and g) compliance with closure works. (Decreto Ejecutivo N.° 44421, artículo 32) The results of these studies shall be reported to the National Environmental Technical Secretariat, municipalities, the Central Government’s Multilevel Waste Commission, and any other institution connected with the operation of environmental parks existing nationwide. // For this purpose, it shall request periodic information concerning the useful life of final waste-disposal sites in order to establish public policies on comprehensive waste management, pursuant to Article 5 of the ‘General Health Act’ (‘Ley General de Salud’) (Ley N.° 5395), which provides: // ‘Every natural or legal person is required to provide, accurately and in a timely manner, any data requested by the competent health official for the preparation, analysis, and dissemination of vital and health statistics and other special administrative studies, for the assessment of health resources and any other special studies required to ensure timely awareness of health problems and to formulate appropriate remedial measures’” (see images 271 to 272 of the interim-relief case file).
Based on the foregoing, counsel for the State takes the position that health order n.° CARTA-MS-DRRSCE-DARSCOS- 0020-2025 falls within the Ministry of Health’s obligations and duties regarding this matter and has adequate technical support arising from document MS-DRRSCE-URS-IT-0016- 2025 de fecha 21 de enero de 2025, entitled “Subject: Interinstitutional inspection visit to the Los Pinos Sanitary Landfill for the month of January 2025.” It states that it is vitally important to consider that the visit established that the treatment plant, located on municipal land, is not operating and that this situation has resulted in uncontrolled pollution of a natural body of water (Río Agua Caliente), which is receiving water containing high levels of organic and inorganic matter, suspended solids, and dissolved heavy metals, among other substances characteristic of leachate (lixiviados) generated by sanitary landfills, as well as foul odors. It also states that no stormwater channeling or inspection chambers can be seen on the land belonging to the Municipalidad de Cartago and, worse still, an area with waste exposed in the open air is evident.
In this regard, counsel for the State states: “While it is true that the recommendations in that report are directed at WPP CONTINENTAL LOS PINOS S.A., we cannot disregard the fact that the deficiencies identified and cited in the technical document on which the health order is based are located on municipally owned land, and are therefore also the responsibility of the Local Government” (see image 274 of the interim-relief case file).
Along the same lines, the Office of the Attorney General states, with respect to ley N° 8839, that waste generators, including property owners, are responsible for the proper management of the waste they generate, in application of the shared-responsibility principle (principio de responsabilidad compartida), and that the Local Government has inherent obligations because this involves environmental protection and public health—obligations from which the municipality cannot entirely distance or disassociate itself with respect to land it owns (artículos 5 y 8 de la citada ley 169 de la Constitución Política)—and therefore considers that the likelihood of success on the merits is weakened in this specific case.
Regarding danger in delay (peligro en la demora), the State’s counsel states that, with respect to the operational, financial, budgetary, rate-related, and human-resource-management impacts invoked by the Municipality in its application, it should be recalled that the alleged issues concerning the Cierre Técnico del Vertedero Los Navarro y el Relleno Sanitario Los Pinos Project are not recent. Rather, as shown in the background section, an amparo proceeding (recurso de amparo) addressing this matter has existed since 2019 and was decided by the Sala Constitucional de la Corte de Suprema de Justicia in 2020. Based on what the Chamber stated in recital XII (considerando XII) of that decision, the State’s counsel maintains that it is very clear that the Local Government has an obligation and duty to safeguard the interests of the Municipality, including the management and operation of the landfill, and that the conflict between the Local Government and the private company is no justification when the problem entails environmental degradation and harm to public health.
This requires the Local Government’s active participation under constitutional provision 169, Article 60 of the Ley Orgánica del Ambiente, and Article 08 of the Ley para la Gestión Integral de Residuos and its corresponding regulations. In essence, the State’s counsel considers that the alleged harm that would be impossible or difficult to remedy, which the plaintiff claims the health order (orden sanitaria) would cause, is a consequence of deficient planning by the Local Government, since the problem has existed since 2020. On this basis, it states that document AOM-OF-105-2023 rests merely on subjective assessments, without any technical basis or supporting document, and seeks to justify the Municipality’s failure to fulfill its legal obligations. Regarding the budgetary impact, the State states that document PL-OF-040-2025 instead demonstrates that the Municipality has a budget appropriation for solid-waste management, illustrating the inadequate planning and management of the problem, since it prepares an annual plan each year, which has been an obligation of the Municipality as ordered by the Sala Constitucional since 2020.
With respect to the impact on institutional human-resource management, it states that official letter RH-OF-356-2025 merely describes the procedure required to hire the personnel whom the Municipality deems necessary to comply with the health order, but at no point identifies any legal or material impossibility in that regard, which, in its view, illustrates the Municipality’s inaction and neglect. Lastly, regarding the rate impact, the State’s counsel states that document AAF-OF-102-2025, like the other documents submitted, was prepared by the same party, which diminishes its objectivity. It further states that the rate analysis is based on a memorandum from WPP CONTINENTAL LOS PINOS itself dated 30 de setiembre de 20129 concerning the cost of a list of works ordered by SETENA in connection with the landfill’s early technical closure, which differs from what was ordered by the health order in this case; consequently, there is no certainty regarding the cost of the works or their rate impact.
Regarding the nature of the alleged harm, it states that the alleged harm is not unlawful because the municipalities bear exclusive responsibility for the integrated management of the waste generated in their canton and cannot disclaim those obligations, which they are being asked to perform on land owned by the Municipality. To conclude its arguments concerning this second requirement, the State’s counsel states the following: “(...) the adjudicator should note that the dispute in this matter may be summarized as follows: in the opinion of the Municipalidad de Cartago, the works required under the health order must be performed by WPP Continental Los Pinos as a consequence of a contract between them. // This situation is relevant to this counsel because, on the same terms as the disputed health order, the Ministerio de Salud issued Health Order N.° CARTA-MS-DRRSCE-DARSC-OS-0021-2025 to WPP Continental Los Pinos.
Therefore, by virtue of the contract between those parties, they must coordinate and reach an agreement to comply with the orders of the ministerial authority in order to safeguard the healthy and ecologically balanced environment and, consequently, the health and lives of the Municipality’s residents” (see image 279 of the precautionary-measure case file). Lastly, regarding the protection of the public interest, the State’s counsel emphasizes that the Ministerio de Salud has acted as required by the legal system with respect to the management and disposal of solid waste, to protect a legal interest of the highest order and prevent the public from being exposed to greater danger from a source of contamination affecting the environment and people’s health and lives. This matter has even been declared to be of public and national interest through Decreto Ejecutivo N° 33477. In other words, there is an overriding public interest in life and an ecologically balanced environment that is fundamental to public health and people’s quality of life, under constitutional Articles 21 and 50.
In this regard, the State’s counsel argues as follows: “(...) the State has an inherent responsibility for waste management and for safeguarding the overriding public interest in life and in an ecologically balanced environment, which is fundamental to public health and people’s quality of life, as provided for in Articles 21 and 50 of the Constitución Política and in compliance with provision 4 of the Ley General de la Salud (N.°5395) and Articles 1, 2, 4 and 7 of the Ley para la Gestión Integral de Residuos (N.°8839). In addition, and in accordance with the matters discussed throughout this document, we cannot disregard the authority and responsibility of Local Governments to address, within their respective territorial jurisdictions, all matters related to solid-waste management. // Consistent with the foregoing, in cases of this kind, when there is a potential threat to life or the environment, their protection must prevail over any other interest, and the heightened precautionary principle (principio precautorio de carácter reforzado) must therefore be applied.” (see image 281 of the precautionary-measure case file).
In this regard, the State’s counsel refers to provision 5 of Ley N° 8839 and judgment 2024-4416 of the Tribunal Contencioso Administrativo concerning the weight of the public-health interest in the balancing of interests, with the Procuraduría stating as follows: “Accordingly, because municipalities are responsible for the integrated management of the solid waste generated in their canton—which they may perform directly or through contracts with companies or private parties, while strictly overseeing the performance of the contracted activities—this does not release them from the responsibilities imposed on them by law concerning the proper and due management of solid waste, particularly when there are technical documents and even a judgment of the Sala Constitucional establishing that the current situation at Rellenos Sanitario Los Pinos is a source of contamination affecting the environment and public health and requires immediate attention. // Following this line of reasoning, the Ministerio de Salud has authority to direct, monitor, evaluate, and supervise waste management, pursuant to Article 7 of the Ley para la Gestión Integral de Residuos, n.º 8839, del 24 de junio del 2010.
Therefore, in application of the precautionary principle established in Article 5 of that same law, it must ensure that solid waste is managed properly and within the limits of the law, to safeguard health and the environment; this is verified and implemented through health order n.° CARTA-MS-DRRSCE-DARSC-OS-0020-2025. // In this case, the Ministerio de Salud is acting pursuant to Articles 5 and 7 of ley n.º 8839, which grant it authority to direct, inspect, and supervise waste management for the protection of public health and the environment. The Ministerio de Salud therefore has an evident public interest in ensuring that waste disposal complies with sustainable development and the law. // That public interest consequently prevails over any private interest of third parties that lacks support in the national legal system. In this case, the argument concerning the impact that adopting the measures ordered by the Ministerio de Salud would have on the Municipalidad—and still less on regulated persons—cannot be accepted, since rate-setting and the integrated management of the canton’s waste are matters of planning that must be assessed year after year.” (see images 282 to 283 of the precautionary-measure case file).
In summary, regarding this third requirement, the State’s position is that the public interest prevails over private or third-party interests. In support of its position, the State’s counsel states that this is a matter of public health and of ensuring a healthy and ecologically balanced environment for the population, which was even addressed by the Sala Constitucional in the same judgment 2020002374, which has implications for the Los Pinos sanitary landfill. Accordingly, this concerns the protection of legal interests of the highest order, and granting the requested precautionary measure (medida cautelar) would effectively disapply powers held by the Ministerio de Salud in accordance with the body of applicable law (bloque de legalidad). The State’s counsel therefore concludes that the public interest in protecting the health of the population must prevail, as it directly affects the right to a healthy and ecologically balanced environment; granting precautionary protection (tutela cautelar) would instead endanger people’s lives by allowing a continuing source of contamination to remain, in addition to harming the environment. As evidence, it offers the following items identified on page 29 of its response:
As developed by the Constitutional Chamber (Sala Constitucional), as well as in prior rulings of this Court (see, among others, ruling N°38-2022 de las diez horas diez minutos del doce de enero de dos mi veintidós), interim relief (justicia cautelar) responds to the need to guarantee the constitutional principle of prompt and effective justice by preserving the factual conditions essential for the issuance and enforcement of the judgment (Resolución 7190-1994, de las 15:24 horas del 6 de diciembre). Along the same lines, Article 19 of the Código Procesal Contencioso Administrativo establishes that the purpose of ordering an interim measure (medida cautelar) is to provisionally protect and safeguard the subject matter of the proceeding and the effectiveness of the judgment. Legal scholarship has indicated that interim relief is not intended to declare a fact or establish liability, create a legal relationship, enforce an order and satisfy an undisputed right, or resolve a dispute, but rather to prevent the harm that litigation may cause or that may arise from an abnormal situation (Gallegos Fedriani, Pablo.
Interim Measures Against the Public Administration. 2 ed. Buenos Aires, Argentina: Ábaco, 2006). In voto #4074-2010, the Administrative Litigation Court (Tribunal Contencioso Administrativo) states that: “there are three requirements for interim protection (tutela cautelar): risk arising from delay (peligro en la demora), likelihood of success on the merits (apariencia de buen derecho), and the balancing of interests (ponderación de los intereses), particularly the public interest,” and “[o]nly when all three elements are present—that is, likelihood of success on the merits, risk arising from delay, and a determination, based on the balancing of interests, that the harm suffered by the private party must be protected above the other interests at stake—may the court grant the requested interim measure” (Tribunal Contencioso Administrativo, resolución n.° 4074-2010 de las 13:21 hrs. del 29 de octubre de 2010).
The Administrative Litigation Court of Appeals (Tribunal de Apelaciones de lo Contencioso Administrativo) has likewise stated: “In the case of interim measures, this means that, in addition to matters relating to the structural characteristics of instrumentality and provisionality, the decision must clearly and sufficiently explain how the requirements of likelihood of success on the merits, risk arising from delay, and the balancing of the interests at stake are or are not satisfied; none of them may be disregarded, because the law requires all of them to be present for the adopted measure to be warranted […] if this Court were hypothetically to accept the arguments concerning this issue and find that the balancing-of-interests element is present, that would require this Court, as a court of first and only instance, to analyze and develop the balancing-of-interests issue in a manner omitted by the lower-court judge; therefore, as the party correctly noted at the time, this Court would be taking the place of the lower-court judge in analyzing that element at first or sole instance, thereby depriving the party of the right to appeal what has been determined in that regard” (see resolución del Tribunal Procesal Contencioso Administrativo, n.° 132-2017-I de las dieciséis horas dieciocho minutos del veintinueve de marzo del dos mil diecisiete.

This position is supplemented by the opinion expressed by the First Chamber of the Supreme Court of Justice (Sala Primera de la Corte Suprema de Justicia), acting as the Administrative Litigation Court of Cassation (Tribunal de Casación de lo Contencioso Administrativo), in Voto N° 5-F-TC-2008 de las diez horas con cuarenta y cinco minutos del seis de febrero del año dos mil ocho, regarding the need to satisfy the burden of proof (carga probatoria) at this interim-relief stage, stating that “(…) three requirements apply: fumus bonis iuris, or likelihood of success on the merits… risk arising from delay, and the balancing of the interests at stake… under the new legislation, likelihood of success on the merits does not impose an onerous burden of demonstrating the seriousness of the claim, but instead entails even the judge’s own internal assessment that the prospective judgment is not frivolous and that the claim is not without merit; this, incidentally, is an inverted view of the so-called fumus bonis iuris.
This periculum is also a burden—a burden of proof borne by the party requesting interim relief—and this is so. Furthermore, interim relief entails a provisional assessment of that risk arising from delay; it is not… an assessment of the merits of the proceeding… as concerns the specific case (…) and this Chamber, after deliberate and extensive consideration, as is its practice, (…) has found that the serious or irreparable damages warranting the adoption of the interim measure at issue have not been duly proven (…) Ultimately, the Court finds that the principle of rational proof applicable to interim relief, which corresponds to balanced proof, has not been satisfied. Although conclusive proof is not required, because such proof cannot be required in interim-relief proceedings, neither can the matter be left solely to the unsupported assertions of the appellant; potential public interests are also involved.” Based on the foregoing statutory and precedential framework for analysis and the elements required for an interim measure to be granted, the specific case will now be examined in light of the presentation of the theory of the case (teoría del caso) (position) and the evidence offered in these interim-relief proceedings. Having established the framework for analysis and the three elements required for an interim measure to be granted, the specific case is analyzed below.-
For approval, interim measures (medidas cautelares) require the concurrence of the three elements indicated above (likelihood of success on the merits (apariencia de buen derecho), viewed inversely as nearly equivalent to a “fumus non mali iuris,” risk arising from delay (peligro en la mora), and the balancing of interests (equilibrio de intereses)). In addition, this interim measure must be instrumental, ancillary, and provisional insofar as it seeks to ensure the effectiveness of the judgment in the main proceeding. VI. A) Interlocutory ruling (interlocutorio) (regarding the PGR’s request for copies): In a pleading dated 19 de mayo de 2025, the State’s counsel indicates that copies of the evidence submitted by the claimant on CD were not provided. However, having reviewed the “preliminary matter” section of the State’s response, in which it withdrew its challenge because it lacked a current interest and, at the same time, requested access to that information by applying to the Court to obtain the evidence so as not to delay the course of the proceeding and to move it forward, and then proceeded to respond, in the opinion of this judge, the omission identified by the State’s counsel has been remedied, and the Court shall therefore issue its ruling in the present case.
VI. B) SUMMARY OF THE RELIEF REQUESTED: As previously explained in detail, in summary, the moving party requests a suspensive and affirmative interim measure so that, on the one hand, the effects of the challenged health order may be stayed and, based on the premise that technical and legal responsibility for the sanitary landfill (relleno sanitario) rests with the developer, WPP Continental de Costa Rica S.A, which it states holds the project’s environmental viability approval (viabilidad ambiental), the premise underlying the application at issue, it requests that, for purposes of the present case, it be ordered and established that said company is responsible for maintaining the land that is the subject of the dispute and the health order. In other words, as previously stated, this consists of a request for a STAY and an obligation to ACT, by which it is sought that this Court order—based on the claimant’s interpretation of the legal system in its application—by way of an interim measure that the developer, WPP Continental de Costa Rica S.A., be deemed technically and legally responsible for the aforementioned land while the full proceeding on the merits (proceso de conocimiento) is pending.
VI. C) REGARDING THE ABSENCE OF THE STRUCTURAL ELEMENTS REQUIRED FOR INTERIM RELIEF AND THE FAILURE TO ESTABLISH THE FIRST REQUIREMENT FOR INTERIM RELIEF: Once the legally required hearing had been granted, this judge finds that not even the first requirement for interim relief (tutela cautelar) has been established, because the action filed lacks the necessary provisional and instrumental nature as structural elements required of an application of this kind. The Tribunal Contencioso Administrativo has stated the following regarding the so-called “structural” elements of interim measures: “In determining whether the measure is appropriate, it is also important to take into account—as noted supra and in addition to the requirements already indicated—that the measure to be adopted structurally possesses the following characteristics: 1.- Its instrumental nature and prior independence in relation to the final judgment to be issued in a main proceeding, a matter that simultaneously determines the measure’s subordination or ancillary nature with respect to the main proceeding within, or for the purposes of, which it is issued. 2.- Its provisional nature, insofar as its effectiveness is, in principle, exhausted when the judgment on the merits is issued in the main matter or when circumstances so require.
That is, its effects are contingent upon the pendency of that proceeding and, on the other hand, upon the continued existence over time of the circumstances taken into account when it was adopted, characteristics arising from its inherent susceptibility to modification or revocation (rebus sic stantibus effect). 3.- The urgency required to avoid risk arising from delay, a feature that justifies interim measures adopted ante causam, prima facie, or inaudita altera parte. 4.- Summary cognizance (sumaria cognitio), that is, measures of this kind are adopted by virtue of an extremely summary examination conducted by the judicial body, without prejudging the merits of the matter, which in no way replaces the full sequence of steps entailed by the proceeding on the merits.-” (TRIBUNAL CONTENCIOSO ADMINISTRATIVO. Segundo Circuito Judicial de San 0814-2022-T, at fourteen hours and forty-five minutes on veintitrés de mayo de dos mil veintidós, among others).
Having analyzed the relevant matters, this judge finds that the claimant’s request for interim relief, under the terms in which it was made, lacks a provisional and instrumental nature and that those two elements cannot be identified, because it would constitute a request for interim relief that, by the very terms in which the party formulated it, would necessarily reach the core of the dispute on the merits between the parties involved in the proceeding on the merits, and even of another proceeding on the merits conducted between the parties under case file 23-006078-1027-CA, in which the same parties dispute which of them is responsible for managing, attending to, maintaining, and developing the land where Relleno Sanitario Los Pinos was located; moreover, according to the claimant itself, its requested stay of the health order issued by the Ministerio de Salud seeks the same result, namely, that only the aforementioned private company WPP (now WPP CONTINENTAL LOS PINOS S.A., as the company indicates following a merger) be deemed responsible.
This is because the claimant maintains that, in its opinion, that company bears legal and technical responsibility for the sanitary landfill because it holds the project’s environmental viability approval; therefore, according to its interpretation of the legal system, the public health administration may not impose upon it the obligations set forth in the administrative act (acto administrativo) whose annulment it requests. Conversely, WPP maintains that the agreement reached with the municipality in 2020 was breached and that the municipality itself expelled WPP from the land and denied it access to the property, which prevented it from continuing to bear the cost of maintaining land belonging to another after losing the operating revenue from Relleno Sanitario Los Pinos (which ceased operations in mayo del año pasado). For that reason, WPP maintains that the municipality cannot expect either WPP or anyone else to bear the cost of maintaining the land.
However, the ESTADO de Costa Rica, in the extensive arguments already detailed earlier in this decision, maintains that the local government is indeed responsible and that, in compliance with the decision of the Sala Constitucional, the conflict with the private company does not mean that the municipality may disregard what is happening to its residents at the site due to the existence of the aforementioned sanitary landfill. Still less can a legal conflict with the private company constitute grounds justifying disregard of the public’s outcry; quite the contrary, the mandatory public health legal framework requires the municipality, in its capacity as the local government, to make extraordinary efforts to protect the public, and situations such as the one that occurred directly contribute to environmental deterioration and, therefore, affect the health of the population, such that the order is fully consistent with law.
This constitutes the essential core of the dispute on the merits submitted to this Court by the parties to this case. This first-instance judge is of the opinion that the requested interim measure would require consideration of the essential core of the parties’ dispute on the merits, which is wholly improper in interim-relief proceedings. In response to requests similar to the one at issue here, involving a request to extend the validity of a concession by way of an interim measure—on that occasion, a public-service concession for power generation until the proceeding was resolved—a dispute processed under case file 22-005898-1027-CA, the higher court in this field, the Tribunal de Apelaciones de lo Contencioso Administrativo y Civil de Hacienda, Sección Segunda, categorically rejected the possibility of using an interim measure to adjudicate in advance the very core of the dispute on the merits in an initial interim-relief proceeding and to establish a situation that would not be merely provisional but would instead be equivalent to definitively resolving, from the outset, the merits of the eventual proceeding on the merits during an interim phase, thereby anticipating a ruling favorable to the interests of one party or the other.
A Court hearing an application for an interim measure cannot substitute its ruling for a decision on the merits that would properly fall to the Trial Court or potentially even to a Direct-Ruling Court in an interim-relief proceeding. This is not permissible and necessarily entails denial of the requested interim relief under the terms in which it was sought; moreover, that defect—that is, the absence of a structural characteristic—may be identified by the Court or the higher court on its own motion at any stage of the proceeding. In this regard, in circumstances similar to those at issue here, in the aforementioned court case in which an extension of a concession term was likewise requested by way of interim relief based on the claimant’s interpretation of the legal system, the higher court in this field, the Tribunal de Apelaciones de lo Contencioso Administrativo y Civil de Hacienda, Sección Segunda, stated the following in judgment N° 079-2023-II, at fifteen hours and forty-seven minutes on veintidós de febrero de dos mil veintitrés: “(...) part of the Court’s most heated discussion when analyzing this issue has focused on precisely that situation: determining how far a claim of this nature may extend and to what extent it may be considered in the situation before us ... [the Court] concludes that a claim under those conditions lacks a provisional nature ... it is also deficient with respect to its instrumental nature.
That is, those two requirements cannot be identified in this case; it would indeed constitute a request for interim relief that would necessarily reach the core of the parties’ dispute in the proceeding on the merits and would entail not the stay of administrative conduct, as the request for interim relief seeks to portray it, but, nothing more and nothing less, a determination that it be granted in anticipation of a ruling favorable to the claimant’s interests...” (See digital recording of the decision in case file 22-005898-1027-CA, from 00:30:29 to 00:31:58 of that digital recording, emphasis added). In this regard, counsel for the respondent State is correct that the first requirement for interim relief has not been established in this case due to the absence of a structural characteristic, as previously indicated.
This judge is not unaware of the distinction drawn in certain judicial decisions regarding the treatment of so-called “structural” characteristics and the so-called likelihood of success on the merits (apariencia de buen derecho) as a prerequisite for interim relief (tutela cautelar); however, even accepting those specific distinctions in treatment, this judge considers that the first requirement for interim relief cannot be deemed satisfied where interim relief is sought to settle the merits of the dispute between the parties by determining, in these summary proceedings (vía de cognición sumaria), based on the claimant’s interpretation of the legal system, that the private company WPP is solely responsible for maintaining the site, since this would constitute an application for interim relief that would necessarily touch upon the core of the parties’ dispute in the proceedings on the merits (proceso de conocimiento) and anticipate an outcome favorable to the municipality’s position on the underlying dispute, which is improper at the interim-relief stage; consequently, the first prerequisite for interim relief cannot be deemed established.
Accordingly, even though the three basic prerequisites for interim relief must be analyzed sequentially, and although, for the reasons stated above, the first prerequisite has been ruled out in this specific case, in order to facilitate effective judicial protection (tutela judicial efectiva) in the present case, all the prerequisites are expressly and specifically analyzed for the corresponding legal purposes. VI. D) FAILURE TO ESTABLISH SERIOUS HARM (DAÑO DE CARÁCTER GRAVE): Before analyzing this second prerequisite for interim relief, it is necessary to review the parties’ central arguments in this dispute: VI.D.1) Claimant’s position: In summary, the serious harm alleged by the municipality is divided into FIVE broad categories (operational, financial, budgetary, rate-related, and human-resource-management impacts), all based on the aforementioned premise, namely, that the administrative action (conducta administrativa) imposes upon it obligations that belong not to it but to the company WPP Continental Los Pinos S.A. In this regard, concerning the risk posed by delay (peligro en la demora), the claimant municipality states as follows: “(...) In this case, under the health order (orden sanitaria) at issue, the Municipalidad de Cartago is compelled to assume responsibilities and make substantial investments of public funds in work that, in addition to lacking a technical basis, clearly does not fall within its responsibilities, because those obligations belong to the company WPP Continental Los Pinos S.A.” (see image 09 of the interim-relief case file (legajo de medida cautelar)).
Once again, it is evident that the argument proceeds from the question-begging assumption (petición de principio) underlying the application for interim relief, namely, that the serious harm arises from assuming obligations that belong to the company WPP Continental Los Pinos S.A, which, as previously indicated, is not appropriate at the interim-relief stage. The claimant municipality then proceeds to provide what it calls an individualized assessment of the impact of the order whose suspension it seeks, from the aforementioned operational, financial, budgetary, rate-related, and human-resource-management perspectives. In summary, regarding the operational impact (section 2.1 of its application), the municipality alleges that, according to official letter AOM-OF-105-2025 signed by the head of the municipal Operations Area, the municipality lacks the technical, human, and financial resources necessary to comply with the health order, because the matters specified therein have never fallen under municipal responsibility and concern duties that belong to the operator under the environmental feasibility approval (viabilidad ambiental); accordingly, compliance would entail a substantial investment that has not yet been quantified.
Moreover, with respect to the leachate treatment plant (planta de tratamiento de lixiviados), leachate (lixiviados) deposited on private property—belonging to the aforementioned company WPP—is received there, and therefore compliance would entail allocating public resources to address a problem originating on private property. In that section, the municipality sets out some of the details of the intervention required under the health order whose suspension is sought, as well as the potential contracts it would entail, because it maintains that the municipality lacks the personnel and equipment appropriate for this work. Finally, it states that an initial investment of no less than one hundred fifty million colones is estimated solely for studies and designs, without including implementation or long-term maintenance. Regarding the budgetary impact (section 2.2.), it states, in summary, that according to official letter PL-OF-040-2025, maintaining the effects of the health order would be particularly serious because it would entail committing resources allocated for a specific purpose in the municipal budget for the 2025 period (budget line (partida) 1.04.06), which are intended to cover payment for solid-waste treatment and final-disposal services; accordingly, the health order compels the municipality to assume new tasks not included in the Annual Work Plan (Plan de Trabajo Anual), which it characterizes as an improper reallocation of public funds that would be diverted from their original purpose and would be insufficient to cover the costs associated with carrying out those actions.
In summary, it states the following in this regard: “(...) the risk posed by delay materializes in the possibility that, while the full proceedings (proceso de cognición plena) seeking annulment of the health order are resolved, the Municipality may be compelled to make substantial investments without any budgetary provision, thereby affecting the institution’s financial balance and allocating public funds to functions that belong to a private party” (see image 12 of the interim-relief case file). Regarding the impact on the management of institutional human resources (section 2.3), the municipality alleges, in summary, that according to official letter RH-OF-356-2025 from the Human Resources Department, the current Position Classification Manual (Manual de Puestos) contains no position profile covering the functions detailed in the health order; it would therefore be necessary to create new positions, and it refers to the steps required for that purpose, including a financial analysis to assess the impact of potentially creating those positions.
If that analysis establishes financial feasibility, budgetary authorization would then have to be obtained and the institution’s Position Classification Manual amended, and only then could a personnel recruitment and selection process begin. It therefore states that this demonstrates a “serious” institutional risk, because the municipality is being compelled immediately to perform functions for which it lacks the necessary structure and human resources. Lastly, regarding the rate-related impact, the municipality states that, according to official letter AAF-OF-102-2025 from the municipal Financial Administrative Area, if the effects remain in force, the municipality would be compelled to assume expenses exceeding one billion two hundred ninety-four million colones over a period of 15 years, with an initial cost of four hundred fourteen million colones in the first year alone, which, it states, would have to be passed on to users through a rate increase of 78,12%, in addition to a prior increase already approved in December 2024.
Furthermore, on this point, it also maintains that a sustained increase of 17.43% is projected over the following fourteen years, which it states would have a disproportionate impact on a vulnerable population, since more than 67% of the canton’s inhabitants are socially vulnerable, according to IMAS data. It characterizes this as irreversible harm to the rate structure and social balance of the public service, affecting the ability of Cartago families to pay. VI.D.2) Position of the STATE (Ministerio de Salud): The respondent State argues that the risk posed by delay is not established. In this regard, State counsel states that, concerning the operational, financial, budgetary, rate-related, and human-resource-management impacts invoked by the municipality in its application, it must be noted that the alleged problems involving the Proyecto Cierre Técnico del Vertedero Los Navarro and the Relleno Sanitario Los Pinos are not recent; rather, as shown in the background section, a petition for constitutional relief (recurso de amparo) addressing this matter has existed since 2019 and was decided by the Sala Constitucional de la Corte de Suprema de Justicia in 2020.
Citing what the Sala stated in considerando XII of that decision, State counsel maintains that it is very clear that the Local Government has an obligation and duty to safeguard the Municipality’s interests, including the management and operation of the landfill, and that the conflict between the Local Government and the private company is no justification where the problem involves environmental degradation and harm to public health, circumstances that require its active participation under constitutional provision 169, article 60 of the Ley Orgánica del Ambiente, and 08 of the Ley para la Gestión Integral de Residuos and its implementing regulations. In essence, State counsel considers that the alleged harm that would be impossible or difficult to remedy (daño de imposible o difícil reparación), which the claimant states would be caused by the health order, is the result of deficient planning by the Local Government, given that the problem has existed since 2020.
On this basis, it states that document AOM-OF-105-2023 rests solely on subjective assessments without any technical basis or supporting documentation and seeks to justify the municipality’s inaction with respect to its legal obligations. Regarding the budgetary impact, the State states that document PL-OF-040-2025 instead demonstrates that the Municipality has a budget line for solid-waste management, illustrating inadequate planning and management of the problem, since it prepares an annual plan every year, which has been an obligation of the municipality pursuant to the order issued by the Sala Constitucional since 2020. Regarding the impact on the management of institutional human resources, it states that official letter RH-OF-356-2025 merely sets out the procedure that, in the municipality’s view, is required to hire personnel to comply with the health order, but at no point establishes any legal or material impossibility in that regard, which, in its view, illustrates the municipality’s inaction and neglect.
Lastly, regarding the rate-related impact, State counsel states that document AAF-OF-102-2025, like the other documents submitted, was prepared by the same party, diminishing its objectivity. It further states that the rate analysis (análisis tarifario) is based on a letter from the same company, WPP CONTINENTAL LOS PINOS, dated 30 de setiembre de 2019, concerning the cost of a list of works ordered by SETENA in connection with the early technical closure (cierre técnico anticipado) of the landfill, which differs from what was required by the health order in this case; consequently, there is no certainty regarding the cost of the works or their rate-related impact. Regarding the nature of the alleged harm, it states that the alleged harm is not unlawful (antijurídico), because municipalities bear exclusive responsibility for the integrated management (gestión integral) of waste generated in their canton and cannot disclaim the obligations they are required to perform on land owned by the municipality.
To conclude its argument concerning this second requirement, counsel for the State states as follows: “(...) the Court should note that the dispute in this matter may be summarized as follows: in the opinion of the Municipalidad de Cartago, the work required by the health order must be performed by WPP Continental Los Pinos, as a result of a contract between them. // This situation is relevant to this representation because the Ministerio de Salud, on the same terms, issued the health order under discussion and issued Health Order N.° CARTA-MS-DRRSCE-DARSC-OS-0021-2025 to WPP Continental Los Pinos; therefore, by virtue of the contract between those parties, they must coordinate and reach an agreement in order to comply with the Ministry’s order, for the purpose of safeguarding a healthy and ecologically balanced environment and, consequently, the health and lives of the municipality’s residents” (see image 279 of the precautionary-measure case file).
VI.D.3) Position of the interested third party: With regard to danger in delay (peligro en la demora), WPP (the interested third party) essentially stated that the municipality cannot seek to impose unjust impoverishment upon it when it was forcibly expelled from the site a year ago by the same municipality, which asserted at the time that there was no environmental feasibility (viabilidad ambiental) for operating there. WPP maintains that the municipality is contradicting its own prior conduct by alleging that the company it represents bears environmental responsibility for property belonging to the Local Government, arguing as follows: “(...) With no possible explanation for such a contradiction, then, the entity seeking this precautionary measure (medida cautelar) considers that, when an economically productive activity is involved, the company I represent lacks environmental feasibility; but, for purposes of maintaining the property—which is not privately owned but is public property—according to the Municipalidad de Cartago, we are indeed covered by the case file opened before SETENA.” (see image 294 of the precautionary-measure case file).
WPP acknowledges that maintaining the land is costly, but precisely for that reason it maintains that the municipality cannot seek, through a request for precautionary relief (tutela cautelar), to shift the cost to the company it represents without compensation, because the municipality should have foreseen the consequences of its material conduct (conducta material), of which it had been aware since the year 2019. VI.D.4) THE COURT’S ASSESSMENT: Having heard the arguments of the plaintiff, the State, and the interested third party, and having analyzed the evidence submitted to the record, the Court finds that the second requirement for precautionary relief has not been met, as explained below. With respect to danger in delay, this Court has previously stated, among many other decisions, in judgment 009-2021-T issued at twelve hours and three minutes on día siete de enero de dos mil veintiuno, that: “...under the applicable statutory provision, precautionary relief may be granted only if the implementation or continuation of the administrative conduct (conducta administrativa) challenged in the proceedings causes serious, actual or potential harm or loss to the legal position of the moving party.
In that regard, it must be emphasized that merely alleging the existence of serious harm (or loss), whether actual or potential, is insufficient; it must be proven, which entails a procedural burden (carga procesal) that must be borne by the interested party pursuant to articles 220 of the Código Procesal Contencioso Administrativo and 41 of the Código Procesal Civil.” With respect to this requirement for precautionary relief, it was also stated at the time that “[...] the current legislation establishes a relaxation of the former procedural system, which referred to ‘impossible or difficult reparation’—that is, it was rigid—we moved from an extremely rigid position requiring proof of harm and loss that was ‘impossible or difficult to repair’ to a more flexible system, specifically in keeping with the philosophy of broadening access to precautionary measures [...] to a threshold of ‘seriousness’ that the harm must meet.
Therefore, stating that serious harm that is difficult or impossible to repair must be demonstrated is language that no longer exists [...] But the threshold—and this is what matters—that Article 21 establishes is ‘serious’; the word is ‘serious.’ At or above that level of seriousness, the precautionary measure may be granted; below that level, anything that cannot be classified as serious does not satisfy the requirements for the precautionary measure. In other words, if the harm does not reach that threshold of ‘seriousness,’ the measure may not be granted [...]. (TRIBUNAL PROCESAL CONTENCIOSO ADMINISTRATIVO, Decision 286-08 issued at twelve hours and thirty minutes on nueve de mayo de 2008. Cf. 12:34:22 – 12:35:27 of the corresponding digital recording, case file 08-35-1027-CA, emphasis added). Regarding this second requirement, as stated in the preceding recitals (considerandos) of this decision, the applicable statutory provision requires, for precautionary relief to be granted, that the implementation or continuation of the conduct challenged in the proceedings cause serious, actual or potential harm or loss to the moving party’s legal position.
In that regard, it must be emphasized that merely alleging the existence of serious harm (or loss), whether actual or potential, is insufficient; it must be proven, which, as explained, is a procedural burden borne by the interested party, as established in articles 220 of the Código Procesal Contencioso Administrativo (CPCA) and 41 of the currently applicable Código Procesal Civil (CPC). Accordingly, this Court concludes that the aforementioned statutory requirement has not been met because the plaintiff has not submitted sufficient and appropriate evidence to establish the degree of “seriousness” of the alleged impact and to permit the Court to determine with certainty that the magnitude of the harm identified in its application for precautionary relief is serious. In this respect, the plaintiff’s claim for precautionary relief is based, in summary, on the assertion that the defendant’s administrative conduct challenged in these proceedings—which the plaintiff characterizes as absolutely null and void (absolutamente nula) on both procedural and substantive grounds—causes the plaintiff serious harm by requiring it to assume obligations belonging to WPP Continental Los Pinos S.A. Once again, it is evident that this argument rests on a petitio principii (petición de principio) that serves as the starting point for the precautionary-relief argument presented—namely, that the serious harm arises from assuming obligations belonging to WPP Continental Los Pinos S.A.—which, as previously stated, is not appropriate in precautionary-relief proceedings. The following evidence of this serious harm was submitted on CD:
Accordingly, the remaining documents to be assessed are document “eighteen” (18), which is Official Letter (Oficio) No. AOM-OF-105-2025 concerning the so-called “operational impact”; evidentiary item “nineteen” (19), which is Official Letter No. PL-OF-040-2025 concerning the so-called “budgetary” impact; document “twenty” (20), which is AAF-OF-102-2025 concerning the so-called “rate” impact; and document “twenty-two” (22), which is Official Letter RH-OPF-356-2025 concerning the so-called impact on human-resource management. These are examined in detail below, and it should be stated at the outset that, in this judge’s view, they do not constitute sufficient evidence of the allegedly serious impact of the health order (orden sanitaria) claimed by the municipality. Evidentiary document “twenty-three” (23) merely states that application of the instrument known as the “Social Information Form” records a total of 46246 persons in the canton of Cartago and that, based on SINIRUBE’s poverty classification, 32.05% of the registered population is living in poverty, 12.77% is in a situation of vulnerability, and 21.79% is not living in poverty (the evidentiary item numbered “23” on the submitted CD would be document “22,” and so forth).
In other words, this document does not establish the seriousness of the harm; it merely refers to IMAS statistical data concerning the classification of poverty and vulnerability in the canton (32.05% and 12.77%), and thus does not even accord with the contention that most of the canton’s inhabitants are living in poverty and social vulnerability. In any event, the document itself states that the database query includes persons whose information has not been processed by SINIRUBE, and therefore it does not constitute appropriate evidence for the purposes sought in these interim-relief proceedings (tutela cautelar). The evidentiary items that do relate to the municipality’s allegation of serious harm (evidentiary items numbered 18, 19, 20 and 21) will now be analyzed together with the alleged impact. VI.D.4.1) Regarding the so-called “operational impact” (section 2.1 of the application for interim relief (gestión cautelar)): In this regard, the municipality alleges that its position is supported by Official Letter AOM-OF-105-2025 (evidentiary item #18—numbered 17 on the CD—).
That letter, prepared by the head of the Operations Division of the applicant municipality itself and setting forth that official’s opinion without supporting documents, states, in summary, that the municipality lacks the technical, human, and financial resources necessary to comply with the health order because the matters specified therein have never been the municipality’s responsibility and concern functions assigned to the operator under the environmental viability approval (viabilidad ambiental). Compliance would therefore require a significant investment that has not yet been quantified; moreover, the leachate treatment plant (planta de tratamiento de lixiviados) receives leachate deposited on private property (belonging to the aforementioned company WPP), meaning that public resources would have to be allocated to address a privately caused problem. On the one hand, the letter clearly states that the investment is “unquantified,” meaning that it cannot be regarded as a technical document establishing a concrete impact of the health order; on the other hand, it again proceeds from the premise that the work is not the municipality’s responsibility but WPP’s (the merits of the matter).
Note that item a. of that document states: “the operator of the Relleno Sanitario Los Pinos is the company WPP; that is, it was not and is not the Municipalidad de Cartago that deposited waste in the project area in plain view and with the acquiescence of the Ministerio de Salud.” Likewise, regarding the leachate treatment plant, item b) states: “The Municipalidad de Cartago could not therefore continue performing maintenance work on the treatment plant because it was never responsible for operating it, or even for obtaining the operating permits or submitting the operating reports...” Regarding “vent maintenance” (“mantenimiento de chimeneas”), the document states (item c) that the vents are based on a design established at the project’s inception, based on analyses contemplated in the environmental viability approval and covering the entire project; consequently, work performed without qualified personnel could cause even greater adverse effects than those currently present.
Regarding maintenance of “perimeter channels” (“canales perimetrales”), item d) states that this is among the tasks the operator must perform during the landfill’s closure and post-closure phases and that the municipality lacks the necessary equipment and machinery. Regarding monitoring of “slope stability” (“estabilidad de taludes”), item e) states that the municipality has neither equipment nor personnel, that this technical task is the responsibility of the Ministerio de Salud, and that most of the noncompliant slopes are located on property belonging to WPP. Finally, regarding the “maintenance of green areas and internal roads” (“mantenimiento de zonas verdes y vías internas”), item f) states that the project operator abandoned those tasks and that no personnel are available, which would require resources to be acquired. As to the cost of the work, the opinion states that it is “impossible” to provide a detailed cost and gives “rough” (“a grosso modo”) estimates of the monthly cost and initial investment.
In other words, this opinion from the Operations Division again proceeds from the premise that the work is WPP’s responsibility and relies on “rough” estimates, which, as stated, rules out its usefulness as sufficient evidentiary support for the purpose relevant to this interim-relief proceeding. What the document submitted into the record does establish is that there is clearly a disagreement among the municipality, WPP, and the Ministerio de Salud regarding responsibility for maintaining the property and the leachate treatment plant. As stated, this is precisely the substance of the dispute at issue, but the document does not constitute sufficient evidence establishing the serious harm alleged in these proceedings. VI.D.4.2) Regarding the so-called “budgetary impact” (section 2.2. of the application for interim relief): In summary, the municipality states that, according to Official Letter PL-OF-040-2025 (evidentiary item #19—numbered 18 on the CD—), maintaining the health order in effect would be particularly serious because it would require the commitment of resources allocated for a specific purpose in the municipal budget for the 2025 period (line item 1.04.06), which are intended to cover payment for solid-waste treatment and final-disposal services.
Once again, this document, prepared by the municipality’s own budget department, does not constitute sufficient and appropriate evidence of the serious magnitude of the impact because it is a logical consequence that the tasks specified in the recently issued health order would not be included in the municipal budget, given that the order was issued subsequently. Thus, the corresponding budget-law procedure is inherent in implementing the health order, and neither the absence of a budget line item nor the procedures potentially required to include one may in itself be deemed to cause the applicant a serious impact. Still less does the letter submitted by the municipality provide sufficient support for finding that the institution’s financial equilibrium would be affected, since the municipality later argues that the resources needed to perform the tasks arising from the health order would come from a potential increase in the rates associated with solid-waste treatment and final-disposal services.
VI.D.4.3) Regarding the so-called “impact on the management of institutional human resources” (section 2.3 of the application for interim relief): In summary, the municipality alleges that, according to Official Letter RH-OF-356-2025 (evidentiary item 22—numbered 21 on the CD—) from the Human Resources Department, the current Job Classification Manual (Manual de Puestos) contains no position profile encompassing the duties specified in the health order; new positions would therefore have to be created, and the letter describes the steps required for that purpose. Once again, this judge does not consider that document sufficient evidence establishing a “serious” impact on the institution’s operations because, as a result of the health order, the municipality must proceed in accordance with the legal framework (bloque de legalidad) to contract for the required work; the fact that it currently lacks the necessary personnel cannot in itself be deemed to cause serious harm.
In this regard, this judge’s view coincides with that expressed by the Procuraduría General de la República: the documentation submitted on this point merely describes the “procedure” required to hire personnel, according to the applicant municipality’s position, in order to comply with the health order, but at no time identifies any legal or material impossibility of doing so. Once again, throughout its application the applicant proceeds from the same premise: that an impact of a “serious” nature arises from having to undertake work that is not its responsibility but that of a third party (WPP). As stated, this exceeds the scope of review applicable to an interim measure (medida cautelar), and the documents prepared by its own departments lack supporting workpapers or independent audits substantiating their assertions. VI.D.4.4) Regarding the so-called “rate impact” (section 2.4 of the application for interim relief): On this point, the municipality states that, according to Official Letter AAF-OF-102-2025 (evidentiary document #20—numbered 19 on the CD—) from the municipal Administrative and Financial Division, if the order remained in effect, the municipality would be required to incur expenses exceeding one billion two hundred ninety-four million colones over a period of 15 years, with an initial cost of four hundred fourteen million colones in the first year alone. It states that this cost would have to be passed on to users through a rate increase of 78,12%, in addition to a previously approved increase of 122.81% in December 2024.
Additionally, on this point, it also contends that a sustained increase of 17.43% is projected over the following fourteen years, which, it states, would disproportionately affect a vulnerable population, since more than 67% of the canton’s inhabitants are in a condition of social vulnerability, according to IMAS data; it characterizes this as irreversible harm to the rate and social balance of the public service, affecting Cartago families’ ability to pay. This adjudicator does not consider the document prepared by the Administrative and Financial Area of the moving party itself to constitute sufficient evidence of its position regarding proof of serious harm (daño grave), since it lacks working papers and is based, as the document itself states, on representations made by the company WPP concerning the work required in a 2019 memorandum to fulfill the health and environmental commitments for Relleno Sanitario Los Pinos, that is, for the area with environmental feasibility (viabilidad ambiental); according to the municipality’s position, however, the health order (orden sanitaria) was issued for an area of land that does not have such environmental feasibility.
In other words, the very basis of the document rules out the applicability of its projections to the case at hand. In this regard, page 1 of the aforementioned document AAF-OF-102-2025 states the foregoing as follows: “(...) we hereby submit a technical report projecting the impact on rates, derived from the economic estimate provided by the company responsible for the health and environmental commitments for Relleno Sanitario Los Pinos, in a memorandum dated 30 de setiembre de 2019” (emphasis added). In other words, according to the document itself, the projection used to determine the impact on rates is based on the estimated costs of operational measures that differ from those ordered by the challenged administrative conduct, which in itself rules out the document’s probative value in supporting the alleged serious harm. In any event, the same document states that an increase ranging from ¢221 to ¢898 was recently imposed on more than 43.000 residential ratepayers, and an increase ranging from ¢1.110 to ¢10.100 was imposed on approximately 5.679 commercial ratepayers, according to a publication in the Gaceta N° 228 del miércoles 4 de diciembre de 2024, without it having been established that a further increase, even one of similar magnitude, would have such a serious effect on users’ assets as to constitute harm of a SERIOUS nature.
In this adjudicator’s opinion, the document in question does not provide a sufficient technical basis for determining that issue. Yet even taking the figures projected in that official communication as the basis for the analysis, the municipality states that the severity of the rate impact would result from passing on to users an additional increase of 78.12% in the garbage collection rate, which would be added to another increase of 122.81% imposed in 2024. To begin with, as stated, the mere percentage of the additional increase (78.12%) does not in itself constitute serious harm to users; indeed, the prior increase of 122.81% in 2024 was greater than the increase that, according to the document itself, would be entailed by the health order whose effects the municipality seeks to suspend. In any event, this is a potential impact on users whose serious nature has not been demonstrated; moreover, should the municipality prevail in its position that these are amounts to be borne by the company WPP, they could potentially even be reimbursed to those same users through rate adjustments, and therefore an impact of a serious nature is ruled out in this respect.
In any event, regarding the rate impact, this adjudicator agrees with the State’s counsel that the rate analysis submitted by the municipality is based on a memorandum from the company WPP CONTINENTAL LOS PINOS itself, dated 30 de setiembre de 2019, concerning the cost of a list of works ordered by SETENA in connection with an early technical closure of the landfill, which is entirely different from what was required by the health order in this case; consequently, there is no certainty as to the cost of the works or their rate impact, and that assessment must therefore be rejected at the outset because it proceeds from a basis that is inapplicable to this specific case. VI.D.4. 5) Summary—failure to establish serious harm: Accordingly, having heard the parties’ arguments and reviewed the evidence in the record, this adjudicator must take into account that the party filing any petition before the judicial authorities bears responsibility for providing sufficient and reasonable evidence that the prerequisites for the relief sought in its application exist; specifically, in this case, a basis for finding the existence of a situation involving SERIOUS harm warranting the immediate suspension of the challenged act and the adoption of the requested suspensive and affirmative interim measure (medida cautelar).
This is because it must be borne in mind that, in this particular case, the evidence offered by the plaintiff is the evidence analyzed above, none of which sufficiently establishes serious harm; this prerequisite is therefore ruled out. Having reviewed the evidence submitted, this adjudicator finds that it does not constitute sufficient competent evidence, for purposes of the present application for interim relief (tutela cautelar), to establish the magnitude of the alleged harm. It should be noted that the rational-evidence principle (principio racional de prueba) governs interim-relief matters, meaning the evidence that is necessary and possible in light of the particular case, as the applicable case law has repeatedly held: “Certainty as to the harm does not, however, require full proof thereof, because, given the summary nature of interim-relief proceedings, the urgency, and sometimes the potential nature of the harm itself, proving it is practically impossible.
Sometimes, indeed, such harm is the logical and unavoidable consequence of public conduct and therefore requires no further evidence. In such a case, verification must be made ‘through the rational-evidence principle,’ meaning the evidence that is necessary and possible in each particular case.” (Tribunal Contencioso Administrativo, Sección Segunda, II Circuito Judicial de San José, N° 1-2007 de las once horas del doce de enero de 2007, citing the decision of the Tribunal Contencioso Administrativo, Sección Segunda, número 167-2002, de las once horas diez minutos del treinta y uno de mayo de dos mil dos, among many others). In this particular case, taking into account the statements of both parties and the evidence submitted into the record, this adjudicator finds that no compelling evidence has been provided that reliably quantifies harm that is serious, actual, assessable, and identifiable, particularly considering that the plaintiff seeks to halt a health order arising from a longstanding dispute caused by the environmental impact on the site in question resulting from the presence of a sanitary landfill (relleno sanitario) and garbage deposited in that area.
Accordingly, the party failed to satisfy its corresponding burden of proof (carga probatoria) (artículo 41.1.1 del Código Procesal Civil, applicable on a supplementary basis to this subject matter by virtue of numeral 220 del Código Procesal Contencioso Administrativo). It is not enough to allege the possibility of incurring economic losses as a result of the health order; that assertion must be established through competent evidence, which, as stated, was not done. In summary, this first-instance adjudicator finds that the allegations regarding the seriousness of the harm rest on a question-begging assumption underlying the plaintiff’s position: namely, that the administration cannot undertake work that, according to the plaintiff’s interpretation of the legal framework, is the responsibility of the company WPP, and that serious harm therefore follows. Accordingly, determining the validity of that premise would likewise entail deciding the very core of the dispute on the merits in an initial interim-relief proceeding, which is improper in such a proceeding.
In summary, the second prerequisite for interim relief has likewise not been established, and the application must therefore be DENIED. Furthermore, regarding the application of the burden of proof in interim-relief applications such as the one before us, this Tribunal has stated, insofar as relevant: “(...) The danger and harm must not only be alleged but also demonstrated, since the petitioner is required to submit all evidence supporting its position pursuant to numeral 41.1.1 del Código Procesal Civil, applied on a supplementary basis under canon 220 del Código Procesal Contencioso Administrativo. Thus, if the plaintiff fails to submit evidence supporting the serious harm caused by the potential administrative decision, this adjudicator cannot assume the party’s role and presume possible harm without evidentiary support. In other words, harm must not merely be stated in general terms or presumed; rather, it must be described extensively in an effort to adequately substantiate the serious harm caused, and it must also be demonstrated.
The requested interim measure fails to meet these requirements, making its adoption difficult and counterproductive, since granting it requires a reasonable and objectively well-founded likelihood that the moving party will suffer serious harm as a result of the delay inherent in the proceedings on the merits. Thus, there must at least be proof, to a reasonable degree of certainty, of the factual conditions consisting of the threat that the petitioner regards as serious harm....” (resolución número 02274-2019, de las quince horas cincuenta y cinco minutos del 17 de diciembre del 2019, cited in the judgment of the Tribunal de Apelaciones de lo Contencioso Administrativo y Civil de Hacienda, Sección Primera, N°349-2020-I de las diez horas treinta minutos del siete de julio de dos mil veinte, emphasis added). Based on the foregoing, because serious harm has not been established, it is unnecessary even to delve into the balancing of the interests at stake, since the prerequisites for granting interim measures are cumulative, and the absence of any one of them entails denial of the petition.
The present interim measure must therefore be denied, as is hereby ordered. As to the balancing or weighing of the interests at stake, the pertinent considerations regarding the balancing of interests, as well as the potential impact on the public interest and third parties, shall also be set forth in this judgment. VI. E) REGARDING THE BALANCING OF THE INTERESTS AT STAKE: With respect to balancing the interests at stake, the plaintiff argues, in summary and as previously stated, that the administrative conduct is vitiated by absolute nullity (nulidad absoluta) and causes it serious economic harm. Counsel for the Estado de Costa Rica, on the other hand, states that the public interest in protecting the environment and human health prevails in this case. Having heard the parties’ positions, this adjudicator finds that the case indeed involves a public interest in which the reinforced precautionary principle (principio precautorio reforzado) prevails because the protection of human health is at stake; it is therefore essential to ascertain whether the harm alleged by the applicant is truly greater than the harm that the requested suspension would cause to the community.
Now, since the magnitude of the harm alleged by the moving party has not been demonstrated by suitable evidence, as detailed in the preceding section, the balance must tip in favor of the prevailing weight of the impact that the requested interim measure (medida cautelar) would have on the powers of environmental and human-health oversight and protection, as well as the heightened precautionary principle (principio precautorio reforzado) applicable to cases such as the one before us, in which the Ministry of Health intervenes through a preventive measure (medida preventiva) to protect Public Health, pursuant to Articles 1, 2, 4, 7, 263, 355, 356 and 357 of the General Health Law, Articles 1 and 2 of the Sanitary Landfills Regulations (Decreto N° 38928-S), Articles 1, 2, 3, 7 and 20 of the Comprehensive Waste Management Law (N° 8839), and Articles 21 and 50 of the Constitution. It should be noted that the inspection conducted at the site by the Ministry of Health in follow-up to Constitutional Chamber decision N°2020002374 on 03 de febrero de 2025 states that, according to the visit to the Municipalidad de Cartago property at the Leachate Treatment Plant: “(...) In summary, the site remains in a state of complete operational abandonment since 10 de mayo de 2024; consequently, the responsible party has also conducted no routine monitoring and control sampling as required by decreto N° 33601-S-MINAE.” (see image 42 of the interim-measure file).
The same document also refers to contamination of natural bodies of water. The site-inspection document prepared by Ministry of Health personnel (MS-DRRSCE-URS-IT-0016-2025) further states that maintenance work has not continued in the project’s various areas and that, specifically on land owned by the Municipalidad de Cartago, no stormwater channeling could be observed; areas were also observed on Municipalidad de Cartago property where the biogas flaring stacks were not operating, as was an area containing waste exposed in the open air, located specifically on land owned by the Municipalidad de Cartago. Accordingly, the Ministry of Health states that the sector has been abandoned, with no operation or maintenance of any kind (see image 47 of the interim-measure file). This judge agrees with the State’s counsel that it is an essential function of the State of Costa Rica to safeguard the population’s health through the Ministry of Health, which must take the appropriate measures to ensure that this right is protected, including by adopting preventive measures to protect Public Health, an area governed by a heightened precautionary principle; therefore, risks to public health cannot be ignored by that Ministry.
Regarding the rights to health and to a healthy environment, constitutional case law has stated as follows: “(...) In settled case law, this Court has held that, pursuant to Article 169 of the Political Constitution, municipalities are responsible for administering the local interests and services of their canton. This authority includes the collection, final disposal, and treatment of solid waste generated within those territorial jurisdictions. Indeed, this is an unavoidable duty that, beyond protecting a healthy and ecologically balanced environment, directly affects human health. From that perspective, problems caused by the improper disposal and management of solid waste transcend the local sphere and become a public-health problem, in relation to which budgetary and economic justifications cannot validate any omission or unjustified delay by those municipal corporations in protecting these rights (see judgment n° 2011010416 of twelve forty-nine p.m. on cinco de agosto del dos mil once).
(Constitutional Chamber of the Supreme Court of Justice, Decision N° 2018-001907 of eleven fifteen a.m. on seis de febrero de dos mil dieciocho; to the same effect, see also Constitutional Chamber rulings 2012-001729 of nine oh-five a.m. on diez de febrero de dos mil doce and 2023007643 of nine twenty a.m. on treinta y uno de marzo de dos mil veintitrés, among many others). Thus, the proper balancing and assignment of prevailing weight in a dispute such as the one before us has already been resolved by the case law of the Constitutional Chamber of the Supreme Court of Justice. Accordingly, when there is a conflict between economic and budgetary impacts, such as those alleged by the municipality in this case, and the harm caused by the improper disposal and management of solid waste, the latter transcends the local sphere and becomes a public-health problem to which special protective principles and the heightened precautionary principle apply; therefore, in the balancing analysis (juicio de ponderación), the protection of a healthy environment and, particularly, human health carries the prevailing weight.
In this regard, this judge finds that the harm that would result from suspending the preventive measure contained in the health order (orden sanitaria) would constitute very serious harm to the public interest, whose prevailing weight is not offset by the moving party’s required showing of serious harm. Accordingly, in this case the balance tips in favor of the prevailing weight of the public interest, which weighs against the relief requested, and the interim measure must be denied. In cases such as the one before us, all three of the aforementioned requirements must be satisfied before the requested interim relief (tutela cautelar) may be granted. Regarding the balancing of the interests involved in the case, it must be stated that granting an interim measure requires simultaneous verification of the three statutory requirements established in Article 21 of the Code of Administrative Litigation Procedure; therefore, a final analysis of this issue must be conducted, which, as noted above, precludes granting the requested interim relief.
The Administrative Litigation Court of Appeals has analyzed this requirement for interim relief in the following terms: “Regarding the issue of balancing or weighing the interests at stake, it must be recalled that, for this type of measure, it is necessary to weigh the effects that the prospective measure may generate on the petitioner’s private interest against those affecting the public interest. In legal scholarship, this requirement has also been understood through what has been termed the bilateral nature of the risk arising from delay (bilateralidad del periculum in mora). Before adopting an interim measure, the judge must assess the implications that the decision may have for the public interest and the legal position of third parties. This balancing must also consider the effect of the interim measure on the ordinary activities of the public administration, because it may affect or frustrate the substantive operations of a particular administrative organization.
Along these lines, properly weighing the public interest entails denying a request for interim relief when the harm to the public interest exceeds the harm to the private interest, taking into account even the financial or budgetary arrangements that the public administration would have to make to implement the interim measure. Finally, it bears emphasizing that any interim measure adopted must always be appropriate to the specific case, insofar as it must be suitable for achieving the intended purposes reasonably and proportionately, bearing in mind the interests at stake...” (see decision of the Administrative Litigation Court of Appeals, N°336-2017-I of thirteen hours and thirty-five minutes on nueve de agosto de 2017, among many others). Accordingly, in light of the specific case, it is precisely the balancing of the interests at stake that must guide the decision, and, in the context of the case file before us, that balancing requires denial of the relief requested by the moving party for the reasons stated above.
As indicated, this judge finds that the harm that would result from suspending the health order would constitute very serious harm to the public interest, whose prevailing weight is not offset by the moving party’s required showing of serious harm. This judge considers that, although the plaintiff has every right to institute proceedings on the merits (proceso de conocimiento) and to identify all shortcomings that it believes may have occurred in the decision whose nullity it alleges—and, if the plaintiff prevails, that outcome may eventually give rise to the corresponding corrective and remedial measures—in the procedural circumstances before us, the legal system does not permit interim judicial protection to favor the moving party’s interest over the public interest and the impact on the legal position of third parties, which are of greater significance in this case. Accordingly, the public interest that the respondent must serve takes precedence over the moving party’s interest, particularly given that the plaintiff has not even established, concretely and specifically, the existence of serious harm.
Thus, in the specific context before us, the decision must favor the prevailing weight of the public interest in this particular case. As a corollary to the foregoing and as explained above, because the existence of all the requirements for interim relief has not been substantiated in accordance with Articles 1, 2, 20 and 21 of the Code of Administrative Litigation Procedure (CPCA), the requested interim measure must consequently be denied. This decision may, where appropriate, be challenged through the corresponding appeal (recurso de apelación) before the superior court with jurisdiction over the matter, the Administrative Litigation and Public Finance Court of Appeals, in accordance with the CPCA.
POR TANTO
Based on the foregoing and in accordance with Articles 20 and 21 of the Administrative Litigation Procedure Code (Código Procesal Contencioso Administrativo), the application for a precautionary measure (medida cautelar) filed by the MUNICIPALIDAD DE CARTAGO against the STATE, in which the company WPP CONTINENTAL LOS PINOS SOCIEDAD ANÓNIMA, corporate identification number 3-101-526134, participates as an interested third party, is REJECTED and denied. EL ESTADO N° 2025005724 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las once horas con dieciocho minutos del once de junio del dos mil veinticinco.- Se conoce medida cautelar interpuesta por la MUNICIPALIDAD DE CARTAGO, en contra del ESTADO, interviene como tercero interesado la empresa WPP CONTINENTAL LOS PINOS SOCIEDAD ANÓNIMA, cédula jurídica 3-101-526134.
CONSIDERANDO
a-) La parte accionante en su escrito presentado en fecha 28 de abril de 2025 solicita medida cautelar en los siguientes términos:"(...) Con base en los fundamentos fácticos y jurídicos expuestos, respetuosamente solicito a su Autoridad se ordene, como medida cautelar ante causam, la suspensión de los efectos de la orden sanitaria n.° CARTA-MS-DRRSCE-DARSC-OS-0020-2025, emitida por el Ministerio de Salud, Dirección Regional Central Este - Área Rectora de Salud Cartago, hasta tanto se resuelva en definitiva el proceso de cognición plena que se interpondrá con la finalidad de requerir su anulación" (ver imagen 15 del legajo de medida cautelar). b-) Por resoluciones de las diecisiete horas veintisiete minutos del nueve de mayo de dos mil veinticinco se confiere audiencia por el plazo de TRES DÍAS HÁBILES a la parte accionada EL ESTADO y como tercero interesado a la empresa WPP CONTINENTAL LOS PINOS S.A. para que contesten por escrito y aporten la prueba que consideren pertinente (ver imágenes 25 a 26 del legajo de medida cautelar). c-) La representación del ESTADO como parte accionada responde la audiencia conferida sobre la medida cautelar en memorial visible a imágenes 257 a 287, indicando, en síntesis, que la petición de tutela cautelar debe ser rechazada por cuanto su posición es que incumple todos los presupuestos requeridos para adoptar la medida cautelar solicitada, ofreciendo como prueba la que detalla en el apartado correspondiente de su gestión consistente en 11 elementos probatorios que se detallan en el considerando correspondiente de esta resolución (ver imágenes 257 a 286 del legajo de medida cautelar). d-) Notificada la empresa WPP CONTINENTAL LOS PINOS S.A. para que se refiera a la solicitud de medida cautelar como tercero interesado en el asunto dicha empresa se apersonó a los autos mediante memoriales de fechas 03 y 04 de junio de 2025 contestando negativamente la gestión y solicitando que la petición cautelar de la municipalidad sea declarada sin lugar y ofreciendo prueba para sustentar su posición (ver imágenes 289 a 347 del legajo de medida cautelar).
En este asunto, la parte promovente solicita una medida cautelar con el siguiente fin: (...) Con base en los fundamentos fácticos y jurídicos expuestos, respetuosamente solicito a su Autoridad se ordene, como medida cautelar ante causam, la suspensión de los efectos de la orden sanitaria n.° CARTA-MS-DRRSCE-DARSC-OS-0020-2025, emitida por el Ministerio de Salud, Dirección Regional Central Este - Área Rectora de Salud Cartago, hasta tanto se resuelva en definitiva el proceso de cognición plena que se interpondrá con la finalidad de requerir su anulación" (ver imagen 15 del legajo de medida cautelar). Se trata, en síntesis, de una medida cautelar de carácter suspensivo e innovativo para que, por un lado, se suspendan los efectos de la orden sanitaria CARTA-MS-DRRSCE-DARSC-OS-0020-2025, emitida por el Ministerio de Salud, Dirección Regional Central Este - Área Rectora de Salud Cartago (en adelante la "orden sanitaria" impugnada) hasta tanto se resuelva el proceso de cognición encaminado a su anulación y, por el otro, en la gestión se sostiene y parte de que la responsabilidad técnica y legal del relleno sanitario corresponde a la empresa desarrolladora WPP Continental de Costa Rica S.A, quien indica ostenta la viabilidad ambiental del proyecto, premisa de la cual se parte todo lo indicado en la gestión cautelar de referencia y se solicita se disponga y así proceda a los efectos de la presente causa.
En términos generales, la parte accionante indica lo siguiente sobre los presupuestos de la tutela cautelar: En cuanto a la denominada "apariencia de buen derecho" o "Fumus boni iuris", en síntesis, señala que la orden sanitaria impugnada CARTA-MS-DRRSCE-DARSC-OS-0020-2025, cuyos efectos busca suspender la gestión, fue notificada en fecha 13 de febrero de 2025, y se procuró en su contra una medida cautelar, así como revocatoria con apelación en subsidio mediante oficios N° AM-OF-139-2025 y AM-OF-141-2025. Señala también la parte actora que la revocatoria y la apelación fueron rechazados mediante resoluciones N° MS-DRRSCE-0170-2024 y N° MS-DM-CP-1732-2025, la última comunicada el 01 de abril de 2025. Asimismo, señala que las acciones de la citada orden sanitaria tienen relación con el proceso de mantenimiento de disposición de desechos sólidos en el relleno sanitario Los Pinos, situado en Dulce Nombre de Cartago, a 2,3 kilómetros del Campo Ayala, desarrollado por la empresa WPP Continental de Costa Rica S.A. y en concreto el proyecto denominado "Cierre técnico del vertedero Navarro y construcción del Relleno Sanitario Los Pinos" se desarrolla en el terreno cubierto por los planos C-409236-1980 y C-572610-1985, según resolución N° 0618-2025-SETENA.
Ahora bien, señala la parte accionante que la orden sanitaria adolece de vicios de nulidad absoluta, en cuanto a su motivación por cuanto si se analiza el Informe Técnico n.° CARTA -MS-DRRSCE-URS-IT-0016-2025 no se evidencia un incumplimiento por parte de la Municipalidad de Cartago en cuanto las obligaciones relativas al manejo y operación del Relleno Sanitario Los Pinos, dado que el informe pone de manifiesto que las responsabilidades en la gestión de dicho relleno corresponden de manera exclusiva a la empresa WPP Continental Los Pinos S.A., quien es la encargada de la operación y mantenimiento del relleno sanitario (ver imagen 06 del legajo de medida cautelar). Indica la parte accionante que a pesar de ser la empresa privada antes citada la encargada de la operación y mantenimiento del relleno, la orden sanitaria de forma arbitraria le impone obligaciones referidas en imagen 06 del legajo de medida cautelar.
Adicional a lo anterior, señala que dicha orden no solo es antijurídica por carecer de motivación técnica, sino también por cuanto la Secretaría Técnica Nacional Ambiental (SETENA) mediante oficio N° SETENA-AJ-0265-2020 ha dejado claro que el cumplimiento de los compromisos ambientales derivados del proyecto le corresponde a la empresa desarrolladora, quien es la legitimada para solicitar la modificación del proyecto y adquirió los derechos y deberes sobre el área, no un tercero aunque sea el propietario registral. En el mismo sentido cita en apoyo de su posición la parte accionante la resolución N° 0618-2025-SETENA. Así las cosas, la parte accionante sostiene que la orden sanitario impugnada tiene vicios sustanciales que afectan su validez y eficacia (ausencia de motivación) indicando finalmente lo siguiente sobre el primer presupuesto cautelar: "(...) En el caso concreto la apariencia de buen derecho, para acoger la suspensión de los efectos de la orden sanitaria n.° CARTA-MS-DRRSCE-DARSC-OS-0020-2025 que se solicita como medida cautelar, tiene sustento en la incompetencia material de la Municipalidad de poder actuar, pues la viabilidad ambiental del proyecto no ha sido otorgada a esta, por el contrario, corresponden a la empresa desarrolladora, WPP Continental Los Pinos S.A., así, como en la ausencia de motivación al ser dictada la orden sanitaria con base en un informe técnico que no establece responsabilidad alguna de esta Municipalidad." (ver imagen 08 del legajo de medida cautelar, destacado propio).
En lo referente al peligro en la demora luego de realizar un desarrollo general de dicho presupuesto de la tutela cautelar, la municipalidad accionante indica lo siguiente: "(...) En este caso, en la orden sanitaria de mérito la Municipalidad de Cartago se ve obligada a asumir responsabilidades y realizar inversiones significativas de fondos públicos en labores que, además de que no tienen un sustento técnico, claramente, no le corresponden, pues las obligaciones son de la empresa WPP Continental Los Pinos S.A." (ver imagen 09 del legajo de medida cautelar). De seguido la municipalidad accionante procede a realizar lo que denomina como individualizar el impacto de la orden cuya suspensión solicita desde los puntos de vista operativo, financiero, presupuestario, tarifario y de gestión del recurso humano. En síntesis, sobre el impacto operativo (apartado 2.1 de su gestión) alega la municipalidad que según oficio AOM-OF-105-2025 que suscribe el encargado del Área de Operaciones municipal, la municipalidad carece de los recursos técnicos, humanos y financieros necesarios para cumplir con lo indicado en la orden sanitaria, pues nunca ha estado bajo la responsabilidad municipal lo ahí indicado y tratarse de funciones que competen al operador según la viabilidad ambiental, de manera que implicaría una inversión significativa aún no cuantificada e incluso en lo correspondiente a la planta de tratamiento de lixiviados ahí se recibe lixiviados depositados en propiedad privada (de la empresa WPP antes citada) por lo que implicaría destinar recursos públicos para atender un problema de origen privado.
Se indica en dicho apartado por parte de la municipalidad algunos de los detalles que requiere la intervención según la orden sanitaria que se pide suspender, así como las eventuales contrataciones que implicaría, debido a que sostiene que la municipalidad no cuenta con el personal ni los equipos adecuados para estas labores. Finalmente señala que únicamente para estudios y diseños se estima una inversión inicial no menor a los ciento cincuenta millones de colones, sin considerar la ejecución ni su mantenimiento a largo plazo. Sobre el impacto presupuestario (apartado 2.2.), en síntesis, señala que según oficio PL-OF-040-2025 mantener los efectos de la orden sanitaria resultaría particularmente grave dado que implica comprometer recursos asignados con un destino específico en el presupuesto municipal para el período 2025 (partida 1.04.06) que tienen como finalidad cubrir el pago por concepto de servicio de tratamiento y disposición final de residuos sólidos, de manera que la orden sanitario obliga a la municipalidad a asumir nuevas tareas no contempladas en el Plan de Trabajo Anual, lo que califica como una reasignación indebida de fondos públicos que serían desviados de su propósito original e insuficientes para atender los costos asociados de la ejecución de dichas acciones.
En síntesis, indica lo siguiente en este sentido: "(...) el peligro en la demora se materializa en la posibilidad e que, mientras se resuelve el proceso de cognición plena dirigido a solicitar la anulación de la orden sanitaria, la Municipalidad se vea obligada a ejecutar inversiones significativas, sin contar con la previsión presupuestaria, afectado el equilibrio financiero institucional y destinando fondos públicos a funciones que competen a un privado" (ver imagen 12 del legajo de medida cautelar). Sobre el impacto en la gestión de los recursos humanos institucionales (apartado 2.3), en síntesis, alega la municipalidad que según oficio RH-OF-356-2025 del Departamento de Recursos Humanos, dentro del Manual de Puestos vigente no existe ningún perfil que contemple las funciones detalladas en la orden sanitaria, de manera necesario crear nuevos cargos haciendo referencia a los pasos necesarios al efecto, incluyendo un análisis financiero para evaluar el impacto de eventual creación de las plazas y si de dicho análisis se determina la viabilidad financiera, se deberá entonces obtener la autorización presupuestaria y modificar el Manual de Puestos institucional, y solo así iniciar un proceso de reclutamiento y selección de personal, por lo cual señala que se evidencia un riesgo institucional de carácter "grave" pues se obliga a la municipalidad a ejecutar de inmediato funciones para las cuales no cuenta con la estructura ni el recurso humano requerido.
En último término, sobre el impacto tarifario señala la municipalidad que según oficio AAF-OF-102-2025 del Área Administrativa Financiera municipal de mantenerse los efectos la municipalidad se vería obligada a asumir gastos por más de mil doscientos noventa y cuatro millones de colones en un período de 15 años, con un costo inicial de cuatrocientos catorce millones de colones solo en el primer año, lo cual indica tendría que trasladarse a los usuarios mediante un aumento tarifario del 78,12% que se suma a un incremento previo ya aprobado en diciembre de 2024. Adicionalmente, en este extremo, sostiene también que se proyecta un incremento sostenido del 17.43% durante los siguientes catorce años, lo que indica impactaría de forma desproporcionada a una población vulnerable ya que más del 67% de los habitantes del cantón se encuentran en condición de vulnerabilidad social, según datos del IMAS, lo que califica como un daño irreversible en el equilibrio tarifario y social del servicio público que afecta la capacidad de pago de las familias cartaginesas.
Ahora bien, en cuanto al tercer presupuesto de la tutela cautelar, lo relativo a la ponderación de intereses en juego es desarrollado por la municipalidad accionante en el apartado 3 de su gestión señalando, en síntesis, que según el referido oficio AAF-OF-102-2025 se presenta informe técnico sobre el impacto económico de dichas acciones que se basa en al nota técnica remitida por la empresa WPP Continental de Costa Rica S.A., en la cual se estiman los costos anuales de las labores, señalando la municipalidad que de asumirse las acciones que detalla la orden sanitaria debe trasladarse dichos costos a los contribuyentes mediante ajustes tarifarios, según el análisis financiero municipal, lo cual implicaría el aumento tarifario antes referido, lo cual considera como desproporcionado para la población y que afecta su capacidad de pago y acceso a servicios públicos esenciales, lo que además debe contextualizarse dentro del panorama socioeconómico del cantón de Cartago que según datos del IMAS tiene hasta un 67% de personas en situación de pobreza y vulnerabilidad social.
Así las cosas, en lo medular, la parte accionante indica que el aumento tarifario proyectado tendría un efecto directo en el encarecimiento del costo de vida, agravando las condiciones socioeconómicas de la población en Cartago. Por último, respecto de la ponderación de intereses, destaca la parte accionante que la suspensión cautelar de la orden sanitaria no perjudica el interés público, por cuanto no se ha acreditado incumplimiento alguno por parte de la municipalidad, por el contrario, sostiene que la responsabilidad técnica y legal del relleno sanitario le corresponde a la empresa desarrolladora WPP Continental de Costa Rica S.A. quien es la que ostenta la viabilidad ambiental del proyecto. Así las cosas, la municipalidad argumenta lo siguiente sobre la ponderación de intereses en este caso: "(...) En este sentido, mantener los efectos de al orden sanitaria mientras se resuelve el fondo del proceso de conocimiento significaría una afectación seria y concreta del equilibrio presupuestario de la Municipalidad, así como al bienestar económico de decenas de miles de habitantes. // Aunado a lo anterior, la ponderación de intereses debe tomar en cuenta la naturaleza de la medida cautelar como provisional e instrumental, esta medida no tiene efectos definitivos, sino que busca evitar la concreción de un perjuicio irreparable mientras se resuelve el proceso de conocimiento que será incoado para solicitar la anulación de la orden sanitaria. // En suma, al ponderara los intereses en juego, la suspensión de los efectos de la orden sanitaria resulta ser una medida razonable y proporcional, que no solo protege los recursos públicos de la Municipalidad de Cartago, sino que también garantiza que los intereses públicos sean respetados, sin que se cause un perjuicio irreparable a ninguna de las partes involucradas" (ver imagen 16 del legajo de medida cautelar). Ofrece la municipalidad como prueba los siguientes elementos, visibles en el apartado correspondiente en imágenes 16 a 18 del legajo de medida cautelar y aportados en CD:
En síntesis, tanto el ESTADO como parte accionada como también el tercero interesado WPP CONTINENTAL LOS PINOS S.A. han solicitado que la gestión cautelar sea rechazada dando sus propias razones. IV. A) POSICIÓN DEL ESTADO ACCIONADO: En síntesis, el ESTADO (Ministerio de Salud) como parte accionada se refiere a la medida cautelar solicitando su rechazo por no concurrir en la especie los requisitos esenciales para el acogimiento de una medida de tal naturaleza. En su argumentación la representación del Estado accionado realiza primero un recuento del objeto de lo peticionado, así como de lo dispuesto en la orden sanitario que se pide suspender, señalando que "(...) el Gobierno Local interpone la presente gestión cautelar al considerar que, lo ordenado en la gestión cautelar es improcedente ya que todo lo relacionado al manejo, mantenimiento de disposición de desechos sólidos en el relleno sanitario Los Pinos, es responsabilidad la Empresa WPP CONTINENTAL LOS PINOS S.A, al ser esta empresa quién cuenta con la respectiva viabilidad ambiental otorgada por SETENA para el proyecto “Cierre Técnico del vertedero de Navarro y construcción del Relleno Sanitario Los Pinos” y tener un contrato de por medio el Gobierno Local" (ver página 3 de la respuesta del Estado imagen 259 del legajo de medida cautelar).
Aunado a lo anterior, la representación del Estado indica su posición sobre los argumentos de la municipalidad sobre el impacto operativo, financiero, presupuestario, tarifario y de gestión de recurso humano, cuyas repercusiones señala la parte accionante y hace de conocimiento del despacho que lo relacionado con determinar a quién le corresponde el manejo, atención y desarrollo del relleno Los Pinos es objeto de discusión ya en la causa judicial 23-006078-1027-CA en la cual figura como parte actora la empresa WPP CONTINENTAL LOS PINOS S.A.; y como demandados entre otros, EL ESTADO y la MUNICIPALIDAD DE CARTAGO. Así como también indica que el tema fue objeto de un recurso de amparo del año 2019 y resuelto en el año 2020 (voto N° 2020002374 de las 09:30 horas del 07 de febrero de 2020), el cual involucró al Gobierno Local. Así las cosas, procede a realizar la representación estatal un recuento de lo que denomina como los antecedentes relevantes del presente asunto y el marco jurídico de la disposición final de desecho o residuos en páginas 4 a 12 de su respuesta, para luego entrar a argumentar respecto de los presupuestos de la medida cautelar peticionada.
En cuanto a los antecedentes señala finalmente la representación estatal lo siguiente: "(...) es necesario hacerle ver al Tribunal que el informe técnico (MSDRRSCE- URS-IT-0016-2025 de fecha 21 de enero de 2025) mediante el cual se basa la orden sanitaria que se busca anular, es producto a la ordenanza realizada por la Sala Constitucional mediante la resolución N.°2020002374 (la cual se adjunta), donde se solicita la coordinación de los procesos administrativos requeridos ante inconvenientes y faltas a la salud pública y al medio ambiente, consecuencia del Relleno Sanitario Los Pinos el cual se desarrolla en bienes inmuebles propiedad de la Empresa WPP y la Municipalidad de Cartago, terrenos que, se ubican en la provincia de Cartago y por consiguiente son competencia territorial de dicho Gobierno Local. Es evidente que existen una serie de acciones que se gestionaron en terreno municipal el cual no tiene viabilidad ambiental, así como que, existe una parte del terreno municipal que cuenta con dicha viabilidad, no obstante, refiere al tema de la planta de tratamiento y las obras necesarias para su debido funcionamiento. // Estas apreciaciones son de suma importancia, producto al desarrollo del fondo de la presente contestación de gestión cautelar, especialmente en cuanto a las obligaciones con cuenta la Municipalidad de Cartago según lo establecido por la Constitución Política, la Ley de Gestión Integral de Residuos y su Reglamento, entre otros, más aun teniendo en consideración que, las acciones que se pretenden y ordenan mediante la orden sanitaria son dentro del inmueble propiedad del municipio" (ver imagen 265 del legajo de medida cautelar, destacado propio).
Luego de lo anterior, en el apartado titulado "Sobre la gestión de medida cautelar" señala sobre los presupuestos de la tutela cautelar propiamente dichos, la representación estatal indica, en síntesis, que carece de insturmentalidad y provisionalidad como requisitos estructurales de la tutela cautelar y pretende adelantar un eventual fallo de fondo confirmatorio de sus pretensiones en cuanto a la nulidad del acto sin ser discutido constituyéndose en una pretensión autónoma que busca valerse por sí misma por lo que debe ser rechazada sin más trámite. No obstante lo indicado, sobre la denominada apariencia de buen derecho, en síntesis, la representación estatal sostiene que se encuentra debilitada ya que sin entrar a efectuar consideraciones de fondo, pues no corresponde a esta sede cautelar, el artículo 7 de la “Ley para la Gestión Integral de Residuos” (Ley N.°8838) delimita las competencias que ostenta el Ministerio de Salud en la materia, de forma que lo describe como la autoridad responsable de establecer políticas, regulaciones y mecanismos para garantizar un manejo adecuado y ambientalmente sostenible de los residuos sólidos, en congruencia con su misión institucional.
También refiere que el Ministerio de Salud es el ente rector en materia de monitoreo, evaluación y control en materia de gestión integral de residuos y el mismo artículo 8 del reglamento sobre manejo de residuos sólidos ordinarios (N° 36093-S) delimita las funciones que tienen las municipalidades y les otorga responsabilidad en la gestión integral de los residuos generados en su cantón. También argumenta lo siguiente en este sentido: "(...) De manera específica, los artículos 36 y 37 de dicha ley en concordancia con el “Reglamento general para permisos sanitarios de funcionamiento, permisos de habilitación y autorización para eventos temporales de concentración masiva de personas” (Decreto Ejecutivo N.°43432) y el “Reglamento de parques ambientales para la separación, tratamiento, aprovechamiento y disposición final de residuos sólidos” (Decreto Ejecutivo N.° 44421, artículos 6, 7 y 8), obligan a que toda persona física o jurídica que desarrolle este tipo de actividad cuente con un Permiso Sanitario de Funcionamiento otorgado por dicho Ministerio. // Una vez otorgado el permiso, los funcionarios de las Áreas Rectoras de Salud deberán realizar inspecciones sobre las actividades desarrolladas y el estado de operación del parque ambiental, con el objetivo de que, si hay alguna anomalía o situación que corregir, se enderece a la mayor brevedad en resguardo de la salud y vida de las personas, así como del medio ambiente.
(Decreto Ejecutivo N.°43432, artículos 20-21 y Decreto Ejecutivo N.° 44421, artículo 31 y 33) // Por su parte, la Dirección de Protección Radiológica y Salud Ambiental (DPRSA) del Ministerio de Salud le corresponde realizar los estudios en las áreas de disposición de los residuos sólidos, entre los que se detallan: a) verificación topográfica del área, b) estudios de estabilidad de taludes, que incluyan el monitoreo de desplazamiento, c) análisis de la memoria de cálculo, d) estudios de análisis piezométricos para aguas subterráneas, e) verificación técnica de vida útil disponible, f) nivel de avance de obras dirigidas hacia las obras de cierre y g) cumplimiento de las obras de cierre. (Decreto Ejecutivo N.° 44421, artículo 32) Los resultados que arrojen estos estudios se harán del conocimiento de la Secretaría Técnica Nacional Ambiental, municipalidades, Comisión Multinivel de Residuos del Gobierno Central y cualquier otra institución que tenga relación con la operación de los parques ambientales existentes a nivel nacional. // Para lo anterior, solicitará información periódica sobre la vida útil de los sitios de disposición final de residuos para establecer políticas públicas sobre gestión integral de residuos, conforme al artículo 5 de la "Ley General de Salud" (Ley N.° 5395), que establece: // " “Toda persona física o jurídica, está obligada a proporcionar de manera cierta y oportuna los datos que el funcionario de salud competente le solicite para los efectos de la elaboración, análisis y difusión de las estadísticas vitales y de salud y demás estudios especiales de administración, para la evaluación de los recursos en salud y otros estudios especiales que sea necesario hacer para el oportuno conocimiento de los problemas de salud y para la formulación de las medidas de soluciones adecuadas" (ver imágenes 271 a 272 del legajo de medida cautelar).
Con fundamento en lo expuesto, la posición de la representación estatal es que la orden sanitaria n.° CARTA-MS-DRRSCE-DARSCOS- 0020-2025 se enmarca dentro de las obligaciones y deberes que tiene el Ministerio de Salud respecto a este tema y cuenta con el debido sustento técnico producto del documento MS-DRRSCE-URS-IT-0016- 2025 de fecha 21 de enero de 2025 y que consiste en “Asunto: Visita de inspección interinstitucional al Relleno Sanitario Los Pinos correspondiente al mes de enero del 2025”. Señala que incluso resulta de vital importancia tomar en consideración que producto de dicha visita se logró determinar que la planta de tratamiento se encuentra en terreno municipal sin operación, y que producto de esta situación existe una condición de contaminación descontrolada a un cuerpo de agua natural (Río Agua Caliente), el cual está recibiendo aguas con altos contenidos de carga orgánica, inorgánica, sólidos suspendidos y metales pesados disueltos, entre otros, característicos de los lixiviados generados en rellenos sanitarios, así como malos olores.
Señala también que en el terreno de la Municipalidad de Cartago no se logra observar la canalización pluvial y las cajas de registro, y que para peores se evidencia una zona con residuos expuestos a cielo abierto. En este sentido la representación estatal señala: "Si bien es cierto, las recomendaciones de dicho informe van direccionadas a la empresa WPP CONTINENTAL LOS PINOS S.A.; no podemos obviar que las deficiencias encontradas y citadas en el documento técnico y el cual se basa la orden sanitaria, se encuentran en el terreno propiedad Municipal, siendo esto también responsabilidad del Gobierno Local" (ver imagen 274 del legajo de medida cautelar). Señala también en la misma línea la Procuraduría lo relativo a la ley N° 8839 que establece cómo los generadores de residuos, incluyendo los propietarios de los inmuebles, son responsables de la gestión adecuada de los residuos que generan, aplicando el principio de responsabilidad compartida y existen obligaciones inherentes al Gobierno Local al meditar un tema de protección al medio ambiente y salud pública que la municipalidad no puede obviar o desligarse por completo en un terreno que es de su propiedad (artículos 5 y 8 de la citada ley 169 de la Constitución Política) por lo cual considera que la apariencia de buen derecho está debilitada en el caso concreto.
Acerca del peligro en la demora, la representación estatal señala que respecto de la afectaciones desde el punto de vista operativo, financiero, presupuestario, tarifario y de gestión de recurso humano invocadas por la municipalidad en su gestión, debe traer a colación que la problemática acusada respecto del Proyecto Cierre Técnico del Vertedero Los Navarro y el Relleno Sanitario Los Pinos, no es un asunto de reciente data, sino que tal y como se evidenció en el apartado de antecedentes, existe de por medio un recurso de amparo que trata este asunto desde el año 2019 y que fue resuelto por la Sala Constitucional de la Corte de Suprema de Justicia en el año 2020 señalando lo indicado por la Sala en el considerando XII de dicha resolución, según lo cual sostiene la representación estatal es muy claro que es una obligación y deber del Gobierno Local velar por los intereses del Municipio, siendo el manejo y operación del relleno uno de ellos y no es justificación el conflicto entre el Gobierno Local y la empresa privada cuando el problema implica un deterioro ambiental y en la salud de la población, lo cual le demanda una participación activa según el numeral 169 constitucional, artículo 60 de la Ley Orgánica del Ambiente y 08 de la Ley para la Gestión Integral de Residuos y su respectivo reglamento.
En lo medular, la representación estatal considera que el supuesto daño de imposible o difícil reparación que indica la actora le ocasionaría la orden sanitaria es consecuencia de una deficiente planificación del Gobierno Local, dado que la problemática se viene presentando desde el año 2020 y bajo este entendido señala que el documento AOM-OF-105-2023 se sustenta en meras valoraciones subjetivas sin ningún sustento técnico ni documento que lo respalde y busca justificar la inacción del municipio en sus obligaciones legales. Ahora bien, en cuanto al impacto presupuestario señala el Estado que el documento PL-OF-040-2025 mas bien evidencia que el Municipio cuenta con una partida presupuestaria para atender la gestión de desechos sólidos, lo que ejemplifica la inadecuada planificación y gestión de la problemática, ya que cada año realiza un plan anual, lo cual es una obligación del municipio según lo ordenado por la Sala Constitucional desde el año 2020.
En lo que respecta al impacto de gestión de recursos humanos institucionales, indica que el oficio RH-OF-356-2025 lo que viene es a desarrollar el procedimiento que se requiere para contratar personal a criterio del municipio para atender la orden sanitaria, pero en ningún momento expone imposibilidad legal o material al respecto, lo que en su criterio ejemplifica la inacción y desidia del municipio. Por último, en cuanto al impacto tarifario indica la representación estatal que el documento AAF-OF-102-2025 al igual que el resto de los documentos aportados son documentos realizados por la misma parte lo que les resta objetividad. Asimismo, que le análisis tarifario se realiza con base en una nota de la misma empresa WPP CONTINENTAL LOS PINOS de fecha 30 de setiembre de 20129, sobre el costo de un listado de obras ordenado por SETENA relacionado con un cierre técnico anticipado del relleno, lo que es distinto a lo ordenado por la orden sanitaria de este caso por lo que no hay certeza del costo de las obras y su impacto tarifario.
Sobre la naturaleza del daño alegado señala que el daño alegado no es antijurídico por cuanto es responsabilidad exclusiva de los municipios la gestión integral de los residuos generados en su cantón no pudiendo desligarse de dichas obligaciones que se solicita realizar dentro del terreno que es propiedad de la municipalidad. Para finalizar su argumentación relativa a este segundo presupuesto, indica la representación estatal lo siguiente: "(...) note el juzgador que el conflicto de este asunto se resume, en que a criterio de la Municipalidad de Cartago las obras por realizar en la orden sanitaria, le corresponde a la empresa WPP Continental Los Pinos, esto producto de un contrato que media entre ellos. // Esta situación adquiere relevancia para esta representación ya que el Ministerio de Salud en los mismos términos emitió la orden sanitaria que se discute, emitió la Orden Sanitaria N.° CARTA-MS-DRRSCE-DARSC-OS-0021-2025 para la empresa WPP Continental Los Pinos, razón por la cual, en virtud del contrato entre dichas partes, es que deben coordinar y ponerse de acuerdo para cumplir con lo ordenado por el ente Ministerial con el fin de salvaguardar el medio ambiente sano y ecológicamente equilibrado y por consiguiente la salud y vida de las personas del municipio" (ver imagen 279 del legajo de medida cautelar).
Por último, sobre la protección del interés público la representación estatal destaca que el Ministerio de Salud ha actuado tal como se lo demanda el ordenamiento jurídico en materia de manejo y disposición de residuos sólidos, en tutela de un bien jurídico de primer orden, con el fin de evitar poner en riesgo de un peligro mayor a la población producto de un foco de contaminación que afecta al medio ambiente, salud y vida de las personas, siendo un tema que incluso ha sido declarado de interés público y nacional mediante el Decreto Ejecutivo N° 33477. Es decir, que existe un interés público superior de la vida y al medio ambiente ecológicamente equilibrado que es fundamental para la salud pública y la calidad de vida de las personas, artículos 21 y 50 constitucionales. En este sentido argumenta la representación estatal lo siguiente: "(...) existe una responsabilidad inherente al Estado en el manejo de residuos y la tutela del interés público superior de la vida y al medio ambiente ecológicamente equilibrado fundamental para la salud pública y la calidad de vida de las personas, contemplados en los artículos 21 y 50 de la Constitución Política y en acatamiento a lo dispuesto en el numeral 4 de la Ley General de la Salud (N.°5395) y artículos 1, 2, 4 y 7 de la Ley para la Gestión Integral de Residuos (N.°8839).
Aunado a lo anterior, y de conformidad a lo expuesto a lo largo de este documento, no podemos obviar que es competencia y responsabilidad de los Gobiernos Locales atender en su respectiva competencia territorial todo lo relacionado al manejo de los desechos sólidos. // En consonancia a lo anterior, en este tipo de casos, cuando existe una posible amenaza a la vida o al ambiente debe prevalecer su protección sobre cualquier otro interés, por lo cual se ha de aplicar el principio precautorio de carácter reforzado." (ver imagen 281 del legajo de medida cautelar). Hace referencia en este sentido la representación estatal al numeral 5 de la Ley N° 8839 y al voto 2024-4416 del Tribunal Contencioso Administrativo sobre el peso del interés público sanitario en el juicio de ponderación de intereses, indicando la procuraduría lo siguiente: "En ese orden de ideas, al ser las municipalidades las responsables de la gestión integral de los residuos sólidos generados en su cantón, -lo cual podrán realizar por administración o mediante contratos con empresas o particulares en estricta vigilancia del cumplimiento de las actividades contratadas-, no la desliga de sus responsabilidades otorgadas por ley en cuanto al adecuado y debido manejo de los residuos sólidos, especialmente cuando existen documento técnicos e incluso un voto de la Sala Constitucional, mediante los cuales se establece que la situación actual del Rellenos Sanitario Los Pinos, es un foco de contaminación que afecta al medio ambiente y a la salud pública de las personas, y se requiere de su atención inmediata. // Bajo esta línea argumentativa, el Ministerio de Salud tiene la potestad de dirección, monitoreo, evaluación y control en la materia de gestión de residuos, de conformidad con el artículo 7 de la Ley para la Gestión Integral de Residuos, n.º 8839, del 24 de junio del 2010, por lo que en aplicación del principio precautorio establecido en el artículo 5 de la misma ley, debe controlar que exista un manejo adecuado de los residuos sólidos, conforme los límites de la ley, en resguardo de la salud y del medio ambiente; hecho que se constata y ejecuta con la ordena sanitaria n.° CARTA-MS-DRRSCE-DARSC-OS-0020-2025. // En este caso el Ministerio de Salud actúa en aplicación de los artículos 5 y 7 de la ley n.º 8839 que le otorgan la potestad de dirección, fiscalización y control sobre el manejo de residuos para la protección de la salud pública y el ambiente, por lo que existe un interés público evidente del Ministerio de Salud de que la disposición de la basura se realice en apego del desarrollo sostenible y de la legalidad. // Interés público que, por ende, tiene prevalencia sobre cualquier interés particular de terceros que no encuentre respaldo en el ordenamiento jurídico nacional, y en este caso no es de recibo el argumento, de la afectación que implicaría para la Municipalidad de adoptar las medidas ordenadas por el Ministerio de Salud, ni menos aún para los administrados, siendo que el tema tarifario así como el manejo integral de los residuos del cantón es una tema de planificación, que incluso deben ponderar año con año." (ver imágenes 282 a 283 del legajo de medida cautelar).
En síntesis, sobre este tercer presupuesto la posición del Estado es que el interés público tiene prevalencia sobre el interés particular o de terceros. En apoyo de su posición la representación del Estado señala que estamos frente a un tema de salud pública y de un ambiente sano ecológicamente equilibrado para la población, lo cual incluso fue tratado por la Sala Constitucional en el mismo voto 2020002374 que tiene implicación en el tema del relleno sanitario Los Pinos, por lo cual estamos ante la protección de bienes jurídicos de primer orden y de acogerse la medida cautelar solicitada se estarían desaplicando potestades con las que cuenta el Ministerio de Salud en apego al bloque de legalidad. En este sentido, concluye la representación estatal debe prevalecer el interés público de protección a la salud de la población la cual tiene incidencia directa en el derecho a un ambiente sano y ecológicamente equilibrado, por lo que de acogerse la tutela cautelar mas bien pondría en riesgo la vida de las personas al mantenerse un foco de contaminación latente además de afectar al medio ambiente. Como prueba ofrece los siguientes elementos indicados en la página 29 de su respuesta:
Tal y como ha sido desarrollado por la Sala Constitucional, así como en fallos anteriores de este Tribunal (ver, entre otros, el fallo N°38-2022 de las diez horas diez minutos del doce de enero de dos mi veintidós) la justicia cautelar responde a la necesidad de garantizar el principio constitucional de una justicia pronta y cumplida, al conservar las condiciones reales indispensables para la emisión y ejecución de la sentencia (Resolución 7190-1994, de las 15:24 horas del 6 de diciembre). En este mismo sentido, el artículo 19 del Código Procesal Contencioso Administrativo, establece que el fin de la fijación de una medida cautelar es proteger y garantizar, provisionalmente el objeto del proceso y la efectividad de la sentencia. La doctrina ha indicado que la justicia cautelar no tiene como fin declarar un hecho o una responsabilidad, ni la de constituir una relación jurídica, ni ejecutar un mandato y satisfacer el derecho que se tiene sin ser discutido, ni dirimir un litigio, sino prevenir los daños que el litigio pueda acarrear o que puedan derivarse de una situación anormal (Gallegos Fedriani, Pablo.
Las medidas cautelares contra la Administración Pública. 2 ed. Buenos Aires, Argentina: Ábaco, 2006). En el voto #4074-2010 el Tribunal Contencioso Administrativo señala que: “los presupuestos de la tutela cautelar son tres, el peligro en la demora, la apariencia de buen derecho y la ponderación de los intereses, particularmente el interés público” y “[s]ólo en la concurrencia de los tres elementos, es decir, de la apariencia de buen derecho, del peligro en la demora y que del análisis de ponderación de intereses se considere que daño sufrido por el particular debe tutelarse por encima de los demás intereses en juego, puede proceder el despacho a conceder la medida cautelar solicitada” (Tribunal Contencioso Administrativo, resolución n.° 4074-2010 de las 13:21 hrs. del 29 de octubre de 2010). También el Tribunal de Apelaciones de lo Contencioso Administrativo ha señalado en el mismo sentido: “En el caso de las medidas cautelares, esto implica que, en adición a lo relativo a las características estructurales de instrumentalidad y provisionalidad, la resolución debe explicar de forma clara y suficiente de qué modo concurren o no los presupuestos de apariencia de buen derecho, peligro en la demora y ponderación de los intereses en juego, ninguno de ellos puede ser dejado de lado, pues para la procedencia de la medida que se adopte la ley exige la concurrencia de todos ellos […] si este Tribunal hipotéticamente acogiese los alegatos relativos a este extremo, y entendiera que el elemento de ponderación de intereses sí está presente eso obligaría a este Tribunal en primera y única instancia a entrar a analizar y a desarrollar el tema de ponderación de intereses en una forma que omitió el juez de instancia, por lo cual, como bien lo señaló en su momento la parte, estaría haciendo que este Tribunal sustituya al juzgador de instancia en el análisis en primera o en única instancia de ese elemento, privando a la parte por lo tanto del derecho de recurrir al respecto de lo que se ha indicado" (ver resolución del Tribunal Procesal Contencioso Administrativo, n.° 132-2017-I de las dieciséis horas dieciocho minutos del veintinueve de marzo del dos mil diecisiete.
Cfr. 00:16:24 – 00:21:35 de la grabación digital del fallo correspondiente). Esta posición se complementa con el criterio externado por la Sala Primera de la Corte Suprema de Justicia, en funciones de Tribunal de Casación de lo Contencioso Administrativo, en Voto N° 5-F-TC-2008 de las diez horas con cuarenta y cinco minutos del seis de febrero del año dos mil ocho, respecto de la necesidad de cumplimiento de la carga probatoria en esta fase cautelar, al indicar que "(…) tres requisitos que se aplican como es el fumus bonis iuris o apariencia de buen derecho… el peligro de la demora y la ponderación de los intereses en juego… la apariencia de buen derecho conforme a la nueva legislación no constituye una carga gravosa de demostración de la seriedad de la demanda, sino la valoración incluso interna del juez de que aquella sentencia no es temeraria de que no es carente de seriedad, que es una visión invertida, por cierto, del denominado fumus bonis iuris, este periculum además corresponde a la carga, como carga probatoria para quien pide la cautelar, y esto es así, luego la cautelar es un juicio provisional de ese peligro en la mora no es… una valoración del fondo del proceso… en lo que corresponde al caso concreto (…) y esta Sala luego de deliberar concienzuda y ampliamente como lo hace (…) ha estimado que no están debidamente demostrados los daños y perjuicios graves o de imposible reparación que ameriten la adopción de la medida cautelar en cuestión (…) En definitiva, el Tribunal estima que no se cumple con el principio de la prueba racional de la cautelar que se corresponde con una prueba de equilibrio, si bien es cierto no se requiere de una prueba contundente, porque no puede serlo en la medida cautelar, tampoco lo podemos dejar al arbitrio del solo dicho de quien recurre, hay de por medio también eventuales intereses públicos".
Partiendo del anterior marco normativo y jurisprudencial de análisis y los elementos requeridos para la estimación de una medida cautelar, se procede a realizar el estudio del caso concreto, atendiendo a la exposición de la teoría del caso (posición) y el ofrecimiento de la prueba en esta sede cautelar. Fijado el escenario de análisis y los tres elementos requeridos para la estimación de una medida cautelar, se analiza de seguido el caso concreto.-
Las medidas cautelares para su aprobación requieren la concurrencia de los tres elementos antes indicados (apariencia de buen derecho en su visión invertida casi asimilable a un "fumus non mali iuris", peligro en la mora y el equilibrio de intereses). Además, esta medida cautelar debe ser instrumental, accesoria y provisional, en el tanto procura asegurar la eficacia de la sentencia del expediente principal. VI. A) Interlocutorio (sobre la solicitud de copias de la PGR): Mediante memorial de fecha 19 de mayo de 2025 la representación del Estado indica falta de copias de la prueba ofrecida por la parte accionante mediante CD. Ahora bien, verificado el apartado "de previo" de la contestación del Estado en que desistió de la impugnación por carecer de interés actual, a su vez que solicita a fin de no atrasar el curso del proceso e impulsar el mismo, acceso a dicha información acudiendo al Tribunal para conseguir la prueba y procede a contestar, en criterio de este juzgador la omisión señalada por la representación estatal ha quedado subsanada y se procede entonces a emitir el fallo relativo al presente caso.
VI. B) SÍNTESIS DE LO PETICIONADO: Tal como se indicó previamente con detalle, en síntesis, la parte promovente solicita una medida cautelar de carácter suspensivo e innovativo para que, por un lado, se suspendan los efectos de la orden sanitaria impugnada, y, partiendo de la premisa de que la responsabilidad técnica y legal del relleno sanitario corresponde a la empresa desarrolladora WPP Continental de Costa Rica S.A, quien indica ostenta la viabilidad ambiental del proyecto, premisa de la cual se parte en la gestión de referencia se solicita se disponga y proceda así a los efectos de la presente causa a disponer que le corresponde a dicha empresa el mantenimiento del terreno objeto de la disputa y de la orden sanitaria. En otras palabras, tal como quedó previamente señalado es consistente en una petición de SUSPENSIÓN y una obligación de HACER en la que se pretende que este Tribunal disponga - a partir de la interpretación del ordenamiento jurídico que realiza la parte accionante en su gestión - una orden en la vía de medida cautelar para que se tenga como la responsable técnica y legal del citado terreno a la empresa desarrolladora WPP Continental de Costa Rica S.A. mientras que se tramita el proceso de conocimiento.
VI. C) SOBRE LA CARENCIA DE ELEMENTOS ESTRUCTURALES NECESARIOS PARA LA TUTELA CAUTELAR Y NO CONFIGURACIÓN DEL PRIMER SUPUESTO DE LA TUTELA CAUTELAR: Una vez otorgada la audiencia de ley, este juzgador considera que no se configura ni siquiera el primer requisito para la tutela cautelar, por cuanto la acción formulada carece de la necesaria provisionalidad e instrumentalidad como elementos estructurales necesarios de una solicitud de esta naturaleza. Se ha indicado en por el Tribunal Contencioso Administrativo, sobre los denominados elementos "estructurales" de las medidas cautelares lo siguiente: "Para la determinación de la procedencia de la medida es también importante tomar en cuenta, -tal y como fuera señalado supra y además de los presupuestos ya indicados-, que la medida que vaya adoptarse estructuralmente cuente con las siguientes características: 1.- La instrumentalidad e independencia previa con relación a la sentencia definitiva que se produzca en un proceso principal, cuestión que determina al propio tiempo, la subordinación o accesoriedad de la medida con respecto del proceso principal dentro, o a efecto del cual se dicta. 2.- La provisionalidad, en cuanto su eficacia en principio se agota al momento de dictarse la sentencia de mérito en el asunto principal o cuando las circunstancias así lo impongan.
Es decir, tiene efectos supeditados a la pendencia de aquel proceso, tanto como y, - por otro lado-, a la permanencia en el tiempo de las circunstancias que fuesen tomadas en cuenta para su adopción, características que traen causa de su intrínseca posibilidad de modificación o revocación (eficacia rebus sic stantibus). 3.- La urgencia para evitar el peligro en la mora, nota que justifica las medidas cautelares adoptadas ante causam, prima facie o inaudita altera parte. 4.- La sumaria cognitio, esto es, que este tipo de medidas son adoptadas en virtud de una cognición sumarísima efectuada por el órgano jurisdiccional, sin entrar a prejuzgar sobre el mérito del asunto, que de forma alguna sustituye la plenaria sucesión de pasos que implica el proceso de conocimiento.-" (TRIBUNAL CONTENCIOSO ADMINISTRATIVO. Segundo Circuito Judicial de San 0814-2022-T de las catorce horas cuarenta y cinco minutos del veintitrés de mayo de dos mil veintidós, entre otros).
Analizado lo correspondiente considera este juzgador que la pretensión cautelar de la parte accionante en las condiciones formuladas carece de provisionalidad e instrumentalidad y no es posible ubicar dichos dos elementos, por cuanto se trataría de una pretensión cautelar que por los términos mismos en que ha sido formulada por la parte llevaría implícito tocar el núcleo mismo de la discusión de fondo de las partes involucradas dentro del proceso de conocimiento e inclusive dentro de otro proceso de conocimiento tramitado entre las partes en la carpeta 23-006078-1027-CA en que las mismas partes sostienen diferendo sobre cuál de las dos partes es la encargada del manejo, atención, mantenimiento y desarrollo del terreno en que se ubicó el Relleno Sanitario Los Pinos; por otro lado, la suspensión que se pide de la orden sanitaria emitida por el Ministerio de Salud, según indica la propia parte accionante va encaminada al mismo efecto, es decir, a que se tenga como responsable únicamente a la citada empresa privada WPP (ahora WPP CONTINENTAL LOS PINOS S.A., según indica la empresa como producto de una fusión).
Lo anterior, por cuanto sostiene la parte accionante que en su criterio es dicha empresa a la que le corresponde la responsabilidad legal y técnica del relleno sanitario por ser quien ostenta la viabilidad ambiental del proyecto; de manera que, según su lectura del ordenamiento jurídico, la administración pública sanitaria no puede imponerle las obligaciones señaladas en el acto administrativo cuya nulidad peticiona. Por el contrario, la empresa WPP sostiene que el acuerdo alcanzado con la municipalidad en el año 2020 fue roto y su representada expulsada del terreno por la propia municipalidad que privó el ingreso al inmueble lo que provocó que no pudiera seguir asumiendo el costo del mantenimiento del terreno ajeno al perder los ingresos de operación del Relleno Sanitario Los Pinos (que cesó en mayo del año pasado). Por tal razón, WPP sostiene que la municipalidad no puede pretender que ya sea su representada, ni nadie, asuma el costo de mantener el terreno.
Ahora bien, el ESTADO de Costa Rica en amplios argumentos ya detallados previamente en la presente resolución, sostiene por su lado que el gobierno local sí es responsable y que en acatamiento de lo decidido por la Sala Constitucional el conflicto con la empresa privada no significa que la municipalidad pueda desatenderse de lo que acontece a sus munícipes en el sitio por la existencia del citado relleno. Ni mucho menos que un conflicto legal con la empresa privada, pueda ser una causal justificante para desoír el clamor de la ciudadanía, todo lo contrario, que el ordenamiento sanitario de orden público obliga a la municipalidad a hacer esfuerzos ingentes en su tutela como gobierno local que es y situaciones como la acontecida inciden directamente en el deterioro ambiental y por ende, en la salud de la población por lo que la orden está totalmente ajustada a derecho. En esto consiste el núcleo duro de la discusión de fondo sometida a conocimiento de este Tribunal por las partes de esta causa.
Ahora bien, es el criterio de esta persona juzgadora de primera instancia que la medida cautelar peticionada implica entrar a conocer el nucleo duro de la discusión de fondo de las partes lo que es absolutamente impropio de una sede de tutela cautelar. Ante peticiones similares a las que nos ocupa en este caso, con ocasión de la petición de extender vía medida cautelar la vigencia de una concesión - en aquélla oportunidad la concesión de servicio público de generación de energía hasta que se resolviera el proceso - , conflicto que fue tramitado en el expediente 22-005898-1027-CA, el Superior en esta materia el Tribunal de Apelaciones de lo Contencioso Administrativo y Civil de Hacienda, Sección Segunda, descartó del todo que por la vía de una medida cautelar se pueda entrar a fallar anticipadamente el núcleo mismo de la discusión de fondo del conflicto en una sede de tutela cautelar inicial y establecer una situación no meramente provisional sino que equivaldría a resolver en definitiva desde un inicio el fondo mismo del eventual proceso de conocimiento en una fase cautelar anticipando de dicha manera una resolución favorable a los intereses de una u otra parte, pero no es posible para un Tribunal al conocer de una medida cautelar llegar a sustituir un pronunciamiento propio del fondo del asunto que le correspondería al Tribunal de Juicio o eventualmente incluso un Tribunal de Fallo Directo dentro de una sede de tutela cautelar, lo que no resulta viable y conlleva el necesario rechazo de la tutela cautelar solicitada por los términos en que se ha solicitado, aspecto que puede ser advertido, es decir la falencia de una característica estructural, incluso en cualquier momento del proceso por el Tribunal o por el Superior de manera oficiosa.
En este sentido, ante situaciones similares a las que nos ocupa, en el citado expediente judicial donde igualmente se peticionaba extender vía cautelar el plazo de una concesión a partir de la interpretación del ordenamiento de la parte actora, el Superior en la materia el Tribunal de Apelaciones de lo Contencioso Administrativo y Civil de Hacienda, Sección Segunda, en el fallo N° 079-2023-II de las quince horas cuarenta y siete minutos del veintidós de febrero de dos mil veintitrés, indicó lo siguiente: "(...) parte de la discusión más acalorada del Tribunal que se ha dado a la hora del análisis de este tema se centra en ésa situación, en considerar hasta dónde alcanza y hasta donde es posible considerar una pretensión de tal naturaleza, dentro de la situación que nos ocupa ... arriba a la conclusión que una pretensión en ésas condiciones carece de provisionalidad ... es también falente en cuanto al tema de la instrumentalidad.
Es decir, no es posible ubicar en la especie esos dos requerimientos, efectivamente se trataría de una pretensión cautelar que llevaría implícito tocar el núcleo de la discusión de las partes en el proceso de conocimiento y llevaría implícito no la suspensión de una conducta administrativa como se pretende hacer ver en la pretensión cautelar, sino que lo que llevaría incluido es, ni más ni menos, que venir a sostener que se adopte anticipando una resolución favorable a los intereses de la parte actora..." (Cfr. grabación digital del voto en el expediente judicial 22-005898-1027-CA a la altura de 00:30:29 hasta 00:31:58 de dicha grabación digital, destacado propio). En este sentido, lleva razón la representación del Estado accionado en cuanto a que no se configura el primer requisito de la tutela cautelar, en este caso, por la ausencia de una característica estructural según se indicó previamente.
No ignora este juzgador la diferenciación que se ha realizado en ciertos fallos judiciales sobre el tratamiento que las denominadas características "estructurales" y la denominada "apariencia de buen derecho" como presupuesto de la tutela cautelar; pero aún partiendo de dichas particularizaciones de tratamiento, es el criterio de esta persona juzgadora que no puede tenerse por configurado el primer requisito de tutela cautelar al pretender por la vía de una tutela cautelar zanjar el fondo de la discusión que sostienen las partes para en esta vía de cognición sumaria determinar a partir de la interpretación del ordenamiento jurídico que realiza la parte accionante como único responsable del mantenimiento del sitio a la empresa privada WPP, ya que esto se trataría de una pretensión cautelar que llevaría implícito tocar el núcleo de la discusión de las partes en el proceso de conocimiento y anticipar un resultado favorable a la posición de la municipalidad sobre el conflicto de fondo, lo cual es impropio de la sede cautelar por lo que no se puede tener por acreditado el primer presupuesto de la tutela cautelar.
Así las cosas, aun y cuando los tres presupuestos básicos de la tutela cautelar deben ser analizados en forma de escalerilla, y que la configuración en el caso concreto del primer presupuesto, por lo dicho anteriormente, ha quedado descartada; para efectos de facilitar la tutela judicial efectiva en el presente caso, se realiza el análisis de todos los presupuestos en forma expresa y puntual a los efectos que en derecho correspondan. VI. D) SOBRE LA FALTA DE ACREDITACIÓN DEL DAÑO DE CARÁCTER GRAVE: De previo a proceder con el análisis de este segundo presupuesto cautelar resulta necesario realizar un recuento de los argumentos centrales de las partes en esta disputa: VI.D.1) Posición de la parte actora: En síntesis, el grave daño alegado por la municipalidad se divide en CINCO grandes apartados (operativo, financiero, presupuestario, tarifario y de gestión de recurso humano), todos a partir de la premisa antes dicha, es decir, que la conducta administrativa le impone obligaciones que no son suyas sino de la empresa WPP Continental Los Pinos S.A. En este sentido, en lo referente al peligro en la demora la municipalidad accionante indica lo siguiente: "(...) En este caso, en la orden sanitaria de mérito la Municipalidad de Cartago se ve obligada a asumir responsabilidades y realizar inversiones significativas de fondos públicos en labores que, además de que no tienen un sustento técnico, claramente, no le corresponden, pues las obligaciones son de la empresa WPP Continental Los Pinos S.A." (ver imagen 09 del legajo de medida cautelar).
Nuevamente resulta evidente que se parte de la petición de principio que resulta el punto de partida de la argumentación cautelar formulada, es decir, que el grave daño se deriva de asumir obligaciones que son de la empresa WPP Continental Los Pinos S.A, lo cual como se indicó previamente no es procedente en la sede de tutela cautelar. De seguido la municipalidad accionante procede a realizar lo que denomina como una individualización del impacto de la orden cuya suspensión solicita desde los citados puntos de vista operativo, financiero, presupuestario, tarifario y de gestión del recurso humano. En síntesis, sobre el impacto operativo (apartado 2.1 de su gestión) alega la municipalidad que según oficio AOM-OF-105-2025 que suscribe el encargado del Área de Operaciones municipal, la municipalidad carece de los recursos técnicos, humanos y financieros necesarios para cumplir con lo indicado en la orden sanitaria, pues nunca ha estado bajo la responsabilidad municipal lo ahí indicado y tratarse de funciones que competen al operador según la viabilidad ambiental, de manera que implicaría una inversión significativa aún no cuantificada e incluso en lo correspondiente a la planta de tratamiento de lixiviados ahí se recibe lixiviados depositados en propiedad privada (de la empresa WPP antes citada) por lo que implicaría destinar recursos públicos para atender un problema de origen privado.
Se indica en dicho apartado por parte de la municipalidad algunos de los detalles que requiere la intervención según la orden sanitaria que se pide suspender, así como las eventuales contrataciones que implicaría, debido a que sostiene que la municipalidad no cuenta con el personal ni los equipos adecuados para estas labores. Finalmente señala que únicamente para estudios y diseños se estima una inversión inicial no menor a los ciento cincuenta millones de colones, sin considerar la ejecución ni su mantenimiento a largo plazo. Sobre el impacto presupuestario (apartado 2.2.), en síntesis, señala que según oficio PL-OF-040-2025 mantener los efectos de la orden sanitaria resultaría particularmente grave dado que implica comprometer recursos asignados con un destino específico en el presupuesto municipal para el período 2025 (partida 1.04.06) que tienen como finalidad cubrir el pago por concepto de servicio de tratamiento y disposición final de residuos sólidos, de manera que la orden sanitario obliga a la municipalidad a asumir nuevas tareas no contempladas en el Plan de Trabajo Anual, lo que califica como una reasignación indebida de fondos públicos que serían desviados de su propósito original e insuficientes para atender los costos asociados de la ejecución de dichas acciones.
En síntesis, indica lo siguiente en este sentido: "(...) el peligro en la demora se materializa en la posibilidad de que, mientras se resuelve el proceso de cognición plena dirigido a solicitar la anulación de la orden sanitaria, la Municipalidad se vea obligada a ejecutar inversiones significativas, sin contar con la previsión presupuestaria, afectado el equilibrio financiero institucional y destinando fondos públicos a funciones que competen a un privado" (ver imagen 12 del legajo de medida cautelar). Sobre el impacto en la gestión de los recursos humanos institucionales (apartado 2.3), en resumen, alega la municipalidad que según oficio RH-OF-356-2025 del Departamento de Recursos Humanos, dentro del Manual de Puestos vigente no existe ningún perfil que contemple las funciones detalladas en la orden sanitaria, de manera necesario crear nuevos cargos haciendo referencia a los pasos necesarios al efecto, incluyendo un análisis financiero para evaluar el impacto de eventual creación de las plazas y si de dicho análisis se determina la viabilidad financiera, se deberá entonces obtener la autorización presupuestaria y modificar el Manual de Puestos institucional, y solo así iniciar un proceso de reclutamiento y selección de personal, por lo cual señala que se evidencia un riesgo institucional de carácter "grave" pues se obliga a la municipalidad a ejecutar de inmediato funciones para las cuales no cuenta con la estructura ni el recurso humano requerido.
En último término, sobre el impacto tarifario señala la municipalidad que según oficio AAF-OF-102-2025 del Área Administrativa Financiera municipal de mantenerse los efectos la municipalidad se vería obligada a asumir gastos por más de mil doscientos noventa y cuatro millones de colones en un período de 15 años, con un costo inicial de cuatrocientos catorce millones de colones solo en el primer año, lo cual indica tendría que trasladarse a los usuarios mediante un aumento tarifario del 78,12% que se suma a un incremento previo ya aprobado en diciembre de 2024. Adicionalmente, en este extremo, sostiene también que se proyecta un incremento sostenido del 17.43% durante los siguientes catorce años, lo que indica impactaría de forma desproporcionada a una población vulnerable ya que más del 67% de los habitantes del cantón se encuentran en condición de vulnerabilidad social, según datos del IMAS, lo que califica como un daño irreversible en el equilibrio tarifario y social del servicio público que afecta la capacidad de pago de las familias cartaginesas.
VI.D.2) Posición del ESTADO (Ministerio de Salud): El Estado accionado argumenta que no se configura el peligro en la demora. En este sentido, la representación estatal señala que respecto de la afectaciones desde el punto de vista operativo, financiero, presupuestario, tarifario y de gestión de recurso humano invocadas por la municipalidad en su gestión, debe traer a colación que la problemática acusada respecto del Proyecto Cierre Técnico del Vertedero Los Navarro y el Relleno Sanitario Los Pinos, no es un asunto de reciente data, sino que tal y como se evidenció en el apartado de antecedentes, existe de por medio un recurso de amparo que trata este asunto desde el año 2019 y que fue resuelto por la Sala Constitucional de la Corte de Suprema de Justicia en el año 2020 señalando lo indicado por la Sala en el considerando XII de dicha resolución, según lo cual sostiene la representación estatal es muy claro que es una obligación y deber del Gobierno Local velar por los intereses del Municipio, siendo el manejo y operación del relleno uno de ellos y no es justificación el conflicto entre el Gobierno Local y la empresa privada cuando el problema implica un deterioro ambiental y en la salud de la población, lo cual le demanda una participación activa según el numeral 169 constitucional, artículo 60 de la Ley Orgánica del Ambiente y 08 de la Ley para la Gestión Integral de Residuos y su respectivo reglamento.
En lo medular, la representación estatal considera que el supuesto daño de imposible o difícil reparación que indica la actora le ocasionaría la orden sanitaria es consecuencia de una deficiente planificación del Gobierno Local, dado que la problemática se viene presentando desde el año 2020 y bajo este entendido señala que el documento AOM-OF-105-2023 se sustenta en meras valoraciones subjetivas sin ningún sustento técnico ni documento que lo respalde y busca justificar la inacción del municipio en sus obligaciones legales. Ahora bien, en cuanto al impacto presupuestario señala el Estado que el documento PL-OF-040-2025 mas bien evidencia que el Municipio cuenta con una partida presupuestaria para atender la gestión de desechos sólidos, lo que ejemplifica la inadecuada planificación y gestión de la problemática, ya que cada año realiza un plan anual, lo cual es una obligación del municipio según lo ordenado por la Sala Constitucional desde el año 2020.
En lo que respecta al impacto de gestión de recursos humanos institucionales, indica que el oficio RH-OF-356-2025 lo que viene es a desarrollar el procedimiento que se requiere para contratar personal a criterio del municipio para atender la orden sanitaria, pero en ningún momento expone imposibilidad legal o material al respecto, lo que en su criterio ejemplifica la inacción y desidia del municipio. Por último, en cuanto al impacto tarifario indica la representación estatal que el documento AAF-OF-102-2025 al igual que el resto de los documentos aportados son documentos realizados por la misma parte lo que les resta objetividad. Asimismo, que le análisis tarifario se realiza con base en una nota de la misma empresa WPP CONTINENTAL LOS PINOS de fecha 30 de setiembre de 2019, sobre el costo de un listado de obras ordenado por SETENA relacionado con un cierre técnico anticipado del relleno, lo que es distinto a lo ordenado por la orden sanitaria de este caso por lo que no hay certeza del costo de las obras y su impacto tarifario.
Sobre la naturaleza del daño alegado señala que el daño alegado no es antijurídico por cuanto es responsabilidad exclusiva de los municipios la gestión integral de los residuos generados en su cantón no pudiendo desligarse de dichas obligaciones que se solicita realizar dentro del terreno que es propiedad de la municipalidad. Para finalizar su argumentación relativa a este segundo presupuesto, indica la representación estatal lo siguiente: "(...) note el juzgador que el conflicto de este asunto se resume, en que a criterio de la Municipalidad de Cartago las obras por realizar en la orden sanitaria, le corresponde a la empresa WPP Continental Los Pinos, esto producto de un contrato que media entre ellos. // Esta situación adquiere relevancia para esta representación ya que el Ministerio de Salud en los mismos términos emitió la orden sanitaria que se discute, emitió la Orden Sanitaria N.° CARTA-MS-DRRSCE-DARSC-OS-0021-2025 para la empresa WPP Continental Los Pinos, razón por la cual, en virtud del contrato entre dichas partes, es que deben coordinar y ponerse de acuerdo para cumplir con lo ordenado por el ente Ministerial con el fin de salvaguardar el medio ambiente sano y ecológicamente equilibrado y por consiguiente la salud y vida de las personas del municipio" (ver imagen 279 del legajo de medida cautelar).
VI.D.3) Posición del tercero interesado: Ahora bien, sobre el peligro en la demora la empresa WPP (tercero interesado), en lo medular, señaló que la municipalidad no puede pretender imponerles un empobrecimiento injusto cuando fueron expulsados del sitio por la fuerza hace un año por la misma municipalidad alegando en su momento que no había viabilidad ambiental para trabajar ahí. WPP sostiene que la municipalidad contradice sus propios actos al alegar que su representada es la responsable ambiental de una finca que le pertenece al Gobierno Local argumentando lo siguiente: "(...) Sin que pueda hallarse explicación para semejante contradicción, entonces, la entidad que promueve esta medida cautelar estima que, cuando se trata de llevar a cabo una actividad económicamente productiva, mi representada carece de viabilidad ambiental; pero, para dar mantenimiento al inmueble -que no es de dominio privado, sino un bien público-, según la Municipalidad de Cartago, sí estamos cubiertos por el expediente abierto en la SETENA." (ver imagen 294 del legajo de medida cautelar).
Acepta la empresa WPP que el mantenimiento del terreno es oneroso pero precisamente por ello sostiene que no puede pretender la municipalidad trasladar el costo a su representada sin compensación mediante una petición de tutela cautelar, pues la municipalidad debió haber previsto las consecuencias de su conducta material que ya conocía desde el año 2019. VI.D.4) CRITERIO DEL DESPACHO: Ahora bien, escuchados los argumentos de la parte actora, del Estado y del tercero interesado y analizados los elementos de prueba aportados a los autos, se considera que no se configura el segundo presupuesto de la tutela cautelar, tal como de seguido se detalla. Con respecto del peligro en la demora, se ha indicado antes por este Tribunal, entre muchos otros, en el fallo 009-2021-T de las doce horas y tres minutos del día siete de enero de dos mil veintiuno que: "...para la procedencia de la tutela cautelar se requiere según disposición legal que la ejecución o permanencia de la conducta administrativa sometida al proceso produzca daños o perjuicios graves, actuales o potenciales, a la situación jurídica de la parte promovente.
En ese sentido debe recalcarse que no basta con alegar la existencia del daño (o perjuicio) grave (actual o potencial) sino que debe probarse, situación que implica una carga procesal que debe asumir la parte interesada, al tenor de los artículos 220 del Código Procesal Contencioso Administrativo y el 41 del Código Procesal Civil." Sobre este presupuesto de tutela cautelar se ha indicado también, en su momento "[…] la actual legislación viene a establecer una flexibilización del antiguo sistema procesal que hablaba de “imposible o difícil reparación” – o sea, era rígido –, pasamos de una posición sumamente rígida de demostración de esos daños y perjuicios de “imposible y difícil reparación” a un sistema más flexible, precisamente en la filosofía de apertura de las cautelares […] a un rango de “gravedad” que tienen que llenar los perjuicios. Por lo tanto, hablar de que se tienen que demostrar graves daños de difícil o imposible reparación es una frase que ya no existe […] Pero el límite, y esto es lo que es importante, de justamente que establece el artículo 21 son “graves” la palabra “graves”, de esa gravedad “hacia arriba” procede la cautelar, de esa gravedad “hacia abajo” lo que no pueda entrar y clasificarse como grave no entra dentro del presupuesto de la cautelar.
En otras palabras, si los daños no alcanzan ese rango de “gravedad” la medida no procede […]. (TRIBUNAL PROCESAL CONTENCIOSO ADMINISTRATIVO, Resolución 286-08 de las doce horas treinta minutos del nueve de mayo de 2008. Cfr. 12:34:22 – 12:35:27 de la grabación digital correspondiente, exp. 08-35-1027-CA, destacado propio). Sobre este segundo presupuesto, tal y como se indicó en los considerandos anteriores de esta resolución, para la procedencia de la tutela cautelar se requiere, según disposición legal, que la ejecución o permanencia de la conducta sometida al proceso produzca daños o perjuicios graves, actuales o potenciales, en la situación jurídica del promovente. En ese sentido, debe recalcarse que no basta con alegar la existencia del daño (o perjuicio) grave (actual o potencial) sino que debe probarse, lo cual, como se expuso, es una carga procesal que asume la parte interesada, como lo establecen los artículos 220 del Código Procesal Contencioso Administrativo (CPCA) y el 41 del Código Procesal Civil (CPC) vigente.
En este sentido, este juzgador concluye que el supuesto legal mencionado no se verifica, porque la parte actora no ha aportado elementos probatorios suficientes e idóneos para acreditar la magnitud de "gravedad" de la afectación que alega y que permita calificar con certeza la magnitud del daño que señala en su gestión cautelar como de carácter grave. La pretensión de tutela cautelar de la parte actora se fundamenta en este extremo, en síntesis, en que la conducta administrativa de la parte accionada cuestionada en esta sede y que se califica por la actora como absolutamente nula por razones de forma y fondo le ocasiona un grave daño a la parte accionante al tener que asumir obligaciones que son de la empresa WPP Continental Los Pinos S.A. Nuevamente resulta evidente que se parte de la petición de principio que resulta el punto de partida de la argumentación cautelar formulada, es decir, que el grave daño se deriva de asumir obligaciones que son de la empresa WPP Continental Los Pinos S.A, lo cual como se indicó previamente no es procedente en la sede de tutela cautelar. Ahora bien, como elementos de prueba de este grave daño aporta los siguientes en CD:
POR TANTO
Con fundamento en lo expuesto y de conformidad con los artículos 20 y 21 del Código Procesal Contencioso Administrativo, se RECHAZA y declara sin lugar la solicitud de medida cautelar promovida por la MUNICIPALIDAD DE CARTAGO, en contra del ESTADO, en que interviene como tercero interesado la empresa WPP CONTINENTAL LOS PINOS SOCIEDAD ANÓNIMA, cédula jurídica 3-101-526134.
