MERITS PANEL No. I, SECOND JUDICIAL CIRCUIT, SAN JOSÉ, GOICOECHEA, at sixteen hours and eight minutes on March twenty-first, two thousand twenty-five.- Ordinary proceeding brought by GUILLERMO RAMÍREZ CHAVES, of legal age, divorced, merchant, resident of Quepos, holder of identity card number 4-0134-0202, against the MUNICIPALITY OF QUEPOS, represented by its special judicial attorney, Mr. Lutgardo Bolaños Gómez, Bar Association membership number 15551. Ms. Ana Lía Umaña Salazar, Bar Association membership number 7197, participates as special judicial attorney for the plaintiff.

BACKGROUND:

  1. 1The plaintiff appeared before this jurisdiction, as evidenced by the complaint filed on May 11, 2023, seeking the following principal relief: “1. That this tax civil action for the Administration’s strict liability be granted. 2. That the defendant Municipality be declared liable for the damages and losses caused to the plaintiff, Guillermo Ramírez Chaves (all described above), through the enforcement of the acts annulled by the Third Section of the Administrative Court, specifically Quepos Municipal Mayor’s Office Resolution 001-DEM-ESP-2018 and Official Letter 020-ALCP-DL-2018 of February ninth, two thousand eighteen. 3. That the Municipality be ordered to pay Mr. Guillermo Ramírez Chaves the current value of the building demolished pursuant to the administrative act declared null and void, the amount of which shall be determined during the judgment-enforcement stage. 4. That the Municipality be ordered to pay Mr.Guillermo Ramírez Chaves the full amount of the profits lost from the operation of Balú Bar and Restaurant from the date it was closed pursuant to the annulled acts, February 15, 2018, which we estimate continued through July 1, 2024, the expiration date of the moratorium established by Law 10,000, which was enacted expressly to extend by the same period the 36-month term established by Law 9577 and whose application was approved by the Municipality of Quepos, and which entered into force one day before the expiration of the term under Law 9373. The amount shall be determined during the judgment-enforcement stage. 5. That the Municipality be ordered to pay Mr. Guillermo Ramírez Chaves interest on all such amounts from the date the act was enforced, February 15, 2018, until actual payment. The amount shall be determined during the judgment-enforcement stage. 6. That the Municipality be ordered to pay Mr.Guillermo Ramírez Chaves the amounts that the plaintiff was required to pay his employees in employment severance payments, which shall be calculated during the judgment-enforcement stage, as well as interest on those amounts from the date Mr. Guillermo made the payment until their actual reimbursement. 7. That the Municipality be ordered to pay the plaintiff for the EMOTIONAL DISTRESS suffered as a result of the annulled acts and their enforcement, which emotional distress is estimated at TEN MILLION COLONES, in addition to interest on said amount from the date of the award until actual payment. 8. That the Administration be ordered to pay both categories of costs in these proceedings, as well as interest thereon from the date of the award until actual payment.” In the same filing, he also asserted the following alternative claim: “If compensation is not awarded for the full amount of the profits lost from the operation of Balú Bar and Restaurant from the date it was closed pursuant to the annulled acts, that is, from February 15, 2018, through July 1, 2024, the expiration date of the moratorium established by Law 10,000, we request that such compensation be awarded through the date on which the term prescribed by Law 9577 expired, namely June 27, 2021, or alternatively July 28, 2018, the date on which the moratorium provided for in Law 9373 expired, as applicable.” In a filing dated June 28, 2023, he clarified that the prudent estimate of the damages and losses was 25 million colones.   2. 2Upon service of the complaint on the defendant’s representative, the defendant denied the allegations and raised the defense of lack of legal entitlement. (Images 41–46 of the electronic case file).
  3. 3The plaintiff filed a reply dated November 15, 2023, without submitting additional evidence. (Images 63–65 of the digital judicial case file).
  4. 4The preliminary hearing was held on November 23, 2023; the relief sought in the proceeding was established, the disputed facts were identified, and the parties’ evidence was admitted. (Images 68–71 of the electronic case file and hearing audio in the SIGAO system).
  5. 5The public oral trial was held on March 4, 2025, with all parties present. Opening statements were made, the proffered evidence was received, and oral closing arguments were heard. The case file was declared highly complex pursuant to Section 111 of the Administrative Procedure Code. (Record in the Case Management System).

The statutory requirements and time limits have been observed in these proceedings, and no defects, deficiencies, or omissions are apparent that could render the proceedings void or deny the parties due process. This judgment is issued within the statutory period. This decision is rendered unanimously and following deliberation.

Judge Mejías Rodríguez authored the decision, with Judges Bolaños Salazar and Gómez Chacón concurring.

CONSIDERING:

I. PROVEN FACTS

The following facts relevant to these proceedings are deemed proven: 1. The plaintiff was using a structure built in the public zone of Espadilla Beach in Quepos, Puntarenas, where he operated a bar and restaurant under the name “Balú.” (Undisputed fact).

2. At extraordinary meeting No. 195, held on October 25, 2000, and extraordinary meeting No. 224, held on March 1, 2001, the Municipality of Aguirre denied the operating permits and ordered the eviction and destruction of the Balú establishment. (Undisputed fact).

3. In case file 01-000192-0163-CA, the challenged resolutions were stayed by way of an interim measure. (Undisputed fact).

4. By Judgment 497-2016, dated March 31, 2016, the Administrative and Tax Civil Court, in case file 01-000192-0163-CA, dismissed the action filed by the present plaintiff against the Municipality, challenging the resolutions adopted by the Municipality of Aguirre at extraordinary meeting No. 195, held on October 25, 2000, and extraordinary meeting No. 224, held on March 1, 2001, which denied the operating permits and ordered the eviction and destruction of the Balú establishment. Insofar as relevant, that judgment states that the plaintiff cannot benefit from his grandfather’s contract with the ITCO, which expired on May 21, 1974, and that the implied extension under Article 141 of the ITCO Law does not apply; that any transfer of licenses or permits requires authorization from the appropriate administrative authority; and that the plaintiff cannot claim rights of use and exploitation in the maritime-terrestrial zone because he lacks authorization from the Municipality of Aguirre.

It states: “…the plaintiff has been conducting his commercial activity for a very long time entirely outside the law.” It rejects the contention that the plaintiff has a vested right or a legally consolidated status arising from his irregular occupation. Finally, it states that the payments made by the plaintiff were made at his own risk and may be covered by Transitional Provision VII of Law 6043. It rejects his claims for compensation (emotional distress and material damages) in the absence of a lawfully acquired right, upholds the Municipality’s decision to order the eviction and demolition of the Balú Bar structure, and finds that commercial activity and the sale of alcoholic beverages are incompatible with the land use applicable to the public zone. 5. By Resolution 15, Article 7, of ordinary meeting 052-2016, dated November 15, 2016, the Municipal Council of Quepos resolved to avail itself of the moratorium under Law 9373. (File “ACTA052-2016-15-11-16-O.pdf” on the evidentiary USB drive).

6. On June 29, 2017, the First Chamber of the Supreme Court of Justice, through Decision 000750-S1-2017, denied the appeal on points of law against Judgment 497-2016 in case file 01-000192-0163-CA. (Images 134–139 of the file “Expediente-180019341027CA-Completo_compressed.pdf” on the evidentiary USB drive).

7. By means of official letter UTA-006-18 dated 18 de enero de 2018, the Municipal Environmental Technical Unit conducted an inspection of Restaurante Balú and other establishments, stating, as relevant: “…b) Given the characteristics of the surrounding areas, it may be considered that the structures present at the site obstruct the continuity of the vegetative system characteristic of a sandy beach area. This could, to some extent, affect the continuity of the ecosystem and the energy exchange among the organisms present at the site… The existence of buildings in the beach area, as well as the presence of light-emitting sources (as seen in the case of Restaurante Balú), becomes a serious problem that may affect the nesting that may sporadically occur at the site. First, because concrete structures and buildings in general limit and restrict potential nesting sites for sea turtles. Furthermore, and no less importantly, white-light illumination of the beach affects hatchlings as they make their way toward the sea, guided by the light visible on the horizon offshore, following a light gradient between the sky and the ocean.

When artificial lights, such as commercial, residential, security, or recreational lights, illuminate nesting beaches, hatchlings move inland, where they can easily die after being crushed by a vehicle, preyed upon, or exposed to the sun. In the case of adult females, lights on the beach trigger an adverse response that deters them from nesting. Both outcomes are reflected in a reduction in the capacity of nesting colonies to produce new individuals and perpetuate their species. For example, data from an analysis of coastal lighting in communities at Playa Grande and Tortuguero confirm that turtles prefer to nest outside areas affected by artificial lights from buildings adjacent to the coast. d) The presence of electrical wiring (of deplorable quality and with makeshift connections) in the area, surrounding and hanging from palm and almond trees, in an area commonly traversed by large numbers of wildlife, including birds, mammals (such as troops of monkeys of different species), and reptiles, poses an imminent risk of electrocution to these organisms. e) Wastewater management at the site is carried out by means of a septic tank, which, due to its location, age, form, and type of construction, could eventually cause seepage both into the stream located southeast of the infrastructure and into the sea… e) The area where this infrastructure is located lies within a sector that may be described as a biological corridor (corredor biológico), connecting areas of secondary forest, beach, and mangrove from Punta Quepos, the mountainous areas of the canton, and Parque Nacional Manuel Antonio, thereby allowing species to move along this route and facilitating genetic exchange, feeding, and shelter for many organisms.

The presence of human-made structures limits, hinders, and affects this interconnectivity, degrading the area’s natural characteristics. f) Because the site is a beach area, ordinary access by solid-waste collection trucks is impossible; therefore, the manner and means by which such waste is handled are unknown… g) The presence of buildings and tidal-containment mechanisms (sandbags) limits the natural dynamics of the coastal area, which may affect the ecosystems present at the site by impeding the natural movement of sediment and water flow. Moreover, proximity to water sources (without observing the protection zones established by law) restricts water flow and promotes excessive sediment movement that gradually causes significant erosion, affecting marine organisms’ exchange of solar energy…”. 8. On 9 de febrero de 2018, the Municipal Mayor’s Office issued resolution 001-DEM-ESP-2018, ordering the eviction and demolition of Restaurante Balú, which was served on the plaintiff on 14 del mismo mes y año. As relevant, that act stated in its “Por tanto”: “…Having analyzed the background concerning the presence of the building housing the commercial establishment known as Restaurante Balú, as well as the legal considerations set forth above in the recitals of this resolution, it is ordered: 1- To demolish the facilities located in the public zone (zona pública) of Playa Espadilla corresponding to the commercial establishment known as Restaurante Balú; 2- To commission the Maritime-Terrestrial Zone Department (Departamento de Zona Marítimo Terrestre) to serve this resolution upon Mr. Guillermo Ramírez Cháves, identity card number 4-0134-0202, for purposes of applying Articles 12, 13, and 20 of Ley 6043 and Article 22 of its Regulations; 3- To grant Mr.

Guillermo Ramírez Chaves, identity card number 4-0134-0202, a period of 10 business days to voluntarily vacate and demolish the buildings of the establishment known as Restaurante Balú. 4- Should Mr. Ramírez Cháves fail to comply with the order within the period granted, the municipal administration, under the coordination of the head of the ZMT Department, shall proceed with the eviction and demolition of the aforementioned structure, the cost of which shall be borne by the regulated party, Ramírez Cháves.” Likewise, the statement of reasons for the act refers to municipal resolution N°4 under Article 2 of session 34-2002, as well as the exception under Ley 9373 due to environmental damage, according to technical opinion UTA-006-18 issued by the head of the Environmental Technical Unit of the respondent municipality. 9. On 15 de febrero de 2018, the “Balú” facilities were closed, and they were closed again on 22 de febrero de 2018. (Images 15 and 29 of the file “Expediente-180019341027CA-Completo_compressed.pdf” on the evidentiary USB flash drive).

10. On 20 de febrero de 2018, the plaintiff filed a motion for reconsideration with a subsidiary appeal (recurso de revocatoria con apelación en subsidio) against resolution 001-DEM-ESP-2018. (Undisputed fact).

11. On 22 de febrero de 2018, by means of resolution RV-DLM-001-2018, the motion for reconsideration against resolution DLM-001-RAM-150218 was denied. (Images 6-13 of the file “Expediente-180019341027CA-Completo_compressed.pdf” on the evidentiary USB flash drive).

12. By means of resolution 002-DEM-BL-2018 of 12 de marzo de 2018, corrected and clarified in official letter 048-ALCP-DL-2018 the following day, the Municipal Mayor of Quepas denied the motion for reconsideration and ordered that the matter and the case file be forwarded to the Third Section of the Administrative Litigation Court (Tribunal Contencioso Administrativo Sección tercera) for consideration of the subsidiary appeal. 13. By means of official letter 393-ALCP-2018 dated 15 de marzo de 2018, in response to the filing of an application for interim relief (medida cautelar) in judicial case file 18-001644-1027-CA, the demolition was provisionally stayed. (Image 134 of the file “225-2023 Expediente 01-DEM-ESP-20218.pdf” on the evidentiary CD).

14. On 17 de mayo de 2018, by means of resolution 319-2018 in case file 18-001644-1027-CA, the application for interim relief filed against resolution 001-DEM-ESP-2018 was denied. (Images 139-142 of the file “225-2023 Expediente 01-DEM-ESP-20218.pdf” on the evidentiary CD).

15. By means of official letter 687-ALCP-2018 dated 4 de junio de 2018, the Mayor’s Office revoked official letter 393-ALCP-2018 and ordered the continued enforcement of resolution 001-DEM-ESP-2018. (Image 145 of the file “225-2023 Expediente 01-DEM-ESP-20218.pdf” on the evidentiary CD).

16. On 17 y 18 de julio de 2018, the “Balú” facilities were demolished. (Image 167 of the file “225-2023 Expediente 01-DEM-ESP-20218.pdf” on the evidentiary CD).

17. By means of official letter PC-ARS-Q-IT-101-2018 dated 18 de julio del 2018, the Ministerio de Salud submitted an inspection report stating, as relevant: “… 1. A septic tank is observed with a PVC pipe directing the water toward a drain. This drain extends to the channel of a receiving water body whose waters discharge directly into Playa Espadilla in Quepos. 2. During a visit conducted jointly with personnel from the Inspection Unit of the Municipalidad de Quepos, it was observed that the drain is located on the sand and was constructed using river stones, corrugated drainage pipe, and black plastic… The wastewater treatment system (sistema de tratamiento de aguas residuales, STAR) of Restaurante Balú in Manuel Antonio de Quepos could hardly have functioned correctly because it was constructed in sand, also considering that wastewater spills into the environment had even been observed in other instances and that the same problem had arisen at other times.

There was a significant risk of fecal contamination of the beach at Manuel Antonio due to the location of the drain, since, at times of high tide, the likelihood that water containing fecal matter would escape (because of the water table) was imminent, particularly considering the presence of a receiving water body at the end of the STAR… a. Because the septic tank and drains were installed in sandy soil, they were directly affected by the tide, causing these types of structures to fill with water whenever the tide rose. This limited the storage capacity of the septic tanks and the operation of the drains. b. Salinization within the wastewater treatment system caused a change in its pH, affecting the optimal environment for the growth of microorganisms necessary to decompose organic matter. c. The installation or construction of septic-tank and drainage-type wastewater treatment systems promotes the salinization and contamination of aquifers as a result of disruption of soil layers, particularly in coastal areas due to seawater intrusion. d. Through drains and/or cracks in the tanks of the wastewater treatment system, fecal coliforms from wastewater are drawn toward the beach by suction caused by the flow of water as the tide recedes. e. 18. By means of resolution 267-2019 dated 12 de febrero de 2019, the Concejo Municipal de Quepos resolved to avail itself of the moratorium under Ley 9577. (File “ACTA267-2019-12-02-2019-ORDINARIA.pdf” on the evidentiary USB flash drive).

19. By means of Resolution 519-2019 at 11:15hrs on 23 de octubre de 2019, Section III of the Administrative Litigation Court, acting as the Non-Hierarchical Superior (Jerarca Impropio), heard the appeal (recurso de apelación) and annulled Resolution 001-DEM-ESP-2018. As relevant here, that administrative act provided: “Having reviewed the documentation submitted, this Court concludes that the Municipal Mayor’s Office erred in its reasoning. It must first be clarified that there are not two grounds for exclusion from the moratorium in question, as the Municipality interprets it, but only one: the existence of a final judicial or administrative decision ordering closure or demolition on the grounds of environmental damage or hazard, an element that is absent in this case. First, the judgment relied upon, namely No. 497-2016, issued by the Administrative Litigation and Civil Treasury Court at dieciséis horas y treinta minutos del treinta y uno de marzo de dos mil dieciséis in expediente 01-000192-0163-CA, and affirmed by the First Chamber of the Supreme Court of Justice through Resolution 000750-S1-2017 at nueve horas quince minutos del veintinueve de junio de dos mil diecisiete, does not order the closure or demolition of the appellant’s commercial establishment; rather, it rejects his claim for annulment directed against the Municipality’s decision to that effect.

Insofar as it dismisses the action and the principal claim for annulment, the judgment in question does not issue the closure and demolition order on which the Municipality seeks to rely, nor does it make a declaration creating any right. The difference is not insignificant, as it might appear at first glance. Consequently, the actual demolition order is administrative in nature and was adopted by the Municipal Council of the Canton then known as Aguirre during extraordinary sessions 195 del veinticinco de octubre de dos mil and 224 del primero de marzo de dos mil uno, in which it denied the petitioner’s application for operating permits and instructed the administration to initiate eviction and demolition proceedings. Thus, what is relevant for present purposes is that said administrative decision was based on the absence of a municipal license and not on environmental damage or hazard; consequently, that decision was implicitly modified by Agreement 15 of Article 7 of ordinary session N° 052-2016, which approved the application of Ley 9373.

In other words, because when the latter agreement was adopted there was no judicial or administrative decision against the appellant ordering the closure, eviction, or demolition of the structure due to environmental damage or hazard, Restaurante Balú became protected by the moratorium established in the cited law. From this follows a necessary clarification: the Municipality was barred from acting against that legal situation unless it first issued an administrative decision establishing the environmental damage or hazard. A report prepared by an internal department of the Municipality is insufficient for that purpose; for it to produce the effects sought by that Municipal Corporation, the act must result from an administrative proceeding (procedimiento administrativo) in which the environmental damage has been established while respecting the potential affected party’s constitutional guarantees.

Accordingly, the report prepared by the Municipality’s Unidad Técnica Ambiental is not, by itself, sufficient to establish the existence of environmental damage and hazard, as the Municipal Mayor’s Office assumed. Under those same criteria, and subject to the clarifications previously set forth for this specific case, the appeal filed must be granted and Resolution 001-DEM-ESP-2018 of the Municipal Mayor’s Office of Quepos, Official Letter 020-ALCP-DL-2018 of nueve de febrero de dos mil dieciocho, must be declared null and void.” (Images 189-195 of the file ““Expediente-180019341027CA-Completo_compressed.pdf” on the USB flash drive submitted as evidence).

20. By means of Official Letter UTA-325-18 dated 3 de diciembre de 2018, the Unidad Técnica Ambiental estimated the amount to be collected for the demolition of Bar Balú. (Images 218-219 of the file “225-2023 Expediente 01-DEM-ESP-20218.pdf” on the evidentiary CD).

21. By means of Official Letter MQ-AJ-103-2023 dated 21 de abril de 2023, the Legal Advisory Office of the respondent stated that charging the plaintiff for the demolition was improper in light of Resolution 519-2019 issued by the Non-Hierarchical Superior. (Images 243-244 of the file “225-2023 Expediente 01-DEM-ESP-20218.pdf” on the evidentiary CD).

22. María de los Ángeles Chaves Miranda, the plaintiff’s mother, testified at the oral and public trial. She explained that Restaurante Balú arose from a concession (concesión) granted to Octavio, her father-in-law, on the beach; he was told that he had to build something in less than 2 years. It was the ITCO, and he and his children built cabins and a place to wash clothes. Later, her husband, Octavio’s son, took an area of what had previously been Bar Mar y Sombra and established Bar Balú there. Don Octavio arrived around the 60s, her husband (Manuel) arrived in the 70s, and several years later her husband transferred the right to his son. She stated that her son paid taxes to the Municipality and the Ministerio de Salud, which was why the business operated, because everything was in order. A gentleman named Don Víctor inspected the business licenses (patentes) and told them that everything was in order. “Oivatco” was a company; its name was the father-in-law’s name spelled backward, and they issued shares, of which her son held one and used it to operate at that location. She clarified that Balú had been part of a rancho belonging to Mar y Sombra but was separated as a right for her son, although the payments were made jointly. (Audio and video in SIGAO).

23. Subsequently, testimony was received from Vielka Cubero Moya, who was the plaintiff’s partner from 2009 until their relationship ended in 2021. She stated that he owned and operated a commercial business on Playa Espadilla in Manuel Antonio, a restaurant; the property was demolished, she believes, in 2018, before the pandemic. The Municipality told him that he had 15 days to vacate and that the property was going to be demolished. By then, she had already been with the plaintiff for many years and knew about the problems with the Municipality; it was already known that the Municipality intended to remove him and force him off the beach. He is an extremely strong and courageous person who hardly ever expresses his emotions, but what he did was seek out his attorneys to address what the Municipality was notifying him of. It affected his health. Despite being a strong person—she had never seen him cry—he was someone who worked excessively and found it difficult to express his feelings.

He was chubby but stopped eating, lost a great deal of weight, ate very poorly, and devoted himself to trying to create a new business and becoming involved in religious matters. He became a sad person, withdrew from her and his children, and isolated himself from her because he did not want people to know how he felt. He had always been an extremely hardworking person. (Audio and video in SIGAO).

24. Next, the witness Silvia María Ramírez Chaves, the plaintiff’s sister, was called. She explained that her brother had operated Restaurante Balú for more than 40-45 years; she worked there, and the income paid for her university education. Balú, Mar y Sombra, and the cabins were held by a company, but everything had been arranged through her grandfather. There are now many people and several businesses in the area; initially, the property was obtained through the ITCO. Payments were made to the Municipality, and they had receipts for everything. It was a wooden rancho-style restaurant; it was nothing extravagant, but an ordinary establishment consisting of a small house, with the restaurant also located on the beach, where food was served. It had something like a roof and small tables, nothing sophisticated or large. In 2018, the Municipality demolished the structure. His father had transferred the liquor and other licenses to him; payments were made at all times, and he held all the rights.

He was served with notice, and then they came and demolished it. She clarified that she worked there from the age of 14 or 15 and later became a flight attendant, so she would go there during vacations, but the connection was always maintained. He was like a father; he was the one who helped all of the siblings. After the demolition, he isolated himself completely. It was a shock: he went from being a happy person to a bitter one because he did not even have enough money to pay the employees. It even affected his children because he could not finish paying for their schooling, much less university; they attended a private school. She believes he went through a depressive episode. He had no money to pay his expenses, became very close to God, and has only now begun to improve somewhat. She is now even the one who provides him with some assistance. The restaurant was “his machete,” his means of livelihood.

He started another restaurant with his son, but financially it was extremely difficult. He was left adrift and has managed to move forward because he is a fighter and a believer who does not give up. Everyone who depended on him was affected. On cross-examination, she stated that she knew Octavio had built everything located there, including the restaurant. The ITCO contract was set to expire, but because they continued making payments, she believes it never expired. Don Manuel transferred it to Guillermo; she did not know whether the Municipality authorized the assignment (cesión), but the Municipality collected the payments. All of the siblings signed so that everything would remain with their brother. The plaintiff went to make payments to the Municipality; even one of the Municipality’s witnesses would come and say that everything was in order. She believes it was persecution. By 2018, she believes the Municipality would no longer accept his money. (Audio and video in SIGAO).

25. Egidio Araya Fallas then testified. He is an administrator and works as head of the Unidad de Licencias of the Municipalidad de Quepos, having served as its head for 15 years and as an official for 19 years. He previously worked as an inspector, Head of Human Resources and Procurement, and later in municipal licensing. When he assumed leadership of the department, he became familiar with the record in these proceedings. In 2018, the plaintiff had no active licenses. He described the license-assignment procedure, which required processing before the Municipality and could not be completed solely between private parties. In 2018, a closure order (orden de clausura) was issued because there was no license, a judicial order existed, and the interim measures (medidas cautelares) had been lifted. That act was challenged and the challenge was denied, after which the establishment was closed. On cross-examination, he did not recall the plaintiff having applied for an assignment of a business license. The record contained an application from around 2000, but it was not approved; he did not know the reasons. He explained that the interim measure suspended the act and was later denied by the judge on appeal. (Audio and video in SIGAO).

26. Finally, the testimony of Víctor Hugo Acuña Zúñiga was received. He is an administrator who had been in charge of the maritime-terrestrial zone (zona marítimo terrestre) since late 2006; he began working for the municipality in 1999 as an inspector and had known about the case since that time. He states that he is aware of Mr. Ramírez’s contract with the ITCO; the contract is part of the case file (expediente), which is in the name of a company called Oivatco. They formed a company to process a concession (concesión) for a restaurant called Mar y Sombra at playa espadilla. That contract expired around 1974 and had a term of 5 years; he has no direct knowledge that the contract had been transferred. He cannot state that Don Octavio constructed the building. There was the Mar y tierra restaurant, Caricosta, which consisted of cabins, and it was said that the Balú restaurant belonged to a brother.

The Procuraduría and Contraloría had already made observations concerning the administration of the maritime-terrestrial zone. The studies had established that the Balú restaurant was located in the public zone (zona pública). There was and is no concession granted to Guillermo or Octavio. The eviction and demolition order (resolución de desalojo y demolición) issued by the Concejo Municipal in 2000 had ordered those measures because the property was in the public zone, and the Contraloría reiterated this in 2006. He states that restaurants may not be located in the public zone under the Ley de Zona Marítimo Terrestre. The gentleman was served notice pursuant to 12-13 of the Ley de Zona Marítimo Terrestre to vacate and demolish the premises, a matter that has even been recognized by the Sala Constitucional. The municipality’s environmental manager and environmental biologist determined that the structures were in the public zone, based on their geographic location, and identified a risk of environmental damage (daño ambiental), because the pipes discharged into septic tanks, creating a threat and risk of contamination or seepage toward the beach and thus a risk to the public zone.

Some of the septic tanks were in the public zone—those of Caricosta and Balú—while the tank for Mar y Costa was partially within the restricted zone (zona restringida). That report was reiterated by the Ministerio de Salud. He explains the procedure for construction within the public zone. He explains that, once the demolition has been completed, a report on the demolition costs is prepared and payment is collected. An inventory is made of the hours and number of officials involved—the salary-per-hour value—and the value of the rented or municipal machinery—the cost of using the equipment; all of this is added together and notice is served. On cross-examination, he explains that he knows the plaintiff because the plaintiff was the person working at the Balú restaurant when he was an inspector, beginning in 1999, and therefore they checked whether the establishment had operating permits and business licenses (patentes); it was known since that time that it could not be located in the public zone.

He does not know how long the establishment had been there. He does not specify how many inspections he conducted at the location, but there was more than one. He knows about the ITCO contract because it is in OIVATCO’s case file and he has therefore seen it. Regarding the 2018 demolition, there was a council resolution providing for the suspension of the business licenses and the implementation of the demolition process; there were also environmental-contamination reports and the authority granted under Law 6043. The demolition notice cited the danger or environmental damage, as well as the finality of the decision regarding the matter that the gentleman had previously challenged and lost. The judicial proceeding concerned the Concejo’s 2000 resolution, based on the property’s location within the public zone. (Audio and video in SIGAO).

II. UNPROVEN FACTS

The following are deemed unproven facts relevant to the proceeding: 1. That the respondent Municipalidad opted to apply Law 10.000 pursuant to Art. 6 of that same statute. (There is no evidence in the record in this regard). 2. That the building known as “Balú” was not located within the public portion of the maritime-terrestrial zone. (There is no evidence in the record in this regard).

III. SUBJECT MATTER OF THE PROCEEDING

In this proceeding, the plaintiff claims that the municipality bears administrative civil liability of the Public Treasury (responsabilidad administrativa civil de hacienda) for its conduct in evicting the occupants from and demolishing the infrastructure known as “Bar Balú,” which belonged to him. He explains that the structure had been built more than 40 years earlier—as established in a criminal proceeding in 1992—by his grandfather, Octavio Ramírez Garita, before Law 6043 entered into force. His grandfather had obtained from the ITCO a leasehold right of occupancy (derecho de ocupación bajo arriendo) covering 5000 meters in that area, and the business licenses and occupancy rights were transferred to his son, Manuel Ramírez Muñoz, who in turn transferred them to the plaintiff through a private sale in 1988. The transfer was submitted to the Concejo Municipal for processing, but the municipality did not respond, although the plaintiff took over the business and proceeded to pay the business-license fees, property taxes, and rent, with receipts issued in the name of OVIATCO SA or Manuel.

He clarifies that OVIATCO was a company created in the 70’s to construct 3 restaurants, cabins, cottages, and rooms in the Playa Espadilla area, managed by the plaintiff and his father. He states that on February 9, 2018, the Alcaldía Municipal issued resolution 001-DEM-ESP-2018, ordering the eviction and demolition of the Balú bar and restaurant; notice was served on the 14th, and the resolution was challenged on the 20th of that same month and year. After rejecting the motion for reconsideration (recurso de revocatoria) and referring it to the Improper Hierarchical Authority (Jerarquía Impropia), that authority, through resolution 519-2019 of October 23, 2019, annulled the challenged act because it violated Law 9373, given that the Municipio had adopted that law through resolution 15, Art. 7, of ordinary session 052-2016. He specifies that, before that resolution was issued, Law 9577—which extended Law 9373—entered into force and was also adopted by the respondent municipality through a municipal resolution; that law was likewise extended by Law 10.000 of 2021, remaining in effect until July 1, 2024.

He asserts that, because Sección III annulled the act that served as the basis for the eviction and demolition, the eviction and demolition became contrary to the legal system and unlawful, causing severe damages and losses. These began with the profits he could have generated from operating the commercial activity that had been conducted on the property for more than 40 years, since under Law 10.000 he would still have had until 2024, as well as the resulting need to pay severance to employees and even borrow money to pay his debts. In addition to that pecuniary damage (daño material), he suffered serious harm to his emotional and physical health and to his family, because the demolition of his family inheritance was traumatic. He further explains that the Municipalidad had attempted to evict the plaintiff long before then. In 2000, it ceased renewing his operating permits and ordered the eviction, bringing the matter before the Juzgado Contencioso Administrativo y Civil de Hacienda, which, in judgment 497-2016—a “judgment devoid of reasoning and extremely incomplete and deficient, particularly with respect to the assessment of the evidence”—dismissed the claim.

The Sala Primera rejected the cassation appeal (casación) on procedural grounds without addressing the merits of the matter. Nevertheless, as the Improper Hierarchical Authority noted, the court’s judgment did not order eviction or demolition but merely rejected the claims asserted by the plaintiff herein. Accordingly, the Municipalidad never enforced the 2000 acts, which were never based on environmental damage but rather on the property’s location within the public zone and the plaintiff’s lack of a concession. For that reason, Sección III gave precedence to Law 9373 and rejected the change in reasoning because the alleged environmental damage had not been established—that is, it extended the protection of Law 9373 notwithstanding the final judgment in that proceeding. Consequently, because the eviction and demolition were carried out pursuant to a void act (acto nulo), a duty to compensate arose, and even the collection of the demolition costs sought by the municipality is improper.

He identifies the pecuniary damage as the income not received during the period in which he could have benefited from the moratorium, from February 15, 2018, until the expiration of Law 10.000 on July 1, 2024; the cost of employee severance payments; and interest on both amounts, estimating the pecuniary damage at 25 million and the non-pecuniary damage (daño moral) at 10 million. In his reply and closing arguments, he reiterated that the basis of his claim is Sección III’s annulment of the 2018 demolition order. What the Municipalidad did was seek to invoke the “environmental damage” exception so that it could carry out the demolition. The plaintiff fell within the scope of the moratorium. He challenges the inconsistencies in the testimony received at trial because the demolition act was annulled by the Improper Hierarchical Authority, regardless of whether it contained a statement of reasons, whether the property was in the public zone, or whether environmental damage existed.

The justification was changed to circumvent the moratorium. He states that, when the Sala Constitucional annulled Law 9373, its decision preserved rights acquired in good faith (derechos adquiridos de buena fe), and the plaintiff was therefore protected. Until 2003, the municipality continued collecting commercial and liquor-license fees, which were registered in the name of Manuel, the plaintiff’s father, and Oviatco. He states that the months covered by the moratorium would have allowed him to save money or make arrangements concerning his business and workers (24 months). The law required the suspension of evictions and demolitions. The damages must be quantified during the enforcement phase (ejecución), even though the non-pecuniary damage was established through the testimony of the witnesses at trial.

IV. REGARDING THE ARGUMENTS OF THE RESPONDENT MUNICIPALITY

In response to the allegations raised in the complaint, the Local Government of Quepos, in its answer and closing arguments, essentially opposes the complaint, stating that the municipality never authorized the transfer of any business or liquor licenses to the plaintiff. In fact, through sessions 195 of October 25, 2000, and 224 of March 1, 2001, the Municipal Council not only denied the petitioner’s application for operating permits but also instructed the administration to initiate eviction and demolition proceedings; consequently, the payments made by the plaintiff were made at his own risk. It asserts that the ITCO contract never granted him the right to use the beach and that, in any event, the instrument had a 5-year term. Thus, following the inspector’s visits beginning in 1999, the Council suspended the plaintiff’s licenses and later ordered him to vacate and demolish the structures.

The plaintiff challenged those resolutions and obtained an interim measure (medida cautelar); the matter was not decided until 2016, when the judgment upheld the Council’s resolutions, found that the plaintiff had no right to remain there, ruled on the issue of the payments (judgment 497-2016), and rejected the damages claimed here. That judgment became final after the cassation appeal was denied. The Municipality did not proceed with demolition because the interim measure issued in the 2001 proceeding remained in effect; there was no inaction by the Local Government. The 2018 action was a new attempt by the plaintiff to suspend the licensing decision ordering him to cease operations, which was upheld in May 2018. The denial of the interim measure seeking to suspend the license was decided on appeal in June 2018, and judgment 497-2016 was recognized as part of the reasoning and was even expressly mentioned.

This is an attempt to relitigate a matter that had already been judicially resolved. There were 17 years of administrative proceedings before the nonhierarchical appellate authority (jerarquía impropia) and of judicial proceedings, not municipal inaction. In the interim, when the moratorium laws entered into force, they were annulled retroactively by the Constitutional Chamber in decision 24.147. Nonhierarchical appellate decision 519-2019 is based on law 9373, which itself was founded on an unconstitutional law. The plaintiff is not acting in good faith, holds no legal right, and the matter had already been conclusively resolved against him by a final judgment. Therefore, the effects of the declaration of unconstitutionality directly affect that nonhierarchical appellate ruling. It rejects the claim for damages because such damages are not compensable, given that the closure of the licensed establishment was not under review in decision 519-2019; it had been final since the judicial proceeding concerning the 2001 acts, while that decision was limited exclusively to the issue of demolition costs. It therefore invokes art. 190.1 (fault of the victim), as well as article 195 of the LGAP. It reiterates the absence of any legal right and requests an award of costs.

V. REGARDING THE PUBLIC ZONE WITHIN THE MARITIME-TERRESTRIAL ZONE (ZONA MARÍTIMO TERRESTRE)

In a matter different from the one at issue here, this Court examined the maritime-terrestrial public zone (zona pública marítima terrestre) and included a historical analysis of the applicable regulations, given their significance in determining the legal consequences for a person, whether authorized or not, who benefits from that area. On that occasion, it stated: “Our starting point (although it is possible to go even further back, doing so is unnecessary for this matter) is the Organic Law of the Costa Rican Tourism Institute, Law N° 1917, in force since August 9, 1955, particularly its original wording, which provided in section 7°, as part of the Institute’s capital—that is, its assets—the lands comprising the ‘Maritime Mile’ zone (subsection c) of the original text of law 1917)… It must be emphasized that this designation had already existed since 1828, when law 162 reserved a ‘mile in width along the seacoasts exclusively for the navy, fisheries, and saltworks’ (Collection of Laws and Decrees, first half of 1828.

P. 86). This was followed by law 128 of August 19, 1853; art. 2 of law N° 5 of 1884, which established that ‘the Nation’s ownership of undeveloped public lands may be transferred, for consideration or free of charge, to Costa Ricans or foreigners, except for lands located within a zone one mile wide along the coasts of both seas and the banks of navigable rivers’; and Law N° 11 of May 26, 1884, whose art. 20 stated: ‘The maritime-terrestrial zone, or the area along the coasts of the Republic washed by the sea at high and low tide, together with the adjacent lands extending for a distance of one mile, is in the public domain’; and, finally, art. 7 of ITCO law 2825 of 1961. This position has long been recognized, including in decision 7-1993 of the First Chamber of the Supreme Court of Justice, which, in its ruling issued at 15:05, stated: ‘…from the first legal provision enacted during the republican era—Law No.162 of June 28, 1828—the reservation of a maritime mile along the coasts of both seas was established; according to Law No. 128 of August 19, 1853, this reservation had existed since the colonial era pursuant to the Royal Decree of October 15, 1754.

(…) Since Costa Rica’s emergence as an independent State, the reserved land along both coastlines has not formed part of the undeveloped public lands—the Crown lands of the colonial period—but has always been subject to a different legal regime, namely that governing public-domain property (bienes de dominio público), and therefore cannot be converted into private property. (…) Its current legal regime is established by Law 6043 of March 2, 1977, its amendments, and its regulations (Decree No. 7841-P of December 16, 1977), that Law being the first legislation specifically addressing the subject. Inalienability (inalienabilidad) and immunity from acquisitive prescription (imprescriptibilidad) are inherent characteristics of such property. (…) As public-domain property, it belongs to the State, is subject to a special legal regime, and is intended for common use and enjoyment. The inalienability of such property means simply that it is outside the stream of commerce, in a manner similar to the Roman-law concept of property ‘extra commercium.’ Accordingly, such property cannot be conveyed—by any means under either Private Law or Public Law—and its inability to be converted into private ownership in any manner is intrinsic to its legal nature.

Hence, another of its characteristics is its immunity from acquisitive prescription; that is, it cannot be acquired through the passage of time under the legal doctrine of adverse possession (usucapión)…’ (Judgment 2024006577 issued at 9:42hrs on September 30, 2024). Finally, on another occasion it was clarified that the so-called public zone is not incompatible with the conduct of activities, as stated in another ruling: ‘…law 6043, Ley de la Zona Marítimo Terrestre (ZMT). It is important to note that the regulation established by that law is not confined exclusively to the so-called public zone and restricted zone (zona restringida) referred to in art. 10 of that Law; rather, it also contains special regulations governing mangroves and estuaries, whether insular or continental, classifying them as public zones, as well as regimes governing industrial and related activities, such as that contained in art. 18, which includes the “construction of industrial plants, sport-fishing facilities or artisanal facilities, port works, mariculture programs, or other similar establishments or facilities whose operation necessarily requires their location near the sea… the construction, installation, and operation of shipyards and dry or floating docks”; art. 22 includes the “establishment and operation of State-owned tourism facilities of manifest benefit to the country,” as well as other infrastructure works consistent with the public purpose of the public zone; access routes (roads) are addressed in art. 23 and, consequently, in the General Law on Public Roads and the related or associated regulations exemplified above.

From a planning perspective, port regulations would have greater intensity and predominance within this area, followed secondarily by maritime-terrestrial regulations…’ (judgment 2024000606 issued at 11:07hrs on January 31, 2024). As will be seen in the merits of the matter, these precedents are extremely relevant to identifying the scope of the legal status of the construction and operation of what was referred to here as ‘Bar Balú,’ which is the subject of this proceeding.”

VI. REGARDING LAW 9373, ITS UNCONSTITUTIONALITY, AND ITS APPLICABILITY TO LOCAL GOVERNMENTS

On another occasion, when considering the extension of Law 9373, this Chamber stated: “This Court recognizes the plurality of regulated persons who, in one way or another, have contact with the maritime-terrestrial zone (zona marítimo terrestre) and who, in turn, have particular legal statuses. Thus, we find residents (pobladores), those identified in article. 75 of the regulations to law 6043; that status is strictly personal and may not be transferred; it entails a series of requirements, namely: being Costa Rican by birth, having lived for more than 10 years in the Zona Marítima Terrestre, and having no real property registered in their name other than the property they occupy in the zone, where their status is precarious, since their occupancy continues until they are relocated in accordance with the planning for the zone; they are entitled to compensation for improvements if they must be relocated, are prohibited from encroaching on the public zone, and have priority over any other concession application.

We also find former lessees (otrora arrendatarios), a term developed by article 73 of the Regulations and Transitory Provision I of Law 6043, who are subject to a wide variety of limitations; these are pre-concession arrangements agreed upon by the corresponding entity and the lessee for the use of the maritime-terrestrial zone, which, in principle, should have had an expiration date or extension, as that transitory provision establishes by stating that ‘… upon their expiration, and if their extension is approved, they shall be amended in accordance with the provisions of this law,’ thereby providing an ex lege mechanism for complying with the guidelines of the aforementioned maritime-zone law. We also find users or use permit holders (usuarios o permisionarios de uso), legal statuses granted under article 154 of the Ley General de Administración Pública as a highly specific authorization for the use, enjoyment, or exploitation of property in the public domain, held on a precarious basis and revocable on grounds of expediency or convenience without liability for the Administration, following proceedings instituted for that purpose and allowing a reasonable period for compliance with the revocation decision; this status is strictly personal, and its holder may not sell, lease, or otherwise transfer it.

It is therefore the most limited status of all, since it is conditioned upon the type of use from which the holder benefits, meaning that the holder may not unilaterally alter the nature of the authorized use. Finally, there is the so-called concession applicant (solicitante de concesión), which is the status acquired by a Costa Rican man or woman, or by a legal entity whose share capital is more than 51% Costa Rican-owned, once the corresponding application has been filed with the Municipality or, where applicable, the corresponding District Municipal Council. It grants no authorization, permit, or right to use the parcel referred to in the application; moreover, any act of occupancy or possession of the property by the applicant before becoming a concession holder shall constitute grounds for the immediate closure of the application and render the applicant liable for the offense of encroachment upon the maritime-terrestrial zone, with the applicant bearing the costs of demolishing any structure erected at the site (art. 13 of law 6043 and 22 of regulation 7841-P).

Lastly, those who do not fall within this category, or who formerly did but whose status subsequently expired, lapsed, or was not extended and who remained at the site, are considered occupants (ocupantes). These are persons who, without meeting the requirements for resident status, occupied the maritime-terrestrial zone, even without authorization, before law 6043 entered into force—that is, before 1977. Their status may neither be transferred nor assigned, and they have no priority over any other concession application. Nevertheless, this designation was expanded to include those arriving after law 6043 entered into force who comprise the protected beneficiary population (población de destino tutelada) under law 9577, article 1° of which describes them as the group of persons who reside or have structures, commercial or agricultural and livestock activities, or ‘any activity’ of a lawful nature existing in the restricted zone (zona restringida), provided that their presence does not cause ‘environmental damage or a danger or threat of harm to the environment,’ as delimited by article 2° of that law.

Accordingly, it is important to highlight the impact of law 9577, whose period of validity was extended by Law N° 10.000, del 2° de julio de 2021, because it covers a large population that, in general terms, would qualify as irregular occupants and would be subject to the application of sections 12 and 13 of law 6043, namely eviction and demolition. Nevertheless, with regard to construction matters, article 69 of that law had regulated, since its enactment, the existence of structures ‘without the respective authorization, pursuant to this law,’ adding that such structures ‘shall be subject to planning in accordance with the urban-planning standards (normas urbanísticas) that are issued, which shall be applied to them gradually in cases of remodeling or reconstruction.’ That article was implemented through section 74 of decree 7841-P, specifying that ‘In accordance with article 69 of the Law, buildings and structures erected without the respective authorization on properties in the restricted zone lawfully leased or granted under concession pursuant to prior laws shall be subject to planning in accordance with the urban-planning standards that are issued, which shall be applied gradually in cases of remodeling or reconstruction.’ As stated, this regulation was expanded by law 9577, specifically article 4°, which provides: ‘Under no circumstances shall the application of this law favor the creation of rights for the benefit of occupants of the zones subject to the moratorium.

Likewise, occupants may not make alterations to the works, except for maintenance work and necessary or urgent improvements, which are hereby authorized. Nor may alterations be made to the activities and projects located in the zones subject to the moratorium.’ These works are likewise regulated by law 9242 del 9 de junio de 2014, whose purpose is ‘to regularize existing structures in the restricted zone of the maritime-terrestrial zone, as defined in article 10 of Ley N.º 6043, Ley sobre la Zona Marítimo Terrestre, de 2 de marzo de 1977, and its amendments, and to legalize their use by granting concessions under that law.’ Article 4 establishes: ‘Municipalities with jurisdiction over the restricted zone of the maritime-terrestrial zone that do not have a current coastal regulatory plan (plan regulador costero) shall have four years to secure approval of the plan. During that period, the municipalities may preserve existing structures, provided that the competent administrative or judicial authority has not established the occurrence of environmental damage or a danger or threat of harm to the environment.’ That period was extended by law 9984, and therefore the stated four-year period began on 15 de junio de 2021, when the amendment to the provision entered into force.

The foregoing is subject to the clarification that a fee (canon), regardless of its designation, may be charged; terms such as ‘use permit, lease, right, maritime-zone fee’ or similar expressions are commonly used and are understood to be authorized by Transitory Provision VII of law 6043, in conjunction with the third paragraph of article 4 of law 9242, which provides: ‘… such structures may be used on a precarious basis, provided that a fee for precarious land use (canon por uso de suelo a título precario), as established by the municipality with the respective jurisdiction, is paid. Payment for precarious land use shall not create any right,’ as well as being subject to other tax-related charges, such as payment of the real property tax and municipal services” (judgment 74-2021-I de las 14:40hrs del 12 de agosto de 2021). Nevertheless, through ruling 24147 del 27 de octubre de 2021, the Sala Constitucional declared law 9373 unconstitutional, reiterating the position taken against law 9370 in vote 2019-012746.

Consequently, the same effect extends to the statutory extensions, insofar as an extension of an unconstitutional provision cannot be given valid legal effect. In that ruling, as relevant here, the Court ordered: “The action brought against Law No. 9373 is granted. Consequently, Law No. 9373 de 28 de junio de 2016, entitled ‘PROTECTION OF OCCUPANTS OF ZONES CLASSIFIED AS SPECIAL,’ is annulled as unconstitutional. Pursuant to article 91 of the Ley de la Jurisdicción Constitucional, this declaration shall have declaratory and retroactive effect as of the date that provision entered into force. Pursuant to article 91 of the Ley de la Jurisdicción Constitucional, this judgment shall have declaratory and retroactive effect as of the date the annulled provisions entered into force, without prejudice to rights acquired in good faith and legal relationships or situations that have become final through prescription, lapse, or a judgment having the force of substantive res judicata (cosa juzgada material).” On a separate matter, but one of extreme relevance to the present case, is the issue of the mandatory applicability of law 9373 to Local Governments, in view of the wording of art. 6 of that law, which stated: “…

ARTICLE 6.-Municipalities are authorized, within the zones under their jurisdiction, to apply the moratorium under the terms established in this law, subject to a favorable opinion from the competent municipal body” (Emphasis added). This section reveals two essential aspects bearing on the present case. First, recalling the legal nature of the Municipalities and the autonomy they possess, which derives directly from the Constitución Política (see vote 5445-99 of the Sala Constitucional), any law that is enacted and has a direct impact on local powers must, during the legislative process, satisfy two specific requirements that do not apply when regulations are enacted for other public entities: mandatory consultation with each Local Government during the legislative process and, second, the mandatory qualified vote required to bind Local Administrations to the enacted legislation. In this case, law 9373, processed by the Legislative Body under expediente 19.139, did not undergo that procedure but was instead processed as an ordinary law, to the extent that it was approved by a simple majority on second reading, as may be verified in ordinary minutes N° 33 del 23 de junio de 2016 of the Asamblea Legislativa, where the Legislative President stated: “…Those who agree to approve expediente 19.139, Law for the Protection of Occupants of Zones Classified as Special, on second reading shall indicate their approval by standing.

A simple majority is required for approval. Thirty-four in favor, six against…” (see folio 706 of the legislative expediente, image 711 of the digital expediente available at https://www.asamblea.go.cr/Centro_de_informacion/Consultas_SIL/SitePages/ConsultaLeyes.aspx). The law under discussion was not binding on the Municipalities and, in fact, provided through the aforementioned art. 6 that adoption of the moratorium was discretionary, hence the use of the expression “authorization is hereby granted”; additionally, it required a special procedure for doing so, which consisted of the decision being made by the competent body, which in this case would be the Concejo Municipal pursuant to the powers under art.

13 of the Municipal Code, following the issuance of a favorable technical opinion, which could include multidisciplinary input from within the Municipal Council, such as technical opinions of a legal, financial, urban-planning, environmental nature and, of course, from the maritime-terrestrial zone department itself. Accordingly, we cannot conclude that the publication and entry into force of Ley 9373 automatically resulted in a suspension of municipal powers, for the reasons already stated.

VII. REGARDING THE SPECIFIC CASE. ABSENCE OF A PROTECTABLE LEGITIMATE INTEREST

In summary, this proceeding seeks a declaration of government civil liability (responsabilidad civil de hacienda) for the demolition and eviction of the building known as “Balú,” which the plaintiff operated at Playa Espadilla de Quepos, alleging that the act ordering both actions, which he identifies as resolution 001-DEM-ESP-2018 of the Alcaldía de Quepos, was annulled by the Municipal Nonhierarchical Appellate Authority (Jerarquía Impropia Municipal) through resolution 519-2019, based on his entitlement to the moratorium under ley 9373, which was extended by leyes 9577 and 10.000. In response, the defendant asserts that the annulment of the act was based on laws that were declared unconstitutional by the Sala Constitucional, and that the actions as such stemmed from final municipal acts issued in 2001 and judicially upheld through proceeding 01-000192-0163-CA; consequently, the plaintiff cannot be deemed a beneficiary of the moratorium established by those laws and is subject to the retroactive effect ordered by the Tribunal Constitucional.

COURT’S FINDING: Before addressing the merits, we must clarify that this proceeding does not concern the validity of resolution 001-DEM-ESP-2018 or resolution 519-2019 of the Nonhierarchical Appellate Authority, which annulled it, since no claims seeking such relief were introduced into this proceeding through the appropriate procedural channels. According to the proven facts (specifically facts 8, 9, 16 and 19), what we find is a formal municipal administrative decision (act) that was enforced (conduct) while its challenge was pending, with the complication that, as a result of that challenge, the underlying act was set aside. This produces a single effect: the enforcement action subsequently became what legal scholarship calls an unlawful administrative action (vía de hecho), regardless of the opinion that the parties or this Court may have concerning the grounds or reasoning stated by the Nonhierarchical Appellate Authority and its assessment of res judicata (cosa juzgada) (proven fact 4).

Accordingly, the subject matter of this proceeding will be to determine here whether that unlawful administrative action provides grounds for the compensation sought by the plaintiff both in his principal claims and in his alternative prayer for relief. From this starting point, we must recall the effects produced by mechanisms for challenging decisions at the municipal administrative level (sede administrativa municipal). This is an issue that could be described as formal and requires determining whether government civil liability arises when an administrative act challenged before the nonhierarchical appellate authority in municipal matters is enforced and, above all, when that hierarchical review subsequently sets aside or annuls the conduct that was enforced or carried out. At the time the Alcaldía’s act 001-DEM-ESP-2018 was issued, the Código Municipal provided (in version 24 of 58 of the provision to date, according to SINALEVI) for the possibility of challenging an Alcaldía decision through a horizontal appeal (motion for reconsideration (revocatoria)) and an appellate or vertical appeal (appeal (apelación)) before the Nonhierarchical Appellate Authority, neither of which had suspensive effect with respect to the act, pursuant to the second paragraph of Article 162 of that version of the municipal provision, although it allowed the adoption of interim measures (medidas cautelares).

In this case, the plaintiff filed an application for judicial interim relief in expediente 18-001644-1027-CA, whereupon the defendant unilaterally suspended the demolition (proven fact 13), since the eviction had already occurred at an earlier stage (proven fact 9). Nevertheless, both the emergency interim measure (medida cautelar provisionalísima) and the final interim measure (medida cautelar definitiva) were denied in that proceeding (proven fact 14), which was subsequently voluntarily dismissed by the plaintiff herein. It was thereafter that, through official communication -ALCP-2018 dated 4 de junio de 2018, the Alcaldía revoked official communication 393-ALCP-2018 and ordered the continued enforcement of resolution 001-DEM-ESP-2018 (proven fact 15). Accordingly, enforcing an act issued by the Alcalde, despite its being challenged, does not in itself constitute a defect in municipal action, and the cited proven facts establish that the defendant Municipality acted cautiously before carrying out the demolition (proven fact 16).

The issue here is therefore limited to the material execution of the eviction and demolition becoming an unlawful administrative action as a result of the intervention of the Nonhierarchical Appellate Authority, an aspect that, in principle, constitutes grounds for a duty to compensate. We must avoid confusing unlawful administrative actions with material conduct (conductas materiales) undertaken by the Administration, since the latter may constitute enforcement of formal acts or may result from conduct supported by the legal system that, despite the absence of written form, complies with the structure required by our legal system as to grounds, content and purpose, as well as the other nonessential requirements that permit administrative or judicial review. Unlawful administrative actions, in contrast, are characterized precisely by the defect that they cannot be justified; hence, they are attributed to arbitrary exercises of the Administration’s sovereign powers (potestades de imperio), abuses of power (desviaciones de poder), or unlawful exercises of public authority, all of which are sources of government civil liability.

In this case, this situation—as explained supra—arose subsequently as a result of the annulment, on nonhierarchical appeal, of act 001-DEM-ESP-2018. Nevertheless, that is not the only requirement necessary for a duty to compensate to arise. Specifically, we must recall the constitutional mandate set forth in art. 49 of the Carta Magna, the third paragraph of which states: “… The law shall protect, at a minimum, the subjective rights (derechos subjetivos) and legitimate interests (intereses legítimos) of governed persons (administrados),” which is supplemented and expanded by Articles 1, 2, 36 and 42 of the CPCA, broadening the matters eligible for protection and incorporating legally protectable situations (situaciones jurídicamente tutelables). This is extremely relevant to the merits of this matter, because the plaintiff claims that such a situation exists as the basis for his compensation, while the defendant denies it.

We clarify that the plaintiff possesses neither a subjective right nor a legitimate interest, matters made abundantly clear by proven facts 2, 4 and 14. Moreover, numeral 4° of ley 9373 itself, invoked by the plaintiff, stated verbatim: “Under no circumstances shall the application of this law favor the creation of rights for occupants of the areas subject to the moratorium. Likewise, occupants may not make modifications to the works, activities and projects located in the areas subject to the moratorium,” a provision repeated in leyes 9577 and 10.000. The matter therefore comes down to the plaintiff’s position that these three provisions granted him a legally protectable situation, namely, entitlement to the moratorium, notwithstanding his preexisting irregular status. There we find the first relevant consideration: the protectable situation is limited exclusively to the time at which the eviction and demolition were carried out, not to whether he was required to endure them, since that status had already been determined administratively and judicially.

The three cited provisions do not—and did not—have the legal capacity to alter the legal classification of a governed person in the maritime-terrestrial zone (zona marítimo terrestre) as either regular or irregular; their sole purpose was temporarily to control when actions to restore public-domain property (restitución demanial) could be carried out. Therefore, the third claim is manifestly unfounded, since the possibility of compensation for the building was even expressly addressed in judgment 497-2016 (proven fact 4), making the absence of any right evident. The same applies to claim 6 for reimbursement of employment-related payments made to his employees because, as stated, this was the necessary and inevitable consequence of carrying out the eviction and demolition, and it was not established that the plaintiff could have continued his operations through another commercial establishment.

It must be added that, in this instance, this was not only a foreseeable result of which the plaintiff had full knowledge since 2000, but also since 2017, when judgment 497-2016 became final (hechos probados 2, 4 and 6). Consequently, the dispute must be addressed on the basis that, given the subsequent annulment of act 001-DEM-ESP-2018 and the execution of the eviction and demolition, the plaintiff might be recognized as having the benefit of the moratorium, which in practical terms would translate into the claimed continuation of operations referred to in claim 4 and the alternative claim, as well as the nonpecuniary harm (daño moral) asserted in claim 7. In this respect, the plaintiff’s position cannot be accepted, as explained below. The first matter to be considered is the Municipality’s argument concerning the application of art. 195 of the Ley General de Administración Pública, which states: “Neither the State nor the Administration shall be liable, even if they cause special harm under the foregoing terms, when the affected interest is not legitimate or is contrary to public policy, morality or accepted principles of conduct, even if that interest was not expressly prohibited before or at the time of the harmful event” (emphasis added), because the factual circumstances of this proceeding fall precisely within the latter situation contemplated by that numeral.

The annulment of resolution 001-DEM-ESP-2018 by the Municipal Nonhierarchical Appellate Authority—which, it must be emphasized, is an administrative act despite having been issued by a judicial body—was based on the application of ley 9373. However, that law was subsequently declared unconstitutional by voto 24147 del 27 de octubre de 2021, with retroactive effect. This necessarily means that the legally protectable situation afforded to the plaintiff under ley 9373 and its extensions became contrary to public policy and, specifically, to the constitutional order. As a result, despite the existence of a defect in the administrative conduct—an unlawful administrative action—the plaintiff’s situation is not protectable because of the effect given to the Tribunal Constitucional’s ruling, which provides sufficient grounds to dismiss the aforementioned claims for compensation. Nevertheless, without detracting from the foregoing, the parties to the proceeding also disputed the scope of that ruling in light of the effect of art. 91 of the Ley de la Jurisdicción Constitucional, which exempts from retroactive effect “rights acquired in good faith and legal relationships or situations consolidated by prescription, lapse of time (caducidad), or by virtue of a judgment having the authority of substantive res judicata (cosa juzgada material).” In this regard, this Chamber agrees with the defendant’s position.

As stated above, the plaintiff possessed neither a subjective right nor a legitimate interest acquired in good faith, nor did he have a situation consolidated by prescription or lapse of time. Indeed, there were two administrative acts against him that were judicially upheld through proceeding 01-000192-0163-CA, which would instead confirm that the situation had been resolved with substantive res judicata against the plaintiff herein. He is therefore precluded from benefiting from the exception set forth in the aforementioned art. 91 of the Ley Reguladora de la Jurisdicción Constitucional. Moreover, because the decision of the Nonhierarchical Appellate Authority constitutes an administrative rather than a judicial function, resolution 519-2019 del 23 de octubre de 2019 cannot be given res judicata effect.

Now, furthermore, pursuant to Considerando V of this judgment, another ground can be drawn for the impossibility of upholding the defendant’s position: the established and undisputed fact that the building and the activity were located in the maritime-terrestrial public zone (zona pública marítima terrestre). As detailed in that Considerando, under no circumstances throughout Costa Rica’s history as a Republic—and even before then—has private use (aprovechamiento privativo) of that area been authorized. Therefore, the claim seeking recognition of the activity’s continuity can only be characterized as openly contrary to public policy (orden público), and it is even more serious given that there was not even a business license (patente), permit, license, or concession authorizing it, particularly since the party did not refute that the building or the activity was located within this specially protected strip.

Finally, notwithstanding the plaintiff’s position that the purported environmental risk was not proven—a position shared by the Municipal Non-Hierarchical Appellate Authority (Jerarquía Impropia Municipal), whose position is, incidentally, highly questionable—the fact remains that the evidence entered into the record included not only the discredited official letter UTA-006-18 dated January 18, 2018, from the Unidad Técnica Ambiental Municipal (Established Fact 7), but also official letter PC-ARS-Q-IT-101-2018 dated July 18, 2018, from the Ministerio de Salud (Established Fact 17), which the plaintiff neither challenged nor disputed and which establishes, through technically persuasive evidence, that the building and the activity in the public zone of Playa Espadilla violated the right under Article 50 of the Constitution to a healthy and ecologically balanced environment, thereby creating another ground of conflict and contradiction with constitutional public policy.

Accordingly, the plaintiff’s position cannot be upheld because the plaintiff lacks a subjective right (derecho subjetivo), legitimate interest (interés legítimo), or legally protectable situation (situación jurídicamente tutelable) on which to base the claims.

VIII. REGARDING THE ANALYSIS OF THE SPECIFIC RELIEF SOUGHT (pretensiones)

In light of the foregoing and, consequently, because the exception or ground for exemption (causal de exoneración) under art. 195 of the Ley General de Administración Pública invoked by the defendant applies, all the principal claims for relief (pretensiones principales) in the complaint must be denied, with the clarification that the alternative claim for relief (pretensión subsidiaria) leads to the same result, since it constitutes an adjustment to principal claim 4, and the alternative claim must be denied for the same reasons that warrant denial of the principal claim. Because the first and second claims are general claims, both must be denied based on the reasoning set forth in the preceding recital (considerando), as must the ancillary claims (pretensiones accesorias) for interest contained in claim 2. As to costs (costas) (claim 8), the parties shall abide by the ruling set forth below.

IX. REGARDING THE DEFENSES RAISED

Counsel for the defendant raised the affirmative defense of lack of legal entitlement (falta de derecho), which, in view of the arguments and reasoning set forth in this judgment, must be sustained in all respects.

X. REGARDING COSTS

With respect to costs, pursuant to section one hundred ninety-three of the Código Procesal Contencioso Administrativo, procedural costs and attorneys’ fees (costas procesales y personales) constitute a burden imposed upon the unsuccessful party by virtue of having lost. Relief from this award is available only when, in the Court’s judgment, there was sufficient cause to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, the Court finds no grounds for exemption from costs; consequently, both categories of costs shall be borne by the plaintiff and shall be assessed during the judgment-enforcement phase (fase de ejecución de sentencia).

THEREFORE

Based on the foregoing findings of fact and conclusions of law, the affirmative defense of lack of legal entitlement is sustained. Consequently, the complaint filed by GUILLERMO RAMÍREZ CHAVES against the MUNICIPALIDAD DE QUEPOS is hereby DISMISSED in all respects. Both categories of costs shall be borne by the plaintiff and shall be assessed during the judgment-enforcement phase. Notice shall be given.

Que se declare que la Municipalidad demandada es responsable por los daños y perjuicios ocasionados al actor Guillermo Ramírez Chaves (todos descritos supra) por la ejecución de los actos anulados por la Sección Tercera del Tribunal Contencioso Administrativo, propiamente la resolución de la Alcaldía Municipal de Quepos 001-DEM-ESP-2018, Oficio 020-ALCP-DL-2018 del nueve de febrero de dos mil dieciocho. 3. Que se condene a la Municipalidad a pagarle a don Guillermo Ramírez Chaves el valor actual de la edificación demolida al amparo del acto administrativo declarado nulo y cuya estimación se determinará en la etapa de ejecución de sentencia. 4.Que se condene a la Municipalidad a pagarle a don Guillermo Ramírez Chaves el costo total de las ganancias dejadas de percibir por la explotación del Bar Restaurante Balú desde el día del cierre del mismo al amparo de los actos anulados 15 de febrero de 2018 y que estimamos que se extienden hasta el 01 de julio de 2024 que es la fecha de vencimiento de la moratoria establecida en la Ley 10.000 la cual se promulgó expresamente para prorrogar en un mismo tanto el plazo de 36 meses establecido en la Ley 9577 y que la Municipalidad de Quepos acordó su aplicación la cual entró a regir un día antes de la expiración del plazo de la ley 9373. Monto que se determinará en ejecución de sentencia. 5. Que se condene a la Municipalidad a pagarle a don Guillermo Ramírez Chaves los intereses sobre todas esas sumas desde el día en que ocurrió la ejecución del acto, 15 de febrero de 2018 hasta su efectivo pago.Monto que se determinará en ejecución de sentencia. 6. Que se condene a la Municipalidad a pagarle a don Guillermo Ramírez Chaves las sumas que tuvo que pagar el actor por concepto de liquidaciones laborales a sus empleados, las cuales se liquidarán en la etapa de ejecución de sentencia y los intereses sobre esas sumas desde que don Guillermo hizo el pago y hasta su efectiva cancelación. 7. Que se condene a la Municipalidad a pagarle al actor el DAÑO MORAL sufrido por los actos anulados y su ejecución, daño moral que se estima en la suma de DIEZ MILLONES DE COLONES. Además de los intereses sobre dicha suma desde su condenatoria y hasta su efectivo pago. 8. Que se condene a la Administración al pago de ambas costas de este proceso y sus intereses desde su condenatoria y hasta su efectivo pago”. Asimismo, planteó en la misma gestión la siguiente pretensión subsidiaria: “En caso de que no se acoja la indemnización del costo total de las ganancias dejadas de percibir por la explotación del Bar Restaurante Balú desde el día del cierre del mismo al amparo de los actos anulados es decir desde el 15 de febrero de 2018 y hasta el 01 de julio de 2024 que es la fecha de vencimiento de la moratoria establecida en la Ley 10.000, solicitamos que se acoja dicha indemnización hasta la fecha en que venció el plazo previsto en la Ley 9577, es decir al 27 de junio de 2021 o bien al 28 de julio de 2018 fecha en que vencía la vigencia de la moratoria revista en la Ley 9373 según sea el caso”. En escrito de fecha 28 de junio de 2023 aclaró que la estimación prudencial de los daños y perjuicios es de 25 millones de colones. (Imágenes 19 y 28 del expediente electrónico).
  2. 2Conferido el traslado a la representación de la demandada, rechazó los hechos, e invocó la defensa de falta de derecho. (Imágenes 41-46 del expediente electrónico).
  3. 3La parte actora replicó en escrito de fecha 15 de noviembre de 2023, sin aportar prueba adicional. (Imágenes 63-65 del expediente judicial digital).
  4. 4Que la audiencia preliminar se realizó el 23 de noviembre del 2023, se fijaron las pretensiones del proceso, se determinaron los hechos controvertidos y se admitió la prueba de las partes. (Imágenes 68-71 del expediente electrónico y audio de la audiencia en sistema SIGAO).
  5. 5El juicio oral y público se realizó el día 4 de marzo del 2025, con la presencia de todas las partes, se realizó el discurso de apertura, se evacuó la prueba ofrecida, y se recibieron conclusiones orales. Se declaró el expediente como muy complejo de conformidad con el canon 111 del Código Procesal Contencioso Administrativo. (Soporte en Sistema de Gestión).

En los procedimientos se han observado la -las prescripciones y términos de ley, y no se perciben vicios, defectos u omisiones susceptibles de producir nulidad de lo actuado o indefensión a las partes. Se dicta esta sentencia dentro del plazo legal. Se dicta la presente resolución por unanimidad y previa deliberación.

Redacta el juez Mejías Rodríguez con el voto afirmativo de las juezas Bolaños Salazar y Gómez Chacón.

CONSIDERANDO:

I. HECHOS PROBADOS

Se tienen como hechos relevantes probados en el presente proceso: 1. Que el actor estuvo utilizando una estructura construida en zona pública de Playa Espadilla en Quepos, Puntarenas donde desarrollaba la actividad de Bar y Restaurante bajo el nombre “Balú”. (Hecho no controvertido).

2. La Municipalidad de Aguirre en su sesión extraordinaria 195 celebrada el 25 de octubre del 2000 y sesión extraordinaria N° 224 celebrada el 1 de marzo del 2001, deniegan los permisos de funcionamiento, se ordena el desalojo y la destrucción del local Balú. (Hecho no controvertido).

3. Dentro del expediente 01-000192-0163-CA, se decreta suspender los acuerdos cuestionados vía medida cautelar. (Hecho no controvertido).

4. Por medio de sentencia 497-2016 de fecha 31 de marzo de 2016, el Juzgado Contencioso Administrativo y Civil de Hacienda, dentro del expediente 01-000192-0163-CA, declara sin lugar la demanda interpuesta por el acá actor en contra de la Municipalidad, en contra de los acuerdos tomados por la Municipalidad de Aguirre en su sesión extraordinaria 195 celebrada el 25 de octubre del 2000 y sesión extraordinaria N° 224 celebrada el 1 de marzo del 2001, que deniegan los permisos de funcionamiento, se ordena el desalojo y la destrucción del local Balú. En lo que interesa, dicho fallo señala que el actor no puede beneficiarse del contrato de su abuelo con el ITCO, el cual expiró el 21 de mayo de 1974, no aplicando la prórroga tácita conforme el art. 141 de la Ley del ITCO, que cualquier traspaso de licencias o permisos ocupan de la respectiva autorización de la Administración que corresponda, señalando que el actor no puede reclamar derechos de uso y explotación en zona marítimo terrestre, por ausencia de autorización de la Municipalidad de Aguirre, expresando que: “…el actor, ha venido explotando desde muy vieja data su actividad comercial, completamente al margen de la ley”.

Descarta que el actor tenga un derecho adquirido o una situación jurídicamente consolidada por su ocupación irregular. Finalmente, señala que los pagos realizados por el actor se realizaron por su cuenta y riesgo, amparables en el transitorio VII de la Ley 6043. Le rechaza pretensiones indemnizatorias (daño moral y material), en ausencia de un derecho adquirido de forma legítima, respaldando la conducta municipal de ordenar el desalojo y demolición de la construcción Bar Balú y afirmando la incompatibilidad de la actividad comercial y de licores con el uso de suelo en zona pública. 5. Por medio de Acuerdo 15 art. 7 de la sesión ordinaria 052-2016 de fecha 15 de noviembre de 2016, el Concejo Municipal de Quepos acuerda acogerse a la moratoria de la Ley 9373. (archivo “ACTA052-2016-15-11-16-O.pdf” en llave maya de prueba).

6. En fecha 29 de junio de 2017, la Sala Primera de la Corte Suprema de Justicia por medio de voto 000750-S1-2017, rechaza el recurso de casación en contra de la sentencia 497-2016 dentro del expediente 01-000192-0163-CA. (Imágenes 134-139 del archivo ““Expediente-180019341027CA-Completo_compressed.pdf” en llave maya de prueba).

7. Por medio de oficio UTA-006-18 de fecha 18 de enero de 2018, la Unidad Técnica Ambiental Municipal realiza inspección en el restaurante Balú y otros locales, señalando en lo que interesa: “…b) Por las características de las zonas aledañas se puede considera que la presencia de las estructuras presentes en el sitio obstaculizan la continuidad del sistema vegetativo propio de una zona de playa arenosa. Esto podría, en cierta manera, afectar la continuidad del ecosistema y el intercambio energético entre los organismos presentes en el lugar… La existencia de construcciones en el sector de la playa, así como la presencia de fuentes de emisión de luz (como se ve en el caso del restaurante Balú), se vuelve un problema grave que puede afectar la anidación que esporádicamente se puede dar en el sitio. Primero porque las estructuras de cemento y construcciones en general limitan y restringen los posibles puntos de anidación de las tortugas marinas.

Además, y no menos importante, podemos indicar que la iluminación con luz blanca sobre la playa afecta a los neonatos que se encaminan hacia el mar orientados por la iluminación que se ve en el horizonte hacia mar adentro, guiados por un gradiente de luz ubicado entre el cielo y el océano. Cuando las luces artificiales como las comerciales, residenciales, luces de seguridad o recreación iluminan las playas de anidación, los neonatos se orientan hacia tierra adentro donde pueden morir fácilmente, aplastadas por un vehículo, depredadas o por exposición al sol. En el caso de las hembras adultas, las luces en la playa provocan una reacción negativa evitando anidar. Ambos resultados se reflejan en una merma en la capacidad de las colonias de anidación de producir nuevos individuos y perpetuar su especie. Por ejemplo, datos provenientes del análisis de las luces costeras de comunidades en Playa Grande y Tortuguero confirman que las tortugas prefieren anidar fuera de los sitios de influencia de las luces artificiales provenientes de las construcciones aledañas a la costa. d) La existencia de cableado eléctrico (de calidades deplorables y con conexiones "hechizas") en la zona, rodeando y colgando de palmeras y almendros, el cual se ubica en un área en donde comúnmente se moviliza gran cantidad de fauna silvestre como aves, mamíferos (como por ejemplo tropas de monos de diferentes especies) y reptiles, representa un peligro inminente de electrocución para estos organismos. e) El control de aguas residuales en el sitio, se da por medio de un tanque séptico, el cual por su ubicación, antigüedad, forma y tipo de construcción, podría eventualmente generar infiltraciones tanto hacia el riachuelo localizado en el sector sureste de la infraestructura, como hacia el mar… e) La zona donde se ubica dicha infraestructura se ubica en un sector que podemos denominar como un "corredor biológico" que une los sectores de bosque secundario y áreas de playa y de manglar desde Punta Quepos, zonas montañosas del cantón y el Parque Nacional Manuel Antonio, lo cual permite la movilidad de especies a lo largo de este trayecto favoreciendo el intercambio genético, alimentación y refugio de muchos organismos.

La presencia de estructuras antrópicas limita, entorpece y afecta esta interconectividad, desmejorando las características naturales de la zona. f) En el sitio, por ser un área de playa, se imposibilita el ingreso normal de camiones recolectores de residuos sólidos, por lo que se desconoce la forma y medios por los cuales se le da tratamiento a dichos residuos… g) La presencia de construcciones y mecanismos de contención mareal (sacos de arena), limitan la dinámica natural de la zona costera lo cual puede afectar los ecosistemas presentes en el sitio, al impedir la movilidad natural de sedimentos y Dujo de agua. Además la cercanía con fuentes de agua (sin respetar las zonas de protección establecidas por ley) limita el caudal hídrico y favorece el movimiento excesivo de sedimentos que paulatinamente generan una erosión importante que afecta el intercambio de energía solar de los organismos marinos…”. (Imágenes 71-102 del archivo ““Expediente-180019341027CA-Completo_compressed.pdf” en llave maya de prueba).

8. El 9 de febrero de 2018, la Alcaldía Municipal emite la resolución 001-DEM-ESP-2018 la cual dispone el desalojo y demolición del bar restaurante Balú, notificada al actor en fecha 14 del mismo mes y año. De interés, dicho acto señaló en su “por tanto”: “…Analizados los antecedentes sobre la presencia de la edificación que alberga el establecimiento comercial denominado Restaurante Balú, así como las consideraciones legales supra indicadas en el considerando de esta resolución, se ordena: 1- Demoler las instalaciones ubicadas en la zona pública de Playa Espadilla que corresponden al establecimiento comercial denominado Restaurante Balú; 2- Comisionar al Departamento de Zona Marítimo Terrestre la notificación de la presente resolución al señor Guillermo Ramírez Cháves, cédula de identidad número 4-0134-0202, a efectos de la aplicación de los artículos 12, 13 y 20 de la Ley 6043 y 22 de su Reglamento; 3- Otorgar el plazo de 10 días hábiles al señor Guillermo Ramírez Chaves, cédula de identidad número 4-0134-0202, para que proceda voluntariamente a desalojar y demoler las edificaciones del establecimiento denominado Restaurante Balú. 4- En caso del que el señor Ramírez Cháves no cumpla con lo ordenado dentro del plazo otorgado, la administración municipal, bajo la coordinación del encargado del Departamento de ZMT, procederá al desalojo y demolición de la estructura referida, cuyo costo será a cargo del administrado Ramírez Cháves”.

De igual manera, en la motivación del acto se refiere al acuerdo municipal N°4 del artículo 2 de la sesión 34-2002, así como la excepción de la ley 9373 por daño ambiental según criterio técnico UTA-006-18 del encargado de la Unidad Técnica Ambiental del municipio accionado. (Imágenes 44-49 del archivo “Expediente-180019341027CA-Completo_compressed.pdf” en llave maya de prueba).

9. El día 15 de febrero de 2018, se ejecutó el cierre de las instalaciones “Balú”, realizado nuevamente el día 22 de febrero de 2018. (Imágenes 15 y 29 del archivo “Expediente-180019341027CA-Completo_compressed.pdf” en llave maya de prueba).

10. En fecha 20 de febrero de 2018, el actor presenta recurso de revocatoria con apelación en subsidio en contra de la resolución 001-DEM-ESP-2018. (Hecho no controvertido).

11. En fecha 22 de febrero de 2018, por medio de resolución RV-DLM-001-2018, se rechaza el recurso de revocatoria en contra de la resolución DLM-001-RAM-150218. (Imágenes 6-13 del archivo “Expediente-180019341027CA-Completo_compressed.pdf” en llave maya de prueba).

12. Por medio de resolución 002-DEM-BL-2018 del 12 de marzo de 2018, corregida y aclarada en el oficio 048-ALCP-DL-2018 del día siguiente, la Alcaldesa Municipal de Quepas rechazó la revocatoria planteada, y ordenó remitir el asunto ante el Tribunal Contencioso Administrativo Sección tercera y el expediente para el conocimiento de la apelación subsidiaria. (Imágenes 167-174 y 179-180 del archivo ““Expediente-180019341027CA-Completo_compressed.pdf” en llave maya de prueba).

13. Por medio de oficio 393-ALCP-2018 de fecha 15 de marzo de 2018, ante la presentación de una medida cautelar en el expediente judicial 18-001644-1027-CA, suspendiendo provisionalmente la demolición. (Imagen 134 del archivo “225-2023 Expediente 01-DEM-ESP-20218.pdf” en CD de prueba).

14. En fecha 17 de mayo de 2018, por medio de resolución 319-2018 dentro del expediente 18-001644-1027-CA, se declara sin lugar la medida cautelar formulada en contra de la resolución 001-DEM-ESP-2018. (Imágenes 139-142 del archivo “225-2023 Expediente 01-DEM-ESP-20218.pdf” en CD de prueba).

15. Por medio de oficio 687-ALCP-2018 de fecha 4 de junio de 2018, la Alcaldía deja sin efecto el oficio 393-ALCP-2018 y ordena continuar con la ejecución de la resolución 001-DEM-ESP-2018. (Imagen 145 del archivo “225-2023 Expediente 01-DEM-ESP-20218.pdf” en CD de prueba).

16. Los días 17 y 18 de julio de 2018, se ejecuta la demolición de las instalaciones de “Balú”. (Imagen 167 del archivo “225-2023 Expediente 01-DEM-ESP-20218.pdf” en CD de prueba).

17. Por medio del oficio PC-ARS-Q-IT-101-2018 de fecha 18 de julio del 2018, el Ministerio de Salud remite informe de inspección, señalando en lo interesa: “… 1. Se evidencia el tanque séptico con un tubo de PVC que dirige las aguas hacia un drenaje. Este drenaje se extiende hasta llegar a un cauce de un cuerpo receptor cuyas aguas se vierten de forma directa a la Playa Espadilla en Quepos. 2. Se logra evidenciar, tras visita en conjunto con funcionarios de Unidad de Inspectores de la Municipalidad de Quepos, que el drenaje se ubica sobre la arena y que este se construyó a base de piedras de río, tubería corrugada para drenaje y plásticos negros… Difícilmente, el sistema de tratamiento de aguas residuales del Restaurante Balú en Manuel Antonio de Quepos funcionara correctamente al tenerse construido en arena, considerando además que en otros casos se han evidenciado inclusive derrames de aguas residuales al medio ambiente, que el mismo ha presentado el mismo problema en otros momentos.

Existió un riesgo importante de contaminación fecal hacia la playa de Manuel Antonio producto de la ubicación del drenaje, ya que en instantes de mareas altas la probabilidad de salidas se (sic) aguas con contenido fecal (por asunto de nivel freático) era inminente máxime considerando la presencia de un cuerpo receptor al términos del STAR… a. Al tenerse tanque séptico y drenajes en suelo de arena, estos se ven directamente influenciado por la marea, ocasionando que este tipo de estructuras se llenen de agua cada vez que sube la marea. Esto limita la capacidad de almacenamiento de los tanques sépticos y el funcionamiento de los drenajes. b. Al haber salinización en el sistema de tratamiento de aguas residuales, se genera un cambio de pH en el mismo, afectando el ambiente óptimo para el desarrollo de microorganismos necesarios para la descomposición de la materia orgánica. c. La instalación o construcción de sistemas de tratamiento de aguas residuales de tipo tanques sépticos y drenaje, favorece la salinización y contaminación de acuíferos producto de la ruptura de capas del suelo, esto en zonas costeras principalmente por intrusión marina. d. Por medio de drenajes y/o fisuras en tanques del sistema de tratamiento de aguas residuales, los coliformes fecales provenientes de aguas residuales, son arrastrados hasta la playa por medio de la succión producto del flujo de agua que genera la marea al bajar. e. El inmueble se encuentra en un sitio ambientalmente frágil…”. (Imágenes 170-175 del archivo “225-2023 Expediente 01-DEM-ESP-20218.pdf” en CD de prueba).

18. Por medio del acuerdo 267-2019 de fecha 12 de febrero de 2019, el Concejo Municipal de Quepos acuerda acogerse a la moratoria de la Ley 9577. (archivo “ACTA267-2019-12-02-2019-ORDINARIA.pdf” en llave maya de prueba).

19. Por medio de resolución 519-2019 de las 11:15hrs del 23 de octubre de 2019, el Tribunal Contencioso Administrativo Sección III, en calidad de Jerarca Impropio conoce el recurso de apelación y anula la resolución 001-DEM-ESP-2018. En lo que interesa, en dicho acto administrativo se dispuso: “Revisada la documentación aportada, este Tribunal concluye que yerra en sus fundamentos la Alcaldía Municipal. Es menester aclarar de previo, que la causa de exclusión de la moratoria de referencia no son dos como interpreta la Municipalidad, sino solamente una, es decir, la existencia de una resolución judicial o administrativa en firme que ordene el cierre o demolición por causa de daño o peligro ambiental, elemento que está ausente en este caso. En primer lugar, la sentencia que sirve de apoyo, es decir, la número 497-2016, dictada por el Juzgado Contencioso Administrativo y Civil de Hacienda a las dieciséis horas y treinta minutos del treinta y uno de marzo de dos mil dieciséis dentro del expediente 01-000192-0163-CA, y confirmada por la Sala Primera de la Corte Suprema de Justicia mediante resolución 000750-S1-2017 de las nueve horas quince minutos del veintinueve de junio de dos mil diecisiete, no ordena el cierre ni demolición del local comercial del apelante; sino que rechaza la pretensión de nulidad que este dirigió contra la resolución de la municipalidad en ese sentido.

En tanto declara sin lugar la acción la pretensión principal anulatoria, la sentencia de marras no emana la orden de cierre y demolición como pretende fundar la Municipalidad, ni tampoco formula una declaración constitutiva de derecho alguno. La diferencia no es nimia como podría parecer a primera vista. Producto de ella la verdadera orden tendiente a la demolición es de carácter administrativo, fue adoptada por el Concejo Municipal del Cantón entonces denominado como Aguirre, en las sesiones extraordinarias 195 del veinticinco de octubre de dos mil y 224 del primero de marzo de dos mil uno, donde le denegaron al petente la solicitud de permisos de funcionamiento e instruyen a la administración para que inicie los procedimientos de desalojo y demolición. De esta manera, lo relevante para lo que ahora nos ocupa, es dicha resolución administrativa estuvo fundada en la ausencia de licencia municipal y no en daño o peligro ambiental; y que producto de ello, quedó implícitamente modificada tal resolución con el acuerdo 15 del artículo 7 de la sesión ordinaria N° 052-2016; que acordó la aplicación de la Ley 9373.

Es decir, dado que a la fecha de adopción de este último acuerdo, no existía ninguna resolución ni judicial ni administrativa en contra del apelante, que ordenara el cierre, desalojo o demolición de la estructura por daño o peligro ambiental, el Restaurante Balú quedó abrigado a la moratoria que se establece en la ley de cita. A partir de allí, se deduce la siguiente precisión necesaria, en el sentido que la Municipalidad estaba imposibilitada de actuar en contra de dicha situación jurídica, a menos que dictara de previo una resolución administrativa en la que se acredite el daño o peligro ambiental; y para ello no es suficiente el informe rendido por una dependencia interna de la Municipalidad, sino que para que pueda surtir los efectos que pretende dicha Corporación, dicho acto debe ser el resultado de un procedimiento administrativo en el que, con respeto a las garantías constitucionales para con el posible afectado, se haya acreditado ese daño ambiental.

En este sentido el informe rendido por la Unidad Técnica Ambiental de la Municipalidad no basta para tener por acreditada la existencia de daño y de peligro ambiental por sí solo, como lo ha asumido la Alcaldía Municipal. Bajo esos mismos criterios, y con las precisiones que para este caso concreto han sido expuestas de previo, se impone acoger la apelación interpuesta y declarar la nulidad de la resolución de la Alcaldía Municipal de Quepos 001-DEM-ESP-2018, Oficio 020-ALCP-DL-2018 del nueve de febrero de dos mil dieciocho”. 20. Por medio de oficio UTA-325-18 de fecha 3 de diciembre de 2018, la Unidad Técnica Ambiental estima el costo a recaudar por la demolición del Bar Balú. (Imágenes 218-219 del archivo “225-2023 Expediente 01-DEM-ESP-20218.pdf” en CD de prueba).

21. Por medio de oficio MQ-AJ-103-2023 de fecha 21 de abril de 2023, la Asesoría Jurídica de la accionada, señala que el cobro por la demolición al actor resulta improcedente por la resolución 519-2019 de la Jerarquía Impropia. (Imágenes 243-244 del archivo “225-2023 Expediente 01-DEM-ESP-20218.pdf” en CD de prueba).

22. En juicio oral y público se recibió a María de los Ángeles Chaves Miranda, madre del actor. Explica que el restaurante Balú fue una concesión que le dieron a Octavio, su suegro, en la playa, le pidieron que tenía que hacer en menos de 2 años, construir algo, fue el ITCO, él junto con sus hijos hizo cabinas y un lugar para lavar la ropa, al tiempo, su esposo (hijo de Octavio), lo que antes era el Bar Mar y Sombra, él agarró un espacio y se hizo el Bar Balú, eso fue como en el 60 que llegó Don Octavio, en el 70 llegó su esposo (Manuel) y unos años después, el esposo le dio el derecho a su hijo. Señala que el hijo pagaba impuestos a la Municipalidad, el Ministerio de Salud, por eso es que funcionaba, porque todo estaba en orden, un señor Don Víctor que chequeaba las patentes y le decían que todo está en orden. "Oivatco" era una sociedad, era el nombre del suegro al revés y ellos hicieron unas acciones y el hijo tenía una acción y la usaban para operar en ese lugar. Aclara que Balú era parte de un rancho de Mar y Sombra, pero se separó, como un derecho para el hijo, se pagaban juntas. (Audio y video en SIGAO).

23. Posteriormente, se recibió la declaración de Vielka Cubero Moya, quien fue pareja del actor desde el 2009 y finalizaron su relación en el año 2021. Señala que era dueño y administraba un negocio comercial en playa espadilla de Manuel Antonio, un restaurante, el inmueble fue demolido, cree que en el año 2018, antes de la pandemia. La Municipalidad le señaló que tenía 15 días para desocupar y que estaba por demolerse. El actor ya tenía muchos años con ella, y conocía los problemas con la Municipalidad, ya se conocía que la intención municipal era de sacarlo y quitarlo de la playa. Él es una persona sumamente fuerte y valiente, casi no expresa sus emociones, pero lo que hizo fue buscar sus abogados para afrontar lo que la municipalidad le estaba notificando. Le afectó su salud, pese a ser una persona fuerte, nunca lo vi llorar, era una persona que trabajaba más de la cuenta, era una persona que le costaba expresar sus sentimientos, era gordito y dejó de comer, adelgazó mucho, comía muy mal, se dedicó a tratar de crear un nuevo negocio y meterse en cosas religiosas, se convirtió en una persona triste, separada de ella y de sus hijos, se aisló de ella, no quería que la gente supiera cómo se sentía, siempre fue una persona sumamente trabajadora. 24. De seguido, Se llama a la testigo Silvia María Ramírez Chaves, hermana del actor. Explica que el restaurante Balú estuvo a cargo de su hermano por más de 40-45 años, ella trabajaba ahí, con eso se pagó la universidad. Balú, Mar y sombra y las cabinas estaban en una sociedad, pero todo se hizo a través de su abuelo. Ahora hay mucha gente, hay varios negocios en la zona, al inicio se consiguió con el ITCO. Se pagaba en la municipalidad, se tenían recibos de todo, era un restaurante tipo rancho de madera, no era nada estrambótico, era regular, era la casita y el restaurante estaba también en la playa, ahí se servía, tenía como un techo y mesitas, nada sofisticado ni grande. La construcción en el 2018 la Municipalidad la botó. Las patentes de licor y otras se las había dado el papá, se pagaba todo el tiempo, él tenía todos los derechos. A él le notificaron y luego vinieron y le botaron. Aclara que ella trabajó desde los 14 o 15 años, y luego se hizo aeromoza, así que lo que hacía era ir en vacaciones, pero siempre se mantuvo el vínculo, era como el papá, él fue el que nos ayudó a todos los hermanos.

Después de la demolición, se aisló completamente, fue un shock, pasó de ser una persona feliz a amargada, ya que no tenía ni para pagar a los empleados, incluso afectó a sus hijos porque no pudo terminar de pagar el colegio, menos la universidad, era colegio privado. Cree que pasó por un proceso depresivo, no tenía para pagar, se hizo muy cercano a Dios, es hasta ahora que está un poco mejor. Ahora ella incluso es la que le ayuda en algo a él. El restaurante era el “machete de él”, se armó con el hijo otro restaurante, pero financieramente era sumamente difícil, quedó como a la deriva y ha salido a delante por ser una persona luchadora, creyente y no se da por perdido, se afectó a todos los que estábamos dependiendo de él. En contrainterrogatorio, le consta que Octavio construyó todo lo que estaba ahí, incluyendo el restaurante. El contrato del ITCO vencía, pero como siguieron pagando, cree que nunca venció.

Don Manuel le pasó a Guillermo, no sé si la municipalidad autorizó la cesión, pero la municipalidad cobraba. Los hermanos todos firmamos para que le quedara todo a su hermano. El actor iba a pagar a la municipalidad, incluso uno de los testigos de la muni, llegaba a decir que todo estaba en orden, cree que era una persecución. Para el 2018, cree que la municipalidad no le recibía la plata. (Audio y video en SIGAO).

25. Después se recibe a Egidio Araya Fallas, administrador, trabaja como jefe de la Unidad de Licencias de la Municipalidad de Quepos, como jefe desde hace 15 años y como funcionario 19, fue inspector, Jefe de Recursos Humanos y proveeduría y luego en licencias municipales. Cuando asume la jefatura tiene contacto con el expediente de este proceso. Para el año 2018, el actor no tenía licencias activas. Narra el trámite de cesión de licencias, ocupando trámite ante el municipio, no es posible que sea posible entre privados. Para el 2018, se giró la orden de clausura por no contar la licencia, existir orden judicial y levantamiento de medidas cautelares. Ese acto fue impugnado y rechazado, se procedió a la clausura del establecimiento. En contrainterrogatorio, no recuerda que el actor haya tramitado de cesión de patente, había en el expediente una solicitud como en el año 2000, pero no fue aprobado, desconoce las razones. Detalla que la medida cautelar, era de suspender el acto, que fue rechazada después por la jueza en apelación. (Audio y video en SIGAO).

26. Finalmente, se recibe la declaración de Víctor Hugo Acuña Zúñiga, administrador, encargado de la zona marítimo terrestre desde finales del 2006, entró a laborar en la municipalidad desde 1999 como inspector y desde ese momento conocía del caso. Afirma conocer del contrato del señor Ramírez con el ITCO, el contrato forma parte del expediente que está a nombre de una sociedad Oivatco, ellos hicieron una sociedad para tramitar una concesión de un restaurante que se llamó Mar y Sombra en playa espadilla. Ese contrato vencía como en el 1974, era de 5 años, no le consta que el contrato hubiese sido traspasado. No puede afirmar que la construcción la hiciera Don Octavio, estaba el restaurante Mar y tierra, Caricosta que eran cabinas y se decía que el restaurante Balú era de un hermano. La Procuraduría y Contraloría ya habían hecho observaciones de la administración de zona marítimo terrestre.

Se había constatado en los estudios que el restaurante Balú estaba en zona pública. No hubo ni hay concesión a Guillermo u Octavio. La resolución de desalojo y demolición, del Concejo Municipal desde el 2000, había ordenado por estar en zona público, la Contraloría en el 2006 lo reiteró. Afirma no es posible tener restaurantes en zona pública, según la ley de zona marítimo terrestre. Se notificó al señor conforme el 12-13 de la Ley de Zona Marítimo Terrestre, para desalojar y demoler, aspecto que incluso ha reconocido la Sala Constitucional. El gestor ambiental y biólogo ambiental de la municipalidad se determinó que las construcciones estaban en zona pública (ubicación geográfica), y señaló peligro de daño ambiental, dado que las tuberías daban a tanques sépticos que es amenaza y riesgo de contaminación o filtración hacia la playa, como un riesgo a la zona pública. Los tanques sépticos estaban unos en la zona pública (Caricosta y Balú) y de Mar y Costa estaba en parte en zona restringida.

Ese informe fue reiterado por el Ministerio de Salud. Explica el trámite de construcción en zona pública. Explica que, realizada la demolición se realiza un informe de costos de la demolición y se realiza un cobro. Se inventaría las horas y cantidad de funcionarios (valor de salario – hora), el valor de la maquinaria rentada o municipal (costo del uso del equipo), se suma todo y se notifica. En contrainterrogatorio, detalla que conoce el actor por ser el que estaba en el restaurante Balú, cuando era inspector (desde 1999), por lo que se revisaba si contaban con permisos de funcionamiento y de patente, y desde esa época se sabía que no podía estar en zona pública. Desconoce cuánto tiempo tenía el local de estar ahí. No precisa cuántas inspecciones realizó en el lugar, pero fueron más de una. Sobre el contrato del ITCO, lo conoce por estar en el expediente de OIVATCO, por eso lo ha tenido a la vista.

La demolición del 2018, hay un acuerdo del concejo que acordaba suspender las patentes y hacer el proceso de demolición, estaba también los informes de contaminación ambiental y la potestad de la Ley 6043. En la notificación de demolición se citó el peligro o daño ambiental, y la firmeza de lo que el señor había impugnado antes que el señor perdió. El proceso judicial era por el acuerdo del Concejo del 2000, por estar en zona pública. (Audio y video en SIGAO).

II. HECHOS NO PROBADOS

Se tienen como hechos no probados de relevancia para el proceso: 1. Que la Municipalidad accionada se haya acogido a la aplicación de la ley 10.000 conforme el art. 6 de la misma norma. (No hay prueba en autos al respecto). 2. Que la edificación denominada “Balú” no se encontrase en zona pública marítimo terrestre. (No hay prueba en autos al respecto).

III. OBJETO DEL PROCESO

La parte actora en este proceso en su demanda reclama una responsabilidad administrativa civil de hacienda del municipio por una conducta desplegada por éste al desalojar y demoler la infraestructura denominada “Bar Balú” que era de su propiedad. Explica que la estructura tenía más de 40 años de construida (tal y como se acreditó en un proceso penal en 1992), habiendo sido levantada por su abuelo Octavio Ramírez Garita antes de la entrada en vigencia de la ley 6043, el cual había obtenido del ITCO un derecho de ocupación bajo arriendo por 5000 metros en dicha zona, siendo las patentes y ocupación trasmitidas a su hijo Manuel Ramírez Muñoz, quien a su vez le transmitió por venta privada al actor en 1988, tramitándose el traspaso al Concejo Municipal, guardando el municipio silencio al respecto, aunque el actor se hizo cargo del negocio y procedió a pagar las patentes, impuestos territoriales, alquiler, siendo los recibos emitidos a nombre de OVIATCO SA o a nombre de Manuel.

Aclara que OVIATCO fue una sociedad creada en los años 70’s para construir 3 restaurantes, cabinas, cabañas y cuartos en la zona de Playa Espadilla, administrado por el actor y su padre. Señala que el 9 de febrero de 2018 la Alcaldía Municipal emite la resolución 001-DEM-ESP-2018 la cual dispone el desalojo y demolición del bar restaurante Balú, siendo notificada el día 14 e impugnada el día 20 del mismo mes y año. Tras rechazar el recurso de revocatoria y elevarlo a la Jerarquía Impropia, ésta, por medio de resolución 519-2019 del 23 de octubre de 2019 anula el acto impugnado por infringir la ley 9373, dado que el Municipio lo había acogido por acuerdo 15 art. 7 de la sesión ordinaria 052-2016. Especifica que, previo a dicha resolución, entró en vigencia la ley 9577 (que prorroga la ley 9373), la cual también fue acogida por el municipio accionado vía acuerdo municipal, norma que, de igual manera, fue prorrogada por ley 10.000 del año 2021, con vigencia al 1 de julio de 2024.

Afirma que, al anularse por la Sección III el acto que le daba sustento al desalojo y demolición, este deviene en un acto disconforme con el ordenamiento jurídico e ilegal, la cual provocó severos daños y perjuicios, comenzando con las ganancias que podía haber generado producto de la explotación de la actividad comercial que se ha realizado en dicho inmueble desde hace más de 40 años ya que según la Ley 10.000 aun tendría plazo a su favor hasta el año 2024, con la consecuente necesidad de liquidar a empleados e incluso tener que pedir dinero prestado para pagar sus deudas. Además de ese daño material, sufrió un grave daño a su salud emocional, física y familiar, ya que la demolición de su herencia familiar fue traumatizante. Desarrolla que la Municipalidad desde mucho antes había intentado desalojar al actor, incluso, en el año 2000 no le renovaron más los permisos de funcionamiento y ordenando el desalojo llevando el asunto a sede judicial ante el Juzgado Contencioso Administrativo y Civil de Hacienda, el cual, en sentencia 497-2016 “sentencia ayuna de fundamentación y sumamente omisa y deficiente sobre todo en lo relativo a la valoración de la prueba” declara sin lugar la demanda, siendo que la Sala Primera rechazó la casación por motivos formales sin entrar a abordar el fondo del asunto.

No obstante, como lo señala la Jerarquía impropia, la sentencia del juzgado no ordenó el desalojo ni la demolición, sino que se limita a rechazar las pretensiones del acá actor. De ahí que la Municipalidad nunca ejecutó los actos del 2000, los cuales en ningún momento se sustentaron en un daño ambiental, sino en la ubicación del bien en zona pública y la carencia de concesión del actor, de ahí que la Sección III le diese primacía a la ley 9373 y rechazando el cambio de motivación al no acreditarse el supuesto daño ambiental, es decir, dando protección de la ley 9373 aún contra la sentencia en firme de aquél proceso. Es por ello que nace, al haberse ejecutado el desalojo y demolición en un acto nulo, un deber indemnizatorio, no siendo procedente ni siquiera el cobro de la demolición como lo pretende el municipio. Determina el daño material en el no percibir los ingresos durante el período en que pudo beneficiarse de la moratoria desde el 15 de febrero de 2018 al vencimiento del plazo de la ley 10.000 el 1 de julio de 2024, el costo de la liquidación de personal y los intereses de ambas sumas, estimando en la suma de 25 millones y el moral en 10 millones.

En réplica y conclusiones, reiteró que la base es la anulación de la Sección III de la orden de demolición en el 2018. Lo que hizo la Municipalidad es buscar la excepción de “daño ambiental” para así demoler. Estaba el actor bajo el supuesto de la moratoria. Reclama la inconsistencia en las declaraciones recibidas en juicio, ya que el acto de demolición fue anulado por Jerarquía Impropia, sin importar si estaba o no motivado, si estaba en zona pública o si estaba en daños ambiental o no. Se cambió la justificación para esquivar la moratoria. Señala que el voto de la Sala Constitucional al anular la ley 9373, reservó los derechos adquiridos de buena fe, con lo cual el actor estaba protegido. La municipalidad hasta el 2003 estuvo cobrando patentes comerciales y licores y estaban a nombre de Manuel, el papá del actor y de Oviatco. Señala que los meses de moratoria le hubiese podido hacer un ahorro o un acomodo con su negocio y trabajadores (24 meses). La norma exigía suspender desalojos y demoliciones. Los daños han de cuantificarse en ejecución, pese a que el daño moral fue acreditado con las declaraciones de los testigos en juicio.

IV. SOBRE LOS ARGUMENTOS DE LA MUNICIPALIDAD DEMANDADA

Frente a las alegaciones planteadas en la demanda, en lo medular el Gobierno Local de Quepos en su contestación y conclusiones responde de manera negativa la demanda señalando que el municipio nunca autorizó la cesión de patentes ya sea comercial o de licores a favor del actor, de hecho por medio de sesiones 195 del veinticinco de octubre de dos mil y 224 del primero de marzo de dos mil uno, el Concejo Municipal no sólo le denegó al petente la solicitud de permisos de funcionamiento sino que instruyeron a la administración para que iniciaran los procedimientos de desalojo y demolición, por lo que los pagos realizados por el actor fueron a su cuenta y riesgo. Afirma que, desde el contrato del ITCO nunca se le otorgó aprovechamiento de la playa, y en todo caso, aquel acto tenía un vencimiento de 5 años. De ahí que, con las visitas del inspector desde 1999, el Concejo suspende las patentes del actor y luego se le ordena salir y demoler.

Esos acuerdos fueron impugnados por el actor, obtiene una medida cautelar, y hasta el 2016 se resuelve, donde en sentencia confirma los acuerdos del Concejo y señala que el actor no tiene derecho de estar ahí, resuelve sobre el tema de los pagos (sentencia 497-2016) y rechaza los daños y perjuicios que acá se reclaman, quedando en firme ante el rechazo de la casación. La Municipalidad no demolió por la vigencia de la medida cautelar del proceso del 2001, no existe inactividad del Gobierno Local. La actuación del 2018 es un nuevo intento de la actora para suspender la resolución de patentes que le ordena detenerse, el cual confirma en mayo del 2018, que el rechazo de la medida cautelar para suspender la patente y resuelto en apelación en junio de 2018, se reconoce la sentencia 497-2016 como motivación e incluso la menciona. Se trata de volver a discutir algo que judicialmente ya estaba resuelto.

Son 17 años de tramitación administrativa en jerarquía impropia y judicial, no inactividad municipal. En el ínterin al entrar en vigencia las leyes de moratoria, fueron anuladas por la Sala Constitucional en voto 24.147 con efecto retroactivo. La resolución de jerarquía impropia 519-2019 se motiva en la ley 9373 que se fundamentó en una ley inconstitucional. El actor no es actor de buena fe, no es titular de un derecho, y el asunto ya estaba zanjado en sentencia en firme en su contra. De ahí que, los alcances de la declaratoria de inconstitucionalidad afectan directamente ese fallo de la jerarquía impropia. Rechaza los daños y perjuicios dado que no son amparables, dado que el cierre de la patente no estuvo bajo revisión de la resolución 519-2019, este estuvo en firme desde el proceso judicial que refiere a los actos del 2001, sino que se limita al tema, exclusivo, de los costos de demolición. De ahí que invoca el art. 190.1 (culpa de la víctima), así como el 195 de la LGAP. Reitera la falta de derecho, solicita la condenatoria de costas.

V. SOBRE LA ZONA PÚBLICA EN ZONA MARÍTIMO TERRESTRE

Este Tribunal en un asunto diverso al que acá se discute, realizó un abordaje de la zona pública marítima terrestre e incorporó un análisis histórico de la normativa aplicable, dada la trascendencia que posee para determinar las consecuencias jurídicas de una persona, sea autorizada o no, que saca provecho de dicha área. En aquél momento se expuso: “Nuestro punto de partida (puesto que es posible ir aún más atrás, pero resulta innecesario para este asunto) es la remisión a la Ley Orgánica del Instituto Costarricense de Turismo, Ley N° 1917 con vigencia desde el 9 de agosto de 1955, particularmente, en su redacción originaria, la cual disponía en su numeral 7° como parte del capital del Instituto, entiéndase, del patrimonio de éste, los terrenos comprendidos por la zona de “Milla Marítima” (inciso c) de la redacción original de la ley 1917)… Dicha referencia, ha de remarcarse, ya preexistía desde 1828, cuando por ley 162 se reservó una “milla de latitud sobre las costas del mar exclusive a favor de la marina, pesquería y salinas” (Colección de Leyes y Decretos, semestre primero 1828.

P. 86), seguida por la ley 128 del 19 de agosto de 1853, el art. 2 de la ley N° 5 de 1884 que establecía la “propiedad que la nación tiene sobre los terrenos baldíos es transmisible, a título oneroso o gratuito, a costarricenses o extranjeros, excepto los terrenos comprendidos en una zona de una milla de latitud a lo largo de las costas de ambos mares, y orillas de ríos navegables” y la Ley N° 11 del 26 de mayo de 1884 que en su art. 20 señalaba “Es de dominio público la zona marítimo – terrestre o espacio de las costas de la República que baña el mar en su flujo y reflujo y los terrenos inmediatos hasta la distancia de una milla” y finalmente en el art. 7 de la ley del ITCO 2825 de 1961. Tal posición ha sido recopilada desde vieja data con el voto 7-1993 de la Sala Primera de la Corte Suprema de Justicia que, en su fallo de las 15:05 horas expuso: “…desde la primera disposición jurídica emanada en la época republicana -Ley No.162 de 28 de junio de 1828- se estableció la reserva de una milla marítima en las costas de ambos mares, que según lo consignado en el Ley No. 128 de 19 de agosto de 1853, era así desde la época colonial por disposición de la Real Cédula de 15 de octubre de 1754.

(…) desde el nacimiento de Costa Rica como Estado independiente, la reserva de terreno a lo largo de ambos litorales no ha sido parte de los baldíos -las tierras realengas de la Colonia- sino que siempre ha estado sometido a un régimen jurídico distinto, el propio de los bienes de dominio público y, por lo tanto, no reducibles a propiedad privada. (…) Su actual régimen jurídico es el establecido por la Ley 6043 de 2 de marzo de 1977, sus reformas y su reglamento (Decreto No. 7841-P de 16 de diciembre de 1977), siendo esta Ley la primera específica sobre la materia. Le son inherentes las características de inalienabilidad e imprescriptibilidad (…) Por ser bienes de dominio público pertenecen al Estado, están sujetos a un régimen jurídico especial y su finalidad –destino- es el uso y aprovechamiento común. La inalienabilidad de estos bienes no significa otra cosa que su no pertenencia al comercio de los hombres de manera similar a la figura romanista de los bienes “extra comercium”.

Por lo tanto, dichos bienes no pueden ser enajenados –por ningún medio de Derecho Privado ni de Derecho Público- siendo consustancial a su naturaleza jurídica su no reducción al dominio privado bajo ninguna forma. De allí que otra de sus características sea su imprescriptibilidad, es decir, la no susceptibilidad de adquirirse mediante el transcurso del tiempo bajo la figura jurídica de la usucapión…” (Sentencia 2024006577 de las 9:42hrs del 30 de setiembre de 2024). Y, finalmente, en otra oportunidad se precisó que la denominada zona pública no es incompatible con la realización de actividades, cuando se resolvió en otro fallo: “… la ley 6043, Ley de la Zona Marítimo Terrestre (ZMT). Es importante advertir que, la regulación de dicha ley no se circunscribe, exclusivamente, a las denominadas zona pública y zona restringida a la que refiere el art. 10 de la referida Ley, sino que, además, regulación especial sobre manglares y esteros, insulares o continentales, calificándolos de zona pública, así como regímenes de actividad industrial y afines como el contenido en el art. 18 que incluye “construcción de plantas industriales, instalaciones de pesca deportiva o instalaciones artesanales, de obras portuarias, programas de maricultura, u otros establecimientos o instalaciones similares, para cuyo funcionamiento sea indispensable su ubicación en las cercanías del mar… construcción, instalación y operación de astilleros y diques secos o flotantes”, el art. 22 incluye “establecimiento y operación de instalaciones turísticas estatales de notoria conveniencia para el país”, así como otras obras de infraestructura que sean atientes al fin público de la zona pública; las vías de acceso (caminos) en el art. 23 y por consecuencia, la Ley General de Caminos Públicos y normativa conexa o asociada que se ejemplificó supra.

Sobre este espacio, desde la perspectiva de planificación, tendría mayor intensidad y dominancia la regulación portuaria y secundariamente, la regulación marítimo terrestre…” (sentencia 2024000606 de las 11:07hrs del 31 de enero de 2024). Como veremos en el fondo del asunto, estos antecedentes resultan de extrema relevancia para identificar los alcances de la situación jurídica de la construcción y operación de lo que acá se denominó “Bar Balú” que es objeto de este proceso.

VI. SOBRE LA LEY 9373, SU INCONSTITUCIONALIDAD Y LA APLICABILIDAD A LOS GOBIERNOS LOCALES

En otra oportunidad, conociendo de la prórroga de la Ley 9373, esta Cámara expuso: “Este Tribunal reconoce la pluralidad de administrados que, de una u otra forma, poseen contacto con la zona marítimo terrestre y que, a su vez, poseen condiciones jurídicas particulares. Así, encontramos los pobladores, aquellos que están indicados en el artículo. 75 del reglamento de la ley 6043, dicha calidad es personalísima y no puede ser trasmitida; conlleva una serie de requisitos que son: ser costarricense por nacimiento, tener más de 10 años viviendo en la Zona Marítima Terrestre, que no tenga bien inmueble a su nombre diferente del que ocupa en la zona, en el cual su calidad es precaria, ya que su ocupación se mantiene mientras tanto no se le reubique acorde con la planificación de la zona, teniendo derecho a indemnización de mejoras si tuviese que ser traslado y teniendo prohibido invadir la zona pública, con derecho de prioridad respecto a cualquier otra solicitud de concesión; encontramos también los otrora arrendatarios, término desarrollado por el artículo 73 del Reglamento y el Transitorio I de la Ley 6043, sujetos a una gran variedad de limitaciones, siendo modelos pre- concesionales acordados por la entidad correspondiente y el arrendatario para el aprovechamiento de la zona marítima terrestre, los cuales, en principio, debieron haber tenido un término final o prórroga, como lo establece dicho transitorio al afirmar que “… a su vencimiento y si fuere acordada su prórroga, se modificarán con arreglo a las normas de esta ley”, procurando un mecanismo ex lege de ajustarse a los lineamientos de la señalada ley de zona marítima; encontramos además los usuarios o permisionarios de uso, figuras otorgadas al amparo del 154 de la Ley General de Administración Pública como una autorización especialísima de goce, disfrute o aprovechamiento de un bien de dominio público, de calidad a título precario, pudiendo ser revocado por razón de oportunidad o conveniencia sin responsabilidad para la Administración, previo a un procedimiento levantado al efecto, otorgando un plazo prudencial para el cumplimiento del acto de revocación, de carácter personalísimo, no pudiendo vender, alquilar, ni en forma alguna traspasar su condición; siendo con ello la calidad más limitada de todos, ya que se encuentra condicionado al tipo de uso del cual sea beneficiario, lo que quiere decir que no puede, unilateralmente, modificar la naturaleza del uso otorgado; y por último el denominado solicitante de concesión, que es la condición que adquiere el o la costarricense o la persona jurídica con capital costarricense mayor de 51% de sus acciones, una vez presentada la respectiva solicitud ante la Municipalidad o de ser el caso, el Concejo Municipal de Distrito correspondiente, y no otorga ninguna clase de autorización, permiso, derecho de usar la parcela a la que se refiere su solicitud, es más, cualquier acto de ocupación o posesión que realice el solicitante del bien sin haber sido convertido en concesionario, se considera causal de archivo inmediato de su solicitud y sujeto imputable por el delito de invasión de la zona marítima terrestre, cargando con las costas de derribo de cualquier construcción levantada en el lugar (art. 13 de la ley 6043 y 22 del reglamento 7841-P); por último, los que no se encuentran en esta categoría, o que la tenían y posteriormente se venció, caducó o no prorrogó y permanecieron en el sitio, se consideran como ocupantes, que son aquellas personas que, no reuniendo las condiciones de poblador, haya ocupado la zona marítima terrestre, aun de forma no autorizada, con antelación a la vigencia de la ley 6043, sea antes de 1977, su calidad no puede ser ni trasmitida ni cedida y no tienen derecho de prioridad respecto a cualquier otra solicitud de concesión, no obstante, esta denominación fue ampliada a aquellos posterior a la vigencia de la ley 6043 y que configuran la población de destino tutelada en los términos de la ley 9577, describiendo el artículo 1° que son el conjunto de personas que habitan, tienen construcciones, actividades comerciales, agropecuarias o “cualquier actividad” de orbe lícito existente en la zona restringida, en tanto su existencia no provea un “daño ambiental o peligro o amenaza de daño al medio ambiente” conforme lo delimita el artículo 2° de la citada ley.

Así, es importante destacar el impacto que la ley 9577, que fue adicionada su vigencia por la Ley N° 10.000, del 2° de julio de 2021, ya que cubre a una gran población que, bajo términos generales, calificaría de ocupantes irregulares, susceptible de aplicación de los numerales 12 y 13 de la ley 6043, a saber, desalojo y demolición. No obstante, referidos a materia constructiva, el artículo 69 de la señalada ley ya regulaba desde su promulgación la existencia de construcciones “sin la respectiva autorización, conforme a esta ley”, agregando que tales “serán objeto de planificación de acuerdo con las normas urbanísticas que se dicten, las cuales les aplicarán gradualmente en casos de remodelaciones o reconstrucciones”, artículo que fue reglamentado en el numeral 74 del decreto 7841-P precisando que “De acuerdo con el artículo 69 de la Ley, las edificaciones y construcciones que se hayan levantado sin la respectiva autorización en predios de la zona restringida dados legalmente en arrendamiento o concesión conforme a leyes anteriores, deberán ser objeto de planificación de acuerdo con las normas urbanísticas que se dicten, las cuales se aplicarán gradualmente en casos de remodelaciones o reconstrucciones”, regulación que, como se dijo, fue ampliada por la ley 9577, concretamente el artículo 4° que señala “En ningún caso, la aplicación de esta ley favorecerá la constitución de derechos a favor de los ocupantes de las zonas objeto de la moratoria.

Asimismo, los ocupantes no podrán realizar modificaciones en las obras, a excepción de obras de mantenimiento, mejoras necesarias o urgentes, las cuales quedan autorizadas. Tampoco se podrán realizar modificaciones en las actividades y los proyectos ubicados en las zonas objeto de la moratoria”. Por su parte, estas obras de igual manera encuentran regulación en la ley 9242 del 9 de junio de 2014, que tiene por finalidad “regularizar las construcciones existentes en la zona restringida de la zona marítimo terrestre, definida en el artículo 10 de la Ley N.º 6043, Ley sobre la Zona Marítimo Terrestre, de 2 de marzo de 1977, y sus reformas, y legalizar el aprovechamiento de estas, mediante el otorgamiento de concesiones al amparo de dicha ley”, estableciendo el artículo 4: “Las municipalidades con jurisdicción en la zona restringida de la zona marítimo terrestre, que no cuenten con un plan regulador costero vigente, dispondrán de cuatro años para concretar la aprobación del plan.

Durante dicho plazo, las municipalidades podrán conservar las construcciones existentes, en tanto la autoridad administrativa o judicial competente no acredite la comisión de daño ambiental o peligro o amenaza de daño al medio ambiente”, plazo que fue ampliado por la ley 9984, por lo que el plazo cuatrienal señalado comenzó a partir del 15 de junio de 2021 cuando la modificación de la norma entró en rigor. Lo anterior aclarando la posibilidad de que se cobre un canon, sea cual sea su denominación, siendo común el uso de terminología como “permiso de uso, arriendo, derecho, canon de zona marítimo” o similares, que se entiende amparado en el transitorio VII de la ley 6043, en concordancia con el párrafo tercero del artículo 4 de la ley 9242 que señala “…dichas construcciones podrán ser utilizadas a título precario siempre que medie el pago de un canon por uso de suelo a título precario, fijado por la municipalidad de la respectiva jurisdicción.

El pago por uso de suelo en precario no generará derecho alguno”, así como la sujeción a otras cargas de orbe tributario como el pago del impuesto de bienes inmuebles y servicios municipales” (sentencia 74-2021-I de las 14:40hrs del 12 de agosto de 2021). No obstante, la Sala Constitucional, a través del fallo 24147 del 27 de octubre de 2021, declaró la inconstitucionalidad de la ley 9373, reiterando la posición dada en contra de la ley 9370 dada en voto 2019-012746, que provoca en consecuencia, el mismo efecto sobre las prórrogas, en tanto no se puede darle contenido jurídico válido a la prórroga de una norma inconstitucional. En aquel fallo, en lo que interesa, se dispuso: “Se declara con lugar la acción interpuesta contra la Ley No. 9373. En consecuencia, se anula por inconstitucional, la Ley No. 9373 de 28 de junio de 2016 denominada “PROTECCIÓN A LOS OCUPANTES DE ZONAS CLASIFICADAS COMO ESPECIALES”.

De conformidad con lo dispuesto en el artículo 91 de la Ley de la Jurisdicción Constitucional, esta declaratoria tiene efecto declarativo y retroactivo a la fecha de vigencia de dicha norma. De conformidad con el artículo 91 de la Ley de la Jurisdicción Constitucional esta sentencia tiene efectos declarativos y retroactivos a la fecha de vigencia de las normas anuladas, sin perjuicio de los derechos adquiridos de buena fe y las relaciones o situaciones jurídicas que se hubieran consolidado por prescripción, caducidad o en virtud de sentencia pasada en autoridad de cosa juzgada material”. En otro orden de ideas, pero de extrema relevancia para el presente asunto, está el tema de la aplicabilidad forzosa de la ley 9373 a los Gobiernos Locales, ello con ocasión de la redacción del art. 6 que tenía la señalada ley cuando afirmaba: “… ARTÍCULO 6.-Se autoriza a las municipalidades, en las zonas de su competencia, para que apliquen la moratoria en los términos establecidos en la presente ley, previo dictamen favorable del órgano municipal competente” (Resaltado es nuestro).

Este numeral revela dos aspectos esenciales de impacto en el presente asunto, el primero de ellos, recordando la naturaleza jurídica de las Municipalidades, así como de la autonomía que poseen la cual deriva directamente de la Constitución Política (véase el voto 5445-99 de la Sala Constitucional), fuerza a que, cualquier ley que se emita y que tenga un impacto directo en las competencias locales, deba llevar, a nivel de trámite legislativo dos particularidades que no se encuentran presentes cuando se emite normativa para otros entes públicos: la obligatoria consulta a cada Gobierno Local en el trámite legislativo y el segundo, es la votación calificada preceptiva para vincular a las Administraciones Locales a la normativa que se promulga. En este caso, le ley 9373, tramitada en el Órgano Legislativo bajo el número de expediente 19.139 no llevó tal trámite, sino que se encaminó como una ley ordinaria, al punto de haber sido aprobada por mayoría simple en segundo debate como se puede consultar en el acta ordinaria N° 33 del 23 de junio de 2016 de la Asamblea Legislativa donde el Presidente Legislativo señaló: “…Quienes estén de acuerdo con aprobar en segundo debate el expediente 19.139, Ley de Protección a los Ocupantes de las Zonas Clasificadas como Especiales, lo manifestarán poniéndose de pie.

Para su aprobación se requiere de simple mayoría. Treinta y cuatro a favor, seis en contra…” (véase folio 706 del expediente legislativo, imagen 711 del expediente en digital consultable en la dirección https://www.asamblea.go.cr/Centro_de_informacion/Consultas_SIL/SitePages/ConsultaLeyes.aspx). La ley en comentario no tenía el carácter vinculante hacia los Municipios y, de hecho, establecía a través del señalado art. 6 que habilitaba de manera potestativa el acogerse a la moratoria, de ahí el uso de la expresión “autorícese” y, de manera adicional, exigió un trámite especial para ello, que consistía en tomar la decisión por el órgano competente que, en este caso, sería el Concejo Municipal conforme las competencias del art. 13 del Código Municipal, previa emisión de un criterio técnico favorable, que podría incluir de manera multidisciplinaria a lo interno del Cabildo como por ejemplo el criterio técnico: legal, financiero, urbanístico, ambiental y, por supuesto, del propio departamento de zona marítima terrestre. Con ello, no podemos afirmar que la publicación y entrada en vigencia de la ley 9373 provocó, de manera automática, una suspensión de las competencias municipales por los motivos ya señalados.

VII. SOBRE EL CASO CONCRETO. AUSENCIA BASE DE INTERÉS LEGÍTIMO NO TUTELABLE

En síntesis, este proceso busca que se declare una responsabilidad civil de hacienda por la demolición y desalojo de la edificación denominada “Balú” cuya explotación realizaba el actor en Playa Espadilla de Quepos, reclamando que el acto que ordenó ambas conductas, las que identifica como resolución 001-DEM-ESP-2018 de la Alcaldía de Quepos, fueron anuladas por la Jerarquía Impropia Municipal a través de la resolución 519-2019, fundamentándose en el goce de la moratoria de la ley 9373, la cual fue prorrogada por las leyes 9577 y 10.000. En contratesis, la accionada manifiesta que el origen de la anulación del acto se motivó en leyes que fueron declaradas inconstitucionales por la Sala Constitucional, y que la conducta como tal provienen de actos municipales en firme del año 2001 y que fueron confirmados judicialmente a través del proceso 01-000192-0163-CA, no siendo posible ubicar al actor como beneficiario de la moratoria de aquellas leyes y sometiéndolo a la retroactividad decretada por el Tribunal Constitucional.

CRITERIO DEL TRIBUNAL: De previo a referirnos sobre el fondo del asunto, debemos aclarar que, en este proceso, no se discute la validez de la resolución 001-DEM-ESP-2018, ni de la resolución 519-2019 de la Jerarquía Impropia que la anuló, ya que en este proceso no se incorporaron a través de las vías procesales respectivas, pretensiones con tal finalidad. Conforme a los hechos probados (específicamente los hechos 8, 9, 16 y 19) lo que encontramos es una decisión administrativa municipal formal (acto) que es ejecutada (conducta) mientras se encontraba en trámite la impugnación, con el inconveniente de que, producto de esta impugnación, el acto base es suprimido, lo que produce un único efecto, y es que la conducta de ejecución se convierte, de manera sobrevenida, en lo que se conoce en doctrina como una vía de hecho, ello al margen de la opinión que puedan tener las partes o este Tribunal del sustento o razonamiento que expuso la Jerarquía Impropia y la valoración que realizó sobre la cosa juzgada (hecho probado 4).

Así las cosas, el objeto de este proceso será definir en estas líneas si tal vía de hecho sustenta o no, el origen de la indemnización que reclama la parte actora tanto en sus pretensiones principales como en su petitoria subsidiaria. Sobre este punto de partida, debemos recordar que los efectos que provocan los mecanismos de impugnación en sede administrativa municipal, lo que es un tema que podríamos denominar formal y que obliga a determinar si se genera o no responsabilidad civil de hacienda si se ejecuta un acto administrativo que se encuentra impugnado en jerarquía impropia en materia municipal y, sobre todo, si dicho control jerárquico después suprime o anula la conducta que se ejecuta o materializa. Para el momento en que el acto de la Alcaldía 001-DEM-ESP-2018 es emitido, el Código Municipal disponía (en su versión de la norma 24 de 58 a hoy, según SINALEVI), la posibilidad de cuestionar una resolución de Alcaldía a través de un recurso horizontal (revocatoria) y otro de alzada o vertical (apelación) ante el Jerarca Impropio, no tiendo en ninguno de los casos un efecto suspensivo en contra del acto, ello según el párrafo segundo del artículo 162 de dicha versión de la norma municipal, aunque permitía la adopción de medidas cautelares.

En este caso, la parte actora presentó una medida cautelar judicial dentro del expediente 18-001644-1027-CA, por lo que la accionada de manera unilateral suspendió la demolición (hecho probado 13), puesto que el desalojo ya se había dado en un primer momento (hecho probado 9), no obstante, tanto la medida cautelar provisionalísima como la definitiva fueron rechazadas en aquél proceso (hecho probado 14), el cual fue posteriormente desistido por el acá demandante. Es de manera posterior a ello que, por medio oficio -ALCP-2018 de fecha 4 de junio de 2018, la Alcaldía deja sin efecto el oficio 393-ALCP-2018 y ordena continuar con la ejecución de la resolución 001-DEM-ESP-2018 (hecho probado 15). Así las cosas, el hecho de ejecutar un acto emitido por el Alcalde, pese a estar impugnado no es, en sí mismo, una patología en la actuación municipal y habiéndose acreditado con los hechos probados citados que el Municipio demandado fue cauteloso previo a ejecutar la demolición (hecho probado 16).

Acá el problema se reduce entonces, al devenir en vía de hecho de la ejecución material del desalojo y demolición, por la intervención de la Jerarquía Impropia, aspecto que, en principio, es causa o motivo de una obligación indemnizatoria. Hemos de evitar confundir las vías de hecho con las conductas materiales que realiza la Administración, puesto que estas segundas pueden llegar a ser ejecuciones de actos formales, o resultar de conductas amparables al ordenamiento jurídico y que respetan, pese a la ausencia de una forma escrita, de la estructura exigida por nuestro ordenamiento de motivo, contenido y fin, así como de los demás requisitos no esenciales que permiten soportar la fiscalización ya sea administrativa o judicial. En cambio, las vías de hecho se caracterizan justamente por el yerro de no ser posible su justificación, de ahí que se imputan de formas arbitrarias de las potestades de imperio de la Administración, desviaciones de poder o ejercicios ilegítimos de atribuciones competenciales públicas, fuentes de responsabilidad civil de hacienda.

En este caso, esta situación – como se expuso supra – es la que se presenta de manera sobrevenida por la anulación por jerarquía impropia del acto 001-DEM-ESP-2018, no obstante, ese no es el único requisito necesario para que nazca una obligación indemnizatoria. De manera puntual, hemos de recordar el mandato constitucional contemplado en el art. 49 de la Carta Magna, que en su párrafo tercero señala: “… La ley protegerá, al menos, los derechos subjetivos y los intereses legítimos de los administrados”, lo cual es complementado y ampliado por los artículos 1, 2, 36 y 42 del CPCA, en el cual se amplían los aspectos tutelables y se incorpora el de situaciones jurídicamente tutelables. Lo anterior resulta de extrema relevancia para el fondo de este asunto, dado que la parte accionante afirma derivar dicha situación para sustentar su indemnización, la cual es negada por la parte accionada. Aclaramos que el actor no posee un derecho subjetivo, ni tampoco un interés legítimo, aspectos que quedaron más que claros en los hechos probados 2, 4 y 14.

Es más, de la propia ley 9373 invocada por el demandante literalmente se extrae del numeral 4° que rezaba: “En ningún caso, la aplicación de esta ley favorecerá la constitución de derechos a favor de los ocupantes de las zonas objeto de la moratoria. Asimismo, los ocupantes no podrán realizar modificaciones en las obras, las actividades y los proyectos ubicados en las zonas objeto de la moratoria”, lo que se repite en las leyes 9577 y 10.000. Entonces, el asunto se resume a que, en postura de quien demanda, estas tres normas le otorgaban una situación jurídicamente tutelable, sea el goce de la moratoria, aún pese a su situación irregular que ya poseía. Ahí encontramos el primer aspecto de relevancia, la situación tutelable se circunscribe, exclusivamente, al momento temporal de ejecución del desalojo y demolición, no al tener que soportar éstos, puesto que tal condición ya había sido previamente definida administrativa y judicialmente.

Las tres normas citadas no tienen (ni tuvieron) la capacidad jurídica de suprimir la definición jurídica de un administrado en zona marítimo terrestre, sea en regular o irregular, sino que lo único para lo que sirvió, es para controlar, temporalmente, cuándo ejecutar conductas de restitución demanial. De ahí que, resulta palmariamente infundamentada la pretensión tercera, puesto que la posibilidad indemnizatoria de la edificación incluso fue tema de pronunciamiento expreso en la sentencia 497-2016 (hecho probado 4), por lo que la falta de derecho resulta evidente, situación que ocurre de igual manera con la pretensión 6 de reintegro de pago de extremos laborales a sus empleados pues, como se dijo, esta era la consecuencia necesaria e inevitable, de ejecutar el desalojo y demolición, sin que se haya acreditado que el actor pudiese continuar su actividad a través de otro local comercial. Ha de adicionarse que, en este supuesto, no sólo era un resultado previsible y de pleno conocimiento del actor desde el año 2000, sino desde el 2017 cuando quedó en firme la sentencia 497-2016 (hechos probados 2, 4 y 6).

De manera consecuente, la litis ha de desarrollarse en los términos de que, ante la anulación del acto 001-DEM-ESP-2018 de manera sobrevenida y la ejecución del desalojo y demolición, es posible reconocérsele la situación de la moratoria, que se traduciría prácticamente, en la pretendida continuidad de explotación a la que se refiere la pretensión 4 y la subsidiaria, así como un daño moral de la pretensión 7. A ello, la tesis del demandante no es atendible, veamos. Lo primero a traer a colación, es el agravio municipal que refiere a la aplicación del art. 195 de la Ley General de Administración Pública, el cual reza: “Ni el Estado ni la Administración serán responsables, aunque causen un daño especial en los anteriores términos, cuando el interés lesionado no sea legítimo o sea contrario al orden público, a la moral o a las buenas costumbres, aún si dicho interés no estaba expresamente prohibido antes o en el momento del hecho dañoso” (resaltado es nuestro), puesto que es, justamente, en este último supuesto desarrollado en el numeral que se enmarca la especie fáctica de este proceso.

La anulación de la resolución 001-DEM-ESP-2018 por parte de la Jerarquía Impropia Municipal, que ha de insistirse, se trata de un acto administrativo, pese a ser emitido por un órgano jurisdiccional, se fundamenta en la aplicación de la ley 9373, no obstante, ésta fue posteriormente declarada inconstitucional por voto 24147 del 27 de octubre de 2021, con efectos retroactivos. Lo anterior implica que, de manera necesaria, la situación jurídicamente tutelable y amparable a la ley 9373 y sus prórrogas a favor del demandante, devino en contrario al orden público, y en específico, al orden constitucional. Esta situación hace que, pese a la existencia de una patología en la conducta administrativa (vía de hecho), la situación del actor no es tutelable por el efecto dado por el fallo del Tribunal Constitucional, dando suficiente motivo para el rechazo de las referidas pretensiones indemnizatorias.

Ahora bien, sin demérito de lo dicho, las partes en el proceso también discutieron los alcances del señalado fallo a través del efecto del art. 91 de la Ley de la Jurisdicción Constitucional el cual excepciona del efecto retroactivo sobre “derechos adquiridos de buena fe y las relaciones o situaciones jurídicas que se hubieran consolidado por prescripción, caducidad o en virtud de sentencia pasada en autoridad de cosa juzgada material”. Al respecto, coincide esta Cámara con la posición accionada, como se dijo anteriormente, el actor no contaba con un derecho subjetivo o interés legítimo de buena fe, ni tampoco una situación consolidada por prescripción o caducidad, de hecho, contaba con dos actos administrativos que fueron confirmados judicialmente a través del proceso 01-000192-0163-CA, lo que más bien confirmaría que, la situación había sido definida bajo cosa juzgada material en contra del acá demandante, lo que le impide, por ende, de beneficiarse de la excepción del referido art. 91 de la Ley Reguladora de la Jurisdicción Constitucional, y recordando que lo resuelto por la Jerarquía Impropia es función administrativa y no judicial, no es posible darle efecto de cosa juzgada a la resolución 519-2019 del 23 de octubre de 2019.

Ahora bien, a mayor abundamiento de razones, conforme el Considerando V de esta sentencia, se extrae otro motivo más de la no posibilidad de amparo de la posición demandada, y es el hecho acreditado y no controvertido de que la edificación y la actividad se realizaban en zona pública marítima terrestre. Conforme se detalló en aquél considerando, bajo ningún supuesto, a lo largo de la historia de Costa Rica como República (e incluso aún antes) se ha habilitado el aprovechamiento privativo de esa área, por lo que la pretensión de reconocer una continuidad de actividad no puede ser calificada de otra cosa como abiertamente contradictoria con el orden público, siendo aún más gravoso sin ni tan siquiera contar con una patente, permiso, licencia o concesión que lo habilite, tomando en consideración de que la parte no desacreditó que el edificio o la actividad se realizasen en esta franja de particular tutela.

Y, finalmente, pese a la posición del actor que considera que el denominado riesgo ambiental no fue probado, coincidiendo con la posición – severamente cuestionable, dicho sea de paso – de la Jerarquía Impropia Municipal, lo cierto es que en autos se trajo como prueba no sólo el demeritado oficio UTA-006-18 de fecha 18 de enero de 2018 de la Unidad Técnica Ambiental Municipal (Hecho probado 7), sino también el oficio PC-ARS-Q-IT-101-2018 de fecha 18 de julio del 2018 del Ministerio de Salud (hecho probado 17), el cual no fue cuestionado o debatido por la parte actora, que se acredita con elementos de convicción técnica la infracción del art. 50 Constitucional de un ambiente sano y ecológicamente equilibrado por parte de la edificación y la actividad en la zona pública de Playa Espadilla, lo que genera otro motivo de riña y contradicción con el orden público constitucional. Así las cosas, la posición del actor no es amparable al carecer de un derecho subjetivo, interés legítimo o situación jurídicamente tutelable para sustentar sus pretensiones.

VIII. SOBRE EL ANÁLISIS DE LAS PRETENSIONES EN CONCRETO

Por lo anterior y de manera consecuente, al aplicarse la excepción o causal de exoneración del art. 195 de la Ley General de Administración Pública invocada por la parte demandada, ha de rechazarse la totalidad de pretensiones principales de la demanda, haciendo la aclaración de que la pretensión subsidiaria también lleva el mismo resultado, por cuanto se trata de un ajuste de la pretensión 4 principal, la cual, por los mismos motivos que originan el rechazo de ésta, ha de denegarse la subsidiaria. Como la pretensión primera y segunda son pretensiones generales, por el razonamiento dado en el considerando anterior han de rechazarse ambas, así como las pretensiones accesorias de intereses contenida en la pretensión 2. Sobre las costas (pretensión 8), aténgase a lo que se resuelve infra.

IX. SOBRE LAS EXCEPCIONES PLANTEADAS

La representación demandada opuso la defensa de falta de derecho, la cual atendiendo los alegatos del razonamiento expuesto en esta sentencia, debe ser acogida en todos sus extremos.

X. SOBRE LAS COSTAS

Respecto a las costas, de conformidad con el numeral ciento noventa y tres del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena sólo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, el Tribunal estima que no existe mérito para la exoneración en costas, consecuentemente son ambas costas a cargo de la parte accionante, las cuales serán liquidados en la fase de ejecución de sentencia.

POR TANTO

Con base en los fundamentos de hecho y derecho expuestos, se acoge la defensa de falta de derecho. Consecuentemente, se declara SIN LUGAR en todos sus extremos la demanda interpuesta por GUILLERMO RAMÍREZ CHAVES contra la MUNICIPALIDAD DE QUEPOS. Son ambas costas a cargo de la parte actora, las cuales serán liquidadas en la fase de ejecución de sentencia. Notifíquese.
