The ESTADO participates as an interested third party (tercero interesado), represented herein by State Attorney Mariamalia Murillo Kopper, Bar membership number 11806. Likewise, attorney Johanna Moreno Bustos, Bar membership number 5757, participates as counsel for the plaintiff, and attorney Fressia Patricia Guzmán Mena, Bar membership number 7750, as counsel for both ASADAS.

BACKGROUND

I.On 25 de setiembre de 2017, the plaintiff filed the complaint, asserting the following claims for relief (pretensiones), which were adjusted at the preliminary hearing (audiencia preliminar): “1) That the co-defendant associations be ordered to return to the plaintiff the disputed land, corresponding to the portion of land unlawfully occupied and used by the defendants from the property registered in the Alajuela Registry District under the Real Folio System, registration number 401761-000.

  • 2)That, should the defendant associations fail to return that area to the plaintiff within fifteen days after the judgment becomes final, their eviction be ordered with the assistance of the Fuerza Pública.
  • 3)That the defendants be held jointly and severally liable for payment to the plaintiff of the procedural and attorneys’ costs (costas procesales y personales) of these proceedings.
  • 4)That the co-defendant associations be held jointly and severally liable for payment of the damages (daños) caused to my client by its lack of possession of that area of the property from the date on which it acquired it, seis de septiembre del año 2004, to the present. These consist of: pecuniary damage (daño material), comprising all material losses sustained by my client on the property because of the absence of management plans for the aquifer, forest, and environment, resulting in erosion and contamination of my client’s property, which damage is estimated at veinte millones de colones; non-pecuniary harm (daño moral), which I estimate at veinte millones de colones and which concerns the frustration arising from the legal and material uncertainty to which my client is subjected by being required to comply with the encumbrances and restrictions of Ley Forestal 7575 while having no control over the activities that the defendant associations conduct on its property subject to that law, compounded by the fact that the boards of directors of the defendant associations are renewed every two years, meaning that different persons enter the property on each occasion, making it difficult to reach agreements and limiting the possibility of negotiation; moreover, to date, it has been impossible to have these associations provide in advance the monthly schedule for preventive and corrective maintenance of the infrastructure that they maintain on my client’s property without any permission, resulting in many people wandering through the property without identifying whether or not they belong to the associations, which radically impairs my client’s ownership rights.
  • 5)That the defendant associations be held jointly and severally liable for payment of the lost profits (perjuicios) suffered by my client, consisting of all monies it has failed to receive from leasing, for environmental services, the area of the property occupied by the defendants, as well as payment for exploitation of the water resource located on my client’s property, which I estimate at veinte millones de colones.” At the preliminary hearing of 11 de diciembre de 2018, it was clarified that the non-pecuniary harm was subjective in nature, while at the preliminary hearing dated 1 de diciembre de 2021, claim 6 was withdrawn. (See audio recordings in SIGAO, as well as the preliminary-hearing minutes at images 375 and 800 of the digital judicial case file).

II.After service was duly effected, ASADA de Cuestillas y Ron Ron filed a response denying the complaint on 16 de noviembre de 2017, asserting the defenses of limitations (prescripción), lack of standing to sue and be sued (falta de legitimación activa y pasiva), and failure to state a legal entitlement (falta de derecho). ASADA de Pénjamo, for its part, filed a response denying the complaint on 17 de noviembre de 2017, asserting lack of standing to sue and be sued. (See images 135-142 and 159-174 of the digital judicial case file).-

III.The plaintiff filed a reply on 29 de octubre de 2018, submitting additional documentary evidence (prueba documental). (Images 233-235 of the digital judicial case file.

IV.The preliminary hearing was held in four sessions, the first on 11 de diciembre de 2018, at which AyA was ordered joined as a defendant, and SINAC and the Estado were invited to participate as interested third parties. SINAC stated that it had no interest in the matter, and the Estado, in a filing dated 17 de diciembre de 2018, stated its willingness to participate in that capacity. (Images 374-376, 385, and 391 of the digital judicial case file).

V.AyA filed a response denying the complaint on 14 de febrero de 2019, asserting the defenses of lack of a current legal interest (falta de interés actual) and failure to state a legal entitlement. (Images 401-437 of the digital judicial case file).

VI.By order issued at thirteen hours and thirty-two minutes on 17 de abril de 2024, the administrative record (expediente administrativo) was ordered produced as additional evidence to assist the Court in reaching its decision (prueba para mejor resolver); it was forwarded by the municipality, which entered an appearance at that time. (Images 57-85 of the digital judicial case file).

VII.The second, third, and fourth sessions of the preliminary hearing were held on 22 de abril de 2019, 7 de febrero de 2020, and finally 1 de diciembre de 2021. During those sessions, the claim for non-pecuniary harm was clarified as subjective, and claim 6 was withdrawn. The disputed facts (hechos controvertidos) were established, and the documentary and testimonial evidence (prueba testimonial) to be received at trial was admitted. The hearings were held in the presence of all parties. ((Audio recording in SIGAO and minutes at images 543-545, 615-616, and 799-807 of the digital judicial case file).

VIII.The oral and public trial was held on 22 de julio de 2024, attended only by the defendants, with no justification offered for the absence of the plaintiff or the Estado. Procedural-curing matters (aspectos de saneamiento) and witness substitution were resolved, opening statements were presented, the plaintiff’s evidence was declared incapable of being received because of its failure to appear, the remaining testimonial evidence was received, and, finally, closing arguments were presented orally. (Audio and video recordings in SIGAO).

This judgment is rendered unanimously within the statutory period, following deliberation by the members of the Court, with no grounds found that could invalidate the proceedings, excluding the holidays of 25 de julio and 2 de agosto de 2024 from the calculation.- Drafted by Judge Mejías Rodríguez, with the concurring votes of Judges Bolaños Salazar and Gómez Chacón.- REASONS

I.PROVEN FACTS.- The following facts of importance to the resolution of this matter have been duly established: 1) The real property registered in the Alajuela Registry District under number 2-401761-000 has survey plan A-0821732-2002, with no recorded creation of aqueduct or right-of-way easements (servidumbres de acueducto o de paso). It was acquired by the plaintiff on 17 de setiembre de 2004, subject to a transferred easement (servidumbre trasladada) (entries 0277-00007480-01-0002-001), as well as restrictions under Ley Forestal N° 7575 arising from a forest-protection project for water resources covering 53 hectáreas 7377,16 metros cuadrados, an encumbrance recorded from 23 de noviembre de 2015 to 23 de noviembre de 2020. Under forestry contract SC-01-222-0024-2015, the plaintiff agreed to restrict its activities on that land by undertaking to: “a) Protect the forest, vegetation cover (cobertura vegetal), and regeneration processes within the area covered by this contract and, consequently, refrain from cutting trees or any type of vegetation. b) Retain a duly licensed forestry manager (Regente Forestal) responsible for technical implementation throughout the term of the contract. e) Prevent and control forest fires. d) Prevent and avoid illegal hunting and the illegal extraction of other forest products. e) Refrain from agricultural and/or livestock activities. f) Refrain from cutting and extracting timber products. g) Refrain from any activity that alters the natural behavior of the area to be protected. h) Notify MINAE of any alteration or contingency causing changes in the protected area. i) Allow MINAE and FONAFIFO inspection personnel free access to the area subject to PSA and facilitate their work. j) Assign to the Fondo Nacional de Financiamiento Forestal the environmental services generated by its forest. k) Comply with any written technical recommendation issued by MINAE or the forestry manager.” (Images 2-5 and 14-38 of the digital judicial case file).

  • 2)The stated property originates from the real property registered in the Alajuela Registry District under number 2-079296-000, which, through an apparent representative, issued authorization over the entire property on 9 de agosto de 2005 so that co-defendant ASADA de Pénjamo could complete the procedures for filing a water-resource claim (“denuncio”). As a result of those proceedings, the co-defendant obtained a total of four springs (nacientes) for use under a public water-supply concession (concesión de agua poblacional), identified as Maroto 1, Maroto 2, Maroto 3, and Rigiioni, pursuant to decisions DA-1434-2006 and SUB-GSC-GA-2014-2819. (Image 15 of the digital judicial case file and folios 19 and 44-45 of physical administrative file 435R of the MINAE Water Department).
  • 3)Likewise, co-defendant ASADA Cuestillas y Ron Ron obtained a concession over the stated property originating from the real property registered in the Alajuela Registry District under number 2-079296-000, covering two springs named Naciente Cuestillas de Ron Ron and La Roca, pursuant to decision DA-1927-2014 dated 4 de noviembre de 2014 and decision DA-0739-2015 dated 20 de julio de 2015. (Folio 44 of physical administrative file 435R of the MINAE Water Department and folios 5-6 and 12-13 of administrative file 1351R of the same department).
  • 4)Co-defendant ASADA de Cuestillas y Ron Ron has had a delegation agreement (convenio de delegación) with co-defendant AyA for the community aqueduct and sewerage system since 28 de noviembre de 2005. (Images 145-157 of the digital judicial case file).
  • 5)The co-defendant ASADA de Pénjamo has had a delegation agreement (convenio de delegación) with co-respondent AyA for the community water-supply and sewerage system since 8 de enero de 2008. (Images 441-453 of the digital court file).
  • 6)On 30 de setiembre de 2014, the co-defendant ASADAS and the plaintiff’s representative jointly petitioned SINAC to delimit the 200-meter protection area (área de protección) around the springs (nacientes), pursuant to the Ley de Aguas. (Image 39 of the digital court file).
  • 7)By memoranda dated 22 de junio de 2015, 29 de junio de 2015 and 15 de febrero de 2017, the plaintiff sent letters to the respondents for the purpose, in summary, of coordinating the activities of the respondent ASADAS, identifying those who enter the property, and planning activities, as well as expressing its concern regarding impacts on the area enrolled in a forestry program. (Images 40-43, 55-56 of the digital court file).
  • 8)In response to the requests submitted by the plaintiff, ASADA de Pénjamo issued official letters ASAPEN-005-2016 dated 13 de junio de 2016, and ASAPEN-012-2017 and ASAPEN-014-2017, both dated 22 de febrero de 2017. (Images 44-47, 57-60 of the digital court file).
  • 9)On 11 de febrero de 2019, AyA issued a technical opinion concerning the water intakes (captaciones) of the co-defendant ASADAS. As relevant here, the report states: “… According to statements made by representatives of ASADA de Pénjamo, the water-supply system was built in 1971 with assistance from Municipalidad de San Carlos; there are no files or construction plans establishing the date of construction. The representatives of ASADA de Cuestillas - Ron Ron stated that they did not know the year in which the water-supply system was built; however, they estimated that it had existed since the 1980s... to access it, one must first cross the property owned by the Esquivel Lobo siblings and then the property owned by Comercial Agrícola Ganadera Monte Carmelo, following a trail through the forest. During the inspection, no infrastructure works altering the environment were observed. Sections of the PVC conveyance pipeline for both water-supply systems are exposed and visible from the trail.

ASADA de Pénjamo has only one concrete intake structure, approximately 3,65m wide by 3,65m long, which appears to be of old construction but remains operational. It has no perimeter fencing. The conveyance pipeline leaving the intake has a diameter of 63mm and runs for approximately 160 meters within the property of Comercial Agrícola Ganadera Monte Carmelo… Three other concrete intake structures of different sizes, owned by ASADA de Cuestillas - Ron Ron, were observed and are operating properly. Recent painting and cleaning work is evident, and they have perimeter fencing. The intakes converge into a 63mm-diameter pipe that runs 188 meters from that point to the boundary of the property of Comercial Agrícola Ganadera Monte Carmelo… There are no storage tanks or disinfection equipment on the site. No new infrastructure works constructed by either ASADA were observed on the property. The Pénjamo water-supply system has two different systems serving its 401 connections: the Maroto system, which records an output of 5,69 liters per second, and the Rigionni spring, with an output of 6,62 liters per second, according to data from the latest flow measurements (aforos) performed by the ASADA during the dry season.

A water-balance calculation (balance hídrico) was conducted, and it was determined that the water-supply system currently requires a maximum daily flow of 7,43 liters per second to meet community demand and that, in twenty years, a flow of 14,78 liters per second will be required. It is therefore concluded that the flow supplied by the Maroto spring is essential to provide drinking water to the current and future population of the community of Pénjamo. The Cuestillas - Ron Ron water-supply system relies solely on the Maroto spring to supply its 368 service connections. The most recent dry-season flow measurement conducted by the ASADA recorded a flow of 6,3 liters per second. A water-balance calculation was conducted, and it was determined that the water-supply system currently requires a maximum daily flow of 6,8 liters per second to meet community demand and that, in twenty years, a flow of 13,5 liters per second will be required.

This Technical Unit therefore concludes that the flow supplied by the Maroto spring is essential to provide drinking water to the current and future populations of the communities of Cuestillas and Ron Ron. Based on the observations and the information contained in the property’s cadastral plan (plano de catastro), it is estimated that the springs’ protection area comprises 125 664m2. Taking as a reference the 200-meter radius established in the Ley de Aguas, this area lies only partially within the boundaries of the Agrícola Ganadera Monte Carmelo property. The right-of-way easement (servidumbre de paso) for both pipelines, in turn, represents an approximate area of 564m2 in the case of ASADA de Cuestillas - Ron Ron and 480m2 in the case of ASADA de Pénjamo.” (Images 463-469 of the digital court file).

  • 10)On 9 de junio de 2020, AyA conducted a hydrogeological study (estudio hidrogeológico) to determine the absolute bacteriological protection zone (zona de protección absoluta bacteriológica) for the springs of the co-defendant ASADAS. Of relevance, it concluded that an absolute operational zone measuring 30m wide by 30 m long, for a total area of 900 m2, was established as the absolute operational protection zone (zona de protección operacional absoluta) for Naciente Maroto 2; whereas an operational protection zone (zona de protección operacional) of 1244 m was established for Naciente Maroto 1, Cuestillas F1, Cuestillas F2 and Cuestillas F3, based on the overlap of each of the 15 m radii defined for each of the cited sources; an absolute protection zone (zona de protección absoluta) was established for Nacientes Maroto 1, Cuestillas F1, Cuestillas F2, Cuestillas F3 and Naciente Maroto 2, measuring 602 m long and a maximum of 180 m wide according to geomorphological, geological and hydrogeological conditions; and a regulated protection zone (zona de protección regulada) was established for Nacientes Maroto 1, Cuestillas F1, Cuestillas F2, Cuestillas F3 and Naciente Maroto 2, extending from 602 m to the drainage divide (a length of 1330 m), upstream from the springs, with high aquifer vulnerability. (Images 731-793 of the digital court file).
  • 11)At the oral and public trial, testimony was received from Luis Alberto Ramírez Pérez, a resident of Ron Ron de Florencia and a member of the Board for two terms. He stated that he knows where the water intakes are located; they cannot be seen at first glance. What can be seen is the intake equipment, but one must reach the specific location. There are concrete boxes and a distribution network serving the community. The water-supply system is more than 42 years old, because he has lived there since that time and the service already existed; it was formerly operated by the Municipalidad. That has always been the source. At the time of the visit, there was only forest there. He has gone there approximately 5 or 6 times when a colleague needed help, most recently about 2 months ago. ASADA de Cuestillas holds a concession (concesión) for that water. He was a member when the delegation agreement with AyA was signed.

The service guidelines have always been followed, and the intake has always operated continuously. There was even a time when the water supplied Santa Clara. Water service is provided to the entire community of Ron Ron and Cuestillas. He does not know whether agreements have been made with the owners of the property. The property contains rocks, trees, and water sources. In response to questions from AyA, he clarified that he does not know who built the system; initially, payments were made to Municipalidad de San Carlos. He does not know whether there are additional tributaries on the property. He has visited the 2 water intakes, including the one belonging to Pénjamo, and the sources are very close together. To reach them, one must enter through another property, which is pastureland, and then one comes to the forest and walks almost 200 meters. The service was billed at a flat rate; there were no meters or telephones, so leaks were a problem and residents would go approximately 8 days without water.

It was then decided, at a meeting with Municipalidad de San Carlos held in the Salón Comunal, to create a Committee to transfer the water-supply system to the ASADA, after which the delegation agreement was executed, although he does not remember the dates. He clarified that he served as Vice President of the Committee and also served on the ASADA Boards. He explained that, during the visits, they formerly entered freely, but because of conflicts in recent years they began requesting permission. During his term, however, there were no problems, and with the previous owner there had been no problems or restrictions for 20 or 25 years. (Audio and video in SIGAO).

  • 12)Testimony was then received from Ana Lorena Gamboa Chaves, a resident of Cuestillas de Florencia. She served on the Junta Administrativa de Cuestillas during the 1993-1995 terms. The ASADA had already existed for a long time. She has lived in the community of Cuestillas for more than 42 years, and water service has existed and been paid for since she began living there. The water is drawn from the mountains of Pénjamo, on the property of the “Maroto” family. The water has always been drawn from there, and all work has been performed on those sources. In fact, during her administration, improvements were made to those sources; the work is carried out by the ASADA. During her term, there were never any access problems or complaints from colleagues or the plumber about entering the site. The waters supply the communities of Pénjamo, Cuestillas and Ron Ron. She does not recall any agreements having been made with the owner of the property.

In response to questions from AyA, she clarified that in 1993 it was a Committee and that by 2013 it had become the Association. Before that, it was operated by the Municipalidad. She does not remember who built it, because the water-supply system was already there when she arrived, and payment was made at the Salón Comunal; personnel from Municipalidad de San Carlos would come there, and the small office was later used by the Committee. At that time, they never had problems entering. (Audio and video in SIGAO).

  • 13)Testimony was also received from witness Keilor Joaquín Araya Vargas, a merchant and resident of Pénjamo. ASADA de Pénjamo has existed for as long as he can remember, as has the Cuestillas system. The water comes from the “Maroto” mountains, named after the original owner. He has visited the intakes. They cannot be seen at first glance; one must enter the mountain, approximately 500 mts or so. The property has always been forestland, and it is currently enrolled in a government program for that purpose. It has trails. The last time he went, they were clear and wide, measuring 10mts across, and people from the town visit on Sundays. His most recent visit was approximately two years ago; he used to visit frequently for recreational purposes. To reach the area, one must cross a fenced cattle farm, with the fence intended to prevent the cattle from entering the forest. It has always been used for that purpose, although timber was formerly extracted from it.

It has always been the intake source; the water-supply system was later supplemented by other sources, but this one has always supplied the town. ASADA de Pénjamo receives visits from AyA to conduct water studies, and the ASADA maintains the structure. In response to questions from AyA, he clarified that he has lived there since 1968. He clarified that Cuestillas, Ron Ron and Pénjamo are different communities. He specified that the water intakes cannot be seen from the trails. (Audio and video in SIGAO).

  • 14)Subsequently, Rodolfo González Gutiérrez, a merchant and resident of Pénjamo, testified. He was a member of the Pénjamo ASADA approximately 30 years ago, and the former owner supplied water directly to him, but that was 30 years ago. When he became a member, the aqueduct already existed; he began living there 34 years ago, and the aqueduct was already operating. Previously, there had been no conflict; it arose only now, with these proceedings. Upon reaching the intake structures (captaciones), the water sources can be seen. The property is devoted to a forest reserve (reserva forestal); it has trails, although activities other than forest conservation are also conducted there. It has always been mountainous land, and in fact there are approximately 6, 7, or 8 springs (nacientes), but the ASADAS use only about 2, one each. The ASADA has always used that resource, and he believes it is in compliance with AyA requirements; he does not know whether agreements exist with the property owners.

The communities benefiting from it are Cuestillas and Pénjamo. He does not recall whether signs are posted on the property. In response to questions from AyA, he clarified that the spring previously used in his name by the former owner is different from the sources used by the ASADAS. He clarified that, when he served in the administration, it was a Committee. He does not recall who built the aqueduct. The population of Pénjamo may be approximately 400 households. In response to questions from the Court, he stated that he last entered the property approximately 2 years ago. He stated that the neighboring properties are fenced, but people may walk freely along the trails. (Audio and video in SIGAO).

  • 15)Immediately thereafter, testimony was received from Christian Eduardo Delgado Segura, a geologist for AyA in the Environmental Management UEN (Strategic Business Unit), and Director of the Hydrogeology Functional Area since 2018, who was responsible for reviewing and approving the report appearing at images 731 et seq. of the court record. He stated that the report was prepared at the request of the Legal Directorate to determine the absolute protection zones (zonas de protección absoluta) for the springs at issue; it is a hydrogeological study (estudio hidrogeológico). The purpose is to define the areas of greatest interest for protecting the quality and quantity of the water resource, in order to protect the absolute protection zones. The report was prepared by an official from the area, a hydrogeologist. The sources and the geological conditions of the site were surveyed on site. Tributary flows (flujos de afluente) are identified, and the characteristics of the unsaturated zone (zona no saturada), the permeability and porosity of the area, and other parameters are determined in order to define the absolute protection zone.

It is also used to identify and classify the type of aquifer in the area. At image 749, the different hydrological units are identified, including highly permeable lava formations subject to direct recharge (recarga directa). The springs shown as triangular points are located on a steep slope where the lava flows crop out, as part of the Florencia tectonic fault. In fact, the light-blue triangles are springs outside the subject matter of the dispute, and therefore the area is a discharge point (punto de descarga). It is an unconfined aquifer (acuífero libre), with no overlying cover. At image 751, the groundwater flow line (línea de flujo de agua) can be analyzed, which is subsequently used to define the recharge zones (zonas de recarga), as shown in image 752. The area was assessed for contaminant transport (tránsito de contaminantes) within a radius of approximately 600mts. The study concludes that the vulnerability (fragilidad) is high.

The vulnerability study weighs several factors to determine how susceptible the aquifer layer (manto acuífero) is to contamination and discharges. In this case, because it is an unconfined aquifer, combined with a very shallow water table (nivel freático), at approximately 5mts, and the absence of cover, it is extremely vulnerable, or highly vulnerable, which accounts for the 600mts radius. The recommended activity would depend on the protection zone; for example, septic tanks, livestock activities, or agrochemical activities generating discharges would not be permitted in the absolute zone. The nature of the area causes many springs to emerge along the entire face of the slope, not only those involved in the dispute and those that are registered; this is inherent in its hydrogeological characteristics. At image 762, the orange squares are the operational zones (zonas operacionales), while the yellow areas are the absolute protection zone, without prejudice to the 200 mts areas established by the water law, whereas the pink striped areas are relative protection zones (zonas de protección relativas).

The orange oval is the 200 mts zone established by the water law. The areas to be directly conserved are the yellow zones and the orange squares. On cross-examination, he clarified that the 200mts measurement is not a technical recommendation, but rather a rule established by the water law. (Audio and video in SIGAO).

  • 16)Finally, testimony was received from Luis Diego Alfaro Artavia, a civil engineer who works for the Huetar Norte Regional Office of Community Aqueducts, which is responsible for monitoring the respondent ASADAS. He has worked there for 7 years and is an engineer in that office’s Technical Unit. The study at images 466-469 was prepared as part of these proceedings to provide a description of each component of the aqueduct infrastructure, as well as the protection areas. The area contains concrete intake works (obras grises de captación) and ancillary works (obras complementarias) (fences, perimeter mesh fencing, inspection boxes, and covers), as well as PVC pipelines. He stated that it is not possible to change the location of the structures, particularly the pipelines. If the intake areas are relocated, there is no way to convey the water naturally to the storage tanks. These are two separate systems: the Pénjamo system, with approximately 450 households, and the Cuestillas Ron Ron system, which is similar in size, with approximately the same number of households.

The Pénjamo ASADA has another source, but the Cuestillas ASADA does not; this is its only one. These systems are highly dependent on this supply. Images 739-740 are photographs of the site. The structures cannot be seen from the property boundaries; in fact, the springs are approximately 200 mts from the entrance through one of the boundaries. He clarified that Maroto 3 has intermittent output. The orange areas are the springs, and the infrastructure (concrete works) is shown by the red square. He clarified that the intake structures are entirely within the protection radius, but the conveyance pipelines (tuberías de conducción) are only partially within it, and the pipelines are the only components located outside the area. At least one pipe runs from each spring to a collection box (caja de reunión), and from there a single pipe runs to the storage area. Each ASADA has its own distribution line.

The collection boxes are located within the 200mts area. In Cuestillas, it is near the spring itself, while the Pénjamo collection point is at a “T”-shaped pipe junction; his last visit was in the year 2020. AyA has the information provided by the ASADA; in this case, the original construction design plans are unavailable, but plans and surveys of the ASADA prepared for subsequent work are available, making it possible to calculate the number of km of pipeline, thickness, etc. He stated that, as of the year 2020, when the last visit was conducted, the records concerning the registered structures and surveyed pipelines do not indicate that any changes had occurred. (Audio and video in SIGAO).

II. REGARDING THE UNPROVEN FACTS

The following are deemed relevant facts not proven in these proceedings: 1) That the conduct of the respondents interfered with or caused a decrease in the claimant’s income under the performance of the Forestal contract with FONAFIFO SC-01-222-0024-2015, and that said contract remained in force when this judgment was issued. (The record). 2) The existence of erosion and/or contamination on the property owned by the claimant as a result of the respondents’ activities and, specifically, caused by the absence of management plans (planes de manejo) for the forest’s aquifer layer and the environment. (The record). 3) That the co-respondents occupy seven hectares of the land at issue in these proceedings. (The record). 4) That the respondent ASADAS or AyA formalized aqueduct and right-of-way easements (servidumbres de acueducto y de paso) for the potable-water systems at issue in these proceedings. (The record).

III. REGARDING THE PLAINTIFF’S ARGUMENT

In its complaint, the plaintiff’s representative states that, as owner of the real property registered in the Alajuela registry under number 2-401761-000, it has Pago de Servicios Ambientales contracts with FONAFIFO for forest protection, for the purpose of safeguarding scenic beauty and water resources, protecting rural-urban or hydroelectric use, preventing gas emissions, and avoiding alteration of the natural behavior of the protected area. Upon taking possession (posesión) of the property in the year 2004, it found that the property contained collection tanks connected to spring water intakes (captaciones de nacientes de agua), water intakes (captaciones), conveyance and distribution networks, and filters that had been installed, used, and exploited by the defendant ASADAS. Considering this to constitute interference with possession (perturbación de la posesión) and with its ownership of the property generally, it has attempted to reach an amicable resolution with the defendants and regularize the situation.

On 30 de setiembre de 2014, it signed a document with the presidents of the ASADAS so that SINAC would designate the spring protection zone (zona de protección de las nacientes) on the properties it owns, thereby preventing the co-defendant associations from engaging in activities that the plaintiff had never authorized and that affect the protection zones. Furthermore, the defendants’ representatives have been advised on several occasions that they must request permission to enter the property. One example is the letter sent to ASADA Pénjamo on 22 de junio de 2015, denying it further entry onto the property because it was interfering with possession and stating that it was required to request entry 15 days in advance. The letter also stated that it had to return the pipeline that it had altered near the intake tank to the location where it had remained until febrero del 2015, because the alteration had been made without authorization.

This was answered on 29 de junio de 2015, with an indication that the pipeline had again been placed in its original location. The plaintiff responded that same day that the existing situation needed to be formalized, because the property had neither been expropriated nor had compensation been paid for the activities conducted there, and that agreements also needed to be reached on environmental-protection matters. This has not occurred, and the situation continues to this day. The same applies to the communication sent to ASADA Pénjamo on 23 de mayo de 2016, the joint meeting of 20 de mayo de 2016, and the communication of 19 de junio de 2016. The plaintiff has insisted upon receiving, two weeks in advance, notice of preventive and corrective maintenance schedules and the names of the persons who will participate in the work, as well as upon participation in prevention and conservation programs with educational and community organizations to promote the protection of the forest, the environment, and water resources.

It has not been possible to fulfill these objectives of regulating access to the property, thereby impairing the proper administration of the plaintiff’s environmental-services commitments, because persons may not wander through the site, hunting and the removal of plants or animals are prohibited, and the forest, the environment, and water resources must be protected. It states that representatives of AyA’s San Carlos regional office, as well as representatives of the Ministerio de Salud and MINAE, have at times participated in the meetings in an effort to regulate the activity, but this has not been possible. The plaintiff has offered to execute a formal lease or sell the portion of land occupied without permission, but the defendants have always declined, citing financial constraints. An attempt was even made to reach a settlement at an early hearing before the Fiscalía de San Carlos on 6 de febrero de 2017, based on a proposal that the two ASADAS jointly pay 5 million colones beginning in enero de 2017 over a period of 5 years; however, the negotiations were unsuccessful, as shown by ASADA Pénjamo communications ASAPEN-012-2017 and ASAPEN-014-2017.

The plaintiff maintains that the land unlawfully occupied and used by the defendants comprises approximately 7 hectares, corresponding to the protection area and the area containing the conveyance pipeline leading to the storage tanks, with the resulting inability to exercise possession since the year 2004. In its reply (réplica), it asserted that the plaintiff purchased the property on 3 de setiembre de 2004 and registered it on 17 of that same month and year, taking possession of the entire property at that latter time. It specified that it had been unaware of the ASADAS’ facilities because they were not located in an area with direct access but in a mountainous, enclosed sector, and the facilities were not visible. It explains that the ASADA’s activities dated back only a few months or years before the purchase, at which time the spring was also registered by MINAE (exp. 435-R y 1351-R), and that no concession (concesión) had existed before then because no permit had been obtained.

It denies that the association had existed for 30 years and emphasizes that concessions have existed since 2015 for which it never granted authorization, and that the permit issued in 2005 was granted by the former owner rather than by the current owner. It explains that there had merely been tolerance of the situation, which has now ended. It denies that the occupied areas constitute State Natural Heritage (Patrimonio Natural del Estado), because they are the private property of the party it represents; it rejects the defense of failure to state a legal right (falta de derecho), because the interference with ownership (perturbación de dominio) underlying the action has been established; it likewise rejects the defenses of lack of standing (falta de legitimación activa) and lack of proper defendant status (falta de legitimación pasiva), because the defendants are the parties interfering with possession and ownership, while the plaintiff is the registered property owner; and it rejects the statute-of-limitations defense (prescripción), because, in its view, the right of ownership is not subject to limitation and, in any event, it has been shown that meetings and actions intended to regularize the situation have taken place over time.

IV. REGARDING THE DEFENDANTS’ ARGUMENT

In its answer to the complaint and final arguments, the ASADA de Cuestillas y Ron Ron states that the aqueduct it operates substantially predates the formal establishment of the ASADA, dating to approximately 1975, and that its facilities have been tolerated by all owners, including the current owners, as demonstrated by the witnesses examined at trial; therefore, it is not true that the intake structures (captaciones), filters, conveyance networks, and distribution networks were installed after the plaintiff became the registered owner of the property. It asserts that there have never been any problems with the party it represents, that the problems concern the ASADA de Pénjamo, and that a lease was discussed on one occasion but was rejected because of its high cost, while a sale has never been discussed. It explains that, although an attempt at conciliation was made during an early hearing before the Fiscalía de San Carlos, no agreement was ever reached; consequently, the case was dismissed and the matter referred to another proceeding.

It states that its actions fall within Art. 33 of Ley Forestal N° 7575, regulation 25721-MINAE, and the technical provisions of AyA. In any event, it acknowledges that, although it occupies an area that has not yet been determined, that area forms part of the State Natural Heritage (Patrimonio Natural del Estado), and its activities are limited to providing the public service of operating the aqueduct. It alleges a lack of legal right (falta de derecho) to seek compensation for land that is in the public domain and subject to water-resource protection, while it conducts its activities under the authority of the law, and to seek recovery of property (reivindicación) consisting of land subject to Ley Forestal, which is inalienable. It asserts a lack of standing (falta de legitimación), because if the plaintiff seeks to protect its interests as owner, it would have to proceed against the State, which administers such property; correspondingly, there is a lack of standing to sue (falta de legitimación activa), because the State is responsible for that land, while the defendants are merely custodians and protectors of the State’s forest resources.

It further asserts that the claims are in any event barred by the statute of limitations (prescripción), because the aqueduct has existed for more than forty years, making the requested recovery improper pursuant to art. 868 of the Código Civil. For its part, the ASADA de Pénjamo states in its defense that it has exploited the water resource for more than 30 years, with the consent of the original owner, “Maroto,” and the subsequent owners, as established by the witnesses examined at trial. It explains that the public drinking-water service has been protected by the case law of the Sala Constitucional and given preference over private interests, and that in this case MINAE granted it the relevant concession; its actions have complied with the guidelines of AyA as the governing authority, as well as health guidelines and, in general, those governing the provision of aqueduct services. It emphasizes that the plaintiff itself acknowledges that they have undertaken joint efforts, such as the action mentioned in the complaint before SINAC to delimit the conservation areas, although it does not know the outcome of that action.

It denies having engaged in conduct harmful to the plaintiff’s property and states that it has confined itself to protecting, maintaining, and safeguarding the concession granted by the Dirección de Aguas del MINAE, as well as taking the actions necessary to keep the service in optimal condition, while always respecting the plaintiff’s private property. It states that the work has always been performed by the ASADA’s plumber, who is known to the plaintiff’s employees, and that only in unforeseen, exceptional cases of force majeure (fuerza mayor) has the plumber been accompanied by third parties; even then, they have remained within the areas occupied by the tank and pipelines. It is therefore impossible, as the plaintiff demands, to coordinate such visits 15 days in advance under those circumstances. It notes that the plumber performs this work at least three times per week because of maintenance and chlorination requirements, of which the plaintiff is aware because this is part of the routine work.

It objects to the plaintiff’s complaint regarding the alleged entry of persons onto the site, because the plaintiff itself built access trails that even lead to the public road, thus creating the very risk about which it now complains. More generally, it asserts that the plaintiff’s position is contradictory because, on the one hand, it demands that the activity cease, while, on the other, it objects to the lack of communication and calls for joint activities such as training and awareness-building regarding environmental protection. It argues that, when the plaintiff acquired the property, the property was already subject to the ASADAS’ activities, and that the relevant areas had always been used by them without disturbing possession of other areas of the property. The requested recovery is therefore improper due to lack of standing to sue. It also states that the plaintiff already receives compensation for the forest-related restriction, specifically through the environmental services contract under which the plaintiff itself receives payments, and that double compensation is not permissible.

It comments that, although the parties engaged in discussions before the Fiscalía de San Carlos in 2017, no binding agreements were reached, particularly because the governing authority, AyA, was absent; accordingly, there were no breaches relating to alleged leases or land purchases. Its final arguments were presented jointly with those of the ASADA de Cuestillas because both were represented by the same counsel. Finally, both in its answer and in its final arguments, AyA refers to official communication UEN-GAR-2019-00403, which compiles information on the condition of the co-defendants’ facilities on the property in question, as well as information concerning their origin dating from the seventies and eighties. It considers that, contrary to the plaintiff’s position, the joint application to SINAC to demarcate the protection areas, far from excluding the co-defendants, was actually intended to demarcate their working area.

It objects that the plaintiff’s requirement of 15 days’ advance notice is unjustified, because intervention in the service must occur whenever required in order to guarantee service continuity. It rejects the plaintiff’s assertions concerning the co-defendants’ conduct because the cited opinion demonstrates that they have complied with their legal duties, without disrupting the property’s environmental surroundings, and have confined themselves to providing the service. The facilities consist of minimal infrastructure for collecting water from springs (nacientes) and conveyance pipelines that existed before the plaintiff became the owner, with no indication of recently constructed structures; indeed, it was precisely the conditions in the area that allowed the plaintiff to enter into an environmental services contract. It insists that the plaintiff itself tolerated these activities on the property for more than 10 years, considering that it held title from 2004 until the dispute began in 2015.

It shows that the co-defendants hold the respective water concessions and corresponding flow allocations for supplying the population, further establishing the protection areas through both the expert testimony (prueba testimonial pericial) presented at trial and technical report UEN-GA-2020-02131. It agrees with the co-defendant that AyA did not participate in the 2017 proceeding before the Fiscalía and therefore cannot validate those actions, because leases or purchases must first be approved by the governing authority, AyA. It categorically denies that the co-defendants possess seven hectares of land, stating instead that, as indicated in the cited opinion, their occupation encompasses only the pipeline area and the intake infrastructure; the plaintiff’s assertion is therefore reckless and entirely unfounded. It states that both co-defendants have entered into delegation agreements (convenios de delegación) with AyA within the framework of the nationalization of the drinking-water service through the indirect provision of a public service, with AyA acting as supervisory, governing, and, where necessary, intervening authority.

It notes that these systems are indispensable to serving the communities of Ron Ron, Cuestillas and Pénjamo and cannot be replaced; furthermore, they were built with the property owner’s consent and acquiescence, making the activity one undertaken in good faith, peacefully, and openly. It therefore rejects the claims for non-pecuniary and material damages, given the existence of evidence of the damages and of causation attributable to the defendants. It reiterates that the technical evidence submitted by AyA disproves the allegations in the complaint, as it does the alleged non-pecuniary harm claimed, which arises from the lawful provision of services by the ASADAS—activities that the plaintiff itself has clearly and openly tolerated for more than ten years. The same applies to the alleged losses, because the plaintiff submitted no evidence of the apparent reduction in payments by MINAE.

It concludes by stating that the plaintiff could under no legal basis appropriate the infrastructure intended for the public service supplying the aforementioned communities, and that exploitation of the water resource falls not within the plaintiff’s authority but within that of the Dirección de Aguas, which, as stated, has regulated the allocation granted to the co-defendants. It invokes lack of legal right, as well as lack of a current interest (falta de interés actual), because the plaintiff knew of the aqueduct components when it acquired the property and tolerated the co-defendants’ activities for more than ten years.

V. REGARDING THE ALLEGED PRESCRIPTION AND LACK OF CURRENT INTEREST

The prescription (prescripción) asserted by the defendant ASADAS must be rejected for the reasons set forth immediately below. First, the subject matter in dispute must be distinguished, as will be explained in detail below, with respect to the area constituting State Natural Heritage (Patrimonio Natural del Estado). Pursuant to sections 261 and 262 of the Civil Code, in relation to section 40 of the CPCA, disputes concerning public-domain property (bienes demaniales) are not subject to prescription; therefore, this defense cannot be raised with respect to this type of property. This Chamber also takes into consideration that the defense of public-domain property falls within the exclusive authority of the State; accordingly, as explained in this judgment, the plaintiff lacks standing (legitimación) to seek its direct protection and, much less, to bring an action for recovery of ownership (acción de reivindicación), such that the defense, as such, cannot be raised against it.

As for the remainder of the land, which is privately owned by the plaintiff, the claim for restitution or recovery of ownership is a direct consequence of an incident of ownership (Art. 264 of the Civil Code) and must therefore be read together with section 313 of the Civil Code, which provides: “The protection afforded by the authorities to a possessor who is disturbed or interfered with in possession shall have no effect whatsoever on questions of ownership or superior right to possess,” as well as section 316, which states: “Every owner has the right to claim judicially the property owned and the free enjoyment of each and every right encompassed therein,” and, in particular, section 320 of the same Code, which provides: “An action for recovery of ownership may be brought against anyone who possesses as owner and shall remain available until another person has acquired ownership of the property through acquisitive prescription (prescripción positiva)” (emphasis added).

Under those provisions, extinctive prescription (prescripción negativa) is inapplicable, contrary to what has been argued, because the time limit is determined by the occurrence of a potential acquisition through acquisitive prescription (prescripción adquisitiva), which is not at issue in this case. Furthermore, AyA alleges a lack of current interest based on the circumstances under which the conduct of the co-defendants toward the plaintiff has been tolerated. In this regard, the defense must be rejected because current interest constitutes an evaluative element—which the Court may examine even on its own motion—through which it determines whether the need for a ruling in the judgment on a particular matter continues to exist over time. In this case, it is clear that the presence of the ASADAS on the property in dispute, far from demonstrating a lack of interest, instead sustains that interest, because a ruling in the judgment is precisely necessary to resolve the conflicting positions of the parties.

Thus, the duration of the co-defendants’ conduct over time is a matter to be considered on the merits, not as evidence that the interest has subsequently ceased to exist, but rather the opposite. These reasons are consistent with the rejection of the prescription defense analyzed above in this same section.

VI. ON PROTECTION AREAS AROUND SPRINGS AND RECHARGE AREAS AS PUBLIC-DOMAIN PROPERTY

THEIR USE FOR POPULATION-SUPPLY PURPOSES AND THE LIABILITY REGIME OF AYA AND ASADAS: On another occasion, regarding the legal nature of the protection areas (zonas de protección) around springs (nacientes), this Chamber, sitting with a different composition, stated: “…Returning to what has been maintained throughout this decision, there is no question as to the inviolability of private property, understood as ‘the right to possess a thing exclusively, to enjoy it, and to dispose of it, subject only to the limitations established by law or by the will of the owner.’ (See Decision N° 2006-017514, issued at 9:41 a.m. on 01 de diciembre de 2006 by the Constitutional Chamber of the Supreme Court of Justice). It is also acknowledged—and this is a position with which we agree—that: ‘The treatment of the protection of rights in rem (derechos reales) in civil and agricultural matters is of great importance in all legal systems that have consolidated a constitutional foundation rooted in the protection of fundamental human rights: alongside rights of economic freedom, including private property and other derivative rights in rem, economic, social, and environmental rights and duties have also been enshrined.

Private property and economic freedom receive constitutional protection under Articles 45 and 46 of our Constitution and, although it may seem obvious, their existence and protection result from the enduring nature of a Social State governed by the rule of law, based on constitutional principles and values that establish not only rights in favor of individuals, but also duties, with a view to achieving economic development with equity, solidarity, and social justice.’ (See Constitutional Chamber Decision Nº 16629 -2012, at 4:31 p.m. on 28 de noviembre del 2012). In this regard, we agree with the position of the Constitutional Chamber quoted above, insofar as the right to property cannot be analyzed in isolation as an unrestricted right; rather, it must also be examined in light of citizens’ duties to protect nature. This necessarily means that, when exercising their rights as owners of property or value, they must do so in harmony with the community and, in the case before us, in balance with the environmental burdens established by the legislature in order to fulfill the social purposes of the State as a whole—or, in the words of the Constitutional Chamber, to seek to ‘achieve economic development with equity, solidarity, and social justice.’ This is because it must not be overlooked that the legal system as a whole establishes a balance or equilibrium between the rights of persons subject to government authority, the guarantees intended to protect the system of liberties—including, as previously stated, the fundamental right ‘to have’ (private property)—and the general and public interest and the social function of property itself (particularly where the safeguarding of water resources is concerned, which is the primary purpose of the limitations or protection areas at issue in this litigation).

It is also appropriate to recall what has already been stated: for these reasons, and due to the evolution of the concept of property itself, it is legally permissible for property to be subject to burdens, limits, or limitations imposed upon real property, some of which must be borne by its owner without any entitlement to compensation, such as the restrictions or protection areas around springs regulated by the Ley Forestal and Ley de Aguas. Accordingly, we do not agree with the petitioners’ position. Consistent with the foregoing, this Chamber of Judges considers that the petitioners interpret ‘depriving the right to private property of its substance’ as equivalent to the inability to erect a residential or commercial building or structure, which is incorrect, as explained below. First, the administrative record contains no evidence that the petitioners applied to the Municipalidad de Puriscal for a business license (patente comercial), or to that or any other public entity for any other permit or license to make use of the real property, such as the Fondo de Financiamiento Forestal, which administers various Pago de Servicios Ambientales or forest-use programs.

The foregoing is not intended as an exhaustive statement of the options that, within the current legal framework and without violating the limitations contained in the repeatedly cited statutory provisions, may be pursued by the petitioners or by any other natural or legal person in the same legal circumstances contemplated by the statutory provisions of the Ley Forestal and Ley de Aguas. This Court infers that counsel for the claimant extrapolates this alleged impossibility of carrying out any type of activity from Articles 33 and 34 of the Ley Forestal and Article 149 of the Ley de Aguas, as well as from the case law issued by the Constitutional Chamber concerning the prohibition on cutting down trees or engaging in activities not permitted on property located within an environmental protection area, such as the petitioners’ properties. From this, counsel concludes that the petitioners must be compensated because a de facto expropriation (expropiación de hecho) has occurred.

However, as noted, it is a mistake to equate the inability to build a dwelling with the inability to use real property as such. The use of real property is not limited to building a dwelling; owners may put it to various uses or derive various benefits from it. According to the Diccionario de la Real Academia Española, the word ‘aprovechar’ is defined as ‘To use something beneficially, make it useful, or obtain the greatest benefit from it. To make use of fabric, time, an opportunity.’ (Real Academia Española. Diccionario de la Lengua Española, Edición 2023 consulted at: https://dle.rae.es/aprovechar). Accordingly, such use must be analyzed in relation to all the rights arising from ownership of property and, as stated, within the context of the different types of property that exist and the purposes served by assets placed at the service of human beings. In this regard, the Constitutional Court has specifically addressed the different designated uses of properties—that is, the purposes and different uses of real property within the concept of its social function, particularly its environmental function, a matter of public national interest.

This is because Article 50 of the Constitution gives rise to the rights to health and life, such that the protection of the environment and water is vital to achieving the harmonious coexistence of humankind. Thus, in Decision N° 2007-006581-2007, issued at 3:39 p.m. on 15 de mayo de 2007, the Constitutional Chamber extensively reviewed the different types of social interest that are consistent with the body of constitutional law and that the petitioners disregard: ‘XV.- TYPES OF SOCIAL INTEREST RECOGNIZED BY CONSTITUTIONAL CASE LAW. Constitutional case law has recognized two types of social interest that legitimize—or justify—the imposition of limitations on property: those relating to environmental protection and those relating to urban planning, the latter based on the analysis set forth in judgment number 4205-96, cited above. It has expressly been recognized that the ultimate rationale for these limitations is precisely the “transnationalization” of the values affected, since they concern not only a locality or nation but humanity as a whole, given that, as previously indicated, the issue of environmental protection transcends the local or regional sphere (judgment number 3705-93, issued at three o’clock in the afternoon on treinta de julio de mil novecientos noventa y tres).

(…) Private forest property—which, as its name indicates, is property held under title by private persons and owned under the terms of Article 45 of the Political Constitution—is subject to a special legal regime: in the first instance, the forest regime, by means of the corresponding executive decree of the Ministerio del Ambiente y Energía. This regime encumbers the property as a limitation in the social interest and must, in all cases, be recorded in the Public Property Registry. For this reason, such real property may be mortgaged, and even the forest resource may be pledged as collateral; it may be acquired through adverse possession (usucapión) and may also be conveyed or its ownership transferred, provided that, in every case, the forest encumbrance is transferred with it. The extent to which private property may be exploited and used will depend on how the applicable legislation categorizes the forest resource, including as forest reserves, protected areas, or wildlife refuges (Article 37 of Ley Forestal number 7174), subject to compliance with the relevant management plan (plan de manejo).

It is clear that forest-related limitations prevent the owner from using the forest resource; under no circumstances is the owner entitled to cut down or economically exploit the forest existing on the property at the owner’s whim or discretion, except—and exclusively—under a management plan duly approved by the Dirección Forestal.’ (Emphasis in bold added by this Chamber). The Constitutional Chamber’s reasoning, with which this Chamber of Judges agrees, is that subjecting a property to a forest regime or forest-related restrictions does not deprive the acts that its owners may perform of all substance; instead, it imposes limitations on use and enjoyment that must be exercised within the parameters established by law. Second, the petitioners overlook the fact that the rights arising from title to or absolute ownership (dominio absoluto) of property are not limited to construction (transformation of the property), but instead are those established in Article 264 of the Civil Code, which provides: ‘Title or absolute ownership of a thing includes the rights: 1º.- To possession. 2º.- To usufruct. 3º.- To transformation and alienation. 4º.- To defense and exclusion; and 5º.- To restitution and compensation.’ Accordingly, the right to property would be deprived of its substance only where the State’s conduct, whether by act or omission, eliminates the possibility of exercising each and every one of the enumerated powers or rights; this, likewise, has not been proven by the claimants.

Although the properties are subject to an environmental limitation and certain types of activities may not be carried out on them, their owners nevertheless retain the power to derive benefits from them, for example through cultivation, agricultural or livestock activities, or commercial activities that do not entail the complete transformation of the property or the erection of permanent structures on it. Consequently, the record does not establish that the limitations contained in Articles 33 and 34 of the Ley Forestal and Article 149 of the Ley de Aguas prevent the exercise of each and every right encompassed within absolute ownership of the property.” Therefore, in the absence of such evidentiary elements, the argument or premise underlying the claim for compensation—that the right of ownership is deprived of its substance—must be rejected, since the burden of proof fell upon the plaintiffs under section 41.1 of the Código Procesal Civil (the provision applicable to this specific case pursuant to article 220 of the CPCA), which states that the burden of proof lies with “Anyone asserting a claim, with respect to the facts establishing that person’s right.” The obligation to introduce evidence into the proceedings also derives from the principle of the “dynamic burden” of proof (carga dinámica de la prueba), insofar as the claimants are better positioned within the legal circumstances of the proceedings to demonstrate the degree to which each and every one of the rights is affected and the various uses or purposes for which the properties may be exploited.

Without intending to reiterate what has already been stated, the case law of the Sala Constitucional and the Sala Primera de la Corte Suprema de Justicia has determined that the statutory limitations arising from Ley N° 7575, Ley Forestal are not compensable insofar as they impose certain limits but do not entirely deprive the right to use and enjoy the property of its substance. Indeed, our Constitutional Court has explained that the environmental limitations arising from sections 33 and 34 of the Ley Forestal—which the claimants allege give rise to disproportionate or unreasonable restrictions by depriving their property right of its substance—are consistent with the fundamental law and therefore do not constitute a de facto expropriation (expropiación de hecho), as the plaintiffs contend, stating as follows: “II.—Regarding the alleged conflict with the Constitution identified by the appellant between sections 33 and 34 of the aforementioned Law and Article 45 of the Constitution, this Chamber considers as follows.

The limits that may be introduced by law on the exercise of a public freedom or fundamental right relate to the right itself, as well as to the abstract position of a person’s sphere of action; that is, limits on the exercise of a public freedom are nothing more than limits on the exercise of a right. This is because the recognition of a right by a constitutional provision does not preclude the legislature from regulating its exercise, since every right is inherently limited because it arises within a system of social coexistence, and its exercise must be harmonized with the rights of others and with the requirements recognized in subsequent legislation, which will specify its limits and the conditions governing its exercise. By contrast, limitations concern the restriction or reduction of a person’s legal sphere, are related to the actual exercise of the public freedom, and must, by their nature, be contained in the constitutional text or be authorized by that text for imposition by the Asamblea Legislativa.

Thus, limitations entail a reduction of fundamental rights insofar as they restrict their effective exercise under certain conditions and in particular circumstances. In the case at hand, we are faced with a limitation imposed by law on the effective exercise of the right of ownership enshrined in Article 45. Because the limitation must be legitimized by the constitutional text itself or be based on an express constitutional authorization granted to the Asamblea Legislativa for its establishment, it is appropriate to determine whether the limitation imposed by Ley 7575 is duly grounded in the constitutional text. The second paragraph of Article 45 of the Carta Política provides: ‘For reasons of public necessity, the Asamblea Legislativa may, by a vote of two-thirds of its entire membership, impose limitations upon property in the social interest.’ It can therefore be seen from the quoted constitutional text that the provision itself permits the Asamblea Legislativa to introduce limitations upon property in the social interest, thereby legitimizing the content of sections 33 and 34 of Ley 7575, which are now being challenged.

III.—Having resolved the issue of the legitimacy of the imposition, what remains is to address the reasonableness of the limitation. This Chamber considers the imposed limitation reasonable because it does not make enjoyment of the property right impossible, but instead defines its scope. In other words, the limitation does not eliminate the appellant’s property right with respect to the portion of land on which construction is prohibited—since the appellant may still enjoy it—but merely directs the appellant not to build within the boundary established by the restriction. Furthermore, fixing a ten-meter setback line (línea de retiro) is reasonable in relation to the public-domain asset (bien demanial) that is to be protected—a stream—and in whose conservation the State has a public interest; the setback established in forestry legislation is therefore considered reasonable and sufficient.

Accordingly, the appeal is inadmissible and must be so declared.” (See, among others, Resolución N° 08234-1997 of 18:15 hours dated 03 de diciembre de 1997 of the Sala Constitucional). This position is shared by this adjudicatory Chamber and, for the same reasons, may be applied to the limitations established in the Ley General de Aguas, since they are even less burdensome upon property than those established in the Ley Foresta discussed herein. In subsequent years, the Sala Constitucional stated that these limitations upon property—which, as noted, are neither disproportionate nor unreasonable—are not compensable because they arise from the social function of property itself, a function that, as indicated, requires weighing the collective interest (the right to the environment and the protection of water) above an individual interest (the ability to build upon the real property, which the plaintiffs claim to have lost).

Thus, in Resolución N° 4465-99 of 10:21 hours dated 11 de junio de 1999, the Sala Constitucional de la Corte Suprema de Justicia held: “Article 45 of the Constitución Política enshrines the right of ownership. Its first paragraph describes that right as ‘inviolable’ and establishes the State’s obligation to compensate the owner in advance when the right must be extinguished for reasons of ‘legally established public interest.’ The second paragraph establishes the possibility of imposing limitations upon property in the social interest through a law passed by a qualified vote—a vote of two-thirds of the entire membership of the Asamblea Legislativa. Accordingly, the State’s obligation to pay compensation is constitutionally provided for solely and exclusively in cases of expropriation and does not apply to limitations in the social interest established by a law passed by a qualified vote.

Nevertheless, such limitations must affect the community generally, may not exceed the standards of reasonableness or proportionality, and may not deprive the property right of its essential content. A restriction upon the property right that deprives the right of its essential content becomes a disguised expropriation (expropiación encubierta) and, consequently, gives rise to an obligation to pay compensation. Limitations established for urban-planning purposes form part of the property right and therefore are not compensable unless they entail a reduction of the right’s essential content, as stated supra.” (Emphasis not in the original)” (Sentencia 2024003530 of 16:03 hours on 3 de junio de 2024). More specifically, as stated, springs (nacientes) are subject to a special protection regime governed by art. 31 of Ley de Aguas N° 276, in force since 1942, which provides that the following are: “lands reserved to the Nation’s ownership (reserva de dominio): a) Lands surrounding potable-water collection sites or intake points, within a perimeter having a radius of no less than two hundred meters”; in this regard, the Sala Primera de la Corte Suprema de Justicia has stated: “…this Chamber agrees with the Tribunal’s determination that the provision applicable to the case is section 31 of the Ley de Aguas, rather than sections 33 and 34 of the Ley Forestal as requested by the appellant, because the area is subject to ownership reserved to the State, as it is a water source supplying human consumption.

In a different vein, the appellant in cassation (casacionista) argues that the parties represented by him lost all rights over the 3000 square meters of land that they acquired under the law and that this portion of the lot is being granted to the Asada. In this regard, it should be clarified that, as stated supra, the appealed judgment does not grant the Asada any right of possession or ownership, since sanitary order number: S-018-2013, issued by the Ministerio de Salud Pública, directed that a fence be installed in the area to protect the water resource because physical and sanitary deficiencies had been identified, for the purpose of protecting that resource and the consumers’ right to health. It should also be noted that the area in dispute is outside private commerce (fuera del comercio de los hombres), since it is an area subject to a public-domain reservation through which an essential public service—the supply of potable water to a community—is guaranteed.

It is also relevant to specify that, when purchasing the property at issue in this litigation, the plaintiff herself was aware of the construction of a water collection tank. Moreover, the Asada de Río Celeste de Guatuso has two water concessions registered with the Registro Nacional, one of which is located on her property…” (Voto 4155-F-S1-2019 of catorce horas cuarenta minutos del veintiocho de noviembre de dos mil diecinueve, emphasis added). It should likewise be recalled that, since 1953, specific regulations have existed in Ley General de Agua Potable N° 1634, section two of which provides: “All lands that both the Ministerio de Obras Públicas and the Ministerio de Salubridad Pública consider indispensable for constructing or locating any part or parts of potable-water supply systems, as well as for ensuring their sanitary and physical protection and the necessary flow rate, are in the public domain.

The Ministerio de Salubridad Pública is responsible for considering applications for the construction, expansion, and modification of potable-water systems and for recommending to the Ministerio de Obras Públicas the construction, expansion, or modification of those systems for which there is the greatest need, following a study of mortality rates, parasitism, and other indicators,” on the understanding that MOPT was replaced by AyA pursuant to its enabling statute N° 2726 and that the Ministerio de Salubridad was replaced by the current Ministerio de Salud, both serving as the governing authorities in this field, while responsibility for granting concessions for water resources rests with MINAE, through the Dirección de Aguas (art. 17 of ley 276).

In the same vein, numeral 31 under discussion refers to another zone of the same nature, corresponding to “The forest zone that protects or is intended to protect all lands where drinking-water infiltration occurs, as well as those encompassing watersheds and reservoir margins, supply sources, or permanent watercourses,” both groups of real property thus being classified as State Natural Heritage (Patrimonio Natural del Estado) and, consequently, subject to the provisions of numerals 261 and 262 of the Civil Code, as well as to the special enhanced protective regime. Accordingly, we must distinguish between two aspects that, although interrelated, are different. On the one hand, there is the public-domain status (demanialidad) of the areas described above in art. 31 of ley 276, which exists independently of the defendants’ conduct; on the other hand, drinking-water service operators serving the population, or private users, may operate within that area.

Regarding the regulation of providers of the public drinking-water service, both ley 276 and ley 1634 establish a heightened regime governing who may provide the service, with priority given to AyA, the Municipalities, and any other entities expressly authorized to provide it, as in the case of ESPH. In turn, in the case of AyA, pursuant to provision 2.g of its Constitutive Law and numerals 1, 3, 6 and 7 of Reglamento Nº 42582-S-MINAE, the service may be provided directly or indirectly through the so-called Associations Administering Aqueduct and Sewerage Systems (Asociaciones Administradoras del Sistema de Acueductos y Alcantarillados, ASADAS), which operate under the administrative mechanism of delegation (delegación). Particularly relevant is the aforementioned regulation, numeral 29 of which states: “Definition of Delegation. Delegation shall mean the comprehensive public-community partnership process whose purpose is to provide Aqueduct and/or wastewater-treatment services, as recognized by the General Law on Public Administration, administrative case law, and judicial case law.” This requires reference to the provisions of numerals 89 to 92 of the General Law on Public Administration (Ley General de Administración Pública, LGAP), as well as numeral 31 of the same regulation cited above, which lists the scope of the delegation.

Within that framework, AyA and the ASADAS share responsibility, as stated in Article 91 of the LGAP: “The delegating authority shall always have the obligation to supervise the delegate’s management and may be held liable together with the delegate for negligent supervision. Liability for negligent selection shall arise only when the selection was discretionary.” Furthermore, as ley 276 indicates in numeral 20, a water concession (concesión de agua) for public supply includes “public-domain lands necessary for the dam, canals, and irrigation ditches. With respect to lands owned by the State, Municipalities, towns, and private parties, a compulsory easement (servidumbre forzosa) shall be imposed, as applicable, in accordance with the legal formalities,” or even expropriation (expropiación), if necessary. This provision is incorporated into Articles 49 and 50 of reglamento 42582-S-MINAE, which provide: “Article 49.

Easements. The ASADAS shall demarcate, survey, acquire, maintain, and protect the easements used in their systems. Permanent structures may not be built, nor may trees be planted, on pipeline easements, which must be at least six meters wide (three meters on each side of the pipeline); the respective municipalities of the country shall enforce this requirement. The ASADAS shall ensure compliance with this provision and with Article 16 of the General Drinking Water Law and may request any necessary advice from AyA for that purpose”; “Article 50. Expropriations. If required, the ASADA may request that AyA establish easements or acquire real property through expropriation proceedings once administrative negotiations have been exhausted. The Association shall bear the costs arising from these proceedings, all in accordance with the AyA Appraisal Regulations.” It is understood, of course, that both easements and any eventual expropriations affect privately owned property and must always be guided by the effective and optimal provision of the public drinking-water service.

VII. ANALYSIS OF THE SPECIFIC CASE

Before ruling on the claims in this matter, it is necessary to address a series of circumstances associated with the merits of the case, including the delimitation of the dispute, the existence of spring protection areas (áreas de protección de naciente), the nature and operation of the defendants, and, finally, the balancing of these matters against the plaintiff’s ownership rights; let us examine them. VII.1. Delimitation of the subject matter of the dispute. Absence of claims seeking annulment of concessions granted by the MINAE Water Directorate: Although the grievances raised by the parties and the evidence entered into the record—particularly the reply—include discussion as to whether the administrative authorizations for public water concessions granted by the Water Directorate were properly issued, as well as the classification of the prior exploitation of the water resource without the corresponding concession, we must bear in mind that, under the principle of congruence (principio de congruencia) to which this Court is subject (the interrelationship of sections 1, 2, 36, and 42 with section 122 of the CPCA), the claims establish the framework within which the Court must rule.

In this case, as is clear from the list of relief requested, not a single claim seeks to challenge the concessions granted to the co-defendants; this issue therefore falls outside the boundaries established by the plaintiff itself when stating its claims, pursuant to the party-presentation principle (principio dispositivo). Thus, the central request—which seeks recovery of property (reivindicatorio) and protection of the plaintiff’s ownership powers under section 264 of the Código Civil—is the central issue in this litigation, in which the plaintiff is positioned against the concession holders, which operate under an administrative delegation from the co-defendant institute. The Court therefore rules on this factual situation, focusing on the boundaries and limitations governing the conduct of the parties to this proceeding. VII.2. The protection areas established by the Ley de Aguas for springs (nacientes) and recharge areas (áreas de recarga) on the disputed land as a matter independent of the defendants: As explained in the preceding recital (considerando), the mere existence of drinking-water springs, as well as their infiltration areas (áreas de infiltración) at a particular location, results by operation of law and the designated purpose of the area in its subjection to the public-domain regime (régimen demanial) as State Natural Heritage (Patrimonio Natural del Estado, PNE), which is consequently incompatible with private ownership.

It must be recalled that, under the principle of initial registration (principio de inmatriculación) and the pro natura principle, PNE is protected even when it has not been formally recognized by the public authorities responsible for the matter; administrative—and even judicial—action is therefore declaratory rather than constitutive of its public-domain status. Accordingly, the plaintiff company’s claim for recovery of property must be denied with respect to the areas identified as PNE because, it bears repeating, these assets are public in nature, even though cadastral and registry records show them as part of the property at issue in this litigation. It is clear from the record that, when this proceeding commenced, none of the parties knew the proper boundaries and location of those areas. Indeed, as established by proven fact 6 of this judgment, since 2014 the ASADAS and the plaintiff had attempted to enlist SINAC to delimit the areas pursuant to the Ley de Aguas, an effort that, at least according to the evidence in this case, does not appear to have succeeded.

It was not until June 2020 that, for the first time, the areas defined as PNE by section 31 of Ley 276 were delineated through a hydrogeological study for the determination of zones (proven fact 10 and testimony corresponding to proven facts 15 and 16). In that regard, the plaintiff submitted no rebuttal evidence against those materials, and the Court therefore endorses them as technical criteria for demarcating PNE areas within the disputed property. Accordingly, the claim for recovery of property must be denied for a manifest lack of legal entitlement with respect to the areas identified in AyA report UEN-GA-2020-02131, as must, consequently, the compensation sought by the plaintiff in connection with those areas. Elaborating on the grounds for denying the claim for recovery, it should be noted that construction within those areas does not require permission from the registered property holder because the owner is the State; what is required are the respective administrative authorizations and concessions discussed in the preceding recital.

Moreover, as explained in detail above, those structures are likewise in the public domain because they form part of public drinking-water supply systems. It is therefore plainly inadmissible to seek to acquire them, recover them as property, or bring them under private ownership, and interference with such systems is criminalized under Chapter Seven of Ley 276 and related regulations. Consistent with the foregoing, AyA is correct in stating that the attempted negotiation conducted by the plaintiff and the co-defendants before the Prosecutor’s Office in February 2017 (proven fact 7) was plainly inadmissible, at least with respect to the areas defined as PNE, because neither the plaintiff nor the defendant ASADAS has authority to negotiate concerning those areas. Likewise, the debate over when and by whom the aqueducts at issue were constructed is unavailing because, at the time judgment was issued, they were operating under the corresponding administrative authorization from AyA (proven facts 4 and 5) and the respective water concessions (proven facts 2 and 3), thereby giving them the public-domain status necessary to benefit from the rule that property of this kind cannot be acquired by prescription (imprescriptibilidad).

Without prejudice to the foregoing, the evidence in the record—specifically, the witness testimony (proven facts 11, 12, 13, and 14)—establishes that the service provided by the defendants predates other administrative arrangements (committees) and even its eventual creation under the Municipalidad de San Carlos. The important point, however, is that its use has at all times involved drinking water for public supply purposes, which is what confers the special public-law protection regime (régimen exorbitante de tutela). This was known to everyone who held title to the property before the plaintiff and to the plaintiff itself, as demonstrated by their cooperative and adversarial interactions since it assumed its role as titleholder. Consequently, the first and second requests for relief must be denied in their entirety with respect to the areas demarcated in the aforementioned AyA technical opinion UEN-GA-2020-02131.

This is without prejudice to any review or rectification of the State Natural Heritage within the property at issue in this proceeding that may be conducted in administrative proceedings or a separate judicial action. VII.3. The determining factor in establishing possible “usurpation.” The need for AyA to formalize the ASADAS’ easements (servidumbres) and the restoration of the plaintiff’s ownership powers: The plaintiff asserts that the co-defendant ASADAS are usurping approximately seven hectares of its property, an assertion denied by all defendants. The defendants are correct in asserting that there is no evidence or showing that acts interfering with possession (actos de perturbación posesoria) have in fact occurred within the area that the plaintiff inaccurately identifies in its complaint. As shown by proven fact 1, the property at issue covers an area of 53 hectares 7377,16 m2, which is far too extensive even to infer the approximate location of the 7 hectares referenced by the company bringing the action.

The record does establish, however—specifically, as shown by proven fact 9—that even outside the aforementioned PNE there are structures belonging to both co-defendants associated with the drinking-water distribution systems (pipelines): approximately 160 linear meters in the case of ASADA de Pénjamo and approximately 188 in the case of ASADA Cuestillas – Ron Ron (corroborated by the testimony of Mr. Alfaro Artavia in proven fact 16). It also establishes that there is no specific or predetermined access path (see the testimony of Ramírez Pérez, Araya Vargas, and Alfaro Artavia in proven facts 11, 13, and 16). The foregoing proves that structures belonging to the defendant ASADAS do in fact exist on the plaintiff’s property outside the PNE and that the ASADAS freely acknowledge using those areas periodically for maintenance and upkeep, both through their respective plumbers and through third parties assisting with that work.

The plaintiff company’s claim is plausible with respect to these areas because a balance must be struck between the use and enjoyment of its property and the co-defendants’ provision of the service, a matter addressed by the regulations through the easement regime. As part of the historical origin of the dispute, the co-defendant ASADA unilaterally changed the location of the pipelines without prior coordination, causing the plaintiff’s dissatisfaction and prompting its request that the pipelines be returned to their original location, which the defendant ASADA complied with (proven fact 7). According to the record, both the ASADAS and AyA—in its capacity as the governing authority aware of the conflict that developed among the parties to this proceeding and as the delegating entity pursuant to proven facts 4 and 5—failed to act by formally establishing the corresponding aqueduct easements (servidumbres de acueducto) and rights-of-way (servidumbres de paso) necessary for the ASADAS’ service across the plaintiff’s property.

This lack of spatial definition has contributed to the creation of the conflict addressed in this matter. As explained in the preceding recital and the subsection just discussed, structures belonging to the drinking-water aqueduct system are in the public domain; where they cross private property, they must be regularized through the corresponding easements, namely an aqueduct easement and, if necessary, a right-of-way providing access to it. This obligation rests first with the ASADAS pursuant to art. 49 of reglamento 42582-S-MINAE, but also with AyA in its capacity as the delegating, governing, and supervisory entity pursuant to article 50 of the same regulations. Accordingly, to achieve a balance among all the parties, compliance with that legal mandate must be ordered. The ASADAS’ conduct on the plaintiff’s parcel must be regularized, and they must, through AyA, undertake the procedures to establish aqueduct easements for both ASADAS, as well as a right-of-way if necessary, over the parcel at issue in this proceeding.

Consequently, the defendants must be ordered to refrain from using any other area of the identified property and to vacate and demolish any other structure located outside the PNE areas and the easements to be established; they must likewise vacate and demolish any other structure not located within those areas. A period of THREE MONTHS is granted for this purpose, which shall be reviewed and adjusted, if necessary, by the judge during the judgment-enforcement stage.

This would restore the plaintiff’s rights under Article 264 of the Código Civil, allowing her the full use and enjoyment of her property.

VIII. SPECIFIC RELIEF SOUGHT

As a corollary of the foregoing, we find that the first claim must be granted in part, solely with respect to the areas that are not part of the State Natural Heritage (Patrimonio Natural del Estado) and the easement areas (áreas de servidumbre) to be established by AyA and the respondent ASADAS, in accordance with the preceding recital and within the aforementioned three-month period. As to the second claim, it is denied, given that the proper mechanism for enforcing the judgment entered in favor of the claimant is enforcement of judgment (ejecución de sentencia), as provided in Article 126 of the Code of Administrative Procedure (Código Procesal Contencioso Administrativo, CPCA), as well as the provisions of Title VIII of that procedural code, and not in the manner requested by the party, it being understood that the enforceability of the judgment is governed by those parameters as a matter of law.

As to the third claim, the parties shall abide by the ruling on costs below. As to the fourth claim, it must be denied in its entirety for the following reasons. With respect to pecuniary damage (daño material), which the party claims consists of material losses arising from the absence of management plans for the forest aquifer and the environment, resulting in erosion and contamination of the property, there is no evidentiary support for either its existence or its amount. It should be noted that, according to AyA’s technical reports (proven facts 8, 9, 15 and 16), the existence of the alleged damage has not been established. With respect to non-pecuniary damage (daño moral), which the party specified at the preliminary hearing as being subjective in nature, it is inadmissible given the nature of the alleged damage in relation to the party asserting it. By its nature, this type of subjective non-pecuniary harm entails an injury to the person’s inner sphere, feelings, and emotions, which may be assessed in re ipsa by the Court.

Such harm cannot be suffered by a legal entity, in this case the claimant limited liability company. Thus, from the standpoint of the nature of the damage, the claimant’s lack of physical personhood makes it impossible for the injury to be experienced or borne by the claimant, and the claim is therefore denied. As to the fifth claim, it suffers from the same defect as the claim for pecuniary damage, namely, the absence of evidence regarding both its existence and its amount. It should be noted that it is not even known whether contract SC-01-222-0024-2015 remains in force, since it had a term of 5 years, expiring on November 23, 2020 (proven fact 1), and there is no indication that FONAFIFO has stated that the income provided under that contract would be reduced due to circumstances associated with these proceedings. Consequently, even if the existence of the loss were presumed, it has not been shown to be causally attributable to the respondents, rendering the claim inadmissible. Accordingly, the action must be declared partially well-founded, granting only part of the first claim for the reasons already stated.

IX. OTHER DEFENSES RAISED

The co-respondent ASADAS raised the defenses of lack of standing to sue and lack of standing to be sued (falta de legitimación activa y pasiva), which must be rejected, as explained below. The claimant has procedural standing to sue under section 10 of the CPCA because it is the owner of the property at issue in these proceedings (proven fact 1); its standing is therefore properly established and substantiated, since it is the party directly affected by the dispute at issue in these proceedings. Standing to be sued (Article 12 CPCA) is likewise properly established because the respondent ASADAS are the entities engaging in the conduct that the claimant characterizes as interfering with its ownership rights. Both forms of standing are therefore properly established. As to the defense of lack of a legal right (falta de derecho) asserted by all respondents, given the manner in which this matter has been decided and the reasoning set forth in the preceding recitals, that defense must be granted with respect to claims 2 through 5 and partially granted with respect to the first claim. It is reiterated that the lack of a current interest (falta de interés actual) and the statute-of-limitations defense (prescripción) were decided above.

X. AWARD OF COSTS

Pursuant to section 193 of the Code of Administrative Procedure, procedural costs and attorneys’ fees (costas procesales y personales) constitute a burden imposed upon the losing party by virtue of having lost. Waiver of such an award is permissible only when, in the Court’s judgment, there was sufficient cause to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, because each side prevailed in part, this matter is decided without a specific award of costs.

POR TANTO

The defense of lack of a legal right is partially sustained with respect to the first claim and is sustained with respect to the second, fourth, and fifth claims. Consequently, the action brought by COMERCIAL AGRÍCOLA GANADERA MONTE CARMELO SRL against the ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO RURAL DE CUESTILLAS Y RON RON DE FLORENCIA (ASADA de Cuestillas y Ron Ron), the ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO DE PÉNJAMO DE FLORENCIA DE SAN CARLOS, ALAJUELA (ASADA de Pénjamo), and the INSTITUTO DE ACUEDUCTOS Y ALCANTARILLADOS (AYA) is declared PARTIALLY WELL-FOUNDED, and is denied as to all relief not expressly granted. Accordingly, AYA and the ASADAS are jointly ordered to establish and register the necessary water and right-of-way easements (servidumbres de aguas y de paso) for the effective provision of their drinking-water service under the concessions granted on property 2-401761-000, pursuant to sections 49 and 50 of decree 42582-S-MINAE, within three months after this judgment becomes final.

That period shall be monitored and adjusted by the enforcement judge during the judgment-enforcement stage. They must refrain from using any other area of the specified property and must vacate and demolish any other structure not located within the areas belonging to the State Natural Heritage or within the easements to be established. Participa como tercero interesado el ESTADO, representado en este acto por la procuradora Mariamalia Murillo Kopper, carnet de colegiada 11806. De igual manera, participa como patrocinio letrado de la parte actora, la Licda. Johanna Moreno Bustos, carnet de colegiada 5757 y como patrocinio letrado de ambas ASADAS, la Licda. Fressia Patricia Guzmán Mena, con carnet de colegiada 7750.

RESULTANDO

I.En fecha 25 de setiembre de 2017, la parte actora presenta la demanda formulando las siguientes pretensiones, las cuales fueron ajustadas en la audiencia preliminar: "1) Se ordene a las asociaciones codemandadas a restituir a la actora el terreno en litigio, correspondiente a la porción de terreno usurpado y usufrutuado indebidamente por los demandados de la finca del Partido de Alajuela, bajo el sistema de Folio Real matrícula número 401761-000.

  • 2)Que en el caso de que las asociaciones demandadas no restituyan dicha área a la parte actora en el plazo de quince días a partir de la firmeza de la sentencia se ordene su desalojo con el auxilio de la Fuerza Pública.
  • 3)Se imponga a las demandadas en forma solidaria el pago de las costas procesales y personales del proceso a favor de la actora y en contra de las asociaciones demandadas.
  • 4)Se les condene a las asociaciones codemandadas solidariamente al pago de los Daños ocasionados a mi representada por no tener la posesión de esa área de la finca desde la fecha en que la adquirió, el seis de septiembre del año 2004, a la fecha. Los cuales consisten en: el daño material que son todas las pérdidas materiales que ha tenido mi representada en la finca por la no existencia de planes de manejo del manto acuífero del bosque y del medioambiente lo que repercute en erosión y contaminación de la propiedad de mi representada, daño que se estima en la suma de veinte millones de colones; el daño moral que lo estimo en veinte millones de colones y que se refiere a la frustración de estar en la inseguridad jurídica legal y material en que se encuentra sometida mi representada al estar obligada a cumplir con las afectaciones y limitaciones de la ley forestal 7575 y no tener control de las actividades que las Asociaciones demandadas realizan en su propiedad afectada a dicha ley aunado que las juntas directivas de las asociaciones demandadas son renovadas cada dos años lo que significa que en cada ocasión ingresan persona diferentes a la propiedad y hace difícil llegar a acuerdos y se limita posibilidad de negociación y además hasta la fecha ha sido imposible que esta asociaciones suministren por anticipado la programación mensual del mantenimiento preventivo y correctivo de la infraestructura que, sin permiso alguno, tienen en la propiedad de mi representada lo que produce que muchas personas deambulan por la finca sin identificarse si pertenecen o no a las Asociaciones y esto afecta radicalmente el dominio de mi representada.
  • 5)Se condene de forma solidaria a las asociaciones demandadas al pago de los perjuicios sufridos por mi representada que son todos los dineros que ha dejado de percibir por arrendar por servicios ambientales esa área de la propiedad que ocupan los demandados, así como hacer el pago por la explotación del recurso hídrico ubicado en la propiedad de mi representada que lo estimo en veinte millones de colones". En la audiencia preliminar del 11 de diciembre de 2018 se aclaró que el daño moral es de tipo subjetivo, mientras que en la audiencia preliminar de fecha 1 de diciembre de 2021, se desistió de la pretensión 6. II.Otorgado el traslado de ley, la ASADA de Cuestillas y Ron Ron responde negativamente en escrito de fecha 16 de noviembre de 2017, alegando las defensas de prescripción, falta de legitimación activa y pasiva, así como falta de derecho. Por su parte, la ASADA de Pénjamo contesta negativamente en escrito de fecha 17 de noviembre de 2017, alegando falta de legitimación activa y pasiva. (Ver imágenes 135-142, 159-174 del expediente digital judicial).-

III.La parte actora realizó réplica en escrito de fecha 29 de octubre de 2018, aportando prueba documental adicional. (Imágenes 233-235 del expediente judicial digital.

IV.La audiencia preliminar fue celebrada en cuatro momentos, la primera de ellas en fecha 11 de diciembre de 2018, en la cual se ordenó integrar a la litis al AyA de manera pasiva, y se invitó al SINAC y al Estado como terceros interesados. El SINAC manifestó no tener interés en el asunto y el Estado en escrito de fecha 17 de diciembre de 2018 manifestó su venia de participar en tal calidad (Imágenes 374-376, 385 y 391 del expediente judicial digital).

V.El AyA contestó negativamente la demanda en escrito de fecha 14 de febrero de 2019, alegando las defensas de falta de interés actual y falta de derecho. (Imágenes 401-437 del expediente judicial digital).

VI.Por medio de resolución de las trece horas y treinta y dos minutos del 17 de abril de 2024, se ordena traer el expediente administrativo como prueba para mejor resolver, el cual es remitido por el municipio, el cual se apersona en esa oportunidad. (Imágenes 57-85 del expediente judicial digital).

VII.La segunda, tercera y cuarta parte de la audiencia preliminar se realizaron en fechas 22 de abril de 2019, 7 de febrero de 2020, y finalmente 1 de diciembre de 2021, en ellas se aclaró la pretensión de daño moral, especificando que es subjetivo y se desistió de la pretensión 6. Se fijaron los hechos controvertidos y se admitió la prueba documental y testimonial a evacuar en juicio. Audiencias realizadas con presencia de todas las partes. ((Audio en SIGAO y minuta a imágenes 543-545, 615-616 y 799-807 del expediente judicial digital).

VIII.El juicio oral y público fue realizado el día 22 de julio de 2024, solo con presencia de las accionadas, sin que se justificase la ausencia de la parte actora o del Estado. Se resolvieron aspectos de saneamiento, así como de sustitución de testigos, se realizó el alegato de apertura, se declaró inevacuable la prueba de la parte actora por inasistencia y se evacuó la demás prueba testimonial y finalmente, se rindieron conclusiones de manera oral. Se dicta esta sentencia dentro del plazo de ley, por unanimidad y previa deliberación de los integrantes del Tribunal, sin que se observen causales capaces de invalidar lo actuado, sin contabilizar los feriados del 25 de julio y 2 de agosto de 2024.- Redacta el Juez Mejías Rodríguez, con el voto afirmativo de los juzgadores Bolaños Salazar y Gómez Chacón.-

CONSIDERANDO

I.DE LOS HECHOS PROBADOS.- De importancia para la resolución de este asunto, se tiene como debidamente acreditado lo siguiente: 1) La matrícula inmobiliaria partido de Alajuela 2-401761-000, posee el plano A-0821732-2002, sin que conste la constitución de servidumbres de acueducto o de paso. Fue adquirida por la parte actora en fecha 17 de setiembre de 2004, soportando una servidumbre trasladada (citas 0277-00007480-01-0002-001), así como limitaciones de la ley forestal N° 7575 por proyecto de protección de bosque en recurso hídrico sobre 53 hectáreas 7377,16 metros cuadrados, afectación que se inscribió entre el 23 de noviembre de 2015 al 23 de noviembre de 2020. Conforme el contrato forestal SC-01-222-0024-2015, la actora aceptó limitar su actividad en dicho terreno para “a) Proteger el bosque, la cobertura vegetal o los procesos de regeneración, del área comprendida en este contrato, y por ende no cortar árboles, o cualquier tipo de vegetación. b) Contar con un Regente Forestal, debidamente colegiado, responsable de la ejecución técnica durante la vigencia del contrato. e) Prevenir y controlar los incendios forestales. d) Prevenir y evitar la cacería ilegal y la extracción ilegal de otros productos del bosque. e) No desarrollar actividades agrícolas y/o ganaderas. f) No efectuar acciones de corta y extracción de productos maderables. g) No realizar ninguna actividad que altere el comportamiento natural del área a proteger. h) Comunicar al MINAE, cualquier alteración o contingencia que ocasione cambios en el área protegida. i) Permitir el libre acceso del personal de MINAE, FONAFIFO, encargado de control, al lugar del área sujeta al PSA facilitando su labor. j) Ceder al Fondo Nacional de Financiamiento Forestal los servicios ambientales, generados por su bosque. k) Acatar cualquier recomendación técnica emitida por el MINAE o el regente, en forma escrita”. (Imágenes 2-5, 14-38 del expediente judicial digital).

  • 2)Sobre la finca señalada proviene de la matrícula inmobiliaria partido de Alajuela 2-079296-000, la cual, a través de un aparente personero en fecha 9 de agosto de 2005, emite autorización sobre toda la finca, para que la codemandada ASADA de Pénjamo pueda realizar los trámites de “denuncio” de recurso hídrico. Producto de dicha diligencia la codemandada obtuvo un total cuatro nacientes para su aprovechamiento en concesión de agua poblacional, identificadas como Maroto 1, Maroto 2, Maroto 3 y Rigiioni, ello por resoluciones DA-1434-2006 y SUB-GSC-GA-2014-2819. (Imagen 15 del expediente judicial digital y folios 19, 44-45 del expediente administrativo 435R del departamento de Aguas del MINAE en físico).
  • 3)De igual manera, la codemandada ASADA Cuestillas y Ron Ron, obtuvo la concesión sobre la finca señalada proviene de la matrícula inmobiliaria partido de Alajuela 2-079296-000, sobre dos nacientes denominadas Naciente Cuestillas de Ron Ron y La Roca, ello conforme la resolución DA-1927-2014 de fecha 4 de noviembre de 2014 y DA-0739-2015 de fecha 20 de julio de 2015. (Folios 44 del expediente administrativo 435R del departamento de Aguas del MINAE en físico y folios 5-6, 12-13 del expediente administrativo 1351R del mismo departamento).
  • 4)Que la codemandada ASADA de Cuestillas y Ron Ron tiene un convenio de delegación con el coaccionado AyA del sistema de acueducto comunal y alcantarillado desde el 28 de noviembre de 2005. (Imágenes 145-157 del expediente judicial digital).
  • 5)Que la codemandada ASADA de Pénjamo tiene un convenio de delegación con el coaccionado AyA del sistema de acueducto comunal y alcantarillado desde el 8 de enero de 2008. (Imágenes 441-453 del expediente judicial digital).
  • 6)En fecha 30 de setiembre de 2014, las ASADAS codemandadas y la representante de la actora, gestionan conjuntamente con el SINAC para que se delimite el área de protección de los 200 metros sobre las nacientes, conforme la ley de aguas. (Imagen 39 del expediente judicial digital).
  • 7)Por medio de memorandos del 22 de junio de 2015, 29 de junio de 2015 y 15 de febrero de 2017, la actora envía misivas a las accionadas para, en resumen, coordinar la actividad de las ASADAS accionadas con la identificación de quienes ingresan a la propiedad, planificación de actividades, además de mostrar su preocupación por la afectación del área que tienen sometidos a programa forestal. (Imágenes 40-43, 55-56 del expediente judicial digital).
  • 8)Ante las gestiones planteadas por la actora, la ASADA de Pénjamo emitió el oficio ASAPEN-005-2016 de fecha 13 de junio de 2016, ASAPEN-012-2017 y ASAPEN-014-2017, ambos de fecha 22 de febrero de 2017. (Imágenes 44-47, 57-60 del expediente judicial digital).
  • 9)En fecha 11 de febrero de 2019, el AyA emite criterio técnico de captaciones de las ASADAS codemandadas, en lo que interesa, el informe señala: “… Según lo manifestado por los representantes de la ASADA de Pénjamo el acueducto se construyó en el año de 1971 con una ayuda de la Municipalidad de San Carlos, no se cuenta con archivos ni planos constructivos que demuestren la fecha de construcción. Los representantes de la ASADA de Cuestillas - Ron Ron dijeron desconocer el año en que se construyó el acueducto, sin embargo; estimaron que existe desde la década de los ochenta... para accesar al mismo es necesario ingresar atravesando primero la finca propiedad de los hermanos Esquivel Lobo y luego la finca propiedad de Comercial Agrícola Ganadera Monte Carmelo mediante un sendero en el bosque. Durante el recorrido no se observaron obras de infraestructura que alteren el medio ambiente, la tubería de conducción de PVC de ambos acueductos se encuentra expuesta en algunos tramos y es visible desde el sendero.

La ASADA de Pénjamo cuenta únicamente con una obra de captación de aproximadamente 3,65m de ancho por 3,65m de largo en concreto en apariencia de construcción antigua pero se encuentra en funcionamiento. No cuenta con malla perimetral, la tubería de conducción que sale de la captación tiene un diámetro de 63mm y recorre aproximadamente 160 metros dentro de la propiedad de Comercial Agrícola Ganadera Monte Carmelo… Se observaron otras tres obras de captación de concreto de distintos tamaños propiedad de la ASADA de Cuestillas - Ron Ron que se encuentran funcionando adecuadamente, se observan labores de pintura y limpieza recientes, cuentan con malla de cerramiento. Las captaciones se reúnen en un tubo de 63mm de diámetro que recorre 188 metros desde ahí hasta la colindancia de la propiedad de Comercial Agrícola Ganadera Monte Carmelo… No existen tanques de almacenamiento ni equipo de desinfección en el sitio.

No se observaron obras de infraestructura nuevas realizadas por ninguna de las ASADAS en la propiedad. El acueducto de Pénjamo cuenta con dos sistemas diferentes para abastecer a sus 401 conexiones, el sistema Maroto que registra una producción de 5,69 litros por segundo y la naciente Rigionni con una producción de 6,62 litros por segundo, según los datos de los últimos aforos realizados por al ASADA en época de verano. Se realizó un cálculo de balance hídrico y se determinó que actualmente el acueducto requiere un caudal máximo diario de 7,43 litros por segundo para hacer frente a la demanda de la comunidad y a veinte años se requerirá un caudal de 14,78 litros por segundo. Por tal motivo se concluye que el caudal que aporta la naciente Maroto es imprescindible para suplir el abastecimiento de agua potable de la población actual y a futuro de la comunidad de Pénjamo. El acueducto de Cuestillas - Ron Ron únicamente con la naciente Maroto para abastecer a sus 368 previstas, el último aforo de verano realizado por la ASADA en verano registró un caudal de 6,3 litros por segundo.

Se realizó un cálculo de balance hídrico y se determinó que actualmente el acueducto requiere un caudal máximo diario de 6,8 litros por segundo para hacer frente a la demanda de la comunidad y a veinte años se requerirá un caudal de 13,5 litros por segundo. Por tal motivo esta Unidad Técnica concluye que el caudal que aporta la naciente Maroto es imprescindible para suplir el abastecimiento de agua potable de la población actual y a futuro de las comunidades de Cuestillas y Ron Ron. De acuerdo a lo observado y a la información contenida en el plano de catastro de la propiedad se estima que el área de protección de las nacientes es de 125 664m2, esta área se encuentra sólo parcialmente dentro de los límites de la propiedad de Agrícola Ganadera Monte Carmelo, tomando como referencia el radio de 200 metros establecido en la Ley de Aguas. Por su parte la servidumbre de paso de ambas tuberías representa un área aproximada de 564m2 en el caso de la ASADA de Cuestillas - Ron Ron y 480m2 en el caso de la ASADA de Pénjamo”. (Imágenes 463-469 del expediente judicial digital).

  • 10)En fecha 9 de junio de 2020 se realiza por parte del AyA un estudio hidrogeológico de determinación de zona de protección absoluta bacteriológica para las nacientes de las ASADAS codemandadas. De relevancia, se concluye que, para la Naciente Maroto 2 se define una zona operacional-absoluta de 30m de ancho y 30 m de largo para un área total de 900 m2 como zona de protección operacional absoluta; mientras que para las nacientes Maroto 1, Cuestillas F1, Cuestillas F2 y Cuestillas F3 se define una zona de protección operacional 1244 m, la cual se define a partir de la sobreposición de cada uno de los radios de 15 m definidos para cada una de las fuentes citadas; la zona de protección absoluta para las Nacientes Maroto 1, Cuestillas F1, Cuestillas F2, Cuestillas F3 y para la naciente Maroto 2, la cual con un largo de 602 m y un ancho máximo de 180 m según condiciones geomorfológicas, geológicas e hidrogeológicas y una zona de protección regulada para las nacientes Nacientes Maroto 1, Cuestillas F1, Cuestillas F2, Cuestillas F3 y para la naciente Maroto 2 que se extenderá desde los 602 m hasta la divisoria de aguas (longitud de 1330 m) en dirección aguas arriba a las nacientes, con vulnerabilidad de acuífero alta. (Imágenes 731-793 del expediente judicial digital).
  • 11)En juicio oral y público se recibió la declaración de Luis Alberto Ramírez Pérez, vecino de Ron Ron de Florencia, miembro de la Junta en dos períodos. Manifiesta que conoce donde está la captación de agua, no se ven a simple vista, lo que se ve es el equipo de toma, pero hay que llegar al punto. Hay unas cajas de cemento y la red de distribución a la comunidad. El acueducto tiene más de 42 años, ya que vive ahí desde esa época y ya había servicio, antes era de la Municipalidad. Esa ha sido siempre la fuente. Al momento de la visita lo que hay es solo bosque, ha ido unas 5 o 6 veces, cuando algún compañero ocupaba ayuda, la última vez fue como hace 2 meses. La ASADA de Cuestillas tiene concesión de esa agua. Él era miembro cuando se firmó el convenio de delegación con el AyA, siempre se ha han seguido los lineamientos de servicio, la captación siempre ha sido permanente, e incluso, hubo una época que el agua daba servicio a Santa Clara.

El agua se presta a toda la comunidad de Ron Ron y de Cuestillas. No sabe si con los dueños de la finca se han hecho convenios. En la finca lo que hay es piedra, árboles y fuentes de agua. En preguntas del AyA, aclara que no sabe quién construyó el servicio, se pagaba inicialmente en la Municipalidad de San Carlos. No sabe si en la finca hay más afluentes, él ha entrado a las 2 tomas de agua, que es la de Pénjamo, las fuentes están muy cercanas. Para llegar, hay que entrar por otra finca, que es un potrero, luego ya uno se topa el bosque, se camina casi como unos 200 metros. El servicio se cobraba por tarifa fija, no había medidores, no había teléfonos, entonces con las fugas era un problema, se pasaba como 8 días sin agua, entonces fue cuando se decidieron en una reunión con la Municipalidad de San Carlos, en el Salón Comunal, se creó un Comité para pasar el acueducto a la ASADA, y después se constituyó el convenio de delegación, pero no recuerda fechas.

Aclara que el puesto que utilizó fue Vicepresidente del Comité, así como en las Juntas de la ASADA. Explica que, en las visitas, antes entraban libremente, pero con los conflictos de los últimos tiempos, se pidió permisos, pero en el período en que estaba no había problema, con el anterior propietario, desde hace 20 o 25 años, nunca hubo problemas o restricciones. (Audio y video en SIGAO).

  • 12)De seguido se recibió la deposición de Ana Lorena Gamboa Chaves, vecina de Cuestillas de Florencia. Perteneció a la Junta Administrativa de Cuestillas, entre los períodos 1993-1995. La ASADA ya existía desde mucho antes, ella tiene más de 42 años de vivir en la comunidad de Cuestillas, y desde que vive ahí está el agua y se pagaba el servicio. El agua se toma de las montañas de Pénjamo, en la Finca de los “Maroto”. El agua siempre se ha usado de ahí, todos los trabajos han sido sobre esas fuentes, de hecho, durante su administración se trató mejoras sobre esas fuentes, los trabajos se hacen por parte de la ASADA. Durante su período, nunca se tuvo problema de acceso, quejas de los compañeros o el fontanero para ingresar al sitio. Las aguas alimentan a las comunidades de Pénjamo, Cuestillas y Ron Ron. No recuerda que se hayan hecho convenios con el dueño de la finca. En preguntas del AyA, aclara que, para la época de 1993 era un Comité, ya para el 2013, era ya la Asociación. Antes de eso era la Municipalidad. No recuerda quién construyó, dado que cuando ella llegó ya el acueducto estaba, y se le pagaba en el Salón Comunal, venían los de la Municipalidad de San Carlos, luego la oficinita la usó el Comité. Para ese momento nunca tuvimos problemas de ingresar. (Audio y video en SIGAO).
  • 13)Además, se recibió la declaración del testigo Keilor Joaquín Araya Vargas, vecino de Pénjamo, comerciante. La ASADA de Pénjamo ha existido desde que tiene memoria, así como el de cuestillas. El agua sale de las montañas “de Maroto” que era el dueño original. Ha visitado las captaciones, no están a simple vista, hay que ingresar a la montaña, unos 500 mts algo así. La finca está dedicada toda la vida a montaña, ahorita la tienen en un programa de gobierno para ello, tienen unos senderos. La última vez que fue estaban limpios, amplios, de 10mts de ancho, la gente del pueblo visita los domingos. La última vez que visitó fue como hace dos años, él visitaba con fines recreativos de manera frecuente. Para llegar hay que pasar una finca ganadera que está cercado para evitar que el ganado pase a la montaña, y siempre se ha usado para eso, aunque antes le sacaban madera. Siempre ha sido la fuente de captación, ya después el acueducto se alimenta de otras fuentes, pero esa siempre ha sido para el pueblo. La ASADA de Pénjamo, reciben visitas del AyA para hacer estudios del agua, el mantenimiento de la estructura la hace la ASADA. En preguntas del AyA, aclara que, desde el año 1968 vive ahí. Aclara que Cuestillas, Ron Ron y Pénjamos son comunidades diferentes. Especifica que, desde los senderos no se pueden ver las tomas de aguas. (Audio y video en SIGAO).
  • 14)Posteriormente, declaró Rodolfo González Gutiérrez, vecino de Pénjamo, comerciante. Fue miembro de la ASADA de Pénjamo como hace 30 años, y el dueño anterior, le daba agua directamente a él, pero eso hace 30 años. Cuando él formó parte, el acueducto ya existía, él comenzó a vivir desde hace 34 años, y ya el acueducto funcionaba. Antes no había conflicto, fue hasta ahora, hasta este proceso. Cuando se llega a las captaciones se aprecia las fuentes. La finca se dedica a reserva forestal, tienen senderos, aunque tienen otras actividades aparte del bosque. Eso siempre ha sido montaña y de hecho hay unas 6, 7 u 8 nacientes, pero las ASADAS solo unas 2, una cada una. La ASADA siempre ha usado ese recurso, y cree que está a derecho con la AyA, desconoce si existen convenios con los dueños de la finca. Las comunidades que se benefician son Cuestillas y Pénjamo. No recuerda que la finca esté rotulada.

En preguntas del AyA, aclara que la naciente que se usaba a nombre de él el anterior propietario es diferente de las fuentes de las ASADAS. Aclara que, para el momento en que formó parte de la administración, era Comité. No recuerda quién fue el que hizo el acueducto. La población podría ser en Pénjamo tal vez unas 400 casas aproximadamente. En preguntas del Tribunal, señala que su último ingreso fue como hace 2 años. Señala que lo cercado son las fincas vecinas, pero se puede caminar libremente por los senderos. (Audio y video en SIGAO).

  • 15)Acto seguido, se recibe a Christian Eduardo Delgado Segura, geólogo para el AyA en la UEN de Gestión Ambiental (Unidad Estratégica de Negocios), Director del Área Funcional de Hidrogeología, desde el 2018, encargado de la revisión y aprobación del informe visible a imágenes 731ss del expediente judicial. Señala que el informe se realiza por parte de la Dirección Jurídica para determinar las zonas de protección absoluta de las nacientes en cuestión, es un estudio hidrogeológico. El objetivo es definir las zonas que son de mayor interés para proteger la calidad y cantidad del recurso hídrico para la protección de las zonas de protección absoluta. El informe lo realizó un funcionario del área, un hidrogeólogo. Se levantó las fuentes en el sitio y las condiciones geológicas del sitio. Se identifican flujos de afluente y se determina las características de las zonas no saturada, permeabilidad y porosidad de la zona y determinación de otros parámetros para definir la zona de protección absoluta.

Sirve también para identificar y calificar el tipo de acuífero que hay en la zona. A imagen 749, identifican las diferentes unidades hidrológicas, encontrándose lavas sumamente permeables de recarga directa. Las nacientes de puntos triangulares, se trata de una pendiente fuerte donde las coladas florecen, como parte de una falla tectónica de Florencia. De hecho, los triángulos celestes son nacientes fuera del objeto de litigio, por lo que la zona es un punto de descarga. Es un acuífero libre, no tiene cobertura superior. A imagen 751 se puede analizar la línea de flujo de agua, que es lo que posteriormente sirve para definir las zonas de recarga, como se observa en imagen 752. El área se contempló el tránsito de contaminantes con un radio de 600mts aproximadamente. El estudio afirma que la fragilidad es alta. El estudio de fragilidad pondera varios factores para ver qué tan sensible es el manto acuífero a la contaminación y al vertido.

En este caso, como es un acuífero libre, que combinado al nivel freático que es muy superficial, a unos 5mts, en conjunto con la ausencia de una cobertura, hace que sea sumamente frágil o de alta fragilidad y por eso el radio de 600mts. La actividad recomendada sería en función de la zona de protección, por ejemplo, en la zona absoluta no se podrían ni tanques sépticos o actividad ganadero o agroquímica que generen vertidos. La naturaleza de la zona hace que en todo el frente de la ladera afloren muchas nacientes, no solo los de litigio y las que están registradas, eso es propio de las características hidrogeológicas. A imagen 762, los cuadros anaranjados son las zonas operacionales, mientras que las amarillas sería zona de protección absoluta, sin perjuicio de las áreas de la ley de aguas de 200 mts, mientras que las rozas de rayas, sería zonas de protección relativas. El óvalo naranja es la zona de 200 mts de la ley de aguas.

Las áreas a conservar directa, serían las zonas amarillas y los cuadrados naranjas. En contrapreguntas, aclara que los 200mts no es recomendación técnica, sino norma de ley de aguas. (Audio y video en SIGAO).

  • 16)Finalmente, se recibió la declaración de Luis Diego Alfaro Artavia, ingeniero civil, labora para la Oficina Regional de Acueductos Comunales Región Huetar Norte, se encargan de darle seguimiento a las ASADAS Accionadas. Labora desde hace 7 años, es ingeniero de la Unidad técnica de dicha oficina. El estudio a imágenes 466-469, se hizo como parte de este proceso para hacer una descripción de cada uno de los componentes de la estructura de los acueductos, así como de las áreas de protección. En la zona lo que hay es obras grises de captación y obras complementarias (cercas, mallas perimetrales, cajas de registro, tapas), así como las tuberías que están en PVC. Señala que no es posible modificar la ubicación de las estructuras, sobre todo de las tuberías. Si se remueve las zonas de captación, no hay manera de llevarlo a los tanques de almacenamiento de manera natural. Se tratan de dos sistemas distintos, la de Pénjamo con 450 casas aproximadamente y el de Cuestillas Ron Ron de tamaño similar con el mismo aproximado de casas.

La ASADA de Pénjamo tiene otra fuente, pero la de Cuestillas no, es la única. Se tratan de sistemas muy dependientes de esta alimentación. A imágenes 739-740 se tratan de fotos del lugar. Las estructuras no son visibles desde los linderos de las fincas, de hecho, las nacientes están a unos 200 mts desde la entrada por uno de los linderos. Aclara que Maroto 3 tiene producción intermitente. Las áreas en naranja son las nacientes y la infraestructura (obra gris) es el cuadro rojo. Aclara que las captaciones en su totalidad están dentro del radio de protección, pero las tuberías de conducción están parcialmente dentro, y las tuberías serían las únicas que están fuera del área. De cada naciente, sale al menos un tubo hacia una caja de reunión, y de ahí uno solo hacia el área de almacenamiento. Cada ASADA posee su propia línea de distribución. Las cajas de reunión se encuentran dentro del área de los 200mts.

En cuestillas es cerca de la misma naciente, mientras que la de Pénjamo es en una reunión entre tuberías tipo “T”, su última visita fue en el año 2020. AyA posee con la información que da la ASADA, en este caso, no se tiene planos originales de diseño de la construcción, pero por trabajos posteriores, se cuenta con planos y levantamientos de la ASADA, que permiten calcular la cantidad de km de tubería, espesor, etc. Señala que, en el año 2020 que es la última vez que se hizo visita, las estructuras registradas y levantadas de tuberías no consta que haya habido cambios. (Audio y video en SIGAO).

II. SOBRE LOS HECHOS NO PROBADOS

Se tienen como hechos relevantes no probados de este proceso: 1) Que la conducta de los demandados haya interferido en la disminución del ingreso económico que tiene la actora en el marco de la ejecución del contrato Forestal con FONAFIFO SC-01-222-0024-2015 y que éste se encuentre vigente al momento de la emisión de esta sentencia. (Los autos). 2) La existencia de erosión y/o contaminación del inmueble propiedad de la actora producto de la actividad de las demandadas y específicamente, ocasionados por la ausencia de planes de manejo del manto acuífero del bosque y del medioambiente. (Los autos). 3) Que las codemandadas ocupen siete hectáreas del terreno objeto de este proceso. (Los autos). 4) Que las ASADAS demandadas o el AyA hayan formalizado servidumbres de acueducto y de paso para los sistemas de agua potable objeto de este proceso. (Los autos).

III. SOBRE EL ARGUMENTO DE LA ACTORA

En su escrito de demanda, la representación actora señala que como propietaria del inmueble matrícula inmobiliaria del partido de Alajuela 2-401761-000 tiene contratos de pago de servicios ambientales con FONAFIFO para protección de bosque, con la finalidad de tutelar la belleza escénica, el recurso hídrico, la protección del uso urbano rural o hidroeléctrico, evitar emisiones de gases y no alteración del comportamiento natural del área protegida. Al entrar en posesión del inmueble en el año 2004, encuentra que en la propiedad existen tanques de reunión de captaciones de nacientes de agua, captaciones, redes de conducción y distribución, filtros que fueron instalados, usados y aprovechados por las ASADAS demandadas. Al considerarse ello una perturbación de la posesión y de propiedad en general de su bien, ha tratado de arreglar de manera pacífica con las demandadas y regularizar la situación, suscribiendo el 30 de setiembre de 2014 un documento con los presidentes de las ASADAS para que el SINAC señalara la zona de protección de las nacientes en las fincas de su propiedad y así las codemandadas asociaciones no estuvieran realizando actividades que nunca han sido autorizadas de su parte y que afectan las zonas de protección.

Además, se ha instado a los representantes de las accionadas en varias oportunidades a que deben pedir permiso para ingresar a la propiedad, dando como ejemplo la misiva a la ASADA Pénjamo del 22 de junio de 2015 donde se le indica la negativa a ingresar nuevamente a la propiedad por perturbar la posesión, teniendo necesariamente que solicitar el ingreso previamente con 15 días de anticipación, y que debían colocar la cañería que habían cambiado al llegar al tanque de captación y colocarla en el lugar que estuvo hasta febrero del 2015, por hacer la modificación sin ninguna autorización, aspecto que fue contestado el 29 de junio de 2015 indicando que habían colocado nuevamente la cañería en el lugar que estaba, respondiendo ese mismo día que era necesario formalizar la situación que se estaba viviendo, ya que no se ha ni expropiado ni indemnizado por las actividades realizadas en la propiedad, además de llegar a acuerdos en temas de protección ambiental, aspecto que no se ha realizado y que continúa al día de hoy.

Igual con la diligencia a la ASADA de Pénjamo del 23 de mayo de 2016, la reunión conjunta del 20 de mayo de 2016 y la comunicación del 19 de junio de 2016. Se ha insistido en la comunicación previa quincenal de las programaciones de mantenimiento preventivo y correctivo, nombres de las personas que van a participar en los trabajos, participar en programas preventivos y de conservación con organizaciones educativas y comunales en pro de la protección del bosque, el ambiente y el recurso hídrico y no ha sido posible cumplir con esos propósitos de ordenar el acceso a la propiedad, afectando con ello el correcto manejo de los compromisos de servicios ambientales que tiene la actora, dado que en el lugar no puede deambular personas, no se puede cazar, extraer plantas animales y se debe proteger el bosque el ambiente y el recurso hídrico. Expone que en ocasiones, en las reuniones han participado representantes del AyA de la dirección regional de San Carlos, así como del Ministerio de Salud y MINAE, para tratar de ordenar la actividad, pero no ha sido posible.

Se ha ofrecido arrendar formalmente, vender la porción de terreno que ocupan sin permiso, pero la respuesta siempre ha sido negativa de parte de las accionadas alegando limitación económica. Incluso se intentó un arreglo en una audiencia temprana en la Fiscalía de San Carlos el 6 de febrero de 2017, con una propuesta de pago de 5 millones de colones entre las dos ASADAS a partir de enero de 2017 con un plazo de 5 años, sin embargo, las negociaciones no prosperaron como se observa en el oficio de la ASADA de Pénjamo ASAPEN-012-2017 y ASAPEN-014-2017. Consideran que el terreno usurpado y usufructuado por las accionadas es de aproximadamente 7 hectáreas de terreno que corresponden al área de protección y el área de tubería de conducción a los tanques de almacenamiento, con la consecuente imposibilidad de ejercer la posesión desde el año 2004. En la réplica, afirmó que la actora adquiere la propiedad por compra el 3 de setiembre de 2004, inscribiéndose el 17 de ese mismo mes y año, teniendo posesión de toda la finca hasta ese último momento, especificando de que desconocía de las instalaciones de las ASADAS dado que su ubicación no es de acceso directo, es un sector montañoso y cerrado, no siendo las instalaciones visibles.

Explica que la actividad de la ASADA remonta apenas a meses o pocos años antes de la compra, cuando además se inscribe la naciente por parte del MINAE (exp. 435-R y 1351-R), siendo que antes de ese momento no se tuvo concesión, ya que no se contaba con permiso. Desmiente que desde hace 30 años esa asociación existiese y remarca de que hay concesiones desde el 2015 sobre las cuales nunca se entregó autorización, y que el permiso entregado en el 2005 fue entregado por el anterior dueño y no por el propietario, explicando que lo que ha existido es una mera tolerancia que se le puso fin. Niega que las áreas ocupadas sean Patrimonio Natural del Estado ya que se trata de propiedad privada de su representada, rechaza la falta de derecho, al tener demostrado la perturbación de dominio que motiva la acción, la falta de legitimación activa y pasiva dado que las accionadas son las perturbadoras de posesión y propiedad, mientras que la actora es la titular inmobiliaria, así como la prescripción dado que, a su juicio, el derecho de dominio es imprescriptible y, en todo caso, se ha acreditado que a lo largo del tiempo han existido reuniones y acciones tendientes a regularizar la situación

IV. SOBRE EL ARGUMENTO DE LOS DEMANDADOS

En su contestación de demanda y conclusiones, la ASADA de Cuestillas y Ron Ron señala que el acueducto por ellos administrados precede mucho la constitución formal de la ASADA y que ronda por el año 1975, los cuales han sido tolerados por todos los dueños, incluidos los actuales propietarios, aspecto que demuestra con los testigos evacuados en juicio, por lo que no es cierto que la existencia de las captaciones, filtros, redes de conducción y distribución sean de época posterior a que la actora fuese dueña registral del inmueble. Afirma que con su representada nunca han tenido problemas, que éstos se dan con la ASADA de Pénjamo, que en alguna oportunidad se habló de arriendo, mas fue rechazado por su elevado costo, mas nunca se ha hablado de venta. Expone que, si bien se realizó un intento de conciliación en audiencia temprana ante la Fiscalía de San Carlos, nunca se llegó a un acuerdo, por lo que la causa fue desestimada y el asunto remitido a otra vía.

Expone que su accionar se enmarca en el art. 33 de la Ley Forestal N° 7575, del reglamento 25721-MINAE y por las disposiciones técnicas del AyA. En todo caso, acepta que, si bien ocupan un área no determinada aún, lo cierto es que se enmarca dentro del Patrimonio Natural del Estado, limitándose a la prestación del servicio público administración del acueducto. Alega una falta de derecho al pretender una indemnización por un terreno que es de dominio público de tutela hídrica, ejerciendo su actividad al amparo de la ley, y pretendiendo una reivindicación de terrenos afectados por la Ley Forestal, el cual es inalienable. Señala que existe una falta de legitimación dado que, si lo que pretende es tutelar sus intereses de propietario, lo tendría que realizar frente al Estado, quien administra ese tipo de bienes, siendo correlativa la falta de legitimación activa al ser el Estado el responsable de esos terrenos, siendo ellos unos simples guardadores y protectores de los recursos forestales del Estado.

Afirma que, en todo caso, existe prescripción de las pretensiones, dado que el acueducto existe hace más de cuarenta años, siendo improcedente la reivindicación solicitada conforme el art. 868 del Código Civil. Por su parte, la ASADA de Pénjamo en su descargo señala que ha mantenido la explotación del recurso hídrico desde hace más de 30 años, contando con la venia desde el propietario original “Maroto” y los propietarios subsecuentes, tal y como lo acreditan los testigos recibidos en juicio. Explica que el servicio de agua potable poblacional ha sido tutelado con la jurisprudencia de la Sala Constitucional, en preferencia frente a los intereses particulares, la cual en este caso ha sido concesionada a su favor por parte del MINAE, siendo que sus actuaciones se han ajustado a los lineamientos del AyA como ente rector, así como los lineamientos de salud y en general, de prestación del servicio de acueducto.

Destaca que la propia parte reconoce que han realizado gestiones en conjunto, como la referida en la demanda ante el SINAC para delimitar las áreas de conservación, sin embargo, desconoce las resultas de la gestión. Rechaza que se hayan realizado conductas lesivas a la propiedad de la actora, y señala que se han limitado a proteger, mantener y cuidar la concesión dada por la Dirección de Aguas del MINAE, así como ha realizar las acciones necesarias para mantener el servicio en óptimas condiciones, siempre respetando la propiedad privada de la demandante. Apuntan que las actividades siempre las ha realizado el fontanero de la ASADA que es conocido por los trabajadores de la actora y solamente en casos excepcionales imprevistos de fuerza mayor, se ha hecho acompañar de terceros, pero siempre limitándose a las áreas del tanque y las tuberías, no siendo posible, como lo pretende la parte, que en tales escenarios se coordine con los 15 días de anticipación que pretende.

Comenta que la actividad del fontanero es de al menos tres veces a la semana, dado el mantenimiento y ejercicio de cloración, cosa que tiene conocimiento la actora dado que ello es la cotidianidad de los trabajos. Reprocha el reclamo de la actora del supuesto ingreso de personas al sitio, siendo que fue la propia parte accionante la que construyó senderos de acceso que incluso llevan a la calle pública, siendo ellos los generadores del riesgo que ahora reclaman. Generaliza afirmando que hay una contradicción en la postura de la parte actora al exigir el cese de la actividad pero por otra reprocha la falta de comunicación, así como el ejercicio de tareas conjuntas como la capacitación y concientización de protección al ambiente. Reprocha que las condiciones en que adquiere la actora el inmueble soportaban la actividad de las ASADAS, siendo los espacios siempre bajo aprovechamiento de éstas, sin perturbación de posesión de otras áreas de la finca, no siendo procedente la petitoria de reivindicación por falta de legitimación activa y señalando que la actora ya recibe una indemnización por la afectación forestal, justamente por el contrato de servicios ambientales que la propia parte recibe a su favor, no siendo factible una doble indemnización.

Comenta que si bien, en el año 2017 se realizó un acercamiento entre partes en la Fiscalía de San Carlos, lo cierto es que no se llegaron a acuerdos firmes, sobre todo considerando la ausencia del ente rector (AyA), de ahí que no existan incumplimientos relativos a supuestos alquileres o compra de terrenos. Las conclusiones fueron en común con la ASADA de Cuestillas al tener el mismo patrocinio letrado. Finalmente, el AyA tanto en su contestación como en conclusiones, refiere al oficio UEN-GAR-2019-00403, el cual copila las condiciones de las instalaciones de las codemandadas en el fundo en cuestión, así como la información de origen que data de los años setenta y ochenta. Considera que, contrario a la posición de la actora, el recurrir de manera conjunta al SINAC para demarcar las áreas de protección lejos de excluir a las codemandadas, más bien tiene por objetivo demarcar su área de trabajo.

Reprocha como injustificada la posición de la actora de informar con 15 días de antelación, dado que el servicio ha de intervenirse cuando se requiera, con la finalidad de garantizar la continuidad del servicio. Rechaza las afirmaciones de la actora respecto de la conducta de las codemandadas, dado que el criterio referido demuestra que éstas se han apegado al cumplimiento de sus deberes legales, sin irrupciones al entorno ambiental de la finca, limitándose a la prestación del servicio, se trata de una infraestructura mínima de captación de nacientes y tuberías de conducción existentes desde antes que la actora fuera propietaria y sin muestras de estructuras de construcción reciente, siendo justamente las condiciones de la zona, que le permitieron a ésta formalizar un contrato de servicios ambientales. Insiste en que ha existido una tolerancia de más de 10 años sobre el fundo dado por la propia actora (considerando su titularidad desde el 2004 y hasta el inicio del conflicto en el 2015).

Muestra que las codemandadas cuentan con las respectivas concesiones de agua, así como su correlativa asignación de caudal, ello con fines poblacionales, reforzando las áreas de protección tanto con la prueba testimonial pericial evacuada en juicio, como el informe técnico UEN-GA-2020-02131. Coincide con la codemandada en el sentido de que para el año 2017, cuando se realizó la gestión ante la Fiscalía, el AyA no formó parte, con lo que no puede validar dichas actuaciones, dado que la constitución de arriendos o compras, deben pasar previamente por el aval del ente rector, que es el AyA. Rechaza categóricamente que las codemandadas tengan en su posesión siete hectáreas de terreno, sino que éstas, como se refiere en el criterio citado, solamente contempla el área de las tuberías, así como de la infraestructura de captaciones, por lo que se trata de una afirmación temeraria sin fundamento alguno.

Señala que ambas codemandadas cuentan con convenio de delegación suscrito con el AyA, en el marco de la nacionalización del servicio de agua potable bajo la figura de una prestación indirecta del servicio público, siendo el AyA ente fiscalizador, rector e interventor, en caso necesario. Apunta que resulta indispensable la existencia de dichos sistemas para la prestación de las comunidades de Ron Ron, Cuestillas y Pénjamo, no siendo posible su sustitución, además del entendido de que éstos fueron edificados con la venia, vista y paciencia del dueño inmobiliario, siendo con ello una actividad de buena fe, pacífica y notoria. Así, rechaza los pedimentos de daño moral y material, dada la existencia de prueba de los daños, así como de causalidad imputable a las accionadas. Reitera que el AyA a través de la prueba técnica aportada desmiente las afirmaciones de la demanda, al igual que el supuesto daño moral reclamado que proviene del ejercicio legítimo de la actividad de servicio brindado por las ASADAS y que han sido ante la tolerancia evidente y manifiesta de superación decenal a manos de la propia actora.

Situación idéntica a los supuestos perjuicios dado que no se aportó prueba de parte de la actora de la aparente disminución de pago por parte del MINAE. Finaliza señalando que es claro que, bajo ningún título, la actora podría hacerse de la infraestructura que está destinada al servicio público de aprovechamiento de las señaladas comunidades, además de que el aprovechamiento del recurso hídrico no es resorte de la actora, sino de la Dirección de Aguas que, como se dijo, tiene regulada la asignación a favor de las codemandadas. Invoca la falta de derecho, así como la falta de interés actual, dado que la actora tenía conocimiento de los componentes del acueducto al momento de la adquisición del inmueble y haber tolerado por más de diez años el accionar de las codemandadas.

V. SOBRE LA PRESCRIPCIÓN ALEGADA Y DE LA FALTA DE INTERÉS ACTUAL

Respecto de la prescripción alegada por las ASADAS accionadas, la misma ha de rechazarse por los motivos que de inmediato se precisan. Por un lado, hemos de separar el objeto en litigio, como se desarrollará en detalle infra, respecto del área Patrimonio Natural del Estado, conforme lo disponen los numerales 261 y 262 del Código Civil, en relación con el numeral 40 del CPCA, la discusión relativa a bienes demaniales es imprescriptible por lo que la defensa no es oponible frente a este tipo de bienes. Toma en consideración además esta Cámara, que la defensa de los bienes de dominio público es una competencia exclusiva del Estado, de suerte que tal y como se explica en esta sentencia, la parte actora no ostenta legitimación para su tutuela directa y mucho menos acción de reivindicación, de manera que la defensa como tal, no le es oponible. Ahora bien, sobre el resto del terreno, dominio privado de la actora, la petitoria de restitución o reivindicación es una derivación directa de una atribución del dominio (art. 264 del Código Civil), con lo que ha de complementarse con lo que dispone el numeral 313 del Código Civil que señala "La protección de la autoridad al poseedor que se viere inquietado o molestado en su posesión, no afecta en nada a las cuestiones sobre propiedad o sobre mejor derecho de poseer", así como el artículo 316 que reza "Todo propietario tiene la facultad de reclamar en juicio la cosa objeto de su propiedad, y el libre goce de todos y cada uno de los derechos que ésta comprende" y en especial el numeral 320 del mismo cuerpo que expresa: "La acción reinvindicatoria puede dirigirse contra todo el que posea como dueño, y subsiste mientras otro no haya adquirido la propiedad de la cosa por prescripción positiva" (resaltado es nuestro), por lo que, conforme dichas normas, resulta inaplicable la prescripción negativa, tal y como se ha pretendido, dado que el límite temporal lo marca el acaecimiento de una eventual adquisición por prescripción adquisitiva, lo que no se está discutiendo en este asunto.

Por otra parte, el AyA invoca una falta de interés actual dada las condiciones en cómo se ha tolerado el actuar de las codemandadas frente a la demandante. Al respecto, la defensa debe rechazarse, en tanto el interés actual se constituye en el elemento valorativo – aún de oficio – de parte del Tribunal, en el cual se determina si existe o no, persistencia en el tiempo, respecto del pronunciamiento en sentencia sobre determinado asunto. En este caso, es claro que la presencia de las ASADAS en el fundo en litigio, lejos de considerar una falta de interés, más bien la mantiene, dado que, justamente, la necesidad del pronunciamiento en sentencia viene a zanjar las posiciones en conflictos entre las partes. Así, la duración en el tiempo de las conductas de las codemandadas, es un aspecto a considerar en el fondo del asunto, no como un componente demostrativo de la devenida carencia de interés, sino de lo contrario, razones que son coherentes con el rechazo de la defensa de prescripción supra, analizada en este mismo apartado.

VI. SOBRE LAS ÁREAS DE PROTECCIÓN ALREDEDOR DE LAS NACIENTES Y ÁREAS DE RECARGA COMO BIENES DEMANIALES

EXPLOTACIÓN DE ÉSTAS PARA FINES POBLACIONALES Y RÉGIMEN DE RESPONSABILIDAD DEL AYA Y DE LAS ASADAS: En otra oportunidad, respecto de la naturaleza jurídica de las zonas de protección alrededor de las nacientes, esta Cámara con una integración diferente manifestó: “…Retomando lo que se ha sostenido a lo largo de la presente resolución, no se pone en duda sobre la inviolabilidad de la propiedad privada, como “aquel derecho de poseer exclusivamente una cosa, gozar y disponer de ella, sin más limitaciones que las establecidas por la ley o por la voluntad del propietario”. (Ver Resolución N° 2006-017514 de las 9:41 horas de fecha 01 de diciembre de 2006 emitida por la Sala Constitucional de la Corte Suprema de Justicia). También se reconoce, posición que se comparte, que: “El tratamiento de la protección de los derechos reales, en materia civil y agraria, tienen una gran importancia en todos los ordenamientos jurídicos que han consolidado una base constitucional arraigada en la protección de los derechos humanos fundamentales: junto a los derechos de libertad económica, entre los cuales se encuentra la propiedad privada y demás derechos reales derivados, también se han consagrado derechos-deberes económicos, sociales y ambientales.

La propiedad privada y la libertad económica encuentran protección constitucional en los artículos 45 y 46 de nuestra Carta Magna y, aunque parece obvio, su existencia y defensa obedecen a la permanencia de un Estado Social de Derecho, basado en principios y valores constitucionales, en los cuales se consagran no solo derechos a favor de los particulares, sino también deberes, con miras a alcanzar un desarrollo económico, con equidad, solidaridad y justicia social”. (Ver Sala Constitucional Resolución Nº 16629 -2012 a las 16:31 horas 28 de noviembre del 2012). En este sentido, se comparte la posición de la Sala Constitucional transcrita, en el tanto, no se puede analizar el derecho de la propiedad de forma aislada, como un derecho irrestricto, sino que también debe analizarse éste dentro de los deberes de los ciudadanos en la protección de la naturaleza, lo cual incide definitivamente en el hecho de que, al momento de ejercer sus derechos como titulares de un bien o un valor, debe realizarse de forma armónica con el colectivo, y para el caso que nos ocupa, en equilibrio con las cargas ambientales que han sido establecidas por el legislador para lograr cumplir los fines sociales del Estado como un todo, en palabras de la Sala Constitucional procurar “alcanzar un desarrollo económico, con equidad, solidaridad y justicia social”.

Lo anterior dado que no se puede perder de vista es que el ordenamiento jurídico como un todo, consagra un balance o un equilibrio entre los derechos de los administrados, las garantías dispuestas en procura de la protección al régimen de libertades, dentro de las que se encuentra, como dijimos anteriormente, el derecho fundamental a “tener” (propiedad privada), y el interés general, público y la propia función social de la propiedad (especialmente cuando se trate del resguardo del recurso hídrico, objetivo primordial de las limitaciones o zonas de protección que son objeto de la presente litis). También se trae a colación lo ya apuntado, en lo concerniente a que, por estos motivos, y la propia evolución del concepto de la propiedad, es que jurídicamente es factible que la propiedad tenga cargas, límites o limitaciones que pesan sobre el bien inmueble, y respecto de las cuales, unas deben ser soportadas por su titular sin pretender ser indemnizadas, como lo son las restricciones o zonas de protección a las nacientes que están reguladas en la Ley Forestal y Ley de Aguas, por lo que no se comparte el criterio de los accionantes.

En consonancia con lo dicho, es criterio de esta Cámara de Juzgadores que los accionantes brindan una interpretación de “vaciar el contenido del derecho a la propiedad privada” equivaliéndolo a la imposibilidad de realizar una edificación o construcción para vivienda o comercial, lo cual es inexacto, según se explica a continuación. En primer lugar, no obra prueba alguna dentro del expediente administrativo respecto a que los accionantes hayan solicitado una patente comercial o algún otro permiso o licencia de aprovechamiento del bien inmueble a la Municipalidad de Puriscal u otra entidad pública como lo podría ser el Fondo de Financiamiento Forestal, que cuenta con diferentes proyectos de pago de servicios ambientales o aprovechamiento forestal. Lo anterior sin pretender ser taxativo en las opciones que, dentro del marco jurídico vigente y, sin transgredir las limitaciones que están contenidas en los preceptos legales de reiterada cita, pueden ejecutar los accionantes, y cualquier otra persona física o jurídica que se encuentre dentro de la misma condición jurídica contenida en los presupuestos normativos de las Ley Forestal y Ley de Aguas.

Infiere este Tribunal que la representación de la parte actora extrapola esa imposibilidad de ejercer cualquier tipo de actividad de las normas 33 y 34 de la Ley Forestal y del numeral 149 de la Ley de Aguas, así como la jurisprudencia emitida por la Sala Constitucional respecto a la imposibilidad de cortar árboles o realizar actividades que no están permitidas dentro de los bienes que están dentro de una zona de protección ambiental, como lo es las propiedades de los accionantes, de donde surge su conclusión de que debe ser indemnizados por ser una expropiación de hecho. Sin embargo, como se apuntó existe un error de equiparar la imposibilidad de construcción de una vivienda del aprovechamiento como tal de un inmueble, el cual no se agota en la construcción de una vivienda, sino que existen diferentes destinos o provechos que se pueden ejercer como propietario. Según el Diccionario de la Real Academia Española, el vocablo “aprovechar” se define como “Emplear útilmente algo, hacerlo provechoso o sacarle el máximo rendimiento.

Aprovechar la tela, el tiempo, la ocasión”. (Real Academia Española. Diccionario de la Lengua Española, Edición 2023 consultada en: https://dle.rae.es/aprovechar). Por lo que, ese aprovechamiento debe analizarse respecto a todos los derechos que surgen del ser titular de un bien, y como se citó, dentro del ámbito de los diferentes tipos de propiedad que existen, y los destinos de los bienes que están al servicio del ser humano. Al respecto, precisamente el Tribunal Constitucional se ha desarrollado el tema de las diferentes vocaciones de las propiedades, es decir, los destinos y diferentes aprovechamientos de los inmuebles dentro del concepto de la función social, especialmente la ambiental, tema que reviste de interés nacional público, en el sentido de que, del numeral 50 Constitucional se logra derivar el derecho a la salud y a la vida, de forma tal que, la protección del ambiente y del agua, son vitales para lograr una coexistencia armónica de la humanidad.

Así la Sala Constitucional en la Resolución N° 2007-006581-2007 de las 15:39 horas de fecha 15 de mayo de 2007 de forma abundante realizó un repaso sobre los diferentes tipos de interés social que son conformes al bloque de constitucional, y que están dejando de lado los accionantes: “XV.- TIPOS DE INTERÉS SOCIAL RECONOCIDOS POR LA JURISPRUDENCIA CONSTITUCIONAL. La jurisprudencia constitucional ha reconocido dos tipos interés social que legitiman -o justifican- la imposición de limitaciones a la propiedad: estos son los relativos a la protección del ambiente y los de orden urbanístico, este último, a partir del desarrollo que se hace en la sentencia número 4205-96, supra citada. Expresamente se ha reconocido que la razón última de estas limitaciones es precisamente la ‘transnacionalización’ de los valores de su afectación, toda vez que no afectan únicamente a la localidad o nación, sino a la Humanidad en su conjunto, ya que como se ha indicado con anterioridad, la problemática de la protección del ambiente trasciende el orden local o regional (sentencia número 3705-93, de las quince horas del treinta de julio de mil novecientos noventa y tres).

(…) Es así como la propiedad forestal privada, la cual, como su nombre lo indica, es la propiedad titulada por los particulares, y que se ostenta en los términos del artículo 45 de la Constitución Política, se afecta con un régimen jurídico especial, en el primer caso, al régimen forestal, mediante el correspondiente decreto ejecutivo del Ministerio del Ambiente y Energía, el cual pesa sobre la propiedad a modo de limitación de interés social, que en todo caso debe inscribirse en el Registro Público de la Propiedad. Por este motivo es que estos inmuebles pueden hipotecarse, e incluso, el recurso forestal puede constituir prenda; adquirirse por usucapión, así como también enajenarse o trasladarse su dominio, con la advertencia de que, en todos los casos, se traslada la afectación forestal. Y dependerá de la categorización que del recurso forestal haga la normativa vigente, como lo son las reservas forestales, las zonas protectoras y los refugios de vida silvestre (artículo 37 de la Ley Forestal número 7174), que la propiedad privada podrá explotarse y aprovecharse, a condición de sujetarse al respectivo plan de manejo.

Queda claro que las limitaciones en materia forestal implican un impedimento de aprovechamiento del recurso forestal por parte de su propietario, quien en modo alguno está legitimado para talar o aprovechar económicamente el bosque existente en su propiedad a su antojo o voluntad, si no es, y exclusivamente, mediante un plan de manejo, debidamente aprobado por la Dirección Forestal”. (Lo resaltado en negrita es autoría propia). De lo esgrimido por la Sala Constitucional, lo cual es compartido por esta Cámara de Juzgadores es que, el estar sometida una propiedad a un régimen forestal o restricciones de índole forestal no conlleva el vaciar de contenido los actos que pueden ser ejercidos por sus titulares, sino limitaciones al uso y disfrute que deben efectuarse dentro del rango de los parámetros que están establecidos en la Ley. En segundo lugar, los accionantes dejan de lado que, los derechos que se derivan de la titularidad o dominio absoluto de un bien no solo son construir (transformar el bien), sino que corresponden a los dispuestos en el numeral 264 del Código Civil, precepto que regula que: “El dominio o propiedad absoluta sobre una cosa, comprende los derechos: 1º.- De posesión. 2º.- De usufructo. 3º.- De transformación y enajenación. 4º.- De defensa y exclusión; y 5º.- De restitución e indemnización”.

De esta manera, únicamente se estaría en el supuesto de vaciar el derecho de propiedad, cuando por la conducta del Estado (activa u omisiva) anula la posibilidad del ejercicio de todos y cada uno de las atribuciones o facultades enunciadas, lo cual tampoco ha sido probado por parte de los actores. Si bien, tiene una limitación ambiental y existen cierto tipo de actividades que no pueden ejecutarse en dichos inmuebles, lo cierto del caso es que aún se mantienen las potestades para usufructuar por ejemplo a través de sembradíos, actividades agropecuarias, o comerciales que no conlleven la transformación completa o la edificación de obras permanentes sobre el inmueble, de suerte que, no se logra desprender de los autos que las limitaciones que están contenidas en los numerales 33 y 34 de la Ley Forestal y 149 de la Ley de Aguas imposibiliten el ejercicio de todos y cada uno de los derechos que están contenidos dentro del dominio absoluto del bien de su propiedad.

Por lo que, ante esa omisión de elementos probatorios debe ser rechazado el argumento o premisa del reclamo indemnizatorio de que se vacía el contenido del derecho de propiedad, siendo que, le correspondía a los actores la carga probatoria a la luz del numeral 41.1 del Código Procesal Civil (norma aplicable al caso en concreto por enunciación del artículo 220 del CPCA), el cual enuncia que, le incumbe la carga de la prueba “A quien formule una pretensión, respecto de los hechos constitutivos de su derecho”. Carga de traer elementos al proceso que también se deriva del postulado de “carga dinámica” de la prueba, en el tanto, los accionantes se encuentran en mejor condición dentro de la situación jurídica del proceso para poder demostrar cuál es el grado de afectación a todos y cada uno de los derechos y dentro de las distintas vocaciones o fines que pueden ser usufructuadas las propiedades.

Sin pretender reiterar lo ya indicado, a nivel de jurisprudencia de la Sala Constitucional y de la Primera de la Corte Suprema de Justicia se ha determinado que las limitaciones legales derivadas de la Ley N° 7575, Ley Forestal no son indemnizables en el tanto, imponen ciertos límites, pero no vacía del contenido de forma absoluta el derecho del uso y disfrute de la propiedad. De hecho nuestro Tribunal Constitucional ha esbozado que, las limitaciones ambientales derivadas de los numerales 33 y 34 de la Ley Forestal, -sobre los cuales los accionantes alegan que se derivan restricciones desproporcionadas o irrazonables, al vaciar el contenido de su derecho de propiedad-, son conformes a la norma fundamental y no conllevan por ende una expropiación de hecho, como lo afirman los actores, al señalar lo que se procede a enunciar de seguido: “II.- En relación con el supuesto roce de constitucionalidad que apunta el recurrente entre los numerales 33 y 34 de la citada Ley y el artículo 45 Constitucional, esta Sala considera lo siguiente.

Los límites que se puedan introducir por Ley al ejercicio de una libertad pública o de un derecho fundamental, van referidos al derecho en sí, lo mismo que a la posición en abstracto de la esfera de acción de un sujeto, o sea, los límites al ejercicio de una libertad pública no es más que un límite al ejercicio de un derecho, lo anterior por cuanto el reconocimiento de un derecho por parte de una norma constitucional no significa exclusión de la posibilidad de regulación de su ejercicio por parte del legislador, ya que todo derecho nace limitado por cuanto nace dentro de un sistema de convivencia social y su ejercicio debe armonizarse con los derechos de los demás y con las exigencias reconocidas en posteriores legislaciones que especificarán sus límites y las condiciones de su ejercicio. Por el contrario, las limitaciones se refieren a la restricción o disminución de la esfera jurídica del sujeto, ocurriendo que se encuentra relacionada con el ejercicio mismo de la libertad pública y deben, por naturaleza, estar contenidas dentro del texto constitucional o que éste autorice a la Asamblea Legislativa para imponerlas.

Así, las limitaciones conllevan una disminución de los derechos fundamentales en cuanto restringen su ejercicio efectivo bajo ciertas condiciones y en determinadas circunstancias. En el caso de marras, nos encontramos ante una limitación impuesta por ley al ejercicio efectivo del derecho a la propiedad contenido en el artículo 45. En razón de que la limitación debe encontrarse legitimada por el mismo texto constitucional o bien fundado en una autorización constitucional expresa a la Asamblea Legislativa para su establecimiento, lo procedente es determinar si la impuesta por la Ley 7575, se encuentra debidamente fundada en el texto constitucional. El artículo 45 de la Carta Política establece en su párrafo segundo que: ‘Por motivos de necesidad pública podrá la Asamblea Legislativa, mediante el voto de los dos tercios de la totalidad de sus miembros, imponer a la propiedad limitaciones de interés social.’ Así, se observa del texto constitucional transcrito que, la misma norma establece la posibilidad de que la Asamblea Legislativa introduzca limitaciones de interés social a la propiedad, viéndose legitimado el contenido del texto de los artículos 33 y 34 de la Ley 7575 que ahora se impugnan.

III.- Agotado el tema de la legitimidad de la imposición, resta discutir la razonabilidad de la limitación. Considera esta Sala que la limitación impuesta resulta razonable toda vez que no importa una imposibilidad del disfrute del derecho de propiedad, sino que delimita los alcances de éste. O sea, la limitación no cercena el derecho de propiedad que posee el recurrente en relación con la porción de tierra sobre la que no podrá construir -ya que de igual forma podrá disfrutar de ella- sino que simplemente le ordena no construir dentro del límite contenido por la restricción. Por otra parte, la fijación de la línea de retiro de diez metros resulta razonable en relación con el bien demanial que se busca proteger -una quebrada- y sobre el cual el Estado posee un interés público en su conservación, considerando razonable y suficiente el retiro establecido en la legislación forestal. Por lo anterior, el recurso deviene en improcedente y así debe declararse”.

(Ver entre otras, Resolución N° 08234-1997 de las 18:15 horas de fecha 03 de diciembre de 1997 de la Sala Constitucional). Postura que se comparte por esta Cámara de Juzgadores y que por igualdad de motivos puede ser aplicada para las limitaciones dispuestas en la Ley General de Aguas, dado que incluso son menor intensidad sobre la propiedad que las dispuestas en la Ley Foresta de comentario. Manifestando dicha Sala Constitucional en años posteriores que, estas limitaciones a la propiedad, las cuales como se reseñó no son desproporcionadas ni irrazonables, no resultan ser indemnizables, por cuanto están en virtud de la propia función social de la propiedad, una función que se indicó que implica ponderar el interés colectivo (derecho al ambiente y la protección del agua) por encima de un interés individual (la posibilidad de edificar sobre el bien inmueble que extrañan los actores). Así en la Resolución N° 4465-99 de las 10:21 horas de fecha 11 de junio de 1999 la Sala Constitucional de la Corte Suprema de Justicia estableció que: “El artículo 45 de la Constitución Política consagra el derecho de propiedad.

En el párrafo primero señala su carácter de ‘inviolable’ y establece la obligación por parte del Estado de indemnizar al propietario previamente, cuando deba suprimirla por razones de ‘interés público legalmente comprobado’. En el párrafo segundo establece la posibilidad de establecer limitaciones de interés social a la propiedad, mediante ley aprobada por votación calificada -votación de los dos tercios de la totalidad de los miembros de la Asamblea Legislativa-. De manera que la obligación de indemnizar por parte del Estado está constitucionalmente prevista única y exclusivamente cuando se trata de expropiar y no rige para las limitaciones de interés social que se establezcan mediante ley aprobada por votación calificada. Sin embargo, estas limitaciones deberán afectar a la colectividad en general y no podrán exceder los parámetros de razonabilidad o proporcionalidad, ni vaciar de su contenido esencial el derecho de propiedad.

La restricción al derecho de propiedad que vacíe de su contenido esencial el derecho se convierte en una expropiación encubierta y, en consecuencia, genera la obligación de indemnizar. Las limitaciones establecidas con fines urbanísticos integran el derecho de propiedad y, por lo tanto, no son susceptibles de indemnización, a menos que implique una reducción del contenido esencial del derecho, como se indicó supra”. (El resaltado no corresponde al original)” (Sentencia 2024003530 de las 16:03 horas del 3 de junio de 2024). Ahora bien, de manera particular, como se dijo, las nacientes poseen un régimen especial de protección, regulado en el art. 31 de la Ley de Aguas N° 276, vigente desde 1942, el cual determina que son: “reserva de dominio a favor de la Nación: a) Las tierras que circunden los sitios de captación o tomas surtidoras de agua potable, en un perímetro no menor de doscientos metros de radio”; al respecto, la Sala Primera de la Corte Suprema de Justicia ha señalado: “…comparte esta Sala el criterio vertido por el Tribunal en relación con el hecho de que la normativa aplicable al caso es el numeral 31 de la Ley de Aguas y no los numerales 33 y 34 de la Ley Forestal como lo peticiona el impugnante, por cuanto, corresponde a una zona de dominio a favor del Estado, por tratarse de una fuente de agua para abastecer el consumo humano.

En otro orden de ideas, arguye el casacionista, que sus representados perdieron todo el derecho sobre los 3000 metros cuadrados de terreno que adquirieron al amparo de la ley, y se le está otorgando esa porción de lote a la Asada. Al respecto, cabe aclarar, tal y como se indicó supra, la sentencia recurrida no otorga derecho de posesión ni de propiedad a favor de la Asada, pues lo que se dictaminó por medio de la orden sanitaria número: S-018-2013, emitida por el Ministerio de Salud Pública, fue que se debía instalar una cerca en la zona para protección del recurso hídrico, debido a que se presentaron deficiencias físico-sanitarias con la finalidad de proteger este recurso y el derecho a la salud de sus consumidores. Además, conviene indicar que el área del litigio no se encuentra dentro del comercio de los hombres, dado que es una zona con reserva de dominio público, por medio del cual se garantiza un servicio público esencial como lo es el suministro de agua potable a una comunidad.

Incluso, es de relevancia especificar que la misma actora al momento de comprar la propiedad objeto de este litigio tenía conocimiento de la construcción de un tanque de captación de agua. Asimismo, la Asada de Río Celeste de Guatuso tiene inscrita dos concesiones de agua ante el Registro Nacional, estando una de ellas ubicada en su propiedad…” (Voto 4155-F-S1-2019 de las catorce horas cuarenta minutos del veintiocho de noviembre de dos mil diecinueve, resaltado es nuestro). Ha de recordarse que, de igual manera, desde 1953 se cuenta con regulación específica en la Ley General de Agua Potable N° 1634 que dispone en su numeral segundo: “Son del dominio público todas aquellas tierras que tanto el Ministerio de Obras Públicas como el Ministerio de Salubridad Pública, consideren indispensables para construir o para situar cualquiera parte o partes de los sistemas de abastecimiento de aguas potables, así como para asegurar la protección sanitaria y física, y caudal necesario de las mismas.

Corresponde al Ministerio de Salubridad Pública conocer de las solicitudes formuladas para construcción, ampliación y modificación de los sistemas de agua potable y recomendar al Ministerio de Obras Públicas la construcción, ampliación o modificación de aquellas de mayor necesidad, previo estudio de índices de mortalidad, parasitismo y otros”, en el entendido de que, el MOPT fue sustituido por el AyA por su ley constitutiva N° 2726 y que el Ministerio de Salubridad es sustituido por el actual Ministerio de Salud, ambos como entes rectores en la materia, mientras que la actividad concesionaria del recurso hídrico recae en el MINAE, bajo la Dirección de Aguas (art. 17 de la ley 276). En igual sentido, el mismo numeral 31 en comentario refiere a otra zona que tiene la misma naturaleza y que corresponde a “La zona forestal que protege o debe proteger el conjunto de terrenos en que se produce la infiltración de aguas potables, así como el de los que dan asiento a cuencas hidrográficas y márgenes de depósito, fuentes surtidoras o curso permanente de las mismas aguas”, siendo entonces ambos grupos de espacios inmobiliarios catalogados bajo la denominación de Patrimonio Natural del Estado, y por ende, aplicable las disposiciones de los numerales 261 y 262 del Código Civil, así como el régimen especial exorbitante de tutela.

Con ello, hemos entonces de separar dos aspectos que, si bien, interrelacionados, son diferentes. Por un lado, tenemos la demanialidad de las áreas anteriormente descritas en el art. 31 de la ley 276, que resulta independiente del accionar de los demandados y, por otro, encontramos que, sobre tal área, es dable la actividad de los operadores del servicio de agua potable poblacional, o de aprovechamiento particular. Ahora bien, hablando de la regulación de los prestatarios del servicio público de agua potable poblacional, tanto la ley 276 como la 1634 establecen un régimen reforzado sobre quienes pueden ser prestadores del servicio, teniendo primacía el AyA, las Municipalidades y aquellos otros entes que, por expresa autorización, puedan brindar el servicio, como es el caso de ESPH. A su vez, en el caso del AyA, conforme los preceptos 2.g de su Ley Constitutiva, así como los numerales 1, 3, 6 y 7 del Reglamento Nº 42582-S-MINAE, la prestación puede darse directamente, o de manera indirecta a través de las denominadas Asociaciones Administradoras del Sistema de Acueductos y Alcantarillados (ASADAS) quienes operan bajo la figura administrativa de delegación.

Particularmente relevante el citado reglamento que en su numeral 29 dice: “Definición de la Delegación. Se entiende delegación al proceso integral de alianza público- comunitaria que tiene como objetivo la prestación de los servicios de Acueducto y/o tratamiento de aguas residuales así reconocido por la Ley General de la Administración Pública, la jurisprudencia administrativa y judicial”, lo que obliga a remitirnos a las disposiciones de los numerales 89 a 92 de la Ley General de Administración Pública (LGAP), así como el numeral 31 del mismo reglamento de cita que enumera los alcances de la delegación. En ese marco de referencia, existe una corresponsabilidad entre el AyA y las ASADAS, tal y como lo señala la LGAP en su artículo 91 al decir “El delegante tendrá siempre la obligación de vigilar la gestión del delegado y podrá ser responsable con éste por culpa en la vigilancia. Sólo habrá lugar a culpa en la elección cuando ésta haya sido discrecional”.

Por otra parte, tal y como lo apunta la ley 276 en su numeral 20, la concesión de agua poblacional incluye “los terrenos de dominio público, necesarios para la obra de la presa y de los canales y acequias. Respecto de los terrenos de propiedad del Estado, de los Municipios, de los pueblos y de los particulares, se procederá, según los casos, a imponer la servidumbre forzosa, con las formalidades de ley” o incluso la expropiación en caso de ser necesario. Este dato es recopilado en los artículos 49 y 50 de reglamento 42582-S-MINAE cuando regula: “Artículo 49. Servidumbres. Las ASADAS deberán delimitar, catastrar, adquirir, mantener y proteger las servidumbres utilizadas en sus sistemas. No se permite construir edificaciones permanentes, ni sembrar árboles en las servidumbres de tubería, las cuales deben tener como mínimo seis metros de ancho (tres metros a cada lado de la línea de tubería) y en ese sentido, deberán observarlo las respectivas municipalidades del país.

Las ASADAS deberán velar porque se cumpla dicha disposición; así como acatar lo establecido en el artículo 16 de la Ley General de Agua Potable, para lo cual, podrá solicitar al AyA la asesoría que requiera”, “Artículo 50. Expropiaciones. De ser requerido, la ASADA podrá solicitar al AyA la constitución de servidumbres o adquisición de inmuebles a través del proceso de expropiación habiéndose agotado la negociación administrativa, debiendo la Asociación sufragar los costos que generen estos procesos, todo conforme al Reglamento de Avalúos del AyA”, entendiéndose, claro está, que tanto las servidumbres como las eventuales expropiaciones, recaen sobre dominio privado, teniendo siempre como punto de orientación, la prestación efectiva y óptima del servicio público de agua potable.

VII. ANÁLISIS DEL CASO CONCRETO

De previo al pronunciamiento respecto de las pretensiones en este asunto, se hace necesario abarcar una serie de situaciones asociadas al asunto de fondo, incluyendo la delimitación del litigio, la existencias de áreas de protección de naciente, la naturaleza y funcionamiento de las demandadas y finalmente, el equilibrio de ello con el derecho de la accionante sobre su dominio, veamos. VII.1. Delimitación del objeto de litigio. Inexistencia de pretensiones anulatorias respecto de concesiones otorgadas ante la Dirección de Aguas del MINAE: Si bien, como parte de los agravios de las partes y de la prueba aportada a autos, encontramos, especialmente la réplica, que se discute si la constitución de las autorizaciones administrativas de concesión de agua poblacional por parte de la Dirección de Aguas están o no bien otorgadas, o la calificación de la explotación previa del recurso hídrico sin la concesión respectiva, lo cierto es que debemos recordar que, como parte del principio de congruencia al que está sometido este Tribunal (concordancia de los numerales 1, 2, 36, 42 frente al numeral 122 del CPCA), las pretensiones constituyen el marco de referencia sobre el cual el Tribunal vierte pronunciamiento.

En este caso, como se desprende del listado de petitorias, no encontramos una sola que vaya encaminada a atacar las concesiones otorgadas a las codemandadas, con lo que este tema escapa de los límites establecidos por la propia demandante (principio dispositivo) al momento de fijar sus pretensiones. Así, el requerimiento central, que es de tipo reivindicatorio y de tutela de sus atribuciones de dominio bajo el numeral 264 del Código Civil, es el eje central sobre el que versa esta litis, donde se enfrentan de manera correlativa la parte actora frente a las concesionarias, las cuales trabajan al amparo de una delegación administrativa del instituto codemandado, por lo que es sobre esta especie fáctica que el Tribunal realiza pronunciamiento, el cual se centra en los límites y limitaciones del accionar de las partes que participan de esta causa. VII.2. Las áreas de protección de las Ley de Aguas sobre nacientes y áreas de recarga en el terreno en litigio como aspecto independiente de las accionadas: Tal y como se expuso en el considerando anterior, la sola existencia de nacientes de agua potable, así como las áreas de infiltración de éstas en determinada locación, hace que se produzca una afectación por ley y destino del área al régimen demanial bajo la manifestación de Patrimonio Natural del Estado (PNE), siendo en consecuencia incompatible con la propiedad privada.

Ahora bien, hemos de recordar que, por el principio de inmatriculación y el principio pro natura, el PNE posee la cualidad de ser tutelado aún y cuando éste no esté formalmente reconocido por los agentes públicos rectores en la materia, siendo entonces que la conducta administrativa – o incluso judicial – tiene carácter declarativo y no constitutivo de la naturaleza demanial. Así las cosas, la pretensión reivindicatoria de la empresa actora debe rechazarse sobre las áreas identificadas como PNE, ello en ocasión, se insiste, de la naturaleza pública que tienen estos bienes, aunque se encuentren catastral y registralmente como parte de la finca acá en litigio. Ahora bien, es claro que, al tenor de los autos, al momento de iniciar este proceso, ninguna de las partes tenía claro la correcta demarcación y locación de dichas áreas, nótese cómo incluso, conforme el hecho probado 6 de esta sentencia, desde el 2014 las ASADAS y la actora intentaron recurrir al SINAC para delimitar las zonas conforme la ley de aguas, aspecto que, al menos con la prueba que rola en esta causa, no se identifica que haya fructificado.

Así, no es sino hasta el mes de junio de 2020, que se levanta, por primera vez, a través de un estudio hidrogeológico de determinación de zonas las áreas que define el numeral 31 de la ley 276 como PNE (hecho probado 10 y deposición conforme hechos probados 15 y 16). En ese sentido, la parte actora no presentó prueba de descargo en contra de dichos insumos, por lo que el Tribunal los avala en calidad de criterios técnicos para la demarcación de áreas de PNE dentro del inmueble en litigio. Así las cosas, la pretensión reivindicatoria ha de rechazarse por una evidente falta de derecho respecto de las áreas señaladas en el informe UEN-GA-2020-02131 del AyA, así como de manera consecuente, las indemnizaciones derivadas que pretende la parte actora sobre dichas áreas. Ahondando en motivos del rechazo de la pretensión de reivindicación, debe señalarse que, para la construcción sobre las referidas áreas no se ocupa de permiso del titular inmobiliario, ya que éste es el Estado, sino que lo que se requiere son las respectivas autorizaciones administrativas y concesionales que se expusieron en el considerando anterior, e incluso, como se desarrolló en detalle supra, tales edificaciones son, de igual manera, de dominio público al constituirse en sistemas de abastecimiento de agua potable poblacional, lo que hace abiertamente improcedente que se pretenda sean adquiridos, reivindicados o accedidos a titularidad privada y la afectación a dichos sistemas está penalizado como lo dispone el Capítulo Sétimo de la Ley 276 y normativa conexa.

En ese orden de ideas, lleva razón el AyA al señalar que el intento de negociación que la actora y las codemandadas realizaron ante la Fiscalía en el mes de febrero de año 2017 (hecho probado 7) resulta abiertamente improcedente, al menos sobre las áreas definidas como PNE, dado que ni la actora, ni las ASADAS demandadas tienen disponibilidad de negociación sobre estos espacios. De igual manera, resulta infructuosa la discusión de determinar cuándo y quién constituyó los acueductos objeto de litigio, en tanto el hecho de que, al momento de la emisión de la sentencia, los mismos se encuentran en funcionamiento con la respectiva autorización administrativa del AyA (hechos probados 4 y 5) y las concesiones de agua respectivas (hechos probados 2 y 3), les otorga la demanialidad necesaria para hacer goce de la imprescriptibilidad de este tipo de bienes. Sin perjuicio de ello, con la prueba obrante en autos, específicamente la testimonial (hechos probados 11, 12, 13 y 14) se logra acreditar que el servicio de las demandadas precede a otras formas administrativas (comités) e incluso a su eventual génesis en manos de la Municipalidad de San Carlos, empero, lo importante es resaltar que, en todo momento, el aprovechamiento siempre se ha caracterizado por ser de agua potable y con fines poblacionales que es lo que otorga el régimen exorbitante de tutela, siendo el mismo conocido por todos quienes han ostentado el título de propietarios previos a la accionante y por esta misma, como lo demuestra las propias interacciones conjuntas y en conflicto desde que asumió su rol de titular de dominio.

Con ello, las petitorias primera y segunda deben rechazarse en su totalidad sobre las áreas demarcadas en el ya citado criterio UEN-GA-2020-02131 del AyA. Lo anterior sin perjuicio de que, en sede administrativa o causa judicial diferente, se proceda a la revisión o rectificación del Patrimonio Natural del Estado en el inmueble objeto de este proceso. VII.3. Sobre el elemento condicionante para la definición de una eventual “usurpación”. La necesidad de regularización de servidumbres de las ASADAS a cargo del AyA y sobre la restitución de las atribuciones de dominio de la actora: Ahora bien, la parte actora señala que las ASADAS codemandadas usurpan un aproximado de siete hectáreas de su dominio, afirmación que es rechazada por todos los accionados. A ello, lleva razón los demandados al afirmar que no existe prueba o demostración de que, efectivamente, existan actos de perturbación posesoria sobre el área que, de manera inexacta, afirma la actora en su demanda.

Nótese que, conforme el hecho probado 1, el inmueble objeto de litigio tiene un área de 53 hectáreas 7377,16 m2, tratándose con ello de una zona demasiado extensa para, al menos, presumir, una pseudo ubicación de las 7 hectáreas que hace referencia la empresa promotora de la acción. Ahora bien, de lo que sí existe prueba en autos, específicamente, de como se desprende del hecho probado 9, es que, aún fuera del PNE referido, existen estructuras de ambas codemandadas asociadas a los sistemas de distribución de agua potable (tuberías), para el caso de la ASADA de Pénjamo de aproximadamente 160 metros lineales, y para el caso de la ASADA Cuestillas – Ron Ron de aproximadamente 188 (corroborado con el testimonio del señor Alfaro Artavia en hecho probado 16) y que no existe un sendero específico o predeterminado de acceso (véase declaración de Ramírez Pérez, Araya Vargas y Alfaro Artavia en hechos probados 11, 13 y 16).

Lo anterior prueba que, sobre el área de dominio de la actora, fuera del PNE, de manera efectiva existen estructuras de las ASADAS accionadas y que éstas, sin reserva alguna, reconocen que utilizan de manera periódica para su mantenimiento y conservación, tanto a través de sus respectivos fontaneros, como de terceros que auxilian en la tarea. Es sobre estos espacios que el reclamo de la empresa actora resulta plausible, dado que debe existir un equilibrio entre el uso, goce y disfrute de su dominio, frente a la prestación del servicio de los codemandados, lo cual la normativa soluciona a través del régimen de servidumbres. Nótese que, como parte de la génesis histórica del conflicto en litigio, encontramos cambios unilaterales de la ASADA codemandada con la ubicación de las tuberías, sin la respectiva coordinación previa, que es origina el malestar de la actora y el solicitar que las tuberías se recolocaran en su lugar original, cosa que es acatada por la accionada ASADA (hecho probado 7).

Conforme los autos, existe una conducta omisa tanto de las ASADAS como del AyA en calidad de ente rector con conocimiento del conflicto que se ha gestado entre las partes de este proceso (delegante conforme los hechos probados 4 y 5), en realizar la respectiva constitución de las servidumbres tanto de acueducto como de paso para el servicio de éstas sobre el inmueble de la actora. En ese sentido, existe una indeterminación de espacios que ha sido proclive a la creación del conflicto que se conoce en este asunto. Tal y como se expuso en el considerando anterior y en el acápite recién abordado, las estructuras que pertenecen al sistema de acueducto de agua potable son de dominio público y si discurren sobre propiedad privada, deben ser regularizadas a través de las respectivas servidumbres que serían de acueducto y, de ser necesario, de paso para el acceso a ésta. Esta carga pesa sobre las ASADAS en primer tanto, conforme el art. 49 del reglamento 42582-S-MINAE, pero también sobre el AyA en calidad de ente delegante, rector y fiscalizador, conforme el artículo 50 de la misma normativa.

Así las cosas, para generar el equilibrio entre todas las partes, ha de ordenarse el cumplimiento del señalado mandato legal, ordenándose la regularización de la conducta de las ASADAS sobre el fundo de la actora debiendo proceder a realizar los trámites, a través del AyA, de constitución de las servidumbres de acueducto de ambas ASADAS así como la de paso, en caso de ser necesario, sobre el fundo objeto de este proceso y, en consecuencia, ordenar a los accionados abstenerse de utilizar cualquier otra área de la finca señalada, así como desocupar y demoler cualquier otra construcción que no se encuentre dentro de las áreas de PNE y de las servidumbres a constituir, debiendo, asimismo, desocupar y demoler cualquier otra construcción que no se encuentre dentro de esos espacios, dándose un plazo de TRES MESES para ello, plazo que será verificado y ajustado, en caso de ser necesario, por el juez en la etapa de ejecución de sentencia. Con ello, se restituiría las atribuciones a favor de la actora conforme el artículo 264 del Código Civil para el pleno goce y disfrute de su inmueble.

VIII. SOBRE LAS PRETENSIONES EN CONCRETO

Corolario de lo anterior, encontramos que la pretensión primera ha de acogerse parcialmente, únicamente respecto de las áreas que no sean Patrimonio Natural del Estado y de las áreas de servidumbre a constituir por parte del AyA y las ASADAS accionadas, conforme lo dicho en el considerando anterior en el referido plazo de tres meses. En cuanto a la pretensión segunda, la misma se rechaza, dado que el mecanismo correcto para la ejecución de lo fallado a favor de la accionante es la ejecución de sentencia conforme lo dispone el artículo 126 del Código Procesal Contencioso Administrativo (CPCA), así como las disposiciones del Título VIII de dicho cuerpo procesal, y no como la parte lo solicita, en el entendido de que el efecto ejecutorio de la sentencia se rige por dichos parámetros por imperativo legal. En cuanto a la pretensión tercera, aténgase a lo resuelto en cuanto a las costas infra.

En cuanto a la pretensión cuarta, la misma ha de rechazarse en su totalidad por los siguientes motivos. En cuanto al daño material, que la parte afirma que corresponde a pérdidas materiales por la no existencia de planes de manejo del manto acuífero del bosque y del medioambiente lo que repercute en erosión y contaminación de la propiedad, carece de sustento probatorio no sólo de su existencia, sino que también, de su cuantía. Téngase en cuenta que, conforme los informes técnicos del AyA (hechos probados 8, 9, 15 y 16), no se logra acreditar la existencia del daño reclamado. En cuanto al daño moral, que la parte especificó en la audiencia preliminar que se trata de tipo subjetivo, el mismo resulta improcedente dada la naturaleza del daño reclamado frente a quien reclama. Dicho tipo de afectación moral subjetiva tiene por naturaleza una lesión a la esfera interna del sujeto, a sus sentimientos y emociones, valorable in re ipsa por parte del Tribunal, aspectos que no son susceptibles de ser padecidos por una persona jurídica, en este caso, por la sociedad actora de responsabilidad limitada, por lo que, desde la perspectiva de la naturaleza del daño, la inmaterialidad física del sujeto reclamante hace que no sea posible que la lesión sea experimentada o soportada por la accionante, por lo que se rechaza.

En cuanto a la pretensión quinta, la misma también padece del mismo defecto que el daño material, sea la carencia de prueba tanto de su existencia, como de su cuantía. Nótese que, incluso, se desconoce si el contrato SC-01-222-0024-2015 se mantiene aún vigente, puesto que tenía una duración de 5 años, venciendo el 23 de noviembre de 2020 (hecho probado 1) y sin que se conozca que exista manifestaciones de parte de FONAFIFO de reducción en el ingreso económico amparado a dicho contrato por situaciones asociadas a este proceso, haciendo que, aún si presumiésemos la existencia del perjuicio, éste no ha sido demostrado como causalmente imputable a los accionados, haciendo así improcedente el reclamo pretendido. Con ello, la demanda ha de declararse parcialmente con lugar acogiéndose sólo en parte la pretensión primera por los motivos ya señalados.

IX. SOBRE LAS DEMÁS DEFENSAS INVOCADAS

Las ASADAS codemandadas invocaron la defensa de falta de legitimación activa y pasiva, las cuales han de rechazarse, según se explica de seguido. La legitimación activa procesal conforme el numeral 10 del CPCA la posee la parte actora en tanto titular del inmueble objeto de este proceso (hecho probado 1) por lo que se encuentra correctamente constituida y acreditada la legitimación en tanto es ésta la que se ve afectada directamente por el conflicto objeto de este proceso, mientras que el efecto pasivo (art. 12 CPCA) se encuentra también correctamente configurado en tanto las ASADAS accionadas son las que realizan las conductas que la actora califica de perturbadoras de su dominio, por lo que ambas manifestaciones de legitimación se encuentran correctamente integradas. En cuanto a la falta de derecho alegada por todos los demandados, por la forma en cómo se ha resuelto este asunto y expuesto en considerandos anteriores, la misma ha de acogerse sobre las pretensiones 2 a 5, así como parcialmente respecto de la pretensión primera. Se reitera que la falta de interés actual y la prescripción fueron resueltas supra.

X. DE LA CONDENATORIA EN COSTAS

De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, al apreciarse un vencimiento recíproco, se resuelve este asunto sin especial condenatoria en costas.

POR TANTO

Se aprecia parcialmente una falta de derecho respecto de la pretensión primera, y se acoge respecto de las pretensiones segunda, cuarta y quinta. En consecuencia, se declara PARCIALMENTE CON LUGAR la demanda interpuesta por COMERCIAL AGRÍCOLA GANADERA MONTE CARMELO SRL en contra de la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO RURAL DE CUESTILLAS Y RON RON DE FLORENCIA (ASADA de Cuestillas y Ron Ron), la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO DE PÉNJAMO DE FLORENCIA DE SAN CARLOS, ALAJUELA (ASADA de Pénjamo) y del INSTITUTO DE ACUEDUCTOS Y ALCANTARILLADOS (AYA), rechazándose en lo no expresamente otorgado. En consecuencia, se ordena de manera conjunta tanto al AYA como a las ASADAS a constituir y registrar las servidumbres de aguas y de paso necesarias para la prestación efectiva de su servicio de agua potable sobre las concesiones otorgadas en la finca 2-401761-000, conforme los numerales 49 y 50 del decreto 42582-S-MINAE ello en un plazo de tres meses a partir de la firmeza de este sentencia, plazo que será fiscalizado y ajustado por el juez ejecutor en la etapa de ejecución de sentencia, debiendo abstenerse de utilizar cualquier otra área de la finca señalada, así como desocupar y demoler cualquier otra construcción que no se encuentre dentro de las áreas de Patrimonio Natural del Estado y de las servidumbres a constituir. Se resuelve sin especial condenatoria en costas. Notifíquese.- Carlos José Mejías Rodríguez Claudia Bolaños Salazar Laura Gómez Chacón ???????????????
