Judge López Barrantes writes the opinion; and,

WHEREAS:

I. DETAILS OF THE PROCEEDINGS

1.- Mr. [Nombre1] requests that the following-described land be registered in his name in the Registro Público de la Propiedad Inmueble: Land consisting of pasture and forest, located in Vuelas, [Dirección1] , , province of SAN JOSÉ; bounded on the North by a public road, with frontage of eight hundred thirty-six meters and forty-eight centimeters; on the South by a stream (quebrada), with Guillermo Rodríguez Badilla on the opposite bank; on the East by MINAE, Cerro Vueltas; and on the West by Enid Delings Fuentes.- Area: THREE HUNDRED TWO THOUSAND SEVEN HUNDRED SIXTY-SIX SQUARE METERS AND TWENTY-FOUR SQUARE DECIMETERS; described according to cadastral survey plan (plano catastrado) number SJ-2224664-2020.- (See initial filing and plan entered on 17/08/2018 04:25:23, and 30/09/2020 11:43:11. (See the virtual docket of the Juzgado Agrario de Cartago, initial petition entered on 17-08-2018 04:25; base plan entered on 14/03/2019 01:52; trial-court judgment 14/10/2021 15:27). 2.- The Procuraduría General de la República and the Instituto de Desarrollo Rural were duly served and entered appearances in the proceeding.

(See ruling entered on 19/01/2021 10:42.) 4.- Judge Silvia Elena Sánchez Blanco of the Juzgado Agrario de Cartago, in judgment number 2021000204, issued at fifteen hours and twenty-seven minutes on October fourteenth, two thousand twenty-one, ruled: “THEREFORE: Based on the foregoing, pursuant to LEY DE INFORMACIONES POSESORIAS N° 139 of July 14, 1941, and its amendments, these POSSESSORY TITLE PROCEEDINGS filed by [Nombre1], of legal age, married, farmer, identity card CED5 - ; resident of Copey de Dota, ARE APPROVED.- The REGISTRO PUBLICO DE LA PROPIEDAD, Real Property Section, shall register in his name, without prejudice to third parties having superior rights and subject to the statutory restrictions set forth below, the property described as follows: Land consisting of pasture and forest, located in Vuelas, [Dirección2] , [Dirección3] DOTA, province of SAN JOSÉ; bounded on the North by a public road, with frontage of eight hundred thirty-six meters and forty-eight centimeters; on the South by a stream, with [Nombre2] Badilla on the opposite bank; on the East by MINAE, Cerro Vueltas; and on the West by [Nombre3] .- Area: THREE HUNDRED TWO THOUSAND SEVEN HUNDRED SIXTY-SIX SQUARE METERS AND TWENTY-FOUR SQUARE DECIMETERS; described according to cadastral survey plan number SJ-2224664-2020.- The property was valued at five million colones, as all requirements established for such purposes by the Ley de Informaciones Posesorias have been satisfied.

A certified copy of this judgment shall serve to register the aforementioned property in the Registro de la Propiedad.- Said registration shall be made with notice to the titleholder that the right-of-way (derecho de vía) of the public road adjoining the property to be titled is fourteen meters wide; consequently, the property is subject to the restrictions established in Article 4 of the Ley General de Caminos Públicos and Article 19(a) of the Ley de Informaciones Posesorias. It is also subject to Articles 1, 2, 3, 4, 5, 6, and 7 of the Ley de Informaciones Posesorias and Articles 1, 2, 7, and 25 of the Ley de Jurisdicción Agraria, as well as the restrictions contained in Articles 33(b) and 34 of Ley Forestal Number 7575. Accordingly, the area adjoining the watercourses is a protection area (área de protección), in which the cutting or removal of trees is prohibited. It is likewise subject to Articles 1(a), 1(b), 1(N), and 3(III) of the Ley de Aguas, because the beds and waters of those watercourses are in the public domain (dominio público), as are the surface water and groundwater existing on the property, which do not form part of the property; and because the property is located entirely within Reserva Forestal Los Santos.- Once this ruling becomes final, the corresponding writ of execution (ejecutoria) shall be issued and this matter shall be closed and archived.” (See the virtual docket of the Juzgado Agrario de Cartago, trial-court judgment entered on 14/10/2021 14:56). 5.- The Procuraduría General de la República filed an appeal (recurso de apelación), expressly stating the grounds relied upon to challenge the trial court’s position (see the virtual docket of the Juzgado Agrario de Cartago, brief entered on 22/10/2021 06:01).

II.The Court affirms proven fact one but modifies it so that the plan number is correctly stated as 1-2224864-2020. Proven facts two and three are accepted. Proven fact four is not affirmed; and the facts numbered five through thirteen are adopted because they are well supported by the record. This Court adds proven fact fourteen as follows: The petitioner has not observed the full setback (retiro) applicable to the stream that originates on the property to be registered (see the land-use study (estudio de uso de suelos), attached to the initial filing in these proceedings, and file 11 concerning the judicial inspection (reconocimiento judicial), entered into the electronic case file on April 26, 2021).

III.This Court finds the following not proven: That the title claimant established the exercise of possession (ejercicio posesorio) for more than ten years before the creation of Reserva Forestal Los Santos.

IV. APPEAL (RECURSO DE APELACIÓN)

The Office of the Attorney General of the Republic (Procuraduría General de la República), by means of a brief added to the electronic case file on 22 de octubre de 2021, filed an appeal against the trial court judgment, number 2021000204, issued at fifteen hours and twenty-seven minutes on catorce de octubre de dos mil veintiuno, based on the following arguments: 1- It states that the judgment under appeal deemed it established, in established fact (hecho probado) four, that Mr. [Nombre1] had exercised derivative possession (posesión derivada) over the land underlying these proceedings for more than sixty years, even though, it asserts, the testimonial and documentary evidence gathered in the case file is insufficient to prove derivative possession prior to 1975, when the property became subject to restrictions as a result of the creation of Reserva Forestal Los Santos. It explains that, in fact five of the initial filing in these proceedings, the applicant for title (persona titulante) claimed to have obtained the land to be registered from his father, Mr. [Nombre4], in 2013; however, it alleges that the donation was not made until 26 de abril de 2019.

Along those lines, it states that the judgment under appeal deemed it established, in fact two, that the applicant for title acquired the property on 26 de abril de 2018; accordingly, it questions the fact that this occurred 43 years after the Reserva Forestal Los Santos protected wildlife area (área silvestre protegida) was created. It indicates that a verbal donation is not legally possible with respect to real property and that, for this reason, the donation is void in its opinion (citing voto 218-2008 of this Court, as well as 583-2004 of the First Chamber). In its view, testimonial evidence is of no use in proving an act transferring title to real property, and even if the donation had been made, it asserts that it would be void because it encompassed public-domain property (bienes demaniales) that is not legally transferable. It challenges the judgment’s recognition that the applicant for title had sixty years of derivative possession based on deed number 86, from volume 7 of the notarial record book of notary public Sandra Navarro Marín, which it asserts is improper.

It objects that, in that deed, executed in 2018, the appearing party, [Nombre4], stated that he was transferring to his son—the petitioner—possession held for more than sixty years. For that reason, it disagrees with the judgment because, it asserts, the statements of the grantor are not valid evidence of the duration of the alleged possession. It also explains that the challenged decision deemed it established that the applicant for title’s father purchased the land from Mr. [Nombre5] by deed CED6 from volume 80 of the notarial record book of notary Álvaro Torres Vicenzi, an unnumbered certified copy of which was entered into the record. Based on the foregoing, it states that the document shows it was executed on 30 de mayo de 1979, that is, 4 years after Reserva Forestal Los Santos was created. In its opinion, possession cannot be exercised over property dedicated to the public domain (dominio público), and the transfer would be absolutely void because it involved property that is not legally transferable.

It further states that, under that deed, Mr. [Nombre4] purportedly purchased a parcel of only 21 hectares—that is, 10 hectares fewer than the area they now seek to title—and that there would be no identity between that parcel and the property at issue in these proceedings, nor could such identity be presumed to the detriment of the public environmental interest inherent in protected wildlife areas. It argues that transfer deeds cannot serve as proof that possession was exercised, because, it asserts, they serve only to confirm the legal transaction that took place; moreover, it states that possession cannot properly be deemed established based on the information provided by the parties (citing Voto 352-2012 of this Court). Regarding the witnesses’ testimony, it disputes that their statements were clear, explaining that they merely provided a list of persons who were purported owners of the land without identifying the duration of possession or acts of possession (actos posesorios) (citing Voto 1058-2020 of this Chamber).

On that point, it states that the witness [Nombre4] did not address the number of paddocks (apartos) on the land, because he stated that he had not walked through the property again for a long time. In its view, that testimony is not suitable because the witness does not visit the land and is related to the applicant for title. With respect to the witness [Nombre6], it states that, despite having known the land since 1966, he testified that he did not know how long the applicant for title had possessed the land, whether he had experienced problems with squatters (precaristas), or whether he extracted timber. It indicates that these matters were challenged before the trial court (Despacho de instancia), but complains that they were neither considered nor analyzed. 2- It states that these proceedings were approved without proof of the exercise of ecological possession (posesión ecológica).

It notes that the conforming land-use certification (certificación de uso conforme de suelos) established that 12.93% of the land is devoted to “silvopastoral use (silvopastoril).” Likewise, it states that the visual inspection (inspección ocular) recorded that the property contains pastures established for dairy cattle, cows for milking, and livestock grazing. It considers those acts of possession contrary to the protection of natural resources (citing this Chamber’s Voto número 836-2016). It further states that, because the land for which title is sought lies within a protected wildlife area, it has a high degree of water-resource vulnerability (fragilidad hídrica). It cites report UEN- GA-2020-00061 of the Instituto Costarricense de Acueductos y Alcantarillados. It states that, even though water is not being used to supply the population, the water resource must be protected. In its opinion, ecological possession encompasses all natural resources present on the land. 3- Protected wildlife areas are public-domain property and cannot be acquired by adverse possession (usucapir).

In support of this argument, it cites Constitutional Chamber judgment número 16975-2008. 4- It states that the judgment under appeal identifies a survey-plat number (número de plano) that does not correspond to the one processed in the possessory title proceeding (información posesoria). On that particular point, it indicates that judgment 2021000204 states, in both its reasoning and operative provisions, that the land to be registered is described in survey plat SJ-2224664-2020, which is not the one used in these proceedings. This is apparent from a review of the survey plat in the record and from the search conducted in the Real Property Registry database. Finally, it requests that these proceedings be denied.

V.Because grounds for grievance one and two are related, this Court will consider them jointly. The appellant is correct with respect to grounds one and two of the appeal. Upon review of the case file by this appellate court, it was established that the property to be registered is indeed located one hundred percent within Reserva Forestal Los Santos, as stated in certification number SINAC-D-ACC-0747-2018 issued by Sistema Nacional de Áreas de Conservación (added to the electronic case file on 23 de octubre de 2018), which was created by Decreto Ejecutivo N°5389-A, of 12 de octubre de 1975. Accordingly, the applicant for title (parte titulante) must prove the exercise of possession (posesión) for ten years prior to the creation of that Decree, that is, before the year 1965, pursuant to Article 7 of the Ley de Informaciones Posesorias. With those legal rules established, it is appropriate to analyze the evidence offered and gathered in the case file in order to determine whether the requirements of that legal provision have been met.

In that regard, the grievance raised by the State’s representative concerns the fact that the judgment under appeal deemed it proven that the applicant had exercised possession of the property to be registered for more than sixty years, even though, it argues, both the testimonial evidence (prueba testimonial) and the documentary evidence (prueba documental) gathered are insufficient to prove such derivative possession (posesión derivada) predating the year 1975, when the property became subject to restrictions as a result of the creation of Reserva Forestal Los Santos. In light of that argument, it should be noted that Article 6 of the Ley de Informaciones Posesorias provides as follows: “Proof of possession shall be established through the testimony of three witnesses who are residents of the canton in which the property is located. They shall be questioned as to how long they have known the property; whether they know that the applicant or previous owners have continuously possessed it for a period of no less than 10 years; whether that possession has been public, peaceful, and exercised as owner; and what acts it has consisted of.

Likewise, the Judge shall question the witnesses, sua sponte (de oficio) or at the request of a party, regarding any other information considered relevant to proving possession. All of the foregoing shall be done without the need for the interested party to submit questions in advance.” Under that provision, this Court understands that testimonial evidence is particularly significant for proving the exercise of possession because, since possessory-information proceedings (trámite de información posesoria) constitute non-contentious judicial activity (actividad judicial no contenciosa), the petitioning party (parte promovente) must comply with the statutory provisions in order to obtain the title claimed in these proceedings. On that basis, the applicant offered the testimony of [Nombre7], [Nombre4], and [Nombre6]. Witness [Nombre7] testified that he is seventy-three years old. He stated that he moved to the Copey area at the age of three.

He testified that he had known the property to be registered for seventy years. He identified the persons who had owned the land: first, Mr. [Nombre8], who transferred it to [Nombre9]; Don [Nombre9] then transferred the property to [Nombre10], who conveyed it to his brother [Nombre11]. He stated that Don Dago transferred the property in question to [Nombre4], who donated it to his son, the applicant [Nombre1]. He stated that the property is used for dairy farming and agricultural crops. Witness [Nombre4], for his part, testified that he was seventy-seven years old. He said that he was born in 1944 in Copey and had always lived in the district. He stated that he had known the land for sixty years, since the time when [Nombre8] owned it. He said that it later belonged to “[Nombre12].” He then said that this person sold it to [Nombre13], the applicant’s father, who in turn donated it to the petitioner.

He did not remember how long ago Don [Nombre4] donated the land to his son. He explained that the property is used for agricultural activities and that some cows are also kept there. Witness [Nombre6] testified at the evidentiary hearing (audiencia de prueba) that he was sixty-two years old. He said that he was a resident of Dota. He stated that he first became acquainted with the property in 1966, that is, after the property became subject to restrictions resulting from the creation of Reserva Forestal Los Santos. He said that when he first knew the property, it belonged to Don [Nombre14]. He then recounted that his father, [Nombre10], acquired the land in question and subsequently sold it to his brother [Nombre5]. He further testified that Don [Nombre5] transferred the property to [Nombre4], who is the petitioner’s father. He then explained that Don [Nombre4] transferred the property to the applicant in these proceedings.

However, he testified that he did not know how long ago that transfer occurred. Article 6 of the Ley de Informaciones Posesorias provides as follows: “Proof of possession shall be established through the testimony of three witnesses who are residents of the canton in which the property is located. They shall be questioned as to how long they have known the property; whether they know that the applicant or previous owners have continuously possessed it for a period of no less than 10 years; whether that possession has been public, peaceful, and exercised as owner; and what acts it has consisted of. Likewise, the Judge shall question the witnesses, sua sponte or at the request of a party, regarding any other information considered relevant to proving possession. All of the foregoing shall be done without the need for the interested party to submit questions in advance.” Under that legal provision, in order to establish possession in non-contentious possessory-information proceedings such as these, the petitioner must demonstrate the exercise of such possession through the testimony of three witnesses.

This appellate body understands that if the provision is not fully complied with, possession cannot be deemed proven. In this case, in the opinion of the majority of this Chamber, this is not a matter of evidence subject to a prescribed value (prueba tasada), but rather a statutory requirement. It must be borne in mind that this is a possessory-information proceeding in which the petitioner must strictly comply with the requirements prescribed by law. In this particular case, Article 6 under review provides, as stated above, that possession in such matters must be established through the testimony of three witnesses. Accordingly, in addition to this requirement, the same law establishes other requirements that the person must meet in order to obtain registration of the property; otherwise, the application for title (solicitud de titulación) must be denied. Moreover, as already indicated, because this is a non-contentious proceeding (proceso no contencioso) in which a series of exhaustive requirements (requisitos taxativos) must be strictly satisfied, the adjudicator must verify that they have been fulfilled exactly as prescribed by law.

As to the required testimonial evidence, the cited Article 6 of the Ley de Informaciones Posesorias expressly states that testimony must be provided by witnesses who satisfy the characteristics specified therein. Thus, not just any testimonial evidence may be received; rather, the provision clearly specifies not only the number of witnesses but also the conditions they must satisfy and the matters that these three witnesses must specifically address. This should not be understood to mean that the case involves evidence subject to a prescribed value, because the requirement of 3 witnesses is part of the exhaustive list of requirements that must be met. The provision does not refer to witness evidence (prueba testifical) generally, such that the testimony of only one or two witnesses could be considered sufficient; instead, as with the other required formal requirements, it must be satisfied exactly as prescribed.

It should be noted that, in this type of proceeding, the adjudicator’s principal task is to determine whether all the required elements have been provided. If even one is missing, the possessory information (información posesoria) must be deemed unproven, and no requirement may be disregarded through an overall assessment of the evidence, because the requirements to be met are specific and clear. Under this analysis, it can be established that, of the three witnesses offered, only two knew the property in question before the year 1965, the year in which the property became subject to restrictions as a result of the creation of Reserva Forestal Los Santos. Accordingly, the Attorney General’s Office (órgano procurador) is correct regarding its claim that possession before the property sought to be titled became subject to those restrictions was not proven.

VI.Regarding the claim that ecological possession (posesión ecológica) has not been exercised over the property, the State’s representative is correct. In this regard, Article 33 of the Ley Forestal provides: “The following are hereby declared protection areas (áreas de protección): (a) Areas bordering permanent springs (nacientes permanentes), within a radius of one hundred meters measured horizontally. (b) A strip of fifteen meters in rural areas and ten meters in urban areas, measured horizontally on both sides along the banks of rivers, ravines, or streams, if the terrain is flat, and fifty horizontal meters if the terrain is rugged.” The wording of this provision affords special protection to areas bordering permanent springs and the banks of rivers, ravines, and streams, depending on whether the terrain is flat or rugged. In other words, the restriction (afectación) established therein is generally applicable and is intended, on the one hand, to ensure the necessary conservation of water resources, which may be adversely affected if the legal provision is not observed, and, on the other hand, to protect individuals from potential natural disasters resulting from physical, chemical, and biotic factors of the terrain, the alteration of which by human beings may cause its degradation, increasing desert areas and risks to individuals.

Similarly, the Ley de Aguas, number 276, provides that: “It is prohibited, in both national and privately owned forests, to destroy trees located less than sixty meters from springs (manantiales) originating in the hills, or less than fifty meters from those originating on flat land.” Regarding that provision, the Sala Primera de Casación has ruled as follows: “As may be observed, the provision does not distinguish between permanent and intermittent springs, and therefore no such distinction may be made when applying it. This is a typical public-interest restriction (limitación de interés público) (Article 45 of the Constitución Política), which, like others established in various bodies of law within the legal system, has advanced the concept of limitations on private property in pursuit of genuine and effective protection of the constitutional guarantee (Article 50 of our Constitución Política) of a healthy and ecologically balanced environment.

Nor does the provision distinguish between publicly owned and privately owned waters. The provision refers only to waters, that is, to water resources in general; consequently, the citation of Articles 1 through 4 of Law no. 276 is not relevant to this case. Accordingly, this Chamber does not find that the Tribunal violated the provision alleged to have been erroneously interpreted and applied when it determined that intermittent springs are indeed afforded legal protection.” Based on the foregoing, in the case under review, this Tribunal observes that the land-use study (estudio de uso de suelos) entered into the electronic case file on 17 de agosto de 2018 stated: “This property is subject to the Ley Forestal, Article 33, and to the Ley de Aguas N° 276 and its amendments. The río Pedregoso and a ravine at [Dirección4] of the property are located in a wooded area and comply with the setback requirement (retiro).

This is not the case with the ravine that ‘originates’ on the property, which complies with the setback requirement only partially. These ravines appear to be seasonal.” For its part, during the judicial inspection conducted in the proceeding and entered into the electronic case file on 26 de abril de 2021, in the files numbered five and eleven, the Court provided a description of the watercourses crossing the land for which title is sought. In file five, it stated that the Río Pedregoso had clearly defined boundaries and was protected by oak and cypress trees and the area’s natural vegetation. In file eleven, the adjudicating judge stated, regarding the unnamed ravine located on the property in question, that it is a geographic feature of the property, crosses the property between [Dirección5], originates on the land, has little flow, and is situated in an area of rugged terrain; regarding forest cover (cobertura boscosa), the judge explained that it extends between five and ten meters on each side, where tall trees and vegetation typical of the area were observed.

Based on this evidence gathered in the case file, this Tribunal concludes that the watercourse originating on the property has indeed not received proper protection, because the protections required under Article 33 of the Ley Forestal and Article 276 of the Ley de Aguas have not been implemented. Although report UEN-GA-2020-00061, issued by the Instituto Costarricense de Acueductos y Alcantarillados and entered into the electronic case file on 15 de enero de 2020, stated that no type of water intake or water use for human consumption affecting any community system had been recorded on or near the property, it also specified that the land is highly vulnerable in terms of water resources because it is located in the upper section of the Río Pedregoso sub-basin within the Parrita basin, because of the presence of surface water bodies bordering the property—the unnamed ravine—and the Río Pedregoso crossing the property, and because it is situated within Reserva Forestal Los Santos.

Based on the reasons stated above, this Chamber concludes that the natural resources have not been protected through the possessory activity (actividad posesoria) carried out on the property, and that the person seeking title has not exercised ecological possession safeguarding those resources. Accordingly, the first ground of the State’s appeal must be upheld.

VII.Because the first and second grounds of the appeal have been upheld, it is unnecessary to address the State’s remaining claims. Accordingly, the trial court’s judgment granting the present non-contentious proceedings (diligencias) must be reversed, and those proceedings must instead be denied.

VIII.Dissenting opinion of Judge Díaz Bolaños: I depart from the majority’s position because I believe that the challenged judgment should be affirmed. a. The substantive basis for this position lies in the manner in which the evidence was weighed. In interpreting section 6 of the Ley de Informaciones Posesorias, it is treated as though it established a system of legally prescribed evidence (prueba tasada). In other words, it is treated as though the testimony of the witnesses must be analyzed separately from the entire body of evidence. It must be borne in mind that the initial application and all other submissions filed by the applicant must be examined against the substantive requirements of the possessory title proceeding (información posesoria), because, unlike other bodies of law, the cited law gives them the weight of statements made under oath (article 3 ibid.). These are not spontaneous assertions as described in the Código del Proceso Civil; they constitute important evidence.

This provides the starting point for structuring the assessment of the evidence. All other items of evidence must clearly align with that application and the subsequent submissions, so that the documentary evidence (land-use studies, Registry certifications, copies of identity cards, submissions by adjoining landowners, submissions by interested third parties, public or private documents establishing the right for which recognition is sought, cadastral plans, documents issued by public institutions, among many others), together with the judicial inspection (reconocimiento judicial) and witness testimony, must be weighed as a whole. Particular attention must be paid to this situation when the properties in question are located within any type of protected wildlife area (área silvestre protegida). It is also essential to recall that the Ley de Informaciones Posesorias establishes a proceeding for obtaining a title eligible for registration in the Registro Público; under the express wording of the first provision of that body of law, the judgment recognizes a right acquired by adverse possession (usucapión) that the applicant already holds, having perfected it before filing the proceeding and having satisfied the requirements of article 856 of the Código Civil.

This represents a shift in the perspective of that law, for which reason the public-domain status (demanialidad) theory that has been advanced in countless cases is wholly inapplicable. Accordingly, the decision is deemed detrimental, by virtue of its effect, to sections 45 and 50 of the Constitución Política, because it fails to weigh the body of evidence as a whole within the context of the protected wildlife area in which the property to be titled is located, taking into account the historical period when that area was created. In addition, the failure to rule on all grounds of appeal, together with the manner in which the evidence was weighed, amounts to a failure to consider evidence (preterición de la probanza). The Sala Primera de la Corte Suprema de Justicia explained the scope of such failure as follows: “XI. - This Chamber has stated that failure to consider evidence occurs: ‘[…] when judges fail to consider, in whole or in part, the evidence submitted in the record.

This entails disregarding the value assigned to it by law and, as such, constitutes an error of law. It follows from the foregoing that disregarding an evidentiary item properly submitted and material to the dispute will constitute such error. This is because it may produce an inaccurate representation of the factual circumstances of what occurred and was disputed in the proceeding, with the resulting indirect infringement of the substantive law applied to the specific case’ (Voto número 771-F-S1-2011 de las 13 horas 30 minutos del 30 de junio de 2011 de la Sala Primera de la Corte Suprema de Justicia).” b. Pursuant to article 7 of the Ley de Informaciones Posesorias, a series of requirements must be satisfied in order to obtain, by means of a judgment so ordering, title eligible for registration to land subject to a management category (categoría de manejo). Consequently, through witness testimony and the submitted acquisition document—where reliance is sought on the possession exercised by the transferors (article 1 Ibidem.)—together with the remaining evidence, it must be shown that the title applicant’s possession and that of the applicant’s transferors was known to have existed for at least ten years before the protected wildlife area was created, based on the date of the decree creating the area.

Section 6 of the Ley de Informaciones Posesorias establishes how possession is to be proven in proceedings of this nature and provides as follows: “Proof of possession shall be established through the testimony of three witnesses who reside in the canton where the property is located. They shall be questioned as to how long they have known the property; whether they have personal knowledge that it has been continuously possessed by the title applicant or previous owners for a period of no less than 10 years; whether such possession has been public, peaceful, and exercised under a claim of ownership; and the acts through which it has been exercised. The Judge shall also question the witnesses, on the Judge’s own initiative or at a party’s request, concerning any other information considered relevant to proving possession. All of the foregoing shall be done without the need for questions previously prepared by the interested party.” Furthermore, the seventh provision states that, when the property is located within a protected wildlife area, the qualifying possession (posesión idónea) to be proven must date back at least ten years before the creation of the respective management category.

It is therefore mandatory to conduct a comprehensive assessment of all evidence entered in the case file, because agrarian proceedings are governed by the system of free assessment of evidence (libre valoración), in accordance with article 54 of the Ley de Jurisdicción Agraria. It bears noting that the referenced article establishes the system for assessing evidence in agrarian matters. Regarding this method, it is appropriate to cite the explanation given by the Sala Primera de la Corte Suprema de Justicia in decision número 60-2011 de las 9 horas 15 minutos del 27 de enero de 2011: “Pursuant to section 54 of the LJA, in agrarian matters evidence must be assessed ‘conscientiously and without strict adherence to the rules of ordinary law; however, when analyzing the results of the evidence obtained in the proceeding, the court must state the principles of equity or law on which its determination is based.’ In turn, provision 61 ibídem establishes: ‘When assessing the evidence and deciding the matter, the Sala de Casación shall be governed by article 54 and, generally, by the principles underlying this law.’ With respect to this issue, this Chamber stated: ‘IV.

In the case at bar, the dispute revolves around a specific point: the assessment of the evidentiary record as to which party breached the contract. The manner in which judges are to assess evidence has changed throughout the history of procedural law. During an initial stage, preceding the nineteenth-century codifications, a system of legally prescribed evidence was used to determine the probative force of each item. Thus, the law predetermined the value of each item of evidence, and the adjudicator could not decide independently which items best informed the adjudicator’s conviction in resolving the particular case. Accordingly, specific means were required to prove each right, with their number varying depending on the right at issue, while a priori distinctions were imposed among witnesses based on gender, age, occupation, or social class. That system was superseded by the Spanish Ley de Enjuiciamiento Civil of 1855, which served as the basis for the procedural codes of Latin America, including Costa Rica.

That Spanish legislation adopted the model of assessing evidentiary material under the rules of sound judicial evaluation (sana crítica). This is an intermediate approach between legally prescribed evidence and unfettered judicial conviction (libre convicción). On the basis of sound judicial evaluation, a judge may independently reach a conviction regarding the truth of the facts underlying the decision through the judge’s own assessment; that assessment, however, is not entirely unrestricted, but is subject to the rules of formal logical reasoning and, simultaneously, to human experience. Legal scholarship, particularly Couture, has stated on this point that a judge is not a reasoning machine but, fundamentally, a human being who becomes aware of the surrounding world and understands it through sensory and intellectual processes. In addition to logic, sound judicial evaluation entails the proper assessment of certain propositions derived from experience that every person uses in life.

The judicial authority is therefore responsible for assessing the evidence through proper logical interconnection and also in light of the circumstances of the surrounding environment as perceived through experience. The purpose of the foregoing is to ensure that the adjudicator may not rely solely on discretion but must explain, on the basis of logic and experience, the reasons for the resulting conviction. This will also allow the reviewing court, if the judgment is challenged, to determine whether the criteria applied by the court below (a quo) complied with those rules of proper human understanding. A third system is known as unfettered judicial conviction. Under this system, the adjudicator’s decision need not necessarily be based on the evidence submitted by the parties to the proceeding. The adjudicator could even rule contrary to the proven facts and rely solely on the judge’s private knowledge.

It would suffice for the judge to assert a moral certainty that the events occurred in a particular manner, without being required to set out the logical development of the reasoning. The Costa Rican Código Procesal Civil follows a hybrid of the rules of sound judicial evaluation and legally prescribed evidence. This conclusion is drawn from provision 330, as well as from various rules that are remnants of the earlier system concerning the value of evidentiary means such as confessions, public instruments, documents that prevail over witness testimony, and the impossibility of proving certain facts solely through such testimony. Article 54, second paragraph, of the Ley de la Jurisdicción Agraria, however, provides as follows: ‘When ruling on the merits of the matter, the judge shall assess the evidence conscientiously and without strict adherence to the rules of ordinary law; however, when analyzing the results of the evidence obtained in the proceeding, the judge must state the principles of equity or law on which the determination is based.’ Although the similarity in terminology might initially suggest that this conforms to the system of unfettered judicial conviction, that is not in fact the case, because the provision itself directs the adjudicator to provide arguments grounded in law or equity to justify the assessment.

The matter was also addressed when the Sala Constitucional, in sentencia n.º 11932 de las 15 horas 37 minutos del 21 de noviembre del 2001, explained that evidence may not be assessed at the mere whim of the judicial authority.

Rather, that section 54 requires it to “...analyze the result of the evidence gathered in the proceeding and state the principles of equity or law on which it bases its judgment, thereby respecting the minimum requirements of the right of defense.” In the cited decision, that Chamber refers to its judgment no. 4448, issued at 9 hours on 30 de agosto de 1996, in which it stated: “Thus, assessment of the evidence according to conscience (apreciación de la prueba en conciencia) does not entail ruling arbitrarily, because every judge—as a public official—is subject to the principle of legality (principio de legalidad), which imposes a duty to ensure that public action conforms not only to the specific rules governing a particular matter, but also to the entire body of law; accordingly, a judge may not rule in disregard of constitutional principles and rights, since the judge is constrained by the rules of sound judicial assessment (sana crítica) and the principles of reasonableness, which, when properly applied, harmonize judicial assessment with the Constitución Política.” It must therefore be concluded that, in fact, section 54 of the Ley de Jurisdicción Agraria does not permit the adjudicator to rely on a system of unfettered conviction (libre convicción).

Moreover, based on the duties to provide reasons that it imposes and in light of the interpretation adopted in constitutional case law, it subjects the adjudicator to the rules of sound judicial assessment, insofar as the adjudicator must employ logical reasoning consistent with shared human experience to justify the decision rendered. Because the provision itself states that the adjudicator is not bound by ordinary law, it must be understood that, unlike civil proceedings, there is no legally prescribed weight of evidence (prueba tasada). Accordingly, when agrarian judges are alleged to have improperly assessed the evidence, what is actually being alleged is their failure to observe the rules of logic and experience that inform sound human understanding when stating the grounds for their conviction.” (See judgment no. 712, issued at 15 hours 15 minutes on 26 de setiembre de 2005; the underlining does not appear in the original).” Under the system for assessing evidence established in the cited article 54, the grounds of grievance will be analyzed, emphasizing that agrarian law has its own weighing system, which is related to the principles informing agrarian proceedings.

Another point to consider is that the evidence may not be analyzed separately; it must be considered as a whole. Consequently, it is improper, as the complaining Procuraduría seeks, to analyze the statements in isolation without considering the entire body of evidence (acervo probatorio). The same conclusion as that reached by the lower court is therefore warranted, because the evidence is consistent and harmonious. On the one hand, the statements are clear as to how long the witnesses have known the petitioner and his possessory relationship with the property. Although those who testified were children of various ages at the relevant time, it is credible that they could attest to the possession; their statements complement one another, are not mutually contradictory, and are consistent with the documentary evidence in the record. As for [Nombre6], this is the person who has known the estate for the shortest period; nevertheless, as discussed extensively above, a joint assessment of the evidence establishes possession dating back 10 years before the creation of the Reserva Forestal Los Santos.

The initial pleading stated under oath that he acquired the property from his father through a gift in 2013, although the instrument was not executed until 2018 (see fifth fact in table 2 in PDF format). That situation does not mean that the period during which acts of possession were exercised between 2013 and 2018 cannot be counted, since the witness testimony clearly establishes that possession was exercised. An important consideration in weighing the evidence, resulting from a proper understanding of the system prevailing in agrarian matters, is the manner in which relationships arise in rural areas. They are normally verbal, because an axiological system based on religious and cultural beliefs prevails. It is therefore understandable that only later, when the parties obtained advice to carry out the possessory-information proceeding (información posesoria), they were told that it had to be recorded in a public instrument.

What matters is that the act was ratified, which is permissible under our legal system, as occurred in this matter. The document appears in image 12, thereby confirming compliance with the formality required for the gift and permitting the previously exercised possession to be counted toward completion of the period specified by law. The witness testimony corroborates and is consistent with the chain of transfers that the applicant must prove, leaving no doubt that the ownership right had vested by the time the forest reserve was created. The substantive requirement for this possessory-information proceeding must therefore be deemed satisfied. c. Regarding the possibility that private parties may register forested properties located on untitled land, this Court considers that untitled land with forest cover (cobertura forestal), whether inside or outside protected wilderness areas (áreas silvestres protegidas), may be titled, provided that the legal requirements established in the various applicable bodies of law have been satisfied (in this regard, judgment Nº 51, issued at 15 hours 15 minutes on 26 de mayo de 1995 by the Sala Primera de la Corte Suprema de Justicia, may be consulted).

Section seven of the Ley de Informaciones Posesorias was amended upon enactment of the current Ley Forestal 7575 and expressly authorized the titling of forested real property through this proceeding. In this regard, this Chamber has ruled as follows: “With respect to forested properties located outside protected wilderness areas, that provision states: ‘... Properties located outside those areas that contain forests may be titled only if the petitioner demonstrates that he or she holds the legal rights arising from ten-year possession (posesión decenal), exercised for at least ten years, and has protected that natural resource, on the understanding that the property must be properly demarcated and enclosed by fences or cleared boundary paths.’ The constitutionality of that provision and of the interpretation once adopted by this Court was challenged, giving rise to the issuance of decision 4587-97 by the Sala Constitucional, which was specifically cited by the appellant.

In that decision, the Chamber declared the provision constitutional, leaving it in force. In view of that circumstance, the appropriate disposition in this case is to affirm the adjudicator’s ruling, because the petitioner proved compliance with the requirements established by that article, namely: ten-year possession, protection of the natural resource, and demarcation of the property by fences or cleared boundary paths,” (Tribunal Agrario, judgment number 573-F-09). Likewise, the Sala Constitucional de la Corte Suprema de Justicia again rejected the constitutional consultation concerning article seven of the Ley de Informaciones Posesorias submitted by this Court under expediente EXPN1, leaving that provision and its effects in force. d. Lastly, the possession exercised is considered not to violate the rules of our country’s agro-environmental legislation. In the judicial inspection (reconocimiento judicial), specifically regarding the protection of areas adjacent to tributaries, file 5 highlights the description of the río Pedregoso, which was observed to be well demarcated and protected by oak and cypress trees and the natural vegetation of the area.

Record number 11 describes the unnamed creek. It was explained that it is a geographical feature of the property, crosses the property between [Dirección6], originates on the land, has little flow, and lies in rugged terrain; as to forest cover (cobertura boscosa), it extends between five and ten meters on each side, where tall trees and vegetation typical of the area can be observed. It follows from the foregoing that there is forest cover appropriate for a geographical feature of this nature. Requiring more extensive cover than that described would be disproportionate and would constitute an unnecessary obstacle to the litigant’s ability to obtain title. No environmental harm is evident, and the possessory-information application may therefore be approved.

POR TANTO:

The judgment under appeal is reversed. In its place, the present possessory information proceedings (diligencias de información posesoria) brought by [Nombre1] are denied. Judge Díaz Bolaños dissents.

( ver resolución incorporada el 19/01/2021 10:42.) 4.- La jueza Silvia Elena Sánchez Blanco, del Juzgado Agrario de Cartago, en sentencia número 2021000204, de las quince horas veintisiete minutos del catorce de octubre de dos mil veintiuno, resolvió: “POR TANTO: Por lo expuesto, de conformidad con la LEY DE INFORMACIONES POSESORIAS N° 139 del 14 de julio de 1941 y sus reformas, SE APRUEBAN estas diligencias de INFORMACIÓN POSESORIA promovidas por [Nombre1] , mayor, casado, agricultor cédula CED5 - ; vecino de Copey de Dota.- Proceda el REGISTRO PUBLICO DE LA PROPIEDAD, Sección Bienes Inmuebles, a inscribir a su nombre sin perjuicio de terceros de mejor derecho y con las limitaciones de Ley que se dirá, la finca que a continuación se detalla: Terreno de Naturaleza de potrero y bosque, sito en Vuelas, [Dirección2] , [Dirección3] DOTA, de la provincia SAN JOSÉ; el cual colinda al Norte: con calle pública con frente de ochocientos treinta y seis metros con cuarenta y ocho centímetros; al Sur: Quebrada en medio de [Nombre2] Badilla; al Este con MINAE, Cerro Vueltas; al Oeste con [Nombre3] .- Mide: TRESCIENTOS DOS MIL SETECIENTOS SESENTA Y SEIS METROS CUADRADOS CON VEINTICUATRO DECÍMETROS CUADRADOS; se describe según plano catastrado número SJ-2224664-2020.- Inmueble que fue estimado en la suma de cinco millones de colones, por cuanto ha cumplido con todos los requisitos que al efecto establece la ley de Informaciones Posesorias.

Sirva la certificación de esta sentencia para inscribir en el Registro de la Propiedad la finca citada.- Dicha inscripción deberá hacerse advirtiendo a su titulante que el derecho de vía de la calle pública que colinda con el inmueble a titular es de catorce metros de ancho, por lo cual queda afecto a las limitaciones establecidas en el artículo 4 de la Ley General de Caminos Públicos y 19 inciso "a" de la Ley de Informaciones Posesorias. Además artículos 1, 2, 3, 4, 5, 6, 7 de la Ley de Informaciones Posesorias y 1, 2, 7 y 25 de la Ley de Jurisdicción Agraria así como a las limitaciones contenidas en los artículos 33, inciso b) y 34 de la Ley Forestal Número 7575, por lo cual el área contigüa a las corriente es área de protección, quedando prohibida la corta o eliminación de árboles, y Ley de Aguas, artículos 1 inciso a y b, inciso N, y 3, inciso III, por cuanto el cauce y las aguas de esas corriente son de dominio público, así como las aguas superficiales y subterráneas existentes en el inmueble, las cuales no forman parte de la finca; así como por ubicarse en su totalidad dentro de la Reserva Forestal Los Santos.- Una vez firme esta resolución, expídase la ejecutoria respectiva y archívese el presente asunto".

(ver escritorio virtual del Juzgado Agrario de Cartago, sentencia primera instancia incorporada el 14/10/2021 14:56). 5.- La Procuraduría General de la República, interpuso recurso de apelación con indicación expresa de las razones en que se apoya para refutar la tesis del juzgado de instancia (ver escritorio virtual del Juzgado Agrario de Cartago, escrito incorporado el 22/10/2021 06:01).

II.El Tribunal avala el hecho probado uno, pero, lo modifica para que el número de plano se lea correctamente como el 1-2224864-2020. Se admiten los hechos probados dos y tres. No se avala el hecho probado cuatro; y se prohijan los hechos enumerados del cinco al trece, al estar bien sustentado en los autos. Se adiciona por parte de esta instancia el hecho probado catorce, en el siguiente sentido: La parte promovente no ha respetado el retiro total correspondiente a la quebrada que nace en el predio a inscribir (ver estudio de uso de suelos, adjunto al escrito inicial de las diligencias y archivo 11 de reconocimiento judicial, incorporado al expediente electrónico el 26 de abril de 2021).

III.Para esta instancia se tiene por no probado lo siguiente: Que la persona titulante haya acreditado un ejercicio posesorio por más de diez años, antes de la creación de la Reserva Forestal Los Santos.

IV. RECURSO DE APELACIÓN

La Procuraduría General de la República, mediante escrito agregado al expediente electrónico en fecha 22 de octubre de 2021, interpuso recurso de apelación en contra de la sentencia de primera instancia, bajo número 2021000204, dictada a las quince horas veintisiete minutos del catorce de octubre de dos mil veintiuno, con base en los siguientes argumentos: 1- Menciona que la sentencia recurrida tuvo por demostrado en el hecho probado cuatro, que el señor [Nombre1] , ha ejercido una posesión derivada por más de sesenta años sobre el terreno base de estas diligencias, pese a que dice, la prueba testimonial y documental recabada en el expediente resulta insuficiente para acreditar la posesión derivada anterior al año de 1975, con motivo a la afectación del inmueble producto de la creación de la Reserva Forestal Los Santos. Expone que la persona titulante afirmó en el hecho quinto del escrito inicial de estas diligencias, haber obtenido el terreno a inscribir de su padre, sea el señor [Nombre4] en el año 2013, sin embargo, acusa que la donación se hizo hasta el 26 de abril de 2019.

En esa línea, menciona que la pieza apelada tuvo por probado en el hecho dos, que la persona titulante adquirió el inmueble el 26 de abril de 2018, siendo así, cuestiona que se hizo 43 años después de que se creó el área silvestre protegida Reserva Forestal Los Santos. Indica que en relación a bienes inmuebles no es factible la donación verbal, por esa razón, en su opinión la donación resulta ser nula (cita el voto 218-2008, de este Tribunal, así como el 583-2004, de la Sala Primera). En su criterio, dice que la prueba testimonial es inútil para demostrar un acto traslativo de dominio de bienes inmuebles, y aún cuando se hubiere hecho la donación, dice sería nula por comprender bienes demaniales que están fuera del comercio. Cuestiona que la sentencia impugnada reconoce al titulante sesenta años de posesión derivada, con base en la escritura número 86, del tomo 7, del protocolo de la notaria pública Sandra Navarro Marín, lo cual, dice es improcedente.

Ataca que en dicha escritura, otorgada en el año 2018, el compareciente [Nombre4] dijo traspasar a su hijo, sea la persona promovente, la posesión por más de sesenta años. Por ese motivo, se muestra inconforme porque dice las manifestaciones de la persona otorgante no es válida para acreditar la antigüedad de la posesión alegada. Así también, explica que en la decisión impugnada, se tuvo por probado que el padre del titulante compró el terreno al señor [Nombre5] , mediante la escritura CED6 del tomo 80 del protocolo del notario Álvaro Torres Vicenzi, cuyo testimonio sin número se trajo a los autos. Con base en lo anterior, dice que, en ese documento consta que fue otorgado el 30 de mayo de 1979, es decir, 4 años después de creada la Reserva Forestal Los Santos. En su opinión, no cabe posesión sobre un bien afectado al dominio público y el acto de transmisión sería absolutamente nulo por tratarse de bienes fuera del comercio.

Así mismo, dice que en esa escritura el señor [Nombre4] presuntamente compró un terreno de apenas 21 hectáreas, sea 10 hectáreas menos que las que ahora pretenden titular, y no habría identidad con el bien objeto de este trámite, ni podría suponerse en perjuicio del interés público ambiental que revisten las áreas silvestres protegidas. Cita que las escrituras de traspaso no pueden servir para acreditar el ejercicio de la posesión, pues estas dice sirven solo para ratificar el negocio jurídico que se llevó a cabo, aunado a ello, dice no es viable tener por acreditada la posesión con la información suministrada por las partes (cita el Voto 352-2012, de este Tribunal). En relación a la declaración de las personas testigos, refuta que no fueron claros, pues menciona se limitaron a decir una lista de personas de supuestos dueños del terreno, pero, menciona no se indicó el tiempo y actos posesorios (trae a colación el Voto 1058-2020, de esta Cámara).

En ese punto, dice que el testigo [Nombre4] no se refirió al número de apartos que hay en el terreno, pues dice afirmó hace mucho tiempo no ha vuelto a recorrer la finca. A su juicio, dicha declaración no resulta idónea al no visitar el terreno y ser familiar de la persona titulante. Con respecto al testigo [Nombre6] , menciona que pese a conocer el terreno desde 1966, declaró no conocer el tiempo que el titulante ha poseído el terreno, ni de si ha tenido problemas con precaristas o extrae madera. Indica objetaron dichos aspectos ante el Despacho de instancia, sin embargo, reclama no fueron apreciados ni analizados. 2- Menciona que las presentes diligencias fueron aprobadas sin haberse comprobado el ejercicio de una posesión ecológica. Cita que en la certificación de uso conforme de suelos, se tuvo por acreditado que el 12.93% del terreno está dedicado a "silvopastoril". En igual sentido, dice que en la inspección ocular realizada se consignó que en el inmueble hay repastos hechos para ganado de leche, vacas para ordeño, y semovientes pastando.

Considera que dichos actos posesorios son contrarios a la protección de los recursos naturales (menciona el Voto de esta Cámara número 836-2016). Así mismo, menciona que, al estar inmerso el terreno a titular en un área silvestre protegida, presenta una alta fragilidad hídrica. Cita el informe UEN- GA-2020-00061, del Instituto Costarricense de Acueductos y Alcantarillados. Expresa que, aun cuando no hay aprovechamiento de agua para abastecimiento poblacional el recurso hídrico debe ser protegido. En su opinión, la posesión ecológica incluye todos los recursos naturales presentes en el terreno. 3- Las áreas silvestres protegidas son bienes de dominio público y no son aptas para usucapir. En este argumento, cita la sentencia de la Sala Constitucional número 16975-2008. 4- Dice que la sentencia apelada consigna un número de plano que no corresponde al tramitado en la información posesoria. Sobre ese particular indica que, la sentencia 2021000204 señala en su parte considerativa y dispositiva que el terreno a inscribir se describe con el plano SJ-2224664-2020, que no es el utilizado en este trámite. Así se extrae de la lectura del plano que obra en autos y de la consulta realizada en la base de datos del Registro Inmobiliario. Finalmente, solicita se imprueben las presentes diligencias.

V.Al estar vinculados los agravios uno y dos, este Tribunal los estará conociendo de forma conjunta. Lleva razón la parte apelante con respecto a los motivos uno y dos del recurso de apelación. Del estudio del expediente por parte de esta instancia, se tuvo por acreditado que efectivamente el fundo a inscribir se encuentra situado en un cien por ciento dentro del Reserva Forestal Los Santos, tal y como consta en la certificación expedida por el Sistema Nacional de Áreas de Conservación, número SINAC-D-ACC-0747-2018 (incorporada al expediente electrónico en fecha 23 de octubre de 2018), la cual fue creada por el Decreto Ejecutivo N°5389-A, del 12 de octubre de 1975. Siendo así, la parte titulante debe de acreditar el ejercicio de una posesión diez años antes de la creación de dicho Decreto, es decir, antes del año de 1965, lo anterior, con base en lo regulado en el artículo 7 de la Ley de Informaciones Posesorias.

Ahora bien, teniendo claro dichas reglas legales, resulta procedente analizar la prueba ofrecida y recabada en el expediente, en aras de constatar o no, sí se cumple lo regulado en ese precepto legal. En ese sentido, el agravio expuesto por la representación del Estado gira en torno a que indica la sentencia apelada tuvo por demostrado el ejercicio posesorio del titulante por más de sesenta años en relación al fundo a inscribir, pese a que cuestiona, tanto de la prueba testimonial, así como de la documental recabada, resulta insuficiente para acreditar dicha posesión derivada anterior al año de 1975, con motivo a la afectación del fundo producto de la creación de la Reserva Forestal Los Santos. Bajo ese argumento, es preciso indicar que el artículo 6 de la Ley de Informaciones Posesorias dispone lo siguiente: "La justificación de la posesión se acreditará con la declaración de tres testigos, vecinos del cantón donde se halle situado el inmueble, a los cuales se interrogará desde cuándo conocen la finca, si les consta que ha estado sometida por el titulante o por anteriores dueños a posesión durante un período continuo no inferior a 10 años, si esa posesión ha sido en forma pública, pacífica y en concepto de dueño y en qué actos ha consistido.

Asimismo el Juez interrogará a los testigos de oficio o a solicitud de parte, sobre cualquier otro dato que se considere de interés para probar la posesión. Todo lo anterior se hará sin necesidad de previo interrogatorio formulado por el interesado". De acuerdo a esa norma, comprende este Tribunal que para la acreditación del ejercicio posesorio la prueba testimonial tiene una especial relevancia, dado que, al ser el trámite de información posesoria de actividad judicial no contenciosa, la parte promovente debe de cumplir las disposiciones sancionadas en la ley para lograr obtener el título que reclama en las diligencias. Con base en lo anterior, la parte titulante ofreció los testimonios de [Nombre7] , [Nombre4] y [Nombre6] . En el caso del testigo [Nombre7] declaró que tiene setenta y tres años. Menciona que llegó a vivir en el sector de Copey a la edad de tres años. Declaró conocer el fundo a inscribir desde hace setenta años.

Explicó las personas que han sido dueñas del terreno, sea primero el señor [Nombre8] , éste se la traspasó a [Nombre9] , luego don [Nombre9] traspaso el inmueble a [Nombre10] y éste se lo cedió a su hermano [Nombre11] . Indica que don Dago le transmitió la propiedad en cuestión a [Nombre4] , y dicha persona se lo donó a su hijo, sea el titulante [Nombre1] . Determinó que el fundo está dedicado a lechería y siembra de cultivos agrícolas. Por su parte, el testigo [Nombre4] , declaró tener setenta y siete años de edad. Dice nació en el año de 1944, en Copey. Siempre ha vivido en el distrito. Manifestó conocer el terreno desde hace sesenta años cuando el dueño del fundo era [Nombre8] . Dice luego fue de "[Nombre12]" . Posteriormente dice él le vendió a [Nombre13] , padre del titulante, y éste a su vez se lo donó al promovente. No recuerda hace cuánto tiempo don [Nombre4] le donó el terreno a su hijo.

Explicó que el inmueble está dedicado a la actividad agrícola y además se mantiene una vacas en el sitio. El testigo [Nombre6] declaro en la audiencia de prueba tener sesenta y dos años. Dijo ser vecino de Dota. Manifestó conocer el inmueble por primera vez en el año de 1966. Es decir, posterior a la afectación que sufrió el inmueble producto de la creación de la Reserva Forestal Los Santos. Dice que cuando conoció el fundo era de don [Nombre14] . Luego relató que el terreno en cuestión lo adquirió su padre [Nombre10] , y éste a su vez se le vendió a su hermano [Nombre5] . Siguió declarando en el sentido de que don [Nombre5] le traspaso el inmueble a [Nombre4] , quién es el padre del promovente. Luego explico que don [Nombre4] le transmitió el inmueble al titulante de estas diligencias. Sin embargo, declaró no conocer hace cuanto se dio ese traspaso. El artículo 6 de la Ley de Informaciones Posesorias regula lo siguiente: "La justificación de la posesión se acreditará con la declaración de tres testigos, vecinos del cantón donde se halle situado el inmueble, a los cuales se interrogará desde cuándo conocen la finca, si les consta que ha estado sometida por el titulante o por anteriores dueños a posesión durante un período continuo no inferior a 10 años, si esa posesión ha sido en forma pública, pacífica y en concepto de dueño y en qué actos ha consistido.

Asimismo el Juez interrogará a los testigos de oficio o a solicitud de parte, sobre cualquier otro dato que se considere de interés para probar la posesión. Todo lo anterior se hará sin necesidad de previo interrogatorio formulado por el interesado". Conforme a ese precepto legal, para acreditarse la posesión en un trámite de información posesoria como el que nos ocupa, cuya naturaleza es no contenciosa, debe la persona promovente demostrar el ejercicio de dicha posesión a través de la declaración de tres testigos, entendiendo este órgano de apelación que, si no se cumple a cabalidad lo dispuesto en la norma, no se tendría por demostrado tal posesión. En este caso, a juicio de la mayoría de esta Cámara, no se trata de prueba tasada, sino un requisito de ley. No puede perderse de vista que nos encontramos ante un proceso de información posesoria en donde estrictamente la persona promovente debe de cumplir con los requerimientos que la ley prevee, y en el caso en particular, el cardinal 6 objeto de examen, establece como se dijo anteriormente, que la posesión en estos asuntos debe de acreditarse con la declaración de tres testigos.

Así las cosas, junto con esa exigencia, la misma ley contempla otros requisitos que la persona debe de cumplir para lograr la inscripción del inmueble, caso contrario, debe de denegarse la solicitud de titulación. Además, como ya se indicó, al tratarse el presente caso de un proceso no contencioso, en el que debe cumplirse de manera puntual con una serie de requisitos taxativos, la persona juzgadora debe verificar que los mismos hayan sido cumplidos tal y como fue previsto por la ley. Y en el caso de la prueba testimonial requerida, expresamente se indicó en el citado artículo 6 de la Ley de Informaciones Posesorias debía cumplirse con la declaración de testigos que debían cumplir con las características que allí se indican, no siendo cualquier prueba testimonial a recibir, sino que la norma es clara en especificar no solo la cantidad sino las condiciones y los aspectos que estos tres testigos debían referirse de manera puntual, sin que ello deba entenderse se está ante un caso de prueba tasada, pues el requerimiento de los 3 testigos es parte de la lista taxativa de los requisitos a cumplir.

La norma no habla de prueba testifical en general como para considerar basta un solo testigo o dos, sino que como el resto de requisitos formales que se requieren deben ser cumplidos tal y como se solicitan. Nótese dentro de este tipo de procesos, la labor principal de la persona juzgadora es revisar si todos los requisitos a presentar han sido cumplidos, y a falta de uno solo de ellos deberá tenerse por improbada la información posesoria, sin que se pueda obviar algún requisito haciendo una valoración probatoria global, pues los requisitos a cumplir son puntuales y claros. Bajo ese análisis, se puede establecer que de los tres testigos ofrecidos, solamente dos conocen el inmueble en cuestión antes del año de 1965, año en el que fundo fue afectado producto de la creación de la Reserva Forestal Los Santos. Así las cosas, lleva razón el órgano procurador con respecto al reclamo planteado en torno a la demostración del ejercicio posesorio antes de la afectación del fundo a titular.

VI.En relación al reclamo expuesto concerniente a que en el fundo no se ha realizado una posesión ecológica, lleva razón la representación del Estado. En ese sentido, el artículo 33 de la Ley Forestal dispone: "Se declaran áreas de protección las siguientes: a) Las áreas que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal. b) Una franja de quince metros en zona rural y de diez metros en zona urbana, medidas horizontalmente a ambos lados, en las riberas de los ríos, quebradas o arroyos, si el terreno es plano, y de cincuenta metros horizontales, si el terreno es quebrado". La letra de esa norma contiene una protección especial a áreas que bordeen nacientes permanentes, riberas de ríos, quebradas, arroyos, de acuerdo a las condiciones del terreno, si es plano o quebrado. Es decir, la afectación allí establecida tiene un alcance general, y obedece a la necesaria conservación, por un lado del recurso hídrico, el cual puede verse afectado si no se respeta lo contenido en la norma jurídica, y por otro lado, se pretende brindar seguridad a las personas con motivo a eventuales desastres naturales, producto de factores físicos, químicos y bióticos del terreno, cuya alteración por el ser humano, puede ocasionar una degradación en éste, aumentando zonas desérticas y riegos para las personas.

En igual sentido, la Ley de Aguas, número 276, sanciona que: "Se prohíbe destruir, tanto en los bosques nacionales como en los de particulares, los árboles situados a menos de sesenta metros de los manantiales que nazcan en los cerros, o a menos de cincuenta metros de los que nazcan en terrenos planos". Sobre ese precepto, la Sala Primera de Casación se ha pronunciado al respecto y ha dicho: "Como se observa, la norma no distingue entre manantiales permanentes e intermitentes, por lo que no cabría hacer tal diferenciación a la hora de aplicarla. Se trata de una típica limitación de interés público (artículo 45 de la Constitución Política), que al igual que otras previstas en diversos cuerpos normativos del ordenamiento jurídico, ha evolucionado el concepto de límites a la propiedad privada, en aras de una tutela real y efectiva de la garantía constitucional (artículo 50 de nuestra Constitución Política) de un ambiente sano y ecológicamente equilibrado.

Tampoco distingue el precepto entre aguas de dominio público y de dominio privado. La norma alude a aguas solamente, sea, al recurso hídrico en general, por lo que la cita de los artículos 1 a 4 de la Ley no. 276 no resulta pertinente al caso. De ahí, que no estima esta Sala que el Tribunal hubiese quebrantado el canon cuya errónea interpretación y aplicación se acusa, al establecer que sí existe amparo legal para las nacientes intermitentes". Con base en lo anterior, en el caso bajo examen observa este Tribunal que en el estudio de uso de suelos incorporado al expediente electrónico en fecha 17 de agosto de 2018, se citó: "Esta propiedad está afectada por la Ley Forestal, artículo 33 y por la Ley de Aguas N° 276 y sus reformas. El río Pedregoso y una quebrada al [Dirección4] del predio se hallan en un sector boscoso, cumpliendo con el retiro. No así la quebrada que "nace" en el predio, que cumple con el retiro parcialmente.

Estas quebradas son en apariencia estacionales.". Por su parte, en el reconocimiento judicial realizado en el proceso, el cual está incorporado al expediente electrónico en fecha 26 de abril de 2021, en los archivos enumerados como cinco y once, el Despacho realizó una descripción con respecto a los afluentes de agua que atraviesan el terreno a titular. En el archivo cinco, citó que el Río Pedregoso se observó buena delimitación, estando protegido éste con árboles de roble, cipres y naturaleza del lugar. En el archivo once, la persona juzgadora indicó que con relación a la quebrada sin nombre ubicada en el fundo en cuestión, describió se trata de un accidente geográfico en la propiedad, la misma atraviesa el inmueble entre los [Dirección5] , nace en el terreno, es poco afluente, describe el área como relieve quebrado y con relación a la cobertura bocosa, explicó hay una extensión entre cinco a diez metros a cada lado, en donde notó árboles de gran altura y vegetación típica de la zona.

Bajo esos elementos probatorios recabados en el expediente, este Tribunal concluye que efectivamente no se ha dado una protección debida en relación al afluente de agua que nace en el inmueble, al no haberse realizado la protección en los términos de los artículos 33 de la Ley Forestal y 276 de la Ley de Aguas. Si bien es cierto, en el informe UEN-GA-2020-00061, emitido por el Instituto Costarricense de Acueductos y Alcantarillados, incorporado al expediente electrónico en fecha 15 de enero de 2020, se hizo mención que en el inmueble o en sus alrededores, no se registro ningún tipo de captación o aprovechamiento hídrico para consumo humano que afecte algún sistema comunal, sí se detalló que el terreno cuenta con una alta fragilidad hídrica al encontrarse en la sección superior de la subcuenca del Río Pedregoso de la cuenca Parrita, además de la existencia de cuerpos de aguas superficiales que limita con el inmueble (quebrada sin nombre) y el Río Pedregoso que atraviesa la propiedad, y por estar situado en la Reserva Forestal Los Santos.

Con base en las razones expuestas, concluye esta Cámara que no se ha protegido los recursos naturales con base en la actividad posesoria que se ha desarrollado en el inmueble, no ejerciendo la persona titulante una posesión ecológica que tutela dichos recursos. Así las cosas, deberá de admitirse el agravio primero del recurso de apelación interpuesto por el Estado.

VII.Al haberse admitido los agravios primero y segundo del recurso de apelación, resulta innecesario entrar a conocer el resto de reclamos expuestos por el Estado. Así las cosas, deberá de revocarse el fallo de primera instancia en cuanto admitió las presentes diligencias, y en su lugar, rechazar las mismas.

VIII.Voto salvado de la jueza Díaz Bolaños: Me separo del criterio de mayoría, pues estimo la sentencia impugnada debe ser confirmada. a. El motivo sustancial de este criterio, radica en la forma en que fue ponderada la prueba. Se considera, al interpretar el numeral 6 de la Ley de Informaciones Posesorias lo analizan como si fuese prueba tasada. En otros términos, como si las declaraciones de las personas testigos deben ser analizadas por separado de todo el elenco probatorio. Debe tenerse presente, se debe someter al examen de los requisitos de fondo de la información posesoria, desde el memorial inicial y todos aquellos pliegos que aparte la persona gestionante, pues a diferencia de otros cuerpos legales, la ley en cita, les da el peso de ser rendidos bajo la fe de juramente (artículo 3 ibid.). No se trata de aseveraciones espontáneas como señala el código del proceso civil, es un elemento probatorio de importancia.

De ahí, se parte para articular la valoración de la prueba. Todos los demás elementos de prueba se deben alinear de forma diáfana a ese memorial y los subsiguientes, de forma tal, la documental (estudios de uso de suelo, certificaciones registrales, copias de cédulas de identidad, memoriales de colindantes, memoriales de terceros interesados, documentos públicos o privados que acrediten el derecho que se pide reconocer, planos catastrados, documentos emitidos por instituciones públicas, entre muchos otros), junto con el reconocimiento judicial y la testimonial se debe ponderar en conjunto. Especialmente debe prestarse atención a esta situación cuando se trata de aquellas heredades ubicadas dentro de cualquier tipo de área silvestre protegida. También es imperante recordar, la Ley de Informaciones Posesorias es un procedimiento para expedir un título inscribible en el Registro Público, lo cual, según la letra del canon primero de ese cuerpo legal, la sentencia reconoce un derecho de usucapión que ya posee la persona gestionante, la cual ha consolidado antes de la presentación del proceso y cumpliendo los requisitos del artículo 856 del Código Civil, lo cual es un cambio de visión en esa ley, motivo por el cual la tesis de la demanialidad que se ha procurado sostener en innumerables casos es absolutamente improcedente.

Por tal razón, se estima la decisión es lesiva por su efecto del numeral 45 y 50 de la Constitución Política, al no ponderar el acervo probatorio en su conjunto, ubicándose en el contexto del área silvestre donde se ubica la heredada a titular debido al momento histórico de la creación de esa zona. Se suma a lo anterior, no resolver la totalidad de los agravios y la forma de ponderar la probanza se incursiona en la preterición de la probanza. De acuerdo a lo explicado por la Sala Primera de la Corte Suprema de Justicia el alcance de la preterición es la siguiente: “XI. - Esta Sala ha expresado que la preterición de prueba ocurre: “[…] cuando los jueces dejan de considerar, total o parcialmente, las probanzas aportadas a los autos. Ello implica el desconocimiento del valor que la ley les otorga, y como tal, constituye un error de derecho. De lo anterior se colige que, desconocer un elemento demostrativo, aportado en forma debida y con incidencia en la lite, configurará ese yerro.

Esto, por cuanto puede apreciarse una representación inexacta del cuadro fáctico de lo sucedido y debatido en el proceso, con el mediato quebranto que ello implica sobre el derecho sustantivo aplicado al caso concreto” (Voto número 771-F-S1-2011 de las 13 horas 30 minutos del 30 de junio de 2011 de la Sala Primera de la Corte Suprema de Justicia). b. De conformidad con el artículo 7 de la Ley de Informaciones Posesorias, para poder obtener título inscribible a través de una sentencia que así lo ordene, de un terreno afectado por una categoría de manejo se deben cumplir una serie de requisitos. Debido a lo anterior, mediante prueba testimonial y documento de adquisición aportado, en caso de pretender aprovechar la posesión de los transmitentes (artículo 1 Ibidem.) junto con las restantes probanzas, debe demostrar se conoce de la posesión de la titulante y sus transmitentes, al menos diez años antes de la creación de esa área silvestre protegida según sea la fecha del decreto que cree la zona.

La Ley de Informaciones Posesorias establece en el ordinal 6 de la ley en cita la manera de demostrar la posesión en los procesos de esta naturaleza y al respecto reza: "La justificación de la posesión se acreditará con la declaración de tres testigos, vecinos del cantón donde se halle situado el inmueble, a los cuales se interrogará desde cuándo conocen la finca, si les consta que ha estado sometida por el titulante o por anteriores dueños a posesión durante un período continuo no inferior a 10 años, si esa posesión ha sido en forma pública, pacífica y en concepto de dueño y en qué actos ha consistido. Asimismo el Juez interrogará a los testigos de oficio o a solicitud de parte, sobre cualquier otro dato que se considere de interés para probar la posesión. Todo lo anterior se hará sin necesidad de previo interrogatorio formulado por el interesado". Por otra parte, el canon sétimo señala, en caso de ubicarse el fundo dentro de un área silvestre protegida, la posesión idónea a probarse debe ser al menos de un plazo anterior de diez años a la creación de la categoría de manejo respectiva.

Por lo anterior, es obligatoria la valoración integral de toda la prueba arribada al expediente, por estar regidos en procesos agrarios al sistema de la libre valoración acorde con el artículo 54 de la Ley de Jurisdicción Agraria. Conviene mencionar el artículo referido establece el sistema de valoración probatoria en materia agraria. Es oportuno señalar sobre este método, lo explicado por la Sala Primera de la Corte Suprema de Justicia mediante decisión número 60-2011 de las 9 horas 15 minutos del 27 de enero de 2011: "Conforme al numeral 54 de la LJA, en materia agraria, la prueba debe ser valorada “a conciencia y sin sujeción estricta a las normas del derecho común, pero, en todo caso, al analizar el resultado de la prueba recogida en el proceso, deberá expresar los principios de equidad o de derecho en que basa su criterio.” Por su parte el mandato 61 ibídem determina “La Sala de Casación, a la hora de apreciar la prueba y de resolver el negocio, se regirá por lo dispuesto en el artículo 54 y, en general, por los principios que informan esta ley.” En lo atinente a este tema, esta Sala indicó: “IV.

En el sub júdice la discusión gira en torno a un punto concreto: la apreciación del material probatorio, en cuanto a cuál de las partes incumplió el contrato. La forma cómo deben los jueces apreciar la prueba, ha variado a lo largo de la historia del Derecho Procesal. En una primera etapa, anterior a las codificaciones decimonónicas, se partía de un sistema tasado para discernir sobre la fuerza demostrativa de cada elemento. Así, la ley de antemano imponía valor a cada probanza, sin que el juzgador estuviera en la posibilidad de decidir, por sí mismo, cuáles elementos informaban mejor su convicción para resolver el caso concreto. De esa manera, se requerían medios específicos para demostrar cada derecho, variando su cantidad en torno a cada uno, así como estableciendo, a priori, discriminaciones sobre los declarantes en razón de su género, edad, oficio o clase social. Ese sistema fue superado en la Ley de Enjuiciamiento Civil española, de 1855, que sirvió de base a los códigos procesales de América Latina, incluyendo a Costa Rica.

En dicha legislación hispana se acogió el modelo de apreciar el material demostrativo a la luz de las reglas de la sana crítica. Se trata de la figura intermedia entre la prueba legal y la libre convicción. Con fundamento en la sana crítica, el juez puede llegar a un convencimiento por sí mismo sobre la certeza de los hechos sobre los cuales basa su decisión, a través de su propia valoración, pero, esta no es del todo libre, sino que está sujeta a las normas del pensamiento lógico formal y, de manera simultánea, a la experiencia humana. Sobre el punto ha expresado la doctrina, en especial, Couture, que el juez no es una máquina de razonar, sino, esencialmente, un ser humano que toma conocimiento del mundo que le rodea y le conoce a través de sus procesos sensibles e intelectuales. La sana crítica es, además de lógica, la correcta apreciación de ciertas proposiciones de experiencia de que toda persona se sirve en la vida.

Por lo tanto, la autoridad judicial estará encargada de apreciar las probanzas con una debida concatenación lógica y, además, bajo las circunstancias de su entorno, observadas mediante la experiencia. La finalidad de lo anterior es que el juzgador no podrá acogerse tan solo a su discrecionalidad, sino que deberá fundamentar, con base en la lógica y la experiencia, los motivos de su convicción. Esto, además, permitirá al superior, si se impugna el fallo, revisar si los criterios del a quo, se sujetaron a tales reglas del correcto entendimiento humano. Un tercer sistema es el denominado como de libre convicción. En este, lo que decida el juzgador no deberá estar sujeto, necesariamente, a la prueba aportada por las partes al proceso. Incluso, podría resolverse contra los hechos probados y tener asidero tan solo en el saber privado del juez. Bastará con que este afirme tener la certidumbre moral de que los hechos sucedieron de tal manera, sin que se le pueda exigir el desarrollo lógico de su razonamiento.

El Código Procesal Civil costarricense se enmarca en un híbrido entre las reglas de la sana crítica y la prueba tasada. Tal conclusión se extrae del precepto 330, así como de diversas regulaciones, resabios del sistema anterior, en torno al valor de los medios demostrativos como la confesión, los instrumentos públicos, los documentos que prevalecen sobre las declaraciones testimoniales y la imposibilidad de probar algunos hechos tan sólo con estas últimas. Por otra parte, la Ley de la Jurisdicción Agraria, en su artículo 54, párrafo segundo, dispone lo siguiente: “Al resolver sobre el fondo del negocio, el juez apreciará la prueba a conciencia y sin sujeción estricta a las normas del derecho común, pero, en todo caso, al analizar el resultado de la prueba recogida en el proceso, deberá expresar los principios de equidad o de derecho en que basa su criterio”. Aunque, por similitud de terminología, en principio, podría interpretarse que se ajusta al sistema de libre convicción, en realidad no es así, pues la propia norma ordena al juzgador dar argumentos de derecho o de equidad para justificar su apreciación.

Asimismo, hubo pronunciamiento sobre el tema, cuando la Sala Constitucional, en su sentencia n.º 11932 de las 15 horas 37 minutos del 21 de noviembre del 2001, explicó que la prueba no puede valorarse al mero arbitrio de la autoridad judicial. Más bien, dicho numeral 54 la obliga a que “...analice el resultado de la prueba recogida en el proceso y exprese los principios de equidad o de derecho en que basa su criterio; respetando de tal modo los contenidos mínimos del derecho de defensa.” Dicha Sala, en el voto de cita, refiere a su sentencia n.º 4448 de las 9 horas del 30 de agosto de 1996, donde expresó: “De esta manera, la apreciación de la prueba en conciencia no implica resolver en forma arbitraria, por cuanto todo juez –como funcionario que es- se encuentra sujeto al principio de legalidad, el cual constituye un imperativo de adecuación de la acción pública, no sólo de las normas específicas sobre un objeto determinado, sino a todo el bloque de legalidad; por lo que no puede fallar con desprecio de los principios y derecho constitucionales, ya que está limitado por las reglas de la sana crítica y principios de razonabilidad, que debidamente aplicados conducen a la armonía de la apreciación jurisdiccional con la Constitución Política” Entonces, debe concluirse, en realidad, el ordinal 54 de la Ley de Jurisdicción Agraria no permite al juzgador acogerse a un sistema de libre convicción.

Aún más, a partir de los deberes de fundamentar que se imponen y, a la luz de lo interpretado en la jurisprudencia constitucional, lo está sujetando a las reglas de la sana crítica, en el tanto, debe procurar un razonamiento lógico y acorde a la experiencia humana intersubjetiva para justificar lo que dispone. Por falta de sujeción al derecho común, según regula el propio precepto, habrá de entenderse que, a diferencia de los procesos civiles, no habrá prueba tasada alguna. En ese tanto, cuando se acuse una indebida valoración probatoria, por parte de los jueces agrarios, en realidad se estará acusando la inobservancia a las reglas de la lógica y de la experiencia, que informan el correcto entendimiento humano, al momento de fundamentar su convicción.” (Véase sentencia no. 712, de las 15 horas 15 minutos del 26 de setiembre de 2005, lo subrayado no corresponde al original)". Conforme al sistema de valoración de la prueba dispuesto en el artículo 54 citado, se procederá a analizar lo agraviado, subrayando en la disciplina agraria existe un sistema de ponderación propio, el cual se encuentra relacionado con los principios que inspiran el proceso agrario.

Otro dato para considerar es inadmisible el análisis separado de las probanzas; debe hacerse en conjunto; motivo por el cual es improcedente, como pretende la Procuraduría quejosa, analizar las declaraciones de manera solitaria sin considerar la totalidad del acervo probatorio. De tal forma se arriba a la misma conclusión del órgano judicial de instancia en cuanto hay coincidencia y armonía entre las pruebas. Por un lado, las declaraciones son claras en cuanto al tiempo de conocer al promovente y su relación posesoria en el fundo. Si bien quienes rindieron declaración cuando eran infantes de diversas edades, es creíble puedan dar cuenta de la posesión, se complementan, no son contradictorias entre sí y se armonizan con la documental constante en autos. En cuanto a [Nombre6] es quien tiene menor tiempo de conocer la heredad, sin embargo como se comentó profusamente en líneas anteriores con la valoración conjunta de las probanzas se logra comprobar una posesión 10 años antes de la creación de la Reserva Forestal Los Santos.

En el pliego inicial se afirmó haber recibido mediante la fe de juramento adquirió el bien de su padre en una donación en el 2013, que fue hasta el año 2018 que se hizo el instrumento (ver hecho quinto en cuadro 2 en modo PDF). Esa situación no significa que el lapso en que se ejercieron actos de posesión entre el 2013 a 2018 no puedan aprovecharse, pues de la testimonial se desprende con claridad que la posesión se realizó. Un dato importante en la ponderación de la prueba, producto de un correcto entendimiento del sistema imperante en materia agraria, es comprender la forma en que se dan las relaciones en las zonas rurales. Normalmente sin verbales pues impera un régimen axiológico basado en creencias religiosas y culturales. De ahí es dable hasta tiempo después las partes, al contar con asesoría para realizar el trámite de información posesoria, en que describieran que tenía que constar en documento público.

Lo relevante es que se convalida el acto, lo cual es admisible en nuestro ordenamiento jurídico, como paso en este asunto. El documento consta en imagen 12 con lo cual se corrobora la formalidad exigida para la donación y aprovechar esa posesión anteriormente ejercida, para completar el lapso señalado en la legislación. Con la testimonial se corrobora y armoniza con la cadena de transmisión que debe probar la persona gestionate, sin que exista duda al momento de creación de la reserva forestal el derecho de propiedad se había consolidado. Razón por la cual ha de tenerse por cumplido el requisito de fondo de la presente información posesoria. c. Respecto al tema de la posibilidad de los particulares de inscribir bienes cubiertos por bosques ubicados en terrenos no titulados, estima esta Sede considera que si es posible titular terrenos no inscritos con cobertura forestal dentro o fuera de áreas silvestres protegidas, siempre y cuando se hubieran cumplido los requisitos legales exigidos en los diversos cuerpos normativos aplicables, (al respecto se puede consultar la sentencia Nº 51 de las 15 horas 15 minutos del 26 de mayo de 1995 de la Sala Primera de la Corte Suprema de Justicia).

El numeral sétimo de la Ley de Informaciones Posesorias, fue modificado al emitirse la vigente Ley Forestal 7575, autorizó en forma expresa la titulación de bienes inmuebles boscosos mediante el presente trámite. Al respecto, esta Cámara ha resuelto lo siguiente: “Dicha norma, en lo referente a las propiedades con bosque, ubicadas fuera de las áreas silvestres protegidas, señala: "... Las fincas ubicadas fuera de esas áreas y que tengan bosques, sólo podrán ser tituladas si el promovente demuestra ser el titular de los derechos legales de posesión decenal, ejercida por lo menos durante diez años y haber protegido ese recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado y con cercas o carriles limpios." La constitucionalidad de dicha norma y de la interpretación dada en algún momento por este Tribunal fue cuestionada de constitucionalidad, gestión que generó la emisión del voto de la Sala Constitucional 4587-97, precisamente citado por la recurrente.

En dicho voto la Sala declaró la constitucionalidad de la norma, manteniendo su vigencia. Ante tal situación, lo procedente en este caso es confirmar lo resuelto por el Juzgador, al haber acreditado el promovente el cumplimiento de los requisitos que dispone ese artículo, a saber: la posesión decenal, protección del recurso natural y la delimitación del inmueble mediante cercas o carriles limpios”, (Tribunal Agrario, sentencia número 573-F-09). De igual forma, la Sala Constitucional de la Corte Suprema de Justicia rechazó nuevamente la consulta de constitucionalidad contra el artículo sétimo de la Ley de Informaciones Posesorias realizada por este Tribunal, bajo expediente EXPN1, quedando vigente tal norma y sus efectos. d. Por último, se considera que la posesión ejercida no violenta las normas de la legislación agroambiental de nuestro país. En el reconocimiento judicial, específicamente sobre la protección de las zonas adyacentes a los afluentes se destaca en el archivo 5, la descripción del río Pedregoso, el cual se observó con buena delimitación y está protegido con árboles de roble, ciprés y naturaleza del lugar.

En el registro número 11, se describe sobre la quebrada sin nombre. Se explicó, es un accidente geográfico de la propiedad, atraviesa la propiedad entre el [Dirección6] , nace en el terreno, es de poco afluente, el relieve es quebrado, en relación con la cobertura boscosa, hay una extensión entre cinco a diez metros a cada lado, en donde se notan árboles de gran altura y vegetación típica de la zona. De lo anterior se desprende existe cobertura boscosa apta para un accidente geográfico de tal naturaleza. Exigir una cobertura mayor a la relacionada es desproporcionado y un obstáculo innecesario para que la persona justiciable pueda titular. No se denota exista una lesión al ambiente y por tal razón es dable aprobar la información posesoria.

POR TANTO:

Se revoca la sentencia venida en alzada. En su lugar, se rechazan las presentes diligencias de información posesoria promovidas por [Nombre1] . Hay voto salvado de la jueza Díaz Bolaños.
