Segundo Circuito Judicial de San José, Anexo A, Goicoechea, at eight fifteen in the morning on ocho de diciembre del dos mil veintiuno.- This Court, acting as the improper hierarchical authority (jerarca impropio), hears the municipal appeal filed by Grupo Mutual La Vivienda de Ahorro y Préstamo, legal entity identification number CED9125, represented by its general manager, Mr. Oscar Alvarado Bogantes, identity card number CED83858, against ruling No. AMSRH-1101-2020 issued by Nombre20665 of San Rafael de Heredia at 9:00 hours on 20 de octubre del 2020.

WHEREAS:

I.Subject matter of this proceeding. The ruling issued by Nombre20665 of San Rafael de Heredia at 9:00 hours on 20 de octubre del 2020 upheld ruling No. P-594-2020 of 6 de agosto de 2020, issued by the Business Licensing Unit (Unidad de Patentes), which denied the “motion for review” (recurso de revisión) filed by Grupo Mutual La Vivienda de Ahorro y Préstamo against ruling No. RESO-P-335-2020, issued at 9:00 hours on 5 de mayo del 2020, which notified that entity that, because it conducted profit-making activities (actividades lucrativas), it was required to obtain a business license (licencia comercial) pursuant to the Ley de Patentes y Licencias Municipales del Cantón de San Rafael de Heredia” -Ley 9713-. Throughout the entire chain of appeals, up to and including this appeal before an improper hierarchical authority, the appellant has challenged the local authorities’ decisions on the same line of argument, asserting that, without any justification, Article 75 of the Ley del Sistema Financiero Nacional para la Vivienda and Article 6 of the Reglamento Beneficios y Exenciones Fiscales Sistema Bancario Nacional were not applied, thereby disregarding the entity-based exemption (exención subjetiva) established therein by reason of the purpose to which it is devoted.

It argues that the fundamental characteristic of mutual associations is the absence of profit, as provided by the applicable regulations, because any resources generated by their activities must necessarily be reinvested and used for the entity’s purposes, which are directed toward addressing the country’s existing housing problem. It considers this to constitute objective profit (lucro objetivo), given that it must not operate at a loss and must not distribute profits. In support of this position, it invokes judgments No. 257-2005 of the Tribunal Contencioso Administrativo, 274-P-2019 of the Tribunal Fiscal Administrativo, and 1552-2020 of the Sala Primera de la Corte Suprema de Justicia, as well as opinion No. C-185-2019 of the Procuraduría General de la República. On that basis, it maintains that Article 1 of the Ley de Patentes de la Municipalidad de San Rafael does not establish a new tax through its historical amendments, but merely constitutes an amendment, because the tax already existed under the prior Law No. 7363.

It maintains that the current wording of Article 1, subsection t), does not identify a taxed activity but rather a subject, “mutual associations,” which is exempt for the reasons stated. Based on these arguments, it alleges a failure by the local authorities to provide reasons. Regarding the procedure followed, it adds that its motion for review should have been decided by the Mayor rather than the Business Licensing Unit, which it considers an additional ground for nullity (nulidad).

II.Regarding the alleged formal defects (vicios formales). Pursuant to section 172 of the Código Municipal, an extraordinary motion for review (recurso extraordinario de revisión) filed against acts issued by bodies subordinate to the Mayor must be heard and decided by that same hierarchical authority. In these proceedings, that motion was first addressed by the Business Licensing Unit and was subsequently referred on appeal to Nombre20665. The purpose of the cited provision is to enable the hierarchical authority, through extraordinary review, to examine the actions of the subordinate body and, where appropriate, decide the allegations of nullity submitted to it. In this case, this Chamber finds that the appellant’s right to appeal was guaranteed and that it benefited from additional levels of review of the actions taken, because it obtained decisions from both the aforementioned unit and the Mayor, thereby achieving the same purpose contemplated in section 172.

The alleged defect cannot be sustained because, under our legal system, there can be no nullity without prejudice or harm, in accordance with the doctrine developed in section 223 of the LGAP, since the alleged procedural defect instead afforded the party an additional level of review. Nor is the alleged defect consisting of a failure to provide reasons evident, because a reading of the Mayor’s act, reviewed by this Chamber in these proceedings, reveals a statement rejecting the appellant’s position on the grounds that the financial services provided by the Mutual are profit-making activities subject to taxation under the local business licensing law -Ley 9713-. That statement construes Article 69 of Ley 7052 as containing a general exemption (exoneración genérica) in favor of the Mutual for financial transactions that do not generate profit because they are directly related to housing financing.

The fact that this position is inconsistent with the theory advanced by the appellant does not mean that the act lacks reasons, as alleged in the appellate pleading. Accordingly, the alleged failure to state reasons cannot be sustained, and it is necessary to proceed to a substantive analysis of the appellant’s arguments, as undertaken in the following recitals (Considerandos).

III.Regarding the taxable event (hecho generador) applicable to business licenses. The power of taxation (potestad tributaria) is the State’s authority to coercively obtain from the taxpayer’s private assets a certain amount of wealth to finance public expenditures, and the taxable person (sujeto pasivo) is the person upon whom the Law imposes obligations and who is subject to the State’s sovereign authority. From this perspective, in very general terms, the taxpayer (contribuyente) is the person with respect to whom the taxable event giving rise to the tax obligation (obligación tributaria) occurs. The obligations assumed by taxpayers consist principally of paying the tax arising from substantive tax obligations (obligaciones tributarias sustanciales), and the source of the tax obligation is the taxable event, which may arise only by operation of law, as follows from subsection 13) of Article 121 of the Constitución Política and Article 5 of the Código de Normas y Procedimientos Tributarios. With respect to local taxation, Article 88 of the Código Municipal establishes a tax on the conduct of any profit-making activity (the taxable event), expressly providing as follows:

“Article 88- To conduct any profit-making activity, interested parties must hold the corresponding municipal license, which shall be obtained through the payment of a tax. That tax shall be paid throughout the entire period during which the profit-making activity was conducted or for the period during which the license was held, even if the activity was not conducted.” The text of the provision clearly identifies the taxable person and the taxable event; accordingly, every person who conducts profit-making activities is required to obtain the license and pay the corresponding amount. That license consists of prior permission or authorization (habilitación previa) from local governments to conduct the desired line of business. Conversely, no one may conduct a profit-making activity without having obtained the municipal license and paid the corresponding business-license tax (patente). In the same vein, the Ley Patentes y Licencias Municipales del Cantón de San Rafael de Heredia -Ley No.9713 de 4 de diciembre del 2019- provides that all profit-making activities conducted in that canton are subject to that tax, as follows:

ARTICLE 1- Mandatory nature and taxable event of the tax The Municipalidad de San Rafael is authorized to grant business licenses within the canton’s jurisdiction. Before granting a business license, the Municipality shall verify compliance with the requirements established in this Law and its regulations and, as an initial premise, respect for the environmental protection enshrined in Article 50 of the Constitución Política.

The conduct of any profit-making activity in the canton of San Rafael de Heredia requires the interested party to pay the corresponding tax. The taxable event is the conduct of any type of profit-making activity:

IV.Regarding the existence of the taxable event in this case. The appellant challenges the grounds for denial stated by Nombre20665 based on the theory that its activity produces objective profit and that it is therefore not subject to the tax, as though the taxable event were absent and the matter therefore involved a case of non-liability (no sujeción). First, it is true that all activities that section 75 of the Ley del Sistema Financiero Nacional para la Vivienda -Ley 7052- authorizes the mutual system to conduct are directed toward the same purpose pursued by that system, namely, providing housing to the country’s population. This proposition is correct, particularly because what the appellant has termed objective profit is indeed generated. Although the Mutual’s statutory purpose is related to a service of public interest, and although section 68 of that body of law provides that it operates on a nonprofit basis because it has a specific mission within the national financial sector, that statutory provision is inconsistent with and far removed from reality, because the financial intermediation it conducts is inherently profit-making, notwithstanding the ultimate, legally prescribed use of its returns.

Because this matter concerns taxation, the principles of tax law must guide every interpretation of the applicable provisions, with the economic-reality principle (principio de realidad económica) being predominant in this case. It must therefore be clearly understood that the taxable event for the business-license tax is entirely unrelated to the founding purposes of any legal entity. Thus, regardless of an organization’s objectives, pursuant to section 88 of the Código Municipal and Ley 7052, the mere conduct of profit-making activities places it within the factual circumstances prescribed by Law and compels it to pay the tax. Whether or not the person has a profit-making purpose is irrelevant to the tax provision; the taxable event requires a purely objective interpretation, such that the presence of a profit-making activity—that is, one that generates earnings—triggers the obligation to pay the tax.

This Chamber therefore finds that the taxable event required by Article 88 of the Código Municipal and the Ley Patentes y Licencias Municipales del Cantón de San Rafael de Heredia -Ley No.9713 de 4 de diciembre del 2019- is present in this case, because the appellant conducts a commercial business (giro mercantil) that generates wealth. The grounds of appeal asserted by the Mutual in an effort to deny that it generates profit are confined to a line of argument based on a legislative construct aimed at obtaining other benefits and on the legally prescribed use of its earnings.

V.Regarding the tax exemption (exención tributaria). Without undertaking any further analysis, the statement of grounds for appeal (libelo de agravios) requests a declaration that an exemption (exoneración) exists in favor of the appellant. In this regard, it must be clarified that the exemption regime (régimen de exoneraciones) is also subject to the principle that it may be established only by statute (reserva de ley), through which tax benefits are created as exceptions to the application of taxes, intended either to prevent the tax obligation (obligación tributaria) from arising—a total exemption—or to reduce the amount of the tax—a partial exemption—through credits or deductions in certain factual circumstances falling within the scope of the taxable event (hecho imponible), the occurrence of which does not give rise to the tax payment obligation, thus constituting an exception to the normal effects arising from the occurrence of that event.

The tax-exemption rule has the force to negate the effects of the rule creating the tax because it affects either the subjective or objective element of the taxable event or the elements used to quantify the tax, that is, the taxable base (base imponible) (deductions and reductions) or the tax rate (tipo de gravamen). The classical theory of exemption defines exemptions as a statutory dispensation from the tax obligation, that is, as a derogation from the payment obligation even though the chargeable event (hecho generador) occurs—which is the effect they produce—whether by exempting certain persons from the obligation to contribute to public expenditures (subjective exemption) or by exempting certain situations or events (objective exemption). Thus, a tax exemption occurs when a provision establishes that, in the circumstances expressly contemplated therein, even though the taxable event occurs, its principal effect does not arise: the duty to pay the tax or tax obligation.

Quite recently, the issue of municipal exemptions in favor of other types of nonprofit organizations, such as cooperatives, was addressed by the Sala Primera de la Corte Suprema de Justicia in judgment No. 001970-F-S1-2020 of eleven o’clock on tres de junio de dos mil veinte, which recognized the existence of a general subjective exemption contained in the Ley de Asociaciones Cooperativas, artículo 6 inciso b). In applying that legislation, Sala Primera held that any commercial business-license tax enacted after that Law entered into force is taxable. In this regard, the judgment states:

“IV.- For this Chamber, it is undeniable that the IPM created by Ley 8821 del 3 de mayo de 2010 is a tax subsequent to the general exemption created by mandate 6 inciso b) de la Ley 4179. Although Ley 4179, in the provision just cited, establishes an exemption from every national or municipal tax or fee on acts of formation, registration, amendment of bylaws, and other requirements for operation, which clearly includes the payment of business-license fees because it is an indispensable requirement for the operation of a cooperative engaged in a productive activity, it is clear that, pursuant to the amendment made by canon 50 de la Ley 7293 to provision 63 del CNPT, tax exemptions may not be extended to taxes created subsequently. Accordingly, it is beyond dispute that the productive activities carried out by the plaintiff are subject to payment of the IPM of the defendant Municipality, pursuant to ordinal 45 de la Ley 8821, because it is a municipal tax created after the exempting provision established in artículo 6 inciso de la Ley 4179.

Consequently, the exemption referred to by the Tribunal in its ruling does not exist, and the claim of error must therefore be upheld.” Respecting and following the reasoning set forth by Sala Primera, the interpretation to be given to ordinal 69 de la Ley del Sistema Financiero Nacional para la Vivienda, which provides that mutual associations “shall enjoy exemption from taxes of every kind, present and future,” and to artículo 1 de la Ley 9713 de 4 de diciembre del 2019 differs from that advanced by the appellant, because it requires application of the more recent provision. Furthermore, a reading of the now-repealed Ley de Impuestos Municipales de San Rafael de Heredia, Ley 7362 de 26 de noviembre de 1993—which is the statute preceding ley 9713—shows that it did not provide in any way that the activities of mutual associations were exempt from the business-license tax, whereas ordinal 1 de la ley vigente did add and specify this.

We are therefore faced with a new tax that repeals, specifically for the particular case of the cantón de San Rafael de Heredia, the subjective exemption provided for in ordinal 69 de la Ley del Sistema Financiero Nacional para la Vivienda. Moreover, even though inciso h del ordinal 1 de la Ley 9713 refers to “mutuales,” it must properly be understood that the activities of those financial institutions were expressly taxed as of the entry into force of that provision. Regrettably, in seeking the exemption, the appellant cites provisions, case law from Sala I and this Tribunal, and opinions of the Procuraduría General de la República that predate the entry into force of Ley 9713, none of which addresses a conflict such as the one presented on this occasion. It is further noted that the judgment of Sala I, No. 1552-2020, cited in the appellate brief, bears not even a remote resemblance to the text transcribed.

Under this interpretation, the municipal-license tax in the cantón de San Rafael de Heredia does apply to the appellant Mutual. Accordingly, the claim that a tax exemption exists is likewise unfounded, given the economic and profit-making activity conducted by the appellant in that canton, which is subject to the tax arising from the commercial license. This leads to the conclusion that this claim must be rejected.

VI.Conclusion. Based on the grounds set forth above, none of the claims raised by the appellant is well-founded. With the adjustments stated regarding the nature and occurrence of the chargeable event for the tax in question, the decision issued by Nombre20665 de San Rafael de Heredia in the resolution under appeal must be affirmed insofar as it subjects the appellant to payment of the commercial-license tax. The appeal must be denied and, because no further appeal is available, the administrative remedies (vía administrativa) must be deemed exhausted.

VII.Because these proceedings were conducted electronically, the parties may obtain a complete copy containing both the administrative case file (expediente administrativo) submitted by the Corporación Municipal and all documents comprising this appeal, for which purpose they must provide an electronic storage device (USB flash drive or compact disc). Likewise, if any physical or electronic documentation (plans, photographs, reports, etc.) was submitted and remains in the custody of the Court, the person who submitted it may retrieve it within 30 business days, in accordance with artículo 12 del Reglamento sobre Expediente Electrónico ante el Poder Judicial, approved by the Corte Plena in sesión n.° 27-11 del 22 de agosto del 2011, artículo XXVI and published in the Boletín Judicial n.° 19 del 26 de enero del 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in sesión n.° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

THEREFORE

The appeal filed is denied, the challenged resolution is affirmed, and the administrative remedies are deemed exhausted.

CONSIDERANDO:

I.Objeto de la presente causa. En la resolución del Nombre20665 de San Rafael de Heredia, de las 9:00 horas del 20 de octubre del 2020, se confirmó la resolución No. P-594-2020 del 6 de agosto de 2020, emitida por la Unidad de Patentes, según la cual se rechazó el “recurso de revisión” que interpuso Grupo Mutual La Vivienda de Ahorro y Préstamo, contra la resolución No. RESO-P-335-2020 de las 9:00 horas del 5 de mayo del 2020, la cual comunicó a dicha entidad que, por realizar actividades lucrativas, estaba en el deber de obtener licencia comercial, a la luz de la Ley de Patentes y Licencias Municipales del Cantón de San Rafael de Heredia” -Ley 9713-. Durante toda la cadena recursiva, hasta el presente recurso en jerarquía impropia, la apelante ha impugnado lo resuelto por las autoridades locales bajo una misma línea argumentativa, reclamando que, sin ningún argumento, se ha desaplicado el artículo 75 de la Ley del Sistema Financiero Nacional para la Vivienda y el artículo 6 del Reglamento Beneficios y Exenciones Fiscales Sistema Bancario Nacional, obviando la exención subjetiva allí creada en razón de la finalidad a la que se dedica.

Alega que la característica fundamental de las mutuales es la ausencia de lucro pues así lo dispone la normativa, puesto que cualquier recurso que genere su actividad debe necesariamente reinvertirse y utilizarse en las finalidades de la entidad, dirigido a procurar la solución del problema habitacional existente en el país, lo cual estima es un lucro objetivo, dado que no debe operar con pérdidas y tampoco debe distribuir utilidades. Invoca al efecto, las sentencias No. 257-2005 del Tribunal Contencioso Administrativo, 274-P-2019 del Tribunal Fiscal Administrativo y 1552-2020 de la Sala Primera de la Corte Suprema de Justicia, así como en el dictamen de la Procuraduría General de la República No. C-185-2019, para con base en ello sostener que el artículo 1 de la Ley de Patentes de la Municipalidad de San Rafael no establece un tributo nuevo a través de sus modificaciones históricas, sino únicamente una reforma, pues ya existía en la Ley anterior No. 7363.

Sostiene que el actual texto normativo en el artículo 1, inciso t) no enuncia una actividad gravada, sino un sujeto “mutuales”, el cual se encuentra exento por las razones indicadas. De estos argumentos, acusa falta de fundamentación por parte de las autoridades locales. En cuanto al trámite seguido, añade que la Unidad de Patentes no debió resolver su recurso de revisión, sino el Alcalde, lo cual estima es una causa de nulidad adicional.

II.Sobre los vicios formales acusados. De conformidad con el ordinal 172 del Código Municipal, el recurso extraordinario de revisión que se interpone en contra de los actos emanados de órganos inferiores al Alcalde, debe ser conocido y resuelto por este mismo jerarca. En los autos, dicho recurso fue atendido primeramente por la Unidad de Patentes, para posteriormente subir en alzada para ante el Nombre20665. La finalidad de la norma de cita radica en que el jerarca pueda atender mediante el extraordinario de revisión lo actuado por el inferior y, de ser procedente, resuelva los alegatos de nulidad que se le presenten. En esta causa, a criterio de esta Cámara se garantizó a la parte apelante su derecho de recurrir y se vio beneficiada con más instancias revisoras de lo actuado, pues obtuvo pronunciamiento tanto de la citada unidad como del Alcalde, alcanzando de esa forma la misma finalidad prevista en el ordinal 172.

El vicio acusado no es de recibo, dado que no procede en nuestro sistema la nulidad sin agravio, sin lesión, conforme a la doctrina desarrollada el ordinal 223 de la LGAP, puesto que el supuesto vicio procesal alegado más bien le garantizó a la parte una adicional instancia revisora. No se evidencia tampoco, el vicio por falta de fundamentación expuesto, ya que de la lectura del acto del Alcalde, revisado en esta vía por esta Cámara, se denota una exposición que rechaza la tesis de la recurrente, en el sentido que los servicios financieros que brinda la Mutual que son actividad lucrativa, se encuentran gravados conforme a la ley de patentes local -Ley 9713-, entendiendo que la Ley 7052, artículo 69, contiene una exoneración genérica a favor de la mutual derivada de las operaciones financieras que no le generen lucro por estar directamente relacionadas con el financiamiento de viviendas. El hecho de que dicha posición no sea compartida con la tesis desarrollada por la apelante, no quiere decir que el acto sea ayuno de fundamentación, en los términos alegados en el libelo recursivo.

Por tal razón el vicio de falta de motivación no es de recibo, siendo menester entrar al análisis de fondo de los argumentos expresados por la parte recurrente, tal y como se procede en los Considerandos siguientes.

III.Sobre el hecho generador en materia de licencias comerciales. La potestad tributaria es aquella facultad del Estado de obtener coactivamente de la esfera privada del contribuyente cierta cantidad de riqueza para financiar gastos públicos, y el sujeto pasivo es aquel al que la Ley le impone obligaciones y corresponde a quien se encuentra sometido a la potestad de imperio del Estado. Desde esta perspectiva, en términos muy generales el contribuyente viene a ser aquella persona respecto de la cual se verifica el hecho generador de la obligación tributaria. Las obligaciones que asumen los contribuyentes, consisten principalmente en la prestación del tributo de las obligaciones tributarias sustanciales, siendo la fuente de la obligación tributaria el hecho generador, el cual puede surgir únicamente por mandato de una ley, como derivado del inciso 13) artículo 121 de la Constitución Política y 5 del Código de Normas y Procedimientos Tributarios. En materia impositiva local, el artículo 88 del Código Municipal crea un impuesto sobre el ejercicio de cualquier actividad lucrativa (hecho generador), al disponer expresamente la norma:

"Artículo 88- Para ejercer cualquier actividad lucrativa, los interesados deberán contar con licencia municipal respectiva, la cual se obtendrá mediante el pago de un impuesto. Dicho impuesto se pagará durante todo el tiempo en que se haya ejercido la actividad lucrativa o por el tiempo que se haya poseído la licencia, aunque la actividad no se haya realizado." Del texto de la norma, se desprende con claridad quién es el sujeto pasivo de la obligación tributaria y cuál es el hecho generador, de modo que está obligado a obtener la licencia y pagar su respectivo importe, toda persona que ejerza actividades lucrativas. Esa licencia consiste en el permiso o habilitación previa por parte de los gobiernos locales para el ejercicio del giro económico deseado. En sentido contrario, se puede indicar que nadie puede ejercer actividad lucrativa, si no ha obtenido la licencia municipal ni ha pagado la respectiva patente. En ese mismo sentido, la Ley Patentes y Licencias Municipales del Cantón de San Rafael de Heredia -Ley No.9713 de 4 de diciembre del 2019-, dispone que se gravan con ese impuesto todas las actividades lucrativas que se desarrollen en dicho cantón, al disponer:

ARTÍCULO 1- Obligatoriedad y hecho generador del impuesto La Municipalidad de San Rafael está facultada para el otorgamiento de licencias comerciales en la jurisdicción del cantón. Previo al otorgamiento de una licencia comercial, la Municipalidad comprobará el cumplimiento de los requisitos establecidos en la presente ley y su reglamento y, como premisa inicial, el respeto a la protección ambiental consagrada en el artículo 50 de la Constitución Política.

El ejercicio de cualquier actividad lucrativa en el cantón de San Rafael de Heredia obliga al interesado a pagar el impuesto respectivo. El hecho generador del impuesto es el ejercicio de cualquier tipo de actividad lucrativa:

…

  • t)Mutuales.

...

IV.Sobre la existencia del hecho generador en la presente causa. La parte apelante objeta los motivos de denegatoria expresados por el Nombre20665 sobre la base de la tesis que su actividad le produce un lucro objetivo y por ello no se encuentre gravada, cual si se tratare de una ausencia de hecho generador, de modo que se trataría de un supuesto de no sujeción. Primeramente, es cierto que toda la actividad que le autoriza brinda el ordinal 75 de la Ley del Sistema Financiero Nacional para la Vivienda -Ley 7052- al sistema mutual está dirigida para el mismo fin que persigue, relacionado con la dotación de vivienda a la población nacional. Esta tesis es correcta, más aún cuando se trate de lo que ha denominado la parte lucro objetivo, éste sí se produce. Si bien la finalidad legal de la Mutual está relacionada con un servicio de interés público y aún cuando el ordinal 68 de dicho cuerpo normativo dispone que carece de fines de lucro por tener un norte específico dentro del sector financiero nacional, tal previsión legal resulta incongruente y lejana de la realidad, pues la labor de intermediación financiera que realiza es, por excelencia, lucrativa, a pesar del destino final y legal de sus rentabilidades.

Dado que estamos en presencia de materia tributaria, son sus principios el norte que integra toda interpretación normativa, predominando para esta causa, el principio de realidad económica. Por ello, debe estarse claro en el sentido de que el hecho generador de la patente comercial, es totalmente ajeno a los fines constitutivos de cualquier persona jurídica, de modo que indistintamente de las metas de la agrupación, conforme lo dispone el numeral 88 del Código Municipal y la Ley 7052, es el mero ejercicio de actividades lucrativas el que le hace incurrir en la situación de hecho prevista en la Ley para que se vea compelida a honrar el tributo. A la norma tributaria le es ajena que la persona tenga o no fines de lucro, el hecho generador requiere de una lectura meramente objetiva, de modo que, ante la presencia de una actividad lucrativa, o sea, que produzca ganancias, se impone el pago del tributo.

Por ello, es criterio de esta Cámara que, en la presente causa, sí estamos en presencia del hecho generador que exige el artículo 88 del Código Municipal y la Ley Patentes y Licencias Municipales del Cantón de San Rafael de Heredia -Ley No.9713 de 4 de diciembre del 2019-, pues la recurrente tiene un giro mercantil que es generador de riqueza. Los agravios expresados por la Mutual, tendientes a desmentir el lucro que produce, se limitan a la exposición de una línea argumentativa que se sostiene sobre la base de una creación legislativa que está dirigida a la consecución de otros beneficios y el destino de sus ganancias que están expresamente contenidos en la Ley.

V.Sobre la exención tributaria. Sin hacer un mayor análisis, el libelo de agravios solicita se declare la existencia de una exoneración a favor de la apelante. Al respecto, debe aclararse que el régimen de exoneraciones también es reserva de ley, mediante la cual se crean beneficios fiscales que son excepciones a la aplicación de los tributos con las cuales se busca impedir el nacimiento de la obligación tributaria -exención total-, o reducir la cuantía del tributo -exención parcial-, a través de bonificaciones o deducciones ante ciertos supuestos de hecho incluidos en el ámbito del hecho imponible cuya realización no da lugar al surgimiento de la obligación tributaria de pago, constituyendo una excepción a los efectos normales derivados de la realización de aquel. La norma de exención del tributo tiene la fuerza de enervar los efectos de la que lo crea, pues afecta, o al elemento subjetivo u objetivo del hecho imponible, o los elementos de cuantificación del tributo, o sea, en la base imponible (deducciones y reducciones) o en el tipo de gravamen.

La teoría clásica de la exención define las exoneraciones como una dispensa legal de la obligación tributaria, sea como una derogación de la obligación de pago, no obstante producirse el hecho generador, que es el efecto que producen, sea la excepción de la obligación de contribuir con los gastos públicos determinados sujetos (exoneración subjetiva), o a determinadas situaciones o hechos (exoneración objetiva). Así, la exención tributaria tiene lugar cuando una norma contempla que, en aquellos supuestos expresamente previstos por ella, no obstante producirse el hecho imponible, no se desarrolla su efecto principal: el deber de pagar el tributo u obligación tributaria. De data bastante reciente, el tema de las exoneraciones municipales a favor de otro tipo de organizaciones sin fines de lucro, como son las cooperativas, fue atendido por la Sala Primera de la Corte Suprema de Justicia, en sentencia No. 001970-F-S1-2020 de las once horas del tres de junio de dos mil veinte, que reconoció la existencia de una exoneración genérica subjetiva contenida en la Ley de Asociaciones Cooperativas, artículo 6 inciso b).

En aplicación de dicha normativa, la Sala Primera se pronunció en el sentido que resulta imponible todo impuesto de patente comercial creado con posterioridad a la vigencia de dicha Ley. Al respecto, dice la sentencia:

“IV.- Para esta Cámara resulta innegable, la existencia del IPM creado por la Ley 8821 del 3 de mayo de 2010, es un tributo posterior a la exoneración genérica creada por el mandato 6 inciso b) de la Ley 4179. Si bien la Ley 4179 en la norma recién citada establece la exención de todo impuesto o tasa, nacional o municipal, sobre los actos de formación, inscripción, modificación de estatutos y demás requisitos para su funcionamiento, lo cual claramente incluye el pago de patentes, por tratarse de un requisito ineludible para el funcionamiento de una cooperativa que realiza una actividad productiva, es claro, que conforme a la reforma realizada mediante el canon 50 de la Ley 7293 al precepto 63 del CNPT, las exenciones tributarias no pueden ser extendidas a los tributos que sean creados con posterioridad. Así las cosas, es inobjetable, las actividades productivas generadas por la actora se encuentran sujetas al pago del IPM del Ayuntamiento demandado, conforme al ordinal 45 de la Ley 8821, pues se trata de un impuesto municipal creado con posterioridad a la norma exonerativa establecida en el artículo 6 inciso de la Ley 4179.

De consiguiente, no existe la exoneración a la cual alude el Tribunal en su fallo, de ahí que el cargo deba ser acogido.” Respetando y siguiendo el argumento expuesto por Sala Primera, la interpretación que debe darse del ordinal 69 de la Ley del Sistema Financiero Nacional para la Vivienda que dicta que las mutuales “gozarán de exención, de tributos de toda clase, presentes y futuros”, y el artículo 1 de la Ley 9713 de 4 de diciembre del 2019 es diferente a la que sustenta la parte apelante, pues impone la aplicación de la norma más reciente. Además, al darse lectura de la hoy derogada Ley de Impuestos Municipales de San Rafael de Heredia, Ley 7362 de 26 de noviembre de 1993-, que es el cuerpo legal anterior a la ley 9713-, no se previó de forma alguna que la actividad de las mutuales estuviera exenta del impuesto por concepto de patente, lo cual sí añadió y especificó en el ordinal 1 de la ley vigente.

Por ello, sí estamos en presencia de un impuesto nuevo que deroga, específicamente para el caso concreto del cantón de San Rafael de Heredia, la exoneración subjetiva prevista en el ordinal 69 de la Ley del Sistema Financiero Nacional para la Vivienda. Además, aún y cuando el inciso h del ordinal 1 de la Ley 9713 se refiera a “mutuales”, debe entenderse correctamente que se gravó expresamente la actividad de dichas entidades financieras, a partir de la entrada en vigencia de esta norma. Lamentablemente, la parte recurrente cita para alcanzar la exoneración, normas, jurisprudencia de la Sala I y de este Tribunal, así como dictámenes de la Procuraduría General de la República, los cuales son anteriores a la entrada en vigencia de la Ley 9713 y ninguno de ellos desarrolla algún conflicto como el que se conoce en esta ocasión. Se advierte, por demás, que la sentencia de Sala I, No. 1552-2020 citada en el libelo recursivo, no corresponde ni por asomo al texto transcrito.

Bajo esta inteligencia, el impuesto por concepto de licencia municipal en el cantón de San Rafael de Heredia, sí le resulta aplicable a la Mutual recurrente. Por ende, el agravio que reclama la existencia de la exención tributaria, tampoco es de recibo, debido a la actividad económica y lucrativa que la apelante despliega en ese cantón, quedando gravada por el impuesto derivado de la licencia comercial. Ello lleva a concluir que este agravio debe ser rechazado.

VI.Corolario. Con base en los fundamentos expuestos, ninguno de los agravios expresados por la parte apelante es de recibo, estimándose que, con los ajustes expuestos en cuanto a la naturaleza y producción del hecho generador del impuesto de cita, lo resuelto por el Nombre20665 de San Rafael de Heredia en la resolución venida en alzada debe ser confirmado en el tanto somete a la apelante al pago del impuesto por concepto de licencia comercial. Deberá declararse sin lugar el recurso de apelación y, ante la inexistencia de recurso ulterior, se ha de dar por agotada la vía administrativa.

VII.Al haberse sustanciado esta sede en forma electrónica, queda a disposición de las partes obtener una copia integral que contiene tanto el expediente administrativo remitido por la Corporación Municipal así como la totalidad de las piezas que conforman la presente alzada, para lo cual deberá aportar el dispositivo electrónico de almacenamiento (llave maya o disco compacto). Asimismo, en caso que hubiere ingresado documentación física o electrónica (planos, fotografías, informes, etc) que permanezca aún en custodia el Despacho, podrá retirarla quien la aportó en un plazo de 30 días hábiles, de conformidad con lo dispuesto en el artículo 12 del Reglamento sobre Expediente Electrónico ante el Poder Judicial, aprobado por la Corte Plena en sesión n.° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial n.° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión n.° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO

Se declara sin lugar el recurso de apelación interpuesto, se confirma la resolución impugnada y se da por agotada la vía administrativa.
