Civil Treasury Proceeding instituted by attorney Álvaro Meza Lázarus, acting as Special Judicial Attorney-in-Fact (Apoderado Especial Judicial) for Grupo de Inversiones Rajpal S.A., corporate identification number CED88921, represented by Mr. Nombre47457, passport No. Placa20202, against the State, represented by attorney Silvia Quesada Casares, bar card Placa20206; the Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica, hereinafter Nombre415, represented by attorney Karla Mora Rivera, bar card 24511; and the Sistema Nacional de Áreas de Conservación, hereinafter SINAC, represented by attorney Magdalena Melegatti Pereira, bar card Placa20207. BACKGROUND:
I.The plaintiff company’s representative instituted a Civil Treasury Proceeding on 14 de agosto de 2013. Its claims were specified at the preliminary hearing, which was held in two sessions on 13 y 21 de febrero de 2020, seeking a judgment declaring: a. That the properties in the Limón Registry District (Partido de Limón), real-property folio registration numbers Placa20208, Placa20209, and Placa20210, entered the private ownership of their original owners in 1971, when the possessory title proceedings (informaciones posesorias) for each of them were approved with the consent of Nombre415 and without opposition from the then ITCO, IDA, now INDER, or the Procuraduría General de la República. b. That the properties in the Limón Registry District, real-property folio registration numbers Placa20208, Placa20209, and Placa20210, were acquired by the company represented by counsel under the protection of good faith in the public registry (buena fe registral) and in its capacity as a registered third party (tercero registral); consequently, such property is not subject to limitations and is protected by the constitutional provisions establishing that, before it may be annulled or the owner dispossessed, it must first be expropriated upon payment of its market value. c. That the property right of the company represented by counsel has been deprived of all substance and rendered ineffective because Nombre28548, MINAET, and Nombre415 prevented it from exercising full ownership over its real property, since it was denied the right to receive income under the “Pago por Servicios Ambientales.” d. That the State compensate the company represented by counsel for the damages (daños y perjuicios) caused by denying it the opportunity to obtain an economic benefit from the “Pago por Servicios Ambientales” program during 2010, 2011, 2012 y 2013, taking into account the amount paid per hectare for those services. e. That although INVERSIONES RAJPAL S.A. was incorporated in Costa Rica, it directly or indirectly has Canadian shareholders, such as Mr.
Nombre47457; therefore, the agreement signed between Costa Rica and Canadá on 18 de marzo de 1998 must be applied to the expropriation and to any other compensation to be determined. f. That because the properties were affected by the Sistema Nacional de Áreas de Conservación, Minaet, and Nombre415, the State must expropriate them and pay their market value within a reasonable period not exceeding three months from the date judgment is issued, which value may not be less than 100 million colones, indexed as of the date of judgment. g. That the State or, failing that, Nombre415 must make payment because the property of the company represented by counsel has been deprived of its substance. h. That the defendants be held jointly and severally liable for attorneys’ fees and costs (ambas costas). (See images 99 to 116 and 155 to 159 of the court case file).
II.By order entered at 10:04 hours on 06 de setiembre del año 2013, the complaint was served on the State and Nombre415. (See images 264 to 266 of the digital court case file).
III.By a filing received on 01 de noviembre de 2013, Nombre415’s representative denied the complaint and raised the defenses (excepciones) of failure to join SINAC as a necessary defendant (litis consorcio pasivo necesario) and absence of a legal right (falta de derecho). (See images 276 to 299 of the digital court case file).
IV.By a filing received on 14 de noviembre de 2013, the State’s representative denied the complaint and raised in its defense the defenses of failure to join a necessary defendant and absence of a legal right. In addition, it filed a counterclaim against Grupo de Inversiones Rajpal S.A., corporate identification number CED88921; Nombre112356; Mis Dos Amores S.A.; and Dalanyo S.A., requesting the following: 1. That the possessory title proceeding processed under case file number 1721 del año 1970 of the Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda be declared null and void, and that the judgment issued by that court at seventeen hours on nueve de mayo de mil novecientos setenta y dos be annulled. 2. That entry 1 of volume 2098, folio 457, for property number 14718 in the Province of Limón, under which that property was registered in the name of Nombre112356, be declared null and void, and that cancellation of the registration of property number 14718 in the Province of Limón be ordered. 3.
That entry 2 of Volume 2098, Folio 457, for property number 14718 in the Province of Limón, under which that property was registered in the name of Mis Dos Amores, S.A., be declared null and void, and that its cancellation be ordered. 4. That entry 3 of Volume 2098, Folio 457, for property number 14718 in the Province of Limón, under which part of that property was registered in the name of Dalanyo S.A., be declared null and void, and that its cancellation be ordered. 5. That the registration of property number 14718-000 in the Limón Registry District in favor of Inversiones Rajpal, S.A., entry 14340, volume 362 of the Registro Inmobiliario, be declared null and void. 6. That the registration of property number 16370 in the Limón Registry District in favor of Dalanyo S.A., entries 1 through 6, volumes 333 and 346 of the Registro Inmobiliario, be declared null and void. 7. That the defendants be held jointly and severally liable for the attorneys’ fees and costs of this counterclaim, as well as the interest accruing thereon until paid in full. V.By order entered at 09:04 hours on 15 de enero de 2014, the plaintiff company was served with the answers to the complaint and the defenses raised by Nombre415 and the State, and the plaintiff, Mr. Nombre112356, Mis Dos Amores S.A., and Dalanyo S.A. were served with the counterclaim. (See images 567 and 568 of the digital court case file).
VI.By a filing received on 18 de febrero de 2014, the representative of Grupo de Inversiones Rajpal S.A. denied the counterclaim and raised in its defense the defenses of improper representation (indebida representación), lack of standing as defendant and plaintiff (falta de legitimación pasiva y activa), and absence of a legal right. (See images 596 to 600 of the digital court case file).
VII.By order No. 3024-2014 entered at 08 hours on 17 de noviembre de 2014, the defense of failure to join all necessary parties (falta de integración de la litis) was sustained, and the Sistema Nacional de Áreas de Conservación (SINAC) was joined as a defendant. (See images 637 to 642 of the digital court case file).
VIII.By order entered at 08:03 hours on 07 de enero del año 2015, the complaint was served on SINAC. (See images 719 and 720 of the digital court case file).
IX.By a filing received on 19 de febrero de 2015, SINAC’s representative denied the complaint and raised the defense of absence of a legal right. (See images 768 to 798 of the digital court case file).
X.By a filing received on 06 de enero de 2016, the court-appointed representative for Mr. Nombre112356 denied the counterclaim and raised in his defense the defenses of lack of standing as plaintiff and defendant; absence of a legal right; lapse of the claim (caducidad); and the statute of limitations (prescripción). (See images 918 to 922 of the digital court case file).
XI.By a filing dated 11 de agosto de 2016, the court-appointed representative for Mis Dos Amores S.A. also denied the allegations of the counterclaim and raised in its defense the defenses of lack of standing as plaintiff and defendant; absence of a legal right; and the statute of limitations. (See images 1000 to 1007 of the digital court case file).
XII.By a filing dated 15 de noviembre de 2016, the court-appointed representative for Dalanyo S.A. denied the counterclaim and raised in its defense the defense of failure to join all necessary parties. (See images 1044 to 1047 of the digital court case file).
XIII.By orders entered at 11:42 hours on 19 de diciembre de 2016 and at 13:00 hours on 01 de marzo de 2017, the State was granted a hearing regarding the answers to the counterclaim and the defenses raised by the representative of Grupo de Inversiones Rajpal S.A. and by the court-appointed representatives of Mr. Nombre112356, Mis Dos Amores S.A., and Dalanyo S.A. (See images 1056 and 1088 of the digital court case file).
XIV.By a filing received on 09 de enero de 2017, the State’s representative addressed the counterclaim defendants’ answers and the defenses raised. (See images 1059 to 1063 of the digital court case file).
XV.The preliminary hearing was held in two sessions on 13 y 21 de febrero de 2020, at which the claims in the complaint and counterclaim were specified in the terms indicated supra, the disputed facts were determined, and the evidence was admitted. After all stages had been completed, the matter was declared, pursuant to Article 98 of the CPCA, to present purely questions of law (asunto de puro derecho), and the parties submitted their closing arguments in writing. (See images 1155 to 1159 and 1173 to 1181 of the digital court case file).
XVI.The case file was assigned to the Court’s Fourth Section on dos de noviembre del dos mil veinte. This decision is issued following deliberation. No grounds for nullity capable of invalidating the proceedings are apparent.
Judge Salas Nombre112356 drafted the decision, with the affirmative votes of Judge Córdoba Ramírez and Judge Baltodano Gómez.
CONSIDERING:
The representative of the plaintiff company instituted a Civil Proceeding against the Treasury, requesting that the judgment declare that the properties registered in the Limón Registry District under Nos. 14660-000, 14718-000, and 14810-000 entered the private domain in 1971 through possessory title proceedings (información posesoria), with the consent of Nombre415 and without opposition from the then-existing ITCO or the Office of the Attorney General of the Republic. It alleged that its principal’s property right had been stripped of its substance and rendered ineffective because Nombre28548, MINAET, and Nombre415 prevented it from exercising full ownership over its properties by denying its right to receive income under the "Pago por Servicios Ambientales" program during 2010, 2011, 2012, and 2013, because the properties were affected by the National System of Conservation Areas. It alleged that, because the properties were acquired by its principal in reliance on good faith in the public registry (buena fe registral) and in its capacity as a registered third party (tercero registral), free of restrictions and protected by the constitutional provisions establishing that, before the ownership may be annulled or the owner dispossessed, the property must first be expropriated upon payment of its market value, the State must compensate it for the damages caused by denying it the opportunity to obtain an economic benefit from the payment for environmental services, taking into consideration the amount paid per hectare for those services.
Furthermore, because its property right has been stripped of its substance, the State or Nombre415 must expropriate the properties and pay their market value within a reasonable period not exceeding three months from the date judgment is issued, and that value may not be less than 100 million colones indexed for inflation. In summary, and without prejudice to the literal wording of their arguments, which this Court has reviewed in their entirety, each party alleges what is set forth below in this section. A) Regarding the facts: Possessory title proceedings were instituted in respect of the properties, which were registered beginning in 1971 under the following Limón Registry District real-property folio numbers: Placa20210, with an area of 271.001.023 mts2.; Placa20209, with an area of 27.193.019 Mts2, survey plan Placa20211; and No. Placa20212, with an area of 241.996.062 mts2, survey plan L-0001584-1971.
Neither the State, Japdeva, nor the then-existing ITCO opposed those proceedings, and the properties benefited from public notice through the registry (publicidad registral) for more than 30 years from the date of registration. Those properties were subsequently transferred by the applicants to Mis Dos Amores S.A., which obtained a loan from Inversiones Rajpal S.A. Following the debtor’s default, on 03 de febrero de 1988 its principal acquired at judicial auction the properties registered in the Limón Registry District under folio numbers Placa20208 and Placa20210 before the Second Civil Court of San José, and those properties were registered in its name beginning on 03 de marzo de 1989. Property Placa20209 had been registered since 11 de mayo de 1987, without any indication of a restriction, limitation, or encumbrance, or of its status as wetlands, and that property was registered in the Public Registry in its name beginning on 15 de febrero de 1988.
During 2009 and 2010, its principal submitted an application to join the "Pago de Servicios Ambientales" (PSA) program. However, in response to an inquiry submitted to Japdeva through official letter FONAFIFO-LM-389-2010, the Legal Department of Nombre415 reported, by official letter AL-589-2011 dated 15 de noviembre de 2011, that the properties were located within the boundaries of lands belonging to the estate of Nombre415, as well as within an area classified as a Protected Wildlife Area (Área Silvestre Protegida) under the category of Wetland. Accordingly, pursuant to Ley Forestal 7575 de 1995, lands in such circumstances form part of the State Natural Heritage (Patrimonio Natural del Estado), and their administration falls to MINAET through the National System of Conservation Areas. It therefore stated that the preliminary application for admission to PSA was not legally valid because those lands were public-domain property (demanialidad) and not subject to acquisitive prescription (imprescriptibilidad).
In addition, the National System of Conservation Areas, La Amistad Caribe Conservation Area, stated in official letters 195, 207, and 208 dated 25 del mes de octubre de 2012 that the properties were located within a property belonging to the estate of Nombre415, according to survey plan Placa20213, real-property folio Placa20214, where they occupy an area classified as a wetland that constitutes State Natural Heritage. As follows from the foregoing facts, its principal owns three properties acquired at judicial auction. Although those properties are located within the estate originally awarded by law to Nombre415, they were privately owned because private parties had possessed them for 10 years before those lands were assigned to Nombre415, and they had been duly registered in the Public Registry for more than ten years when its principal acquired them and for more than thirty years as of the present date.
They are supported by registered title, which contained no notation or warning whatsoever concerning the reported situation. Its principal’s properties are protected by Article 45 of the Political Constitution, which establishes that private property is inviolable and that no person may be deprived of property except for reasons of public interest or social interest and upon prior payment of just compensation, which is claimed herein. Expropriation (expropiación) of those properties is therefore appropriate, given that the right to obtain a benefit from them has been extinguished. For purposes of the expropriation, it must be taken into account that, on 18 de marzo de 1998, Costa Rica and Canada signed an agreement for the promotion and protection of investments and investors of Canadian citizens in Costa Rica. That agreement must be applied in this case because Mr. Nombre47457, a Canadian citizen, made investments in Costa Rica through the purchase of the properties whose economic substance has been eliminated by determinations issued by State offices, rendering those properties unproductive.
Under that Agreement, expropriations payable to Canadian citizens who directly or indirectly hold investments in Costa Rica involving property subject to expropriation must take its market value into account. B) Regarding the law: Legal scholarship has stated that the principle of public notice through the registry generally operates "in favor of the holder of the registration, anyone whose rights derive from the former, and third parties external to the registry." FUEYO LANERI (Fernando. Teoría General de los Registros, Buenos Aires, Argentina, Editorial Astrea, Primera Edición, 1982, Pág. 197). This registry notice operates in two ways: one, known as formal registry publicity (publicidad formal del Registro), as an informational instrument, "consists of the right of any person to request access to the registry books and the registrar’s obligation to make available to applicants any information they request" (RODRÍGUEZ, Joaquín.
Curso de Derecho Mercantil, México, Editorial Porrúa, Tomo I, 1979, Pág.246.) The other, known as substantive registry publicity (publicidad material), determines the principal effects of the Registry, which are: A. The positive aspect of public notice through the registry, insofar as registered matters are presumed to be known to third parties. B. The negative aspect of public notice through the registry, insofar as matters not registered cannot prejudice third parties acting in good faith. This substantive registry publicity is enshrined in the first paragraph of Article 455 of our Civil Code, which provides that: "instruments subject to registration that have not been registered shall not prejudice third parties until the date on which they are submitted to the Registry." Accordingly, the principle of reliance on the public registry (fe pública registral) establishes a presumption in favor of third parties that registry entries are accurate and complete; anyone who conducts a transaction in reliance on the Registry does so as an interested party acting in good faith, and the title is enforceable against third parties.
Reliance on the public registry is an effect of public notice arising from the Property Registry and provides dual protection through two presumptions derived from registry entries: rebuttable protection (iuris tantum), which establishes that the real rights (derechos reales) published by the Registry exist and belong to their holder in the manner specified in the corresponding entry, constituting the principle of registry legitimacy (legitimación registral); and an irrebuttable presumption (iure et de iure) in favor of third-party purchasers who satisfy the legal requirements. These give their acquisition a secure status and constitute reliance on the public registry. Such reliance entails two presumptions: Positive presumption of Reliance on the Public Registry: A person who was not a party to the act or contract to which the registration refers and who submits an instrument to the Registry is presumed to be a third party.
The negative presumption of Reliance on the Public Registry means that anything not expressly appearing in the registry entries is presumed not to exist as a legal matter. Article 1 of the Ley de "Inscripción de Documentos en el Registro Público" states that the purpose of the National Registry is to guarantee the security of registered property or rights with respect to third parties, while Article 9 establishes the Registry’s obligation to take all appropriate steps, including obtaining documents or copies, to correct errors or omissions made by Registrars when recording or registering documents. Consequently, the parties or interested persons may not be required to provide documents or undertake procedures to correct such Registry errors. The State therefore incurs strict liability (responsabilidad objetiva) when a person acquires, in reliance on the Registry, a title that has been registered for more than thirty years and is denied the opportunity to enjoy full ownership of those properties, since Article 190 of the General Law of Public Administration states in this regard that the Administration shall be liable for all damage caused by its lawful or unlawful, normal or abnormal operation, except in cases of force majeure, fault of the injured party, or an act of a third party.
Along these lines, the First Chamber of the Supreme Court of Justice has stated that "the existence of a harmful result causing actual, economically assessable harm that is individualized with respect to a person or group of persons is sufficient for the obligation to compensate to arise, without any requirement other than a causal relationship between the act and the damage and wholly irrespective of whether the act giving rise to the damage was lawful or unlawful." (véase Sala-Primera voto 112 de 14 y 25 horas del 25 de diciembre de 1994). Regarding good faith and public notice through the registry, the First Chamber of the Supreme Court of Justice stated in its voto 162-F-01 de las 8 horas 15 minutos del 16 de febrero de 2001: "...In this case, Mr. Nombre112357 acquired the property in question directly from the person who appeared as its owner in the Public Property Registry. Consequently, he had no means of determining whether that person’s right derived from a void act, since its registration created the appearance of a valid and effective act, and the purchaser acted in good faith in reliance on the aforementioned institution." Under the protection of Article 456 of the Civil Code, any declaration of nullity (declaratoria de nulidad) that may be entered against property titles held by persons other than those who instituted the titling proceedings cannot prejudice them; they must therefore be regarded as third-party purchasers in good faith.
All of the foregoing is based on Articles 45 of the Political Constitution; 264, 266, 267, 268, 269 et seq. and related provisions, 455, 456 et seq. and related provisions of the Civil Code; 409, 410, 426 et seq. and related provisions, 449, 450, 457, 462, 865 et seq. and related provisions of the Civil Code; 1 et seq. and related provisions of the Administrative Litigation Procedure Code; 1 et seq. and related provisions of the Law on Possessory Information; and 1 et seq. and related provisions of the Law on Registration of Documents in the Public Registry. The representative of the Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica answered the complaint as follows: A) Regarding the facts: The properties possess the typical characteristics of public-domain status (demanialidad) and immunity from acquisition by prescription (imprescriptibilidad), and are not eligible for registration with the Public Registry; therefore, their invasion and occupation would be subject to penalties, and Nombre415 will retain ownership because they form part of its assets, except for the areas comprising the State Natural Heritage (Patrimonio Natural del Estado), the administration of which falls to the Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET), through the Sistema Nacional de Áreas de Conservación.
Article 13 of the Ley Forestal establishes that the State Heritage is composed of all properties registered in its name and in the names of autonomous institutions, and, with respect to that natural heritage, Article 15 defines the restrictions imposed on the public administration, prohibiting it from exchanging, assigning, conveying, or leasing rural lands owned or administered by it unless they have first been classified by MINAET; this constitutes a restriction that must be recorded in the Public Registry. It is important to note that our legislation creates a system in which dedication to public use (afectación) becomes the primary element for including property within the public domain; therefore, property designated by law or by an administrative act shall be public-domain property when authorized by law. When property is incorporated into the public-domain regime, it acquires several essential characteristics, including inalienability (inalienabilidad), immunity from acquisition by prescription, and immunity from attachment (inembargabilidad); therefore, such property need not be expropriated.
The lands registered in the name of Nombre415 were so registered pursuant to its Organic Law No. 3091 of 18 February 1963, subsequently amended by Law No. 5337 of 27 August 1973, Articles 2 and 41(b) of which provide that it shall receive all State lands located in the area served by navigable canals, comprising an area extending 10 kilometers inland from the sea, parallel to the coast, and a strip 3 kilometers wide parallel to both sides of the rivers and canals administered by the Board, in accordance with real-property folio No. 7-096658-000 and cadastral plan L-000001-1977. These are therefore lands granted by law—which, as the Procuraduría General de la República has stated, have public-domain status—and are consequently inalienable, immune from acquisition by prescription, and nontransferable, because they are outside private commerce, being State lands assigned to a specific entity, in this case Nombre415.
Paradoxically, although they have generally been deemed public-domain property because they are outside private commerce, many portions in numerous sectors are duly registered in the National Public Registry. Notwithstanding the foregoing, it may be concluded that, although the properties identified by Ram Rajpal S.A are physically located within the boundaries of Nombre415’s property, registered under real-property folio No. 7-096658-000 of the Limón Registry District and legally created by Public Deed number 132 at 10:00 a.m. on 8 June 2001, the State Notary, Licda. Gladys Herrera Raven, stated that it was legally created subject to rights acquired by third parties in good faith. This was because, within the territorial boundaries of the property belonging to Nombre415, there is an entire patchwork of duly registered properties; accordingly, the registration of all properties that had legally come into existence before that date (8 June 2001) had to be respected.
Nombre415 must therefore acknowledge that certain third parties have superior rights, provided it is shown that the property or properties were registered before property 7-96658-000. In the present case, the properties of Inversiones Rapjal S.A legally came into existence before Nombre415’s property, as evidenced by the Public Registry’s certifications, and under the well-established legal principle of “first in time, first in right,” they would belong to the plaintiff company. It stated that the situation is different for properties located within Nombre415’s territorial boundaries that are forest areas or form part of the State Natural Heritage, because jurisdiction over such matters falls to MINAET. B) Regarding the law: Article 16 of the General Law of Public Administration provides that under no circumstances may acts be issued contrary to the unequivocal rules of science or technology or to elementary principles of justice, logic, or expediency.
Respecting the legal principle of “first in time, first in right,” and based on the statement made by the State Notary when the lands owned by Nombre415 were registered through deed No. Placa20215, which provided that the transfer was made without prejudice to third parties possessing superior rights, it is understood that those who held title (rights) before the registration of Nombre415’s lands retain rights over their legally registered portions. Under the Ley Forestal of 1969, which coined the term “State Forest Heritage” (Patrimonio Forestal del Estado), later changed to “State Natural Heritage” in Ley Forestal No. 7575 of 1996, the law nevertheless provided that the management and administration of that Heritage fell to MINAE, now MINAET. The administration of the State Natural Heritage therefore falls outside the functions assigned to Nombre415. In resolution No. 5893-95 at 9:48 a.m. on 27 October 1997, the Sala Constitucional recognized the appropriateness of restricting the exercise of property rights or freedom of economic initiative for environmental reasons.
Along the same lines, in judgment No 5893-95 at 9:48 a.m. on 27 October 1997, the Sala Primera stated: “These are assets subject to a mixed legal regime: private as to ownership, but fulfilling a function determined by the public or common interest, as a limitation or restriction on private property. This is the doctrine of Article 45 of the Political Constitution. In the case of property subject to restricted use, as a limitation on ownership, that special legal regime does not necessarily entail expropriation, much less compensation, because private parties retain title.” Accordingly, given that the lands in question are classified as having extensive forest growth, if the competent entity (SINAC) determines that those lands belong to the State Natural Heritage, the current occupants would be holding public-domain property, the legal nature of which has already been addressed. Finally, it stated that, with respect to the exercise of fundamental rights such as private property, freedom of commerce is not unrestricted and may therefore be limited for reasons of social welfare, since the rights to a healthy environment and to health are fundamental rights that the State must protect.
Imposing restrictions on property rights and freedom of economic initiative is justified to protect the environment, thereby seeking a balance between conservation and production, both of which are supported by interests of a social nature. In light of all the foregoing, imposing restrictions on private property in favor of environmental conservation and forest heritage is rationally and constitutionally valid. For its part, the Sistema Nacional de Áreas de Conservación stated, in summary and insofar as relevant: A) Regarding the facts: Properties bearing registration numbers Placa20210, Placa20209, and Placa20208 were registered in the Property Public Registry in the names of private parties through possessory-information proceedings (información posesoria) in 1972. They were subsequently transferred to Mis Dos Amores, S.A. and are currently registered in the National Registry in the name of the plaintiff company; however, they are located on lands owned by the Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica (Nombre415), which were transferred to that Institution by Law No. 3091 of 18 February 1963 and registered under real-property folio Placa20214.
Thus, the properties at issue in these proceedings were registered as private property after Nombre415 became their owner, rather than ten years earlier as asserted by the plaintiff. It should be noted that, in the case of property number Placa20209, the possession of the petitioner in the possessory-information proceedings began in 1960, three years before Nombre415 became the owner by operation of law of the lands on which that property is located. In addition, official letter RIM-CT-00736-2013 of 17 October 2013, signed by Mr. Marlon Aguilar Chaves, Deputy Director of Cadastre of the Registro Inmobiliario; report No. DGIGN-RN-2013-062 of 4 October 2013 of the Instituto Geográfico Nacional; and official letter SINAC-ACLAC-PNE-065-2013 of 9 October 2013 from the Área de Conservación La Amistad-Caribe stated that those properties are covered by forest. Lic. Carlos Eduardo Vargas Ramírez, Coordinator of the State Natural Heritage of the Área de Conservación La Amistad Caribe (ACLAC), issued certifications SINAC-ACLAC-PNE-195-2012 (cadastral plan N° L-1584-1971), SINACACLAC-PNE-207-2012 (cadastral plan N° L-1585-1971), and SINAC-ACLAC-PNE-208-2012 (cadastral plan N° L-1586-1971).
He reiterated that, although the properties are located outside any Protected Wildlife Area (Área Silvestre Protegida) administered by SINAC, they are nevertheless located within the heritage property of the Junta de Administración Portuaria y de Desarrollo de la vertiente Atlántica (Japdeva), real-property folio N° 7096658-000, with cadastral plan Placa20203°, and that their cadastral plans show conditions characteristic of wetland areas. B) Regarding the merits: The properties located in the Limón Registry District under real-property folio registration numbers Placa20210, Placa20209, and Placa20208, with cadastral plans Placa20204° and Placa20216, were registered in the National Registry in the names of private parties through possessory-information proceedings in 1972. However, they overlap property Placa20205°, owned by Nombre415, a State institution to which the lands were transferred by Law No. 3091 of 18 February 1963.
They are therefore public-domain property because they belong to the State, and the properties were registered as private property after the cited Law entered into force. Furthermore, the lands on which those properties are located are shown to be covered by forest, as stated by the National Registry in official letter No. DG-IGN-RN-21-013-061 dated 04 October 2013, with a wetland-type vegetation zone (yolillal) according to the corresponding legend.
Whereas, because the land concerning which the plaintiff brought the claim overlaps with the State-owned property and is therefore subject to the public domain, such property has particular characteristics, including immunity from adverse possession (imprescriptibilidad), inalienability (inalienabilidad), and immunity from attachment (inembargabilidad). Whereas the plaintiff did not demonstrate that its ten-year possession of the properties predated the entry into force of Ley No. 3091 del 18 de febrero de 1963. Whereas, in addition to the foregoing, it is important to consider that Lic. Carlos Eduardo Vargas Ramírez, Coordinador de Patrimonio Natural del Estado del Área de Conservación La Amistad Caribe (ACLAC), del Sistema Nacional de Áreas de Conservación, issued certifications SINAC-ACLAC-PNE-195-2012 (plano catastrado No. L-1584-1971), SINAC-ACLAC-PNE-207-2012 (plano catastrado N° L-1585-1971), and SINAC-ACLAC-PNE-208-2012 (plano catastrado No. L-1586-1971), in which he stated that the properties located within the property belonging to the estate of Nombre415 No. Placa20214, with plano catastrado N° L-00001-1977, include wetland areas (áreas con humedal), according to a Patrimonio Natural del Estado consultancy conducted for Japdeva.
Thus, although the land transferred to Nombre415 by Ley número 3091 de 18 de febrero de 1963 and recorded under real-property folio (folio real) registration Placa20214 was initially recorded as private property of that entity (bienes patrimoniales), upon the entry into force of Ley Forestal número 4465 de 29 de noviembre de 1969—together with its amendments under Ley No. 7174 de 28 de junio de 1990 and 7575 de 13 de febrero de 1996—it was established that the portion of the land covered by forests or suited for forestry (aptitud forestal) and belonging to the State or its institutions became part of what was then called “Patrimonio Forestal del Estado,” thereby acquiring the status of public-domain property (bienes demaniales). Whereas these areas thus became part of “public-domain property” (bienes de dominio público), which is afforded special protection under Article 121, subsection 14), of the Constitución Política, providing that such property belongs to the Nation and may be permanently removed from its ownership only with authorization from the Asamblea Legislativa, because it has particular characteristics such as immunity from adverse possession, inalienability, and immunity from attachment.
Whereas, for that reason, the land that the plaintiff claims to possess cannot be the subject of possession capable of supporting acquisition by adverse possession (usucapión); therefore, the plaintiff’s request concerning properties N° 14718-000, 14810-000, and 14660-000 is legally inadmissible, because they could not have entered private ownership in 1971, since at that time those properties had been owned by Nombre415 since 1963; consequently, to have been acquired by adverse possession, they would have had to be so acquired before 18 de febrero de 1963. Whereas it is important to note that public-domain property is governed by the principle of exemption from initial registration (principio de inmatriculación), under which its status as public property dedicated to a public use, service, or purpose does not require its registration in the Registro Nacional; therefore, public-domain property need not be registered to be effective against third parties, and, accordingly, such parties cannot claim the status of good-faith purchasers (adquirente de buena fe), given its inalienable nature and immunity from adverse possession.
Finally, whereas the granting of the Pago de Servicios Ambientales benefit is an administrative act (acto administrativo) involving discretion on the part of the Administración Forestal del Estado and does not constitute a right or form part of private parties’ property rights, because they merely submit the corresponding application and, depending on budgetary projections, the priorities and criteria adopted, and the circumstances of each particular case, the benefit is or is not granted in accordance with the procedure established in the cited regulations, Articles 39 and 40; it is therefore a benefit subject to certain requirements and granted according to the priorities and criteria defined by the Administration; and, in accordance with the foregoing, because there is no obligation to expropriate, the provisions of the “Acuerdo con Canadá sobre Promoción y Protección Recíproca de Inversiones,” approved by Ley número 7870 de 5 de mayo de 1999, do not apply.
Finally, the State’s representative stated: A) Regarding the facts: Whereas, pursuant to official letter RIM-CT-00736-2013 de 17 de octubre de 2013, signed by the Subdirector Catastral del Registro Inmobiliario, the Junta de Administración Portuaria y de Desarrollo Económico de la vertiente Atlántica (Japdeva) owns the real property recorded under real-property folio registration Placa20214. Whereas that land was transferred to that State institution by Ley No. 3091 de 18 de febrero de 1963. Whereas, although the plaintiff stated that properties numbers 14810-000, 14718-000, and 14660-000 are agricultural in nature, according to official letter número DG-IGN-RN-2013-062 de 4 de octubre del 2013 from the Instituto Geográfico Nacional and official letter SINAC-ACOC-PNE-065-2013 de 9 de octubre de 2013 from the Área de Conservación La Amistad-Caribe, those properties are covered by forest and therefore constitute Patrimonio Natural del Estado.
Whereas, accordingly, those properties were, on the one hand, registered in the name of Nombre415 beginning in 1963 and, on the other hand, form part of the Patrimonio Natural del Estado. Whereas, in the case of property number 14718-000, the petitioner’s possession began in 1960, only three years before Nombre415 became, by law, the owner of the land on which that property is located. Whereas, although the Estado de Costa Rica and Canadá entered into an agreement for the promotion and protection of Canadian investments in Costa Rica, the application of that agreement in this case is an assessment made by the plaintiff’s representative, not a plain and simple fact, and it is not true that the State caused it loss and damage. B) On the merits: a. Regarding the invalidity of the registration of the Partido de Limón properties numbers Placa20210, 14718-000, and Placa20208. Whereas the Partido de Limón properties numbers 14810-000, 14718-000, and Placa20217 originated in possessory-title proceedings (proceso de información posesoria), pursuant to which they were registered in favor of private parties in 1972; however, the cited properties, with cadastral plans (planos catastrados) L-1584-1971, L-1585-1971, and L-1586-1971, overlap with the land comprising property number Placa20214.
The land transferred to Nombre415 by Ley No. 3091 de 18 de febrero de 1963 and recorded under real-property folio registration Placa20214 was initially recorded as private property of that entity; however, pursuant to Articles 18, 19, 28, 40, and 41 of Ley Forestal número 4465 de 29 de noviembre de 1969 (amended by Ley No. 7174 and Ley 7575), the portion of that land covered by forests or suited for forestry and belonging to the State or its institutions thereafter became part of the Patrimonio Forestal del Estado, thereby acquiring the status of public-domain property. Whereas, since the first Ley Forestal, del 25 de noviembre de 1969, land owned by autonomous institutions and covered by forest or suited for forestry has formed part of the Patrimonio Natural de Estado, formerly known as Patrimonio Forestal del Estado, and has constituted public-domain property since that time. Whereas the public-domain status (carácter demanial) of the land incorporated into what was then called Patrimonio Forestal del Estado, now Patrimonio Natural del Estado, means that its possession by private parties created no rights whatsoever.
It therefore could not be acquired by adverse possession. In other words, the portions of the property ultimately recorded under real-property folio 7-096658-000, but which had been owned by Nombre415 since the entry into force of Ley 3091 de 18 de febrero de 1963, were also incorporated into the Patrimonio Forestal del Estado and acquired the status of public-domain property beginning in 1969. Whereas, according to official letter No. RIM-CIT-00736-2013 from the Subdirección del Registro Inmobiliario, as well as the photographic interpretation (foto-interpretación) contained in report official letter número DG-IGN-RN-2013-062 prepared by the Instituto Geográfico Nacional, the nature of that land is established. Whereas all of the foregoing means that the validity of the registration of properties numbers Placa20210, Placa20209, and Placa20208 depends on when possession began; however, there is no proof that such possession occurred between 1953 and 1963.
Whereas the petitioner maintained that, by 1970, it had possessed the land for 10 years, meaning that in 1963, when the land was transferred to Nombre415, it had possessed it for only 3 years, which was insufficient for acquisition by adverse possession; and the portions covered by forest became part of the Patrimonio Forestal del Estado beginning in 1969. Whereas it is irrelevant in this case that the property owned by Nombre415 was not registered until 2001 because, as public-domain property, it is governed by the principle of exemption from initial registration, under which the property need not be registered in the Registro Público for public ownership thereof to be effective against third parties. Accordingly, that registration is void. Consequently, the plaintiff company’s request for a declaration that the Partido de Limón property, real-property folio registration number Placa20218, entered private ownership in 1971 is legally inadmissible.
The same is also true of properties 14810-000 and 14660-000, because they could not have entered private ownership in 1971, since at that time the land on which they were located had been owned by Nombre415 since 1963. b. Regarding good-faith acquisition of public-domain property. Whereas, in the case of public-domain property, the provisions of Articles 455 and 456 of the Código Civil concerning third parties who acquire property in reliance on the public notice afforded by the registry (publicidad registral) do not apply. Whereas, first, public-domain property need not be registered to be effective against third parties, given the principle of exemption from initial registration that governs this type of property; and, second, one cannot claim the status of a good-faith purchaser in the case of public-domain property, given its inalienable nature and immunity from adverse possession. Whereas the nullity of the act through which public-domain property was registered in favor of a private party does affect a third party who acquired it in reliance on the public faith of the registry (fe pública registral) maintained by the Registro Nacional, because otherwise a private party—the third-party purchaser who relied on the public notice afforded by the registry—would be permitted to become the owner of public-domain property, notwithstanding the inalienable nature of such property. c. Regarding payment for environmental services (pago de servicios ambientales), the “emptying” (vaciamiento) of the property right, and nonpayment for environmental services.
Whereas payment for environmental services—established in Article 46 of Ley Forestal número 7575—is the legal expression of an incentive policy intended to promote both forest conservation and forest plantations, involves discretion on the part of the Administración Ambiental, and does not constitute a right forming part of private parties’ property rights. e. Regarding the State’s alleged duty to expropriate in the present case and the application of the “Acuerdo con Canadá sobre Promoción y Protección Recíproca de Inversiones.” Whereas this is not a case of expropriation, but rather an action by the Administration that neither entails imposing limitations on the exercise of the right nor occurs pursuant to any provision imposing such limitations.
Therefore, the alleged “deprivation” of the plaintiff’s property right has not occurred; consequently, the State has no duty to expropriate. In accordance with the foregoing, and because the State is under no obligation to expropriate, the provisions of the “Agreement with Canada for the Promotion and Reciprocal Protection of Investments,” approved by Law No. 7870 of May 5, 1999, are inapplicable. Accordingly, the plaintiff’s claim seeking a declaration that the State has a duty to expropriate the properties it claims to own is entirely without legal basis.
The State’s representation filed a counterclaim against Grupo de Inversiones Rajpal S.A., corporate identification number CED88921; Mr. Nombre112356; Mis Dos Amores S.A.; and Dalanyo S.A., seeking a judgment that: “...The possessory title proceeding (información posesoria) processed under expediente número 1721 del año 1970 before the Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda be declared null and void, and that the judgment issued by that court at diecisiete horas del nueve de mayo de mil novecientos setenta y dos be annulled. That entry 1 of volume 2098, folio 457, for property number 14718 of the Province of Limón, pursuant to which said property was registered in the name of Nombre112356, be declared null and void, and that the registration of property number 14718 of the Province of Limón be cancelled. Furthermore, that entry 2 of Volume 2098, Folio 457, for property number 14718 of the Province of Limón, pursuant to which said property was registered in the name of Mis Dos Amores, S.A., be declared null and void, and that its cancellation be ordered.
That entry 3 of Volume 2098, Folio 457, for property number 14718 of the Province of Limón, pursuant to which part of said property was registered in the name of Dalanyo S.A., be declared null and void, and that its cancellation be ordered. That the registration of property number 14718-000 of the Limón Registry District in favor of Inversiones Rajpal S.A., entry 14340, volume 362 of the Registro Inmobiliario, be declared null and void. That the registration of property number 16370 of the Limón Registry District in favor of Dalanyo S.A., entries 1 through 6, volumes 333 and 346 of the Registro Inmobiliario, be declared null and void...” The foregoing was based on the following arguments: A) Regarding legal protection of the State Natural Heritage (Patrimonio Natural del Estado):
That, for these purposes, it is irrelevant that, in the possessory title proceeding (información posesoria), the competent entities or bodies did not express their opposition. That such omission can never validate possession exercised over a patrimonial asset (bien patrimonial) of a public entity which, moreover, became subject to the public domain (dominio público) before the applicant in the possessory title proceeding completed the ten-year possession period. That the nullity of the registration acts (actos de inscripción) affects subsequent purchasers even if they acquired on the basis of the public registry record (publicidad registral) and in good faith. That, because it is public-domain property (bien de dominio público), the principle of first registration (inmatriculación) applies to the property owned by Nombre415, by virtue of which it is not necessary for the property to be registered in the Public Registry for its public ownership to affect third parties (see the aforementioned judgment of the Constitutional Chamber, number 3145-96, issued at nine twenty-seven in the morning on veintiocho de junio de mil novecientos noventa y seis), and its mere status as public-domain property is sufficient.
That, accordingly, it is irrelevant that the property owned by Nombre415 was not registered until 2001. Moreover, the status of good-faith purchaser—artículo 456, Código Civil—does not apply with respect to public-domain assets (bienes demaniales), given their inalienable and imprescriptible nature. That, in the case of this type of property, all registration acts are null and void, both the original acts carried out through a possessory title proceeding and subsequent acts, even when they involve good-faith purchasers acting on the basis of the public registry record. This is because any registration by a private-law person of an ownership right created over public-domain property is null and void because such property is inalienable, regardless of whether it was acquired on the basis of the information published by the Registro Nacional. That, as stated in the response to the complaint, holding otherwise would mean that a purchaser relying on the public registry record could become the owner of public-domain property despite the inalienable nature of such property; the foregoing arguments authorize the State to seek annulment of the original registration of property number 14718-000 of the Limón Registry District, as well as the registry transactions involving that property, namely, the registration entries for its transfers and segregations (segregaciones).
It should be taken into account that, pursuant to artículo 13 of Ley Forestal 7575, the land on which the property is located is administered by MINAE because it forms part of the Patrimonio Natural del Estado. Consequently, the possessory title proceeding that led to the registration of property number 14718-000 is null and void and, for the same reasons, so is the registration of that same property in favor of Mis Dos Amores, S.A., as well as its registration in favor of Dalanyo S.A. and Inversiones Rajpal, S.A. Counsel for Inversiones Rajpal S.A. stated: A) Regarding the facts: That the law transferred to Nombre415 properties that, for many years previously, had mostly been owned and possessed by private individuals, and some were even under cultivation, as is the case with the property belonging to the party she represents. That counsel for Nombre415 stated in the response to the complaint that all land registrations that came into legal existence before the registration of the aforementioned property in the institution’s name are respected, but not those that came into existence after 8 de junio del año 2001, the date of the deed by which the transfer to Nombre415 was effected.
That, likewise, in responding to other allegations in the complaint, Nombre415 acknowledges that the properties of the party she represents must be respected, and therefore she does not understand the validity of this counterclaim (reconvención), in accordance with the principle of legality. That the public registry record shows that the property has existed legally in the names of third parties and has been respected by the State for more than forty years. That the plaintiff company acquired it through a judicial auction (remate), that is, as a third party with a superior right, and Nombre415 acknowledged that this property must be respected; and if the owner says so, it is not understood how the Procuraduría can say otherwise, since doing so disregards the principle of legality and respect for administrative jurisdiction. That most of the property’s land has been covered by forest, but it has been cultivated since before 1950 by its original possessors and subsequently by the registered owners, such that this land does not form part of the State’s natural heritage; land was simply transferred to Nombre415 recklessly and without a technical study, and that is why neither Nombre415 nor the Procuraduría opposed the possessory title proceeding undertaken to register it, as can be seen from the evidence submitted by the counterclaimant.
That not everything partially covered by forest forms part of the State’s natural heritage and that, in any event, if that were currently the case, the property of the party she represents must be expropriated, as requested in the complaint. That the party she represents is a company belonging to a Canadian citizen who is entitled to benefit from the investor-protection agreement signed by Canadá and Costa Rica and no longer wishes to continue investing in this country because of the legal uncertainty arising from owning something whose ownership is being challenged by the State. B) Legal grounds: That the party she represents owns land protected by the public registry record, which has been registered for more than forty years, and that, at the time it was registered, as detailed in the evidence submitted by the State, neither Nombre415 nor the Procuraduría opposed that titling (titulación); therefore, the State cannot now seek to assert a right that it failed to protect when it had the opportunity to oppose that possessory title proceeding or to seek its nullity through a motion for nullity (incidente de nulidad) within the three years following its registration in the Public Registry.
That the complaint was filed because her property right has been deprived of its substance insofar as she was denied the right to use and enjoy the property, by being denied the ability to engage in conduct permitted by the legal system for properties that contain a forested portion. In other words, she has been denied the right to obtain forestry incentives promoted by the State itself to preserve the mountain or forest. That, under this premise, and because the party she represents is entitled to the rights arising from the agreement entered into between Costa Rica and Canadá for the protection of investments made by Canadian citizens, whether they are direct owners or shareholders of investment companies, and because there is no longer legal certainty regarding the enjoyment of these properties, it is appropriate that they be expropriated by Nombre415 or the State and pass directly into State ownership, subject to prior compensation in accordance with the law.
That Nombre415 stated in the response to the complaint that it recognizes and respects ownership of properties acquired before the month of junio de 1981 (Sic), the date on which the deed transferring ownership to Nombre415 of certain land located within a particular geographical area was executed. The court-appointed representative (curador procesal) of Mr. Nombre112356 stated: That the property was registered in the Registro Nacional on 2 de octubre de 1972 through a possessory title proceeding conducted before the Juez Segundo Contencioso Administrativo y Civil de Hacienda, with the Procurador Agrario and the Instituto de Tierras y Colonización participating as parties, and that it was approved by a final judgment issued at 17 hours on 9 de mayo de 1972. That, by a deed executed before Notary Álvaro Echeverría Murray at 11 hours on 12 de enero de 1973, he sold property No. 14718-000 to Mis Dos Amores Sociedad Anónima.
That, according to the certification submitted by the plaintiff appearing at folio 49, “Documentary evidence (Prueba documental) 4,” the first entry in the registration of the aforementioned property states that the Procurador Agrario and the Instituto de Tierras y Colonización were parties to the possessory title proceedings that gave rise to the registration. That the ITCO and the Procurador Agrario de la república were notified of the possessory title proceedings on 14 de Agosto de 1970. That the representative of ITCO entered an appearance in the proceedings, requesting to be recognized as a party thereto, on 21 de Agosto de 1970. That, by a ruling of the Juzgado Segundo Civil Contencioso Administrativo y Civil de Hacienda issued at 14 hours 40 minutes on 23 de diciembre de 1971 and served on the Procurador Agrario and ITCO on 03 de enero de 1972, they were given an opportunity to be heard regarding the proceedings for periods of 8 and 10 days, respectively, and the Procurador Agrario submitted the arguments contained in the written filing dated 10 de enero de 1972.
That the judgment issued by the Juez Segundo de lo Contencioso Administrativo y Civil de Hacienda at 17 hours on 9 de mayo de 1972 states the following in point 6 of Considerando I: “6.- That the Procurador Agrario de la República and the Instituto de Tierras y Colonización were granted participation in these proceedings, and neither opposed them.” (See Case File (Expediente)) Folio 402 V). That Considerando II provided: “II.- In view of the fact that all the requirements imposed for such purposes by the Ley de Informaciones Posesorias número 139 of 14 de julio de 1941 have been met, this possessory title proceeding must be approved.- Consequently, the Public Registry is ordered to register the property in the name of the applicant Nombre112356, without prejudice to third parties with a superior right.” That the “Por tanto” of the same judgment provided: “This possessory title proceeding is approved.” That the title applicant (titulante) duly demonstrated before the corresponding Judge that he and his transferor had exercised possession for more than ten years, thereby satisfying the requirements of the Ley de Informaciones Posesorias, and that such possession had therefore been exercised by his transferor Nombre112358 for a substantial period beforehand.
That, according to the historical account, the title applicant acquired the possessory rights (derechos de posesión) on 22 de mayo de 1970, and his transferor had exercised the right of possession for more than ten years quietly, publicly, and peacefully, with the judgment approving the possessory title proceeding being issued on 9 de mayo de 1972. That, taking the date on which the right was transferred as the reference point for calculating the ten years of possession, such possession must have been exercised before the entry into force of ley número 3091 of 18 de Febrero de 1963; and because the document transferring the right was notarized by Notary Alfredo Tosi Bonilla on 25 de junio de 1970, in protocolo 12, escritura 33, the possession exercised by transferor Nombre112358 must have begun at least before the month of mayo de 1960. The exact date cannot be specified because the Ley de Informaciones Posesorias did not require it, and although the law governing Nombre415 had been in force since 1963, it did not apply to the specific case because the State representatives—the Procurador Agrario and ITCO—participated as parties to the titling and did not oppose the proceedings, and the Judge himself, who was familiar with the applicable legislation, approved the possessory title proceeding by judgment; and the registration of the property under real-property folio (folio real), registration number Placa20209, in the province of Limón, took place in the month of octubre de 1972.
That this counterclaim (contrademanda) was filed by the Procuraduría General de la República on 11 de noviembre del 2013, and the undersigned accepted the appointment on 26 de junio del 2015, more than ten years after the property was registered in the Registro Nacional.
In accordance with the foregoing, since the Agrarian Attorney and the representative of ITCO had been duly notified of the possessory information proceedings (diligencias de información posesoria) as of 14 de Agosto de 1970, both institutions were parties to that proceeding and had the procedural opportunity, from that date and in that case file, to exercise the State’s rights had they considered that the lands being claimed belonged to the entity they represented. Thus, the Office of the Attorney General has been aware of the possessory information proceedings since 14 de agosto de 1970, and the land was registered subject only to the reservations under the "Ley de Aguas," without prejudice to third parties having a superior right. Such rights, including those of the State, if not exercised within the proceeding, as occurred in this case, could have been exercised subsequently, but within ten years after registration of the possessory information; therefore, the period for bringing the corresponding actions, even by the State, expired by prescription in the mes de octubre de 1982 and, consequently, is now time-barred.
The court-appointed representative (curador procesal) of the company "Mis Dos Amores" stated: A) Regarding the facts: The Ley de Nombre415 does not contemplate the possibility that the transferred area might contain lands registered to third parties in the Public Registry, or legitimate third-party possessions that could eventually generate valid titles upon registration in the Public Registry and could give rise to rights to compensation in favor of those private parties and against the State as the entity responsible for the legislative act that ordered the transfer to Nombre415 of all lands included within the area established by that law. In answering the complaint, the representative of the Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica stated clearly and categorically that the Institution respects all registrations of real property made prior to the registration in the Public Registry of the Limón property, registration number Placa7705, in the name of Nombre415, which registration was completed on 08 de Junio del 2001.
The State, represented by the Procuraduría General de la República in the corresponding possessory information proceeding, did not object to registration of the Limón property, registration number Placa20220, in the name of the petitioner in those proceedings, thereby fully endorsing the validity of both the proceeding conducted for that purpose and the property title arising from it. The company INVERSIONES RAJPAL, S.A. acquired that property through a public auction or judicial sale conducted as part of a court proceeding. B) Legal grounds for opposing the counterclaim (reconvención): The State seeks a declaration of nullity (declaratoria de nulidad) of the "Possessory Information Proceeding," including the judgment issued in that judicial proceeding at 17 horas del 09 de mayo de 1972, and, consequently, of the registration entry for the Limón property, registration number Placa20209, and all subsequent entries, because that property apparently overlaps the Limón property registered under Placa7705 in the name of the Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica (Nombre415), rather than in the name of the State.
Consequently, the only legal entity with standing to seek a declaration of nullity is Nombre415, not the State as a separate legal entity. Furthermore, it is not true that the Limón property, registration number Placa20209, became part of the State Forest Estate (Patrimonio Forestal del Estado) by virtue of the Ley Forestal No. 4465 del 29 de noviembre de 1969; and since no evidence whatsoever establishes that fact, the lack of any legal basis for seeking a declaration of nullity of the possessory information proceeding, including the judgment issued in that judicial proceeding at 17 horas del 09 de mayo de 1972, and, consequently, of the registration entry for the Limón property, registration number Placa20209, and all subsequent entries, is evident and manifestly unfounded. It must also be noted that the Procuraduría General de la República, through Agrarian Attorney Licenciado Víctor Manuel Bulgarelli Flores, stated in a brief dated 10 de Enero de 1972, filed in the possessory information proceeding whose nullity the Procuraduría General de la República seeks in this proceeding, that the contract for the sale of the property to the applicant for title was private rather than public in nature, as required by law, and that ten-year possession (posesión decenal) had not been established; nevertheless, the petitioner in the "Possessory Information Proceeding" proceeded at that time to establish that the contract for the sale of the property to the applicant for title bore the corresponding notarial certification of a date certain, which gave public effect to that contract, and, furthermore, the witnesses who had not attested to ten-year possession were questioned again by the competent judicial authority, and all clearly stated that possession had lasted for more than ten years.
Once the requirements imposed by the Agrarian Attorney had been satisfied, the Juez Segundo de lo Contencioso Administrativo y Civil de Hacienda issued the judgment ordering registration of the corresponding property, thereby creating the Limón property registered under Placa20209. Under these circumstances, it is evident that the State has no legal basis for seeking the nullity of that possessory information proceeding forty-four years after failing to allege nullity within the possessory information proceeding itself, where it should have been raised. In the possessory information proceeding whose nullity is sought in this case, Mr. Nombre112356 established through appropriate means that he held the right of possession (derecho de posesión) over the land that would become the Limón property, registration number Placa20209, and that possession of that land had lasted for more than ten years; under those circumstances, once it was registered in the Public Registry, he sold and transferred it to the company represented by the court-appointed representative in the año de 1973.
None of the counterclaim defendants may be required to prove possession extending for more than ten years prior to 1963, because none of them is currently seeking title to the land; rather, title to it was already obtained through a duly conducted judicial possessory information proceeding before the competent judicial authority, with the active participation of the State itself through the Procuraduría Agraria and without any objection whatsoever. It cannot be permissible, forty-four years after the possessory information proceeding at issue was conducted and concluded, for the Procuraduría General de la República to attempt to reopen the dispute concerning the duration of the possession that led to registration of the Limón property, registration number Placa20209, because the witnesses to that possession, who stated that it had exceeded ten years, must now be deceased or of very advanced age, and this is not the appropriate time to demand proof of a period of possession in the manner maliciously sought by the State’s representative in this case.
It cannot be established that the possession that led to registration of the Limón property, registration number Placa20209, did not begin in the año 1953 or earlier. In his counterclaim, the Attorney asserted that the possession at issue did not begin in that año de 1953 but rather in the año 1960; however, that assertion lacks any evidentiary basis whatsoever. The Attorney further asserted, without the corresponding evidence, that the land titled by Mr. Nombre112356 was then covered by forest. The property was registered in the Public Registry under registration number Placa20209 in the name of Mr. Nombre112356 because all requirements imposed by the Ley de Informaciones Posesorias then in force had been satisfied and because possession exceeding ten years had been established; that is, ten-year possession was established and satisfied. Consequently, because the land corresponding to the Limón property, registration number Placa20209, was protected by ten-year possession, it cannot be deemed to have become part of the State Forest Estate, now known as the State Natural Heritage (Patrimonio Natural del Estado).
Lastly, this action for nullity (acción de nulidad) is barred by the statute of limitations because the ordinary ten-year limitation period governed by Article 868 of the Civil Code has clearly elapsed, forty-four years having passed in this case since the property at issue was registered in the Public Registry. The Law refers to the non-prescriptibility (imprescriptibilidad) of an action for recovery of property (acción reivindicatoria), but not of an action for nullity such as the one at issue in this specific case and asserted in the counterclaim filed by the State. Indeed, through the counterclaim at issue, the State asserts an action for nullity rather than an action for recovery of property; therefore, it cannot claim or allege that the action or right is not subject to a limitation period. The action for recovery of property, governed by Article 348 of the Civil Code, is the action through which a non-possessing owner asserts the right to recover the property from a possessor who is not the owner.
Furthermore, such an action requires satisfaction of a series of conditions that are not met in this case, and the State did not seek recovery of specific properties but rather the nullity of a judicial possessory information proceeding and of entries in the Public Registry, which clearly constitutes an action for nullity rather than an action for recovery of property; consequently, the limitation of the nullity claims asserted by the State’s representative in its counterclaim is evident and manifest. Finally, the court-appointed representative of the company "Dalanyo S.A." stated: Her principal’s conduct was always consistent with the principle of good faith in the registry (buena fe registral), because, as the record shows, all registry transactions and legal transactions (negocios jurídicos) were carried out before any dispute arose with the State or Japdeva. The evidence submitted by El Estado does not provide any means of establishing the vegetation or use of the property during that period, nor does it establish that the property belongs to the State Natural Heritage, because that is the subject matter of the dispute (litis) in this proceeding and, therefore, a matter that remains under dispute cannot be stated as a fact.
The following facts are relevant to the outcome of this matter:
By complaint filed on 14 de agosto de 2013, the representative of Grupo de Inversiones Rajpal S.A., corporate identification number CED88921, requested, in essence, that the judgment declare that the properties in the Limón Registry District, real-property folio registration numbers No. Placa20208, Placa20209 and Placa20210, entered the private domain in 1971, when the possessory title proceedings (informaciones posesorias) for each of them were approved with the consent of Nombre415 and without opposition from the then ITCO, IDA, now INDER, or the Procuraduría General de la República; that they were therefore acquired by the company it represents under the protection of good faith in the Land Registry (buena fe registral) and in its capacity as a registered third party (tercero registral); and that, consequently, those properties are not subject to restrictions and are protected by the constitutional provisions establishing that, for them to be expropriated, their market value must be paid.
Since the properties were affected by the Sistema Nacional de Áreas de Conservación, Minaet and Japdeva, the State must expropriate them and pay their market value, which may not be less than 100 millones de colones, adjusted for inflation through the date of judgment. It is therefore clear that the claim is based on the title to the property. Subsequently, in answering the complaint, the State’s counsel filed a counterclaim (reconvención), requesting that the judgment declare null and void the judgment of the Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda issued at 17 horas on 09 de mayo de 1972 and, consequently, declare null and void entry 1 of volume 2098, folio 457, for property number 14718 in the Province of Limón, pursuant to which that property was registered in the name of Nombre112356; cancel the registration of property number 14718 in the Province of Limón; declare null and void entry 2 of Volume 2098, Folio 457, for property number 14718 in the Province of Limón, pursuant to which that property was registered in the name of Mis Dos Amores, S.A.; declare null and void entry 3 of Volume 2098, Folio 457, for property number 14718 in the Province of Limón, pursuant to which part of that property was registered in the name of Dalanyo S.A.; declare null and void the registration of property number 14718-000 in the Limón Registry District in favor of Inversiones Rajpal, S.A., entry 14340, volume 362 of the Registro Inmobiliario; and declare null and void the registration of property number 16370 in the Limón Registry District in favor of Dalanyo S.A., entries 1 al 6, volumes 333 and 346 of the Registro Inmobiliario.
The State thus seeks a declaration that the judgment concluding the possessory title proceedings is null and void and, on that basis, the nullification of the resulting registry acts (actos registrales). It is clear that, if the plaintiff company’s right rests upon its title to the property, and if the State’s position and arguments are correct, the claims of Grupo de Inversiones Rajpal S.A. would be barred by a lack of standing on the merits (legitimación ad causam). Accordingly, because the plaintiff bases its action on the existence of an ownership right (derecho del dominio) over real property, and because that title is being challenged under the terms of the counterclaim, the counterclaim must be decided first. For that reason, the arguments raised in the counterclaim will be analyzed first.
VI.OBJECTIONS BASED ON THE STATUTE OF LIMITATIONS AND EXPIRATION OF THE CLAIM (EXCEPCIONES DE PRESCRIPCIÓN Y CADUCIDAD DE LA ACCIÓN): The court-appointed representative (curador procesal) of Mr. Nombre112356 stated that the action brought by the State’s counsel should have been filed within ten years after registration of the possessory title proceedings; that is, the period for bringing the corresponding actions expired in octubre de 1982, and because no action was filed within that period, these proceedings are time-barred by expiration (caducidad). For his part, the court-appointed representative of “Mis Dos Amores” stated that the action brought seeks nullification of the registry entries identified therein, rather than recovery of Nombre415’s property, and that the Law refers to the imprescriptibility of an action for recovery of property (acción reivindicatoria), but not of an action for nullification (acción de nulidad), such as the one at issue in this specific case and asserted in the State’s counterclaim; consequently, the State’s counterclaims for nullification are plainly and manifestly barred by the statute of limitations.
This Panel of Judges considers that both objections must be addressed as a preliminary matter because, if the challenges are well-founded, they would require dismissal of the action brought by the State and make any further consideration of the merits unnecessary. This case involves a conflict concerning the temporal application of laws to real property. The dispute centers on whether Ley No. 3091 del 18 de febrero de 1963 transferred the lands encompassing the property registered through possessory title proceedings as No. 14718-000 in the Limón Registry District. If so, a property that had belonged to a State institution since 1963 was registered in 1972, unless the beneficiaries of the possessory title proceedings had proven that their occupation had begun at least 10 years before 1963. In addition, beginning in 1969, State-owned properties suitable for forestry use (inmuebles con vocación forestal) and belonging to its institutions became part of the State Natural Heritage (Patrimonio Natural del Estado), pursuant to Leyes No. 4465 del 25 de noviembre de 1969, 7174 del 28 de junio de 1990 and No. 7575 del 16 de marzo de 1996, and were afforded special protection.
Thus, the dispute concerns an asset that would be classified broadly as an asset within the State’s public domain (bien de dominio público del Estado), and extensive case law has held in this regard that: “...IV.- Furthermore, it should be noted that, with respect to the State’s public domain, the assets cannot permanently leave the Nation’s ownership (article 121 subsection 14 of the Political Constitution), because they form part of the State’s natural heritage (article 89 of the Constitution)...They are, consequently, assets not subject to acquisitive prescription (imprescriptibles), inalienable, immune from attachment, and not susceptible to private appropriation...” (Votos No. 1763-94 de las 16:45 horas del 13 de abril de 1994). Accordingly, because this type of asset is at issue, an action seeking its protection is not subject to a statute of limitations or expiration, regardless of whether the relief sought is recovery of the State’s own property or nullification of an improperly recorded registry entry.
To hold otherwise would lead to the absurd result of allowing a State-owned asset to be validated in favor of a private party merely through the passage of time, which cannot be permitted under article 121 of the Constitution. For that reason, the objections based on the statute of limitations and expiration must be rejected.
As indicated supra, counsel for the State requested that the judgment declare null and void the judgment of the Second Administrative and Civil Court of the Treasury issued at 17:00 hours on 09 May 1972, which granted the possessory information proceedings (diligencias de Información Posesoria) instituted by Mr. Nombre112356, and consequently declare null and void entry 1 of volume 2098, folio 457, for property number 14718 in the Province of Limón; entry 2 of Volume 2098, Folio 457, for property number 14718 in the Province of Limón, pursuant to which that property was registered in the name of Mis Dos Amores, S.A.; entry 3 of Volume 2098, Folio 457, for property number 14718, and entries 1 through 6, volumes 333 and 346, of the Real Property Registry of the Province of Limón, pursuant to which part of that property was registered in the name of Dalanyo S.A.; and the registration of property number 14718-000 of the Limón Registration District in favor of Inversiones Rajpal, S.A., entry 14340, volume 362 of the Real Property Registry.
The foregoing was based on the argument that Law No. 3091 of 18 February 1963 transferred to Nombre112361 the lands that comprised those properties, and therefore by 1972 they already belonged to that State institution; furthermore, Laws Nos. No. 4465 of 25 November 1969, 7174 of 28 June 1990, and No. 7575 of 16 March 1996 established special protection for properties belonging to the State and its institutions that were suited for forestry, such that the properties at issue constitute forest property or State Natural Heritage (Patrimonio Natural del Estado), a public-domain asset that therefore cannot be appropriated or titled by private parties. In its defense, the counterclaim defendant, represented by counsel for Inversiones Rajpal, S.A., asserted that Law 3091 transferred to Nombre415 private properties that had been occupied before that law entered into force and were under cultivation, as was the case with the property of the company represented by counsel; indeed, Nombre415 stated in its answer to the complaint that it respected acquisitions of land made before property No. Placa20219 in the Province of Limón, cadastral plan L-00001-1977, was registered on 08 June 2001.
It asserted that the plaintiff company acquired property No. Placa20209 of the Limón Registration District at public auction, demonstrating that the asset had been held in the names of third parties for more than 40 years. It further asserted that although the lands are mostly covered by forest, they had also been cultivated since before 1950 by their original possessors and subsequently by the registered owners; therefore, those lands are not State Natural Heritage, which is why neither Nombre415 nor the Office of the Attorney General objected to the possessory information proceedings at the time. It argued that if the property constitutes State Natural Heritage, then the company represented by counsel must be expropriated. It further asserted that the company represented by counsel belongs to a Canadian citizen who is entitled to benefit from the investment protection agreement signed by Canada and Costa Rica.
The court-appointed representative (curador procesal) of Mr. Nombre112356 stated: Taking the date on which the right was conveyed as the basis for calculating the ten years of possession, that possession must have been exercised before Law number 3091 of 18 February 1963 entered into force; given that the instrument conveying the right was notarized by Notary Alfredo Tosi Bonilla on 25 June 1970 in protocol 12, deed 33, the possession exercised by the transferor, Nombre112358, must have begun at least before May 1960. The exact date cannot be specified because the Ley de Informaciones Posesorias did not require it. Although the law governing Nombre415 had been in force since 1963, it did not apply to this specific case because the State representatives—the Agrarian Attorney and the ITCO, as parties to the titling proceeding—did not object to the proceedings, and the Judge himself, being familiar with the applicable legislation, approved the possessory information proceedings by judgment; registration of the property under real-property folio Placa20209 in the Province of Limón occurred in October 1972.
The court-appointed representative of the company “Mis Dos Amores” stated: A) Concerning the facts: Law No. 3091 did not anticipate that the transferred area contained lands registered in the names of third parties in the Public Registry, or legitimately possessed by third parties, which could generate valid titles upon registration in the Public Registry and could give rise to rights to compensation in favor of those private parties; for that reason, the representative of Nombre415 stated that the Institution respects all property registrations made before the registration in the Public Registry of the Limón property bearing registration number Placa7705 in the name of Nombre415, which registration took place on 08 June 2001. The State, represented by the Office of the Attorney General of the Republic in the possessory information proceeding (Proceso de Información Posesoria), did not object to the registration of the Limón property bearing registration number Placa20220 in the name of the petitioner in the aforementioned proceeding, thereby fully endorsing the validity of the proceeding conducted for that purpose and of the title to property arising from it.
The only legal entity with standing to bring suit and seek a declaration of nullity is Nombre415, not the State as an independent legal entity. It is not true that the Limón property bearing registration number Placa20209 became part of the State Forest Heritage (Patrimonio Forestal del Estado) by virtue of Ley Forestal No. 4465 of 29 November 1969; since there is no evidence whatsoever establishing that fact, the lack of a legal basis for seeking a declaration of nullity of the possessory information proceedings—including the judgment issued in that judicial proceeding at 17 hours on 09 May 1972—and, consequently, of the registration entry for the Limón property bearing registration number Placa20209 and all subsequent entries, is evident and manifestly renders that claim inadmissible. Mr. Nombre112356 established through appropriate evidence in the possessory information proceeding, the nullity of which is sought in this case, that he held the right of possession over the land that would become the Limón property bearing registration number Placa20209, and that possession of that land had continued for more than ten years; under those circumstances, after it was registered in the Public Registry, he sold it in 1973 to the company represented by counsel.
Finally, the court-appointed representative of “Dalanyo S.A.” stated: The conduct of the company represented by counsel always complied with the principle of good faith in the registry (principio de la buena fe registral), since, as the record shows, all registry transactions and legal transactions were carried out before any dispute arose with the State or Japdeva. The evidence submitted by the State provides no means of establishing the vegetation or use of the property during that period, nor that the property belongs to the State Natural Heritage, because that is the subject matter of the present dispute and therefore an issue that remains under consideration cannot be asserted as fact. Thus, in the view of the counterclaim defendant company and the codefendants, the possessory information proceedings were conducted in accordance with law, and Mr. Nombre112356 established that, when he filed those proceedings, he had possessed the property publicly, peacefully, continuously, and as owner for more than 10 years; accordingly, the decision of the Second Civil Court for Administrative and Civil Treasury Matters granting the petition was correct.
Moreover, neither the Office of the Attorney General nor the ITCO objected at the time, and Law No. 3091 did not consider or anticipate that portions of the transferred property might be occupied by or registered in favor of third parties. Opinion of the Chamber: This Court considers the arguments of the counterclaim defendants to be without merit. Those arguments specifically concern the inapplicability of Law No. 3091 and the validity of the ruling by the Second Civil Court for Administrative Matters granting the possessory information petition filed by Mr. Nombre112356 in 1970. Regarding the application of Law No. 3091, we must begin by noting that Article 261 of the Civil Code of 1888 provides: “Public things are those that, by law, are permanently allocated to any service of general utility, as well as those that everyone may use because they have been placed in public use. All other things are private and subject to private ownership, even if they belong to the State or the Municipalities, which, for this purpose, as civil persons, are no different from any other person.” Article 262, in turn, provides: “Public things are outside commerce and may not enter into commerce unless this is legally provided for by withdrawing them from the public use to which they were allocated.” Thus, under those articles, assets are classified as public or private.
Public assets are those that, by law, are allocated to any service of general utility and, as an immediate consequence, are outside private commerce—that is, they are inalienable, meaning that private parties cannot acquire them by any means. Furthermore, in Article 41 of the “Ley Orgánica de de la Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica (Japdeva), Law No. 3091 of 18 February 1963, the State, acting as legislator, provided: “In addition to its ordinary and extraordinary assets and revenues, the following are the property of Nombre415: ...(...) b) All State lands located in the area opened by navigable canals, within an area extending ten kilometers inland from the sea and running parallel to both sides of the rivers and canals administered by the Board.” Thus, all lands located within the boundaries specified in this Law became part of a State Institution as of February 1963 and were therefore removed from private commerce, meaning that after that date no person could validly claim title to any portion of land located within those boundaries.
Accordingly, because of the characteristics of the Law—namely, its general applicability and force—it applies to and must be respected by everyone from the time it enters into force, and no one may acquire rights contra legem or plead ignorance of it, pursuant to Article 129 of the Political Constitution. The argument of the counterclaim defendants challenging Article 41 of the Ley Orgánica of Nombre415 and its application to the possessory information proceeding brought by Mr. Nombre112356 before the Second Civil Court for Administrative Matters must therefore be rejected. Consequently, after Law No. 3091 of 18 February 1963 entered into force, no land could have been registered through possessory information proceedings unless it had been established that occupation began 10 years before that Law entered into force—that is, between 1953 and 1963. For completeness, it must also be noted that, in protecting the environment, the Costa Rican State granted special protection to the State Forest Heritage in Articles 18, 19, and 28 of Ley Forestal No. 4465 of 25 November 1969.
Article 18 provided: “The State Forest Estate (Patrimonio Forestal del Estado) consists of National Reserves, Forest Reserves, National Parks, State Forest Nurseries, Protected Zones, and Biological Reserves.” Article 19: “All forests and forest lands located on the following are hereby dedicated to the purposes of this law: a) Lands considered National Reserves; and b) Rural properties in the private domain of the State, and those belonging to municipalities and autonomous and semi-autonomous institutions.” Thus, the lands within the boundaries established by Law No. Placa20221 as property of Nombre415 subsequently became subject to more stringent protection insofar as those lands were suitable for forestry, and Article 28 of the same body of law classified them as part of the “State Forest Estate.” For its part, Law No. 7174, “Ley Forestal,” of June 28, 1990, stated in Article 32: “The State Forest Estate consists of all forests and forest lands within national reserves, areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other agencies of the Public Administration.” Article 33), for its part, provided: “The forest lands and forests constituting the State Forest Estate, as detailed in the preceding article, shall be immune from attachment (inembargables) and inalienable (inalienables); possession thereof by private parties shall create no rights in their favor, and the State’s action for recovery of title (acción reivindicatoria) to such lands shall not be subject to limitation (imprescriptible).
Consequently, they may not be registered in the Public Registry through possessory-title proceedings (información posesoria); their encroachment and occupation shall be punished in accordance with the provisions of this law, and lands suitable for forestry shall automatically be incorporated into the State Forest Estate.” Finally, “Ley Forestal” No. 7575 of March 16, 1996, provided in Article 13): “Establishment and administration. The State Natural Estate (patrimonio natural del Estado) shall consist of the forests and forest lands within national reserves, areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other agencies of the Public Administration, except for real property securing credit transactions with the National Banking System that becomes part of its assets. The Ministry of Environment and Energy shall administer the estate.
Where appropriate, through the Office of the Attorney General of the Republic, it shall register the lands in the Public Registry of Property as separately identified properties owned by the State. Nongovernmental organizations that acquire real property containing forest or suitable for forestry using funds from donations or the public treasury obtained on behalf of the State shall transfer such property into the State’s name.” And Article 14): “Immunity from attachment and inalienability of the natural estate. The forest lands and forests constituting the State Natural Estate, as detailed in the preceding article, shall be immune from attachment and inalienable; possession thereof by private parties shall create no rights in their favor, and the State’s action for recovery of title to such lands shall not be subject to limitation. Consequently, they may not be registered in the Public Registry through possessory-title proceedings, and both their encroachment and occupation shall be punished in accordance with the provisions of this law.” Thus, since 1969, the legislation protecting the State Forest Estate has included among such assets lands suitable for forestry belonging to the central State and its decentralized institutions, as was the case with the lands transferred by law to Nombre415.
It should be noted that, according to Instituto Geográfico Nacional Certificate No. DG-IGN-RN-2013-061 of October 04, 2013, it was concluded—based on the location of the lands shown on plans 7-1584-1971, 7-1585-1971, and 7-1586-1971 on the Moín topographic sheet at a scale of 1:50-000—that the area has wetland-type vegetation cover (Yolillal), according to the applicable map symbols. Accordingly, State protection of this type of vegetation arose upon the law’s entry into force, not upon registry recordation of the property owned by Nombre415. The counterclaim defendants argue that the property established by Ley 3091 was not registered until June 8, 2001, and that it became effective against third parties only as of that date. This Chamber does not agree, because property in the public domain is governed by the principle that initial registry recordation is unnecessary (inmatriculación registral), as it forms part of public property, and the provisions of the law concerning such property must therefore be applied mandatorily, regardless of whether it is registered in the Public Registry.
Thus, it is clear that Article 41.b) of the Organic Law of Nombre415 and Ley Forestal, as amended, apply in all respects to the lands included in Ley 3091 since 1963, because they constitute property belonging to a State institution. The counterclaim defendants’ second argument focuses on the validity of the possessory-title proceedings, contending that the possession of Mr. Nombre112358, added to that of the petitioner Nombre112356, exceeded 10 years, the requirement for registration of ownership of the property in Limón, folio number Placa20209. A complete review of the record of the possessory-title proceeding establishes that the petitioner filed the application in writing dated July 30, 1970, and, regarding possession for ten years, stated that “it has been undisturbed, public, peaceful, uninterrupted, and under a claim of ownership, consisting of physical possession of the property under my control and enjoyment, as was also exercised by the person who sold it.” (See images 462 and 463 of the digital court record).
Subsequently, Nombre112359, Mr. JOSÉ JAIME LOBO CORDERO, Mr. Nombre112360, and Mr. FRANCISCO URBINA BERMÚDEZ appeared as witnesses in the proceeding, and all stated generally that Mr. Nombre112358 and Nombre112356 had possessed the property for more than 10 years. (See images 515, 534, 535, 544, and 545 of the digital court record). Finally, by a ruling issued at 17:00 hours on May 09, 1972, the Juzgado Segundo Civil de lo Contencioso Administrativo y Civil de Hacienda found that the applicant had possessed the real property identified by him for more than 10 years publicly, peacefully, uninterruptedly, and as owner; granted the possessory-title application; and ordered its registration, whereupon it was registered under Folio No.14718-000 of the Limón Registry District. (See images 549 and 550 of the digital court record). It should be noted that in 1970 possession was claimed over real property that, pursuant to Law No. 3091, had formed part of the estate of an Autonomous State Institution since 1963 and was subject to special protection under Ley Forestal of 1969 because it was suitable for forestry.
Thus, from 1963 onward, the applicant’s possession could not be recognized as valid; nor was it established that the claimed possession of 10 years or more occurred between 1953 and 1963. Consequently, when he pursued the possessory-title proceeding, he could not exercise possession in good faith (posesión de buena fe), because the property belonged by law to Nombre415; and because he did not establish possession for 10 years between 1953 and 1963, there could be no acquisitive prescription (usucapión) either. This makes it possible to annul a registered title at any time when it was created to the detriment of the State and affects property in the public domain, because in such cases ownership is not subject to limitation and is inalienable by private parties. Moreover, because this constitutes a ground of absolute nullity (nulidad absoluta), it may even be declared by the court on its own motion (artículo 837 del Código Civil).
Under those circumstances, if there was no valid possession beginning in 1963 and no possession whatsoever was established between 1953 and 1963, neither the validity nor, much less, the effectiveness of a spurious title lacking actual substantive basis could be upheld, because the counterclaim defendants did not, in fact, have possession sufficient for acquisitive prescription (posesión ad usucapionen útil), either before or after registration of the ownership title in the Public Registry. The Court reaches this conclusion because the statements of the witnesses who testified in the possessory-title proceeding—namely, Nombre112359, Mr. JOSÉ JAIME LOBO CORDERO, Mr. Nombre112360, and Mr. FRANCISCO URBINA BERMÚDEZ—are not consistent in establishing that Mr. Nombre112358 and Nombre112356 possessed the property to be titled between 1953 and 1963. Finally, in its response to the counterclaim, the representative of Grupo de Inversiones Rajpal S.A. argued that, although it is a Costa Rican company, it belongs to a Canadian citizen entitled to benefit from the “Convenio de protección a inversionistas firmado por Canadá y Costa Rica,” approved by Law No. 7870 of May 05, 1999, without providing further details concerning that Convention in relation to the protection claimed for the business activities of Sociedad Inversiones Rajpal S.A. Nevertheless, a review of the Convention shows that Article 8), Expropriations, provides: “1.- Investments of investors of either Contracting Party shall not be nationalized, expropriated, or subjected to measures having an effect equivalent to nationalization or expropriation (hereinafter referred to as ‘expropriation’) in the territory of the other Contracting Party, except for a public purpose, under due process of law, in a nondiscriminatory manner, and against prompt, adequate, and effective compensation.
Such compensation shall be based on the fair market value of the expropriated investment immediately before the expropriation or when the proposed expropriation became public knowledge, whichever occurred first. This compensation shall be payable: a) in Canada, from the date of expropriation, with interest at the normal commercial interest rate; b) in Costa Rica, from the date of dispossession in accordance with Article 11 of Ley de Expropiaciones No. 7495 of May 3, 1995 (hereinafter referred to as ‘Ley de Expropiaciones’), with interest at the average interest rate for deposits prevailing in the national banking system, without delay, and shall be effectively realizable and freely transferable. The valuation criteria for determining fair market value shall include the value of the enterprise as a going concern, the value of the assets, including the declared tax value of tangible property, and other criteria, as appropriate, including, in the case of Costa Rica, Article 22 of Ley de Expropiaciones. 2.- The affected investor shall have the right, under the law of the Contracting Party carrying out the expropriation, to prompt review by a judicial or other independent authority of that Party of the investor’s case and of the valuation of the investment in accordance with the principles set forth in this Article. 3.- The provisions of this Article shall apply to taxation measures unless the tax authorities of the Contracting Parties, within a period not exceeding six months after receiving notice from an investor challenging a taxation measure, jointly determine that the measure in question does not constitute an expropriation.” In this Chamber’s view, however, and in accordance with what has been stated supra, this case does not involve the factual situation contemplated by that provision, namely an expropriation, because the counterclaim concerned the nullity of a registry entry for real property generated through a possessory-title proceeding in 1970, concerning property that since 1963 had belonged pursuant to Law No.
3091 in the name415 and, since 1969, protected as part of the State Natural Heritage (Patrimonio Natural del Estado), without proof that the applicant in the possessory title proceeding (información posesoria) had satisfied the ten-year occupancy requirement between 1953 and 1963. Thus, it bears repeating, this was not an expropriation of a legally protected property right. It follows from the foregoing that the counterclaim (contrademanda) must be granted and the following must be declared null and void: the ruling set forth in the judgment issued by the Second Administrative and Civil Court of the Treasury at 17:00 hours on 09 de mayo de 1972 and, consequently, entry 1 in volume 2098, folio 457, for property number 14718 in the Province of Limón; entry 2 in Volume 2098, Folio 457, for property number 14718 in the Province of Limón, pursuant to which that property was registered in the name of Mis Dos Amores, S.A.; entry 3 in Volume 2098, Folio 457, for property number 14718, and entries 1 through 6 in volumes 333 and 346 of the Real Property Registry (Registro Inmobiliario) of the Province of Limón, pursuant to which part of that property was registered in the name of Dalanyo S.A.; and the registration of property number 14718-000 in the Limón Registry District (Partido de Limón) in favor of Inversiones Rajpal, S.A., entry 14340, volume 362 of the Real Property Registry.
The representative of Grupo de Inversiones Rajpal S.A., corporate identification number (cédula jurídica) CED88921, principally sought to impose strict liability (responsabilidad objetiva) on the State, alleging that, because the company he represents had acquired the property in reliance on the public land registry (publicidad registral), based on the validity of the registered title (título registral) arising from the judgment issued by the Second Administrative Litigation and Civil Treasury Court at 17:00 hours on 09 de mayo de 1972, and pursuant to the constitutional protection of private property, the property should be expropriated and its market value paid, which in any event could not be less than one hundred million colones. In accordance with the foregoing, and given that the counterclaim (reconvención) filed by the State’s counsel was granted and cancellation of the registry entry (asiento registral) was ordered, analyzing the merits of that claim would be entirely futile because, in light of the ruling, the claimant lacks the right asserted.
With respect to the claim, the State’s counsel, Nombre415, and SINAC raised the defense of lack of legal right (falta de derecho), which must be sustained because the claimant, Sociedad Inversiones Rajpal S.A., has no legally protectable right based on the matters stated above. The counterclaim defendants (reconvenidos), in turn, raised the defenses of statute of limitations (prescripción), expiration (caducidad), lack of standing to sue (falta de legitimación activa), lack of standing to be sued (falta de legitimación pasiva), and lack of legal right. The first two were resolved, and therefore no further statement concerning them is necessary in this section. Regarding standing to be sued, it is clear that the counterclaim defendants, having acquired real property derived from the registry entry challenged by the State’s counsel, have standing to be sued, and that the State has standing to bring an action to protect public-domain assets (bienes de dominio público), such as the Natural Heritage of the State (Patrimonio Natural del Estado). Regarding lack of legal right, as stated throughout this judgment, the legal system supports the arguments and relief sought by the State’s counsel in its counterclaim; consequently, the defense at issue must be rejected and the counterclaim granted in all respects, as is hereby ordered.
Article 193 of the Administrative Litigation Procedure Code (Código Procesal Contencioso Administrativo) provides that litigation costs and attorneys’ fees (costas procesales y personales) shall be imposed on the losing party solely by virtue of having lost. Relief from this award is available only when, in the Court’s judgment, there was sufficient reason to litigate or when the judgment is issued on the basis of evidence of which the opposing party was unaware. With respect to the claim brought by Inversiones Rajpal S.A. against the State, the Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica, and the Sistema Nacional de Áreas de Conservación, the claimant was the losing party, and there are no circumstances warranting exemption from that award. Accordingly, Inversiones Rajpal S.A. is ordered to pay both categories of costs, together with interest thereon until paid in full; those amounts shall be assessed during the judgment-enforcement phase (fase de ejecución de sentencia) upon application by the interested parties.
With respect to the State’s counterclaim against Mr. Nombre112356; Mis Dos Amores S.A.; and Dalanyo S.A., those parties are ordered to pay both categories of costs, together with interest thereon until paid in full, the amount of which shall be established during the judgment-enforcement phase upon application by the State’s counsel.
POR TANTO:
With respect to the counterclaim, the defenses of expiration, statute of limitations, lack of standing to sue, lack of standing to be sued, and lack of legal right are rejected. Consequently, the counterclaim filed by the State against Grupo de Inversiones Rajpal S.A., Mr. Nombre112356; Mis Dos Amores S.A.; and Dalanyo S.A. is granted in all respects. Accordingly, the ruling contained in the judgment issued by the Second Administrative Litigation and Civil Treasury Court at 17:00 hours on 09 de mayo de 1972 is annulled, and consequently Entry No. 1 of Volume 2098, Folio 457, for property number 14718 in the Province of Limón; Entry No. 2 of Volume 2098, Folio 457, for property number 14718 in the Province of Limón, under which that property was registered in the name of Mis Dos Amores, S.A.; Entry No. 3 of Volume 2098, Folio 457, for property number 14718; and Entries 1 through 6, Volumes 333 and 346, of the Real Property Registry of the Province of Limón, under which part of that property was registered in the name of Dalanyo S.A., are annulled, as is the registration of property number 14718-000 of the Limón Registry District (Partido de Limón) in favor of Inversiones Rajpal, S.A., Entry No. 14340, Volume 362 of the Real Property Registry.
Once this judgment becomes final, the Public Registry shall take note thereof for all matters within its purview. With respect to the claim brought by Inversiones Rajpal S.A. against the State, the Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica, and the Sistema Nacional de Áreas de Conservación, the defense of lack of legal right is sustained and, consequently, the claim is denied in all respects. Inversiones Rajpal S.A. shall bear both categories of costs of the proceedings, together with interest thereon until paid in full, with respect to its claim against the State, the Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica, and the Sistema Nacional de Áreas de Conservación; those amounts shall be assessed during the judgment-enforcement phase upon application by the interested parties. With respect to the State’s counterclaim, Mr.
Nombre112356; Mis Dos Amores S.A.; and Dalanyo S.A. shall bear both categories of costs of the proceedings, together with interest thereon until paid in full, the amount of which shall be established during the judgment-enforcement phase upon application by the State’s counsel. Proceso Civil de Hacienda establecido por el Licenciado Álvaro Meza Lázarus, en su condición de Apoderado Especial Judicial de la sociedad Grupo de Inversiones Rajpal S.A., cédula jurídica CED88921 representada por el señor Nombre47457 , pasaporte No. Placa20202 contra el Estado representado por la Licenciada Silvia Quesada Casares, carné Placa20206; la Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica en adelante Nombre415 representada por la Licenciada Karla Mora Rivera, carné 24511 y el Sistema Nacional de Áreas de Conservación en adelante SINAC representado por la Licenciada Magdalena Melegatti Pereira, carné Placa20207. Y contrademanda del Estado contra la sociedad Grupo de Inversiones Rajpal S.A.; el señor Nombre112356 representado por su Curador Procesal, Licenciado Alejandro Fernández Carrillo; la Sociedad Mis Dos Amores S.A. representada por su Curador Procesal el Licenciado Carlos Chaverri Negrino y la sociedad Dalanyo S.A. representada por su Curador Procesal, el Licenciado Brayan Alfaro Aragón.
RESULTANDO:
I.La representación de la sociedad actora planteó proceso Civil de Hacienda día 14 de agosto de 2013, cuyas pretensiones fueron precisadas en la audiencia preliminar realizada en dos tantos durante los días 13 y 21 de febrero de 2020, para que en sentencia se declare: a. Que las fincas del Partido de Limón matrículas de folio real No. Placa20208, Placa20209 y Placa20210 ingresaron al dominio privado de sus propietarios originales desde el año de 1971 cuando se aprobaron las informaciones posesorias de cada una de ellas con anuencia de Nombre415 y sin oposición del entonces ITCO, IDA, hoy INDER o la Procuraduría General de la República. b. Que las fincas del Partido de Limón matrículas de folio real No. Placa20208, Placa20209 y Placa20210 fueron adquiridas por su representada al amparo de la buena fe registral y en su condición de tercero registral, por lo que dicha propiedad no esta sujeta a limitaciones y está protegida por las normas constitucionales que establecen que para anularse la misma o desposeer debe antes expropiarse pagando el precio de mercado. c. Que el derecho de propiedad de su representada ha quedado vaciado haciéndolo nugatorio en razón de que Nombre28548, MINAET y Nombre415 le impidieron a su representada ejercer el dominio pleno sobre sus inmuebles ya que se le ha negado el derecho a percibir los ingresos por concepto del "Pago por Servicios Ambientales". d. Que el Estado indemnice a su representada en cuanto a los daños y perjuicios causados al negarle la posibilidad de obtener una ganancia económica producto del programa "Pago por Servicios Ambientales" durante los años 2010, 2011, 2012 y 2013 tomando en consideración el monto que por hectárea se cancela por esos servicios. e. Que si bien la sociedad INVERSIONES RAJPAL S.A. fue constituida en Costa Rica, ---de manera directa o indirectamente tiene socios canadienses como el señor Nombre47457 ---, por lo que debe aplicarse en la expropiación y en cualquier otra indemnización a determinarse, el acuerdo suscrito entre Costa Rica y Canadá de fecha 18 de marzo de 1998. f. Que siendo que las fincas fueron afectadas por el Sistema Nacional de Áreas de Conservación, Minaet y por Nombre415; debe el Estado expropiarlas y cancelar su valor de mercado en un tiempo prudencial que no puede superar los tres meses, al día que se emita la sentencia, cuyo valor no puede ser inferior a los 100 millones de colones indexados al día de la sentencia. g. Que debe el Estado o en su defecto Nombre415 cancelar dado que la propiedad de su representada ha quedado vaciada en cuanto a su contenido. h. Que son ambas costas a cargo de los demandados en forma solidaria. (Ver imágenes de la 99 a la 116 y de la 155 a la 159 del expediente judicial).
II.Por auto de las 10:04 horas del 06 de setiembre del año 2013, se dio traslado de la demanda al Estado y a Nombre415. (Ver imágenes de la 264 a la 266 del expediente digital judicial).
III.Por escrito recibido el 01 de noviembre de 2013, la representación de Nombre415 contestó de forma negativa la demanda y opuso la excepción de litis consorcio pasivo necesario con respecto al Sistema Nacional de Áreas de Conservación (SINAC) y falta de derecho. (Ver imágenes de la 276 a la 299 del expediente digital judicial).
IV.Por escrito recibido el 14 de noviembre de 2013, la representación del Estado contestó negativamente la demanda y en su defensa opuso las excepciones de litis consorcio pasivo necesario y falta de derecho. Además, planteó contrademanda contra Grupo de Inversiones Rajpal S.A., cédula jurídica CED88921, Nombre112356 ; sociedad Mis Dos Amores S.A. y la sociedad Dalanyo S.A., y peticionó lo siguiente: 1. Que se declare la nulidad de la información posesoria tramitada bajo el expediente número 1721 del año 1970 del Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda, y se anule la sentencia dictada por ese juzgado a las diecisiete horas del nueve de mayo de mil novecientos setenta y dos. 2. Que se declare la nulidad del asiento 1 del tomo 2098 del folio 457 de la finca número 14718 de la Provincia de Limón, según el cual dicha finca quedó inscrita a nombre de Nombre112356 , y se ordene la anulación de la inscripción de la finca número 14718 de la Provincia de Limón. 3.
Que se declare la nulidad del asiento 2 del Tomo 2098 del Folio 457 de la finca número 14718 de la Provincia de Limón, según el cual dicha finca quedó inscrita a nombre de la sociedad Mis Dos Amores, S.A., y se ordene su anulación. 4. Que se declare la nulidad del asiento 3 del Tomo 2098 del Folio 457 de la finca número 14718 de la Provincia de Limón, según el cual parte de dicha finca quedó inscrita a nombre de la sociedad Dalanyo S.A. y se ordene su anulación. 5. Que se declare la nulidad de la inscripción de la finca número 14718-000 del Partido de Limón a favor de Inversiones Rajpal, S.A., asiento 14340, tomo 362 del Registro Inmobiliario. 6. Que se declare la nulidad de la inscripción de la finca número 16370 del Partido de Limón a favor de la sociedad Dalanyo S.A., asientos 1 al 6, tomos 333 y 346 del Registro Inmobiliario. 7. Que se condene a los demandados en forma solidaria al pago de ambas costas de esta contrademanda, así como los intereses que éstas generen hasta su efectivo pago. (Ver imágenes de la 369 a la 407 del expediente digital judicial).
V.Por resolución de las 09:04 horas del 15 de enero de 2014, de la contestación de la demanda y excepciones opuestas por Nombre415 y el Estado se dio traslado a la sociedad actora, y así como de la contrademanda a la actora y al señor Nombre112356 , a la Sociedad Mis Dos Amores S.A. y a la Sociedad Dalanyo S.A. (Ver imágenes 567 y 568 del expediente digital judicial).
VI.Por escrito recibido el día 18 de febrero de 2014, la representación de la sociedad Grupo de Inversiones Rajpal S.A. contestó negativamente la reconvención y en su defensa opuso la excepción de indebida representación, falta de legitimación pasiva y activa y falta de derecho. (Ver imágenes de la 596 a la 600 del expediente digital judicial).
VII.Por resolución No. 3024-2014 de las 08 horas del 17 de noviembre de 2014, se acogió la excepción de falta de integración de la litis y se integró pasivamente al Sistema Nacional de Áreas de Conservación (SINAC). (Ver imágenes de la 637 a la 642 del expediente digital judicial).
VIII.Por auto de las 08:03 horas del 07 de enero del año 2015, se dio traslado de la demanda al SINAC. (Ver imágenes 719 y 720 del expediente digital judicial).
IX.Por escrito recibido el día 19 de febrero de 2015, la representación del SINAC contestó negativamente la demanda y en su defensa opuso la excepción de falta de derecho. (Ver imágenes de la 768 a la 798 del expediente digital judicial).
X.Por escrito recibido el día 06 de enero de 2016 el curador procesal del señor Nombre112356 contestó la demanda en forma negativa en su defensa opuso las excepciones de falta de legitimación activa y pasiva; falta de derecho, caducidad y prescripción. (Ver imágenes de la 918 a la 922 del expediente digital judicial).
XI.Por escrito de fecha 11 de agosto de 2016, el curador procesal de la sociedad Mis Dos Amores S.A., también rechazó los hechos de la demanda y en su defensa opuso las excepciones de falta de legitimación activa y pasiva; falta de derecho y prescripción. (Ver imágenes de la 1000 a la 1007 del expediente digital judicial).
XII.Por escrito de fecha 15 de noviembre de 2016, el curador procesal de la sociedad Dalanyo S.A., contestó la demanda en sentido negativo y en su defensa opuso la excepción de falta de integración de la litis. (Ver imágenes de la 1044 a la 1047 del expediente judicial digital).
XIII.Por resolución de las 11:42 horas del 19 de diciembre de 2016, y de las 13:00 horas del 01 de marzo de 2017, de la contestación de la contrademanda y excepciones opuestas por la representación de la sociedad Grupo de Inversiones Rajpal S.A. y de los curadores procesales del señor Nombre112356 , la sociedad Mis Dos Amores S.A. y de la sociedad Dalanyo S.A. se dio audiencia al Estado. (Ver imagen 1056 y 1088 del expediente judicial digital).
XIV.Por escrito recibido el día 09 de enero de 2017, la representación estatal se refirió a la contestación de los reconvenidos y las excepciones opuestas. (Ver imagen 1059 a la 1063 del expediente judicial digital).
XV.La audiencia preliminar se realizó en dos tantos durante los días 13 y 21 de febrero de 2020, en la que se precisaron las pretensiones de la demanda y la reconvención en los términos indicados supra, se determinaron los hechos controvertidos y se admitió la prueba y agotadas todas las fases, se declaró conforme al artículo 98 del CPCA como un asunto de puro derecho y las partes rindieron sus conclusiones por escrito. (Ver imágenes de la 1155 a la 1159 y de la 1173 a la 1181 del expediente judicial digital).
XVI.El expediente fue turnado a la Sección Cuarta del Tribunal en fecha dos de noviembre del dos mil veinte. Esta resolución se dicta, previa deliberación. No se notan causales de nulidad capaces de invalidar lo actuado.
Redacta el Juez Salas Nombre112356, con el voto afirmativo del juzgador Córdoba Ramírez y el juzgador Baltodano Gómez.
CONSIDERANDO:
La representación de la sociedad actora planteó proceso Civil de Hacienda solicitando que en sentencia se declare que las fincas del Partido de Limón No. 14660-000, 14718-000 y 14810-000 ingresaron al dominio privado desde el año de 1971 mediante información posesoria con la anuencia de Nombre415 y sin oposición del entonces ITCO y de la Procuraduría General de la República. Que el derecho de propiedad de su representada ha quedado vaciado haciéndolo nugatorio en razón de que Nombre28548, MINAET y Nombre415 le impidieron ejercer el dominio pleno sobre sus inmuebles al negarle su derecho a percibir los ingresos por concepto del "Pago por Servicios Ambientales", durante los años 2010, 2011, 2012 y 2013 siendo afectadas por el Sistema Nacional de Áreas de Conservación. Que siendo que las fincas fueron adquiridas por su representada al amparo de la buena fe registral y en su condición de tercero registral, sin sujeción a limitaciones y protegida por las normas constitucionales que establecen que para anularse la misma o desposeer debe antes expropiarse pagando el precio de mercado; deberá el Estado indemnizarla por los daños y perjuicios causados al negarle la posibilidad de obtener una ganancia económica producto del pago de servicios ambientales tomando en consideración el monto que por hectárea se cancela por esos servicios y dado que su derecho de propiedad ha quedado vaciado de contenido, debe el Estado o Nombre415 expropiar los inmuebles y cancelar su valor de mercado en un tiempo prudencial que no puede superar los tres meses, al día que se emita la sentencia, cuyo valor no puede ser inferior a los 100 millones de colones indexados.
En síntesis y sin perjuicio de la literalidad de sus argumentaciones, las cuales han sido estudiadas en su totalidad por este Tribunal, cada una de las partes alegan lo que seguidamente se detalla en este apartado. A) Sobre los hechos: Que se promovió información posesoria sobre los inmuebles los cuales se inscribieron desde el año de 1971, bajo los número del Partido de Limón matrículas de Folio Real Placa20210 con una cabida de 271.001.023 mts2.; Placa20209 con una cabida de 27.193.019 Mts2 plano Placa20211 y la No. Placa20212 con una cabida de 241.996.062 mts2 plano L-0001584-1971, en las que no hubo oposición del Estado, ni de Japdeva, ni del entonces ITCO, gozando desde la fecha de inscripción de la publicidad registral por mas de 30 años. Que posteriormente esas fincas fueron traspasadas por sus promoventes a la sociedad Mis Dos Amores S.A., la cual adquirió un préstamo de Inversiones Rajpal S.A. y ante el incumplimiento de la deudora su representada el día 03 de febrero de 1988, se adjudicó en remate las fincas del Partido de Limón matrículas Placa20208 y Placa20210, ante el Jugado Segundo Civil de San José, inscribiéndose esas fincas a su nombre desde el día 03 de marzo de 1989 y la finca Placa20209 desde el día 11 de mayo de 1987, sin advertirse la existencia de restricción, limitación o gravamen, ni la condición de humedales, inscribiéndose dicha finca en el Registro Público, a su nombre desde el 15 de febrero de 1988.
Que durante los años 2009 y 2010 su representada presentó una solicitud para ingresar al programa de "Pago de Servicios Ambientales" (PSA), sin embargo ante consulta realizada por oficio FONAFIFO-LM-389-2010 a Japdeva, por oficio AL-589-2011 del 15 de noviembre de 2011, el Departamento Legal de Nombre415 informó que las fincas se encontraban dentro del límite de las tierras patrimonio de Nombre415, así como dentro de una área clasificada como Área Silvestre Protegida en su categoría de Humedal por lo que de conformidad con la Ley Forestal 7575 de 1995 los terrenos en tales condiciones integran el Patrimonio Natural del Estado y su administración corresponde al MINAET a través del Sistema Nacional de Aras de Conservación y consecuentemente indicó que la pre-solicitud para ingresar al PSA no estaba a derecho, por la demanialidad e imprescriptibilidad de dichos terrenos. Además, el Sistema Nacional de Áreas de Conservación Área de Conservación La Amistad Caribe mediante oficios 195, 207 y 208 del 25 del mes de octubre de 2012, indicó que los inmuebles se encontraban dentro de una finca patrimonio de Nombre415 según el plano Placa20213 matrícula de folio real Placa20214 donde ocupa una área clasificada como humedal que constituye Patrimonio Natural del Estado.
Que como se desprende de los hechos anteriores, su representada es propietaria de tres fincas que adquirió mediante remate. Fincas que aunque se ubican dentro del patrimonio que fue originalmente adjudicado a Nombre415 por Ley, eran patrimonio de los particulares porque habían sido poseídas por 10 años de anterioridad a la asignación de dichas tierras a Nombre415 y se encontraban debidamente inscritas en el Registro Público por más de diez años cuando las adquirió su representada y por más de treinta años a la actualidad; encontrándose las mismas amparadas a un título registral, que no contaba con anotación o advertencia alguna de la situación denunciada. Que los inmuebles de su representada están garantizados por el artículo 45 de la Constitución Política que establece que la propiedad privada es inviolable y a nadie puede privarse de la suya si no es por interés público o interés social, previo pago de una indemnización justa, la cual se reclama en este acto por lo que procedente es la expropiación de dichas fincas, dado que el derecho de obtener un beneficio con relación a ellas se ha anulado.
Que para efectos de la expropiación debe tomarse en cuenta que el 18 de marzo de 1998, Costa Rica y Canadá firmaron un acuerdo para la promoción y protección de inversiones e inversionistas de ciudadanos canadienses en Costa Rica, convenio que debe ser aplicado en este caso al ser el señor Nombre47457 , ciudadano canadiense quien realizó inversiones en Costa Rica a través de la compra de los inmuebles cuyo contenido ha sido vaciado por los pronunciamientos que las oficinas estatales han emitido y que han tornado improductivos dichos inmuebles y que al amparo de ese Convenio las expropiaciones a pagar a los ciudadanos canadiense que directa o indirectamente tienen inversiones en Costa Rica en bienes que deban ser expropiados debe tomarse en cuenta suvalor de mercado. B) Sobre el derecho: Que la doctrina ha indicado que el principio de publicidad registral está referido en general a "favor del titular de la inscripción, de aquél que tiene derechos derivados del anterior y de terceros extraños al registro".
FUEYO LANERI (Fernando. Teoría General de los Registros, Buenos Aires, Argentina, Editorial Astrea, Primera Edición, 1982, Pág. 197). Que esta publicidad registral se da de dos maneras: Una llamada publicidad formal del Registro, como instrumento informativo, lo que "consiste en el derecho que tiene cualquier persona a solicitar que se le manifiesten los libros del registro, y en la obligación del registrador de poner a disposición de los solicitantes cuantos datos soliciten" (RODRÍGUEZ, Joaquín. Curso de Derecho Mercantil, México, Editorial Porrúa, Tomo I, 1979, Pág.246.) La otra, llamada publicidad material, es la que determina los efectos principales del Registro que son: A. Aspecto positivo de la Publicidad Registral en cuanto a que lo inscrito se supone conocido por terceros. B. Aspecto negativo de la Publicidad Registral, en cuanto que lo no inscrito, no puede perjudicar a terceros de buena fe.
Que esta publicidad registral material se encuentra consagrada en el primer párrafo del artículo 455 de nuestro Código Civil, cuando establece que: "los títulos sujetos a inscripción, que no estén inscritos, no perjudican a terceros, sino desde la fecha de su presentación al Registro." Que conforme a ello, la fe pública registral es un principio y establece la presunción a favor de terceros, de que los asientos registrales son exactos y completos, y quien realiza una transacción al amparo del Registro, la realiza como interesado de buena fe y el título es oponible a terceros. Que la fe pública es un efecto de la publicidad, que nace del Registro de la Propiedad, por el que provoca una doble protección a través de una doble presunción la cual surge de los asientos registrales: Una protección iuris tantum que determina que los derechos reales publicados por el Registro existen y pertenecen a su titular en la forma determinada por el asiento respectivo, que es la del principio de legitimación registral.
La otra presunción es iure et de iure a favor de los terceros adquirentes quienes cumplen con los requisitos legales. Estos le dan una posición firme de su adquisición y constituye la fe pública registral. Que esta fe pública tiene dos presunciones, que son: Presunción positiva de la Fe Pública Registral: Es el que presume como tercero, a quien no ha sido parte en el acto o contrato o que se refiere la inscripción y presenta un título al Registro. Que la presunción negativa de la Fe Pública Registral: Significa que lo que no aparezca explícitamente en las inscripciones registrales, presumiblemente, no existe en la realidad jurídica. Que la Ley de "Inscripción de Documentos en el Registro Público" en su artículo 1 señala que el propósito del Registro Nacional es garantizar la seguridad de los bienes o derechos inscritos con respecto a terceros y el artículo 9 la obligación del Registro de realizar todas las gestiones pertinentes, incluyendo la obtención de documentos o copias para corregir errores u omisiones en que hubieran incurrido los Registradores al anotar o inscribir documentos.
Que por consiguiente, no procede exigir a las partes o interesados que aporten documento o lleven a cabo gestiones para la corrección de esos errores del Registro y por ende existe una responsabilidad objetiva del Estado que se produce cuando quien adquiere al amparo del Registro un título inscrito durante más de treinta años y se le niega la posibilidad de disfrutar plenamente de la propiedad de dichos inmuebles ya que al respecto señala la Ley General de Administración Pública en su artículo 190 que la Administración responderá por todos los daños que cause su funcionamiento legítimo o ilegitimo, normal o anormal, salvo fuerza mayor, culpa de la víctima o hecho de un tercero. Que en esta línea la Sala Primera de la Corte Suprema de Justicia ha dicho que "basta la existencia de un resultado dañoso que cause un perjuicio efectivo, evaluable económicamente e individualizado respecto a una persona o un grupo de personas, para que suya la obligación de indemnizar, sin que se requiera otro requisito que al relación de causalidad entre el acto y el daño y prescindiendo en absoluto de la licitud o ilicitud del acto originador del daño." (véase Sala-Primera voto 112 de 14 y 25 horas del 25 de diciembre de 1994).
Que sobre la buena fe y la publicidad registral la Sala Primera de la Corte Suprema de Justicia en su voto 162-F-01 de las 8 horas 15 minutos del 16 de febrero de 2001 dijo: "...En la especie, señor Nombre112357 adquirió el inmueble de cita, directamente de la persona que aparecía como dueña en el Registro Público de la Propiedad, por ende, no estaba a su alcance determinar si el derecho de esa persona provenía o no de un acto nulo, pues con su inscripción registral obtuvo la apariencia de un acto válido y eficaz, siendo el adquirente de buena fe al amparo de la mencionada institución." Que se está ante el amparo del artículo 456 del Código Civil la declaratoria de nulidad que pueda establecerse en contra de títulos de propiedad que se encuentren en poder de personas distintas a los que promovieron las gestiones de titulación no puede perjudicarles y por ende debe tenerse entonces como terceros adquirentes de buena fe.
Todo lo anterior con fundamento en los artículos 45, de la Constitución Política, 264, 266, 267, 268, 269 siguientes y concordantes, 455, 456 siguientes y concordantes del Código Civil, 409, 410, 426 siguientes y concordantes, 449, 450, 457, 462, 865 siguientes y concordantes del Código Civil, 1 siguientes y concordantes del Código Procesal Contencioso Administrativo, 1 siguientes y concordante de la Ley de Informaciones Posesorias, 1 siguientes y concordantes de la Ley de Inscripción de Documentos en el Registro Público. La representación de la Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica, contestó la demanda de la siguiente manera: A) Sobre los hechos: Que las propiedades reúnen las típicas características de la demanialidad e imprescriptibilidad, las cuales no son susceptibles de inscripción ante el Registro Público, por lo que su invasión y ocupación serían sancionados y Nombre415 continuará con el dominio en virtud de que forman parte de su patrimonio, salvo las áreas que integren el Patrimonio Natural del Estado que corresponde su administración al Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET), a través del Sistema Nacional de Áreas de Conservación.
Que la Ley Forestal en su artículo 13 establece que el Patrimonio del Estado está constituido por todas las fincas inscritas a su nombre y las de las instituciones autónomas, y que con lo que respecta a ese patrimonio natural el artículo 15 define los impedimentos que tiene la administración pública, prohibiéndose la permuta, el ceder, enajenar, ni entregar en arriendo terrenos rurales o bajo su administración sin que antes hayan sido clasificados por el MINAET, y esto constituirá una limitación que deberá inscribirse en el Registro Público. Que es importante acotar que nuestra legislación crea un sistema en que la afectación se torna en el elemento primordial para la inclusión de un bien de dominio público, por lo tanto será de dominio público un bien destinado por ley o por un acto administrativo, cuando ésta lo autorice. Que cuando un bien es integrado al régimen de dominio público, adquiere una serie de características esenciales como la inalienabilidad, la imprescriptibilidad, y la inembargabilidad, por lo que estos bienes no requieren ser expropiados.
Que los terrenos inscritos a nombre de Nombre415 se hicieron por disposición de su Ley Orgánica No. 3091 del 18 de febrero de 1963, reformada posteriormente por la ley No. 5337 del 27 de agosto de 1973, en sus artículos 2 y 41 inciso b) los cuales señalan que le corresponderán todos los terrenos del Estado situados en el área habilitada por canales navegables comprendidos en una área de 10 kilómetros desde el mar hacia el interior paralela a la costa y una faja de 3 kilómetros de ancho, paralela a ambos lados de los ríos y canales que administre la Junta, y de conformidad con el folio real No. 7-096658-000, plano catastrado L-000001-1977. Que se trata entonces de terrenos que fueron otorgados por Ley, ---los que como ha dicho la Procuraduría General de la República--- ostentan una condición de demaniales, y por ende inalienables, imprescriptibles e intransferibles, por cuanto se encuentran fuera del comercio de los hombres, ya que son terrenos del Estado asignados a un ente en especifico, en este caso a Nombre415.
Que paradójicamente si bien se les ha dado una condición general de demaniales por estar fuera del comercio de los hombres, en muchos sectores existen gran cantidad de porciones que se encuentran debidamente inscritas en el Registro Público Nacional. Que no obstante lo anterior, se puede rescatar que si bien las propiedades indicadas por el señor Ram Rajpal S.A, se encuentran materialmente dentro de los linderos de la propiedad de Nombre415 inscrita a bajo folio real del Partido de Limón No. 7-096658-000, la cual nació a la vida jurídica por Escritura Pública numero 132, de las 10 horas del día 8 de junio del año 2001; la Notario del Estado, Licda. Gladys Herrera Raven, indicó que la misma nacía a la vida jurídica respetando los derechos adquiridos por terceros de buena fe, ello por cuanto dentro de los límites territoriales de la propiedad que pertenece a Nombre415 hay todo un mapa de propiedades debidamente inscritas, de manera que todas aquellas propiedades que hubiesen nacido a la vida jurídica previo a esa fecha (8 de junio del año 2001); se les debía de respetar su inscripción, de manera que Nombre415 debe aceptar que existen terceros con mejor derecho, siempre y cuando se demuestre que la inscripción de las o las propiedades, se hizo previo a la inscripción de la finca 7-96658-000.
Que en el presente caso las propiedades de la sociedad Inversiones Rapjal S.A surgieron a la vida jurídica, previo al nacimiento de la propiedad de Nombre415, tal y como así lo hace ver el Registro Público en sus certificaciones, y bajo el consabido principio jurídico de que "primero en tiempo, primero en derecho" le pertenecerían a la sociedad actora. Indicó que otra cosa lo es con respecto a las propiedades que estando dentro de los límites territoriales de Nombre415, sean áreas dedicadas a bosques o que sean parte del Patrimonio Natural del Estado, situación que por competencia material le corresponde al MINAET su conocimiento. B) Sobre el derecho: Que el articulo 16 de la Ley General de la Administración Pública, señala que en ningún caso podrán dictarse actos contrario a las reglas unívocas de la ciencia o de la técnica, o a principios elementales de justicia, lógica o conveniencia y que respetando el principio jurídico de "primero en tiempo, primero en derecho", a partir de lo señalado por la Notaria del Estado al momento de la inscripción de las tierras propiedad de Nombre415 en la escritura No. Placa20215, en donde se dispuso que el traspaso se hacia sin perjuicio de terceros con mejor derecho, entendiéndose con esto, que aquellos que ostentan titularidad (derecho) antes de la inscripción de las tierras de Nombre415, gozan del derecho sobre su porción legalmente inscrita.
Que conforme a la Ley Forestal de 1969, en la que se acuñó el término "Patrimonio Forestal del Estado", que luego se modificó en la Ley Forestal No. 7575 del año 1996 por "Patrimonio Natural del Estado", sin embargo se indicó en dicha ley que, el manejo y administración de dicho Patrimonio, le correspondía al MINAE hoy MINAET. De forma que la administración del Patrimonio Natural del Estado escapa a las funciones encargadas a Nombre415. Que la Sala Constitucional, en su resolución No. 5893-95 de las 9:48 horas del 27 de octubre de 1997, señaló la pertinencia de limitar el ejercicio del derecho de propiedad o de libre iniciativa económica por motivos ambientales y en esa misma línea también la Sala Primera, en su sentencia No 5893-95 de las 9:48 horas del 27 de octubre de 1997, en la que indicó: "Se trata de bienes con un régimen jurídico mixto; privados en cuanto a su titularidad, pero cumpliendo una función determinada por el interés público o común, en tanto limitación o restricción a la propiedad privada.
Esta es la doctrina del artículo 45 de la Constitución Política. En tratándose de bienes de uso restringido, en cuanto limitaciones a la propiedad, ese régimen jurídico especial no Implica necesariamente la expropiación y mucho menos la indemnización, pues los privados mantienen su titularidad." De manera que, teniendo en consideración que los terrenos en cuestión, se encuentran catalogados de gran auge forestal, en caso de llegar a determinarse por parte del ente competente (SINAC) que dichos terrenos pertenecen al Patrimonio Natural del Estado, los actuales ocupantes se encontrarían detentando bienes, de dominio público, -de los cuales su naturaleza jurídica ya se consideró. Finalmente señaló que frente al ejercicio de los derechos fundamentales como la propiedad privada; la libertad de comercio no es irrestricta, por ende es consecuente limitarlos por razones de bienestar social, siendo que el derecho a un ambiente sano y a la salud son derechos fundamentales que el Estado debe proteger; el imponer límites al derecho de propiedad y la libre iniciativa económica se justifican en aras de defensa del medio ambiente, con ello se pretende un equilibrio entre la conservación y la producción, ambos se respaldan en intereses de carácter social, de manera que de todo lo manifestado, se encuentra racional y constitucionalmente válido imponer limitaciones a la propiedad privada en pro de la conservación del medio ambiente y del patrimonio forestal.
Por su parte el Sistema Nacional de Áreas de Conservación indicó a manera de síntesis y en lo que interesa: A) Sobre los hechos: Que las fincas matrículas números Placa20210, Placa20209 y Placa20208 fueron inscritas en el Registro Público de la Propiedad a nombre de particulares por medio de información posesoria en el año 1972. Luego fueron traspasadas a la sociedad Mis Dos Amores, S.A. y actualmente se encuentran inscritas en el Registro Nacional a nombre de la sociedad actora; sin embargo están ubicadas en terrenos propiedad de la Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica (Nombre415), traspasados a dicha Institución por Ley No. 3091 de 18 de febrero de 1963 e inscritos bajo el folio real matrícula Placa20214; de manera que las fincas objeto de este proceso fueron inscritas como propiedad privada con posterioridad a que Nombre415 se convirtiera en su propietaria, y no diez años antes como lo afirma la parte actora.
Nótese que en el caso de la finca número Placa20209 la posesión del promovente de la información posesoria se inició en el año 1960, tres años antes de que Nombre415 se convirtiera por ley en la propietaria de los terrenos en que se ubica dicha finca. Aunado a ello se tiene que en el oficio RIM-CT-00736-2013 de 17 de octubre de 2013, suscrito por el señor Marlon Aguilar Chaves, Subdirector Catastral del Registro Inmobiliario y en el informe del Instituto Geográfico Nacional No. DGIGN-RN-2013-062 de 4 de octubre del 2013 y del Área de Conservación La Amistad-Caribe contenido en el oficio SINAC-ACLAC-PNE-065-2013 de 9 de octubre de 2013; se indicó que dichas fincas están cubiertas de bosque. Que el Lic. Carlos Eduardo Vargas Ramírez, Coordinador de Patrimonio Natural del Estado del Área de Conservación La Amistad Caribe (ACLAC), emitió las certificaciones SINAC-ACLAC-PNE-195-2012 (plano catastrado N° L-1584-1971), SINACACLAC-PNE-207-2012 (plano catastrado N° L-1585-1971) y SINAC-ACLAC-PNE-208-2012 (plano catastrado N° L-1586-1971); reiteró que si bien las propiedades se encuentran fuera de cualquier Área Silvestre Protegida administrada por el SINAC, no obstante se ubican dentro de la finca patrimonio de la Junta de Administración Portuaria y de Desarrollo de la vertiente Atlántica (Japdeva) folio real N° 7096658-000, con plano catastrado Placa20203° y que sus planos catastrados presentan condiciones de áreas con humedal.
Que debido a que los terrenos sobre los cuales la parte actora planteó el reclamo, traslapan con la finca propiedad del Estado y por tal razón afectos al dominio público, dichos bienes poseen características particulares como la imprescriptibilidad, la inalienabilidad e inembargabilidad. Que la parte actora no demostró que su posesión decenal sobre las fincas fuese con anterioridad a la entrada en vigencia de la Ley No. 3091 del 18 de febrero de 1963. Que además de lo anterior es importante considerar que el Lic. Carlos Eduardo Vargas Ramírez, Coordinador de Patrimonio Natural del Estado del Área de Conservación La Amistad Caribe (ACLAC), del Sistema Nacional de Áreas de Conservación, emitió las certificaciones SINAC-ACLAC-PNE-195-2012 (plano catastrado No. L-1584-1971), SINAC-ACLAC-PNE-207-2012 (plano catastrado N° L-1585-1971) y SINAC-ACLAC-PNE-208-2012 (plano catastrado No. L-1586-1971), en las que indicó que las propiedades que se ubican dentro de la finca patrimonio de Nombre415 No. Placa20214, con plano catastrado N° L-00001-1977, presentan condiciones de áreas con humedal, según consultoría de Patrimonio Natural del Estado realizado a Japdeva.
De forma que, además de que dichos terrenos que fueron traspasados a Nombre415 por la Ley número 3091 de 18 de febrero de 1963, inscritos bajo el folio real matrícula Placa20214 en principio lo fueron como bienes patrimoniales de dicho ente, sin embargo, con la entrada en vigencia de la Ley Forestal número 4465 de 29 de noviembre de 1969, ---y sus reformas por Ley No. 7174 de 28 de junio de 1990 y 7575 de 13 de febrero de 1996---; se dispuso que aquella parte de los terrenos cubiertos de bosques o que eran de aptitud forestal, que pertenecieran al Estado y a sus instituciones, pasaban a formar parte de lo que entonces se llamó "Patrimonio Forestal del Estado", con lo cual adquirieron la condición de bienes demaniales. Que de esta forma dichas zonas ingresaron a formar parte de "los bienes de dominio público", a los cuales se le da una tutela especial en el artículo 121 inciso 14) de la Constitución Política, que dispone que son bienes propios de la Nación, y solo podrán salir definitivamente de su dominio por medio de autorización de la Asamblea Legislativa ya que dichos bienes poseen características particulares como la imprescriptibilidad, la inalienabilidad e inembargabilidad.
Que por esa circunstancia los terrenos que la actora dice poseer no pueden ser objeto de posesión apta para usucapir, por lo que la petición formulada por la parte actora con relación a las fincas N° 14718-000, 14810-000 y 14660-000, es jurídicamente improcedente, por cuanto no pudieron haber ingresado al dominio privado en el año 1971, ya que para dicha fecha dichas fincas eran propiedad de Nombre415 desde el año 1963, por lo cual para que hubieran sido adquiridas por usucapión debieron ser antes del 18 de febrero de 1963. Que es importante indicar, que con respecto a los bienes demaniales rige el principio de inmatriculación en razón del cual su carácter de bienes públicos afectos a un uso, servicio o fin público no requiere de su inscripción en el Registro Nacional, por lo cual en el caso de los bienes demaniales, no es necesario que estén inscritos para que surtan efectos frente a terceros, dado a lo anterior no pueden alegar la condición de adquirente de buena fe dado el carácter inalienable e imprescriptible de estos.
Finalmente, que el otorgamiento del beneficio del pago por servicios ambientales es un acto administrativo que tiene un ámbito de discrecionalidad por parte de la Administración Forestal del Estado y no constituye un derecho, ni parte del derecho de propiedad de los particulares, ya que estos se limitan hacer la solicitud respectiva y según las previsiones presupuestarias, las prioridades y criterios adoptados, así como las circunstancias de cada caso en particular, se otorga o no el beneficio, de conformidad con el trámite establecido en el citado reglamento, artículos 39 y 40, se trata pues, de un beneficio sujeto a determinados requisitos y otorgado según las prioridades y criterios definidos por la Administración y de conformidad con lo dicho, y que al no existir la obligación de expropiar, no es de aplicación lo dispuesto en el "Acuerdo con Canadá sobre Promoción y Protección Recíproca de Inversiones", aprobado por Ley número 7870 de 5 de mayo de 1999.
Finalmente la representación estatal indicó: A) Sobre los hechos: Que conforme al oficio RIM-CT-00736-2013 de 17 de octubre de 2013, suscrito por el Subdirector Catastral del Registro Inmobiliario, la Junta de Administración Portuaria y de Desarrollo Económico de la vertiente Atlántica (Japdeva), es propietaria de los bienes inmuebles inscritos bajo el folio real matrícula Placa20214. Que esos terrenos le fueron traspasados a esa institución estatal por Ley No. 3091 de 18 de febrero de 1963. Que aun cuando la actora indicó que las fincas números 14810-000, 14718-000 y 14660-000 poseen naturaleza agrícola; conforme al oficio número DG-IGN-RN-2013-062 de 4 de octubre del 2013, del Instituto Geográfico Nacional y al oficio SINAC-ACOC-PNE-065-2013 de 9 de octubre de 2013, del Área de Conservación La Amistad-Caribe; dichas fincas están cubiertas de bosque, por lo que constituyen Patrimonio Natural del Estado.
Que así las cosas, dichas fincas por un lado fueron inscritas a nombre de Nombre415 desde el año 1963 y por otro forman parte del Patrimonio Natural del Estado. Que en el caso de la finca número 14718-000 la posesión del promovente se inició en 1960, sólo tres años antes de que Nombre415 se convirtiera por ley en la propietaria de los terrenos en que se ubica dicha finca. Que si bien el Estado de Costa Rica y Canadá suscribieron un convenio para la promoción y protección de inversiones canadienses en Costa Rica; sin embargo la aplicación en este caso del convenio es una apreciación del representante de la actora y no un hecho puro y simple y no es cierto que el Estado le haya causado daños y perjuicios. B) Sobre el fondo: a. Sobre la invalidez de la inscripción de las fincas del Partido de Limón números Placa20210, 14718-000 y Placa20208. Que las fincas del Partido de Limón números 14810-000, 14718-000 y Placa20217, tuvieron su origen en un proceso de información posesoria en razón de los cuales se inscribieron a favor de particulares en el año 1972, sin embargo las fincas citadas, con planos catastrados L-1584-1971, L-1585-1971 y L-1586-1971, se traslapan con los terrenos de la finca número Placa20214.
Terrenos que fueron traspasados a Nombre415 por la Ley No. 3091 de 18 de febrero de 1963, inscritos bajo el folio real matrícula Placa20214 en principio lo fueron como bienes patrimoniales de dicho ente; sin embargo, conforme a los artículos 18, 19, 28, 40 y 41 de la Ley Forestal número 4465 de 29 de noviembre de 1969, (Reformada por ley No. 7174 y la 7575) aquella parte de dichos terrenos cubiertos de bosques o que son de aptitud forestal, que pertenecieran al Estado o a sus instituciones, pasaron a formar parte desde entonces del Patrimonio Forestal del Estado, con lo cual adquirieron la condición de bienes de dominio público. Que desde la primera Ley Forestal, del 25 de noviembre de 1969, los terrenos propiedad de las instituciones autónomas cubiertos de bosque o que sean de aptitud forestal, forman parte del Patrimonio Natural de Estado, antes denominado Patrimonio Forestal del Estado y son, desde entonces, bienes demaniales.
Que el carácter demanial de los terrenos incorporados al entonces denominado Patrimonio Forestal del Estado, hoy Patrimonio Natural del Estado, implica que su posesión por particulares no generó derecho alguno. De allí que no podrían ser adquiridos por usucapión. Es decir, aquellos terrenos de la finca que finalmente quedó inscrita bajo el folio real 7-096658-000, pero que era propiedad de Nombre415 desde la entrada en vigencia de la Ley 3091 de 18 de febrero de 1963; también quedaron incorporados al Patrimonio Forestal del Estado y adquirieron el carácter de bienes de dominio público a partir del año 1969. Que conforme a lo indicado en el oficio No. RIM-CIT-00736-2013 de la Subdirección del Registro Inmobiliario, así como la foto-interpretación contenida en el informe oficio número DG-IGN-RN-2013-062 hecha por el Instituto Geográfico Nacional se constata la naturaleza que tienen dicho terrenos.
Que todo lo dicho significa que, la validez de la inscripción de las fincas números Placa20210, Placa20209 y Placa20208, depende de cuando se haya iniciado la posesión, sin embargo no acreditan que esa posesión se hubiese dado entre 1953 y 1963. Que el gestionante sostuvo que al año 1970 tenía una posesión de 10 años, de forma que al año 1963 fecha en que los terrenos fueron traspasados a Nombre415 apenas tenía 3 años de posesión insuficientes para usucapir y en relación con aquellas partes que tenían bosque, pasó a formar parte del Patrimonio Forestal del Estado desde el año de 1969. Que para el caso es irrelevante que la finca propiedad de Nombre415 fuera inscrita hasta el año 2001, pues al tratarse de un bien de dominio público rige el principio de inmatriculación en virtud de cual no es necesario que el bien esté inscrito en el Registro Público para que la titularidad pública de aquél afecte a terceros.
De allí que dicha inscripción es nula. En consecuencia, es jurídicamente improcedente la petición de la sociedad actora consistente en que se declare que la finca de Partido de Limón matrícula folio real número Placa20218, ingresó al dominio privado desde el año 1971. Pero también lo es respecto de las fincas 14810-000 y 14660-000, pues no pudieron haber ingresado al dominio privado en 1971 ya que para ese entonces los terrenos sobre los cuales estaban ubicadas eran propiedad de Nombre415 desde 1963. b. Sobre la adquisición de buena fe frente a bienes demaniales. Que en el caso de los bienes demaniales, no rige lo dispuesto en los artículos 455 y 456 del Código Civil en relación con terceros que adquieren al amparo de la publicidad registral. Que en primer lugar, no es necesario que los bienes demaniales estén inscritos para que surtan efectos frente a terceros, dado el principio de inmatriculación que rige para este tipo de bienes; y, en segundo lugar, no puede alegarse la condición de adquirente de buena fe en el caso de los bienes demaniales dado el carácter inalienable e imprescriptible de estos.
Que la nulidad del acto mediante el cual se inscribió a favor de un particular un bien de dominio público, sí afecta al tercero que adquirió con base en la fe pública registral del Registro Nacional, ya que de lo contrario implicaría permitir a un privado -el tercero adquirente con base en la publicidad registral- convertirse en propietario de un bien de dominio público, a despecho del carácter inalienable de estos bienes. c. Sobre el pago de servicios ambientales y el "vaciamiento" del derecho de propiedad y no pago de servicios ambientales. Que el pago por servicios ambientales -establecido en el artículo 46 de la Ley Forestal número 7575- es la expresión jurídica de una política de fomento destinada a estimular tanto la conservación del bosque como las plantaciones forestales que tiene un ámbito de discrecionalidad por parte de la Administración Ambiental y no constituye un derecho parte del derecho de propiedad de los particulares. e. Sobre el alegado deber estatal de expropiar en el presente caso y la aplicación del "Acuerdo con Canadá sobre Promoción y Protección Recíproca de Inversiones".
Que no se está ante un caso de expropiación, sino ante una actuación de la Administración que no implica la imposición de limitaciones al ejercicio del derecho, ni se da en aplicación de alguna norma que imponga tales limitaciones. Que no se da por tanto, el alegado "vaciamiento" del derecho de propiedad de la actora, por lo que no nace el deber de expropiar por parte del Estado y que de conformidad con lo dicho, y al no existir la obligación de expropiar por parte del Estado, no es de aplicación lo dispuesto en el "Acuerdo con Canadá sobre Promoción y Protección Recíproca de Inversiones", aprobado por Ley número 7870 de 5 de mayo de 1999 y en consecuencia, carece de todo fundamento jurídico la pretensión de la parte actora consistente en que se declare el deber del Estado de expropiar las fincas que dice son de su propiedad.
La representación del Estado planteó reconvención contra la sociedad Grupo de Inversiones Rajpal S.A., cédula jurídica CED88921, el señor Nombre112356 ; la sociedad Mis Dos Amores S.A. y la sociedad Dalanyo S.A., cuyo objeto lo que para que en sentencia: "...Se declare la nulidad de la información posesoria tramitada bajo el expediente número 1721 del año 1970 ante el Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda, y se anule la sentencia dictada por ese juzgado a las diecisiete horas del nueve de mayo de mil novecientos setenta y dos. Que se declare la nulidad del asiento 1 del tomo 2098 del folio 457 de la finca número 14718 de la Provincia de Limón, según el cual dicha finca quedó inscrita a nombre de Nombre112356 , y se ordene la anulación de la inscripción de la finca número 14718 de la Provincia de Limón. Además, que se declare la nulidad del asiento 2 del Tomo 2098 del Folio 457 de la finca número 14718 de la Provincia de Limón, según el cual dicha finca quedó inscrita a nombre de la sociedad Mis Dos Amores, S.A., y se ordene su anulación.
Que se declare la nulidad del asiento 3 del Tomo 2098 del Folio 457 de la finca número 14718 de la Provincia de Limón, según el cual parte de dicha finca quedó inscrita a nombre de la sociedad Dalanyo S.A. y se ordene su anulación. Que se declare la nulidad de la inscripción de la finca número 14718-000 del Partido de Limón a favor de Inversiones Rajpal S.A., asiento 14340, tomo 362 del Registro Inmobiliario Que se declare la nulidad de la inscripción de la finca número 16370 del Partido de Limón a favor de la sociedad Dalanyo S.A., asientos 1 al 6, tomos 333 y 346 del Registro Inmobiliario..." Lo anterior bajo el siguiente alegato: A) Sobre la tutela jurídica del patrimonio natural del Estado:
De importancia para el resultado del presente asunto se tienen de importancia:
Por demanda presentada el día 14 de agosto de 2013, el representante de la sociedad Grupo de Inversiones Rajpal S.A., cédula jurídica CED88921, solicitó en lo medular que en sentencia se declare que las fincas del Partido de Limón matrículas de folio real No. Placa20208, Placa20209 y Placa20210 ingresaron al dominio privado desde el año de 1971 cuando se aprobaron las informaciones posesorias de cada una de ellas con anuencia de Nombre415 y sin oposición del entonces ITCO, IDA, hoy INDER y la Procuraduría General de la República, por lo que fueron adquiridas por su representada al amparo de la buena fe registral y en su condición de tercero registral, por lo que dichas propiedades no están sujetas a limitaciones y están protegidas por las normas constitucionales que establecen que para expropiarse se les debe cancelar su precio de mercado. Que siendo que las fincas fueron afectadas por el Sistema Nacional de Áreas de Conservación, Minaet y Japdeva; el Estado debe expropiarlas y cancelar su valor de mercado, cuyo valor no puede ser inferior a los 100 millones de colones indexados al día de la sentencia.
De esta forma es claro que la pretensión del acto se funda en el título de propiedad. Luego, la representación del Estado al contestar la demanda presentó reconvención solicitando que en sentencia se declare la nulidad de la sentencia del Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda de las 17 horas del 09 de mayo de 1972 y por ende la nulidad del asiento 1 del tomo 2098 del folio 457 de la finca número 14718 de la Provincia de Limón, según el cual dicha finca quedó inscrita a nombre de Nombre112356 ; la anulación de la inscripción de la finca número 14718 de la Provincia de Limón; la nulidad del asiento 2 del Tomo 2098 del Folio 457 de la finca número 14718 de la Provincia de Limón, según el cual dicha finca quedó inscrita a nombre de la sociedad Mis Dos Amores, S.A.; la nulidad del asiento 3 del Tomo 2098 del Folio 457 de la finca número 14718 de la Provincia de Limón, según el cual parte de dicha finca quedó inscrita a nombre de la sociedad Dalanyo S.A.; se declare la nulidad de la inscripción de la finca número 14718-000 del Partido de Limón a favor de Inversiones Rajpal, S.A., asiento 14340, tomo 362 del Registro Inmobiliario y la nulidad de la inscripción de la finca número 16370 del Partido de Limón a favor de la sociedad Dalanyo S.A., asientos 1 al 6, tomos 333 y 346 del Registro Inmobiliario.
De esta forma el Estado solicita la declaratoria de nulidad de la sentencia por la que se dio término la información posesoria y a partir de ello, la nulidad de los actos registrales que surgieron de ella. Es claro que si el derecho de la sociedad actora subyace en su título de propiedad, de llevar razón el Estado y sus alegatos, sobreviene una falta de legitimación ad causam con respecto a las pretensiones de la sociedad Grupo de Inversiones Rajpal S.A. De forma que, como el actor erige su acción a partir de la existencia de un derecho del dominio sobre un inmueble, al estar siendo tal título impugnado en los términos de la contrademanda, habrá de resolverse esta de modo previo. En razón de ello se analizará en primer orden los alegatos de la contrademanda.
El curador procesal del señor Nombre112356 , señaló que la acción planteada por la representación del Estado debió hacerla dentro del plazo de diez años a partir de la inscripción de la información posesoria, sea que el plazo para interponer las acciones correspondientes prescribieron en el mes de octubre de 1982 y al no haberlo hecho en dicho plazo, el presente proceso está caduco. Por su parte el Curador Procesal de la Sociedad "Mis Dos Amores", indicó que la gestión planteada lo que pretende es la nulidad de los asientos registrales que indicó, y no una reivindicación de la propiedad de Nombre415 y que la Ley lo que hace referencia es a la imprescriptibilidad de la acción reivindicatoria, más no de la acción de nulidad como la que nos ocupa en este caso concreto, y que es la que se formula en la reconvención interpuesta por el Estado y en consecuencia, la prescripción de las pretensiones de nulidad que formula la representación estatal en su reconvención resulta evidente y manifiesta.
Estima esta Cámara de Juzgadores que se impone conocer de previo ambas excepciones, con causa en que de llevar razón en sus reproches, ello conduciría al rechazo de la gestión planteada por el Estado, y tornaría innecesario entrar en mayores consideraciones de fondo. En la especie nos encontramos ante un conflicto por aplicación de normas en el tiempo sobre bienes inmuebles. La discusión gira en torno a que si la Ley No. 3091 del 18 de febrero de 1963, traspasó los terrenos que abarcan los de la propiedad que se inscribió mediante información posesoria No. 14718-000 del Partido de Limón, significaría que se inscribió en 1972 un bien que pertenecía a una institución del Estado desde 1963, salvo que los beneficiados de la información posesoria hubiesen acreditado que su ocupación de había dado al menos 10 años antes de 1963. Y aunado a ello, posteriormente a partir de 1969, a los inmuebles con vocación forestal pertenecientes al Estado y sus instituciones, conforme a las leyes No. 4465 del 25 de noviembre de 1969, 7174 del 28 de junio de 1990 y la No. 7575 del 16 de marzo de 1996, forman parte del Patrimonio Natural del Estado y se les dota de una tutela especial.
De manera que la discusión está traba sobre un bien que sería calificado como un bien de dominio público del Estado en sentido amplio y en este sentido hay basta jurisprudencia que ha señalado que: "...IV.- A mayor abundamiento, conviene señalar, que tratándose del dominio público del Estado, los bienes no pueden salir definitivamente del dominio de la Nación (artículo 121 inciso 14 de la Constitución Política), porque forman parte del patrimonio natural del Estado (artículo 89 Constitucional)...Se trata, en consecuencia, de bienes imprescriptibles, inalienables, inembargables, y no susceptibles de apropiación privada..." (Votos No. 1763-94 de las 16:45 horas del 13 de abril de 1994). De manera que al estar en discusión este tipo de bienes, la acción en su tutela no prescribe ni caduca, más allá de que lo que se pretenda sea reivindicar el bien propio del Estado o solicitar la nulidad de un asiento registral, indebidamente inscrito.
Aceptar lo contrario, llevaría al sin sentido de permitir la convalidación de un bien propio del Estado a favor de un particular por el mero transcurso del tiempo, lo cual no puede ser posible conforme al artículo 121 constitucional. Por razón de ello es que se debe rechazar la prescripción y caducidad alegada.
Tal y como se indicó supra, la representación del Estado solicitó que en sentencia se declare la nulidad de la sentencia del Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda de las 17:00 horas del 09 de mayo de 1972 que declaró con lugar las diligencias de Información Posesoria incoada por el señor Nombre112356 y en consecuencia la nulidad del asiento 1 del tomo 2098 del folio 457 de la finca la Provincia de Limón número 14718; la nulidad del asiento 2 del Tomo 2098 del Folio 457 de la finca número 14718 de la Provincia de Limón, según el cual dicha finca quedó inscrita a nombre de la sociedad Mis Dos Amores, S.A.; la nulidad del asiento 3 del Tomo 2098 del Folio 457 de la finca número 14718 y los asientos del 1 al 6, tomos 333 y 346 del Registro Inmobiliario de la Provincia de Limón, según el cual parte de dicha finca quedó inscrita a nombre de la sociedad Dalanyo S.A. y la nulidad de la inscripción de la finca número 14718-000 del Partido de Limón a favor de Inversiones Rajpal, S.A., asiento 14340, tomo 362 del Registro Inmobiliario.
Lo anterior bajo el alegato de que la Ley No. 3091 del 18 de febrero de 1963 traspasó a Nombre112361 los terrenos que conformaron dichas propiedades, por lo que ya al año de 1972 pertenecían a esa institución del Estado, aunado a que las Leyes Nos. No. 4465 del 25 de noviembre de 1969, 7174 del 28 de junio de 1990 y la No. 7575 del 16 de marzo de 1996, establecieron una tutela especial sobre las propiedades del Estado y sus instituciones que fuesen de vocación forestal, por lo que en la especie dichos inmuebles constituyen propiedad forestal o Patrimonio Natural del Estado, bien que es de dominio público y por ende no es susceptible de ser apropiado o titulado por los particulares. El alegato de defensa del reconvenido representante de la Sociedad Inversiones Rajpal, S.A. indicó que la Ley 3091 traspasó a favor de Nombre415 propiedades privadas ocupadas antes de su entrada en vigencia, estando sembradas como lo fue en el caso de su representada, que incluso Nombre415 indicó en la contestación de la demanda su respeto a las adquisiciones de terrenos previas a la inscripción de la finca No. Placa20219 de la Provincia de Limón con plano catastrado L-00001-1977 el día 08 de junio de 2001.
Que la sociedad actora adquirió el inmueble del Partido de Limón No. Placa20209 en remate público, lo que demostró que el bien ha estado a nombre de terceros desde hace más de 40 años. Que si bien los terrenos están cubiertos de bosque en su mayor parte, también se han cultivado desde antes de 1950 por los poseedores originales de los mismos y luego por los propietarios registrales, de forma que esos terrenos no son Patrimonio Natural del Estado, y por eso ni Nombre415, ni la Procuraduría en su momento se opusieron a la información posesoria. Que si el inmueble constituye Patrimonio Natural del Estado lo que se debe entonces es expropiar a su representada. Que su representada es una sociedad perteneciente a un ciudadano canadiense que tiene el derecho de ser beneficiado por el convenio de protección a inversionistas firmado por Canadá y Costa Rica. El curador procesal del señor Nombre112356 , señaló: Que tomando la fecha de transmisión del derecho como parámetro para contabilizar los diez años de posesión, ésta tuvo que haber sido ejercida antes de la entrada en vigencia de la ley número 3091 del 18 de Febrero de 1963, y siendo que el documento de transmisión de derecho fue protocolizado por el Notario Alfredo Tosi Bonilla en fecha 25 de junio de 1970, en su protocolo 12, escritura 33, se tiene que mínimo la posesión ejercida por el transmitente Nombre112358 se ejercitó desde antes del mes de mayo de 1960, no pudiendo precisar la fecha exacta por no exigirlo así la Ley de Informaciones Posesorias y que la ley de Nombre415 si bien vigente desde 1963, no fue de aplicación al caso concreto pues los representantes estatales, sea el Procurador Agrario y el ITCO como partes de la titulación, no se opusieron a las diligencias, y el mismo Juez conocedor de la legislación correspondiente, aprobó en sentencia la Información Posesoria y la inscripción de la finca a folio real matrícula Placa20209 de la provincia de Limón fue en el mes de octubre de 1972.
El curador procesal de la sociedad "Mis Dos Amores", señaló: A) Sobre los hechos: Que la Ley No. 3091 no previó que en el área traspasada, existieran terrenos inscritos a nombre de terceros en el Registro Público, o de posesiones legítimas de terceros, que podían generar títulos válidos al inscribirse en el Registro Público, y que pudieran generar derechos indemnizatorios a favor de tales administrados y por ello la representación de Nombre415 indicó que la Institución respeta todas las inscripciones de inmuebles realizadas previa a la inscripción en el Registro Público del inmueble de Limón, matrícula número Placa7705 a nombre de Nombre415, inscripción que se llevó a cabo el día 08 de Junio del 2001. Que el Estado, representado por la Procuraduría General de la República dentro del Proceso de Información Posesoria, no se opuso a la inscripción del inmueble de Limón, Matrícula número Placa20220 a nombre del promotor de la mencionada Información Posesoria, dándole un aval de total validez al proceso desarrollado al efecto y al título de propiedad originado en el mismo.
Que la única persona jurídica legitimada activamente para demandar y pretender la declaratoria de nulidad es Nombre415, más no el Estado como persona jurídica independiente. Que no es cierto que el inmueble de Limón, matricula número Placa20209 haya pasado a formar parte del Patrimonio Forestal del Estado, en virtud de lo dispuesto por la Ley Forestal No. 4465 del 29 de noviembre de 1969, y no existiendo prueba alguna que acredite tal hecho, la falta de derecho para pretender la declaratoria de nulidad de la Información Posesoria, incluida la sentencia dictada dentro de dicho proceso judicial de las 17 horas del 09 de mayo de 1972, y consecuentemente, del asiento de inscripción del inmueble de Limón, matrícula número Placa20209, y de todos los asientos posteriores resulta evidente y manifiestamente improcedente. Que el señor Nombre112356 acreditó, por los medios idóneos, en el Proceso de Información Posesoria, cuya nulidad se pretende en este proceso, ser el titular del derecho de posesión sobre el terreno que se convertiría en el inmueble de Limón, Matrícula Placa20209, y que la posesión sobre el terreno dicho era de más de diez años, y en tales condiciones, una vez inscrito en el Registro Público, se lo vendió a la empresa que representa en el año de 1973.
Finalmente el curador procesal de la sociedad "Dalanyo S.A." indicó: Que el actuar de su representada siempre fue acorde al principio de la buena fe registral ya que como consta todos los movimientos registrales y negocios jurídicos fueron realizados antes de cualquier conflicto con el Estado o Japdeva. Que de las pruebas dadas por El Estado no tienen la manera de comprobar la vegetación o el uso de la finca en ese período de tiempo y tampoco que la finca pertenece al Patrimonio Natural del Estado ya que ello es la litis del presente proceso y por tanto no se puede afirmar un asunto que se encuentra en discusión todavía. De esta forma en criterio de la sociedad reconvenida y los codemandados, la Información Posesoria se hizo conforme a derecho y en la que se acreditó por parte del señor Nombre112356 una posesión sobre el inmueble de manera pública, pacífica, ininterrumpida, y en calidad de dueño por más de 10 años al momento de presentar dichas diligencias y por ende lo resuelto por el Juzgado Segundo civil de lo Contencioso Administrativo y Civil de Hacienda estuvo correcto, aunado a ello a que no hubo oposición de la Procuraduría ni del ITCO en aquel momento y que la Ley No. 3091 no consideró o previó que partes del inmueble traspasado estuviesen ocupados o inscritos a favor de terceros.
Criterio de la Cámara: Este Tribunal considera que no llevan razón los reconvenidos en sus alegatos, los que en concreto se refieren a la inaplicabilidad de lo dispuesto en la Ley No. 3091 y la validez de lo dispuesto por el Juzgado Segundo Civil de los Contencioso Administrativo en cuanto declaró con lugar la Información Posesoria presentada por el señor Nombre112356 en el año de 1970. Sobre la aplicación de lo dispuesto en la Ley No. 3091 debemos empezar por indicar que el artículo 261 del Código Civil de 1888 establece: "Son cosas públicas las que, por ley, están destinadas de un modo permanente a cualquier servicio de utilidad general, y aquellas de que todos pueden aprovecharse por estar entregadas al uso público. Todas las demás cosas son privadas y objeto de propiedad particular, aunque pertenezcan al Estado o a los Municipios, quienes para el caso, como personas civiles, no se diferencian de cualquier otra persona." Por su parte el artículo 262: "Las cosas públicas están fuera del comercio; y no podrán entrar en él, mientras legalmente no se disponga así, separándolas del uso público a que estaban destinadas." De esta forma, conforme a dichos artículos los bienes se califican en públicos y privados, siendo los primeros, aquellos que son por Ley afectos a cualquier servicio de utilidad general, y como resultado inmediato, estos bienes se encuentran fuera del comercio de los hombres, es decir, son inalienables, lo que significa que no pueden ser adquiridos por ningún medio a favor de particular.
Luego se tiene que el Estado-Legislador en el artículo 41 de la "Ley Orgánica de de la Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica (Japdeva), Ley No. 3091 del 18 de febrero de 1963 dispuso: "Son propiedad de Nombre415 además de sus activos e ingresos ordinarios y extraordinarios los siguientes: ...(...) b) Todos los terrenos del Estado situados en el área habilitada por canales navegables, comprendidos en una área de diez kilómetros desde el mar hacia el interior, paralela a ambos lados de los ríos y canales que administra la Junta". De esta forma, todos los terrenos ubicados dentro de los límites indicados en esta Ley entraron a formar parte de una Institución del Estado desde el mes de febrero de 1963, y por ende excluidos del comercio de los hombres, lo que significa que posterior a esa fecha ninguna persona podría válidamente alegar titularidad sobre una porción de terreno ubicado dentro de dichos límites.
Así, por las características de la Ley, a saber, su generalidad y potencia, esta aplica a todos y debe ser respetada por todos desde su entrada en vigencia y nadie puede adquirir derechos contra legem, ni alegar su desconocimiento según el artículo 129 de la Constitución Política, de ahí que se debe rechazar el alegato de los reconvenidos en cuanto cuestionan lo dispuesto en la Ley Orgánica de Nombre415 en su artículo 41 y su aplicación para el caso de la Información Posesoria que gestionó el señor Nombre112356 ante el Juzgado Segundo Civil de la Contencioso Administrativo. Por consiguiente posterior a la entrada en vigencia de la Ley No. 3091 del 18 de febrero de 1963 ningún terreno podría haberse inscrito por la vía de las diligencias de Información Posesoria, salvo que hubiese acreditado que su ocupación se hubiese dado 10 años antes a la entrada en vigencia de esa Ley, es decir entre 1953 y 1963.
También debe indicarse a mayor abundamiento que el Estado Costarricense en tutela del medio ambiente, otorgó en los artículos 18, 19 y 28 de la "Ley Forestal " No. 4465 del 25 de noviembre de 1969, una protección especial sobre el Patrimonio Forestal del Estado. Su artículo 18 dispuso: "El Patrimonio Forestal del Estado está constituido por las Reservas Nacionales, Reservas Forestales, Parques Nacionales, Viveros Forestales del Estado, las Zonas Protectoras y Reservas Biológicas." Su artículo 19: "Quedan afectados a los fines de la presente ley, todos los bosques y terrenos forestales situados en: a) Las tierras consideradas como Reservas Nacionales; y b) Las fincas rurales del dominio privado del Estado, las pertenecientes a municipalidades e instituciones autónomas y semiautónomas." De esta forma, a la tierras contempladas en los límites que estableció la Ley No. Placa20221 como propiedad de Nombre415, le sobrevino una protección más intensa, en cuanto esos terrenos tuviesen aptitud forestal y el artículo 28 del mismo cuerpo normativo los calificó como parte del "Patrimonio Forestal del Estado".
Por su parte la Ley No. 7174 "Ley Forestal" del 28 de junio de 1990, señaló en su artículo 32: "El patrimonio forestal del Estado está constituido por todos los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a las municipalidades, a las instituciones autónomas y a los demás organismos de la Administración Pública.". Por su parte el articulo 33) "Los terrenos forestales y bosques que constituyen el patrimonio forestal del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no son susceptibles de inscripción en el Registro Público mediante información posesoria; su invasión y ocupación serán sancionadas conforme con lo dispuesto en esta ley de aptitud forestal, quedarán automáticamente incorporados al patrimonio forestal del Estado." Finalmente la "Ley Forestal" No. 7575 del 16 de marzo de 1996, dispuso en su artículo 13): "Constitución y administración El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio.
El Ministerio del Ambiente y Energía administrará el patrimonio. Cuando proceda, por medio de la Procuraduría General de la República, inscribirá los terrenos en el Registro Público de la Propiedad como fincas individualizadas de propiedad del Estado. Las organizaciones no gubernamentales que adquieran bienes inmuebles con bosque o de aptitud forestal, con fondos provenientes de donaciones o del erario, que se hayan obtenido a nombre del Estado, deberán traspasarlos a nombre de este. Y el artículo 14): "Condición inembargable e inalienable del patrimonio natural Los terrenos forestales y bosques que constituyen el patrimonio natural del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley." De esta forma, la normativa que tutela el Patrimonio Forestal del Estado desde el año de 1969 incluyó dentro de dichos bienes, los terrenos de aptitud forestal que pertenezcan al Estado central y a sus instituciones descentralizadas, como lo fueron los terrenos traspasados por Ley a Nombre415.
Véase que conforme al certificado del Instituto Geográfico Nacional No. DG-IGN-RN-2013-061, del 04 de octubre de 2013 concluyó de acuerdo a la localización de los terrenos contenidos en los planos 7-1584-1971, 7-1585-1971 y 7-1586-1971 en la hoja topográfica Moín escala 1:50-000, la zona tiene cobertura de vegetación tipo humedal (Yolillal) según la simbología correspondiente. De forma que la tutela estatal de este tipo de vegetación se dio a partir de la entrada en vigencia de la Ley, y no de la inscripción registral del inmueble propiedad de Nombre415. Y es que los reconvenidos alegan que la propiedad establecida en la Ley 3091 fue inscrita hasta el 8 de junio de 2001 y que es a partir de dicha fecha que surte efectos frente a terceros, criterio que no comparte la Cámara ya que sobre los bienes de dominio publico rige el principio de inmatriculación registral, al ser parte de la propiedad pública, debiendo aplicarse en forma obligatoria lo que sobre ellos dispone la Ley, más allá de si se encuentran inscritos o no en el Registro Público.
De esta forma es claro que lo dispuesto en la Ley Orgánica de Nombre415 en su artículo 41.b) y la Ley Forestal y su reformas, son aplicables en todos sus extremos a los terrenos que se incluyeron en la Ley 3091, desde 1963, por constituir un bien propio de una institución del Estado. El segundo alegato de los reconvenidos se centra en la validez de la información posesoria sosteniendo que la posesión del señor Nombre112358 sumada a la del promovente Nombre112356 sobrepasaron los 10 años, requisito para que procediera la inscripción de la propiedad del inmueble de Limón, matrícula número Placa20209. Revisado íntegramente el expediente del proceso de Información Posesoria se tiene acreditado que el promovente presentó la gestión por escrito de fecha 30 de julio de 1970, y en cuanto a la posesión decenal señaló que "esta ha sido quieta, pública, pacífica, ininterrumpida y a título de dueño consistiendo en la tenencia física del bien bajo mi dominio y disfruto como así lo hizo quien la vendió.
(Ver imagen 462 y 463 del expediente judicial digital). Luego, dentro de las diligencias comparecieron como testigos la señora Nombre112359 , don JOSÉ JAIME LOBO CORDERO, el señor Nombre112360 y don FRANCISCO URBINA BERMÚDEZ, y todos indicaron de manera general que la posesión del señor Nombre112358 y Nombre112356 lo era por más de 10 años. (Ver imagen 515, 534, 535, 544 y 545 del expediente judicial digital) y finalmente por resolución de la 17:00 horas del 09 de mayo de 1972, el Juzgado Segundo Civil de lo Contencioso Administrativo y Civil de Hacienda, tuvo por acreditado que el gestionante poseía el bien inmueble que indicó por más de 10 años de manera pública, pacífica, ininterrumpida, y en calidad de dueño, y la declaró con lugar la información posesoria y ordenó su inscripción registral quedando inscrita bajo Matrícula No.14718-000 del Partido de Limón. (Ver imagen 549 y 550 del expediente judicial digital).
Nótese que para el año 1970 se alegó una posesión sobre un inmueble que conforme a la Ley No. 3091, desde el año 1963 había pasado a formar parte del patrimonio de una Institución Autónoma del Estado y con una tutela especial conforme a la Ley Forestal de 1969 por poseer aptitud forestal. Así, a partir de 1963 no podía validarse la posesión del gestionante y luego no se tuvo por acreditado que los 10 años y más que sostuvieron poseían sobre el inmueble, lo fuese entre el años 1953 y 1963. De forma que cuando tramitó la información posesoria no podía ejercer una posesión de buena fe, pues el bien pertenecía a Nombre415 por ley, y al no acreditar que la posesión lo fuese por de 10 años pero entre 1953 y 1963, tampoco podía existir usucapión, lo que hace posible anular un título registral en cualquier tiempo, cuando se ha levantado en perjuicio del Estado y afecta un bien de dominio público, pues en estos casos la propiedad es imprescriptible, inalienable por los particulares, tratándose más de un motivo de nulidad absoluta, es incluso declarable de oficio (artículo 837 del Código Civil).
En dicha tesitura, si no hay posesión válida a partir de 1963 y no acreditar posesión alguna entre el año 1953 y 1963 no podría calificarse la validez, y mucho menos la eficacia de un título espureo, sin contenido material real, pues realmente no ha existido una posesión ad usucapionen útil, por parte de los reconvenidos, ni antes ni después de la inscripción del título de propiedad en el Registro Público. El Tribunal llega a dicho convencimiento, porque los testigos que depusieron en la información posesoria, a saber, Nombre112359 , don JOSÉ JAIME LOBO CORDERO, el señor Nombre112360 y don FRANCISCO URBINA BERMÚDEZ sus declaraciones no resultan contestes con que la posesión del señor Nombre112358 y Nombre112356 sobre el inmueble a titular se diera entre 1953 y 1963. Finalmente, la representación de la sociedad Grupo de Inversiones Rajpal S.A. alegó en la contestación de la reconvención que esta es una sociedad que si bien costarricense, pertenece a un ciudadano canadiense que tiene el derecho de ser beneficiado por el "Convenio de protección a inversionistas firmado por Canadá y Costa Rica" aprobado por Ley No. 7870 del 05 de mayo de 1999, sin indicar mayores detalles del indicado Convenio con respecto a la tutela que reclama con respecto a la actividad empresarial de la Sociedad Inversiones Rajpal S.A. No obstante revisado el indicado Convenio tenemos que en su artículo 8) Expropiaciones señala: "1.- Las inversiones de inversionistas de cualquiera de las Partes Contratantes no serán nacionalizadas, expropiadas o sujetas a medidas que tengan un efecto equivalente a la nacionalización o expropiación (en lo sucesivo denominadas "expropiación") en el territorio de la otra Parte Contratante, excepto por razones de interés público, bajo el debido proceso de la ley, de una manera no discriminatoria y contra indemnización pronta, adecuada y efectiva.
Tal indemnización estará basada en el valor justo de mercado de la inversión expropiada inmediatamente antes de la expropiación o al momento en que la expropiación propuesta se hizo de conocimiento público, lo que ocurra primero. Esta indemnización será pagadera: a) en Canadá, a partir de la fecha de expropiación con intereses a la tasa de interés comercial normal; b) en Costa Rica, a partir de la fecha de desposesión de acuerdo con el Artículo 11 de la Ley de Expropiaciones No. 7495 de 3 de mayo de 1995 (en adelante denominada la "Ley de Expropiaciones"), con intereses al tipo de interés promedio para los depósitos, imperante en el sistema bancario nacional, Sin demora y será efectivamente realizable y libremente transferible. El criterio de valoración para determinar el valor justo de mercado incluirá el valor de la empresa en pleno funcionamiento, el valor de los activos incluyendo el valor tributario declarado de la propiedad tangible, y otros criterios, según proceda, incluyendo, en el caso de Costa Rica, el Artículo 22 de la Ley de Expropiaciones. 2.- El inversionista afectado tendrá derecho, bajo la legislación de la Parte Contratante que realiza la expropiación, a una pronta revisión, por una autoridad judicial u otra autoridad independiente de esa Parte, de su caso y de la valoración de su inversión de acuerdo con los principios estipulados en este Artículo. 3.- Las disposiciones de este Artículo serán aplicables a las medidas tributarias a menos que las autoridades fiscales de las Partes Contratantes, en un plazo que no exceda los seis meses después de haber recibido notificación por parte de un inversionista que impugna una medida tributaria, determinen conjuntamente que la medida en cuestión no constituye una expropiación." Sin embargo en criterio de esta Cámara, conforme a lo que se ha indicado supra, en el presente caso no nos encontramos frente al supuesto fáctico contemplado en la indicada norma, a saber, una expropiación, toda vez que la reconvención giró en torno a la nulidad de un asiento registral de un inmueble generado en una información posesoria del año 1970, sobre un inmueble que desde el año de 1963 pertenecía por Ley No. 3091 a Nombre415 y desde 1969 protegido en lo que respecta al Patrimonio Natural del Estado, sin que se acreditara que el gestionante de la información posesoria cumpliera con la ocupación decenal entre 1953 y 1963.
De forma que, se reitera, no se trató de una expropiación sobre un derecho de propiedad jurídicamente tutelado. Corolario de lo expuesto es acoger la contrademanda y ordenar la nulidad de lo dispuesto en la sentencia del Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda de las 17:00 horas del 09 de mayo de 1972 y en consecuencia la nulidad del asiento 1 del tomo 2098 del folio 457 de la finca la Provincia de Limón número 14718; la nulidad del asiento 2 del Tomo 2098 del Folio 457 de la finca número 14718 de la Provincia de Limón, según el cual dicha finca quedó inscrita a nombre de la sociedad Mis Dos Amores, S.A.; la nulidad del asiento 3 del Tomo 2098 del Folio 457 de la finca número 14718 y los asientos del 1 al 6, tomos 333 y 346 del Registro Inmobiliario de la Provincia de Limón, según el cual parte de dicha finca quedó inscrita a nombre de la sociedad Dalanyo S.A. y la nulidad de la inscripción de la finca número 14718-000 del Partido de Limón a favor de Inversiones Rajpal, S.A., asiento 14340, tomo 362 del Registro Inmobiliario.
El representante de la sociedad Grupo de Inversiones Rajpal S.A., cédula jurídica CED88921, exigió en lo medular responsabilidad objetiva del Estado alegando que por haber adquirido su representada al amparo de la publicidad registral en razón de la validez del título registral que generó la sentencia del Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda de las 17:00 horas del 09 de mayo de 1972, y que conforme a la tutela constitucional a la propiedad privada; se le expropiara y cancelara su precio de mercado, que en todo caso no podría ser menor a los cien millones de colones. Conforme a lo expuesto supra, y siendo que la reconvención presentada por la representación estatal fue acogida, ordenándose la cancelación del asiento registral, entrar a analizar la procedencia de dicha pretensión resulta absolutamente estéril por carecer la actora del derecho reclamado, a partir de lo fallado.
En lo referido a la demanda la representación estatal, de Nombre415 y el SINAC opusieron la excepción de falta de derecho, la cual se debe acoger, en razón de que la actora Sociedad Inversiones Rajpal S.A. no tiene un derecho tutelable con base en lo que se indicó supra. Por su parte los reconvenidos opusieron las excepciones de prescripción, caducidad, falta de legitimación activa, pasiva y falta de derecho. Las dos primeras fueron resueltas por lo que resulta innecesario hacer manifestación alguna en este apartado. En cuanto a la legitimación pasiva es claro que los reconvenidos al adquirir un bien inmueble generado a partir del asiento registral que impugnó la representación estatal, están legitimados pasivamente para ser accionados y la representación estatal para accionar en tutela de los bienes de domino público, como lo es el Patrimonio Natural del Estado. Sobre la falta de derecho, indicar que siendo que tal y como fue señalado a lo largo de esta sentencia, el ordenamiento jurídico ampara lo argumentado y pretendido por la representación estatal en su contrademanda, razón por la cual, la excepción de comentario se debe rechazar, declarando con lugar en todos sus extremos la reconvención, como en efecto se dispone.
El artículo 193 del Código Procesal Contencioso Administrativo establece que las costas procesales y personales se imponen al vencido por el solo hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o cuando la sentencia se dicte en virtud de pruebas que desconociera la parte contraria. En lo que la demanda fue incoada por Inversiones Rajpal S.A. contra el Estado, la Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica y el Sistema Nacional de Áreas de Conservación, la parte vencida lo fue la actora, no mediando circunstancia alguna para exonerarle de la condenatoria dicha, de modo que en ese tanto se condena a la compañía denominada Inversiones Rajpal S.A. al pago de ambas costas mas sus intereses hasta su efectivo pago las cuales se liquidarán en fase de ejecución de sentencia a ruego de las interesadas. En lo que el Estado contrademandó al señor Nombre112356 ; a la sociedad Mis Dos Amores S.A. y a la sociedad Dalanyo S.A., se condena a estos en ambas costas, más sus intereses hasta su efectivo pago, cuyo importe será establecido en la fase de ejecución de sentencia a ruego de la representación estatal.
POR TANTO:
En relación con la contrademanda, se rechazan las excepciones de caducidad, prescripción, falta de legitimación activa y pasiva y falta de derecho. En consecuencia se declara con lugar en todos sus extremos la reconvención incoada por el Estado contra la sociedad Grupo de Inversiones Rajpal S.A., el señor Nombre112356 ; la sociedad Mis Dos Amores S.A. y la sociedad Dalanyo S.A., por ende se anula lo dispuesto en la sentencia del Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda de las 17:00 horas del 09 de mayo de 1972 y en consecuencia el asiento No. 1 del tomo 2098 del folio 457 de la finca la Provincia de Limón número 14718; del asiento No. 2 del Tomo 2098 del Folio 457 de la finca número 14718 de la Provincia de Limón, según el cual dicha finca quedó inscrita a nombre de la sociedad Mis Dos Amores, S.A.; la nulidad del asiento No. 3 del Tomo 2098 del Folio 457 de la finca número 14718 y los asientos del 1 al 6, tomos 333 y 346 del Registro Inmobiliario de la Provincia de Limón, según el cual parte de dicha finca quedó inscrita a nombre de la sociedad Dalanyo S.A. y la nulidad de la inscripción de la finca número 14718-000 del Partido de Limón a favor de Inversiones Rajpal, S.A. asiento No. 14340, tomo 362 del Registro Inmobiliario.
Firme la presente sentencia tome nota el Registro Público para lo de su cargo. En relación con la demanda incoada por la compañía denominada Inversiones Rajpal S.A. contra el Estado, la Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica y el Sistema Nacional de Áreas de Conservación, se acoge la excepción de falta de derecho y en consecuencia sin lugar la demanda en todos sus extremos. Son ambas costas del proceso más sus intereses hasta su efectivo pago a cargo de Inversiones Rajpal S.A. en lo que su demanda lo fue contra el Estado, la Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica y el Sistema Nacional de Áreas de Conservación, las cuales se liquidarán en fase de ejecución de sentencia a ruego de las interesadas. En lo que respecta a la contrademanda del Estado, son ambas costas del proceso más sus intereses hasta su efectivo pago a cargo del señor Nombre112356 ; la sociedad Mis Dos Amores S.A. y la sociedad Dalanyo S.A., cuyo importe será establecido en la fase de ejecución de sentencia a ruego de la representación estatal.
