Recitals:
The representatives of ICAA stated that they were seeking a permanent solution for all affected sites in Bagaces, but given the complexity of a project of such magnitude, technical studies were required. A second meeting was scheduled to follow up on the agreements reached that day. The obligation of ICAA to supply the population of Agua Caliente with sufficient drinking water by tanker trucks was also reiterated, until the interconnection was completed and operating properly. On 4 de abril de 2013, a meeting was held with representatives of ICAA, during which ICAA was asked to provide the results of laboratory tests from water-supply systems with some level of arsenic, in order to monitor its behavior and make timely decisions to protect public health. Finally, with respect to the Área Rectora de Salud de La Cruz, according to the 2010 results, the arsenic level in the water was found to exceed the permitted limit (32 µg/l). It was immediately decided to prohibit use of the well and to continue bringing another well into operation to ensure the proper supply of water. From that time to the present, drinking water has been provided in adequate quantity and quality.
13- Lizanías Zúñiga López and Xinia Guevara Contreras, respectively Mayor and President of the Municipal Council of Cañas, report under oath that the Municipalidad has never administered any of the affected water supply systems. They state that they are indeed aware of the problem of water contaminated with arsenic and that it has been a matter of great concern to the local government, to such an extent that it has made several inquiries and held meetings with various institutions (ICAA, Ministerio de Salud) in order to obtain better information about the problem and possible solutions; however, they have only been told that the matter is under study and that no system is available to remove arsenic from the water. They emphasize that they fully intend to help and will continue investigating and attempting to find a definitive solution; nevertheless, the institutions specializing in water issues and their laboratories have not identified any solution, and thus, to date, they have no idea how they can help.
They believe that the Ministerio de Salud and, failing that, ICAA are responsible for providing mechanisms to resolve the problem. Once the solution is clear, the other public institutions and the municipality will, according to their means, be obligated to provide financial support, personnel, and equipment to implement the remedial project. They state that, to date, no such solution has been presented by those institutions, the local residents, or the petitioners.
14-. In a pleading received on 15 de mayo de 2013, Elizabeth Briceño C. and others, in their capacity as residents of Bagaces, Guanacaste, submitted a motion for active intervention (coadyuvancia activa). They request that the petition be granted and that the respondents be ordered to guarantee a supply of fully potable water.
Justice Rueda Leal drafts the opinion; and,
Considering:
I.Subject matter of the petition. The petitioners consider that their fundamental rights to health and life have been violated because, although more than one year ago the Executive Branch declared a public health emergency (emergencia sanitaria) in Guanacaste and the northern region of Alajuela due to arsenic contamination of water for human consumption, the problem persists to date.
II.Regarding the motion to intervene (gestión de coadyuvancia). In a written submission added to the case file (expediente) on 7 de mayo de 2013, Deputy Claudio Monge Pereira requests recognition as an active intervenor (coadyuvante activo) in this amparo proceeding (amparo). In this regard, section 34, paragraph 3 of the Ley de la Jurisdicción Constitucional provides that anyone possessing a legitimate interest in the proceeding may participate as an intervenor, whether in support of the petitioner or the respondent. In this specific case, according to the applicant, a high percentage of residents in several areas of Guanacaste are receiving arsenic-contaminated water for human consumption, and no definitive solution has yet been provided to protect the health of the population, which he believes violates the fundamental rights of the area’s inhabitants. Accordingly, the aforementioned request to intervene is admissible. The intervenor should note that, because he is not a principal party, he is not directly affected by the judgment or by the res judicata effect (cosa juzgada) of the decision, although he may benefit indirectly from the effectiveness of the ruling because of the erga omnes effect of the case law and precedents of this Tribunal Constitucional.
III.Proven facts (hechos probados). The following facts are deemed duly established and relevant to the decision in this matter: Regarding the canton of Cañas, Guanacaste: a) by official letter DR-CH-2011-2010 dated 23 de diciembre de 2010, the Acting Director of the Región Chorotega of the Ministerio de Salud informed the offices of the Directors of the region’s Governing Health Areas (Áreas Rectoras de Salud) of the presence of arsenic above the permitted limit in water for human consumption in the Cañas area (see folio 74 of the administrative record of the Ministerio de Salud); b) on 4 de enero de 2011, the Laboratorio Nacional de Aguas of the ICAA collected a water sample for analysis, which determined that it complied with the Reglamento para la Calidad del Agua Potable (see folio 79 of the administrative record of the Ministerio de Salud); c) in official letter No. ICAACA-2011-006 dated 14 de enero de 2011, the ICAA Cantonal Chief in Cañas informed the Director of the Área Rectora de Salud that, as a solution to the problem, drilling of two wells would begin (folio 78 of the administrative record of the Ministerio de Salud); d) by official letter No. ICAACA-2011-013 dated 25 de enero de 2011, the ICAA Cantonal Chief in Cañas informed the Director of the Área Rectora de Salud that well No. 6 had been taken out of operation because it had been determined to be the cause of the arsenic level exceeding the permitted limit.
He further informed her that the decision had been made to drill a new well in Sandillal because it was the most suitable alternative, and that drilling was 70% complete as of that date (see folio 81 of the administrative record of the Ministerio de Salud); e) on 08 de marzo de 2011, the Dirección Regional Chorotega of the Ministerio de Salud issued health order (orden sanitaria) No. LAEO-011-2012, ordering the ICAA Cantonal Representative to submit, within 10 days, a prioritized corrective action plan (folio 84 of the administrative record of the Ministerio de Salud); f) on 14 de marzo de 2011, the Dirección Regional Chorotega of the Ministerio de Salud issued health order No. LAEO-012-2011, ordering the Regional Director of ICAA Liberia to submit, within 10 days, a prioritized corrective action plan (folio 85 of the administrative record of the Ministerio de Salud); g) the water supply system (acueducto) of the ASADA de la Libertad was interconnected with that of Barrio Hotel (see folio 92 of the administrative record of the Ministerio de Salud); h) samples collected on 4 de enero and 21 de febrero de 2012, as well as 30 de enero de 2012, showed levels between 3 and 10 µg/l (see folio 92 of the administrative record of the Ministerio de Salud).
Regarding Bagaces, Guanacaste: a) by email dated 5 de enero de 2011, the Laboratorio Nacional de Aguas of the ICAA transmitted the results of analyses of the Bagaces water supply system, showing that the water was potable (see folio 76 of the administrative record of the Ministerio de Salud); b) on 16 de setiembre de 2011, the Área Rectora de Salud de Bagaces received a complaint filed by the Asociación de Desarrollo Integral de Agua Caliente concerning water contaminated with arsenic (86 µg/l), according to tests conducted on 19 de agosto de 2011 (see folio 92 of the administrative record of the Ministerio de Salud); c) on 22 de setiembre de 2011, the Área Rectora de Salud de Bagaces asked the ICAA office in Bagaces to supply water to Agua Caliente (see folio 91 of the administrative record of the Ministerio de Salud); d) on 26 de setiembre de 2011, the Área Rectora de Salud received a report from the Laboratorio Nacional de Aguas containing the results of analyses of samples collected on 02 de marzo de 2011, reporting an arsenic level of 60 µg/l; it was therefore recommended that an alternative source be found to supply the water system, that water be provided by tanker trucks, and that treatment alternatives be studied to remove arsenic from the water (see report submitted under oath); e) on 28 de setiembre de 2011, the Área Rectora de Salud confirmed that potable water was being provided by tanker trucks (see statements submitted under oath); f) at a meeting held on 28 de setiembre de 2011, the Acueductos Rurales office of the ICAA informed the other authorities that technical studies were being conducted to supply water from the ASADA de Montenegro (see statements submitted under oath); g) on 24 de febrero de 2012, the Laboratorio Nacional de Aguas collected a sample from the Agua Caliente well, which showed an arsenic content of 80 µg/l (see report submitted under oath); h) at a meeting held on 18 de julio de 2012, ICAA representatives stated that construction of the interconnection between the Montenegro and Agua Caliente water systems could be completed within two days; however, as of this date, it has not been completed (see statements submitted under oath by the respondent authorities); i) by health order No. 117-2012, the Área Rectora de Salud de Bagaces ordered both the ICAA representatives and the ASADAS to provide the community of Agua Caliente de Bagaces with a continuous and sufficient supply of potable water (see statements submitted under oath); j) on 20 de noviembre de 2012, the Área Rectora de Salud de Bagaces submitted to the Tribunales de Liberia a complaint against the ICAA and the ASADAS for disobedience of authority (see statements submitted under oath); k) at a meeting held on 21 de marzo de 2013, the Director Regional Chorotega requested from the General Manager of the ICAA a critical-path schedule for the pending actions required to resolve the problem in Agua Caliente.
On that occasion, the Ministerio de Salud noted that interconnection with Montenegro was a temporary solution because that water system also had arsenic levels exceeding the permitted limits (see statements submitted under oath); l) the documents submitted by the ICAA in compliance with the request of the Regional office of the Ministerio de Salud have been under review since 04 de abril de 2013 (see statements submitted under oath); m) the community of Agua Caliente is being supplied by tanker trucks (see report submitted under oath). Regarding the canton of La Cruz, Guanacaste: a) in 2010, the water systems of Puerto Soley and El Jobo de La Cruz were analyzed and found to have arsenic levels of 32 µg/l, whereupon it was immediately decided to place another well into service (see statements submitted under oath); b) as of this date, there is no arsenic contamination in La Cruz (see statements submitted under oath).
Regarding the northern region of Alajuela: a) the Región Huetar Norte of the Ministerio de Salud, in coordination with the Áreas Rectoras de Salud, collected samples from 47 supply sources serving 26 ASADAS and the municipal water system of Ciudad Quesada (see statements submitted under oath); b) except for the water systems of La Virgen and Santa Cecilia, which have arsenic levels of 11.3 and 33.3 µg/l, all the others have normal arsenic levels (see statements submitted under oath); c) on 3 de noviembre de 2011, the ASADA San José -La Gloria de Aguas Zarcas de San Carlos submitted to the Área Rectora de Salud de Salud de Aguas Zarcas a report from the Laboratorio Nacional de Aguas indicating levels between 22 µg/l and 95 µg/l (see folio 64 of the administrative record of the Ministerio de Salud); d) at a meeting held on 11 de noviembre de 2011, the Ministerio de Salud explained the urgent need to intervene in the water system and take the contaminated springs (nacientes) out of operation (see statements submitted under oath); e) on 11 de noviembre de 2011, the Ministerio de Salud issued health order No. OS-169-2011, ordering the various ICAA units involved to discontinue use of the supply sources that exceeded the established arsenic limits and to ensure the immediate supply of potable water by another means.
It also ordered them to submit a report on the corrective actions to be carried out (see statements submitted under oath); f) on 01 de diciembre de 2011, the President of the ASADA for the San José -La Gloria water system informed officials of the Regional offices of the Ministerio de Salud and the ICAA that it had a second drilled well and would begin drilling another well (see statements submitted under oath); g) on 16 de diciembre de 2011, a new report was received concerning analyses of samples collected in setiembre de 2011, showing levels between 139 and 187 µg/l (see folio 63 of the administrative record of the Ministerio de Salud); h) on 6 de enero de 2012, the Área Rectora de Salud served health order No. OS-002-2012 on the various ICAA units involved, as well as on the ASADAS San José -La Gloria and Vuelta de Kopper, ordering them to discontinue use of the supply sources exceeding the permitted arsenic levels and to submit a report on corrective actions (see report submitted under oath); i) at a multidisciplinary meeting held on 10 de enero de 2012, a presentation was given on arsenic exposure in water systems nationwide, and proposals were presented by companies offering technology for arsenic removal (see folio 45 of the administrative record of the Ministerio de Salud); j) on 14 de febrero de 2012, the Regional ICAA conducted pumping and water-quality tests on the new well of the San José - La Gloria water system.
The results were favorable, and the contaminated source was therefore replaced (see statements submitted under oath); k) on 23 de febrero de 2012, at a meeting with the ICAA Manager, it was agreed that the two springs at Vuelta de Kooper would immediately be taken out of operation and that the system would be interconnected with the ASA-5 water system (San José -La Gloria) (see report submitted under oath); l) in mid-2012, the UEN Gestión Ambiental of the ICAA formed a multidisciplinary professional and technical team tasked with carrying out a series of activities and actions aimed at investigating and identifying the origin and spatial distribution of arsenic’s impact on sources of water for human consumption, specifically in the Aguas Zarcas de San Carlos area (see attached documentary evidence); n) on 6 de diciembre de 2012, the Laboratorio LAMBDA conducted new sampling of water from the sources supplying water for human consumption to the ASA-5 water system (3 wells and one spring).
The results of the arsenic analyses were issued on 31 de diciembre de 2012, and no arsenic concentrations were detected in any of the supply sources of the Acueducto Rural San José -La Gloria, (ASA-5) (see statements submitted under oath); m) the springs serving the water systems of Vuelta de Kooper and Caño Negro de Aguas Zarcas were taken out of service, and the ASA-5 water system assumed responsibility for supplying water to those communities (see folio 43 of the administrative record of the Ministerio de Salud).
IV.Unproven facts. The following fact relevant to this decision is not deemed proven: that the problems involving arsenic contamination of water for human consumption in the aqueducts of La Virgen and Santa Cecilia de Los Chiles, as well as Montenegro and Agua Caliente de Bagaces, had been definitively resolved.
V.On arsenic and its implications for public health. According to Fact Sheet No. 372 of the World Health Organization (WHO), the chemical element arsenic (As) occurs naturally at high levels in the groundwater of several countries and is one of the 10 chemicals that the WHO considers most dangerous to public health. The presence of arsenic in drinking water (agua potable) may result either from the dissolution of minerals naturally present in the soil through which water flows before being collected for human use or from human activity, as a consequence of pesticides or industrial pollution. Its greatest threat to public health lies in the use of contaminated water for drinking, preparing food, and irrigating food crops. Prolonged exposure to arsenic through the consumption of contaminated water and food can cause cancer and skin lesions. It has also been associated with developmental problems, cardiovascular diseases, neurotoxicity, and diabetes.
The most important intervention in affected communities is to prevent prolonged exposure to arsenic by implementing a safe drinking-water supply system. Arsenic exists in both organic and inorganic forms. Inorganic arsenic compounds, such as those found in water, are extremely toxic, whereas organic arsenic compounds, such as those found in fish and shellfish, are less harmful to health. According to the WHO, there are various options for reducing arsenic levels in drinking water, such as replacing supply sources with high arsenic levels; reserving water with low arsenic levels for drinking, cooking, and irrigation, while using water with higher concentrations for other purposes; distinguishing between supply sources with high arsenic levels and those with low levels of that chemical element; blending water with low arsenic levels with water of a higher concentration in order to obtain a greater quantity of water with an acceptable concentration level; installing arsenic-removal systems, either centrally or at the household level; and ensuring that removed arsenic undergoes appropriate waste treatment.
Technologies used to remove arsenic include oxidation, coagulation-precipitation, absorption, ion exchange, and various membrane techniques, nanofiltration, adsorption, coagulation-filtration, and biological removal, among others, all of which also require the corresponding technology for the final disposal of the chemical.
VI.On the recommended level of arsenic in water for human consumption. The WHO has established a guideline value for arsenic in its “Guidelines for Drinking-water Quality,” intended to serve as the basis for regulating and standardizing this issue. At present, the recommended limit for the concentration of arsenic in drinking water is 10 µg/l, although this reference value is considered provisional given the difficulties in measurement and the practical obstacles associated with removing arsenic from drinking water. As acknowledged by the Ministra de Salud, allowing water for human consumption to contain an amount of arsenic exceeding 10 µg/l may endanger the health of the population. It should be added that this parameter is consistent with the levels permitted under Decreto Ejecutivo No. 32327, entitled “Reglamento para la Calidad del Agua Potable,” which establishes a maximum of 0.01 mg/L, equivalent to 10 µg/l.
VII.On the right of access to drinking water. In repeated decisions, this Sala has recognized a fundamental right to drinking water, as stated in judgment No. 2006-05606 at 15:21 hours on 26 de abril de 2006:
“VII.-Access to drinking water as a human right. In addition to the foregoing, and perhaps the most relevant aspect of this issue, is the nature and function of water for human life. It is unnecessary to provide a detailed explanation here of the evident and widely known fact that without water there can be no life or quality of life and that, therefore, with or without a nationalization law, by its very nature this matter is not, and cannot be, a territorial or local matter. The Sala itself has stated in its constitutional case law that access to drinking water is a fundamental human right, insofar as it forms part of the substance of the rights to health and life. (SALA CONSTITUCIONAL, judgments numbers 534-96, 2728-91, 3891-93, 1108-96, 2002-06157 2002-10776; 2004-1923). This same position has been maintained in judgments 2003-04654 and 2004-07779. (…)”
VIII.On the proper operation of public services. Our Constitución Política implicitly recognizes the fundamental right of persons subject to the administration to the proper and efficient operation of public services, that is, to have such services provided according to high quality standards. The necessary counterpart of that right is the obligation of public administrations to provide them continuously, regularly, promptly, effectively, and efficiently. This atypical or unnamed individual guarantee is heightened in the case of essential public services such as the supply of drinking water. The heads of the institutions involved may not invoke a lack of financial, human, or technical resources to justify deficient and inadequate service, because the obligation that public services be provided efficiently, effectively, continuously, regularly, and promptly is a constitutional imperative, particularly when absolutely essential constitutional rights are at stake: people’s health and lives.
IX.On the powers of the Ministerio de Salud, the Instituto Costarricense de Acueductos y Alcantarillados, SENARA, and the municipalities regarding the supply of water intended for consumption by the population. Pursuant to that legislation, the use of water for human consumption takes priority and, therefore, every system supplying water intended for use and consumption by the population must provide drinking water continuously and in sufficient quantities to meet people’s needs (art. 267). Article 268 of that body of law establishes that the Ministerio de Salud is responsible for verifying the quality of the water supplied to the population and ensuring that the components of the systems, their operation, and their state of repair guarantee an adequate and safe supply; the Ministerio may intervene if there is a danger to the health of the inhabitants. Consistent with the foregoing, section 368 authorizes the Ministerio de Salud to intervene in cases of danger, threat, or the spread of an epidemic, to assume responsibility for protecting drinking-water sources and to take the corresponding actions to protect the health of the population.
Regarding the powers of the Instituto Costarricense de Acueductos y Alcantarillados, it should be noted that its enabling statute, Ley No. 2726 de 14 de abril de 1961, as amended, established that it is the institution with authority to direct and oversee all matters related to providing the inhabitants of the Republic with drinking-water supply services and the collection and disposal of sewage, as well as liquid industrial waste and stormwater in urban areas. In this regard, Article 2° states, in pertinent part:
“Article 2.- (*) The Instituto Costarricense de Acueductos y Alcantarillados shall be responsible for:
Under no circumstances may it delegate the administration of the aqueduct and sanitary sewer systems of the Área Metropolitana.
Nor may it delegate the administration of systems for which financial responsibility exists for as long as that responsibility lies directly with the Instituto.
For its part, SENARA (Sistema Nacional de Aguas Subterráneas, Riego y Avenamiento), although its jurisdiction appears to be limited to irrigation, drainage, and flood-control districts—physical, technical, and administrative agricultural units intended to achieve socioeconomic development, defined by Executive Decree at the request of that entity (Articles 17 and 18 of its Ley de Creación No. 6877 of 18 July 1983, as amended)—is in fact entrusted by its founding law with significant powers regarding the protection of water resources. This is confirmed by the institutional history of this public entity, since Ley No. 5438 of 17 December 1973—which ratified and superseded Decreto Ejecutivo No. 1878-P of 22 July 1972—and which has since been repealed, created the Servicio Nacional de Aguas Subterráneas (SENAS), with a clearly nationwide mandate to plan, research, and provide advice on all matters in this field.
For its part, the currently applicable law, number 6877 of 18 July 1983, lists among its functions “To investigate, protect, and promote the use of the country’s surface and groundwater resources” and “To conduct, coordinate, promote, and keep hydrological and hydrogeological research up to date (...)” (art. 3, subsections ch and e). Article 4 establishes that SENARA is responsible for promoting and directing coordination and cooperation with other competent institutions and entities in matters such as “Prevention, correction, and elimination of all types of water pollution in irrigation districts,” “Preparation and updating of an inventory of national waters, as well as assessment of their potential use for utilization in irrigation districts,” and “Construction and maintenance of the works necessary for the conservation and replenishment of usable aquifers for agricultural activities in irrigation districts” (subsections c, ch, and f).
The powers of the Junta Directiva include issuing resolutions requesting recovery, expropriation, or purchase of the “(...) lands on or beneath which water resources are located (...)” (Articles 6° and 7°).
Finally, it should be emphasized that the Municipalidades also play a very important role in this matter. As established by Article 169 of the Constitución Política and the Código Municipal, the Municipalidades are responsible for administering local services and interests in order to promote the comprehensive development of the cantons in harmony with national development. In addition to addressing such services and interests, it is clear that the municipal governments are required to safeguard the rights of their residents. Municipal government is accountable to the members of its own cantons and therefore cannot remain inactive when the fundamental rights of residents are affected, as in this case with the right to receive drinking water for the protection of health and life. The foregoing is even more evident in the case of municipal water-supply systems, which are the responsibility of the municipality itself, but it also applies when jurisdiction lies with other agencies (Ministerio de Salud and ICAA), in which case the municipal corporations must activate whatever mechanisms are necessary to defend residents’ rights.
The case before us is no exception; accordingly, the municipalities must actively engage in planning and coordination with the other entities involved in order to safeguard the interests of their communities and, consequently, the fundamental rights of their inhabitants. It might be thought that all these multiple responsibilities mentioned above would cause chaos in administrative management. This is not the case, however, because, in order to avoid the simultaneous coexistence of spheres of authority of differing origins and nature, the duplication of national and local efforts, and confusion regarding the rights and obligations of the various parties involved, it is necessary to establish a series of coordinating relationships among the various agencies of the Executive Branch and the decentralized institutions, and between those institutions and the municipalities, so that they may carry out the functions entrusted to them.
This Chamber previously—and quite clearly—addressed the principle of coordination between public agencies and municipalities in pursuing common purposes—which must obviously be extended to the relationship between institutions of the Central Administration and decentralized institutions in performing this important function—and reference is therefore made to what was stated on that occasion (judgment number 1999-5445, at fourteen hours thirty minutes on fourteen July nineteen ninety-nine):
“Thus, coordination is the ordering of relationships among these various independent activities, taking account of their convergence upon the same object or entity so as to make that convergence useful within an overall public plan, without eliminating the reciprocal independence of the acting entities. Because there is no hierarchical relationship among decentralized institutions, or between the State itself and the municipalities, specific conduct cannot be imposed upon them. This gives rise to the indispensable interinstitutional ‘concerted action,’ in the strict sense, whereby autonomous and independent centers of action reach agreement on that preventive and comprehensive framework, within which each performs a role with a view to a mission entrusted to the others. Accordingly, relations between municipalities and other public entities may be conducted only on an equal footing, resulting in agreed forms of coordination and excluding any mandatory arrangement detrimental to municipal autonomy that would subject corporate entities to a coordination framework without or against their consent; nevertheless, the necessary subordination of these entities to the State and in the State’s interest is permissible (through the State’s ‘administrative oversight’ (tutela administrativa), specifically through the function of reviewing legality entrusted to it, with powers of general supervision over the entire sector).” Based on the foregoing, there can be no doubt that, in the present matter, any failure to fulfill the duty of coordination among public institutions could endanger the population’s health, because the definitive solution to the issue underlying this amparo proceeding (proceso de amparo) involves a number of interinstitutional actors, each possessing its own statutory powers.
X.Regarding the actions of ICAA and the Ministry of Health in the specific case. In the case under review (sub iudice), it has been established that, since 2010, several communities in the northern region of Alajuela and Guanacaste have been affected by arsenic contamination of water for human consumption. During this time, the ICAA National Water Laboratory has detected levels ranging from values below 10 µg/l to 187 µg/l, as in Aguas Zarcas, for example. Based on the foregoing considerations, there is no doubt that the presence of this chemical element in water in quantities exceeding permitted levels places the population’s health at serious risk, since it may eventually cause skin lesions, cardiovascular diseases, neurotoxicity, and diabetes, among other conditions; prolonged ingestion may even lead to death. For this reason, the public authorities responsible for health and the supply of drinking water, as well as the local governments involved, have been studying the matter in order to find a definitive solution to the problem, without excluding the involvement of additional agencies.
The Chamber notes that this type of problem requires a particularly expeditious solution, because the longer it continues, the greater the harm to people’s health and the more seriously their lives are endangered. To date, the situation has affected at least 12 thousand people in 23 communities and neighborhoods in Guanacaste and the northern region of Alajuela, including, by way of example, Cañas, Bagaces, La Cruz, Aguas Zarcas, and Los Chiles. The Chamber observes that the actions taken by the Ministry of Health and ICAA authorities include periodic sampling, multidisciplinary meetings, the issuance of health orders (órdenes sanitarias), replacement of pipelines, purchase of pumping equipment, replacement of contaminated sources, drilling of new wells, interconnection of aqueducts, and removal of contaminated springs (nacientes) from operation. To some extent, these actions have partially mitigated the problem.
Thus, the contamination in Hotel de Cañas was resolved on 26 de marzo through interconnection with the Libertad de Cañas system, as shown in official letter SUB-G-GSC-2013-0357. Likewise, on 6 de diciembre de 2012, the LAMBDA chemical laboratory sampled the water from the supply sources of the ASA-5 aqueduct (3 wells and one spring). The analysis results were issued on 31 de diciembre de 2012, and no arsenic concentrations were detected in any of the sources. Accordingly, with respect to the Vuelta de Kooper aqueduct, the evidence shows that the supply source was taken out of service and the ASA-5 aqueduct assumed responsibility for supplying water to the affected community. As for the Área Rectora de Salud de La Cruz, according to the 2010 results, the arsenic level in the water exceeded the permitted level (32 µg/l). In this regard, according to the sworn report, use of one well was prohibited and work continues to bring another well into service for proper supply; therefore, to date, drinking water of adequate quantity and quality has been provided.
Nevertheless, coordination between the Ministry of Health and ICAA has not always been harmonious. For example, through official letter number CH-ARS-B-352-2012, the Área Rectora de Salud de Bagaces informed Acueductos Comunales del ICAA that it had failed to provide fresh water by tanker truck, thereby exposing residents to health risks, and that it had also failed to complete the interconnection work. In addition, through official letter CH-ARS-B-526-2012, on 20 de noviembre de 2012, a complaint was filed with the Tribunales de Liberia for disobedience of authority and failure to comply with health order No. 117-2012. Moreover, the reports submitted in this matter do not establish that the arsenic problems in the La Virgen and Santa Cecilia aqueducts have been resolved; the same is true of the community of Bagaces. Likewise, neither the Ministry of Health nor ICAA yet has complete clarity regarding the extent of the problem.
This explains why ICAA has not ruled out regional solutions, both for its own systems and for those of the ASADAS, while adopting measures as knowledge of the situation progresses. Furthermore, although SENARA states that other potential sources of contamination should not be ruled out, it is equally true that the technical authorities involved in the matter from the outset (ab initio), based on the current state of knowledge in Costa Rica and the experiences of other countries, conclude that the arsenic originates as water passes through geological formations containing materials that release arsenic, which inevitably affects drinking-water sources. Consequently, the presence of arsenic in the affected areas is geographically widespread and may be found in surface water, groundwater, spring water, or well water. It follows that the problem of arsenic contamination of drinking water, although resolved in some places, persists in others, and there is a strong probability that it affects an extensive region and may even be occurring in other communities within the regions concerned.
Coordination among the various entities is therefore required, including the Ministry of Health, ICAA, SENARA, and the municipalities of the affected cantons, because even in places where successful measures have been taken, there remains an obligation to continuously monitor water quality, as contamination could recur given the probable natural origin of arsenic in the area. All the more so, in cantons where the problem persists, the municipality must intervene to safeguard its residents’ rights to a drinking-water supply. Accordingly, ICAA must ensure the supply of drinking water to the affected communities while the contamination problem is being resolved. Among other measures, supplying water by tanker trucks is feasible, it being understood that, pursuant to the principles of continuity and efficiency of public services, drinking water must be provided with due regularity and its quality ensured, while always recognizing that this is a provisional emergency measure and not a genuine solution to the problem.
In this regard, it has been alleged that on some occasions as much as one week has elapsed without a tanker truck visiting certain communities, which is unacceptable. This Chamber also emphasizes that the irregularity of the service has caused a series of difficulties for residents, who are often unable to meet their basic hygiene needs, thereby placing their health at risk. ICAA is advised that, although Article 2 of Ley 2726 authorizes it to enter into agreements with community organizations for the administration of aqueduct and sewerage systems, the respondent Instituto is ultimately responsible for matters relating to the operation, maintenance, administration, and development of the systems necessary to supply water to communities. Accordingly, Article 4 of Decreto Ejecutivo No. 32529, “Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales,” provides that ICAA may assume the administration, operation, maintenance, and development of all community aqueduct and/or sewerage systems, regardless of the identity of their administering entity, whenever the public service is not guaranteed in accordance with Article 4 of Ley General de la Administración Pública.
These systems shall be assumed by operation of law (de pleno derecho), together with all their duties, obligations, and assets.” This possibility cannot be overlooked by the ICAA authorities, which must act accordingly when an ASADA is found incapable of providing an effective solution to the problem at issue. As for the Ministry of Health, it has indeed issued health orders and carried out coordination efforts with other institutions to address the situation; nevertheless, it is a fact that the problem persists in several communities and that, given its presumed origin, the problem is very likely to be geographically extensive. Therefore, it cannot be said that, to date, the Ministry of Health’s actions have resulted in a definitive solution to the problem, despite its status as the governing authority for health matters. Accordingly, the petition for constitutional relief (amparo) against ICAA and the Ministry of Health is well-founded.
XI.Regarding the actions of the municipalities and SENARA. With respect to this point, as indicated in the preceding consideration, in addition to ICAA and the Ministry of Health, the municipalities of the affected cantons have a duty to coordinate with the technical entities in order to resolve the serious problem of arsenic contamination of drinking water that is harming their residents. From the established facts, it is concluded that the respondent municipalities have thus far acted within the scope of their authority to coordinate with the technical entities; moreover, there is no indication that any aqueduct is administered by a municipal corporation. However, even in places where successful measures have been taken, public authorities remain obligated to continuously monitor water quality because arsenic contamination could recur given the probable natural origin of the problem; ensuring that this is done also entails a supervisory duty on the part of the municipalities.
Likewise, in cantons where the problem persists, the municipalities must intervene to safeguard their residents’ rights to a drinking-water supply. Furthermore, it cannot be ruled out that other municipalities may assume greater responsibility in the future when municipal aqueducts are involved. In this case, however, the respondent municipalities do not appear to have been indifferent to the problem; rather, they have petitioned the competent technical bodies to resolve it. Therefore, this petition for constitutional relief does not lie against the respondent municipalities. With respect to SENARA, it has not participated in resolving the problem to date because, on the one hand, no request has been directed to that entity and, on the other, negotiations have taken place primarily among the Ministry of Health, ICAA, and the municipalities. Nevertheless, its authority over the matter is evident, since there may be a contamination problem in the aquifers (mantos acuíferos).
Therefore, although this particular petition for constitutional relief does not lie against the municipalities or SENARA, it is appropriate to order their active involvement in analyzing and resolving the problem, each within the scope of its respective authority.
XII.With regard to the Ministerio del Ambiente y Energía, Decreto Ejecutivo 37072 of March 22, 2012 was issued by the Executive Branch, represented by the President of the Republic and the Minister of Health, pursuant to the Ley General de Salud. That regulatory instrument concerns a public-health emergency (emergencia sanitaria) caused by deficiencies in the supply of water fit for human consumption. Accordingly, the Ministerio del Ambiente y Energía has had no involvement in this matter that could be subject to constitutional review (control de constitucionalidad), since the Executive Branch expressly entrusted the Ministerio de Salud with addressing the problem. Consequently, this amparo proceeding (recurso de amparo) does not lie against the Ministerio del Ambiente y Energía. With respect to the Comisión Nacional de Emergencias y Prevención de Riesgos, the appeal must likewise be dismissed because, as indicated, it has not been granted jurisdiction to intervene in matters of this kind.
It should be noted that this case does not involve a declaration of a state of emergency (Declaratoria de Estado de Emergencia) pursuant to Article 29 of Ley Nº 8488 of January 11, 2006 (Ley Nacional de Emergencias y Prevención del Riesgo), but rather a declaration of a public-health emergency (Declaratoria de Emergencia Sanitaria), which, despite the similarity of its name to the former, is governed by its own rules set forth in the Ley General de Salud. Compliance with it therefore falls to the ministerial authority responsible for health matters, the Ministerio de Salud, with the direct involvement of the entities directly responsible for supplying drinking water (ICAA) and protecting aquifers (SENARA), without prejudice to the indispensable coordination with the municipalities or to the possibility that other institutions may assist in resolving the problem.
XIII.By virtue of the foregoing considerations, the amparo proceeding is partially meritorious, with the consequences set forth in the operative portion (parte dispositiva) of the judgment.
Por tanto:
The appeal is hereby partially granted, solely against the Ministerio de Salud and the Instituto Costarricense de Acueductos y Alcantarillados. Daisy María Corrales Díaz and Javier Vargas Tencio, respectively the Minister of Health and General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds those offices, are ordered to issue immediately the required instructions and coordinate whatever is necessary so that, within six months, the cause of the arsenic contamination of water intended for human consumption in Guanacaste and the northern region of Alajuela is scientifically determined. To that end, they shall coordinate with SENARA and the affected municipalities, without prejudice to the participation of other entities, such as university research institutes. In the interim, the respondents (accionados) shall adopt all measures necessary to ensure that the affected populations receive drinking water in sufficient quantities and at sufficient intervals, as well as of the required quality; likewise, they shall assess the water quality in all affected aqueduct systems at least every three months.
Once the cause of the presence of arsenic in water intended for human consumption has been determined, the corresponding studies shall be made public, and the respondents (recurridos) shall adopt the appropriate measures to resolve the problem. As to the remaining respondents, the appeal is denied. The respondents are warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that the person must comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State and the Instituto Costarricense de Acueductos y Alcantarillados are ordered to pay the legal costs, damages, and losses caused by the acts underlying this ruling, which shall be determined during enforcement of the judgment before the administrative-law courts.
This decision shall be served personally upon Daisy María Corrales Díaz and Javier Vargas Tencio, respectively the Minister of Health and General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds those offices. Let it be communicated.- Gilbert Armijo S.

Resultando:
13- Informan bajo juramento Lizanías Zúñiga López y Xinia Guevara Contreras, por su orden Alcalde y Presidenta del Concejo Municipal de Cañas, que la Municipalidad en ningún momento ha administrado ninguno de los acueductos afectados. Señalan que, efectivamente, se conoce la problemática del agua contaminada con Arsénico, y ha sido un tema sumamente preocupante para el gobierno local, tanto así que se han tramitado varias consultas y reuniones con diferentes instituciones (ICAA, Ministerio de Salud) a fin de se les informara mejor sobre la problemática y posibles soluciones; sin embargo, lo único que se les ha manifestado es que el caso se encuentra en estudio y que no se cuenta con un sistema para eliminar Arsénico del agua. Recalcan que tienen toda la intensión de ayudar y continuarán investigando y tratando de buscar una solución definitiva; no obstante, las instituciones especializadas en el tema del agua y su laboratorio no han indicado solución alguna, por lo que hasta el momento no tienen idea de cómo ayudar.
Estiman que el Ministerio de Salud y en su defecto el ICAA son los encargados de brindar los mecanismos de solución. Una vez que se tenga claridad en cuanto a la solución, las otras instituciones públicas y la municipalidad, según sus posibilidades, estarán en la obligación de brindar apoyo económico, humano y equipo para ejecutar el proyecto de solución. Refieren que a la fecha, esa solución no se ha presentado ni por dichas instituciones ni por los vecinos de la zona o los recurrentes.
14-. En memorial recibido el 15 de mayo de 2013, Elizabeth Briceño C. y otros en su condición de vecinos de Bagaces, Guanacaste, presentan gestión de coadyuvancia activa. Solicitan se declare con lugar el recurso planteado, obligándose a los recurridos garantizar un suministro de agua completamente potable.
Redacta el Magistrado Rueda Leal; y,
Considerando:
I.Objeto del recurso. Los recurrentes estiman lesionados sus derechos fundamentales a la salud y la vida, pues pese a que desde hace más de un año decretó el Poder Ejecutivo emergencia sanitaria en Guanacaste y la zona norte de Alajuela debido a la contaminación del agua para consumo humano con Arsénico, la realidad es que a la fecha persiste el problema.
II.Sobre la gestión de coadyuvancia. Mediante escrito agregado al expediente el 7 de mayo de 2013, el Diputado Claudio Monge Pereira solicita que se le tenga como coadyuvante activo en el presente amparo. Sobre este particular, el numeral 34, párrafo 3 de la Ley de la Jurisdicción Constitucional, estipula que quien posea un interés legítimo en el proceso puede intervenir, sea en su perfil activo o pasivo, como coadyuvante. En el caso concreto, según lo indicado por el gestionante, existe un alto porcentaje de pobladores de varias zonas de Guanacaste que están recibiendo agua para consumo humano contaminada con arsénico, sin que a la fecha se haya dado una solución definitiva en aras de proteger la salud de la población, lo cual estima violenta los derechos fundamentales de los habitantes de la zona. En consecuencia, resulta admisible la referida solicitud de coadyuvancia. Observe el coadyuvante que por no ser actor principal, no resulta directamente afectado por la sentencia, ni por la condición de cosa juzgada del pronunciamiento, aunque puede de manera indirecta favorecerle la eficacia de lo resuelto por el carácter erga omnes de la jurisprudencia y los precedentes de este Tribunal Constitucional.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos: En cuanto al cantón de Cañas, Guanacaste: a) mediante oficio DR-CH-2011-2010 del 23 de diciembre de 2010, la Directora a.i Región Chorotega del Ministerio de Salud comunicó a los despachos de los Directores de las Áreas Rectoras de Salud de la región, sobre la existencia de Arsénico superior al límite permitido, en el agua para consumo humano de la zona de Cañas (ver folio 74 del expediente administrativo del Ministerio de Salud); b) el 4 de enero de 2011, el Laboratorio Nacional de Aguas del ICAA tomó una muestra de agua para análisis, la cual determinó que cumplía con el Reglamento para la Calidad del Agua Potable (ver folio 79 expediente administrativo del Ministerio de Salud); c) en oficio No. ICAACA-2011-006 del 14 de enero de 2011, el Jefe Cantonal del ICAA en Cañas comunicó a la Directora del Área Rectora de Salud que como solución a la problemática se estaría iniciando con la perforación de dos pozos (folio 78 del expediente administrativo del Ministerio de Salud); d) por oficio No. ICAACA-2011-013 del 25 de enero de 2011, el Jefe Cantonal del ICAA en Cañas informó a la Directora del Área Rectora de Salud que se había sacado de operación el pozo No. 6, por haberse determinado que era el causante de exceso del nivel de Arsénico permitido.
Le Indicó además, que se había tomado la decisión de perforar un nuevo pozo en Sandillal, pues era la alternativa más idónea, perforación que a la fecha llevaba un 70% de avance (ver folio 81 expediente administrativo Ministerio de Salud); e) el 08 de marzo de 2011, la Dirección Regional Chorotega del Ministerio de Salud emitió la orden sanitaria No. LAEO-011-2012, en la que se ordenó al Representante Cantonal del ICAA presentar en el plazo de 10 días un plan de acciones correctivas en orden de prioridad (folio 84 del expediente administrativo del Ministerio de Salud); f) el 14 de marzo de 2011, la Dirección Regional Chorotega del Ministerio de Salud emitió la orden sanitaria No. LAEO-012-2011, en la que ordenó al Director Regional del ICAA Liberia, que en plazo de 10 días presentara un plan de acciones correctivas en orden de prioridad (folio 85 del expediente administrativo del Ministerio de Salud); g) el acueducto de la ASADA de la Libertad se interconectó con el de Barrio Hotel (ver folio 92 del enero y 21 de febrero de 2012, así como 30 de enero de 2012, se detectaron niveles entre 3 y 10 µ g/l (ver folio 92 del expediente administrativo del Ministerio de Salud).
En lo referido a Bagaces, Guanacaste: a) mediante correo electrónico del 5 de enero de 2011, el Laboratorio Nacional de Aguas del ICAA remitió los resultados de los análisis del acueducto de Bagaces, en donde se muestra que la calidad del agua es potable (ver folio 76 del expediente administrativo del Ministerio de Salud); b) el 16 de setiembre de 2011 el Área Rectora de Salud de Bagaces recibió denuncia presentada por la Asociación de Desarrollo Integral de Agua Caliente, por agua contaminada con Arsénico (86 µg/l), según exámenes realizados el 19 de agosto de 2011 (ver folio 92 del expediente administrativo del Ministerio de Salud); c) el 22 de setiembre de 2011, el Área Rectora de Salud de Bagaces solicitó a la oficina del ICAA en Bagaces el abastecimiento de agua para Agua Caliente (ver folio 91 del expediente administrativo del Ministerio de Salud); d) el 26 de setiembre de 2011, el Área Rectora de Salud recibió informe del Laboratorio Nacional de Aguas con los resultados de los análisis de muestras tomadas el 02 de marzo de 2011, donde se reporta un nivel de Arsénico de 60 µ g/l, por lo que se recomendó buscar una fuente alterna para abastecer el acueducto, suplir agua con camiones cisterna y estudiar alternativas de tratamiento para eliminar el Arsénico en el agua (ver informe rendido bajo fe de juramento); e) el 28 de setiembre de 2011 el Área Rectora de Salud corroboró que se estaba brindando servicio de agua potable mediante camiones cisterna (ver manifestaciones rendidas bajo fe de juramento); f) en reunión sostenida el 28 de setiembre de 2011, la oficina de Acueductos Rurales del ICAA indicó a las demás autoridades que se estaban realizando estudios técnicos para suministrar agua de la ASADA de Montenegro (ver manifestaciones rendidas bajo juramento); g) el 24 de febrero de 2012 el Laboratorio Nacional de Aguas tomó una muestra del pozo de Agua Caliente, donde se evidencia un contenido de 80 µ g/l de Arsénico (ver informe rendido bajo fe de juramento); h) en reunión sostenida el 18 de julio de 2012, los representantes del ICAA indicaron que en dos días podía terminarse la construcción de la interconexión entre los acueductos de Montenegro y Agua Caliente; sin embargo, a la fecha, no se ha podido concretar (ver manifestaciones rendidas bajo fe de juramento por las autoridades recurridas); i) mediante orden sanitaria No. 117-2012, el Área Rectora de Salud de Bagaces ordenó tanto a los representantes del ICAA como a las ASADAS proveer a la comunidad de Agua Caliente de Bagaces agua potable en forma continua, en cantidad suficiente (ver manifestaciones rendidas bajo fe de juramento); j) el 20 de noviembre de 2012 el Área Rectora de Salud de Bagaces envió a los Tribunales de Liberia denuncia por desobediencia a la autoridad contra el ICAA y las ASADAS (ver manifestaciones rendidas bajo fe de juramento); k) en reunión sostenida el 21 de marzo de 2013, el Director Regional Chorotega solicitó al Gerente General del ICAA un cronograma con ruta crítica de las acciones pendientes para solucionar el problema en Agua Caliente.
El Ministerio de Salud apuntó en esa ocasión, que la solución de interconexión con Montenegro es temporal, ya que este acueducto también tiene valores de Arsénico más allá de los permitidos (ver manifestaciones rendidas bajo fe de juramento); l) los documentos enviados por parte del ICAA para cumplir con lo solicitado por la Regional del Ministerio de Salud en encuentran en revisión desde el 04 de abril de 2013 (ver manifestaciones rendidas bajo fe de juramento); m) la comunidad de Agua Caliente está siendo abastecida por camiones cisterna (ver informe bajo juramento). En lo relativo al cantón de La Cruz, Guanacaste: a) en el año 2010 se analizaron los acueductos de Puerto Soley y El Jobo de La Cruz, encontrándose niveles de Arsénico de 32 µ g/l, por lo que inmediatamente se decidió habilitar otro pozo (ver manifestaciones rendidas bajo fe de juramento); b) a la fecha no existe contaminación con Arsénico en La Cruz (ver manifestaciones rendidas bajo fe de juramento).
En cuanto a la zona norte de Alajuela: a) La Región Huetar Norte del Ministerio de Salud, en coordinación con las Áreas Rectoras de Salud, procedió a la toma de muestras en 47 fuentes de abastecimiento correspondientes a 26 ASADAS y el acueducto municipal de Ciudad Quesada (ver manifestaciones rendidas bajo fe de juramento); b) a excepción de los acueductos de La Virgen y Santa Cecilia, que presentan valores de Arsénico de 11.3 y 33.3 µ g/l, todas las restantes presentan niveles de Arsénico normales (ver manifestaciones rendidas bajo fe de juramento); c) el 3 de noviembre de 2011, la ASADA San José -La Gloria de Aguas Zarcas de San Carlos presentó en el Área Rectora de Salud de Salud de Aguas Zarcas reporte del Laboratorio Nacional de Aguas, en lo que se indican parámetros entre los 22 µ g/l y 95 µg/l (ver folio 64 del expediente administrativo del Ministerio de Salud); d) en reunión sostenida el 11 de noviembre de 2011, el Ministerio de Salud expuso la urgencia de intervenir el acueducto y sacar de operación las nacientes que se encontraban contaminadas (ver manifestaciones rendidas bajo fe de juramento); e) el 11 de noviembre de 2011, el Ministerio de Salud emitió la orden sanitaria No. OS-169-2011, en la que ordenó a las distintas dependencias del ICAA involucradas suspender las fuentes de abastecimiento que sobrepasaron los límites establecidos de Arsénico y asegurar el suministro inmediato de agua potable por otra vía.
Además, presentar un informe de acciones correctivas a ejecutar (ver manifestaciones rendidas bajo de juramento); f) el 01 de diciembre de 2011, el Presidente de la ASADA del acueducto San José -La Gloria, indicó a los funcionarios del Regionales del Ministerio de Salud y del ICAA que tiene un segundo pozo perforado y que iniciará la perforación de otro pozo (ver manifestaciones rendidas bajo fe de juramento); g) el 16 de diciembre de 2011 se recibió un nuevo reporte de análisis de muestras tomadas en setiembre de 2011, donde se pueden ver parámetros entre 139 y 187 µ g/l (ver folio 63 del Rectora de Salud notificó a las distintas dependencias del ICAA involucradas, así como a las ASADAS San José -La Gloria y Vuelta de Kopper, orden sanitaria No. OS-002-2012, en la que se dispuso suspender las fuentes de abastecimiento que sobrepasan los niveles de Arsénico permitidos, así como presentar un informe de acciones correctivas (ver informe rendido bajo juramento); i) en reunión multidisciplinaria sostenida el 10 de enero de 2012, se impartió una charla sobre la exposición de Arsénico en acueductos a nivel nacional y se presentaron las propuestas de empresas que brindan tecnología para la remoción del Arsénico (ver folio 45 del expediente administrativo del Ministerio de Salud); j) el 14 de febrero de 2012, el ICAA Regional realizó pruebas de bombeo y de calidad de agua del pozo nuevo del acueducto San José - La Gloria.
Los resultados fueron buenos, por lo que se pasó a sustituir la fuente contaminada con Arsénico (ver manifestaciones rendidas bajo fe de juramento); k) el 23 de febrero de 2012, en reunión con el Gerente del ICAA, se acordó que de inmediato se sacaran de operación las dos nacientes de Vuelta de Kooper y se interconectara con el acueducto ASA-5 (San José -La Gloria) (ver informe bajo juramento); l) a mediados de 2012, la UEN Gestión Ambiental del ICAA conformó un equipo multidisciplinario a nivel profesional y técnico que se dio a la tarea de ejecutar una serie de actividades y acciones tendientes a investigar y a detectar el origen y distribución espacial del impacto del Arsénico sobre las fuentes de agua para consumo humano, propiamente en la zona de Aguas Zarcas de San Carlos (ver prueba documental adjunta); n) el 6 de diciembre de 2012, se realizó un nuevo muestreo en las aguas de las fuentes de abastecimiento de agua para consumo humano en el acueducto ASA-5 (3 pozos y una naciente), por parte del Laboratorio LAMBDA.
Los resultados de los análisis de Arsénico fueron emitidos el 31 de diciembre de 2012, en los cuales no se detectó concentraciones de Arsénico en ninguna de las fuentes de abastecimiento del acueducto Rural San José -La Gloria, (ASA-5) (ver manifestaciones rendidas bajo fe de juramento); m) las nacientes de los acueductos de Vuelta de Kooper y Caño Negro de Aguas Zarcas, fueron suspendidos, y el acueducto ASA-5 asumió el abastecimiento de agua en esas comunidades (ver folio 43 del expediente administrativo del Ministerio de Salud).
IV.Hechos no probados. No se estima demostrado el siguiente hecho de relevancia para esta resolución: que los problemas de contaminación del agua para consumo humano con Arsénico en los acueductos de La Virgen y Santa Cecilia de Los Chiles, así como Montenegro y Agua Caliente de Bagaces hubieran sido resueltos en forma definitiva.
V.Sobre el Arsénico y sus implicaciones en la salud pública. De acuerdo con la nota descriptiva No. 372 de la Organización Mundial de la Salud (OMS), el elemento químico Arsénico (As) está presente de forma natural en niveles altos en las aguas subterráneas de varios países y es una de las 10 sustancias químicas que la OMS considera más peligrosas para la salud pública. La presencia de Arsénico en el agua potable puede resultar tanto de la disolución de mineral presente naturalmente en el suelo por donde fluye el agua antes de su captación para uso humano, como por la vía antrópica como consecuencia de pesticidas o contaminación industrial. Su mayor amenaza para la salud pública reside en la utilización de agua contaminada para beber, preparar alimentos y regar cultivos alimentarios. La exposición prolongada al Arsénico a través del consumo de agua y alimentos contaminados puede causar cáncer y lesiones cutáneas.
También se ha asociado a problemas de desarrollo, nfermedades cardiovasculares, neurotoxicidad y diabetes. La intervención más importante en las comunidades afectadas consiste en prevenir que se prolongue la exposición al Arsénico implantando un sistema seguro de abastecimiento de agua potable. El Arsénico existe tanto en forma orgánica como inorgánica. Los compuestos de Arsénico inorgánico (como los que se encuentran en el agua) son extremadamente tóxicos, en tanto que los compuestos de Arsénico orgánico (como los que se encuentran en pescados y mariscos) son menos perjudiciales para la salud. Según la OMS, existen diversas opciones para reducir los niveles de Arsénico en el agua potable, tales como sustituir las fuentes de abastecimiento con elevados niveles de Arsénico, reservar el agua con bajos niveles de Arsénico para beber, cocinar y regar y utilizar el agua con mayor concentración para otros fines, discriminar entre las fuentes de abastecimiento con altos niveles de Arsénico y aquellas con bajos niveles de ese elemento químico, mezclar agua con bajos niveles de Arsénico con agua de concentración más elevada a fin de conseguir más cantidad de agua con un nivel de concentración aceptable, instalar sistemas de eliminación del Arsénico -ya sea de manera centralizada o a nivel doméstico -y asegurar que el Arsénico eliminado se someta a un tratamiento de residuos adecuado.
Entre las tecnologías que permiten eliminar el Arsénico destacan la oxidación, la coagulación-precipitación, la absorción, el intercambio de iones y diversas técnicas de membranas, nanofiltración, adsorción, coagulación filtración y remoción biológica, etc. todo lo cual requiere también de la tecnología correspondiente a los temas de disposición final del químico.
VI.Sobre el nivel recomendado de Arsénico en el agua para consumo humano. La OMS ha definido un valor guía para el Arsénico en sus “Guías Para la Calidad del Agua Potable ´, cuya finalidad es servir de base en las tareas de reglamentación y normalización de este problema. En estos momentos, el límite recomendado para la concentración de Arsénico en el agua potable es de 10 µg/l, aunque este valor de referencia es considerado como provisional dada las dificultades de medición y los obstáculos prácticos relacionados con la eliminación del Arsénico del agua de bebida. Según reconoció la Ministra de Salud, permitir que el agua para consumo humano posea una cantidad de Arsénico superior a un valor de 10 µ g/l, puede poner en riesgo la salud de la población. Cabe agregar que este parámetro es congruente con los niveles permitidos en el Decreto Ejecutivo No. 32327 denominado ³Reglamento para la Calidad del Agua Potable´, donde se establece un máximo de 0.01 mg/L, lo que es igual a 10 µ g/l.
VII.Sobre el derecho de acceso al agua potable. En reiteradas resoluciones esta Sala ha reconocido un derecho fundamental al agua potable, así se dispuso en la sentencia No. 2006-05606 de las 15:21 horas del 26 de abril de 2006, lo siguiente:
“VII.-El acceso al agua potable como derecho humano. Adicionalmente a lo señalado, y talvez el aspecto más relevante en este tema, lo constituye la naturaleza y función del agua para la vida humana. No es necesario detallar aquí una explicación sobre la realidad evidente y notoria de que sin agua no puede haber vida, ni calidad de vida, y que por lo tanto, con ley o sin ley de nacionalización, por su propia esencia, este tema, no es ni puede ser un tema territorial o local. La propia Sala en su jurisprudencia constitucional ha dicho que el acceso al agua potable es un derecho humano fundamental, en cuanto se configura como un integrante del contenido del derecho a la salud y a la vida. (SALA CONSTITUCIONAL, sentencias números 534-96, 2728-91, 3891-93, 1108-96, 2002-06157 2002-10776; 2004-1923). Esta misma línea se ha mantenido en las sentencias 2003-04654 y 2004-07779 .(…)”
VIII.Sobre el adecuado funcionamiento de los servicios públicos . Nuestra Constitución Política recoge, implícitamente, el derecho fundamental de los administrados al buen y eficiente funcionamiento de los servicios públicos, esto es, que sean prestados con elevados estándares de calidad, el cual tiene como correlato necesario la obligación de las administraciones públicas de prestarlos de forma continua, regular, célere, eficaz y eficiente. Esa garantía individual atípica o innominada se acentúa en tratándose de servicios públicos esenciales como el suministro de agua potables. Los jerarcas de las instituciones involucradas no pueden invocar, para justificar una atención deficiente y precaria, la carencia de recursos financieros, humanos y técnicos, puesto que un imperativo constitucional es la obligación de que los servicios públicos sean prestados de forma eficiente, eficaz, continua, regular y célere, máxime cuando está de por medio el resguardo de derechos constitucionales absolutamente esenciales: la salud y la vida las personas.
IX.Sobre las competencias del Ministerio de Salud, el Instituto Costarricense de Acueductos y Alcantarillados, el SENARA y las municipalidades en materia de suministro de agua destinada al consumo de la población. De conformidad con dicha legislación, la utilización del agua para el consumo humano es prioritaria y, por ende, todo sistema de abastecimiento de agua destinada al uso y consumo de la población debe suministrar agua potable en forma continua y en cantidad suficiente para satisfacer las necesidades de las personas (art. 267). El artículo 268 de ese cuerpo normativo establece que corresponde al Ministerio de Salud verificar la calidad del agua que se suministre a la población y velar porque los elementos constitutivos de los sistemas, su funcionamiento y estado de conservación garanticen el suministro adecuado y seguro, pudiendo ser intervenido por el Ministerio si hubiera peligro para la salud de los habitantes.
En concordancia con lo anterior, el numeral 368 faculta al Ministerio de Salud a intervenir en casos de peligro, amenaza o de invasión de epidemia, para tomar a su cargo la protección de las fuentes de agua potable y adoptar las acciones correspondientes para proteger la salud de la población. En lo que respecta a las competencias del Instituto Costarricense de Acueductos y Alcantarillados, cabe indicar que mediante su Ley Constitutiva, Ley No. 2726 de 14 de abril de 1961 y sus reformas, se estableció que es la institución competente para dirigir y vigilar todo lo concerniente a proveer a los habitantes de la República de un servicio de suministro de agua potable y recolección y evacuación de aguas negras, así como de residuos industriales líquidos y de aguas pluviales en las áreas urbanas. Sobre el particular, el artículo 2° señala en lo conducente:
“Artículo 2.- (*) Corresponde al Instituto Costarricense de Acueductos y Alcantarillados:
Bajo ningún concepto podrá delegar la administración de los sistemas de acueductos y alcantarillado sanitario del Área Metropolitana.
Tampoco podrá delegar la administración de los sistemas sobre los cuales exista responsabilidad financiera y mientras ésta corresponda directamente al Instituto.
Por su parte, el SENARA (Sistema Nacional de Aguas Subterráneas, Riego y Avenamiento), a pesar de tener aparentemente limitada su competencia a los distritos de riego, avenamiento y control de inundaciones -unidades físicas técnico administrativas de carácter agropecuario para el logro de su desarrollo socioeconómico definidas por Decreto Ejecutivo a solicitud de este ente (artículos 17 y 18 de su Ley de Creación No. 6877 del 18 de julio de 1983 y sus reformas)-, es lo cierto que su ley constitutiva le asigna importantes competencias en materia de protección de recurso hídrico. Lo anterior resulta corroborado por los antecedentes de este ente público, puesto que, la Ley No. 5438 del 17 de diciembre de 1973 -que ratificó y sustituyó el Decreto Ejecutivo No. 1878-P del 22 de julio de 1972-, actualmente derogada, creó el Servicio Nacional de Aguas Subterráneas (SENAS) con una vocación claramente nacional para la planificación, investigación y asesoría de todo lo relativo a la materia.
Por su parte, en la ley vigente número 6877 del 18 de julio de 1983, entre sus funciones, figura la de "Investigar, proteger y fomentar el uso de los recursos hídricos del país tanto superficiales como subterráneos” y " Realizar, coordinar, promover y mantener actualizadas las investigaciones hidrológicas, hidrogeológicas (...)” (art. 3, incisos ch y e). En el artículo 4 se establece que le compete al SENARA promover y dirigir la coordinación y colaboración con otras instituciones y entidades competentes en materias tales como "Prevención, corrección y eliminación de todo tipo de contaminación de las aguas en los distritos de riego", "Elaboración y actualización de un inventario de las aguas nacionales, así como la evaluación de su uso potencial para efectos de aprovechamiento en los distritos de riego” y “Construcción y mantenimiento de las obras necesarias para la conservación y renovación de los manos acuíferos aprovechables para las actividades agropecuarias en los distritos de riego´(incisos c, ch y f).
Dentro de las atribuciones de la Junta Directiva está la de expedir los acuerdos de solicitud de recuperación, expropiación o compra de las “(...) tierras en que asienten o subyazcan recursos hídricos (...)” (artículos 6° y 7°).
Finalmente, procede destacar que las Municipalidades también juegan un papel muy importante en esta materia. Conforme lo establece el artículo 169 de la Constitución Política y el Código Municipal, corresponde a las Municipalidades la administración de los servicios e intereses locales, con el fin de promover el desarrollo integral de los cantones en armonía con el desarrollo nacional. Además de atender tales servicios e intereses, está claro que las municipalidades están obligadas a velar por los derechos de sus munícipes. El gobierno municipal se debe a los miembros de sus propios cantones, de manera que no puede permanecer inerte, cuando a los munícipes se les afectan derechos fundamentales, como ocurre en la especie con el derecho a recibir agua potable a los efectos de la salud y la vida. Lo anterior más que evidente cuando se trata de acueductos municipales, que son responsabilidad de la propia municipalidad, pero también aplica cuando la competencia recae en otras dependencias (Ministerio de Salud e ICAA), en cuyo caso las corporaciones municipales deben activar los mecanismos que sean necesarios para defender los derechos de los munícipes.
El caso que nos ocupa no es la excepción, de manera que corresponde a las municipalidades promover una labor activa de planificación y coordinación con los demás entes involucrados a fin de tutelar los intereses de sus comunidades y con ello los derechos fundamentales de sus habitantes. Ahora bien, podría pensarse que todas estas múltiples responsabilidades mencionadas anteriormente provocarían un caos en la gestión administrativa, lo cual no es cierto, por cuanto a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, es que se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas.
Esta Sala con anterioridad -y en forma bastante clara- se refirió al principio de coordinación de las dependencias públicas con las municipalidades en la realización de fines comunes -lo cual, obviamente se debe hacer extensivo a la relación que en esta importante función realizan las instituciones de la Administración Central y las descentralizadas-, para lo cual se remite a lo indicado en aquella ocasión (sentencia número 1999-5445, de las catorce horas treinta minutos del catorce de julio de mil novecientos noventa y nueve):
"De manera que la coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes. Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible «concierto» interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros. Así, las relaciones de las municipalidades con los otros entes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de éste (a través de la «tutela administrativa» del Estado, y específicamente, en la función de control la legalidad que a éste compete, con potestades de vigilancia general sobre todo el sector).” Partiendo de lo dicho, no cabe duda de que en el presente asunto, cualquier omisión al deber de coordinación entre instituciones públicas podría poner en peligro la salud de la población, por cuanto la solución definitiva a la problemática objeto de amparo abarca una serie de actores interinstitucionales, cada uno con sus competencias legales.
X.Sobre las actuaciones del ICAA y el Ministerio de Salud en el caso concreto. En el sub iudice, se tiene por acreditado que desde el año 2010, varias comunidades de la zona norte de Alajuela y Guanacaste se han visto afectadas por la contaminación con Arsénico del agua para consumo humano. Durante este tiempo, el Laboratorio Nacional de Aguas del ICAA ha detectado niveles que van desde valores inferiores a 10 µ g/l hasta de 187 µ g/l, como por ejemplo en Aguas Zarcas. De acuerdo con lo expuesto en los considerandos anteriores, no cabe duda de que la presencia de este elemento químico en el agua en cantidades fuera de lo permitido, pone en grave riesgo la salud de la población, ya que puede producir a futuro lesiones en la piel, enfermedades cardiovasculares, neurotoxicidad y diabetes, entre otros; incluso, una ingesta prolongada del mismo puede llevar a la muerte. Por tal razón, las autoridades públicas rectoras en materia de salud y suministro de agua potable, así como los gobiernos locales involucrados, han venido estudiando la problemática con el fin de buscar una solución definitiva al problema, lo que no excluye la intervención de más dependencias.
Advierte la Sala que este tipo de problema exige una solución particularmente célere, puesto que entre más tiempo transcurra, más se acrecienta el daño a la salud de las personas y se compromete seriamente su vida. A la fecha, la situación ha afectado a por lo menos 12 mil personas de 23 comunidades y barrios de Guanacaste y la zona norte de Alajuela, dentro de los que se pueden mencionar a manera de ejemplo: Cañas, Bagaces, La Cruz, Aguas Zarcas y Los Chiles. Observa la Sala que dentro de las acciones tomadas por las autoridades del Ministerio de Salud y el ICAA, están la toma periódica de muestras, reuniones multidisciplinarias, confección de órdenes sanitarias, cambio de tuberías, compra de equipo de bombeo, sustitución de fuentes contaminadas, perforación de nuevos pozos, interconexiones de acueductos y retirado de operación de nacientes contaminadas. De alguna forma, estas acciones han logrado mitigar parcialmente el problema.
Así, la contaminación de Hotel de Cañas fue solucionada el pasado 26 de marzo con la interconexión al sistema de la Libertad de Cañas, como se aprecia en el oficio SUB-G-GSC-2013-0357. Asimismo, el 6 de diciembre de 2012 se realizó un muestreo de las aguas en las fuentes de abastecimiento en el acueducto ASA-5 (3 pozos y una naciente) por parte del laboratorio químico LAMBDA. Los resultados de los análisis fueron emitidos el 31 de diciembre de 2012, en los que no se detectaron concentraciones de Arsénico en ninguna de las fuentes. De este modo, con respecto al acueducto Vuelta de Kooper se evidencia que la fuente de abastecimiento fue suspendida, y el acueducto ASA-5 asumió el abastecimiento de agua en la comunidad afectada. En cuanto al Área Rectora de Salud de La Cruz, según resultados del año 2010, se encontró que el nivel de Arsénico en el agua sobrepasaba lo permitido (32 µ g/l). Al respecto, según se informa bajo juramento, se prohibió el uso de un pozo y se continúa con la habilitación de otro pozo para su debido suministro, por lo que a la fecha se ha brindado agua potable en cantidad y calidad.
No obstante, la coordinación entre el Ministerio de Salud y el ICAA no ha sido siempre armónica. Por ejemplo, mediante oficio número CH-ARS-B-352-2012, el Área Rectora de Salud de Bagaces indicó a Acueductos Comunales del ICAA que había incumplido con las provisiones de agua viva vía camión cisterna, exponiéndoles a riesgos para la salud, y que, además, no habían concluido la obra de interconexión. En adición, mediante oficio CH-ARS-B-526-2012, el 20 de noviembre de 2012 se formuló ante los Tribunales de Liberia una denuncia por desobediencia a la autoridad e incumplimiento de la orden sanitaria No. 117-2012. Por otro lado, de los informes aportados a este asunto no se colige que los problemas de Arsénico en los acueductos La Virgen y Santa Cecilia hayan sido resueltos, al igual que ocurre con la comunidad de Bagaces. Asimismo, ni el Ministerio de Salud ni el ICAA tienen absoluta claridad aún sobre la extensión del problema.
Lo anterior explica que el ICAA no haya descartado soluciones regionales, tanto para sus propios sistemas como para los de las ASADAS, al tiempo que ha venido adoptando disposiciones en la medida que se avanza en el conocimiento del estado de la situación. De otro lado, aunque el SENARA indica que no se deben descartar otras posibles fuentes de contaminación, no menos cierto es que las autoridades técnicas que ab initio han intervenido en el asunto, con base en el nivel de conocimiento actual en el Costa Rica y las experiencias en otros países concluyen que el Arsénico se origina en el paso de las aguas a través de formaciones geológicas que contienen materiales que liberan el Arsénico, lo que irremediablemente afecta las fuentes de agua potable. En consecuencia, la presencia del Arsénico en las zonas afectadas es geográficamente muy extensa y puede encontrarse en aguas superficiales, subterráneas, de manantiales o de pozos.
De lo anterior resulta que el problema de contaminación de agua potable con Arsénico, si bien resuelto en algunos lugares, persiste en otros y existe una gran probabilidad de que afecte una región extensa, incluso que se esté dando en otras comunidades de las regiones involucradas. De ahí que se requiera una coordinación entre las diversas entidades, lo cual comprende tanto al Ministerio de Salud, el ICAA y el SENARA, como a las municipalidades de los cantones afectados, puesto que aun en aquellos lugares donde se han tomado medidas exitosas, persiste la obligación del monitoreo constante de la calidad del agua que podría reaparecer dada la probable génesis natural del Arsénico en la zona; con mucho más razón, en los cantones donde persiste el problema, debe la Municipalidad intervenir a los efectos de velar por los derechos de sus munícipes al suministro del agua potable. Así las cosas, el ICAA debe velar por asegurar el suministro de agua potable a las comunidades afectadas mientras se resuelve el problema de contaminación.
Entre otras medidas, resulta viable el suministro de agua por cisternas, en el entendido de que en virtud de los principios de continuidad y eficiencia del servicio público, se debe brindar agua potable con la regularidad debida y asegurando su calidad, siempre comprendiendo que se trata de una medida provisional y de urgencia, no ninguna solución real al problema. Al respecto, se ha planteado que en ocasiones ha transcurrido hasta una semana sin que el cisterna pase por ciertas comunidades, lo cual es inaceptable. Esta Sala subraya, asimismo, que la irregularidad en el servicio ha traído una serie de inconvenientes a los vecinos, quienes muchas veces no pueden cubrir sus necesidades básicas de aseo, lo que ha puesto en riesgo su salud. Advierta el ICAA que si bien el artículo 2 de la Ley 2726 lo faculta para convenir con organismos comunales la administración sistemas de acueductos y alcantarillados, el Instituto recurrido es responsable en última instancia de los asuntos relativos a la operación, mantenimiento, administración y desarrollo de los sistemas necesarios para el suministro de agua a las poblaciones.
A partir de lo anterior, el artículo 4 de Decreto Ejecutivo No. 32529 “Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales”, estipula que el ICAA podrá asumir la administración, operación, mantenimiento y desarrollo de todos los sistemas de acueductos y/o alcantarillado comunales, indistintamente de quien sea su ente administrador, cuando no se garantice el servicio público de conformidad con el artículo 4 de la Ley General de la Administración Pública. Estos sistemas serán asumidos de pleno derecho con todos sus deberes, obligaciones y patrimonio”. Esta posibilidad no puede pasar desapercibida por las autoridades del ICAA, quienes deberán actuar de conformidad cuando se establezca la incapacidad de una ASADA para brindar una solución efectiva al problema de marras. En cuanto al Ministerio de Salud, ciertamente ha dictado órdenes sanitarias y ha llevado a cabo labores de coordinación con otras instituciones para atender la situación; empero, es un hecho que el problema persiste en varias comunidades y es muy probable que por su presunta génesis la problemática sea extensa geográficamente, por lo que no se puede decir que a la fecha, la actuación del Ministerio de Salud haya redundado en una solución precisa a la problemática, a pesar del ser la entidad rectora en materia de salud. Así las cosas, resulta procedente el amparo contra el ICAA y el Ministerio de Salud.
XI.Sobre la actuación de las municipalidades y el SENARA. En lo referido a este punto, como se indicó en el considerando anterior, además del ICAA y el Ministerio de Salud, las municipalidades de los cantones afectados tienen el deber de coordinar con las entidades técnicas a efectos de solventar el grave problema de contaminación del agua potable con Arsénico que perjudica a sus munícipes. De la relación de hechos probados, se concluye que las municipalidades accionadas han actuado a la fecha dentro del ámbito de sus competencias para coordinar con las entidades técnicas; además, no se advierte la existencia de algún acueducto administrado por una corporación municipal. Ahora bien aun en aquellos lugares en donde se han tomado medidas exitosas, persiste la obligación del monitoreo constante de la calidad del agua por parte de las autoridades públicas pues la contaminación con Arsénico podría reaparecer dada la probable génesis natural del problema; velar porque ello se haga también implica un deber de control por parte de las municipalidades.
Asimismo, en los cantones donde persiste el problema, deben las municipalidades intervenir a los efectos de resguardar los derechos de sus munícipes al suministro del agua potable. Por lo demás, no se puede descartar que en el futuro otras municipalidades adquieran mayor responsabilidad cuando se trate de acueductos municipales. Ahora bien, en la especie, no se aprecia que las municipalidades accionadas hayan sido indiferentes al problema, sino que han gestionado ante los órganos técnicos competentes la solución al mismo; por ello, contra las municipalidades accionadas no procede este amparo. Respecto del SENARA, a la fecha no ha participado en la solución del problema, toda vez que, por un lado, ninguna gestión ha sido dirigida a esa entidad y, por el otro, las negociaciones se han dado básicamente entre el Ministerio de Salud, el ICAA y las municipalidades. No obstante, es evidente su competencia en la materia por cuanto se podría estar dando un problema de contaminación en los mantos acuíferos.
De ahí que en cuanto a las municipalidades y el SENARA, a pesar de que no proceda este amparo en particular, sí resulta conveniente que se ordene su incorporación activa en el análisis y solución del problema, todo ello dentro de lo concerniente a sus competencias correspondientes.
XII.En lo atinente al Ministerio del Ambiente y Energía, el Decreto Ejecutivo 37072 de 22 de marzo de 2012 fue emitido por el Poder Ejecutivo en la figura de la Presidenta de la República y la Ministra de Salud con base en la Ley General de Salud. Dicho cuerpo normativo consiste en una emergencia sanitaria causada por deficiencias en el suministro de agua apta para el consumo humano. Así las cosas, el Ministerio del Ambiente y Energía no ha tenido participación en este asunto que pudiera ser objeto de control de constitucionalidad, toda vez que el Poder Ejecutivo expresamente encomendó la atención del problema al Ministerio de Salud. Consiguientemente, este amparo no procede contra el Ministerio del Ambiente y Energía. Con respecto a la Comisión Nacional de Emergencias y Prevención de Riesgos, igualmente se debe desestimar el recurso, toda vez que tal y como se indicó, no se le ha otorgado competencia para intervenir en este tipo de asuntos.
Adviértase que aquí no se está ante la emisión de una Declaratoria de Estado de Emergencia con base en el artículo 29 de la Ley Nº 8488 del 11 de enero del 2006 (Ley Nacional de Emergencias y Prevención del Riesgo), sino ante una Declaratoria de Emergencia Sanitaria, última que a pesar de la similitud de su nombre con la primera, se rige por sus propias normas dispuestas en la Ley General de Salud, de modo que su cumplimiento incumbe a la dependencia ministerial rectora en Salud, el Ministerio de Salud, con el directo involucramiento de las entidades directamente responsables por el suministro de agua potable (el ICAA) y la protección de los mantos acuíferos (el SENARA), sin demérito de la ineludible coordinación con las municipalidades y de que otras instituciones pudieran coadyuvar en la solución al problema.
XIII.En virtud de las consideraciones expuestas, el recurso de amparo resulta parcialmente procedente, con las consecuencias que se dirán en la parte dispositiva de la sentencia.
Por tanto:
Se declara parcialmente con lugar el recurso, únicamente contra el Ministerio de Salud y el Instituto Costarricense de Acueductos y Alcantarillados. Se ordena a Daisy María Corrales Díaz y Javier Vargas Tencio, por su orden Ministra de Salud y Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes ocupen esos cargos, que de inmediato emitan las instrucciones requeridas y coordinen lo necesario para que en el plazo de seis meses, se determine científicamente la causa de la contaminación del agua para consumo humano con Arsénico en Guanacaste y la zona norte de Alajuela, para cuyo efecto deberán coordinar con el SENARA y las municipalidades afectadas, sin demérito de que participen otras entidades, como institutos universitarios de investigación. En el ínterin, los accionados deberán adoptar todas las medidas necesarias para que las poblaciones afectadas reciban agua potable con la cantidad y periodicidad suficiente así como con la calidad requerida; asimismo, como mínimo cada tres meses deberán evaluar la calidad del agua en todos los acueductos que se han visto afectos.
Una vez determinada la causa de la presencia de Arsénico en el agua destinada al consumo humano, los estudios respectivos deberán hacerse del conocimiento público y los recurridos deberán adoptar las medidas correspondientes para solucionar tal problema. En cuanto a los demás accionados se declara sin lugar el recurso. Se apercibe a los recurridos que con base en lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y la Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
Notifíquese esta resolución a Daisy María Corrales Díaz y Javier Vargas Tencio, por su orden Ministra de Salud y Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes ocupen esos cargos, en forma personal. Comuníquese.- Gilbert Armijo S.
