*090122750007CO* CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at eighteen hours and six minutes on the twenty-third of March, two thousand eleven.
Writ of amparo (recurso de amparo) filed by Carlos Esquivel Esquivel, of legal age, holder of identity card number 1-272-278, in his capacity as President of the Asociación Administradora del Acueducto de Sámara, against the Ministro del Ambiente, Energía y Telecomunicaciones, the Head of the Water Department of that Ministry, the Director of the Área de Conservación Tempisque, Nicoya Office, and the Executive President of the Instituto Costarricense de Acueductos y Alcantarillados.
Background:
La Quebrada, upstream, has several springs (nacimientos) that supply water to that source: the Santo Domingo, Cenicero, Viscoyol, and Escabel 1 and 2 springs. It was determined that, downstream from the SUA properties, a flow rate (caudal) of 5,00 liters per second was running. In a filing dated 4 de setiembre de 2008, the Junta Directiva del Acueducto Rural de Santo Domingo de Sámara challenged the inspection report, describing it as superficial, partial, and unscientific. Geógrafo Porras Vega addressed the criticisms in official letters (oficios) IMN-DA-3645-2008 del 22 de octubre de 2008 and IMN-DA-3645-2009 del 7 de enero de 2009. The official letter dated 7 de enero of this year was served on the ASADA de Santo Domingo de Sámara. A pending registration application filed by the Instituto Costarricense de Acueductos y Alcantarillados for two wells with a flow rate of 23 liters per second was recorded in the name of the ASADA de Sámara.
An application by Acueductos y Alcantarillados to reserve the water resource (recurso hídrico) of the ASADA de Sámara from the Santo Domingo 1, Cenicero 2, Viscoyol 3, Mango, Buenos Aires, San Lucas, Terciopelo 2, Terciopelo 5, Escabel 1 No6, Escabel 2 No5, and Arguedas 1, 2, 3, 4, 5 and 6 springs, for a total flow rate of 4,879 liters per second, remains pending. According to AyA, the demand of the ASADA de Samara is 1344 inhabitants, equivalent to 320 projected. Pursuant to the Manual de Dotaciones del Departamento de Agua, for a 25-year projection of the natural population growth of the community served by the ASADA de Sámara, based on the demand indicated by AyA, the flow rate required to meet its needs is 6,06 liters per second. Regarding the projection compared with the registered and pending-registration flow rates (two wells), the ASADA de Sámara currently has an available and registered flow rate of 9,40 liters per second, plus two wells pending registration, for a total flow rate of 34,40 liters per second; therefore, long-term demand, equivalent to 6,06 liters per second, is fully covered.
If sufficient water is unavailable, there is an order of priority for meeting needs, with water-supply systems for communities ranking first. SENARA will be asked to issue a certification regarding water availability. They request that the appeal be dismissed.
Justice Armijo Sancho authored the opinion; and,
Considering:
I.Subject matter of the petition. The petitioner considers the construction of an artificial lake in Santo Domingo de Sámara, supplied by sixteen springs, to be contrary to the right to a healthy and ecologically balanced environment, as well as the right of access to water, with the resulting harm to the potable-water supply of the local inhabitants.
II.Proven facts. For purposes of deciding this matter, the following facts are deemed duly established, either because they have been proven or because the respondent failed to address them as ordered in the initial ruling:
III.Merits. Before the amendment of Article 50 of the Political Constitution (Constitución Política), the case law of the Chamber had recognized the protection and preservation of the environment as a fundamental right (judgment #2233-93), deriving it from Articles 21 (right to health), 69 (the constitutional requirement of the “rational use of land”) and 89 (protection of natural beauty), all of the Constitution. Article 50 was amended by Ley #7412, of 3 de junio de 1994, for the purpose of expressly stating the State’s obligation to protect the environment and granting citizens a full right of action to defend it, thereby giving explicit content to the fundamental right to a healthy and ecologically balanced environment. In this regard, its third paragraph states: “The State shall guarantee, defend, and preserve that right.” Protecting the environment requires intervention by public authorities with respect to factors that may disturb its balance and hinder individuals’ development and ability to live in a healthy environment.
Environmental protection must be directed toward the appropriate and intelligent use of its elements within their natural, sociocultural, technological, and political relationships—sustainable development (desarrollo sostenible)—thereby safeguarding the heritage to which present and future generations are entitled. Accordingly, the primary objective of environmental use and protection is to ensure that the production and use of technology yield not only economic gains (freedom of enterprise) but also development and evolution favorable to the environment, natural resources, and human beings—that is, without causing harm or injury (judgment #2006-11470 at 16:30 hours on 8 de agosto de 2006). The State—as a whole—also has an obligation to take the measures necessary to protect the environment, in order to prevent levels of pollution, deforestation, extinction of flora and fauna, and excessive or improper use of natural resources that endanger the health of the governed.
Failures to fulfill the duty to protect the environment and comply with environmental regulations are constitutionally significant because administrative inaction in this area may cause irreversible damage.
IV.The right to potable water (agua potable), in turn, derives from the fundamental rights to health, life, a healthy environment, food, and adequate housing, among others, as recognized in international human-rights instruments applicable in Costa Rica: it appears explicitly in the Convention on the Elimination of All Forms of Discrimination against Women (art. 14) and the Convention on the Rights of the Child (art. 24); it is also stated in the Cairo International Conference on Population and Development (principle 2). Within our Inter-American Human Rights System, the country is particularly bound by the provisions of article 11.1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (“Protocol of San Salvador” of 1988), which provides:
“Article 11. Right to a healthy environment 1. Everyone shall have the right to live in a healthy environment and to have access to basic public services.” Furthermore, the UN Committee on Economic, Social and Cultural Rights reiterated that access to water is a human right which, in addition to being indispensable for leading a healthy life, is a prerequisite for the realization of all other human rights (see the judgments of the Chamber (Sala) #4654-2003 of 15:44 hours on 27 de mayo de 2003, #2755-2000 of 10:48 hours on 24 de marzo de 2000, #9629-2002 of 11:09 hours on 4 de octubre de 2002, and #2009-10678 of 15:11 hours on 7 de julio del 2009).
V.In addition to making serious efforts to provide service to the population, public institutions have a duty to use the available water resource (recurso hídrico) responsibly and judiciously. This entails having certainty as to the water that may be exploited—availability—thereby guaranteeing its present allocation and the future sustainability of the service, and preventing the current use of the resource from creating an environmental risk that jeopardizes the future existence and supply of water. The Chamber has had occasion to rule forcefully and in detail on the protection that must be afforded to the nation’s water resources, clarifying both the regulatory framework for their protection and the institutions comprising the water sector, and recognizing and specifying the scope of those entities’ authority and the significance of their actions concerning the allocation, use, and protection of water (judgment #2009-262 of 14:30 hours on 14 de enero de 2009. See, to the same effect, decisions #2004-1923 of 14:55 hours on 25 de febrero de 2004; #2008-14092 of 9:28 hours on 23 de setiembre and #2008-15657 of 11:45 hours on 17 de octubre, both of 2008).
VI.In the case presented by the petitioner, the company that owns a tourism-oriented housing development and the ASADA de Santo Domingo de Sámara, which is responsible for supplying potable water to that community, are competing for water resources. The Sociedad de Usuarios de Agua de las Ventanas de Carrillo obtained the right to draw water (captación) from several local sources under two surface-water use concessions (concesiones de aprovechamiento de aguas superficiales) granted by the Departamento de Aguas del Ministerio del Ambiente, Energía y Telecomunicaciones in 1999 and 2000, both of which have now expired and are subject to a technical recommendation against renewal. Through the Instituto Costarricense de Acueductos y Alcantarillados, the Asociación Administradora de los Sistemas de Acueductos y Alcantarillados Comunales involved in the matter applied in 2008 to use several sources, some of which coincided with those held under concession by the Sociedad de Usuarios de Agua de las Ventanas de Carrillo.
The reports submitted by the respondents and the documentation they provided show that an initial difficulty in resolving the interested parties’ positions was the lack of clarity regarding the locations, names, and flow rates of the sources. The first two items were clarified through fieldwork conducted on 6 y 7 de octubre de 2010, during which all the sources involved were surveyed. The work was guided by officials from the Dirección de Acueductos Comunales del Instituto Costarricense de Acueductos y Alcantarillados and the Dirección de Aguas del Ministerio del Ambiente, Energía y Telecomunicaciones, with the participation of representatives of the ASADA de Santo Domingo and the aforementioned corporation. The results were set out in technical report AT-1335-2010, which also documented a consensus among all parties regarding the names and locations of sixteen water sources sought by the ASADA Santo Domingo de Sámara in expediente 601R and those sought by Ventanas del Mar in expedientes 8678A y 8780A.
Because the proceedings included sources in common, it was further agreed that the ASADA de Santo Domingo would officially manage the sources necessary to meet the needs of all users—including the Sociedad de Usuarios de Agua de las Ventanas de Carrillo—in a rational and efficient manner.
VII.It can therefore be seen that the administrative regulation of water use appears to be moving toward a solution that gives priority to human consumption over other uses of that resource, given that there is a technical recommendation against renewing the concessions, which, in addition to the stated consumption, include recreational uses (swimming pools, artificial lake), and that it was agreed that the ASADA de Santo Domingo would be responsible for drawing water from and managing the sources. This order of priorities in the use of potable water derives not only from article 27 of the Ley de Aguas, but also from the fundamental right to water itself, recognized as such because it is instrumental to human health and life. However, the reported agreements have not yet resulted in formal administrative decisions. The Head of the Dirección de Aguas explains that studies characterizing the sources and applicants’ needs must be completed, the flow rate must be gauged during the dry season, and it must be determined whether the ASADA de Santo Domingo is capable of supplying the Las Ventanas del Mar development.
Considering that, since 1999, the Ministerio del Ambiente (Área de Conservación Tempisque) had been informed of residents’ objections to using water from the area to supply an artificial lake—because they believed that it caused shortages during the dry season—that such use was confirmed that year, and that a formal complaint was filed in julio del 2009 with both the aforementioned Ministry and the Instituto Costarricense de Acueductos y Alcantarillados, the Chamber finds that the response of the respondent authorities, particularly the Dirección de Aguas del MINAET, has not been consistent with their duty to protect the environment and the right to water.
VIII.For the foregoing reasons, the amparo proceeding (amparo) must be granted against the respondents, ordering the Head of the Dirección de Aguas del MINAET and the Executive President of the Instituto Costarricense de Acueductos y Alcantarillados to arrange and coordinate the actions necessary to ensure that the outstanding studies deemed indispensable are completed within the two months following notification of this judgment and, once those studies have been completed, if their results are positive, that the disputed sources be allocated with due respect and priority given to the right of the area’s inhabitants to receive a permanent and sufficient potable-water service throughout the year, including the dry season.
IX.Furthermore, regarding the alleged violation of the right to prompt administrative justice, it was established that on 29 de julio de 2009 the petitioner filed a complaint concerning water management in the area with the Departamento de Aguas, the Presidencia Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados, and the Oficina Regional de Nicoya del Área de Conservación Tempsique, and that none of the three authorities has yet responded. The Director de Aguas justifies the omission on the ground that he is waiting for the ASADA de Sámara to indicate who will be responsible for supplying potable water to the Las Ventanas development, while the Executive President of the respondent Institute states that the matter was referred to the UEN de Acueductos Rurales. Under the right of every person subject to public administration, derived from article 41 of the Constitution, to have claims brought before public authorities decided diligently and expeditiously, so that the decision addresses the issues raised and the person is notified of the determination within a reasonable period, the authorities failed to provide such a response or, more generally, to inform the interested party of the status of the proceedings or the difficulties affecting them for a year and a half.
That period is unreasonable and therefore contrary to the stated right. Accordingly, the amparo must also be granted with respect to this issue, and the respondents must be ordered to inform the petitioner immediately of the status of his application and expressly answer it once the allocation addressed in this case has been determined.

The appeal is granted. José Miguel Zeledón Calderón, Head of the Dirección de Aguas del Ministerio del Ambiente, Energía y Telecomunicaciones, and Oscar Núñez Calvo, Executive President of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds those offices, are ordered to arrange and coordinate the actions necessary to ensure that the indispensable studies which they state remain outstanding in this case are completed within the two months following notification of this judgment and, once completed, if their results are positive, that the sources be allocated with due respect and priority given to the right of the area’s inhabitants to receive a permanent and sufficient potable-water service throughout the year, including the dry season. The aforementioned officials and Nelson Marín Mora, Acting Director of the Área de Conservación Tempisque, or whoever holds that office, are further ordered to inform the petitioner immediately of the status of his application, filed on 20 de julio de 2009 with the Área de Conservación Tempisque and on 29 de julio de 2009 with the Presidencia Ejecutiva del A y A and the Departamento de Aguas, and to answer it expressly once the allocation of water addressed in this case has been determined.
The State and the Instituto Costarricense de Acueductos y Alcantarillados are ordered to pay the legal costs, damages, and losses caused, the amounts of which shall be determined in enforcement proceedings before the administrative-litigation jurisdiction (jurisdicción de lo contencioso administrativo). The aforementioned officials are advised that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that the person must comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not punishable by a more severe penalty. This decision shall be served personally on the respondents.

Recurso de amparo interpuesto por Carlos Esquivel Esquivel, mayor, portador de la cédula de identidad número 1-272-278, en su condición de Presidente de la Asociación Administradora del Acueducto de Sámara, contra el Ministro del Ambiente, Energía y Telecomunicaciones, el Jefe del Departamento de Aguas de ese Ministerio, el Director del Área de Conservación Tempisque, Sede Nicoya, y el Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados.
Resultando:
Redacta el Magistrado Armijo Sancho; y,
Considerando:
I.Objeto del recurso. Considera al actor que es contrario al derecho a un medio ambiente sano y ecológicamente equilibrado, así como al derecho de acceso al agua, la construcción de un lago artificial en Santo Domingo de Sámara, para cuyo abastecimiento se emplean dieciséis nacientes de agua, con el consecuente perjuicio para el aprovisionamiento de agua potable de los habitantes del lugar.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
III.Sobre el fondo. Antes de la reforma del artículo 50 de la Constitución Política, la jurisprudencia de la Sala había reconocido la protección y preservación del medio ambiente como un derecho fundamental (sentencia #2233-93), al derivarlo de los artículos 21 (derecho a la salud), 69 (exigencia constitucional a la “explotación racional de la tierra”) y 89 (protección de las bellezas naturales), todos de la Constitución. El artículo 50 fue reformado mediante Ley #7412, de 3 de junio de 1994, con el objetivo de expresar la obligación del Estado de proteger el ambiente y otorgar a los ciudadanos plena acción para defenderlo, dando así contenido explícito al derecho fundamental a un ambiente sano y ecológicamente equilibrado. Dice, en este sentido, su párrafo tercero que "El Estado garantizará, defenderá y preservará ese derecho". La protección del ambiente hace necesaria la intervención de los poderes públicos sobre los factores que pueden alterar su equilibrio y obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano.
La protección al ambiente debe encaminarse a la utilización adecuada e inteligente de sus elementos en sus relaciones naturales, socioculturales, tecnológicas y de orden político (desarrollo sostenible), para con ello salvaguardar el patrimonio al que tienen derecho las generaciones presentes y futuras. Por ello, el objetivo primordial del uso y protección del ambiente es que a través de la producción y uso de la tecnología, se obtengan no solo ganancias económicas (libertad de empresa) sino un desarrollo y evolución favorable del ambiente y los recursos naturales con el ser humano, esto es, sin que se cause daño o perjuicio (sentencia #2006-11470 de las 16:30 horas del 8 de agosto de 2006). Existe, además, una obligación para el Estado –como un todo– de tomar las medidas necesarias para proteger el ambiente, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan el peligro la salud de los administrados.
Las omisiones al deber de protección del ambiente y de cumplimiento de la normativa ambiental son de relevancia constitucional, pues debido a la inercia de la Administración, en esta materia, se puede producir daños irreversibles.
IV.El derecho al agua potable, a su vez, se deriva de los derechos fundamentales a la salud, la vida, al medio ambiente sano, a la alimentación y la vivienda digna, entre otros, tal como ha sido reconocido en instrumentos internacionales sobre Derechos Humanos aplicables en Costa Rica: figura explícitamente en la Convención sobre la Eliminación de todas las formas de discriminación contra la mujer (art. 14) y la Convención sobre los Derechos del Niño (art. 24); además, se enuncia en la Conferencia Internacional sobre Población y el Desarrollo de El Cairo (principio 2). En nuestro Sistema Interamericano de Derechos Humanos el país se encuentra particularmente obligado por lo dispuesto en el artículo 11.1 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos Económicos, Sociales y Culturales ("Protocolo de San Salvador" de 1988), el cual dispone que:
“Artículo 11. Derecho a un medio ambiente sano 1. Toda persona tiene derecho a vivir en un medio ambiente sano y a contar con servicios públicos básicos”.
Además, el Comité de Derechos Económicos, Culturales y Sociales de la ONU reiteró que disponer de agua es un derecho humano que, además de ser imprescindible para llevar una vida saludable, es un requisito para la realización de todos los demás derechos humanos (v. las sentencias de la Sala #4654-2003 de las 15:44 horas del 27 de mayo de 2003, #2755-2000 de las 10:48 horas del 24 de marzo de 2000, #9629-2002 de las 11:09 horas del 4 de octubre de 2002 y #2009-10678 de las 15:11 horas del 7 de julio del 2009).
V.Además de realizar esfuerzos serios para brindar el servicio a la población, existe el deber de las instituciones públicas de hacer un uso responsable y comedido del recurso hídrico disponible, lo cual implica tener certeza del agua susceptible de explotación –disponibilidad–, garantizando su otorgamiento presente y la futura sostenibilidad del servicio, evitando que con la utilización actual del recurso se produzca un riesgo ambiental que comprometa la existencia y dotación futura del líquido. La Sala ha tenido oportunidad de pronunciarse de manera contundente y detallada sobre la protección que debe otorgarse al recurso hídrico nacional, clarificando tanto el marco normativo de protección, como las instituciones que conforman el sector hídrico, reconociendo y precisando el ámbito de competencias de dichas instancias y la trascendencia de sus actuaciones en materia de otorgamiento, aprovechamiento y protección del agua (sentencia #2009-262 de las 14:30 horas del 14 de enero de 2009. V. en el mismo sentido las resoluciones #2004-1923 de las 14:55 horas del 25 de febrero de 2004; #2008-14092 de las 9:28 horas del 23 de setiembre y #2008-15657 de las 11:45 horas del 17 de octubre, las dos de 2008).
VI.En el caso que plantea el recurrente aparecen compitiendo por recursos hídricos la sociedad propietaria de un proyecto habitacional de connotación turística y la ASADA de Santo Domingo de Sámara, responsable del suministro de agua potable en esa población. La Sociedad de Usuarios de Agua de las Ventanas de Carrillo obtuvo la captación de varias fuentes del lugar, al amparo de dos concesiones de aprovechamiento de aguas superficiales conferidas por el Departamento de Aguas del Ministerio del Ambiente, Energía y Telecomunicaciones de 1999 y 2000, ambas vencidas ya a esta fecha y con recomendación técnica de no renovación. A través del Instituto Costarricense de Acueductos y Alcantarillados, la Asociación Administradora de los Sistemas de Acueductos y Alcantarillados Comunales involucrada, requirió, en el 2008, aprovechamiento de varias fuentes que coincidían con algunas de las que tenía bajo concesión la Sociedad de Usuarios de Agua de las Ventanas de Carrillo.
De los informes de los accionados y la documentación que aportan se aprecia que una primera dificultad para dirimir las posiciones de los interesados era la falta de claridad sobre la ubicación de las fuentes, sus nombres y caudal. Los dos primeros datos indicados fueron depurados en el trabajo de campo efectuado el 6 y 7 de octubre de 2010, en el cual se efectuó un levantamiento de todas las fuentes involucradas. El trabajo fue guiado por personeros de la Dirección de Acueductos Comunales del Instituto Costarricense de Acueductos y Alcantarillados y de la Dirección de Aguas del Ministerio del Ambiente, Energía y Telecomunicaciones, con participación de representantes de la ASADA de Santo Domingo y de la sociedad anónima mencionada. Los resultados del trabajo fueron plasmados en el informe técnico AT-1335-2010, dando cuenta, además, de un consenso de todas las partes sobre el nombre y ubicación de dieciséis fuentes de agua, solicitadas por la ASADA Santo Domingo de Sámara en el expediente 601R y las solicitadas por Ventanas del Mar en los acordó, además, que la ASADA de Santo Domingo administrará oficialmente las fuentes necesarias para satisfacer las necesidades de todos los usuarios –incluida la Sociedad de Usuarios de Agua de las Ventanas de Carrillo–, de forma racional y eficiente.
VII.Puede verse, entonces, como la actividad administrativa reguladora del uso del agua parece encaminarse a una solución en la que se prioriza el consumo humano a otros usos de ese bien, al existir una recomendación técnica de no renovar las concesiones que tienen, además del consumo indicado, destinos recreativos (piscinas, lago artificial) y haberse acordado que la ASADA de Santo Domingo se encargaría de captar las fuentes y administrarlas. Tal orden de prioridades en el uso del agua potable no solo se deriva del artículo 27 de la Ley de Aguas, sino del propio derecho fundamental al agua, reconocido como tal por su carácter instrumental para la salud y vida de las personas. Sin embargo, los acuerdos que se informan no han dado lugar aún a decisiones administrativas formales. Explica el Jefe de la Dirección de Aguas que deben completarse estudios de caracterización de las fuentes, de las necesidades de los solicitantes, efectuar el aforo del caudal en época seca y determinarse si la ASADA de Santo Domingo se encuentra en capacidad de abastecer el proyecto Las Ventanas del Mar.
Si se toma en consideración que desde 1999 se había advertido en instancias del Ministerio del Ambiente (Área de Conservación Tempisque) la disconformidad de los vecinos con el uso de agua de la zona para alimentar un lago artificial –por considerar que les causaba desabastecimiento en época seca–, que ese uso se corroboró en ese año, y que en julio del 2009 se planteó una denuncia formal, tanto ante el Ministerio mencionado, como ante el Instituto Costarricense de Acueductos y Alcantarillados, a juicio de la Sala la reacción de las instancias recurridas, en especial de la Dirección de Aguas del MINAET, no ha sido consecuente con su obligación de protección del ambiente y del derecho al agua.
VIII.Por las anteriores razones, el amparo debe estimarse contra los accionados, ordenando al Jefe de la Dirección de Aguas del MINAET y al Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados disponer y coordinar las acciones necesarias para que los estudios que falta realizar y resulten indispensables se concluyan en los dos meses siguientes a la notificación de esta sentencia y, concluidos esos estudios, en caso que resulten positivos, se adjudiquen las fuentes en disputa, con respeto y prelación del derecho de los habitantes de la zona a contar con servicio de agua potable, permanente y suficiente, durante todo el año, incluida la época seca.
IX.Además, sobre la aducida infracción al derecho a la justicia administrativa pronta, se tuvo por comprobado que el actor presentó una denuncia sobre el manejo de aguas en la zona, el 29 de julio de 2009, ante el Departamento de Aguas, la Presidencia Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados y la Oficina Regional de Nicoya del Área de Conservación Tempsique, sin que ninguna de las tres instancias le contestara aún. El Director de Aguas justifica la omisión en que espera a que la ASADA de Sámara le indique quién se encargará de suministrar agua potable al proyecto Las Ventanas y el Presidente Ejecutivo del Instituto accionado dice que la gestión se trasladó a la UEN de Acueductos Rurales. Desde el punto de vista del derecho de todo administrado, derivado del artículo 41 constitucional, de que se decida con diligencia y celeridad los reclamos planteados ante las administraciones públicas, de tal manera que la resolución sea congruente con los extremos alegados, y se le comunique lo dispuesto, dentro de un plazo razonable, se ha omitido dar esa respuesta y, en general, informar del trámite o sus dificultades al interesado, por espacio de año y medio.
Ese lapso resulta irrazonable y, por ello, contrario al derecho señalado, de forma que también corresponde estimar el amparo en lo relacionado con este extremo, ordenándose a los recurridos, informar al actor, de inmediato, del estado de su gestión y contestarla expresamente una vez que se defina la adjudicación a la que se refiere este caso.
Por tanto:
Se declara con lugar el recurso. Se ordena a José Miguel Zeledón Calderón, Jefe de la Dirección de Aguas del Ministerio del Ambiente, Energía y Telecomunicaciones, y a Oscar Núñez Calvo, Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes ocupen esos cargos, disponer y coordinar las acciones necesarias para que los estudios indispensables que dicen falta realizar en este caso se concluyan en los dos meses siguientes a la notificación de esta sentencia y, concluídos, en caso de que resulten positivos, se adjudiquen, con respeto y prelación del derecho de los habitantes de la zona a contar con servicio de agua potable, permanente y suficiente, durante todo el año, incluida la época seca. Además se ordena a los funcionarios mencionados y a Nelson Marín Mora, Director a.i. del Área de Conservación Tempisque, o a quien ocupe ese puesto, informar al actor, de inmediato, del estado de su gestión, presentada el 20 de julio de 2009 en el Área de Conservación Tempisque y en la Presidencia Ejecutiva del A y A y el Departamento de Aguas el 29 de julio de 2009, y contestarla, refiere este caso.
Se condena al Estado y al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios ocasionados, los cuales se liquidarán en ejecución de sentencia de lo contencioso administrativo. Se advierte a los funcionarios dichos que, de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Notifíquese a los recurridos la presente resolución en forma personal.
